 <section id="H731FA22A9A6943A380657E9AE7F60C25" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alaska Native Veterans Land Allotment Equity Act</short-title></quote>.</text> </section><section id="H45A57B17CAE14862B41818407E6C6064"><enum>2.</enum><header>Clarification regarding occupancy of Native allotments in national forests</header><text display-inline="no-display-inline">Section 18(a) of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1617">43 U.S.C. 1617(a)</external-xref>) is amended—</text>

United States</quote> (698 F.2d 987 (9th Cir. 1983), cert. denied (104 S. Ct. 73 (1983))) shall be reopened and considered to be approved pursuant to this paragraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="HBACBA39B3CFE4238BA7D542D6E9862B7"><enum>3.</enum><header>Open season for certain Alaska Native veterans for allotments</header><text display-inline="no-display-inline">Section 41 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1629g">43 U.S.C. 1629g</external-xref>) is amended—</text> <paragraph id="HA10ED09F5BA748A7A0869DFF00178DF2"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
 <subparagraph id="H286EEB62A1184E9387D1654BCBF331E0"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">In general</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Alaska Native veteran allotments</header-in-text></quote>;</text> </subparagraph><subparagraph id="HA6A407664FCB44F1A6453E5CEB8A4872"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraphs (1) through (4) and inserting the following:</text>

						<paragraph id="HDC72F87177AA4382B2F89404EBEF6A2A"><enum>(1)</enum><header>Allotments</header>
 <subparagraph id="H753B31C4ACCE4851B971FEAAFC1B2342"><enum>(A)</enum><header>Eligible recipients</header><text display-inline="yes-display-inline">Any person described in paragraph (1) or (2) of subsection (b) shall be eligible to receive an allotment under the Act of May 17, 1906 (34 Stat. 197, chapter 2469) (as in effect before December 18, 1971), of not more than 2 parcels of Federal land, the total area of which shall not exceed 160 acres. Any person described in paragraph (1) and (2) of subsection (b) who, prior to the date on which the Secretary promulgates regulations pursuant to section 4 of the Alaska Native Veterans Land Allotment Equity Act, received an allotment that has a total area of less than 160 acres shall be eligible to receive an allotment under the Act of May 17, 1906 (34 Stat. 197, chapter 2469) (as in effect before December 18, 1971), of not more than 1 parcel of Federal land, the total area of which shall not exceed the difference in acres between 160 acres and the total area of the allotment that the person previously received under the Act.</text>
 </subparagraph><subparagraph id="H9D132EE7B47D40C4910925D2A1EF44BD"><enum>(B)</enum><header>Filing deadline</header><text>An allotment shall be filed for an eligible recipient not later than 3 years after the date on which the Secretary promulgates regulations pursuant to section 4 of the <short-title>Alaska Native Veterans Land Allotment Equity Act</short-title>.</text>
							</subparagraph></paragraph><paragraph id="HA85F3EB36EEB41A88A150EC28276CDC9"><enum>(2)</enum><header>Land available for allotments</header>
 <subparagraph id="HB15D9B3BAFB946C18D15E56F53C7BCAC"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (C), an allotment under this section shall be selected from land that is—</text> <clause id="H3D93A9A211204C268CE45415EFB12CF6"><enum>(i)</enum> <subclause commented="no" display-inline="yes-display-inline" id="HDEA6CAE0B366423CB2BEC98C60A270B2"><enum>(I)</enum><text>vacant; and</text>
 </subclause><subclause changed="added" committee-id="HII00" id="H73408050ABDF4601B9C2A3718A7A9EA6" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>owned by the United States;</text> </subclause></clause><clause id="H0B173E66C164442BB66FA45DCEE5FA28"><enum>(ii)</enum><text>selected by, or conveyed to, the State of Alaska, if the State voluntarily relinquishes or conveys to the United States the land for the allotment; or</text>
 </clause><clause id="HB4F78E10E0104AD5AD457309F12BDDE9"><enum>(iii)</enum><text>selected by, or conveyed to, a Native Corporation, if the Native Corporation voluntarily relinquishes or conveys to the United States the land for the allotment.</text>
 </clause></subparagraph><subparagraph id="H00D14DE4CF0B4D7D94F96F9858F2FA33"><enum>(B)</enum><header>Relinquishment by Native Corporation</header><text>If a Native Corporation relinquishes land under subparagraph (A)(iii), the Native Corporation may select appropriate Federal land, as determined by the Secretary, the area of which is equal to the area of the land relinquished by the Native Corporation, to replace the relinquished land.</text>
 </subparagraph><subparagraph id="H95C75462468944A0A3AD63C50F7A5304"><enum>(C)</enum><header>Exclusions</header><text>An allotment under this section shall not be selected from land that is located within—</text> <clause id="HE5B9CDF2A5D84FFCA4F47D6C9D3A8828"><enum>(i)</enum><text>a right-of-way of the TransAlaska Pipeline;</text>
 </clause><clause id="H88ED0765F6D640E78B79800674A89ADE"><enum>(ii)</enum><text>an inner or outer corridor of such a right-of-way; or</text> </clause><clause id="H6F71804ED87344D39C515C5C0F993637"><enum>(iii)</enum><text>a unit of the National Park System, a National Preserve, or a National Monument.</text>
 </clause></subparagraph></paragraph><paragraph id="H9CB8058402194B819726E4C8DE3D6B7F"><enum>(3)</enum><header>Alternative allotments</header><text>A person described in paragraph (1) or (2) of subsection (b) who qualifies for an allotment under this section on land described in paragraph (2)(C) may select an alternative allotment from land that is—</text>
 <subparagraph id="HBE2A54FDA32A4AA6BBC4255CD38BCB61"><enum>(A)</enum><text>located within the boundaries of land described in paragraph (2)(C);</text> </subparagraph><subparagraph id="HBCF76CB9047A4E41B37571697C7F2A3D"><enum>(B)</enum> <clause commented="no" display-inline="yes-display-inline" id="H15227288EACA44148FCBBF04976A3701"><enum>(i)</enum> <subclause commented="no" display-inline="yes-display-inline" id="HA72DFD36F04F42769D341DDCF27A153D"><enum>(I)</enum><text>withdrawn under section 11(a)(1)(C); and</text>
 </subclause><subclause changed="added" committee-id="HII00" id="H2E03E7BF7ADB4BF6B84FD8E61CBC4C32" indent="up2" reported-display-style="italic"><enum>(II)</enum><text>not selected, or relinquished after selection, under section 11(a)(3);</text> </subclause></clause><clause changed="added" committee-id="HII00" id="HD4DEFCA59B734973A050B0F991343B48" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>contiguous to an outer boundary of land withdrawn under section 11(a)(1)(C); or</text>
 </clause><clause changed="added" committee-id="HII00" id="H0035EDD85F5440C8A7DE55A37EBF4765" indent="up1" reported-display-style="italic"><enum>(iii)</enum><text>vacant, unappropriated, and unreserved; and</text> </clause></subparagraph><subparagraph id="HB9E5D764C6294B82A3D1E054E0375C2E"><enum>(C)</enum><text>not a unit of the National Park System, a National Preserve, or a National Monument.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H3347D048339C4ECF9258DB1712325886"><enum>(C)</enum><text>by redesignating paragraphs (5) and (6) as paragraphs (4) and (5), respectively;</text> </subparagraph></paragraph><paragraph id="H8B83267E9B864481BB15FE57DD297CF8"><enum>(2)</enum><text>in subsection (b)—</text>
 <subparagraph id="H9E973EA44CE64A1E8C0302A0AA667557"><enum>(A)</enum><text>in paragraph (1), by striking subparagraph (B) and inserting the following:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H513B8B9BF34048A3BBE75E258A949EB8" reported-display-style="italic" style="OLC"> <subparagraph id="H3E247986C662476D90935773B488D3B5" indent="up1"><enum>(B)</enum><text>is a veteran who served during the period beginning on August 5, 1964, and ending on May 7, 1975.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H019C50BF692D4AD8ADBDB66C44793941"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text> <quoted-block changed="added" committee-id="HII00" id="HE9A88C09F88649EEAA74C37113C1B491" reported-display-style="italic"> <paragraph id="HFD37D5DD51134C93981379AD16086FB4"><enum>(2)</enum><header>Deceased persons</header><text>If an individual who would otherwise have been eligible for an allotment under this section dies before applying for an allotment, an heir of the person may apply for, and receive, an allotment under this section, on behalf of the estate of the person.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H85114E4A9325470ABF40F294C1E9D09F"><enum>(C)</enum><text display-inline="yes-display-inline">by striking paragraph (3) and inserting the following:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H3DB9E1BB15534C0AA78E10FC8B7B7E39" reported-display-style="italic" style="OLC"> <paragraph id="H6BCA9EA55AFC46D5AD5B763F8E99928D"><enum>(3)</enum><header>Limitations</header><text>No person who received an allotment or has a pending allotment under the Act of May 17, 1906, may receive an allotment under this section, other than—</text>
 <subparagraph id="HC2AE5CD7533E477C81552BB174C0BCA2"><enum>(A)</enum><text>an heir who applies for, and receives, an allotment on behalf of the estate of a deceased person under paragraph (2); and</text>
 </subparagraph><subparagraph id="H696F3A0C3F5B4EAC9B2B5E824EBD0886"><enum>(B)</enum><text>a person who, prior to the date on which the Secretary promulgates regulations pursuant to section 4 of the Alaska Native Veterans Land Allotment Equity Act, received an allotment under the Act of May 17, 1906 (34 Stat. 197, chapter 2469), that has a total area of less than 160 acres.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H1CF9CD38748E4BDF99327AE629C3B669"><enum>(3)</enum><text>by redesignating subsections (d) and (e) as subsections (f) and (g), respectively;</text> </paragraph><paragraph id="HDC28DCBE25884889AFFC591B40DED94D"><enum>(4)</enum><text>by inserting after subsection (c) the following:</text>
				<quoted-block changed="added" committee-id="HII00" id="HCDF7D13D6F4B419C823770653FFC750B" reported-display-style="italic">
					<subsection id="H426F2807F0CD434EA25C9A31D3DB1B67"><enum>(d)</enum><header>Approval of allotments</header>
 <paragraph id="H2956FDDFAA8A4A738E8DCD826B227C4D"><enum>(1)</enum><header>In general</header><text>Subject to any valid right in existence on the date of enactment of the <short-title>Alaska Native Veterans Land Allotment Equity Act</short-title>, and except as provided in paragraph (3), not later than December 31, 2020, the Secretary shall—</text> <subparagraph id="HF4308E8F175F4631B86022270990AD65"><enum>(A)</enum><text>approve any application for an allotment filed in accordance with subsection (a); and</text>
 </subparagraph><subparagraph id="HB106D64B44484A898C49D8CF958F1EA3"><enum>(B)</enum><text>issue a certificate of allotment under such terms, conditions, and restrictions as the Secretary determines to be appropriate.</text>
 </subparagraph></paragraph><paragraph id="H7A3DB236B5134050B0BD83B4740ED256"><enum>(2)</enum><header>Notification</header><text>Not later than December 31, 2017, on receipt of an application for an allotment under this section, the Secretary shall provide to any person or entity that has an interest in land described in subsection (a)(2) that is potentially adverse to the interest of the applicant a notice of the right of the person or entity, by not later than 90 days after the date of receipt of the notice—</text>
 <subparagraph id="HB2929686DB574A19A2B8B4F62373DEDC"><enum>(A)</enum><text>to initiate a private contest of the allotment; or</text> </subparagraph><subparagraph id="HC2305B2B3B3F4D70B70EF9C1D9D7ADB3"><enum>(B)</enum><text>to file a protest against the allotment in accordance with procedures established by the Secretary.</text>
 </subparagraph></paragraph><paragraph id="HA25E9E232605445D9D2EC754972C7BCD"><enum>(3)</enum><header>Action by Secretary</header><text>If a private contest or protest relating to an application for an allotment is initiated or filed under paragraph (2), the Secretary shall not issue a certificate for the allotment under paragraph (1)(B) until a final determination has been made with respect to the private contest or protest.</text>
 </paragraph></subsection><subsection id="HF9CF046BE22D48049EEC8B987BA788C0"><enum>(e)</enum><header>Reselection</header><text>A person that selected an allotment under this section may withdraw that selection and reselect land in accordance with this section after the date of enactment of the <short-title>Alaska Native Veterans Land Allotment Equity Act</short-title>, if the land originally selected—</text>
 <paragraph id="H45F747BD0DF44F3AB97DA02AC94B95FE"><enum>(1)</enum><text>was selected before the date of enactment of the <short-title>Alaska Native Veterans Land Allotment Equity Act</short-title>; and</text> </paragraph><paragraph id="H6C30B83227C049A1B28C847563C75BA9"><enum>(2)</enum><text>as of the date of enactment of that Act, was not conveyed to the person.</text></paragraph></subsection><after-quoted-block>; and </after-quoted-block></quoted-block>
 </paragraph><paragraph id="H693C5117034A4E5FA3392A2F7DC1C13D"><enum>(5)</enum><text display-inline="yes-display-inline">by striking subsection (f), as designated by paragraph (3) and inserting:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="HF22219A00A7F432991B7FBF184DC3949" reported-display-style="italic" style="OLC"> <subsection id="H3391F43F024E4ADBA6070B6612058016"><enum>(f)</enum><header>Definitions</header><text>For the purposes of this section:</text>
 <paragraph id="H7505A8E6A2C849DC92D219587EB909FF"><enum>(1)</enum><text>The term <quote>veteran</quote> means a person who served in the active military, naval, or air service, and who was discharged or released therefrom.</text>
 </paragraph><paragraph id="HB5A7F9D8320A402D95354969120CF8BE"><enum>(2)</enum><text>The term <quote>Vietnam era</quote> has the meaning given the term by paragraph (29) of section 101 of title 38.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="HBAA10C253DED42D6AC7DC0AB5146F609"><enum>4.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of the Interior shall promulgate, after consultation with Alaska Native organizations, final regulations to carry out the amendments made by this Act. During the consultation process, the Secretary shall, in coordination with Alaska Native organizations and to the greatest extent possible, identify persons who are eligible to receive an allotment under section 3 of this Act. Upon promulgation of the final regulations, the Secretary shall contact each of these persons directly to provide an explanation of the process by which the person may apply for an allotment under section 3 of this Act.</text>
