<congress display="yes">114th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 2328</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To reauthorize and amend the National Sea Grant College Program Act, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="id5e29c945-c851-4e38-ad18-4f75d2e9ca34" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Sea Grant College Program Amendments Act of 2015</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id848d7d73-b471-4dca-9b5f-d8c34a971593" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">References to the National Sea Grant College Program Act</header><text display-inline="no-display-inline">Except as otherwise expressly provided, wherever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1121">33 U.S.C. 1121 et seq.</external-xref>).</text></section><section commented="no" display-inline="no-display-inline" id="id92761b63-7b33-4081-b5b5-e9b7ed2033ae" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Modification of Dean John A. Knauss Marine Policy Fellowship</header><subsection commented="no" display-inline="no-display-inline" id="id70a090c8-62cb-4347-8b06-75622b34e3ab"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 208(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1127">33 U.S.C. 1127(b)</external-xref>) is amended by striking <quote>may</quote> and inserting <quote>shall</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id621d597e-4bb6-49fa-9bd5-837ce16d1c2e"><enum>(b)</enum><header display-inline="yes-display-inline">Placements in Congress</header><text display-inline="yes-display-inline">Such section is further amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id08aeeb78-efc0-43ae-b98e-bf4cbf42ff0a"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id58d67e70-17db-4249-9198-14b7d69f242c" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idc481f9da-8d9a-4900-b42c-807627823a63"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90086a41-2867-4f9f-ac96-c17b3756dd61"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1), as designated by paragraph (1), in the second sentence, by striking <quote>A fellowship</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idf0990e07-7a78-4c23-8f5a-bd5fcd077d12" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idcdb4c20a-4978-4f7a-8240-1bf1ee685cb9"><enum>(2)</enum><header display-inline="yes-display-inline">Placement priorities</header><subparagraph commented="no" display-inline="no-display-inline" id="id19211ff3-d1d7-42c8-93d5-2792eb52d208"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In each year in which the Secretary awards a legislative fellowship under this subsection, when considering the placement of fellows, the Secretary shall prioritize placement of fellows in the following:</text><clause commented="no" display-inline="no-display-inline" id="idb1368edc-d0ac-4ff6-a71b-213819297cd2"><enum>(i)</enum><text display-inline="yes-display-inline">Positions in offices of, or with members on, committees of Congress that have jurisdiction over the National Oceanic and Atmospheric Administration.</text></clause><clause commented="no" display-inline="no-display-inline" id="idc1a2fcaa-5d35-4749-8c22-4b9eec75b777"><enum>(ii)</enum><text display-inline="yes-display-inline">Positions in offices of members of Congress that have a demonstrated interest in ocean, coastal, or Great Lakes resources.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2c04fb38-1b90-4c3a-8259-883e895e7e77"><enum>(B)</enum><header display-inline="yes-display-inline">Equitable distribution</header><text display-inline="yes-display-inline">In placing fellows in offices described in subparagraph (A), the Secretary shall ensure, to the maximum degree practicable, that placements are equitably distributed among the political parties.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a13e824-e283-4eab-8469-c252183b61ba"><enum>(3)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">A fellowship</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3db38c78-6fc8-43d6-a834-afd0abf6b951"><enum>(c)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (b) shall apply with respect to the first calendar year beginning after the date of enactment of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf181a226-96f1-4b30-8837-4f7a13acacb0"><enum>(d)</enum><header display-inline="yes-display-inline">Sense of Congress concerning Federal hiring of former fellows</header><text display-inline="yes-display-inline">It is the sense of Congress that in recognition of the competitive nature of the fellowship under section 208(b) of the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1127">33 U.S.C. 1127(b)</external-xref>), and of the exceptional qualifications of fellowship awardees, the Secretary of Commerce, acting through the Under Secretary of Commerce for Oceans and Atmosphere, should encourage participating Federal agencies to consider opportunities for fellowship awardees at the conclusion of their fellowship for workforce positions appropriate for their education and experience.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idba9dc3e1-d85d-423b-81fb-d04b4972c47a" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Modification of authority of Secretary of Commerce to accept donations for National Sea Grant
 College Program</header><subsection commented="no" display-inline="no-display-inline" id="id91c1c0d0-0413-42f6-8091-a1c13d46040e"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 204(c)(4)(E) (<external-xref legal-doc="usc" parsable-cite="usc/33/1123">33 U.S.C. 1123(c)(4)(E)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="ide9ff31dd-6921-4780-adef-27286d5a911d" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="id6b600b46-1610-4e1c-a4ef-2538545bb993"><enum>(E)</enum><text display-inline="yes-display-inline">accept donations of money and, notwithstanding section 1342 of title 31, United States Code, of voluntary and uncompensated services;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id16038281-e2de-4a0a-a5a8-7f0a8940c4a2"><enum>(b)</enum><header display-inline="yes-display-inline">Priorities</header><text display-inline="yes-display-inline">The Secretary of Commerce, acting through the Under Secretary of Commerce for Oceans and Atmosphere, shall establish priorities for the use of donations accepted under section 204(c)(4)(E) of the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1123">33 U.S.C. 1123(c)(4)(E)</external-xref>), and shall consider among those priorities the possibility of expanding the Dean John A. Knauss Marine Policy Fellowship's placement of additional fellows in relevant legislative offices under section 208(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1127">33 U.S.C. 1127(b)</external-xref>), in accordance with the recommendations under subsection (c) of this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd5526a27-1c67-4389-ad68-8e6b5a2fae56"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of the National Sea Grant College Program, in consultation with the National Sea Grant Advisory Board and the Sea Grant Association, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id74bb265d-fc33-425d-ace8-2e9114572d5b"><enum>(1)</enum><text display-inline="yes-display-inline">develop recommendations for the optimal use of any donations accepted under section 204(c)(4)(E) of the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1123">33 U.S.C. 1123(c)(4)(E)</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a68b75f-58be-4d7f-ad46-ee915d731b26"><enum>(2)</enum><text display-inline="yes-display-inline">submit to Congress a report on the recommendations developed under paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6aadf355-9fe4-4eeb-9549-1ab2ce6869d6"><enum>(d)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to limit or otherwise affect any other amounts available for marine policy fellowships under section 208(b) of the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1127">33 U.S.C. 1127(b)</external-xref>), including amounts—</text><paragraph commented="no" display-inline="no-display-inline" id="id5e718a41-db69-4f64-af7c-8ecf4e52d8d8"><enum>(1)</enum><text display-inline="yes-display-inline">accepted under section 204(c)(4)(F) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1123">33 U.S.C. 1123(c)(4)(F)</external-xref>); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4fc09c55-ecc3-4b6c-82b0-425840c22c3e"><enum>(2)</enum><text display-inline="yes-display-inline">appropriated under section 212 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1131">33 U.S.C. 1131</external-xref>).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idddbcd783-fe66-48d7-b1a8-a5d2cded5fd8" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Repeal of requirement for report on coordination of oceans and coastal research activities</header><text display-inline="no-display-inline">Section 9 of the National Sea Grant College Program Act Amendments of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/33/857-20">33 U.S.C. 857–20</external-xref>) is repealed.</text></section><section commented="no" display-inline="no-display-inline" id="id76216a0d-8bbc-4be5-bee7-6c3ee47ea0fe" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Reduction in frequency required for National Sea Grant Advisory Board report</header><text display-inline="no-display-inline">Section 209(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/33/1128">33 U.S.C. 1128(b)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id1b699e69-9a69-49eb-ac4f-39f022beaeea"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">Biennial</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Periodic</header-in-text></quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb82c5f1f-f69e-4621-8fa6-44a5cdf8f6d4"><enum>(2)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>The Board shall report to the Congress every two years</quote> and inserting <quote>Not less frequently than once every 3 years, the Board shall submit to Congress a report</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id2a4e302d-7336-4f43-80a3-a885c425dbc6" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Modification of elements of National Sea Grant College Program</header><text display-inline="no-display-inline">Section 204(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1123">33 U.S.C. 1123(b)</external-xref>) is amended, in the matter before paragraph (1), by inserting <quote>for research, education, extension, training, technology transfer, and public service</quote> after <quote>financial assistance</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id45180D7F62A7406AA545EF1C1F33BE0C" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Direct hire authority; Dean John A. Knauss Marine Policy Fellowship</header><subsection commented="no" display-inline="no-display-inline" id="idA108654E529346B58CFC5937345CB5AF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">During fiscal year 2016 and thereafter, the head of any Federal agency may appoint, without regard to the provisions of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, other than sections 3303 and 3328 of that title, a qualified candidate described in subsection (b) directly to a position with the Federal agency for which the candidate meets Office of Personnel Management qualification standards.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6B8288D84A264999B55A4769AD6C5B7A"><enum>(b)</enum><header display-inline="yes-display-inline">Dean John A. Knauss Marine Policy Fellowship</header><text display-inline="yes-display-inline">Subsection (a) applies with respect to a former recipient of a Dean John A. Knauss Marine Policy Fellowship under section 208(b) of the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1127">33 U.S.C. 1127(b)</external-xref>) who—</text><paragraph commented="no" display-inline="no-display-inline" id="idC3FF2EC991C044B3B49798E7EF8C113A"><enum>(1)</enum><text display-inline="yes-display-inline">earned a graduate or post-graduate degree in a field related to ocean, coastal and Great Lakes resources or policy from an accredited institution of higher education; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF3CEDE4EAFDD4E069507131D0F9D0BA6"><enum>(2)</enum><text display-inline="yes-display-inline">successfully fulfilled the requirements of the fellowship within the executive or legislative branch of the United States Government.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id01FB1027A8494689A299D8EF7F6E12CF"><enum>(c)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The direct hire authority under this section shall be exercised with respect to a specific qualified candidate not later than 2 years after the date that the candidate completed the fellowship.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id88c62c75-4ef4-416d-821a-da62b14cab34" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Authorization of appropriations for National Sea Grant College Program</header><subsection commented="no" display-inline="no-display-inline" id="ided4ac0d2-d7a8-419a-97f9-bfe5842c9158"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 212(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1131">33 U.S.C. 1131(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id170dc617-cded-44ba-9f11-9bfae00e5f49"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id53b2717c-7de5-4b82-ac04-d64cecb19ce9"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29fbd264-b5ab-4c8f-94f8-a6cd0ab5be6e"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (F), by striking the period at the end and inserting <quote>;</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6891a627-1df1-4b91-913f-e811080218e5"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id7ab21e52-62ec-48aa-959a-b47210bb7e03" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="idc576cecb-71ec-45f7-91d0-4de8d029b65b"><enum>(G)</enum><text display-inline="yes-display-inline">$72,000,000 for fiscal year 2015;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2a311778-42fc-4a3c-9f03-43b8d1985442"><enum>(H)</enum><text display-inline="yes-display-inline">$75,600,000 for fiscal year 2016;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idea2d7084-98d5-41db-bbb3-d933201e5a62"><enum>(I)</enum><text display-inline="yes-display-inline">$79,380,000 for fiscal year 2017;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ed8bd93-2c14-407f-a8ad-2bced7f9a11b"><enum>(J)</enum><text display-inline="yes-display-inline">$83,350,000 for fiscal year 2018;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24422a79-0482-4ee2-b075-453e845cc039"><enum>(K)</enum><text display-inline="yes-display-inline">$87,520,000 for fiscal year 2019;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida3964208-f921-4fb1-bf64-fd629f40b91c"><enum>(L)</enum><text display-inline="yes-display-inline">$91,900,000 for fiscal year 2020; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0ce68516-1894-416b-9393-ee6a259cc908"><enum>(M)</enum><text display-inline="yes-display-inline">$96,500,000 for fiscal year 2021.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7cc34cf1-6d6a-49ba-b09d-b1c9ccbb1550"><enum>(2)</enum><text display-inline="yes-display-inline">in the heading for paragraph (2), by inserting <quote><header-in-text level="paragraph" style="OLC">for fiscal years 2009 through 2014</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">Priority activities</header-in-text></quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0883eebb-6377-4d6a-8116-8d9b5e3b93a3"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id5f63b4a4-7f5c-4217-8e17-592c0facd860" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idea2fe479-7110-43b1-ad50-dc1da787a917"><enum>(3)</enum><header display-inline="yes-display-inline">Priority activities for fiscal years 2015 through 2020</header><text display-inline="yes-display-inline">In addition to the amounts authorized under paragraph (1), there is authorized to be appropriated $6,000,000 for each of fiscal years 2015 through 2020 for competitive grants for the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="idc08a2c4d-a31a-4c00-b7c0-2fd0e31ac997"><enum>(A)</enum><text display-inline="yes-display-inline">University research on the biology, prevention, and control of aquatic nonnative species.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id691a5763-bce1-4e4a-856e-afe6118f6629"><enum>(B)</enum><text display-inline="yes-display-inline">University research on oyster diseases, oyster restoration, and oyster-related human health risks.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide3e067bd-9ece-4031-89e1-f7dc6a6636a6"><enum>(C)</enum><text display-inline="yes-display-inline">University research on the biology, prevention, and forecasting of harmful algal blooms.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3586d880-76da-4354-afd6-31abf612b6aa"><enum>(D)</enum><text display-inline="yes-display-inline">University research, education, training, and extension services and activities focused on coastal resilience and U.S. working waterfronts and other regional or national priority issues identified in the strategic plan under section 204(c)(1).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id47dce7e4-c490-4e30-8a7f-7dec3dae4c24"><enum>(E)</enum><text display-inline="yes-display-inline">University research on sustainable aquaculture techniques and technologies.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide08bbd4b-644c-424a-b265-95309f1c1a57"><enum>(F)</enum><text display-inline="yes-display-inline">Fishery extension activities conducted by sea grant colleges or sea grant institutes to enhance, and not supplant, existing core program funding.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id527d2678-d59b-40cf-9d43-3fc6e49a46f5"><enum>(b)</enum><header display-inline="yes-display-inline">Modification of limitations on amounts for administration</header><text display-inline="yes-display-inline">Paragraph (1) of section 212(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1131">33 U.S.C. 1131(b)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="id66e3b25d-8770-4bea-b355-edb5b39a1f73" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id4cec6852-b432-4176-b52a-d2c63d037c7f"><enum>(1)</enum><header display-inline="yes-display-inline">Administration</header><subparagraph commented="no" display-inline="no-display-inline" id="id15d6e9ff-1128-4545-93e8-4b6165ce2f02"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There may not be used for administration of programs under this title in a fiscal year more than 5.5 percent of the lesser of—</text><clause commented="no" display-inline="no-display-inline" id="ide84eef73-7652-44f2-a0d0-9a5ab1cadc1a"><enum>(i)</enum><text display-inline="yes-display-inline">the amount authorized to be appropriated under this title for the fiscal year; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id58944d7e-2106-4d0b-acfa-4fa1d3989542"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount appropriated under this title for the fiscal year.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9c0a16a2-9134-4042-b211-02257e914c4e"><enum>(B)</enum><header display-inline="yes-display-inline">Critical staffing requirements</header><clause commented="no" display-inline="no-display-inline" id="id644d04c9-c09d-4c8c-a24e-487cd9565ad0"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director shall use the authority under subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, to meet any critical staffing requirement while carrying out the activities authorized in this title.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0be4c29b-3e78-4fb6-a589-d8c1f34babf1"><enum>(ii)</enum><header display-inline="yes-display-inline">Exception from cap</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), any costs incurred as a result of an exercise of authority as described in clause (i) shall not be considered an amount used for administration of programs under this title in a fiscal year.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id60c12982-1d98-466b-b4ca-d7d8287f4b8f"><enum>(c)</enum><header display-inline="yes-display-inline">Allocation of funding</header><paragraph commented="no" display-inline="no-display-inline" id="idf79b5c9e-12b7-4b01-865a-153a1c5395b8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 204(d)(3) (<external-xref legal-doc="usc" parsable-cite="usc/33/1123">33 U.S.C. 1123(d)(3)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5ab69161-b18b-470f-bbab-52c933a8098f"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter before subparagraph (A), by striking <quote>With respect to sea grant colleges and sea grant institutes</quote> and inserting <quote>With respect to sea grant colleges, sea grant institutes, sea grant programs, and sea grant projects</quote>;
