 </subparagraph><subparagraph id="HD7B79131A4B4402A9E0D1B57D460B465"><enum>(B)</enum><text>$6,981,036,000 for fiscal year 2017.</text> </subparagraph></paragraph><paragraph id="H64767051373C43E98DBBD3F366091BC2"><enum>(2)</enum><text>For the acquisition, construction, renovation, and improvement of aids to navigation, shore facilities, vessels, and aircraft, including equipment related thereto, and for maintenance, rehabilitation, lease, and operation of facilities and equipment—</text>

 </subparagraph></paragraph><paragraph id="HAB0F5174DE9F44A9BC4635520CD52276"><enum>(4)</enum><text>For the environmental compliance and restoration functions of the Coast Guard under chapter 19 of this title—</text>
 <subparagraph id="H3D3B0ED6CEDE4BFC81888A03620ADB63"><enum>(A)</enum><text>$16,701,000 for fiscal year 2016; and</text> </subparagraph><subparagraph id="H973B7473E6D246B2891163CB78485784"><enum>(B)</enum><text>$16,701,000 for fiscal year 2017.</text>
 </subparagraph></paragraph><paragraph id="HC04F3D86678A41BF98EAD04270A957F0"><enum>(5)</enum><text>To the Commandant of the Coast Guard for research, development, test, and evaluation of technologies, materials, and human factors directly related to improving the performance of the Coast Guard's mission with respect to search and rescue, aids to navigation, marine safety, marine environmental protection, enforcement of laws and treaties, ice operations, oceanographic research, and defense readiness, and for maintenance, rehabilitation, lease, and operation of facilities and equipment—</text>
 <subparagraph id="HE98D936C5560449AAEA2EB021063948C"><enum>(A)</enum><text>$19,890,000 for fiscal year 2016; and</text> </subparagraph><subparagraph id="HFDF0B99F814545E78ABB4480217A4692"><enum>(B)</enum><text>$19,890,000 for fiscal year 2017.</text>
										</subparagraph></paragraph></section><section id="H988DD4B4AC24409D91B9F5C45B40DC5F"><enum>2704.</enum><header>Authorized levels of military strength and training</header>
 <subsection id="H0E6D06A9DB1B41F39D00ECF872227878"><enum>(a)</enum><header>Active duty strength</header><text display-inline="yes-display-inline">The Coast Guard is authorized an end-of-year strength for active duty personnel of 43,000 for each of fiscal years 2016 and 2017.</text>
 </subsection><subsection id="H5CB31DDC9CAC40B2B3A354C089DA3748"><enum>(b)</enum><header>Military training student loads</header><text display-inline="yes-display-inline">The Coast Guard is authorized average military training student loads for each of fiscal years 2016 and 2017 as follows:</text>
 <paragraph id="HF44F431B39F74497AEA6A61D3C99717D"><enum>(1)</enum><text>For recruit and special training, 2,500 student years.</text> </paragraph><paragraph id="H2830BEFA5ECC41CC84B6DB549A3DEBE2"><enum>(2)</enum><text>For flight training, 165 student years.</text>
 </paragraph><paragraph id="H4AF2EBB405C0495ABC55AE57D291668D"><enum>(3)</enum><text>For professional training in military and civilian institutions, 350 student years.</text> </paragraph><paragraph id="H294C206E05C54303A9984DA4CB9831D5"><enum>(4)</enum><text>For officer acquisition, 1,200 student years.</text>

								<section id="H92A1745529D04DEA9DCE5EC698CE68C0"><enum>2904.</enum><header>Manpower requirements plan</header>
 <subsection id="HD9ACF6A531C547DE9EF77D3212D65610"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">On the date on which the President submits to Congress a budget for fiscal year 2017 under section 1105 of title 31, on the date on which the President submits to Congress a budget for fiscal year 2019 under such section, and every 4 years thereafter, the Commandant shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a manpower requirements plan.</text>
 </subsection><subsection id="H99953E6E89A24BFCBEA5694514CFF0C9"><enum>(b)</enum><header>Scope</header><text>A manpower requirements plan submitted under subsection (a) shall include for each mission of the Coast Guard—</text>
 <paragraph id="H604F097DB73B497EB6B5B1340C321E5E"><enum>(1)</enum><text>an assessment of all projected mission requirements for the upcoming fiscal year and for each of the 3 fiscal years thereafter;</text>
 </paragraph><paragraph id="H6D59251AD4C94E73A3F8BE2D3E69C7CB"><enum>(2)</enum><text>the number of active duty, reserve, and civilian personnel assigned or available to fulfill such mission requirements—</text>
 <subparagraph id="H2592340424134432B6C38F4AC46D2F99"><enum>(A)</enum><text>currently; and</text> </subparagraph><subparagraph id="HAA879630B1D148A98E10E2F0B96C53B7"><enum>(B)</enum><text display-inline="yes-display-inline">as projected for the upcoming fiscal year and each of the 3 fiscal years thereafter;</text>
 </subparagraph></paragraph><paragraph id="H261339F7FDF447D397AB28DF190AD8EE"><enum>(3)</enum><text>the number of active duty, reserve, and civilian personnel required to fulfill such mission requirements—</text>
 <subparagraph id="H79DF8C44EA9545EABAAD25E7A65A85A8"><enum>(A)</enum><text>currently; and</text> </subparagraph><subparagraph id="H90D5FE16308E4773B659E87CAB159AFF"><enum>(B)</enum><text>as projected for the upcoming fiscal year and each of the 3 fiscal years thereafter;</text>
 </subparagraph></paragraph><paragraph id="H4F6345700A8F498FAA19F3AED83E46EE"><enum>(4)</enum><text>an identification of any capability gaps between mission requirements and mission performance caused by deficiencies in the numbers of personnel available—</text>
 <subparagraph id="HD480A48613E14248A11B45CB967BB68E"><enum>(A)</enum><text>currently; and</text> </subparagraph><subparagraph id="HD21E454D01614C5EBD25C02A28D22275"><enum>(B)</enum><text>as projected for the upcoming fiscal year and each of the 3 fiscal years thereafter; and</text>
 </subparagraph></paragraph><paragraph id="H4C12F8F7FA9F420C9936409C29291C6D"><enum>(5)</enum><text>an identification of the actions the Commandant will take to address capability gaps identified under paragraph (4).</text>
 </paragraph></subsection><subsection id="H8300516D695346738194ABF2E0C0E396"><enum>(c)</enum><header>Consideration</header><text>In composing a manpower requirements plan for submission under subsection (a), the Commandant shall consider—</text>
 <paragraph id="H9B5475DFD90945129F6F8C6B9A46DADC"><enum>(1)</enum><text>the marine safety strategy required under section 2116 of title 46;</text> </paragraph><paragraph id="HC7EE45BC54EC4C01A2EEDBD190C6101D"><enum>(2)</enum><text>information on the adequacy of the acquisition workforce included in the most recent report under section 2903 of this title; and</text>
 </paragraph><paragraph id="H7A4031E0BBD34296A67CE4FDADDCF59D"><enum>(3)</enum><text>any other Federal strategic planning effort the Commandant considers appropriate.</text></paragraph></subsection></section></chapter></part><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HEB890F996E3A42A990321546B93D86C1"><enum>(b)</enum><header>Requirement for prior authorization of appropriations</header><text display-inline="yes-display-inline">Section 662 of title 14, United States Code, is amended—</text>
 <paragraph id="H21C422760E6844678374A62D4C644EAB"><enum>(1)</enum><text>by redesignating such section as section 2701;</text> </paragraph><paragraph id="H959D2046DD634D6EBD9182339CA3757B"><enum>(2)</enum><text>by transferring such section to appear before section 2702 of such title (as added by subsection (a) of this section); and</text>
 </paragraph><paragraph id="H0A92CDC38D6241DAB9A25E3CC34AE654"><enum>(3)</enum><text>by striking paragraphs (1) through (5) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H071E9757C88642E28E8CC0AF661C870B" style="USC"> <paragraph id="HB76FC35D3F4E440EB794C34B4DE5A4FB"><enum>(1)</enum><text display-inline="yes-display-inline">For the operation and maintenance of the Coast Guard, not otherwise provided for.</text>
 </paragraph><paragraph id="HF09D3C71FB9247D48AE0663AC8075A2F"><enum>(2)</enum><text display-inline="yes-display-inline">For the acquisition, construction, renovation, and improvement of aids to navigation, shore facilities, vessels, and aircraft, including equipment related thereto, and for maintenance, rehabilitation, lease, and operation of facilities and equipment.</text>
 </paragraph><paragraph id="HEC695B6AC0AE4F6D8DF7CCC4C2DFD73F"><enum>(3)</enum><text display-inline="yes-display-inline">For the Coast Guard Reserve program, including operations and maintenance of the program, personnel and training costs, equipment, and services.</text>
 </paragraph><paragraph id="H95274C4C8BD44D20B1CFFAD8A0A1B9D5"><enum>(4)</enum><text display-inline="yes-display-inline">For the environmental compliance and restoration functions of the Coast Guard under chapter 19 of this title.</text>
 </paragraph><paragraph id="HD429F711AF25495DB39C8A3F45173486"><enum>(5)</enum><text display-inline="yes-display-inline">For research, development, test, and evaluation of technologies, materials, and human factors directly related to improving the performance of the Coast Guard.</text>
 </paragraph><paragraph id="H4E781A83655A47DDBA21394C421D8DC1"><enum>(6)</enum><text>For alteration or removal of bridges over navigable waters of the United States constituting obstructions to navigation, and for personnel and administrative costs associated with the Alteration of Bridges Program.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HB4E7987025F64842B1433BCF8990E8C8"><enum>(c)</enum><header>Authorization of personnel end strengths</header><text display-inline="yes-display-inline">Section 661 of title 14, United States Code, is amended—</text> <paragraph id="H86A7376A561A4AFF88DA9B4D188EF3A0"><enum>(1)</enum><text>by redesignating such section as section 2703; and</text>

 <paragraph id="HBDECA6947380462A9A7B4F84C31BD166"><enum>(1)</enum><text>implement a standard for tracking operational days at sea for Coast Guard cutters that does not include days during which such cutters are undergoing maintenance or repair; and</text>
 </paragraph><paragraph id="HC27D4A938EFB4282A7ABECC38343E5B6"><enum>(2)</enum><text>notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate of the standard implemented under paragraph (1).</text>
 </paragraph></subsection><subsection id="H61C7DB45D8C94B7AB1FB3394DFD57C60"><enum>(d)</enum><header>Fixed wing aircraft fleet mix analysis</header><text>Not later than September 30, 2015, the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a revised fleet mix analysis of Coast Guard fixed wing aircraft.</text>
				</subsection></section><section id="HB7B250BBA35F420F9CD449BA7DE4F6B4" section-type="subsequent-section"><enum>205.</enum><header>Auxiliary jurisdiction</header>
 <subsection id="H310F7E67A5FE43669A07D27C0C7F0BE9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 822 of title 14, United States Code, is amended—</text> <paragraph id="H7FCC8F64078140A0B3A7CB374661447A"><enum>(1)</enum><text>by striking <quote>The purpose</quote> and inserting the following:</text>

 </paragraph><paragraph id="HE9F89AB0A8DD4A4B892D9F08CED21A48"><enum>(2)</enum><text>a State or other proper authority has requested such patrol pursuant to section 141 of this title or section 13109 of title 46.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H8467CAE793C040DE8B06FA700723903F"><enum>(b)</enum><header>Notification</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard shall—</text> <paragraph id="HF03552ECADBA49BB8D1CCECB93E6F02B"><enum>(1)</enum><text>review the waterways patrolled by the Coast Guard Auxiliary in the most recently completed fiscal year to determine whether such waterways are eligible or ineligible for patrol under section 822(b) of title 14, United States Code (as added by subsection (a)); and</text>
 </paragraph><paragraph id="HD0FFE3294A424FB8A8D7EA8414AEF311"><enum>(2)</enum><text>not later than 180 days after the date of the enactment of this Act, provide to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a written notification of—</text>
 <subparagraph id="HA7CCCA34E12144ADBA044E9249FACEAB"><enum>(A)</enum><text>any waterways determined ineligible for patrol under paragraph (1); and</text> </subparagraph><subparagraph id="HA1B4F8E81DC94D7F8D31603F605A064F"><enum>(B)</enum><text>the actions taken by the Commandant to ensure Auxiliary patrols do not occur on such waterways.</text>
 </subparagraph></paragraph></subsection></section><section id="H3B2C308BC93E4AC9A84D64887AEB77D6"><enum>206.</enum><header>Long-term major acquisitions plan</header><text display-inline="no-display-inline">Section 2903 of title 14, United States Code, as redesignated and otherwise amended by this Act, is further amended—</text>

 <subsection id="HA3514388B0AE484884C7C85198E81CFD"><enum>(e)</enum><header>Long-Term major acquisitions plan</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include a plan that describes for the upcoming fiscal year, and for each of the 20 fiscal years thereafter—</text>
 <paragraph id="H248BADAEBDC04B99B814B1AB2797D161"><enum>(1)</enum><text>the numbers and types of cutters and aircraft to be decommissioned;</text> </paragraph><paragraph id="H464DE654647048BEB828EC873C7B3A38"><enum>(2)</enum><text>the numbers and types of cutters and aircraft to be acquired to—</text>
 <subparagraph id="H73116A7EF9DB45479FFCA95DCE29F788"><enum>(A)</enum><text>replace the cutters and aircraft identified under paragraph (1); or</text> </subparagraph><subparagraph id="HB7C88104B2404BE19914D9E212D68AB7"><enum>(B)</enum><text>address an identified capability gap; and</text>
 </subparagraph></paragraph><paragraph id="H3CA96705A4794B51800F152012D69FEC"><enum>(3)</enum><text>the estimated level of funding in each fiscal year required to—</text> <subparagraph id="H88B9503223AD47EEAB6954C520B621E6"><enum>(A)</enum><text>acquire the cutters and aircraft identified under paragraph (2);</text>
 </subparagraph><subparagraph id="H1056C71AA83E4DC19881D2FC7BA9EF93"><enum>(B)</enum><text>acquire related command, control, communications, computer, intelligence, surveillance, and reconnaissance systems; and</text>
 </subparagraph><subparagraph id="H7794E6A931984F19A345B6D1E6E81082"><enum>(C)</enum><text>acquire, construct, or renovate shoreside infrastructure.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="HFA73114B6BDE46788B7F9ADF4EC14955"><enum>207.</enum><header>Coast Guard communities</header><text display-inline="no-display-inline">Section 409 of the Coast Guard Authorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/14/639">14 U.S.C. 639</external-xref> note) is amended by striking the second sentence and inserting the following: <quote>The Commandant may recognize any other community in a similar manner if the Commandant determines that such community has demonstrated enduring support of the Coast Guard, Coast Guard personnel, and the dependents of Coast Guard personnel.</quote>.</text>
 </section><section id="H0BB636DF4A6E4AE3BC88E3B738F4B814"><enum>208.</enum><header><quote>Polar Sea</quote> materiel condition assessment and service life extension decision</header><text display-inline="no-display-inline">Section 222 of the Coast Guard and Maritime Transportation Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/213">Public Law 112–213</external-xref>; 126 Stat. 1560) is amended—</text>

 <paragraph id="H327CBF38CE1746DEA75EF6F985C5A50A"><enum>(1)</enum><text>not less than two National Security Cutters;</text> </paragraph><paragraph id="H3DAB4EBDC7BB4145975E8F912F39072D"><enum>(2)</enum><text>not less than four Fast Response Cutters; and</text>
 </paragraph><paragraph id="H36022F8D85D74AD19DA6EEE3C8B8069B"><enum>(3)</enum><text>not less than four Medium Endurance Cutters (270 foot).</text> </paragraph></subsection><subsection id="H3D7423D373A8468C92A1F400A9A38DE9"><enum>(b)</enum><header>Timing</header><text display-inline="yes-display-inline">With respect to the National Security Cutters and Fast Response Cutters participating in the pilot program, a digital boat profile shall be established prior to the commissioning of the cutters.</text>
 </subsection><subsection id="H1F0BD01245664CA3B7F9DCA4A92D9BDE"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the establishment of the pilot program, and annually thereafter for the succeeding 4 years, the Secretary of the department in which the Coast Guard is operating shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report describing—</text>
 <paragraph id="HCB279084E1854EC8B08345D5D134A01C"><enum>(1)</enum><text>the implementation of the pilot program; and</text> </paragraph><paragraph id="HC3240F3A312D49E39675FDD849CA0328"><enum>(2)</enum><text>the results of the use of digital boat profiles under the pilot program with respect to—</text>
 <subparagraph id="H8ACB9807E5264B919D2AAA39D8C9FECB"><enum>(A)</enum><text>efficient maintenance of the cutters involved; and</text> </subparagraph><subparagraph id="H7C69328133184C6C92110179DBE8FA0F"><enum>(B)</enum><text>the post-delivery warranty management of equipment items, the repair and replacement of which are contractually obligated.</text>
 </subparagraph></paragraph></subsection><subsection id="H9070B70441724D2BB2A045919037C908"><enum>(d)</enum><header>Digital boat profile defined</header><text display-inline="yes-display-inline">In this section, the term <quote>digital boat profile</quote> means a commercially available off-the-shelf technology that creates an electronic data source with respect to a vessel that—</text>
 <paragraph id="H4C51E8D92A6743D196AD461A320D45BD"><enum>(1)</enum><text>provides lifecycle management support, including through the incorporation of systems manuals, schematics, and vessel documentation;</text>
 </paragraph><paragraph id="H24EBA53965DA4E73B7DFF18D5D65C3B4"><enum>(2)</enum><text>incorporates all manufacturer recommendations and operator best practices;</text> </paragraph><paragraph id="HE2EC1E6E6E334F649C59D32951FA4B68"><enum>(3)</enum><text>incorporates the use of real-time analytics of deferred tasks, future tasks, readiness assessments, and budgetary planners;</text>
 </paragraph><paragraph id="H3435CD51351C4FF9BB175099489B203E"><enum>(4)</enum><text>provides advance electronic notification of upcoming maintenance and inspections to multi-level permission-based recipients on a daily, weekly, or monthly basis;</text>
 </paragraph><paragraph id="HC21725DFB52D4891BC9EF0D0495B83AD"><enum>(5)</enum><text>facilitates oversight for pre-delivery discrepancy reporting and post-delivery warranty management of equipment items, the repair and replacement of which are contractually obligated; and</text>
 </paragraph><paragraph id="HED68365E48C44959933276C878C641E8"><enum>(6)</enum><text>is accessible by computing devices.</text> </paragraph></subsection></section><section id="HF8D82A6B99D84C0C9003AA31A3B01A18"><enum>212.</enum><header>Discontinuance of an aid to navigation</header> <subsection id="HD99F5AC9E17644AA8FB19DBDE687DF3E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall establish a process for the discontinuance of an aid to navigation established, maintained, or operated by the Coast Guard.</text>
 </subsection><subsection id="HEB1403FADA834ABE9C4737AFA7665986"><enum>(b)</enum><header>Requirement</header><text>The process established under subsection (a) shall include procedures to notify the public of any discontinuance of an aid to navigation described in that subsection.</text>
 </subsection><subsection id="H2F6965BDA2EA43E69CE20881CF35DF4F"><enum>(c)</enum><header>Consultation</header><text>In establishing a process under subsection (a), the Secretary shall consult with and consider any recommendations of the Navigation Safety Advisory Council.</text>
 </subsection><subsection id="H07C598C04D1B4D6D95712DA0242DCE43"><enum>(d)</enum><header>Notification</header><text>Not later than 30 days after establishing a process under subsection (a), the Secretary shall notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate of the process established.</text>
 </subsection></section><section id="H5E77452022C14853B89AAD9D6589242C"><enum>213.</enum><header>Mission performance measures</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Transportation and Infrastructure and the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate an assessment of the efficacy of the Coast Guard’s Standard Operational Planning Process with respect to annual mission performance measures.</text>
			</section><section id="H96AC72EA63F0449AA5BACBC237DD7DAC" section-type="subsequent-section"><enum>214.</enum><header>Communications</header>
 <subsection id="HC7C459DAEF684B3EAC531180C9EF858C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the department in which the Coast Guard is operating shall establish and carry out a response capabilities pilot program to assess, at not fewer than two Coast Guard command centers, the effectiveness of a radio gateway that—</text>
 <paragraph id="H8631ECB0E7534967ADFC3E2D1F138A71"><enum>(1)</enum><text>provides for—</text> <subparagraph id="H62EE9B7CD9D040EA821207AEB59F8E14"><enum>(A)</enum><text>multiagency collaboration and interoperability; and</text>
 </subparagraph><subparagraph id="H3AE0E68FE29D4C4AA0715D4BA3F04C94"><enum>(B)</enum><text>wide-area, secure, and peer-invitation-and-acceptance-based multimedia communications;</text> </subparagraph></paragraph><paragraph id="HB3F8E518F7E44B5E8B6D93E0003DBED9"><enum>(2)</enum><text>is certified by the Department of Defense Joint Interoperability Test Center; and</text>
 </paragraph><paragraph id="H82600B8D414C4B9EB43816EC73BEF1CE"><enum>(3)</enum><text>is composed of commercially available, off-the-shelf technology.</text> </paragraph></subsection><subsection id="HFA388A0D07724FBD97A81B019623BFB1"><enum>(b)</enum><header>Assessment</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter for the succeeding 4 years, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate an assessment of the pilot program, including the impacts of the program with respect to interagency and Coast Guard response capabilities.</text>
 </subsection></section><section id="HAF05D5D70DA042EEB8B508B031C1575A"><enum>215.</enum><header>Coast Guard graduate maritime operations education</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall establish an education program, for members and employees of the Coast Guard, that—</text>
 <paragraph id="HDF6DEFBE69034CA5913779AA1DCAE6E3"><enum>(1)</enum><text>offers a master’s degree in maritime operations;</text> </paragraph><paragraph id="H14767B1EFF1C4E3C87C1672653AB36F4"><enum>(2)</enum><text>is relevant to the professional development of such members and employees;</text>
 </paragraph><paragraph id="HC500AB02B9034A3087AFEE0F424F7BE2"><enum>(3)</enum><text>provides resident and distant education options, including the ability to utilize both options; and</text> </paragraph><paragraph id="HD15F47695F52460B86C533487F8FEE32"><enum>(4)</enum><text>to the greatest extent practicable, is conducted using existing academic programs at an accredited public academic institution that—</text>
 <subparagraph id="H5AEB74114EC64370AC8559E1A3381A36"><enum>(A)</enum><text>is located near a significant number of Coast Guard, maritime, and other Department of Homeland Security law enforcement personnel; and</text>
 </subparagraph><subparagraph id="H5686F5D16B3346AEB42A125E37D71BF3"><enum>(B)</enum><text>has an ability to simulate operations normally conducted at a command center.</text> </subparagraph></paragraph></section></title><title id="H10D53F7EE9E84E7BA914B79BE37BB308"><enum>III</enum><header>Shipping and Navigation</header> <section id="HCC36B22E39E44FD8AD9FF06F652D0130"><enum>301.</enum><header>Treatment of fishing permits</header> <subsection id="H149D381680B8417EB4DE5122DB6FBC28"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/313">chapter 313</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HDB5097220C4240AD90DE76AB09226160" style="USC">
						<section id="H6BA1FD4186854E4C97729ABFD9021221"><enum>31310.</enum><header>Treatment of fishing permits</header>
 <subsection id="H328CB1C775BA46F3AD2112581A0E8E15"><enum>(a)</enum><header>Limitation on maritime liens</header><text>This chapter—</text> <paragraph id="H5D51EC33CEE4462F9FFB90D4EDABEEBE"><enum>(1)</enum><text>does not establish a maritime lien on a fishing permit; and</text>
 </paragraph><paragraph id="H1827F3E6A57C484D9325BC3155E48476"><enum>(2)</enum><text>does not authorize any civil action to enforce a maritime lien on a fishing permit.</text> </paragraph></subsection><subsection id="HF6F695F122604B59B24E7577412BDC64"><enum>(b)</enum><header>Treatment of fishing permits under State and Federal law</header><text>A fishing permit—</text>
 <paragraph id="H1DB8F094F85A453EBD73667F3006B594"><enum>(1)</enum><text>is governed solely by the State or Federal law under which it is issued; and</text> </paragraph><paragraph id="H3940AA0A6B89438AB6A12CE15F6E7A23"><enum>(2)</enum><text>shall not be treated as part of a vessel, or as an appurtenance or intangible of a vessel, for any purpose under Federal law.</text>
 </paragraph></subsection><subsection id="H1063DBC7068248DABFA6B0F7359BD50C"><enum>(c)</enum><header>Authority of Secretary of Commerce not affected</header><text>Nothing in this section shall be construed as imposing any limitation upon the authority of the Secretary of Commerce—</text>
 <paragraph id="H0C889F2F2DBC4B108F1CB1817AF64235"><enum>(1)</enum><text>to modify, suspend, revoke, or impose a sanction on any fishing permit issued by the Secretary of Commerce; or</text>
 </paragraph><paragraph id="H19C17D21572A4517AE186824B4A062F8"><enum>(2)</enum><text>to bring a civil action to enforce such a modification, suspension, revocation, or sanction.</text> </paragraph></subsection><subsection id="HF2926127404A4ACCBE2D9428ED2A8A0E"><enum>(d)</enum><header>Fishing permit defined</header><text>In this section the term <term>fishing permit</term> means any authorization of a person or vessel to engage in fishing that is issued under State or Federal law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H4EA24439EFCF49BD8DC2780D0EE5DBF4"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 31309 the following:</text>

				</subsection></section><section id="H6144B3AF7D364508A9863ABB79FDCF74"><enum>302.</enum><header>Survival craft</header>
 <subsection id="H342827809B3940099D459A55959E1139"><enum>(a)</enum><header>In general</header><text>Section 3104 of title 46, United States Code, is amended to read as follows:</text> <quoted-block id="HF104AD74AACF424EBB20F4DE1B0F5D6A" style="USC"> <section id="H7DAF10B1E0314721904CEA5901BF50D5"><enum>3104.</enum><header>Survival craft</header> <subsection id="H64166D2392F94F88806438E10FB20AEC"><enum>(a)</enum><header>Requirement To Equip</header><text>The Secretary shall require that a passenger vessel be equipped with survival craft that ensures that no part of an individual is immersed in water, if—</text>
 <paragraph id="H64D5D13EBD3742F0AC0F3075A462D72B"><enum>(1)</enum><text>such vessel is built or undergoes a major conversion after January 1, 2016; and</text> </paragraph><paragraph id="HB79B813705994E8BB8CF7E5DB8BA166E"><enum>(2)</enum><text>operates in cold waters as determined by the Secretary.</text>
 </paragraph></subsection><subsection id="H0A53C917706B43E5A0D5D5D343C1401C"><enum>(b)</enum><header>Higher standard of safety</header><text>The Secretary may revise part 117 or part 180 of title 46, Code of Federal Regulations, as in effect before January 1, 2016, if such revision provides a higher standard of safety than is provided by the regulations in effect on or before the date of the enactment of the <short-title>Coast Guard Authorization Act of 2015</short-title>.</text>
 </subsection><subsection id="HC4CD3ECBF0E9424FB81A837131AD84CD"><enum>(c)</enum><header>Innovative and novel designs</header><text>The Secretary may, in lieu of the requirements set out in part 117 or part 180 of title 46, Code of Federal Regulations, as in effect on the date of the enactment of the <short-title>Coast Guard Authorization Act of 2015</short-title>, allow a passenger vessel to be equipped with a life saving appliance or arrangement of an innovative or novel design that—</text>
 <paragraph id="HCC684B944CA640F9BF545C33D399E344"><enum>(1)</enum><text>ensures no part of an individual is immersed in water; and</text> </paragraph><paragraph id="HA6A4F440DE9345C68508274B3A5E9C18"><enum>(2)</enum><text>provides an equal or higher standard of safety than is provided by such requirements as in effect before such date of the enactment.</text>
 </paragraph></subsection><subsection id="HB524E51DB8C544479E5410089B246033"><enum>(d)</enum><header>Built Defined</header><text>In this section, the term <term>built</term> has the meaning that term has under section 4503(e).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H2EBD16EE446A452BB313BA6468D43352"><enum>(b)</enum><header>Review; revision of regulations</header> <paragraph id="H343CF62F5A8D45139AE2A690F4FE9B1A"><enum>(1)</enum><header>Review</header><text>Not later than December 31, 2015, the Secretary of the department in which the Coast Guard is operating shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a review of—</text>
 <subparagraph id="H56B389FA0F6B40BCA94EBB35B77EF7FB"><enum>(A)</enum><text>the number of casualties for individuals with disabilities, children, and the elderly as a result of immersion in water, reported to the Coast Guard over the preceding 30-year period, by vessel type and area of operation;</text>
 </subparagraph><subparagraph id="H6FE89A9559EC4CACAB9C2E5700F3F092"><enum>(B)</enum><text>the risks to individuals with disabilities, children, and the elderly as a result of immersion in water, by passenger vessel type and area of operation;</text>
 </subparagraph><subparagraph id="HE1094D36189B467793E6F39BA6B678A9"><enum>(C)</enum><text>the effect that carriage of survival craft that ensure that no part of an individual is immersed in water has on—</text>
 <clause id="H0FF5C868259E432889BD5D16034EDF86"><enum>(i)</enum><text>passenger vessel safety, including stability and safe navigation;</text> </clause><clause id="H63AF653767CA40339C000A99B8176AC0"><enum>(ii)</enum><text>improving the survivability of individuals, including individuals with disabilities, children, and the elderly; and</text>
 </clause><clause id="HEFB40F4DD8824C7A95E873AA740E71F9"><enum>(iii)</enum><text display-inline="yes-display-inline">the costs, the incremental cost difference to vessel operators, and the cost effectiveness of requiring the carriage of such survival craft to address the risks to individuals with disabilities, children, and the elderly;</text>
 </clause></subparagraph><subparagraph id="H6C266012B96A479499714129B60DAC15"><enum>(D)</enum><text display-inline="yes-display-inline">the efficacy of alternative safety systems, devices, or measures in improving survivability of individuals with disabilities, children, and the elderly; and</text>
 </subparagraph><subparagraph id="H51BD6373A7E04D1F957079150EAEEF5F"><enum>(E)</enum><text display-inline="yes-display-inline">the number of small businesses and nonprofit vessel operators that would be affected by requiring the carriage of such survival craft on passenger vessels to address the risks to individuals with disabilities, children, and the elderly.</text>
 </subparagraph></paragraph><paragraph id="H886242132D47440EA68FB59A15A9DB3B"><enum>(2)</enum><header>Revision</header><text>Based on the review conducted under paragraph (1), the Secretary may revise regulations concerning the carriage of survival craft pursuant to section 3104(c) of title 46, United States Code.</text>
					</paragraph></subsection></section><section commented="no" id="HFE11B0180B3046E1B3BC45DA79C102A5"><enum>303.</enum><header>Enforcement</header>
 <subsection commented="no" id="H5D457BC1E30B470F94BBB00CB25F1FB9"><enum>(a)</enum><header>In general</header><text>Section 55305(d) of title 46, United States Code, is amended—</text> <paragraph commented="no" id="H2381E4E143FE48DD9E5FAD283D22860B"><enum>(1)</enum><text>by amending paragraph (1) to read as follows:</text>
						<quoted-block id="H6380742830D84791A95ECB5EA9D12A3E" style="OLC">
 <paragraph commented="no" id="H3738679F7DD6425D821B8E0651CB940A"><enum>(1)</enum><text>Each department or agency that has responsibility for a program under this section shall administer that program consistent with this section and any regulations promulgated pursuant to subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, issued by the Secretary of Transportation, and developed in consultation with each department and agency subject to this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" id="H6FD035AF02A2413E939F4954D376AEA8"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3), and by inserting after paragraph (1) the following:</text>
						<quoted-block id="HD3C2BEA14B8642FDB3AFAA99464FB895" style="OLC">
							<paragraph commented="no" id="H0CAA0721562440E2A1B1C9FCDB562DDA"><enum>(2)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H9D6B9F5214CB41D2A4FE84572B8BC762"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary, after consulting with the department, agency, organization, or person involved, shall have sole responsibility for determining the applicability of this section to a program of a Federal department or agency, after consulting with the department, agency, organization, or person involved.</text>
 </subparagraph><subparagraph commented="no" id="H6B67EAC750434B158E8A769156DFAE9C" indent="up1"><enum>(B)</enum><text>The head of a Federal department or agency shall request the Secretary to determine the applicability of this section to a program of such department or agency if the department or agency is uncertain of such applicability. Not later than 30 days after receiving such a request, the Secretary shall make such determination.</text>
 </subparagraph><subparagraph commented="no" id="H41F134463A4944FA8076609808526B72" indent="up1"><enum>(C)</enum><text>Subparagraph (B) shall not be construed to limit the authority of the Secretary to make a determination regarding the applicability of this section to a program administered by a Federal department or agency.</text>
 </subparagraph><subparagraph commented="no" id="H70F5C79FD1AC47899ED30BBC78AAFB3B" indent="up1"><enum>(D)</enum><text>A determination made by the Secretary under this paragraph regarding a program shall remain in effect until the Secretary determines that this section no longer applies to such program.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" id="H7D77A6F7C056430794DE2B269204DB75"><enum>(3)</enum><text>in paragraph (3), as so redesignated, by amending subparagraph (A) to read as follows:</text> <quoted-block id="H5FF97AB7F8E645468996BC2F37BC6E1E" style="OLC"> <subparagraph commented="no" id="H8598F1E9F13F4780BBDD635883CD1FDB"><enum>(A)</enum><text>shall conduct an annual review of the administration of programs subject to the requirements of this section to determine compliance with the requirements of this section;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" id="HBB022644564A4D6897EB4E1F7CDC5CA3"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block id="H421DE1696C0F45F9AA8EFD48C143DA5A" style="OLC"> <paragraph commented="no" id="H864928D342A64B2B9992F745873B4B41"><enum>(4)</enum><text>On the date on which the President submits to Congress a budget pursuant to section 1105 of title 31, the Secretary shall make available on the Internet website of the Department of Transportation a report that—</text>
 <subparagraph commented="no" id="H59A7830C54C94B8FAC6BA8C0F47D90F3"><enum>(A)</enum><text>lists the programs that were subject to determinations made by the Secretary under paragraph (2) in the preceding year; and</text>
 </subparagraph><subparagraph commented="no" id="HFF149939EFA845B4B234A78A1EEAB2E9"><enum>(B)</enum><text>describes the results of the most recent annual review required by paragraph (3)(A), including identification of the departments and agencies that transported cargo in violation of this section and any action the Secretary took under paragraph (3) with respect to each violation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="HB095C1714527473B970512D722D248B3"><enum>(b)</enum><header>Deadline for first review</header><text>The Secretary of Transportation shall complete the first review required under the amendment made by subsection (a)(1)(C) by not later than December 31, 2015.</text>
 </subsection><subsection id="H5F91B546633D4C4E8070DABC7B4F015D"><enum>(c)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 3511(c) of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (<external-xref legal-doc="usc" parsable-cite="usc/46/55305">46 U.S.C. 55305</external-xref> note) is repealed.</text>
				</subsection></section><section id="H6308439EB4504243AACD3A916BACA39A"><enum>304.</enum><header>Model years for recreational vessels</header>
 <subsection id="HBAD2C47B264F45FBB207C4CF4E8B7BEC"><enum>(a)</enum><header>In general</header><text>Section 4302 of title 46, United States Code is amended by adding at the end the following:</text> <quoted-block id="H4AE20C5A291D494D921353BCC35E90E1" style="OLC"> <subsection id="H1A487FB4BE87448BA14D424F7C1E37C4"><enum>(e)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="H6AEE87363D6549ECBDAD1ED39C0470AB"><enum>(1)</enum><text>If in prescribing regulations under this section the Secretary establishes a model year for recreational vessels and associated equipment, such model year shall, except as provided in paragraph (2)—</text>
 <subparagraph id="H6AABCF83312D45C1B191063446DFB28E" indent="up1"><enum>(A)</enum><text>begin on June 1 of a year and end on July 31 of the following year; and</text> </subparagraph><subparagraph id="H10D97855C9144D5280B01075C53CD81D" indent="up1"><enum>(B)</enum><text>be designated by the year in which it ends.</text>
 </subparagraph></paragraph><paragraph id="H8CD6FD6E2D4647C0904989C70C26BF5F" indent="up1"><enum>(2)</enum><text>Upon the request of a recreational vessel manufacturer to which this chapter applies, the Secretary may alter a model year for a model of recreational vessel of the manufacturer and associated equipment, by no more than 6 months from the model year described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H8C8BBE609216441CA5CEF19B51E6173B"><enum>(b)</enum><header>Application</header><text>This section shall only apply with respect to recreational vessels and associated equipment constructed or manufactured, respectively, on or after June 1, 2015.</text>
 </subsection><subsection id="H3749FADF07784172A6C769A684DB9E6D"><enum>(c)</enum><header>Guidance</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall publish guidance to implement section 4302(d)(2) of title 46, United States Code.</text>
				</subsection></section><section id="HF8467DD4629B4C4EB6EF92B4F8D96C1A"><enum>305.</enum><header>Merchant mariner credential expiration harmonization</header>
 <subsection id="H76E4FBF1CDC24CF0B84BF57B7142BEE8"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (c) and not later than 1 year after the date of the enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall establish a process to harmonize the expiration dates of merchant mariner credentials, mariner medical certificates, and radar observer endorsements for individuals applying to the Secretary for a new merchant mariner credential or for renewal of an existing merchant mariner credential.</text>
 </subsection><subsection id="HA4238A702E294EF6A2671533676D42D5"><enum>(b)</enum><header>Requirements</header><text>The Secretary shall ensure that the process established under subsection (a)—</text> <paragraph id="H52D5B6CB14484595A3028E87CC1E2444"><enum>(1)</enum><text>does not require an individual to renew a merchant mariner credential earlier than the date on which the individual’s current credential expires; and</text>
 </paragraph><paragraph id="HFF797D2B6DB44D49A07464A213299C43"><enum>(2)</enum><text>results in harmonization of expiration dates for merchant mariner credentials, mariner medical certificates, and radar observer endorsements for all individuals by not later than 6 years after the date of the enactment of this Act.</text>
 </paragraph></subsection><subsection id="H629783D14CF24E669B5C3FAC23C5661B"><enum>(c)</enum><header>Exception</header><text>The process established under subsection (a) does not apply to individuals—</text> <paragraph id="H0B0D671FFF274693B91E8FFBA72D6B3B"><enum>(1)</enum><text>holding a merchant mariner credential with—</text>
 <subparagraph id="H6864B6BD1B4448279F5BFF7B24095B4D"><enum>(A)</enum><text>an active Standards of Training, Certification, and Watchkeeping endorsement; or</text> </subparagraph><subparagraph id="HECCEBFFF075643199A4290ED7D17DDD6"><enum>(B)</enum><text>Federal first-class pilot endorsement; or</text>
 </subparagraph></paragraph><paragraph id="HAF9D7E39D5E44246A54DD20A432F83D7"><enum>(2)</enum><text>who have been issued a time-restricted medical certificate.</text> </paragraph></subsection></section><section id="H54E8671A27E3473FA4563358768AF735"><enum>306.</enum><header>Marine event safety zones</header><text display-inline="no-display-inline">Section 6 of the Ports and Waterways Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1225">33 U.S.C. 1225</external-xref>) is amended by adding at the end the following:</text>

					<subsection id="H333A4396D099433CBAE6621173BEDD11"><enum>(c)</enum><header>Marine event safety zones</header>
 <paragraph id="HBCBCACF765BF4E539F73A6DAAE7A8948"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary shall recover all costs the Coast Guard incurs to enforce a safety zone under this section if such safety zone is established for a marine event conducted under a permit or other authorization by the Coast Guard.</text>
 </paragraph><paragraph id="HB2D3993107BC4D358542D192BF6B0F4F"><enum>(2)</enum><header>Exception</header><text>The Secretary may not recover costs under paragraph (1) from a State or local government.</text> </paragraph><paragraph id="H35D1772FB38F47A88797CBC757901AB4"><enum>(3)</enum><header>Treatment of recovered costs</header><text>Costs recovered by the Secretary under this subsection shall be credited to the appropriation for operating expenses of the Coast Guard.</text>
 </paragraph><paragraph id="HFC53B54AA1D64FB49FE8A25978A5A2F1"><enum>(4)</enum><header>Marine event defined</header><text>In this section the term <quote>marine event</quote> means a planned activity of limited duration that by its nature, circumstances, or location, will introduce extra or unusual hazards to the safety of life on the navigable waters of the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H0D972F65D51041819D6EB4C03E792382"><enum>307.</enum><header>Technical corrections</header>
 <subsection id="H24C362114F6541C18E58E2586F75CA13"><enum>(a)</enum><header>Title 46</header><text>Title 46, United States Code, is amended—</text> <paragraph id="HB9ED89B9D60A469CAC3451ACEB4D959A"><enum>(1)</enum><text>in section 103, by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/33/151">33 U.S.C. 151</external-xref>).</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/33/151">33 U.S.C. 151(b)</external-xref>).</quote>;</text>

 <paragraph id="H795126A9F20C4E5FAA1134CF370C288F"><enum>(1)</enum><text>the Department of Homeland Security Office of Inspector General report entitled <quote>Marine Accident Reporting, Investigations, and Enforcement in the United States Coast Guard</quote>, released on May 23, 2013; and</text> </paragraph><paragraph id="H39B0038C2A3A409399BE593C04F75BB7"><enum>(2)</enum><text>the Towing Safety Advisory Committee report entitled <quote>Recommendations for Improvement of Marine Casualty Reporting</quote>, released on March 26, 2015.</text>
 </paragraph></section><section id="HAEDB1331D56C43A7BC9861CF69C86B7F"><enum>309.</enum><header>Recreational vessel engine weights</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall issue regulations amending Table 4 to Subpart H of Part 183–Weights (Pounds) of Outboard Motor and Related Equipment for Various Boat Horsepower Ratings (33 CFR 183) as appropriate to reflect <quote>Standard 30–Outboard Engine and Related Equipment Weights</quote> published by the American Boat and Yacht Council, as in effect on the date of the enactment of this Act.</text>
			</section><section id="HBE0048FADFEC4C4293757D4597554E4B"><enum>310.</enum><header>Merchant mariner medical certification reform</header>
 <subsection id="H662080FAB84448F8AE9CD7729B4B113C"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/75">Chapter 75</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text> <quoted-block id="HA207B2EF69C246B1B29AAAAEF30DB9FC" style="USC"> <section id="H9573890B83CE43E2A243C6B7E72E5452"><enum>7509.</enum><header>Medical certification by trusted agents</header> <subsection id="H033C34CE53F74A99BD180059B192BB15"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law and pursuant to regulations prescribed by the Secretary, a trusted agent may issue a medical certificate to an individual who—</text>
 <paragraph id="H7023AD3A60FB41FE86EB4FA6BD5946D8"><enum>(1)</enum><text>must hold such certificate to qualify for a license, certificate of registry, or merchant mariner’s document, or endorsement thereto under this part; and</text>
 </paragraph><paragraph id="H3743976208B84CA690A04878AF9C5DC9"><enum>(2)</enum><text>is qualified as to sight, hearing, and physical condition to perform the duties of such license, certificate, document, or endorsement, as determined by the trusted agent.</text>
 </paragraph></subsection><subsection id="H69B4A71D0954462DB49298BB128C2D0D"><enum>(b)</enum><header>Trusted agent defined</header><text>In this section the term <quote>trusted agent</quote> means a medical practitioner certified by the Secretary to perform physical examinations of an individual for purposes of a license, certificate of registry, or merchant mariner’s document under this part.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HC6457070300147A5A8DA93535782A986"><enum>(b)</enum><header>Deadline</header><text>Not later than 3 years after the date of the enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall issue a final rule implementing section 7509 of title 46, United States Code, as added by this section.</text>
 </subsection><subsection id="H9BC70EDCF8744B3CA1E1063B4945EBED"><enum>(c)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by adding at the end the following:</text> <quoted-block id="HE35020C00DF44243B98B8FC2ABAF50AB" style="USC"> <toc regeneration="no-regeneration"> <toc-entry level="section">7509. Medical certification by trusted agents.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section id="H56CF74E825E74656A7A3A8DB3DCE49D0"><enum>311.</enum><header>Atlantic Coast port access route study</header><text display-inline="no-display-inline">Not later than April 1, 2016, the Commandant of the Coast Guard shall conclude the Atlantic Coast Port Access Route Study and submit the results of such study to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text>
 </section><section id="H536D80ED0ADE4360BDB3D8DA72BEBE5D"><enum>312.</enum><header>Certificates of documentation for recreational vessels</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of the Department in which the Coast Guard is operating shall issue regulations that—</text>
 <paragraph id="H353A3488E72D48849073FF30E04C6034"><enum>(1)</enum><text>make certificates of documentation for recreational vessels effective for 5 years; and</text> </paragraph><paragraph id="H2F784824E92545AAA3A6FEA274AD7385"><enum>(2)</enum><text>require the owner of such a vessel—</text>
 <subparagraph id="HB18750AAA6E244DAADCA34354FAD3CF5"><enum>(A)</enum><text>to notify the Coast Guard of each change in the information on which the issuance of the certificate of documentation is based, that occurs before the expiration of the certificate; and</text>
 </subparagraph><subparagraph id="HE76BC2D2B4164021A0958048C88E7874"><enum>(B)</enum><text>apply for a new certificates of documentation for such a vessel if there is any such change.</text> </subparagraph></paragraph></section><section id="H5F20F1525CF24F7C8DEF1093CD74A68A"><enum>313.</enum><header>Program guidelines</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment this Act, the Secretary of Transportation shall—</text>
 <paragraph id="HD88CB5B499FB41BBA385D5372B9AF0CF"><enum>(1)</enum><text display-inline="yes-display-inline">develop guidelines to implement the program authorized under section 304(a) of the Coast Guard and Maritime Transportation Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/241">Public Law 109–241</external-xref>), including specific actions to ensure the future availability of able and credentialed United States licensed and unlicensed seafarers including—</text>
 <subparagraph id="HA00E73587961455D84323E2F357E0037"><enum>(A)</enum><text display-inline="yes-display-inline">incentives to encourage partnership agreements with operators of foreign-flag vessels that carry liquified natural gas, that provide no less than one training billet per vessel for United States merchant mariners in order to meet minimum mandatory sea service requirements;</text>
 </subparagraph><subparagraph id="H4F1EDB29BC974520A4BEA77826A8E4BA"><enum>(B)</enum><text>development of appropriate training curricula for use by public and private maritime training institutions to meet all United States merchant mariner license, certification, and document laws and requirements under the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978; and</text>
 </subparagraph><subparagraph id="HC8278A772BF344B4927771F4A0769DF7"><enum>(C)</enum><text>steps to promote greater outreach and awareness of additional job opportunities for sea service veterans of the United States Armed Forces; and</text>
 </subparagraph></paragraph><paragraph id="H6F13937B019844319E9881F5E8142123"><enum>(2)</enum><text>submit such guidelines to the Committee Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text>
				</paragraph></section><section id="H87FA08DA04B44DDB930FBC89D578108F"><enum>314.</enum><header>Repeals</header>
 <subsection id="H0C90D3A6B9D64CCA9A2AD039663538D9"><enum>(a)</enum><header>Repeals, Merchant Marine Act, 1936</header><text>Sections 601 through 606, 608 through 611, 613 through 616, 802, and 809 of the Merchant Marine Act, 1936 (<external-xref legal-doc="usc" parsable-cite="usc/46/53101">46 U.S.C. 53101</external-xref> note) are repealed.</text>

 <subsection id="HA3BB038D59E4419FB461B82E52401B92"><enum>(a)</enum><header>Conveyance authorized</header><text>The Commandant of the Coast Guard may convey all right, title, and interest of the United States in and to the covered property, upon payment to the United States of the fair market value of the covered property.</text>
 </subsection><subsection id="H0123C246609A441D86F1F415B1DABBA0"><enum>(b)</enum><header>Right of first refusal</header><text>The County of Marin, California shall have the right of first refusal with respect to purchase of the covered property under this section.</text>
 </subsection><subsection id="HB3AD629FC0D643928A19DDD6CE0B8967"><enum>(c)</enum><header>Survey</header><text>The exact acreage and legal description of the covered property shall be determined by a survey satisfactory to the Commandant.</text>
 </subsection><subsection id="HD6F5BB17380C44F8A56098499DE6C6D6"><enum>(d)</enum><header>Fair market value</header><text>The fair market value of the covered property shall—</text> <paragraph id="HA223356DBB8C4D89BCE2F0DED64300A9"><enum>(1)</enum><text>be determined by appraisal; and</text>
 </paragraph><paragraph id="H63980AFD47A34BC2A1E11DB9A7ED3664"><enum>(2)</enum><text>be subject to the approval of the Commandant.</text> </paragraph></subsection><subsection id="H73A2D08EE8FF4109852282C9F99AAACC"><enum>(e)</enum><header>Costs of conveyance</header><text>The responsibility for all reasonable and necessary costs, including real estate transaction and environmental documentation costs, associated with a conveyance under this section shall be determined by the Commandant and the purchaser.</text>
 </subsection><subsection id="H1B78034C68C8429F9A31F922978EA94C"><enum>(f)</enum><header>Additional terms and conditions</header><text>The Commandant may require such additional terms and conditions in connection with a conveyance under this section as the Commandant considers appropriate and reasonable to protect the interests of the United States.</text>
 </subsection><subsection id="HDB808EBF2EF8488F9A17AB922DC8CCD6"><enum>(g)</enum><header>Deposit of proceeds</header><text display-inline="yes-display-inline">Any proceeds received by the United States in a conveyance under this section shall be deposited in the Coast Guard Housing Fund established by section 687 of title 14, United States Code.</text>
 </subsection><subsection id="H76CE48C902464F3B8FE6A11032D83EDE"><enum>(h)</enum><header>Covered property defined</header><text>In this section, the term <quote>covered property</quote> means the approximately 32 acres of real property (including all improvements located on the property) that are—</text>
 <paragraph id="H8ED3F7831BA7466487AD2320EF822159"><enum>(1)</enum><text display-inline="yes-display-inline">located at Station Point Reyes in Marin County, California;</text> </paragraph><paragraph id="H5ED78F1FC2514CBC8BBF4783C5D8EB96"><enum>(2)</enum><text>under the administrative control of the Coast Guard; and</text>
 </paragraph><paragraph id="H2DC0930FF5224FE18193AB49A7D87DD9"><enum>(3)</enum><text>described as <quote>Parcel A, Tract 1</quote>, <quote>Parcel B, Tract 2</quote>, <quote>Parcel C</quote>, and <quote>Parcel D</quote> in the Declaration of Taking (Civil No. C–71–1245 SC) filed June 28, 1971, in the United States District Court for the Northern District of California.</text>
					</paragraph></subsection></section><section id="H334E23618E30431E84D45E64231ACA77"><enum>502.</enum><header>Elimination of reports</header>
 <subsection id="H1451F2F126A845BD944DCDBB5AA64063"><enum>(a)</enum><header>Distant Water Tuna Fleet</header><text>Section 421 of the Coast Guard and Maritime Transportation Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/46/8103">46 U.S.C. 8103</external-xref> note) is amended by striking subsection (d).</text>
 </subsection><subsection id="H2611974C21ED4F4092DEB8F745985AD3"><enum>(b)</enum><header>Annual Updates on Limits to Liability</header><text>Section 603(c)(3) of the Coast Guard and Maritime Transportation Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/33/2704">33 U.S.C. 2704</external-xref> note) is amended by striking <quote>on an annual basis.</quote> and inserting <quote>not later than January 30 of the year following each year in which occurs an oil discharge from a vessel or nonvessel source that results or is likely to result in removal costs and damages (as those terms are defined in section 1001 of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2701">33 U.S.C. 2701</external-xref>)) that exceed liability limits established under section 1004 of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2704">33 U.S.C. 2704</external-xref>).</quote>.</text>
 </subsection><subsection id="H71A8FD72FBF342B3AFE123689BB51AE0"><enum>(c)</enum><header>International Bridge Act of 1972</header><text>The International Bridge Act of 1972 is amended by striking section 11 (<external-xref legal-doc="usc" parsable-cite="usc/33/535h">33 U.S.C. 535h</external-xref>).</text> </subsection></section><section id="H62778FE3492E4344A099E9D16438D404"><enum>503.</enum><header>Vessel documentation</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment this Act, the Comptroller General of the United States shall submit to the Committee on Transportation and infrastructure of the House and the Committee on Commerce, Science, and Transportation of the Senate, a description of actions that could be taken to—</text>
 <paragraph id="H4FC1D331D7DA433DAEF78318C2389B19"><enum>(1)</enum><text>improve the efficiency of performance of the functions currently carried out by the National Vessel Documentation Center, including by—</text>
 <subparagraph id="H7E8754C928E74AB69E60925DB6B68AD7"><enum>(A)</enum><text>transferring such functions to Coast Guard headquarters; and</text> </subparagraph><subparagraph id="HC3B9B23E8144418F82C5265046C143ED"><enum>(B)</enum><text>reassigning Coast Guard personnel to better meet the Coast Guard’s vessel documentation mission; and</text>
 </subparagraph></paragraph><paragraph id="H5132A6AA699C4DA3A312C41BEAAACED1"><enum>(2)</enum><text>strengthen the review of compliance with United States ownership requirements for vessels documented under the laws of the United States.</text>
				</paragraph></section><section commented="no" id="H4FE672D6380E444C94A9D64B537986A8" section-type="subsequent-section"><enum>504.</enum><header>Conveyance of Coast Guard property in Tok, Alaska</header>
 <subsection commented="no" id="H23DC8929CC2448C9ADA691549D3E50E9"><enum>(a)</enum><header>Conveyance authorized</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard may convey all right, title, and interest of the United States in and to the covered property, upon payment to the United States of the fair market value of the covered property.</text>
 </subsection><subsection commented="no" id="H74DC0A2B98414597A76A982897B70069"><enum>(b)</enum><header>Right of first refusal</header><text display-inline="yes-display-inline">The Tanana Chiefs’ Conference shall have the right of first refusal with respect to purchase of the covered property under this section.</text>
 </subsection><subsection commented="no" id="H016908FC21AB4A4E9D7BFC99548D98B0"><enum>(c)</enum><header>Survey</header><text display-inline="yes-display-inline">The exact acreage and legal description of the covered property shall be determined by a survey satisfactory to the Commandant.</text>
 </subsection><subsection commented="no" id="HF97B304C0DDF48C28D8E6FB87E5B724A"><enum>(d)</enum><header>Fair market value</header><text display-inline="yes-display-inline">The fair market value of the covered property shall be—</text> <paragraph commented="no" id="HAA96BC05D99A4F3287AE4272064CFF6B"><enum>(1)</enum><text>determined by appraisal; and</text>
 </paragraph><paragraph commented="no" id="H8043D962ACE2413ABB2F1C7D8802CB06"><enum>(2)</enum><text>subject to the approval of the Commandant.</text> </paragraph></subsection><subsection commented="no" id="HB887DB70CD314A2B96674AD305BDA388"><enum>(e)</enum><header>Costs of conveyance</header><text display-inline="yes-display-inline">The responsibility for all reasonable and necessary costs, including real estate transaction and environmental documentation costs, associated with a conveyance under this section shall be determined by the Commandant and the purchaser.</text>

 </subsection><subsection commented="no" id="H1303C44CCF29471A92812A7A43A2615C"><enum>(g)</enum><header>Deposit of proceeds</header><text>Any proceeds received by the United States from a conveyance under this section shall be deposited in the Coast Guard Housing Fund established under section 687 of title 14, United States Code.</text>
				</subsection><subsection commented="no" id="HE467F06E002548D8AF80DB59EB71BE9E"><enum>(h)</enum><header>Covered property defined</header>
 <paragraph commented="no" id="HF4F4DDFD14D5427FBADE1A9BBFE7719A"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>covered property</term> means the approximately 3.25 acres of real property (including all improvements located on the property) that are—</text>
 <subparagraph commented="no" id="H06BFA6BB8055485399ED5833B74987FE"><enum>(A)</enum><text>located in Tok, Alaska;</text> </subparagraph><subparagraph commented="no" id="H2D6CB48A416847C4B83FE5F9A0C5B8DD"><enum>(B)</enum><text>under the administrative control of the Coast Guard; and</text>
 </subparagraph><subparagraph commented="no" id="H78F256E29DE4420D823BABFC030ECC9C"><enum>(C)</enum><text>described in paragraph (2).</text> </subparagraph></paragraph><paragraph commented="no" id="H883CC57D98124E3A8FE64C466B94B237"><enum>(2)</enum><header>Description</header><text>The property described in this paragraph is the following:</text>

 </subparagraph></paragraph></subsection></section><section id="H6FB953E2F4964E2C9BDDBCB17B9C1725"><enum>505.</enum><header>Safe vessel operation in the Great Lakes</header><text display-inline="no-display-inline">The Howard Coble Coast Guard and Maritime Transportation Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/281">Public Law 113–281</external-xref>) is amended—</text>

 <subsection id="HB557854A29744FC8AFDA50FD8D784E06"><enum>(a)</enum><header>Audit</header><text>The Comptroller General of the United States shall conduct an audit of funds credited in each fiscal year after fiscal year 2004 to the Vessel Operations Revolving Fund that are attributable to the sale of obsolete vessels in the National Defense Reserve Fleet that were scrapped or sold under sections 57102, 57103, and 57104 of title 46, United States Code, including—</text>
 <paragraph id="H1F8AC452276E40DBBCCDFDCF9A25D645"><enum>(1)</enum><text>a complete accounting of all vessel sale proceeds attributable to the sale of obsolete vessels in the National Defense Reserve Fleet that were scrapped or sold under sections 57102, 57103, and 57104 of title 46, United States Code, in each fiscal year after fiscal year 2004;</text>
 </paragraph><paragraph id="H8D588AE02B9B475EB8686A501DD7C549"><enum>(2)</enum><text>the annual apportionment of proceeds accounted for under paragraph (1) among the uses authorized under section 308704 of title 54, United States Code, in each fiscal year after fiscal year 2004, including—</text>
 <subparagraph id="H85B2802C91C74FF29CD4CC928EADA253"><enum>(A)</enum><text>for National Maritime Heritage Grants, including a list of all annual National Maritime Heritage Grant grant and subgrant awards that identifies the respective grant and subgrant recipients and grant and subgrant amounts;</text>
 </subparagraph><subparagraph id="H3D11CF556CD7431FB1B15084B32D5C72"><enum>(B)</enum><text>for the preservation and presentation to the public of maritime heritage property of the Maritime Administration;</text>
 </subparagraph><subparagraph id="HA16425F54A2040CC81DD38802A8F19DA"><enum>(C)</enum><text>to the United States Merchant Marine Academy and State maritime academies, including a list of annual awards; and</text>
 </subparagraph><subparagraph id="H8542EE4E7DFA46029BBE39CFF66F7DEF"><enum>(D)</enum><text>for the acquisition, repair, reconditioning, or improvement of vessels in the National Defense Reserve Fleet; and</text>
 </subparagraph></paragraph><paragraph id="H7E10A943450E4ED2BACBCD7CD2D8BAD3"><enum>(3)</enum><text>an accounting of proceeds, if any, attributable to the sale of obsolete vessels in the National Defense Reserve Fleet that were scrapped or sold under sections 57102, 57103, and 57104 of title 46, United States Code, in each fiscal year after fiscal year 2004, that were expended for uses not authorized under section 308704 of title 54, United States Code.</text>
 </paragraph></subsection><subsection id="HD6E8742DBE604051A3CC5D9F18749224"><enum>(b)</enum><header>Submission to congress</header><text>Not later than 180 days after the date of enactment this Act, the Comptroller General shall submit the audit conducted in subsection (a) to the Committee on Armed Services, the Committee on Natural Resources, and the Committee on Transportation and Infrastructure of the House and the Committee on Commerce, Science, and Transportation of the Senate.</text>
 </subsection></section><section id="H296F7C1A2E434BD79EF4D6DEEF344DFF"><enum>507.</enum><header>Fishing vessel and fish tender vessel certification</header><text display-inline="no-display-inline">Section 4503 of title 46, United States Code, is amended—</text> <paragraph id="H70A66059A4E3452CB6D4C1D436FCE919"><enum>(1)</enum><text>in subsection (c), by adding at the end the following: <quote>Subsection (a) does not apply to a fishing vessel or fish tender vessel described in subsection (d)(6), if the vessel complies with an alternative safety compliance program established under that subsection for such a vessel.</quote>; and</text>
 </paragraph><paragraph id="HE9E6BFEC04984604AF743FA3CFF9068A"><enum>(2)</enum><text>in subsection (d), by adding at the end the following:</text> <quoted-block id="H88407D9A5BBB447482A3C11B3498185D" style="OLC"> <paragraph id="H140151E36914436BBFAABBB1632349FB" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">The Secretary shall establish an alternative safety compliance program for fishing vessels or fish tender vessels (or both) that are at least 50 feet overall in length, and not more than 79 feet overall in length, and built after July 1, 2013.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HBD01F74927204866B3897FAC652B14DA"><enum>508.</enum><header>National Academy of Sciences cost comparison</header>
 <subsection id="HCC1973BAD52B46D4BB7E692333351929"><enum>(a)</enum><header>Cost comparison</header><text>The Secretary of the department in which the Coast Guard is operating shall seek to enter into an arrangement with the National Academy of Sciences under which the Academy, by no later than 180 days after the date of the enactment of this Act, shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a comparison of the costs incurred by the Federal Government for each of the following alternatives:</text>
 <paragraph id="H6FF95AE7E7D64F4BB0217A72A653B796"><enum>(1)</enum><text>Transferring the Polar Sea to a non-governmental entity at no cost, and leasing back the vessel beginning on the date on which the Coast Guard certifies that the vessel is capable of the breaking out and missions described in subsection (c)(1).</text>
 </paragraph><paragraph id="H018D0772FDF34E478FD2965A05B9054D"><enum>(2)</enum><text>The reactivation and operation by the Coast Guard of the Polar Sea to an operational level at which the vessel is capable of such breaking out and missions.</text>
 </paragraph><paragraph id="HAE682E87F722423BB2A95CACB21ABD4D"><enum>(3)</enum><text>Acquiring and operating a new icebreaker through the Coast Guard’s acquisition process that is capable of such breaking out and missions.</text>
 </paragraph><paragraph id="HFDFE7C726CC04C0C8B76479FF7BA38C6"><enum>(4)</enum><text>Construction by a non-Federal entity of an icebreaker capable of such breaking out and missions, that will be leased by the Federal Government and operated using a Coast Guard crew.</text>
 </paragraph><paragraph id="H40E20D8753C6410B82D986D321E5FBEB"><enum>(5)</enum><text>Construction by a non-Federal entity of an icebreaker capable of such breaking out and missions, that will be leased by the Federal Government and operated by a crew of non-Federal employees.</text>
 </paragraph><paragraph id="H64C9DB6E0AC04A148C971E5B044DC8C7"><enum>(6)</enum><text>The acquisition of services from a non-Federal entity to perform such breaking out and missions.</text> </paragraph></subsection><subsection id="H2C5C6ABB3ACF41409DF2049C6F314928"><enum>(b)</enum><header>Included costs</header><text>For purposes of subsection (a), the cost of each alternative includes costs incurred by the Federal Government for—</text>
 <paragraph id="H8E15C520FCE2480BBA2BDB75C494758A"><enum>(1)</enum><text>the lease or operation and maintenance of the vessel concerned;</text> </paragraph><paragraph id="HFE4913A053BB4D86BE234903439B3550"><enum>(2)</enum><text>disposal of such vessel at the end of the useful life of the vessel;</text>
 </paragraph><paragraph id="HF684ABE83E884B69A409455F5D95C635"><enum>(3)</enum><text>retirement and other benefits for Federal employees who operate such vessel; and</text> </paragraph><paragraph id="H2ABE4CF33375444F983DB37E0E699855"><enum>(4)</enum><text>interest payments assumed to be incurred for Federal capital expenditures.</text>
 </paragraph></subsection><subsection id="H664F16CB2A244452A7D3A68CBDF694E7"><enum>(c)</enum><header>Assumptions</header><text>For purposes of comparing the costs of such alternatives, the Academy shall assume that—</text> <paragraph id="HA1301371108E41A0B22F506E97DDC667"><enum>(1)</enum><text>each vessel under consideration is—</text>
 <subparagraph id="H1CF2F6A356584EE885EE79961229FA77"><enum>(A)</enum><text>capable of breaking out of McMurdo Station, and conducting Coast Guard missions in the United States territory in the Arctic (as that term is defined in section 112 of the Arctic Research and Policy Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/15/4111">15 U.S.C. 4111</external-xref>)); and</text>
 </subparagraph><subparagraph id="H22E090F1215742338D6706692E968A99"><enum>(B)</enum><text>operated for a period of 20 years;</text> </subparagraph></paragraph><paragraph id="H3BF75A7DA9264AFF967299CF82A5D4DE"><enum>(2)</enum><text>the acquisition of services and the operation of each vessel begin on the same date; and</text>
 </paragraph><paragraph id="HBE0CCCF1A0F4435BA8DA5E7D6A02337B"><enum>(3)</enum><text>the periods for conducting Coast Guard missions in the Arctic are of equal lengths.</text> </paragraph></subsection></section><section commented="no" id="H0C2BED7E0A8C49A788F9001E9A474FA0"><enum>509.</enum><header>Penalty wages</header> <subsection commented="no" id="HAA4FE976E81540C5A772B255E36F694C"><enum>(a)</enum><header>Foreign and intercoastal voyages</header><text>Section 10313(g) of title 46, United States Code, is amended—</text>
 <paragraph commented="no" id="H7313EB66FB57425D83155E5FF56AEDEB"><enum>(1)</enum><text>in paragraph (2)—</text> <subparagraph commented="no" id="HD3CF962156344C9EA5F38FA48808D60D"><enum>(A)</enum><text>by striking <quote>all claims in a class action suit by seamen</quote> and inserting <quote>each claim by a seaman</quote>; and</text>

 <subparagraph commented="no" id="H149AA8E060AC4BFABFD760360166E19F"><enum>(A)</enum><text>by striking <quote>class action</quote>; and</text> </subparagraph><subparagraph commented="no" id="HA88D95519C584784907D6F75E22B8E8C"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>, by a seaman who is a claimant in the suit,</quote> and inserting <quote>by the seaman</quote>.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="HD30F0E6D50D44B6CB3538A535AEDC699"><enum>(b)</enum><header>Coastwise voyages</header><text>Section 10504(c) of such title is amended—</text> <paragraph commented="no" id="H53E6FB032C2447E684C9152096720982"><enum>(1)</enum><text>in paragraph (2)—</text>

 </subparagraph></paragraph><paragraph commented="no" id="HDC03293F9EF34ACA917CA7DC10323EB0"><enum>(2)</enum><text>in paragraph (3)—</text> <subparagraph commented="no" id="HCEC09D9C863F4D10AF9FB190527A6387"><enum>(A)</enum><text>by striking <quote>class action</quote>; and</text>
 </subparagraph><subparagraph commented="no" id="H638B57C0429A4A71BF695DCB785F13F5"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>, by a seaman who is a claimant in the suit,</quote> and inserting <quote>by the seaman</quote>.</text> </subparagraph></paragraph></subsection></section><section commented="no" id="HF04BAAA0C9ED454E95FBEC7197643AAA"><enum>510.</enum><header>Recourse for noncitizens</header><text display-inline="no-display-inline">Section 30104 of title 46, United States Code, is amended—</text>
 <paragraph commented="no" id="HF40AB2890DC144958A1B2078D4E08977"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In General.—</header-in-text></quote> before the first sentence; and</text> </paragraph><paragraph commented="no" id="H3BBB2DCF8DAA48A7A412BCC85A89BD36"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>
					<quoted-block id="H50DAD66D5DD54E489449D01D265CD49A" style="OLC">
 <subsection commented="no" id="HB4C536021D6C413D8618B23DE04A8F1F"><enum>(b)</enum><header>Restriction on recovery for nonresident aliens employed on foreign passenger vessels</header><text>A claim for damages or expenses relating to personal injury, illness, or death of a seaman who is a citizen of a foreign nation, arising during or from the engagement of the seaman by or for a passenger vessel duly registered under the laws of a foreign nation, may not be brought under the laws of the United States if—</text>
 <paragraph commented="no" id="HE9668A1E53904FA38C98EA7FDDFE0563"><enum>(1)</enum><text>such seaman was not a permanent resident alien of the United States at the time the claim arose;</text> </paragraph><paragraph commented="no" id="H112991DFE2A04948A1102288615E5DB8"><enum>(2)</enum><text>the injury, illness, or death arose outside the territorial waters of the United States; and</text>
 </paragraph><paragraph commented="no" id="H0567D1DD831F48028E5E2ED531E73107"><enum>(3)</enum><text>the seaman or the seaman’s personal representative has or had a right to seek compensation for the injury, illness, or death in, or under the laws of—</text>
 <subparagraph commented="no" id="HFE43A9CE0AC84C1B828E5BDE3BF7A3D1"><enum>(A)</enum><text>the nation in which the vessel was registered at the time the claim arose; or</text> </subparagraph><subparagraph commented="no" id="H177C114F36F84F6DA8E8B1939A0A3BC4"><enum>(B)</enum><text>the nation in which the seaman maintained citizenship or residency at the time the claim arose.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
