<congress display="no">115th CONGRESS</congress><session display="no">1st Session</session><legis-num display="no">H.R. 1370</legis-num><current-chamber display="yes">In the Senate of the United States,</current-chamber><action><action-date date="20171106">November 6, 2017.</action-date></action><legis-type display="yes">Amendment:</legis-type></engrossed-amendment-form><engrossed-amendment-body><section id="id0b318c3703ed4c648b5f5538efdd9b2c" section-type="resolved"><text>That the bill from the House of Representatives (H.R. 1370) entitled <quote>An Act to amend the Homeland Security Act of 2002 to require the Secretary of Homeland Security to issue Department of Homeland Security-wide guidance and develop training programs as part of the Department of Homeland Security Blue Campaign, and for other purposes.</quote>, do pass with the following</text></section><amendment><amendment-instruction blank-lines-after="0"><text>Strike all after the enacting clause and insert the following:</text></amendment-instruction><amendment-block blank-lines-after="1" changed="added" reported-display-style="italic"><section commented="no" display-inline="no-display-inline" id="idB0EAA887BCD545EE8513AA90F46CEE51" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Homeland Security Blue Campaign Authorization Act of 2017</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H683FCDBEDDF74C03AE793C98081D5722" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Enhanced Department of Homeland Security coordination through the Blue Campaign</header><subsection commented="no" display-inline="no-display-inline" id="H86F598503BEE46718FA3720486C0A7D1"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle C of title IV of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/231">6 U.S.C. 231</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="H274A662F29D94C89B70A832CAE615892" reported-display-style="italic" style="OLC"><section commented="no" display-inline="no-display-inline" id="H50D76C7001F7458F9D8256C5C0FEC82C" section-type="subsequent-section"><enum>434.</enum><header display-inline="yes-display-inline">Department of Homeland Security Blue Campaign</header><subsection commented="no" display-inline="no-display-inline" id="idBEEEC8F12F464584848E16B34533B8D9"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>human trafficking</term> means an act or practice described in paragraph (9) or (10) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H2E399DB3FC694F9B9AE22F0FC8FCA0ED"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established within the Department a program, which shall be known as the <quote>Blue Campaign</quote>. The Blue Campaign shall be headed by a Director, who shall be appointed by the Secretary.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idF70F879069A441BBB9F944B9268768CA"><enum>(c)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the Blue Campaign shall be to unify and coordinate Department efforts to address human trafficking.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9E5ADB1C6484485DAFCDB3FB673693E3"><enum>(d)</enum><header display-inline="yes-display-inline">Responsibilities</header><text display-inline="yes-display-inline">The Secretary, working through the Director, shall, in accordance with subsection (e)—</text><paragraph commented="no" display-inline="no-display-inline" id="H6697D444ECD3418FA0596E1583F4DF81"><enum>(1)</enum><text display-inline="yes-display-inline">issue Department-wide guidance to appropriate Department personnel;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB9A305BB21094F5682D3D83B05679AB9"><enum>(2)</enum><text display-inline="yes-display-inline">develop training programs for such personnel;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0BC5EE38BBFC41B1AA45CE3F1FDF02C8"><enum>(3)</enum><text display-inline="yes-display-inline">coordinate departmental efforts, including training for such personnel; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id610F7DB355B540E8ABEC629CB742E70E"><enum>(4)</enum><text>provide guidance and training on trauma-informed practices to ensure that human trafficking victims are afforded prompt access to victim support service providers, in addition to the government assistance required under section 107 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105</external-xref>), to address their immediate and long-term needs.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7352C2DA632F4925816382A21FD5D5F8"><enum>(e)</enum><header display-inline="yes-display-inline">Guidance and training</header><text display-inline="yes-display-inline">The Blue Campaign shall provide guidance and training to appropriate Department personnel and other Federal, State, tribal, and law enforcement personnel, as appropriate regarding—</text><paragraph commented="no" display-inline="no-display-inline" id="H2E1E756BCE0649A7AD8F778192DD53AB"><enum>(1)</enum><text display-inline="yes-display-inline">programs to help identify instances of human trafficking;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7E7345D24C444DE6B243D91E5F9DC184"><enum>(2)</enum><text display-inline="yes-display-inline">the types of information that should be collected and recorded in information technology systems utilized by the Department to help identify individuals suspected or convicted of human trafficking;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD2FECC73B7BE45AF94A16D4A81D2D433"><enum>(3)</enum><text display-inline="yes-display-inline">systematic and routine information sharing within the Department and among Federal, State, tribal, and local law enforcement agencies regarding—</text><subparagraph commented="no" display-inline="no-display-inline" id="id425629201B0E490FA0EAAE70EC385D97"><enum>(A)</enum><text display-inline="yes-display-inline">individuals suspected or convicted of human trafficking; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5F0F46043BB44C63A829A13A1BF3176A"><enum>(B)</enum><text display-inline="yes-display-inline">patterns and practices of human trafficking;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H952C594B2A864EF692609649C8778271"><enum>(4)</enum><text display-inline="yes-display-inline">techniques to identify suspected victims of trafficking along the United States border and at airport security checkpoints;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H748E7391D03E4011A1264CBFE54C40FD"><enum>(5)</enum><text display-inline="yes-display-inline">methods to be used by the Transportation Security Administration and personnel from other appropriate agencies—</text><subparagraph commented="no" display-inline="no-display-inline" id="H47DC1AA2053948258D7FD86EF7CBAA16"><enum>(A)</enum><text display-inline="yes-display-inline">to train employees of the Transportation Security Administration to identify suspected victims of trafficking; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id611F9B6750CD4331A6E47BCED34C6C86"><enum>(B)</enum><text display-inline="yes-display-inline">to serve as a liaison and resource regarding human trafficking prevention to appropriate State, local, and private sector aviation workers and the traveling public;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H163749BBC8D14E30B40286931CD9E6FC"><enum>(6)</enum><text display-inline="yes-display-inline">utilizing resources, such as indicator cards, fact sheets, pamphlets, posters, brochures, and radio and television campaigns—</text><subparagraph commented="no" display-inline="no-display-inline" id="idA3CAF6305FFA448DA55CB4270B2753C8"><enum>(A)</enum><text display-inline="yes-display-inline">to educate partners and stakeholders; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCD6F1B4D6E054961A0B33A1CD900EB72"><enum>(B)</enum><text display-inline="yes-display-inline">to increase public awareness of human trafficking;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2C18E79E7902458D990DCB5211E2B78F"><enum>(7)</enum><text display-inline="yes-display-inline">leveraging partnerships with State and local governmental, nongovernmental, and private sector organizations to raise public awareness of human trafficking; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE709271870C748CCB03929C9E96DFE5A"><enum>(8)</enum><text display-inline="yes-display-inline">any other activities the Secretary determines necessary to carry out the Blue Campaign.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H57F7E90485FD495B8BC9D3A7F9FDC7E5"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>) is amended by inserting after the item relating to section 433 the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="H2EA8BFBE972248CA8881595AF665A909" reported-display-style="italic" style="OLC"><toc changed="added" regeneration="no-regeneration" reported-display-style="italic"><toc-entry bold="off" level="section">Sec. 434. Department of Homeland Security Blue Campaign.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="HF45B37248CCE4ABFB8F8F0625AFB645E" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Information technology systems</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Homeland Security shall ensure, in accordance with the Department of Homeland Security-wide guidance required under section 434(d) of the Homeland Security Act of 2002, as added by section 2, the integration of information technology systems utilized within the Department to record and track information regarding individuals suspected or convicted of human trafficking.</text></section><section commented="no" display-inline="no-display-inline" id="H7559094882F44DF8ABA3D0A58130E77C" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Report</header><text display-inline="no-display-inline">Not later than 18 months after the date of the enactment of this Act, the Secretary of Homeland Security shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that—</text><paragraph commented="no" display-inline="no-display-inline" id="id66A963A275FE4F088D478F4ECA8728A1"><enum>(1)</enum><text display-inline="yes-display-inline">describes the status and effectiveness of the Department of Homeland Security Blue Campaign; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB48AFBD9FBBC4347B1E44D12DDDB1DD9"><enum>(2)</enum><text display-inline="yes-display-inline">provides a recommendation regarding the appropriate office within the Department of Homeland Security for the Blue Campaign.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="H37C468C9DC4741BCA5A8D02755873A0F" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated $819,000 to carry out section 434 of the Homeland Security Act of 2002, as added by section 2.</text></section></amendment-block></amendment></engrossed-amendment-body><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
