<legis-type>AN ACT</legis-type> 
<official-title display="yes">To establish the bases by which the Administrator of the Environmental Protection Agency shall issue, implement, and enforce certain emission limitations for existing electric utility steam generating units that convert coal refuse into energy.</official-title>

<legis-body display-enacting-clause="yes-display-enacting-clause" id="HB7ED6158EC1D4BBF819481A81BE696D7" style="OLC"> 
<section id="HA143C8669B854BD39CDE38BB2A3AFFD5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Satisfying Energy Needs and Saving the Environment Act</short-title></quote> or the <quote>SENSE Act</quote>.</text> </section> <section id="HC735940006234F8F929D45C0DACA9490"><enum>2.</enum><header>Standards for coal refuse power plants</header> <subsection id="H0A432C6D82B74C6682C7CBC014CBE887"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text> 
<paragraph id="H4B8189EA4CAF438E8B8B7FD0F8ACB671"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text> </paragraph> <paragraph commented="no" id="H8FFDB9FAEE154B75B15ED6D8F9ABDD7B"><enum>(2)</enum><header>Boiler operating day</header><text display-inline="yes-display-inline">The term <term>boiler operating day</term> has the meaning given such term in section 63.10042 of title 40, Code of Federal Regulations, or any successor regulation.</text> </paragraph>
<paragraph id="H010EA87E7F61441AB3DFE1EE9F76A1E4"><enum>(3)</enum><header>Coal refuse</header><text>The term <term>coal refuse</term> means any byproduct of coal mining, physical coal cleaning, or coal preparation operation that contains coal, matrix material, clay, and other organic and inorganic material.</text> </paragraph> <paragraph id="H153436EC661B47C18AFC1EE85D054E9A"><enum>(4)</enum><header>Coal refuse electric utility steam generating unit</header><text display-inline="yes-display-inline">The term <term>coal refuse electric utility steam generating unit</term> means an electric utility steam generating unit that—</text> 
<subparagraph id="H3F7F74862AA64BC2B19A47968463B074"><enum>(A)</enum><text>is in operation as of the date of enactment of this Act;</text> </subparagraph> <subparagraph id="HF806A88C38834BF7B4956B6A1836BEC9"><enum>(B)</enum><text>uses fluidized bed combustion technology to convert coal refuse into energy; and</text> </subparagraph>
<subparagraph id="HE511124167BE4AFFB91D19F185D088B6"><enum>(C)</enum><text>uses coal refuse as at least 75 percent of the annual fuel consumed, by heat input, of the unit.</text> </subparagraph></paragraph> <paragraph commented="no" id="HD7A9118416D5482DA30FCC925965C1E4"><enum>(5)</enum><header>Coal refuse-fired facility</header><text>The term <term>coal refuse-fired facility</term> means all coal refuse electric utility steam generating units that are—</text> 
<subparagraph id="HF78172D847F54633810110C7DE2CBAD4"><enum>(A)</enum><text>located on one or more contiguous or adjacent properties;</text> </subparagraph> <subparagraph id="HBA18784A8CBC404B94EE5A561F079281"><enum>(B)</enum><text>specified within the same Major Group (2-digit code), as described in the Standard Industrial Classification Manual (1987); and</text> </subparagraph>
<subparagraph id="H8D744CD791BE4FCCAB63ED2D80404DAE"><enum>(C)</enum><text>under common control of the same person (or persons under common control).</text> </subparagraph></paragraph> <paragraph commented="no" id="H92A06A7409F34862AE186E75D725BFB4"><enum>(6)</enum><header>Electric utility steam generating unit</header><text display-inline="yes-display-inline">The term <term>electric utility steam generating unit</term> means an electric utility steam generating unit, as such term is defined in section 63.10042 of title 40, Code of Federal Regulations, or any successor regulation.</text> </paragraph></subsection>
<subsection commented="no" id="HB86AC18CAFFE4F499C4FDC987689A10B"><enum>(b)</enum><header>Emission limitations To address hydrogen chloride and sulfur dioxide as hazardous air pollutants</header> 
<paragraph commented="no" id="H970283F957B04ACAB808792C88DBC921"><enum>(1)</enum><header>Applicability</header><text>For purposes of regulating emissions of hydrogen chloride or sulfur dioxide from a coal refuse electric utility steam generating unit under section 112 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412</external-xref>), the Administrator—</text> <subparagraph commented="no" id="H5E04FAB66B404894A028B3FAD1AD8BEA"><enum>(A)</enum><text>shall authorize the operator of such unit to elect that such unit comply with either—</text> 
<clause commented="no" id="HC68004636DF9457DADBC286070F896F0"><enum>(i)</enum><text>an emissions standard for emissions of hydrogen chloride that meets the requirements of paragraph (2); or</text> </clause> <clause commented="no" id="HA2537A970D444A259C489C12FA7FEC33"><enum>(ii)</enum><text>an emission standard for emissions of sulfur dioxide that meets the requirements of paragraph (2); and</text> </clause></subparagraph>
<subparagraph commented="no" id="H6B975E4059544A0B83BC39406AD48857"><enum>(B)</enum><text>may not require that such unit comply with both an emission standard for emissions of hydrogen chloride and an emission standard for emissions of sulfur dioxide.</text> </subparagraph></paragraph> <paragraph commented="no" id="H0633008CDE064D7CA5FCE2E66FE4D0F2"><enum>(2)</enum><header>Rules for emission limitations</header> <subparagraph commented="no" id="HFBD0B9D9A1CA4350BE551A8002E538A8"><enum>(A)</enum><header>In general</header><text>The Administrator shall require an operator of a coal refuse electric utility steam generating unit to comply, at the election of the operator, with no more than one of the following emission standards:</text> 
<clause commented="no" id="H10CB8441096E486685D8F4D06DFD3D56"><enum>(i)</enum><text display-inline="yes-display-inline">An emission standard for emissions of hydrogen chloride from such unit that is no more stringent than an emission rate of 0.002 pounds per million British thermal units of heat input.</text> </clause> <clause commented="no" id="H8A0BD4DE288247E8A31BDC89A2AEBC5D"><enum>(ii)</enum><text>An emission standard for emissions of hydrogen chloride from such unit that is no more stringent than an emission rate of 0.02 pounds per megawatt-hour.</text> </clause>
<clause commented="no" id="H7D5BD2979D2541B38532A820DF6DED0B"><enum>(iii)</enum><text>An emission standard for emissions of sulfur dioxide from such unit that is no more stringent than an emission rate of 0.20 pounds per million British thermal units of heat input.</text> </clause> <clause commented="no" id="HF39B556C530D41F79453FD39D8F8B983"><enum>(iv)</enum><text>An emission standard for emissions of sulfur dioxide from such unit that is no more stringent than an emission rate of 1.5 pounds per megawatt-hour.</text> </clause>
<clause commented="no" id="HDF72BE91A0EC4109BBBDFA01664B6CFF"><enum>(v)</enum><text display-inline="yes-display-inline">An emission standard for emissions of sulfur dioxide from such unit that is no more stringent than capture and control of 93 percent of sulfur dioxide across the generating unit or group of generating units, as determined by comparing—</text> <subclause commented="no" id="HE0ABA1A383A54F37B887FE6AE35BF900"><enum>(I)</enum><text>the expected sulfur dioxide generated from combustion of fuels emissions calculated based upon as-fired fuel samples, to</text> </subclause>
<subclause commented="no" id="H10032D5DEC2744B699CC86F353F14D59"><enum>(II)</enum><text display-inline="yes-display-inline">the actual sulfur dioxide emissions as measured by a sulfur dioxide continuous emission monitoring system.</text> </subclause></clause></subparagraph> <subparagraph commented="no" id="H851188B337A749638263197FA6C5B6FF"><enum>(B)</enum><header>Measurement</header><text display-inline="yes-display-inline">An emission standard described in subparagraph (A) shall be measured as a 30 boiler operating day rolling average per coal refuse electric utility steam generating unit or group of coal refuse electric utility steam generating units located at a single coal refuse-fired facility.</text> </subparagraph></paragraph></subsection></section>
