		<section id="H49DF9C4F530F4DFC985DC8D5429DB1AB" section-type="section-one"><enum>1.</enum><header>Making online banking initiation legal and easy</header>
 <subsection id="HE16B700A00E94E919AABB79CD7FD9F56"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HCE9EAB3D4E93433F888626FCA036B9F5"><enum>(1)</enum><header>Affiliate</header><text>The term <term>affiliate</term> has the meaning given the term in section 2 of the Bank Holding Company Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/12/1841">12 U.S.C. 1841</external-xref>).</text>
 </paragraph><paragraph id="HCB43E7F316174E77AD79F0529ECE93E7"><enum>(2)</enum><header>Driver's license</header><text>The term <term>driver's license</term> means a license issued by a State to an individual that authorizes the individual to operate a motor vehicle on public streets, roads, or highways.</text>
 </paragraph><paragraph id="H8774FF9A0CC44EB6B0382CFDB9465AE6"><enum>(3)</enum><header>Federal bank secrecy laws</header><text>The term <term>Federal bank secrecy laws</term> means—</text> <subparagraph id="HC3E7AD913D8D4F9E99934970DC08BA55"><enum>(A)</enum><text>section 21 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1829b">12 U.S.C. 1829b</external-xref>);</text>
 </subparagraph><subparagraph id="H5A515EE99EDD4A838166288E607717B4"><enum>(B)</enum><text>section 123 of <external-xref legal-doc="public-law" parsable-cite="pl/91/508">Public Law 91–508</external-xref> (84 Stat. 1116); and</text> </subparagraph><subparagraph id="HC71633D169AD4880A0D96C0D3D8EF045"><enum>(C)</enum><text>subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code.</text>
 </subparagraph></paragraph><paragraph id="HC3097F3465464B30A587A877C33C51C6"><enum>(4)</enum><header>Federally recognized Indian Tribe</header><text display-inline="yes-display-inline">The term <quote>federally recognized Indian Tribe</quote> has the meaning given the term by the Secretary of the Interior under section 104(a) of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131(a)</external-xref>).</text>
 </paragraph><paragraph id="H9C2818C7847344E6855F06463DDE37ED"><enum>(5)</enum><header>Financial institution</header><text>The term <term>financial institution</term> means—</text> <subparagraph id="HCF67A74A0A16491EB37B727A7228D2A8"><enum>(A)</enum><text>an insured depository institution;</text>
 </subparagraph><subparagraph id="HF89EEB66CB3146988447A6F6D77C7B3B"><enum>(B)</enum><text>an insured credit union; or</text> </subparagraph><subparagraph id="HB5C584B60B6B477DA595A21743FDEE86"><enum>(C)</enum><text>any affiliate of an insured depository institution or insured credit union.</text>
 </subparagraph></paragraph><paragraph id="H8FD8682B3DA54BFC9E621387A84FD173"><enum>(6)</enum><header>Financial product or service</header><text>The term <term>financial product or service</term> has the meaning given the term in section 1002(15) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481(15)</external-xref>).</text>
 </paragraph><paragraph id="H47BE3E4291EA4B438FF6E48906AF8AD2"><enum>(7)</enum><header>Insured credit union</header><text>The term <term>insured credit union</term> has the meaning given the term in section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>).</text> </paragraph><paragraph id="HEC2772DE488B43538D286A7AF2EBB810"><enum>(8)</enum><header>Insured depository institution</header><text>The term <term>insured depository institution</term> has the meaning given the term in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>).</text>
 </paragraph><paragraph id="H87D90C428BF24621BB0F5C9EA05EC837"><enum>(9)</enum><header>Online service</header><text>The term <term>online service</term> means any Internet-based service, such as a Web site or mobile application.</text> </paragraph><paragraph id="H3CADCB9C4BA94D6B971892C33FD774D4"><enum>(10)</enum><header>Personal identification card</header><text>The term <term>personal identification card</term> means an identification document issued by a State, local government, or federally recognized Indian Tribe to an individual solely for the purpose of identification of that individual.</text>
 </paragraph><paragraph id="H65B59B8B691E4E65B47DA17D18841DAE"><enum>(11)</enum><header>Personal information</header><text>The term <term>personal information</term> means the information displayed on or electronically encoded on a driver’s license or personal identification card that is reasonably necessary to fulfill the purpose and uses permitted by subsection (b).</text>
 </paragraph><paragraph id="HC8D65ABAF0F64632B7BCFCE8A04562F5"><enum>(12)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means any State, commonwealth, territory, or possession of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, American Samoa, Guam, or the United States Virgin Islands.</text>
 </paragraph><paragraph id="HEEFC830AFD5C47E8A1D1F84FD322AE89"><enum>(13)</enum><header>Scan</header><text>The term <term>scan</term> means the act of using a device or software to decipher, in an electronically readable format, personal information displayed on or electronically encoded on a driver’s license or personal identification card.</text>
				</paragraph></subsection><subsection id="H306A2D9EA49849AB8BAAD562D4975C65"><enum>(b)</enum><header>Use of a driver's license or personal identification card</header>
 <paragraph id="HD12D9EF9107A405687743781C828EB1E"><enum>(1)</enum><header>In general</header><text>When an individual initiates a request through an online service to open an account with a financial institution or obtain a financial product or service from a financial institution, the financial institution may record personal information from a scan of the driver’s license or personal identification card of the individual, or make a copy or receive an image of the driver’s license or personal identification card of the individual, and store or retain such information in any electronic format for the purposes described in paragraph (2).</text>
 </paragraph><paragraph id="H67ACF702434C4D5BA78D26B80195F0F7"><enum>(2)</enum><header>Uses of information</header><text>Except as required to comply with Federal bank secrecy laws, a financial institution may only use the information obtained under paragraph (1)—</text>
 <subparagraph id="HEA3EAB3D161B4FD4818B0F6B2D857E83"><enum>(A)</enum><text>to verify the authenticity of the driver’s license or personal identification card;</text> </subparagraph><subparagraph id="HA0358FD57572450AAD23CF008B9B0435"><enum>(B)</enum><text>to verify the identity of the individual; and</text>
 </subparagraph><subparagraph id="HEA2BA56C09E349159085EB163A13F833"><enum>(C)</enum><text>to comply with a legal requirement to record, retain, or transmit the personal information in connection with opening an account or obtaining a financial product or service.</text>
 </subparagraph></paragraph><paragraph id="H31B5CA3870F0430FA051AB1C67345567"><enum>(3)</enum><header>Deletion of image</header><text display-inline="yes-display-inline">A financial institution that makes a copy or receives an image of a driver’s license or personal identification card of an individual in accordance with paragraph (1) shall, after using the image for the purposes described in paragraph (2), permanently delete, within a reasonable amount of time—</text>
 <subparagraph id="H173FD766701049529E9E16A8C54318F4"><enum>(A)</enum><text>any image of the driver’s license or personal identification card, as applicable; and</text> </subparagraph><subparagraph id="H7AA303CBF1C74C1D958243AFF8C941B8"><enum>(B)</enum><text>any copy of any such image.</text>
 </subparagraph></paragraph></subsection><subsection id="HDAFE641CB38246F6BF49CF149C4C9860"><enum>(c)</enum><header>Disclosure of personal information</header><text>Nothing in this section shall be construed to amend, modify, or otherwise affect any State or Federal laws that govern a financial institution’s disclosure and security of personal information that is not publicly available.</text>
 </subsection><subsection id="HCA0DB5CE43224ADFAB74040D0C970B43"><enum>(d)</enum><header>Relation to State law</header><text>The provisions of this section shall preempt and supersede any State law that conflicts with a provision of this section, but only to the extent of such conflict.</text>
