<legis-type>AN ACT</legis-type> 
<official-title display="yes"> To authorize a Wall of Remembrance as part of the Korean War Veterans Memorial and to allow certain private contributions to fund that Wall of Remembrance.</official-title>

<section id="H8C9C3E3719FA499683C94659506F7109" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Korean War Veterans Memorial Wall of Remembrance Act</short-title></quote>.</text></section> <section id="HE689C874354446EF83308E183B5A48EC"><enum>2.</enum><header>Wall of remembrance</header> <subsection id="H7DCC535CD78B47FBAC58876A88F4E455"><enum>(a)</enum><header>Authorization</header> <paragraph id="HDB06FC00B6C044A5A7A85486F8D110BE"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 8908(c) of title 40, United States Code, the Korean War Veterans Memorial Foundation, Inc., may construct a Wall of Remembrance at the site of the Korean War Veterans Memorial.</text></paragraph>
<paragraph id="H322DE469D6A042CFACFB4E3FB850906F"><enum>(2)</enum><header>Requirement</header>
<subparagraph id="H3E217DB3319146E68E8625E0114DC0E4"><enum>(A)</enum><header>In general</header><text>The Wall of Remembrance shall include a list of names of members of the Armed Forces of the United States who died in the Korean War, as determined by the Secretary of Defense, in accordance with subparagraph (B).</text></subparagraph> <subparagraph id="HFC47B6BB03B64A6A8C138522DE044D7F"><enum>(B)</enum><header>Criteria; submission to the secretary of the interior</header><text>The Secretary of Defense shall—</text>
<clause id="H2E930F096897453B932ABC79E66F214E"><enum>(i)</enum><text>establish eligibility criteria for the inclusion of names on the Wall of Remembrance under subparagraph (A); and</text></clause> <clause id="H4A96E5C958124150B2D0A4F920270872"><enum>(ii)</enum><text>provide to the Secretary of the Interior a final list of names for inclusion on the Wall of Remembrance under subparagraph (A) that meet the criteria established under clause (i).</text></clause></subparagraph></paragraph>
<paragraph id="HC2F66C38C4B7425F876C1F586CB5DD90"><enum>(3)</enum><header>Additional information</header><text>The Wall of Remembrance may include other information about the Korean War, including the number of members of the Armed Forces of the United States, the Korean Augmentation to the United States Army, the Republic of Korea Armed Forces, and the other nations of the United Nations Command who, in regards to the Korean War—</text> <subparagraph id="H58B9BD3F89094976B6909C22031438A3"><enum>(A)</enum><text>were killed in action;</text></subparagraph>
<subparagraph id="H85FEC95A9D9A4B2E88959E040B53CC04"><enum>(B)</enum><text>were wounded in action;</text></subparagraph> <subparagraph id="H9944087D87FB4D53B44688CB2B8F1A8F"><enum>(C)</enum><text>are listed as missing in action; or</text></subparagraph>
<subparagraph id="HA46AC54070E84EC08AFC625E15B0238B"><enum>(D)</enum><text>were prisoners of war.</text></subparagraph></paragraph></subsection> <subsection id="H3D0AACA6A6D24C5B8DC57565D83054A7"><enum>(b)</enum><header>Commemorative works act</header><text>Except as provided in subsection (a)(1), <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/89">chapter 89</external-xref> of title 40, United States Code (commonly known as the <quote>Commemorative Works Act</quote>), shall apply.</text></subsection>
<subsection id="H202A0EB9A44348C09EB0F2F7F230A854"><enum>(c)</enum><header>No federal funds</header><text>No Federal funds may be used to construct the Wall of Remembrance.</text></subsection></section> </legis-body> <attestation><attestation-group><role>Speaker of the House of Representatives.</role></attestation-group><attestation-group><role>Vice President of the United States and President of the Senate.</role></attestation-group></attestation> </bill>
