 </paragraph><paragraph id="HCA1C613CC8A84CA58CA85027F92BF60D"><enum>(2)</enum><text>The National Aeronautics and Space Administration.</text> </paragraph></subsection><subsection id="H7AD48C1E767643448215CB4E30136B00"><enum>(b)</enum><header>Definitions</header><text>In this chapter:</text>
 <paragraph id="HC096FABAFE3E4D8FB681F7F92CCE1348"><enum>(1)</enum><header>Head of an agency</header><text>The term <quote>head of an agency</quote> means the Secretary of Defense and the Administrator of the National Aeronautics and Space Administration.</text>
 </paragraph><paragraph id="HC0196110C1584DA3BE33C8B8E9C13BA7"><enum>(2)</enum><header>Claim</header><text>The term <quote>claim</quote> means any request, demand, or submission—</text> <subparagraph id="HA8CFCACFBCD945118FDFB93639DDFB18"><enum>(A)</enum><text>made to the head of an agency for property, services, or money (including money representing grants, loans, insurance, or benefits);</text>
 </subparagraph><subparagraph id="HEC84621133F345E1A409E43793EE6701"><enum>(B)</enum><text>made to a recipient of property, services, or money received directly or indirectly from the head of an agency or to a party to a contract with the head of an agency—</text>
 <clause id="HA9A8A1A66F4842D09EEAEB18744FFB86"><enum>(i)</enum><text>for property or services if the United States—</text> <subclause id="H2107B81A15C94CB782702030F215A88E"><enum>(I)</enum><text>provided such property or services;</text>
 </subclause><subclause id="H4E803E65DB4D4FD8A6002D71A32C10A2"><enum>(II)</enum><text>provided any portion of the funds for the purchase of such property or services; or</text> </subclause><subclause id="H9EC173A6EA87432A9C83050767A949AD"><enum>(III)</enum><text>will reimburse such recipient or party for the purchase of such property or services; or</text>
 </subclause></clause><clause id="H9857C869769D487BA114623D3E9437B1"><enum>(ii)</enum><text>for the payment of money (including money representing grants, loans, insurance, or benefits) if the United States—</text>
 <subclause id="H515C245DED6B48879486341C3B8A8C5F"><enum>(I)</enum><text>provided any portion of the money requested or demanded; or</text> </subclause><subclause id="HCB5F41B20C9A436899E7C20714D1233E"><enum>(II)</enum><text>will reimburse such recipient or party for any portion of the money paid on such request or demand; or</text>
 </subclause></clause></subparagraph><subparagraph id="HF7DF9F15EED74EF8866113D2ECB7447A"><enum>(C)</enum><text>made to the head of an agency which has the effect of decreasing an obligation to pay or account for property, services, or money.</text>
 </subparagraph></paragraph><paragraph id="HDDAB1187826446D2AB133153685DE9E3"><enum>(3)</enum><header>Knows or has reason to know</header><text>The term <quote>knows or has reason to know</quote>, for purposes of establishing liability under section 2752 of this title, means that a person, with respect to a claim or statement—</text>
 <subparagraph id="HF2E316B697F94FB4B4B3806D1F847664"><enum>(A)</enum><text>has actual knowledge that the claim or statement is false, fictitious, or fraudulent;</text> </subparagraph><subparagraph id="HF00517FF3B814B70A024215730BB765A"><enum>(B)</enum><text>acts in deliberate ignorance of the truth or falsity of the claim or statement; or</text>
 </subparagraph><subparagraph id="H820FDF5C30444164846F3456A064ACA9"><enum>(C)</enum><text>acts in reckless disregard of the truth or falsity of the claim or statement, and no proof of specific intent to defraud is required.</text>
 </subparagraph></paragraph><paragraph id="H9F99CC5F87BB44569A8A03E613F09879"><enum>(4)</enum><header>Responsible official</header><text>The term <quote>responsible official</quote> means a designated debarring and suspending official of the agency named in subsection (a).</text> </paragraph><paragraph id="HF43C64459CCF48F09C3F0D43E69FBD8D"><enum>(5)</enum><header>Respondent</header><text>The term <quote>respondent</quote> means a person who has received notice from a responsible official asserting liability under section 2752 of this title.</text>
 </paragraph><paragraph id="H2145A4962F334A649E3B594170476FAB"><enum>(6)</enum><header>Statement</header><text>The term <quote>statement</quote> means any representation, certification, affirmation, document, record, or an accounting or bookkeeping entry made—</text>
 <subparagraph id="HF1739CDDD0C540DEA3EB19B5D54724DE"><enum>(A)</enum><text>with respect to a claim or to obtain the approval or payment of a claim (including relating to eligibility to make a claim); or</text>
 </subparagraph><subparagraph id="HC98F1D4EC4F34FC9939892D1DF487A4B"><enum>(B)</enum><text>with respect to (including relating to eligibility for)—</text> <clause id="H747AE2E4279C4E77B5E340D85E290FD9"><enum>(i)</enum><text>a contract with, or a bid or proposal for a contract with the head of an agency; or</text>
 </clause><clause id="H79EE0D4BB2C34FD38225A23BCE6B48C5"><enum>(ii)</enum><text>a grant, loan, or benefit from the head of an agency.</text> </clause></subparagraph></paragraph></subsection><subsection id="H3992C5EC153344D8AFF7E58712B9A4C8"><enum>(c)</enum><header>Claims</header><text>For purposes of paragraph (2) of subsection (b)—</text>
 <paragraph id="H3D22FBA48C794E839BBE6215C189485B"><enum>(1)</enum><text>each voucher, invoice, claim form, or other individual request or demand for property, services, or money constitutes a separate claim;</text>
 </paragraph><paragraph id="H3CEDF45613C84288905535EAFB78849E"><enum>(2)</enum><text>each claim for property, services, or money is subject to this chapter regardless of whether such property, services, or money is actually delivered or paid; and</text>
 </paragraph><paragraph id="HD3BB5648FC724FB59F5DE15441F4C323"><enum>(3)</enum><text>a claim shall be considered made, presented, or submitted to the head of an agency, recipient, or party when such claim is actually made to an agent, fiscal intermediary, or other entity acting for or on behalf of such authority, recipient, or party.</text>
 </paragraph></subsection><subsection id="HC7FB44903EB34CA19A50F44A25A590D7"><enum>(d)</enum><header>Statements</header><text>For purposes of paragraph (6) of subsection (b)—</text> <paragraph id="H2AAD607761D940A1801ECAB5DBE2CBAF"><enum>(1)</enum><text>each written representation, certification, or affirmation constitutes a separate statement; and</text>
 </paragraph><paragraph id="HF1AAAB586C484AB89E7E0F29C6A8C11F"><enum>(2)</enum><text>a statement shall be considered made, presented, or submitted to the head of an agency when such statement is actually made to an agent, fiscal intermediary, or other entity acting for or on behalf of such authority.</text>
											</paragraph></subsection></section><section id="H8C290863ECC34B468EEB65E44C337A71"><enum>2752.</enum><header>False claims and statements; liability</header>
 <subsection id="H4D7B3445EFA844E4A99E8A3ACEE5D96D"><enum>(a)</enum><header>False claims</header><text>Any person who makes, presents, or submits, or causes to be made, presented, or submitted, to the head of an agency a claim that the person knows or has reason to know—</text>
 <paragraph id="HF5D476A23CE9412480940478658ED56C"><enum>(1)</enum><text>is false, fictitious, or fraudulent;</text> </paragraph><paragraph id="H1E142AC6DB484788B22906FC75E2E925"><enum>(2)</enum><text>includes or is supported by any written statement which asserts a material fact this is false, fictitious, or fraudulent;</text>
 </paragraph><paragraph id="HD1E0FFB7385D4348A1C9770A0B9CE25B"><enum>(3)</enum><text>includes or is supported by any written statement that—</text> <subparagraph id="H72CF5C173B2A481D915EEBF6501B7643"><enum>(A)</enum><text>omits a material fact;</text>
 </subparagraph><subparagraph id="H9BC81468E874484D8663050CACFC7043"><enum>(B)</enum><text>is false, fictitious, or fraudulent as a result of such omission; and</text> </subparagraph><subparagraph id="HFD48461390FE44D28E733009A2B4F597"><enum>(C)</enum><text>the person making, presenting, or submitting such statement has a duty to include such material fact; or</text>
 </subparagraph></paragraph><paragraph id="H3197C8A1EA6C4ECD937F61146A907383"><enum>(4)</enum><text>is for payment for the provision of property or services which the person has not provided as claimed, shall, in addition to any other remedy that may be prescribed by law, be subject to a civil penalty of not more than $5,000 for each such claim. Such person shall also be subject to an assessment of not more than twice the amount of such claim, or the portion of such claim which is determined by the responsible official to be in violation of the preceding sentence.</text>
 </paragraph></subsection><subsection id="HDE8711BF6AF849D5A247DC0E8C57EE83"><enum>(b)</enum><header>False statements</header><text>Any person who makes, presents, submits, or causes to be made, presented, or submitted, a written statement in conjunction with a procurement program or acquisition of the an agency named in section 2751(a) of this title that—</text>
 <paragraph id="H204A0355DF3C4EF0B8F7435A843E006A"><enum>(1)</enum><text>the person knows or has reason to know—</text> <subparagraph id="HF26C445A7CE3474BACAB9495F2B0FAF5"><enum>(A)</enum><text>asserts a material fact that is false, fictitious, or fraudulent; or</text>
												</subparagraph><subparagraph id="HA835F7D365A64C60BF0FF55107DC138E"><enum>(B)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H9AC391B6D75F4C3881345031DA6988E8"><enum>(i)</enum><text>omits a material fact; and</text> </clause><clause id="H41E0D491B910482BADB29E79DA56F1A1" indent="up1"><enum>(ii)</enum><text>is false, fictitious, or fraudulent as a result of such omission;</text>
 </clause></subparagraph></paragraph><paragraph id="H0FDC9A0ECA394FDAB48C84699756C067"><enum>(2)</enum><text>in the case of a statement described in subparagraph (B) of paragraph (1), is a statement in which the person making, presenting, or submitting such statement has a duty to include such material fact; and</text>
 </paragraph><paragraph id="HE7B761915BA04313B5021E933C474675"><enum>(3)</enum><text>contains or is accompanied by an express certification or affirmation of the truthfulness and accuracy of the contents of the statement, shall be subject to, in addition to any other remedy that may be prescribed by law, a civil penalty of not more than $5,000 for each such statement.</text>
											</paragraph></subsection></section><section id="H77F3B78B65424440B2823C96FA3F49A3"><enum>2753.</enum><header>Hearing and determinations</header>
 <subsection id="HC18C11D0C6CB4D91B73CC528579934F1"><enum>(a)</enum><header>Transmittal of notice to attorney general</header><text>If a responsible official determines that there is adequate evidence to believe that a person is liable under section 2752 of this title, the responsible official shall transmit to the Attorney General, or any other officer or employee of the Department of Justice designated by the Attorney General, a written notice of the intention of such official to initiate an action under this section. The notice shall include the following:</text>
 <paragraph id="H894E4924DB014ED094224E00D5EF2E67"><enum>(1)</enum><text>A statement of the reasons for initiating an action under this section.</text> </paragraph><paragraph id="HE2DFD55769F946F0ABD8B5793400588A"><enum>(2)</enum><text>A statement specifying the evidence which supports liability under section 2752 of this title.</text>
 </paragraph><paragraph id="H88B1890B35FD437FA28667FC5BA71EC0"><enum>(3)</enum><text>A description of the claims or statements for which liability under section 2752 of this title is alleged.</text>
 </paragraph><paragraph id="HB2445116F44C4E45962B2D29A5262A1D"><enum>(4)</enum><text>An estimate of the penalties and assessments that will be demanded under section 2752 of this title.</text>
 </paragraph><paragraph id="H39BDEC0006B9464A91C2E6B07610FA5A"><enum>(5)</enum><text>A statement of any exculpatory or mitigating circumstances which may relate to such claims or statements.</text>
											</paragraph></subsection><subsection id="HCD7FFAB375C941A8B54EFD667A1DD46B"><enum>(b)</enum><header>Statement from attorney general</header>
 <paragraph id="H51D597F1C541429B82CDBCAF49898DD2"><enum>(1)</enum><text>Within 90 days after receipt of a notice from a responsible official under subsection (a), the Attorney General, or any other officer or employee of the Department of Justice designated by the Attorney General, shall transmit a written statement to the responsible official which specifies—</text>
 <subparagraph id="H7FD60470E2C94F8E854D9F6E62F54947"><enum>(A)</enum><text>that the Attorney General, or any other officer or employee of the Department of Justice designated by the Attorney General, approves or disapproves initiating an action under this section based on the allegations of liability stated in such notice; and</text>
 </subparagraph><subparagraph id="H10AD87B4FD0243DC8841234A48E47FBE"><enum>(B)</enum><text>in any case in which the initiation of an action under this section is disapproved, the reasons for such disapproval.</text>
 </subparagraph></paragraph><paragraph id="HED76687D9FD0452DAF033624CD5F557B"><enum>(2)</enum><text>If at any time after the initiation of an action under this section the Attorney General, or any other officer or employee of the Department of Justice designated by the Attorney General, transmits to a responsible official a written determination that the continuation of any action under this section may adversely affect any pending or potential criminal or civil action, such action shall be immediately stayed and may be resumed only upon written authorization from the Attorney General, or any other officer or employee of the Department of Justice designated by the Attorney General.</text>
 </paragraph></subsection><subsection id="HBFAD060402394383A46596709AF3C6C3"><enum>(c)</enum><header>Limitation on amount of claim that may be pursued under this section</header><text>No action shall be initiated under this section, nor shall any assessment be imposed under this section, if the total amount of the claim determined by the responsible official to violate section 2752(a) of this title exceeds $500,000. The $500,000 threshold does not include penalties or any assessment permitted under 2752(a) of this title greater than the amount of the claim determined by the responsible official to violate such section.</text>
										</subsection><subsection id="H701AE15846C1462E96102806CA052B3A"><enum>(d)</enum><header>Procedures for resolving claims</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H53317FF3255C4A24845D2650C43DBA4E"><enum>(1)</enum><text>Upon receiving approval under subsection (b) to initiate an action under this section, the responsible official shall mail, by registered or certified mail, or other similar commercial means, or shall deliver, a notice to the person alleged to be liable under section 2752 of this title. Such notice shall specify the allegations of liability against such person, specify the total amount of penalties and assessments sought by the United States, advise the person of the opportunity to submit facts and arguments in opposition to the allegations set forth in the notice, advise the person of the opportunity to submit offers of settlement or proposals of adjustment, and advise the person of the procedures of the agency named in section 2751(a) of this title governing the resolution of actions initiated under this section.</text>
 </paragraph><paragraph id="HF7E6A9FD47434EDD93A653E30095DD85" indent="up1"><enum>(2)</enum><text>Within 30 days after receiving a notice under paragraph (1), or any additional period of time granted by the responsible official, the respondent may submit in person, in writing, or through a representative, facts and arguments in opposition to the allegations set forth in the notice, including any additional information that raises a genuine dispute of material fact.</text>
 </paragraph><paragraph id="HBFD6BE70460A4F30882FA5C5629AF7D0" indent="up1"><enum>(3)</enum><text>If the respondent fails to respond within 30 days, or any additional time granted by the responsible official, the responsible official may issue a written decision disposing of the matters raised in the notice. Such decision shall be based on the record before the responsible official. If the responsible official concludes that the respondent is liable under section 2752 of this title, the decision shall include the findings of fact and conclusions of law which the responsible official relied upon in determining that the respondent is liable, and the amount of any penalty and/or assessment to be imposed on the respondent. Any such determination shall be based on a preponderance of the evidence. The responsible official shall promptly send to the respondent a copy of the decision by registered or certified mail, or other similar commercial means, or shall hand deliver a copy of the decision.</text>
 </paragraph><paragraph id="H8493FE2F6FDE437299105BE5937D8267" indent="up1"><enum>(4)</enum><text>If the respondent makes a timely submission, and the responsible official determines that the respondent has not raised any genuine dispute of material fact, the responsible official may issue a written decision disposing of the matters raised in the notice. Such decision shall be based on the record before the responsible official. If the responsible official concludes that the respondent is liable under section 2752 of this title, the decision shall include the findings of fact and conclusions of law which the responsible official relied upon in determining that the respondent is liable, and the amount of any penalty or assessment to be imposed on the respondent. Any such determination shall be based on a preponderance of the evidence. The responsible official shall promptly send to the respondent a copy of the decision by registered or certified mail, or other similar commercial means, or shall hand deliver a copy of the decision.</text>
 </paragraph><paragraph id="HCDBD5C986B864CE2954E10C7DA97F536" indent="up1"><enum>(5)</enum><text>If the respondent makes a timely submission, and the responsible official determines that the respondent has raised a genuine dispute of material fact, the responsible official shall commence a hearing to resolve the genuinely disputed material facts by mailing by registered or certified mail, or other similar commercial means, or by hand delivery of, a notice informing the respondent of—</text>
 <subparagraph id="HC3943D90CCB340ADA1BBE9F84B29EA8A"><enum>(A)</enum><text>the time, place, and nature of the hearing;</text> </subparagraph><subparagraph id="H0C154ACED343409E854C2499758F60F1"><enum>(B)</enum><text>the legal authority under which the hearing is to be held;</text>
 </subparagraph><subparagraph id="H6442AFD8C6C44D9EB6D77E2804A54D7F"><enum>(C)</enum><text>the material facts determined by the responsible official to be genuinely in dispute that will be the subject of the hearing; and</text>
 </subparagraph><subparagraph id="HEBDB694256FA48CC9EF926E65443684A"><enum>(D)</enum><text>a description of the procedures for the conduct of the hearing.</text> </subparagraph></paragraph><paragraph id="HC7ABDD7D59E746F68FB7A192F029D2A7" indent="up1"><enum>(6)</enum><text>The responsible official and any person against whom liability is asserted under this chapter may agree to a compromise or settle an action at any time. Any compromise or settlement must be in writing.</text>
 </paragraph></subsection><subsection id="H0A211EBCB90449F48D8EBE82F0E790BC"><enum>(e)</enum><header>Respondent entitled to copy of the record</header><text>At any time after receiving a notice under paragraph (1) of subsection (d), the respondent shall be entitled to a copy of the entire record before the responsible official.</text>
 </subsection><subsection id="H7907743E65CD40838229A223D832B63B"><enum>(f)</enum><header>Hearings</header><text>Any hearing commenced under this section shall be conducted by the responsible official, or a fact-finder designated by the responsible official, solely to resolve genuinely disputed material facts identified by the responsible official and set forth in the notice to the respondent.</text>
										</subsection><subsection id="HB81CFEFABD3B421CA6897891AE9CF3B4"><enum>(g)</enum><header>Procedures for hearings</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H741F1C864DF84F608E49B066CF822037"><enum>(1)</enum><text>Each hearing shall be conducted under procedures prescribed by the head of the agency. Such procedures shall include the following:</text>
 <subparagraph id="H20B01833E02746EA9B6201706B59884E" indent="up1"><enum>(A)</enum><text>The provision of written notice of the hearing to the respondent, including written notice of—</text> <clause id="HF041A05574C24288A38CE51170238B98"><enum>(i)</enum><text>the time, place, and nature of the hearing;</text>
 </clause><clause id="H3FD3588A704B478F90BA300A1941A949"><enum>(ii)</enum><text>the legal authority under which the hearing is to be held;</text> </clause><clause id="H6E6D7668D38D4FD9B48F42C7BD707243"><enum>(iii)</enum><text>the material facts determined by the responsible official to be genuinely in dispute that will be the subject of the hearing; and</text>
 </clause><clause id="HCF30A667C97C4A3FAB4C60C944705583"><enum>(iv)</enum><text>a description of the procedures for the conduct of the hearing.</text> </clause></subparagraph><subparagraph id="H4E446A888B924EEDABDD00C9077608C4" indent="up1"><enum>(B)</enum><text>The opportunity for the respondent to present facts and arguments through oral or documentary evidence, to submit rebuttal evidence, and to conduct such cross-examination as may be required to resolve any genuinely disputed material facts identified by the responsible official.</text>
 </subparagraph><subparagraph id="H69EDAD37233A4FF1ACC7CCD3BE183ED7" indent="up1"><enum>(C)</enum><text>The opportunity for the respondent to be accompanied, represented, and advised by counsel or such other qualified representative as the Secretary may specify in such regulations.</text>
 </subparagraph></paragraph><paragraph id="H9586859CACF34A8C9AB3FBEE2638677C" indent="up1"><enum>(2)</enum><text>For the purpose of conducting hearings under this section, the responsible official is authorized to administer oaths or affirmations.</text>
 </paragraph><paragraph id="HB2B2EC50A1B74CFAA2A108593E51C47B" indent="up1"><enum>(3)</enum><text>Hearings shall be held at the responsible official’s office, or at such other place as may be agreed upon by the respondent and the responsible official.</text>
 </paragraph></subsection><subsection id="HE4FFE5DF09B142B4941367E587A0CA86"><enum>(h)</enum><header>Decision following hearing</header><text>The responsible official shall issue a written decision within 60 days after the conclusion of the hearing. That decision shall set forth specific findings of fact resolving the genuinely disputed material facts that were the subject of the hearing. The written decision shall also dispose of the matters raised in the notice required under paragraph (1) of subsection (d). If the responsible official concludes that the respondent is liable under section 2752 of this title, the decision shall include the findings of fact and conclusions of law which the responsible official relied upon in determining that the respondent is liable, and the amount of any penalty or assessment to be imposed on the respondent. Any decisions issued under this subparagraph shall be based on the record before the responsible official and shall be supported by a preponderance of the evidence. The responsible official shall promptly send to the respondent a copy of the decision by registered or certified mail, or other similar commercial means, or shall hand deliver a copy of the decision.</text>
										</subsection></section><section id="HE40210C45F864D8EA21B1DC2579971A3"><enum>2754.</enum><header>Payment; interest on late payments</header>
 <subsection id="H53B73A2A3E054DCAAAE6E8260FDD85D8"><enum>(a)</enum><header>Payment of assessments and penalties</header><text>A respondent shall render payment of any assessment and penalty imposed by a responsible official, or any amount otherwise agreed to as part of a settlement or adjustment, not later than the date—</text>
 <paragraph id="H9015B9B6D2D948A4B1A5E4FF1933056D"><enum>(1)</enum><text>that is 30 days after the date of the receipt by the respondent of the responsible official’s decision; or</text>
 </paragraph><paragraph id="H912B58C539C24376A8C7DC63BDBC3580"><enum>(2)</enum><text>as otherwise agreed to by the respondent and the responsible official.</text> </paragraph></subsection><subsection id="H5B23ED77B76346789D6607ECB595BCC8"><enum>(b)</enum><header>Interest</header><text>If there is an unpaid balance as of the date determined under paragraph (1), interest shall accrue from that date on any unpaid balance. The rate of interest charged shall be the rate in effect as of that date that is published by the Secretary of the Treasury under section 3717 of title 31.</text>
 </subsection><subsection id="H52DA97300A104D7697DB403605F8E3B7"><enum>(c)</enum><header>Treatment of receipts</header><text>All penalties, assessments, or interest paid, collected, or otherwise recovered under this chapter shall be deposited into the Treasury as miscellaneous receipts as provided in section 3302 of title 31.</text>
 </subsection></section><section id="H725D4CF361434BF28B1322899699601A"><enum>2755.</enum><header>Judicial review</header><text display-inline="no-display-inline">A decision by a responsible official under section 2753(d) or 2753(h) of this title shall be final. Any such final decision is subject to judicial review only under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5.</text>
									</section><section id="HE1EB67BCE7F7493AB0AD744B9328C6F4"><enum>2756.</enum><header>Collection of civil penalties and assessments</header>
 <subsection id="H93C7335E49E841F8B11136BF23D33211"><enum>(a)</enum><header>Judicial enforcement of civil penalties and assessments</header><text>The Attorney General shall be responsible for judicial enforcement of any civil penalty or assessment imposed under this chapter.</text>
 </subsection><subsection id="H02EA75D1074F49AD96E83F56F83D39F8"><enum>(b)</enum><header>Civil actions for recovery</header><text>Any penalty or assessment imposed in a decision by a responsible official, or amounts otherwise agreed to as part of a settlement or adjustment, along with any accrued interest, may be recovered in a civil action brought by the Attorney General. In any such action, no matter that was raised or that could have been raised in a proceeding under this chapter or pursuant to judicial review under section 2755 of this title may be raised as a defense, and the determination of liability and the determination of amounts of penalties and assessments shall not be subject to review.</text>
 </subsection><subsection id="H873477A794FE405F8DE0C49F18277EF5"><enum>(c)</enum><header>Jurisdiction of United States district courts</header><text>The district courts of the United States shall have jurisdiction of any action commenced by the United States under subsection (b).</text>
 </subsection><subsection id="HDFE420A6A1854203904A267AB2F652DC"><enum>(d)</enum><header>Joining and consolidating actions</header><text>Any action under subsection (b) may, without regard to venue requirements, be joined and consolidated with or asserted as a counterclaim, cross-claim, or setoff by the United States in any other civil action which includes as parties the United States, and the person against whom such action may be brought.</text>
 </subsection><subsection id="H713626E53523406E9069096C9374A45F"><enum>(e)</enum><header>Jurisdiction of united states court of federal claims</header><text>The United States Court of Federal Claims shall have jurisdiction of any action under subsection (b) to recover any penalty or assessment, or amounts otherwise agreed to as part of a settlement or adjustment, along with any accrued interest, if the cause of action is asserted by the United States as a counterclaim in a matter pending in such court. The counterclaim need not relate to the subject matter of the underlying claim.</text>
 </subsection></section><section id="H6CBB5749FCC142EE9CDF3FF6BAE05AD7"><enum>2757.</enum><header>Right to administrative offset</header><text display-inline="no-display-inline">The amount of any penalty or assessment that has been imposed by a responsible official, or any amount agreed upon in a settlement or compromise, along with any accrued interest, may be collected by administrative offset.</text>
									</section><section id="HF33F8E5DC1D84753A06A2A375A2232AA"><enum>2758.</enum><header>Limitations</header>
 <subsection id="HBE56F92B31A44902BD9841AC478F7A8B"><enum>(a)</enum><header>Limitation on period for initiation of administrative action</header><text>An action under section 2752 of this title with respect to a claim or statement shall be commenced within six years after the date on which such claim or statement is made, presented, or submitted.</text>
										</subsection><subsection id="HCFF90D86BF3F4F8B95BC93A71F40AEE3"><enum>(b)</enum><header>Limitation period for initiation of civil action for recovery of administrative penalty or
 assessment</header><text>A civil action to recover a penalty or assessment under section 2756 of this title shall be commenced within three years after the date of the decision of the responsible official imposing the penalty or assessment.</text>
										</subsection></section><section id="H845936A91B71479BAD735DD683FC1A42"><enum>2759.</enum><header>Effect on other laws</header>
 <subsection id="HE3C2ABD78C16457B95DABDE3CAC86566"><enum>(a)</enum><header>Relationship to title 44 authorities</header><text>This chapter does not diminish the responsibility of the head of an agency to comply with the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, relating to coordination of Federal information policy.</text>
 </subsection><subsection id="HF300580F501F442793AD35B05B1C755D"><enum>(b)</enum><header>Relationship to title 31 authorities</header><text>The procedures set forth in this chapter apply to the agencies named in section 2751(a) of this title in lieu of the procedures under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/38">chapter 38</external-xref> of title 31, relating to administrative remedies for false claims and statements.</text>
 </subsection><subsection id="HC461EDC0B5F241ADA222659643862BA8"><enum>(c)</enum><header>Relationship to other authorities</header><text>Any action, inaction, or decision under this chapter shall be based solely upon the information before the responsible official and shall not limit or restrict any agency of the Government from instituting any other action arising outside this chapter, including suspension or debarment, based upon the same information. Any action, inaction or decision under this chapter shall not restrict the ability of the Attorney General to bring judicial action, based upon the same information as long as such action is not otherwise prohibited by law.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H91811C1AA90E43FEB273876E2973A11C"><enum>(2)</enum><header>Clerical amendment</header><text>The tables of chapters at the beginning of subtitle A, and at the beginning of part IV of subtitle A, of such title are each amended by inserting after the item relating to chapter 163 the following new item:</text>

 of supply to Afghanistan</header><text display-inline="no-display-inline">Section 801(f) of the National Defense Authorization Act for Fiscal Year 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/84">Public Law 111–84</external-xref>; 123 Stat. 2399), as most recently amended by section 832 of the National Defense Authorization Act for Fiscal Year 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/66">Public Law 113–66</external-xref>; 127 Stat. 814), is further amended by striking <quote>December 31, 2015</quote> and inserting <quote>December 31, 2018</quote>.</text>
				</section><section id="HCD9254D4772745329756EF84E62148B6"><enum>813.</enum><header>Exception to requirement to include cost or price to the Government as a factor in the evaluation
			 of proposals for certain task or delivery order contracts</header>
 <subsection id="HC87CB584A966441C9A63CDB30FB53601"><enum>(a)</enum><header>Contracting under title 41, United States Code</header><text>Section 3306(c) of title 41, United States Code, is amended—</text> <paragraph id="H3201142E44FC45AD9EE8D7FE5E5E949B"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>except as provided in paragraph (3),</quote> in subparagraphs (B) and (C) after the subparagraph designation; and</text>
 </paragraph><paragraph id="H4BB747B134AF4BE1980553BDA7E3F4ED"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text> <quoted-block id="HE5B1B8F3175943F8B6AA840B736A78BF" style="OLC"> <paragraph id="H6DEBBD8D007B40EB8C00EEB1DD477E1A"><enum>(3)</enum><header>Exceptions for certain indefinite delivery, indefinite quantity contracts</header><text>If the head of an agency issues a solicitation for multiple task or delivery order contracts under section 4103(d) of this title for the same or similar services and intends to make a contract award to each qualifying offeror—</text>
 <subparagraph id="H4F2AD904E8F44731B3C917477D9CFFF6"><enum>(A)</enum><text>cost or price to the Federal Government need not, at the Government’s discretion, be considered under subparagraph (B) of paragraph (1) as an evaluation factor for the contract award; and</text>
 </subparagraph><subparagraph id="HB5AA488D04B0423DAF05A93B341A6598"><enum>(B)</enum><text>if, pursuant to subparagraph (A), cost or price to the Federal Government is not considered as an evaluation factor for the contract award—</text>
 <clause id="H9FFE84A309664034B304396F128229A8"><enum>(i)</enum><text>the disclosure requirement of subparagraph (C) of paragraph (1) shall not apply; and</text> </clause><clause id="H39B2955CB7AF446A989C23989D98B74E"><enum>(ii)</enum><text>cost or price to the Federal Government shall be considered in conjunction with the issuance pursuant to section 4106(c) of this title of a task or delivery order under any contract resulting from the solicitation.</text>
 </clause></subparagraph></paragraph><paragraph id="H075F128D91FD464097BC9F2444B4D060"><enum>(4)</enum><header>Qualifying offeror defined</header><text>In paragraph (3), the term <quote>qualifying offeror</quote> means an offeror that—</text> <subparagraph id="H3C33466010364F92A8C1512EE7163B16"><enum>(A)</enum><text>is determined to be a responsible source;</text>
 </subparagraph><subparagraph id="H92E681C65B754C5A85A34121585BE478"><enum>(B)</enum><text>submits a proposal that conforms to the requirements of the solicitation; and</text> </subparagraph><subparagraph id="H65A5319CAE8E4873B96999F428C1F091"><enum>(C)</enum><text>the contracting officer has no reason to believe would likely offer other than fair and reasonable pricing.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H1929B908864D4337A1A6A12A962AEAED"><enum>(b)</enum><header>Contracting under title 10, united states code</header><text>Section 2305(a)(3) of title 10, United States Code, is amended—</text> <paragraph id="HBFF575317C2D4604B633323B16014D82"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>(except as provided in subparagraph (C))</quote> in clauses (ii) and (iii) after <quote>shall</quote>; and</text>
 </paragraph><paragraph id="H4A0131B1EA5E43C3A637A4E44CD9507A"><enum>(2)</enum><text>by adding at the end the following new subparagraphs:</text> <quoted-block id="H34C1627271044A7A9847B0971A6EE89E" style="OLC"> <subparagraph id="HAFECE5FD98584D3ABE07DA8F9D39648D" indent="up2"><enum>(C)</enum><text>If the head of an agency issues a solicitation for multiple task or delivery order contracts under section 2304a(d)(1)(B) of this title for the same or similar services and intends to make a contract award to each qualifying offeror—</text>
 <clause id="H99146A1C3B2A4BA19F7E66AF27528C8C"><enum>(i)</enum><text>cost or price to the Federal Government need not, at the Government’s discretion, be considered under clause (ii) of subparagraph (A) as an evaluation factor for the contract award; and</text>
 </clause><clause id="H0E663A7791BC45F69735E49A2D8F7BED"><enum>(ii)</enum><text>if, pursuant to clause (i), cost or price to the Federal Government is not considered as an evaluation factor for the contract award—</text>
 <subclause id="HBFE11A158AD448698DEA4DB8F7E1683A"><enum>(I)</enum><text>the disclosure requirement of clause (iii) of subparagraph (A) shall not apply; and</text> </subclause><subclause id="H70F69CC3A4EA488287461D782DE249C2"><enum>(II)</enum><text>cost or price to the Federal Government shall be considered in conjunction with the issuance pursuant to section 2304c(b) of this title of a task or delivery order under any contract resulting from the solicitation.</text>
 </subclause></clause></subparagraph><subparagraph id="HF95CE5E7F78A4C9C869A8B65AA23CA1E" indent="up2"><enum>(D)</enum><text>In subparagraph (C), the term <quote>qualifying offeror</quote> means an offeror that—</text> <clause id="H98AE7C73F60D4FCF8D89699084E2AA73"><enum>(i)</enum><text>is determined to be a responsible source;</text>
 </clause><clause id="H8C51F1D63EF6407E96C93BD649BBEE95"><enum>(ii)</enum><text>submits a proposal that conforms to the requirements of the solicitation; and</text> </clause><clause id="HCE340B3C00644901BAB78BC7F2352F75"><enum>(iii)</enum><text>the contracting officer has no reason to believe would likely offer other than fair and reasonable pricing.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section></subtitle><subtitle id="H3E87DE06E3824EC28708C3FE2D17ECB6"><enum>C</enum><header>Acquisition Reform Proposals</header>
				<section id="H920D4F6324EA4283B9A0781B82025F2E"><enum>821.</enum><header>Modification to requirements relating to determination of contract type for major development
			 programs</header>
 <subsection id="H77F69F5661444FB3A94D84E38024E88F"><enum>(a)</enum><header>Determination of contract type</header><text>Section 2306 of title 10, United States Code, is amended by adding at the end the following new subsection:</text>
						<quoted-block id="H0747EA6B324C43BCA3498EAE56CAE40B" style="OLC">
							<subsection id="H193138FE03FD4A938351FEF7009CC425"><enum>(i)</enum><header>Required elements of guidance relating to contract type</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HD1F3B8F356FE4932B57110D4F6E1E6A1"><enum>(1)</enum><text>The Secretary of Defense shall ensure that the guidance of the Department of Defense relating to major defense acquisition programs and major automated information systems includes—</text>
 <subparagraph id="H6AA8484599154C4D8FFDC398F95224A9"><enum>(A)</enum><text>a requirement that the acquisition strategy for such a program or system include identification of the contract type for development of the program or system; and</text>
 </subparagraph><subparagraph id="HB51BA89734EB4544A9F2A64B0E08EFF6"><enum>(B)</enum><text>a justification of the contract type identified.</text> </subparagraph></paragraph><paragraph id="H32BAAF3E0B274CBC9B83DB10F078EC0C" indent="up1"><enum>(2)</enum><text>The contract type identified in accordance with paragraph (1)(A) may be—</text>
 <subparagraph id="H798CD3DFB6414B65B76D7ABCEC608CB0"><enum>(A)</enum><text>a fixed-price type contract (including a fixed-price incentive contract); or</text> </subparagraph><subparagraph id="H513E3BA27FE347D5AE1AB03DAB68BBDF"><enum>(B)</enum><text>a cost-type contract (including a cost-plus-incentive-fee contract).</text>
 </subparagraph></paragraph><paragraph id="HFEBCD2280B404757A9CD72EF4C103787" indent="up1"><enum>(3)</enum><text>The guidance referred to in paragraph (1) shall require that the justification for the contract type selected explain—</text>
 <subparagraph id="H35CEA7094F864734AAEB2A614D1E0181"><enum>(A)</enum><text>how the level of program risk relates to the contract type selected; and</text> </subparagraph><subparagraph id="HDB4C206D2CBB4B5E99AF24F04770FF13"><enum>(B)</enum><text>how the use of incentives (especially cost incentives) in the contract, if any, supports the objectives of the development program.</text>
 </subparagraph></paragraph><paragraph id="HF6DF13A5C0B54860A3CF5D81217C3E0E" indent="up1"><enum>(4)</enum><text>The guidance shall also specify that the use of contracts with target costs, target profits or fees, and profit or fee adjustment formulas, during development, where applicable, is ordinarily in the interest of the Government.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HC3C4B62DE49D4FD783CC6D13DCB81CDD"><enum>(b)</enum><header>Repeal</header><text>Section 818 of the John Warner National Defense Authorization Act for Fiscal Year 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/364">Public Law 109–364</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2306">10 U.S.C. 2306</external-xref> note) is amended by striking subsections (b), (c), (d), and (e).</text>
 </subsection><subsection id="H14285893D21C411DA4318E93C64EC0C9"><enum>(c)</enum><header>Modification of regulations</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Defense shall modify the regulations of the Department of Defense regarding the determination of contract type for development programs to be consistent with the amendments made by this section.</text>
					</subsection></section><section id="H8417C0BE695244FAA627AB73E7E4EB3E"><enum>822.</enum><header>Repeal of requirement for stand-alone manpower estimates for major defense acquisition programs</header>
 <subsection id="H410D4F6FED86435E8509FE3FE436EE08"><enum>(a)</enum><header>Repeal of requirement</header><text>Subsection (a)(1) of section 2434 of title 10, United States Code, is amended by striking <quote>and a manpower estimate for the program have</quote> and inserting <quote>has</quote>.</text> </subsection><subsection id="H009C3622A00E4481BCEBAEE4E01F4D94"><enum>(b)</enum><header>Conforming amendments relating to regulations</header><text>Subsection (b) of such section is amended—</text>
 <paragraph id="H9C32BC9AB9984ADB9FA4996539A457DE"><enum>(1)</enum><text>by striking paragraph (2);</text> </paragraph><paragraph id="HA9123BEB5B8B47AEA500CEE3630B5BA0"><enum>(2)</enum><text>by striking <quote>shall require—</quote> and all that follows through <quote>that the independent</quote> and inserting <quote>shall require that the independent</quote>;</text>
 </paragraph><paragraph id="H932409C13FFE49F693ED6982ED655528"><enum>(3)</enum><text>by redesignating subparagraphs (A) and (B) as paragraphs (1) and (2), respectively, and realigning those paragraphs so as to be two ems from the left margin; and</text>

 <paragraph id="HEF06FEA7F06E4881B57E90F3CF29F6CD"><enum>(1)</enum><header>In general</header><text>Sections 2366a and 2366b of title 10, United States Code, are amended to read as follows:</text> <quoted-block id="HA702BDE8B7DD41ECA06FC71DC088B6D3" style="USC"> <section id="H8B2E81A012EA4E2FB9DDA159E24B27F8"><enum>2366a.</enum><header>Major defense acquisition programs: responsibilities at Milestone A approval</header> <subsection id="H7858FBAA85E14007A9BF3FA2ABC4021D"><enum>(a)</enum><header>Responsibilities</header><text>Before granting Milestone A approval for a major defense acquisition program or a major subprogram, the Milestone Decision Authority for the program or subprogram shall ensure—</text>
 <paragraph id="H7950FCA685B34838BA642A222E6CE6B1"><enum>(1)</enum><text>that information about the program or subprogram is sufficient to warrant entry of the program or subprogram into the risk reduction phase; and</text>
 </paragraph><paragraph id="HFB09290370B248B799F5A231E69A2511"><enum>(2)</enum><text>that there are sound plans for progression of the program or subprogram to the development phase.</text> </paragraph></subsection><subsection id="HF098433DCBAC4DDAB167472FEA76302A"><enum>(b)</enum><header>Considerations</header><text>In carrying out subsection (a), the Milestone Decision Authority shall consider to what extent the program or subprogram—</text>
 <paragraph id="H5E0E39565C99468EBF436D7EFF32C98A"><enum>(1)</enum><text>meets a joint military requirement;</text> </paragraph><paragraph id="HD77338A1B4FF439DAC456200AF5FF919"><enum>(2)</enum><text>responds to an anticipated or likely threat;</text>
 </paragraph><paragraph id="H5CF1A682519C4B8195A1571B2A7F0CCB"><enum>(3)</enum><text>has been developed in light of a review of alternative approaches;</text> </paragraph><paragraph id="HF0E4D0E57B324D899074164A0B6AE841"><enum>(4)</enum><text>is affordable;</text>
 </paragraph><paragraph id="H202E9D2DD1EE4876A0FC4026E72F8695"><enum>(5)</enum><text>has (A) identified areas of risk and, (B) for each such identified area of risk, has a plan to reduce the risk that is documented in the acquisition strategy for the program or subprogram;</text>
 </paragraph><paragraph id="HF39027B9EA744C8CB081B54819879275"><enum>(6)</enum><text>addresses planning for sustainment; and</text> </paragraph><paragraph id="H76444B36887441DB8D082F7D5230E689"><enum>(7)</enum><text>meets any other considerations the Milestone Decision Authority considers relevant.</text>
 </paragraph></subsection><subsection id="H9447E786E3D94C38AA0C0786673B28E2"><enum>(c)</enum><header>Relationship to other statutes</header><text>In assessing the considerations in subsection (b), the Milestone Decision Authority shall include consideration of the following:</text>
 <paragraph id="H6E2E09C1FB494662B49AC393CAEEE4AD"><enum>(1)</enum><text>With respect to joint military requirements, the requirements of section 181 of this title.</text> </paragraph><paragraph id="H495F3E97547A48F08D002E0F6AD716B4"><enum>(2)</enum><text>With respect to alternative approaches, the requirements of section 201 of the Weapon Systems Acquisition Reform Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/23">Public Law 111–23</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2302">10 U.S.C. 2302</external-xref> note).</text>
 </paragraph><paragraph id="HF6E643EE6EE74AC6A59B793D73578C59"><enum>(3)</enum><text>With respect to affordability and cost estimates and analyses, the requirements of section 2334 of this title.</text>

The Milestone Decision Authority’s decision memorandum with respect to such approval shall be available to the congressional defense committees upon request, consistent with any relevant classification requirements.</text>
 </subsection><subsection id="H70CBA12DD3174A0285C1B05332316983"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H491A906CF92E4918ACF41072AB3B42D4"><enum>(1)</enum><text>The term <quote>major defense acquisition program</quote> means a Department of Defense acquisition program that is a major defense acquisition program for purposes of section 2430 of this title.</text>
 </paragraph><paragraph id="H9A653065F78E4E69B892DF3631A71C3B"><enum>(2)</enum><text>The term <quote>major subprogram</quote> means a major subprogram of a major defense acquisition program designated under section 2430a(a)(1) of this title.</text>
 </paragraph><paragraph id="H291BD2640C8A4E87B6CBD9F1C4330CF1"><enum>(3)</enum><text>The term <quote>Milestone Decision Authority</quote>, with respect to a major defense acquisition program or a major subprogram, means the official within the Department of Defense designated with the overall responsibility and authority for acquisitions decisions for the program or subprogram, including authority to approve entry of the program or subprogram into the next phase of the acquisition process.</text>
 </paragraph><paragraph id="H3FEC1E37CE2C4C5B880F1B1DA86D082E"><enum>(4)</enum><text>The term <quote>Milestone A approval</quote> means a decision to enter into a risk reduction phase pursuant to guidance prescribed by the Secretary of Defense for the management of Department of Defense acquisition programs.</text>
 </paragraph><paragraph id="H69FD6B07571A43FF9497EE82454D4674"><enum>(5)</enum><text>The term <quote>joint military requirement</quote> has the meaning given that term in section 181(g)(1) of this title.</text> </paragraph></subsection></section><section id="HE4C27BCEB2E44D13951E95287383AD0A"><enum>2366b.</enum><header>Major defense acquisition programs: responsibilities at Milestone B approval</header> <subsection id="HB97E4C86E5CD45929A6D835181463718"><enum>(a)</enum><header>Responsibilities</header><text>Before granting Milestone B approval for a major defense acquisition program or a major subprogram, the Milestone Decision Authority for the program or subprogram shall ensure—</text>
 <paragraph id="H49756B29783C428DA25B910BB0F244FE"><enum>(1)</enum><text>that information about the program or subprogram is sufficient to warrant entry of the program or subprogram into the development phase; and</text>
 </paragraph><paragraph id="H3465F3D7EEDD411697A9AB84ED6F6921"><enum>(2)</enum><text>that there are sound plans in place for the program or subprogram to deliver the required capability.</text>
 </paragraph></subsection><subsection id="H21224BFFDAE74656970E6CB4E439002A"><enum>(b)</enum><header>Considerations</header><text>In carrying out subsection (a), the Milestone Decision Authority shall consider to what extent the program or subprogram will do each of the following:</text>
 <paragraph id="HD773A74F29A142D2935B1E04F198E0FB"><enum>(1)</enum><text>Provide a capability that is affordable.</text> </paragraph><paragraph id="H97B47E4BC96C468D8BCB7420B81764E1"><enum>(2)</enum><text>Identify and mitigate programmatic risks.</text>
 </paragraph><paragraph id="HA8D8225727324C789CA1759B172A3F75"><enum>(3)</enum><text>Deliver a capability with acceptable performance to fulfill a joint military requirement.</text> </paragraph><paragraph id="H422CCF466517438E80A52C5553CEC2CA"><enum>(4)</enum><text>Utilize technologies assessed to be mature.</text>
 </paragraph><paragraph id="HEA777C8656354860BA80706A02C14AD6"><enum>(5)</enum><text>Effectively utilize competition.</text> </paragraph><paragraph id="H170608A6C0F74EA69763897675E39E68"><enum>(6)</enum><text>Enable sustainment of the capability that is provided by the program or subprogram.</text>
 </paragraph><paragraph id="H900C5B4A9F4B483EB0970128750BC39D"><enum>(7)</enum><text>Continue to address, as necessary, the considerations for Milestone A approval (or in the case that the program has not previously been granted Milestone A approval, address such considerations).</text>
 </paragraph><paragraph id="H42CDDCE40CA741F396C57B6529FCA69F"><enum>(8)</enum><text>Respond to anticipated or likely threats.</text> </paragraph><paragraph id="H529A11D0FB3040EA86489D4373368D3A"><enum>(9)</enum><text>Meet any other considerations the Milestone Decision Authority considers relevant.</text>
 </paragraph></subsection><subsection id="H77E392A39B324DCCB82CC845A4DE1F51"><enum>(c)</enum><header>Relationship to other statutes</header><text>In addressing the considerations in subsection (b), the Milestone Decision Authority shall include consideration of the following:</text>
 <paragraph id="H2C4B3D1C3F5A4E8BB3B04CDCE6719CD3"><enum>(1)</enum><text>With respect to affordability, the requirements of section 2334 of this title.</text> </paragraph><paragraph id="HBC9640DA5A434BA6B2D7110FBAEA98F1"><enum>(2)</enum><text>With respect to risk, the requirements of—</text>
 <subparagraph id="HBC8F686EF2A941FEA492AFDE8E2EDA7C"><enum>(A)</enum><text>section 203 of the Weapon Systems Acquisition Reform Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/23">Public Law 111–23</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2430">10 U.S.C. 2430</external-xref> note); and</text>

 </subparagraph><subparagraph id="H5BCA059AE6814210A9884477DF9020E4"><enum>(B)</enum><text>section 2304 of this title.</text> </subparagraph></paragraph><paragraph id="H7B143CC0099C41399575A6AC083E7B4F"><enum>(5)</enum><text>With respect to sustainment, the requirements of section 2337 and section 2464 of this title.</text>
 </paragraph></subsection><subsection id="H70E7EE46AC3F4128BADFF90AC5B2439D"><enum>(d)</enum><header>Notification</header><text>Not later than 30 days after granting Milestone B approval for a major defense acquisition program or major subprogram, the Milestone Decision Authority for the program or subprogram shall submit to the congressional defense committees notice of such approval in writing. The Milestone Decision Authority’s decision memorandum with respect to such approval shall be available to the congressional defense committees upon request, consistent with any relevant classification requirements.</text>
 </subsection><subsection id="H79EFEB9AEEB2469297688C1286FC66A8"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H6C21FD77BDFC48BABC13953468E28416"><enum>(1)</enum><text>The term <quote>major defense acquisition program</quote> means a Department of Defense acquisition program that is a major defense acquisition program for purposes of section 2430 of this title.</text>
 </paragraph><paragraph id="H5322BB5222504E6795677A114F102F93"><enum>(2)</enum><text>The term <quote>major subprogram</quote> means a major subprogram of a major defense acquisition program designated under section 2430a(a)(1) of this title.</text>
 </paragraph><paragraph id="HBFA2C51DEE4645589B98C7F04AE7A7C8"><enum>(3)</enum><text>The term <quote>Milestone Decision Authority</quote>, with respect to a major defense acquisition program or a major subprogram, means the official within the Department of Defense designated with the overall responsibility and authority for acquisition decisions for the program or subprogram, including authority to approve entry of the program or subprogram into the next phase of the acquisition process.</text>
 </paragraph><paragraph id="H9E149BB45BAD4BEE9401CE179A6801EF"><enum>(4)</enum><text>The term <quote>Milestone A approval</quote> means a decision to enter into a risk reduction phase pursuant to guidance prescribed by the Secretary of Defense for the management of Department of Defense acquisition programs.</text>
 </paragraph><paragraph id="H1F9266586A24439AB7A8C0A4895F2FDF"><enum>(5)</enum><text>The term <quote>Milestone B approval</quote> means a decision to enter into a development phase pursuant to guidance prescribed by the Secretary of Defense for the management of Department of Defense acquisition programs.</text>

								<section id="H93D0E68967AD49E09B1A5433F04BCFFB"><enum>2222.</enum><header>Defense business systems: business process reengineering; enterprise architecture; management</header>
 <subsection id="H00DE17F090A44B63A8035CCDD3DAA59F"><enum>(a)</enum><header>Defense business systems generally</header><text>The Secretary of Defense shall ensure that each covered defense business system developed, deployed, and operated by the Department of Defense—</text>
 <paragraph id="HD77353A0E8C2401EAFBA6D5A3E78BA9A"><enum>(1)</enum><text>supports efficient business processes that have been reviewed, and as appropriate revised, through business process reengineering;</text>
 </paragraph><paragraph id="H76FB17BE84B14963A123185AC0464CCA"><enum>(2)</enum><text>is integrated into a comprehensive defense business enterprise architecture; and</text> </paragraph><paragraph id="HC9B4ABD5063B451897E049C9A12ECC76"><enum>(3)</enum><text>is managed in a manner that provides visibility into, and traceability of, expenditures for the system.</text>
										</paragraph></subsection><subsection id="H5BDA5AAA29D848758F19FDB2ED88D9B0"><enum>(b)</enum><header>Issuance of guidance</header>
 <paragraph id="H057BDB13B25440A5AB4DE08D2C48E8C0"><enum>(1)</enum><header>Secretary of defense guidance</header><text>The Secretary shall issue guidance to provide for the coordination of, and decision making for, the planning, programming, and control of investments in covered defense business systems.</text>
 </paragraph><paragraph id="H55DE6FEF28104E1F8BADA039B9521477"><enum>(2)</enum><header>Supporting guidance</header><text>The Secretary shall direct the Deputy Chief Management Officer of the Department of Defense, the Under Secretary of Defense for Acquisition, Technology, and Logistics, the Chief Information Officer, and the Chief Management Officer of each of the military departments to issue and maintain supporting guidance, as appropriate, for the guidance of the Secretary issued under paragraph (1).</text>
 </paragraph></subsection><subsection id="HAEAE15A1351B4EE6B6CBEA89DD223F17"><enum>(c)</enum><header>Guidance elements</header><text>The guidance issued pursuant to subsection (b)(1) shall include the following elements:</text> <paragraph id="H35BBF376742F468B82F0716A1CF8CC03"><enum>(1)</enum><text>Policy to ensure that the business processes of the Department of Defense are continuously evolved to—</text>
 <subparagraph id="H8405245E824041C493ED22B56C726E65"><enum>(A)</enum><text>implement the most streamlined and efficient business process practicable; and</text> </subparagraph><subparagraph id="HDD40E75A8A944F0088A898ED584FF5BB"><enum>(B)</enum><text>enable the use of commercial off-the-shelf business systems with the fewest changes necessary to accommodate requirements and interfaces that are unique to the Department of Defense.</text>
 </subparagraph></paragraph><paragraph id="HC089BF98FC64471A83C5C2AEDBE4B567"><enum>(2)</enum><text>A process to establish requirements for covered defense business systems.</text> </paragraph><paragraph id="HB7F43C75A42C441A9A71A9E2D17E2510"><enum>(3)</enum><text>Mechanisms for the planning and control of investments in covered defense business systems, including a process for the collection and review of programming and budgeting information for covered defense business systems.</text>
 </paragraph><paragraph id="H36D5BC678203497AAB0C92BFBACA968F"><enum>(4)</enum><text>Policy requiring the periodic review of covered defense business systems that have been fully deployed, by portfolio, to ensure that investments in such portfolios are appropriate.</text>
										</paragraph></subsection><subsection id="HEF4C6B828A3244DEA7BBFE4162898661"><enum>(d)</enum><header>Defense business enterprise architecture</header>
 <paragraph id="HC9FC33506F804056B1D1712DC7A7427A"><enum>(1)</enum><header>Blueprint</header><text>The Secretary, working through the Deputy Chief Management Officer of the Department of Defense, shall develop and maintain a blueprint to guide the development of integrated business processes within the Department of Defense Such blueprint shall be known as the <quote>defense business enterprise architecture</quote>.</text>
 </paragraph><paragraph id="H3D3717E9749142189D3C3C5BA984BF40"><enum>(2)</enum><header>Purpose</header><text>The defense business enterprise architecture shall be sufficiently defined to effectively guide implementation of interoperable defense business system solutions and shall be consistent with the policies and procedures established by the Director of the Office of Management and Budget.</text>
 </paragraph><paragraph id="HC0E24A0B7E9C47848CFDF49B7C5AC27E"><enum>(3)</enum><header>Elements</header><text>The defense business enterprise architecture shall—</text> <subparagraph id="HE3521B0C66EF4865ADA4CDD56AED4565"><enum>(A)</enum><text>include policies, procedures, business data standards, business performance measures, and business information requirements that apply uniformly throughout the Department of Defense; and</text>
 </subparagraph><subparagraph id="H66D73B99990846E9849F1907D37A07BC"><enum>(B)</enum><text>enable the Department of Defense to—</text> <clause id="H337463B0DFB74EA28A609B0B86548FF4"><enum>(i)</enum><text>comply with all applicable law, including Federal accounting, financial management, and reporting requirements;</text>
 </clause><clause id="H8697509FC08E45E1926722BB9358D1B9"><enum>(ii)</enum><text>routinely produce verifiable, timely, accurate, and reliable business and financial information for management purposes; and</text>
 </clause><clause id="H81C2CB9A0F6C43EBBAAFEC2E808A0EBC"><enum>(iii)</enum><text>integrate budget, accounting, and program information and systems.</text> </clause></subparagraph></paragraph><paragraph id="H092B45E1AE634213B75418A1E3632044"><enum>(4)</enum><header>Integration into information technology architecture</header><text>The defense business enterprise architecture shall integrate into an information technology enterprise architecture, developed by the Chief Information Officer of the Department of Defense, which describes a target business systems computing environment for each of the major business processes conducted by the Department of Defense.</text>
										</paragraph></subsection><subsection id="H7F3171F911574655A8EAB86958914591"><enum>(e)</enum><header>Defense business council</header>
 <paragraph id="H499ECBA463CB460F93B6445207E2E134"><enum>(1)</enum><header>Requirement for council</header><text>The Secretary shall establish a Defense Business Council to provide advice to the Secretary on developing the defense business enterprise architecture, reengineering the Department’s business processes, and requirements for defense business systems. The Council shall be chaired by the Deputy Chief Management Officer and the Chief Information Officer of the Department of Defense.</text>
 </paragraph><paragraph id="HEA211E5436654665B3511115C5C737C9"><enum>(2)</enum><header>Membership</header><text>The membership of the Council shall include the following:</text> <subparagraph id="H7DB110C881674C5CBFFBCFDD421DE8C1"><enum>(A)</enum><text>The Chief Management Officers of the military departments, or their designees.</text>
 </subparagraph><subparagraph id="H2E7E147919B840F2B6E123A49BBFDDFB"><enum>(B)</enum><text>The following officials of the Department of Defense, or their designees:</text> <clause id="H668E5D359CEB46808F6773C25AB833FA"><enum>(i)</enum><text>The Under Secretary of Defense for Acquisition, Technology, and Logistics with respect to acquisition, logistics, and installations management processes.</text>
 </clause><clause id="H9B25F6A952954EC59F08BCB5C123107D"><enum>(ii)</enum><text>The Under Secretary of Defense (Comptroller) with respect to financial management and planning and budgeting processes.</text>
 </clause><clause id="HDC14B7417CE84DDAB465063E4005581D"><enum>(iii)</enum><text>The Under Secretary of Defense for Personnel and Readiness with respect to human resources management processes.</text>
												</clause></subparagraph></paragraph></subsection><subsection id="H0577A653FE8D445D8FAEE3DF94EBCEB8"><enum>(f)</enum><header>Approvals required for development</header>
 <paragraph id="HF4B7191D9FD742DB972DFA302015E859"><enum>(1)</enum><header>Initial approval required</header><text>The Secretary shall ensure that a covered defense business system program cannot proceed into development (or, if no development is required, into production or fielding) unless the appropriate approval official (as specified in paragraph (2)) has determined that the covered defense business system concerned—</text>
 <subparagraph id="H863D9358C9B443778627F6F12D3BD79A"><enum>(A)</enum><text>supports a business process that has been, or is being as a result of the acquisition program, reengineered to be as streamlined and efficient as practicable consistent with the guidance issued pursuant to subsection (b), including business process mapping;</text>
 </subparagraph><subparagraph id="HDCBB4961D7E04574B8A3627B0AB1737C"><enum>(B)</enum><text>is in compliance with the defense business enterprise architecture developed pursuant to subsection (d) or will be in compliance as a result of modifications planned;</text>
 </subparagraph><subparagraph id="HBE03202AE7904577AC6E8D8B6DB7401F"><enum>(C)</enum><text>has valid, achievable requirements; and</text> </subparagraph><subparagraph id="H81CC6CB22E4A4589865164A6E95D99E8"><enum>(D)</enum><text>is in compliance with the Department’s auditability requirements.</text>
 </subparagraph></paragraph><paragraph id="HBACB6A16A99242BAA82863FE317C76F6"><enum>(2)</enum><header>Appropriate official</header><text>For purposes of paragraph (1), the appropriate approval official with respect to a covered defense business system is the following:</text>
 <subparagraph id="HBF98D1C164B04FAD9080015B2EFF4D44"><enum>(A)</enum><text>In the case of a system of a military department, the Chief Management Officer of that military department.</text>
 </subparagraph><subparagraph id="HE95360074DFE4CE99B084217E7657E0D"><enum>(B)</enum><text>In the case of a system of a Defense Agency or Defense Field Activity or a system that will support the business process of more than one military department or Defense Agency or Defense Field Activity, the Deputy Chief Management Officer of the Department of Defense.</text>
 </subparagraph><subparagraph id="HF2CE32859B3840AEB91EAFD59076C284"><enum>(C)</enum><text>In the case of any system, such official other than the applicable official under subparagraph (A) or (B) as the Secretary designates for such purpose.</text>
 </subparagraph></paragraph><paragraph id="HEF4BD7124DBB4883A897A05D644246A7"><enum>(3)</enum><header>Annual certification</header><text>For any fiscal year in which funds are expended for development pursuant to a covered defense business system program, the Defense Business Council shall review the system and certify (or decline to certify as the case may be) that it continues to satisfy the requirements of paragraph (1). If the Council determines that certification cannot be granted, the chairman of the Council shall notify the Appropriate Approving Official and the acquisition Milestone Decision Authority for the program and provide a recommendation for corrective action.</text>
 </paragraph><paragraph id="H2AC5F316EA044D5CAE770500992EBD63"><enum>(4)</enum><header>Obligation of funds in violation of requirements</header><text>The obligation of Department of Defense funds for a covered defense business system program that has not been certified in accordance with paragraph (3) is a violation of section 1341(a)(1)(A) of title 31.</text>
 </paragraph></subsection><subsection id="H683B5397633240D6B6D817A809F074A5"><enum>(g)</enum><header>Responsibility of milestone decision authority</header><text>The Secretary shall ensure that, as part of the defense acquisition system, the requirements of this section are fully addressed by the Milestone Decision Authority for a covered defense business system program as acquisition process approvals are considered for such system.</text>
 </subsection><subsection id="HF14F377DB4AB43D88A068631482A4065"><enum>(h)</enum><header>Annual report</header><text>Not later than March 15 of each year from 2016 through 2020, the Secretary shall submit to the congressional defense committees a report on activities of the Department of Defense pursuant to this section. Each report shall include the following:</text>
 <paragraph id="H86EE48694A0B442384B67C632A53A287"><enum>(1)</enum><text>A description of actions taken and planned with respect to the guidance required by subsection (b) and the defense business enterprise architecture developed pursuant to subsection (d).</text>
 </paragraph><paragraph id="HB2141876EC234771A106DD87C895A7A8"><enum>(2)</enum><text>A description of actions taken and planned for the reengineering of business processes by the Defense Business Council established pursuant to subsection (e).</text>
 </paragraph><paragraph id="H2C5098632BBE4B9CB0381AB9D26749E0"><enum>(3)</enum><text>A summary of covered defense business system funding and covered defense business systems approved pursuant to subsection (f).</text>
 </paragraph><paragraph id="H7B34137DC69E4789A8460BF6286F5A96"><enum>(4)</enum><text>Identification of any covered defense business system program that during the preceding fiscal year was reviewed and not approved pursuant to subsection (f) and the reasons for the lack of approval.</text>
 </paragraph><paragraph id="H4B356BB8CD2C40249D3C1C7F35A9584A"><enum>(5)</enum><text>Identification of any covered defense business system program that during the preceding fiscal year failed to achieve initial operational capability within five years of when the program received Milestone B approval.</text>
 </paragraph><paragraph id="HDE867410C0784DA48979B5F329834102"><enum>(6)</enum><text>For any program identified under paragraph (5), a description of the plan to address the issues which caused the failure.</text>
 </paragraph><paragraph id="H6B06A9D333A04527BE69363C53812E94"><enum>(7)</enum><text>A discussion of specific improvements in business operations and cost savings resulting from successful covered defense business systems programs.</text>
 </paragraph><paragraph id="H162D673B725B4D248EED8AB8C4F327BC"><enum>(8)</enum><text>A copy of the most recent report of the Chief Management Officer of each military department on implementation of business transformation initiatives by such military department in accordance with section 908 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/110/417">Public Law 110–417</external-xref>; 122 Stat. 4569; <external-xref legal-doc="usc" parsable-cite="usc/10/2222">10 U.S.C. 2222</external-xref> note).</text>
 </paragraph></subsection><subsection id="H6518FDE445964FF49A37006AB837FD41"><enum>(i)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H04B749B835064088A19260114E7452BE"><enum>(1)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H5C829F4C0EDB4E0BB3EBE6D489C46CA7"><enum>(A)</enum><header>Defense business system</header><text>The term <quote>defense business system</quote> means an information system that is operated by, for, or on behalf of the Department of Defense, including any of the following:</text>
 <clause id="HEA9BC10334ED4B2380DF7CF2ED6210EB" indent="up1"><enum>(i)</enum><text>A financial system.</text> </clause><clause id="HDA7052288F9D488ABFFF5F859C957215" indent="up1"><enum>(ii)</enum><text>A financial data feeder system.</text>
 </clause><clause id="HB236D328C8144D3887D007740B0FB19C" indent="up1"><enum>(iii)</enum><text>A contracting system.</text> </clause><clause id="H947CED85C53A4A13B6CD1D0B4DC9EA7C" indent="up1"><enum>(iv)</enum><text>A logistics system.</text>
 </clause><clause id="HC670203D455B4C9498055FA119F188B8" indent="up1"><enum>(v)</enum><text>A planning and budgeting system.</text> </clause><clause id="H0E6141F47AF842279434EF40D7C6803B" indent="up1"><enum>(vi)</enum><text>An installations management system.</text>
 </clause><clause id="H68375C5DA1664D568FBB4ECA2ED06821" indent="up1"><enum>(vii)</enum><text>A human resources management system.</text> </clause><clause id="H96276696738646CE8B72A88DA1D2D27B" indent="up1"><enum>(viii)</enum><text>A training and readiness system.</text>
 </clause></subparagraph><subparagraph id="H3D38BFD0E4BD452A913E49FE54BDB3C9" indent="up1"><enum>(B)</enum><text>The term does not include—</text> <clause id="H2FE5743929CD4784BF01CA4085A0190D"><enum>(i)</enum><text>a national security system; or</text>
 </clause><clause id="HAE3A3C3F16B6456C92C58F8AD5F81B7A"><enum>(ii)</enum><text>an information system used exclusively by and within the defense commissary system or the exchange system or other instrumentality of the Department of Defense conducted for the morale, welfare, and recreation of members of the armed forces using nonappropriated funds.</text>
 </clause></subparagraph></paragraph><paragraph id="H3E1D8DF0F53B425CBDA0E8E0F90E9142"><enum>(2)</enum><header>Covered defense business system</header><text>The term <quote>covered defense business system</quote> means a defense business system that is expected to have a total amount of budget authority over the period of the current future-years defense program submitted to Congress under section 221 of this title, in excess of the threshold established for the use of special simplified acquisition procedures pursuant to section 2304(g)(1)(B) of this title.</text>
 </paragraph><paragraph id="H5E0801F1044B46529ABE23806D988E5D"><enum>(3)</enum><header>Covered defense business system program</header><text>The term <quote>covered defense business system program</quote> means a defense acquisition program to develop and field a covered defense business system or an increment of a covered defense business system.</text>
 </paragraph><paragraph id="HC49AF40ECE144FEA80FACBE995BA4198"><enum>(4)</enum><header>Enterprise architecture</header><text>The term <quote>enterprise architecture</quote> has the meaning given that term in section 3601(4) of title 44.</text> </paragraph><paragraph id="HE30D355E80DC4C1B8E1FF44143CB42AD"><enum>(5)</enum><header>Information system</header><text>The term <quote>information system</quote> has the meaning given that term in section 11101 of title 40.</text>
 </paragraph><paragraph id="H1066542C23FC47368C49710A4E1E4424"><enum>(6)</enum><header>National security system</header><text>The term <quote>national security system</quote> has the meaning given that term in section 3542(b)(2) of title 44.</text> </paragraph><paragraph id="H6E3B4FA1977C4477A2BC4A7B9A5CEDEE"><enum>(7)</enum><header>Milestone decision authority</header><text>The term <quote>Milestone Decision Authority</quote>, with respect to a defense acquisition program, means the individual within the Department of Defense designated with the responsibility to grant milestone approvals for that program.</text>

 <subsection id="H00BE39ECF8F74E889FE47514B698417F"><enum>(a)</enum><header>Consolidation of certain logistics and sustainment-Related provisions</header><text>Section 2337(b)(2) of title 10, United States Code, is amended—</text> <paragraph id="H27519CDAB35F47FABE5FC9CEA9FEFFC6"><enum>(1)</enum><text>in subparagraph (A), by inserting before the semicolon the following: <quote>in order to sustain the system until either (i) a replacement system is fielded and assumes the majority of responsibility for the mission of the existing system, or (ii) the mission of the system is eliminated and the system is disposed of</quote>;</text>

 </paragraph></subsection><subsection id="H655CB4513F174224BE295A41BE26D2D7"><enum>(b)</enum><header>Core logistics capabilities</header><text>Section 2464 of such title is amended—</text> <paragraph id="H2F9867E299D141398F39DD17CDD9DC1A"><enum>(1)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text>

 <paragraph id="H4D1F223E56F042AB960293165C757C01"><enum>(1)</enum><text>Before Milestone A approval for the program is granted, an analysis of the applicability of core logistics capabilities requirements to the program shall be considered.</text>
 </paragraph><paragraph id="H8BCB2BB6D82B4E4098F76601D2EB53A5"><enum>(2)</enum><text>Before Milestone B approval for the program is granted, an estimate of the requirements for core logistics capabilities for the program, and the associated sustaining workloads required to support such requirements, shall be considered.</text>
 </paragraph><paragraph id="H29B85E33491C49C9A9E0CFDBC64B58A1"><enum>(3)</enum><text>Before approval is granted for the program to enter low-rate initial production, a description of requirements for core depot-level maintenance and repair capabilities, as well as the associated logistics capabilities and the associated sustaining workloads required to support such requirements, shall be considered.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

									<subsection id="H8BF5159F9CB64E83BADE52AACA73666C"><enum>(a)</enum><header>Requirement</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HCA548F221E174DD88F33B8AAB2D7AE5E"><enum>(1)</enum><text>There shall be an acquisition strategy for each major defense acquisition program. The acquisition strategy for a major defense acquisition program shall be reviewed by the Milestone Decision Authority for the program at each time specified in paragraph (2). The Milestone Decision Authority may approve, disapprove, or revise the acquisition strategy at any such time.</text>
 </paragraph><paragraph id="HE90E19D5E6E3405C8BDFA1042E8C7130" indent="up1"><enum>(2)</enum><text>The times at which the acquisition strategy for a major defense acquisition program shall be reviewed by the Milestone Decision Authority for the program under paragraph (1) are the following:</text>
 <subparagraph id="HFAB1CC198A5D4002A1CF4B72B3B2C204"><enum>(A)</enum><text>Program initiation.</text> </subparagraph><subparagraph id="HA93F16DB12294C9097A34EC4A8940F16"><enum>(B)</enum><text>Each subsequent milestone.</text>
 </subparagraph><subparagraph id="HD685AC235E5E43B8840116325FDCC858"><enum>(C)</enum><text>Full-Rate Production Decision Review.</text> </subparagraph><subparagraph id="H5122AD85250E43AF95FA2093E9626270"><enum>(D)</enum><text>Any other time considered relevant by the Milestone Decision Authority.</text>
 </subparagraph></paragraph></subsection><subsection id="H1BB786C5AD114DCCB271FFB3F4708555"><enum>(b)</enum><header>Considerations</header><text>The acquisition strategy for a major defense acquisition program shall present a top-level description of the business and technical management approach designed to achieve the objectives of the program within the resource constraints imposed. The strategy shall clearly express the program manager’s approach to the program in sufficient detail to allow the Milestone Decision Authority to assess the viability of approach, implementation of laws and policies, and program objectives. The content and review and approval process for the acquisition strategy for a major defense acquisition program shall be issued and maintained by the Under Secretary of Defense for Acquisition, Technology, and Logistics; however, the acquisition strategy should consider the following:</text>
 <paragraph id="H057F46FBF01340508C4385C16A87B6E3"><enum>(1)</enum><text>Tailoring.</text> </paragraph><paragraph id="H84FAB624F0E44F5F92A65A0EEB4F1BBE"><enum>(2)</enum><text>Acquisition approach, including industrial base considerations in accordance with section 2440 of this title and, if applicable, plans for increments or evolutionary acquisition.</text>
 </paragraph><paragraph id="H7887A4FA694B4E5AA414A3BF60DF9F44"><enum>(3)</enum><text>Risk management, in accordance with section 203 of the Weapon Systems Acquisition Reform Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/23">Public Law 111–23</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2430">10 U.S.C. 2430</external-xref> note).</text>
 </paragraph><paragraph id="H16F77C5A8D3B4F0AA497CF3EEE6E0939"><enum>(4)</enum><text>Business strategy, including measures to ensure competition in accordance with section 202 of the Weapon Systems Acquisition Reform Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/23">Public Law 111–23</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2430">10 U.S.C. 2430</external-xref> note).</text>

 </paragraph></subsection><subsection id="H28D1AB8B6AFD4A17943E5E393FB4146E"><enum>(c)</enum><text>In this section, the term <quote>Milestone Decision Authority</quote>, with respect to a major defense acquisition program, means the official within the Department of Defense designated with the overall responsibility and authority for acquisition decisions for the program, including authority to approve entry of the program into the next phase of the acquisition process.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HD2F1D730E99F4789A4028464F0BADF7D"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 2431 the following new item:</text>

 programs</header><text display-inline="no-display-inline">Section 203 of the Weapon Systems Acquisition Reform Act of 2009 is amended to read as follows:</text> <quoted-block id="H5679E81044A64726A381A44431EFA7DF" style="OLC"> <section id="HF7E9F492C68D41B0A0C85A8BE0941FBB"><enum>203.</enum><header>Risk reduction in major defense acquisition programs</header> <subsection id="H16B7A751B32E4D4E97021754BF8179F2"><enum>(a)</enum><header>Guidance on risk reduction in major defense acquisition programs</header><text>The Secretary of Defense shall ensure that the acquisition strategy for each major defense acquisition program for which development activities are required includes the following:</text>
 <paragraph id="H2926D20DA83E44E5A89DC08F5CE2F208"><enum>(1)</enum><text>A comprehensive approach to identifying and addressing risk (including technical, cost and schedule risk) during the period preceding full rate production as a means to improve programmatic decision making and appropriately manage program concurrency.</text>
 </paragraph><paragraph id="H6CDCDBFEE12F44BC815A1512661A2890"><enum>(2)</enum><text>Documentation of the major sources of risk identified and the approach to retiring that risk.</text> </paragraph></subsection><subsection id="HD92EC6B4AF5A47C6968D3E8502451DC3"><enum>(b)</enum><header>Elements of comprehensive approach to risk reduction</header><text>The elements of a comprehensive approach to identifying and addressing risk for purposes of subsection (a)(1) shall include some combination of the following as appropriate for the item or system being acquired:</text>
 <paragraph id="H9E95B3D2E5294DC4B5B2A096D943A81C"><enum>(1)</enum><text>Development planning.</text> </paragraph><paragraph id="H0A3D2F01FF4B4882B0EB953ADDB32711"><enum>(2)</enum><text>Systems engineering.</text>
 </paragraph><paragraph id="H28FB4AC60D9E4916A3F502C6DAE009AC"><enum>(3)</enum><text>Integrated developmental and operational test.</text> </paragraph><paragraph id="H7CC70A816FEF416DBB780E72EAB3AA04"><enum>(4)</enum><text>Preliminary and critical design reviews and technical reviews.</text>
 </paragraph><paragraph id="H28AEA9864B4D49D0853B2D9F4B4085CF"><enum>(5)</enum><text>Prototyping (including prototyping at the system or subsystem level and competitive prototyping, where appropriate).</text>
 </paragraph><paragraph id="H5263A7C1FD614A419A88247DFEA6132A"><enum>(6)</enum><text>Modeling and simulation.</text> </paragraph><paragraph id="H5A1FFCC2D4974926BFE74797F29A74F9"><enum>(7)</enum><text>Technology demonstrations and technology off ramps.</text>
 </paragraph><paragraph id="H2F7B4960E86B4D4C89364FEF0674314E"><enum>(8)</enum><text>Multiple design approaches.</text> </paragraph><paragraph id="H86BE73A1E4C64B06B5320B6FEEAEE467"><enum>(9)</enum><text>Alternative, lower risk reduced performance designs.</text>

			</section></title><title id="H5816C0C003D54FE39CF973C7BFA68EEB"><enum>X</enum><header>General Provisions</header>
			<subtitle id="H824C8834342A4D79ADC296DCDA259A4A"><enum>A</enum><header>Financial Matters</header>
				<section id="H7AE84094D35F47A989CAD09415EBAFF6"><enum>1001.</enum><header>Enhancement of interagency support during contingency operations and transition periods</header>
 <subsection id="HA0BA15DD62EB457B9E76601741497F64"><enum>(a)</enum><header>Authority</header><text>The Secretary of Defense and the Secretary of State may enter into an agreement under which each Secretary may provide covered support, supplies, and services on a reimbursement basis, or by exchange of covered support, supplies, and services, to the other Secretary during a contingency operation and related transition period for up to two years following the end of such contingency operation.</text>
 </subsection><subsection id="H52494525224F4C3D9C8F71866CE1E433"><enum>(b)</enum><header>Agreement</header><text>An agreement entered into under this section shall be in writing and shall include the following terms:</text>
 <paragraph id="HF74320966107470DA3A4AAAF60BB3DF4"><enum>(1)</enum><text>The price charged by a supplying agency shall be the direct costs that such agency incurred by providing the covered support, supplies, or services to the requesting agency under this section.</text>
 </paragraph><paragraph id="H76E87B2B30994DD88F3ECF97840E334F"><enum>(2)</enum><text>Credits and liabilities of the agencies accrued as a result of acquisitions and transfers of covered support, supplies, and services under this section shall be liquidated not less often than once every 3 months by direct payment to the agency supplying such support, supplies, or services by the agency receiving such support, supplies, or services.</text>
 </paragraph><paragraph id="HF5FB036EBBBC486EA7DD0F628D72EFA5"><enum>(3)</enum><text>Exchange entitlements accrued as a result of acquisitions and transfers of covered support, supplies, and services under this section shall be satisfied within 12 months after the date of the delivery of the covered support, supplies, or services. Exchange entitlements not so satisfied shall be immediately liquidated by direct payment to the agency supplying such covered support, supplies, or services.</text>
 </paragraph></subsection><subsection id="HE8770010435941C0B9E4313EBBA5C4EB"><enum>(c)</enum><header>Effect of obligation and availability of funds</header><text>An order placed by an agency pursuant to an agreement under this section is deemed to be an obligation in the same manner that a similar order or contract placed with a private contractor is an obligation. Appropriations remain available to pay an obligation to the servicing agency in the same manner as appropriations remain available to pay an obligation to a private contractor.</text>
 </subsection><subsection id="H46B720F8B64E4D81A000FE0038560A55"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HD016224C642B441D951C3F1FF07E6F1A"><enum>(1)</enum><text>The term <quote>covered support, supplies, and services</quote> means food, billeting, transportation (including airlift), petroleum, oils, lubricants, communications services, medical services, ammunition, base operations support (and construction incident to base operations support), use of facilities, spare parts and components, repair and maintenance services, and calibration services.</text>
 </paragraph><paragraph id="H63A1121328C04B908DA0055B1006C7F4"><enum>(2)</enum><text>The term <quote>contingency operation</quote> has the meaning given that term in section 101(a)(13) of title 10, United States Code.</text> </paragraph></subsection><subsection id="H4296B39056C740738A69AE062D21F1EB"><enum>(e)</enum><header>Crediting of receipts</header><text>Any receipt as a result of an agreement entered into under this section shall be credited, at the option of the Secretary of Defense with respect to the Department of Defense and the Secretary of State with respect to the Department of State, to—</text>
 <paragraph id="H3F8A4134EB6F4D4D9C40BACDB0F967DA"><enum>(1)</enum><text>the appropriation, fund, or account used in incurring the obligation; or</text> </paragraph><paragraph id="H23569E6EB5874A2BA2CCF59D5A9506EF"><enum>(2)</enum><text>an appropriate appropriation, fund, or account currently available for the purposes for which the expenditures were made.</text>
						</paragraph></subsection></section></subtitle><subtitle id="HB390F00521D4447CAC8D7BF8B32E2859"><enum>C</enum><header>Naval Vessels and Shipyards</header>
				<section id="H50B431D2E38D4FB6AD0111CC3BAE0C88"><enum>1021.</enum><header>Extension of authority for reimbursement of expenses for certain Navy mess operations afloat</header>

 <paragraph id="HDFE889E581534CA3A2FF7DC1A7C97709"><enum>(1)</enum><text>U.S.S. George Washington (CVN–73).</text> </paragraph><paragraph id="HDCC0B4A6F0BF4BD69C6A54C763154466"><enum>(2)</enum><text>U.S.S. John C. Stennis (CVN–74).</text>
 </paragraph><paragraph id="HE4E369F294D4496EB8545429FEBCE74B"><enum>(3)</enum><text>U.S.S. Harry S. Truman (CVN–75).</text> </paragraph><paragraph id="H1FFC1F38F8CA4B1FA49C20342D2D2D2A"><enum>(4)</enum><text>U.S.S. Ronald Reagan (CVN–76).</text>
 </paragraph><paragraph id="H98B50FDC854241F0B6DB5407E0803349"><enum>(5)</enum><text>U.S.S. George H.W. Bush (CVN–77).</text> </paragraph><continuation-text continuation-text-level="subsection">Each such refueling and overhaul shall be carried out from amounts appropriated or otherwise made available within Shipbuilding and Conversion, Navy, for refueling the Nimitz-class aircraft carriers.</continuation-text></subsection><subsection id="H7BAA9170CE3E4BB090770120C117BEB7"><enum>(b)</enum><header>Special funding authority when a continuing resolution is in effect</header><text>Unless expressly prohibited in a continuing resolution enacted after this date, if advance procurement funds are appropriated for a fiscal year to begin a refueling and complex overhaul on a Nimitz-class aircraft carrier identified in subsection (a), then Shipbuilding and Conversion, Navy, appropriations in the amounts contained in the President’s Budget for that refueling and complex overhaul for the following Fiscal Year shall be available for obligation under a continuing resolution enacted for the following fiscal year to continue the refueling and complex overhaul on that aircraft carrier.</text>
 </subsection><subsection id="H2C3B1F1855BD431C9DF4B988840D5640"><enum>(c)</enum><header>Incremental funding authority</header><text>The Secretary of the Navy is authorized to incrementally fund contracts entered into for a nuclear refueling and complex overhaul authorized in subsection (a), for a period not to exceed six years after advance procurement funds for the nuclear refueling and complex overhaul effort are first obligated, from amounts appropriated or otherwise made available within Shipbuilding and Conversion, Navy for refueling the Nimitz-class aircraft carriers.</text>
 </subsection><subsection id="H2BCD755700C64AD9A6F382A0ABBBC01C"><enum>(d)</enum><header>Condition for out-Year contract payments</header><text>A contract entered into under subsection (c) shall provide that any obligation of the United States to make a payment under a contract for carrier refueling in a fiscal year subsequent to the initial year of contract execution is subject to the availability of appropriations.</text>
					</subsection></section></subtitle><subtitle id="H823695856FC04EFA987A8DB5DCC1831B"><enum>D</enum><header>Other Matters</header>
				<section id="H49A048BBF00A42548CCB8997097244D8"><enum>1041.</enum><header>Transfer of functions of the Veterans’ Advisory Board on Dose Reconstruction to the Secretaries of
 Veterans Affairs and Defense</header><text display-inline="no-display-inline">Section 601 of the Veterans Benefits Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/183">Public Law 108–183</external-xref>; 117 Stat. 2667; <external-xref legal-doc="usc" parsable-cite="usc/38/1154">38 U.S.C. 1154</external-xref> note) is amended to read as follows:</text>

						<section id="HF8F5B9733AC3480EA0FD45A218F5BD5B"><enum>601.</enum><header>Radiation Dose Reconstruction Program of the Department of Defense</header>
 <subsection id="H4B37250CA14640328816A4C09F8529CA"><enum>(a)</enum><header>Review and oversight</header><text>The Secretary of Veterans Affairs and the Secretary of Defense shall jointly take appropriate actions to ensure the on-going independent review and oversight of the Radiation Dose Reconstruction Program of the Department of Defense.</text>
 </subsection><subsection id="HF14A5527042F436C9437A1D525666675"><enum>(b)</enum><header>Duties</header><text>In carrying out subsection (a), the Secretaries shall—</text> <paragraph id="HC1D8866AB8EE4B929790E849123F1CC2"><enum>(1)</enum><text>conduct periodic, random audits of dose reconstructions under the Radiation Dose Reconstruction Program and of decisions by the Department of Veterans Affairs on claims for service connection of radiogenic diseases;</text>
 </paragraph><paragraph id="H26C1AC0EA26642D3A9601F6D55B4E357"><enum>(2)</enum><text>communicate to veterans information on the mission, procedures, and evidentiary requirements of the Program; and</text>
 </paragraph><paragraph id="H1CCDA74D342049AC89236E8169F73FEB"><enum>(3)</enum><text>carry out such other activities with respect to the review and oversight of the Program as the Secretaries shall jointly specify.</text>
 </paragraph></subsection><subsection id="H9CB98946D2C645939EED4504A0B78E2D"><enum>(c)</enum><header>Recommendations</header><text>The Secretaries may make such recommendations on modifications in the mission or procedures of the Program as they consider appropriate as a result of the audits conducted under subsection (b)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

 </section><section id="H0AAB703ECBE4457C824053BDFEDEE39B"><enum>1102.</enum><header>Authority to provide additional allowances and benefits for defense clandestine service employees</header><text display-inline="no-display-inline">Section 1603 of title 10, United States Code, is amended by adding at the end the following new subsection:</text>

			 Kuwait Armed Forces</header>
 <subsection id="H9034CC1CC2594DD2879D2E5DB0152546"><enum>(a)</enum><header>Authority To accept contributions</header><text>The Secretary of Defense, after consultation with the Secretary of State, may accept cash contributions from the State of Kuwait, for the purposes specified in subsection (c).</text>
 </subsection><subsection id="H53ABA591C3C24C2BB3EB0B27FDCF5C97"><enum>(b)</enum><header>Accounting</header><text>Contributions accepted under subsection (a) shall be placed in an account established by the Secretary of Defense and shall remain available until expended for the purposes specified in subsection (c).</text>
 </subsection><subsection id="H7A1C524572ED462F928436E2A3DDC992"><enum>(c)</enum><header>Availability of contributions</header><text>Contributions accepted under subsection (a) shall be available only for payment of costs in connection with mutually beneficial construction (including military construction not otherwise authorized by law), maintenance, and repair projects in Kuwait.</text>
 </subsection><subsection id="HF9C153B5266F4EB8BDBA2AD23F14F9BF"><enum>(d)</enum><header>Mutually beneficial defined</header><text>A project shall be considered to be <quote>mutually beneficial</quote> for purposes of this section if—</text> <paragraph id="H2B15BD9282DF48C1B4B7008F279541FA"><enum>(1)</enum><text>the project is in support of a bilateral United States and Kuwait defense cooperation agreement; or</text>
 </paragraph><paragraph id="H1361172DD696472591B31E3A8F2FD8B1"><enum>(2)</enum><text>the Secretary of Defense determines that the United States may derive a benefit from the project, including—</text>
 <subparagraph id="HDF7D96B309C44270B2D2834E226B7B94"><enum>(A)</enum><text>access to and use of facilities of the Kuwait Armed Forces;</text> </subparagraph><subparagraph id="H3EA1FA85FF48477D95A4243F5A0FE420"><enum>(B)</enum><text>ability or capacity for future posture; and</text>

 <subsection id="HC39C4BE162E945ABB4F643CA0AF30BBE"><enum>(a)</enum><header>Authority</header><text>From funds made available for the Department of Defense for operation and maintenance, the Secretary of Defense, with the concurrence of the Secretary of State and in consultation with the Director of the Office of Management and Budget, may provide reimbursements for counterinsurgency, counterterrorism, and stabilization operations carried out by the Government of Pakistan in its campaign against al-Qaeda, the Tehrik-e-Taliban Pakistan, and associated militants.</text>
 </subsection><subsection id="H1495F3F77C1E4B84B1D109094FBD2EE1"><enum>(b)</enum><header>Types of reimbursements</header><text>Reimbursements made under the authority in subsection (a) may be made, in such amounts as the Secretary of Defense considers appropriate, for logistical, military, and other expenditures associated with the operations specified in subsection (a).</text>
				</subsection><subsection id="HDFD5A9A07C1F465C9D1D421518F0F96F"><enum>(c)</enum><header>Limitations</header>
 <paragraph id="H92D99B328F4848DD806A391673E1DE59"><enum>(1)</enum><header>Prohibition on contractual obligations to make payments</header><text>The Secretary of Defense may not enter into any contractual obligation to make a reimbursement under the authority in subsection (a).</text>
 </paragraph><paragraph id="H762A5AE447CC490C8B0E6E3D3E591D76"><enum>(2)</enum><header>Prohibition on reimbursement of pakistan for support during periods closed to transshipment</header><text>The Secretary of Defense may not provide a reimbursement under the authority in subsection (a) for claims of support provided during any period when the ground lines of supply through Pakistan were closed to the transshipment of equipment and supplies in support of United States military operations in Afghanistan.</text>
 </paragraph></subsection><subsection id="H1B9175D253D7438BBC410C29EB428796"><enum>(d)</enum><header>Notice to congressional committees</header><text>The Secretary of Defense shall notify the appropriate congressional committees not later than 15 days before making any reimbursement under the authority in subsection (a).</text>
 </subsection><subsection id="HF566C4F488CF427EA7887C3B70771F78"><enum>(e)</enum><header>Termination</header><text>The Secretary of Defense may not use the authority in subsection (a) to provide reimbursement for any costs that are incurred after September 30, 2018.</text>
				</subsection><subsection id="H9434EE9243334BC288679F0B86C809A6"><enum>(f)</enum><header>Limitation on reimbursements to the Government of Pakistan under section 1233 of the National
 Defense Authorization Act for Fiscal Year 2008</header><text>No reimbursement may be provided to the Government of Pakistan under section 1233 of the National Defense Authorization Act for Fiscal Year 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/181">Public Law 110–181</external-xref>, 122 Stat. 393), as most recently amended by section 1222 of the National Defense Authorization Act for Fiscal Year 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/113/291">Public Law 113–291</external-xref>, 128 Stat. yyy), for any period during which this section is also in effect.</text>

				<section id="H32CAE1F59FE74A23A2096B546FCD63AC"><enum>2801.</enum><header>Change in authorities relating to scope of work variations for military construction projects</header>
 <subsection id="HA987DCBDE2744F63979BFB64D6C432F0"><enum>(a)</enum><header>Limited authority for scope of work increase</header><text>Section 2853 of title 10, United States Code, is amended—</text> <paragraph id="HF3536152396B46798DFD995AACEA47F6"><enum>(1)</enum><text>in subsection (b)(2), by striking <quote>The scope of work</quote> and inserting <quote>Except as provided in subsection (d), the scope of work</quote>;</text>
