 <section id="H81CFD4DD5FAC4A3695A41AF51DDE7C14" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans E-Health and Telemedicine Support Act of 2017</short-title></quote> or the <quote><short-title>VETS Act of 2017</short-title></quote>.</text> </section><section id="H463FD7953FF84208A2CF56716A643CF8"><enum>2.</enum><header>Licensure of health care professionals of the department of veterans affairs providing treatment via telemedicine</header> <subsection id="H8EEBC40953F843BE9556A9B11C702BD6"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">Chapter 17</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1730A">section 1730A</external-xref> the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H2C3C1A73A6FE4F25AA0739C143F82EDB" style="USC">
					<section id="H304226F3C50846BFB5E80AE36EE3C107"><enum>1730B.</enum><header>Licensure of health care professionals providing treatment via telemedicine</header>
 <subsection id="H328BF25AB3BA4BAA92A14561E18E2278"><enum>(a)</enum><header>In general</header><text>Notwithstanding any provision of law regarding the licensure of health care professionals, a covered health care professional may practice the health care profession of the health care professional at any location in any State, regardless of where the covered health care professional or the patient is located, if the covered health care professional is using telemedicine to provide treatment to an individual under this chapter.</text>
 </subsection><subsection id="H927AD53B2A8C41E4AC661E8C5256B9E6"><enum>(b)</enum><header>Property of federal government</header><text>Subsection (a) shall apply to a covered health care professional providing treatment to a patient regardless of whether the covered health care professional or patient is located in a facility owned by the Federal Government during such treatment.</text>
 </subsection><subsection id="H60F5FEEF56BB4FE6815D149B52142C66"><enum>(c)</enum><header>Construction</header><text>Nothing in this section may be construed to remove, limit, or otherwise affect any obligation of a covered health care professional under the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.).</text>
 </subsection><subsection id="H1EC8EDC1097E42638CDEB5E83236D679"><enum>(d)</enum><header>Covered health care professional defined</header><text>In this section, the term <term>covered health care professional</term> means a health care professional who—</text> <paragraph id="HDA1925B91EAD489DA973CAC029DCDB70"><enum>(1)</enum><text>is an employee of the Department appointed under the authority under sections 7306, 7401, 7405, 7406, or 7408 of this title, or title 5;</text>
 </paragraph><paragraph id="H01E3A9A56D4A4DA380720388F843D821"><enum>(2)</enum><text>is authorized by the Secretary to provide health care under this chapter;</text> </paragraph><paragraph id="H9BB68FFF6CCF4DA8A20012DF3906B0C5"><enum>(3)</enum><text>is required to adhere to all quality standards relating to the provision of telemedicine in accordance with applicable policies of the Department; and</text>
 </paragraph><paragraph id="H28D9727E6ED04EB19A4A4B8DCBD0775A"><enum>(4)</enum><text>has an active, current, full, and unrestricted license, registration, or certification in a State to practice the health care profession of the health care professional.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H06D69B86F0BE4DF3AA7F23BCE18FA275"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 17 of such title is amended by inserting after the item relating to section 1730A the following new item:</text>

						<toc-entry level="section">1730B. Licensure of health care professionals providing treatment via telemedicine.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1D650C2383364A66B25325B283543124"><enum>(c)</enum><header>Report on telemedicine</header>
 <paragraph id="HE7EC32F3B076484BA2D2DE0CDE5F5FCE"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the effectiveness of the use of telemedicine by the Department of Veterans Affairs.</text>
 </paragraph><paragraph id="H8C84BA06A9624B7C9B4CBE6D16C4D12A"><enum>(2)</enum><header>Elements</header><text>The report required by paragraph (1) shall include an assessment of the following:</text> <subparagraph id="H066CD77DF9934C83852B4A5980D7D8B1"><enum>(A)</enum><text>The satisfaction of veterans with telemedicine furnished by the Department.</text>
 </subparagraph><subparagraph id="HDB4D2F2428F24E708AB3FEB4A554675F"><enum>(B)</enum><text>The satisfaction of health care providers in providing telemedicine furnished by the Department.</text> </subparagraph><subparagraph id="HB21458B1CCAB400CAE69AA26F9C99AA6"><enum>(C)</enum><text>The effect of telemedicine furnished by the Department on the following:</text>
 <clause id="H2A56F36137154093BFF407D8C81353F0"><enum>(i)</enum><text>The ability of veterans to access health care, whether from the Department or from non-Department health care providers.</text>
 </clause><clause id="HEDB400F9479B4CD593AC22F6CFD11553"><enum>(ii)</enum><text>The frequency of use by veterans of telemedicine.</text> </clause><clause id="H03B7A635260F46CA8A972F2BD8F841F1"><enum>(iii)</enum><text>The productivity of health care providers.</text>
 </clause><clause id="H85BC3A153A9441F0975116C2D31F3A06"><enum>(iv)</enum><text>Wait times for an appointment for the receipt of health care from the Department.</text> </clause><clause id="H618B5B59D4BE4C7C9A837B068A2F01E4"><enum>(v)</enum><text>The reduction, if any, in the use by veterans of in-person services at Department facilities and non-Department facilities.</text>
 </clause></subparagraph><subparagraph id="H8AFB675DA2674E3DA146B670992BA262"><enum>(D)</enum><text>The types of appointments for the receipt of telemedicine furnished by the Department that were provided during the 1-year period preceding the submittal of the report.</text>
 </subparagraph><subparagraph id="H8E62598F17304883968C80CDC16A661F"><enum>(E)</enum><text>The number of appointments for the receipt of telemedicine furnished by the Department that were requested during such period, disaggregated by Veterans Integrated Service Network.</text>
 </subparagraph><subparagraph id="H9D7AFBD3CDBF4C69B01F79D2582825C8"><enum>(F)</enum><text>Savings by the Department, if any, including travel costs, of furnishing health care <pagebreak></pagebreak>through the use of telemedicine during such period.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
