<official-title display="yes">To place the Financial Stability Oversight Council and the Office of Financial Research under the regular appropriations process, to provide for certain quarterly reporting and public notice and comment requirements for the Office of Financial Research, and for other purposes.</official-title>

<section id="HF0D237F4F6FE45ED82609E5CE5F0C226" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financial Stability Oversight Council Reform Act</short-title></quote>.</text></section> <section id="HB1C22D08516E4E95B4485A6F1FE29290"><enum>2.</enum><header>Funding</header> <subsection id="H326472FDF86846ADBB8A77D538DA8CE2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 155 of the Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5345">12 U.S.C. 5345</external-xref>) is amended—</text> 
<paragraph id="HB16579BD306845339EC1C88BD36D641C"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="H258BEBA1C3EA45AA9022E51D044E1B05"><enum>(A)</enum><text>in paragraph (1), by striking <quote>be immediately available to the Office</quote> and inserting <quote>be available to the Office, as provided for in appropriation Acts</quote>;</text></subparagraph> 
<subparagraph id="HD500AE5DCE8E4B2BA10B0B3AC82AB440"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (2); and</text></subparagraph> <subparagraph id="H6EC2743956D44CDD9642FF6DE8656F25"><enum>(C)</enum><text>by redesignating paragraph (3) as paragraph (2); and</text></subparagraph></paragraph> 
<paragraph id="H1C2586DE70674993A6053B30A9CEF0D0"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d), by amending the heading to read as follows: <quote><header-in-text level="subsection" style="OLC">Assessment schedule.—</header-in-text></quote>.</text></paragraph></subsection> <subsection id="H4A8EB34BD37A428A9A64B465C8AAC7CB"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2016.</text></subsection></section> 
<section id="HCCBD6F7ECDCD4BB5A097C4ED8EEDA6B5"><enum>3.</enum><header>Quarterly reporting</header><text display-inline="no-display-inline">Section 153 of the Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5343">12 U.S.C. 5343</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="HDF8AD03F9EF04628B018E72B6EF7A0C7" display-inline="no-display-inline"> <subsection id="HF261DC6C8C3644D6A3B9C06F69887185"><enum>(g)</enum><header>Quarterly reporting</header> <paragraph id="H1F6F9EE754A44138BC7FB4A1FF9AE677"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the end of each quarter, the Office shall submit reports on the Office’s activities to the Committees on Appropriations of the House of Representatives and the Senate, the Committee on Financial Services of the House of Representatives, and the Committee on Banking, Housing, and Urban Affairs of the Senate.</text></paragraph> 
<paragraph id="HA87DC0E10A084CE79CD7431E9A28CFFD"><enum>(2)</enum><header>Contents</header><text>The reports required under paragraph (1) shall include—</text> <subparagraph id="H78F6DD935A414537BBB37CF822929E9C"><enum>(A)</enum><text>the obligations made during the previous quarter by object class, office, and activity;</text></subparagraph> 
<subparagraph id="HF814C1CBE21D46A59A9E4A8F86D8AD79"><enum>(B)</enum><text>the estimated obligations for the remainder of the fiscal year by object class, office, and activity;</text></subparagraph> <subparagraph id="H51E8B3811E7046B78B30E851E686D5B0"><enum>(C)</enum><text>the number of full-time equivalents within the Office during the previous quarter;</text></subparagraph> 
<subparagraph id="HF3BAC77F3D1F4E0D8A859B8A10FBEDE2"><enum>(D)</enum><text>the estimated number of full-time equivalents within each office for the remainder of the fiscal year; and</text></subparagraph> <subparagraph id="H844BC097AB734DB5A55BF063882501EF"><enum>(E)</enum><text>actions taken to achieve the goals, objectives, and performance measures of the Office.</text></subparagraph></paragraph> 
<paragraph id="HB0324AD501D94AC3BD936D9A55AF9F33"><enum>(3)</enum><header>Testimony</header><text>At the request of any committee specified under paragraph (1), the Office shall make officials available to testify on the contents of the reports required under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H6FA88604D6FD46B7B6B05FAA800639C1"><enum>4.</enum><header>Public notice and comment period</header><text display-inline="no-display-inline">Section 153(c) of the Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5343">12 U.S.C. 5343(c)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H0B27DAB8514A4FA6B91D756457CBF785"><enum>(3)</enum><header>Public notice and comment period</header><text display-inline="yes-display-inline">The Office shall provide for a public notice and comment period of not less than 90 days before issuing any proposed report, rule, or regulation.</text></paragraph> <paragraph id="HEED73653177F4125A4A13053BC8DE169"><enum>(4)</enum><header>Additional report requirements</header> <subparagraph id="HF295DDC0717E4790B9341F0F882613A8"><enum>(A)</enum><header>In general</header><text>Except as provided under paragraph (3), the requirements under section 553 of title 5, United States Code, shall apply to a proposed report of the Office to the same extent as such requirements apply to a proposed rule of the Office.</text></subparagraph> 
<subparagraph id="HBC5BED9A97AE4ACF86F9EED938F88F19"><enum>(B)</enum><header>Exception for certain reports</header><text display-inline="yes-display-inline">This paragraph and paragraph (3) shall not apply to a report required under subsection (g)(1) or section 154(d)(1).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H1FDEAAE288C54350B7C0D6E150AEC6C5" section-type="subsequent-section"><enum>5.</enum><header>Additional duties of the Office of Financial Research</header><text display-inline="no-display-inline">Section 153 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5343">12 U.S.C. 5343</external-xref>), as amended by section 3, is further amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="HB115DA40C5034D669333BEC532884FC7" style="OLC"> 
<subsection id="H13797B7372B44AC8AFBB800A6EB68765"><enum>(h)</enum><header>Additional duties</header> 
<paragraph id="H3FFAA22927744781971092E2391BB8D7"><enum>(1)</enum><header>Annual work plan</header> 
<subparagraph id="HBB2FA97BA6E044F0910265EEBCA58664"><enum>(A)</enum><header>In general</header><text>The Director shall, after a period of 60 days for public notice and comment, annually publish a detailed work plan concerning the priorities of the Office for the upcoming fiscal year.</text></subparagraph> <subparagraph id="HFD3F2D7E9A6D4901B9D86F9F1DADB8D8"><enum>(B)</enum><header>Requirements</header><text>The work plan shall include the following:</text> 
<clause id="H5F3E05DCBE9D4B2081330A3F46C5D2F9"><enum>(i)</enum><text>A unique alphanumeric identifier and detailed description of any report, study, working paper, grant, guidance, data collection, or request for information that is expected to be in progress during, or scheduled to begin in, the upcoming fiscal year.</text></clause> <clause id="HE777DFC042F7474A89BEFB96B6FE4B0A"><enum>(ii)</enum><text>For each item listed under clause (i), a target date for any significant actions related to such item, including the target date—</text> 
<subclause id="H8E6089339B7D4DB987392FCF590DB2E3"><enum>(I)</enum><text>for the release of a report, study, or working paper;</text></subclause> <subclause id="HC5AE7DBAC45F4FF0B9734253DAA023ED"><enum>(II)</enum><text>for, and topics of, a meeting of a working paper group and each solicitation of applications for grants; and</text></subclause> 
<subclause id="HBD62BDCC440349A89206BAE96E48908C"><enum>(III)</enum><text>for the issuance of guidance, data collections, or requests for information.</text></subclause></clause> <clause id="H23AD976E9BF94007B6F61231F426965B"><enum>(iii)</enum><text>A list of all technical and professional advisory committees that is expected to be convened in the upcoming fiscal year pursuant to section 152(h).</text></clause> 
<clause id="HD20D6E5D9FE84891AC2C0868BDA25E54"><enum>(iv)</enum><text display-inline="yes-display-inline">The name and professional affiliations of each individual who served during the previous fiscal year as an academic or professional fellow pursuant to section 152(i).</text></clause> <clause id="H9C296565BE154E589DC7C1FCBD5CF5EB"><enum>(v)</enum><text display-inline="yes-display-inline">A detailed description of the progress made by primary financial regulatory agencies in adopting a unique alphanumeric system to identify legally distinct entities that engage in financial transactions (commonly known as a <quote>Legal Entity Identifier</quote>), including a list of regulations requiring the use of such a system and actions taken to ensure the adoption of such a system by primary financial regulatory agencies.</text></clause></subparagraph></paragraph> 
<paragraph id="H41AD688AD01E4A01A46CCB088A13EC82"><enum>(2)</enum><header>Public reports</header> 
<subparagraph id="HE7FEBE633073484DB17FBB9CB9346D4B"><enum>(A)</enum><header>Consultation</header><text display-inline="yes-display-inline">In preparing any public report with respect to a specified entity, class of entities, or financial product or service, the Director shall consult with any Federal department or agency with expertise in regulating the entity, class of entities, or financial product or service.</text></subparagraph> <subparagraph id="H3E4381503E8A409DABEAF1A89997A033"><enum>(B)</enum><header>Report requirements</header><text>A public report described in subparagraph (A) shall include—</text> 
<clause id="HD53BE7104D6F484596051EB830E33C64"><enum>(i)</enum><text>an explanation of any changes made as a result of a consultation under this subparagraph and, with respect to any changes suggested in such consultation that were not made, the reasons that the Director did not incorporate such changes; and</text></clause> <clause id="HE911085163B242689AC4E872548BE213"><enum>(ii)</enum><text>information on the date, time, and nature of such consultation.</text></clause></subparagraph> 
<subparagraph id="HD463F9DAD4AD43A3BFDC42784ECF738E"><enum>(C)</enum><header>Notice and comment</header><text>Before issuing any public report described in subparagraph (A), the Director shall provide a period of 90 days for public notice and comment on the report.</text></subparagraph></paragraph> <paragraph id="HCF7416C8C02C4DB8BF04FE6771BCDD02"><enum>(3)</enum><header>Cybersecurity plan</header> <subparagraph id="H0AED5D4883BF46AE8BD512AB0D5F8135"><enum>(A)</enum><header>In general</header><text>The Office shall develop and implement a cybersecurity plan that uses appropriate safeguards that are adequate to protect the integrity and confidentiality of the data in the possession of the Office.</text></subparagraph> 
<subparagraph id="H768B8B8C77744BFF9D5EA877303ECB65"><enum>(B)</enum><header>GAO review</header><text>The Comptroller General of the United States shall annually audit the cybersecurity plan and its implementation described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> <attestation><attestation-group><attestation-date date="20160414" chamber="House">Passed the House of Representatives April 14, 2016.</attestation-date><attestor display="no">Karen L.
