<official-title display="yes">To reform the authorities of the Federal Government to require the production of certain business records, conduct electronic surveillance, use pen registers and trap and trace devices, and use other forms of information gathering for foreign intelligence, counterterrorism, and criminal purposes, and for other purposes.</official-title>

<section commented="no" id="HACF07EAEFD6F45A385D7396739B196A2"><enum>2.</enum><header>Amendments to the Foreign Intelligence Surveillance Act of 1978</header><text display-inline="no-display-inline">Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or a repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>).</text> </section> <title id="H8295972F00184B029398F34334D9D2E5"><enum>I</enum><header>FISA business records reforms</header> <section id="H63F231AFF2DC462283C183E74488D284"><enum>101.</enum><header>Additional requirements for call detail records</header> <subsection id="H779EBAFF2E93404A8430349EE57FF806"><enum>(a)</enum><header>Application</header><text>Section 501(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(b)(2)</external-xref>) is amended—</text> 
<paragraph id="H7A01B39B041D45A985A8EFA084010A50"><enum>(1)</enum><text>in subparagraph (A)—</text> <subparagraph id="H3D4933ADA2D24C678A0CEC0886BDD036"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>a statement</quote> and inserting <quote>in the case of an application other than an application described in subparagraph (C) (including an application for the production of call detail records other than in the manner described in subparagraph (C)), a statement</quote>; and</text> </subparagraph> 
<subparagraph id="HEEC5E19FE7E546419793E6E5453E6313"><enum>(B)</enum><text>in clause (iii), by striking <quote>; and</quote> and inserting a semicolon;</text> </subparagraph></paragraph> <paragraph id="H1DC202114C4E4DFF87D9B839C65E5EFC"><enum>(2)</enum><text>by redesignating subparagraphs (A) and (B) as subparagraphs (B) and (D), respectively; and</text> </paragraph> 
<paragraph id="HD1436ECB3A7F41159BB68255FEF48279"><enum>(3)</enum><text>by inserting after subparagraph (B) (as so redesignated) the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="HEF188535A7A0497489552950E3529668" style="OLC"> <subparagraph id="HCF02E22E5ADA497DADADAFA7F0435759"><enum>(C)</enum><text>in the case of an application for the production on an ongoing basis of call detail records created before, on, or after the date of the application relating to an authorized investigation (other than a threat assessment) conducted in accordance with subsection (a)(2) to protect against international terrorism, a statement of facts showing that—</text> 
<clause id="H3FA8427EF19B407C8E310CCFF1421100"><enum>(i)</enum><text>there are reasonable grounds to believe that the call detail records sought to be produced based on the specific selection term required under subparagraph (A) are relevant to such investigation; and</text> </clause> <clause id="HAA8D21FBEFDD4740B63650393E3D3784"><enum>(ii)</enum><text>there is a reasonable, articulable suspicion that such specific selection term is associated with a foreign power engaged in international terrorism or activities in preparation therefor, or an agent of a foreign power engaged in international terrorism or activities in preparation therefor; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H1F750007492A4B55A41B29CF3AD16098"><enum>(b)</enum><header>Order</header><text>Section 501(c)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(c)(2)</external-xref>) is amended—</text> <paragraph id="H5DC648AC4F31410D9B7D35959F9EF3CF"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>; and</quote> and inserting a semicolon;</text> </paragraph> 
<paragraph id="HB53D86EE46D3474788E20F6F563209D5"><enum>(2)</enum><text>in subparagraph (E), by striking the period and inserting <quote>; and</quote>; and</text> </paragraph> <paragraph id="H2AF77D6F0681433290BBC5F08093C621"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="HF7CDBDC9371C47688EF293F12A92EAA7" style="OLC"> 
<subparagraph id="H5B684652640D47B18088AC1ABA6554A9"><enum>(F)</enum><text>in the case of an application described in subsection (b)(2)(C), shall—</text> <clause id="H7C1550C276304CD2A500D5838F469BAD"><enum>(i)</enum><text>authorize the production on a daily basis of call detail records for a period not to exceed 180 days;</text> </clause> 
<clause id="H31A81C5E0F8848A69D159F9411609FF8"><enum>(ii)</enum><text>provide that an order for such production may be extended upon application under subsection (b) and the judicial finding under paragraph (1) of this subsection;</text> </clause> <clause id="H4C388EF0FF5846209000FC695168C599"><enum>(iii)</enum><text>provide that the Government may require the prompt production of a first set of call detail records using the specific selection term that satisfies the standard required under subsection (b)(2)(C)(ii);</text> </clause> 
<clause id="H89B2F6BC1A9F47C18913AB9EBDBB9DC8"><enum>(iv)</enum><text>provide that the Government may require the prompt production of a second set of call detail records using session-identifying information or a telephone calling card number identified by the specific selection term used to produce call detail records under clause (iii);</text> </clause> <clause id="HAD905C7B14C94FE8AC7359D7495601AA"><enum>(v)</enum><text>provide that, when produced, such records be in a form that will be useful to the Government;</text> </clause> 
<clause id="H59F90FA95A88450FA5D16B2270C488E1"><enum>(vi)</enum><text>direct each person the Government directs to produce call detail records under the order to furnish the Government forthwith all information, facilities, or technical assistance necessary to accomplish the production in such a manner as will protect the secrecy of the production and produce a minimum of interference with the services that such person is providing to each subject of the production; and</text> </clause> <clause id="HE44228C0FE684A64A58245B6A9D03FED"><enum>(vii)</enum><text>direct the Government to—</text> 
<subclause id="HC33C103F1C234DAC9936EA3F176DAF8E"><enum>(I)</enum><text>adopt minimization procedures that require the prompt destruction of all call detail records produced under the order that the Government determines are not foreign intelligence information; and</text> </subclause> <subclause id="HD56AE50322D941F49874D325420B4895"><enum>(II)</enum><text>destroy all call detail records produced under the order as prescribed by such procedures.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section> 
<section id="H6A13FEC986B94CA2A72BA3A3F0456815"><enum>102.</enum><header>Emergency authority</header> 
<subsection id="HBF6F0436D97C40489196DF9D681BAC7A"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HE119B72F5C864407A347E801F2824D1C" style="OLC"> <subsection id="HF0915979BCC944EEBAAE7916A19AEBC9"><enum>(i)</enum><header>Emergency authority for production of tangible things</header> <paragraph display-inline="no-display-inline" id="HA6D9D68AA0E8440790A9EA5C2ADDE32C"><enum>(1)</enum><text>Notwithstanding any other provision of this section, the Attorney General may require the emergency production of tangible things if the Attorney General—</text> 
<subparagraph display-inline="no-display-inline" id="H015BAB54BF9D4CB08010D72DF6181CDB"><enum>(A)</enum><text display-inline="yes-display-inline">reasonably determines that an emergency situation requires the production of tangible things before an order authorizing such production can with due diligence be obtained;</text> </subparagraph> <subparagraph display-inline="no-display-inline" id="HE4D0B8AF5F314FF996CA580DB4CEFF9B"><enum>(B)</enum><text>reasonably determines that the factual basis for the issuance of an order under this section to approve such production of tangible things exists;</text> </subparagraph> 
<subparagraph display-inline="no-display-inline" id="H3095CB1D2A8346179C7EFE26417FD953"><enum>(C)</enum><text>informs, either personally or through a designee, a judge having jurisdiction under this section at the time the Attorney General requires the emergency production of tangible things that the decision has been made to employ the authority under this subsection; and</text> </subparagraph> <subparagraph display-inline="no-display-inline" id="HDF0C56079FAF4794859E90FEB01B34D4"><enum>(D)</enum><text>makes an application in accordance with this section to a judge having jurisdiction under this section as soon as practicable, but not later than 7 days after the Attorney General requires the emergency production of tangible things under this subsection.</text> </subparagraph></paragraph> 
<paragraph display-inline="no-display-inline" id="H45EA2B689D26476191EFD532FD982A49"><enum>(2)</enum><text>If the Attorney General requires the emergency production of tangible things under paragraph (1), the Attorney General shall require that the minimization procedures required by this section for the issuance of a judicial order be followed.</text> </paragraph> <paragraph display-inline="no-display-inline" id="HA6FCDA33CB994E2787EF6C9DE0B456EE"><enum>(3)</enum><text>In the absence of a judicial order approving the production of tangible things under this subsection, the production shall terminate when the information sought is obtained, when the application for the order is denied, or after the expiration of 7 days from the time the Attorney General begins requiring the emergency production of such tangible things, whichever is earliest.</text> </paragraph> 
<paragraph display-inline="no-display-inline" id="H011D09E14348401186AE1171899389D6"><enum>(4)</enum><text>A denial of the application made under this subsection may be reviewed as provided in section 103.</text> </paragraph> <paragraph display-inline="no-display-inline" id="H7B09160BDC484AC19E35AFA8E140821D"><enum>(5)</enum><text>If such application for approval is denied, or in any other case where the production of tangible things is terminated and no order is issued approving the production, no information obtained or evidence derived from such production shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or a political subdivision thereof, and no information concerning any United States person acquired from such production shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of such person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text> </paragraph> 
<paragraph display-inline="no-display-inline" id="H51875A33A36F415BAE07F8DC119ECA19"><enum>(6)</enum><text>The Attorney General shall assess compliance with the requirements of paragraph (5).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="HDC8C42BF54084CE4A6F8006C6AB2418C"><enum>(b)</enum><header>Conforming amendment</header><text>Section 501(d) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(d)</external-xref>) is amended—</text> 
<paragraph id="H95501481C7F147AA9A709EABAC967D35"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="HC5100AE2DDAC4A288351B7788C2778E1"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>pursuant to an order</quote> and inserting <quote>pursuant to an order issued or an emergency production required</quote>;</text> </subparagraph> 
<subparagraph id="HE59063B29694453DAC2F8EE1A470C87C"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>such order</quote> and inserting <quote>such order or such emergency production</quote>; and</text> </subparagraph> <subparagraph id="H90A4B10293D24A8AB01576FBADD4CE4A"><enum>(C)</enum><text>in subparagraph (B), by striking <quote>the order</quote> and inserting <quote>the order or the emergency production</quote>; and</text> </subparagraph></paragraph> 
<paragraph id="H69DD912E66E74E5998284EAA21DE9300"><enum>(2)</enum><text>in paragraph (2)—</text> <subparagraph id="H0CDF81952EBA479CB26BBD2420DF67E1"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>an order</quote> and inserting <quote>an order or emergency production</quote>; and</text> </subparagraph> 
<subparagraph id="HA0E409F9E67349FB93C6D0D1B09447F8"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>an order</quote> and inserting <quote>an order or emergency production</quote>.</text> </subparagraph></paragraph></subsection></section> <section id="H1FD772A2FA1341AEBCFEA96D1D69D8D6"><enum>103.</enum><header>Prohibition on bulk collection of tangible things</header> <subsection id="H697F383B6C004683AFA048233842E283"><enum>(a)</enum><header>Application</header><text>Section 501(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(b)(2)</external-xref>), as amended by section 101(a) of this Act, is further amended by inserting before subparagraph (B), as redesignated by such section 101(a) of this Act, the following new subparagraph:</text>

<subparagraph id="HF5E2469A666749459B7E00E54D73F0DA"><enum>(A)</enum><text>a specific selection term to be used as the basis for the production of the tangible things sought;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="HED041B9F154F4E689643249CCF957629"><enum>(b)</enum><header>Order</header><text>Section 501(c) (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(c)</external-xref>) is amended—</text> 
<paragraph id="HBB75CE9E7D914A5599CE3681E8088149"><enum>(1)</enum><text>in paragraph (2)(A), by striking the semicolon and inserting <quote>, including each specific selection term to be used as the basis for the production;</quote>; and</text> </paragraph> <paragraph id="H401EDD1FAF0E4F59944DCA4846A04C33"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<subparagraph id="H64FD207F46464EDCB14DBE9E1744E031" indent="up1"><enum>(A)</enum><text>produces tangible things or provides information, facilities, or technical assistance in accordance with an order issued or an emergency production required under this section; or</text> </subparagraph> <subparagraph id="H5CDE34BD73094A30BA11895587A70C77" indent="up1"><enum>(B)</enum><text>otherwise provides technical assistance to the Government under this section or to implement the amendments made to this section by the <short-title>USA FREEDOM Act of 2015</short-title>.</text> </subparagraph></paragraph> 
<paragraph id="HB53B6BB84AA946B8B3DCCA555A57007F" indent="up1"><enum>(2)</enum><text>A production or provision of information, facilities, or technical assistance described in paragraph (1) shall not be deemed to constitute a waiver of any privilege in any other proceeding or context.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> <section id="HF2E595BF3F2B4AA898F2B78231AD9E74"><enum>106.</enum><header>Compensation for assistance</header><text display-inline="no-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>), as amended by section 102 of this Act, is further amended by adding at the end the following new subsection:</text>

<subsection id="H0CC2ACF4DCD54459887B912AFF93F0A9"><enum>(j)</enum><header>Compensation</header><text display-inline="yes-display-inline">The Government shall compensate a person for reasonable expenses incurred for—</text> <paragraph id="H0F0728AC893E4B68ADB9043716450732"><enum>(1)</enum><text>producing tangible things or providing information, facilities, or assistance in accordance with an order issued with respect to an application described in subsection (b)(2)(C) or an emergency production under subsection (i) that, to comply with subsection (i)(1)(D), requires an application described in subsection (b)(2)(C); or</text> </paragraph> 
<paragraph id="H4411356189C9419D8A03A235B1D2CC6C"><enum>(2)</enum><text>otherwise providing technical assistance to the Government under this section or to implement the amendments made to this section by the <short-title>USA FREEDOM Act of 2015</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> <section id="HE73FABEE0D8B4FB8945EBD29A9CA2E95"><enum>107.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>), as amended by section 106 of this Act, is further amended by adding at the end the following new subsection:</text>

<paragraph id="HDABAE7191DC541A2B87DB2E52A24C0FE"><enum>(2)</enum><header>Address</header><text>The term <term>address</term> means a physical address or electronic address, such as an electronic mail address or temporarily assigned network address (including an Internet protocol address).</text> </paragraph> <paragraph id="H23733033C9FD430FBEEB4D032E60C7C2"><enum>(3)</enum><header>Call detail record</header><text>The term <term>call detail record</term>—</text> 
<subparagraph id="H266E8396C2CC4D01B9488C736632CECB"><enum>(A)</enum><text>means session-identifying information (including an originating or terminating telephone number, an International Mobile Subscriber Identity number, or an International Mobile Station Equipment Identity number), a telephone calling card number, or the time or duration of a call; and</text> </subparagraph> <subparagraph id="H336C7E0166AE450CB379CC055994E28A"><enum>(B)</enum><text>does not include—</text> 
<clause id="HEB2E949F292541689B9AA1ABEB2109EC"><enum>(i)</enum><text>the contents (as defined in section 2510(8) of title 18, United States Code) of any communication;</text> </clause> <clause id="HA371F957CD2040139C420F9A2E378578"><enum>(ii)</enum><text>the name, address, or financial information of a subscriber or customer; or</text> </clause> 
<clause id="H63EF632B8066442DA1C6418E9607291E"><enum>(iii)</enum><text>cell site location or global positioning system information.</text> </clause></subparagraph></paragraph> <paragraph id="H5592D08FDB5A4ADB9058380404287523"><enum>(4)</enum><header>Specific selection term</header> <subparagraph id="H91EEB36D92224108815B4288E5FC5550"><enum>(A)</enum><header>Tangible things</header> <clause id="H12A5B6FA18854D24B8C55A836A734240"><enum>(i)</enum><header>In general</header><text>Except as provided in subparagraph (B), a <term>specific selection term</term>—</text> 
<subclause id="HE18F79FC35794DC397FC957B80A821CA"><enum>(I)</enum><text>is a term that specifically identifies a person, account, address, or personal device, or any other specific identifier; and</text> </subclause> <subclause id="H8261E16E0B454D3A9B092091521D4A3C"><enum>(II)</enum><text>is used to limit, to the greatest extent reasonably practicable, the scope of tangible things sought consistent with the purpose for seeking the tangible things.</text> </subclause></clause> 
<clause commented="no" id="H1DFFC50959DA4C0CB1FCBFACAC51C448"><enum>(ii)</enum><header>Limitation</header><text>A specific selection term under clause (i) does not include an identifier that does not limit, to the greatest extent reasonably practicable, the scope of tangible things sought consistent with the purpose for seeking the tangible things, such as an identifier that—</text> <subclause commented="no" id="HD773E64345CC426AAB51F186DCBFFD95"><enum>(I)</enum><text>identifies an electronic communication service provider (as that term is defined in section 701) or a provider of remote computing service (as that term is defined in section 2711 of title 18, United States Code), when not used as part of a specific identifier as described in clause (i), unless the provider is itself a subject of an authorized investigation for which the specific selection term is used as the basis for the production; or</text> </subclause> 
<subclause commented="no" id="HC04806DAE6F14F1195C0F8FCC03B0FE6"><enum>(II)</enum><text>identifies a broad geographic region, including the United States, a city, a county, a State, a zip code, or an area code, when not used as part of a specific identifier as described in clause (i).</text> </subclause></clause> <clause id="H7BE26B230D33437383295ECEE50262C6"><enum>(iii)</enum><header>Rule of construction</header><text>Nothing in this paragraph shall be construed to preclude the use of multiple terms or identifiers to meet the requirements of clause (i).</text> </clause></subparagraph> 
<subparagraph id="H998A5944B3194A7A9A9B8A29EC86B590"><enum>(B)</enum><header>Call detail record applications</header><text>For purposes of an application submitted under subsection (b)(2)(C), the term <term>specific selection term</term> means a term that specifically identifies an individual, account, or personal device.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> <section id="H6CFACB7BF45F4766A21716BE058EA912"><enum>108.</enum><header>Inspector General reports on business records orders</header><text display-inline="no-display-inline">Section 106A of the USA PATRIOT Improvement and Reauthorization Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/177">Public Law 109–177</external-xref>; 120 Stat. 200) is amended—</text> 
<paragraph id="H1CAA6ABBEF9541BB882340DFCA56080E"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="H3658D040DEB84D5D830763447D3AD736"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>and calendar years 2012 through 2014</quote> after <quote>2006</quote>;</text> </subparagraph>

<paragraph id="H317AE92E1E044D76BD20CCBFE8C4586B"><enum>(3)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively;</text> </paragraph> <paragraph id="HCB55F3CB4BE04760A224DD8BD8D8CE82"><enum>(4)</enum><text>by inserting after subsection (c) the following new subsection:</text>

<paragraph id="H0C47C370EE674564B09ABA30E5DFB433"><enum>(1)</enum><header>In general</header><text>For the period beginning on January 1, 2012, and ending on December 31, 2014, the Inspector General of the Intelligence Community shall assess—</text> <subparagraph id="H3135F165B8E741F792DBB746229205E9"><enum>(A)</enum><text>the importance of the information acquired under title V of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861 et seq.</external-xref>) to the activities of the intelligence community;</text> </subparagraph> 
<subparagraph id="H7B2A1CBF8E2F48C2854F0CA4FA667434"><enum>(B)</enum><text>the manner in which that information was collected, retained, analyzed, and disseminated by the intelligence community;</text> </subparagraph> <subparagraph id="H1499218634954E57B8B3C95E68292694"><enum>(C)</enum><text>the minimization procedures used by elements of the intelligence community under such title and whether the minimization procedures adequately protect the constitutional rights of United States persons; and</text> </subparagraph> 
<subparagraph id="H71D9093792B8492EA5EFA5420B38F070"><enum>(D)</enum><text>any minimization procedures proposed by an element of the intelligence community under such title that were modified or denied by the court established under section 103(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(a)</external-xref>).</text> </subparagraph></paragraph> <paragraph id="H7106F48411AE4A04AA1C4730E9933DE6"><enum>(2)</enum><header>Submission date for assessment</header><text>Not later than 180 days after the date on which the Inspector General of the Department of Justice submits the report required under subsection (c)(3), the Inspector General of the Intelligence Community shall submit to the Committee on the Judiciary and the Select Committee on Intelligence of the Senate and the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives a report containing the results of the assessment for calendar years 2012 through 2014.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph>

<subsection id="H6ADBDF5F869E4894A23BC5C5BB5B1956"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by sections 101 through 103 shall take effect on the date that is 180 days after the date of the enactment of this Act.</text> </subsection> <subsection commented="no" id="H4C9B6020B17B464CB6820AEB0F2D25E1"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to alter or eliminate the authority of the Government to obtain an order under title V of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861 et seq.</external-xref>) as in effect prior to the effective date described in subsection (a) during the period ending on such effective date.</text> </subsection></section>

<subparagraph commented="no" id="H7669EDBB7265480893C2763559182868" indent="up1"><enum>(B)</enum><text>A specific selection term under subparagraph (A) does not include an identifier that does not limit, to the greatest extent reasonably practicable, the scope of information sought, consistent with the purpose for seeking the use of the pen register or trap and trace device, such as an identifier that—</text> <clause commented="no" id="H348BA73F1FE84537855B19D9BBC20C7E"><enum>(i)</enum><text>identifies an electronic communication service provider (as that term is defined in section 701) or a provider of remote computing service (as that term is defined in section 2711 of title 18, United States Code), when not used as part of a specific identifier as described in subparagraph (A), unless the provider is itself a subject of an authorized investigation for which the specific selection term is used as the basis for the use; or</text> </clause> 
<clause commented="no" id="HE129163A07B14842AADDFB2F38EB8111"><enum>(ii)</enum><text>identifies a broad geographic region, including the United States, a city, a county, a State, a zip code, or an area code, when not used as part of a specific identifier as described in subparagraph (A).</text> </clause></subparagraph> <subparagraph id="H1C838D10C2314AC5AC91E0D999E4FF6A" indent="up1"><enum>(C)</enum><text>For purposes of subparagraph (A), the term <term>address</term> means a physical address or electronic address, such as an electronic mail address or temporarily assigned network address (including an Internet protocol address).</text> </subparagraph> 
<subparagraph id="H6D0A3D8A7EDB4C799D604277F643C720" indent="up1"><enum>(D)</enum><text>Nothing in this paragraph shall be construed to preclude the use of multiple terms or identifiers to meet the requirements of subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> <section id="H50AD2859A2C640B69FC96FB0CBECC618"><enum>202.</enum><header>Privacy procedures</header> <subsection id="H25687E50B4E84E48913DDBF1F609B4BA"><enum>(a)</enum><header>In general</header><text>Section 402 (<external-xref legal-doc="usc" parsable-cite="usc/50/1842">50 U.S.C. 1842</external-xref>) is amended by adding at the end the following new subsection:</text>

Such policies and procedures shall, to the maximum extent practicable and consistent with the need to protect national security, include privacy protections that apply to the collection, retention, and use of information concerning United States persons.</text> </paragraph> <paragraph id="H9537981913FA4380A8E708976A674A37"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection limits the authority of the court established under section 103(a) or of the Attorney General to impose additional privacy or minimization procedures with regard to the installation or use of a pen register or trap and trace device.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>

<title id="HBAF82DAD90A84D738E4EDAC1CDF49441"><enum>III</enum><header>FISA acquisitions targeting persons outside the United States reforms</header> 
<section commented="no" display-inline="no-display-inline" id="H1C06072032E8444A91FEDD50925948F6" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Limits on use of unlawfully obtained information</header><text display-inline="no-display-inline">Section 702(i)(3) (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(i)(3)</external-xref>) is amended by adding at the end the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="H73FA89047D80413C82CB4F93944BC4EA" style="OLC"> <subparagraph commented="no" display-inline="no-display-inline" id="H93F2341DD5D247FF863AB3B0EE87BDFC"><enum>(D)</enum><header display-inline="yes-display-inline">Limitation on use of information</header> <clause commented="no" display-inline="no-display-inline" id="H74187BACF30D48218D2C939B92999CA4"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), if the Court orders a correction of a deficiency in a certification or procedures under subparagraph (B), no information obtained or evidence derived pursuant to the part of the certification or procedures that has been identified by the Court as deficient concerning any United States person shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof, and no information concerning any United States person acquired pursuant to such part of such certification or procedures shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of the United States person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H5691AE4B36A64FA1919CC91EA462E564"><enum>(ii)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">If the Government corrects any deficiency identified by the order of the Court under subparagraph (B), the Court may permit the use or disclosure of information obtained before the date of the correction under such minimization procedures as the Court may approve for purposes of this clause.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </section></title> <title id="H32E101CCB2AE4627BF04485BE52E0FBC"><enum>IV</enum><header>Foreign Intelligence Surveillance Court reforms</header> <section id="H401CD416F4E54CDA927950652AB53FA5"><enum>401.</enum><header>Appointment of amicus curiae</header><text display-inline="no-display-inline">Section 103 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended by adding at the end the following new subsections:</text>

<subsection id="HBF17B6777AAA4F0B9D06E37E7A71ABF6"><enum>(i)</enum><header>Amicus curiae</header> 
<paragraph id="HCC01D93170374071B602D891CCD2AE0D"><enum>(1)</enum><header>Designation</header><text>The presiding judges of the courts established under subsections (a) and (b) shall, not later than 180 days after the enactment of this subsection, jointly designate not fewer than 5 individuals to be eligible to serve as amicus curiae, who shall serve pursuant to rules the presiding judges may establish. In designating such individuals, the presiding judges may consider individuals recommended by any source, including members of the Privacy and Civil Liberties Oversight Board, the judges determine appropriate.</text> </paragraph> <paragraph id="H843D12FF5527417BA1E2E93A2F8D71E0"><enum>(2)</enum><header>Authorization</header><text>A court established under subsection (a) or (b), consistent with the requirement of subsection (c) and any other statutory requirement that the court act expeditiously or within a stated time—</text> 
<subparagraph id="H4680EC97EB7C4814932335F7BC3910B9"><enum>(A)</enum><text>shall appoint an individual who has been designated under paragraph (1) to serve as amicus curiae to assist such court in the consideration of any application for an order or review that, in the opinion of the court, presents a novel or significant interpretation of the law, unless the court issues a finding that such appointment is not appropriate; and</text> </subparagraph> <subparagraph id="H9E418C9F03C04F398CCE5D7D78A6F7AD"><enum>(B)</enum><text>may appoint an individual or organization to serve as amicus curiae, including to provide technical expertise, in any instance as such court deems appropriate or, upon motion, permit an individual or organization leave to file an amicus curiae brief.</text> </subparagraph></paragraph> 
<paragraph id="H64D0FD8FD0EF40088EB8D23A6096CB29"><enum>(3)</enum><header>Qualifications of amicus curiae</header> 
<subparagraph id="H58E3A99FF8E64EBEB50630E2B46F9ED9"><enum>(A)</enum><header>Expertise</header><text>Individuals designated under paragraph (1) shall be persons who possess expertise in privacy and civil liberties, intelligence collection, communications technology, or any other area that may lend legal or technical expertise to a court established under subsection (a) or (b).</text> </subparagraph> <subparagraph id="H55BDAD6BD9EE4064A966277ED4F265BF"><enum>(B)</enum><header>Security clearance</header><text>Individuals designated pursuant to paragraph (1) shall be persons who are determined to be eligible for access to classified information necessary to participate in matters before the courts. Amicus curiae appointed by the court pursuant to paragraph (2) shall be persons who are determined to be eligible for access to classified information, if such access is necessary to participate in the matters in which they may be appointed.</text> </subparagraph></paragraph> 
<paragraph id="H429D64413EB34D108B706EDFA25C72C7"><enum>(4)</enum><header>Duties</header><text>If a court established under subsection (a) or (b) appoints an amicus curiae under paragraph (2)(A), the amicus curiae shall provide to the court, as appropriate—</text> <subparagraph id="HF53E053DF3CB456E83E5A29C1DBAE570"><enum>(A)</enum><text>legal arguments that advance the protection of individual privacy and civil liberties;</text> </subparagraph> 
<subparagraph id="H6075F30879C647DFB44E5EF3700053AD"><enum>(B)</enum><text>information related to intelligence collection or communications technology; or</text> </subparagraph> <subparagraph id="H488FE591DE764D4898ABEEAB46773854"><enum>(C)</enum><text>legal arguments or information regarding any other area relevant to the issue presented to the court.</text> </subparagraph></paragraph> 
<paragraph id="HEF9801EB34144CB787B2C3AD6268D262"><enum>(5)</enum><header>Assistance</header><text>An amicus curiae appointed under paragraph (2)(A) may request that the court designate or appoint additional amici curiae pursuant to paragraph (1) or paragraph (2), to be available to assist the amicus curiae.</text> </paragraph> <paragraph id="H4610DAC431524913A03CD2BB54FEFA66"><enum>(6)</enum><header>Access to information</header> <subparagraph id="H12867FD59B0845CDB45EA883F5E586F1"><enum>(A)</enum><header>In general</header><text>If a court established under subsection (a) or (b) appoints an amicus curiae under paragraph (2), the amicus curiae—</text> 
<clause id="H5129A29F9CFA4985BD32767D556F6831"><enum>(i)</enum><text>shall have access to any legal precedent, application, certification, petition, motion, or such other materials that the court determines are relevant to the duties of the amicus curiae; and</text> </clause> <clause id="H280E13AAFE8F4BD2B6DAF2EA62B8BB57"><enum>(ii)</enum><text>may, if the court determines that it is relevant to the duties of the amicus curiae, consult with any other individuals designated pursuant to paragraph (1) regarding information relevant to any assigned proceeding.</text> </clause></subparagraph> 
<subparagraph id="HEFF22D5630854AA394A0FF1987DA642A"><enum>(B)</enum><header>Briefings</header><text>The Attorney General may periodically brief or provide relevant materials to individuals designated pursuant to paragraph (1) regarding constructions and interpretations of this Act and legal, technological, and other issues related to actions authorized by this Act.</text> </subparagraph> <subparagraph id="H1430B10E027B4126B0D40BD209AC0513"><enum>(C)</enum><header>Classified Information</header><text>An amicus curiae designated or appointed by the court may have access to classified documents, information, and other materials or proceedings only if that individual is eligible for access to classified information and to the extent consistent with the national security of the United States.</text> </subparagraph> 
<subparagraph id="H83FF71F49D5C46F6BBF8AEB6D2B9BACB"><enum>(D)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to require the Government to provide information to an amicus curiae appointed by the court that is privileged from disclosure.</text> </subparagraph></paragraph> <paragraph id="H62745CFFE8C245A5B890624C66F278FA"><enum>(7)</enum><header>Notification</header><text>A presiding judge of a court established under subsection (a) or (b) shall notify the Attorney General of each exercise of the authority to appoint an individual to serve as amicus curiae under paragraph (2).</text> </paragraph> 
<paragraph id="H75127793872F433897348D9CC74C262F"><enum>(8)</enum><header>Assistance</header><text>A court established under subsection (a) or (b) may request and receive (including on a nonreimbursable basis) the assistance of the executive branch in the implementation of this subsection.</text> </paragraph> <paragraph id="HAB9EE1A3048B43E99D69445118180EFF"><enum>(9)</enum><header>Administration</header><text display-inline="yes-display-inline">A court established under subsection (a) or (b) may provide for the designation, appointment, removal, training, or other support for an individual designated to serve as amicus curiae under paragraph (1) or appointed to serve as amicus curiae under paragraph (2) in a manner that is not inconsistent with this subsection.</text> </paragraph> 
<paragraph id="H1BF185AFD3DA4384B40A6805082B8E43"><enum>(10)</enum><header>Receipt of information</header><text>Nothing in this subsection shall limit the ability of a court established under subsection (a) or (b) to request or receive information or materials from, or otherwise communicate with, the Government or amicus curiae appointed under paragraph (2) on an ex parte basis, nor limit any special or heightened obligation in any ex parte communication or proceeding.</text> </paragraph></subsection> <subsection id="H67297701D5E244CD9B22B83E8B6291B5"><enum>(j)</enum><header>Review of FISA court decisions</header><text>Following issuance of an order under this Act, a court established under subsection (a) shall certify for review to the court established under subsection (b) any question of law that may affect resolution of the matter in controversy that the court determines warrants such review because of a need for uniformity or because consideration by the court established under subsection (b) would serve the interests of justice. Upon certification of a question of law under this subsection, the court established under subsection (b) may give binding instructions or require the entire record to be sent up for decision of the entire matter in controversy.</text> </subsection> 
<subsection id="H392FE98D078940D9BFCC0271D2C7F43C"><enum>(k)</enum><header>Review of FISA court of review decisions</header> 
<paragraph id="H821C5DF9F6624C368EC7383EECB66710"><enum>(1)</enum><header>Certification</header><text>For purposes of section 1254(2) of title 28, United States Code, the court of review established under subsection (b) shall be considered to be a court of appeals.</text> </paragraph> <paragraph commented="no" id="HD467AF7D282248CA946DDBCDBFA52BE9"><enum>(2)</enum><header>Amicus curiae briefing</header><text>Upon certification of an application under paragraph (1), the Supreme Court of the United States may appoint an amicus curiae designated under subsection (i)(1), or any other person, to provide briefing or other assistance.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="H487E343B64D5469B902F791032A47E3B"><enum>402.</enum><header>Declassification of decisions, orders, and opinions</header>

<subsection id="HC2DD0A67375540598EC139F4DE98E67D"><enum>(b)</enum><header>Redacted form</header><text>The Director of National Intelligence, in consultation with the Attorney General, may satisfy the requirement under subsection (a) to make a decision, order, or opinion described in such subsection publicly available to the greatest extent practicable by making such decision, order, or opinion publicly available in redacted form.</text> </subsection> <subsection id="HA9EB837122794E208420998F6E08427D"><enum>(c)</enum><header>National security waiver</header><text>The Director of National Intelligence, in consultation with the Attorney General, may waive the requirement to declassify and make publicly available a particular decision, order, or opinion under subsection (a), if—</text> 
<paragraph id="HDFCA6CD3124542CBA75CB0E887778681"><enum>(1)</enum><text>the Director of National Intelligence, in consultation with the Attorney General, determines that a waiver of such requirement is necessary to protect the national security of the United States or properly classified intelligence sources or methods; and</text> </paragraph> <paragraph id="H8B2EA83E80634B78A8C085CAC7951CCD"><enum>(2)</enum><text>the Director of National Intelligence makes publicly available an unclassified statement prepared by the Attorney General, in consultation with the Director of National Intelligence—</text> 
<subparagraph id="HE3590606D0F64CD4B4AECFA8ACC69302"><enum>(A)</enum><text>summarizing the significant construction or interpretation of any provision of law, which shall include, to the extent consistent with national security, a description of the context in which the matter arises and any significant construction or interpretation of any statute, constitutional provision, or other legal authority relied on by the decision; and</text> </subparagraph> <subparagraph id="H33E87A4B5D5E4113BB0518510ED48236"><enum>(B)</enum><text>that specifies that the statement has been prepared by the Attorney General and constitutes no part of the opinion of the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>

<section id="H88B5B7F56C454BD4A8654984548521BF"><enum>502.</enum><header>Limitations on disclosure of national security letters</header> 
<subsection id="HF9FAE778A410456F8A766DBF747B4985"><enum>(a)</enum><header>Counterintelligence access to telephone toll and transactional records</header><text>Section 2709 of title 18, United States Code, is amended by striking subsection (c) and inserting the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H27544E8D918D45E480DB08082BA1667F" style="OLC"> <subsection id="H2A43B70E86474F09AAC014415D31E9C2"><enum>(c)</enum><header>Prohibition of certain disclosure</header> <paragraph id="H8F1283C9886F4803A45F85C2BCA79FB3"><enum>(1)</enum><header>Prohibition</header> <subparagraph id="HC49401E9A6AF46B6B1F83400274A71E3"><enum>(A)</enum><header>In general</header><text>If a certification is issued under subparagraph (B) and notice of the right to judicial review under subsection (d) is provided, no wire or electronic communication service provider that receives a request under subsection (b), or officer, employee, or agent thereof, shall disclose to any person that the Federal Bureau of Investigation has sought or obtained access to information or records under this section.</text> </subparagraph> 
<subparagraph id="HC02196CE163741C5B168440762E9965F"><enum>(B)</enum><header>Certification</header><text>The requirements of subparagraph (A) shall apply if the Director of the Federal Bureau of Investigation, or a designee of the Director whose rank shall be no lower than Deputy Assistant Director at Bureau headquarters or a Special Agent in Charge of a Bureau field office, certifies that the absence of a prohibition of disclosure under this subsection may result in—</text> <clause id="H8F1CE613A110479AB11F65FAACE61F8B"><enum>(i)</enum><text>a danger to the national security of the United States;</text> </clause> 
<clause id="HEAB8CB659520490DA821CF2A7E55F6EA"><enum>(ii)</enum><text>interference with a criminal, counterterrorism, or counterintelligence investigation;</text> </clause> <clause id="HB96647B75FE149E6BED8F73E893C324B"><enum>(iii)</enum><text>interference with diplomatic relations; or</text> </clause> 
<clause id="H0CCB94FDE36045EE90315636761BD4BA"><enum>(iv)</enum><text>danger to the life or physical safety of any person.</text> </clause></subparagraph></paragraph> <paragraph id="H99FB7EE6E4384ABB888680569688132F"><enum>(2)</enum><header>Exception</header> <subparagraph id="H43B3013B23B74CD8A4DC548683F66894"><enum>(A)</enum><header>In general</header><text>A wire or electronic communication service provider that receives a request under subsection (b), or officer, employee, or agent thereof, may disclose information otherwise subject to any applicable nondisclosure requirement to—</text> 
<clause id="HC3490F4731B74B749B3BE117DB08A557"><enum>(i)</enum><text>those persons to whom disclosure is necessary in order to comply with the request;</text> </clause> <clause id="H90C403AC6C35426D98DB06AA2E912A3D"><enum>(ii)</enum><text>an attorney in order to obtain legal advice or assistance regarding the request; or</text> </clause> 
<clause id="H6AABDEA5910D4464A5B75291A25BBAB5"><enum>(iii)</enum><text>other persons as permitted by the Director of the Federal Bureau of Investigation or the designee of the Director.</text> </clause></subparagraph> <subparagraph id="HF334045FE6484925ABC7A0ADEE5FE221"><enum>(B)</enum><header>Application</header><text>A person to whom disclosure is made under subparagraph (A) shall be subject to the nondisclosure requirements applicable to a person to whom a request is issued under subsection (b) in the same manner as the person to whom the request is issued.</text> </subparagraph> 
<subparagraph id="HB3D4489B512948A38E9F670B9526F7B6"><enum>(C)</enum><header>Notice</header><text>Any recipient that discloses to a person described in subparagraph (A) information otherwise subject to a nondisclosure requirement shall notify the person of the applicable nondisclosure requirement.</text> </subparagraph> <subparagraph id="HC84AFCE316E640CA8EA31A46365A6BA8"><enum>(D)</enum><header>Identification of disclosure recipients</header><text>At the request of the Director of the Federal Bureau of Investigation or the designee of the Director, any person making or intending to make a disclosure under clause (i) or (iii) of subparagraph (A) shall identify to the Director or such designee the person to whom such disclosure will be made or to whom such disclosure was made prior to the request.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H209AF32B28524107BCEFF7B409B7CDF5"><enum>(b)</enum><header>Access to financial records for certain intelligence and protective purposes</header><text>Section 1114 of the Right to Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414</external-xref>) is amended—</text> <paragraph id="H1B4EB032048A40CDB48BC3A34133F10F"><enum>(1)</enum><text>in subsection (a)(5), by striking subparagraph (D); and</text> </paragraph>

<clause id="H2F7EF50E6A694A4EAC701AB43F29204F"><enum>(iv)</enum><text>danger to the life or physical safety of any person.</text> </clause></subparagraph></paragraph> <paragraph id="HF5D12F32958E4CEDB1A541BB766496C3"><enum>(2)</enum><header>Exception</header> <subparagraph id="H7C2EBFF63BD94C5387560A0694F3A402"><enum>(A)</enum><header>In general</header><text>A financial institution that receives a request under subsection (a), or officer, employee, or agent thereof, may disclose information otherwise subject to any applicable nondisclosure requirement to—</text> 
<clause id="H258C7B3553C144DC99FDCEBB8045DDDD"><enum>(i)</enum><text>those persons to whom disclosure is necessary in order to comply with the request;</text> </clause> <clause id="HB55AAACEAD634B1298DB8B0C562DC33F"><enum>(ii)</enum><text>an attorney in order to obtain legal advice or assistance regarding the request; or</text> </clause> 
<clause id="HC0C2CAE5C5DE4F5D87CCC861F613E9DD"><enum>(iii)</enum><text>other persons as permitted by the Director of the Federal Bureau of Investigation or the designee of the Director.</text> </clause></subparagraph> <subparagraph id="H607447E5E4EA4516B69DB8C6966C6722"><enum>(B)</enum><header>Application</header><text>A person to whom disclosure is made under subparagraph (A) shall be subject to the nondisclosure requirements applicable to a person to whom a request is issued under subsection (a) in the same manner as the person to whom the request is issued.</text> </subparagraph>

<clause id="H99E9E004E2DB4312B1E021516F332932"><enum>(iii)</enum><text>other persons as permitted by the Director of the Federal Bureau of Investigation or the designee of the Director.</text> </clause></subparagraph> <subparagraph id="H82B1FE39FB6D4BF391FE42F9073122D6"><enum>(B)</enum><header>Application</header><text>A person to whom disclosure is made under subparagraph (A) shall be subject to the nondisclosure requirements applicable to a person to whom a request under subsection (a) or (b) or an order under subsection (c) is issued in the same manner as the person to whom the request is issued.</text> </subparagraph>

<subparagraph id="HA7045071583B4168BB0AE0124AA356A8"><enum>(B)</enum><header>Certification</header><text>The requirements of subparagraph (A) shall apply if the head of the government agency described in subsection (a), or a designee, certifies that the absence of a prohibition of disclosure under this subsection may result in—</text> <clause id="HA182AE9249344163BC49D0C074F5B14E"><enum>(i)</enum><text>a danger to the national security of the United States;</text> </clause> 
<clause id="H15D45E538C234E3CBDC76CE3281C07B3"><enum>(ii)</enum><text>interference with a criminal, counterterrorism, or counterintelligence investigation;</text> </clause> <clause id="H1822A6BDB09443F7A7D68F405A23EA9D"><enum>(iii)</enum><text>interference with diplomatic relations; or</text> </clause> 
<clause id="H3D46E48EBD1D415DBAEB1EB3B29B34C7"><enum>(iv)</enum><text>danger to the life or physical safety of any person.</text> </clause></subparagraph></paragraph> <paragraph id="HAFD993B3E3CD4A2F8D37385C5359938B"><enum>(2)</enum><header>Exception</header> <subparagraph id="H227E68B770CD4481AA5AF3B274A5734D"><enum>(A)</enum><header>In general</header><text>A consumer reporting agency that receives a request under subsection (a), or officer, employee, or agent thereof, may disclose information otherwise subject to any applicable nondisclosure requirement to—</text> 
<clause id="H0AE7B7DF52334CAC8D1F7201AF3EBC5B"><enum>(i)</enum><text>those persons to whom disclosure is necessary in order to comply with the request;</text> </clause> <clause id="H50C96C823F4E4B859018DE6B1B98F2D0"><enum>(ii)</enum><text>an attorney in order to obtain legal advice or assistance regarding the request; or</text> </clause> 
<clause id="H1471EC3CBEBE47F78CC461A324D9DF24"><enum>(iii)</enum><text>other persons as permitted by the head of the government agency described in subsection (a) or a designee.</text> </clause></subparagraph> <subparagraph id="H7634837D19E34B4B973FC04F8368E24E"><enum>(B)</enum><header>Application</header><text>A person to whom disclosure is made under subparagraph (A) shall be subject to the nondisclosure requirements applicable to a person to whom a request under subsection (a) is issued in the same manner as the person to whom the request is issued.</text> </subparagraph> 
<subparagraph id="HD54A063BD6D347C1BE380DB3269FE596"><enum>(C)</enum><header>Notice</header><text>Any recipient that discloses to a person described in subparagraph (A) information otherwise subject to a nondisclosure requirement shall inform the person of the applicable nondisclosure requirement.</text> </subparagraph> <subparagraph id="H81A883C88280451DBAC45281665DA84D"><enum>(D)</enum><header>Identification of disclosure recipients</header><text>At the request of the head of the government agency described in subsection (a) or a designee, any person making or intending to make a disclosure under clause (i) or (iii) of subparagraph (A) shall identify to the head or such designee the person to whom such disclosure will be made or to whom such disclosure was made prior to the request.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H57D80667564F4BE99568B9E60F1592E4"><enum>(e)</enum><header>Investigations of persons with access to classified information</header><text>Section 802 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>) is amended by striking subsection (b) and inserting the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HCF3C8703683A4545B4F6983741ADF168" style="OLC"> <subsection id="H5C78D18DE94142058C3881973DF5EFAD"><enum>(b)</enum><header>Prohibition of certain disclosure</header> <paragraph id="H8B4C8869C2374E06911E18BB582DE24B"><enum>(1)</enum><header>Prohibition</header> <subparagraph id="HCB3FF99B862143D08E536D1E5CACF62A"><enum>(A)</enum><header>In general</header><text>If a certification is issued under subparagraph (B) and notice of the right to judicial review under subsection (c) is provided, no governmental or private entity that receives a request under subsection (a), or officer, employee, or agent thereof, shall disclose to any person that an authorized investigative agency described in subsection (a) has sought or obtained access to information under subsection (a).</text> </subparagraph> 
<subparagraph id="H49D3ADD5AD824BAAAD800FBDE98D1B1A"><enum>(B)</enum><header>Certification</header><text>The requirements of subparagraph (A) shall apply if the head of an authorized investigative agency described in subsection (a), or a designee, certifies that the absence of a prohibition of disclosure under this subsection may result in—</text> <clause id="HA45DF7A1D41C420C96AE922EE93DAEEC"><enum>(i)</enum><text>a danger to the national security of the United States;</text> </clause> 
<clause id="H89699A9513804D1B873E77F1E21FE8F2"><enum>(ii)</enum><text>interference with a criminal, counterterrorism, or counterintelligence investigation;</text> </clause> <clause id="H669FA3A5072C4EF09A62C60016B71B26"><enum>(iii)</enum><text>interference with diplomatic relations; or</text> </clause> 
<clause id="HDB62F4B927E441EABA14EE0619DB7CB7"><enum>(iv)</enum><text>danger to the life or physical safety of any person.</text> </clause></subparagraph></paragraph> <paragraph id="H2AB7C26D82E34C00A2F5B62CADDFD8DD"><enum>(2)</enum><header>Exception</header> <subparagraph id="H4B3122C41BFF4B82A5124AC5AFFDE14D"><enum>(A)</enum><header>In general</header><text>A governmental or private entity that receives a request under subsection (a), or officer, employee, or agent thereof, may disclose information otherwise subject to any applicable nondisclosure requirement to—</text> 
<clause id="H2E4FC48E96D849E08CB4D1568907AFCB"><enum>(i)</enum><text>those persons to whom disclosure is necessary in order to comply with the request;</text> </clause> <clause id="H7C9E12261A8947CCB3B69B492A5F226F"><enum>(ii)</enum><text>an attorney in order to obtain legal advice or assistance regarding the request; or</text> </clause> 
<clause id="HF3F47D9E56D94E8792E0B82AD8522CDF"><enum>(iii)</enum><text>other persons as permitted by the head of the authorized investigative agency described in subsection (a) or a designee.</text> </clause></subparagraph> <subparagraph id="HCB8D1E09277B46ECA7AAFF4E2F61B30A"><enum>(B)</enum><header>Application</header><text>A person to whom disclosure is made under subparagraph (A) shall be subject to the nondisclosure requirements applicable to a person to whom a request is issued under subsection (a) in the same manner as the person to whom the request is issued.</text> </subparagraph> 
<subparagraph id="H6E0B24368FCE4117AB5B11CA7917749C"><enum>(C)</enum><header>Notice</header><text>Any recipient that discloses to a person described in subparagraph (A) information otherwise subject to a nondisclosure requirement shall inform the person of the applicable nondisclosure requirement.</text> </subparagraph> <subparagraph id="HBC814F99C534414DB1B83C85EC8CC4EC"><enum>(D)</enum><header>Identification of disclosure recipients</header><text>At the request of the head of an authorized investigative agency described in subsection (a), or a designee, any person making or intending to make a disclosure under clause (i) or (iii) of subparagraph (A) shall identify to the head of the authorized investigative agency or such designee the person to whom such disclosure will be made or to whom such disclosure was made prior to the request.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HF08638001E3440F4B1DCEEAE17375985"><enum>(f)</enum><header>Termination procedures</header> 
<paragraph id="H7E5F6C58FA174AEA9D71AA0719601FA6"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General shall adopt procedures with respect to nondisclosure requirements issued pursuant to section 2709 of title 18, United States Code, section 626 or 627 of the Fair Credit Reporting Act (15 U.S.C. 1681u and 1681v), section 1114 of the Right to Financial Privacy Act (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414</external-xref>), or section 802 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>), as amended by this Act, to require—</text> <subparagraph id="HF8FF31A2A68F462799219F1CB1F41BD1"><enum>(A)</enum><text>the review at appropriate intervals of such a nondisclosure requirement to assess whether the facts supporting nondisclosure continue to exist;</text> </subparagraph> 
<subparagraph id="H446F943850184499825031146ED2C446"><enum>(B)</enum><text>the termination of such a nondisclosure requirement if the facts no longer support nondisclosure; and</text> </subparagraph> <subparagraph id="H29079EB93739421E9AE32B1BF68441F5"><enum>(C)</enum><text>appropriate notice to the recipient of the national security letter, or officer, employee, or agent thereof, subject to the nondisclosure requirement, and the applicable court as appropriate, that the nondisclosure requirement has been terminated.</text> </subparagraph></paragraph> 
<paragraph id="H3FA4FC008B344BACBAB181AE577BECE3"><enum>(2)</enum><header>Reporting</header><text>Upon adopting the procedures required under paragraph (1), the Attorney General shall submit the procedures to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives.</text> </paragraph></subsection> <subsection id="H8F752B163D714816B353C97A6ABC995A"><enum>(g)</enum><header>Judicial review</header><text>Section 3511 of title 18, United States Code, is amended by striking subsection (b) and inserting the following new subsection:</text>

<paragraph id="H8155DE2362B1445995A1840F413AD49D"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H8C296F53CF49448DACFE616AB9534E6D"><enum>(A)</enum><header>Notice</header><text>If a recipient of a request or order for a report, records, or other information under section 2709 of this title, section 626 or 627 of the Fair Credit Reporting Act (15 U.S.C. 1681u and 1681v), section 1114 of the Right to Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414</external-xref>), or section 802 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>), wishes to have a court review a nondisclosure requirement imposed in connection with the request or order, the recipient may notify the Government or file a petition for judicial review in any court described in subsection (a).</text> </subparagraph> <subparagraph id="H228C1BF11C5E46ECA5CC68AFCA7D223A"><enum>(B)</enum><header>Application</header><text>Not later than 30 days after the date of receipt of a notification under subparagraph (A), the Government shall apply for an order prohibiting the disclosure of the existence or contents of the relevant request or order. An application under this subparagraph may be filed in the district court of the United States for the judicial district in which the recipient of the order is doing business or in the district court of the United States for any judicial district within which the authorized investigation that is the basis for the request is being conducted. The applicable nondisclosure requirement shall remain in effect during the pendency of proceedings relating to the requirement.</text> </subparagraph> 
<subparagraph id="HB78CBDBD460648A68E0A5B0C0D6ADC7A"><enum>(C)</enum><header>Consideration</header><text>A district court of the United States that receives a petition under subparagraph (A) or an application under subparagraph (B) should rule expeditiously, and shall, subject to paragraph (3), issue a nondisclosure order that includes conditions appropriate to the circumstances.</text> </subparagraph></paragraph> <paragraph id="HFDA3E37CBCAD4ABEBED9E4985E5022FF"><enum>(2)</enum><header>Application contents</header><text>An application for a nondisclosure order or extension thereof or a response to a petition filed under paragraph (1) shall include a certification from the Attorney General, Deputy Attorney General, an Assistant Attorney General, or the Director of the Federal Bureau of Investigation, or a designee in a position not lower than Deputy Assistant Director at Bureau headquarters or a Special Agent in Charge in a Bureau field office designated by the Director, or in the case of a request by a department, agency, or instrumentality of the Federal Government other than the Department of Justice, the head or deputy head of the department, agency, or instrumentality, containing a statement of specific facts indicating that the absence of a prohibition of disclosure under this subsection may result in—</text> 
<subparagraph id="H7DAF09586A9D475F9C9A93CF64F2F07A"><enum>(A)</enum><text>a danger to the national security of the United States;</text> </subparagraph> <subparagraph id="H247B1A476F01483785F47251D29FEAF7"><enum>(B)</enum><text>interference with a criminal, counterterrorism, or counterintelligence investigation;</text> </subparagraph> 
<subparagraph id="H03B839C5D39445E99F789258119450A4"><enum>(C)</enum><text>interference with diplomatic relations; or</text> </subparagraph> <subparagraph id="HA8E46CC0DDD34CA1A987135311250D04"><enum>(D)</enum><text>danger to the life or physical safety of any person.</text> </subparagraph></paragraph> 
<paragraph id="HA9CAD0EA37254B01A8C88433E3CC20E0"><enum>(3)</enum><header>Standard</header><text>A district court of the United States shall issue a nondisclosure order or extension thereof under this subsection if the court determines that there is reason to believe that disclosure of the information subject to the nondisclosure requirement during the applicable time period may result in—</text> <subparagraph id="H3CE899FD1E734BE5B8374DE8D8721703"><enum>(A)</enum><text>a danger to the national security of the United States;</text> </subparagraph> 
<subparagraph id="HDC43D8BED8194367AEE4DA820A651B99"><enum>(B)</enum><text>interference with a criminal, counterterrorism, or counterintelligence investigation;</text> </subparagraph> <subparagraph id="HDC7409EFEF9E4815B502F62B181952EE"><enum>(C)</enum><text>interference with diplomatic relations; or</text> </subparagraph>

<subparagraph id="H21E84BD4FDB043F99C3D9BE73719AF82"><enum>(D)</enum><text>the number of applications or certifications denied under each of those sections;</text> </subparagraph> <subparagraph id="H4238706873554B2B8DFB56FBDB38C42B"><enum>(E)</enum><text>the number of appointments of an individual to serve as amicus curiae under section 103, including the name of each individual appointed to serve as amicus curiae; and</text> </subparagraph>

<paragraph id="H93DD5BE17E1E4E9BAFA326799BFB9041"><enum>(2)</enum><text>the total number of orders issued pursuant to section 702 and a good faith estimate of—</text> <subparagraph id="H7ABCA595DDA4458A85A0044A060D5B07"><enum>(A)</enum><text display-inline="yes-display-inline">the number of search terms concerning a known United States person used to retrieve the unminimized contents of electronic communications or wire communications obtained through acquisitions authorized under such section, excluding the number of search terms used to prevent the return of information concerning a United States person; and</text> </subparagraph> 
<subparagraph id="HFBCFE059BDA8403FA9A96D6FFC7665F7"><enum>(B)</enum><text>the number of queries concerning a known United States person of unminimized noncontents information relating to electronic communications or wire communications obtained through acquisitions authorized under such section, excluding the number of queries containing information used to prevent the return of information concerning a United States person;</text> </subparagraph></paragraph> <paragraph id="H1DC2B0E6DF27439D808258B9D04DCE58"><enum>(3)</enum><text>the total number of orders issued pursuant to title IV and a good faith estimate of—</text>

<subsection id="H72738B74B04148A5A6388216ECFAD28A"><enum>(c)</enum><header>Timing</header><text>The annual reports required by subsections (a) and (b) shall be made publicly available during April of each year and include information relating to the previous calendar year.</text> </subsection> <subsection id="H57DE5369BBA349F68D84BEBAEFD8ACD6"><enum>(d)</enum><header>Exceptions</header> <paragraph id="HF1B712D2B7974485AD8E84BE0339F551"><enum>(1)</enum><header>Statement of numerical range</header><text>If a good faith estimate required to be reported under subparagraph (B) of any of paragraphs (3), (4), or (5) of subsection (b) is fewer than 500, it shall be expressed as a numerical range of <quote>fewer than 500</quote> and shall not be expressed as an individual number.</text> </paragraph> 
<paragraph id="HC4FC282D50CF496DA6DDAF2F89B576F9"><enum>(2)</enum><header>Nonapplicability to certain information</header> 
<subparagraph id="H915BE48C8296447DA6015B3A7689B726"><enum>(A)</enum><header>Federal Bureau of Investigation</header><text>Paragraphs (2)(A), (2)(B), and (5)(C) of subsection (b) shall not apply to information or records held by, or queries conducted by, the Federal Bureau of Investigation.</text> </subparagraph> <subparagraph id="H99E6E9DCCB5946B7ADC58148CEFC479F"><enum>(B)</enum><header>Electronic mail address and telephone numbers</header><text>Paragraph (3)(B) of subsection (b) shall not apply to orders resulting in the acquisition of information by the Federal Bureau of Investigation that does not include electronic mail addresses or telephone numbers.</text> </subparagraph></paragraph> 
<paragraph id="H50A2B16C6B5D44089503703810C6885E"><enum>(3)</enum><header>Certification</header> 
<subparagraph id="H3A91BB3C08204E09899488845C077A98"><enum>(A)</enum><header>In general</header><text>If the Director of National Intelligence concludes that a good faith estimate required to be reported under subsection (b)(2)(B) cannot be determined accurately because some but not all of the relevant elements of the intelligence community are able to provide such good faith estimate, the Director shall—</text> <clause id="H2EEDF90C5CD44679AD6E036FF9C38281"><enum>(i)</enum><text>certify that conclusion in writing to the Select Committee on Intelligence and the Committee on the Judiciary of the Senate and the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of Representatives;</text> </clause> 
<clause id="H7D38412A13A34546AA87DB2A612391F8"><enum>(ii)</enum><text>report the good faith estimate for those relevant elements able to provide such good faith estimate;</text> </clause> <clause id="H78E62AC8CF0742D7B880D6D2CC181A69"><enum>(iii)</enum><text>explain when it is reasonably anticipated that such an estimate will be able to be determined fully and accurately; and</text> </clause> 
<clause id="HBE263022D7D04BDEBBD137350993B1EC"><enum>(iv)</enum><text>make such certification publicly available on an Internet Web site.</text> </clause></subparagraph> <subparagraph id="HA090CAB970D841ECB760639FF3DB4504"><enum>(B)</enum><header>Form</header><text>A certification described in subparagraph (A) shall be prepared in unclassified form, but may contain a classified annex.</text> </subparagraph> 
<subparagraph id="HF1A9579EFD34402C805D3C124FA64049"><enum>(C)</enum><header>Timing</header><text>If the Director of National Intelligence continues to conclude that the good faith estimates described in this paragraph cannot be determined accurately, the Director shall annually submit a certification in accordance with this paragraph.</text> </subparagraph></paragraph></subsection> <subsection id="H4EC90C9B37EC4981ADDA3EAC02B6C73B"><enum>(e)</enum><header>Definitions</header><text>In this section:</text>

<paragraph id="H78D3BC127DDA4483A4778FDA4AD68F40"><enum>(3)</enum><header>National security letter</header><text>The term <term>national security letter</term> means a request for a report, records, or other information under—</text> <subparagraph id="H02587DDE650346DFAE8146452E8E245F"><enum>(A)</enum><text>section 2709 of title 18, United States Code;</text> </subparagraph>

<subparagraph id="HB1D9A72F3F3C4F52A2ED01F15F654D97"><enum>(C)</enum><text>the number of orders or directives received, combined, under this Act for contents, reported in bands of 1000 starting with 0–999;</text> </subparagraph> <subparagraph id="HD10F0CEE655D4BA29B5063FDFACA8CD9"><enum>(D)</enum><text>the number of customer selectors targeted under orders or directives received, combined, under this Act for contents reported in bands of 1000 starting with 0–999;</text> </subparagraph>

<subparagraph id="HD54F850BB09F403A93226124DE60801A"><enum>(B)</enum><text>the total number of customer selectors targeted under all national security process received, including all national security letters, and orders or directives under this Act, combined, reported in bands of 250 starting with 0–249.</text> </subparagraph></paragraph> <paragraph id="HA712F29645A6411585696780F7D05869"><enum>(4)</enum><text>An annual report that aggregates the number of orders, directives, and national security letters the person was required to comply with into separate categories of—</text> 
<subparagraph id="HFFAC28231BE543389DDAB5A85555BE6D"><enum>(A)</enum><text>the total number of all national security process received, including all national security letters, and orders or directives under this Act, combined, reported in bands of 100 starting with 0–99; and</text> </subparagraph> <subparagraph id="H00BBEC074F43455D93A5351A658021E6"><enum>(B)</enum><text>the total number of customer selectors targeted under all national security process received, including all national security letters, and orders or directives under this Act, combined, reported in bands of 100 starting with 0–99.</text> </subparagraph></paragraph></subsection> 
<subsection id="H8059C284DD26486F8EB020AF16B59F7C"><enum>(b)</enum><header>Period of time covered by reports</header> 
<paragraph id="H6CCCCB23CA9A4AC89E1F60105E27B885"><enum>(1)</enum><text>A report described in paragraph (1) or (2) of subsection (a) shall include only information—</text> <subparagraph id="H21180EA8772D4DA68B49488A9B39FEFB"><enum>(A)</enum><text>relating to national security letters for the previous 180 days; and</text> </subparagraph> 
<subparagraph id="H327C621239B54062BB42D9905C8A9F15"><enum>(B)</enum><text>relating to authorities under this Act for the 180-day period of time ending on the date that is not less than 180 days prior to the date of the publication of such report, except that with respect to a platform, product, or service for which a person did not previously receive an order or directive (not including an enhancement to or iteration of an existing publicly available platform, product, or service) such report shall not include any information relating to such new order or directive until 540 days after the date on which such new order or directive is received.</text> </subparagraph></paragraph> <paragraph id="H15F63048F5CB456FAEA8FA294D8C37E1"><enum>(2)</enum><text>A report described in paragraph (3) of subsection (a) shall include only information relating to the previous 180 days.</text> </paragraph> 
<paragraph id="H67EB05ABEFF348C0B60D94266E2A5ED3"><enum>(3)</enum><text>A report described in paragraph (4) of subsection (a) shall include only information for the 1-year period of time ending on the date that is not less than 1 year prior to the date of the publication of such report.</text> </paragraph></subsection> <subsection id="H90CB77AC750741BE8F72EE1C3E4C807E"><enum>(c)</enum><header>Other forms of agreed to publication</header><text>Nothing in this section prohibits the Government and any person from jointly agreeing to the publication of information referred to in this subsection in a time, form, or manner other than as described in this section.</text> </subsection>

<paragraph id="HE3041037AB5E4CF2B0ADB0A8014A5E64"><enum>(1)</enum><text>by redesignating subsections (f), (g), (h), and (i) as subsections (g), (h), (i), and (j), respectively; and</text> </paragraph> <paragraph id="H0E1A01793DF840EEAFB46CD92027DACB"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text>

<subsection id="H4F75596D36234BF9A81C9ED7CB2C2556"><enum>(f)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H5B5278FD02C84FCAA1D6673297F81C7F"><enum>(1)</enum><text>Notwithstanding any other provision of this Act, the lawfully authorized targeting of a non-United States person previously believed to be located outside the United States for the acquisition of foreign intelligence information may continue for a period not to exceed 72 hours from the time that the non-United States person is reasonably believed to be located inside the United States and the acquisition is subject to this title or to title III of this Act, provided that the head of an element of the intelligence community—</text> <subparagraph id="HF528E559FECC489A9DEF32A5B43CBD67" indent="up1"><enum>(A)</enum><text>reasonably determines that a lapse in the targeting of such non-United States person poses a threat of death or serious bodily harm to any person;</text> </subparagraph> 
<subparagraph id="HDFC0AE10FB9040A3BBDE9C268469BAAC" indent="up1"><enum>(B)</enum><text>promptly notifies the Attorney General of a determination under subparagraph (A); and</text> </subparagraph> <subparagraph id="HF749F6B9A1FB483A9B31C8ACE464E1AE" indent="up1"><enum>(C)</enum><text>requests, as soon as practicable, the employment of emergency electronic surveillance under subsection (e) or the employment of an emergency physical search pursuant to section 304(e), as warranted.</text> </subparagraph></paragraph> 
<paragraph id="HB8B13D609C5D4E02AD44604621AF79C8" indent="up1"><enum>(2)</enum><text>The authority under this subsection to continue the acquisition of foreign intelligence information is limited to a period not to exceed 72 hours and shall cease upon the earlier of the following:</text> <subparagraph id="H84C19AA7DB494DEE97D918D6E94A6EDD"><enum>(A)</enum><text display-inline="yes-display-inline">The employment of emergency electronic surveillance under subsection (e) or the employment of an emergency physical search pursuant to section 304(e).</text> </subparagraph> 
<subparagraph id="H8F4BB02D7D974E94BD4A327CA8FD8757"><enum>(B)</enum><text>An issuance of a court order under this title or title III of this Act.</text> </subparagraph> <subparagraph id="H024D1010628B4F93BEA5CD93EED8777A"><enum>(C)</enum><text>The Attorney General provides direction that the acquisition be terminated.</text> </subparagraph> 
<subparagraph id="H1BC684F7B49E4DB69BFB254AE5BB2C70"><enum>(D)</enum><text>The head of the element of the intelligence community conducting the acquisition determines that a request under paragraph (1)(C) is not warranted.</text> </subparagraph> <subparagraph id="HBD91A4F8000A4600B6BE99D3FFB6E867"><enum>(E)</enum><text>When the threat of death or serious bodily harm to any person is no longer reasonably believed to exist.</text> </subparagraph></paragraph> 
<paragraph id="H0FA4CB1BD1A64E7EA8859A08E7203215" indent="up1"><enum>(3)</enum><text>Nonpublicly available information concerning unconsenting United States persons acquired under this subsection shall not be disseminated during the 72 hour time period under paragraph (1) unless necessary to investigate, reduce, or eliminate the threat of death or serious bodily harm to any person.</text> </paragraph> <paragraph id="H3949DA33E7FD495795CDB84E116124E7" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">If the Attorney General declines to authorize the employment of emergency electronic surveillance under subsection (e) or the employment of an emergency physical search pursuant to section 304(e), or a court order is not obtained under this title or title III of this Act, information obtained during the 72 hour acquisition time period under paragraph (1) shall not be retained, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text> </paragraph> 
<paragraph id="H2EB2ABFFA2514DB1B3B03D8F757DB458" indent="up1"><enum>(5)</enum><text>Paragraphs (5) and (6) of subsection (e) shall apply to this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> <subsection id="H8E12F113D8E14E6E9B243AAC78B2233B"><enum>(b)</enum><header>Notification of emergency employment of electronic surveillance</header><text>Section 106(j) (<external-xref legal-doc="usc" parsable-cite="usc/50/1806">50 U.S.C. 1806(j)</external-xref>) is amended by striking <quote>section 105(e)</quote> and inserting <quote>subsection (e) or (f) of section 105</quote>.</text> </subsection> 
<subsection id="HF682F7E3FC694C989D9CF7A614FB04D5"><enum>(c)</enum><header>Report to Congress</header><text>Section 108(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/50/1808">50 U.S.C. 1808(a)(2)</external-xref>) is amended—</text> <paragraph id="H6CBC51AD3E384D979E7A8F0AB196ED8E"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text> </paragraph>

<paragraph id="HDB2DABD76B76482A8637C363EC3EE1CB"><enum>(3)</enum><text display-inline="yes-display-inline"><term>biological weapon</term> means—</text> <subparagraph id="HB6D63BC23CFD437C92340EB03650D608"><enum>(A)</enum><text display-inline="yes-display-inline">microbial or other biological agents, or toxins whatever their origin or method of production, of types and in quantities that have no justification for prophylactic, protective, or other peaceful purposes; or</text> </subparagraph> 
<subparagraph id="H068736D5C3904FF48F9C8140D32B72C1"><enum>(B)</enum><text>weapons, equipment, or means of delivery designed to use such agents or toxins for hostile purposes or in armed conflict;</text> </subparagraph></paragraph> <paragraph id="HF602459514064118B70E14409AC208C7"><enum>(4)</enum><text display-inline="yes-display-inline"><term>chemical weapon</term> means, together or separately—</text> 
<subparagraph id="H227D8D96CE8C4B5CBBE86D79D6B64D6C"><enum>(A)</enum><text display-inline="yes-display-inline">toxic chemicals and their precursors, except where intended for—</text> <clause id="H3A025FE842A74C04931EF09B1876F302"><enum>(i)</enum><text display-inline="yes-display-inline">industrial, agricultural, research, medical, pharmaceutical, or other peaceful purposes;</text> </clause> 
<clause id="H720661DAA8F34EB9962F43B9DB15F7EB"><enum>(ii)</enum><text>protective purposes, namely those purposes directly related to protection against toxic chemicals and to protection against chemical weapons;</text> </clause> <clause id="H28EE6C794795443B9395D0F5EFF56FE1"><enum>(iii)</enum><text>military purposes not connected with the use of chemical weapons and not dependent on the use of the toxic properties of chemicals as a method of warfare; or</text> </clause> 
<clause commented="no" id="H8577A61CD7BE45C081D81D76301EEF16"><enum>(iv)</enum><text display-inline="yes-display-inline">law enforcement including domestic riot control purposes,</text> </clause><continuation-text continuation-text-level="subparagraph">as long as the types and quantities are consistent with such purposes;</continuation-text></subparagraph> <subparagraph id="HD3DEAD2983334B1B935C7A3E5FF1E69F"><enum>(B)</enum><text display-inline="yes-display-inline">munitions and devices, specifically designed to cause death or other harm through the toxic properties of those toxic chemicals specified in subparagraph (A), which would be released as a result of the employment of such munitions and devices; and</text> </subparagraph> 
<subparagraph id="H434A43D1E9EC454EBB2C3C2C7241E18B"><enum>(C)</enum><text>any equipment specifically designed for use directly in connection with the employment of munitions and devices specified in subparagraph (B);</text> </subparagraph></paragraph> <paragraph id="HF7843E15EC1E4EB2803AFB712584DAC9"><enum>(5)</enum><text display-inline="yes-display-inline"><term>covered ship</term> means a ship that is navigating or is scheduled to navigate into, through or from waters beyond the outer limit of the territorial sea of a single country or a lateral limit of that country’s territorial sea with an adjacent country;</text> </paragraph> 
<paragraph id="HC37D93AC69514EE1A618D7E48E7E014E"><enum>(6)</enum><text><term>explosive material</term> has the meaning given the term in section 841(c) and includes explosive as defined in section 844(j) of this title;</text> </paragraph> <paragraph id="H6FBD66F9481F4C06A3443F8DDC97B195"><enum>(7)</enum><text><term>infrastructure facility</term> has the meaning given the term in section 2332f(e)(5) of this title;</text> </paragraph> 
<paragraph id="H3B8CEF5ECD5740539DDCF87B4011EC85"><enum>(8)</enum><text><term>international organization</term> has the meaning given the term in section 831(f)(3) of this title;</text> </paragraph> <paragraph id="H73D3E97ED00340E9A069E4EB0E011FCC"><enum>(9)</enum><text><term>military forces of a state</term> means the armed forces of a state which are organized, trained, and equipped under its internal law for the primary purpose of national defense or security, and persons acting in support of those armed forces who are under their formal command, control, and responsibility;</text> </paragraph> 
<paragraph id="HEF120043C48D403B9FDB95C9D62B283C"><enum>(10)</enum><text><term>national of the United States</term> has the meaning stated in section 101(a)(22) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>);</text> </paragraph> <paragraph id="H7C23A0897972428CAA9455F488E4BF11"><enum>(11)</enum><text><term>Non-Proliferation Treaty</term> means the Treaty on the Non-Proliferation of Nuclear Weapons, done at Washington, London, and Moscow on 1 July 1968;</text> </paragraph> 
<paragraph id="HD26F27105EA84D31B76D37EAA12B76E5"><enum>(12)</enum><text display-inline="yes-display-inline"><term>Non-Proliferation Treaty State Party</term> means any State Party to the Non-Proliferation Treaty, to include Taiwan, which shall be considered to have the obligations under the Non-Proliferation Treaty of a party to that treaty other than a Nuclear Weapon State Party to the Non-Proliferation Treaty;</text> </paragraph> <paragraph id="H40133F1D0DD34E0EB00EA2536CB29157"><enum>(13)</enum><text><term>Nuclear Weapon State Party to the Non-Proliferation Treaty</term> means a State Party to the Non-Proliferation Treaty that is a nuclear-weapon State, as that term is defined in Article IX(3) of the Non-Proliferation Treaty;</text> </paragraph> 
<paragraph id="H31AE506D1D0242E2AC80635DDBA3E0A6"><enum>(14)</enum><text><term>place of public use</term> has the meaning given the term in section 2332f(e)(6) of this title;</text> </paragraph> <paragraph id="HCDBF0893F2614428AD41E1736C2CD0BB"><enum>(15)</enum><text><term>precursor</term> has the meaning given the term in section 229F(6)(A) of this title;</text> </paragraph> 
<paragraph id="HAC808EEF1DB2469F9043C3328D3C226C"><enum>(16)</enum><text><term>public transport system</term> has the meaning given the term in section 2332f(e)(7) of this title;</text> </paragraph> <paragraph id="H6B571ECE3C684DA59D7AA2FCCCE1B5CA"><enum>(17)</enum><text><term>serious injury or damage</term> means—</text> 
<subparagraph id="H14D93424B3C5415FB0E3985B88E1C828"><enum>(A)</enum><text>serious bodily injury,</text> </subparagraph> <subparagraph id="HB3B64E51358B4678880BA1956BF7A610"><enum>(B)</enum><text>extensive destruction of a place of public use, State or government facility, infrastructure facility, or public transportation system, resulting in major economic loss, or</text> </subparagraph> 
<subparagraph id="H35BC9B02CEEB44ABACB280489D658E35"><enum>(C)</enum><text>substantial damage to the environment, including air, soil, water, fauna, or flora;</text> </subparagraph></paragraph> <paragraph id="H6993ED11746E496582DC5A652DAA8844"><enum>(18)</enum><text><term>ship</term> means a vessel of any type whatsoever not permanently attached to the sea-bed, including dynamically supported craft, submersibles, or any other floating craft, but does not include a warship, a ship owned or operated by a government when being used as a naval auxiliary or for customs or police purposes, or a ship which has been withdrawn from navigation or laid up;</text> </paragraph> 
<paragraph id="H47E986B2EA49404FAB3C53300A373EA0"><enum>(19)</enum><text><term>source material</term> has the meaning given that term in the International Atomic Energy Agency Statute, done at New York on 26 October 1956;</text> </paragraph> <paragraph id="H67BA2106EABE4635A8AC78E2FCF3D112"><enum>(20)</enum><text><term>special fissionable material</term> has the meaning given that term in the International Atomic Energy Agency Statute, done at New York on 26 October 1956;</text> </paragraph> 
<paragraph id="HE3BE073812D54D44A1E8C3CA2D91D213"><enum>(21)</enum><text><term>territorial sea of the United States</term> means all waters extending seaward to 12 nautical miles from the baselines of the United States determined in accordance with international law;</text> </paragraph> <paragraph id="HF186F8B8BEAC4B68A8FED9E89AD814D9"><enum>(22)</enum><text><term>toxic chemical</term> has the meaning given the term in section 229F(8)(A) of this title;</text> </paragraph> 
<paragraph id="HF7F18966B68448598196AA89DC0D8907"><enum>(23)</enum><text><term>transport</term> means to initiate, arrange or exercise effective control, including decisionmaking authority, over the movement of a person or item; and</text> </paragraph> <paragraph id="H3276F650D4AB45D3A2D6B5D961858B41"><enum>(24)</enum><text><term>United States</term>, when used in a geographical sense, includes the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, and all territories and possessions of the United States.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> 
<paragraph commented="no" id="H5898D72223FA49D4A8A511F6BF00D2FB"><enum>(5)</enum><text display-inline="yes-display-inline">by inserting after subsection (d) (as added by paragraph (4) of this section) the following:</text> <quoted-block display-inline="no-display-inline" id="H1922D0665196466CB76885BB3B5989BF" style="OLC"> <subsection commented="no" id="H083CB38BC7334B2F9E5EDE2C3D2F19DA"><enum>(e)</enum><header>Exceptions</header><text display-inline="yes-display-inline">This section shall not apply to—</text> 
<paragraph commented="no" id="H2CDE73E7F52C41EF9D64355511937944"><enum>(1)</enum><text>the activities of armed forces during an armed conflict, as those terms are understood under the law of war, which are governed by that law; or</text> </paragraph> <paragraph commented="no" id="H35BAB944ECF6426E8651D2254CC3FD42"><enum>(2)</enum><text>activities undertaken by military forces of a state in the exercise of their official duties.</text> </paragraph></subsection> 
<subsection commented="no" id="H6B14D48DD0DD4A7A86F066835A79615A"><enum>(f)</enum><header>Delivery of suspected offender</header><text display-inline="yes-display-inline">The master of a covered ship flying the flag of the United States who has reasonable grounds to believe that there is on board that ship any person who has committed an offense under section 2280 or section 2280a may deliver such person to the authorities of a country that is a party to the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation. Before delivering such person to the authorities of another country, the master shall notify in an appropriate manner the Attorney General of the United States of the alleged offense and await instructions from the Attorney General as to what action to take. When delivering the person to a country which is a state party to the Convention, the master shall, whenever practicable, and if possible before entering the territorial sea of such country, notify the authorities of such country of the master's intention to deliver such person and the reasons therefor. If the master delivers such person, the master shall furnish to the authorities of such country the evidence in the master’s possession that pertains to the alleged offense.</text> </subsection> <subsection commented="no" id="HEB9770A3B20F4573A00A702328553B7A"><enum>(g)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="HF130CD6F150A4ADC81BE087316582029"><enum>(1)</enum><header>Civil forfeiture</header><text display-inline="yes-display-inline">Any real or personal property used or intended to be used to commit or to facilitate the commission of a violation of this section, the gross proceeds of such violation, and any real or personal property traceable to such property or proceeds, shall be subject to forfeiture.</text> </paragraph> 
<paragraph commented="no" id="H8BF7CC4DE02643949B69092899F6BB69" indent="up1"><enum>(2)</enum><header>Applicable procedures</header><text display-inline="yes-display-inline">Seizures and forfeitures under this section shall be governed by the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">chapter 46</external-xref> of title 18, United States Code, relating to civil forfeitures, except that such duties as are imposed upon the Secretary of the Treasury under the customs laws described in section 981(d) shall be performed by such officers, agents, and other persons as may be designated for that purpose by the Secretary of Homeland Security, the Attorney General, or the Secretary of Defense.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> <section id="HB336FFCD665941008B9D683A3D375410"><enum>802.</enum><header>New section 2280a of title 18, United States Code</header> <subsection id="H7E7A8201483D441EB494355ABE8EA8DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/111">Chapter 111</external-xref> of title 18, United States Code, is amended by adding after section 2280 the following new section:</text>

<section id="H60B0E14F580845D6B49970B9D4B473F8"><enum>2280a.</enum><header>Violence against maritime navigation and maritime transport involving weapons of mass destruction</header> 
<subsection id="HBEC953FE0D4C4676ABE790B41279EADC"><enum>(a)</enum><header>Offenses</header> 
<paragraph id="H4D708BD4860B4615A66966CB545E07BB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the exceptions in subsection (c), a person who unlawfully and intentionally—</text> <subparagraph id="HB9C05099D02749B49BB34EC5ED707168"><enum>(A)</enum><text display-inline="yes-display-inline">when the purpose of the act, by its nature or context, is to intimidate a population, or to compel a government or an international organization to do or to abstain from doing any act—</text> 
<clause id="H0939C418FA4A49E78244A169BD557D34"><enum>(i)</enum><text display-inline="yes-display-inline">uses against or on a ship or discharges from a ship any explosive or radioactive material, biological, chemical, or nuclear weapon or other nuclear explosive device in a manner that causes or is likely to cause death to any person or serious injury or damage;</text> </clause> <clause id="H0EF286C087FB47DDAB7246E18E5E82DF"><enum>(ii)</enum><text>discharges from a ship oil, liquefied natural gas, or another hazardous or noxious substance that is not covered by clause (i), in such quantity or concentration that causes or is likely to cause death to any person or serious injury or damage; or</text> </clause> 
<clause id="H033B3E05CBF54B259E08C0ECE6714158"><enum>(iii)</enum><text>uses a ship in a manner that causes death to any person or serious injury or damage;</text> </clause></subparagraph> <subparagraph id="H7FA88ADDBB014F9494269EBC9CC1D9A8"><enum>(B)</enum><text display-inline="yes-display-inline">transports on board a ship—</text> 
<clause id="H33A29715109545CEA192FB9012840D00"><enum>(i)</enum><text display-inline="yes-display-inline">any explosive or radioactive material, knowing that it is intended to be used to cause, or in a threat to cause, death to any person or serious injury or damage for the purpose of intimidating a population, or compelling a government or an international organization to do or to abstain from doing any act;</text> </clause> <clause id="HD1B939B450D64992972CBB285B920472"><enum>(ii)</enum><text>any biological, chemical, or nuclear weapon or other nuclear explosive device, knowing it to be a biological, chemical, or nuclear weapon or other nuclear explosive device;</text> </clause> 
<clause id="H15EA9799FF86436FA01B1D1CC291FDF1"><enum>(iii)</enum><text>any source material, special fissionable material, or equipment or material especially designed or prepared for the processing, use, or production of special fissionable material, knowing that it is intended to be used in a nuclear explosive activity or in any other nuclear activity not under safeguards pursuant to an International Atomic Energy Agency comprehensive safeguards agreement, except where—</text> <subclause id="H09954DBF5FC243AF862E884AD5280825"><enum>(I)</enum><text display-inline="yes-display-inline">such item is transported to or from the territory of, or otherwise under the control of, a Non-Proliferation Treaty State Party; and</text> </subclause> 
<subclause id="H3886915EB0B347D4AF9BD3F1DBF7B829"><enum>(II)</enum><text>the resulting transfer or receipt (including internal to a country) is not contrary to the obligations under the Non-Proliferation Treaty of the Non-Proliferation Treaty State Party from which, to the territory of which, or otherwise under the control of which such item is transferred;</text> </subclause></clause> <clause id="H52FA8F785A1440F3BCCFAE04C55C4C31"><enum>(iv)</enum><text display-inline="yes-display-inline">any equipment, materials, or software or related technology that significantly contributes to the design or manufacture of a nuclear weapon or other nuclear explosive device, with the intention that it will be used for such purpose, except where—</text> 
<subclause id="H5A4431FDC90C4FC0B15E9410F1C918AC"><enum>(I)</enum><text display-inline="yes-display-inline">the country to the territory of which or under the control of which such item is transferred is a Nuclear Weapon State Party to the Non-Proliferation Treaty; and</text> </subclause> <subclause id="HA7D999BA68264E0385CBF46D7E9AEDB0"><enum>(II)</enum><text display-inline="yes-display-inline">the resulting transfer or receipt (including internal to a country) is not contrary to the obligations under the Non-Proliferation Treaty of a Non-Proliferation Treaty State Party from which, to the territory of which, or otherwise under the control of which such item is transferred;</text> </subclause></clause> 
<clause id="H97666072A44A44829D5B35B5E3284398"><enum>(v)</enum><text display-inline="yes-display-inline">any equipment, materials, or software or related technology that significantly contributes to the delivery of a nuclear weapon or other nuclear explosive device, with the intention that it will be used for such purpose, except where—</text> <subclause id="H15E672445B40415AB69CF575E9117790"><enum>(I)</enum><text display-inline="yes-display-inline">such item is transported to or from the territory of, or otherwise under the control of, a Non-Proliferation Treaty State Party; and</text> </subclause> 
<subclause id="HFF61E5B2C05C4B7DB76BB0E85684382E"><enum>(II)</enum><text>such item is intended for the delivery system of a nuclear weapon or other nuclear explosive device of a Nuclear Weapon State Party to the Non-Proliferation Treaty; or</text> </subclause></clause> <clause id="HDAC223537295472E884D449BA424CF12"><enum>(vi)</enum><text display-inline="yes-display-inline">any equipment, materials, or software or related technology that significantly contributes to the design, manufacture, or delivery of a biological or chemical weapon, with the intention that it will be used for such purpose;</text> </clause></subparagraph> 
<subparagraph id="H4613297C9A514991A01361F0770F3A77"><enum>(C)</enum><text display-inline="yes-display-inline">transports another person on board a ship knowing that the person has committed an act that constitutes an offense under section 2280 or subparagraph (A), (B), (D), or (E) of this section or an offense set forth in an applicable treaty, as specified in section 2280(d)(1), and intending to assist that person to evade criminal prosecution;</text> </subparagraph> <subparagraph id="HB643A7A413914322A8DD775A8907EA1B"><enum>(D)</enum><text>injures or kills any person in connection with the commission or the attempted commission of any of the offenses set forth in subparagraphs (A) through (C), or subsection (a)(2), to the extent that the subsection (a)(2) offense pertains to subparagraph (A); or</text> </subparagraph> 
<subparagraph id="HB7EF82EDF8C74A2AB91EF63D8B353902"><enum>(E)</enum><text>attempts to do any act prohibited under subparagraph (A), (B) or (D), or conspires to do any act prohibited by subparagraphs (A) through (E) or subsection (a)(2),</text> </subparagraph><continuation-text continuation-text-level="paragraph">shall be fined under this title, imprisoned not more than 20 years, or both; and if the death of any person results from conduct prohibited by this paragraph, shall be imprisoned for any term of years or for life.</continuation-text></paragraph> <paragraph id="H5199C19D57D94CABA9F39831D977237A"><enum>(2)</enum><header>Threats</header><text display-inline="yes-display-inline">A person who threatens, with apparent determination and will to carry the threat into execution, to do any act prohibited under paragraph (1)(A) shall be fined under this title, imprisoned not more than 5 years, or both.</text> </paragraph></subsection> 
<subsection id="H51BFB661440444DD9BCA11E72092FE7C"><enum>(b)</enum><header>Jurisdiction</header><text>There is jurisdiction over the activity prohibited in subsection (a)—</text> <paragraph id="H3146CF02E2FD4818ABE94FA3643B220B"><enum>(1)</enum><text>in the case of a covered ship, if—</text> 
<subparagraph id="HCE6365145463443092B8F3F91FB43C77"><enum>(A)</enum><text>such activity is committed—</text> <clause id="H27DC7101A1DD4901AEDF58669529E306"><enum>(i)</enum><text>against or on board a vessel of the United States or a vessel subject to the jurisdiction of the United States (as defined in section 70502 of title 46) at the time the prohibited activity is committed;</text> </clause> 
<clause id="H92CAF4C008C945BBA1B629FA2CAB12EF"><enum>(ii)</enum><text>in the United States, including the territorial seas; or</text> </clause> <clause id="HE921977107F14D1A83247C19B097766E"><enum>(iii)</enum><text>by a national of the United States, by a United States corporation or legal entity, or by a stateless person whose habitual residence is in the United States;</text> </clause></subparagraph> 
<subparagraph id="H93A33E36073B4C97BDE5D196F4D52CBC"><enum>(B)</enum><text>during the commission of such activity, a national of the United States is seized, threatened, injured, or killed; or</text> </subparagraph> <subparagraph id="HE0F1F7D3F3F2475CAF899736985A76CD"><enum>(C)</enum><text>the offender is later found in the United States after such activity is committed;</text> </subparagraph></paragraph> 
<paragraph id="H9C8DF661F2E74C6CB1B68529EFE1B259"><enum>(2)</enum><text>in the case of a ship navigating or scheduled to navigate solely within the territorial sea or internal waters of a country other than the United States, if the offender is later found in the United States after such activity is committed; or</text> </paragraph> <paragraph id="H492932127BC14DAB93CA3EB1A1FDBFAB"><enum>(3)</enum><text>in the case of any vessel, if such activity is committed in an attempt to compel the United States to do or abstain from doing any act.</text> </paragraph></subsection> 
<subsection id="HD2DE4A5AB6994AECB79C0398EE5941CD"><enum>(c)</enum><header>Exceptions</header><text>This section shall not apply to—</text> <paragraph id="HDD2BB61DAE0240D094750D3964CF2F4E"><enum>(1)</enum><text>the activities of armed forces during an armed conflict, as those terms are understood under the law of war, which are governed by that law; or</text> </paragraph> 
<paragraph id="H07BDF56B620C4EDF9D80DB7A86B8C00F"><enum>(2)</enum><text>activities undertaken by military forces of a state in the exercise of their official duties.</text> </paragraph></subsection> <subsection id="H88759E4328EE4A13AB48C05FD574339B"><enum>(d)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="H31A22F2DAAB641079E3DC26E0949E694"><enum>(1)</enum><header>Civil forfeiture</header><text display-inline="yes-display-inline">Any real or personal property used or intended to be used to commit or to facilitate the commission of a violation of this section, the gross proceeds of such violation, and any real or personal property traceable to such property or proceeds, shall be subject to forfeiture.</text> </paragraph>

<subsection id="H3549858CEB4147AEA73982442362C415"><enum>(a)</enum><header>Offenses</header> 
<paragraph id="H8280874CBFDB4145A672D48F71BB8FF8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A person who unlawfully and intentionally—</text> <subparagraph id="HDE7630BABFED4450864C57F1FE8FC290"><enum>(A)</enum><text>when the purpose of the act, by its nature or context, is to intimidate a population, or to compel a government or an international organization to do or to abstain from doing any act—</text> 
<clause id="H541C1C2FA23B47DB9AFE2C2887DAC86F"><enum>(i)</enum><text>uses against or on a fixed platform or discharges from a fixed platform any explosive or radioactive material, biological, chemical, or nuclear weapon in a manner that causes or is likely to cause death or serious injury or damage; or</text> </clause> <clause id="HF9C5D7EEDF85453ABBF71AD9AFE1DABB"><enum>(ii)</enum><text>discharges from a fixed platform oil, liquefied natural gas, or another hazardous or noxious substance that is not covered by clause (i), in such quantity or concentration that causes or is likely to cause death or serious injury or damage;</text> </clause></subparagraph> 
<subparagraph id="HDFA17EC2689740B6994EFF60A188FE35"><enum>(B)</enum><text>injures or kills any person in connection with the commission or the attempted commission of any of the offenses set forth in subparagraph (A); or</text> </subparagraph> <subparagraph id="HD01F57FB68AD44B391C0FC721B47E541"><enum>(C)</enum><text>attempts or conspires to do anything prohibited under subparagraph (A) or (B),</text> </subparagraph><continuation-text continuation-text-level="paragraph">shall be fined under this title, imprisoned not more than 20 years, or both; and if death results to any person from conduct prohibited by this paragraph, shall be imprisoned for any term of years or for life.</continuation-text></paragraph> 
<paragraph id="H756330EC65E247E2B6B424E9411436A4"><enum>(2)</enum><header>Threat to safety</header><text>A person who threatens, with apparent determination and will to carry the threat into execution, to do any act prohibited under paragraph (1)(A), shall be fined under this title, imprisoned not more than 5 years, or both.</text> </paragraph></subsection> <subsection id="H8DFCA3EAC91A4F32A471DD2CA5FCBD67"><enum>(b)</enum><header>Jurisdiction</header><text>There is jurisdiction over the activity prohibited in subsection (a) if—</text> 
<paragraph id="HA05EDDB4968942A997650F75F535ECEC"><enum>(1)</enum><text>such activity is committed against or on board a fixed platform—</text> <subparagraph id="HBC846145299640AFA5650CBBB2E47D46"><enum>(A)</enum><text>that is located on the continental shelf of the United States;</text> </subparagraph> 
<subparagraph id="HA90FAB47690B40D3BACD471D88EFA6DA"><enum>(B)</enum><text>that is located on the continental shelf of another country, by a national of the United States or by a stateless person whose habitual residence is in the United States; or</text> </subparagraph> <subparagraph id="H91275C44A76E4F66BE24352533C2A500"><enum>(C)</enum><text>in an attempt to compel the United States to do or abstain from doing any act;</text> </subparagraph></paragraph> 
<paragraph id="H0ED9150CA93A4B4787C81E3296985C31"><enum>(2)</enum><text>during the commission of such activity against or on board a fixed platform located on a continental shelf, a national of the United States is seized, threatened, injured, or killed; or</text> </paragraph> <paragraph id="H0356F515E92542A9A98A31F5809C73ED"><enum>(3)</enum><text>such activity is committed against or on board a fixed platform located outside the United States and beyond the continental shelf of the United States and the offender is later found in the United States.</text> </paragraph></subsection> 
<subsection id="HB266F2E7331642A8942834FB048B9706"><enum>(c)</enum><header>Exceptions</header><text display-inline="yes-display-inline">This section does not apply to—</text> <paragraph id="HC6590E602B734A7DBA7965F0EA9951D5"><enum>(1)</enum><text>the activities of armed forces during an armed conflict, as those terms are understood under the law of war, which are governed by that law; or</text> </paragraph> 
<paragraph id="H24D6FE9518E64B53A51EBC1F5E215537"><enum>(2)</enum><text>activities undertaken by military forces of a state in the exercise of their official duties.</text> </paragraph></subsection> <subsection id="HC6010AA017DA45EE9D1D34891B503F5E"><enum>(d)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="HE9A8B746275C4E8EB7BBD6A6F45F6B4C"><enum>(1)</enum><text><term>continental shelf</term> means the sea-bed and subsoil of the submarine areas that extend beyond a country’s territorial sea to the limits provided by customary international law as reflected in Article 76 of the 1982 Convention on the Law of the Sea; and</text> </paragraph> <paragraph id="HF20EF81389FB44B697A2165C949B4F88"><enum>(2)</enum><text display-inline="yes-display-inline"><term>fixed platform</term> means an artificial island, installation, or structure permanently attached to the sea-bed for the purpose of exploration or exploitation of resources or for other economic purposes.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>

<subsection id="HF8923668628244828800600BC5A70B39"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">Chapter 113B</external-xref> of title 18, United States Code, is amended by adding after section 2332h the following:</text> <quoted-block display-inline="no-display-inline" id="H589C71597C0F415BA0E2314E3D8E23DD" style="USC"> <section id="H692731BC79EA4A2A9B2F90894F66D64F"><enum>2332i.</enum><header>Acts of nuclear terrorism</header> <subsection id="H833E3329C35149D88C55FCD31C4BDA30"><enum>(a)</enum><header>Offenses</header> <paragraph id="HBC794599108A4CC08CDC4F18076A00A1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever knowingly and unlawfully—</text> 
<subparagraph id="H091786547DA9445C972FA4D1C47A1E89"><enum>(A)</enum><text>possesses radioactive material or makes or possesses a device—</text> <clause id="H474C51E446584D9D890F186ED7F4AA8B"><enum>(i)</enum><text>with the intent to cause death or serious bodily injury; or</text> </clause> 
<clause id="H6E2604A3F9E847A3A686355F38DE690B"><enum>(ii)</enum><text>with the intent to cause substantial damage to property or the environment; or</text> </clause></subparagraph> <subparagraph id="H6FF01E5AA05E4FE29A80807FAC409DA4"><enum>(B)</enum><text>uses in any way radioactive material or a device, or uses or damages or interferes with the operation of a nuclear facility in a manner that causes the release of or increases the risk of the release of radioactive material, or causes radioactive contamination or exposure to radiation—</text> 
<clause id="H84C5654456A4430191FC286FBC86A2C9"><enum>(i)</enum><text>with the intent to cause death or serious bodily injury or with the knowledge that such act is likely to cause death or serious bodily injury;</text> </clause> <clause commented="no" id="H9CE073F837A44047A85E59E7FAE861FC"><enum>(ii)</enum><text>with the intent to cause substantial damage to property or the environment or with the knowledge that such act is likely to cause substantial damage to property or the environment; or</text> </clause> 
<clause id="H7A354B46643141ACB2E07C1EFA121272"><enum>(iii)</enum><text>with the intent to compel a person, an international organization or a country to do or refrain from doing an act,</text> </clause><continuation-text continuation-text-level="subparagraph">shall be punished as prescribed in subsection (c).</continuation-text></subparagraph></paragraph> <paragraph id="H1749B73CF02649A49070BF1DB94DA879"><enum>(2)</enum><header>Threats</header><text>Whoever, under circumstances in which the threat may reasonably be believed, threatens to commit an offense under paragraph (1) shall be punished as prescribed in subsection (c). Whoever demands possession of or access to radioactive material, a device or a nuclear facility by threat or by use of force shall be punished as prescribed in subsection (c).</text> </paragraph> 
<paragraph id="H43B7F48EF9084354BFDBDB28BEA8AB8D"><enum>(3)</enum><header>Attempts and conspiracies</header><text>Whoever attempts to commit an offense under paragraph (1) or conspires to commit an offense under paragraph (1) or (2) shall be punished as prescribed in subsection (c).</text> </paragraph></subsection> <subsection id="H3B5BE518FA194FF48607D5F4F9DB41C5"><enum>(b)</enum><header>Jurisdiction</header><text>Conduct prohibited by subsection (a) is within the jurisdiction of the United States if—</text> 
<paragraph id="H3DD3BBDABD7641969402A36BCAB6AD2A"><enum>(1)</enum><text>the prohibited conduct takes place in the United States or the special aircraft jurisdiction of the United States;</text> </paragraph> <paragraph id="H59F8BED8A7C542CA96E9D7C1FF47CA09"><enum>(2)</enum><text>the prohibited conduct takes place outside of the United States and—</text> 
<subparagraph id="H261F5C9FF19D406E8C1AA76E7C80BE3C"><enum>(A)</enum><text>is committed by a national of the United States, a United States corporation or legal entity or a stateless person whose habitual residence is in the United States;</text> </subparagraph> <subparagraph id="H9A85805382AF45B1ADCB8FD5237DBC76"><enum>(B)</enum><text>is committed on board a vessel of the United States or a vessel subject to the jurisdiction of the United States (as defined in section 70502 of title 46) or on board an aircraft that is registered under United States law, at the time the offense is committed; or</text> </subparagraph> 
<subparagraph id="HCE82CC008B804F8CAE74DFC333CFD73B"><enum>(C)</enum><text>is committed in an attempt to compel the United States to do or abstain from doing any act, or constitutes a threat directed at the United States;</text> </subparagraph></paragraph> <paragraph id="H2C82B996763D494CA6DB3796B7670609"><enum>(3)</enum><text>the prohibited conduct takes place outside of the United States and a victim or an intended victim is a national of the United States or a United States corporation or legal entity, or the offense is committed against any state or government facility of the United States; or</text> </paragraph> 
<paragraph id="H6D7582A5D459424D81205D164D7E97CE"><enum>(4)</enum><text>a perpetrator of the prohibited conduct is found in the United States.</text> </paragraph></subsection> <subsection id="H61E50E1F083643A58BA457B00C1117A5"><enum>(c)</enum><header>Penalties</header><text>Whoever violates this section shall be fined not more than $2,000,000 and shall be imprisoned for any term of years or for life.</text> </subsection> 
<subsection id="HB324923F075C4F339B6E7EFF5C781926"><enum>(d)</enum><header>Nonapplicability</header><text>This section does not apply to—</text> <paragraph id="H19E1D574273A45C1A5A2CFB5830B8F9D"><enum>(1)</enum><text>the activities of armed forces during an armed conflict, as those terms are understood under the law of war, which are governed by that law; or</text> </paragraph> 
<paragraph id="HBA2D78908FE34BADB0060C5D0A584E81"><enum>(2)</enum><text>activities undertaken by military forces of a state in the exercise of their official duties.</text> </paragraph></subsection> <subsection id="H69419AA841014E83871E697CD48F5FAA"><enum>(e)</enum><header>Definitions</header><text>As used in this section, the term—</text> 
<paragraph id="HA6CDCA19ADE0459D943B16D2C812C3DF"><enum>(1)</enum><text><term>armed conflict</term> has the meaning given that term in section 2332f(e)(11) of this title;</text> </paragraph> <paragraph id="HF8A8FD408D694D11ABD94F40B7145B92"><enum>(2)</enum><text><term>device</term> means:</text> 
<subparagraph id="HAF83C418DD284475A38533AB12004EDB"><enum>(A)</enum><text>any nuclear explosive device; or</text> </subparagraph> <subparagraph id="H9BE1CE7CE98F4EE4803839E9DEB9FB1B"><enum>(B)</enum><text>any radioactive material dispersal or radiation-emitting device that may, owing to its radiological properties, cause death, serious bodily injury or substantial damage to property or the environment;</text> </subparagraph></paragraph> 
<paragraph id="H99B271EEB138448DB80DE7EFA928F976"><enum>(3)</enum><text><term>international organization</term> has the meaning given that term in section 831(f)(3) of this title;</text> </paragraph> <paragraph id="HDAF37E6B4F1D4537BD698E93BBBB4DF9"><enum>(4)</enum><text><term>military forces of a state</term> means the armed forces of a country that are organized, trained and equipped under its internal law for the primary purpose of national defense or security and persons acting in support of those armed forces who are under their formal command, control and responsibility;</text> </paragraph> 
<paragraph id="H84D177CB17E34EE7933B3D1E8CEA9E11"><enum>(5)</enum><text><term>national of the United States</term> has the meaning given that term in section 101(a)(22) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>);</text> </paragraph> <paragraph id="HA215A5AF9FAB4B42BFF9B139A4A7DFDD"><enum>(6)</enum><text><term>nuclear facility</term> means:</text> 
<subparagraph id="H57B5D9E0837E4D8F8B6EB60AD684DAE4"><enum>(A)</enum><text>any nuclear reactor, including reactors on vessels, vehicles, aircraft or space objects for use as an energy source in order to propel such vessels, vehicles, aircraft or space objects or for any other purpose;</text> </subparagraph> <subparagraph id="H08B69705092B4BF782C6B03807CA34A4"><enum>(B)</enum><text>any plant or conveyance being used for the production, storage, processing or transport of radioactive material; or</text> </subparagraph> 
<subparagraph id="H1E31D3EE8D3C4A889A47FC426789FB0A"><enum>(C)</enum><text>a facility (including associated buildings and equipment) in which nuclear material is produced, processed, used, handled, stored or disposed of, if damage to or interference with such facility could lead to the release of significant amounts of radiation or radioactive material;</text> </subparagraph></paragraph> <paragraph id="H8A1B923ABC064529800418DB6B814F03"><enum>(7)</enum><text><term>nuclear material</term> has the meaning given that term in section 831(f)(1) of this title;</text> </paragraph> 
<paragraph id="H5360C8CD0DFD4C1AAE40C0FD35561CD6"><enum>(8)</enum><text><term>radioactive material</term> means nuclear material and other radioactive substances that contain nuclides that undergo spontaneous disintegration (a process accompanied by emission of one or more types of ionizing radiation, such as alpha-, beta-, neutron particles and gamma rays) and that may, owing to their radiological or fissile properties, cause death, serious bodily injury or substantial damage to property or to the environment;</text> </paragraph> <paragraph id="H019732994F9C4B5D89B985629BBDF6A7"><enum>(9)</enum><text><term>serious bodily injury</term> has the meaning given that term in section 831(f)(4) of this title;</text> </paragraph> 
<paragraph id="H9B6481DE6B7B45E3971471D9FF2659D6"><enum>(10)</enum><text><term>state</term> has the same meaning as that term has under international law, and includes all political subdivisions thereof;</text> </paragraph> <paragraph id="HD258740D5A0A459A8E91806F9806EA32"><enum>(11)</enum><text><term>state or government facility</term> has the meaning given that term in section 2332f(e)(3) of this title;</text> </paragraph> 
<paragraph id="H269E993F64324BBFBD58C2FE356F698A"><enum>(12)</enum><text><term>United States corporation or legal entity</term> means any corporation or other entity organized under the laws of the United States or any State, Commonwealth, territory, possession or district of the United States;</text> </paragraph> <paragraph id="H46B905DB373B47CA9E0A6C5340E53B24"><enum>(13)</enum><text><term>vessel</term> has the meaning given that term in section 1502(19) of title 33; and</text> </paragraph>
