 <section id="HB271855D6DAB47949EF5FD24C73D16A2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mortgage Choice Act of 2017</short-title></quote>.</text> </section><section id="H324610CDDD174DE599BF5A4E97549532" section-type="subsequent-section"><enum>2.</enum><header>Definition of points and fees</header> <subsection id="HE196051E7161443B888D556FA4E31EEE"><enum>(a)</enum><header>Amendment to section 103 of TILA</header><text display-inline="yes-display-inline">Section 103(bb)(4) of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1602">15 U.S.C. 1602(bb)(4)</external-xref>) is amended—</text>
 <paragraph id="H6A72FF175F9147738841B7FB2037A4ED"><enum>(1)</enum><text>by striking <quote>paragraph (1)(B)</quote> and inserting <quote>paragraph (1)(A) and section 129C</quote>;</text> </paragraph><paragraph id="H51844DAF6F834CD387ACF52E598DC200"><enum>(2)</enum><text>in subparagraph (C)—</text>
 <subparagraph id="H81545C903A8544B1B9284534FEBE98A2"><enum>(A)</enum><text>by inserting <quote>and insurance</quote> after <quote>taxes</quote>;</text> </subparagraph><subparagraph id="HB2F31105A3D7426089D3794C9B99324C"><enum>(B)</enum><text>in clause (ii), by inserting <quote>, except as retained by a creditor or its affiliate as a result of their participation in an affiliated business arrangement (as defined in section 2(7) of the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2602">12 U.S.C. 2602(7)</external-xref>)</quote> after <quote>compensation</quote>; and</text>
 </subparagraph><subparagraph id="H27A72AD16F1B481E8FEB2CB1C91670BA"><enum>(C)</enum><text display-inline="yes-display-inline">by striking clause (iii) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H82C1720777A34D03958FAD9365CC1FDD" style="OLC"> <clause id="H50B8C4F7DC3549B89A1CB9DC692A5F8B" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">the charge is—</text>
 <subclause id="HFBDA2DE50E6A424E9AB7939204935DF8"><enum>(I)</enum><text>a bona fide third-party charge not retained by the mortgage originator, creditor, or an affiliate of the creditor or mortgage originator; or</text>
 </subclause><subclause id="H646ED37D3F914D8E9D829CD4A0B7658B"><enum>(II)</enum><text>a charge set forth in section 106(e)(1);</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="HA15D436F74104A979AD9DADF073EF470"><enum>(3)</enum><text>in subparagraph (D)—</text>
 <subparagraph id="H24C66F2A12D1414E849E15CF8CD0FBF0"><enum>(A)</enum><text>by striking <quote>accident,</quote>; and</text> </subparagraph><subparagraph id="HEDF552EB31D74EE48D984AFB746EBFE4"><enum>(B)</enum><text>by striking <quote>or any payments</quote> and inserting <quote>and any payments</quote>.</text>
 </subparagraph></paragraph></subsection><subsection id="H7DC7981C61BD4584B9C18086787EB9A1"><enum>(b)</enum><header>Amendment to section 129C of TILA</header><text>Section 129C of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1639c">15 U.S.C. 1639c</external-xref>) is amended—</text> <paragraph id="HC6C2DA3A35FC4FB489A9E9AD663A9345"><enum>(1)</enum><text>in subsection (a)(5)(C), by striking <quote>103</quote> and all that follows through <quote>or mortgage originator</quote> and inserting <quote>103(bb)(4)</quote>; and</text>
 </paragraph><paragraph id="H17305500B5584EEF87E8A9422CA6E18D"><enum>(2)</enum><text>in subsection (b)(2)(C)(i), by striking <quote>103</quote> and all that follows through <quote>or mortgage originator)</quote> and inserting <quote>103(bb)(4)</quote>.</text> </paragraph></subsection></section><section id="HA2517AAD7FB84FAFB8F3B23A1EC3AD56"><enum>3.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than the end of the 90-day period beginning on the date of the enactment of this Act, the Bureau of Consumer Financial Protection shall issue final regulations to carry out the amendments made by this Act, and such regulations shall be effective upon issuance.</text>
