<section id="H86E807C6A6DC476A9403E418378105EC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Banking for Human Traffickers Act of 2018</short-title></quote>.</text> </section> <section id="HB84AC9BE644F4645B062F674575AAEEE"><enum>2.</enum><header>Increasing the role of the financial industry in combating human trafficking</header> <subsection id="H06A5A30427344F03BDCC2BD149E2AF2A"><enum>(a)</enum><header>Treasury as a member of the President’s Interagency Task Force To Monitor and Combat Trafficking</header><text>Section 105(b) of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(b)</external-xref>) is amended by inserting <quote>the Secretary of the Treasury,</quote> after <quote>the Secretary of Education,</quote>.</text> </subsection> 
<subsection id="H537D7075343A47C3BCA805EC9F1349E8"><enum>(b)</enum><header>Required review of procedures</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Financial Institutions Examination Council, in consultation with the Secretary of the Treasury, the private sector, and appropriate law enforcement agencies, shall—</text> <paragraph id="H271B937062684A189512BDFFF0BB9B35"><enum>(1)</enum><text display-inline="yes-display-inline">review and enhance training and examinations procedures to improve the capabilities of anti-money laundering and countering the financing of terrorism programs to detect financial transactions relating to severe forms of trafficking in persons;</text></paragraph> 
<paragraph id="HEDAD8C2569354EE3B065DEFEE74349DA"><enum>(2)</enum><text display-inline="yes-display-inline">review and enhance procedures for referring potential cases relating to severe forms of trafficking in persons to the appropriate law enforcement agency; and</text></paragraph> <paragraph id="H8ECDE6BD02264D10BBA0C4669CA49820"><enum>(3)</enum><text display-inline="yes-display-inline">determine, as appropriate, whether requirements for financial institutions are sufficient to detect and deter money laundering relating to severe forms of trafficking in persons.</text></paragraph></subsection> 
<subsection id="H11CE312A7BEB4D8C9FF4C48DBC13316E"><enum>(c)</enum><header>Interagency task force recommendations targeting money laundering related to human trafficking</header> 
<paragraph id="HBDE3BE4181624C7EB3FB38B777D0DED8"><enum>(1)</enum><header>In general</header><text>Not later than 270 days after the date of the enactment of this Act, the Interagency Task Force to Monitor and Combat Trafficking shall submit to the Committee on Financial Services and the Committee on the Judiciary of the House of Representatives, the Committee on Banking, Housing, and Urban Affairs and the Committee on the Judiciary of the Senate, and the head of each appropriate Federal banking agency—</text> <subparagraph id="H832123A9F65341429325275AB8BA694A"><enum>(A)</enum><text display-inline="yes-display-inline">an analysis of anti-money laundering efforts of the United States Government and United States financial institutions relating to severe forms of trafficking in persons; and</text></subparagraph> 
<subparagraph id="H54F98B25C8A74501853D8CD9D549CFBB"><enum>(B)</enum><text display-inline="yes-display-inline">appropriate legislative, administrative, and other recommendations to strengthen efforts against money laundering relating to severe forms of trafficking in persons.</text></subparagraph></paragraph> <paragraph id="H89996F75A7DB4988BFDBFD762CB02ED7"><enum>(2)</enum><header>Required recommendations</header><text>The recommendations under paragraph (1) shall include—</text> 
<subparagraph id="H8493423D66B744769CE0CED937F857E7"><enum>(A)</enum><text display-inline="yes-display-inline">feedback from financial institutions on best practices of successful programs to combat severe forms of trafficking in persons currently in place that may be suitable for broader adoption by similarly situated financial institutions;</text></subparagraph> <subparagraph id="H958BAA7515E242DB983238ED56D8EE3B"><enum>(B)</enum><text display-inline="yes-display-inline">feedback from stakeholders, including victims of severe forms of trafficking in persons and financial institutions, on policy proposals derived from the analysis conducted by the task force referred to in paragraph (1) that would enhance the efforts and programs of financial institutions to detect and deter money laundering relating to severe forms of trafficking in persons, including any recommended changes to internal policies, procedures, and controls relating to severe forms of trafficking in persons;</text></subparagraph> 
<subparagraph id="H088D1FE172D54685949F95928C6E634F"><enum>(C)</enum><text display-inline="yes-display-inline">any recommended changes to training programs at financial institutions to better equip employees to deter and detect money laundering relating to severe forms of trafficking in persons;</text></subparagraph> <subparagraph id="H8E9E6393D6964BA6B28E6BD3B111D782"><enum>(D)</enum><text display-inline="yes-display-inline">any recommended changes to expand information sharing relating to severe forms of trafficking in persons among financial institutions and between such financial institutions, appropriate law enforcement agencies, and appropriate Federal agencies; and</text></subparagraph> 
<subparagraph id="H9B6B8A16456A4E42B4905BB3F0D9DCFE"><enum>(E)</enum><text display-inline="yes-display-inline">recommended changes, if necessary, to existing statutory law to more effectively detect and deter money laundering relating to severe forms of trafficking in persons, where such money laundering involves the use of emerging technologies and virtual currencies.</text></subparagraph></paragraph></subsection> <subsection id="HE460C3999768435B9F4816F16E1E54ED"><enum>(d)</enum><header>Limitation</header><text>Nothing in this Act shall be construed to grant rulemaking authority to the Interagency Task Force to Monitor and Combat Trafficking.</text> </subsection> 
<subsection id="H91D48CC161B740A2BE702700E581270D"><enum>(e)</enum><header>Definitions</header><text>As used in this section—</text> <paragraph id="HC41C4EF1C6B9422F934B1A0453AE78D4"><enum>(1)</enum><text>the term <term>appropriate Federal banking agency</term> has the meaning given the term in section 3(q) of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813(q)</external-xref>);</text> </paragraph> 
<paragraph id="HC663C8D8BDFC4D30BF23032FC87597CF" commented="no"><enum>(2)</enum><text>the term <quote>severe forms of trafficking in persons</quote> has the meaning given such term in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>); </text> </paragraph> <paragraph id="H43D488AD5D9948CE92C64427905C89E2"><enum>(3)</enum><text>the term <term>Interagency Task Force to Monitor and Combat Trafficking</term> means the Interagency Task Force to Monitor and Combat Trafficking established by the President pursuant to section 105 of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103</external-xref>); and</text> </paragraph> 
<paragraph id="H452647C3274E4909B3DE24D2443F7F4E"><enum>(4)</enum><text>the term <term>law enforcement agency</term> means an agency of the United States, a State, or a political subdivision of a State, authorized by law or by a government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal or civil law.</text> </paragraph></subsection></section> <section id="H7444D93CD9DD4F13B9E1B42F455B4605"><enum>3.</enum><header>Coordination of human trafficking issues by the Office of Terrorism and Financial Intelligence</header> <subsection id="H7C85D40932B648FEB5F219CD4A4B5CB3"><enum>(a)</enum><header>Functions</header><text>Section 312(a)(4) of title 31, United States Code, is amended—</text> 
<paragraph id="H5DE1F8D0FDD94F99B15C6D4B402A237E"><enum>(1)</enum><text>by redesignating subparagraphs (E), (F), and (G) as subparagraphs (F), (G), and (H), respectively; and</text></paragraph> <paragraph id="H4A6E695BED5A497CA9E0B7990BD1E985"><enum>(2)</enum><text>by inserting after subparagraph (D) the following:</text>

<subparagraph id="H0D38217FD003499A9EB1DDAA7C7F9418"><enum>(E)</enum><text display-inline="yes-display-inline">combating illicit financing relating to severe forms of trafficking in persons;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H1EBCA631FB694254A359A10A5669EF36"><enum>(b)</enum><header>Interagency coordination</header><text display-inline="yes-display-inline">Section 312(a) of title 31, United States Code, is amended by adding at the end the following:</text>

<paragraph id="HBAA5F0344C944A2192532B5A5F103AD2"><enum>(8)</enum><header>Interagency coordination</header><text>The Secretary of the Treasury, after consultation with the Undersecretary for Terrorism and Financial Crimes, shall designate an office within the OTFI that shall coordinate efforts to combat the illicit financing of severe forms of trafficking in persons with—</text> <subparagraph id="H77E6200294054A11A006C30C2EC0F1E9"><enum>(A)</enum><text>other offices of the Department of the Treasury;</text></subparagraph> 
<subparagraph id="H8637415EF8E54EFB98BDF90248F55F18"><enum>(B)</enum><text>other Federal agencies, including—</text> <clause id="H64381B994F9C4F238860E31695AAAAE5"><enum>(i)</enum><text>the Office to Monitor and Combat Trafficking in Persons of the Department of State; and</text></clause> 
<clause id="H672CDCB7228444B3AC89629ABA09114E"><enum>(ii)</enum><text>the Interagency Task Force to Monitor and Combat Trafficking;</text></clause></subparagraph> <subparagraph id="HA91E537BF3984D3C9BC04D74B20BE56D"><enum>(C)</enum><text>State and local law enforcement agencies; and</text></subparagraph> 
<subparagraph id="H3224437649C645178ECA7F4C2CD3F64F"><enum>(D)</enum><text>foreign governments.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H86C957BFFF094EAB92BC47662005F800"><enum>(c)</enum><header>Definition</header><text>Section 312(a) of title 31, United States Code, as amended by this section, is further amended by adding at the end the following:</text>

<paragraph id="H5F5611C839BC407F8D7506993940A211"><enum>(9)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <quote>severe forms of trafficking in persons</quote> has the meaning given such term in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H2EDFBA6B7C6945B69D4E19C27CA18111"><enum>4.</enum><header>Additional reporting requirement under the Trafficking Victims Protection Act of 2000</header><text display-inline="no-display-inline">Section 105(d)(7) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(d)(7)</external-xref>) is amended—</text> 
<paragraph id="H9F4722E87CC043BCB178EBBE0819D52B"><enum>(1)</enum><text>in the matter preceding subparagraph (A)—</text> <subparagraph id="HF3EB55FDD8754DC1830430EE4018968F"><enum>(A)</enum><text>by inserting <quote>the Committee on Financial Services,</quote> after <quote>the Committee on Foreign Affairs,</quote>; and</text></subparagraph> 
<subparagraph id="H628F6D17B5CC4CC1B04BCE760C34FAA4"><enum>(B)</enum><text>by inserting <quote>the Committee on Banking, Housing, and Urban Affairs,</quote> after <quote>the Committee on Foreign Relations,</quote>;</text></subparagraph></paragraph> <paragraph id="HE2D86C66EF4D4C47926E37EF71F7E24D"><enum>(2)</enum><text>in subparagraph (Q)(vii), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph> 
<paragraph id="H42F48E346B9F4E3DB83E80860DA80F2A"><enum>(3)</enum><text>in subparagraph (R), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="H4F554664E8944227AAF0F7F3D7F5F71B"><enum>(4)</enum><text>by adding at the end the following: </text>

<subparagraph id="H8F0D5AE8B0AD41B68DFABD96E3C07508"><enum>(S)</enum><text display-inline="yes-display-inline">the efforts of the United States to eliminate money laundering relating to severe forms of trafficking in persons and the number of investigations, arrests, indictments, and convictions in money laundering cases with a nexus to severe forms of trafficking in persons.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HA79B259C6060438687DBAA5FDB7A8060"><enum>5.</enum><header>Minimum standards for the elimination of trafficking</header><text display-inline="no-display-inline">Section 108(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7106">22 U.S.C. 7106(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H4CB67E257B7740489D98AFEDB2F13D1D"><enum>(13)</enum><text display-inline="yes-display-inline">Whether the government of the country, consistent with the capacity of the country, has in effect a framework to prevent financial transactions involving the proceeds of severe forms of trafficking in persons, and is taking steps to implement such a framework, including by investigating, prosecuting, convicting, and sentencing individuals who attempt or conduct such transactions.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> <attestation><attestation-group><attestation-date date="20180410" chamber="House">Passed the House of Representatives April 10, 2018.</attestation-date><attestor display="no">Karen L.
