			<section id="H699632D0A9194350A4CB2A377A3E5FE1"><enum>101.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">Funds are
			 authorized to be appropriated for each of the fiscal years 2012, 2013, and 2014
			 for necessary expenses of the Coast Guard as follows:</text>
				<paragraph id="HAA9BE8154537436B990190DA626B6967"><enum>(1)</enum><text>For the operation
			 and maintenance of the Coast Guard—</text>
					<subparagraph id="H9BDB544E3E5842118E4D141F4D6CA950"><enum>(A)</enum><text>$6,819,505,000 for
			 fiscal year 2012;</text>
					</subparagraph><subparagraph id="H87908F3ABC024D939F7CDB1B56D71DEC"><enum>(B)</enum><text>$6,922,645,000 for
			 fiscal year 2013; and</text>
					</subparagraph><subparagraph id="HB1641A9827664AFE9B043E79EF89F17B"><enum>(C)</enum><text>$7,018,499,000 for
			 fiscal year 2014;</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">of which
			 $24,500,000 is authorized for each of the fiscal years 2012, 2013, and 2014 to
			 be derived from the Oil Spill Liability Trust Fund to carry out the purposes of
			 section 1012(a)(5) of the Oil Pollution Act of 1990 (33 U.S.C.

			 fiscal year 2012;</text>

					</subparagraph><subparagraph id="H35BB46CE17254EFABD41262938618617"><enum>(C)</enum><text>$139,311,000 for
			 fiscal year 2014.</text>
					</subparagraph></paragraph><paragraph id="H744D4F8F798641F9BDC378A7F3294225"><enum>(4)</enum><text>For environmental
			 compliance and restoration of Coast Guard vessels, aircraft, and facilities
			 (other than parts and equipment associated with operation and
			 maintenance)—</text>

			 fiscal year 2012;</text>
					</subparagraph><subparagraph id="H8511D5A70C6A444996A68482844E2369"><enum>(B)</enum><text display-inline="yes-display-inline">$16,699,000 for fiscal year 2013;
			 and</text>
					</subparagraph><subparagraph id="HB7249B32900D4A8E82B22EDFA0024B21"><enum>(C)</enum><text>$16,700,000 for
			 fiscal year 2014;</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">to remain
			 available until expended.</continuation-text></paragraph><paragraph id="H551FB36494574943A110572FBB95F811"><enum>(5)</enum><text>To the Commandant
			 of the Coast Guard for research, development, test, and evaluation of
			 technologies, materials, and human factors directly related to improving the
			 performance of the Coast Guard’s mission in search and rescue, aids to
			 navigation, marine safety, marine environmental protection, enforcement of laws
			 and treaties, ice operations, oceanographic research, and defense
			 readiness—</text>
					<subparagraph id="H597E6D45A3B444D4819C2B148D629C1C"><enum>(A)</enum><text>$19,779,000 for
			 fiscal year 2012;</text>
					</subparagraph><subparagraph id="H83B91DCB8ACA4596B3EBE20945ED8572"><enum>(B)</enum><text>$19,848,000 for
			 fiscal year 2013; and</text>
					</subparagraph><subparagraph id="HABF6C4E2976B4B958466D1EE37A6AB14"><enum>(C)</enum><text>$19,913,000 for
			 fiscal year 2014;</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">of which
			 $650,000 for each of the fiscal years 2012, 2013, and 2014 shall be derived
			 from the Oil Spill Liability Trust Fund to carry out the purposes of section
			 1012(a)(5) of the Oil Pollution Act of 1990.</continuation-text></paragraph></section><section id="H4820C7D7CC524408984738440279C858"><enum>102.</enum><header>Authorized
			 levels of military strength and training</header>
				<subsection id="H47877F6D91B740C5A44B41907A17B8C3"><enum>(a)</enum><header>Active duty
			 strength</header><text>The Coast Guard is authorized an end-of-year strength
			 for active duty personnel of 47,000 for each of the fiscal years 2012 through
			 fiscal year 2014.</text>
				</subsection><subsection id="H85BE7BE360B04D93A11C378CF91AB0D7"><enum>(b)</enum><header>Military
			 training student loads</header><text>The Coast Guard is authorized average
			 military training student loads for the each of the fiscal years 2012 through
			 fiscal year 2014 as follows:</text>
					<paragraph id="H4A0148ECF5CC4D23B86E4BDE03ABBA68"><enum>(1)</enum><text>For recruit and
			 special training, 2,500 student years.</text>
					</paragraph><paragraph id="HA239F4D341864DF5894D57048A1537A9"><enum>(2)</enum><text>For flight
			 training, 165 student years.</text>
					</paragraph><paragraph id="H045FF0EDB04B4095994AF49D47C158C7"><enum>(3)</enum><text>For professional
			 training in military and civilian institutions, 350 student years.</text>
					</paragraph><paragraph id="HD2A810AFD282498B8A46C81889DE1A6C"><enum>(4)</enum><text>For officer
			 acquisition, 1,200 student years.</text>
					</paragraph></subsection></section></title><title id="H78961A9449F7459F873D059940CDF263"><enum>II</enum><header>Coast Guard and
			 Servicemember Parity</header>
			<section id="HCF7C7C8E8840477F9EA3663F7CA5048B"><enum>201.</enum><header>Academy
			 emoluments</header><text display-inline="no-display-inline">Section 195 of
			 title 14, United States Code, is amended—</text>
				<paragraph id="H033B44A814D34E2582209783909F2B36"><enum>(1)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="H7E2DAC4D4E3D44F8BB8FB06DAEC10CC6"><enum>(A)</enum><text>in the first
			 sentence—</text>
						<clause id="H39DF4DBBE1C24B25B7FDADE127EFF5BE"><enum>(i)</enum><text>by
			 striking <quote>person</quote> and inserting <quote>foreign national</quote>;
			 and</text>
						</clause><clause id="H40B20A5AF2C244ECAF19872B2288D038"><enum>(ii)</enum><text>by
			 striking <quote>pay and allowances,</quote> and inserting <quote>pay,
			 allowances, and emoluments,</quote>; and</text>
						</clause></subparagraph><subparagraph id="H18F85B3C784A40F79489F36102088BFE"><enum>(B)</enum><text>in the second
			 sentence—</text>
						<clause id="H697983D9613D4C8188F9C6159E323325"><enum>(i)</enum><text>by
			 striking <quote>A person</quote> and inserting <quote>A foreign
			 national</quote>; and</text>
						</clause><clause id="HA20841CB9BD1474B8F38CF694C94CCB5"><enum>(ii)</enum><text>by
			 striking <quote>pay and allowances,</quote> and inserting <quote>pay,
			 allowances, and emoluments,</quote>; and</text>
						</clause></subparagraph></paragraph><paragraph id="H5DBE7127569D42DB92E8E42E27FDA590"><enum>(2)</enum><text>in subsection (d),
			 by striking <quote>A person</quote> and inserting <quote>A foreign
			 national</quote>.</text>
				</paragraph></section><section id="H7A81C831D06344BE847FA11FE7F09077"><enum>202.</enum><header>Policy on
			 sexual harassment and sexual violence</header>
				<subsection id="H66E9431C528F450CA994711632F3F350"><enum>(a)</enum><header>Policy
			 requirement</header><text>Chapter 9 of title 14, United States Code, is amended
			 by inserting the following:</text>
					<quoted-block id="HBD7CD488C5B344059339990265EFE467" style="USC">
						<section id="H03D7ED2F305345C698669422F69CBEF5"><enum>200.</enum><header>Policy on
				sexual harassment and sexual violence</header>
							<subsection id="HFFE8529A1AEC49C0BD653C1438E8500E"><enum>(a)</enum><header>Required
				policy</header><text>The Commandant shall direct the Superintendent of the
				Coast Guard Academy to prescribe a policy on sexual harassment and sexual
				violence applicable to the cadets and other personnel of the Coast Guard
				Academy.</text>
							</subsection><subsection id="H080EFE540227475AA429DB986E50D5F5"><enum>(b)</enum><header>Matters To be
				specified in policy</header><text>The policy on sexual harassment and sexual
				violence prescribed under this section shall include specification of the
				following:</text>
								<paragraph id="H121898590B4045AD8812204428B4C8F0"><enum>(1)</enum><text>Programs to
				promote awareness of the incidence of rape, acquaintance rape, and other sexual
				offenses of a criminal nature that involve cadets or other Academy
				personnel.</text>
								</paragraph><paragraph id="H0C83F913199247F28EA2737C942A117B"><enum>(2)</enum><text>Procedures that a
				cadet should follow in the case of an occurrence of sexual harassment or sexual
				violence, including—</text>
									<subparagraph id="H8A61A1AA10854C9D9800CFE9A2C5E114"><enum>(A)</enum><text>if the cadet
				chooses to report an occurrence of sexual harassment or sexual violence, a
				specification of the person or persons to whom the alleged offense should be
				reported and the options for confidential reporting;</text>
									</subparagraph><subparagraph id="H9E2781DAFF014C10AA838DCD361CFDF4"><enum>(B)</enum><text>a specification of
				any other person whom the victim should contact; and</text>
									</subparagraph><subparagraph id="H17C20E9D350E45A9A613413E7ECD9154"><enum>(C)</enum><text>procedures on the
				preservation of evidence potentially necessary for proof of criminal sexual
				assault.</text>
									</subparagraph></paragraph><paragraph id="H4C07ED93EE974F2CB86B426DEDACDD49"><enum>(3)</enum><text>Procedures for
				disciplinary action in cases of alleged criminal sexual assault involving a
				cadet or other Academy personnel.</text>
								</paragraph><paragraph id="H24D0A4145FD342FA9B0061F1B77DD038"><enum>(4)</enum><text>Any other sanction
				authorized to be imposed in a substantiated case of sexual harassment or sexual
				violence involving a cadet or other Academy personnel in rape, acquaintance
				rape, or any other criminal sexual offense, whether forcible or
				nonforcible.</text>
								</paragraph><paragraph id="H0A440469AAAD47FEB0835E7E1A91D194"><enum>(5)</enum><text>Required training
				on the policy for all cadets and other Academy personnel, including the
				specific training required for personnel who process allegations of sexual
				harassment or sexual violence involving Academy personnel.</text>
								</paragraph></subsection><subsection id="H45959279F1A14F759FCD164FE9954A8B"><enum>(c)</enum><header>Annual
				assessment</header>
								<paragraph id="HEE1B7E8F1DAE45F58D1A9E4A509BCFFD"><enum>(1)</enum><text>The Commandant
				shall direct the Superintendent of the Academy to conduct at the Academy during
				each Academy program year an assessment to determine the effectiveness of the
				policies, training, and procedures of the Academy with respect to sexual
				harassment and sexual violence involving Academy personnel.</text>
								</paragraph><paragraph id="H9085C74C41514BA9BC3A63F57867E155"><enum>(2)</enum><text>For the assessment
				at the Academy under paragraph (1) with respect to an Academy program year that
				begins in an odd-numbered calendar year, the Superintendent shall conduct a
				survey of Academy personnel—</text>
									<subparagraph id="H3FBBE4358C45490FAA3761F0E63BC46B"><enum>(A)</enum><text>to measure—</text>
										<clause id="HB72C37B54C4B497BA123FF2A1B50F59A"><enum>(i)</enum><text>the incidence,
				during that program year, of sexual harassment and sexual violence events, on
				or off the Academy reservation, that have been reported to officials of the
				Academy; and</text>
										</clause><clause id="HCE0C36E7121248D192174CF1A15B436A"><enum>(ii)</enum><text>the incidence,
				during that program year, of sexual harassment and sexual violence events, on
				or off the Academy reservation, that have not been reported to officials of the
				Academy; and</text>
										</clause></subparagraph><subparagraph id="H10E0DAC155454FAE868B7B64CABF0ACE"><enum>(B)</enum><text>to assess the
				perceptions of Academy personnel of—</text>
										<clause id="H47F3D2B44100461CB455EF0385D6F4C1"><enum>(i)</enum><text>the policies,
				training, and procedures on sexual harassment and sexual violence involving
				Academy personnel;</text>
										</clause><clause id="H13B68FC43749490D8E80AEAA95AF13A6"><enum>(ii)</enum><text>the enforcement
				of such policies;</text>
										</clause><clause id="HA7E8D38FE1C14DDCAF30CDE0DE17BD4E"><enum>(iii)</enum><text>the incidence of
				sexual harassment and sexual violence involving Academy personnel; and</text>
										</clause><clause id="HDCFAAA9EE2FA4694855C4B008D365152"><enum>(iv)</enum><text>any other issues
				relating to sexual harassment and sexual violence involving Academy
				personnel.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H097000E2E84E4D29A4C70FA8ED73E960"><enum>(d)</enum><header>Annual
				report</header>
								<paragraph id="HB4AB664AA5EC413BA196DDB0C5B2D210"><enum>(1)</enum><text>The Commandant
				shall direct the Superintendent of the Academy to submit to the Commandant a
				report on sexual harassment and sexual violence involving cadets or other
				personnel at the Academy for each Academy program year.</text>
								</paragraph><paragraph id="HF50072091B02477C998C5F4B12BE47B8"><enum>(2)</enum><text>Each report under
				paragraph (1) shall include, for the Academy program year covered by the
				report, the following:</text>
									<subparagraph id="H8526E575E8D04BEC81640E3889BCA24F"><enum>(A)</enum><text>The number of
				sexual assaults, rapes, and other sexual offenses involving cadets or other
				Academy personnel that have been reported to Academy officials during the
				program year and, of those reported cases, the number that have been
				substantiated.</text>
									</subparagraph><subparagraph id="HD46A52EF14DC42B395E54FF82485ABEE"><enum>(B)</enum><text>The policies,
				procedures, and processes implemented by the Commandant and the leadership of
				the Academy in response to sexual harassment and sexual violence involving
				cadets or other Academy personnel during the program year.</text>
									</subparagraph><subparagraph id="HC4FD4BB7F73C41C9B681FBD1FA9BB879"><enum>(C)</enum><text>A plan for the
				actions that are to be taken in the following Academy program year regarding
				prevention of and response to sexual harassment and sexual violence involving
				cadets or other Academy personnel.</text>
									</subparagraph></paragraph><paragraph id="H935ADBC53302426CBCFE597B3C56ECB6"><enum>(3)</enum><text>Each report under
				paragraph (1) for an Academy program year that begins in an odd-numbered
				calendar year shall include the results of the survey conducted in that program
				year under subsection (c)(2).</text>

			 reports of aircraft accident investigations</header>
				<subsection id="H141917C6602948E492A67BEBB6A94915"><enum>(a)</enum><header>In
			 general</header><text>Chapter 17 of title 14, United States Code, is amended by
			 adding at the end the following:</text>
					<quoted-block id="HA51B3E27A59C4A59B5DD6802F3A1F3CC" style="USC">
						<section id="H1A74B5AE1D4E4078835577379CA84D10"><enum>678.</enum><header>Treatment of
				reports of aircraft accident investigations</header>
							<subsection id="HE8C9E08C8CE74CEE92AC17459A1BF64C"><enum>(a)</enum><header>In
				general</header><text>Whenever the Commandant conducts an accident
				investigation of an accident involving an aircraft under the jurisdiction of
				the Commandant, the records and report of the investigation shall be treated in
				accordance with this section.</text>
							</subsection><subsection id="H2813B9853D034BBC9D982DA5D291CB1E"><enum>(b)</enum><header>Public
				disclosure of certain accident investigation information</header>
								<paragraph id="HCCAE728F18B147AB9EE04B4D83E55F92"><enum>(1)</enum><text>Subject to
				paragraph (2), the Commandant, upon request, shall publicly disclose
				unclassified tapes, scientific reports, and other factual information pertinent
				to an aircraft accident investigation.</text>
								</paragraph><paragraph id="HF10C9ABF5A234AE6A2E027809747F227"><enum>(2)</enum><text>The Commandant
				shall not disclose the information requested in paragraph (1) unless the
				Commandant determines—</text>
									<subparagraph id="HAE2E418DEDE246D38DA8EEC64A6A173E"><enum>(A)</enum><text>that such tapes,
				reports, or other information would be included within and releasable with the
				final accident investigation report; and</text>
									</subparagraph><subparagraph id="HB8800E2989D0471E812312F06BEBF90D"><enum>(B)</enum><text>that release of
				such tapes, reports, or other information—</text>
										<clause id="HAB30A1DB7A8941B799CF16D5BC1FE478"><enum>(i)</enum><text>would not
				undermine the ability of accident or safety investigators to continue to
				conduct the investigation; and</text>
										</clause><clause id="H179E1B8E03FF41939A259F484894E9A6"><enum>(ii)</enum><text>would not
				compromise national security.</text>
										</clause></subparagraph></paragraph><paragraph id="HCB61DD4239AE491A881A69211A879FE2"><enum>(3)</enum><text>A disclosure under
				paragraph (1) may not be made by or through officials with responsibility for,
				or who are conducting, a safety investigation with respect to the
				accident.</text>
								</paragraph></subsection><subsection id="H2A6F393ECE444CB99477FF0B465B8616"><enum>(c)</enum><header>Opinions
				regarding causation of accident</header><text>Following an aircraft accident
				referred to in subsection (a)—</text>
								<paragraph id="H06AB097312E14257A31A68837A239934"><enum>(1)</enum><text>if the evidence
				surrounding the accident is sufficient for the investigators who conduct the
				accident investigation to come to an opinion as to the cause or causes of the
				accident, the final report of the accident investigation shall set forth the
				opinion of the investigators as to the cause or causes of the accident;
				and</text>
								</paragraph><paragraph id="H18043C536DC744F084C6C878654B0AD5"><enum>(2)</enum><text>if the evidence
				surrounding the accident is not sufficient for the investigators to come to an
				opinion as to the cause or causes of the accident, the final report of the
				accident investigation shall include a description of those factors, if any,
				that, in the opinion of the investigators, substantially contributed to or
				caused the accident.</text>
								</paragraph></subsection><subsection id="HB0B7FC851A41421ABADEE17BD6A879CB"><enum>(d)</enum><header>Use of
				information in civil proceedings</header><text>For purposes of any civil or
				criminal proceeding arising from an aircraft accident referred to in subsection
				(a), any opinion of the accident investigators as to the cause of, or the
				factors contributing to, the accident set forth in the accident investigation
				report may not be considered as evidence in such proceeding, nor may such
				report be considered an admission of liability by the United States or by any
				person referred to in such report.</text>
							</subsection><subsection id="H5E3441E474FE401A8C0D1D0F44E80103"><enum>(e)</enum><header>Regulations</header><text>The
				Commandant shall prescribe regulations to carry out this section.</text>
							</subsection><subsection id="HB737158CDB564ADD8231E8D82E8582EF"><enum>(f)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
								<paragraph id="H322C57DF7A764223BC0BBCE3A9388895"><enum>(1)</enum><text>the term
				<quote>accident investigation</quote> means any form of investigation by Coast
				Guard personnel of an aircraft accident referred to in subsection (a), other
				than a safety investigation; and</text>
								</paragraph><paragraph id="HA536A6F56D2144748FFE92D6F297C908"><enum>(2)</enum><text>the term
				<quote>safety investigation</quote> means an investigation by Coast Guard
				personnel of an aircraft accident referred to in subsection (a), that is
				conducted solely to determine the cause of the accident and to obtain
				information that may prevent the occurrence of similar
				accidents.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H9687D8668FA94F269E8D9841B83F7250"><enum>(b)</enum><header>Clerical

			 Committee on Transportation and Infrastructure of the House of Representatives
			 a report on the status of Coast Guard servicemember housing, including—</text>

			 statement of the Coast Guard’s housing needs requirements;</text>

				E felony; and</text>

				penalty of not more than $1,000 per day for each

				and performance goals for such program, including a justification for any
				change to those needs and goals from any report previously submitted under this
				subsection;</text>
								</paragraph><paragraph id="HEA4EB109D9354FCD810675F71838A8BD"><enum>(2)</enum><text>a justification
				for how the projected number and capabilities of each planned acquisition
				program asset meets those mission needs and performance goals;</text>
								</paragraph><paragraph id="HAC9C375F025E4F23873EC52BA368CFA2"><enum>(3)</enum><text>an identification
				of any and all mission hour gaps, accompanied by an explanation on how and when
				the Coast Guard will close those gaps;</text>
								</paragraph><paragraph id="H475B8BA8CDCA4167B414D25ED6E5C3B4"><enum>(4)</enum><text>an identification
				of any changes to such program, including—</text>

				timeline for the acquisition of each new asset and the phase out of legacy

				costs of new assets and legacy assets for that fiscal year, future fiscal
				years, or the total acquisition cost;</text>

				for how any change to such program fulfills the mission needs and performance
				goals of the Coast Guard;</text>
								</paragraph><paragraph id="HCAFA33581E7642FB9B4C0442EFBDC6DC"><enum>(6)</enum><text>a description of
				how the Coast Guard is planning for the integration of each new asset acquired
				under such program into the Coast Guard, including needs related to shore-based
				infrastructure and human resources;</text>
								</paragraph><paragraph id="H18299E55B6CE4A4AA7B685493FFC35C3"><enum>(7)</enum><text>an identification
				of how funds in that fiscal year’s budget request will be allocated, including
				information on the purchase of specific assets;</text>
								</paragraph><paragraph id="H40569107D01542DC93934B87B93B6544"><enum>(8)</enum><text>a projection of
				the remaining operational lifespan and lifecycle cost of each legacy asset that
				also identifies any anticipated resource gaps;</text>
								</paragraph><paragraph id="H10AAC414AA7C49CD831D33AC988EC755"><enum>(9)</enum><text>a detailed
				explanation of how the costs of the legacy assets are being accounted for
				within such program;</text>
								</paragraph><paragraph id="H1842D5FA33D54ADA987764033A3FB349"><enum>(10)</enum><text>an annual
				performance comparison of new assets to legacy assets; and</text>
								</paragraph><paragraph id="H2C1E50AD8D6341B6996E53AA99890A9E"><enum>(11)</enum><text>an identification
				of the scope of the anticipated acquisitions workload for the next fiscal year
				and a determination on the adequacy of the current acquisition workforce to
				meet that anticipated workload, including the specific positions that are or
				will be understaffed, and actions that will be taken to correct such
				understaffing.</text>
								</paragraph></subsection><subsection id="H82DA6EE8512347BE9A2D7ACD7C722D3A"><enum>(c)</enum><header>Cutters not
				maintained in class</header><text>Each report under subsection (a) shall
				identify which, if any, Coast Guard cutters that have been issued a certificate
				of classification by the American Bureau of Shipping have not been maintained
				in class with an explanation detailing the reasons why they have not been
				maintained in class.</text>
							</subsection><subsection id="HFDE42E3CC987404388831739AA3DF183"><enum>(d)</enum><header>Definition</header><text>For
				the purposes of this section, the term <quote>major acquisition program</quote>
				means an ongoing acquisition undertaken by the Coast Guard with a life-cycle
				cost estimate greater than or equal to
				$300,000,000.</text>

			 Act, the Commandant of the Coast Guard shall decommission the USCGC POLAR SEA

			 star</header><text>Not later than 3 years after the date of enactment of this
			 Act, the Commandant of the Coast Guard shall decommission the USCGC POLAR STAR
			 (WAGB 10).</text>
				</subsection></section><section id="HFCE9EDE62FE942689FE67D7AA272AC89"><enum>308.</enum><header>Assessment of
			 needs for additional coast guard presence in high latitude
			 regions</header><text display-inline="no-display-inline">Not later than 60 days
			 after the date of enactment of this Act, the Secretary of the department in
			 which the Coast Guard is operating shall submit a report to the Committee on
			 Commerce, Science, and Transportation of the Senate and the Committee on
			 Transportation and Infrastructure of the House of Representatives assessing the
			 need for additional Coast Guard prevention and response capability in the high
			 latitude regions. The assessment shall address needs for all Coast Guard
			 mission areas, including search and rescue, marine pollution response and
			 prevention, fisheries enforcement, and maritime commerce. The Secretary shall
			 include in the report—</text>
				<paragraph id="HBCC5B310ED3047ADAE99DFA05004F006"><enum>(1)</enum><text>an assessment of
			 the high latitude operating capabilities of all current Coast Guard assets
			 other than icebreakers, including assets acquired under the Deepwater
			 program;</text>
				</paragraph><paragraph id="H751F74DA88D24DE398453F07A960D887"><enum>(2)</enum><text>an assessment of
			 projected needs for Coast Guard forward operating bases in the high latitude
			 regions; and</text>
				</paragraph><paragraph id="HC44A3659A33940138DF0AD90830BC08A"><enum>(3)</enum><text>an assessment of
			 shore infrastructure, personnel, logistics, communications, and resources
			 requirements to support Coast Guard forward operating bases in the high
			 latitude regions.</text>

			 general</header><text>Chapter 555 of title 46, United States Code, is amended

				is established a Committee on the Marine Transportation System (in this section
				referred to as the <quote>Committee</quote>).</text>
							</subsection><subsection id="H34D5FC3BB8E44BBD892A50348D59BC9B"><enum>(b)</enum><header>Purpose</header><text>The
				Committee shall—</text>
								<paragraph id="HE1C26020907743049289D9E0CD3D6D43"><enum>(1)</enum><text>assess the
				adequacy of the marine transportation system (including ports, waterways,
				channels, and their intermodal connections);</text>
								</paragraph><paragraph id="HAD2FCD1502AB48C7B06D631FA79BDFA4"><enum>(2)</enum><text>develop and
				implement policies to promote an efficient marine transportation system;
				and</text>
								</paragraph><paragraph id="H995D5A748CF842B7BE5FFC5E167F493B"><enum>(3)</enum><text>coordinate
				policies among Federal agencies to promote an efficient marine transportation
				system.</text>
								</paragraph></subsection><subsection id="H571F833D327B4B868184A09DDD30B142"><enum>(c)</enum><header>Membership</header>
								<paragraph id="HCDFA4763F39947808608CDD86C12F783"><enum>(1)</enum><header>In
				general</header><text>The Committee shall consist of the Secretary of
				Transportation, the Secretary of Defense, the Secretary of Homeland Security,
				the Secretary of Commerce, the Secretary of the Treasury, the Secretary of
				State, the Secretary of the Interior, the Secretary of Agriculture, the
				Attorney General, the Secretary of Labor, the Secretary of Energy, the
				Administrator of the Environmental Protection Agency, the Chairman of the
				Federal Maritime Commission, and the head of any other Federal agency that the
				Committee Chair, with the approval of a majority of the voting members of the
				Committee, determines can further the purpose and activities of the
				Committee.</text>
								</paragraph><paragraph id="H5A76367454C04D27A998475ADFD4B569"><enum>(2)</enum><header>Ex-officio
				members</header><text>The Committee may also consist of so many nonvoting
				members as the Committee Chair, with the approval of a majority of the voting
				members of the Committee, determines is appropriate to further the purpose and
				activities of the Committee.</text>
								</paragraph><paragraph id="H89EE05A3D951421FBA292698731E3B80"><enum>(3)</enum><header>Chairman</header><text>The
				Chair of the Committee shall rotate each year among the Secretary of
				Transportation, the Secretary of Defense, the Secretary of Homeland Security,
				and the Secretary of Commerce. The order of rotation shall be determined with
				the approval of a majority of the voting members of the Committee.</text>
								</paragraph></subsection><subsection id="H2B3AA5D7DDA243E5BAC84F25B2A73A10"><enum>(d)</enum><header>Support</header>
								<paragraph id="H9106837BB34C4FD38CC1AA4732F05A83"><enum>(1)</enum><header>Coordinating
				board</header><text>Each member of the Committee may select a senior level
				representative to serve on a coordinating board which shall assist the
				Committee in carrying out its purpose and activities.</text>
								</paragraph><paragraph id="H78512F5A45E148FE8C2A44116B4B0F9B"><enum>(2)</enum><header>Executive
				director</header><text>The Secretary of Transportation, in consultation with
				the Secretary of Defense, the Secretary of Homeland Security, and the Secretary
				of Commerce, shall select an executive director to assist the Committee in
				carrying out its purpose and activities.</text>
								</paragraph></subsection><subsection id="HE48271E81EF04B6FAE16E9FA203D4773"><enum>(e)</enum><header>Marine
				transportation system assessment and strategy</header><text>Not later than one
				year after the date of enactment of this Act and every 5 years thereafter, the
				Committee shall provide a report to Congress which includes—</text>
								<paragraph id="H779E263D47834C7BA5096E327B8ED833"><enum>(1)</enum><text>steps taken to
				implement actions recommended in the July 2008 <quote>National Strategy for the
				Marine Transportation System: A Framework for Action</quote>;</text>
								</paragraph><paragraph id="HFED43B9CBC79479E87346C4601F987B3"><enum>(2)</enum><text>an assessment of
				the condition of the marine transportation system;</text>
								</paragraph><paragraph id="H2E019E9D3FEC448CADFF2D1CEA167B68"><enum>(3)</enum><text>a discussion of
				the challenges the system faces in meeting user demand;</text>
								</paragraph><paragraph id="H7D9616A8B0504D6DB0757EA7829554C6"><enum>(4)</enum><text>a plan with
				recommended actions for improving the marine transportation system to meet
				current and future challenges; and</text>
								</paragraph><paragraph id="HA3C6C69AD3C1483DAC05D998CEE8CC7D"><enum>(5)</enum><text>steps taken to
				implement actions recommended in previous reports required under this
				subsection.</text>
								</paragraph></subsection><subsection id="H42BA9E501DC54F70BF772791298F1F9B"><enum>(f)</enum><header>Consultation</header><text>In
				carrying out its purpose and activities, the Committee may consult with the
				Marine Transportation System National Advisory Council, interested parties, and
				the
				public.</text>

			 States shipyard jobs and industrial base expertise as a result of rebuild,
			 conversion, and double-hull work on United States-flag vessels eligible to
			 engage in the coastwise trade being performed in foreign shipyards;</text>
				</paragraph><paragraph id="H73DD33C103194732B261BC6B4CAC6C3F"><enum>(2)</enum><text>enforcement of the
			 Coast Guard’s foreign rebuild determination regulations; and</text>
				</paragraph><paragraph id="HA60348386FA546CD93CD4B16E8E71205"><enum>(3)</enum><text>recommendations
			 for improving the transparency in the Coast Guard’s foreign rebuild
			 determination process.</text>

				laws of a foreign nation, may not be brought under the laws of the United
				States if—</text>
							<paragraph id="H7650B466CAA949B08235DDC11DB6990D"><enum>(1)</enum><text>such seaman was
				not a permanent resident alien of the United States at the time the claim
				arose;</text>
							</paragraph><paragraph id="H7F61A61A7E2B49109280B4FC9B5CC8D3"><enum>(2)</enum><text>the injury,
				illness, or death occurred on the high seas or in the territorial waters of a
				nation other than the United States; and</text>
							</paragraph><paragraph id="HC293D0F90BCE4A1197CF8D1524472757"><enum>(3)</enum><text>the seaman or the
				seaman’s personal representative has or had a right to seek compensation for
				the injury, illness, or death in, or under the laws of—</text>
								<subparagraph id="H0F45753103F04AB7AF1692510DEDE63B"><enum>(A)</enum><text>the nation in
				which the vessel was registered at the time the claim arose; or</text>
								</subparagraph><subparagraph id="H1D1793E9D77F42249DA5ED1A14D29371"><enum>(B)</enum><text>the nation in
				which the seaman maintained citizenship or residency at the time the claim
				arose.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 on fishing permits</header>

			 Code, is amended by adding at the end the following:</text>

								<paragraph id="H2139141A001144D6881EE68F958B9178"><enum>(1)</enum><text>does not establish
				a maritime lien on a permit that—</text>
									<subparagraph id="HBDEC5CFD50AA43CB98BCA0C1C0D847B4"><enum>(A)</enum><text>authorizes a
				person or use of a vessel to engage in fishing; and</text>

								</paragraph></subsection><subsection id="H4EF79238405948A5868B727ABE6347E8"><enum>(b)</enum><header>Fishing permit
				described</header><text>A fishing permit—</text>
								<paragraph id="H3E907BCEE8D04061BC80293F6D272CFA"><enum>(1)</enum><text>is governed solely
				by the State or Federal law under which it was issued; and</text>
								</paragraph><paragraph id="HAB704570FE01457EA25B4460DB419BCE"><enum>(2)</enum><text>is not included in
				the whole of a vessel or as an appurtenance or intangible of a vessel for any
				purpose.</text>
								</paragraph></subsection><subsection id="H735F6BA90CCA494DBDB9A9FD085C9CDC"><enum>(c)</enum><header>Limitation on
				statutory construction</header><text>Nothing in subsections (a) and (b) shall
				be construed as imposing any limitation upon the authority of the Secretary of
				Commerce to modify, suspend, revoke, or sanction any Federal fishery permit
				issued by the Secretary of Commerce or to bring a civil action to enforce such
				modification, suspension, revocation, or
				sanction.</text>

				submit to the Committee on Commerce, Science, and Transportation of the Senate
				and the Committee on Transportation and Infrastructure of the House of
				Representatives a comprehensive study on the construction or alteration of any
				bridge, drawbridge, or causeway over the navigable waters of the United States
				with a channel depth of 25 feet or greater that may impede or obstruct future
				navigation to or from port facilities, for which a permit under the Act of
				March 23, 1906 (chapter 1130; 33 U.S.C. 491 et seq.), popularly known as the
				Bridge Act of 1906, was requested on or after January 1, 2006 and on or before
				August 3,
				2011.</text>

				</subsection></section><section id="H9DAAE64AF7BF41BEAE8C7E60812A5D44"><enum>602.</enum><header>Report on Coast
			 Guard merchant mariner medical evaluation program</header>
				<subsection id="H38582D12FD204BC7B52EF6319209D569"><enum>(a)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Commandant of the Coast Guard shall submit to the Committee on
			 Transportation and Infrastructure of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate a report on
			 the Coast Guard National Maritime Center’s merchant mariner medical evaluation
			 program and alternatives to the program.</text>
				</subsection><subsection id="H16A9C69E4BDA49A999D52B4F3C3E3AA5"><enum>(b)</enum><header>Contents</header><text>The
			 report required under subsection (a) shall include the following:</text>
					<paragraph id="HF573E175234B467DB2514C4023632A19"><enum>(1)</enum><text>An overview of the
			 adequacy of the program for making medical certification determinations for
			 issuance of merchant mariners’ documents.</text>
					</paragraph><paragraph id="H9AE002DC8C1B411EAA88F134F3505ADC"><enum>(2)</enum><text>An analysis of how
			 a system similar to the Federal Motor Carrier Safety Administration’s National
			 Registry of Certified Medical Examiners program, and the Federal Aviation
			 Administration’s Designated Aviation Medical Examiners program, could be
			 applied by the Coast Guard to make medical fitness determinations for issuance
			 of merchant mariners’ documents.</text>
					</paragraph><paragraph id="H10467BB0653247849F523E69F6AEAD2A"><enum>(3)</enum><text>An explanation of
			 how the amendments to the International Convention on Standards of Training,
			 Certification and Watchkeeping for Seafarers, 1978, that enter into force on
			 January 1, 2012, will require changes to the Coast Guard’s merchant mariner
			 medical evaluation program.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H38D76CC4FFD741EAB5BB723B7BF81E15" section-type="subsequent-section"><enum>603.</enum><header>Notice of
			 arrival</header><text display-inline="no-display-inline">The regulations
			 required under section 109(a) of Public Law 109–347 (33 U.S.C. 1223 note) on
			 notice of arrival for foreign vessels on the Outer Continental Shelf shall not
			 apply to a vessel documented under section 12105 of title 46, United States
			 Code, unless such vessel arrives from a foreign port or place.</text>
