 sixteen</enrolled-dateline><legis-num display="yes">S. 2040</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To deter terrorism, provide justice for victims, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice Against Sponsors of Terrorism Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id25dbbd7d031f4ac5a4292623071a316d" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings and purpose</header><subsection commented="no" display-inline="no-display-inline" id="id1f930d5bab1740688e0e8a599b2e38eb"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id9137a9124bdd49f4bd45f6a2493d93da"><enum>(1)</enum><text display-inline="yes-display-inline">International terrorism is a serious and deadly problem that threatens the vital interests of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcbe454365c044f90986f0f524da8a16b"><enum>(2)</enum><text display-inline="yes-display-inline">International terrorism affects the interstate and foreign commerce of the United States by harming international trade and market stability, and limiting international travel by United States citizens as well as foreign visitors to the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida64685b747ea46cbb4617ae87da370e8"><enum>(3)</enum><text display-inline="yes-display-inline">Some foreign terrorist organizations, acting through affiliated groups or individuals, raise significant funds outside of the United States for conduct directed and targeted at the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1636b550b5e4013864379f1af8545fa"><enum>(4)</enum><text display-inline="yes-display-inline">It is necessary to recognize the substantive causes of action for aiding and abetting and conspiracy liability under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48c28ba45f434cf89bbbbbd0d7ba5588"><enum>(5)</enum><text display-inline="yes-display-inline">The decision of the United States Court of Appeals for the District of Columbia in Halberstam v. Welch, 705 F.2d 472 (D.C. Cir. 1983), which has been widely recognized as the leading case regarding Federal civil aiding and abetting and conspiracy liability, including by the Supreme Court of the United States, provides the proper legal framework for how such liability should function in the context of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd2966face63f4a17a8d4737a1d05fe3f"><enum>(6)</enum><text display-inline="yes-display-inline">Persons, entities, or countries that knowingly or recklessly contribute material support or resources, directly or indirectly, to persons or organizations that pose a significant risk of committing acts of terrorism that threaten the security of nationals of the United States or the national security, foreign policy, or economy of the United States, necessarily direct their conduct at the United States, and should reasonably anticipate being brought to court in the United States to answer for such activities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id921f4d8c79a14bdfb313a91645450709"><enum>(7)</enum><text display-inline="yes-display-inline">The United States has a vital interest in providing persons and entities injured as a result of terrorist attacks committed within the United States with full access to the court system in order to pursue civil claims against persons, entities, or countries that have knowingly or recklessly provided material support or resources, directly or indirectly, to the persons or organizations responsible for their injuries.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf751b6e74b3746d4bc632da4e85f8cdd"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to provide civil litigants with the broadest possible basis, consistent with the Constitution of the United States, to seek relief against persons, entities, and foreign countries, wherever acting and wherever they may be found, that have provided material support, directly or indirectly, to foreign organizations or persons that engage in terrorist activities against the United States.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id562072f52d6147ad87f0da85893e89d5" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Responsibility of foreign states for international terrorism against the United States</header><subsection commented="no" display-inline="no-display-inline" id="id74d71114969a44b895094e2267c23bca"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">Chapter 97</external-xref> of title 28, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/28/1605A">section 1605A</external-xref> the following:</text><quoted-block display-inline="no-display-inline" id="idE38C2D53C9974F83853B506527869447" style="USC"><section commented="no" display-inline="no-display-inline" id="id24AE3D725E134AC094AC9E38B78B3A03" section-type="subsequent-section"><enum>1605B.</enum><header display-inline="yes-display-inline">Responsibility of foreign states for international terrorism against the United States</header><subsection commented="no" display-inline="no-display-inline" id="idCA684690151641BC9902AD4725F7B2DE"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>international terrorism</term>—</text><paragraph commented="no" display-inline="no-display-inline" id="idF7480D85CCC745759C585567F1423420"><enum>(1)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 2331 of title 18, United States Code; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61B25527E7AB4B27A28CC67450217419"><enum>(2)</enum><text display-inline="yes-display-inline">does not include any act of war (as defined in that section).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id33E79390E4DD433AB4902665CE800567"><enum>(b)</enum><header display-inline="yes-display-inline">Responsibility of foreign states</header><text display-inline="yes-display-inline">A foreign state shall not be immune from the jurisdiction of the courts of the United States in any case in which money damages are sought against a foreign state for physical injury to person or property or death occurring in the United States and caused by—</text><paragraph commented="no" display-inline="no-display-inline" id="id5894f02197bf408f93f4a58522a34196"><enum>(1)</enum><text display-inline="yes-display-inline">an act of international terrorism in the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbc79e4456571492c8e2521e507ee10f4"><enum>(2)</enum><text display-inline="yes-display-inline">a tortious act or acts of the foreign state, or of any official, employee, or agent of that foreign state while acting within the scope of his or her office, employment, or agency, regardless where the tortious act or acts of the foreign state occurred.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE9DB819649234237A7F40AE60517870D"><enum>(c)</enum><header display-inline="yes-display-inline">Claims by nationals of the United States</header><text display-inline="yes-display-inline">Notwithstanding section 2337(2) of title 18, a national of the United States may bring a claim against a foreign state in accordance with section 2333 of that title if the foreign state would not be immune under subsection (b).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc33a2fb7446846488f6623bd0018cfac"><enum>(d)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">A foreign state shall not be subject to the jurisdiction of the courts of the United States under subsection (b) on the basis of an omission or a tortious act or acts that constitute mere negligence.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id3d833750bfef4ce4bd15fb727eee9100"><enum>(b)</enum><header display-inline="yes-display-inline">Technical and conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="idE5FD6EBE2E9C4CAAB356A6648EB46983"><enum>(1)</enum><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">chapter 97</external-xref> of title 28, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/28/1605A">section 1605A</external-xref> the following:</text><quoted-block display-inline="no-display-inline" id="id9294e0e3-f9c3-42d8-87c8-8be3cb8443e4" style="USC"><toc><toc-entry bold="off" idref="id24AE3D725E134AC094AC9E38B78B3A03" level="section">1605B. Responsibility of foreign states for international terrorism against the United States.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDEC343B3CDA0429D961E088C9E9C5E38"><enum>(2)</enum><text display-inline="yes-display-inline">Subsection 1605(g)(1)(A) of title 28, United States Code, is amended by inserting <quote>or section 1605B</quote> after <quote>but for section 1605A</quote>.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id83cbdafc7f694bdd8531a5e1081a3e00" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Aiding and abetting liability for civil actions regarding terrorist acts</header><subsection commented="no" display-inline="no-display-inline" id="id991dfd78cd4d4e76a02f576bdf0403b2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 2333 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idcde1e6bec4e5457086750dcd713ca678" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id7ae528f445e14545a1d0beb0a95740a1"><enum>(d)</enum><header display-inline="yes-display-inline">Liability</header><paragraph commented="no" display-inline="no-display-inline" id="id30A4442074554AFEAD680AB806BA689B"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>person</term> has the meaning given the term in section 1 of title 1.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE6D7A77DB2754FD19AC65B87609E2431"><enum>(2)</enum><header display-inline="yes-display-inline">Liability</header><text display-inline="yes-display-inline">In an action under subsection (a) for an injury arising from an act of international terrorism committed, planned, or authorized by an organization that had been designated as a foreign terrorist organization under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>), as of the date on which such act of international terrorism was committed, planned, or authorized, liability may be asserted as to any person who aids and abets, by knowingly providing substantial assistance, or who conspires with the person who committed such an act of international terrorism.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id0bd1a0706ec245e0ba80302e47d2ab0d"><enum>(b)</enum><header display-inline="yes-display-inline">Effect on Foreign Sovereign Immunities Act</header><text display-inline="yes-display-inline">Nothing in the amendment made by this section affects immunity of a foreign state, as that term is defined in section 1603 of title 28, United States Code, from jurisdiction under other law.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idb797994de1684fb6a3b0a6327658f86c" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Stay of actions pending state negotiations</header><subsection commented="no" display-inline="no-display-inline" id="id4adb4f6add2543ac817c0254793dd65f"><enum>(a)</enum><header display-inline="yes-display-inline">Exclusive jurisdiction</header><text display-inline="yes-display-inline">The courts of the United States shall have exclusive jurisdiction in any action in which a foreign state is subject to the jurisdiction of a court of the United States under section 1605B of title 28, United States Code, as added by section 3(a) of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id36bbd92d26d04585be4104240fc7fef4"><enum>(b)</enum><header display-inline="yes-display-inline">Intervention</header><text display-inline="yes-display-inline">The Attorney General may intervene in any action in which a foreign state is subject to the jurisdiction of a court of the United States under section 1605B of title 28, United States Code, as added by section 3(a) of this Act, for the purpose of seeking a stay of the civil action, in whole or in part.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf3d9a5fce74a4bf0a98c191ddf56c5b9"><enum>(c)</enum><header display-inline="yes-display-inline">Stay</header><paragraph commented="no" display-inline="no-display-inline" id="id43D972931F1540D8A835F60B5350B1A1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A court of the United States may stay a proceeding against a foreign state if the Secretary of State certifies that the United States is engaged in good faith discussions with the foreign state defendant concerning the resolution of the claims against the foreign state, or any other parties as to whom a stay of claims is sought.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9e7c2a051af4bc3a74fac947e0222a1"><enum>(2)</enum><header display-inline="yes-display-inline">Duration</header><subparagraph commented="no" display-inline="no-display-inline" id="id7E52ACD3F93A4D738C1D3E753E01AE44"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A stay under this section may be granted for not more than 180 days.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3327A5372BF44D709D8CDA494D579B78"><enum>(B)</enum><header display-inline="yes-display-inline">Extension</header><clause commented="no" display-inline="no-display-inline" id="id40697F39AAB84FDEBEA210D62F01219C"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General may petition the court for an extension of the stay for additional 180-day periods.</text></clause><clause commented="no" display-inline="no-display-inline" id="id966A24DF918A46078895CA70EEAEB57C"><enum>(ii)</enum><header display-inline="yes-display-inline">Recertification</header><text display-inline="yes-display-inline">A court shall grant an extension under clause (i) if the Secretary of State recertifies that the United States remains engaged in good faith discussions with the foreign state defendant concerning the resolution of the claims against the foreign state, or any other parties as to whom a stay of claims is sought.</text></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9fc5fd9180aa444cb97c363eefd97531" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Severability</header><text display-inline="no-display-inline">If any provision of this Act or any amendment made by this Act, or the application of a provision or amendment to any person or circumstance, is held to be invalid, the remainder of this Act and the amendments made by this Act, and the application of the provisions and amendments to any other person not similarly situated or to other circumstances, shall not be affected by the holding.</text></section><section commented="no" display-inline="no-display-inline" id="id32301968a4d84c348d0f44af49289fb7" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to any civil action—</text><paragraph commented="no" display-inline="no-display-inline" id="id6e57539d39024ffbb9faa61f593c3d79"><enum>(1)</enum><text display-inline="yes-display-inline">pending on, or commenced on or after, the date of enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id388cd1816c0b48fc96854d5bf6ada81b"><enum>(2)</enum><text display-inline="yes-display-inline">arising out of an injury to a person, property, or business on or after September 11, 2001.</text></paragraph></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of
