title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Kevin and Avonte's Law of 2017</short-title></quote>.</text></section><subtitle commented="no" id="H42EA3919307045959D883A966DAE9FC1" level-type="subsequent"><enum>A</enum><header display-inline="yes-display-inline">Missing Alzheimer’s Disease Patient Alert Program reauthorization</header><section commented="no" display-inline="no-display-inline" id="H7A47C4B277F34BBD8AF0E05027472E52" section-type="subsequent-section"><enum>211.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This subtitle may be cited as the <quote><short-title>Missing Americans Alert Program Act of 2017</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H06D6F23751B14D9E8C641127B76FCAAD" section-type="subsequent-section"><enum>212.</enum><header display-inline="yes-display-inline">Reauthorization of the missing Alzheimer’s Disease Patient Alert Program</header><subsection commented="no" display-inline="no-display-inline" id="HD35F9B4F874F492CAABC75423D36F6E6"><enum>(a)</enum><header display-inline="yes-display-inline">Amendments</header><text display-inline="yes-display-inline">Section 240001 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12621">34 U.S.C. 12621</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H4191D601204A416F8013D11BC689BCBD"><enum>(1)</enum><text display-inline="yes-display-inline">in the section header, by striking <quote><header-in-text level="section" style="OLC">Alzheimer's disease patient</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Americans</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H65EBBE875D714FEEA903224E8C010FEF"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HE27F5D06418D43D48E48CC8AE59043CD" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H97A411559B5C42BEA9EF2A22B1A3EF0F"><enum>(a)</enum><header display-inline="yes-display-inline">Grant program To reduce injury and death of missing Americans with dementia and developmental disabilities</header><text display-inline="yes-display-inline">Subject to the availability of appropriations to carry out this section, the Attorney General, through the Bureau of Justice Assistance and in consultation with the Secretary of Health and Human Services—</text><paragraph commented="no" display-inline="no-display-inline" id="H6C789BFA975D4592AB2EEC2B9250AB8A"><enum>(1)</enum><text display-inline="yes-display-inline">shall award competitive grants to health care agencies, State and local law enforcement agencies, or public safety agencies and nonprofit organizations to assist such entities in planning, designing, establishing, or operating locally based, proactive programs to prevent wandering and locate missing individuals with forms of dementia, such as Alzheimer’s Disease, or developmental disabilities, such as autism, who, due to their condition, wander from safe environments, including programs that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HE8F5F1B468B74ABB9842A118BD0E063B"><enum>(A)</enum><text display-inline="yes-display-inline">provide prevention and response information, including online training resources, and referrals to families or guardians of such individuals who, due to their condition, wander from a safe environment;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5F9E07EB18F74F8CA029974BEF7AA56C"><enum>(B)</enum><text display-inline="yes-display-inline">provide education and training, including online training resources, to first responders, school personnel, clinicians, and the public in order to—</text><clause commented="no" display-inline="no-display-inline" id="HDFA7E96B1A14411291F8433C56C87118"><enum>(i)</enum><text display-inline="yes-display-inline">increase the safety and reduce the incidence of wandering of persons, who, due to their dementia or developmental disabilities, may wander from safe environments;</text></clause><clause commented="no" display-inline="no-display-inline" id="H8DD2980886C4418686B25CD0B148A256"><enum>(ii)</enum><text display-inline="yes-display-inline">facilitate the rescue and recovery of individuals who, due to their dementia or developmental disabilities, wander from safe environments; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HF9B3631EC2DD4DC890C788A741BB05D8"><enum>(iii)</enum><text display-inline="yes-display-inline">recognize and respond to and appropriately interact with endangered missing individuals with dementia or developmental disabilities who, due to their condition, wander from safe environments;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H63FB718134094DDF90CCCD5C6F68FD6C"><enum>(C)</enum><text display-inline="yes-display-inline">provide prevention and response training and emergency protocols for school administrators, staff, and families or guardians of individuals with dementia, such as Alzheimer’s Disease, or developmental disabilities, such as autism, to help reduce the risk of wandering by such individuals; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H87C4FAAD5FA54AFAAE6258F385180A19"><enum>(D)</enum><text display-inline="yes-display-inline">develop, operate, or enhance a notification or communications systems for alerts, advisories, or dissemination of other information for the recovery of missing individuals with forms of dementia, such as Alzheimer’s Disease, or with developmental disabilities, such as autism; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCEB03541EDFD4BE7B93A80482EA14495"><enum>(2)</enum><text display-inline="yes-display-inline">shall award grants to health care agencies, State and local law enforcement agencies, or public safety agencies to assist such agencies in designing, establishing, and operating locative tracking technology programs for individuals with forms of dementia, such as Alzheimer's Disease, or children with developmental disabilities, such as autism, who have wandered from safe environments.</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB9A9B24DBE744FAEB4F178D0DCCEFAD1"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H96C3C53E35DC44B8AC317A78C05803C5"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>competitive</quote> after <quote>to receive a</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBC66413372C34CA5BC09BE9478689E7C"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>agency or</quote> before <quote>organization</quote> each place it appears; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H90F090FCF3F14288B195C5F94F893219"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following: <quote>The Attorney General shall periodically solicit applications for grants under this section by publishing a request for applications in the Federal Register and by posting such a request on the website of the Department of Justice.</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H28BA27951BA34A279E970C4200874E9D"><enum>(4)</enum><text display-inline="yes-display-inline">by striking subsections (c) and (d) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H3D3070FB0DD64F59AA8DA89F181629AC" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H75C9AE9014FB4E62B267515E5EA2C363"><enum>(c)</enum><header display-inline="yes-display-inline">Preference</header><text display-inline="yes-display-inline">In awarding grants under subsection (a)(1), the Attorney General shall give preference to law enforcement or public safety agencies that partner with nonprofit organizations that appropriately use person-centered plans minimizing restrictive interventions and that have a direct link to individuals, and families of individuals, with forms of dementia, such as Alzheimer's Disease, or developmental disabilities, such as autism.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HC80982985ECC484A9966201AC7C38853"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $2,000,000 for each of fiscal years 2018 through 2022.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HE832FAA4568E4A84B7305BB1123A9A4B"><enum>(e)</enum><header display-inline="yes-display-inline">Grant accountability</header><text display-inline="yes-display-inline">All grants awarded by the Attorney General under this section shall be subject to the following accountability provisions:</text><paragraph commented="no" display-inline="no-display-inline" id="H8D8A454F046E4EFA863C79372EAC9DDB"><enum>(1)</enum><header display-inline="yes-display-inline">Audit requirement</header><subparagraph commented="no" display-inline="no-display-inline" id="HFEC4050C83BF4D5DAB573FBC72DACFAA"><enum>(A)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this paragraph, the term <term>unresolved audit finding</term> means a finding in the final audit report of the Inspector General of the Department of Justice that the audited grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within 12 months from the date when the final audit report is issued.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEAC6E167DAE14EF183DA41427B885720"><enum>(B)</enum><header display-inline="yes-display-inline">Audits</header><text display-inline="yes-display-inline">Beginning in the first fiscal year beginning after the date of enactment of this subsection, and in each fiscal year thereafter, the Inspector General of the Department of Justice shall conduct audits of recipients of grants under this section to prevent waste, fraud, and abuse of funds by grantees. The Inspector General shall determine the appropriate number of grantees to be audited each year.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H24A9A2EDF0254301B7D62D3FD2A75070"><enum>(C)</enum><header display-inline="yes-display-inline">Mandatory exclusion</header><text display-inline="yes-display-inline">A recipient of grant funds under this section that is found to have an unresolved audit finding shall not be eligible to receive grant funds under this section during the first 2 fiscal years beginning after the end of the 12-month period described in subparagraph (A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE17F514498684F078286A682E816E318"><enum>(D)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In awarding grants under this section, the Attorney General shall give priority to eligible applicants that did not have an unresolved audit finding during the 3 fiscal years before submitting an application for a grant under this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7D890F0B33FA43C1B1032808B6A859E1"><enum>(E)</enum><header display-inline="yes-display-inline">Reimbursement</header><text display-inline="yes-display-inline">If an entity is awarded grant funds under this section during the 2-fiscal-year period during which the entity is barred from receiving grants under subparagraph (C), the Attorney General shall—</text><clause commented="no" display-inline="no-display-inline" id="H66E220E7393D4B97B5394912B82F8AB3"><enum>(i)</enum><text display-inline="yes-display-inline">deposit an amount equal to the amount of the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HC528415B7CB04BBCB285B43E92DC3E15"><enum>(ii)</enum><text display-inline="yes-display-inline">seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H57D91D1EC243421992FFF083E9904524"><enum>(2)</enum><header display-inline="yes-display-inline">Nonprofit organization requirements</header><subparagraph commented="no" display-inline="no-display-inline" id="HFF66DA70863943E7823DA78413B45851"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of nonprofit organization</header><text display-inline="yes-display-inline">For purposes of this paragraph and the grant programs under this section, the term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HECB7EBC6A1854FFB93AD5BC5457D22A9"><enum>(B)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">The Attorney General may not award a grant under this section to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in <external-xref legal-doc="usc" parsable-cite="usc/26/511">section 511(a)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD3191704566643F1966A1144697B9A28"><enum>(C)</enum><header display-inline="yes-display-inline">Disclosure</header><text display-inline="yes-display-inline">Each nonprofit organization that is awarded a grant under this section and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees, and key employees, shall disclose to the Attorney General, in the application for the grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, the Attorney General shall make the information disclosed under this subparagraph available for public inspection.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD9B8E0C57EED48FB9AA9A009C20F8CB2"><enum>(3)</enum><header display-inline="yes-display-inline">Conference expenditures</header><subparagraph commented="no" display-inline="no-display-inline" id="H6228773D6D8C4FC38B95B578B59825B4"><enum>(A)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">No amounts made available to the Department of Justice under this section may be used by the Attorney General, or by any individual or entity awarded discretionary funds through a cooperative agreement under this section, to host or support any expenditure for conferences that uses more than $20,000 in funds made available by the Department of Justice, unless the head of the relevant agency or department, provides prior written authorization that the funds may be expended to host the conference.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFC5615FAC25241D28CC6807238746F57"><enum>(B)</enum><header display-inline="yes-display-inline">Written approval</header><text display-inline="yes-display-inline">Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost of all food, beverages, audio-visual equipment, honoraria for speakers, and entertainment.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H95EF31F029A34548B5E9F25AA0559FE9"><enum>(C)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on all conference expenditures approved under this paragraph.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD7E3EF49407A47EBAB467357D9BA311A"><enum>(4)</enum><header display-inline="yes-display-inline">Annual certification</header><text display-inline="yes-display-inline">Beginning in the first fiscal year beginning after the date of enactment of this subsection, the Attorney General shall submit, to the Committee on the Judiciary and the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives, an annual certification—</text><subparagraph commented="no" display-inline="no-display-inline" id="H8A0812BB10AD4AF295FBCCCFCEAC712E"><enum>(A)</enum><text display-inline="yes-display-inline">indicating whether—</text><clause commented="no" display-inline="no-display-inline" id="HA0B6683383804058BE3D04F4939046D7"><enum>(i)</enum><text display-inline="yes-display-inline">all audits issued by the Office of the Inspector General under paragraph (1) have been completed and reviewed by the appropriate Assistant Attorney General or Director;</text></clause><clause commented="no" display-inline="no-display-inline" id="HFA9211DD17D146F598E60FE78599F97F"><enum>(ii)</enum><text display-inline="yes-display-inline">all mandatory exclusions required under paragraph (1)(C) have been issued; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H8C7C57BEDA6440678F092F59D6C14124"><enum>(iii)</enum><text display-inline="yes-display-inline">all reimbursements required under paragraph (1)(E) have been made; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H984CF7221C924FE8B045E11067A5C2A4"><enum>(B)</enum><text display-inline="yes-display-inline">that includes a list of any grant recipients excluded under paragraph (1) from the previous year.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD66BD14271C247058A5A85D35CDB2E0D"><enum>(f)</enum><header display-inline="yes-display-inline">Preventing duplicative grants</header><paragraph commented="no" display-inline="no-display-inline" id="H86A1AEC0354C42ABA682A8E240AD7D61"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Before the Attorney General awards a grant to an applicant under this section, the Attorney General shall compare potential grant awards with other grants awarded by the Attorney General to determine if grant awards are or have been awarded for a similar purpose.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H640F070CE6AF4D40BC79E39D11DC1C6D"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">If the Attorney General awards grants to the same applicant for a similar purpose the Attorney General shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report that includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF045828D67BB4E8897EFEE287DCA05BF"><enum>(A)</enum><text display-inline="yes-display-inline">a list of all such grants awarded, including the total dollar amount of any such grants awarded; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2619CE7F6D6C449E8DBBFFB4D0EF0876"><enum>(B)</enum><text display-inline="yes-display-inline">the reason the Attorney General awarded multiple grants to the same applicant for a similar purpose.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE6A9B41615FB473BA0E3DC71B1D931B4"><enum>(b)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act and every year thereafter, the Attorney General shall submit to the Committee on the Judiciary and the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives a report on the Missing Americans Alert Program, as amended by subsection (a), which shall address—</text><paragraph commented="no" display-inline="no-display-inline" id="H1CFEA2BEFEF9435685EB10F4186AC40E"><enum>(1)</enum><text display-inline="yes-display-inline">the number of individuals who benefitted from the Missing Americans Alert Program, including information such as the number of individuals with reduced unsafe wandering, the number of people who were trained through the program, and the estimated number of people who were impacted by the program;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB46594FE9EA7408DB16A332E14F1FD38"><enum>(2)</enum><text display-inline="yes-display-inline">the number of State, local, and tribal law enforcement or public safety agencies that applied for funding under the Missing Americans Alert Program;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HECF2602279364D8CBFAD8DECF173BDEF"><enum>(3)</enum><text display-inline="yes-display-inline">the number of State, local, and tribal local law enforcement or public safety agencies that received funding under the Missing Americans Alert Program, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="H882D69CAF3384F698FE2A5AD8BF350C3"><enum>(A)</enum><text display-inline="yes-display-inline">the number of State, local, and tribal law enforcement or public safety agencies that used such funding for training; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H44454B48482045F789F184E3B3A678D6"><enum>(B)</enum><text display-inline="yes-display-inline">the number of State, local, and tribal law enforcement or public safety agencies that used such funding for designing, establishing, or operating locative tracking technology;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E223BAFAFD1414281284EDFAFADAD8D"><enum>(4)</enum><text display-inline="yes-display-inline">the companies, including the location (city and State) of the headquarters and local offices of each company, for which their locative tracking technology was used by State, local, and tribal law enforcement or public safety agencies;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEF0DD56844754E939F0AD1786A421026"><enum>(5)</enum><text display-inline="yes-display-inline">the nonprofit organizations, including the location (city and State) of the headquarters and local offices of each organization, that State, local, and tribal law enforcement or public safety agencies partnered with and the result of each partnership;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H873B64EDACA849E890D58D820214034A"><enum>(6)</enum><text display-inline="yes-display-inline">the number of missing children with autism or another developmental disability with wandering tendencies or adults with Alzheimer's being served by the program who went missing and the result of the search for each such individual; id="H5C7AA40555344D3799F780367BA1184A"><enum>(1)</enum><header display-inline="yes-display-inline">Child</header><text display-inline="yes-display-inline">The term <term>child</term> means an individual who is less than 18 years of age.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H66DCB0A60341443E8D7D6FDE670D3653"><enum>(2)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> has the meaning given that term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H92A865AD75DC4123B86070DF6DFECB95"><enum>(3)</enum><header display-inline="yes-display-inline">Law enforcement agency</header><text display-inline="yes-display-inline">The term <term>law enforcement agency</term> means an agency of a State, unit of local government, or Indian tribe that is authorized by law or by a government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6FB0F5F8512F4B42B2164DBFA72B8602"><enum>(4)</enum><header display-inline="yes-display-inline">Non-invasive and non-permanent</header><text display-inline="yes-display-inline">The term <quote>non-invasive and non-permanent</quote> means, with regard to any technology or device, that the procedure to install the technology or device does not create an external or internal marker or implant a device, such as a microchip, or other trackable items.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCFDBAF9102A7498CB7BADC41AF73CA3E"><enum>(5)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, American Samoa, Guam, and the Commonwealth of the Northern Mariana Islands.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CECBA05A3214A3AA009E27EE59CEA67"><enum>(6)</enum><header display-inline="yes-display-inline">Unit of local government</header><text display-inline="yes-display-inline">The term <term>unit of local government</term> means a county, municipality, town, township, village, parish, borough, or other unit of general government below the State level.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="H5072786DB63845ECAF66CEE7E3077493" section-type="subsequent-section"><enum>242.</enum><header display-inline="yes-display-inline">Standards and best practices for use of non-invasive and non-permanent tracking devices</header><subsection commented="no" display-inline="no-display-inline" id="H25E7A32DDA3B470E950B9D808FABC40A"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="H392B2C84B1BA47FBAB8A89019353401D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Attorney General, in consultation with the Secretary of Health and Human Services and leading research, advocacy, self-advocacy, and service organizations, shall establish standards and best practices relating to the use of non-invasive and non-permanent tracking technology, where a guardian or parent has determined that a non-invasive and non-permanent tracking device is the least restrictive alternative, to locate individuals as described in subsection (a)(2) of section 240001 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12621">34 U.S.C. 12621</external-xref>), as added by this title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFD2CADEB870F49D796AAED52AD5B1A29"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In establishing the standards and best practices required under paragraph (1), the Attorney General shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HEAF0CDCA580641D09EEE4DB27B1E6932"><enum>(A)</enum><text display-inline="yes-display-inline">determine—</text><clause commented="no" display-inline="no-display-inline" id="H39F86829B3A347C5B3013B3B5AF2D158"><enum>(i)</enum><text display-inline="yes-display-inline">the criteria used to determine which individuals would benefit from the use of a tracking device;</text></clause><clause commented="no" display-inline="no-display-inline" id="HFB2D7A9223AA4D9B97C7EFB6E23E75D7"><enum>(ii)</enum><text display-inline="yes-display-inline">the criteria used to determine who should have direct access to the tracking system; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H69743CAC15744477AE6FE419E6E7A29E"><enum>(iii)</enum><text display-inline="yes-display-inline">which non-invasive and non-permanent types of tracking devices can be used in compliance with the standards and best practices; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD68F8A234A1A412BA73C6DDBDA8A3F94"><enum>(B)</enum><text display-inline="yes-display-inline">establish standards and best practices the Attorney General determines are necessary to the administration of a tracking system, including procedures to—</text><clause commented="no" display-inline="no-display-inline" id="H03E99D6613C24BA9B8B766E7C317BD42"><enum>(i)</enum><text display-inline="yes-display-inline">safeguard the privacy of the data used by the tracking device such that—</text><subclause commented="no" display-inline="no-display-inline" id="H3FBF6D7ADA904E0784A5BBFEB4FDC0AC"><enum>(I)</enum><text display-inline="yes-display-inline">access to the data is restricted to law enforcement and health agencies determined necessary by the Attorney General; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H649438F020204F0EB904FAFB40F2CC38"><enum>(II)</enum><text display-inline="yes-display-inline">collection, use, and retention of the data is solely for the purpose of preventing injury to or death of the individual wearing the tracking device;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H8D1CCA4376D54797AEF1160D61F7A917"><enum>(ii)</enum><text display-inline="yes-display-inline">establish criteria to determine whether use of the tracking device is the least restrictive alternative in order to prevent risk of injury or death before issuing the tracking device, including the previous consideration of less restrictive alternatives;</text></clause><clause commented="no" display-inline="no-display-inline" id="H039CF2DFE77F49E680E3A81C4DF433AA"><enum>(iii)</enum><text display-inline="yes-display-inline">provide training for law enforcement agencies to recognize signs of abuse during interactions with applicants for tracking devices;</text></clause><clause commented="no" display-inline="no-display-inline" id="H59BACF7FBA194D7F83298FBCD83324A7"><enum>(iv)</enum><text display-inline="yes-display-inline">protect the civil rights and liberties of the individuals who use tracking devices, including their rights under the Fourth Amendment to the Constitution of the United States;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC2CEBA25F70A49B194FE106065EE31E4"><enum>(v)</enum><text display-inline="yes-display-inline">establish a complaint and investigation process to address—</text><subclause commented="no" display-inline="no-display-inline" id="H128B0B6FE4D948C7A9E68EAF04DF8527"><enum>(I)</enum><text display-inline="yes-display-inline">incidents of noncompliance by recipients of grants under subsection (a)(2) of section 240001 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12621">34 U.S.C. 12621</external-xref>), as added by this title, with the best practices established by the Attorney General or other applicable law; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6C70C471CE3747169AADBA2701171EAA"><enum>(II)</enum><text display-inline="yes-display-inline">use of a tracking device over the objection of an individual; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H480EA5FD696346FBB60B15C1149F57F7"><enum>(vi)</enum><text display-inline="yes-display-inline">determine the role that State agencies should have in the administration of a tracking system.</text></clause></subparagraph></paragraph><paragraph id="id4fe62f621e38478e93b7b3af5bbf49f1"><enum>(3)</enum><header>Effective date</header><text>The standards and best practices established pursuant to paragraph (1) shall take effect 90 days after publication of such standards and practices by the Attorney General.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB047B5948E274E8AACCC75657D4DE32E"><enum>(b)</enum><header display-inline="yes-display-inline">Required compliance</header><paragraph commented="no" display-inline="no-display-inline" id="HC81B92104CBC42F496CD5BB89B97DBD3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each entity that receives a grant under subsection (a)(2) of section 240001 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12621">34 U.S.C. 12621</external-xref>), as added by this title, shall comply with any standards and best practices relating to the use of tracking devices established by the Attorney General in accordance with subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41919C22DD0549DE8D302CCDC58A0AED"><enum>(2)</enum><header display-inline="yes-display-inline">Determination of compliance</header><text display-inline="yes-display-inline">The Attorney General, in consultation with the Secretary of Health and Human Services, shall determine whether an entity that receives a grant under subsection (a)(2) of section 240001 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12621">34 U.S.C. 12621</external-xref>), as added by this title, acts in compliance with the standards and best practices described in paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1B27A764A60E48F3809923C9B3B9CE06"><enum>(c)</enum><header display-inline="yes-display-inline">Applicability of standards and best practices</header><text display-inline="yes-display-inline">The standards and best practices established by the Attorney General under subsection (a) shall apply only to the grant programs authorized under subsection (a)(2) of section 240001 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12621">34 U.S.C. 12621</external-xref>), as added by this title.</text></subsection><subsection id="H314FD52348C74079BDC2C93E8FE678BE"><enum>(d)</enum><header>Limitations on program</header><paragraph id="H1DE80F6FCBDA49F2846E2F097560B8DA"><enum>(1)</enum><header>Data storage</header><text display-inline="yes-display-inline">Any tracking data provided by tracking devices issued under this program may not be used by a Federal entity to create a database.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H15BD78A0EB7C45189FD3F9A1C87EEFFF"><enum>(2)</enum><header>Voluntary participation</header><text display-inline="yes-display-inline">Nothing in this title may be construed to require that a parent or guardian use a tracking device to monitor the location of a child or adult under that parent or guardian’s supervision if the parent or guardian does not believe that the use of such device is necessary or in the interest of the child or adult under supervision.</text></paragraph></subsection></section></subtitle></title></amendment-block></amendment></engrossed-amendment-body><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
