A BILL
To amend the Elementary and Secondary Education Act of 1965 to provide
additional grants to schools eligible for grants under chapter 1 of title
I of such Act that require students to maintain satisfactory grades as a
condition of participation in extracurricular activities.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. SHORT TITLE.
  This Act may be cited as the `Student Incentive Act of 1990'.
SEC. 2. BONUS GRANTS FOR SCHOOLS THAT REQUIRE SATISFACTORY GRADES FOR
PARTICIPATION IN EXTRACURRICULAR ACTIVITIES.
  Subpart 1 of part A of chapter 1 of title I of the Elementary and Secondary
  Education Act of 1965 is amended by adding at the end the following new
  section:
`SEC. 1007. BONUS GRANTS FOR SCHOOLS THAT REQUIRE SATISFACTORY GRADES FOR
PARTICIPATION IN EXTRACURRICULAR ACTIVITIES.
  `(a) PROGRAM AUTHORIZED- The Secretary shall make grants to eligible
  States for purposes of making grants to local educational agencies that
  impose a satisfactory grade requirement on the public secondary schools
  under their jurisdiction.
  `(b) ELIGIBLE STATES- In order to be eligible for a grant under this section,
  a State shall--
  `(1) certify to the Secretary that the State, by regulation, either--
  `(A) has established a satisfactory grade requirement for all local
  educational agencies in the State; or
  `(B) encourages each local educational agency in the State to establish
  a satisfactory grade requirement; and
  `(2) submit to the Secretary for approval--
  `(A) a description of the regulation described in paragraph (1); and
  `(B) a definition of the term `core curriculum'.
  `(c) DETERMINATION OF GRANT AMOUNTS- The amount which a local educational
  agency in a State is eligible to receive under this section for a fiscal
  year shall be an amount equal to 10 percent of the amount determined for
  such local educational agency under section 1005.
  `(d) GRANTS TO LOCAL EDUCATIONAL AGENCIES-
  `(1) Each State that receives a grant under this section shall use
  amounts provided under such grant for the purpose of making grants to
  local educational agencies in the State that--
  `(A) are eligible for assistance under this chapter; and
  `(B) in the case of any State that has not established a satisfactory
  grade requirement for all local educational agencies in the State, have
  established a satisfactory grade requirement.
  `(2) Each local educational agency that receives a grant under this
  subsection shall use amounts provided under such grant for the purposes
  described in section 1011(a), except that such local educational agency
  shall give priority for services provided under such section to students
  who are denied eligibility for participation in extracurricular activities
  because they fail to fulfill the satisfactory grade requirement.
  `(e) DEFINITIONS- For purposes of this section:
  `(1) The term `extracurricular activity' means any activity that does not
  promote, assist, or relate to a student's academic performance.
  `(2) The term `satisfactory grade requirement' means a requirement that
  in order to participate in extracurricular activities, students must
  earn a 2.0 grade point average on a 4 point scale (or its equivalent)
  in a core curriculum.
  `(f) AUTHORIZATION OF APPROPRIATIONS- There are authorized to be appropriated
  to carry out the provisions of this section $100,000,000 for each of the
  fiscal years 1991, 1992, and 1993.'.
