A BILL
To amend the Solid Waste Disposal Act to authorize the Environmental Protection
Agency to make technical assistance grants to certain groups to monitor,
investigate, or obtain information about releases of hazardous wastes at
storage, treatment, and disposal facilities.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. TECHNICAL ASSISTANCE GRANTS.
  (a) GRANTS- Section 7004 of the Solid Waste Disposal Act (42 U.S.C. 6974)
  is amended by adding at the end the following new subsection:
  `(c) GRANTS FOR TECHNICAL ASSISTANCE- (1) Subject to such amounts as are
  provided in appropriation Acts and in accordance with regulations promulgated
  by the Administrator, the Administrator may make grants available to any
  group of individuals which may be affected by a release of hazardous waste
  or constituents of such waste from any solid waste management unit at a
  treatment, storage, or disposal facility seeking a permit under section
  3005 or for which a permit has been issued under such section. Such grants
  may be used to obtain technical assistance for any of the following purposes:
  `(A) To interpret information with regard to the nature of the release.
  `(B) To investigate the release or to monitor an owner or operator of a
  facility in investigating the release.
  `(C) To make recommendations to the Administrator on the selection of
  corrective action measures to be taken at the facility.
  `(2) The amount of any grant under this subsection may not exceed $50,000
  for a single grant recipient. The Administrator may waive the $50,000
  limitation in any case in which such waiver is necessary to carry out the
  purposes of this subsection. Each grant recipient shall be required, as
  a condition of the grant, to contribute at least 20 percent of the total
  of costs of the technical assistance for which such grant is made. The
  Administrator may waive the 20 percent contribution requirement if the
  grant recipient demonstrates financial need and such waiver is necessary to
  facilitate public participation in the selection of corrective action at the
  facility. Not more than one grant may be made under this subsection with
  respect to a single facility, but the grant may be renewed to facilitate
  public participation at all stages of corrective action (including the
  period before a corrective action permit is granted and the period during
  which corrective action is being carried out).'
  (b) FUNDING- (1) Subject to paragraph (2), during fiscal year 1990 the
  Administrator of the Environmental Protection Agency shall pay for grants
  awarded pursuant to section 7004(c) of the Solid Waste Disposal Act (as
  added by subsection (a)) out of funds appropriated to the Administrator,
  before or after the date of the enactment of this Act, for fiscal year 1990.
  (2) The Administrator of the Environmental Protection Agency may not
  pay more than $2,000,000 for grants awarded pursuant to section 7004(c)
  of such Act during fiscal year 1990.
