A BILL
To amend the Consolidated Farm and Rural Development Act to prohibit the
Secretary of Agriculture from making or enforcing any rule requiring all
borrowers under such Act to demonstrate a positive cash flow, without taking
into account the individual characteristics of borrowers.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. PROHIBITION AGAINST RULES IMPOSING UNIFORM REQUIREMENT OF POSITIVE
CASH FLOW.
  Section 339 of the Consolidated Farm and Rural Development Act (7
  U.S.C. 1989) is amended--
  (1) by inserting `(a) IN GENERAL- ' before `The Secretary is authorized'; and
  (2) by adding at the end the following:
  `(b) PROHIBITION AGAINST RULES IMPOSING UNIFORM REQUIREMENT OF POSITIVE
  CASH FLOW- The Secretary shall not make or enforce any rule under this
  section that requires all borrowers in a class, without exception based on
  the individual characteristics of the borrower, to demonstrate a positive
  cash flow.'.
