and to freeze the reduction in payments to hospitals for indirect costs

A BILL
To amend title XVIII of the Social Security Act to increase the amount
of payment for inpatient hospital services under the Medicare Program,
and to freeze the reduction in payments to hospitals for indirect costs
of medical education.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``American Hospital Preservation Act
of 2001''.
SEC. 2. RESTORING FULL MARKET BASKET UPDATE FOR INPATIENT PPS
HOSPITALS.
Section 1886(b)(3)(B)(i) of the Social Security Act (42 U.S.C.
1395ww(b)(3)(B)(i)), as amended by section 301(a) of BIPA (114 Stat.
2763A-491), is amended--
(1) in subclause (XV), by adding ``and'' at the end;
(2) in subclause (XVI)--
(A) by inserting ``and each subsequent fiscal
year'' after ``for fiscal year 2001''; and
(B) by striking ``; and'' and inserting a period;
and
(3) by striking subclauses (XVII), (XVIII), and (XIX).
SEC. 3. FREEZING INDIRECT MEDICAL EDUCATION (IME) ADJUSTMENT PERCENTAGE
AT 6.5 PERCENT.
(a) In General.--Section 1886(d)(5)(B)(ii) of the Social Security
Act (42 U.S.C. 1395ww(d)(5)(B)(ii)), as amended by section 302(a) of
BIPA (114 Stat. 2763A-493), is amended--
(1) in subclause (V), by adding ``and'' at the end; and
(2) by striking subclauses (VI) and (VII) and inserting the
following:
``(VI) on or after October 1, 2001,
`c' is equal to 1.6.''.
(b) Conforming Amendment Relating to Determination of Standardized
Amount.--Section 1886(d)(2)(C)(i) of the Social Security Act (42 U.S.C.
1395ww(d)(2)(C)(i)), as amended by section 302(c) of BIPA (114 Stat.
2763A-493), is amended--
(1) by striking ``1999 or'' and inserting ``1999,''; and
(2) by inserting ``, or the American Hospital Preservation
Act of 2001'' after ``2000''.
SEC. 4. REFERENCES TO BIPA.
In this Act, the term ``BIPA'' means the Medicare, Medicaid, and
SCHIP Benefits Improvement and Protection Act of 2000 (Appendix F, 114
Stat. 2763A-463), as enacted into law by section 1(a)(6) of Public Law
106-554.
