		appropriations</header>
						<subsection id="id0a926f6a-fe2e-4d21-83e7-4c6f11bb40f8"><enum>(a)</enum><header>Fiscal year
		2013</header><text>Funds are authorized to be appropriated for fiscal year 2013
		for necessary expenses of the Coast Guard as follows:</text>
							<paragraph id="id65917b62-ec3b-48a6-8d24-d3bf0b9cdc74"><enum>(1)</enum><text>For the operation and
		maintenance of the Coast Guard, $7,077,783,000 of which $24,500,000 is
		authorized to be derived from the Oil Spill Liability Trust Fund to carry out
		the purposes of section 1012(a)(5) of the Oil Pollution Act of 1990 (33 U.S.C.
		2712(a)(5)).</text>
							</paragraph><paragraph id="ida562b0dd-febe-4bed-84de-9fa4d6962388"><enum>(2)</enum><text>For the acquisition,
		construction, rebuilding, renovation, and improvement of aids to navigation,
		shore and offshore facilities, vessels, and aircraft, including equipment
		related thereto, $1,421,924,000 of which—</text>
								<subparagraph id="id25f40a03-951b-4dc6-b478-6781a77c7233"><enum>(A)</enum><text>$20,000,000 shall be
		derived from the Oil Spill Liability Trust Fund to carry out the purposes of
		section 1012(a)(5) of the Oil Pollution Act of 1990 (33 U.S.C. 2712(a)(5)), to
		remain available until expended;</text>
								</subparagraph><subparagraph id="idea9a2986-6964-41d3-b0cb-625e196ff25f"><enum>(B)</enum><text>$642,000,000 is
		authorized to acquire, effect major repairs to, renovate, or improve vessels,
		small boats, and related equipment;</text>
								</subparagraph><subparagraph id="idd84c2672-e59a-4549-8239-32b3c9075d0d"><enum>(C)</enum><text>$289,000,000 is
		authorized to acquire, effect major repairs to, renovate, or improve aircraft
		or increase aviation capability;</text>
								</subparagraph><subparagraph id="id6bd81ccb-35fc-4c6e-9033-43c576126845"><enum>(D)</enum><text>$166,140,000 is
		authorized for other equipment;</text>
								</subparagraph><subparagraph id="id5aacbcd8-1662-474c-bc8c-17cd2670b58b"><enum>(E)</enum><text>$213,692,000 is
		authorized for shore facilities, aids to navigation facilities, and military
		housing, of which not more than $14,000,000 shall be derived from the Coast
		Guard Housing Fund; and</text>
								</subparagraph><subparagraph id="idf7ea50a0-ebfb-4009-8dd7-f71a57c1c111"><enum>(F)</enum><text>$110,192,000 is
		authorized for personnel compensation and benefits and related costs.</text>
								</subparagraph></paragraph><paragraph id="id3d0d3622-9777-4386-bd70-3f6aef36f7a6"><enum>(3)</enum><text>For research,
		development, testing, and evaluation of technologies, materials, and human
		factors directly related to improving the performance of the Coast Guard's
		mission in search and rescue, aids to navigation, marine safety, marine
		environmental protection, enforcement of laws and treaties, ice operations,
		oceanographic research, and defense readiness, $19,779,000.</text>
							</paragraph><paragraph id="id3eb8f646-704c-4338-88ab-855c327dc78c"><enum>(4)</enum><text>For retired pay
		(including the payment of obligations otherwise chargeable to lapsed
		appropriations for this purpose), payments under the Retired Serviceman's
		Family Protection and Survivor Benefit Plans, and payments for medical and
		dental care of retired personnel and their dependents under chapter 55 of title
		10, United States Code, $1,440,157,000, to remain available until
		expended.</text>
							</paragraph><paragraph id="ideff6d09b-ddf8-41d0-b249-0df171b5b292"><enum>(5)</enum><text>For alteration or removal
		of bridges over navigable waters of the United States constituting obstructions
		to navigation, and for personnel and administrative costs associated with the
		Alteration of Bridges Program, $16,000,000.</text>
							</paragraph><paragraph id="id7be925a7-0a3d-4f9e-9d03-1636d4ca3420"><enum>(6)</enum><text>For environmental
		compliance and restoration functions under chapter 19 of title 14, United
		States Code, $16,699,000.</text>
							</paragraph><paragraph id="id9d9397b9-3393-49c5-b4ee-493c6bd0eb45"><enum>(7)</enum><text>For operation and
		maintenance of the Coast Guard Reserve program, $136,778,000.</text>

		2014</header><text>Funds are authorized to be appropriated for fiscal year 2014
		for necessary expenses of the Coast Guard as follows:</text>

		2013</header>
							<paragraph id="id78b051cb-4bba-4a39-81b1-d8c6addeffd7"><enum>(1)</enum><header>Active duty
		strength</header><text>The Coast Guard is authorized an end-of-year strength
		for active duty personnel of 47,000 for the fiscal year ending on September 30,
		2013.</text>
							</paragraph><paragraph id="idd9fb7ed0-2ced-4e7c-9f3f-b1b8b934e507"><enum>(2)</enum><header>Military training
		student loads</header><text>For fiscal year 2013, the Coast Guard is authorized
		average military training student loads as follows:</text>
								<subparagraph id="id633a1454-0db3-435e-809e-5dc49a05bb33"><enum>(A)</enum><text>For recruit and special
		training, 2,500 student years.</text>
								</subparagraph><subparagraph id="id5a40d107-0c3a-4d36-a398-6f4adaf9e2cc"><enum>(B)</enum><text>For flight training, 165
		student years.</text>
								</subparagraph><subparagraph id="id136572a9-e6e1-41af-83c9-76e0a85448f7"><enum>(C)</enum><text>For professional training
		in military and civilian institutions, 350 student years.</text>
								</subparagraph><subparagraph id="id390f9674-c1ca-4cf4-8465-a8303cc80012"><enum>(D)</enum><text>For officer acquisition,
		1,200 student years.</text>

		student loads</header><text>For fiscal year 2014, the Coast Guard is authorized
		average military training student loads as follows:</text>

					<section id="id7e02a904-3934-4382-96f8-baea3acb5443"><enum>201.</enum><header>Coast Guard authority
		to operate and maintain Coast Guard assets</header>
						<subsection id="id7e9b6abb-d074-416e-bb5b-05a27eecb9b8"><enum>(a)</enum><header>In
		general</header><text>Section 93 of title 14, United States Code, is amended by
		adding at the end the following:</text>

								<subsection id="id4a1c3ca7-9b55-4c23-8106-cf34cb07c32b"><enum>(e)</enum><header>Operation and
		  maintenance of Coast Guard assets and facilities</header><text>All authority,
		  including programmatic budget authority, for the operation and maintenance of
		  Coast Guard vessels, aircraft, systems, aids to navigation, infrastructure, and
		  any other Coast Guard assets or facilities, shall be allocated to and vested in
		  the Coast Guard and the department in which the Coast Guard is
		  operating.</text>

						</subsection></section><section id="idd3019c21-264e-4067-97b2-06f6ab0284f9"><enum>202.</enum><header>Clarification of Coast
		Guard ice operations mission</header>
						<subsection id="id135d9185-db23-482f-b68e-b20175f01886"><enum>(a)</enum><header>Coast guard provision
		of Federal icebreaking services</header><text display-inline="yes-display-inline">Chapter 5 of title 14, United States Code,
		is amended by inserting after section 86 the following:</text>

								<section id="idd475e743-9a25-4c5d-9f5a-d9a5146fb4ef"><enum>87.</enum><header>Provision of
		  icebreaking services</header>
									<subsection id="ide9a45ebc-013c-46be-8a31-3f2accf320dc"><enum>(a)</enum><header>In
		  general</header><text>Notwithstanding any other provision of law, except as
		  provided in subsection (b), the Coast Guard shall be the sole supplier of
		  icebreaking services, on an advancement or reimbursable basis, to each Federal
		  agency that requires icebreaking services.</text>

		is amended by adding at the end the following:</text>

		  policy</header><text>The Commandant shall direct the Superintendent of the
		  Coast Guard Academy to prescribe a policy on sexual harassment and sexual
		  violence applicable to the cadets and other personnel of the Coast Guard
		  Academy.</text>
									</subsection><subsection id="id148d6144-4cef-4a48-a600-ca8a0a54e708"><enum>(b)</enum><header>Matters to be specified
		  in policy</header><text>The policy on sexual harassment and sexual violence
		  under this section shall include specification of the following:</text>
										<paragraph id="idb5c867d0-67d4-4ccc-ab85-cbe9146390b3"><enum>(1)</enum><text>Programs to promote
		  awareness of the incidence of rape, acquaintance rape, and other sexual
		  offenses of a criminal nature that involve cadets or other Academy
		  personnel.</text>
										</paragraph><paragraph id="id99B67D98805D4E47994D4DBC80EF05E1"><enum>(2)</enum><text>Information about how the
		  Coast Guard and the Academy will protect the confidentiality of victims,
		  including how any records, statistics, or reports intended for public release
		  will be formatted such that the confidentiality of victims is not
		  jeopardized.</text>
										</paragraph><paragraph id="id672b02d1-5a8e-42ce-82c7-ed6b11b29b00"><enum>(3)</enum><text>Procedures that a cadet
		  or other Academy personnel should follow in the case of an occurrence of sexual
		  harassment or sexual violence, including—</text>
											<subparagraph id="id1c998a29-57cb-4eb0-baf5-d6d51787c018"><enum>(A)</enum><text>if the cadet or other
		  Academy personnel chooses to report an occurrence of sexual harassment or
		  sexual violence, a specification of the person or persons to whom the alleged
		  offense should be reported and options for confidential reporting, including
		  written information to be given to victims which explains how the Coast Guard
		  and the Academy will protect the confidentiality of victims;</text>
											</subparagraph><subparagraph id="idB5B145C403B840F3ADE71F768FCD3731"><enum>(B)</enum><text>a specification of any
		  other person whom the victim should contact; and</text>
											</subparagraph><subparagraph id="id4B0190C3649748018511D1817EC69CEF"><enum>(C)</enum><text>procedures on the
		  preservation of evidence potentially necessary for proof of criminal sexual
		  assault.</text>
											</subparagraph></paragraph><paragraph id="idccad53ba-dc34-49bd-a291-574c742fd8c0"><enum>(4)</enum><text>Procedures for
		  disciplinary action in cases of criminal sexual assault involving a cadet or
		  other Academy personnel.</text>
										</paragraph><paragraph id="id764529a0-cba0-4b2f-ab03-3fd567c8643a"><enum>(5)</enum><text>Any other sanction
		  authorized to be imposed in a substantiated case of sexual harassment or sexual
		  violence involving a cadet or other Academy personnel in rape, acquaintance
		  rape, or other criminal sexual offence, whether forcible or nonforcable.</text>
										</paragraph><paragraph id="id0559ceba-d4b7-40ab-a2e1-82485ae88334"><enum>(6)</enum><text>Required training on the
		  policy for all cadets and other Academy personnel who process allegations of
		  sexual harassment or sexual violence involving a cadet or other Academy
		  personnel.</text>
										</paragraph></subsection><subsection id="id9af67cf4-67c3-4a21-b10c-4fb896610adc"><enum>(c)</enum><header>Assessment</header>
										<paragraph id="idc59d5d70-4a16-43d4-9b6f-84992bbd9e53"><enum>(1)</enum><header>In
		  general</header><text>The Commandant shall direct the Superintendent to conduct
		  at the Academy during each Academy program year an assessment to determine the
		  effectiveness of the policies of the Academy with respect to sexual harassment
		  and sexual violence involving cadets and other Academy personnel.</text>
										</paragraph><paragraph id="ide8e019d6-f1ea-4ca8-81da-2f820472b443"><enum>(2)</enum><header>Biennial
		  survey</header><text>For the assessment at the Academy under paragraph (1) with
		  respect to an Academy program year that begins in an odd-numbered calendar
		  year, the Superintendent shall conduct a survey of cadets and other Academy
		  personnel—</text>
											<subparagraph id="id0a79c0c9-17c7-41b2-86b0-84dda564badf"><enum>(A)</enum><text>to measure—</text>
												<clause id="ide4ea64c4-49a8-43da-981a-456ebb32811f"><enum>(i)</enum><text>the incidence, during
		  that program year, of sexual harassment and sexual violence events, on or off
		  the Academy reservation, that have been reported to an official of the Academy;
		  and</text>
												</clause><clause id="id225b19f5-f513-4a56-a959-923dc4d2a997"><enum>(ii)</enum><text>the incidence, during
		  that program year, of sexual harassment and sexual violence, on or off the
		  Academy reservation, that have not been reported to an official of the Academy;
		  and</text>
												</clause></subparagraph><subparagraph id="id87f7a017-1def-4496-bf44-97c26363eb27"><enum>(B)</enum><text>to assess the perceptions
		  of the cadets and other Academy personnel of—</text>
												<clause id="idc4ad2d97-6e5c-4b41-a789-3b4d318c50f4"><enum>(i)</enum><text>the policies, training,
		  and procedures on sexual harassment and sexual violence involving cadets and
		  other Academy personnel;</text>
												</clause><clause id="id16803210-fab1-4a81-9008-cb3df7f74367"><enum>(ii)</enum><text>the enforcement of such
		  policies;</text>
												</clause><clause id="id0fea5538-0bc1-436a-b9ca-62d1c1db9c00"><enum>(iii)</enum><text>the incidence of sexual
		  harassment and sexual violence involving cadets and other Academy personnel;
		  and</text>
												</clause><clause id="idf8c1f892-4246-4dd0-8b1d-d698b02cd235"><enum>(iv)</enum><text>any other issues
		  relating to sexual harassment and sexual violence involving cadets and other
		  Academy personnel.</text>
												</clause></subparagraph></paragraph></subsection><subsection id="id61051e0a-5b81-4eef-91cd-0d1c3ab6d66a"><enum>(d)</enum><header>Report</header>
										<paragraph id="iddfe6be08-0ed3-4cf2-9c65-84739f2f1221"><enum>(1)</enum><header>In
		  general</header><text>The Commandant shall direct the Superintendent of the
		  Coast Guard Academy to submit to the Commandant a report on sexual harassment
		  and sexual violence involving cadets or other Academy personnel for each
		  Academy program year.</text>
										</paragraph><paragraph id="ida570eb3e-fe62-4877-96ce-a829249dfc37"><enum>(2)</enum><header>Report
		  specifications</header><text>Each report under paragraph (1) shall include, for
		  the Academy program year covered by the report, the following:</text>
											<subparagraph id="ida2bb2d98-9988-4211-a5bf-851127e0f218"><enum>(A)</enum><text>The number of sexual
		  assaults, rapes, and other sexual offenses involving cadets or other Academy
		  personnel that have been reported to Coast Guard Academy officials during the
		  Academy program year and, of those reported cases, the number that have been
		  substantiated.</text>
											</subparagraph><subparagraph id="id5c5d891b-1144-4b95-8ff0-588d6a2cec98"><enum>(B)</enum><text>A plan for the actions
		  that are to be taken in the following Academy program year regarding prevention
		  of and response to sexual harassment and sexual violence involving cadets or
		  other Academy personnel.</text>
											</subparagraph></paragraph><paragraph id="id5d68b0e5-70d0-47ab-9508-4e8dbed98691"><enum>(3)</enum><header>Biennial
		  survey</header><text>Each report under paragraph (1) for an Academy year that
		  begins in an odd-numbered calendar year shall include the results of the survey
		  conducted in that Academy program year under subsection (c)(2).</text>
										</paragraph><paragraph id="idb907739b-63ab-4843-8dd7-346ab3304045"><enum>(4)</enum><header>Transmission of
		  report</header><text>The Commandant shall transmit each report received by the
		  Commandant under this subsection, together with the Commandant's comments on
		  the report to—</text>
											<subparagraph id="idF66EF54F18264183956B080B0C9CBCBE"><enum>(A)</enum><text>the Committee on
		  Commerce, Science, and Transportation of the Senate; and</text>
											</subparagraph><subparagraph id="id70381F9FAAF3416F8866902E2EA841CE"><enum>(B)</enum><text>the Committee on
		  Transportation and Infrastructure of the House of Representatives.</text>
											</subparagraph></paragraph><paragraph id="id9312191C41804B29BC826451186A643C"><enum>(5)</enum><header>Focus groups</header>
											<subparagraph id="id82C967EA6E92411E8823ABA331388296"><enum>(A)</enum><header>In
		  general</header><text>In each even-numbered calendar year that the
		  Superintendent is not required to conduct a survey at the Academy under
		  subsection (c)(2), the Commandant shall require focus groups to be conducted at
		  the Academy for the purposes of ascertaining information relating to sexual
		  assault and sexual harassment issues at the Academy.</text>
											</subparagraph><subparagraph id="id0A54EFAAA3A144F0927685AF343B99F5"><enum>(B)</enum><header>Inclusion in
		  reports</header><text>Information derived from a focus group under subparagraph
		  (A) shall be included in the Commandant's report under this subsection.</text>
											</subparagraph></paragraph></subsection><subsection id="id542E47CE07284F248BF14B0456AD2A2C"><enum>(e)</enum><header>Victim
		  Confidentiality</header><text>To the extent that information collected under
		  authority of this section is reported or otherwise made available to the
		  public, such information shall be provided in a form that is consistent with
		  applicable privacy protections under Federal law and does not jeopardize the
		  confidentiality of
		  victims.</text>
									</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
						</subsection><subsection id="id86072FFB6CE94CFA9E82FAA4A6431982"><enum>(b)</enum><header>Conforming

		  101(a)(20) of the Immigration and Nationality Act (8 U.S.C.

		  motorboats, yachts, aircraft, or radio stations; or</text>

		  experience are deemed by the Commandant to be qualified for duty in the

					</section></title><title id="idfcfa675e-62f6-4719-b58e-4c3d7821f024"><enum>IV</enum><header>Administration</header>
					<section id="ide8057303-a879-439f-9bad-fd72f42e49f0"><enum>401.</enum><header>Advance procurement
		funding</header><text display-inline="no-display-inline">With respect to any
		Coast Guard vessel for which amounts are appropriated or otherwise made
		available for vessels for the Coast Guard in any fiscal year, the Secretary may
		enter into a contract or place an order, in advance of a contract or order for
		construction of a vessel, for—</text>
						<paragraph id="idad695001-e302-49c1-8c45-49aeaa4bd6ef"><enum>(1)</enum><text>materials, parts,
		components, and effort for the vessel;</text>
						</paragraph><paragraph id="id1f7065a2-2959-4f9d-99d2-69f734a08838"><enum>(2)</enum><text>advance construction of
		parts or components for the vessel;</text>
						</paragraph><paragraph id="id761df87e-c607-4c8d-b5ad-326e14dd8fad"><enum>(3)</enum><text>protection and storage of
		materials, parts, or components for the vessel; and</text>
						</paragraph><paragraph id="id2f7d0167-0e4b-4db2-8075-9a3a6960388d"><enum>(4)</enum><text>production planning,
		design, and other related support services that reduce the overall procurement
		lead time of the vessel.</text>
						</paragraph></section><section id="idB12B3EDE81FA4609934AA825F2BCA0C2"><enum>402.</enum><header>Multiyear procurement
		authority for Coast Guard National Security Cutters</header>
						<subsection id="id7EFA493019674036A3EE2905FB4DD2A4"><enum>(a)</enum><header>In
		General</header><text display-inline="yes-display-inline">Beginning with the
		fiscal year 2013 program year, the Secretary of the department in which the
		Coast Guard is operating may enter, under section 2306b of title 10, United
		States Code, into a multiyear contract for the procurement of Coast Guard
		National Security Cutters and government-furnished equipment associated with
		the National Security Cutter program.</text>
						</subsection><subsection id="id69A5D130162B402A8622E291849F8AC0"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary may not enter into a contract
		under subsection (a) until—</text>
							<paragraph id="idBB93D83242AB4286BCC3C1AAE1DC7847"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary submits to the Committee on
		Commerce, Science, and Transportation of the Senate and the Committee on
		Transportation and Infrastructure of the House of Representatives a
		certification that the Secretary has made, with respect to the contract, each
		of the findings under section 2306b(a) of title 10, United States Code, such as
		the analysis referred to under subsection (c) of this section; and</text>
							</paragraph><paragraph id="id588FABCEB50149A0B2C37966FF62EB4E"><enum>(2)</enum><text display-inline="yes-display-inline">a period of 30 days has elapsed after the
		date that the Secretary submits the certification under paragraph (1).</text>
							</paragraph></subsection><subsection id="id6804C63A7CE74E96A4DA5B7C57D909E9"><enum>(c)</enum><header>Determination of
		Substantial Savings</header><text display-inline="yes-display-inline">In
		conducting an analysis of substantial savings under section 2306b(a)(1) of
		title 10, United States Code, the Secretary—</text>
							<paragraph id="idD85DD1A87C1640C5B1F6590C25E0FAA2"><enum>(1)</enum><text display-inline="yes-display-inline">may not limit the analysis to a simple
		percentage-based metric; and</text>
							</paragraph><paragraph id="id53D783159AED49109782980B4F999626"><enum>(2)</enum><text display-inline="yes-display-inline">shall employ a full-scale analysis of cost
		avoidance—</text>
								<subparagraph id="idCD48C92FA2AE4551B2EF19A61C64120D"><enum>(A)</enum><text display-inline="yes-display-inline">based on a multiyear procurement;
		and</text>
								</subparagraph><subparagraph id="idA58121E8EDE24937AFD7314BB11BB423"><enum>(B)</enum><text display-inline="yes-display-inline">taking into account the potential benefit
		any accrued savings might have for future shipbuilding programs if the cost
		avoidance savings were subsequently utilized for further ship
		construction.</text>
								</subparagraph></paragraph></subsection></section><section commented="no" id="id091d07e0-c3cc-4b47-b7df-185dba483f83"><enum>403.</enum><header>Requirement to
		maintain United States polar icebreaking capability</header>
						<subsection commented="no" id="idE74DD8185A674B90AB84DAACAE6133F4"><enum>(a)</enum><header>Current icebreaker
		maintenance</header><text>Until new heavy icebreakers are acquired for
		operation by the Coast Guard, in order to meet Coast Guard mission
		requirements, the Commandant of the Coast Guard may not—</text>
							<paragraph commented="no" id="id7C1DD4C656F1416CB0FF46CC8D6B2AEC"><enum>(1)</enum><text>transfer, relinquish
		ownership of, dismantle, or recycle the POLAR SEA or POLAR STAR;</text>
							</paragraph><paragraph commented="no" id="id919A3C3BD3554E7599B905AE716FF23A"><enum>(2)</enum><text>remove any part of the
		POLAR SEA unless it will be installed on the POLAR STAR before it is put in
		‘‘active’’ status and the Commandant certifies to the Committee on Commerce,
		Science, and Transportation of the Senate and the Committee on Transportation
		and Infrastructure of the House of Representatives that it is not possible for
		the POLAR STAR to function properly without doing so;</text>
							</paragraph><paragraph commented="no" id="idB1BD103CA80B4229AA98E15CB407C8D4"><enum>(3)</enum><text>change the existing
		homeport of any Coast Guard icebreaker; or</text>
							</paragraph><paragraph commented="no" id="idC99E69A071224A9C99F73D8C09190150"><enum>(4)</enum><text>expend any funds—</text>
								<subparagraph commented="no" id="id155003CB926C42F59D433AECF646C3D5"><enum>(A)</enum><text>for any expenses directly
		or indirectly associated with the decommissioning of either of the vessels,
		including expenses for dock use or other goods and services;</text>
								</subparagraph><subparagraph commented="no" id="id6C79DD94A03944C38122F3E9855866B1"><enum>(B)</enum><text>for any personnel
		expenses directly or indirectly associated with the decommissioning of either
		of the vessels, including expenses for a decommissioning officer;</text>
								</subparagraph><subparagraph commented="no" id="id3D8A984B82734C67BAE2E6DA0CC1087E"><enum>(C)</enum><text>for any expenses
		associated with a decommissioning ceremony for either of the vessels;</text>
								</subparagraph><subparagraph commented="no" id="idA14110219E784794AAFEB94D68953F14"><enum>(D)</enum><text>to appoint a
		decommissioning officer to be affiliated with either of the vessels; or</text>
								</subparagraph><subparagraph commented="no" id="idBCAA4A5F93BD4F4B881F30126CAB446E"><enum>(E)</enum><text>to place either of the
		vessels in inactive status.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="id929F5E7695A848DCAA00240B279A8F99"><enum>(b)</enum><header>Reimbursement</header><text>Nothing
		in this section shall preclude the Secretary from seeking reimbursement for
		operation and maintenance costs of the polar icebreakers from other Federal
		agencies and entities, including foreign governments, that benefit from the use
		of the polar icebreakers.</text>
						</subsection></section><section id="id0adb04d6-92c1-495e-9965-080d1184b471"><enum>404.</enum><header>National response
		functions</header>
						<subsection id="id3094e538-29e9-4c14-9076-f83f12753e0f"><enum>(a)</enum><header>In
		general</header><text>Section 311 of the Federal Water Pollution Control Act
		(33 U.S.C. 1321) is amended—</text>
							<paragraph id="id7ee55c70-db36-442b-8a6f-8384517e39cd"><enum>(1)</enum><text>in subsection (a)—</text>
								<subparagraph id="ida786440d-1235-48a3-a966-cd6ac4dd97f0"><enum>(A)</enum><text>by striking paragraph

							</paragraph></subsection></section><section id="id99C7225F0A904C6F81DC60FA92ACFD20"><enum>405.</enum><header>National Response
		Center notification requirements</header><text display-inline="no-display-inline">The Ohio River Valley Water Sanitation
		Commission, established pursuant to the Ohio River Valley Water Sanitation
		Compact authorized by House Joint Resolution 377, 74th Congress, agreed to June
		8, 1936 (49 Stat. 1490), and consented to and approved by Congress in the Act
		of July 11, 1940 (54 Stat. 752), is deemed a Government agency for purposes of
		the notification requirements of section 103 of the Comprehensive Environmental
		Response, Compensation, and Liability Act of 1980 (42 U.S.C. 9603). The
		National Response Center shall convey notification, including complete and
		un-redacted incident reports, expeditiously to the Commission regarding each
		release in or affecting the Ohio River Basin for which notification to all
		appropriate Government agencies is required.</text>
					</section><section id="idff887ea5-363d-460b-a843-96822c2feb73"><enum>406.</enum><header>Conforming
		amendment</header><text display-inline="no-display-inline">Section 210 of the
		Coast Guard and Maritime Transportation Act of 2006 (14 U.S.C. 93 note) is
		repealed.</text>
					</section></title><title id="idf766bf30-789f-4296-b487-38e41b91c167"><enum>V</enum><header>Shipping and
		navigation</header>
					<section id="idab943e38-2a39-4d57-b56d-3a27411d67d6"><enum>501.</enum><header>Central Bering Sea
		potential place of refuge</header>
						<subsection id="ida98b3324-5c00-493c-a245-db49acf250b5"><enum>(a)</enum><header>Consultation</header><text>Not
		later than 1 year after the date of enactment of this Act, the Commandant of
		the Coast Guard shall consult with appropriate Federal agencies and with State
		and local interests to determine what improvements, if any, are necessary to
		designate existing ice-free facilities (or infrastructure) in the Central
		Bering Sea as a fully functional, year-round Potential Place of Refuge for
		vessels with drafts up to 25 feet and lengths overall of up to 450 feet.</text>
						</subsection><subsection id="id41815dbc-2b0a-4257-9246-c5952024a5ae"><enum>(b)</enum><header>Purposes</header><text>The
		purposes of the consultation under subsection (a) shall be to enhance safety of
		human life at sea and protect the marine environment in the Central Bering
		Sea.</text>
						</subsection><subsection id="idb170f920-e012-4d4c-bc9c-022f074a7ec0"><enum>(c)</enum><header>Report</header><text>Not
		later than 90 days after making the determination under subsection (a), the
		Commandant shall inform the Committee on Commerce, Science, and Transportation
		of the Senate and the Committee on Transportation and Infrastructure of the
		House of Representatives in writing of the findings under subsection
		(a).</text>
						</subsection></section><section id="idf493471e-d58b-476c-a56c-50d787a1fd3d"><enum>502.</enum><header>Protection and fair
		treatment of seafarers</header>
						<subsection id="id91cfb424-c657-4d11-a660-7a5180c264ac"><enum>(a)</enum><header>In
		general</header><text>Chapter 111 of title 46, United States Code, is amended
		by adding at the end the following:</text>
							<quoted-block changed="added" display-inline="no-display-inline" id="id02b756a5-429e-4ec8-bb21-82384383cd6c" reported-display-style="italic" style="USC">
								<section id="id80dacdd6-3fd4-462d-9b9c-8f07e0f46f16"><enum>11113.</enum><header>Protection and fair
		  treatment of seafarers</header>
									<subsection id="id257275d0-da2e-4b8e-a578-e9b2678b031a"><enum>(a)</enum><header>Purpose</header><text>The
		  purpose of this section shall be to ensure the protection and fair treatment of
		  seafarers.</text>
									</subsection><subsection id="id96f1bdbf-4af9-425a-95e2-e2274706edf5"><enum>(b)</enum><header>Special fund</header>
										<paragraph id="id70114b32-7af8-4451-a6c8-fa7626a916a6"><enum>(1)</enum><header>Establishment</header><text>There
		  is established in the Treasury a special fund known as the Support of Seafarers
		  Fund.</text>
										</paragraph><paragraph id="id6a995ae5-90b9-496c-b429-e4a00e7d751e"><enum>(2)</enum><header>Use of amounts in
		  Fund</header><text>The amounts deposited into the Fund shall be available to
		  the Secretary, without fiscal year limitation, to—</text>
											<subparagraph id="id4337bfb3-56e5-4023-b0d7-1a5b2af5f413"><enum>(A)</enum><text>pay necessary support
		  under subsection (c)(1); and</text>
											</subparagraph><subparagraph id="id0e67ae9c-557d-4316-8300-b5e6010b2b8c"><enum>(B)</enum><text>reimburse a shipowner for
		  necessary support under subsection (c)(2).</text>
											</subparagraph></paragraph><paragraph id="idb86e634c-062b-4183-b1fc-3128a465ba82"><enum>(3)</enum><header>Amounts credited to
		  Fund</header><text>Notwithstanding any other provision of law, the Fund may
		  receive—</text>
											<subparagraph id="id1720231e-81c8-4206-a5c5-2db6247156ba"><enum>(A)</enum><text>any moneys ordered to be
		  paid to the Fund in the form of community service under section 8B1.3 of the
		  United States Sentencing Guidelines Manual or to the extent permitted under
		  paragraph (4); and</text>
											</subparagraph><subparagraph id="id9aa999f5-075a-4ff3-8e0c-80f8498bda33"><enum>(B)</enum><text>amounts reimbursed or
		  recovered under subsection (e).</text>
											</subparagraph></paragraph><paragraph id="idda03ae06-6410-4bfe-aebc-20e57c69ad58"><enum>(4)</enum><header>Prerequisite for
		  community service credits</header><text>The Fund may receive credits under
		  paragraph (3)(A) if the unobligated balance of the Fund is less than
		  $5,000,000.</text>
										</paragraph><paragraph id="id0D18082E66C24E5DBF0BEACE580EF8F4"><enum>(5)</enum><header>Authorization of
		  appropriation</header><text>There are authorized to be appropriated, from the
		  Fund, for each fiscal year such sums as may be necessary for the purposes set
		  forth in paragraph (2).</text>
										</paragraph><paragraph id="id5a0f3fb4-6093-4804-87da-4339dd70775f"><enum>(6)</enum><header>Report
		  required</header>
											<subparagraph id="id21693507-7340-40ec-b8f8-ff6f35c70ff1"><enum>(A)</enum><header>In
		  general</header><text>The Secretary shall submit to Congress, concurrent with
		  the President’s budget submission for a given fiscal year, a report that
		  describes—</text>
												<clause id="id0c3e2da7-1521-4464-802f-93773c8dd63c"><enum>(i)</enum><text>the amounts credited to
		  the Fund under paragraph (3) for the preceding fiscal year;</text>
												</clause><clause id="id64252d98-9a38-44dc-af91-eb75387f7aba"><enum>(ii)</enum><text>in detail, the
		  activities for which amounts were charged; and</text>
												</clause><clause id="id7f951988-05bc-4926-a807-02b2ea187f67"><enum>(iii)</enum><text>the projected level of
		  expenditures from the Fund for the upcoming fiscal year, based on—</text>
													<subclause id="idb1352530-269f-4e80-8115-3b7bc2f10fe2"><enum>(I)</enum><text>on-going activities;
		  and</text>
													</subclause><subclause id="ideca5fcdb-cf89-4212-b6f5-244066c34dbd"><enum>(II)</enum><text>new cases, derived from
		  historic data.</text>
													</subclause></clause></subparagraph><subparagraph id="idcf9381d2-0f1b-450c-86cd-c668930332d8"><enum>(B)</enum><header>Exception</header><text>Subparagraph
		  (A) shall not apply to obligations during the first fiscal year during which
		  amounts are credited to the Fund.</text>
											</subparagraph></paragraph><paragraph id="id3b0b051c-62ac-4b7c-8bf7-269e58476ccc"><enum>(7)</enum><header>Fund
		  manager</header><text>The Secretary shall designate a Fund manager. The Fund
		  manager shall—</text>
											<subparagraph id="idf8a77fc0-2654-4fa6-8079-4fe6de0cbbae"><enum>(A)</enum><text>ensure the visibility and
		  accountability of transactions utilizing the Fund;</text>
											</subparagraph><subparagraph id="idde0fb915-f1b1-4ecb-8b0e-94f7224cc4e7"><enum>(B)</enum><text>prepare the report under
		  paragraph (6);</text>
											</subparagraph><subparagraph id="idd679e194-c102-4240-9ec0-6035472d21da"><enum>(C)</enum><text>monitor the unobligated
		  balance of the Fund; and</text>
											</subparagraph><subparagraph id="id037ceb93-d661-475f-966b-d4c3d021785a"><enum>(D)</enum><text>provide notice to the
		  Secretary and the Attorney General whenever the unobligated balance of the Fund
		  is less than $5,000,000.</text>
											</subparagraph></paragraph></subsection><subsection id="id3907e4c2-7df0-46cc-b264-8362b181af5a"><enum>(c)</enum><header>Authority</header><text>The
		  Secretary may—</text>
										<paragraph id="idc884a604-9a7e-49df-bbdc-386bb406826a"><enum>(1)</enum><text>pay, from amounts
		  appropriated from the Fund, necessary support of—</text>
											<subparagraph id="ide9f89b0f-09f1-4818-a628-27f7e5b51995"><enum>(A)</enum><text>a seafarer that—</text>
												<clause id="id231bcd8f-2980-46f5-857e-a3a679b721b5"><enum>(i)</enum><text>enters, remains, or is
		  paroled into the United States; and</text>
												</clause><clause id="idb02ec03e-e4cf-43e4-a978-1ccbb764c31b"><enum>(ii)</enum><text>is involved in an
		  investigation, reporting, documentation, or adjudication of any matter that is
		  related to the administration or enforcement of any treaty, law, or regulation
		  by the Coast Guard; and</text>
												</clause></subparagraph><subparagraph id="id0bf64050-be26-4b92-a1e5-36ec894cb00b"><enum>(B)</enum><text>a seafarer that the
		  Secretary determines was abandoned in the United States; and</text>
											</subparagraph></paragraph><paragraph id="ide3404774-00d9-4642-9ced-4887a39d1a22"><enum>(2)</enum><text>reimburse, from amounts
		  appropriated from the Fund, a shipowner that has provided necessary support of
		  a seafarer who has been paroled into the United States to facilitate an
		  investigation, reporting, documentation, or adjudication of any matter that is
		  related to the administration or enforcement of any treaty, law, or regulation
		  by the Coast Guard, for the costs of necessary support if the Secretary
		  determines that reimbursement is necessary to avoid serious injustice.</text>
										</paragraph></subsection><subsection id="ide37fc673-142b-45be-8f26-0e4f55065c95"><enum>(d)</enum><header>Limitation</header><text>Nothing
		  in this section shall be construed—</text>
										<paragraph id="idc2521b5a-119f-4e27-a753-45d7d2308505"><enum>(1)</enum><text>to create a right,
		  benefit, or entitlement to necessary support; or</text>
										</paragraph><paragraph id="idb77c5610-09eb-4d50-bb9f-e043a3a7e186"><enum>(2)</enum><text>to compel the Secretary
		  to pay or reimburse the cost of necessary support.</text>
										</paragraph></subsection><subsection id="id8204ff69-2046-408c-80d5-811ddfa9e4b3"><enum>(e)</enum><header>Reimbursement;
		  recovery</header>
										<paragraph id="id9d89b820-34ad-494f-ab50-75cb90f43457"><enum>(1)</enum><header>In
		  general</header><text>A shipowner shall reimburse the Fund an amount equal to
		  the total amount paid from the Fund for necessary support of a seafarer plus a
		  surcharge of 25 percent of the total amount if—</text>
											<subparagraph id="id0fda554f-ee5b-4ced-9250-87036e9df719"><enum>(A)</enum><text>the shipowner—</text>
												<clause id="idd6299f68-a579-4972-923c-42cb73f77cbc"><enum>(i)</enum><text>during the course of an
		  investigation, reporting, documentation, or adjudication of any matter that the
		  Coast Guard referred to a United States Attorney or the Attorney General, fails
		  to provide necessary support of a seafarer who was paroled into the United
		  States to facilitate the investigation, reporting, documentation, or
		  adjudication; and</text>
												</clause><clause id="id71530e6f-1c53-4a1e-ba76-5c0be24679aa"><enum>(ii)</enum><text>subsequently receives a
		  criminal penalty; or</text>
												</clause></subparagraph><subparagraph id="id08fb2147-1049-47b5-b2af-44f5973fd1f6"><enum>(B)</enum><text>the shipowner, under any
		  circumstance, abandons a seafarer in the United States, as determined by the
		  Secretary.</text>
											</subparagraph></paragraph><paragraph id="id16d39e3c-0eb6-4c37-87ac-146f90878f1f"><enum>(2)</enum><header>Enforcement</header><text>If
		  a shipowner fails to reimburse the Fund under paragraph (1), the Secretary
		  may—</text>
											<subparagraph id="idc7ff5d05-2f97-48e7-8449-7d2fd38951f7"><enum>(A)</enum><text>proceed in rem against
		  any vessel of the shipowner in the Federal district court for the district in
		  which the vessel is found; and</text>
											</subparagraph><subparagraph id="id2a959030-b9c5-4fbe-bdac-3390c3906aa6"><enum>(B)</enum><text>withhold or revoke the
		  clearance required under section 60105 of any vessel of the shipowner wherever
		  the vessel is found.</text>
											</subparagraph></paragraph><paragraph id="id102ea52d-033a-4aa2-9bc1-c7547d249963"><enum>(3)</enum><header>Remedy</header><text>A
		  vessel may obtain clearance from the Secretary after it is withheld or revoked
		  under paragraph (2)(B) if the shipowner reimburses the Fund the amount required
		  under paragraph (1).</text>
										</paragraph></subsection><subsection id="idc19e8670-296b-4815-8593-0dd2f1314591"><enum>(f)</enum><header>Bond and
		  surety</header>
										<paragraph id="id3960733b-532f-451c-bbcc-7673612040ee"><enum>(1)</enum><header>Authority</header><text>The
		  Secretary may require a bond or a surety satisfactory as an alternative to
		  withholding or revoking clearance under subsection (e) if, in the opinion of
		  the Secretary, the bond or surety satisfactory is necessary to facilitate an
		  investigation, reporting, documentation, or adjudication of any matter that is
		  related to the administration or enforcement of any treaty, law, or regulation
		  by the Coast Guard.</text>
										</paragraph><paragraph id="idA032F6977DE94B4EACFD33B4D0A9A72E"><enum>(2)</enum><header>Surety
		  corporations</header><text>A surety corporation may provide a bond or surety
		  satisfactory under paragraph (1) if the surety corporation is authorized by the
		  Secretary of the Treasury under section 9305 of title 31 to provide surety
		  bonds under section 9304 of title 31.</text>
										</paragraph><paragraph id="id47caa452-1136-417b-8101-081e24ada43f"><enum>(3)</enum><header>Application</header><text>The
		  authority to require a bond or surety satisfactory or to request the
		  withholding or revocation of the clearance under subsection (e) applies to any
		  investigation, reporting, documentation, or adjudication of any matter that is
		  related to the administration or enforcement of any treaty, law, or regulation
		  by the Coast Guard.</text>
										</paragraph></subsection><subsection id="id108b5087-6d0a-4275-939d-b331d7e1e178"><enum>(g)</enum><header>Definitions</header><text>In
		  this section:</text>
										<paragraph id="id8235cef9-8eb0-4146-90ce-c2e9641948df"><enum>(1)</enum><header>Abandons;
		  abandoned</header><text>The term <term>abandons</term> or
		  <term>abandoned</term> means—</text>
											<subparagraph id="idc143d824-f5c3-4c3b-8529-d9f3c0a0d890"><enum>(A)</enum><text>a shipowner's unilateral
		  severance of ties with a seafarer; or</text>
											</subparagraph><subparagraph id="id6906df4a-cbfb-4c3d-9925-bb1893c9a44e"><enum>(B)</enum><text>a shipowner's failure to
		  provide necessary support of a seafarer.</text>
											</subparagraph></paragraph><paragraph id="id68c7c9ac-99ff-41e4-bfb0-b3a8a083a430"><enum>(2)</enum><header>Bond or surety
		  satisfactory</header><text>The term <term>bond or surety satisfactory</term>
		  means a negotiated instrument, the terms of which may, at the discretion of the
		  Secretary, include provisions that require a shipowner—</text>
											<subparagraph id="idebc42d5f-17a8-42d2-94c7-5f1e83f3f73d"><enum>(A)</enum><text>to provide necessary
		  support of a seafarer who has or may have information pertinent to an
		  investigation, reporting, documentation, or adjudication of any matter that is
		  related to the administration or enforcement of any treaty, law, or regulation
		  by the Coast Guard;</text>
											</subparagraph><subparagraph id="id2a88773e-ef1b-4d11-94ae-871c386f8a60"><enum>(B)</enum><text>to facilitate an
		  investigation, reporting, documentation, or adjudication of any matter that is
		  related to the administration or enforcement of any treaty, law, or regulation
		  by the Coast Guard;</text>
											</subparagraph><subparagraph id="id1be013b7-76da-49a6-993b-50faf387fae5"><enum>(C)</enum><text>to stipulate to certain
		  incontrovertible facts, including the ownership or operation of the vessel, or
		  the authenticity of documents and things from the vessel;</text>
											</subparagraph><subparagraph id="id769c818d-7520-444a-becc-6d8abf1a7494"><enum>(D)</enum><text>to facilitate service of
		  correspondence and legal papers;</text>
											</subparagraph><subparagraph id="id9d0d52a2-1535-46f5-883f-e5abe3d54af0"><enum>(E)</enum><text>to enter an appearance in
		  United States district court;</text>
											</subparagraph><subparagraph id="id5488a224-fb06-4a40-80ed-1ffc4497792e"><enum>(F)</enum><text>to comply with directions
		  regarding payment of funds;</text>
											</subparagraph><subparagraph id="idf0e9dcb2-0389-476e-9ad4-d4001e5ca547"><enum>(G)</enum><text>to name an agent in the
		  United States for service of process;</text>
											</subparagraph><subparagraph id="ide3a430b7-a7bb-4cc2-b1e1-fa5add0cc1a0"><enum>(H)</enum><text>to stipulate in United
		  States district court as to the authenticity of certain documents;</text>
											</subparagraph><subparagraph id="id4dffd323-e070-43e3-86b6-5ad078e0495d"><enum>(I)</enum><text>to provide assurances
		  that no discriminatory or retaliatory measures will be taken against a seafarer
		  involved in an investigation, reporting, documentation, or adjudication of any
		  matter that is related to the administration or enforcement of any treaty, law,
		  or regulation by the Coast Guard;</text>
											</subparagraph><subparagraph id="id677f1385-aa32-41a2-af64-9fdab01da73b"><enum>(J)</enum><text>to provide financial
		  security in the form of cash, bond, or other means acceptable to the Secretary;
		  and</text>
											</subparagraph><subparagraph id="idd2b219a5-d997-46b0-99af-59632fda0d7b"><enum>(K)</enum><text>to provide for any other
		  appropriate measures as the Secretary considers necessary to ensure the
		  Government is not prejudiced by granting the clearance required under section
		  60105 of title 46.</text>
											</subparagraph></paragraph><paragraph id="idf1086a46-ed9b-48bc-ba85-31efab5fb8d0"><enum>(3)</enum><header>Fund</header><text>The
		  term <term>Fund</term> means the Support of Seafarers Fund established under
		  this section.</text>
										</paragraph><paragraph id="id0a861243-9ec4-41cc-8791-34444b898159"><enum>(4)</enum><header>Necessary
		  support</header><text>The term <term>necessary support</term> means normal
		  wages, lodging, subsistence, clothing, medical care (including
		  hospitalization), repatriation, and any other expense the Secretary considers
		  appropriate.</text>
										</paragraph><paragraph id="id59f82dab-9b64-44ec-b2c2-bd5422eaf2f2"><enum>(5)</enum><header>Seafarer</header><text>The
		  term <term>seafarer</term> means an alien crewman who is employed or engaged in
		  any capacity on board a vessel subject to the jurisdiction of the United
		  States. A seafarer is a claimant for the purposes of section 30509.</text>
										</paragraph><paragraph id="id257d62fd-181a-4631-b81b-3d225cbd9545"><enum>(6)</enum><header>Shipowner</header><text>The
		  term <term>shipowner</term> means an individual or entity that owns, has an
		  ownership interest in, or operates a vessel subject to the jurisdiction of the
		  United States.</text>
										</paragraph><paragraph id="idebafef10-3c56-43c1-88f8-a719333bdf40"><enum>(7)</enum><header>Vessel subject to the
		  jurisdiction of the United States</header><text>The term <term>vessel subject
		  to the jurisdiction of the United States</term> has the meaning given the term
		  in section 70502(c), except that it excludes—</text>
											<subparagraph id="idce72e96b-89e6-4cd4-8f0b-868d5a7ba224"><enum>(A)</enum><text>a vessel—</text>

						</paragraph></section><section id="id78c9a0c3-10db-4f29-8c96-f140e959e0bd"><enum>504.</enum><header>Report on
		establishment of arctic deep water port</header>
						<subsection id="ide0ac9065-2a9e-4fe9-816a-6bce1b9d2b82"><enum>(a)</enum><header>Study</header><text>The
		Commandant of the Coast Guard shall conduct a study on the feasibility and
		potential of establishing a deep water sea port in the Arctic to protect and
		advance strategic United States interests within the Arctic region.</text>
						</subsection><subsection id="id4de938fb-2a2a-4224-a0ec-c839ecfd521e"><enum>(b)</enum><header>Scope</header><text>The
		study under subsection (a) shall include an analysis of—</text>
							<paragraph id="id3ba6a5de-ceed-4538-88c4-dcae9c170043"><enum>(1)</enum><text>the capability that a
		deep water sea port would provide;</text>
							</paragraph><paragraph id="id27c971db-02bb-47f0-a139-68fd24e01fbc"><enum>(2)</enum><text>the potential and optimum
		locations for the port;</text>
							</paragraph><paragraph id="id89b48f97-31da-462f-ab1a-8518ef92885e"><enum>(3)</enum><text>the resources needed to
		establish the port;</text>
							</paragraph><paragraph id="idd42792f3-cc70-4eb0-ac2d-307d1e21942a"><enum>(4)</enum><text>the time frame needed to
		establish the port;</text>
							</paragraph><paragraph id="id9ec09842-02c7-4f4d-9a40-f0760b354da9"><enum>(5)</enum><text>the infrastructure
		required to support the port; and</text>
							</paragraph><paragraph id="id0f9abe75-d023-40c3-9a43-554dedb3b1f5"><enum>(6)</enum><text>any other issues the
		Secretary considers necessary to complete the study.</text>
							</paragraph></subsection><subsection id="id6564a2b4-af25-4d3e-99a7-88d77007d5c4"><enum>(c)</enum><header>Report</header><text>Not
		later than 1 year after the date of enactment of this Act, the Commandant shall
		submit a report on the findings of the study under subsection (a) to the
		Committee on Commerce, Science, and Transportation of the Senate and the
		Committee on Transportation and Infrastructure of the House of
		Representatives.</text>
						</subsection></section><section id="idAAF77FF68B474FBBBF2914FBDB135A72"><enum>505.</enum><header>Risk analysis of
		transporting Canadian oil sands</header>
						<subsection id="idAC2D0B9C6D994027AC331FC9B8EF9993"><enum>(a)</enum><header>In
		general</header><text>The Commandant of the Coast Guard shall assess the
		increased vessel traffic in the Salish Sea (including the Puget Sound, the
		Strait of Georgia, Haro Strait, Rosario Strait, and the Strait of Juan de
		Fuca), that may occur from the transport of Canadian oil sands oil.</text>
						</subsection><subsection id="id4AE1E94EC198402DA3F55B9D093C973D"><enum>(b)</enum><header>Scope</header><text>The
		analysis required under subsection (a) shall, at a minimum, consider—</text>
							<paragraph id="idE0D0B3EB70A74A599668D6B31BD555DD"><enum>(1)</enum><text>the extent to which
		vessel (barge, tanker, and supertanker) traffic may increase due to Canadian
		oil sands development;</text>
							</paragraph><paragraph id="idC4C8BC6AA52E461788823974E9880FE8"><enum>(2)</enum><text>whether transport of
		Canadian oil sands within the Salish Sea is likely to require navigation
		through United States territorial waters;</text>
							</paragraph><paragraph id="id8FF77B46670E436A8AFDA26C0F4D2C6A"><enum>(3)</enum><text>the rules and regulations
		that restrict supertanker traffic in United States waters, including an
		assessment of whether there are methods to bypass those rules in such waterways
		and adjacent Canadian waters;</text>
							</paragraph><paragraph id="id9E09D742B35F4FAB841450EA045EBAC7"><enum>(4)</enum><text>the rules and regulations
		that restrict the amount of oil transported in tankers or barges in United
		States waters, including an assessment of whether there are methods to bypass
		those rules in such waterways and adjacent Canadian waters;</text>
							</paragraph><paragraph id="idAD11EAFFB990449DB0920BD185DFF846"><enum>(5)</enum><text>the spill response
		capability throughout the shared water of the United States and Canada,
		including oil spill response planning requirements for vessels bound for one
		nation transiting through the waters of the other nation;</text>
							</paragraph><paragraph id="id52D134A141854D2EBB47B3C4603C9F42"><enum>(6)</enum><text>the vessel emergency
		response towing capability at the entrance to the Strait of Juan de
		Fuca;</text>
							</paragraph><paragraph id="id0246A1C49EBB4AAAA093144E7E629FA1"><enum>(7)</enum><text>the agreement between the
		United States and Canada that outlines requirements for laden tank vessels to
		be escorted by tug boats;</text>
							</paragraph><paragraph id="id35EEBDD2997E42C9B66FAE03F80D50FD"><enum>(8)</enum><text>whether oil extracted
		from oil sands has different properties from other types of oil, including
		toxicity and other properties, which may require different maritime clean up
		technologies;</text>
							</paragraph><paragraph id="id37A26404FCC14F77BD37CBD3048013D4"><enum>(9)</enum><text>a risk assessment of the
		increasing supertanker, tanker, and barge traffic associated with Canadian oil
		sands development or expected to be associated with Canadian oil sands
		development; and</text>
							</paragraph><paragraph id="idC20B3A897D0746EBB15E932006DC4747"><enum>(10)</enum><text>the potential costs and
		benefits to the U.S. public and the private sector of maritime transportation
		of oil sands products.</text>
							</paragraph></subsection><subsection id="id6A559798F4E74730A938A63046FD5DBE"><enum>(c)</enum><header>Consultation
		requirement</header><text>In conducting the analysis required under this
		section, the Commandant shall consult with the State of Washington and affected
		tribal governments. The Commandant is also strongly encouraged to consult with
		the Secretary of State.</text>
						</subsection><subsection id="id1E7058A5C6AC4C94A51C8C0E5AF10BFF"><enum>(d)</enum><header>Report</header><text>Not
		later than 180 days after the date of enactment of this Act, the Commandant
		shall submit a report based on the analysis required under this section to the
		Committee on Commerce, Science, and Transportation of the Senate and the
		Committee on Transportation and Infrastructure of the House of
		Representatives.</text>
						</subsection></section><section id="idE59594EDB0D34CBE9861069FD81E8F75"><enum>506.</enum><header>Eligibility to receive
		surplus training equipment</header><text display-inline="no-display-inline">Section 51103(b)(2)(C) of title 46, United
		States Code, is amended by inserting “or a training institution that is an
		instrumentality of a State, Territory, or Commonwealth of the United States or

		  waterways</header><text>Not later than October 1, 2013, the Secretary, in
		  consultation with the Secretary of Defense and the commanding officer of the
		  Army Corps of Engineers, and with the concurrence of the Secretary of the
		  department in which the Coast Guard is operating, shall submit a report to the
		  Committee on Commerce, Science, and Transportation of the Senate and the
		  Committee on Armed Services and the Committee on Transportation and
		  Infrastructure of the House of Representatives on the status of the Nation's
		  coastal and inland waterways that—</text>
										<subparagraph id="ID775AC5E5DB634A75AF5E9173C629CB2A"><enum>(A)</enum><text>describes the state of
		  the United States' marine transportation infrastructure, including intercoastal
		  infrastructure, intracoastal infrastructure, inland waterway infrastructure,
		  ports, and marine facilities;</text>
										</subparagraph><subparagraph id="IDF3C6BA6BA9F0469AB62751902C6FAB7D"><enum>(B)</enum><text>provides estimates of the
		  investment levels required—</text>
											<clause id="ID065012865B7D425594FAFC80BBAEC46C"><enum>(i)</enum><text>to maintain the
		  infrastructure; and</text>
											</clause><clause id="IDE330CA1B6F7E47488D5679B73DA1D65D"><enum>(ii)</enum><text>to improve the
		  infrastructure; and</text>
											</clause></subparagraph><subparagraph id="ID0CA550E4ACBB4B48A3C48F8B68D8DD3E"><enum>(C)</enum><text>describes the overall
		  environmental management of the maritime transportation system and the
		  integration of environmental stewardship into the overall system.</text>
										</subparagraph></paragraph><paragraph id="IDE526AE0618104DFD940070F8857835C6"><enum>(2)</enum><header>Marine
		  transportation</header><text>The Secretary may investigate, make determinations
		  concerning, and develop a repository of statistical information relating to
		  marine transportation, including its relationship to transportation by land and
		  air, to facilitate research, assessment, and maintenance of the maritime
		  transportation system. As used in this paragraph, the term <term>marine
		  transportation</term> includes intercoastal transportation, intracoastal
		  transportation, inland waterway transportation, ports, and marine
		  facilities.</text>
									</paragraph><paragraph id="IDDDE4CD4995B545A08CC587A0FD8127BB"><enum>(3)</enum><header>Authorization of
		  appropriations</header><text>There are authorized to be appropriated to the
		  Secretary such sums as may be necessary to carry out this
		  subsection.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subsection><subsection id="ID8CC654E055EA4B69BA392BB7749A08F4"><enum>(b)</enum><header>Container-on-barge
		transportation</header>
							<paragraph id="ID128F14F17E6B4FBA96A4166A6A624CC9"><enum>(1)</enum><header>Assessment and
		report</header><text>Not later than 6 months after the date of enactment of
		this Act, the Maritime Administration shall assess the potential for using
		container-on-barge transportation on the inland waterways system and submit a
		report, together with the Administration's findings, conclusions, and
		recommendations, to the Committee on Commerce, Science, and Transportation of
		the Senate and the Committee on Armed Services and the Committee on
		Transportation and Infrastructure of the House of Representatives. If the
		Administration determines that it would be in the public interest, the report
		may include recommendations for a plan to increase awareness of the potential
		for use of such container-on-barge transportation and recommendations for the
		development and implementation of such a plan.</text>
							</paragraph><paragraph id="IDD7738D25B2A24640ADCAA95645D7FCD7"><enum>(2)</enum><header>Factors</header><text>In
		conducting the assessment, the Administration shall consider—</text>
								<subparagraph id="IDD1F67302E9D1474FAABD2987BFE3E4C6"><enum>(A)</enum><text>the environmental
		benefits of increasing container-on-barge movements on our inland and
		intracoastal waterways system;</text>
								</subparagraph><subparagraph id="IDC7BB467237004366B0AEB4483DE00E3F"><enum>(B)</enum><text>the regional differences
		in the inland waterways system;</text>
								</subparagraph><subparagraph id="IDB0DC2DA3EDBB428E88EB8B1EE9EFD966"><enum>(C)</enum><text>the existing programs
		established at coastal and Great Lakes ports for establishing awareness of deep
		sea shipping operations;</text>
								</subparagraph><subparagraph id="ID88DBDC31216C42CD9511BF0B8EFA84A0"><enum>(D)</enum><text>the mechanisms to ensure
		that implementation of the plan will not be inconsistent with antitrust laws;
		and</text>
								</subparagraph><subparagraph id="ID70E5ECF4D2F649EDB658F66BC951FC97"><enum>(E)</enum><text>the potential frequency
		of service at inland river ports.</text>

		  the use of public vessels under the control of the Maritime Administration or
		  private vessels under Untied States registry, and through partnerships and
		  cooperative efforts with academic, public, private, and non-governmental
		  entities and facilities.</text>
									</subsection><subsection id="id393545867C3349788E1EF2B6C16421ED"><enum>(b)</enum><header>Program
		  requirements</header><text>The program shall—</text>
										<paragraph id="idE833709505C94B89B0CD73884F46416E"><enum>(1)</enum><text>identify, study,
		  evaluate, test, demonstrate, or improve emerging marine technologies and
		  practices that are likely to achieve environmental improvements by—</text>
											<subparagraph id="id983F273B79AB403187C2DFBDF17146F8"><enum>(A)</enum><text>reducing air emissions,
		  water emissions, or other ship discharges;</text>
											</subparagraph><subparagraph id="idF1D54EFAD6D941C1A15EA2CC53BF3F4B"><enum>(B)</enum><text>increasing fuel economy
		  or the use of alternative fuels and alternative energy (including the use of
		  shore power); or</text>
											</subparagraph><subparagraph id="id3AF8650779294D249C62EA9F508B9C26"><enum>(C)</enum><text>controlling aquatic
		  invasive species; and</text>
											</subparagraph></paragraph><paragraph id="id0261CBA376E94751B77E23AAA4327A15"><enum>(2)</enum><text>be coordinated with the
		  Environmental Protection Agency, the United States Coast Guard, and other
		  Federal, State, local, or tribal agencies, as appropriate.</text>
										</paragraph></subsection><subsection id="id573D243431BA4FCDBF53E2E4039EBBE4"><enum>(c)</enum><header>Program
		  coordination</header><text>Program coordination under subsection (b)(2) may
		  include—</text>
										<paragraph id="id7D8FDC24202D40BDB9CD60030283503F"><enum>(1)</enum><text>activities that are
		  associated with the development or approval of validation and testing regimes;
		  and</text>
										</paragraph><paragraph id="id085FC7C1DF214B12884883C67DAD008A"><enum>(2)</enum><text>certification or
		  validation of emerging technologies or practices that demonstrate significant
		  environmental benefits.</text>
										</paragraph></subsection><subsection id="ID27E38A319C374CDC8E7AE47BDDD3F0D3"><enum>(d)</enum><header>Funding and
		  fees</header>
										<paragraph id="ID8A4D7258617B4B8D9E6E8245B78D1ED5"><enum>(1)</enum><header>In
		  general</header><text>In carrying out the maritime environmental and technical
		  assistance program, the Secretary of Transportation may apply such funds as may
		  be appropriated and such funds or resources as may become available by gift,
		  cooperative agreement, or otherwise, including the collection of fees, for the
		  purposes of the program and its administration.</text>
										</paragraph><paragraph id="ID4F88933E7E1B4D35B171547832A887BF"><enum>(2)</enum><header>Establishment of
		  fees</header><text>Pursuant to section 9701 of title 31, the Secretary of
		  Transportation may promulgate regulations establishing fees to recover
		  reasonable costs to the Secretary and to academic, public, and non-governmental
		  entities associated with the program.</text>
										</paragraph><paragraph id="IDD1D3745FF7CE4511A0C8C19906EA2FEE"><enum>(3)</enum><header>Fee
		  deposit</header><text>Any fees collected under this section shall be deposited
		  in a special fund of the United States Treasury for services rendered under the
		  program, which thereafter shall remain available until expended to carry out
		  the Secretary of Transportation's activities for which the fees were
		  collected.</text>
										</paragraph></subsection><subsection id="ID555FB38F9E2C477A9DE92C18929994E3"><enum>(e)</enum><header>Report</header><text>The
		  Secretary of Transportation shall report on the activities, expenditures, and
		  results of the maritime environmental and technical assistance program during
		  the preceding fiscal year in the annual budget submission to
		  Congress.</text>

		  covered by an operating agreement under this

							</paragraph></subsection><subsection id="IDA7AB3F9EB4C84446AA677F19D6B8F36A"><enum>(b)</enum><text>Section 53102(b) is
		amended to read as follows:</text>

		  (or in the case of a vessel to be constructed, will be operated) in providing
		  transportation in foreign commerce;</text>
									</paragraph><paragraph id="IDC29000082AF4415881C4292EFF1305B0"><enum>(3)</enum><text>the vessel is
		  self-propelled and—</text>
										<subparagraph id="ID5E3183F6D4134FACA6D114FDE8B78DEE"><enum>(A)</enum><text>is a tank vessel that is
		  10 years of age or less on the date the vessel is included in the Fleet;
		  or</text>
										</subparagraph><subparagraph id="ID7B6108737198444B91D0C7960116EECA"><enum>(B)</enum><text>is any other type of
		  vessel that is 15 years of age or less on the date the vessel is included in
		  the Fleet;</text>
										</subparagraph></paragraph><paragraph id="IDD17D35C0CED9423D9FA5504527F99920"><enum>(4)</enum><text>the vessel—</text>
										<subparagraph id="ID4BBCC8E4144E4137A3B415348267F2FF"><enum>(A)</enum><text>is suitable for use by
		  the United States for national defense or military purposes in time of war or
		  national emergency, as determined by the Secretary of Defense; and</text>
										</subparagraph><subparagraph id="ID33058F84ED7C4DF3A71DFA4443D663A3"><enum>(B)</enum><text>is commercially viable,
		  as determined by the Secretary; and</text>
										</subparagraph></paragraph><paragraph id="ID775AE5BCC0044FC3A86F81DE155D12F2"><enum>(5)</enum><text>the vessel—</text>
										<subparagraph id="IDBDE8E34DC3B6449C8FEBC614D04EE2A7"><enum>(A)</enum><text>is a United
		  States-documented vessel; or</text>
										</subparagraph><subparagraph id="IDE1DC4B4D71264F278B04BD5FD04D2833"><enum>(B)</enum><text>is not a United
		  States-documented vessel, but—</text>
											<clause id="ID96EA498B2D02472894A7056F218E9665"><enum>(i)</enum><text>the owner of the vessel
		  has demonstrated an intent to have the vessel documented under chapter 121 of
		  this title if it is included in the Fleet; and</text>
											</clause><clause id="ID58D62319844D45459C9EDBF10B0ADBE4"><enum>(ii)</enum><text>at the time an operating
		  agreement for the vessel is entered into under this chapter, the vessel is
		  eligible for documentation under chapter 121 of this
		  title.</text>
											</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subsection><subsection id="ID144230F240844DABA61C9061A66DCCCE"><enum>(c)</enum><text>Section 53103 is
		amended—</text>
							<paragraph id="IDCA60B3480473415C9C2BAD10CC688ECE"><enum>(1)</enum><text>by amending subsection
		(b) to read as follows:</text>

		  <short-title>Maritime Administration Authorization Act for
		  Fiscal Year 2013</short-title>, the Secretary shall offer, to an existing
		  contractor, to extend, through September 30, 2025, an operating agreement that
		  is in existence on the date of enactment of that Act. The terms and conditions
		  of the extended operating agreement shall include terms and conditions
		  authorized under this chapter, as amended from time to time.</text>
										</paragraph><paragraph id="IDE1FE4772779E4B0992670B05E73F4A7D"><enum>(2)</enum><header>Time
		  limit</header><text>An existing contractor shall have not later than 120 days
		  after the date the Secretary offers to extend an operating agreement to agree
		  to the extended operating agreement.</text>
										</paragraph><paragraph id="ID3BB9FC8D02E24CB1AF0D4233BF99188F"><enum>(3)</enum><header>Subsequent
		  award</header><text>The Secretary may award an operating agreement to an
		  applicant that is eligible to enter into an operating agreement for fiscal
		  years 2016 through 2025 if the existing contractor does not agree to the
		  extended operating agreement under paragraph
		  (2).</text>
										</paragraph></subsection><after-quoted-block>;
		  and</after-quoted-block></quoted-block>
							</paragraph><paragraph id="ID9C6C51628F884A9EA0609DBF0CB9F50C"><enum>(2)</enum><text>by amending subsection
		(c) to read as follows:</text>
								<quoted-block changed="added" display-inline="no-display-inline" id="ID3F47C1E5A81743A2A0AA3359F255F22A" reported-display-style="italic" style="OLC">
									<subsection id="ID12B14B2E1D5D4E4796CFD3947BE36FF4"><enum>(c)</enum><header>Procedure for awarding
		  new operating agreements</header><text>The Secretary may enter into a new
		  operating agreement with an applicant that meets the requirements of section
		  53102(c) (for vessels that meet the qualifications of section 53102(b)) on the
		  basis of priority for vessel type established by military requirements of the
		  Secretary of Defense. The Secretary shall allow an applicant at least 30 days
		  to submit an application for a new operating agreement. After consideration of
		  military requirements, priority shall be given to an applicant that is a U.S.
		  citizen under section 50501 of this title. The Secretary may not approve an
		  application without the consent of the Secretary of Defense. The Secretary
		  shall enter into an operating agreement with the applicant or provide a written
		  reason for denying the
		  application.</text>
									</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
							</paragraph></subsection><subsection id="ID5D73F24A121841169819A306A39500FB"><enum>(d)</enum><text>Section 53104 is
		amended—</text>
							<paragraph id="ID460AFD26FEDD4964999CEF36C34C1269"><enum>(1)</enum><text>in subsection (c), by
		striking paragraph (3); and</text>

							</paragraph><paragraph id="ID51542690826844B586BC365ACFAAF3E1"><enum>(2)</enum><text>by amending subsection
		(f) to read as follows:</text>

							</paragraph></subsection><subsection id="ID0187C9C15C3D47CD842895BEE948E498"><enum>(f)</enum><text>Section 53106 is
		amended—</text>
							<paragraph id="ID05B64AD364294842B9A4E9B2D2672BBB"><enum>(1)</enum><text>in subsection (a)(1), by
		striking <quote>and (C) $3,100,000 for each of fiscal years 2012 through

							</paragraph><paragraph id="ID456E5D2C419841E4898EDEDDE159E856"><enum>(2)</enum><text>in subsection (c)(3)(C),
		by striking <quote>a LASH vessel.</quote> and inserting <quote>a lighter aboard
		ship vessel.</quote>; and</text>
							</paragraph><paragraph id="IDF3567E9970AF4C6C805F56A12CD675DD"><enum>(3)</enum><text>by striking subsection
		(f).</text>
							</paragraph></subsection><subsection id="IDC3962525A9674395A762676B9239A9A3"><enum>(g)</enum><text>Section 53107(b)(1) is
		amended to read as follows:</text>

						</subsection><subsection id="ID6F5C2F6B54DA4F4B89AD80ECBD31B394"><enum>(h)</enum><text>Section 53109 is
		repealed.</text>
						</subsection><subsection id="ID125D7FE82215424390B7120DD79EBEDB"><enum>(i)</enum><text>Section 53111 is
		amended—</text>

		program</header><text>Section 3517(i) of the Maritime Security Act of 2003 (46
		U.S.C. 53101 note) is amended by striking <quote>2011</quote> and inserting
		<quote>2025</quote>.</text>
						</subsection><subsection id="IDEAE578092F9A46F097D3A6431FA01386"><enum>(k)</enum><header>Effective date of
		amendments</header><text>The amendments made by—</text>
							<paragraph id="ID405CABAA0062448FBDD7D7994C55369F"><enum>(1)</enum><text>paragraphs (2), (3), and
		(4) of section 606(a) of this Act take effect on December 31, 2014; and</text>
							</paragraph><paragraph id="ID608BE3645B454BDA8FC898B69102BF37"><enum>(2)</enum><text>section 606(f)(2) of this
		Act take effect on December 31, 2014.</text>
							</paragraph></subsection></section><section id="ID14EF93DD259F464C8A6130F0FE1AC89F"><enum>607.</enum><header>Maritime workforce
		study</header>
						<subsection id="ID98C63DD5D4F34D2EA79A5D10E798271E"><enum>(a)</enum><header>Training
		study</header><text>The Comptroller General of the United States shall conduct
		a study on the training needs of the maritime workforce.</text>
						</subsection><subsection id="IDDE12DFD562954864A824D51DFC2B10C0"><enum>(b)</enum><header>Study
		components</header><text>The study shall—</text>
							<paragraph id="ID47E5EAA4F70C47E0B488B2363475310A"><enum>(1)</enum><text>analyze the impact of
		training requirements imposed by domestic and international regulations and
		conventions, companies, and government agencies that charter or operate
		vessels;</text>
							</paragraph><paragraph id="ID17750945F6D742F989DC18E067BBDCA8"><enum>(2)</enum><text>evaluate the ability of
		the Nation's maritime training infrastructure to meet the current needs of the
		maritime industry;</text>
							</paragraph><paragraph id="IDE0EC718A463C4A379B09A37CA5A84CA2"><enum>(3)</enum><text>evaluate the ability of
		the Nation's maritime training infrastructure to effectively meet the needs of
		the maritime industry in the future;</text>
							</paragraph><paragraph id="IDD1414714CD754B4687803F458B044998"><enum>(4)</enum><text>identify trends in
		maritime training;</text>
							</paragraph><paragraph id="ID59543A02A13548EB9B55771176D9864C"><enum>(5)</enum><text>compare the training
		needs of U.S. mariners with the vocational training and educational assistance
		programs available from Federal agencies to evaluate the ability of Federal
		programs to meet the training needs of U.S. mariners;</text>
							</paragraph><paragraph id="ID8ED0BFB7EC2A43E5B08AEB949FD713B9"><enum>(6)</enum><text>include recommendations
		for future programs to enhance the capabilities of the Nation's maritime
		training infrastructure; and</text>
							</paragraph><paragraph id="IDDD48024819654D4D9AD5189C49401A98"><enum>(7)</enum><text>include recommendations
		for future programs to assist U.S. mariners and those entering the maritime
		profession achieve the required training.</text>
							</paragraph></subsection><subsection id="ID58A25F6DB19A4BB09C31AC7E712B4751"><enum>(c)</enum><header>Final
		report</header><text>Not later than 1 year after the date of enactment of this
		Act, the Comptroller General shall submit a report on the results of the study
		to the Committee on Commerce, Science, and Transportation of the Senate and the
		Committee on Transportation and Infrastructure of the House of
		Representatives.</text>
						</subsection></section><section id="ID8D64D7C1597B4F2E9DD783099A7918AC"><enum>608.</enum><header>Maritime
		administration vessel recycling contract award practices</header>
						<subsection id="IDD859AD23FBB74B088ABD7C751C630F9F"><enum>(a)</enum><header>In
		general</header><text>Not later than 12 months after the date of enactment of
		this Act, the Inspector General of the Department of Transportation shall
		conduct an assessment of the source selection procedures and practices used to
		award the Maritime Administration's National Defense Reserve Fleet vessel
		recycling contracts. The Inspector General shall assess the process,
		procedures, and practices used for the Maritime Administration's qualification
		of vessel recycling facilities. The Inspector General shall report the findings
		to the Committee on Commerce, Science, and Transportation and the Committee on
		Armed Services of the Senate, and the Committee on Transportation and
		Infrastructure and the Committee on Armed Services of the House of
		Representatives.</text>
						</subsection><subsection id="IDECB0DF0D453E4E609A7EC0DE2CB66F4B"><enum>(b)</enum><header>Assessment</header><text>The
		assessment under subsection (a) shall include a review of whether the Maritime
		Administration's contract source selection procedures and practices are
		consistent with law, the Federal Acquisition Regulations (FAR), and Federal
		best practices associated with making source selection decisions.</text>
						</subsection><subsection id="IDC19E189440F241CCBDF01F86BAD72C36"><enum>(c)</enum><header>Considerations</header><text>In
		making the assessment under subsection (a), the Inspector General may consider
		any other aspect of the Maritime Administration's vessel recycling process that
		the Inspector General deems appropriate to review.</text>
						</subsection></section><section id="id7B52827DEC2C4CCC8EEE1DD929D70E2E"><enum>609.</enum><header>Requirement for barge
		design</header><text display-inline="no-display-inline">Not later than 9 months
		after the date of enactment of this Act, the Administrator of the Maritime
		Administration shall complete the design for a containerized articulated barge
		identified in the Dual Use Vessel Study carried out by the Administrator and
		the Secretary of Defense that is able to utilize roll-on, roll-off or load-on,

					</section></title><title id="idb4493b60-68b8-41a0-9427-21c29c4b7c77"><enum>VII</enum><header>Miscellaneous</header>
					<section id="id3b2147c6-4460-4247-9f9b-e51b51bea26a"><enum>701.</enum><header>Limitation on
		availability of funds for procurement of alternative fuel</header><text display-inline="no-display-inline">None of the funds authorized to be
		appropriated by this Act or otherwise made available during fiscal year 2013 or
		2014 for the Coast Guard may be obligated or expended for the production or
		purchase of any alternative fuel if the cost of producing or purchasing the
		alternative fuel exceeds the cost of producing or purchasing a traditional
		fossil fuel that would be used for the same purpose as the alternative
		fuel.</text>
					</section><section id="id830F3CA9FE3F4259B67598698E397EFE"><enum>702.</enum><header>Passenger vessel
		security and safety requirements</header>
						<subsection id="id06762772C5194ADBA2FF7928E49BB29B"><enum>(a)</enum><header>Vessel design,
		equipment, construction, and retrofitting requirements</header><text>Section
		3507(a) of title 46, United States Code, is amended—</text>
							<paragraph id="idC2793762A040437288A9328B28581A73"><enum>(1)</enum><text>in paragraph (1)—</text>
								<subparagraph commented="no" id="id1F6B59E247FF4A2DA8ACB7936A84577A"><enum>(A)</enum><text>in the matter preceding
		subparagraph (A), by striking <quote>to which this subsection applies</quote>
		and inserting <quote>to which this section applies</quote>;</text>
								</subparagraph><subparagraph id="idA8D544D9D472463997219037000CFE00"><enum>(B)</enum><text>in subparagraph
		(A)—</text>

		subparagraph, the addition of an optional privacy cover on the interior side of
		the entry shall not in and of itself constitute an obstruction.</quote>;

								</subparagraph></paragraph><paragraph id="idB0DFFBEAEC0F4FCCA17E472C3AC43273"><enum>(2)</enum><text>in paragraph (3)—</text>
								<subparagraph id="id507B18D4B23940E78B225E51E632F14B"><enum>(A)</enum><text>by striking

								</subparagraph></paragraph></subsection><subsection id="idAE27B9DD87AE4FCAACB062588B75F4F7"><enum>(b)</enum><header>Video
		recording</header><text>Section 3507(b)(1) of title 46, United States Code, is
		amended to read as follows:</text>
							<quoted-block changed="added" display-inline="no-display-inline" id="id9A4575B103BC48DCAE8711DDE00241E8" reported-display-style="italic" style="OLC">
								<paragraph id="id93192588BBEF4BF78719DA95FBD91212"><enum>(1)</enum><header>Requirement to maintain
		  surveillance</header>
									<subparagraph id="idD218E1A670034C2F96AED1A932D319A6"><enum>(A)</enum><header>In
		  general</header><text>The owner of a vessel to which this section applies shall
		  maintain a video surveillance system to assist in documenting crimes on the
		  vessel and in providing evidence for the prosecution of such crimes, as
		  determined by the Secretary.</text>
									</subparagraph><subparagraph id="id2AE0E4DF6C2046629AA8B3A9F3D89A78"><enum>(B)</enum><header>Assessment</header><text>Not
		  later than 120 days after the date of enactment of the
		  <short-title>Coast Guard Authorization Act of
		  2012</short-title>, the owner of a vessel to which this section applies shall
		  perform and submit to the Commandant a criminal and passenger safety risk
		  assessment to determine the appropriate placement of video surveillance
		  equipment on the vessel. The assessment shall require consideration of camera
		  placement in areas where video surveillance may assist in documenting crimes on
		  the vessel and in providing evidence of such crimes. The assessment shall make
		  recommendations as to the appropriate placement of video surveillance equipment
		  throughout the vessel, including passenger and crew common areas where there is
		  no expectation of privacy, as to the frequency or infrequency of crimes in
		  areas of the vessel, and as to the use of cameras in areas of perceived higher
		  risk. The Commandant shall have authority to review, modify, and require
		  modifications to the assessment to provide for additional video coverage of a
		  vessel.</text>
									</subparagraph><subparagraph id="idD4906C8C452449F5BC54E69E5A46F4C5"><enum>(C)</enum><header>Interim retention
		  requirements</header><text>The owner of a vessel to which this section applies
		  shall retain all video images for a voyage for not less than 10 days after the
		  date that the images are recorded. If an incident described in subsection
		  (g)(3)(A)(i) is alleged and reported to law enforcement, all video images for a
		  voyage that the Federal Bureau of Investigation determines relevant
		  shall—</text>
										<clause id="id427444EA8BFB427D829D62F57B0D0D4D"><enum>(i)</enum><text>be provided to the
		  Federal Bureau of Investigation; and</text>
										</clause><clause id="id5FC907A3A95945BE91A9714F5EE5998E"><enum>(ii)</enum><text>be preserved by the
		  vessel owner for not less than 3 years from the date of the Federal Bureau of
		  Investigation's determination.</text>
										</clause></subparagraph><subparagraph id="id281337BF9F8944DB8D2D27AE3A7F682A"><enum>(D)</enum><header>Retention
		  requirements</header><text>Not later than 3 years after the date of enactment
		  of the <short-title>Coast Guard Authorization Act of
		  2012</short-title>, the Commandant, in consultation with the Federal Bureau of
		  Investigation, shall promulgate standards for the retention of video
		  surveillance records. The Commandant shall consider factors that would aid in
		  the investigation of serious crimes, including crimes that go unreported until
		  after the completion of a voyage. The Commandant shall consider the different
		  types of video surveillance systems and storage requirements in creating
		  standards both for vessels currently in operation and for vessels newly
		  built.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subsection><subsection id="id2F74A6350EA447DDB160E59D5147E741"><enum>(c)</enum><header>Sexual
		assault</header><text>Section 3507(d)(1) of title 46, United States Code, is
		amended by inserting <quote>(taking into consideration the length of the voyage
		and the number of passengers and crewmembers that the vessel can
		accommodate)</quote> after <quote>a sexual assault</quote>.</text>
						</subsection><subsection id="idCC11D121227249C39EFE1AB34C2650FA"><enum>(d)</enum><header>Crew access to
		passenger staterooms</header><text>Section 3507(f)(2) of title 46, United
		States Code, is amended by striking <quote>are fully and properly implemented
		and periodically reviewed.</quote> and inserting <quote>are fully and properly
		implemented, reviewed annually, and updated as necessary.</quote>.</text>
						</subsection><subsection id="id40578B4917E44F0D9A8472317BF7C955"><enum>(e)</enum><header>Log book and reporting
		requirements</header><text>Section 3507(g) of title 46, United States Code, is
		amended—</text>
							<paragraph id="id331C9581E8AD451885E2DA1928D68323"><enum>(1)</enum><text>by amending paragraph (1)
		to read as follows:</text>

		  crimes committed on any voyage that embarks or disembarks passengers in the
		  United States; and</text>
											</clause></subparagraph><subparagraph id="id2D5FE5DDAE6B40BFBF232B89043A7564"><enum>(B)</enum><text>make the log book and all
		  entries therein available, whether the log book and entries are maintained
		  onboard the vessel or at a centralized location off the vessel, upon request
		  to—</text>
											<clause id="id6A3B27A3D8EE4AA2A516C1095E69088A"><enum>(i)</enum><text>any agent of the Federal
		  Bureau of Investigation performing official duties in the course and scope of
		  an investigation;</text>
											</clause><clause id="id308C9FCD4CD240A9836A93C2EB596B2C"><enum>(ii)</enum><text>any member of the United
		  States Coast Guard performing official duties in the course and scope of an
		  investigation; and</text>
											</clause><clause id="idAE811ABC711B43758055919D16B1CC14"><enum>(iii)</enum><text>any law enforcement
		  officer performing official duties in the course and scope of an
		  investigation.</text>
											</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
							</paragraph><paragraph id="idEA1E808AD2794BADA95E371BF2F93829"><enum>(2)</enum><text>in paragraph
		(3)(A)—</text>

		  recorded in each report filed under paragraph (3)(A)(i). Each such incident
		  shall be included in the statistical compilation regardless of whether the
		  incident is under investigation by the Federal Bureau of Investigation or not,
		  unless the Bureau determines through the investigative process the report to be
		  unfounded. If determined to be unfounded, the incident shall not be included in
		  the statistical compilation or shall be removed when the determination is made.
		  The data shall be updated no less frequently than quarterly, aggregated by
		  cruise line, each cruise line shall be identified by name and each crime and
		  alleged crime shall be identified as to whether it was committed or allegedly
		  committed by a passenger or crew member and against a passenger or crew member.
		  The Secretary shall also include on the Internet site a rate of crime,
		  comparable to that provided under the Uniform Crime Reporting Program, as
		  determined by the Federal Bureau of Investigation. The rate shall take into
		  account the total number of passengers and crew members carried by each
		  reporting cruise line on voyages that embark or disembark in the United States
		  during the reporting period, and shall be adjusted by the Bureau to reflect the
		  average length of time such persons were on board, as documented to the
		  Secretary by each reporting cruise line.</text>
											</clause><clause id="id8F1E7C54A6AA4D9D89EAAE3E558A153B"><enum>(ii)</enum><header>Definition of
		  unfounded</header><text>For purposes of this subparagraph, the term
		  <term>unfounded</term> means an allegation that is determined through the
		  course of an investigation to be false or
		  baseless.</text>
											</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
								</subparagraph><subparagraph id="id0CC23184771F4101B911CF01A808CE23"><enum>(B)</enum><text>by redesignating
		subparagraph (B) as subparagraph (C);</text>
								</subparagraph><subparagraph id="idC832EF2F2E7242C88C2D4D0113E25EC4"><enum>(C)</enum><text>by inserting after

								</subparagraph><subparagraph id="id8206904AE492479BA170ACD1C470C934"><enum>(D)</enum><text>in subparagraph (C), as
		redesignated—</text>
									<clause id="id48675019178245F48C37A439568925C0"><enum>(i)</enum><text>by striking <quote>taking
		on or discharging</quote> and inserting <quote>that takes on or

							</paragraph></subsection></section><section id="id1148da5f-4049-4a54-9e98-bf0b186473f6"><enum>703.</enum><header>Oil spill liability
		trust fund investment amount</header><text display-inline="no-display-inline">Not later than 30 days after the date of
		enactment of this Act, the Secretary of the Treasury shall increase the amount
		invested in income producing securities under section 5006(b) of the Oil
		Pollution Act of 1990 (33 U.S.C. 2736(b)) by $12,851,340.</text>
					</section><section id="idB410F103792843E6BFA5A7F537F9C84F"><enum>704.</enum><header>Vessel
		determinations</header>
						<subsection id="idC2A8106720514881AE2C2693DE7EE926"><enum>(a)</enum><header>Vessels Deemed New
		Vessels</header><text display-inline="yes-display-inline">The vessel with
		United States official number 981472 and the vessel with United States official
		number 988333 shall each be deemed to be a new vessel effective on the date of
		delivery after January 1, 2008, from a privately owned United States shipyard
		if no encumbrances are on record with the United States Coast Guard at the time
		of the issuance of the new vessel certificate of documentation for each
		vessel.</text>
						</subsection><subsection id="id9EFA3B9F4085464F921B7339E5CF0526"><enum>(b)</enum><header>Safety
		Inspection</header><text display-inline="yes-display-inline">Each vessel under
		subsection (a) shall be subject to the vessel safety and inspection
		requirements of title 46, United States Code (as in effect on the day before
		the date of enactment of this Act), applicable to any such vessel.</text>
						</subsection></section><section id="idAF046BF79AAD42F2851CBA116CE0DBA5"><enum>705.</enum><header>Alteration of bridge
		obstructing navigation</header>
						<subsection id="idE4E9BDBC68F047A4AE44663C2EF12152"><enum>(a)</enum><header>Requirement to commence
		administrative review</header><text display-inline="yes-display-inline">Not
		later than 15 days after the date of enactment of this Act, the Secretary of
		the department in which the Coast Guard is operating shall certify to the
		Committee on Commerce, Science, and Transportation of the Senate and the
		Committee on Transportation and Infrastructure of the House of Representatives
		that the Coast Guard has commenced the required interagency administrative
		review of the pending proposal to alter the bridge that is unreasonably
		obstructing navigation and that spans the Kill Van Kull, connecting Bayonne,
		New Jersey, and Staten Island, New York.</text>
						</subsection><subsection id="id8BAE88FF441E4004AEE4F1165D3E71ED"><enum>(b)</enum><header>Expedited
		Process</header><text display-inline="yes-display-inline">The
		Commandant—</text>
							<paragraph id="id620EACBA8E814B799A0D31D2E1668480"><enum>(1)</enum><text display-inline="yes-display-inline">shall expedite the interagency
		administrative review under subsection (a); and</text>
							</paragraph><paragraph id="id0CEEF08C53574734991853A2F862F310"><enum>(2)</enum><text display-inline="yes-display-inline">may use any resources offered to the Coast
		Guard by the bridge owner for the purpose of paragraph (1).</text>
							</paragraph></subsection><subsection id="id20B18E20AB704719BB77D6CE470A824B"><enum>(c)</enum><header>Deadline for
		Completion</header><text display-inline="yes-display-inline">Not later than
		November 30, 2012, the Coast Guard shall complete the interagency
		administrative review under subsection (a).</text>
						</subsection></section><section id="id2A06818A00F74DB0A680312E4B40224A"><enum>706.</enum><header>Notice of
		arrival</header><text display-inline="no-display-inline">The regulations
		required under section 109(a) of the Security and Accountability For Every Port
		Act of 2006 (33 U.S.C. 1223 note) dealing with notice of arrival requirements
		for foreign vessels on the Outer Continental Shelf shall not apply to a vessel
		documented under section 12105 of title 46, United States Code, unless the
		vessel arrives from a foreign port or place.</text>
					</section><section id="id9D39D2F1118044C8AFA498F51B81E2DE"><enum>707.</enum><header>Waivers</header>
						<subsection id="id1FBE3D990E80489CA0BB9515CB084FC2"><enum>(a)</enum><header>F/V TEXAS STAR
		CASINO</header><text display-inline="yes-display-inline">Notwithstanding
		subchapter II of chapter 121 and chapter 551 of title 46, United States Code,
		the Secretary of the department in which the Coast Guard is operating may issue
		a fishery endorsement and a license under chapter 121 for the fishing vessel
		TEXAS STAR CASINO (IMO number 7722047).</text>
						</subsection><subsection id="id71488FA0E6074BED926C4B65F03D6796"><enum>(b)</enum><header>RANGER
		III</header><text display-inline="yes-display-inline">Section 3703a of title
		46, United States Code, does not apply to the passenger vessel RANGER III
		(United States official number 277361), so long as it is owned and operated by
		the National Park Service.</text>
						</subsection></section><section id="id9E02569DF3D1469A9372737231FAB211"><enum>708.</enum><header>Budgetary
		effects</header><text display-inline="no-display-inline">The budgetary effects
		of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act
		of 2010 (2 U.S.C. 931 et seq.), shall be determined by reference to the latest
		statement titled “Budgetary Effects of PAYGO Legislation” for this Act,
		submitted for printing in the Congressional Record by the Chairman of the
		Senate Budget Committee, provided that such statement has been submitted prior
		to the vote on passage.</text>
					</section><section id="ideb0a8fdf-5434-4600-a78e-717519a37a5d"><enum>709.</enum><header>Technical
		amendments</header>
						<subsection id="id4a99bb2e-16fe-4612-a88a-bf7363ad24ba"><enum>(a)</enum><header>Continuation on active
		duty</header><text>Section 290(a) of title 14, United States Code, is amended
