<section id="H3FD74FA0B03E4835A553CBCCAADF445C"><enum>101.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Funds are authorized to be appropriated for each of fiscal years 2013 and 2014 for necessary expenses of the Coast Guard as follows:</text> 
<paragraph id="H4A9A7337EEEF4387874E7B405E239B11"><enum>(1)</enum><text>For the operation and maintenance of the Coast Guard—</text> 
<subparagraph id="H9B899F718BEF483D96343B3F63881317"><enum>(A)</enum><text display-inline="yes-display-inline">$6,882,645,000 for fiscal year 2013; and</text></subparagraph> 
<subparagraph id="HEDF5940C8E2B4E2CB30D9F5E853DB573"><enum>(B)</enum><text>$6,981,036,000 for fiscal year 2014;</text></subparagraph><continuation-text continuation-text-level="paragraph">of which $24,500,000 is authorized each fiscal year to be derived from the Oil Spill Liability Trust Fund to carry out the purposes of section 1012(a)(5) of the Oil Pollution Act of 1990 (33 U.S.C. 2712(a)(5)).</continuation-text></paragraph> 
<paragraph id="HF2D7076FE9E74F43A2E8F0DF61703F39"><enum>(2)</enum><text>For the acquisition, construction, rebuilding, and improvement of aids to navigation, shore and offshore facilities, vessels, and aircraft, including equipment related thereto—</text>

<section id="HF2AE84DE64804561BFA8E5847035F589"><enum>102.</enum><header>Authorized levels of military strength and training</header> 
<subsection id="HF7511AC6C1C145E7888BEE61ED40AE2A"><enum>(a)</enum><header>Active duty strength</header><text>The Coast Guard is authorized an end-of-year strength for active duty personnel of 47,000 for each of fiscal years 2013 and 2014.</text></subsection> 
<subsection id="H2EFC569CD7904CE09372DD2992B0A32B"><enum>(b)</enum><header>Military training student loads</header><text>The Coast Guard is authorized average military training student loads for each of fiscal years 2013 and 2014 as follows:</text> 
<paragraph id="H7DB119361D7B4048A2D0001F97DD3834"><enum>(1)</enum><text>For recruit and special training, 2,500 student years.</text></paragraph> 
<paragraph id="HECAA943C74324CBBB02901EF7A09948C"><enum>(2)</enum><text>For flight training, 165 student years.</text></paragraph> 
<paragraph id="HCF92947C118742099725887751FA0970"><enum>(3)</enum><text>For professional training in military and civilian institutions, 350 student years.</text></paragraph>

<title id="HC14B584781754199A5373948EB105742"><enum>II</enum><header>Coast Guard</header> 
<section commented="no" id="H32D743B5332F4DA5AE95863F6CC1E76C"><enum>201.</enum><header>Interference with Coast Guard transmissions</header><text display-inline="no-display-inline">Section 88 of title 14, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H2AA23DCCF8A04A3DB5B8E7270C459427" style="USC"> 
<subsection commented="no" id="H879E21EC7E4D4D7DBAB6CA6697B7EE1A"><enum>(e)</enum><text>An individual who knowingly and willfully operates a device with the intention of interfering with the broadcast or reception of a radio, microwave, or other signal (including a signal from a global positioning system) transmitted, retransmitted, or augmented by the Coast Guard for the purpose of maritime safety is—</text> 
<paragraph commented="no" id="H377B52E50E2E4265AC3CD013C7E5CC84"><enum>(1)</enum><text>guilty of a class E felony; and</text></paragraph> 
<paragraph commented="no" id="HC08F268C881148548C365A9BE215759A"><enum>(2)</enum><text>subject to a civil penalty of not more than $1,000 per day for each violation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3CEE145C5C9B4A5EA870D3ABFA44AA73"><enum>202.</enum><header>Coast Guard authority to operate and maintain Coast Guard assets</header><text display-inline="no-display-inline">Section 93 of title 14, United States Code, is amended by adding at the end the following:</text>

<subsection id="H92BDF7BFDDF04630BBA4086493722434"><enum>(e)</enum><header>Operation and maintenance of Coast Guard assets and facilities</header><text display-inline="yes-display-inline">All authority, including programmatic budget authority, for the operation and maintenance of Coast Guard vessels, aircraft, systems, aids to navigation, infrastructure, and other assets or facilities shall be allocated to and vested in the Coast Guard and the department in which the Coast Guard is operating.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section commented="no" display-inline="no-display-inline" id="H6CDB2D7D236E48A18BB8AD4212627BDF" section-type="subsequent-section"><enum>203.</enum><header>Limitation on expenditures</header><text display-inline="no-display-inline">Section 149(d) of title 14, United States Code, is amended by adding at the end the following:</text>

<section id="HF0954871BEBD47DF91B8083D1E75985A"><enum>205.</enum><header>Policy on sexual harassment and sexual violence</header> 
<subsection id="H3C9082D752194A4E83B46E7DCC2BFC6D"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Chapter 9 of title 14, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H8C239B1301CB4F9C951AC3CA6E1DFF9D" display-inline="no-display-inline"> 
<section id="H56A03D8A5ECC4FF0BAED7895244FEDB6"><enum>200.</enum><header>Policy on sexual harassment and sexual violence</header> 
<subsection id="HC3109811CF7747AC9A852B79D007621B"><enum>(a)</enum><header>Required policy</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard shall direct the Superintendent of the Coast Guard Academy to prescribe a policy on sexual harassment and sexual violence applicable to the cadets and other personnel of the Academy. </text></subsection> 
<subsection id="H4DC1EE8189F142869243B4C534F22497"><enum>(b)</enum><header>Matters To be specified in policy</header><text>The policy on sexual harassment and sexual violence under this section shall include specification of the following: </text> 
<paragraph id="HFE09071592E749D99F6BBFA179D660F7"><enum>(1)</enum><text>Programs to promote awareness of the incidence of rape, acquaintance rape, and other sexual offenses of a criminal nature that involve cadets or other Academy personnel. </text></paragraph> 
<paragraph id="H3A0827D405AF4290AB99D03007C4EEE5"><enum>(2)</enum><text>Information about how the Coast Guard and the Academy will protect the confidentiality of victims of sexual harassment or sexual violence, including how any records, statistics, or reports intended for public release will be formatted such that the confidentiality of victims is not jeopardized.</text></paragraph> 
<paragraph id="HE1CF7A033F5C4957A2318BA64E340043"><enum>(3)</enum><text>Procedures that cadets and other Academy personnel should follow in the case of an occurrence of sexual harassment or sexual violence, including—</text> 
<subparagraph id="HE5D9F34BDC374C56BF86F4A5419D9B17"><enum>(A)</enum><text>if the victim chooses to report an occurrence of sexual harassment or sexual violence, a specification of the person or persons to whom the alleged offense should be reported and options for confidential reporting, including written information to be given to victims that explains how the Coast Guard and the Academy will protect the confidentiality of victims; </text></subparagraph> 
<subparagraph id="H08B6BFFF828F44D69CB0AF2F49FC5C88"><enum>(B)</enum><text>a specification of any other person whom the victim should contact; and </text></subparagraph> 
<subparagraph id="HEB629AD38B5F4C76B80C25C087AF07A8"><enum>(C)</enum><text>procedures on the preservation of evidence potentially necessary for proof of criminal sexual assault. </text></subparagraph></paragraph> 
<paragraph id="H428A25A24C4443DCB870B8766B4FEA66"><enum>(4)</enum><text>Procedures for disciplinary action in cases of criminal sexual assault involving a cadet or other Academy personnel. </text></paragraph> 
<paragraph id="HE61BD69D582843D68F4F082DF97FABB1"><enum>(5)</enum><text>Sanctions authorized to be imposed in a substantiated case of sexual harassment or sexual violence involving a cadet or other Academy personnel, including with respect to rape, acquaintance rape, or other criminal sexual offense, whether forcible or nonforcible.</text></paragraph> 
<paragraph id="H123E81BBDFE642F7811B3732FF243BA3"><enum>(6)</enum><text>Required training on the policy for all cadets and other Academy personnel who process allegations of sexual harassment or sexual violence involving a cadet or other Academy personnel. </text></paragraph></subsection> 
<subsection id="HF424D511216C44AB9CB165DCF1399322"><enum>(c)</enum><header>Assessment</header> 
<paragraph id="HE78052C33AAA4639888D6A70D61B609D"><enum>(1)</enum><header>In general</header><text>The Commandant shall direct the Superintendent to conduct at the Academy during each Academy program year an assessment to determine the effectiveness of the policies of the Academy with respect to sexual harassment and sexual violence involving cadets or other Academy personnel.</text></paragraph> 
<paragraph id="H0BAD9A9C64AA4E47A9B6374D16C423A3"><enum>(2)</enum><header>Biennial survey</header><text>For the assessment at the Academy under paragraph (1) with respect to an Academy program year that begins in an odd-numbered calendar year, the Superintendent shall conduct a survey of cadets and other Academy personnel—</text> 
<subparagraph id="H2638A3C2E95A474093F9A3AD1E6EEB6C"><enum>(A)</enum><text>to measure—</text> 
<clause id="HC0406ECF97AE42E6A40C26FC314B9F5F"><enum>(i)</enum><text>the incidence, during that program year, of sexual harassment and sexual violence events, on or off the Academy reservation, that have been reported to an official of the Academy; and </text></clause> 
<clause id="H12F49DAF64864D55ACB3C6DD70CA2CFA"><enum>(ii)</enum><text>the incidence, during that program year, of sexual harassment and sexual violence events, on or off the Academy reservation, that have not been reported to an official of the Academy; and</text></clause></subparagraph> 
<subparagraph id="HCC9C1B6BDF194C66854CC8A0A93EF261"><enum>(B)</enum><text>to assess the perceptions of the cadets and other Academy personnel with respect to—</text> 
<clause id="H21C2F0DEF2614163A394054E55BDBD36"><enum>(i)</enum><text>the Academy’s policies, training, and procedures on sexual harassment and sexual violence involving cadets or other Academy personnel; </text></clause> 
<clause id="H131F0FE00BC14AB2B4F6E244B6038EA3"><enum>(ii)</enum><text>the enforcement of such policies; </text></clause> 
<clause id="H2BF5D39C6BA74E1EADE82CE83D624A49"><enum>(iii)</enum><text>the incidence of sexual harassment and sexual violence involving cadets or other Academy personnel; and </text></clause> 
<clause id="HC9314F17A4F54AF2B4E194C7EF483124"><enum>(iv)</enum><text>any other issues relating to sexual harassment and sexual violence involving cadets or other Academy personnel.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H0A7500969F664EA3A6921305BB8DB53C"><enum>(d)</enum><header>Report</header> 
<paragraph id="HC080D74F79EA40EABF30B306DA48D4F5"><enum>(1)</enum><header>In general</header><text>The Commandant shall direct the Superintendent to submit to the Commandant a report on sexual harassment and sexual violence involving cadets or other Academy personnel for each Academy program year.</text></paragraph> 
<paragraph id="H90F18642C3694D47889900310DF8CBED"><enum>(2)</enum><header>Report specifications</header><text>Each report under paragraph (1) shall include, for the Academy program year covered by the report, the following:</text> 
<subparagraph id="H568B18D4BEDA42F48079D1BE1A78E2F8"><enum>(A)</enum><text>The number of sexual assaults, rapes, and other sexual offenses involving cadets or other Academy personnel that have been reported to Academy officials during the Academy program year and, of those reported cases, the number that have been substantiated.</text></subparagraph> 
<subparagraph id="H1281214B9E8D46389BF4D7B6D3440D89"><enum>(B)</enum><text>A plan for the actions that are to be taken in the following Academy program year regarding prevention of and response to sexual harassment and sexual violence involving cadets or other Academy personnel.</text></subparagraph></paragraph> 
<paragraph id="H5F41E083980948D6856BC230852A942A"><enum>(3)</enum><header>Biennial survey</header><text>Each report under paragraph (1) for an Academy program year that begins in an odd-numbered calendar year shall include the results of the survey conducted in that Academy program year under subsection (c)(2).</text></paragraph> 
<paragraph id="H44D723AC8BE04DB4BDFC23491B7A2CD2"><enum>(4)</enum><header>Transmission of report</header><text>The Commandant shall transmit each report received by the Commandant under this subsection, together with the Commandant's comments on the report, to—</text> 
<subparagraph id="HC3DB45A5C4AA43A78AE5951177C627D3"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph> 
<subparagraph id="H55469D1FD3124AED9A2BCA8BBBADDF6C"><enum>(B)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives.</text></subparagraph></paragraph> 
<paragraph id="HC1C33532EEA14784AA3506AE734CCCDA"><enum>(5)</enum><header>Focus groups</header> 
<subparagraph id="H08796A3E2793426EB499C02ADFB129B8"><enum>(A)</enum><header>In general</header><text>For each Academy program year with respect to which the Superintendent is not required to conduct a survey at the Academy under subsection (c)(2), the Commandant shall require focus groups to be conducted at the Academy for the purposes of ascertaining information relating to sexual assault and sexual harassment issues at the Academy. </text></subparagraph> 
<subparagraph id="H3720B7BB86154EE49EDB660B3713EC2F"><enum>(B)</enum><header>Inclusion in reports</header><text>Information derived from a focus group under subparagraph (A) shall be included in the next transmitted Commandant's report under this subsection.</text></subparagraph></paragraph></subsection> 
<subsection id="H49957B54FD9F49588B2C1B54945405D3"><enum>(e)</enum><header>Victim confidentiality</header><text>To the extent that information collected under the authority of this section is reported or otherwise made available to the public, such information shall be provided in a form that is consistent with applicable privacy protections under Federal law and does not jeopardize the confidentiality of victims.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCDE78D4E974E4098913D5F54F8815F7F"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for chapter 9 of title 14, United States Code, is amended by inserting after the item relating to section 199 the following:</text>

<subparagraph id="H91DB324571D84B2281CA5F987AA92BA7"><enum>(A)</enum><text display-inline="yes-display-inline">an officer or former officer was not considered for selection for promotion by a selection board convened under section 251; or</text></subparagraph> 
<subparagraph id="H72A8CBF93A2443909EE06A77F0B9AFB3"><enum>(B)</enum><text display-inline="yes-display-inline">the name of an officer or former officer was not placed on an all-fully-qualified-officers list;</text></subparagraph><continuation-text continuation-text-level="paragraph">the Secretary shall convene a special selection board to determine whether such officer or former officer should be recommended for promotion and such officer or former officer shall not be considered to have failed of selection for promotion prior to the consideration of the special selection board.</continuation-text></paragraph> 
<paragraph id="H66E63FD5BC9F496A825993E21D422445"><enum>(2)</enum><header>Effect of failure to recommend for promotion</header><text display-inline="yes-display-inline">If a special selection board convened under paragraph (1) does not recommend for promotion an officer or former officer, whose grade is below the grade of captain and whose name was referred to that board for consideration, the officer or former officer shall be considered to have failed of selection for promotion.</text></paragraph></subsection> 
<subsection id="HEF3DAAD157B34427BC16D5422E29C5D7"><enum>(b)</enum><header>Officers considered But not selected; material error</header> 
<paragraph id="HC513D8EE79924B54929311C8A402D77E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of an officer or former officer who was eligible for promotion, was considered for selection for promotion by a selection board convened under section 251, and was not selected for promotion by that board, the Secretary may convene a special selection board to determine whether the officer or former officer should be recommended for promotion, if the Secretary determines that—</text> 
<subparagraph commented="no" id="H1B2D6FB81EE74E7486B7084CB9E73A72"><enum>(A)</enum><text display-inline="yes-display-inline">an action of the selection board that considered the officer or former officer—</text> 
<clause commented="no" id="HCA4962AD0C4A42A7B93488FDB8873907"><enum>(i)</enum><text display-inline="yes-display-inline">was contrary to law in a matter material to the decision of the board; or</text></clause> 
<clause commented="no" id="H5354579A88DB4D03A5B8DAAA50801861"><enum>(ii)</enum><text>involved material error of fact or material administrative error; or</text></clause></subparagraph> 
<subparagraph commented="no" id="H80541438E0DD46229FA3B786259318A4"><enum>(B)</enum><text display-inline="yes-display-inline">the selection board that considered the officer or former officer did not have before it for consideration material information.</text></subparagraph></paragraph> 
<paragraph id="H1D9848F7A4494471AB1DA2EFE90BBD3F"><enum>(2)</enum><header>Effect of failure to recommend for promotion</header><text display-inline="yes-display-inline">If a special selection board convened under paragraph (1) does not recommend for promotion an officer or former officer, whose grade is that of commander or below and whose name was referred to that board for consideration, the officer or former officer shall be considered—</text> 
<subparagraph id="H34A73007FFAE4567B0E1AA974755A2FA"><enum>(A)</enum><text>to have failed of selection for promotion with respect to the board that considered the officer or former officer prior to the consideration of the special selection board; and</text></subparagraph> 
<subparagraph id="HD16C436B8B3448FFB06B750DA1DB2B1A"><enum>(B)</enum><text>to incur no additional failure of selection for promotion as a result of the action of the special selection board.</text></subparagraph></paragraph></subsection> 
<subsection id="H96EEE68A7D1F4747BF68774613E2C204"><enum>(c)</enum><header>Requirements for special selection boards</header><text display-inline="yes-display-inline">Each special selection board convened under this section shall—</text> 
<paragraph id="HC43491A4B5FC4BA29FEAE88C450B6BDE"><enum>(1)</enum><text display-inline="yes-display-inline">be composed in accordance with section 252 and the members of the board shall be required to swear the oaths described in section 254;</text></paragraph> 
<paragraph id="HF548080BFAD244479E3876BB9DC8DC00"><enum>(2)</enum><text display-inline="yes-display-inline">consider the record of an applicable officer or former officer as that record, if corrected, would have appeared to the selection board that should have considered or did consider the officer or former officer prior to the consideration of the special selection board and that record shall be compared with a sampling of the records of—</text> 
<subparagraph id="H7C3B7BAB6F184D07AD0F433D184489AA"><enum>(A)</enum><text>those officers of the same grade who were recommended for promotion by such prior selection board; and</text></subparagraph> 
<subparagraph id="HCFBB9C1FEBDE41889DE6E10BEE848616"><enum>(B)</enum><text>those officers of the same grade who were not recommended for promotion by such prior selection board; and</text></subparagraph></paragraph> 
<paragraph id="H8BCB1353D1B043BBADDD7A9B83846BE0"><enum>(3)</enum><text display-inline="yes-display-inline">submit to the Secretary a written report in a manner consistent with sections 260 and 261.</text></paragraph></subsection> 
<subsection id="H43B1B45D6A0B4B1890689DDEAC5E4126"><enum>(d)</enum><header>Appointment of officers recommended for promotion</header> 
<paragraph id="H8816E6BD625E4A0B86A49679ED29878A"><enum>(1)</enum><header>In general</header><text>An officer or former officer whose name is placed on a promotion list as a result of the recommendation of a special selection board convened under this section shall be appointed, as soon as practicable, to the next higher grade in accordance with the law and policies that would have been applicable to the officer or former officer had the officer or former officer been recommended for promotion by the selection board that should have considered or did consider the officer or former officer prior to the consideration of the special selection board.</text></paragraph> 
<paragraph id="H5F30150F3FAB4186BFB03BE236C16A8A"><enum>(2)</enum><header>Effect</header><text display-inline="yes-display-inline">An officer or former officer who is promoted to the next higher grade as a result of the recommendation of a special selection board convened under this section shall have, upon such promotion, the same date of rank, the same effective date for the pay and allowances of that grade, and the same position on the active duty promotion list as the officer or former officer would have had if the officer or former officer had been recommended for promotion to that grade by the selection board that should have considered or did consider the officer or former officer prior to the consideration of the special selection board.</text></paragraph> 
<paragraph id="HCD688C32536D42329698557FFB81F772"><enum>(3)</enum><header>Record correction</header><text display-inline="yes-display-inline">If the report of a special selection board convened under this section, as approved by the President, recommends for promotion to the next higher grade an officer not eligible for promotion or a former officer whose name was referred to the board for consideration, the Secretary may act under section 1552 of title 10 to correct the military record of the officer or former officer to correct an error or remove an injustice resulting from the officer or former officer not being selected for promotion by the selection board that should have considered or did consider the officer or former officer prior to the consideration of the special selection board.</text></paragraph></subsection> 
<subsection id="HED98B93B354542D18C38CE90093A912A"><enum>(e)</enum><header>Application process and time limits</header><text display-inline="yes-display-inline">The Secretary shall issue regulations regarding the process by which an officer or former officer may apply to have a matter considered by a special selection board convened under this section, including time limits related to such applications.</text></subsection> 
<subsection commented="no" id="H3EC91C6D7498426EA8B5404C592D0B54"><enum>(f)</enum><header>Limitation of other jurisdiction</header><text display-inline="yes-display-inline">No official or court of the United States shall have authority or jurisdiction over any claim based in any way on the failure of an officer or former officer to be selected for promotion by a selection board convened under section 251, until—</text> 
<paragraph commented="no" id="HE0EF28EB45364A9EB8E7A9FCE45FA404"><enum>(1)</enum><text display-inline="yes-display-inline">the claim has been referred to a special selection board convened under this section and acted upon by that board; or</text></paragraph> 
<paragraph commented="no" id="HF70B9CAB81A04C52BC147F914287397E"><enum>(2)</enum><text display-inline="yes-display-inline">the claim has been rejected by the Secretary without consideration by a special selection board convened under this section.</text></paragraph></subsection> 
<subsection commented="no" id="HCA8C37EBCB1D47D6B5E74FAA7FCFF608"><enum>(g)</enum><header>Judicial review</header> 
<paragraph commented="no" id="HD2CACEA6C30A46559DECE356EF9D03E7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A court of the United States may review—</text> 
<subparagraph commented="no" id="H5F3F41CBE6A443408DD6AB9E77801B7B"><enum>(A)</enum><text display-inline="yes-display-inline">a decision of the Secretary not to convene a special selection board under this section to determine if the court finds that the decision of the Secretary was arbitrary or capricious, not based on substantial evidence, or otherwise contrary to law; and</text></subparagraph> 
<subparagraph commented="no" id="H5D52A802DE5E4E9596AA37ABF9B3928A"><enum>(B)</enum><text display-inline="yes-display-inline">an action of a special selection board under this section to determine if the court finds that the action of the special selection board was contrary to law or involved material error of fact or material administrative error.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H7C5B40578E1B4A5FB3E07C80639E74CB"><enum>(2)</enum><header>Remand and reconsideration</header><text>If, with respect to a review under paragraph (1), a court makes a finding described in subparagraph (A) or (B) of that paragraph, the court shall remand the case to the Secretary and the Secretary shall provide the applicable officer or former officer consideration by a new special selection board convened under this section.</text></paragraph></subsection> 
<subsection id="H9DE57A30C16C44AB8A98534973E9E45E"><enum>(h)</enum><header>Designation of boards</header><text display-inline="yes-display-inline">The Secretary may designate a selection board convened under section 251 as a special selection board convened under this section. A selection board so designated may function in the capacity of a selection board convened under section 251 and a special selection board convened under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H3FADC3E0388349D29D256589CC4DCECA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may require a Physical Evaluation Board to reevaluate any covered individual if the Secretary determines there is reason to believe that a medical condition of the covered individual considered by a Physical Evaluation Board during an evaluation of the covered individual renders the covered individual unsuitable for continued duty.</text></paragraph> 
<paragraph id="H1798941238994766BBA12651798DB298"><enum>(2)</enum><header>Retirements and separations</header><text display-inline="yes-display-inline">A covered individual who is determined, based on a reevaluation under paragraph (1), to be unfit to perform the duties of the covered individual’s office, grade, rank, or rating may be retired or separated for physical disability under this chapter.</text></paragraph></subsection>

<subsection id="H967A9AFFFDDD4A6C8510F5B2DD7A99AF"><enum>(b)</enum><header>Information To be included</header><text>Each report under subsection (a) shall include for each major acquisition program—</text> 
<paragraph id="H0A9C8AC406544B71865DA316D189CF86"><enum>(1)</enum><text display-inline="yes-display-inline">a statement of the Coast Guard’s mission needs and performance goals relating to such program, including a justification for any change to those needs and goals subsequent to a report previously submitted under this section;</text></paragraph> 
<paragraph id="H854E6523057349629257C174C8C6E0F9"><enum>(2)</enum><text>a justification explaining how the projected number and capabilities of assets acquired under such program meet applicable mission needs and performance goals;</text></paragraph> 
<paragraph id="H6612C7EFBA7749838DA66AAF906EA038"><enum>(3)</enum><text>an identification of any and all mission hour gaps, accompanied by an explanation of how and when the Coast Guard will close those gaps;</text></paragraph> 
<paragraph id="H925057C36CB84384A55BD05A48880E41"><enum>(4)</enum><text>an identification of any changes with respect to such program, including—</text> 
<subparagraph id="H7011A562638943189EFB89090E75E93F"><enum>(A)</enum><text>any changes to the timeline for the acquisition of each new asset and the phaseout of legacy assets; and</text></subparagraph> 
<subparagraph id="H2B676280474D4C99A1D23924B2E2058A"><enum>(B)</enum><text>any changes to—</text> 
<clause id="H155CA03477774B388C988D1903794578"><enum>(i)</enum><text>the costs of new assets or legacy assets for that fiscal year or future fiscal years; or</text></clause> 
<clause id="HD8DDA18B0521432E91984A30E1148338"><enum>(ii)</enum><text>the total acquisition cost;</text></clause></subparagraph></paragraph> 
<paragraph id="HDD53E86AABA649D08D791B2D4D77CA6C"><enum>(5)</enum><text>a justification explaining how any change to such program fulfills the mission needs and performance goals of the Coast Guard;</text></paragraph> 
<paragraph id="H64E5E03F47614320876051CE7DDCA462"><enum>(6)</enum><text>a description of how the Coast Guard is planning for the integration of each new asset acquired under such program into the Coast Guard, including needs related to shore-based infrastructure and human resources;</text></paragraph> 
<paragraph id="H3864C0E4E36E4CB2B891EBABD5FBDE19"><enum>(7)</enum><text>an identification of how funds in the applicable fiscal year’s budget request will be allocated, including information on the purchase of specific assets;</text></paragraph> 
<paragraph id="H8AE4BC8B189143369F7598D72DA5A463"><enum>(8)</enum><text>a projection of the remaining operational lifespan and life-cycle cost of each legacy asset that also identifies any anticipated resource gaps;</text></paragraph> 
<paragraph id="H0907AAC60387489DA9DD34EE4E2FE28A"><enum>(9)</enum><text>a detailed explanation of how the costs of legacy assets are being accounted for within such program; and</text></paragraph> 
<paragraph id="H1DD2F45DD1984238ABD28086F873F244"><enum>(10)</enum><text>an annual performance comparison of new assets to legacy assets.</text></paragraph></subsection> 
<subsection id="HF6F0CD6C3CE7436491FD69EDDAB11DF0"><enum>(c)</enum><header>Adequacy of acquisition workforce</header><text display-inline="yes-display-inline">Each report under subsection (a) shall—</text> 
<paragraph id="HEC88421C15E34D9493ACB27DB59E0396"><enum>(1)</enum><text display-inline="yes-display-inline">include information on the scope of the acquisition activities to be performed in the next fiscal year and on the adequacy of the current acquisition workforce to meet that anticipated workload;</text></paragraph> 
<paragraph id="H07D1962F7B424A2AB0782220D7884C3B"><enum>(2)</enum><text display-inline="yes-display-inline">specify the number of officers, members, and employees of the Coast Guard currently and planned to be assigned to each position designated under section 562(c) of this subchapter; and</text></paragraph> 
<paragraph id="H0677665D143540E58623BF51B40986BB"><enum>(3)</enum><text display-inline="yes-display-inline">identify positions that are or will be understaffed and actions that will be taken to correct such understaffing.</text></paragraph></subsection> 
<subsection id="H2C412F69A8A34FB29DFE5383F128566C"><enum>(d)</enum><header>Cutters not maintained in class</header><text>Each report under subsection (a) shall identify which, if any, Coast Guard cutters that have been issued a certificate of classification by the American Bureau of Shipping have not been maintained in class, with an explanation detailing the reasons why the cutters have not been maintained in class.</text></subsection> 
<subsection id="HD34E4F0150D24E1F97349817814FDCE8"><enum>(e)</enum><header>Major acquisition program defined</header><text>In this section, the term <quote>major acquisition program</quote> means an ongoing acquisition undertaken by the Coast Guard with a life-cycle cost estimate greater than or equal to $300,000,000.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection>

<subsection id="H01D61FB7F5494E2B910B88371A6E19B6"><enum>(a)</enum><header>In general</header><text>Whenever the Commandant of the Coast Guard conducts an accident investigation of an accident involving an aircraft under the jurisdiction of the Commandant, the records and report of the investigation shall be treated in accordance with this section.</text></subsection> 
<subsection id="H4A860DCD3EED42D58E81948B3151498D"><enum>(b)</enum><header>Public disclosure of certain accident investigation information</header> 
<paragraph id="HE6D8A81FBE7245B7B9C437F8F8530226"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Commandant, upon request, shall publicly disclose unclassified tapes, scientific reports, and other factual information pertinent to an aircraft accident investigation.</text></paragraph> 
<paragraph id="H834B77482A35466EB976E352EEBAF98E"><enum>(2)</enum><header>Conditions</header><text>The Commandant shall only disclose information requested pursuant to paragraph (1) if the Commandant determines—</text> 
<subparagraph id="H154CF272E3264EDEA7BD6D7FA5A12CC5"><enum>(A)</enum><text>that such tapes, reports, or other information would be included within and releasable with the final accident investigation report; and</text></subparagraph> 
<subparagraph id="HD0B948F141104ED999D713E9D423B1AC"><enum>(B)</enum><text>that release of such tapes, reports, or other information—</text> 
<clause id="HEA2DE55B75F54648A8ACACC3317D12F1"><enum>(i)</enum><text>would not undermine the ability of accident or safety investigators to continue to conduct the investigation; and</text></clause> 
<clause id="H58BF1A50936C4DDDB698405596BCD6F4"><enum>(ii)</enum><text>would not compromise national security.</text></clause></subparagraph></paragraph> 
<paragraph id="H587FD984CF34420498E170C7C6C658BA"><enum>(3)</enum><header>Restriction</header><text>A disclosure under paragraph (1) may not be made by or through officials with responsibility for, or who are conducting, a safety investigation with respect to the accident.</text></paragraph></subsection> 
<subsection id="H8E1DDA40EF3249FBA3462429B887669C"><enum>(c)</enum><header>Opinions regarding causation of accident</header><text>Following an aircraft accident referred to in subsection (a)—</text> 
<paragraph id="HB3DF52DE032D44AF90B0FCB701F3F9B7"><enum>(1)</enum><text>if the evidence surrounding the accident is sufficient for the investigators who conduct the accident investigation to come to an opinion as to the cause or causes of the accident, the final report of the accident investigation shall set forth the opinion of the investigators as to the cause or causes of the accident; and</text></paragraph> 
<paragraph id="H2A44C4E7BFD54F55B2797218B08ACDF5"><enum>(2)</enum><text>if the evidence surrounding the accident is not sufficient for the investigators to come to an opinion as to the cause or causes of the accident, the final report of the accident investigation shall include a description of those factors, if any, that, in the opinion of the investigators, substantially contributed to or caused the accident.</text></paragraph></subsection> 
<subsection id="H5EEFF3A2C77F42FBB166C4610419F26A"><enum>(d)</enum><header>Use of information in civil or criminal proceedings</header><text>For purposes of any civil or criminal proceeding arising from an aircraft accident referred to in subsection (a), any opinion of the accident investigators as to the cause of, or the factors contributing to, the accident set forth in the accident investigation report may not be considered as evidence in such proceeding, nor may such report be considered an admission of liability by the United States or by any person referred to in such report.</text></subsection> 
<subsection id="HC42971367350472ABB62FE061628FFC9"><enum>(e)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="H7314A3D9C24E43CEB30EB80F1C3C44E9"><enum>(1)</enum><text>the term <quote>accident investigation</quote> means any form of investigation by Coast Guard personnel of an aircraft accident referred to in subsection (a), other than a safety investigation; and</text></paragraph> 
<paragraph id="H1818AAC6766549F2A2568443C1D5E6F8"><enum>(2)</enum><text>the term <quote>safety investigation</quote> means an investigation by Coast Guard personnel of an aircraft accident referred to in subsection (a) that is conducted solely to determine the cause of the accident and to obtain information that may prevent the occurrence of similar accidents.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H5CECFADC5FE34C83BB3BC47B8264195B"><enum>(3)</enum><text>administer laws and promulgate and enforce regulations for the promotion of safety of life and property on and under the high seas and waters subject to the jurisdiction of the United States, covering all matters not specifically delegated by law to some other executive department;</text></paragraph> 
<paragraph id="HF2A53EE6A57A4314845C3E409ECBD54F"><enum>(4)</enum><text>develop, establish, maintain, and operate, with due regard to the requirements of national defense, aids to maritime navigation, icebreaking facilities, and rescue facilities for the promotion of safety on, under, and over the high seas and waters subject to the jurisdiction of the United States;</text></paragraph> 
<paragraph id="HDFBA27CA4CC546DEAE507C6CE3915E15"><enum>(5)</enum><text>pursuant to international agreements, develop, establish, maintain, and operate icebreaking facilities on, under, and over waters other than the high seas and waters subject to the jurisdiction of the United States;</text></paragraph> 
<paragraph id="HB1970217BA2F4BFBADD48CCD847283B6"><enum>(6)</enum><text>engage in oceanographic research of the high seas and in waters subject to the jurisdiction of the United States; and</text></paragraph> 
<paragraph id="H1E93599C1C8F4FEABDA7F77687FFC072"><enum>(7)</enum><text>maintain a state of readiness to function as a specialized service in the Navy in time of war, including the fulfillment of Maritime Defense Zone command responsibilities.</text></paragraph></section> 
<section id="H44AE06BE83784BFEACD06FD24E407554"><enum>3.</enum><header>Department in which the Coast Guard operates</header> 
<subsection id="H03EDDB7B23474197BB518EF9B22A5042"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Coast Guard shall be a service in the Department of Homeland Security, except when operating as a service in the Navy.</text></subsection> 
<subsection id="H4DDB0254805F45969328977E072026F6"><enum>(b)</enum><header>Transfers</header><text display-inline="yes-display-inline">Upon the declaration of war if Congress so directs in the declaration or when the President directs, the Coast Guard shall operate as a service in the Navy, and shall so continue until the President, by Executive order, transfers the Coast Guard back to the Department of Homeland Security. While operating as a service in the Navy, the Coast Guard shall be subject to the orders of the Secretary of the Navy, who may order changes in Coast Guard operations to render them uniform, to the extent such Secretary deems advisable, with Navy operations.</text></subsection> 
<subsection id="H0CF50E78321F4302807EB03F5ADE54C3"><enum>(c)</enum><header>Operation as a service in the Navy</header><text display-inline="yes-display-inline">Whenever the Coast Guard operates as a service in the Navy—</text> 
<paragraph id="H84FB246FA00746629C1E28CE143D26B9"><enum>(1)</enum><text display-inline="yes-display-inline">applicable appropriations of the Navy Department shall be available for the expense of the Coast Guard;</text></paragraph> 
<paragraph id="H2CAB077B567343CDBAEF71CD7CF199CF"><enum>(2)</enum><text>applicable appropriations of the Coast Guard shall be available for transfer to the Navy Department;</text></paragraph> 
<paragraph id="H20CCEBD6BFC344FAB8F3CA6B77EE6A38"><enum>(3)</enum><text>precedence between commissioned officers of corresponding grades in the Coast Guard and the Navy shall be determined by the date of rank stated by their commissions in those grades;</text></paragraph> 
<paragraph id="HE21FDDF24DBB44A1B938A2C9534E77A5"><enum>(4)</enum><text>personnel of the Coast Guard shall be eligible to receive gratuities, medals, and other insignia of honor on the same basis as personnel in the naval service or serving in any capacity with the Navy; and</text></paragraph> 
<paragraph id="H355B408221F2446C9577693E3D3686A2"><enum>(5)</enum><text>the Secretary may place on furlough any officer of the Coast Guard and officers on furlough shall receive one half of the pay to which they would be entitled if on leave of absence, but officers of the Coast Guard Reserve shall not be so placed on furlough.</text></paragraph></subsection></section>

<section id="HCEC2B71D8F814F59BF8B757DFBF73AB5"><enum>219.</enum><header>Renewal of temporary early retirement authority</header><text display-inline="no-display-inline">For fiscal years 2013 through 2018—</text> 
<paragraph id="H1AC263C633C54E6D9411A92EE51EDC5B"><enum>(1)</enum><text display-inline="yes-display-inline">notwithstanding subsection (c)(2)(A) of section 4403 of the National Defense Authorization Act for Fiscal Year 1993 (10 U.S.C. 1293 note), such section shall apply to the Coast Guard in the same manner and to the same extent it applies to the Department of Defense, except that—</text> 
<subparagraph id="H744719F894AD47D7A437B788505B86C3"><enum>(A)</enum><text>the Secretary of Homeland Security shall implement such section with respect to the Coast Guard and, for purposes of that implementation, shall apply the applicable provisions of title 14, United States Code, relating to retirement of Coast Guard personnel; and</text></subparagraph> 
<subparagraph id="H4D6BE26C216B4C3496D3023056722A70"><enum>(B)</enum><text>the total number of commissioned officers who retire pursuant to this section may not exceed 200, and the total number of enlisted members who retire pursuant to this section may not exceed 300; and</text></subparagraph></paragraph> 
<paragraph id="HD5204637D729432F84906045617AA52A"><enum>(2)</enum><text>only appropriations available for necessary expenses for the operation and maintenance of the Coast Guard shall be expended for the retired pay of personnel who retire pursuant to this section.</text></paragraph></section> 
<section id="H3B885ECF7E6945F4ACE8A2B4315D53F1"><enum>220.</enum><header>Response Boat-Medium procurement</header> 
<subsection id="HA84E46E86E5342DE85AE4E2BAF8E1A3A"><enum>(a)</enum><header>Requirement To fulfill approved program of record</header><text>Except as provided in subsection (b), the Commandant of the Coast Guard shall maintain the schedule and requirements for the total acquisition of 180 boats as specified in the approved program of record for the Response Boat-Medium acquisition program in effect on June 1, 2012.</text></subsection> 
<subsection id="HF51B5EA5E75345F8B085DB6A48BF8E95"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subsection (a) shall not apply on and after the date on which the Commandant submits to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate such documentation as the Coast Guard Major Systems Acquisition Manual requires to justify reducing the approved program of record for Response Boat-Medium to a total acquisition of less than 180 boats.</text></subsection></section> 
<section id="HA4E65945BE9A46C3A7A1F03BFB2D05D1" section-type="subsequent-section"><enum>221.</enum><header>National Security Cutters</header> 
<subsection id="HEB78231790F64C57861043ED2F547F88"><enum>(a)</enum><header>In general</header> 
<paragraph id="H51427C2FAA594B82882B6E137C3A95D6"><enum>(1)</enum><header>Multiyear authority</header><text display-inline="yes-display-inline">In fiscal year 2013 and each fiscal year thereafter, the Secretary of the department in which the Coast Guard is operating may enter into, in accordance with section 2306b of title 10, United States Code, a multiyear contract for the procurement of Coast Guard National Security Cutters and Government-furnished equipment associated with the National Security Cutter program.</text></paragraph> 
<paragraph id="H9AC24AA5DFF54436A255D536D99E5E65"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary may not enter into a contract under paragraph (1) until the date that is 30 days after the date the Secretary submits to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a certification that the Secretary has made, with respect to the contract, each of the findings specified under section 2306b(a) of title 10, United States Code, and has done so in accordance with paragraph (3) of this subsection.</text></paragraph> 
<paragraph id="H2F3011902BE04DD6A2EF4D3144DC8D8E"><enum>(3)</enum><header>Determination of substantial savings</header><text display-inline="yes-display-inline">For purposes of this section, in conducting an analysis with respect to substantial savings under section 2306b(a)(1) of title 10, United States Code, the Secretary—</text> 
<subparagraph id="H134EA39A9F644B179F999BD70B2E7718"><enum>(A)</enum><text display-inline="yes-display-inline">may not limit the analysis to a simple percentage-based metric; and</text></subparagraph> 
<subparagraph id="H066190D6FC574A29B168D457D2D4B5C6"><enum>(B)</enum><text>shall employ a full-scale analysis of cost avoidance—</text> 
<clause id="HFDC977AAEB2241B98683BAD876C50494"><enum>(i)</enum><text>based on a multiyear procurement; and</text></clause> 
<clause id="HDF30F226D71A490AB26745B60A9E73CE"><enum>(ii)</enum><text>taking into account the potential benefit any accrued savings might have for future shipbuilding programs if the cost avoidance savings were subsequently utilized for further ship construction.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HDEC78E79305A45A8BA362CBF08DA62D6"><enum>(b)</enum><header>Certificate To operate</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard may not certify a sixth National Security Cutter as Ready for Operations before the Commandant has—</text> 
<paragraph id="H76502C83FE2740C098705B0BC6AAC813"><enum>(1)</enum><text>submitted to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives program execution plans detailing—</text> 
<subparagraph id="HDA3A77F1926740E084D2C83EE770A384"><enum>(A)</enum><text>how the first 3 National Security Cutters will achieve the goal of 225 days away from homeport in fiscal years following the completion of the Structural Enhancement Drydock Availability of the first 2 National Security Cutters; and</text></subparagraph> 
<subparagraph id="H6AA4A9A1A50542F0908D247D9622D15B"><enum>(B)</enum><text>increased aerial coverage to support National Security Cutter operations; and </text></subparagraph></paragraph> 
<paragraph id="H7DF891A8D79C45FEBB0EEEAC2E76E2FC"><enum>(2)</enum><text>awarded a contract for detailed design and construction for the Offshore Patrol Cutter.</text></paragraph></subsection></section> 
<section id="HE58A95A6689A4865829E89A7C072ED3B"><enum>222.</enum><header>Coast Guard polar icebreakers</header> 
<subsection id="H328C4268C0E24C7A993568B64104144A"><enum>(a)</enum><header>In general</header><text>The Secretary of the department in which the Coast Guard is operating shall conduct a business case analysis of the options for and costs of reactivating and extending the service life of the Polar Sea until at least September 30, 2022, to maintain United States polar icebreaking capabilities and fulfill the Coast Guard’s high latitude mission needs, as identified in the Coast Guard’s July 2010, High Latitude Study Mission Analysis Report, during the Coast Guard’s recapitalization of its polar class icebreaker fleet. The analysis shall include—</text> 
<paragraph id="H006086CD36D7464BA63CE44B180347EE"><enum>(1)</enum><text>an assessment of the current condition of the Polar Sea;</text></paragraph> 
<paragraph id="H8277D56A08A44BDA8B0942518F3FBB28"><enum>(2)</enum><text>a determination of the Polar Sea’s operational capabilities with respect to fulfilling the Coast Guard’s high latitude operating requirements if renovated and reactivated;</text></paragraph> 
<paragraph id="H7E3A201B828D47E5AF800FEAF6936AE3"><enum>(3)</enum><text>a detailed estimate of costs with respect to reactivating and extending the service life of the Polar Sea;</text></paragraph> 
<paragraph id="HE61B0FF6718C45B6A6C871C523C51883"><enum>(4)</enum><text>a life cycle cost estimate with respect to operating and maintaining the Polar Sea for the duration of its extended service life; and</text></paragraph> 
<paragraph id="H23D01A09080A40D5A286D14E83122577"><enum>(5)</enum><text>a determination of whether it is cost-effective to reactivate the Polar Sea compared with other options to provide icebreaking services as part of a strategy to maintain polar icebreaking services.</text></paragraph></subsection> 
<subsection id="HE2E589A0500345C1B00634170224B503"><enum>(b)</enum><header>Restrictions</header><text>The Secretary shall not remove any part of the Polar Sea until the Secretary submits the analysis required under subsection (a).</text></subsection> 
<subsection id="H5CB79259DE604CFEA89E79AD40875BF8"><enum>(c)</enum><header>Deadline</header><text>Not later than 270 days after the date of enactment of this Act, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate the analysis required under subsection (a).</text></subsection> 
<subsection id="H60AAAD44C3064C67AECCABF3E34F99DC"><enum>(d)</enum><header>Requirement for reactivation of Polar Sea</header> 
<paragraph id="HE36D0EC9153546B8A763CAADBB6F5A98"><enum>(1)</enum><header>Service life extension plan</header> 
<subparagraph id="H28961365477F4C5B8E3E05844BE43056"><enum>(A)</enum><header>In general</header><text>If the Secretary determines based on the analysis required under subsection (a) that it is cost-effective to reactivate the Polar Sea compared with other options to provide icebreaking services, the Secretary shall develop a service life extension plan for such reactivation, including a timetable for such reactivation.</text></subparagraph> 
<subparagraph id="H94EB1A484C1A47E5AF4E52DC452C232A"><enum>(B)</enum><header>Utilization of existing resources</header><text>In the development of the plan required under subparagraph (A), the Secretary shall utilize to the greatest extent practicable recent plans, studies, assessments, and analyses regarding the Coast Guard’s icebreakers and high latitude mission needs and operating requirements.</text></subparagraph> 
<subparagraph id="HF6A8A6B8401A4534BAF5BB0EEB472CCF"><enum>(C)</enum><header>Submission</header><text>The Secretary shall submit the plan required under subparagraph (A), if so required, to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate not later than 180 days after the submission of the analysis required under subsection (a).</text></subparagraph></paragraph> 
<paragraph id="H03E158458A114FA59D2640976F334975"><enum>(2)</enum><header>Decommissioning; bridging strategy</header><text>If the analysis required under subsection (a) is submitted in accordance with subsection (c) and the Secretary determines under subsection (a)(5) that it is not cost-effective to reactivate the Polar Sea, then not later than 180 days after the date on which the analysis is required to be submitted under subsection (c) the Commandant of the Coast Guard—</text> 
<subparagraph id="HE1168CE51F104F358FEAF183E862F57C"><enum>(A)</enum><text>may decommission the Polar Sea; and</text></subparagraph> 
<subparagraph id="HD3ADD8FEA51A4772A7E1EA4A450671C0"><enum>(B)</enum><text>shall submit a bridging strategy for maintaining the Coast Guard’s polar icebreaking services until at least September 30, 2022, to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text></subparagraph></paragraph></subsection> 
<subsection id="H3DCB6D482B33485BA97711ECC4F7D8E9"><enum>(e)</enum><header>Restriction</header><text>Except as provided in subsection (d), the Commandant of the Coast Guard may not—</text> 
<paragraph id="HE892B472D3264444AD7243B79E4DEF9D"><enum>(1)</enum><text>transfer, relinquish ownership of, dismantle, or recycle the Polar Sea or Polar Star;</text></paragraph> 
<paragraph id="HEBA5EC88FF684E56B835328AC11BB04C"><enum>(2)</enum><text>change the current homeport of either of the vessels; or</text></paragraph> 
<paragraph id="HD41107C9192B4F20B8DC13D93E9F450E"><enum>(3)</enum><text>expend any funds—</text> 
<subparagraph id="HE1D1DB196339403CAD1C7BF71A0CF85F"><enum>(A)</enum><text>for any expenses directly or indirectly associated with the decommissioning of either of the vessels, including expenses for dock use or other goods and services;</text></subparagraph> 
<subparagraph id="HA2E70413B8B541408607E41CC8C69C21"><enum>(B)</enum><text>for any personnel expenses directly or indirectly associated with the decommissioning of either of the vessels, including expenses for a decommissioning officer;</text></subparagraph> 
<subparagraph id="H6ABB0FDCE6114661BB51BA5ECB11BDC3"><enum>(C)</enum><text>for any expenses associated with a decommissioning ceremony for either of the vessels;</text></subparagraph> 
<subparagraph id="H99470FCC2CFD48AF8FD3C6315BB9D5EF"><enum>(D)</enum><text>to appoint a decommissioning officer to be affiliated with either of the vessels; or</text></subparagraph> 
<subparagraph id="HA46DF23F2B0B4E328526FAD39F657E43"><enum>(E)</enum><text>to place either of the vessels in inactive status.</text></subparagraph></paragraph></subsection> 
<subsection id="HEB3366D4150B4E02AF28786E4E6FDFC6"><enum>(f)</enum><header>Definition</header><text>For purposes of this section—</text> 
<paragraph id="H0D3432BD42654FCE98B45BE57B779E49"><enum>(1)</enum><text>the term <quote>Polar Sea</quote> means Coast Guard Cutter Polar Sea (WAGB 11); and</text></paragraph> 
<paragraph id="H11188B61D1C34BFD9633E22401B3D222"><enum>(2)</enum><text>the term <quote>Polar Star</quote> means Coast Guard Cutter Polar Star (WAGB 10).</text></paragraph></subsection> 
<subsection id="HC57E2FC4D50F4CE0809CDA5BF5CE9F2D"><enum>(g)</enum><header>Repeal</header><text>This section shall cease to have effect on September 30, 2022.</text></subsection></section></title> 
<title id="H396D846E137F4CA9953EF02FB7119C92"><enum>III</enum><header>Shipping and Navigation</header> 
<section id="H61CC032B709E42BFAC0144B2AD8A5D8B" section-type="subsequent-section"><enum>301.</enum><header>Identification of actions to enable qualified United States flag capacity to meet national defense requirements</header><text display-inline="no-display-inline">Section 501(b) of title 46, United States Code, is amended—</text>

<subparagraph id="HBDB67C6BDFD742278DD8D3AEA8250280"><enum>(C)</enum><text>publish each such determination on the Internet Web site of the Department of Transportation not later than 48 hours after notice of the determination is provided to the Secretary of Transportation.</text></subparagraph></paragraph> 
<paragraph id="H71149FB458F748098024462570EE8D82"><enum>(3)</enum><header>Notice to Congress</header> 
<subparagraph id="HB0F05EDA2DEA4AAA8861213B2C5A0B1D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The head of an agency referred to in paragraph (1) shall notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate—</text> 
<clause id="H30DF95AFAB3447899A20F9B1AE57022E"><enum>(i)</enum><text>of any request for a waiver of the navigation or vessel-inspection laws under this section not later than 48 hours after receiving such a request; and</text></clause> 
<clause id="H1D2EE1F27B0A4472BB3E7AAB9AFE0ACD"><enum>(ii)</enum><text>of the issuance of any such waiver not later than 48 hours after such issuance.</text></clause></subparagraph> 
<subparagraph id="HE82E9DB2EEAA44F18489B849C219829A"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">Such head of an agency shall include in each notification under subparagraph (A)(ii) an explanation of—</text> 
<clause id="HC8A2730B2DD94795B7D78197EB4ABD08"><enum>(i)</enum><text>the reasons the waiver is necessary; and</text></clause>

<paragraph id="H54BE11E77C584BCEBF3C6AC3F5FDD31A"><enum>(1)</enum><text display-inline="yes-display-inline">the number of casualties, by vessel type and area of operation, as the result of immersion in water reported to the Coast Guard for each of fiscal years 1991 through 2011;</text></paragraph> 
<paragraph id="H35DE47CA3BD4425689B0ACD9B1E57EA1"><enum>(2)</enum><text display-inline="yes-display-inline">the effect the carriage of such survival craft has on—</text> 
<subparagraph id="HC749AE76B7BD4F8390ECA2291CFB5FFC"><enum>(A)</enum><text>vessel safety, including stability and safe navigation; and</text></subparagraph> 
<subparagraph id="HEAECF41F595C479BBA8DB3097407A3A6"><enum>(B)</enum><text>survivability of individuals, including persons with disabilities, children, and the elderly;</text></subparagraph></paragraph> 
<paragraph id="H524D9BEBA2CF4E9393FE23151772F1EB"><enum>(3)</enum><text display-inline="yes-display-inline">the efficacy of alternative safety systems, devices, or measures;</text></paragraph> 
<paragraph id="H43454F5D6C2A46E1A5F09392F28489A9"><enum>(4)</enum><text display-inline="yes-display-inline">the cost and cost effectiveness of requiring the carriage of such survival craft on vessels; and</text></paragraph> 
<paragraph id="HBD32721DBBCE45F7A6AC23289F2F9594"><enum>(5)</enum><text display-inline="yes-display-inline">the number of small businesses and nonprofit entities that would be affected by requiring the carriage of such survival craft on vessels.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H4149507D4B5E43899ACC245380BA0E15"><enum>304.</enum><header>Classification societies</header><text display-inline="no-display-inline">Section 3316 of title 46, United States Code, is amended—</text>

<paragraph id="H529162B402594CE6AB63F346B870875E"><enum>(1)</enum><header>Coordinating Board</header> 
<subparagraph id="H261F59500D514513B4357DDD614E42BB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">There is hereby established, within the Committee, a Coordinating Board. Each member of the Committee may select a senior level representative to serve on such Board. The Board shall assist the Committee in carrying out its purpose and activities.</text></subparagraph> 
<subparagraph id="HDFC4B5C7AACB45BAAB8AB18E3971292B"><enum>(B)</enum><header>Chair</header><text>There shall be a Chair of the Coordinating Board. The Chair of the Coordinating Board shall rotate each year among the Secretary of Transportation, the Secretary of Defense, the Secretary of Homeland Security, and the Secretary of Commerce. The order of rotation shall be determined by a majority of the voting members of the Committee.</text></subparagraph></paragraph> 
<paragraph id="HBC825F887E6941A891C7766DE4263995"><enum>(2)</enum><header>Executive Director</header><text display-inline="yes-display-inline">The Secretary of Transportation, in consultation with the Secretary of Defense, the Secretary of Homeland Security, and the Secretary of Commerce, shall appoint an Executive Director of the Committee.</text></paragraph> 
<paragraph id="H03F38D1740D54BDCA4E4AD495FA7D20B"><enum>(3)</enum><header>Transfers</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the head of a Federal department or agency who is a member of the Committee may—</text> 
<subparagraph id="H34613540DFCD40309ECA42F51297FE15"><enum>(A)</enum><text>provide, on a reimbursable or nonreimbursable basis, facilities, equipment, services, personnel, and other support services to carry out the activities of the Committee; and</text></subparagraph> 
<subparagraph id="H2BB2CEB719054D5886351051927C200A"><enum>(B)</enum><text>transfer funds to another Federal department or agency in order to carry out the activities of the Committee.</text></subparagraph></paragraph></subsection> 
<subsection id="H60CD880F8F464D06A90866064D13BA84"><enum>(e)</enum><header>Marine transportation system assessment and strategy</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act and every 5 years thereafter, the Committee shall provide to the Committee on Commerce, Science, and Transportation and the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that includes—</text> 
<paragraph id="H45530908A04041A3B0323E6B85C862AF"><enum>(1)</enum><text>steps taken to implement actions recommended in the document titled <quote>National Strategy for the Marine Transportation System: A Framework for Action</quote> and dated July 2008;</text></paragraph> 
<paragraph id="H8524D8AA4199434981EFF942E84A4CC0"><enum>(2)</enum><text>an assessment of the condition of the marine transportation system;</text></paragraph> 
<paragraph id="H9DD3553D167246A8A17E6AAFBE12C8F8"><enum>(3)</enum><text display-inline="yes-display-inline">a discussion of the challenges the marine transportation system faces in meeting user demand, including estimates of investment levels required to ensure system infrastructure meets such demand;</text></paragraph> 
<paragraph id="H488D1B9C62D3498C984D8D8AE14C39A1"><enum>(4)</enum><text>a plan, with recommended actions, for improving the marine transportation system to meet current and future challenges; and</text></paragraph> 
<paragraph id="H8F9FF693D6ED4A11AAFD3E9F9E6F5601"><enum>(5)</enum><text>steps taken to implement actions recommended in previous reports required under this subsection.</text></paragraph></subsection> 
<subsection id="H9A5944133D644660BBF9A39BED0483DD"><enum>(f)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out its purpose and activities, the Committee may consult with marine transportation system-related advisory committees, interested parties, and the public.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<section id="H0305F3F3349F41F0B6DDC936B868CB68"><enum>401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Maritime Administration Authorization Act for Fiscal Year 2013</quote>.</text></section> 
<section id="H8D8E123CC63C4502B35F2F089D7AEE9F"><enum>402.</enum><header>Authorization of appropriations for national security aspects of the merchant marine for fiscal year 2013</header><text display-inline="no-display-inline">Funds are hereby authorized to be appropriated for fiscal year 2013, to be available without fiscal year limitation if so provided in appropriations Acts, for the use of the Department of Transportation for Maritime Administration programs associated with maintaining national security aspects of the merchant marine, as follows:</text> 
<paragraph id="HD25B693DC4814B3C9F8DD538315A692D"><enum>(1)</enum><text>For expenses necessary for operations of the United States Merchant Marine Academy, $77,253,000, of which—</text> 
<subparagraph id="HDEEF999C9F774C8492DC97AC9B5BD92B"><enum>(A)</enum><text>$67,253,000 shall remain available until expended for Academy operations; and</text></subparagraph> 
<subparagraph id="HE445ED2986314B9B891D8C79F91BF077"><enum>(B)</enum><text>$10,000,000 shall remain available until expended for capital asset management at the Academy.</text></subparagraph></paragraph> 
<paragraph id="HBDAD812D65C9468CB853A212CB3489A8"><enum>(2)</enum><text>For expenses necessary to support the State maritime academies, $16,045,000, of which—</text> 
<subparagraph id="H13CF576E38204D3FAC2C4C8F90FB2E14"><enum>(A)</enum><text>$2,400,000 shall remain available until expended for student incentive payments;</text></subparagraph> 
<subparagraph id="H7B78539543654AD785EBE9C1220AA496"><enum>(B)</enum><text>$2,545,000 shall remain available until expended for direct payments to such academies; and</text></subparagraph> 
<subparagraph id="HC56934FD31764AC7B0881F02FAE35BCA"><enum>(C)</enum><text>$11,100,000 shall remain available until expended for maintenance and repair of State maritime academy training vessels.</text></subparagraph></paragraph> 
<paragraph id="HD7B60022C15F4BC3900C2205339AB78A"><enum>(3)</enum><text>For expenses necessary to dispose of vessels in the National Defense Reserve Fleet, $12,717,000, to remain available until expended.</text></paragraph> 
<paragraph id="HE3DFB94FC2BD4F06997B501FE3A7182C"><enum>(4)</enum><text>For expenses to maintain and preserve a United States-flag merchant marine to serve the national security needs of the United States under chapter 531 of title 46, United States Code, $186,000,000.</text></paragraph>

<subsection id="H9C703F2514C54B5C93D5CD2524BE729B"><enum>(a)</enum><header>In general</header><text>The Secretary of Transportation may engage in the environmental study, research, development, assessment, and deployment of emerging marine technologies and practices related to the marine transportation system through the use of public vessels under the control of the Maritime Administration or private vessels under United States registry, and through partnerships and cooperative efforts with academic, public, private, and nongovernmental entities and facilities.</text></subsection> 
<subsection id="H7DD3B9BCAFA049A7B5713832F5EF43F8"><enum>(b)</enum><header>Components</header><text>Under this section, the Secretary of Transportation may—</text> 
<paragraph id="HF7653209DA2B44EBB8C6C9B61BDC66C1"><enum>(1)</enum><text>identify, study, evaluate, test, demonstrate, or improve emerging marine technologies and practices that are likely to achieve environmental improvements by—</text> 
<subparagraph id="HD6A443D489E64C9696DA6499D70105D7"><enum>(A)</enum><text>reducing air emissions, water emissions, or other ship discharges;</text></subparagraph> 
<subparagraph id="H435493819CF44ED891946717999132D6"><enum>(B)</enum><text>increasing fuel economy or the use of alternative fuels and alternative energy (including the use of shore power); or</text></subparagraph> 
<subparagraph id="H6731A5D9A72C405EBE5F933DC8155E50"><enum>(C)</enum><text>controlling aquatic invasive species; and</text></subparagraph></paragraph> 
<paragraph id="H475A52D2DBDB4769ACFD80D06C462D36"><enum>(2)</enum><text>coordinate with the Environmental Protection Agency, the Coast Guard, and other Federal, State, local, or tribal agencies, as appropriate.</text></paragraph></subsection> 
<subsection id="H8C6D6D09F2A1480BB0B8A0043B945AA3"><enum>(c)</enum><header>Coordination</header><text>Coordination under subsection (b)(2) may include—</text> 
<paragraph id="H5B3435B55165470187D3CDD2F55FB06F"><enum>(1)</enum><text>activities that are associated with the development or approval of validation and testing regimes; and</text></paragraph> 
<paragraph id="H976E7BBBFD5A45138AA1A9FA5632F349"><enum>(2)</enum><text>certification or validation of emerging technologies or practices that demonstrate significant environmental benefits.</text></paragraph></subsection> 
<subsection id="HE080CCE4A6F34F71B978999FCEF6D8F1"><enum>(d)</enum><header>Assistance</header><text display-inline="yes-display-inline">The Secretary of Transportation may accept gifts, or enter into cooperative agreements, contracts, or other agreements with academic, public, private, and nongovernmental entities and facilities to carry out the activities authorized under subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<section id="H73C0376DD6E74F669C0F2F5A936823C5"><enum>411.</enum><header>Requirement for barge design</header><text display-inline="no-display-inline">Not later than 270 days after the date of enactment of this Act, the Administrator of the Maritime Administration shall complete the design for a containerized, articulated barge, as identified in the dual-use vessel study carried out by the Administrator and the Secretary of Defense, that is able to utilize roll-on/roll-off or load-on/load-off technology in marine highway maritime commerce.</text></section> 
<section id="HDC1615990C9245CE83CEF70C731E6C21"><enum>412.</enum><header>Container-on-barge transportation</header> 
<subsection id="H4A84EB75A35740668C62CB767E52EDA3"><enum>(a)</enum><header>Assessment</header><text display-inline="yes-display-inline">The Administrator of the Maritime Administration shall assess the potential for using container-on-barge transportation in short sea transportation (as such term is defined in section 55605 of title 46, United States Code).</text></subsection> 
<subsection id="H7BF25B22DEA44802972DC8B526D529B4"><enum>(b)</enum><header>Factors</header><text display-inline="yes-display-inline">In conducting the assessment under subsection (a), the Administrator shall consider—</text> 
<paragraph id="HFD66CA2868AA45DF95CD41828F85EAC0"><enum>(1)</enum><text display-inline="yes-display-inline">the environmental benefits of increasing container-on-barge movements in short sea transportation;</text></paragraph> 
<paragraph id="H8A3BA1C5669C48C48CDF5C59F54865EC"><enum>(2)</enum><text display-inline="yes-display-inline">the regional differences in the use of short sea transportation;</text></paragraph> 
<paragraph id="H71038897499C4CFDB1D5D30136AD9E83"><enum>(3)</enum><text>the existing programs established at coastal and Great Lakes ports for establishing awareness of deep sea shipping operations;</text></paragraph> 
<paragraph id="HBBEDB556027B435BB029A5234E6EB3B1"><enum>(4)</enum><text>the mechanisms necessary to ensure that implementation of a plan under subsection (c) will not be inconsistent with antitrust laws; and</text></paragraph> 
<paragraph id="HDD5E45C9329E426D864C7E17720BB323"><enum>(5)</enum><text display-inline="yes-display-inline">the potential frequency of container-on-barge service at short sea transportation ports.</text></paragraph></subsection> 
<subsection id="HCC420A21C21F44688190597ECEAB1BD8"><enum>(c)</enum><header>Recommendations</header><text display-inline="yes-display-inline">The assessment under subsection (a) may include recommendations for a plan to increase awareness of the potential for use of container-on-barge transportation.</text></subsection> 
<subsection id="H64A8D28C877C43D7ACCA11E26C3423DA"><enum>(d)</enum><header>Deadline</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall submit the assessment required under this section to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subsection></section> 
<section id="HA175C23E13F143BD94AA66E7BF646E33"><enum>413.</enum><header>Department of Defense national strategic ports study and Comptroller General studies and reports on strategic ports</header> 
<subsection id="H5EA2231AFACB4BB99B52073911E1EB47"><enum>(a)</enum><header>Sense of Congress on completion of DOD report</header><text display-inline="yes-display-inline">It is the sense of Congress that the Secretary of Defense should expedite completion of the study of strategic ports in the United States called for in the conference report to accompany the National Defense Authorization Act for Fiscal Year 2012 (Conference Report 112–329) so that it can be submitted to Congress before July 1, 2013.</text></subsection> 
<subsection id="H0DF33FA6205041D59A98EB73662992B7"><enum>(b)</enum><header>Submission of report to Comptroller General</header><text display-inline="yes-display-inline">In addition to submitting the report referred to in subsection (a) to Congress, the Secretary of Defense shall submit the report to the Comptroller General of the United States for consideration under subsection (c).</text></subsection> 
<subsection id="HE2A00F69B5EB4511ADA76AD2D837DFE7"><enum>(c)</enum><header>Comptroller General studies and reports on strategic ports</header> 
<paragraph id="HDFAB3A3A25A0412F92A9347D88404F8F"><enum>(1)</enum><header>Comptroller General review</header><text>Not later than 90 days after receipt of the report referred to in subsection (a), the Comptroller General shall conduct an assessment of the report and submit to the Committee on Armed Services of the House of Representatives and the Committee on Armed Services of the Senate a report of such assessment.</text></paragraph> 
<paragraph id="H4F1B864B1DBA41E1B219AAFEB199738A"><enum>(2)</enum><header>Comptroller General study and report</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Comptroller General shall conduct a study of the Department of Defense’s programs and efforts related to the state of strategic ports with respect to the Department’s operational and readiness requirements, and report to the Committee on Armed Services of the House of Representatives and the Committee on Armed Services of the Senate on the findings of such study. The report may include an assessment of—</text> 
<subparagraph id="H2E1D26CF465544B9A9CDB90E524ABFB3"><enum>(A)</enum><text>the extent to which the facilities at strategic ports meet the Department of Defense’s requirements;</text></subparagraph> 
<subparagraph id="HCCB072F67A744C4D8E63C4C6328C65F9"><enum>(B)</enum><text>the extent to which the Department has identified gaps in the ability of existing strategic ports to meet its needs and identified and undertaken efforts to address any gaps; and</text></subparagraph> 
<subparagraph id="H788077366AA64767A4F48F5AE12BE1C0"><enum>(C)</enum><text>the Department’s ability to oversee, coordinate, and provide security for military deployments through strategic ports.</text></subparagraph></paragraph></subsection> 
<subsection id="H97E1118FAC4847FC8D6BCD1894E5C045"><enum>(d)</enum><header>Strategic port defined</header><text>In this section, the term <quote>strategic port</quote> means a United States port designated by the Secretary of Defense as a significant transportation hub important to the readiness and cargo throughput capacity of the Department of Defense.</text></subsection></section> 
<section id="H8E89451363E74D068FC1F9B9601C7D4A"><enum>414.</enum><header>Maritime workforce study</header> 
<subsection id="HEF79BCB0BE9B4411B539F338087A9E49"><enum>(a)</enum><header>Training study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study on the training needs of the maritime workforce.</text></subsection> 
<subsection id="H97B871D1656A460FB425907EE1BC0DF2"><enum>(b)</enum><header>Study components</header><text display-inline="yes-display-inline">The study shall—</text> 
<paragraph id="H41497394087B4DB8BD5A23F910537D65"><enum>(1)</enum><text>analyze the impact of maritime training requirements imposed by domestic and international regulations and conventions, companies, and government agencies that charter or operate vessels; </text></paragraph> 
<paragraph id="HFF12CDEEE5F84230B67650F1D617FF2A"><enum>(2)</enum><text>evaluate the ability of the United States maritime training infrastructure to meet the needs of the maritime industry; </text></paragraph> 
<paragraph id="H10256BB47BEC42A5884A572D0ACF812D"><enum>(3)</enum><text>identify trends in maritime training; </text></paragraph> 
<paragraph id="H507D53A4A005432C82E9AF6C0959286E"><enum>(4)</enum><text>compare the training needs of United States mariners with the vocational training and educational assistance programs available from Federal agencies to evaluate the ability of Federal programs to meet the training needs of United States mariners; </text></paragraph> 
<paragraph id="H8CC4A9E84979471CB9484987D366C6C0"><enum>(5)</enum><text>include recommendations to enhance the capabilities of the United States maritime training infrastructure; and </text></paragraph> 
<paragraph id="HB8C66B66996F4E8DBBA63566668D2981"><enum>(6)</enum><text>include recommendations to assist United States mariners and those entering the maritime profession to achieve the required training. </text></paragraph></subsection> 
<subsection id="HC1202D4C54394929A12651E80DE4DBB4"><enum>(c)</enum><header>Final report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General shall submit a report on the results of the study to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subsection></section> 
<section id="HD953C642729A46A2BA40C33361686D5A" section-type="subsequent-section"><enum>415.</enum><header>Maritime Administration vessel recycling contract award practices</header> 
<subsection id="H98B51280CEE64BE6BDC7B4A1B9F6BBB6"><enum>(a)</enum><header>Assessment</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct an assessment of the source selection procedures and practices used to award the Maritime Administration's National Defense Reserve Fleet vessel recycling contracts.</text></subsection> 
<subsection id="HF5EC2F31CDA04EA2AF02C0E5052EE826"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The assessment under subsection (a) shall include a review of—</text> 
<paragraph id="HAEAFE600860A409DB3F1F491FA5A1F61"><enum>(1)</enum><text>whether the Maritime Administration's contract source selection procedures and practices are consistent with law, including the Federal Acquisition Regulation, and Federal best practices associated with making source selection decisions;</text></paragraph> 
<paragraph id="HA77FCF24435F47C0BCBD546C1DE9B9F3"><enum>(2)</enum><text>the process, procedures, and practices used for the Maritime Administration's qualification of vessel recycling facilities; and</text></paragraph> 
<paragraph id="HB41F2C998B6A46B39DF59D5C7C6E36B4"><enum>(3)</enum><text>any other aspect of the Maritime Administration's vessel recycling process that the Comptroller General deems appropriate to review.</text></paragraph></subsection> 
<subsection id="H0C8C541C1A8D4831B9600D9242F8AC91" commented="no"><enum>(c)</enum><header>Findings</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, the Comptroller General shall report the findings of the assessment under subsection (a) to the Committee on Commerce, Science, and Transportation and the Committee on Armed Services of the Senate and the Committee on Transportation and Infrastructure and the Committee on Armed Services of the House of Representatives.</text></subsection></section></title> 
<title id="H2C060FBFF8DA4276B3015A7E06A3ABF0"><enum>V</enum><header>Piracy</header> 
<section id="HF5BE51955CD4443886D0744659FD9D4A" section-type="subsequent-section"><enum>501.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Piracy Suppression Act of 2012</quote>.</text></section> 
<section id="H29DEBE62F0954CE79728CDC8B0F802CA"><enum>502.</enum><header>Training for use of force against piracy</header> 
<subsection id="H3BCA9B8A11C64732B203DAF9AA0A580C"><enum>(a)</enum><header>In general</header><text>Chapter 517 of title 46, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H18E3789C34714447B99B50FB55043139" style="USC"> 
<section id="HA9E699A0938640798D7A348C8BADA995"><enum>51705.</enum><header>Training for use of force against piracy</header><text display-inline="no-display-inline">The Secretary of Transportation, in consultation with the Secretary of Defense and the Secretary of the department in which the Coast Guard is operating, shall certify a training curriculum for United States mariners on the use of force against pirates. The curriculum shall include—</text> 
<paragraph id="H78274EBB4A704063A57A47DF57AD3E2C"><enum>(1)</enum><text>information on waters designated as high-risk waters by the Commandant of the Coast Guard;</text></paragraph> 
<paragraph id="HFF69031225B14B39B8F8093B8EFAB403"><enum>(2)</enum><text>information on current threats and patterns of attack by pirates;</text></paragraph> 
<paragraph id="H0DAE8B1EE0CF4D689B5EB07E7EC6CDFC"><enum>(3)</enum><text>tactics for defense of a vessel, including instruction on the types, use, and limitations of security equipment;</text></paragraph> 
<paragraph id="H034A4C4A1E1C4FB99BCF5F51407F418B"><enum>(4)</enum><text>standard rules for the use of force for self-defense as developed by the Secretary of the department in which the Coast Guard is operating under section 912(c) of the Coast Guard Authorization Act of 2010 (Public Law 111–281; 46 U.S.C. 8107 note), including instruction on firearm safety for crewmembers of vessels carrying cargo under section 55305 of this title; and</text></paragraph> 
<paragraph id="HA29FA787DD6B42D1AC3DC33547DC8F7A"><enum>(5)</enum><text>procedures to follow to improve crewmember survivability if captured and taken hostage by pirates.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5CBA1AE0713D42B6AFFBEDDB20A9604F"><enum>(b)</enum><header>Deadline</header><text>The Secretary of Transportation shall certify the curriculum required under the amendment made by subsection (a) not later than 270 days after the date of enactment of this Act.</text></subsection> 
<subsection id="H69E7A9502E02495B9E99C24D92917B00"><enum>(c)</enum><header>Clerical amendment</header><text>The analysis for chapter 517 of title 46, United States Code, is amended by adding at the end the following:</text>

<section id="HD7D96AD05E224E57BCBBD20A63EDC396"><enum>503.</enum><header>Security of Government-Impelled cargo</header><text display-inline="no-display-inline">Section 55305 of title 46, United States Code, is amended by adding at the end the following:</text>

<subsection id="H7238C69575954CEA9592EB9EF8ACA4D9"><enum>(e)</enum><header>Security of Government-Impelled cargo</header> 
<paragraph id="H91B88891F8C54E60B7CBCC2E222B6EFF"><enum>(1)</enum><text>In order to ensure the safety of vessels and crewmembers transporting equipment, materials, or commodities under this section, the Secretary of Transportation shall direct each department or agency (except the Department of Defense), when responsible for the carriage of such equipment, materials, or commodities, to provide armed personnel aboard vessels of the United States carrying such equipment, materials, or commodities if the vessels are transiting high-risk waters.</text></paragraph> 
<paragraph id="H36E55235447B4F4EBC25097CC91255A5"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary of Transportation shall direct each department or agency responsible to provide armed personnel under paragraph (1) to reimburse, subject to the availability of appropriations, the owners or operators of applicable vessels for the cost of providing armed personnel. </text></paragraph> 
<paragraph id="H9F1C5309F33A4549BE70B7D40681B483"><enum>(3)</enum><text>In this subsection, the term <quote>high-risk waters</quote> means waters so designated by the Commandant of the Coast Guard in the Port Security Advisory in effect on the date on which an applicable voyage begins.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H80F222814C004E5D8BCA2294EAFB1042"><enum>504.</enum><header>Actions taken to protect foreign-flagged vessels from piracy</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Defense, in consultation with the Secretary of the department in which the Coast Guard is operating, shall provide to the Committee on Armed Services and the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Armed Services and the Committee on Commerce, Science, and Transportation of the Senate a report on actions taken by the Secretary of Defense to protect foreign-flagged vessels from acts of piracy on the high seas. The report shall include—</text> 
<paragraph id="HC588A0FDDA084C5B8703882F3D749476"><enum>(1)</enum><text>the total number of incidents for each of the fiscal years 2009 through 2012 in which a member of the armed services or an asset under the control of the Secretary of Defense was used to interdict or defend against an act of piracy directed against any vessel not documented under the laws of the United States; and</text></paragraph> 
<paragraph id="HA67545E684FE4B7DB4E8AA4A3FD08A4B"><enum>(2)</enum><text>the estimated cost for each of the fiscal years 2009 through 2012 for such incidents.</text></paragraph></section></title>

<paragraph id="H248B3BA06BA34EBE90EEEA9E5BD2248C"><enum>(3)</enum><text>undertake efforts to reduce the adverse impacts of lost and discarded fishing gear on living marine resources and navigation safety, including—</text> 
<subparagraph id="HFC0EE382AAE6434E9233AE14F4BEB734"><enum>(A)</enum><text>research and development of alternatives to gear posing threats to the marine environment and methods for marking gear used in certain fisheries to enhance the tracking, recovery, and identification of lost and discarded gear; and</text></subparagraph> 
<subparagraph id="HA2524C43216A4B5F97292AE39646FF46"><enum>(B)</enum><text>the development of effective nonregulatory measures and incentives to cooperatively reduce the volume of lost and discarded fishing gear and to aid in gear recovery;</text></subparagraph></paragraph> 
<paragraph id="HD90B3D2F8ECD4B92900210DEF4E5D4AA"><enum>(4)</enum><text>undertake outreach and education activities for the public and other stakeholders on sources of marine debris, threats associated with marine debris, and approaches to identifying, determining sources of, assessing, preventing, reducing, and removing marine debris and its adverse impacts on the United States economy, the marine environment, and navigation safety, including outreach and education activities through public-private initiatives; and</text></paragraph> 
<paragraph id="H2D570E9904A34E14AD60F9910B0AB21C"><enum>(5)</enum><text>develop, in consultation with the Interagency Committee, interagency plans for the timely response to events determined by the Administrator to be severe marine debris events, including plans to—</text> 
<subparagraph id="HFB4315B80E174B3299D21324553CC890"><enum>(A)</enum><text>coordinate across agencies and with relevant State, tribal, and local governments to ensure adequate, timely, and efficient response;</text></subparagraph> 
<subparagraph id="H5DF849FD282E4B44930F01D4C12CE9B3"><enum>(B)</enum><text>assess the composition, volume, and trajectory of marine debris associated with a severe marine debris event; and</text></subparagraph> 
<subparagraph id="H9982D9726C2A401EB5BA2D301EBDC332"><enum>(C)</enum><text>estimate the potential impacts of a severe marine debris event, including economic impacts on human health, navigation safety, natural resources, tourism, and livestock, including aquaculture.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="HF32AF47B177B4AF3A30B5BFC362468BD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 12113(a)(4) of title 46, United States Code, the Secretary of the department in which the Coast Guard is operating may issue a certificate of documentation with a fishery endorsement for the Texas Star Casino (IMO number 7722047).</text></paragraph> 
<paragraph id="HA2EAFA5869BB4EC1825FE43B85ACFA3E"><enum>(2)</enum><header>Restriction</header><text display-inline="yes-display-inline">Notwithstanding section 12113(b)(1) of title 46, United States Code, a fishery endorsement issued under paragraph (1) is not valid for any fishery for which a fishery management plan has been approved by the Secretary of Commerce pursuant to section 304 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1854) before the date of enactment of this Act.</text></paragraph></subsection> 
<subsection id="HE926382114FB4258AEEE105162B1A515"><enum>(b)</enum><header>Ranger III</header><text display-inline="yes-display-inline">Section 3703a of title 46, United States Code, does not apply to the passenger vessel Ranger III (United States official number 277361), during any period that the vessel is owned and operated by the National Park Service.</text></subsection></section> 
<section id="HA90680E72578444E9AE9D105931FFBD2"><enum>706.</enum><header>National Response Center notification requirements</header><text display-inline="no-display-inline">The Ohio River Valley Water Sanitation Commission, established pursuant to the Ohio River Valley Water Sanitation Compact consented to and approved by Congress in the Act of July 11, 1940 (54 Stat. 752), is deemed a Government agency for purposes of the notification requirements of section 103 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C. 9603). The National Response Center shall convey notification, including complete and unredacted incident reports, expeditiously to the Commission regarding each release in or affecting the Ohio River Basin for which notification to all appropriate Government agencies is required.</text></section> 
<section id="HA8AF657334EA43E7AB03AEEE8911836A"><enum>707.</enum><header>Vessel determinations</header><text display-inline="no-display-inline">The vessel with United States official number 981472 and the vessel with United States official number 988333 shall each be deemed to be a new vessel effective on the date of delivery after January 1, 2008, from a privately owned United States shipyard if no encumbrances are on record with the Coast Guard at the time of the issuance of the new vessel certificate of documentation for each vessel.</text></section> 
<section id="H795FD4B8C5E34B1EA8BFA1071C8A685D" section-type="subsequent-section"><enum>708.</enum><header>Mille Lacs Lake, Minnesota</header><text display-inline="no-display-inline">The waters of Mille Lacs Lake, Minnesota, are not waters subject to the jurisdiction of the United States for the purposes of section 2 of title 14, United States Code.</text></section> 
<section id="H1A0446A3D4F048B7A3532452C7D26214"><enum>709.</enum><header>Transportation Worker Identification Credential process reform</header><text display-inline="no-display-inline">Not later than 270 days after the date of enactment of this Act, the Secretary of Homeland Security shall reform the process for Transportation Worker Identification Credential enrollment, activation, issuance, and renewal to require, in total, not more than one in-person visit to a designated enrollment center except in cases in which there are extenuating circumstances, as determined by the Secretary, requiring more than one such in-person visit.</text></section> 
<section id="H795A2EB90325430487CFF19BB9775AD1" section-type="subsequent-section"><enum>710.</enum><header>Investment amount</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary of the Treasury shall increase the $22,500,000 invested in income-producing securities for purposes of section 5006(b) of the Oil Pollution Act of 1990 (33 U.S.C. 2736(b)) by $12,851,340.</text></section> 
<section id="HE92E5D2C7581429BB4580D8818DD5C04"><enum>711.</enum><header>Integrated cross-border maritime law enforcement operations between the United States and Canada</header> 
<subsection id="H170A8823886148ED96E4281DCB8339F5"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, acting through the Commandant of the Coast Guard, may establish an Integrated Cross-Border Maritime Law Enforcement Operations Program to coordinate the maritime security operations of the United States and Canada (in this section referred to as the <quote>Program</quote>).</text></subsection> 
<subsection id="HDAC6203790A44D428892BC4E4BADEA06"><enum>(b)</enum><header>Purpose</header><text>The Secretary, acting through the Commandant, shall administer the Program in a manner that results in a cooperative approach between the United States and Canada to strengthen border security and detect, prevent, suppress, investigate, and respond to terrorism and violations of law related to border security.</text></subsection> 
<subsection id="H3A5054C9133C4799A6FBCD5747E0A706"><enum>(c)</enum><header>Training</header><text>The Secretary, acting through the Commandant and in consultation with the Secretary of State, may—</text> 
<paragraph id="H2012178608504744B68AC397958BCC83"><enum>(1)</enum><text>establish, as an element of the Program, a training program for individuals who will serve as maritime law enforcement officers; and</text></paragraph> 
<paragraph id="HECE27A3CEF0E45AA87A7F9E0CECC6BBB"><enum>(2)</enum><text>conduct training jointly with Canada to enhance border security, including training—</text> 
<subparagraph id="H44D47FEAF6694EC0B71CECE19F334972"><enum>(A)</enum><text>on the detection and apprehension of suspected terrorists and individuals attempting to unlawfully cross or unlawfully use the international maritime border between the United States and Canada;</text></subparagraph> 
<subparagraph id="H1A53E0543C34400CAD85A0DF7355D1CE"><enum>(B)</enum><text>on the integration, analysis, and dissemination of port security information by and between the United States and Canada;</text></subparagraph> 
<subparagraph id="HCA0D4AA18D544E2B9C55E50952AEF7E6"><enum>(C)</enum><text>on policy, regulatory, and legal considerations related to the Program;</text></subparagraph> 
<subparagraph id="H0542D49BDCA74FCD9264E6285A7E26D2"><enum>(D)</enum><text>on the use of force in maritime security;</text></subparagraph> 
<subparagraph id="HEA5F1589A60C4CAA892D05135257D082"><enum>(E)</enum><text>on operational procedures and protection of sensitive information; and</text></subparagraph> 
<subparagraph id="HB0998CF6A50A4E2A83A3FB856648B66C"><enum>(F)</enum><text>on preparedness and response to maritime terrorist incidents.</text></subparagraph></paragraph></subsection> 
<subsection id="HB69A17C4A1A0429D8F9C4AC830990E6E"><enum>(d)</enum><header>Coordination</header><text>The Secretary, acting through the Commandant, shall coordinate the Program with other similar border security and antiterrorism programs within the Department of Homeland Security.</text></subsection> 
<subsection id="H1B7947F6B8EA4A70B5CBCADB5F923CF5"><enum>(e)</enum><header>Memoranda of agreement</header><text>The Secretary may enter into any memorandum of agreement necessary to carry out the Program.</text></subsection></section> 
<section id="HCFBD04149B084D32929EECB648B7FFC9"><enum>712.</enum><header>Bridge permits</header> 
<subsection id="H67C070DF4E1143429C23554302E922E2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For the purposes of reviewing a permit application pursuant to section 9 of the Act of March 3, 1899, popularly known as the Rivers and Harbors Appropriation Act of 1899 (33 U.S.C. 401), the Act of March 23, 1906, popularly known as the Bridge Act of 1906 (33 U.S.C. 491 et seq.), the Act of June 21, 1940, popularly known as the Truman-Hobbs Act (33 U.S.C. 511 et seq.), or the General Bridge Act of 1946 (33 U.S.C. 525 et seq.), the Secretary of the department in which the Coast Guard is operating may—</text> 
<paragraph id="H33AEC3F37E4C46FB8064ABA6BB8B2D26"><enum>(1)</enum><text>accept voluntary services from one or more owners of a bridge; and</text></paragraph> 
<paragraph id="H6331B9C920584C86AF4A885C66F640F5"><enum>(2)</enum><text>accept and credit to Coast Guard operating expenses any amounts received from one or more owners of a bridge.</text></paragraph></subsection> 
<subsection id="H5F205041008F4D7BB3AD652C59293A2C" commented="no"><enum>(b)</enum><header>Expedited process</header><text display-inline="yes-display-inline">The Secretary of the department in which the Coast Guard is operating shall complete, on an expeditious basis and using the shortest existing applicable process, determinations on any required approval for issuance of any permits under the jurisdiction of such department related to the construction or alteration of a bridge over the Kill Van Kull consistent with Executive Order No. 13604 (March 22, 2012) and the Administration’s objectives for the project.</text></subsection></section> 
<section id="H764A9E30EA4543BB861075206A3FB296" section-type="subsequent-section"><enum>713.</enum><header>Tonnage of Aqueos Acadian</header><text display-inline="no-display-inline">The Secretary of the department in which the Coast Guard is operating may consider the tonnage measurements for the vessel Aqueos Acadian (United States official number 553645) recorded on the certificate of inspection for the vessel issued on September 8, 2011, to be valid until May 2, 2014, if the vessel and the use of its space is not changed after November 16, 2012, in a way that substantially affects the tonnage of the vessel.</text></section> 
<section id="H70F2D73065DA4E89BC2A2874034E337B"><enum>714.</enum><header>Navigability determination</header> 
<subsection id="H6EB9E735B6C24CB68A005AC8FAD560C0"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate an assessment of the impact of additional regulatory requirements imposed on passenger vessels operating on the Ringo Cocke Canal in Louisiana as a result of the covered navigability determination.</text></subsection> 
<subsection id="H635B0D740EFB447BA12E689CAF830B69"><enum>(b)</enum><header>Restriction</header><text>Before the date that is 180 days after the date on which the assessment required under subsection (a) is submitted, the Commandant may not enforce any regulatory requirements imposed on passenger vessels operating on the Ringo Cocke Canal in Louisiana that are a result of the covered navigability determination.</text></subsection> 
<subsection id="HA3CEBCE19B504AE5A3EE7F9CFFA94176"><enum>(c)</enum><header>Covered navigability determination defined</header><text>In this section, the term <quote>covered navigability determination</quote> means the Coast Guard’s Navigability Determination for Ringo Cocke Canal, Louisiana, dated March 25, 2010.</text></subsection></section> 
<section id="H74B8C531E7B9471CB55FD6A9D0B0BB8F"><enum>715.</enum><header>Coast Guard housing</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives the Coast Guard’s National Housing Assessment and any analysis conducted by the Coast Guard of such assessment.</text></section> 
<section id="H191E50380AE54D5694DCCF55D0A0C7E0"><enum>716.</enum><header>Assessment of needs for additional Coast Guard presence in high-latitude regions</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives an assessment of the need for additional Coast Guard prevention and response capability in the high-latitude regions. The assessment shall address needs for all Coast Guard mission areas, including search and rescue, marine pollution response and prevention, fisheries enforcement, and maritime commerce. The Secretary shall include in the assessment—</text> 
<paragraph id="H9096965176974A808F45E7EA94E98DC0"><enum>(1)</enum><text>an analysis of the high-latitude operating capabilities of all current Coast Guard assets other than icebreakers, including assets acquired under the Deepwater program;</text></paragraph> 
<paragraph id="HCE8C296AEB0A47E7819AD6D1336B50C9"><enum>(2)</enum><text>an analysis of projected needs for Coast Guard operations in the high-latitude regions; and</text></paragraph> 
<paragraph id="HA09D21FA943E4FB0ACBA9861125BEE97"><enum>(3)</enum><text display-inline="yes-display-inline">an analysis of shore infrastructure, personnel, logistics, communications, and resources requirements to support Coast Guard operations in the high-latitude regions, including forward operating bases and existing infrastructure in the furthest north locations that are ice free, or nearly ice free, year round.</text></paragraph></section> 
<section id="HAD778704AA97431D92A5F1F23C140D48"><enum>717.</enum><header>Potential Place of Refuge</header> 
<subsection id="H2B898BAAFFD2435F8E39DD2EB46AC01B"><enum>(a)</enum><header>Consultation</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Commandant of the Coast Guard shall consult with appropriate Federal agencies and with State and local interests to determine what improvements, if any, are necessary to designate existing ice-free facilities or infrastructure in the Central Bering Sea as a fully functional, year-round Potential Place of Refuge.</text></subsection> 
<subsection id="HC65236E5594D40699CE8A50296EEB49D"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the consultation under subsection (a) shall be to enhance safety of human life at sea and protect the marine environment in the Central Bering Sea. </text></subsection> 
<subsection id="HAAA5AEC6ED624F90A82C33B99938E909"><enum>(c)</enum><header>Deadline for submission</header><text>Not later than 90 days after making the determination under subsection (a), the Commandant shall inform the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives in writing of the findings under subsection (a).</text></subsection></section> 
<section id="H2430497FFDFD4DAC9368A327DD678584"><enum>718.</enum><header>Merchant mariner medical evaluation program</header> 
<subsection id="HC7AA7D4FB5AB461EA4062A7B7CCEBCD5"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate an assessment of the Coast Guard National Maritime Center’s merchant mariner medical evaluation program and alternatives to the program.</text></subsection> 
<subsection id="H26C756DB8FFB465F88D75DE47BF4FE9B"><enum>(b)</enum><header>Contents</header><text>The assessment required under subsection (a) shall include the following:</text> 
<paragraph id="H70B19A5CED8247B49A6FFC3D8FE3E62C"><enum>(1)</enum><text>An overview of the adequacy of the program for making medical certification determinations for issuance of merchant mariners’ documents.</text></paragraph> 
<paragraph id="H5742A65FC1E14AB4AF89992ACD8B593F"><enum>(2)</enum><text>An analysis of how a system similar to the Federal Motor Carrier Safety Administration’s National Registry of Certified Medical Examiners program, and the Federal Aviation Administration’s Designated Aviation Medical Examiners program, could be applied by the Coast Guard in making medical fitness determinations for issuance of merchant mariners’ documents.</text></paragraph> 
<paragraph id="HC1F55F0290B54613B513434FDBFD934B"><enum>(3)</enum><text>An explanation of how the amendments to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, that entered into force on January 1, 2012, required changes to the Coast Guard’s merchant mariner medical evaluation program.</text></paragraph></subsection></section> 
<section id="HAA7555C2914E42DCBF546C8284192A10"><enum>719.</enum><header>Determinations</header><text display-inline="no-display-inline">Not later than 270 days after the date of enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall provide to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate an assessment of—</text> 
<paragraph id="HB03A27DEF61E40518B81460FF53A4AB9"><enum>(1)</enum><text>the loss of United States shipyard jobs and industrial base expertise as a result of rebuild, conversion, and double-hull work on United States-flag vessels eligible to engage in the coastwise trade being performed in foreign shipyards;</text></paragraph> 
<paragraph id="H3B24729B37F641D2818D18E3CC031F5B"><enum>(2)</enum><text>enforcement of the Coast Guard’s foreign rebuild determination regulations; and</text></paragraph> 
<paragraph id="HBA979DF2F6704CF482761D7ECA327532"><enum>(3)</enum><text>recommendations for improving transparency in the Coast Guard’s foreign rebuild determination process.</text></paragraph></section> 
<section id="HA94094B017D34077915D5AEEA0F182EF"><enum>720.</enum><header>Impediments to the United States-flag registry</header> 
<subsection id="HE78F2013204D409F8F0DDD520128DCD4"><enum>(a)</enum><header>Assessment</header><text>Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate an assessment of factors under the authority of the Coast Guard that impact the ability of vessels documented in the United States to effectively compete in international transportation markets.</text></subsection> 
<subsection id="H75BE314218184F3EA413C568BAFC417B"><enum>(b)</enum><header>Content</header><text>The assessment under subsection (a) shall include—</text> 
<paragraph id="HE22EDCD0A51A42758A96A7CDECCA8B7D"><enum>(1)</enum><text>a review of differences between Coast Guard policies and regulations governing the inspection of vessels documented in the United States and International Maritime Organization policies and regulations governing the inspection of vessels not documented in the United States;</text></paragraph> 
<paragraph id="H2F18CD02E963475B86867160C47BF869"><enum>(2)</enum><text>a statement on the impact such differences have on operating costs for vessels documented in the United States; and</text></paragraph> 
<paragraph id="H1CB974EEBF4B4CBEB57E061B6E548F72"><enum>(3)</enum><text>recommendations on whether to harmonize any such differences.</text></paragraph></subsection> 
<subsection id="HF6710A1B2821480A8B77316B78C11AE0"><enum>(c)</enum><header>Consultation</header><text>In preparing the assessment under subsection (a), the Commandant may consider the views of representatives of the owners or operators of vessels documented in the United States and the organizations representing the employees employed on such vessels.</text></subsection></section> 
<section id="H5BAD2451B52B4D218480E80C9134D26D"><enum>721.</enum><header>Arctic deepwater seaport</header> 
<subsection id="H76BF91E6ED5B4627B19CB8F74E637A92"><enum>(a)</enum><header>Study</header><text>The Commandant of the Coast Guard, in consultation with the Commanding General of the Army Corps of Engineers, the Maritime Administrator, and the Chief of Naval Operations, shall conduct a study on the feasibility of establishing a deepwater seaport in the Arctic to protect and advance strategic United States interests within the Arctic region.</text></subsection> 
<subsection id="H45F1FA83683D4C19A5AB052A53BDB774"><enum>(b)</enum><header>Scope</header><text>The study under subsection (a) shall include an analysis of—</text> 
<paragraph id="H055AD6E14F9548098AB7C174C6EDDF40"><enum>(1)</enum><text>the capability provided by a deepwater seaport that—</text> 
<subparagraph id="HD8354035979F4B6D92426F7E176067A3"><enum>(A)</enum><text>is in the Arctic (as that term is defined in the section 112 of the Arctic Research and Policy Act of 1984 (15 U.S.C. 4111)); and</text></subparagraph> 
<subparagraph id="H5E5200371E934BEE99C1B78873A8E8C8"><enum>(B)</enum><text>has a depth of not less than 34 feet;</text></subparagraph></paragraph> 
<paragraph id="HD5FD2378B43342389ED246F5CB351D48"><enum>(2)</enum><text>the potential and optimum locations for such deepwater seaport;</text></paragraph> 
<paragraph id="H22D5E947203344CE8E869DB81668552B"><enum>(3)</enum><text display-inline="yes-display-inline">the resources needed to establish such deepwater seaport;</text></paragraph> 
<paragraph id="HFEF71E8097AA4A68BE54B4F36078F0B2"><enum>(4)</enum><text display-inline="yes-display-inline">the timeframe needed to establish such deepwater seaport;</text></paragraph> 
<paragraph id="H4068AB80221E4C2E938B2704D119F118"><enum>(5)</enum><text display-inline="yes-display-inline">the infrastructure required to support such deepwater seaport; and</text></paragraph> 
<paragraph id="H3AD94B7F0764433191A8D1C99D8F97F3"><enum>(6)</enum><text>any other issues the Secretary considers necessary to complete the study.</text></paragraph></subsection> 
<subsection id="H3F14DCE58BAD4BC6A6FB69896DDBEF48"><enum>(c)</enum><header>Deadline for submission of findings</header><text>Not later than 1 year after the date of enactment of this Act, the Commandant shall submit the findings of the study under subsection (a) to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subsection></section> 
<section id="HE1BC53E9359A464C8AAA2F60F8DDAC7C"><enum>722.</enum><header>Risk assessment of transporting Canadian oil sands</header> 
<subsection id="HF0F4FCA9B23A4FFD85B63C3A45443DDC"><enum>(a)</enum><header>In general</header><text>The Commandant of the Coast Guard shall assess the increased vessel traffic in the Salish Sea (including Puget Sound, the Strait of Georgia, Haro Strait, Rosario Strait, and the Strait of Juan de Fuca), that may occur from the transport of Canadian oil sands oil.</text></subsection> 
<subsection id="H2098BC12C6C84623B968CC2FB02C10D5"><enum>(b)</enum><header>Scope</header><text>The assessment required under subsection (a) shall, at a minimum, consider—</text> 
<paragraph id="H04DAC337A9E74D5FAC987D1325E65DEF"><enum>(1)</enum><text>the extent to which vessel (including barge, tanker, and supertanker) traffic may increase due to Canadian oil sands development;</text></paragraph> 
<paragraph id="H4F1A5FC68FCC4B89BC54B8F45257E3BC"><enum>(2)</enum><text>whether the transport of oil from Canadian oil sands within the Salish Sea is likely to require navigation through United States territorial waters;</text></paragraph> 
<paragraph id="HF1C0D499237942CDB5CD950FCCBE0ACF"><enum>(3)</enum><text>the rules or regulations that restrict supertanker traffic in United States waters, including an assessment of whether there are methods to bypass those rules or regulations in such waters and adjacent Canadian waters;</text></paragraph> 
<paragraph id="H98C186FD995F4508B073095DB4B74A12"><enum>(4)</enum><text>the rules or regulations that restrict the amount of oil transported in tankers or barges in United States waters, including an assessment of whether there are methods to bypass those rules or regulations in such waters and adjacent Canadian waters;</text></paragraph> 
<paragraph id="HE7A03CDF29A24D38B3EC795A4F083A55"><enum>(5)</enum><text>the spill response capability throughout the shared waters of the United States and Canada, including oil spill response planning requirements for vessels bound for one nation transiting through the waters of the other nation;</text></paragraph> 
<paragraph id="H88E8B3E5B9E141398D1F9D2E74A2E3DF"><enum>(6)</enum><text>the vessel emergency response towing capability at the entrance to the Strait of Juan de Fuca;</text></paragraph> 
<paragraph id="H1FC58D963DCF47119EF0773B5A11161F"><enum>(7)</enum><text>the agreement between the United States and Canada that outlines requirements for laden tank vessels to be escorted by tug boats;</text></paragraph> 
<paragraph id="HB104367EBD57400A8046DE9996448180"><enum>(8)</enum><text>whether oil extracted from oil sands has different properties from other types of oil, including toxicity and other properties, that may require different maritime clean up technologies;</text></paragraph> 
<paragraph id="H111ABE3B8FD14846BEEA343074AA8819"><enum>(9)</enum><text>a risk assessment of the increasing supertanker, tanker, and barge traffic associated with Canadian oil sands development or expected to be associated with Canadian oil sands development; and</text></paragraph> 
<paragraph id="H34BDCD4A26BB41D682BC2594E2F8DF31"><enum>(10)</enum><text>the potential costs and benefits to the United States public and the private sector of maritime transportation of oil sands products.</text></paragraph></subsection> 
<subsection id="HE55B68E89E69462A84C40698016110C2"><enum>(c)</enum><header>Consultation requirement</header><text>In conducting the assessment required under this section, the Commandant shall consult with the State of Washington, affected tribal governments, and industry, including vessel operators, oil sands producers, and spill response experts. The Commandant may consult with the Secretary of State.</text></subsection> 
<subsection id="HABEBED35E9064EA89095F0BB74C55068"><enum>(d)</enum><header>Deadline for submission</header><text>Not later than 180 days after the date of enactment of this Act, the Commandant shall submit the assessment required under this section to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subsection></section></title>
