producers in determining prevented planting credit.

A BILL
To amend the Disaster Assistance Act of 1989 to allow the Secretary of
Agriculture to take into account the verified planting intentions of soybean
producers in determining prevented planting credit.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. PREVENTED PLANTING CREDIT.
  (a) MAXIMUM ACREAGE- Section 104(b)(2) of the Disaster Assistance Act of
  1989 is amended by striking `Such' and by inserting `Except as provided
  in paragraph 3, such'.
  (b) ADJUSTMENTS- Section 104(b)(3) of the Disaster Assistance Act of 1989
  is amended to read as follows:
  `(3) ADJUSTMENTS- The Secretary shall make appropriate adjustments in
  applying the limitations contained in paragraph (2) to take into account the
  crop rotation practices of the producers or the verified planting intentions
  of the producers of soybeans for 1989. The Secretary shall consider the
  planting intentions of the producers of soybeans only if the producers
  provide one of the following: (A) a copy of documentation verifying to
  the satisfaction of the Secretary or his designee that (i) the producer
  had received loan approval and that (ii) loan funds were disbursed to the
  producer for the 1989 crop intended to be produced, (B) verification to
  the satisfaction of the Secretary or his designee that an application for
  disaster credit was filed with the local Agricultural Stabilization and
  Conservation Service office for the 1989 crop intended to be produced,
  or (C) a copy of a forward contract verifying to the satisfaction of the
  Secretary or his designee that the producer had contracted to sell the
  crop that was intended to be produced in 1989.'.
