		<official-title display="yes">To prohibit the sale of shark fins, and for other purposes.</official-title>

 <section id="H06D985F66F004AA7835043B259BE98F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Shark Fin Sales Elimination Act of 2017</short-title></quote>.</text> </section><section id="H6CE35C7A1BF246B8B1B92DB0743845A7"><enum>2.</enum><header>Prohibition on sale of shark fins</header> <subsection id="H125DB8038873401DA8A75B4244A7023F"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Except as provided in section 3, no person shall possess, offer for sale, sell, or purchase any shark fin or product containing any shark fin.</text>
 </subsection><subsection id="H0CA41C37407D4A71B00C37A3C1D6EBBE"><enum>(b)</enum><header>Penalty</header><text>For purposes of section 308(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1858">16 U.S.C. 1858(a)</external-xref>), a violation of this section shall be treated as an act prohibited by section 307 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1857">16 U.S.C. 1857</external-xref>).</text>
 </subsection></section><section id="H8856F461C2204500AE6869A1036392CB"><enum>3.</enum><header>Exemption for traditional fisheries, education, and science</header><text display-inline="no-display-inline">Section 2 shall not apply with respect to possession of a shark fin that was taken lawfully under a State, territorial, or Federal license or permit to take or land sharks, if the shark fin is separated from the shark in a manner consistent with the license or permit and is—</text>
 <paragraph id="H410F05EBB59C4B6CA34925B8588F16A4"><enum>(1)</enum><text>destroyed or discarded;</text> </paragraph><paragraph id="HA8C1208A6BA64B9BBDB39B35C33350C0"><enum>(2)</enum><text>used for noncommercial subsistence purposes in accordance with State or territorial law; or</text>
 </paragraph><paragraph id="H37873A97789F4C7B8F4F01F219ACE10D"><enum>(3)</enum><text>used solely for display or research purposes by a museum, college, or university, or other person under a State or Federal permit to conduct noncommercial scientific research.</text>
 </paragraph></section><section id="H57086EE17BC1468292739E1463A9088C"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HA114553617A54559A37C4385D2F30F19"><enum>(1)</enum><header>Shark</header><text>The term <quote>shark</quote> means any species of the orders Pristiophoriformes, Squa­tini­formes, Squaliformes, Hexanchiformes, Lam­ni­formes, Carchariniformes, Orectolobiformes, and Hetero­don­ti­formes.</text>
 </paragraph><paragraph id="H52F4DEB9EF424442A4B5E6DE2520C921"><enum>(2)</enum><header>Shark fin</header><text>The term <quote>shark fin</quote> means the raw, dried, or otherwise processed detached fin, or the raw, dried, or otherwise processed detached tail, of a shark.</text>
 </paragraph></section><section id="HA5C98639572449E589C85F7ABBC0B6DA"><enum>5.</enum><header>State authority</header><text display-inline="no-display-inline">Nothing in this Act affects any right of a State or territory of the United States to adopt or enforce any regulation or standard that is more stringent than a regulation or standard in effect under this Act.</text>
