			 United States Code, the Secretary of the Army may enter into a multiyear

			 procurement of Arleigh Burke class guided missile destroyers, as well as the
			 AEGIS Weapon Systems, MK 41 Vertical Launching Systems, and Commercial
			 Broadband Satellite Systems associated with those vessels.</text>

			 multiyear procurement</header><text>Subject to section 2306b of title 10,
			 United States Code, the Secretary of the Navy may enter into a multiyear
			 contract or contracts, beginning with the fiscal year 2013 program year, for
			 the procurement of V–22 aircraft for the Department of the Navy, Department of
			 the Air Force and the United States Special Operations Command.</text>
					</subsection><subsection id="H2F8DDBA9BC664C8CBAF7507F16CFDA4B"><enum>(b)</enum><header>Condition for

					</subsection></section><section id="H9A8C365DE9D149F383856B2918B0740A"><enum>114.</enum><header>Refueling and
			 complex overhaul of the U.S.S. Abraham Lincoln</header>
					<subsection id="H2C058674AC3E454DAE67C686F7C539D7"><enum>(a)</enum><header>Amount
			 authorized from scn account</header><text>Of the amount appropriated or
			 otherwise made available for shipbuilding and conversion, Navy, for fiscal year
			 2013, $1,613,392,000 is authorized to be available for the commencement of the
			 nuclear refueling and complex overhaul of the U.S.S. Abraham Lincoln (CVN–72)
			 during fiscal year 2013. The amount authorized to be made available in the
			 preceding sentence is the first increment in the two-year sequence of
			 incremental funding planned for the nuclear refueling and complex overhaul of
			 that vessel.</text>
					</subsection><subsection id="HF6989ADC33A94E6C8BF5F6442AC0E2FD"><enum>(b)</enum><header>Contract
			 authority</header><text>The Secretary of the Navy is authorized to enter into a
			 contract during fiscal year 2013 for the nuclear refueling and complex overhaul
			 of the U.S.S. Abraham Lincoln.</text>
					</subsection><subsection id="HEA14D5FD268F417DA0ACEED74B53DE67"><enum>(c)</enum><header>Condition for
			 out-Year contract payments</header><text>A contract entered into under
			 subsection (b) shall provide that any obligation of the United States to make a
			 payment under the contract for a fiscal year after fiscal year 2013 is subject
			 to the availability of appropriations for that purpose for that later fiscal
			 year.</text>
					</subsection></section><section id="HF64A2061447746D484773B9F159626D6"><enum>115.</enum><header>Multiyear
			 procurement authority for Virginia class submarine program</header>
					<subsection id="HD4375344773D419792796C287F97B5D0"><enum>(a)</enum><header>Authority for
			 multiyear procurement</header><text>The Secretary of the Navy may, in
			 accordance with section 2306b of title 10, United States Code, enter into
			 multiyear contracts, beginning with the fiscal year 2014 program year, for
			 procurement of Virginia class submarines and Government-furnished equipment
			 associated with the Virginia class submarine program.</text>
					</subsection><subsection id="H155D1E3B157B445DA23FA4C6071EF382"><enum>(b)</enum><header>Authority for
			 advance procurement</header><text>The Secretary of the Navy may enter into one
			 or more contracts, beginning in fiscal year 2013, for advance procurement
			 associated with the vessels and equipment for which authorization to enter into
			 a multiyear procurement contract is provided under subsection (a).</text>
					</subsection><subsection id="HAF07B5D921C74706BA181F3AB0857BD7"><enum>(c)</enum><header>Condition for
			 out-Year contract payments</header><text>A contract entered into under
			 subsection (a) shall provide that any obligation of the United States to make a
			 payment under the contract for a fiscal year after fiscal year 2014 is subject
			 to the availability of appropriations or funds for that purpose for such later
			 fiscal year.</text>
					</subsection></section><section id="H04EE43AB3D7A47C2A15B46003E6001D5"><enum>116.</enum><header>Extension of
			 multiyear procurement authority for F/A–18E, F/A–18F, and EA–18G
			 aircraft</header><text display-inline="no-display-inline">Section 128 of the
			 National Defense Authorization Act for Fiscal Year 2010 (Public Law 111–84; 123
			 Stat. 2217), as amended by Public Law 111–238 (124 Stat. 2500), is further
			 amended by adding at the end the following new subsection:</text>
					<quoted-block id="H013F660ADFE3472AA91F766A8CDEE170" style="OLC">
						<subsection id="H88B86397CD604E4C91C76C17F1510775"><enum>(f)</enum><header>Extension of
				multiyear authority</header><text>With respect to a multiyear contract entered
				into under subsection (a), the Secretary of the Navy may, notwithstanding any
				provision of section 2306b of title 10, United States Code, to the contrary,
				modify such contract to add a fifth production year to the
				contract.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HE94E5CA0379D4A8082E7FB96BA58F208"><enum>117.</enum><header>Authority for
			 reallocation of certain aegis weapon system assets between and within the
			 DDG–51 destroyer and Aegis Ashore programs in order to meet mission
			 requirements</header>
					<subsection id="H78716A9C3DEE43BA8EA7EA56A5EF30F3"><enum>(a)</enum><header>Authority</header><text>Notwithstanding
			 any other provision of law, the Secretary of the Navy is authorized to provide
			 Aegis Weapon System (AWS) equipment with Ballistic Missile Defense (BMD)
			 capability to the Missile Defense Agency (MDA) for use in its Aegis Ashore
			 System for installation in the country designated as Host Nation #1 (HN–1) by
			 transferring to MDA such equipment procured with prior-year Shipbuilding and
			 Conversion, Navy (SCN) appropriations for the DDG–51 Destroyer Program. The
			 Secretary of the Navy is further authorized to make adjustments in equipment
			 deliveries in accordance with subparagraph (a)(2) of this section as needed to
			 support shipbuilding schedules for affected ships. The Secretary of the Navy is
			 further authorized to install on an SCN-funded DDG–51 Class Destroyer, AWS
			 equipment with BMD capability procured using appropriations for Research,
			 Development, Test and Evaluation, Defense-Wide (RDT&amp;E,DW). The authority of
			 the Secretary of the Navy under this section shall consist of the following
			 specific authorizations:</text>
						<paragraph id="H0239DDDB5499431EB800682FEF9B31B2"><enum>(1)</enum><text>The Secretary of
			 the Navy may transfer AWS equipment with BMD capability procured for the DDG–51
			 Destroyer Program in FY 2010 and FY 2011 to MDA for installation in a
			 shore-based AWS in the country designated as HN–1.</text>
						</paragraph><paragraph id="H15AB864D3A9F4BE280FB556921203C59"><enum>(2)</enum><text>The Secretary of
			 the Navy may obligate funds appropriated under the subdivision of
			 appropriations <quote>DDG–51 Destroyer</quote> under the heading
			 <quote>Shipbuilding and Conversion, Navy</quote> for FY 2012, or may use any
			 AWS assets acquired with such funds, to deliver complete, mission-ready AWS
			 with BMD capability to any DDG–51 Class Destroyer for which SCN funds were
			 appropriated in FY 2011.</text>
						</paragraph><paragraph id="H1802C2477B1E44978152708924BA51DD"><enum>(3)</enum><text>The Director, MDA
			 shall transfer AWS equipment with BMD capability procured for installation in a
			 shore-based AWS to the Department of the Navy for the DDG–51 Destroyer Program
			 to replace equipment transferred to MDA under the authority of subparagraph
			 (a)(1). Notwithstanding the appropriation that funded the acquisition of such
			 replacement equipment, the Secretary of the Navy shall fund all work necessary
			 to complete construction and outfitting of any recipient DDG–51 Class Destroyer
			 in the same manner as if the replacement equipment had been acquired using SCN
			 appropriations.</text>
						</paragraph></subsection><subsection id="H94988F78A36540FD9C968AB2C91E9254"><enum>(b)</enum><header>Relationship to
			 other law</header><text>Nothing in this section shall be construed to repeal or
			 otherwise modify in any way the limitation on obligation or expenditure of
			 funds for missile defense interceptors in Europe as specified in section 223 of
			 the Ike Skelton National Defense Authorization Act for Fiscal Year 2011 (Public
			 Law 111–383).</text>
					</subsection></section><section id="HD00EFB1CC6D348018C0BAA9B117791DE"><enum>118.</enum><header>Reduction in
			 number of aircraft required to be maintained in strategic airlift aircraft
			 inventory</header>
					<subsection id="HB7166D542FCD456FBABA6E8C7F715985"><enum>(a)</enum><header>Reduction in
			 inventory requirement</header><text>Section 8062(g)(1) of title 10, United
			 States Code, is amended—</text>
						<paragraph id="H9C8D8550210A443C97D2849B32450981"><enum>(1)</enum><text>by striking
			 <quote>Effective October 1, 2011, the</quote> and inserting <quote>The</quote>;
			 and</text>
						</paragraph><paragraph id="HABBC7184C5914EF29CDACA287BEB598D"><enum>(2)</enum><text>by striking
			 <quote>301 aircraft</quote> and inserting <quote>275 aircraft</quote>.</text>
						</paragraph></subsection><subsection id="H0B7AE69B6C2E4A618DB4CCC52F86F950"><enum>(b)</enum><header>Modification of
			 certification requirement</header><text>Subsection (d)(3)(B) of section 137 of
			 the National Defense Authorization Act for Fiscal Year 2010 (Public Law 111–84;
			 123 Stat. 2221) is amended by striking <quote>316 strategic airlift
			 aircraft</quote> and inserting <quote>275 strategic airlift
			 aircraft</quote>.</text>
					</subsection></section><section id="H201760CD42C24D529E3959F921633B7B"><enum>119.</enum><header>Quadrennial
			 long-term plan for the procurement of aircraft for the Navy and the Air
			 Force</header>
					<subsection id="H78AC10C98B2F4D818AC93085D3B3759B"><enum>(a)</enum><header>In
			 general</header><text>Section 231a of title 10, United States Code, is amended
			 to read as follows:</text>
						<quoted-block id="H40AEFCD85616435198A252CC3BEFA623" style="USC">
							<section id="H40FF92F37920476D8868CA352E5835C7"><enum>231a.</enum><header>Long-range
				plan for procurement of aircraft for the navy and air force</header>
								<subsection id="H38DE71A27163404EBEE015F32D2F75B2"><enum>(a)</enum><header>Quadrennial
				aircraft procurement plan</header><text>At the same time that the budget of the
				President is submitted under section 1105(a) of title 31 during each year in
				which the Secretary of Defense submits a quadrennial defense review, the
				Secretary of Defense shall submit to the congressional defense committees a
				long-range plan for the procurement of covered aircraft for the Department of
				the Navy and the Department of the Air Force that supports the aviation force
				structure recommendations of the quadrennial defense review.</text>
								</subsection><subsection id="H8F6AA53B533F4AA2AB0A5B136EEF3D4E"><enum>(b)</enum><header>Matters
				included</header><text>Each aircraft procurement plan under subsection (a)
				shall include the following:</text>
									<paragraph id="HF4C4782116B940C8AFE5DF9587678387"><enum>(1)</enum><text>A detailed
				schedule for procurement of covered aircraft for the Department of the Navy and
				the Department of the Air Force for the 10-year period beginning on the date on
				which the plan is submitted.</text>
									</paragraph><paragraph id="H54D876B576724DD4B71382A76E299869"><enum>(2)</enum><text>A notional
				procurement schedule for the 20-year period beginning on the date that is 10
				years after the date on which the plan is submitted.</text>
									</paragraph><paragraph id="H7FA3EAA5CD8643BCBC99BA1FF25D8EB2"><enum>(3)</enum><text>For the
				procurement schedules under paragraph (1)—</text>
										<subparagraph id="H699B1F0E202A405B8B5A8B0BB015F906"><enum>(A)</enum><text>the estimated
				levels of annual funding necessary to carry out such schedule;</text>
										</subparagraph><subparagraph id="H133A37E88FA141F1B43930F2E7C081D9"><enum>(B)</enum><text>a determination by
				the Director of Cost Assessment and Program Evaluation of the level of funding
				necessary to carry out such schedules; and</text>
										</subparagraph><subparagraph id="H47A61F4CD41A4F779B50960EB3D27E59"><enum>(C)</enum><text>an evaluation by
				the Director of the potential risk associated with such schedules, including
				detailed effects on operational plans, missions, deployment schedules, and
				fulfillment of the requirements of the commanders of the combatant
				commands.</text>
										</subparagraph></paragraph></subsection><subsection id="HBB03498C38FE48A788DA8B398313169B"><enum>(c)</enum><header>Assessment when
				aircraft procurement budget is insufficient</header><text>If the budget for a
				fiscal year provides for funding of the procurement of covered aircraft for
				either the Department of the Navy or the Department of the Air Force at a level
				that is less than the level determined necessary by the Director of Cost
				Assessment and Program Evaluation under subsection (b)(3)(B), the Secretary of
				Defense shall include with the defense budget materials for that fiscal year an
				assessment that describes and discusses the risks associated with the budget,
				including the risk associated with a reduced force structure of aircraft that
				may result from funding covered aircraft procurement at such level.</text>
								</subsection><subsection id="HEE49B7B743A24DCA90F66F55EBF32201"><enum>(d)</enum><header>CBO
				evaluation</header><text>Not later than 60 days after the date on which the
				congressional defense committees receive the plan under subsection (a), the
				Director of the Congressional Budget Office shall submit to such committees a
				report assessing the sufficiency of the estimated levels of annual funding
				included in such plan with respect to the budget submitted during the year in
				which the plan is submitted and the future-years defense program submitted
				under section 221 of this title.</text>
								</subsection><subsection id="HCFC5A27729F54CD6BA5D6A92494CA4FF"><enum>(e)</enum><header>Definitions</header><text>In
				this section:</text>
									<paragraph id="HFFE25EDAACB1484D84172900E7AF1CBB"><enum>(1)</enum><text>The term
				<quote>covered aircraft</quote> means the following:</text>
										<subparagraph id="H4D839C3C0FF34DCFAF5C32496A5AD456"><enum>(A)</enum><text>Fighter
				aircraft.</text>
										</subparagraph><subparagraph id="H1C13D019F5D9431BA161A0586FCA420D"><enum>(B)</enum><text>Attack
				aircraft.</text>
										</subparagraph><subparagraph id="H7FAFAF0EF11E4BF58476F56927568482"><enum>(C)</enum><text>Bomber
				aircraft.</text>
										</subparagraph><subparagraph id="HD6158619A6EA4F8584A27CCDCF6AEF33"><enum>(D)</enum><text>Strategic lift
				aircraft.</text>
										</subparagraph><subparagraph id="H221838BBBEEE4852AB8359733007438B"><enum>(E)</enum><text>Intratheater lift
				aircraft.</text>
										</subparagraph><subparagraph id="HF663435F7E37450094EBE227F984562C"><enum>(F)</enum><text>Intelligence,
				surveillance, and reconnaissance aircraft.</text>
										</subparagraph><subparagraph id="H7E54921141DD4F0D895D9B731603FEC6"><enum>(G)</enum><text>Tanker

										</subparagraph><subparagraph id="H030A4ABB1F354CA6A29A06E52DAFA287"><enum>(H)</enum><text>Any other major
				support aircraft designated by the Secretary of Defense for purposes of this
				section.</text>
										</subparagraph></paragraph><paragraph id="HEEA6D71D6FC54D23B7F874692FE7A68B"><enum>(2)</enum><text>The term
				<quote>budget</quote>, with respect to a fiscal year, means the budget for that
				fiscal year that is submitted to Congress by the President under section
				1105(a) of title 31.</text>
									</paragraph><paragraph id="H09A57A685F8E44CB8DF57F4FA8F24DCF"><enum>(3)</enum><text>The term
				<quote>defense budget materials</quote>, with respect to a fiscal year, means
				the materials submitted to Congress by the Secretary of Defense in support of
				the budget for that fiscal year.</text>
									</paragraph><paragraph id="H54BACCED504B4CA6967CB48E5A795675"><enum>(4)</enum><text>The term
				<quote>quadrennial defense review</quote> means the review of the defense
				programs and policies of the United States that is carried out every four years
				under section 118 of this

			 fiscal year, the end strength prescribed for such fiscal year for the Selected
			 Reserve of such reserve component shall be increased proportionately by the
			 total authorized strengths of such units and by the total number of such
			 individual members.</text>

			 by adding at the end the following new section:</text>

									<paragraph id="H8801EABBD7E14B9EAFD085215571F2A7"><enum>(1)</enum><header>In
				general</header><text>The Secretary of the Navy may enter into agreements,
				including cooperative agreements (as described in section 6305 of title 31),
				with the association to manage any aspect of the athletic and physical fitness
				programs of the Naval Academy.</text>
									</paragraph><paragraph id="H9C6781F3EB0D42E298986CA51C62F92A"><enum>(2)</enum><header>Association
				defined</header><text>In this section, the term <quote>association</quote>
				means the Naval Academy Athletic Association and its successors and
				assigns.</text>
									</paragraph></subsection><subsection id="H540EA01A42D3480D83BB0D658F5323DD"><enum>(b)</enum><header>Authority To
				provide support to association</header>
									<paragraph id="H7A0E6D60D0FF4B5CA841A162E6C4DAF2"><enum>(1)</enum><header>Authority to
				transfer funds to the association</header><text>The Secretary may to transfer
				funds to the association to pay expenses incurred by the association in
				managing the athletic and physical fitness programs of the Naval
				Academy.</text>
									</paragraph><paragraph id="HE0CCC1FDFC2A48CB87E5EB8AD78BA72D"><enum>(2)</enum><header>Authority to
				provide other support</header><text>The Secretary may provide personal property
				and the services of members of the naval service and civilian personnel of the
				Department of the Navy to assist the association in managing the athletic and
				physical fitness programs of the Naval Academy.</text>
									</paragraph></subsection><subsection id="H5F6959D14D154955BA4B6DDBF8AD0BAF"><enum>(c)</enum><header>Acceptance of
				gifts from the association</header><text>The Secretary may accept from the
				association funds, supplies, and services for the support of the athletic and
				physical fitness programs of the Naval Academy.</text>
								</subsection><subsection id="HC813E09C5DFF488BBF2C1B2FFCD2658F"><enum>(d)</enum><header>Receipt and
				retention of funds</header>
									<paragraph id="H73CE1CE340E84B3B9A88E737EF24FFB7"><enum>(1)</enum><header>Funds received
				from the association</header><text>The Secretary may receive from the
				association funds generated by the athletic and physical fitness programs of
				the Naval Academy and any other activity of the association and to retain and
				use such funds to further the mission of the Naval Academy. Receipt and
				retention of such funds shall be subject to oversight by the Secretary of the
				Navy.</text>
									</paragraph><paragraph id="HBEB83CC1E7434B5DA71BCE04C81B06FE"><enum>(2)</enum><header>Funds received
				from ncaa</header><text>The Secretary may accept, use, and retain funds from
				the National Collegiate Athletic Association and to transfer all or part of
				those funds to the association for the support of the athletic and physical
				fitness programs of the Naval Academy.</text>
									</paragraph><paragraph id="H921D18AFBF65487C8D4A8F4DD2991447"><enum>(3)</enum><header>User
				fees</header><text>The Secretary may charge user fees to the association for
				the association’s use of Naval Academy facilities for the conduct of summer
				athletic camps. Fees collected under this subsection may be retained for use in
				support of the Naval Academy athletic program and shall remain available until
				expended.</text>
									</paragraph></subsection><subsection id="HF3B9CABE9E2B42B6AFE63BF35B22BCBD"><enum>(e)</enum><header>Licensing,
				marketing, and sponsorship agreements</header><text>The Secretary may enter
				into an agreement with the association authorizing the association to represent
				the Department of the Navy in connection with licensing, marketing, and
				sponsorship agreements relating to trademarks and service marks identifying the
				Naval Academy, to the extent authorized by the Chief of Naval Research and in
				accordance with sections 2260 and 5022 of this title. Notwithstanding section
				2260(d) of this title, any funds generated by the licensing, marketing, and
				sponsorship under such agreement may be accepted, used, and be retained by the
				Secretary of the Navy or transferred by the Secretary to the association for
				the athletic and physical fitness programs of the Naval Academy.</text>
								</subsection><subsection id="HC7E62DF82B064EB7B720E0375BC15BBE"><enum>(f)</enum><header>Authorized
				service on board of directors</header><text>The Secretary may authorize members
				of the naval service and civilian personnel of the Department of the Navy to
				serve in accordance with sections 1033 and 1589 of this title as members of the
				governing board of the association.</text>
								</subsection><subsection id="H6C589DBBA57848B7864553D890F6DA77"><enum>(g)</enum><header>Conditions</header><text>The
				authority provided in this section with respect to the association is available
				only so long as the association continues to—</text>
									<paragraph id="HB665296A6FC842C9A0F75DCDC15A2162"><enum>(1)</enum><text>qualify as a
				nonprofit organization under section 501(c)(3) of the Internal Revenue Code of
				1986 and operates in accordance with this section, the laws of the State of
				Maryland, and the constitution and bylaws of the association; and</text>
									</paragraph><paragraph id="HC8FD9DFDE152435690D44A19E734D516"><enum>(2)</enum><text>operate
				exclusively to support the athletic and physical fitness programs of the Naval
				Academy.</text>

			 152 of title 10, United States Code, is amended by inserting after section 2552

				of Chaplains in the Air Force, appointed by the President, by and with the
				advice and consent of the Senate, from officers of the Air Force designated
				under section 8067(h) of this title as chaplains who are serving in the grade
				of colonel or above, are serving on active duty, and have served on active duty
				as a chaplain for at least eight years.</text>
									</paragraph><paragraph id="H95512421892D4469816F55B0CC5013CC"><enum>(2)</enum><text>An officer
				appointed as the Chief of Chaplains shall be appointed for a term of three
				years. However, the President may terminate or extend the appointment at any
				time.</text>

				Chaplains shall be appointed in the regular grade of major general.</text>

			 amendments made by this section for any month that begins before the date of
			 the enactment of this Act.</text>

						<paragraph id="HF409A7F3FD15459C9A586179C8230EA5"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HEC1FC727E89644EB88994743200A7003"><enum>(A)</enum><text>Beginning October 1,
				2012, the annual enrollment fees referred to in paragraph (1)—</text>
								<clause id="H996BC929E5E94214AC71F4D6ED3B583E" indent="up1"><enum>(i)</enum><text>may not be increased for a survivor
				of a member of the uniformed services who dies while on active duty, or a
				person retired under chapter 61 of this title or the dependents of such person;
				and</text>
								</clause><clause id="H7DBCFEDB62E840C99AA5AA6FF3D92055" indent="up1"><enum>(ii)</enum><text>for an individual enrollment,
				shall be one-half of the amount for a family enrollment.</text>
								</clause></subparagraph><subparagraph id="HEEAC40768D3C4CB2A6B34C86DE9DDD7A" indent="up1"><enum>(B)</enum><text>Beginning October 1, 2012, such annual
				enrollment fees shall have three Tiers, as follows:</text>
								<clause id="H9766A4DC0B1B407BA448B01DE604C12C"><enum>(i)</enum><text>Tier 1, which shall be applicable
				to former members (or their survivors) with retired pay (or in the case of
				survivors, annuity under the Survivor Benefits Plan under chapter 73 of this
				title) in 2012 less than $22,590.</text>
								</clause><clause id="H66F17F45D7A44ACE9159276AB063444B"><enum>(ii)</enum><text>Tier 2, which shall be applicable
				to former members (or their survivors) with retired pay (or in the case of
				survivors, annuity under the Survivor Benefits Plan under chapter 73 of this
				title) in 2012 between $22,590 and $45,178 inclusive.</text>
								</clause><clause id="H297F8FF40F104E9D9A34FB2283CBCE50"><enum>(iii)</enum><text>Tier 3, which shall be applicable
				to former members (or their survivors) with retired pay (or in the case of
				survivors, annuity under the Survivor Benefits Plan under chapter 73 of this
				title) in 2012 more than $45,178.</text>
								</clause></subparagraph><subparagraph id="H9B31B84DFE9E41F4AB0BDAF97F208D78" indent="up1"><enum>(C)</enum><text>Each amount specified in subparagraph
				(B) shall be adjusted in subsequent years by the cost of living adjustment
				applied to retired pay. In subsequent years, tier placement will be based on
				retired pay or annuity during the calendar year in which the fiscal year
				starts. For purposes of applying subparagraph (B), the amount of retired pay or
				annuity determined to be received by any eligible beneficiary under this
				section and any other tier placement issues under this section shall be
				determined by the Secretary of Defense.</text>
							</subparagraph><subparagraph id="HED109DCF30E84BFFAA110F36D057FE93" indent="up1"><enum>(D)</enum><text>The annual family enrollment fee by
				fiscal year referred to in paragraph (1), based upon the Tiers determined under
				subparagraphs (B) and (C), is the following:</text>
								<clause id="H5822DF141CDC46E29032BEBA5B9E8DA8"><enum>(i)</enum><text>For 2013, $600 for Tier 1, $720 for
				Tier 2, and $820 for Tier 3.</text>
								</clause><clause id="H56D7D6622A1E4542946F6004B07CEA29"><enum>(ii)</enum><text>For 2014, $680 for Tier 1, $920
				for Tier 2, and $1,120 for Tier 3.</text>
								</clause><clause id="H06CEE8037BDA4F75A6B85981CE75C9AF"><enum>(iii)</enum><text>For 2015, $760 for Tier 1, $1,185
				for Tier 2, and $1,535 for Tier 3.</text>
								</clause><clause id="H83982FF2679448198587D49240B0755F"><enum>(iv)</enum><text>For 2016, $850 for Tier 1, $1,450
				for Tier 2, and $1,950 for Tier 3.</text>
								</clause><clause id="H4D71C4E8B89F4945AE6F63E8707E2319"><enum>(v)</enum><text>For years after 2016, the amount
				for 2016, indexed by the National Health Expenditures per capita rate, as
				established by the Secretary of Health and Human
				Services.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H26D3A350A99942D894AE03FCA1A65E27"><enum>(b)</enum><header>Establishment of
			 annual enrollment fee for certain tricare standard
			 beneficiaries</header><text>Section 1086(b)(1) of such title is amended to read
			 as follows:</text>
					<quoted-block id="HFCF836D20CD94A48A2E1AAB6CADAE257" style="OLC">
						<paragraph id="HD39BA00D704F4B6E8DE6BD0BDFF4BEF2"><enum>(1)</enum><text>Beginning October
				1, 2012, an annual enrollment fee, which shall be a precondition to coverage
				under this section (including coverage that provides for discounts on
				cost-sharing for using TRICARE network providers) and section 1074g, except
				that such fee shall not apply to persons described in paragraph (5) or in
				subsection (d), or to those covered by an enrollment fee under section 1097.
				The amount of the enrollment fee by fiscal year shall be—</text>
							<subparagraph id="H83A897818B8747DCB50B07A02FF5ADB5"><enum>(A)</enum><text>in 2013, $70 for
				an individual or $140 for a family group;</text>
							</subparagraph><subparagraph id="HAB32C6762A5A496C898EB430F252CA79"><enum>(B)</enum><text>in 2014, $85 for
				an individual or $170 for a family group;</text>
							</subparagraph><subparagraph id="H2F52A703CB5748D0A5718361C052C9AB"><enum>(C)</enum><text>in 2015, $100 for
				an individual or $200 for a family group;</text>
							</subparagraph><subparagraph id="H235113401DB842B698B15A9FD3623625"><enum>(D)</enum><text>in 2016, $115 for
				an individual or $230 for a family group;</text>
							</subparagraph><subparagraph id="H11086003DE414B9CB0849306055E9718"><enum>(E)</enum><text>in 2017, $130 for
				an individual or $250 for a family group; and</text>
							</subparagraph><subparagraph id="H9A035E5A9E5945CDA4E7DCB9D26B64B0"><enum>(F)</enum><text>after 2017, the
				amounts for 2017 adjusted based on the National Health Expenditures per capita
				rate, as established by the Secretary of Health and Human
				Services.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HAFFAD8EAF9E543188855FA25B98FE9EB"><enum>(c)</enum><header>Revision of
			 annual deductible amounts</header><paragraph commented="no" display-inline="yes-display-inline" id="HB2517DEC75FD4F7DBEBE5DE1E5BE646B"><enum>(1)</enum><text>Section 1086(b)(2) of
			 such title is amended to read as follows:</text>
						<quoted-block id="HF9666D382AEF4C509719CCD03E5599BC" style="OLC">
							<paragraph id="H9F5817CE57B14321B6ACD825720C80E9"><enum>(2)</enum><text>An annual
				deductible amount applicable to the charges for all types of care authorized by
				this section and received while in an outpatient status and 25 percent of the
				additional charges for such care during a year. The annual deductible amount,
				except for persons described in paragraph (5), by fiscal year shall be—</text>
								<subparagraph id="H0EAFF4B7B5D64EE6903A2A4FB7547648"><enum>(A)</enum><text>in 2013, $160 for
				an individual or $320 for a family group;</text>
								</subparagraph><subparagraph id="H9DD6A4854A134614A20CF6FEA287EC64"><enum>(B)</enum><text>in 2014, $200 for
				an individual or $400 for a family group;</text>
								</subparagraph><subparagraph id="H8A7082F880854D47967B6CFADD1E67E5"><enum>(C)</enum><text>in 2015, $230 for
				an individual or $460 for a family group;</text>
								</subparagraph><subparagraph id="HB5C4168557FE4E42B48C6B274ED50E3B"><enum>(D)</enum><text>in 2016, $260 for
				an individual or $520 for a family group;</text>
								</subparagraph><subparagraph id="H4EDC92D402904D73BAB6173529DA3171"><enum>(E)</enum><text>in 2017, $290 for
				an individual or $580 for a family group; and</text>
								</subparagraph><subparagraph id="H24BCEBFE3AB24D26929A05A24D83C9CA"><enum>(F)</enum><text>after 2017, the
				amounts for 2017 adjusted based on the National Health Expenditures per capita
				rate, as established by the Secretary of Health and Human
				Services.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H132B860EBF4E4896B9E95856625C79D4"><enum>(2)</enum><text>Such subsection is
			 further amended by adding at the end the following new paragraph:</text>
						<quoted-block id="HFB7A1C1801954B46990C3A47E919E208" style="OLC">
							<paragraph id="H66ACBD3413524533BFA8408EA85E2696"><enum>(5)</enum><text>Paragraphs (1),
				(2), and (4)(B) shall not apply to a survivor of a member of the uniformed
				services who died while on active duty or to a person retired under chapter 61
				of this title or the dependents of such person. For such individuals—</text>
								<subparagraph id="H6276C6CA8F8745E5BB375FC49544E292"><enum>(A)</enum><text>there is no annual
				enrollment fee;</text>
								</subparagraph><subparagraph id="H309AA5A18B114EB4BCCB240F9819CD4B"><enum>(B)</enum><text>the deductible
				amounts in effect in fiscal year 2012 shall remain in effect; and</text>
								</subparagraph><subparagraph id="H6E46F83A950B47C3A7301E9F381493E1"><enum>(C)</enum><text>the maximum
				payment amount referred to in paragraph (4)(A) shall remain in
				effect.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HB0324B04F3D447418101D44809EF5601"><enum>(d)</enum><header>Establishment of
			 annual enrollment fee for tricare for life beneficiaries</header><text>Section
			 1086(d)(3) of such title is amended by adding at the end the following new
			 subparagraph:</text>
					<quoted-block id="H6339EBF156BB4DABBA823D8DED6B7D4B" style="OLC">
						<subparagraph id="H5F1533EC0C324236B81BCC83BB55E511"><enum>(D)</enum><text>A person described
				in paragraph (2) (except a person described in clause (i) of this
				subparagraph), shall pay an annual fiscal year enrollment fee as an additional
				condition of eligibility for health care benefits under this section.</text>
							<clause id="HB1DE47D561D1476E8A292A957032D287"><enum>(i)</enum><text>The annual
				enrollment fee shall not be charged to a survivor of a member of the uniformed
				services who died while on active duty, or to a person retired under chapter 61
				of this title or the dependents of such person.</text>
							</clause><clause id="H6BBC4261A9BB44B68B98FA5C4C25534C"><enum>(ii)</enum><text>The annual
				enrollment fee shall have three Tiers, with Tier 1 applicable to former members
				(or their survivors) with retired pay (or in the case of survivors, annuity
				under the Survivor Benefits Plan under chapter 73 of this title) in 2012 less
				than $22,590, Tier 2 between $22,590 and $45,178 (inclusive), and Tier 3 more
				than $45,178.</text>
							</clause><clause id="HCC729920C3764CE6A327EF5912B6A450"><enum>(iii)</enum><text>Each of the
				amounts in clause (ii) shall be adjusted in subsequent years by the cost of
				living adjustment applied to retired pay.</text>
							</clause><clause id="H57C141C62E9246F7885E7D3D799E9125"><enum>(iv)</enum><text>Tier placement in
				years after 2012 shall be based on retired pay or annuity during the calendar
				year in which the fiscal year starts.</text>
							</clause><clause id="H95A3222DBA564B149E412DBD44B88BA9"><enum>(v)</enum><text>For purposes of
				tier placement, the amount of retired pay or annuity determined to be received
				by any eligible beneficiary under this subparagraph, and any other tier
				placement issues under this section shall be determined by the Secretary of
				Defense.</text>
							</clause><clause id="HC7BE738229654055983803BD78E6BEE4"><enum>(vi)</enum><text>In 2013 the
				enrollment fee for an individual shall be $35 for Tier 1, $75 for Tier 2, and
				$115 for Tier 3.</text>
							</clause><clause id="H2166965FBBC540B58E35D7C493076DE0"><enum>(vii)</enum><text>In 2014 the
				enrollment fee for an individual shall be $75 for Tier 1, $150 for Tier 2, and
				$225 for Tier 3.</text>
							</clause><clause id="H59A0B44E2F83424A8D0B4B1E69DFE757"><enum>(viii)</enum><text>In 2015 the
				enrollment fee for an individual shall be $115 for Tier 1, $225 for Tier 2, and
				$335 for Tier 3.</text>
							</clause><clause id="HDFF660B1A8B8475EA8D32E0D964C92BF"><enum>(ix)</enum><text>In 2016 the
				enrollment fee for an individual shall be $150 for Tier 1, $300 for Tier 2, and
				$450 for Tier 3.</text>
							</clause></subparagraph><subsection id="HBFD13E69496B4E9CA2CB35FC726CA2BF" indent="down3"><enum>(x)</enum><text>In subsequent years, the enrollment fee
				for an individual shall be the amount in 2016, indexed by the National Health
				Expenditures per capita rate, as established by the Secretary of Health and
				Human
				Services.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HD7D326172C9B437591F28E6D27D410B5"><enum>(e)</enum><header>Revisions to
			 catastrophic cap</header><text>Section 1086(b)(4) of such title is
			 amended—</text>
					<paragraph id="HC99D66FBE1E34B4A8AD10C019FC58342"><enum>(1)</enum><text>by inserting
			 <quote>(A)</quote> after "(4); and</text>
					</paragraph><paragraph id="H8FE57E5640004ECDA30EC171ADB43839"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block id="H675CA4C3FB974C88B65B8E02925AE7EC" style="OLC">
							<subparagraph id="H748AF98AC29C4F3AA6F3B690EEAD9CF7"><enum>(B)</enum><text>Beginning October
				1, 2012, the amount referred to in subparagraph (A) shall be adjusted based on
				the National Health Expenditures per capita rate, as established by the
				Secretary of Health and Human Services, and shall not include enrollment fees
				under this
				chapter.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H39DD46AD648D4D17B87C87BDEE5E0E8A"><enum>(f)</enum><header>Revisions to
			 tricare pharmacy program requirements</header><paragraph commented="no" display-inline="yes-display-inline" id="H922796F15E254A8DA9BE332F145BA7E4"><enum>(1)</enum><text>Section 1074g(a)(5) of
			 such title is amended by striking <quote>at least one of the means described in
			 paragraph (2)(E)</quote> and inserting <quote>the national mail order pharmacy
			 program</quote>.</text>
					</paragraph><paragraph id="H3622BA61719F4042A033439795FC4F40" indent="up1"><enum>(2)</enum><text>Section 1074g(a)(6) of such title is
			 amended by adding at the end the following new subparagraph:</text>
						<quoted-block id="H0284F4C84ADC4EBFA4DC34E385AAEB8D" style="OLC">
							<subparagraph id="H48B6B4C59D99452BBA1414B2783BF588" indent="up1"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H49F8D83AD6C140B1B278C38CD68076D8"><enum>(i)</enum><text>Notwithstanding any
				limitation in subparagraph (A) and subject to clause (iv), the generally
				applicable cost sharing amounts specified in the following table shall apply in
				the years 2013 through 2021:</text>

								</clause><clause id="H7DC3E68E1734460DA23682FE80B9295D" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The amounts specified in the table in
				clause (i) for retail dispensing refer to dispensing in retail network
				pharmacies for prescriptions for up to a 30-day supply. The amounts specified
				for mail order dispensing are for an up to 90-day supply.</text>
								</clause><clause id="HE32BCFB7E7194046B02D9816537C5006" indent="up1"><enum>(iii)</enum><text>The amounts specified in the table
				in clause (i) shall be adjusted by the Secretary for years after 2021 based on
				changes (as determined by the Secretary) in the costs of pharmaceutical agents
				and prescription dispensing, rounded to the nearest dollar.</text>
								</clause><clause id="H3A35957E059C45B4A58CC33179CE4058" indent="up1"><enum>(iv)</enum><text>A cost-sharing amount under this
				subparagraph shall not apply to a survivor of a member of the uniformed
				services who died while on active duty, or to a person retired under chapter 61
				of this title or the dependents of such person. For such individuals, the
				amounts in effect during fiscal year 2012 shall remain in
				effect.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H5B668F5B23604D8F9A97F768B58867DB"><enum>(g)</enum><header>Effective date
			 and regulations</header><text>This section shall take effect October 1, 2012.
			 The Secretary of Defense may issue an interim final rule or take such other
			 action as necessary to ensure implementation as of that date. Such action may
			 include presumptive enrollment for designated beneficiaries (subject to
			 declination) and automatic deduction from retired pay or annuity of enrollment
			 fee amounts.</text>
				</subsection></section><section id="H3433ECF33D8649E99640F95726BC9904"><enum>702.</enum><header>Requirement for
			 Medicare participating physician or supplier to accept TRICARE and veterans
			 affairs participating rates</header><text display-inline="no-display-inline">Section 1842(h)(1) of the Social Security
			 Act (42 U.S.C. 1395u(h)(1)) is amended by adding at the end the following new
			 sentence: <quote>Any physician or supplier who voluntarily enters into an
			 agreement with the Secretary to become a participating physician or supplier
			 shall be deemed to have agreed to be a participating provider of medical care
			 or services under any health plan contracted for under section 1079 or 1086 of
			 title 10, United States Code, or under section 1718 of title 38, United States
			 Code, in accordance with the payment methodology and amounts prescribed under
			 joint regulations prescribed by the Secretary, the Secretary of Defense, and
			 the Secretary of Homeland Security pursuant to sections 1079 and 1086 of title
			 10, United States Code.</quote>.</text>
			</section></title><title id="H9B51744CCDD4445C8491DDB99E69343A"><enum>VIII</enum><header>ACQUISITION
			 POLICY, ACQUISITION MANAGEMENT, AND RELATED MATTERS</header>
			<section id="HDFEDF942585347498A81BD6F863F2A60"><enum>801.</enum><header>Reduction in
			 requirements for submission of Selected Acquisition Reports for major defense
			 acquisition programs</header><text display-inline="no-display-inline">Section
			 2432(g) of title 10, United States Code, is amended by striking <quote>90
			 percent</quote> both places it appears and inserting <quote>75

			</section><section id="H881881485E4A48A08363A5BEC8A1FC91"><enum>802.</enum><header>Authorization
			 for entering into multiyear contracts with Federally Funded Research and
			 Development Centers</header><text display-inline="no-display-inline">Section
			 2367 of title 10, United States Code, is amended by adding at the end the
			 following new subsection:</text>
				<quoted-block id="H860EA7B4FFB64F3DBAC4DB354DCC8B5C" style="OLC">
					<subsection id="H9DEB2B17EB49482CB5F4635AFA56F983"><enum>(e)</enum><header>Administration
				of centers</header><paragraph commented="no" display-inline="yes-display-inline" id="HC4FD631324234DE6B56C4173B39685D4"><enum>(1)</enum><text>The head of an agency
				may enter into multiyear contracts with federally funded research and
				development centers with which the agency has a sponsoring agreement. Any such
				contract may be for a term not to exceed five years, consistent with the
				sponsoring agreement of the Department of Defense with such center.</text>
						</paragraph><paragraph id="HBC6E99DD8A8349C4A4F0698A603F94BD" indent="up1"><enum>(2)</enum><text>The head of an agency that enters
				into a sponsoring agreement with a federally funded research and development
				center—</text>
							<subparagraph id="H1E49ACE99C0A4526A1015024B96E358B"><enum>(A)</enum><text>shall include in the sponsoring
				agreement, or in applicable contracts with that center, provisions—</text>
								<clause id="H8AD5D9243C7E4582BBBD4C7E110D6006"><enum>(i)</enum><text>for the orderly termination or
				nonrenewal of the center; and</text>
								</clause><clause id="H8C0652F2C7E44592B542D11BA8A2A361"><enum>(ii)</enum><text>upon such termination or
				nonrenewal, for disposal of assets, and settlement of liabilities, of the
				center; and</text>
								</clause></subparagraph><subparagraph id="H37B43A7A6462463BAE0CFFE6A66647FA"><enum>(B)</enum><text>may include in the sponsoring
				agreement, or in applicable contracts with that center, provisions—</text>
								<clause id="H21A1F1D713BD49BCBAE95B943F8ED073"><enum>(i)</enum><text>for special close-out costs,
				cancellation costs, termination costs and other types of expenses that may be
				incurred at the end of sponsorship; and</text>
								</clause><clause id="H3F9AF885A9AE4641A0804222CBA92F3B"><enum>(ii)</enum><text>for transfer of title to, or
				liquidation of, the proceeds of sale or transfer of any property held by the
				center for the benefit of the Government.</text>
								</clause></subparagraph></paragraph><paragraph id="H1439848347664BB29FEC14FAD8BBFB8E" indent="up1"><enum>(3)</enum><text>In this subsection, the term
				<quote>head of an agency</quote> has the meaning given that term in subsection
				(c)(2).</text>

			 2539b of title 10, United States Code, is amended—</text>

				services</header><text>Services of the Defense Contract Management Agency may
				be made available under subsection (a)(5) only if the contract or other
				arrangement for those services—</text>

				States harmless if the items covered by the contract or other arrangement
				(whether or not tested and inspected under the contract or other arrangement)
				are not subsequently ordered by or delivered to the United States under a
				procurement contract entered into after the contract or other arrangement is
				entered into; and</text>
								</paragraph><paragraph id="H409DE95F84974B899C5BC9185E68A44B"><enum>(2)</enum><text>holds the United
				States harmless against any claim arising out of the inspection and testing, or
				the use in any commercial application, of the equipment tested and inspected by
				the Defense Contract Management Agency under the contract or other
				arrangement.</text>
