 <section id="H3BCA5E3C65BD46B9B0478A70F3886784" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Political Appointee Burrowing Prevention Act</short-title></quote>.</text> </section><section id="HEBA0D6D5AEF14DBA961DF1873975CC07"><enum>2.</enum><header>Limitation on employment of political appointees in career civil service positions</header> <subsection id="H7840C205069F450EA93025ED9F5BF452"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

					<section id="H279DB8B40CF74C579D39B0AC8796DFE6"><enum>3115.</enum><header>Employment of political appointees </header>
						<subsection id="H228A9802E879416A9AA81F4C64378D03"><enum>(a)</enum><header>Appointment approval required</header>
 <paragraph id="H00CDDAD8EAB64153B00C671F94F8DBCE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An individual described in paragraph (4) may not be appointed to a career position without receiving prior written approval from the Director of the Office of Personnel Management with respect to such appointment, consistent with the requirements of this subsection.</text>
 </paragraph><paragraph id="H6C4F14539840417D92FFE7CAD8DE953D"><enum>(2)</enum><header>Agency appointment request</header><text display-inline="yes-display-inline">The head of an agency shall submit a request to the Director to approve the appointment of any individual described in paragraph (4) to a career position. Any such request shall include certification by the agency head to the Director that the appointment is critical for the agency to meet its mission.</text>
 </paragraph><paragraph id="H745BA742B0944738AD4EB68561E948F8"><enum>(3)</enum><header>OPM review</header><text display-inline="yes-display-inline">The Director shall review any request received pursuant to paragraph (2) and—</text> <subparagraph id="H8AC2CD76A2AA44C2B12A112378BA845D"><enum>(A)</enum><text>with respect to any such request, may—</text>
 <clause id="H6388784E21DF4049A4FE4484FE9600ED"><enum>(i)</enum><text>approve the request if the Director determines that the appointment process with respect to the request was fair, open, and free from political influence; or</text>
 </clause><clause id="H3C9C5B167C8040F88766438C9CA5FDFE"><enum>(ii)</enum><text>deny the request if—</text> <subclause id="H7EF05C6F410A45FE8697C5006FE45723"><enum>(I)</enum><text>the Director fails to make the determination under clause (i); or</text>
 </subclause><subclause id="H7D78116C575544A2937158DFF83B3BB5"><enum>(II)</enum><text>determines that the agency certification under paragraph (2) is unreasonable; and</text> </subclause></clause></subparagraph><subparagraph id="HE709DD005EA14BB8BC6C1B388DF375D0"><enum>(B)</enum><text>with respect to a request approved under subparagraph (A)(i), shall, not less than five days before the date of approval, provide to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate the agency certification and the Director’s rationale for concurring with that certification.</text>
 </subparagraph></paragraph><paragraph id="H4F702C20725540BCA90E82D977F8068C"><enum>(4)</enum><header>Covered individuals</header><text>An individual described in this paragraph is—</text> <subparagraph id="H8DD53FD7D5DC4C7DA1A87CABFEC33861"><enum>(A)</enum><text>a political appointee;</text>
 </subparagraph><subparagraph id="H6D153FC6122549538693A8F9DB955D92"><enum>(B)</enum><text>a former political appointee who held any political position during the five-year period before the date of the request described in paragraph (2); or</text>
 </subparagraph><subparagraph id="H122BC3CC11FC47B6935FA63C80D76B7E"><enum>(C)</enum><text display-inline="yes-display-inline">at the discretion of the Director, a former political appointee who held any political position before the five-year period described in subparagraph (B).</text>
								</subparagraph></paragraph></subsection><subsection id="H1FDAA35240F44623A271293B4317CD2E"><enum>(b)</enum><header>Restriction on appointment</header>
 <paragraph id="HBAEA95BC31F04A1EA3DB7754393127FF"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other law, rule, or regulation, during the 2-year period following the date a political appointee separates from a political position, such appointee may not be appointed to any career position in the civil service.</text>
 </paragraph><paragraph id="H073BFE6339074F569BDF7672C93D9B55"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to a political appointee who has not personally and substantially participated in any particular matter while employed in a political position.</text>
 </paragraph></subsection><subsection id="HE6536F0BFFF94EE382903FC2552C1918"><enum>(c)</enum><header>Application</header><text>Nothing in this section shall be construed to restrict the appointment of an individual who is—</text> <paragraph id="H115DB600CCA242AB8E5DD39CD90E90F9"><enum>(1)</enum><text>entitled to reinstatement under section 3593(b); or</text>
 </paragraph><paragraph id="H00F350B6EDF74D90A6F880880BC40001"><enum>(2)</enum><text>eligible for reinstatement under section 3593(a).</text> </paragraph></subsection><subsection id="HB87CD1C36FEF4DE496F16BDCEEFDDC8A"><enum>(d)</enum><header>Definitions</header><text>In this section—</text>
 <paragraph id="H2E4A47F9D9C34694A4E394472830B7AA"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>agency</quote> has the meaning given the term <quote>Executive agency</quote> in section 105;</text> </paragraph><paragraph id="HFBB5E6AD917340FAA63AD540C8D75A32"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>political appointee</quote> means an individual serving in an appointment of any duration to a political position;</text>
 </paragraph><paragraph id="H06211A274B6A4EBCBAB622F5B4389D7E"><enum>(3)</enum><text>the term <quote>political position</quote> means—</text> <subparagraph id="HB4905AA2C36D4E3D8F66447766957306"><enum>(A)</enum><text>a position which has been excepted from the competitive service by reason of its confidential, policy-determining, policy-making, or policy-advocating character;</text>
 </subparagraph><subparagraph id="HF815E6648E8D4C92A7BA9608E8F78069"><enum>(B)</enum><text>a position described under sections 5312 through 5316 (relating to the Executive Schedule); and</text> </subparagraph><subparagraph id="HCA49D0AC749F4CDC85B23915958BE01F"><enum>(C)</enum><text display-inline="yes-display-inline">a general position in the Senior Executive Service during such time as it is filled by—</text>
 <clause id="HE093B80997354930A41264BDE84809A0"><enum>(i)</enum><text>a noncareer appointee, as defined in paragraph (7) of section 3132(a); or</text> </clause><clause id="H4E33672FCF294E56A848356127E6D817"><enum>(ii)</enum><text>a limited term appointee or limited emergency appointee, as defined in paragraphs (5) and (6) of section 3132(a), who is serving under a political appointment.</text>
 </clause></subparagraph></paragraph><paragraph id="H4221F069C4C54B2DB1699FE28AE752CE"><enum>(4)</enum><text>the term <quote>career position</quote> means—</text> <subparagraph id="H6BADC9611BB54E4A83B3E561A82FFEEA"><enum>(A)</enum><text display-inline="yes-display-inline">a position in the competitive service filled by career or career-conditional appointment;</text>
 </subparagraph><subparagraph id="HE20AF3BF00A64785AA63AE7D70A1F9A1"><enum>(B)</enum><text display-inline="yes-display-inline">a position in the excepted service filled by an appointment of equivalent tenure as a position described in subparagraph (A);</text>
 </subparagraph><subparagraph id="H1A7A9B6A9B4C4FFB949D43852CF18BB6"><enum>(C)</enum><text display-inline="yes-display-inline">a career reserved position, as defined in paragraph (8) of section 3132(a), in the Senior Executive Service; or</text>
 </subparagraph><subparagraph id="HF715FBB4C3E94A998882CC6718182FAD"><enum>(D)</enum><text>a general position in the Senior Executive Service when filled by a career appointee, as defined in section 3132(a)(4);</text>
 </subparagraph></paragraph><paragraph id="HA548F9CA84E941A5A914F5F285A1F18B"><enum>(5)</enum><text>the term <quote>participated</quote> means an action taken as an officer or employee through decision, approval, disapproval, recommendation, the rendering of advice, investigation, or other such action; and</text>
 </paragraph><paragraph id="H00B69F75A6BC45D58EB0EEFF94757B65"><enum>(6)</enum><text>the term <quote>particular matter</quote> includes any investigation, application, request for a ruling or determination, rulemaking, contract, controversy, claim, charge, accusation, arrest, or judicial or other proceeding.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H40D8DC9861C146AA917A7AE7F2E329E3"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding after the item relating to section 3114 the following:</text>

						<toc-entry level="section">3115. Employment of political appointees.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3A09E17B35594DF5B1F15A4D696F62A3"><enum>(c)</enum><header>Application</header>
 <paragraph id="H731CA0F5F8DF4D37BC9B90768BFFBE69"><enum>(1)</enum><header>Appointment requests</header><text>Section 3115(a) of title 5, United States Code, as added by subsection (a), shall apply to any appointment or request for appointment described in such section submitted to the Office of Personnel Management after the date of enactment of this Act.</text>
 </paragraph><paragraph id="H8E582B5E7DCD422C9E84F5434CFA4B54"><enum>(2)</enum><header>Limitation on appointments</header><text>Section 3115(b) of title 5, United States Code, as added by subsection (a), shall apply to any individual who separates from a political position (as that term is defined in section 3115(c)(2) of such title, as added by such subsection) after the date of enactment of this Act.</text>
 </paragraph></subsection><subsection id="H221CB7FAE6644F11AC321F095CF631CD"><enum>(d)</enum><header>Regulations required</header><text>The Director of the Office of Personnel Management shall issue regulations necessary to carry out this Act, including regulations to define the term <quote>personally and substantially participated</quote> as such term is used in section 3115(b)(2) of title 5, United States Code, as added by subsection (a).</text>
