<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend the Homeland Security Act of 2002 to require the Secretary of Homeland Security to issue Department of Homeland Security-wide guidance and develop training programs as part of the Department of Homeland Security Blue Campaign, and for other purposes. </official-title>

<division id="H700BC290E73E4FD4ADEF50BD4F85A59D" style="appropriations"><enum>A</enum><header>Further Additional Continuing Appropriations Act, 2018</header> 
<section id="HF480E5DBFA3B46C7AC3DB1F5DB491DF0" section-type="section-one"><enum>1001.</enum><text display-inline="yes-display-inline">The Continuing Appropriations Act, 2018 (division D of <external-xref legal-doc="public-law" parsable-cite="pl/115/56">Public Law 115–56</external-xref>) is further amended—</text> <paragraph id="H539DB3C91A8C4502BF463D7CACE74EE3"><enum>(1)</enum><text>by striking the date specified in section 106(3) and inserting <quote>January 19, 2018</quote>; and</text></paragraph> 
<paragraph id="H321C23F1E41E422B9EDE0AD81266D185"><enum>(2)</enum><text>by adding after section 142 the following:</text> <quoted-block style="appropriations" id="HA325BAC20015474E8C872C41BD439EF9" display-inline="no-display-inline"> <section id="H4D4C148068E247818E52614DBF9BE906"><enum>143.</enum><text display-inline="yes-display-inline">Notwithstanding section 104, amounts made available by section 111 for <quote>Department of Homeland Security—Coast Guard—Retired Pay</quote> may be obligated to carry out Retired Pay Reform, as authorized by part 1 of subtitle D of title VI of the National Defense Authorization Act for Fiscal Year 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/92">Public Law 114–92</external-xref>, as amended), and the matter under such heading in division F of the Consolidated Appropriations Act, 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/115/31">Public Law 115–31</external-xref>; 131 Stat. 409) shall be applied during the period covered by this Act by inserting <quote>payment of continuation pay under section 356 of title 37, United States Code,</quote> after <quote>payment for career status bonuses,</quote>.</text></section> 
<section id="HC6643B66025D4691834C337D22837BB0" display-inline="no-display-inline"><enum>144.</enum><text display-inline="yes-display-inline">In addition to amounts provided by section 101, amounts are provided for <quote>Department of Health and Human Services—Indian Health Service—Indian Health Services</quote> at a rate for operations of $11,761,000 and amounts are provided for <quote>Department of Health and Human Services—Indian Health Service—Indian Health Facilities</quote> at a rate for operations of $1,104,000, for an additional amount for costs of staffing and operating newly constructed facilities; and such amounts may be apportioned up to the rate for operations necessary to staff and operate newly constructed facilities.</text></section> <section id="HB7624D8BE7914F5BA74C2496D948B205"><enum>145.</enum><text display-inline="yes-display-inline">Amounts made available by section 101 for <quote>Department of Health and Human Services—Administration for Children and Families—Refugee and Entrant Assistance</quote> may be apportioned up to the rate for operations necessary to maintain program operations for carrying out section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>) and section 462 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279</external-xref>) at the level provided in fiscal year 2017.</text></section> 
<section id="H99C46F2D1F854A00B63A99D778C2B687"><enum>146.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, amounts are provided for the purposes described in the third paragraph under the heading <quote>Department of Health and Human Services—Office of the Secretary—Public Health and Social Services Emergency Fund</quote> at a rate for operations of $112,000,000; and such amounts may be apportioned up to the rate for operations necessary to prepare for or respond to an influenza pandemic.</text></section> <section id="H75DC3637C5BC4707833B33BCAB54EB2C"><enum>147.</enum><text display-inline="yes-display-inline">Notwithstanding section 251(a)(1) of the Balanced Budget and Emergency Deficit Control Act of 1985 and the timetable in section 254(a) of such Act, the final sequestration report for fiscal year 2018 pursuant to section 254(f)(1) of such Act and any order for fiscal year 2018 pursuant to section 254(f)(5) of such Act shall be issued, for the Congressional Budget Office, 10 days after the date specified in section 106(3), and for the Office of Management and Budget, 15 days after the date specified in section 106(3).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HD50446EB3BA44EC88EB91FE48E572904" section-type="subsequent-section" display-inline="no-display-inline"><enum>1002.</enum> 
<subsection id="H120EDD8E3F384903AB1C01A2D9D0A476" display-inline="yes-display-inline"><enum>(a)</enum><text display-inline="yes-display-inline">Notwithstanding the dates specified in section 403(b) of the FISA Amendments Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/261">Public Law 110–261</external-xref>; 122 Stat. 2474), the amendments made by such section shall not take effect until the date specified in section 106(3) of the Continuing Appropriations Act, 2018 (division D of <external-xref legal-doc="public-law" parsable-cite="pl/115/56">Public Law 115–56</external-xref>), as amended.</text></subsection> <subsection id="H04C8139E5D604AE6A405CB81DD99EF80"><enum>(b)</enum><text display-inline="yes-display-inline">If during the period beginning on the date of the enactment of this Act and ending on the date specified in section 106(3) of the Continuing Appropriations Act, 2018 (division D of <external-xref legal-doc="public-law" parsable-cite="pl/115/56">Public Law 115–56</external-xref>), as amended, any Act amending the dates specified in section 403(b) of the FISA Amendments Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/261">Public Law 110–261</external-xref>; 122 Stat. 2474) is enacted, this section shall be repealed.</text></subsection></section> 
<section section-type="undesignated-section" display-inline="no-display-inline" id="HDE1BC539CCB545B48426D2F94B15CD78" commented="no"><text display-inline="yes-display-inline">This division may be cited as the <quote>Further Additional Continuing Appropriations Act, 2018</quote>.</text></section></division> <division id="H0CABF9AB25D14B1AB07DACBCBCE674AD"><enum>B</enum><header>Missile Defense</header> <section id="H4846440A23C340E49F35C906C208671F" section-type="undesignated-section"><text display-inline="yes-display-inline">The following sums are appropriated, out of any money in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2018, and for other purposes, namely:</text></section>

<italic>Provided</italic>, That such funds may be obligated or expended for planning and design and military construction projects not otherwise authorized by law: <italic>Provided further</italic>, That such amount is designated by the Congress as an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</text></appropriations-major></title> 
<title id="H4FCD0CDD649F4A349643A99C5905EBDD" style="appropriations"><enum>III</enum><header>General Provisions</header> 
<section id="H9475C46DA2C5436DA41A549BA1574748"><enum>2001.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, funds made available in this division are in addition to amounts appropriated or otherwise made available for the Department of Defense for fiscal year 2018.</text></section> <section id="H50A0BCF7DBA2461C844240EB632F81AB" display-inline="no-display-inline"><enum>2002.</enum> <subsection id="HA84CF4E88E63460CA9FEB247C5472F0D" display-inline="yes-display-inline"><enum>(a)</enum><text display-inline="yes-display-inline"> Funds made available in title I of this division shall be allocated to programs, projects, and activities in accordance with the detailed congressional budget justifications submitted by the Department of Defense to accompany the Fiscal Year 2018 Budget Amendments requested by the President on November 6, 2017: <italic>Provided</italic>, That changes to the allocation of such funds shall be subject to the reprogramming requirements set forth in the annual appropriations Act.</text></subsection> 
<subsection id="H513239ACB7244F168BAAAC9FE41E7468"><enum>(b)</enum><text>Funds made available in this division may be obligated and expended notwithstanding sections 102 and 104 of division D of <external-xref legal-doc="public-law" parsable-cite="pl/115/56">Public Law 115–56</external-xref>.</text></subsection></section> <section id="H71DA0230BE2D4254866D332E87153D5E"><enum>2003.</enum><text display-inline="yes-display-inline">Each amount designated in this division by the Congress as an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 shall be available only if the President subsequently so designates all such amounts and transmits such designations to the Congress.</text></section> 
<section id="H962EE3C8F34143E69B69F3AEF2A3AD7B"><appropriations-small commented="no" id="H5578A90E13D244EC9F897589A8AD4F52"><text display-inline="no-display-inline">This division may be cited as the <quote><short-title>Department of Defense Missile Defeat and Defense Enhancements Appropriations Act, 2018</short-title></quote>.</text></appropriations-small></section></title></division> <division id="HED09725A3A46465B96AF5A8F3450E9BC"><enum>C</enum><header>Health provisions</header> <title id="H7AFCA1CF5ADA4DD6989103EBA14985FE"><enum>I</enum><header>Public Health Extenders</header> <section id="H275B69E8D00C4FD8B502C84B1E23CEFC" commented="no"><enum>3101.</enum><header>Extension for community health centers, the National Health Service Corps, and teaching health centers that operate GME programs</header> <subsection id="HA0F1D8CA809D4A8EA171CD4AE810FA29" commented="no"><enum>(a)</enum><header>Community health centers funding</header><text display-inline="yes-display-inline">Section 10503(b)(1) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b-2">42 U.S.C. 254b–2(b)(1)</external-xref>) is amended—</text>

<subsection id="H9FF2C52C041A4BADA6900415392871C9" commented="no"><enum>(c)</enum><header>Teaching health centers that operate graduate medical education programs</header><text>Subsection (g) of section 340H of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256h">42 U.S.C. 256h</external-xref>) is amended—</text> <paragraph id="H1449259700DE4C58B6BDD7B215D34FB1" commented="no"><enum>(1)</enum><text>by striking <quote>To carry out</quote> and inserting the following:</text>

<paragraph id="H0FC5A3BACDBE4CF684877C6574E6018D" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H3620F33212754B41A112F72DCDC52B02" display-inline="no-display-inline"> <paragraph id="H4B6BFF09EBF248AD9E957FF50DF9DEE0" commented="no"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amount made available to carry out this section for any fiscal year, the Secretary may not use more than 5 percent of such amount for the expenses of administering this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8A7B22FA2FAB4D1EA428121F654FACAE" commented="no"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">Amounts appropriated pursuant to this section are subject to the requirements contained in <external-xref legal-doc="public-law" parsable-cite="pl/115/31">Public Law 115–31</external-xref> for funds for programs authorized under sections 330 through 340 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b–256</external-xref>).</text></subsection> <subsection id="H12E81A2A9263499EB6BE2D24E503518E" commented="no"><enum>(e)</enum><header>Conforming amendments</header><text>Section 3014(h) of title 18, United States Code, is amended—</text>

<paragraph commented="no" id="HA4ABF23B898340EC9E1C683384B90387"><enum>(3)</enum><header>Application of regular expenditure rules</header><text>Amounts allotted to a State under section 2104(m)(10)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397dd">42 U.S.C. 1397dd(m)(10)(A)</external-xref>) (as added by paragraph (1)) shall be subject to the same requirements of title XXI of such Act and applicable regulations of the Secretary of Health and Human Services as apply to other allotments made to States for a fiscal year under section 2104 of such Act.</text></paragraph></subsection> <subsection commented="no" id="H24EE7D3475454B268D3FFB7B11A6EBCD"><enum>(c)</enum><header>Extension of CHIP allocation redistribution special rule for certain shortfall States</header> <paragraph commented="no" id="H0B1F0E83BEBE4880A6E70A4F759D5539"><enum>(1)</enum><header>In general</header><text>Section 2104(f)(2)(B)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397dd">42 U.S.C. 1397dd(f)(2)(B)</external-xref>), as amended by section 201 of <external-xref legal-doc="public-law" parsable-cite="pl/115/90">Public Law 115–90</external-xref>, is amended—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD3F75DE05A734554AD293A7ECFF72E95"><enum>(A)</enum><text display-inline="yes-display-inline">in the clause heading, by striking <quote><header-in-text level="clause" style="traditional">first quarter</header-in-text></quote> and inserting <quote><header-in-text level="clause" style="traditional">first half</header-in-text></quote>;</text></subparagraph> <subparagraph commented="no" id="H592ED5E9112344DFA3B7765AD4E7C249"><enum>(B)</enum><text>by redesignating subclause (III) as subclause (VI); and</text></subparagraph> 
<subparagraph commented="no" id="HE7E23ACAEB3341AAAFBC63CA559A421A"><enum>(C)</enum><text>by striking subclauses (I) and (II) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H342C7EFD3CFB47FE976F6C914A77F120" style="OLC"> <subclause id="H34A83E6A0FC143E0955FE5DB5C1293B3"><enum>(I)</enum><header>In general</header><text>For each month beginning during the period beginning on October 1, 2017, and ending March 31, 2018, subject to the succeeding subclauses of this clause, the Secretary shall redistribute any amounts available for redistribution under paragraph (1) for fiscal year 2018, to each State that is an emergency shortfall State for the month (as defined in subclause (II)) such amount as the Secretary determines will eliminate the estimated shortfall described in subclause (II) for such State for the month (as may be adjusted under subparagraph (C)) before the Secretary may redistribute such amounts to any shortfall State that is not an emergency shortfall State. In the case of any amounts redistributed under this subclause to a State that is not an emergency shortfall State, such amounts shall be determined in accordance with clause (i).</text></subclause> 
<subclause id="HC31BD35F6FAE4505909EFA2E77294C69"><enum>(II)</enum><header>Emergency shortfall State defined</header><text>For purposes of this clause, the term <quote>emergency shortfall State</quote> means, with respect to a month beginning during the period beginning October 1, 2017, and ending March 31, 2018, a shortfall State for which the Secretary estimates, in accordance with subparagraph (A) (unless otherwise specified in this subclause) and on a monthly basis using the most recent data available to the Secretary as of such month, that the projected expenditures under the State child health plan and under section 2105(g) (calculated as if the reference under section 2105(g)(4)(A) to <quote>2017</quote> were a reference to <quote>2018</quote> and insofar as the allotments are available to the State under this subsection or subsection (e) or (m)) for such month will exceed the sum of the amounts described in clauses (i) through (iii) of subparagraph (A) for such month, including after application of any amount redistributed under paragraph (1) for a previous month for fiscal year 2018 in accordance with this clause, to such State. A shortfall State may be an emergency shortfall State under the previous sentence without regard to whether any amounts were redistributed to such State under paragraph (1) for a previous month in fiscal year 2018.</text></subclause> <subclause id="H555ED956E8CB45A5A92E5FE0D409704A"><enum>(III)</enum><header>Funds redistributed in the order in which States realize funding shortfalls</header><text>The Secretary shall redistribute the amounts available for redistribution under paragraph (1) to emergency shortfall States described in subclause (II) in the order in which such States realize monthly funding shortfalls under this title for fiscal year 2018. The Secretary shall only make redistributions under this clause to the extent that such amounts are available for such redistributions.</text></subclause> 
<subclause id="HAA3BE67EB0364BE6B812AA05E5B67BAF"><enum>(IV)</enum><header>Proration rule</header><text>If the amounts available for redistribution under paragraph (1) for a month during the period described in subclause (I) are less than the total amounts of the estimated shortfalls determined for the month for emergency shortfall States described in subclause (II), the amount computed under subclause (I) for each emergency shortfall State shall be reduced proportionally.</text></subclause> <subclause commented="no" id="H2E5EB47A9C0448AA970AB1FB0E4BFF3A"><enum>(V)</enum><header>Unobligated redistributed funds</header><text>The Secretary shall withhold any funds redistributed under paragraph (1) for fiscal year 2018 before January 1, 2018, but which have not been obligated for amounts expended by a State as of that date, and shall redistribute such funds in accordance with the preceding subclauses of this clause.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph commented="no" id="H1C11D5CE9E174D1CB93D5605EEC323B6"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in the amendments made by paragraph (1) shall be construed as authorizing the Secretary of Health and Human Services to de-obligate any funds redistributed under clause (ii) of section 2104(f)(2)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397dd">42 U.S.C. 1397dd(f)(2)(B)</external-xref>) that have been obligated for amounts expended by an emergency shortfall State described in such clause as of January 1, 2018.</text></paragraph></subsection></section> <section id="H050A16400B5D4021BA83A8E97EE2AA59" section-type="undesignated-section"><text display-inline="yes-display-inline">This division may be cited as the <quote>CHIP and Public Health Funding Extension Act</quote>.</text></section></title></division>
