A BILL
To amend the Atomic Energy Act of 1954 to provide for the consideration of
off-site emergency planning and preparedness issues prior to the construction
of nuclear powerplants, and for other purposes.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. SHORT TITLE.
  This Act may be cited as the `Nuclear Emergency Planning and Preparedness
  Improvement Act of 1990'.
SEC. 2. EMERGENCY PLANNING AND PREPAREDNESS REQUIREMENTS FOR PERMITS AND
LICENSES.
  Chapter 16 of the Atomic Energy Act of 1954 (42 U.S.C. 2231 et seq.) is
  amended by adding at the end the following new section:
  `SEC. 193. EMERGENCY PLANNING AND PREPAREDNESS REQUIREMENTS-
  `The Nuclear Regulatory Commission (hereafter in this section referred
  to as the `Commission') may not issue a construction permit, operating
  license, early site permit, or combined license unless the Commission first
  determines, in consultation with the Federal Emergency Management Agency,
  that the applicant for such permit or license has complied with all emergency
  planning and preparedness requirements applicable to such permit or license
  established by the Commission by rule, as in effect on June 1, 1989.'.
SEC. 3. DEFINITIONS.
  Section 11 of the Atomic Energy Act of 1954 (42 U.S.C. 2014) is amended
  by adding at the end the following new subsections:
  `kk. COMBINED LICENSE- As used in section 193, `combined license' means
  a combined construction permit and operating license issued pursuant to
  subpart C of part 52 of title 10, Code of Federal Regulations, as in effect
  on June 1, 1989.
  `ll. EARLY SITE PERMIT- As used in section 193, `early site permit' means a
  Nuclear Regulatory Commission approval, issued pursuant to subpart A of part
  52 of title 10, Code of Federal Regulations, as in effect on June 1, 1989.'.
