<official-title display="yes">To amend the Veterans Access, Choice, and Accountability Act of 2014 to improve the access of veterans to organ transplants, and for other purposes.<pagebreak/></official-title>

<section id="HF5E932BDF2C94F509BAFBE6B68A2A411" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Increased Choice for Transplanted Organs and Recovery Act of 2017</short-title></quote> or the <quote><short-title>VICTOR Act of 2017</short-title></quote>.</text> </section> <section id="H899339FEA7F64FE3B941DD347004C110"><enum>2.</enum><header>Organ transplants under the Veterans Choice Program</header><text display-inline="no-display-inline">Section 101(b)(2) of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note) is amended—</text> 
<paragraph id="HBE6B1FAC840B41AF904234C3546A7C02"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (C)(ii), by striking <quote>or</quote>;</text> </paragraph> <paragraph id="H99FD78EBA8F94A2C87AF29AFFF6F5E99"><enum>(2)</enum><text>in subparagraph (D)(ii)(II)(dd), by striking the period and inserting <quote>; or</quote>; and</text> </paragraph>
<paragraph id="HE827C2F8AD254F0393CA245BA69D0683"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text> <quoted-block changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H1DAA9495F8944BD98183EFD97FE28185" reported-display-style="italic" style="USC"> <subparagraph id="HFFD009D4CD7546598936D3C57FC6EEF9"><enum>(E)</enum> <clause commented="no" display-inline="yes-display-inline" id="H732F7C72F49E4BB089C577E37954F53B"><enum>(i)</enum><text>requires an organ or bone marrow transplant; and</text> </clause>
<clause changed="added" committee-id="HVR00" id="H175C7942C3E3429586EF9B823ACDC53B" indent="up1" reported-display-style="italic"><enum>(ii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="H2A6C3E7876C94E97B73A21A74D072136"><enum>(I)</enum><text>has, in the opinion of the primary health care provider of the veteran, a medically compelling reason to travel outside the region of the Organ Procurement and Transplantation Network, established under section 372 of the National Organ Transplantation Act (<external-xref legal-doc="public-law" parsable-cite="pl/98/507">Public Law 98–507</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/274">42 U.S.C. 274</external-xref>), in which the veteran resides to receive such transplant at a medical facility of the Department; or</text> </subclause> <subclause changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H50AE7C2CC9C84CA0BBDC55A917667720" indent="up1" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">faces an unusual or excessive burden in receiving such transplant at a medical facility of the Department, including—</text> 
<item id="H7A88C1A426064CD18130F3A271D169B2"><enum>(aa)</enum><text>geographical challenges;</text> </item> <item id="HA5695F28DBE44709AE219A6FB2ED69D9"><enum>(bb)</enum><text>environmental factors, including roads that are not accessible to the general public, traffic, or hazardous weather;</text> </item>
<item id="HA7389E18501C4F0E80AFB167F160017F"><enum>(cc)</enum><text>a medical condition of the veteran that affects the ability to travel; or</text> </item> <item commented="no" id="HD67C594388F546D79CE5CFD814DD24D3"><enum>(dd)</enum><text display-inline="yes-display-inline">other factors the Secretary determines appropriate, including the preference of the veteran to receive such transplant at a non-Department facility.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
<section id="H75A56F260FEB4273A0676623FAF71945"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the later of—</text> <paragraph id="HF3D3A4A577434C4A9D837A67639EC639"><enum>(1)</enum><text>October 1, 2018; and</text> </paragraph>
