			 civil service position for any former political appointee, and for other
			 purposes.</official-title></form>
	<legis-body id="H9E552FED2C424429850901B398FE6853" style="OLC">
 <section id="H72D5EBF58BBC4C38B62AE4027F9C55EB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Political Appointee Burrowing Prevention Act</short-title></quote>.</text> </section><section id="H50D4AF3FF3D44C0C89E8B4E693E7C7B3"><enum>2.</enum><header>Temporary prohibition on employment of political appointees in career civil service positions</header> <subsection id="HDB6A51C66D144AC0B3BB3A5B3FD363D4"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="H2114EA0358BC4230A41D75D3332A6B1E" style="USC">
					<section id="H85573D981CC64269B50090B8C050154D"><enum>3115.</enum><header>Employment of former political appointees; restrictions</header>
 <subsection id="H006FCB9D28A14CBFA1348C36D93825E3"><enum>(a)</enum><text>A political appointee employed in a political position in the civil service may not be appointed to a career position in the civil service during the period of 2 years immediately following the date the individual separates from such political position.</text>
 </subsection><subsection id="HC9B8DBC2725D4DEB9EFA9F14365900D7"><enum>(b)</enum><text>Subsection (a) shall not apply to a political appointee who has not personally and substantially participated in any particular matter while employed in a political position.</text>
 </subsection><subsection id="H5ECC1CD784004531AF529B806E9EDA55"><enum>(c)</enum><text>In this section—</text> <paragraph id="H7A36669D04BA46EEB31AC63A66341871"><enum>(1)</enum><text>the term <quote>political appointee</quote> has the meaning given the term in section 3101(a);</text>
 </paragraph><paragraph id="H0C7BBDD10EB347E892351D5BEE131ADE"><enum>(2)</enum><text>the term <quote>political position</quote> means—</text> <subparagraph id="HC819E8F4FE2E4D7FBC64739931BDD7A6"><enum>(A)</enum><text>a position which has been excepted from the competitive service by reason of its confidential, policy-determining, policy-making, or policy-advocating character;</text>
 </subparagraph><subparagraph id="HDA24F72EA31B4A608D486ED3808B4E80"><enum>(B)</enum><text>a position described under sections 5312 through 5316 of title 5, United States Code (relating to the Executive Schedule); or</text>
 </subparagraph><subparagraph id="H3F4727D1078F41F7B7C379C240DEAFA2"><enum>(C)</enum><text>a position in the Senior Executive Service as a limited term appointee, limited emergency appointee, or noncareer appointee (as those terms are defined in paragraphs (5), (6), and (7), respectively, of section 3132(a));</text>
 </subparagraph></paragraph><paragraph id="H2EF0EE04AD7947F7BBACDEC10DBD56A0"><enum>(3)</enum><text>the term <quote>career position</quote> means—</text> <subparagraph id="H02FE15A8B3ED4425A49F133A2A944BD7"><enum>(A)</enum><text>a position in the competitive service; or</text>
 </subparagraph><subparagraph id="HA75EB779A4C248C1AACC67B2E4782B43"><enum>(B)</enum><text>a position in the Senior Executive Service as a career appointee (as that term is defined in section 3132(a)(4));</text>
 </subparagraph></paragraph><paragraph id="HD037C896206A48AE93B756C7046EBAA0"><enum>(4)</enum><text>the term <quote>participated</quote> means an action taken as an officer or employee through decision, approval, disapproval, recommendation, the rendering of advice, investigation, or other such action; and</text>
 </paragraph><paragraph id="H47855B50A7AA41D1887AD91C840D5C69"><enum>(5)</enum><text>the term <quote>particular matter</quote> includes any investigation, application, request for a ruling or determination, rulemaking, contract, controversy, claim, charge, accusation, arrest, or judicial or other proceeding.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H6EB7711B2C64412D87B7497971AF22CA"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding after the item relating to section 3114 the following:</text>

 </subsection><subsection id="HA864A88B192D4BD49042CB9CFF20B7A4"><enum>(c)</enum><header>Application</header><text>The amendment made by subsection (a) shall apply to any individual who separates from a political position (as that term is defined in section 3115 of title 5, United States Code, as added by such subsection) after the date of enactment of this Act.</text>
