This Act and such amendments shall be carried out using amounts otherwise available for such purposes.</text>
 </section><section id="H20B8D7C7E7C94A51BBD943474CE377C2"><enum>3.</enum><header>Definition of congressional homeland security committees</header><text display-inline="no-display-inline">In this Act, the term <quote>congressional homeland security committees</quote> means—</text> <paragraph id="H839E276F2E0E461587E433D61F256A27"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text>
 </paragraph><paragraph id="HBFE43DEEB8AD4B7D9D89E218EC77587B"><enum>(2)</enum><text>the Committee on Appropriations of the House of Representatives and the Committee on Appropriations of the Senate.</text>
			</paragraph></section><title id="HDBC7E885E1CF43BA8D3DA3D9AADC03B7"><enum>I</enum><header>Department of Homeland Security Headquarters</header>
			<section id="HAC949AD7E5704B4B80BFA9DF805BFFDB"><enum>101.</enum><header>Homeland security enterprise defined</header>
 <text display-inline="no-display-inline">Section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>) is amended—</text> <paragraph commented="no" id="H291F5907FFB04F51A3EECF182F24AC00"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (9) through (20) as paragraphs (10) through (21), respectively; and</text>
 </paragraph><paragraph id="H991E8B1F57FB49B097F29F21E827A611"><enum>(2)</enum><text>by inserting after paragraph (8) the following new paragraph (9):</text> <quoted-block display-inline="no-display-inline" id="HB75F7F087B764AFEA0B29F1DC8D6E6F6" style="OLC"> <paragraph id="HDACF135B3DCE426FAA3D3BA494918E8A"><enum>(9)</enum><text display-inline="yes-display-inline">The term <quote>homeland security enterprise</quote> means any relevant governmental or nongovernmental entity involved in homeland security, including a Federal, State, or local government official, private sector representative, academic, or other policy expert.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H2F294130D6A34A3DB663495115F009D7"><enum>102.</enum><header>Functions and components of Headquarters of Department of Homeland Security</header><text display-inline="no-display-inline">Section 102 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/112">6 U.S.C. 112</external-xref>) is amended—</text> <paragraph id="H136C2919BEAD45FA8EA71B33BBB230E2"><enum>(1)</enum><text>in subsection (c)—</text>
 <subparagraph id="H9BC761651F994F15B295A2A9C9102B24"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>through the Office of State and Local Coordination (established under section 801)</quote> and inserting <quote>through the Office of Partnership and Engagement</quote>;</text> </subparagraph><subparagraph id="H8A887837332C478AA1EB0CF056BFF456"><enum>(B)</enum><text>in paragraph (2), by striking <quote>and</quote> after the semicolon at the end;</text>
 </subparagraph><subparagraph id="HA8B414DF166942A0AEFE073D5C8D1CCA"><enum>(C)</enum><text>in paragraph (3), by striking the period and inserting <quote>; and</quote>; and</text> </subparagraph><subparagraph id="H11C31FE2A8B84578AD6646E8CE0EEBB4"><enum>(D)</enum><text>by adding at the end the following:</text>

 <paragraph id="HCC6B43EF0DAF447C8E4BD26264FEBD3F"><enum>(4)</enum><text>entering into agreements with governments of other countries, in consultation with the Secretary of State, and international nongovernmental organizations in order to achieve the missions of the Department.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H2C061A8FA89F4443B9BDE7B80C92D71D"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block id="H1AA6813413DD4973AB45ECAB5ABD3A1C" style="OLC"> <subsection id="H3FD77B32A0044A80B3471B0717F7BEBD"><enum>(h)</enum><header>Headquarters</header> <paragraph id="H20369EBCB6C14A5184667AA306DFC5A6"><enum>(1)</enum><header>Components</header><text>There is in the Department a Headquarters. The Department Headquarters shall include each of the following:</text>
 <subparagraph id="HA0EDE2D5A0CB48B6A18F884799E0F44A"><enum>(A)</enum><text>The Office of the Secretary.</text> </subparagraph><subparagraph id="HB5DC5DE14C20473BB7A68509B4DCE883"><enum>(B)</enum><text>The Office of the Deputy Secretary.</text>
 </subparagraph><subparagraph id="H963ACE3BE84A4AC78BC1B2269F079BB5"><enum>(C)</enum><text>The Executive Secretary.</text> </subparagraph><subparagraph id="H9A19459735A444C989863DBC2DE957F4"><enum>(D)</enum><text>The Management Directorate, including the Office of the Chief Financial Officer.</text>

 </subparagraph></paragraph><paragraph id="H1C436750ABE34B57B3F47418B2B976DD"><enum>(2)</enum><header>Functions</header><text>The Secretary, acting through the appropriate official of the Headquarters, shall—</text> <subparagraph id="H99CE49C29A384442A2D6BDC921AEB38E"><enum>(A)</enum><text>establish an overall strategy to successfully further the mission of the Department;</text>
 </subparagraph><subparagraph id="H23FC56A89BC747E4BB940BAB96F8D4AF"><enum>(B)</enum><text>establish initiatives that improve Department-wide operational performance;</text> </subparagraph><subparagraph id="HCCFF5F3A1B2646FE816FFE6F27010899"><enum>(C)</enum><text>establish mechanisms to—</text>
 <clause id="H870004241D7D48E19BEEE8C12E0AC309"><enum>(i)</enum><text>ensure that components of the Department comply with Department policies and fully implement the strategies and initiatives of the Secretary; and</text>
 </clause><clause id="H191CA81C52304F228B4FB3C0F2EF4C64"><enum>(ii)</enum><text>require the head of each component of the Department and component chief officers to comply with such policies and implement such strategies and initiatives;</text>
 </clause></subparagraph><subparagraph id="H7F9D6D2F53B2409CA9164387DFBAD5D9"><enum>(D)</enum><text>establish annual operational and management objectives to evaluate the performance of the Department;</text>
 </subparagraph><subparagraph id="H1619430E3D5F41C98883A772AAD2A2D3"><enum>(E)</enum><text>ensure that the Department successfully meets operational and management performance objectives through conducting oversight of component agencies;</text>
 </subparagraph><subparagraph id="HEA5449B1DD3745D4889D17B4779BA5BD"><enum>(F)</enum><text>ensure that the strategies, priorities, investments, and workforce of Department components align with Department objectives;</text>
 </subparagraph><subparagraph id="H7E45E5B4A97948139E93BD9563287635"><enum>(G)</enum><text>establish and implement policies related to Department ethics and compliance standards;</text> </subparagraph><subparagraph id="HE14EBC9762D84254AB22B15869E1F5D1"><enum>(H)</enum><text>manage and encourage shared services across Department components;</text>
 </subparagraph><subparagraph id="H32B0F57132414361BAD651FDC6DFED9E"><enum>(I)</enum><text>lead and coordinate interaction with Congress and other external organizations; and</text> </subparagraph><subparagraph id="H847E27924BC6499CA4A457DBF981179C"><enum>(J)</enum><text>carry out other such functions as the Secretary determines are appropriate.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HBDE2BEB128AC445D8F1483CC8BA657EC"><enum>103.</enum><header>Repeal of Director of Shared Services and Office of Counternarcotics Enforcement of Department of
			 Homeland Security</header>
				<subsection id="H5031D0408AD94B8CA2368538599A2B64"><enum>(a)</enum><header>Abolishment of Director of Shared Services</header>
 <paragraph id="H1BEDC4A914BA4F7981630862633926CE"><enum>(1)</enum><header>Abolishment</header><text>The position of Director of Shared Services of the Department of Homeland Security is abolished.</text> </paragraph><paragraph commented="no" id="H55392C762683425BA7691DAC9FFC0898"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The Homeland Security Act of 2002 is amended by striking section 475 (<external-xref legal-doc="usc" parsable-cite="usc/6/295">6 U.S.C. 295</external-xref>).</text>
 </paragraph><paragraph commented="no" id="H88071B481B944083A4D1CD259B6717AA"><enum>(3)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by striking the item relating to section 475.</text>
					</paragraph></subsection><subsection id="H881D39F20C6D486FB410F374B75940DB"><enum>(b)</enum><header>Abolishment of the Office of Counternarcotics Enforcement</header>
 <paragraph id="H7BA0F30DDEBE4A9A85142841144C7C7B"><enum>(1)</enum><header>Abolishment</header><text>The Office of Counternarcotics Enforcement is abolished.</text> </paragraph><paragraph commented="no" id="H9C604F4D77714E1093449AC9BC63DD76"><enum>(2)</enum><header>Conforming amendments</header><text>The Homeland Security Act of 2002 is amended—</text>
 <subparagraph commented="no" id="HEA35F043D1814C41BD7BB3419F302DB6"><enum>(A)</enum><text>in subparagraph (B) of section 843(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/6/413">6 U.S.C. 413(b)(1)</external-xref>), by striking <quote>by—</quote> and all that follows through the end of that subparagraph and inserting <quote>by the Secretary; and</quote>; and</text> </subparagraph><subparagraph commented="no" id="H6587563CA52A49A982352552D84AE06D"><enum>(B)</enum><text>by striking section 878 (<external-xref legal-doc="usc" parsable-cite="usc/6/112">6 U.S.C. 112</external-xref>).</text>

					</paragraph></subsection></section><section id="H2F6EE3ED1CAB4A4390098BC697176072"><enum>104.</enum><header>Responsibilities and functions of Chief Privacy Officer</header>
 <subsection id="H0F44E2A9F72D499BB98E6C0573E12000"><enum>(a)</enum><header>In general</header><text>Section 222 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/142">6 U.S.C. 142</external-xref>) is amended—</text> <paragraph id="H0A4E3180B34F46EB9D03BED37FA41B1F"><enum>(1)</enum><text>in subsection (a)—</text>
 <subparagraph id="HED6C1515C5FF4503AA7EEB48FFD4A663"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text> <clause id="H218AE438643E45B1B69B5A0CC7B40BDC"><enum>(i)</enum><text>by inserting <quote>to be the Chief Privacy Officer of the Department,</quote> after <quote>in the Department,</quote>; and</text>
 </clause><clause id="HCD3C97FDBE804394B52F5422B60DF7D7"><enum>(ii)</enum><text>by striking <quote>to the Secretary, to assume</quote> and inserting <quote>to the Secretary.  </paragraph><paragraph id="HFF703D24FC4C4BB28AAF067A7CB04026"><enum>(7)</enum><text>establishing a mechanism to ensure such components are in compliance with Federal, regulatory, statutory, and Department privacy requirements, mandates, directives, and policies;</text>
 </paragraph><paragraph id="HF5A142A1FADC44E5AB7DC577F9DF2827"><enum>(8)</enum><text>working with the Chief Information Officer of the Department to identify methods for managing and overseeing the records, management policies, and procedures of the Department;</text>
 </paragraph><paragraph id="HBB8773A584304858A2D97158A1344674"><enum>(9)</enum><text>working with components and offices of the Department to ensure that information sharing activities incorporate privacy protections;</text>
 </paragraph><paragraph id="HE5D7F57879AF45669584E0E86E04647C"><enum>(10)</enum><text>serving as the Chief FOIA Officer of the Department for purposes of subsection (j) of section 552 of title 5, United States Code (popularly known as the Freedom of Information Act), to manage and process requests related to such section;</text>
 </paragraph><paragraph id="H2EC9C033E4CC4E2E8C4F6968F7431061"><enum>(11)</enum><text>developing guidance on procedures to be followed by individuals making requests for information under section 552 of title 5, United States Code;</text>
 </paragraph><paragraph id="H2067CB4424534AF0B445D1B3610F96F5"><enum>(12)</enum><text>overseeing the management and processing of requests for information under section 552 of title 5, United States Code, within Department Headquarters and relevant Department component offices;</text>
 </paragraph><paragraph id="H8C062D51954948A0A0FE500F1C77825D"><enum>(13)</enum><text>identifying and eliminating unnecessary and duplicative actions taken by the Department in the course of processing requests for information under section 552 of title 5, United States Code;</text>
 </paragraph><paragraph id="H257BE3391C214833AAD94A38851A42E6"><enum>(14)</enum><text>preparing an annual report to Congress that includes—</text> <subparagraph id="H29F213B853FF484E8D5AC8A7EE832982"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the activities of the Department that affect privacy during the fiscal year covered by the report, including complaints of privacy violations, implementation of section 552a of title 5, United States Code (popularly known as the Privacy Act of 1974), internal controls, and other matters; and</text>
 </subparagraph><subparagraph id="H9FD869A79966447DA577B12A1884C614"><enum>(B)</enum><text>the number of new technology programs implemented in the Department during the fiscal year covered by the report, the number of such programs that the Chief Privacy Officer has evaluated to ensure that privacy protections are considered and implemented, the number of such programs that effectively implemented privacy protections into new technology programs, and an explanation of why any new programs did not effectively implement privacy protections; and</text>
 </subparagraph></paragraph><paragraph id="HF36D50F288224993AB520C12F4751021"><enum>(15)</enum><text>carrying out such other responsibilities as the Secretary determines are appropriate, consistent with this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H423DF03DDB694C95B5F2AF9F2B705C13"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block id="H43BC4B7ACF1D45319359C684E86E72CE" style="OLC"> <subsection id="HCE260D002D00451F8B6B8580D92637D7"><enum>(f)</enum><header>Reassignment of functions</header><text>Notwithstanding subsection (a)(10), the Secretary may reassign the functions related to managing and processing requests for information under section 552 of title 5, United States Code, to another officer within the Department, consistent with requirements of that section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="HE146E8FF3CF74825B1B241E6AD6F2A02"><enum>105.</enum><header>Responsibilities of Chief Financial Officer</header><text display-inline="no-display-inline">Section 702 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/342">6 U.S.C. 342</external-xref>) is amended—</text> <paragraph id="H082F4D32C435425E843017ED738633C0"><enum>(1)</enum><text>by redesignating subsections (b) and (c) as subsections (c) and (d), respectively; and</text>
 </paragraph><paragraph id="H804C387337DA4CBFA881679DDB8BBE36"><enum>(2)</enum><text>by inserting after subsection (a) the following new subsection (b):</text> <quoted-block id="H9C8FBE2973C848DEA4E266C534E04B30" style="OLC"> <subsection id="H2EC8146045FA4AADB51E4A39D48F263B"><enum>(b)</enum><header>Responsibilities</header><text>The Chief Financial Officer, in consultation with the Under Secretary for Management and the Under Secretary for Intelligence and Analysis, as appropriate, shall—</text>
 <paragraph id="HBA2B1C90AA74479BAC7677BD1019C1AC"><enum>(1)</enum><text>oversee Department budget formulation and execution;</text> </paragraph><paragraph id="HE558BE9D40CC41529547E491E7BA36AB"><enum>(2)</enum><text>lead and provide guidance on performance-based budgeting practices for the Department to ensure that the Department and its components are meeting missions and goals;</text>
 </paragraph><paragraph id="H81069FF4C7224EE1B32A4165222F12A5"><enum>(3)</enum><text>lead cost-estimating practices for the Department, including the development of policies on cost estimating and approval of life cycle cost estimates;</text>
 </paragraph><paragraph id="HA9AF5C321ACC44E3A883E9398BC72B7C"><enum>(4)</enum><text>coordinate with the Office of Strategy, Policy, and Plans to ensure that the development of the budget for the Department is compatible with the long-term strategic plans, priorities, and policies of the Secretary;</text>
 </paragraph><paragraph id="H4B530CB6786F45AC89F60182B514C84B"><enum>(5)</enum><text>develop financial management policy for the Department and oversee the implementation of such policy, including the establishment of effective internal controls over financial reporting systems and processes throughout the Department;</text>
 </paragraph><paragraph id="H393E95B8CDAF4CE1A0FBDB403D995AAA"><enum>(6)</enum><text>provide guidance for and over financial system modernization efforts throughout the Department;</text> </paragraph><paragraph id="H9A0F96DC213F42CDAF925D1B907DD473"><enum>(7)</enum><text>lead the efforts of the Department related to financial oversight, including identifying ways to streamline and standardize business processes;</text>
 </paragraph><paragraph id="HCEE53A6DE57D41D686D5E7E2B5D729D0"><enum>(8)</enum><text>oversee the costs of acquisition programs and related activities to ensure that actual and planned costs are in accordance with budget estimates and are affordable, or can be adequately funded, over the life cycle of such programs and activities; and</text>
 </paragraph><paragraph id="HD073D76F062E422A8F046471D0B7DEB6"><enum>(9)</enum><text>fully implement a common accounting structure to be used across the entire Department by fiscal year 2020.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HBA40552A3284430CB22AFC84EF1E9992"><enum>106.</enum><header>Chief Information Officer</header>
 <subsection id="HE129405BAC89481C914B84D300C595DF"><enum>(a)</enum><header>In general</header><text>Section 703 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/343">6 U.S.C. 343</external-xref>) is amended—</text> <paragraph id="HBAEF3B49D10E4E2D9247237FF39D67FA"><enum>(1)</enum><text>in subsection (a), by adding at the end the following new sentence: <quote>In addition to the functions under section 3506(a)(2) of title 44, United States Code, the Chief Information Officer shall perform the functions set forth in this section and such other functions as may be assigned by the Secretary.</quote>;</text>
 </paragraph><paragraph id="HC497023756CB4252AE23A11D1FFAD24D"><enum>(2)</enum><text>by redesignating subsection (b) as subsection (d); and</text> </paragraph><paragraph id="HC4D9C90F81064085B32C969F8A63C9C4"><enum>(3)</enum><text>by inserting after subsection (a) the following new subsections:</text>
						<quoted-block id="H61E5B60FE4944CCCB89DE170F60048AD" style="OLC">
 <subsection id="HD60B9E1716524869A1DCE9DF10030080"><enum>(b)</enum><header>Responsibilities</header><text>In addition to performing the functions under section 3506 of title 44, United States Code, the Chief Information Officer shall serve as the lead technical authority for information technology programs of the Department and Department components and, in consultation with the Under Secretary for Management, shall—</text>
 <paragraph id="H3B19537F00B9423AB6C38999717E8D07"><enum>(1)</enum><text>advise and assist the Secretary, heads of the components of the Department, and other senior officers in carrying out the responsibilities of the Department for all activities relating to the budgets, programs, security, and operations of the information technology functions of the Department;</text>
 </paragraph><paragraph id="H20A08B64EEDD474094D7E4D1D5F22780"><enum>(2)</enum><text>to the extent delegated by the Secretary, exercise leadership and authority over Department information technology management and establish the information technology priorities, policies, processes, standards, guidelines, and procedures of the Department to ensure interoperability and standardization of information technology;</text>
 </paragraph><paragraph id="H91768307244C428AA7A37DF0EDEA4010"><enum>(3)</enum><text>maintain a consolidated inventory of the mission critical and mission essential information systems of the Department, and develop and maintain contingency plans for responding to a disruption in the operation of any of those information systems;</text>
 </paragraph><paragraph id="HC28869DF329E4B22A145CAE18124B949"><enum>(4)</enum><text>maintain the security, visibility, reliability, integrity, and availability of data and information technology of the Department;</text>
 </paragraph><paragraph id="HEA1EAF9119AD4659B4D5FA23E06DD0CD"><enum>(5)</enum><text>establish and implement policies and procedures to effectively monitor and manage vulnerabilities in the supply chain for purchases of information technology, in consultation with the Chief Procurement Officer of the Department;</text>
 </paragraph><paragraph id="HFDC3BD9C6DD64B31BCC786E2F8F61560"><enum>(6)</enum><text>review contracts and interagency agreements associated with major information technology investments and information technology investments that have had cost, schedule, or performance challenges in the past;</text>
 </paragraph><paragraph id="H57C80100ACB24DFA9BCF179D63D8CB5A"><enum>(7)</enum><text>assess the risk of all major information technology investments and publically report the risk rating to the Office of Management and Budget; and</text>
 </paragraph><paragraph id="HF00B12A4961F4B8FB3A76A72EE532EEE"><enum>(8)</enum><text>carry out any other responsibilities delegated by the Secretary consistent with an effective information system management function.</text>
 </paragraph></subsection><subsection id="H7F5624D3D879489A972F67EE3025D388"><enum>(c)</enum><header>Strategic plans</header><text>In coordination with the Chief Financial Officer, the Chief Information Officer shall develop an information technology strategic plan every five years and report to the Committee on Homeland Security and the Committee on Appropriations of the House of Representatives and the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate on the extent to which—</text>
 <paragraph id="H658495CFA11F405F8D12C105D78FB2EC"><enum>(1)</enum><text>the budget of the Department aligns with priorities specified in the information technology strategic plan;</text>
 </paragraph><paragraph id="HC24F42C77F03406DB8E296ABCCFD4F71"><enum>(2)</enum><text>the information technology strategic plan informs the budget process of the Department;</text> </paragraph><paragraph id="H9B12FDE1743B483BB5B76E53EE09D214"><enum>(3)</enum><text>information technology priorities were or were not funded and the reasons for not funding all priorities in a given fiscal year;</text>
 </paragraph><paragraph id="H6560E7D0606D4510A5707FA9B2968720"><enum>(4)</enum><text>the Department has identified and addressed skills gaps needed to implement the information technology strategic plan; and</text>
 </paragraph><paragraph id="H2CA397FC08C2412E82B0F324236658AA"><enum>(5)</enum><text>unnecessary duplicate information technology within and across the components of the Department has been eliminated.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="HE47D2BE94BEB4FF99234FE448F701FF8"><enum>(b)</enum><header>Software licensing</header>
 <paragraph commented="no" id="H4F3EFC935D8F49578E3780953650D7AB"><enum>(1)</enum><header>Software inventory</header><text>Not later than 180 days after the date of the enactment of this Act and every two years thereafter until 2022, the Chief Information Officer of the Department of Homeland Security, in consultation with Department component chief information officers, shall—</text>
 <subparagraph commented="no" id="H269FEEDC70474E9CA24EA406D0E4D47E"><enum>(A)</enum><text>conduct a Department-wide inventory of all existing software licenses held by the Department, including utilized and unutilized licenses;</text>
 </subparagraph><subparagraph commented="no" id="H3CEDE69F4E424CD385FD37D637A9B93B"><enum>(B)</enum><text>assess the needs of the Department and the components of the Department for software licenses for the subsequent two fiscal years;</text>
 </subparagraph><subparagraph commented="no" id="HB5D99BF775EC4F368B9FB169D5A9E7B4"><enum>(C)</enum><text>examine how the Department can achieve the greatest possible economies of scale and cost savings in the procurement of software licenses;</text>
 </subparagraph><subparagraph commented="no" id="H5BC356B5DF5145D2AE824FE74E4CD567"><enum>(D)</enum><text>determine how the use of shared cloud-computing services will impact the needs for software licenses for the subsequent two fiscal years;</text>
 </subparagraph><subparagraph commented="no" id="HA46D682B2E194B21832365DDED6CC2E9"><enum>(E)</enum><text>establish plans and estimated costs for eliminating unutilized software licenses for the subsequent two fiscal years; and</text>
 </subparagraph><subparagraph commented="no" id="HDB0E06BF0C394D70B96EE27FBFBEA8FA"><enum>(F)</enum><text>submit a copy of each inventory conducted under subparagraph (A) to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HE9DE6B48E3E64F9BB7CA89078E6DFD79"><enum>(2)</enum><header>Plan to reduce software licenses</header><text>If the Chief Information Officer determines through the inventory conducted under paragraph (1) that the number of software licenses held by the Department and the components of the Department exceed the needs of the Department, not later than 90 days after the date on which the inventory is completed, the Secretary of Homeland Security shall establish a plan for reducing the number of such software licenses to meet needs of the Department.</text>
					</paragraph><paragraph commented="no" id="H6F3B25C0CE6444258927B822C5F1B7D5"><enum>(3)</enum><header>Prohibition on procurement of new software licenses</header>
 <subparagraph commented="no" id="HCD0BEAC9AC3949C193304429C8BE146C"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), upon completion of a plan under paragraph (2), no additional resources may be obligated for the procurement of new software licenses for the Department until such time as the need of the Department exceeds the number of used and unused licenses held by the Department.</text>
 </subparagraph><subparagraph commented="no" id="HDBF191ECA22347D28FEF9363E643717A"><enum>(B)</enum><header>Exception</header><text>The Chief Information Officer may authorize the purchase of additional licenses and amend the number of needed licenses as necessary.</text>
 </subparagraph></paragraph></subsection><subsection id="HFBAF1250C3CC44CDB6C8E5A24AC79B9D"><enum>(c)</enum><header>Comptroller General review</header><text>Not later than fiscal year 2019, the Comptroller General of the United States shall review the extent to which the Chief Information Officer fulfilled all requirements established in this section and the amendment made by this section.</text>
 </subsection><subsection id="H1DB0B088232B4B5C9036FA942FE4A30C"><enum>(d)</enum><header>Completion of first definition of capabilities</header><text>Not later than one year after the date of the enactment of this Act, the Chief Information Officer shall complete the first information technology strategic plan required under subsection (c) of section 701 of the Homeland Security Act of 2002, as added by subsection (a) of this section.</text>
				</subsection></section><section id="H165A4250248D45E4A1F022CA1E357F4D"><enum>107.</enum><header>Quadrennial Homeland Security review</header>
 <subsection id="HDD8D007653784230B5F9A905A0CD2AAB"><enum>(a)</enum><header>In general</header><text>Section 707 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/347">6 U.S.C. 347</external-xref>) is amended—</text> <paragraph id="HBFF43D22339C40C2A0EC743661654012"><enum>(1)</enum><text>in subsection (a)(3)—</text>
 <subparagraph id="H373E257BA9CE45D3B16B7C5306CEB9C0"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="HB5BBB621D4D945BEA8AE5D5D8080B302"><enum>(B)</enum><text>by redesignating subparagraph (C) as subparagraph (D); and</text>
 </subparagraph><subparagraph id="HDA7530F41E9948A8BDB964DF12C80FC6"><enum>(C)</enum><text>by inserting after subparagraph (B) the following new subparagraph (C):</text> <quoted-block id="HC04B3EF7A8264022A119CDCCCC45F4F5" style="OLC"> <subparagraph id="HEE281F9AF97745EBB3FEC974A16C0CC0"><enum>(C)</enum><text>representatives from appropriate advisory committees established pursuant to section 871, including the Homeland Security Advisory Council and the Homeland Security Science and Technology Advisory Committee, or otherwise established, including the Aviation Security Advisory Committee established pursuant to section 44946 of title 49, United States Code; and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HA019133CAB4D4F17874024082C7147B9"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="H3905EE54670543D9970553B5E885C7C4"><enum>(A)</enum><text>in paragraph (2), by inserting before the semicolon at the end the following: <quote>based on the risk assessment required pursuant to subsection (c)(2)(B)</quote>;</text>

 <paragraph id="HFD8BA7384DA34FAB9CD0B4805E45CACD"><enum>(3)</enum><header>Documentation</header><text>The Secretary shall retain and, upon request, provide to Congress the following documentation regarding the quadrennial homeland security review:</text>
 <subparagraph id="HDEE19AA29D87480DB1021BABE187D558"><enum>(A)</enum><text>Records regarding the consultation carried out the pursuant to subsection (a)(3), including—</text> <clause id="H1E8EB896411E4C23998A41A9075028BB"><enum>(i)</enum><text>all written communications, including communications sent out by the Secretary and feedback submitted to the Secretary through technology, online communications tools, in-person discussions, and the interagency process; and</text>
 </clause><clause id="HBE593F913A6C4B77A64C9EA8EB84F37D"><enum>(ii)</enum><text>information on how feedback received by the Secretary informed the quadrennial homeland security review.</text>
 </clause></subparagraph><subparagraph id="HA21A7696FE4A488A94BBC899C1B53B41"><enum>(B)</enum><text>Information regarding the risk assessment, as required under subsection (c)(2)(B), including—</text> <clause id="HB7C58DDA3DCE4E33B7F1691C5BF0AE56"><enum>(i)</enum><text>the risk model utilized to generate the risk assessment;</text>
 </clause><clause id="HF7DC6D95DD3247D8AE118CFEFEE71258"><enum>(ii)</enum><text>information, including data used in the risk model, utilized to generate the risk assessment;</text> </clause><clause id="H95A96AC094174C0EA3794C1985C1B1F1"><enum>(iii)</enum><text>sources of information, including other risk assessments, utilized to generate the risk assessment; and</text>

 <subsection id="H9AC403B9C16446989AC951DBA0CD590D"><enum>(d)</enum><header>Review</header><text>Not later than 90 days after the submission of each report required under subsection (c)(1), the Secretary shall provide to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate information on the degree to which the findings and recommendations developed in the quadrennial homeland security review covered by the report were integrated into the acquisition strategy and expenditure plans for the Department.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HDA0B3E38B41149D6ABABF57821E0B45A"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to a quadrennial homeland security review conducted after December 31, 2017.</text>
				</subsection></section><section id="H3F158C073E564773AA0CF358099A2004"><enum>108.</enum><header>Office of Strategy, Policy, and Plans</header>
 <subsection id="H721C9D67CB654F4C86B7416F27F5FFB8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 709 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/349">6 U.S.C. 349</external-xref>) is amended—</text> <paragraph id="H8E8C8A5405D94E57A5AD903D3D56D5D6"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by adding at the end the following:</text>

 <subparagraph id="H53C39CADCE0A4E36B04C68247F47D580"><enum>(A)</enum><text>lead the efforts of the Department to incorporate external feedback from stakeholders into policy and strategic planning efforts, as appropriate;</text>
 </subparagraph><subparagraph commented="no" id="H1416A66A8E1143B59A56805B0124DAE4"><enum>(B)</enum><text display-inline="yes-display-inline">conduct the activities specified in section 2006(b);</text> </subparagraph><subparagraph id="HEB066DFDFFFE4BA29CCAAEDDA746B385"><enum>(C)</enum><text>advise the Secretary on the effects of the policies, regulations, processes, and actions of the Department on the private sector and create and foster strategic communications with the private sector to enhance the primary mission of the Department to protect the homeland;</text>
 </subparagraph><subparagraph id="H4CAB8322598B4CFCA00C18B823795CB4"><enum>(D)</enum><text>coordinate the activities of the Department relating to State and local government;</text> </subparagraph><subparagraph id="H85CBE11F71B646FAA726CEAC39274D52"><enum>(E)</enum><text>provide State and local governments with regular information, research, and technical support to assist local efforts at securing the homeland; and</text>
 </subparagraph><subparagraph id="H2BD565B5105C4FC196A7C7218BA11198"><enum>(F)</enum><text>perform such other functions as are established by law or delegated by the Under Secretary for Policy.</text>
 </subparagraph></paragraph><paragraph id="HF16BFD2BD8B44304BD237849C274EEBC"><enum>(2)</enum><header>Assistant Secretary for International Affairs</header><text>The Office of International Affairs shall be led by an Assistant Secretary for International Affairs appointed by the Secretary. The Assistant Secretary shall—</text>
 <subparagraph id="H4B530D57258B44FFB47151A79CED096A"><enum>(A)</enum><text>coordinate international activities within the Department, including activities carried out by the components of the Department, in consultation with other Federal officials with responsibility for counterterrorism and homeland security matters;</text>
 </subparagraph><subparagraph id="H32364DD7019B45178115C3DDA75B3308"><enum>(B)</enum><text>advise, inform, and assist the Secretary with respect to the development and implementation of the policy priorities of the Department, including strategic priorities for the deployment of assets, including personnel, outside the United States;</text>
 </subparagraph><subparagraph id="H04D9A9D32B0C446797501B246085720B"><enum>(C)</enum><text>develop, in consultation with the Under Secretary for Management, guidance for selecting, assigning, training, and monitoring overseas deployments of Department personnel, including minimum standards for pre-deployment training;</text>
 </subparagraph><subparagraph id="H0C9AD614CAFF4B5C84833ECBAA91B9EB"><enum>(D)</enum><text>maintain awareness regarding the international travel of senior officers of the Department and their intent to pursue negotiations with foreign government officials, and review resulting draft agreements; and</text>
 </subparagraph><subparagraph id="HE75894902B1E4905BF8049A71D56892D"><enum>(E)</enum><text>perform such other functions as are established by law or delegated by the Under Secretary for Policy.</text>

 </paragraph></subsection><subsection id="H0CF7A6FEA9D74F6ABA0242296C0C8B6C"><enum>(g)</enum><header>Homeland Security Advisory Council</header><text>Subsection (b) of section 102 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/112">6 U.S.C. 112</external-xref>) is amended—</text> <paragraph id="HC85C6BEE46924857B4B265A755983F01"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text>

 </paragraph></subsection><subsection id="HC4C99E078FBE42BDA407E07FA44826C6"><enum>(h)</enum><header>Prohibition on new offices</header><text>No new office may be created to perform functions transferred by this section, other than as provided in section 709 of the Homeland Security Act of 2002, as amended by this Act.</text>
 </subsection><subsection id="HB42BE4AEDA3346D28E37172B79867734"><enum>(i)</enum><header>Definitions</header><text>In this section each of the terms <quote>functions</quote>, <quote>assets</quote>, and <quote>personnel</quote> has the meaning given each such term under section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>).</text>
				</subsection><subsection id="HEA16070E062948859F8356B8821F579C"><enum>(j)</enum><header>Duplication review</header>
 <paragraph commented="no" id="HF3508442F6DE406FA7C123B2C049BB59"><enum>(1)</enum><header>Review required</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Homeland Security shall complete a review of the functions and responsibilities of each Department of Homeland Security component responsible for international affairs to identify and eliminate areas of unnecessary duplication.</text>
 </paragraph><paragraph id="HD9373203B7F1405193EA1E91F8ECDEAA"><enum>(2)</enum><header>Submittal to Congress</header><text>Not later than 30 days after the completion of the review required under paragraph (1), the Secretary shall provide the results of the review to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text>
 </paragraph><paragraph id="H8ACCE08178704C31B1F5960C635D88EE"><enum>(3)</enum><header>Action plan</header><text>Not later than one year after the date of the enactment of this Act, the Secretary shall submit to the congressional homeland security committees an action plan, including corrective steps and an estimated date of completion, to address areas of duplication, fragmentation, and overlap and opportunities for cost savings and revenue enhancement, as identified by the Government Accountability Office based on the annual report of the Government Accountability Office entitled <quote>Additional Opportunities to Reduce Fragmentation, Overlap, and Duplication and Achieve Other Financial Benefits</quote>.</text>
					</paragraph></subsection></section><section id="H0195558704F845B78561ACDF48EAB83B"><enum>109.</enum><header>Chief Procurement Officer</header>
 <subsection id="H0FA1D21EDAD04F0CB963B418A4C20A23"><enum>(a)</enum><header>In general</header><text>Title VII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/341">6 U.S.C. 341</external-xref> et seq.) is amended by adding at the end the following new section:</text>
					<quoted-block id="HC0D16B0D113248829C2EC46870DB6880" style="OLC">
						<section id="H390C120C2A8F440AAAF96D2148446435"><enum>710.</enum><header>Chief Procurement Officer</header>
 <subsection id="H706B0F20340C4AC18A95FE4BE6BC2465"><enum>(a)</enum><header>In general</header><text>There is in the Department a Chief Procurement Officer, who shall serve as a senior business advisor to agency officials on procurement-related matters and report directly to the Under Secretary for Management. The Chief Procurement Officer is the senior procurement executive for purposes of subsection (c) of section 1702 of title 41, United States Code, and shall perform procurement functions as specified in such subsection.</text>
 </subsection><subsection id="H06154B5DA4684F9A8705F78EE36C7F5D"><enum>(b)</enum><header>Responsibilities</header><text>The Chief Procurement Officer shall—</text> <paragraph id="H8063607D13EF40FCB280E879B756BC79"><enum>(1)</enum><text>delegate or retain contracting authority, as appropriate;</text>
 </paragraph><paragraph id="HE26DD519AFB14B939A55FFB3FAEF6BF1"><enum>(2)</enum><text>issue procurement policies and oversee the heads of contracting activity of the Department to ensure compliance with those policies;</text>
 </paragraph><paragraph id="HB9FDC52CB9E942FA852F9C1BCA77FB7D"><enum>(3)</enum><text>serve as the main liaison of the Department to industry on procurement-related issues;</text> </paragraph><paragraph id="HA8CFA6BCE5A14B9686B8CB9A41D9EB96"><enum>(4)</enum><text>account for the integrity, performance, and oversight of Department procurement and contracting functions;</text>
 </paragraph><paragraph id="H1EE8AD4C290C4904A5ACE4FDC1AF3497"><enum>(5)</enum><text>ensure that procurement contracting strategies and plans are consistent with the intent and direction of the Acquisition Review Board;</text>
 </paragraph><paragraph id="H582B296ABA994D1E915565B8AE3970F0"><enum>(6)</enum><text>oversee a centralized acquisition workforce certification and training program using, as appropriate, existing best practices and acquisition training opportunities from the Federal Government, private sector, or universities and colleges to include training on how best to identify actions that warrant referrals for suspension or debarment;</text>
 </paragraph><paragraph id="H2218C738962B4D098E7099C128776B0C"><enum>(7)</enum><text>provide input on the periodic performance reviews of each head of contracting activity of the Department;</text>
 </paragraph><paragraph id="H6A9E42336F9D41F492EE585C18A9A1C4"><enum>(8)</enum><text>collect baseline data and use such data to establish performance measures on the impact of strategic sourcing initiatives on the private sector, including small businesses;</text>
 </paragraph><paragraph id="HEBCEA245A60C47118C2964935653E307"><enum>(9)</enum><text>establish and implement policies and procedures to effectively monitor and manage vulnerabilities in the supply chain for all Department purchases;</text>
 </paragraph><paragraph id="HF7856632F7824B4C82FF5D82EAFF2635"><enum>(10)</enum><text>ensure that a fair proportion of the value of Federal contracts and subcontracts are awarded to small businesses (in accordance with the procurement contract goals under section 15(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)</external-xref>)), maximize opportunities for small business participation in such contracts, and ensure, to the extent practicable, small businesses that achieve qualified vendor status for security-related technologies are provided an opportunity to compete for contracts for such technology;</text>
 </paragraph><paragraph id="H17DD7327BBA444D08FA2E481F8F03981"><enum>(11)</enum><text>conduct oversight of implementation of administrative agreements to resolve suspension or debarment proceedings and, upon request, provide information to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate about the effectiveness of such agreements at improving contractor responsibility; and</text>
 </paragraph><paragraph id="H0B4E4BA703F9462B9C23C61008205260"><enum>(12)</enum><text>carry out any other procurement duties that the Under Secretary for Management may designate.</text> </paragraph></subsection><subsection id="H55F326A21EAF4E1EAD9BC1C770FE5997"><enum>(c)</enum><header>Head of contracting activity defined</header><text>In this section the term <quote>head of contracting activity</quote> means an official responsible for the creation, management, and oversight of a team of procurement professionals properly trained, certified, and warranted to accomplish the acquisition of products and services on behalf of the designated components, offices, and organizations of the Department, and as authorized, other government entities.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H3A8D4B00D82C43ECAF27FB44015F5526"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by adding at the end of the items relating to title VII the following new item:</text>

 <subsection id="HC5E8CB2726CA4EF8894D4B4682077B6A"><enum>(a)</enum><header>In general</header><text>There is in the Department a Chief Security Officer, who shall report directly to the Under Secretary for Management.</text>
 </subsection><subsection id="H26C78DFECB284B75B36CDF91E9114CD1"><enum>(b)</enum><header>Responsibilities</header><text>The Chief Security Officer shall—</text> <paragraph id="HDC1B40FBFC4E4944AD372672CF3A08D4"><enum>(1)</enum><text>develop and implement the security policies, programs, and standards of the Department;</text>
 </paragraph><paragraph id="H62B6CBDF7FBB415BAED0925D03A83202"><enum>(2)</enum><text>identify training and provide education to Department personnel on security-related matters; and</text> </paragraph><paragraph id="H1C9DF58C4CC04AF59E66458B170C8111"><enum>(3)</enum><text>provide support to Department components on security-related matters.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

 <subsection commented="no" id="H4AC36F873E404296A41209014A518942"><enum>(a)</enum><header>Notification</header><text>The heads of offices and components of the Department of Homeland Security shall promptly advise the Inspector General of the Department of all allegations of misconduct with respect to which the Inspector General has investigative authority under the Inspector General Act of 1978. The Inspector General may waive the notification requirement under this subsection with respect to any category or subset of allegations of misconduct.</text>
 </subsection><subsection id="HCF94AE9599B74DD0A377ADAFAF9A4990"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section may be construed as affecting the authority of the Secretary of Homeland Security under subsection (a) of <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /8I">section 8I</external-xref> of the Inspector General Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/8I">5 U.S.C. App. 8I</external-xref>).</text>
				</subsection></section><section id="H15632908130542E38165D242DEF784F8"><enum>112.</enum><header>Department of Homeland Security Rotation Program</header>
 <subsection id="H12C4DF4EB8BD414290253E7224B9D66B"><enum>(a)</enum><header>Enhancements to the rotation program</header><text>Section 844 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/414">6 U.S.C. 414(a)</external-xref>) is amended—</text> <paragraph id="H37B8E46B05074E5D8F1340508C4CEB7F"><enum>(1)</enum><text>by striking <quote>(a) <header-in-text level="subsection" style="OLC">Establishment.—</header-in-text></quote>;</text>
 </paragraph><paragraph id="H72F3F61E2F9B4F809AB245120D39ACE3"><enum>(2)</enum><text>by redesignating paragraphs (1) through (5) as subsections (a) through (e), respectively, and adjusting the margins accordingly;</text>

 <paragraph id="H42869D2388B14ECF8DAB564A592F67E0"><enum>(1)</enum><text>before selecting employees for participation in the Rotation Program, disseminate information broadly within the Department about the availability of the Rotation Program, qualifications for participation in the Rotation Program, including full-time employment within the employing component or office not less than one year, and the general provisions of the Rotation Program;</text>
 </paragraph><paragraph id="H050645148C5342AD8A45E55339F6EC3C"><enum>(2)</enum><text>require as a condition of participation in the Rotation Program that an employee—</text> <subparagraph id="HCBE1FB74863B4335B6764F204BA935D1"><enum>(A)</enum><text>is nominated by the head of the component or office employing the employee; and</text>
 </subparagraph><subparagraph id="H4451EDC69CA9461BBC0D0180A58D7744"><enum>(B)</enum><text>is selected by the Secretary, or the Secretary’s designee, solely on the basis of relative ability, knowledge, and skills, after fair and open competition that assures that all candidates receive equal opportunity;</text>
 </subparagraph></paragraph><paragraph id="HF348A79B1EAB45AFB72F80D92DEFB7A0"><enum>(3)</enum><text>ensure that each employee participating in the Rotation Program shall be entitled to return, within a reasonable period of time after the end of the period of participation, to the position held by the employee, or a corresponding or higher position, in the component or office that employed the employee prior to the participation of the employee in the Rotation Program;</text>
 </paragraph><paragraph id="HB13BDD601C944F5CA025318B34DFDD3A"><enum>(4)</enum><text>require that the rights that would be available to the employee if the employee were detailed from the employing component or office to another Federal agency or office remain available to the employee during the employee participation in the Rotation Program; and</text>
 </paragraph><paragraph id="HA00395673FA443CE953EB91D3553A8C9"><enum>(5)</enum><text>require that, during the period of participation by an employee in the Rotation Program, performance evaluations for the employee—</text>
 <subparagraph id="H6739040B074B4278A85CBB71E24A1205"><enum>(A)</enum><text>shall be conducted by officials in the office or component employing the employee with input from the supervisors of the employee at the component or office in which the employee is placed during that period; and</text>
 </subparagraph><subparagraph id="H8B4A9B179DFA424E9C2EC73E1234F42E"><enum>(B)</enum><text>shall be provided the same weight with respect to promotions and other rewards as performance evaluations for service in the office or component employing the employee.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H8EBAB51C390B4D3F8F8CFDA00AE5850A"><enum>(8)</enum><text>by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H8B9FE8AAD6B74F46A8117368CFBA0889" style="OLC"> <subsection id="H872334DB691A4E4ABEDF788D26EA66C0"><enum>(g)</enum><header>Intelligence rotational assignment program</header> <paragraph id="H813826D4A8554AE8B8C6D1C68FD4E334"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish an Intelligence Rotational Assignment Program as part of the Rotation Program under subsection (a).</text>
 </paragraph><paragraph id="H5F14C208F516418BB57742653CA6CFAA"><enum>(2)</enum><header>Administration</header><text>The Chief Human Capital Officer, in conjunction with the Chief Intelligence Officer, shall administer the Intelligence Rotational Assignment Program established pursuant to paragraph (1).</text>
 </paragraph><paragraph id="H690D125034E349A4BD6DEF3206CCC1E7"><enum>(3)</enum><header>Eligibility</header><text>The Intelligence Rotational Assignment Program established pursuant to paragraph (1) shall be open to employees serving in existing analyst positions within the Department’s Intelligence Enterprise and other Department employees as determined appropriate by the Chief Human Capital Officer and the Chief Intelligence Officer.</text>
 </paragraph><paragraph commented="no" id="HFCA7D7C6F9264E7094F1B0132E104B63"><enum>(4)</enum><header>Coordination</header><text>The responsibilities specified in subsection (c)(2) that apply to the Rotation Program under such subsection shall, as applicable, also apply to the Intelligence Rotational Assignment Program under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HE9A63BA45FAC4FBF8035CDB6BCF6F76C"><enum>(b)</enum><header>Congressional notification and oversight</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland Security shall provide to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate information about the status of the Homeland Security Rotation Program authorized by section 844 of the Homeland Security Act of 2002, as amended by subsection (a) of this section.</text>
				</subsection></section><section id="H84098BF043114897A9C717922F810275"><enum>113.</enum><header>Future Years Homeland Security Program</header>
 <subsection id="HA8E64D5046774097AA1CBF52E69F38EA"><enum>(a)</enum><header>In general</header><text>Section 874 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/454">6 U.S.C. 454</external-xref>) is amended—</text> <paragraph id="H5AC5C851C7EC45AF804BB58BF49F462D"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">year</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">years</header-in-text></quote>;</text>
 </paragraph><paragraph id="H3523FC6E6CFE4149998A3FF778C5E820"><enum>(2)</enum><text>by striking subsection (a) and inserting the following:</text> <quoted-block id="HBE36F42BD6E24FF18E3AF48B6757FD09" style="OLC"> <subsection id="HA7F79CE92BF546D495D8D25030879C57"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date on which the budget of the President is submitted to Congress under section 1105(a) of title 31, United States Code, the Secretary shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives (referred to in this section as the <quote>appropriate committees</quote>) a Future Years Homeland Security Program that covers the fiscal year for which the budget is submitted and the 4 succeeding fiscal years.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HC767B5C579984778A8CE12F6DEFA3626"><enum>(3)</enum><text>by striking subsection (c) and inserting the following new subsections:</text> <quoted-block id="H3CBB98954E064C92AC00CBE1D1F2922C" style="OLC"> <subsection id="H334DE03E838A441FB5625A52956A8857"><enum>(c)</enum><header>Projection of acquisition estimates</header><text>On and after February 1, 2018, each Future Years Homeland Security Program shall project—</text>
 <paragraph id="HF76689194084453B934832411B193DDA"><enum>(1)</enum><text>acquisition estimates for the fiscal year for which the budget is submitted and the four succeeding fiscal years, with specified estimates for each fiscal year, for all major acquisitions by the Department and each component of the Department; and</text>
 </paragraph><paragraph id="HB6A54FC681414B25B3BC64C2D1332C45"><enum>(2)</enum><text>estimated annual deployment schedules for all physical asset major acquisitions over the five-fiscal-year period described in paragraph (1) and the full operating capability for all information technology major acquisitions.</text>
 </paragraph></subsection><subsection id="H4F862B9132504A1BA5D8FDB30B3B337F"><enum>(d)</enum><header>Sensitive and classified information</header><text>The Secretary may include with each Future Years Homeland Security Program a classified or other appropriately controlled document containing any information required to be submitted under this section that is restricted from public disclosure in accordance with Federal law or any Executive order.</text>
 </subsection><subsection id="HC46FB0950B8B49EDA52F538D4F35B857"><enum>(e)</enum><header>Availability of information to the public</header><text>The Secretary shall make available to the public in electronic form the information required to be submitted to the appropriate committees under this section, other than information described in subsection (d).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="H49D3B54DBF6A412691A94C421C794483"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is further amended by striking the item relating to section 874 and inserting the following new item:</text>

				</subsection></section><section id="HB23C516960B34313A321DCFBA94EFDC7"><enum>114.</enum><header>Field efficiencies plan</header>
 <paragraph id="H1A5568D76C324F04A10256E3F809B0B4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives and Committee on Homeland Security and Governmental Affairs of the Senate a field efficiencies plan that—</text>
 <subparagraph id="H41595BBF0F204839B65EEE517785EA64"><enum>(A)</enum><text>examines the facilities and administrative and logistics functions of components of the Department of Homeland Security located within designated geographic areas; and</text>
 </subparagraph><subparagraph id="H0F543F415A2542968EE5DDAAC82804FF"><enum>(B)</enum><text>provides specific recommendations and an associated cost-benefit analysis for the consolidation of the facilities and administrative and logistics functions of components of the Department within each designated geographic area.</text>
 </subparagraph></paragraph><paragraph id="HD7C3961FA8424F169F62B5495C6F2C4C"><enum>(2)</enum><header>Contents</header><text>The field efficiencies plan submitted under paragraph (1) shall include the following:</text> <subparagraph id="HDDC55993CE73439DAA2166A586B001B2"><enum>(A)</enum><text>An accounting of leases held by the Department or its components that have expired in the current fiscal year or will be expiring in the next fiscal year, that have begun or been renewed in the current fiscal year, or that the Department or its components plan to sign or renew in the next fiscal year.</text>
 </subparagraph><subparagraph id="H3EC35F1041354E32B6C79D3ACF687B66"><enum>(B)</enum><text display-inline="yes-display-inline">For each designated geographic area—</text> <clause id="HF713088928064FC1B7BA771E26C8470E"><enum>(i)</enum><text>an evaluation of specific facilities at which components, or operational entities of components, of the Department may be closed or consolidated, including consideration of when leases expire or facilities owned by the government become available;</text>
 </clause><clause display-inline="no-display-inline" id="H92243F3CE18E4F998807B3F039C2FC4E"><enum>(ii)</enum><text>an evaluation of potential consolidation with facilities of other Federal, State, or local entities, including—</text>
 <subclause id="H9F3E389764684A7F94F68D11FF34CAF0"><enum>(I)</enum><text>offices;</text> </subclause><subclause id="H842DECD947394596829628B9C42AAB62"><enum>(II)</enum><text>warehouses;</text>
 </subclause><subclause id="HB1C63A43C7CA407A996AABE04A93D464"><enum>(III)</enum><text>training centers;</text> </subclause><subclause id="HD8994204361A4238A63588483A9C2DA9"><enum>(IV)</enum><text>housing;</text>
 </subclause><subclause id="H17D3F24C91234492B54F37CA17D97B87"><enum>(V)</enum><text>ports, shore facilities, and airfields;</text> </subclause><subclause id="H596E5B53E6AD4647813EBB7419E5873E"><enum>(VI)</enum><text>laboratories; and</text>
 </subclause><subclause id="H2DC30804F2514DF8A61C55D6C891A644"><enum>(VII)</enum><text>other assets as determined by the Secretary; and</text> </subclause></clause><clause display-inline="no-display-inline" id="H70EA2F40F28946BD81D82F6AD4013C90"><enum>(iii)</enum><text>an evaluation of the potential for the consolidation of administrative and logistics functions, including—</text>
 <subclause id="HABDC62C81A8D4DC3839A2A1BD7DFCF3E"><enum>(I)</enum><text>facility maintenance;</text> </subclause><subclause id="H6A6F255D74294AD3B7E3780FF9DB4C2E"><enum>(II)</enum><text>fleet vehicle services;</text>
 </subclause><subclause id="H1EEA16929ABD4FA7978BE34E5F454ED5"><enum>(III)</enum><text>mail handling and shipping and receiving;</text> </subclause><subclause id="H4C2544DCEDD04FDD850CF1DEFCF57FD7"><enum>(IV)</enum><text>facility security;</text>
 </subclause><subclause id="H02F89782CCE74B7495B40711DA04C356"><enum>(V)</enum><text>procurement of goods and services;</text> </subclause><subclause id="HFB90554D96B04874A239D71567EE85DC"><enum>(VI)</enum><text>information technology and telecommunications services and support; and</text>
 </subclause><subclause id="H588D215BAF0E48F18BB6A0076F2F0B77"><enum>(VII)</enum><text>additional ways to improve unity of effort and cost savings for field operations and related support activities as determined by the Secretary.</text>
 </subclause></clause></subparagraph><subparagraph id="HB6BF1E6E2548495ABC1349AC88468352"><enum>(C)</enum><text>An implementation plan, including—</text> <clause id="H3DBEE6D4D33D439395FC343490DB0CDC"><enum>(i)</enum><text>near-term actions that can co-locate, consolidate, or dispose of property within 24 months;</text>
 </clause><clause id="H5AEDBB4D34654A3486413AA9C50B03B9"><enum>(ii)</enum><text>identifying long-term occupancy agreements or leases that cannot be changed without a significant cost to the Government; and</text>

 <subsection id="H105900A02E04473FB4C1DA12326AE438"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VII of the Homeland Security Act of 2002 is further amended by adding at the end the following new section:</text>

 <paragraph id="HC48FA9B694D74A3092EBD62D23D3A231"><enum>(1)</enum><text>any circumstance during the year covered by the report in which the Secretary exercised the authority to reprogram or transfer funds to address unforeseen costs, including costs associated with operational surges; and</text>

 <subsection id="H9C954837F74A4F6EBD98EAE7EDBBB823"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, the Secretary of Homeland Security, acting through the Under Secretary of Homeland Security for Management, shall submit to the congressional homeland security committees a report that includes each of the following:</text>
 <paragraph id="HEF6826A4C8114DE09CAA6EBBED6F96A4"><enum>(1)</enum><text>A detailed accounting of the management and administrative expenditures and activities of each component of the Department of Homeland Security and identifies potential cost savings, avoidances, and efficiencies for those expenditures and activities.</text>
 </paragraph><paragraph id="HA43BB8C84BF94645AEAE636DF04A539A"><enum>(2)</enum><text>An examination of major physical assets of the Department, as defined by the Secretary;</text> </paragraph><paragraph id="H826B09DBD0E24C87BBD332E8EA5324F4"><enum>(3)</enum><text>A review of the size, experience level, and geographic distribution of the operational personnel of the Department.</text>
 </paragraph><paragraph id="H80AA43F648D54BD98D397E81FF5EBDD1"><enum>(4)</enum><text>Recommendations for adjustments in the management and administration of the Department that would reduce deficiencies in the capabilities of the Department, reduce costs, and enhance efficiencies.</text>
 </paragraph></subsection><subsection id="HED025C52B7924634B88E97ACC3516851"><enum>(b)</enum><header>Form of report</header><text display-inline="yes-display-inline">The report required under subsection (a) shall be submitted in unclassified form but may include a classified annex.</text>
				</subsection></section><section id="HF4269887141544C2A97CF11601B41797"><enum>117.</enum><header>Research and development and CBRNE organizational review</header>
				<subsection id="HCB116183B1324D8A9FB9DDF7714211FA"><enum>(a)</enum><header>Department of Homeland Security research and development activities</header>
 <paragraph id="H121AD4A8317348E6B2E2F701CF9BBCDA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall assess the organization and management of the Department of Homeland Security’s research and development activities, and shall develop and submit to the Committee on Homeland Security and the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate, not later than six months after the date of the enactment of this Act, a proposed organizational structure for the management of such research and development activities.</text>
 </paragraph><paragraph id="H84A1934EB8C84528B8911174F1FE1CF5"><enum>(2)</enum><header>Organizational justification</header><text display-inline="yes-display-inline">The proposed organizational structure for the management of the Department of Homeland Security’s research and development activities included in the assessment required under paragraph (1) shall include the following:</text>
 <subparagraph id="H87D75C7427B944D2A62A9F6E272AB12E"><enum>(A)</enum><text>A discussion of the methodology for determining such proposed organizational structure.</text> </subparagraph><subparagraph id="H29220E19B5BA4D629858127AC28735A0"><enum>(B)</enum><text>A comprehensive inventory of research and development activities of the Department, and the proposed location of each activity under such proposed organizational structure.</text>
 </subparagraph><subparagraph id="H39ACDBFBAF60407B8EC20E0F75F76D01"><enum>(C)</enum><text>Information relating to how such proposed organizational structure will facilitate and promote enhanced coordination and better collaboration between the Under Secretary for Science and Technology of the Department and the offices and components of the Department.</text>
 </subparagraph><subparagraph id="HC5DDDA13979441ECA229F55F95BA3208"><enum>(D)</enum><text>Information relating to how such proposed organizational structure will support the development of research and development priorities and capabilities across the Department.</text>
 </subparagraph><subparagraph id="HB2768083E27A47A9B9E08956F23ABFD3"><enum>(E)</enum><text display-inline="yes-display-inline">A discussion of the resulting cost savings and efficiencies from such proposed organizational structure.</text>
 </subparagraph><subparagraph id="HDD742CFB216D4C3E864AEDB087CF63EF"><enum>(F)</enum><text>Recommendations for any necessary statutory changes.</text> </subparagraph></paragraph></subsection><subsection id="H60BCDB9CFCCC4BAA86A6694F1C32D12B"><enum>(b)</enum><header>Department of Homeland Security chemical, biological, radiological, nuclear, and explosives activities</header> <paragraph id="HCBA2237E7259413AAF47C4789A156658"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall assess the organization and management of the Department of Homeland Security’s chemical, biological, radiological, nuclear, and explosives activities, and shall develop and submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate, not later than six months after the date of the enactment of this Act, a proposed organizational structure to ensure enhanced coordination and provide strengthened chemical, biological, radiological, nuclear, and explosives capabilities in support of homeland security.</text>

 </subparagraph><subparagraph id="H06CC7A650F3D4A93B6ED9B56B4A31FCA"><enum>(E)</enum><text>Recommendations for any necessary statutory changes.</text> </subparagraph></paragraph></subsection></section></title><title id="H044BE6749E484F848E38821BC98FF78D"><enum>II</enum><header>Department of Homeland Security Acquisition Accountability and Efficiency</header> <section id="H24F66E09AD8F4B8CA8B2F831883C9566"><enum>201.</enum><header>Definitions</header> <subsection id="HE6575B304B674AA985705B48F0CCFA87"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle D of title VIII of the Homeland Security Act of 2002 is amended by inserting before section 831 the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="HFF774805567D44598F2044CECC92D6FD" style="OLC">
 <section id="H9BC969DA5D3D44D8A333B755387FD9F5"><enum>830.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="H34B63A9B6C9843E3BAF26765DD8D082F"><enum>(1)</enum><text>The term <quote>acquisition</quote> has the meaning given such term in section 131 of title 41, United States Code.</text>
 </paragraph><paragraph id="H17EE7839CF484F12BC3D7F3AC9A44C51"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>acquisition decision authority</quote> means the authority, held by the Secretary acting through the Deputy Secretary or Under Secretary for Management to—</text>
 <subparagraph id="H9F804400806A4C3F99F0B44FEF79A7E0"><enum>(A)</enum><text display-inline="yes-display-inline">ensure compliance with Federal law, the Federal Acquisition Regulation, and Department acquisition management directives;</text>
 </subparagraph><subparagraph id="H25DBA24614814CACA10AE2FFAE4484EC"><enum>(B)</enum><text>review (including approving, pausing, modifying, or canceling) an acquisition program through the life cycle of such program;</text>
 </subparagraph><subparagraph id="H9FADE0C71FEE4965B2E434A861CFF74C"><enum>(C)</enum><text>ensure that acquisition program managers have the resources necessary to successfully execute an approved acquisition program;</text>
 </subparagraph><subparagraph id="H038FC60007D54769B38D9C5DB5CCD8D1"><enum>(D)</enum><text>ensure good acquisition program management of cost, schedule, risk, and system performance of the acquisition program at issue, including assessing acquisition program baseline breaches and directing any corrective action for such breaches; and</text>
 </subparagraph><subparagraph id="H80482B07DC434270A4F5B8D1A98F76DA"><enum>(E)</enum><text>ensure that acquisition program managers, on an ongoing basis, monitor cost, schedule, and performance against established baselines and use tools to assess risks to an acquisition program at all phases of the life cycle of such program to avoid and mitigate acquisition program baseline breaches.</text>
 </subparagraph></paragraph><paragraph id="H1D8AF4ECB03D44FCBC2CD8083821E1FF"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>acquisition decision event</quote> means, with respect to an acquisition program, a predetermined point within each of the acquisition phases at which the acquisition decision authority determines whether such acquisition program shall proceed to the next acquisition phase.</text>
 </paragraph><paragraph id="H5058D669D0E6495D92A2C60A51C75F47"><enum>(4)</enum><text display-inline="yes-display-inline">The term <quote>acquisition decision memorandum</quote> means, with respect to an acquisition, the official acquisition decision event record that includes a documented record of decisions, exit criteria, and assigned actions for such acquisition, as determined by the person exercising acquisition decision authority for such acquisition.</text>
 </paragraph><paragraph id="H57D9690F468D4DAD831EC0B2D2CB9019"><enum>(5)</enum><text>The term <quote>acquisition program</quote> means the process by which the Department acquires, with any appropriated amounts, by contract for purchase or lease, property or services (including construction) that support the missions and goals of the Department.</text>
 </paragraph><paragraph id="H49E850FA082A49DDAE9EE6EA3A394E43"><enum>(6)</enum><text>The term <quote>acquisition program baseline</quote>, with respect to an acquisition program, means a summary of the cost, schedule, and performance parameters, expressed in standard, measurable, quantitative terms, which must be met in order to accomplish the goals of such program.</text>
 </paragraph><paragraph id="H08815361CDFD459F84588963E73979E7"><enum>(7)</enum><text>The term <quote>best practices</quote>, with respect to acquisition, means a knowledge-based approach to capability development that includes—</text>
 <subparagraph id="H087D33C9B0D74871B9434B4E0D1EC406"><enum>(A)</enum><text>identifying and validating needs;</text> </subparagraph><subparagraph id="H50FBF1544F0545A89DD7B404166B1BBC"><enum>(B)</enum><text>assessing alternatives to select the most appropriate solution;</text>
 </subparagraph><subparagraph id="H8B95AE56D9764D5AAFFF64A8623C4005"><enum>(C)</enum><text>clearly establishing well-defined requirements;</text> </subparagraph><subparagraph id="H09A6546C069543C2ADFDE4B13463FF66"><enum>(D)</enum><text>developing realistic cost assessments and schedules;</text>
 </subparagraph><subparagraph id="HDF41973B33DA42CCAC08CEE5482ED60C"><enum>(E)</enum><text>securing stable funding that matches resources to requirements;</text> </subparagraph><subparagraph id="H0FC91DC6D646434E9F1A956C32837C53"><enum>(F)</enum><text>demonstrating technology, design, and manufacturing maturity;</text>
 </subparagraph><subparagraph id="H6A154D11665440D9BFD8CF7536329E39"><enum>(G)</enum><text>using milestones and exit criteria or specific accomplishments that demonstrate progress;</text> </subparagraph><subparagraph id="H2417EB7D217140B7B336D0A8337B38E1"><enum>(H)</enum><text>adopting and executing standardized processes with known success across programs;</text>
 </subparagraph><subparagraph id="H35084807DA39478884B6934E3B5934AE"><enum>(I)</enum><text>establishing an adequate workforce that is qualified and sufficient to perform necessary functions; and</text>
 </subparagraph><subparagraph id="H7DEDAF15358543648D55E687E9C7F791"><enum>(J)</enum><text>integrating the capabilities described in subparagraphs (A) through (I) into the Department’s mission and business operations.</text>
 </subparagraph></paragraph><paragraph id="H49D955868A6648199B5676A1CFDE8E6C"><enum>(8)</enum><text>The term <quote>breach</quote>, with respect to a major acquisition program, means a failure to meet any cost, schedule, or performance threshold specified in the most recently approved acquisition program baseline.</text>
 </paragraph><paragraph id="H9FF68EFB41EF474E820C527196EE8849"><enum>(9)</enum><text>The term <quote>congressional homeland security committees</quote> means—</text> <subparagraph id="H2221010555DB46398080AC1B58F11520"><enum>(A)</enum><text>the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text>
 </subparagraph><subparagraph id="H28DEED9C97C449F6BD82C34C38865FEF"><enum>(B)</enum><text>the Committee on Appropriations of the House of Representatives and of the Senate.</text> </subparagraph></paragraph><paragraph id="HB200134C68184ED880CB15D2DC934293"><enum>(10)</enum><text>The term <quote>Component Acquisition Executive</quote> means the senior acquisition official within a component who is designated in writing by the Under Secretary for Management, in consultation with the component head, with authority and responsibility for leading a process and staff to provide acquisition and program management oversight, policy, and guidance to ensure that statutory, regulatory, and higher level policy requirements are fulfilled, including compliance with Federal law, the Federal Acquisition Regulation, and Department acquisition management directives established by the Under Secretary for Management.</text>
 </paragraph><paragraph id="H8E54630ED20C4C90BA2EA33F0E0920E8"><enum>(11)</enum><text>The term <quote>major acquisition program</quote> means a Department acquisition program that is estimated by the Secretary to require an eventual total expenditure of at least $300,000,000 (based on fiscal year 2017 constant dollars) over its life cycle cost.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>

							<subsection id="HDAB7905959894A66ABB5F56564E41AA0"><enum>(d)</enum><header>Acquisition and related responsibilities</header>
 <paragraph id="H7782C6D323994E0E8068FF22D821EB63"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (a) of section 1702 of title 41, United States Code, the Under Secretary for Management is the Chief Acquisition Officer of the Department. As Chief Acquisition Officer, the Under Secretary shall have the authorities and perform the functions specified in subsection (b) of such section and shall perform all other functions and responsibilities delegated by the Secretary or described in this subsection.</text>
 </paragraph><paragraph id="H8E1865AA6FB04CACAE2527FE8687ABE9"><enum>(2)</enum><header>Functions and responsibilities</header><text>In addition to the authorities and functions specified in section 1702(b) of title 41, United States Code, the functions and responsibilities of the Under Secretary for Management related to acquisition include the following:</text>
 <subparagraph id="H829C4BDFCADD4F818BD5D0B19BD4210E"><enum>(A)</enum><text display-inline="yes-display-inline">Advising the Secretary regarding acquisition management activities, taking into account risks of failure to achieve cost, schedule, or performance parameters, to ensure that the Department achieves its mission through the adoption of widely accepted program management best practices and standards and, where appropriate, acquisition innovation best practices.</text>
 </subparagraph><subparagraph id="H84FFDB1F78C44D31B225871267300DB1"><enum>(B)</enum><text display-inline="yes-display-inline">Leading the acquisition oversight body of the Department, the Acquisition Review Board, and exercising the acquisition decision authority to approve, pause, modify (including the rescission of approvals of program milestones), or cancel major acquisition programs, unless the Under Secretary delegates such authority to a Component Acquisition Executive pursuant to paragraph (3).</text>
 </subparagraph><subparagraph id="H2045FAF3B6974A2891F6E322E208972C"><enum>(C)</enum><text>Establishing policies for acquisition that implement an approach that takes into account risks of failure to achieve cost, schedule, or performance parameters that all components of the Department shall comply with, including outlining relevant authorities for program managers to effectively manage acquisition programs.</text>
 </subparagraph><subparagraph id="HE1E47463F2C241618AC52B3B987762B8"><enum>(D)</enum><text>Ensuring that each major acquisition program has a Department-approved acquisition program baseline, pursuant to the Department’s acquisition management policy.</text>
 </subparagraph><subparagraph id="H46B71E14BF1D4D85822C4A4557BE9030"><enum>(E)</enum><text>Ensuring that the heads of components and Component Acquisition Executives comply with Federal law, the Federal Acquisition Regulation, and Department acquisition management directives.</text>
 </subparagraph><subparagraph id="H7E09625050784CCCB8BC1AD6674475E0"><enum>(F)</enum><text>Ensuring that grants and financial assistance are provided only to individuals and organizations that are not suspended or debarred.</text>
 </subparagraph><subparagraph id="HA30F23642E8042EC8102E55520266FBA"><enum>(G)</enum><text>Distributing guidance throughout the Department to ensure that contractors involved in acquisitions, particularly contractors that access the Department’s information systems and technologies, adhere to relevant Department policies related to physical and information security as identified by the Under Secretary for Management.</text>
 </subparagraph><subparagraph id="H9834E9B6F71E428DAF4A80E7C996B730"><enum>(H)</enum><text>Overseeing the Component Acquisition Executive organizational structure to ensure Component Acquisition Executives have sufficient capabilities and comply with Department acquisition policies.</text>
									</subparagraph></paragraph><paragraph id="H20C06076D384406E8117D0DF3068C02B"><enum>(3)</enum><header>Delegation of acquisition decision authority</header>
 <subparagraph id="H7948FB9FD40349BEBE4DDA4E47EED7E7"><enum>(A)</enum><header>Level 3 acquisitions</header><text>The Under Secretary for Management may delegate acquisition decision authority in writing to the relevant Component Acquisition Executive for an acquisition program that has a life cycle cost estimate of less than $300,000,000.</text>
 </subparagraph><subparagraph id="H24F99E5278FB4DB6BD6D4F8A47A7C26F"><enum>(B)</enum><header>Level 2 acquisitions</header><text>The Under Secretary for Management may delegate acquisition decision authority in writing to the relevant Component Acquisition Executive for a major acquisition program that has a life cycle cost estimate of at least $300,000,000 but not more than $1,000,000,000 if all of the following requirements are met:</text>
 <clause id="H5A0F123F454940A6A4C6B593DFAC073D"><enum>(i)</enum><text>The component concerned possesses working policies, processes, and procedures that are consistent with Department-level acquisition policy.</text>
 </clause><clause id="HAB757D5FBDE74322B367A9B76F873F7F"><enum>(ii)</enum><text>The Component Acquisition Executive concerned has adequate, experienced, and dedicated professional employees with program management training, as applicable, commensurate with the size of the acquisition programs and related activities delegated to such Component Acquisition Executive by the Under Secretary for Management.</text>
 </clause><clause id="H0D6C14BBE5074A0D816A01DCA8D37083"><enum>(iii)</enum><text>Each major acquisition program concerned has written documentation showing that it has a Department-approved acquisition program baseline and it is meeting agreed-upon cost, schedule, and performance thresholds.</text>
										</clause></subparagraph></paragraph><paragraph id="HDD4718BF15F7405391B8A4604639F28D"><enum>(4)</enum><header>Relationship to Under Secretary for Science and Technology</header>
 <subparagraph id="H491FAEEAF5D54791AA5D3C2D2F5843AB"><enum>(A)</enum><header>In general</header><text>Nothing in this subsection shall diminish the authority granted to the Under Secretary for Science and Technology under this Act. The Under Secretary for Management and the Under Secretary for Science and Technology shall cooperate in matters related to the coordination of acquisitions across the Department so that investments of the Directorate of Science and Technology are able to support current and future requirements of the components of the Department.</text>
 </subparagraph><subparagraph id="H37D3E155BD19489088F6386444E8BA1F"><enum>(B)</enum><header>Operational testing and evaluation</header><text>The Under Secretary for Science and Technology shall—</text> <clause id="H4EE0F2C134EE4BB19FA7E83593E241A3"><enum>(i)</enum><text>ensure, in coordination with relevant component heads, that major acquisition programs—</text>
 <subclause id="H507209F017814EA4A32E5C6E25EE2C61"><enum>(I)</enum><text>complete operational testing and evaluation of technologies and systems;</text> </subclause><subclause id="H6245C436A0C3416DBC7F07CB0CAF53C0"><enum>(II)</enum><text>use independent verification and validation of operational test and evaluation implementation and results; and</text>
 </subclause><subclause id="H1427AEBE20274996A2985960FE40CA75"><enum>(III)</enum><text>document whether such programs meet all performance requirements included in their acquisition program baselines;</text>
 </subclause></clause><clause id="H81E59F5D5B3742EB97B32C111D4F91E4"><enum>(ii)</enum><text>ensure that such operational testing and evaluation includes all system components and incorporates operators into the testing to ensure that systems perform as intended in the appropriate operational setting; and</text>
 </clause><clause id="H82AF52B21E1E4C14A17D3446552FA2DA"><enum>(iii)</enum><text>determine if testing conducted by other Federal agencies and private entities is relevant and sufficient in determining whether systems perform as intended in the operational setting.</text>
 </clause></subparagraph></paragraph><paragraph id="HA9BB13154EAE42C69A59C08D6E2945D2"><enum>(5)</enum><header>Definitions</header><text>In this subsection, the terms <quote>acquisition</quote>, <quote>best practices</quote>, <quote>acquisition decision authority</quote>, <quote>major acquisition program</quote>, <quote>acquisition program baseline</quote>, and <quote>Component Acquisition Executive</quote> have the meanings given such terms in section 830.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="H718F067DCF714DE190035957C78C9017"><enum>212.</enum><header>Acquisition authorities for Chief Financial Officer of the Department of Homeland Security</header><text display-inline="no-display-inline">Paragraph (2) of section 702(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/342">6 U.S.C. 342(b)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

 <subparagraph id="HCD09C21A6E3E4BDE8C478E8AC028E123"><enum>(J)</enum><text display-inline="yes-display-inline">Oversee the costs of acquisition programs and related activities to ensure that actual and planned costs are in accordance with budget estimates and are affordable, or can be adequately funded, over the life cycle of such programs and activities.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H7DBBB477CBB14D8A9C660FD26CC46F76"><enum>213.</enum><header>Acquisition authorities for Chief Information Officer of the Department of Homeland Security</header><text display-inline="no-display-inline">Section 703 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/343">6 U.S.C. 343</external-xref>) is amended—</text> <paragraph id="H6E4E219FC97645C7A5AB74FCAED236EF"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text>
 </paragraph><paragraph id="HE4CAB5F9D35B49BAA4D6E6FBFD9AD288"><enum>(2)</enum><text>by inserting after subsection (a) the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H0FDC23BA6FEB45A5AB901ABE9AA615DD" style="OLC"> <subsection id="H6718A6EBF1264A6182B657F8A8279212"><enum>(b)</enum><header>Acquisition responsibilities</header><text>Notwithstanding section 11315 of title 40, United States Code, the acquisition responsibilities of the Chief Information Officer, in consultation with the Under Secretary for Management, shall include the following:</text>
 <paragraph id="H98826D3A753C45C1918DCA1EB3FE6DD4"><enum>(1)</enum><text>Oversee the management of the Homeland Security Enterprise Architecture and ensure that, before each acquisition decision event (as such term is defined in section 830), approved information technology acquisitions comply with departmental information technology management processes, technical requirements, and the Homeland Security Enterprise Architecture, and in any case in which information technology acquisitions do not comply with the Department’s management directives, make recommendations to the Acquisition Review Board regarding such noncompliance.</text>
 </paragraph><paragraph id="HF782937724C54AEEB74FD660835FDA98"><enum>(2)</enum><text>Be responsible for providing recommendations to the Acquisition Review Board regarding information technology programs, and be responsible for developing information technology acquisition strategic guidance.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HB9FF33E94E7240CA8B8E311E5EE862AF"><enum>214.</enum><header>Acquisition authorities for Program Accountability and Risk Management</header>
 <subsection id="HB150D2BF891C44968680138D76FCF4D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/341">6 U.S.C. 341</external-xref> et seq.) is further amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H0BC9F73AEFDB4357A6F1BE542D548E52" style="OLC">
							<section id="H47C1A5459FC74775B0CDC2E5E3138D4D"><enum>713.</enum><header>Acquisition authorities for Program Accountability and Risk Management</header>
 <subsection display-inline="no-display-inline" id="H78F149ED7B7343CC8D0A687B4F7F9A34"><enum>(a)</enum><header>Establishment of Office</header><text display-inline="yes-display-inline">There is in the Management Directorate of the Department an office to be known as <quote>Program Accountability and Risk Management</quote>. The purpose of the office is to—</text> <paragraph id="H477CE1E1F0534F9C8D88650ADE258C45"><enum>(1)</enum><text>provide consistent accountability, standardization, and transparency of major acquisition programs of the Department; and</text>
 </paragraph><paragraph id="H9BD0D7A7C11F40D3B7C0F51124AB2FF4"><enum>(2)</enum><text>serve as the central oversight function for all Department acquisition programs.</text> </paragraph></subsection><subsection id="H0BD8942C2E154FCFBE32F4AC51E2F1C0"><enum>(b)</enum><header>Responsibilities of Executive Director</header><text display-inline="yes-display-inline">The Program Accountability and Risk Management shall be led by an Executive Director to oversee the requirement under subsection (a). The Executive Director shall report directly to the Under Secretary for Management, and shall carry out the following responsibilities:</text>
 <paragraph id="H4FBA8FC5B5BE461BAC31CF0436700F18"><enum>(1)</enum><text>Monitor regularly the performance of Department acquisition programs between acquisition decision events to identify problems with cost, performance, or schedule that components may need to address to prevent cost overruns, performance issues, or schedule delays.</text>
 </paragraph><paragraph id="HACA867B7DCE3482983877852ABFB8259"><enum>(2)</enum><text display-inline="yes-display-inline">Assist the Under Secretary for Management in managing the acquisition programs and related activities of the Department.</text>
 </paragraph><paragraph id="H2BD89E3ACE1B4818B838AF8C45F294F0"><enum>(3)</enum><text>Conduct oversight of individual acquisition programs to implement Department acquisition program policy, procedures, and guidance with a priority on ensuring the data the office collects and maintains from Department components is accurate and reliable.</text>
 </paragraph><paragraph id="HA70A72034E2E40669E3F8ED769286B40"><enum>(4)</enum><text>Serve as the focal point and coordinator for the acquisition life cycle review process and as the executive secretariat for the Acquisition Review Board.</text>
 </paragraph><paragraph id="H38A6EE2411944BA8A746601752549A1D"><enum>(5)</enum><text>Advise the persons having acquisition decision authority in making acquisition decisions consistent with all applicable laws and in establishing clear lines of authority, accountability, and responsibility for acquisition decision making within the Department.</text>
 </paragraph><paragraph id="HB934EE19ECB24C0393E65490C92DBB61"><enum>(6)</enum><text>Engage in the strategic planning and performance evaluation process required under section 306 of title 5, United States Code, and sections 1105(a)(28), 1115, 1116, and 9703 of title 31, United States Code, by supporting the Chief Procurement Officer in developing strategies and specific plans for hiring, training, and professional development in order to rectify any deficiency within the Department’s acquisition workforce.</text>
 </paragraph><paragraph id="HCAFA48DB8AEB42FCBBCBFFB7041849C2"><enum>(7)</enum><text>Develop standardized certification standards in consultation with the Component Acquisition Executives for all acquisition program managers.</text>
 </paragraph><paragraph id="HFC8E3A763F2747FBB937FB57EC8D783C"><enum>(8)</enum><text>In the event that a certification or action of an acquisition program manager needs review for purposes of promotion or removal, provide input, in consultation with the relevant Component Acquisition Executive, into the performance evaluation of the relevant acquisition program manager and report positive or negative experiences to the relevant certifying authority.</text>
 </paragraph><paragraph id="HB6F066E4D0EC479690AA60A2115B4440"><enum>(9)</enum><text>Provide technical support and assistance to Department acquisitions and acquisition personnel in conjunction with the Chief Procurement Officer.</text>
 </paragraph><paragraph commented="no" id="H5EDC0BE21C214E5FBB3AD4A619D3515E"><enum>(10)</enum><text display-inline="yes-display-inline">Prepare the Comprehensive Acquisition Status Report for the Department, as required by title I of division D of the Consolidated Appropriations Act, 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/113">Public Law 114–113</external-xref>), and make such report available to the congressional homeland security committees.</text>
 </paragraph></subsection><subsection id="H625DBE6214624A9981114853F59937B9"><enum>(c)</enum><header>Responsibilities of components</header><text display-inline="yes-display-inline">Each head of a component shall comply with Federal law, the Federal Acquisition Regulation, and Department acquisition management directives established by the Under Secretary for Management. For each major acquisition program, each head of a component shall—</text>
 <paragraph id="H72CC8D3F8D3140A799700CD5EA46AF9C"><enum>(1)</enum><text>define baseline requirements and document changes to such requirements, as appropriate;</text> </paragraph><paragraph id="HC34A842F67F747EE95B2A3396BD7295B"><enum>(2)</enum><text>establish a complete life cycle cost estimate with supporting documentation, including an acquisition program baseline;</text>
 </paragraph><paragraph id="HFDC18AFA559D4FF78917428D4AE28AE3"><enum>(3)</enum><text>verify each life cycle cost estimate against independent cost estimates, and reconcile any differences;</text>
 </paragraph><paragraph id="HD9790E83E21B4568B79A8059F0DE4772"><enum>(4)</enum><text>complete a cost-benefit analysis with supporting documentation;</text> </paragraph><paragraph id="H32CE8C2D7F504433A9627F2C416D17B4"><enum>(5)</enum><text>develop and maintain a schedule that is consistent with scheduling best practices as identified by the Comptroller General of the United States, including, in appropriate cases, an integrated master schedule; and</text>
 </paragraph><paragraph id="H6610DD7C65104D679BF95B19A8635BB6"><enum>(6)</enum><text>ensure that all acquisition program information provided by the component is complete, accurate, timely, and valid.</text>
 </paragraph></subsection><subsection id="H683A2C39168C472C84BA27D5ACE76D93"><enum>(d)</enum><header>Congressional homeland security committees defined</header><text>In this section, the term <quote>congressional homeland security committees</quote> means—</text> <paragraph id="HB405B5C4E2F0413C8BC3A80128A3A70B"><enum>(1)</enum><text>the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text>
 </paragraph><paragraph id="H6D05388461F242DBAD2AAE6E79501262"><enum>(2)</enum><text>the Committee on Appropriations of the House of Representatives and the Committee on Appropriations of the Senate.</text>
									</paragraph></subsection></section><section id="HDCA4BBCB41B1486AA7921C70559BEF45"><enum>714.</enum><header>Acquisition documentation</header>
 <subsection id="HAF1214ADE70B460CA65B256C5F4579ED"><enum>(a)</enum><header>In general</header><text>For each major acquisition program, the Executive Director responsible for the preparation of the Comprehensive Acquisition Status Report, pursuant to paragraph (11) of section 710(b), shall require certain acquisition documentation to be submitted by Department components or offices.</text>
 </subsection><subsection id="H349684EA963A4A829B76B069450A30D5"><enum>(b)</enum><header>Waiver</header><text>The Secretary may waive the requirement for submission under subsection (a) for a program for a fiscal year if either—</text>
 <paragraph id="HC38410FF431E4CEB807DCFD48DD22F7C"><enum>(1)</enum><text>the program has not—</text> <subparagraph id="H3AA10B3D606C4657BABC7693ED579EB8"><enum>(A)</enum><text>entered the full rate production phase in the acquisition life cycle;</text>
 </subparagraph><subparagraph id="H887EF91F88394C789E6542FFF444575D"><enum>(B)</enum><text>had a reasonable cost estimate established; and</text> </subparagraph><subparagraph id="H1614165823E04115A303EFB8CB667FC7"><enum>(C)</enum><text>had a system configuration defined fully; or</text>
 </subparagraph></paragraph><paragraph id="H498545C7199548A6A39A02EC33B4E050"><enum>(2)</enum><text>the program does not meet the definition of <quote>capital asset</quote>, as defined by the Director of the Office of Management and Budget.</text> </paragraph></subsection><subsection id="H3E101F45747245F5A13A5DB388FA78BE"><enum>(c)</enum><header>Congressional oversight</header><text>At the same time the President’s budget is submitted for a fiscal year under section 1105(a) of title 31, United States Code, the Secretary shall submit to the Committee on Homeland Security of the House of Representatives and Committee on Homeland Security and Governmental Affairs of the Senate information on the exercise of authority under subsection (b) in the prior fiscal year that includes the following specific information regarding each program for which a waiver is issued under subsection (b):</text>
 <paragraph id="H04D80D782ABA47D09257FDAD213C1FD7"><enum>(1)</enum><text>The grounds for granting a waiver for that program.</text> </paragraph><paragraph id="H6385014BFCBA4BCF9E9EE5FDFA3DFC84"><enum>(2)</enum><text>The projected cost of that program.</text>
 </paragraph><paragraph id="HBCC166FC341F4A25B350F4187E25E0D9"><enum>(3)</enum><text>The proportion of a component’s annual acquisition budget attributed to that program, as available.</text> </paragraph><paragraph id="H3A3792917280401783109D099000844B"><enum>(4)</enum><text>Information on the significance of the program with respect to the component’s operations and execution of its mission.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H623BC5E9C9A24400892C333AFA5CF181"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 709 the following new items:</text>

 <subsection id="HB2D6EA02B618456F94E0DC09C1A3270C"><enum>(a)</enum><header>In general</header><text>Subtitle D of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/391">6 U.S.C. 391</external-xref> et seq.) is amended by adding at the end the following new section:</text>
						<quoted-block id="HDF6C12CCAB2C41B592CD15DC4713BF16" style="OLC">
							<section id="H14AD6E4978DE4667B645BB341F7E4ABB"><enum>836.</enum><header>Acquisition Review Board</header>
 <subsection id="H1678857BB4C94511A81DC5ABA717D160"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish an Acquisition Review Board (in this section referred to as the <quote>Board</quote>) to—</text> <paragraph id="H538AC68F61E847E9A635011EBCBA347C"><enum>(1)</enum><text>strengthen accountability and uniformity within the Department acquisition review process;</text>
 </paragraph><paragraph id="H942CF80613E84B3695A0362F1A5BB53F"><enum>(2)</enum><text>review major acquisition programs; and</text> </paragraph><paragraph id="H814D34DC00F24E8381EBE1F034BD4ABA"><enum>(3)</enum><text>review the use of best practices.</text>
 </paragraph></subsection><subsection id="HCB1E9B57B3FA4DBB8A8E54084C76CE36"><enum>(b)</enum><header>Composition</header><text>The Under Secretary for Management shall serve as chair of the Board. The Secretary shall also ensure participation by other relevant Department officials, including at least two component heads or their designees, as permanent members of the Board.</text>
 </subsection><subsection id="H9299E026CCED48C7BA95552D0C65BE60"><enum>(c)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Board shall meet regularly for purposes of ensuring all acquisitions processes proceed in a timely fashion to achieve mission readiness. The Board shall convene at the discretion of the Secretary and at any time—</text>
 <paragraph id="HA767A6217D22459D8583E25944C0397C"><enum>(1)</enum><text>a major acquisition program—</text> <subparagraph id="HF97F5135E80D45BEB95F9FD19825D337"><enum>(A)</enum><text>requires authorization to proceed from one acquisition decision event to another throughout the acquisition life cycle;</text>
 </subparagraph><subparagraph id="H36E5FB692FB34F86BB8D6D9103C7FC86"><enum>(B)</enum><text>is in breach of its approved requirements; or</text> </subparagraph><subparagraph id="HDFB534DC694C4849A7C784662D98118B"><enum>(C)</enum><text display-inline="yes-display-inline">requires additional review, as determined by the Under Secretary for Management; or</text>
 </subparagraph></paragraph><paragraph id="H23177BB78FD74B3082999054BE3C0CA0"><enum>(2)</enum><text>a non-major acquisition program requires review, as determined by the Under Secretary for Management.</text>
 </paragraph></subsection><subsection id="H2C38CFBB3AB147839BEACA48113D7A74"><enum>(d)</enum><header>Responsibilities</header><text>The responsibilities of the Board are as follows:</text> <paragraph id="HF1E625B7188E44EBA8218626C90E1195"><enum>(1)</enum><text>Determine whether a proposed acquisition has met the requirements of key phases of the acquisition life cycle framework and is able to proceed to the next phase and eventual full production and deployment.</text>
 </paragraph><paragraph id="HAE22C0B5FCDE4CEEBCE415BCDA9F945E"><enum>(2)</enum><text>Oversee whether a proposed acquisition’s business strategy, resources, management, and accountability is executable and is aligned to strategic initiatives.</text>
 </paragraph><paragraph id="HA8C8744C99E74338B2EA36A8BC16C9B9"><enum>(3)</enum><text>Support the person with acquisition decision authority for an acquisition in determining the appropriate direction for such acquisition at key acquisition decision events.</text>
 </paragraph><paragraph id="H3B7A0B06848946F99F8AB53513384E91"><enum>(4)</enum><text>Conduct systematic reviews of acquisitions to ensure that such acquisitions are progressing in compliance with the approved documents for their current acquisition phases.</text>
 </paragraph><paragraph id="H34B8AF84908249F18E1A6155B41AA392"><enum>(5)</enum><text>Review the acquisition documents of each major acquisition program, including the acquisition program baseline and documentation reflecting consideration of tradeoffs among cost, schedule, and performance objectives, to ensure the reliability of underlying data.</text>
 </paragraph><paragraph id="HC4C06B3F65B14F64B0ABF6F2999F322D"><enum>(6)</enum><text>Ensure that practices are adopted and implemented to require consideration of trade-offs among cost, schedule, and performance objectives as part of the process for developing requirements for major acquisition programs prior to the initiation of the second acquisition decision event, including, at a minimum, the following practices:</text>
 <subparagraph id="H68F6C717928F44A6A5ECA29429568F31"><enum>(A)</enum><text>Department officials responsible for acquisition, budget, and cost estimating functions are provided with the appropriate opportunity to develop estimates and raise cost and schedule matters before performance objectives are established for capabilities when feasible.</text>
 </subparagraph><subparagraph id="H929D7C6177F14A7796C3EEDA5D8C59C7"><enum>(B)</enum><text>Full consideration is given to possible trade-offs among cost, schedule, and performance objectives for each alternative.</text>
 </subparagraph></paragraph></subsection><subsection id="HA35D9A0709F34C13BA790227BF15A837"><enum>(e)</enum><header>Acquisition program baseline report requirement</header><text>If the person exercising acquisition decision authority over a major acquisition program approves such program to proceed into the planning phase before such program has a Department-approved acquisition program baseline, the Under Secretary for Management shall create and approve an acquisition program baseline report regarding such approval, and the Secretary shall—</text>
 <paragraph id="H51C1EBF47BD047F48CA070CD51161390"><enum>(1)</enum><text>within seven days after an acquisition decision memorandum is signed, notify in writing the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate of such decision; and</text>
 </paragraph><paragraph id="H3B93EAB360F64E458647CCC57A6390DA"><enum>(2)</enum><text>within 60 days after the acquisition decision memorandum is signed, submit to such committees a report stating the rationale for such decision and a plan of action to require an acquisition program baseline for such program.</text>
 </paragraph></subsection><subsection display-inline="no-display-inline" id="H048BF6FC1B0D476090FD97F74D16C6F4"><enum>(f)</enum><header>Report</header><text display-inline="yes-display-inline">The Under Secretary for Management shall provide information to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate on an annual basis through fiscal year 2022 on the activities of the Board for the prior fiscal year that includes information relating to the following:</text>
 <paragraph id="H981C7F2D9C8445AB8ABDBD53E5C3119E"><enum>(1)</enum><text>For each meeting of the Board, any acquisition decision memoranda.</text> </paragraph><paragraph id="H40270089043941C1901FA83B91824DBA"><enum>(2)</enum><text>Results of the systematic reviews conducted pursuant to paragraph (4) of subsection (d).</text>
 </paragraph><paragraph id="H3CA5AE713F5B49029081C8D7D6C88E82"><enum>(3)</enum><text>Results of acquisition document reviews required pursuant to paragraph (5) of subsection (d).</text> </paragraph><paragraph id="H6BC4E5FA76B24A4E9D3AAAD26ECBDD1D"><enum>(4)</enum><text>Activities to ensure that practices are adopted and implemented throughout the Department pursuant to paragraph (6) of subsection (d).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

 <subsection id="H4C359B1F6C534B8CB8501489557BFDC4"><enum>(a)</enum><header>In general</header><text>Subtitle D of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/391">6 U.S.C. 391</external-xref> et seq.) is further amended by adding at the end the following new section:</text>
						<quoted-block id="H0C841427E6D249C6AFD0FE5950B8B7EF" style="OLC">
							<section id="H150EB6A8355F41589229E45D96897E70"><enum>837.</enum><header>Requirements to reduce duplication in acquisition programs</header>
 <subsection id="HF9F7F58394764F189251C13C3F4F23AF"><enum>(a)</enum><header>Requirement To establish policies</header><text>In an effort to reduce unnecessary duplication and inefficiency for all Department investments, including major acquisition programs, the Deputy Secretary, in consultation with the Under Secretary for Management, shall establish Department-wide policies to integrate all phases of the investment life cycle and help the Department identify, validate, and prioritize common component requirements for major acquisition programs in order to increase opportunities for effectiveness and efficiencies. The policies shall also include strategic alternatives for developing and facilitating a Department component-driven requirements process that includes oversight of a development test and evaluation capability; identification of priority gaps and overlaps in Department capability needs; and provision of feasible technical alternatives, including innovative commercially available alternatives, to meet capability needs.</text>
 </subsection><subsection id="H9C99D100597749CA8E624D22983CA1CC"><enum>(b)</enum><header>Mechanisms To carry out requirement</header><text>The Under Secretary for Management shall coordinate the actions necessary to carry out subsection (a), using such mechanisms as considered necessary by the Secretary to help the Department reduce unnecessary duplication and inefficiency for all Department investments, including major acquisition programs.</text>
 </subsection><subsection id="H589617A4DC104787B618C2ECD291D5B4"><enum>(c)</enum><header>Coordination</header><text>In coordinating the actions necessary to carry out subsection (a), the Deputy Secretary shall consult with the Under Secretary for Management, Component Acquisition Executives, and any other Department officials, including the Under Secretary for Science and Technology or his designee, with specific knowledge of Department or component acquisition capabilities to prevent unnecessary duplication of requirements.</text>
 </subsection><subsection id="HEF9DE49CE9C447EDA904606161DFD42A"><enum>(d)</enum><header>Advisors</header><text>The Deputy Secretary, in consultation with the Under Secretary for Management, shall seek and consider input within legal and ethical boundaries from members of Federal, State, local, and tribal governments, nonprofit organizations, and the private sector, as appropriate, on matters within their authority and expertise in carrying out the Department’s mission.</text>
 </subsection><subsection id="H737984B2BEE14B48A2E07F2C125BB62E"><enum>(e)</enum><header>Meetings</header><text>The Deputy Secretary, in consultation with the Under Secretary for Management, shall meet at least quarterly and communicate with components often to ensure that components do not overlap or duplicate spending or activities on major investments and acquisition programs within their areas of responsibility.</text>
 </subsection><subsection id="H805667D0E8494FEF86E9621EDDD9B3D2"><enum>(f)</enum><header>Responsibilities</header><text>In carrying out this section, the responsibilities of the Deputy Secretary, in consultation with the Under Secretary for Management, are as follows:</text>
 <paragraph id="HCF3F48C3C2B3464984987D9D5E7D0AA9"><enum>(1)</enum><text>To review and validate the requirements documents of major investments and acquisition programs prior to acquisition decision events of the investments or programs.</text>
 </paragraph><paragraph id="H569003C82C45417EBF762137CE7674F1"><enum>(2)</enum><text>To ensure the requirements and scope of a major investment or acquisition program are stable, measurable, achievable, at an acceptable risk level, and match the resources planned to be available.</text>
 </paragraph><paragraph id="H147B833E188140DDBE89A1659818519A"><enum>(3)</enum><text>Before any entity of the Department issues a solicitation for a new contract, coordinate with other Department entities as appropriate to prevent unnecessary duplication and inefficiency and—</text>
 <subparagraph id="HA5379ACB05AC441D8FD97007172129E2"><enum>(A)</enum><text>to implement portfolio reviews to identify common mission requirements and crosscutting opportunities among components to harmonize investments and requirements and prevent unnecessary overlap and duplication among components; and</text>
 </subparagraph><subparagraph id="HE55FFB3F32D2436AB8EBE1504D4D5066"><enum>(B)</enum><text>to the extent practicable, to standardize equipment purchases, streamline the acquisition process, improve efficiencies, and conduct best practices for strategic sourcing.</text>
 </subparagraph></paragraph><paragraph id="H11E3C4047BC24426A437E1E2B7375AD2"><enum>(4)</enum><text>To ensure program managers of major investments and acquisition programs conduct analyses, giving particular attention to factors such as cost, schedule, risk, performance, and operational efficiency in order to determine that programs work as intended within cost and budget expectations.</text>
 </paragraph><paragraph id="H06DA4C1BD8714B9BB460AF4DE7EE1DD3"><enum>(5)</enum><text>To propose schedules for delivery of the operational capability needed to meet each Department investment and major acquisition program.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H5B9BD8B259C7424EB9DC473DEABCA875"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref> et seq.) is further amended by adding after the item relating to section 836 the following new item:</text>

								<toc-entry level="section">Sec. 837. Requirements to reduce duplication in acquisition programs.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="H13E92105205040EE88E198ACB80E6DC2"><enum>223.</enum><header>Government Accountability Office review of Board and of requirements to reduce duplication in
			 acquisition programs</header>
 <subsection id="H4C8833D150E541169062E1A14AF5E4C6"><enum>(a)</enum><header>Review required</header><text>The Comptroller General of the United States shall conduct a review of the effectiveness of the Acquisition Review Board established under section 836 of the Homeland Security Act of 2002 (as added by section 221) and the requirements to reduce unnecessary duplication in acquisition programs established under section 837 of such Act (as added by section 222) in improving the Department’s acquisition management process.</text>
 </subsection><subsection id="HFFEE26EE4EEA49CFB9F0DE78BA1CF1B3"><enum>(b)</enum><header>Scope of report</header><text>The review shall include the following:</text> <paragraph id="H1833216B8FDD49B1A95B8630F74CDBF1"><enum>(1)</enum><text>An assessment of the effectiveness of the Board in increasing program management oversight, best practices and standards, and discipline among the components of the Department, including in working together and in preventing overlap and unnecessary duplication.</text>
 </paragraph><paragraph id="HD237B5E8428E41B89FC9F42D28AF461D"><enum>(2)</enum><text>An assessment of the effectiveness of the Board in instilling program management discipline.</text> </paragraph><paragraph id="H90C738FB526E4BD9B26F37B29CA0AF11"><enum>(3)</enum><text>A statement of how regularly each major acquisition program is reviewed by the Board, how often the Board stops major acquisition programs from moving forward in the phases of the acquisition life cycle process, and the number of major acquisition programs that have been halted because of problems with operational effectiveness, schedule delays, or cost overruns.</text>
 </paragraph><paragraph id="HC103C1B7670E495FA1B952688DDB3A20"><enum>(4)</enum><text>An assessment of the effectiveness of the Board in impacting acquisition decisionmaking within the Department, including the degree to which the Board impacts decision making within other headquarters mechanisms and bodies involved in the administration of acquisition activities.</text>
 </paragraph></subsection><subsection id="H4CD4D24075BA489BA8ED43111362DE68"><enum>(c)</enum><header>Report required</header><text>Not later than one year after the date of the enactment of this Act, the Comptroller General shall submit to the congressional homeland security committees a report on the review required by this section. The report shall be submitted in unclassified form but may include a classified annex.</text>
 </subsection></section><section id="HB838DDC382F343469494884DF1B86D41"><enum>224.</enum><header>Excluded party list system waivers</header><text display-inline="no-display-inline">Not later than five days after the issuance of a waiver by the Secretary of Homeland Security of Federal requirements that an agency not engage in business with a contractor in the Excluded Party List System (or successor system) as maintained by the General Services Administration, the Secretary shall submit to Congress notice of such waiver and an explanation for a finding by the Secretary that a compelling reason exists for issuing such waiver.</text>
 </section><section id="H453897548080412A920D19AC3E00041C"><enum>225.</enum><header>Inspector General oversight of suspension and debarment</header><text display-inline="no-display-inline">The Inspector General of the Department of Homeland Security—</text> <paragraph id="H5B8EF85991BB40B6A22B55C29A985EB9"><enum>(1)</enum><text>may audit decisions about grant and procurement awards to identify instances where a contract or grant was improperly awarded to a suspended or debarred entity and whether corrective actions were taken to prevent recurrence; and</text>
 </paragraph><paragraph id="HBE7AC02453714D68B9CDBF94551C0351"><enum>(2)</enum><text>shall review the suspension and debarment program throughout the Department of Homeland Security to assess whether suspension and debarment criteria are consistently applied throughout the Department and whether disparities exist in the application of such criteria, particularly with respect to business size and categories.</text>
					</paragraph></section></subtitle><subtitle id="H6AC585216D474124ADB506332620980A"><enum>C</enum><header>Acquisition Program Management Accountability and Transparency</header>
				<section display-inline="no-display-inline" id="HCE92EDB6AE85482B97FF6172EE0719CD"><enum>231.</enum><header>Congressional notification for major acquisition programs</header>
 <subsection id="H5D5B521A748B4C0EA613962CCA061A20"><enum>(a)</enum><header>In general</header><text>Subtitle D of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/391">6 U.S.C. 391</external-xref> et seq.) is further amended by adding at the end the following new section:</text>
						<quoted-block id="H25FA8427FB6C497088436D7BBB6339F0" style="OLC">
							<section id="H1BF8C57A84114F3E8B240086A5FCA1FB"><enum>838.</enum><header>Congressional notification and other requirements for major acquisition program breach</header>
								<subsection id="HF62853E61BEA49C68269E67216D70F8D"><enum>(a)</enum><header>Requirements within Department in event of breach</header>
									<paragraph id="H181E8C7B4BB84522A82141C7A20A2908"><enum>(1)</enum><header>Notifications</header>
 <subparagraph id="HB08D7382BE7B4BA1ABC78541FB2B06FD"><enum>(A)</enum><header>Notification of breach</header><text>If a breach occurs in a major acquisition program, the program manager for such program shall notify the Component Acquisition Executive for such program, the head of the component concerned, the Executive Director of the Program Accountability and Risk Management division, the Under Secretary for Management, and the Deputy Secretary not later than 30 calendar days after such breach is identified.</text>
 </subparagraph><subparagraph id="H2E8583356D5B4A12A00A377B1DDB4762"><enum>(B)</enum><header>Notification to Secretary</header><text display-inline="yes-display-inline">If a breach occurs in a major acquisition program and such breach results in a cost overrun greater than 15 percent, a schedule delay greater than 180 days, or a failure to meet any of the performance thresholds from the cost, schedule, or performance parameters specified in the most recently approved acquisition program baseline for such program, the Component Acquisition Executive for such program shall notify the Secretary and the Inspector General of the Department not later than five business days after the Component Acquisition Executive for such program, the head of the component concerned, the Executive Director of the Program Accountability and Risk Management Division, the Under Secretary for Management, and the Deputy Secretary are notified of the breach pursuant to subparagraph (A).</text>
										</subparagraph></paragraph><paragraph id="HC54F64FA7FE0499F902852B159B54334"><enum>(2)</enum><header>Remediation plan and root cause analysis</header>
 <subparagraph id="H1FED50C62A2049BC94395082A7F4A9CB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If a breach occurs in a major acquisition program, the program manager for such program shall submit to the head of the component concerned, the Executive Director of the Program Accountability and Risk Management division, and the Under Secretary for Management in writing a remediation plan and root cause analysis relating to such breach and program. Such plan and analysis shall be submitted at a date established at the discretion of the Under Secretary for Management.</text>
 </subparagraph><subparagraph id="HFDA446BD0BF7413BB0E87DE6E8348898"><enum>(B)</enum><header>Remediation plan</header><text>The remediation plan required under this subparagraph (A) shall—</text> <clause id="HA4DFE8B0AEF4428ABFC6160AE1BA314B"><enum>(i)</enum><text>explain the circumstances of the breach at issue;</text>
 </clause><clause id="HC0E74210A60E4FD5AE3F9F532F3B5205"><enum>(ii)</enum><text>provide prior cost estimating information;</text> </clause><clause id="H443CFD993892473F91C0348BD12C5169"><enum>(iii)</enum><text>include a root cause analysis that determines the underlying cause or causes of shortcomings in cost, schedule, or performance of the major acquisition program with respect to which such breach has occurred, including the role, if any, of—</text>
 <subclause id="H2AC13289F5544828A4913AA8AA3252D1"><enum>(I)</enum><text>unrealistic performance expectations;</text> </subclause><subclause id="HF79CDE7CE45D41A18AB147FC1D438C1E"><enum>(II)</enum><text>unrealistic baseline estimates for cost or schedule or changes in program requirements;</text>
 </subclause><subclause id="HA9513DEF677D4103B984037B593EE941"><enum>(III)</enum><text>immature technologies or excessive manufacturing or integration risk;</text> </subclause><subclause id="H0195F560AB2344CD9BBC0DD109159B46"><enum>(IV)</enum><text>unanticipated design, engineering, manufacturing, or technology integration issues arising during program performance;</text>
 </subclause><subclause id="HEC3362486D3A4781B24327B8B7F9B242"><enum>(V)</enum><text>changes to the scope of such program;</text> </subclause><subclause id="HBCEA273B85E643E1904D0FBDBEA13DA1"><enum>(VI)</enum><text>inadequate program funding or changes in planned out-year funding from one 5-year funding plan to the next 5-year funding plan as outlined in the Future Years Homeland Security Program required under section 874;</text>
 </subclause><subclause id="H72FDE641252444739A8F6DAADEB73436"><enum>(VII)</enum><text>legislative, legal, or regulatory changes; or</text> </subclause><subclause id="H39E4C0EF7CED4130BC3A3441C89A516F"><enum>(VIII)</enum><text>inadequate program management personnel, including lack of sufficient number of staff, training, credentials, certifications, or use of best practices;</text>
 </subclause></clause><clause id="H97AF3DF95FD0422B9157ED21CD449C97"><enum>(iv)</enum><text>propose corrective action to address cost growth, schedule delays, or performance issues;</text> </clause><clause id="H0080FB0865C446D8B66BE853D700BA12"><enum>(v)</enum><text>explain the rationale for why a proposed corrective action is recommended; and</text>
 </clause><clause id="H7784E8642FDA49C1988E0EE5BA415827"><enum>(vi)</enum><text>in coordination with the Component Acquisition Executive for such program, discuss all options considered, including the estimated impact on cost, schedule, or performance of such program if no changes are made to current requirements, the estimated cost of such program if requirements are modified, and the extent to which funding from other programs will need to be reduced to cover the cost growth of such program.</text>
											</clause></subparagraph></paragraph><paragraph id="H41374F701AE145EE93986D7B700EFF89"><enum>(3)</enum><header>Review of corrective actions</header>
 <subparagraph id="H334A194964634063AC4A97CA72CF8EDA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Under Secretary for Management shall review the remediation plan required under paragraph (2). The Under Secretary may approve such plan or provide an alternative proposed corrective action within 30 days of the submission of such plan under such paragraph.</text>
 </subparagraph><subparagraph commented="no" id="HF3BF9F23A94C4123A4B5AC6421F8628B"><enum>(B)</enum><header>Submission to Congress</header><text>Not later than 30 days after the review required under subparagraph (A) is completed, the Under Secretary for Management shall submit to the congressional homeland security committees the following:</text>
 <clause commented="no" id="H33CD58FDBB4C471486ACD599B8D01601"><enum>(i)</enum><text>A copy of the remediation plan and the root cause analysis required under paragraph (2).</text> </clause><clause commented="no" id="HEF1D432AD71345E1A7050D862DD3B068"><enum>(ii)</enum><text>A statement describing the corrective action or actions that have occurred pursuant to paragraph (2)(b)(iv) for the major acquisition program at issue, with a justification for such action or actions.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="H397F53AD16A24EB88A32759620BE7528"><enum>(b)</enum><header>Requirements relating to congressional notification if breach occurs</header>
 <paragraph commented="no" id="HED446AB38A4244D5A7F23E36F0D844E8"><enum>(1)</enum><header>Notification to Congress</header><text display-inline="yes-display-inline">If a notification to the Secretary is made under subsection (a)(1)(B) relating to a breach in a major acquisition program, the Under Secretary for Management shall notify the congressional homeland security committees of such breach in the next quarterly Comprehensive Acquisition Status Report, as required by title I of division D of the Consolidated Appropriations Act, 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/113">Public Law 114–113</external-xref>), following receipt by the Under Secretary of notification under such subsection.</text>
 </paragraph><paragraph id="H16683E965D154020A7ECC489808C7F09"><enum>(2)</enum><header>Significant variances in costs or schedule</header><text>If a likely cost overrun is greater than 20 percent or a likely delay is greater than 12 months from the costs and schedule specified in the acquisition program baseline for a major acquisition program, the Under Secretary for Management shall include in the notification required in paragraph (1) a written certification, with supporting explanation, that—</text>
 <subparagraph id="H283322FD1E034F658459BADD47B1DF62"><enum>(A)</enum><text>such program is essential to the accomplishment of the Department’s mission;</text> </subparagraph><subparagraph id="HF7B7D7C654AF45A280834E0C283CD0F2"><enum>(B)</enum><text>there are no alternatives to the capability or asset provided by such program that will provide equal or greater capability in both a more cost-effective and timely manner;</text>
 </subparagraph><subparagraph id="H6830F327882E49749CA593CB8B7490B7"><enum>(C)</enum><text>the new acquisition schedule and estimates for total acquisition cost are reasonable; and</text> </subparagraph><subparagraph id="H7A2383F0D27243CDB82AAC320BAF42ED"><enum>(D)</enum><text>the management structure for such program is adequate to manage and control cost, schedule, and performance.</text>
 </subparagraph></paragraph></subsection><subsection id="HAC9E5AC24EEF48728BCBECFD2F1C72E5"><enum>(c)</enum><header>Congressional homeland security committees defined</header><text>In this section, the term <quote>congressional homeland security committees</quote> means—</text> <paragraph id="HAB25CE7BE74F44FDA5E49270270B4243"><enum>(1)</enum><text>the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text>
 </paragraph><paragraph id="H62277BC95E324BDAB4E3A88E6BF0F570"><enum>(2)</enum><text>the Committee on Appropriations of the House of Representatives and the Committee on Appropriations of the Senate.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HEA045EB089FF42118E1817364A34C458"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 835 the following new item:</text>

 <subsection id="H21A6E987BD3048F7AE706A7193B194A4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle D of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/391">6 U.S.C. 391</external-xref> et seq.) is further amended by adding at the end the following new section:</text>
						<quoted-block display-inline="no-display-inline" id="HFD8274899ABA4C179E47433BD6135A86" style="OLC">
							<section id="H3E2E413FCF954E259E56EA2A1C215FEF"><enum>839.</enum><header>Multiyear acquisition strategy</header>
								<subsection id="HEEAD67A077AD41688FDCE3C75751FA18"><enum>(a)</enum><header>Multiyear acquisition strategy required</header>
 <paragraph id="HBFA97DE5C794419C8EAB9B1B117E952E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this section, the Secretary shall submit to the appropriate congressional committees and the Comptroller General of the United States a multiyear acquisition strategy to guide the overall direction of the acquisitions of the Department while allowing flexibility to deal with ever-changing threats and risks, and to help industry better understand, plan, and align resources to meet the future acquisition needs of the Department. Such strategy shall be updated and included in each Future Years Homeland Security Program required under section 874.</text>
 </paragraph><paragraph id="H5B79E69158F2497A8ACC82166CAE3C03"><enum>(2)</enum><header>Form</header><text>The strategy required under paragraph (1) shall be submitted in unclassified form but may include a classified annex for any sensitive or classified information if necessary. The Secretary shall publish such strategy in an unclassified format that is publicly available.</text>
 </paragraph></subsection><subsection id="H127BADC732754E439967A08A0C7C4176"><enum>(b)</enum><header>Consultation</header><text>In developing the strategy required under subsection (a), the Secretary shall, as the Secretary determines appropriate, consult with headquarters, components, employees in the field, and individuals from industry and the academic community.</text>
 </subsection><subsection id="H9D7366D92DD54571B38DCA1BFA57A4A6"><enum>(c)</enum><header>Contents of strategy</header><text>The strategy shall include the following:</text> <paragraph id="H0A714AFFBB29420990E368ACBF779FB9"><enum>(1)</enum><header>Prioritized list</header><text>A systematic and integrated prioritized list developed by the Under Secretary for Management in coordination with all of the Component Acquisition Executives of Department major acquisition programs that Department and component acquisition investments seek to address, including the expected security and economic benefit of the program or system that is the subject of acquisition and an analysis of how the security and economic benefit derived from such program or system will be measured.</text>
 </paragraph><paragraph id="H99B1258493424F108AE4985ECFA63D42"><enum>(2)</enum><header>Inventory</header><text>A plan to develop a reliable Department-wide inventory of investments and real property assets to help the Department—</text>
 <subparagraph id="HC511337D8A6C4EA6884B4DFFBFCC721E"><enum>(A)</enum><text>plan, budget, schedule, and acquire upgrades of its systems and equipment; and</text> </subparagraph><subparagraph id="HC2F209FA03D34CFBAE3BCEBED8AA6674"><enum>(B)</enum><text>plan for the acquisition and management of future systems and equipment.</text>
 </subparagraph></paragraph><paragraph id="H4214EB9D4ADA4BF4AA9F42DF20EEDBD8"><enum>(3)</enum><header>Funding gaps</header><text>A plan to address funding gaps between funding requirements for major acquisition programs and known available resources, including, to the maximum extent practicable, ways of leveraging best practices to identify and eliminate overpayment for items to—</text>
 <subparagraph id="H7A9CEC4C0BB84E9EB85F9C6AF9B02198"><enum>(A)</enum><text>prevent wasteful purchasing;</text> </subparagraph><subparagraph id="H0EDBC99FF30248598B45CB4ADABD66D6"><enum>(B)</enum><text>achieve the greatest level of efficiency and cost savings by rationalizing purchases;</text>
 </subparagraph><subparagraph id="H65D1D6E2BDC9416F9A9C07B7E5442F6B"><enum>(C)</enum><text>align pricing for similar items; and</text> </subparagraph><subparagraph id="H9B20589E7FDF47FDB68E390E451E8714"><enum>(D)</enum><text>utilize purchase timing and economies of scale.</text>
 </subparagraph></paragraph><paragraph id="H320E0CCFA475480CA4A60B445C4551CF"><enum>(4)</enum><header>Identification of capabilities</header><text>An identification of test, evaluation, modeling, and simulation capabilities that will be required to—</text>
 <subparagraph id="HE8C2BF2219A84381A51EBEF272D14B4D"><enum>(A)</enum><text>support the acquisition of technologies to meet the needs of such strategy;</text> </subparagraph><subparagraph id="H0CE31E043B2448EF8D61B2E1FB1D6ECF"><enum>(B)</enum><text>leverage to the greatest extent possible emerging technological trends and research and development trends within the public and private sectors; and</text>
 </subparagraph><subparagraph id="H977EAC1D095A4F8CB261BB144F61F79F"><enum>(C)</enum><text>identify ways to ensure that appropriate technology is acquired and integrated into the Department’s operating doctrine to improve mission performance.</text>
 </subparagraph></paragraph><paragraph id="H410FC91649ED4C4AB64FD6B9D88FBC80"><enum>(5)</enum><header>Focus on flexible solutions</header><text>An assessment of ways the Department can improve its ability to test and acquire innovative solutions to allow needed incentives and protections for appropriate risk-taking in order to meet its acquisition needs with resiliency, agility, and responsiveness to assure homeland security and facilitate trade.</text>
 </paragraph><paragraph id="HAD04D63CFEB84299BF20111AB1F78C96"><enum>(6)</enum><header>Focus on incentives to save taxpayer dollars</header><text>An assessment of ways the Department can develop incentives for program managers and senior Department acquisition officials to—</text>
 <subparagraph id="H4C9646AB124B4990AFA42FACEDE1165A"><enum>(A)</enum><text>prevent cost overruns;</text> </subparagraph><subparagraph id="HBB8E44BCE7134CCD9353F8CBDB0FE98C"><enum>(B)</enum><text>avoid schedule delays; and</text>
 </subparagraph><subparagraph id="H11EEF27B9790423DB077801B4CB7F3FC"><enum>(C)</enum><text>achieve cost savings in major acquisition programs.</text> </subparagraph></paragraph><paragraph id="H8F17230823C04CC9BC6C0AFF1ACFBD89"><enum>(7)</enum><header>Focus on addressing delays and bid protests</header><text>An assessment of ways the Department can improve the acquisition process to minimize cost overruns in—</text>
 <subparagraph id="H5C1FE7B131A24D3EB8497D2A7ECF4AAC"><enum>(A)</enum><text>requirements development;</text> </subparagraph><subparagraph id="HEAF15AF87CE94F5DBAF0346715A4A1E0"><enum>(B)</enum><text>procurement announcements;</text>
 </subparagraph><subparagraph id="H92282F68F96C4B1EB52127B5547BD2E8"><enum>(C)</enum><text>requests for proposals;</text> </subparagraph><subparagraph id="H9BB8329343D642AFABEC2A4A3607CAEF"><enum>(D)</enum><text>evaluation of proposals;</text>
 </subparagraph><subparagraph id="H6F81C4204086468CB857A79A01C4F6BB"><enum>(E)</enum><text>protests of decisions and awards; and</text> </subparagraph><subparagraph id="H68D09CFFF0274CE695D726F38F58D120"><enum>(F)</enum><text>the use of best practices.</text>
 </subparagraph></paragraph><paragraph id="H8589667FDE2F46AC8B722083EB5A1092"><enum>(8)</enum><header>Focus on improving outreach</header><text>An identification and assessment of ways to increase opportunities for communication and collaboration with industry, small and disadvantaged businesses, intra-government entities, university centers of excellence, accredited certification and standards development organizations, and national laboratories to ensure that the Department understands the market for technologies, products, and innovation that is available to meet its mission needs and to inform the Department’s requirements-setting process before engaging in an acquisition, including—</text>
 <subparagraph id="HFFB9DC5578D64EFE872CDFD4FD2C768A"><enum>(A)</enum><text>methods designed especially to engage small and disadvantaged businesses, a cost-benefit analysis of the tradeoffs that small and disadvantaged businesses provide, information relating to barriers to entry for small and disadvantaged businesses, and information relating to unique requirements for small and disadvantaged businesses; and</text>
 </subparagraph><subparagraph id="HCDC3A8B020654A169D87FB8C63374EC5"><enum>(B)</enum><text>within the Department Vendor Communication Plan and Market Research Guide, instructions for interaction by acquisition program managers with such entities to—</text>
 <clause id="H0C1D16BA53A5468695BAAF571BE550D2"><enum>(i)</enum><text>prevent misinterpretation of acquisition regulations; and</text> </clause><clause id="H8E94CAC38639467A8080E6079880AFBD"><enum>(ii)</enum><text>permit, within legal and ethical boundaries, interacting with such entities with transparency.</text>
 </clause></subparagraph></paragraph><paragraph id="HB6ECBFC132FF4BC7BA578E808DA278F5"><enum>(9)</enum><header>Competition</header><text>A plan regarding competition under subsection (d).</text> </paragraph><paragraph id="HECAAF2289B7E460FA995BA2DF37FF9F0"><enum>(10)</enum><header>Acquisition workforce</header><text>A plan regarding the Department acquisition workforce under subsection (e).</text>
 </paragraph></subsection><subsection id="HF3222AA2E8D94B239AD3E4E4BFE80E66"><enum>(d)</enum><header>Competition plan</header><text>The strategy required under subsection (a) shall also include a plan to address actions to ensure competition, or the option of competition, for major acquisition programs. Such plan may include assessments of the following measures in appropriate cases if such measures are cost effective:</text>
 <paragraph id="H8C6B30B3E9424513B5ED79B4D55BE2D5"><enum>(1)</enum><text>Competitive prototyping.</text> </paragraph><paragraph id="HBBF1CE84F70042D9A3E39DC6484398CF"><enum>(2)</enum><text>Dual-sourcing.</text>
 </paragraph><paragraph id="HDA7996B955734CD1828E1B4044C2F6C0"><enum>(3)</enum><text>Unbundling of contracts.</text> </paragraph><paragraph id="HFA2D6ADD392843CAB4FF9DCFEABA90E2"><enum>(4)</enum><text>Funding of next-generation prototype systems or subsystems.</text>
 </paragraph><paragraph id="H5499EEEF4A4C4461BB145FF566A4362C"><enum>(5)</enum><text>Use of modular, open architectures to enable competition for upgrades.</text> </paragraph><paragraph id="H33A355799A7847868544A1A98D6544CC"><enum>(6)</enum><text>Acquisition of complete technical data packages.</text>
 </paragraph><paragraph id="H9349AB6F08E546C1AE529ACE73141FDA"><enum>(7)</enum><text>Periodic competitions for subsystem upgrades.</text> </paragraph><paragraph id="H9198712F25524439AF86AC78247AA9FB"><enum>(8)</enum><text>Licensing of additional suppliers, including small businesses.</text>
 </paragraph><paragraph id="HEC6BE89457E74A85B81E84248F3565E4"><enum>(9)</enum><text>Periodic system or program reviews to address long-term competitive effects of program decisions.</text> </paragraph></subsection><subsection id="HBB31AFF6FACF408A9BD916DA43167335"><enum>(e)</enum><header>Acquisition workforce plan</header> <paragraph id="H862269E8A40F4134B53C6CCD38FAF879"><enum>(1)</enum><header>Acquisition workforce</header><text>The strategy required under subsection (a) shall also include a plan to address Department acquisition workforce accountability and talent management that identifies the acquisition workforce needs of each component performing acquisition functions and develops options for filling such needs with qualified individuals, including a cost-benefit analysis of contracting for acquisition assistance.</text>
 </paragraph><paragraph id="H6C1B654574D74885908D077D3B2ECCE3"><enum>(2)</enum><header>Additional matters covered</header><text>The acquisition workforce plan under this subsection shall address ways to—</text> <subparagraph id="H4C170AD4BFFE4677BA5D1858C0E701DE"><enum>(A)</enum><text>improve the recruitment, hiring, training, and retention of Department acquisition workforce personnel, including contracting officer’s representatives, in order to retain highly qualified individuals who have experience in the acquisition life cycle, complex procurements, and management of large programs;</text>
 </subparagraph><subparagraph id="H0E18D7F3E68B4671816D0AE5474A6FFB"><enum>(B)</enum><text>empower program managers to have the authority to manage their programs in an accountable and transparent manner as such managers work with the acquisition workforce;</text>
 </subparagraph><subparagraph id="H474186D323744727A5940C76FBCA6B87"><enum>(C)</enum><text>prevent duplication within Department acquisition workforce training and certification requirements through leveraging already-existing training within the Federal Government, academic community, or private industry;</text>
 </subparagraph><subparagraph id="H31BC0F3EF2CA4FAD90A19661889F360F"><enum>(D)</enum><text>achieve integration and consistency with Government-wide training and accreditation standards, acquisition training tools, and training facilities;</text>
 </subparagraph><subparagraph id="H23BAA3556B2049A680746F49091E5E95"><enum>(E)</enum><text>designate the acquisition positions that will be necessary to support the Department acquisition requirements, including in the fields of—</text>
 <clause id="HF1482FEBA7A44CC6BB83F778A59E6E82"><enum>(i)</enum><text>program management;</text> </clause><clause id="HA180B44274CC4ED8861CDB256DCFA38A"><enum>(ii)</enum><text>systems engineering;</text>
 </clause><clause id="HFBA3DD74A3E441F498F61E2B5F12441F"><enum>(iii)</enum><text>procurement, including contracting;</text> </clause><clause id="H3FEDB487D3644D5CB23F7E570B926921"><enum>(iv)</enum><text>test and evaluation;</text>
 </clause><clause id="H942593BFF24E441A9C21BFD65480452E"><enum>(v)</enum><text>life cycle logistics;</text> </clause><clause id="H2E73F2D8FE774EA59857C9736390FA76"><enum>(vi)</enum><text>cost estimating and program financial management; and</text>
 </clause><clause id="H0E65033DD3304B399F4A12AB330564D4"><enum>(vii)</enum><text>additional disciplines appropriate to Department mission needs;</text> </clause></subparagraph><subparagraph id="H3077A4F8A9A14E92813F95F4FB558912"><enum>(F)</enum><text>strengthen the performance of contracting officers’ representatives (as defined in subpart 1.602–2 and subpart 2.101 of the Federal Acquisition Regulation), including by—</text>
 <clause id="H162FE2FE8AF2474C81CB3FCD5BC965DA"><enum>(i)</enum><text>assessing the extent to which such representatives are certified and receive training that is appropriate;</text>
 </clause><clause id="H9963A9BBF64746E2B0635AB9CE218868"><enum>(ii)</enum><text>assessing what training is most effective with respect to the type and complexity of assignment; and</text>
 </clause><clause id="HA25436C0F29945DF99EAD0B64C2BC905"><enum>(iii)</enum><text>implementing actions to improve training based on such assessments; and</text> </clause></subparagraph><subparagraph id="H34720E877EF24DB8AF18E79A627F3DF2"><enum>(G)</enum><text>identify ways to increase training for relevant investigators and auditors of the Department to examine fraud in major acquisition programs, including identifying opportunities to leverage existing Government and private sector resources in coordination with the Inspector General of the Department.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA6CEF426B0C94B929C0CEBA829D67328"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 835 the following new item:</text>

					</subsection><subsection id="HFE876F34678B48598385740CFD650D1A"><enum>(c)</enum><header>Government Accountability Office review of multiyear acquisition strategy</header>
 <paragraph id="HA3D1BBE2632A4E589B39115E5A86DF2D"><enum>(1)</enum><header>Review</header><text display-inline="yes-display-inline">After submission of the first multiyear acquisition strategy in accordance with section 839 of the Homeland Security Act of 2002, as added by subsection (a), after the date of the enactment of this Act, the Comptroller General of the United States shall conduct a review of such plan within 180 days to analyze the viability of such plan’s effectiveness in the following:</text>
 <subparagraph id="H474213BF03D64B6AB10F3C127A153AF3"><enum>(A)</enum><text>Complying with the requirements of such section 839.</text> </subparagraph><subparagraph id="H977330B4E4C746A1920ECCB7160E0D9F"><enum>(B)</enum><text>Establishing clear connections between Department of Homeland Security objectives and acquisition priorities.</text>
 </subparagraph><subparagraph id="HAAEABF151F414CC687E5A540BEA4D77D"><enum>(C)</enum><text>Demonstrating that Department acquisition policy reflects program management best practices and standards.</text>
 </subparagraph><subparagraph id="HA2B90F7B40FC44DBBCA08B99173C1495"><enum>(D)</enum><text>Ensuring competition or the option of competition for major acquisition programs.</text> </subparagraph><subparagraph id="H2016D753996D4F808CCD78C5A18EAFCA"><enum>(E)</enum><text>Considering potential cost savings through using already-existing technologies when developing acquisition program requirements.</text>
 </subparagraph><subparagraph id="H54CFF84958A94EFBABA8EB75F1858296"><enum>(F)</enum><text>Preventing duplication within Department acquisition workforce training requirements through leveraging already-existing training within the Federal Government, academic community, or private industry.</text>
 </subparagraph><subparagraph id="HBCBC5885B0BD42339158EDF03F49A161"><enum>(G)</enum><text>Providing incentives for acquisition program managers to reduce acquisition and procurement costs through the use of best practices and disciplined program management.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H957848F59B1A44F3BE95D729CB0210FC"><enum>(2)</enum><header>Definitions</header><text>The terms <quote>acquisition</quote>, <quote>best practices</quote>, and <quote>major acquisition programs</quote> have the meaning given such terms in section 830 of the Homeland Security Act of 2002, as added by section 201.</text>
 </paragraph><paragraph id="HDA2F235DD0504237973D7E17749D8752"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the completion of the review required by subsection (a), the Comptroller General of the United States shall submit to the Committee on Homeland Security and the Committee on Appropriations of the House of Representatives and the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate a report on the review. Such report shall be submitted in unclassified form but may include a classified annex.</text>
						</paragraph></subsection></section><section id="H0204D49103FB4E9D9D6BF5693DDE886D"><enum>233.</enum><header>Acquisition reports</header>
 <subsection id="H12AD0A934DAE4CD7AC37F6833FF85014"><enum>(a)</enum><header>In general</header><text>Subtitle D of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/391">6 U.S.C. 391</external-xref> et seq.) is further amended by adding at the end the following new section:</text>

							<section id="H0572958EA36247EA9B9B024359B5169C"><enum>840.</enum><header>Acquisition reports</header>
								<subsection id="HC76945B75E4C46EF876BFDC6974F0BFD"><enum>(a)</enum><header>Comprehensive acquisition status report</header>
 <paragraph commented="no" id="H39690A669C4C48E5B7EA75E19D0C065D"><enum>(1)</enum><header>In general</header><text>At the same time as the President’s budget is submitted for a fiscal year under section 1105(a) of title 31, United States Code, the Under Secretary for Management shall submit to the congressional homeland security committees an annual comprehensive acquisition status report. The report shall include the following:</text>
 <subparagraph commented="no" id="HEB8BC139E61649F5A8C6E67C35546AD0"><enum>(A)</enum><text>The information required under the heading <quote>Office of the Under Secretary for Management</quote> under title I of division D of the Consolidated Appropriations Act, 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/74">Public Law 112–74</external-xref>) (as required under the Department of Homeland Security Appropriations Act, 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/113/6">Public Law 113–6</external-xref>)).</text>
 </subparagraph><subparagraph commented="no" id="H8183B6FA65AE4A1F81E650D537FFDAE4"><enum>(B)</enum><text>A listing of programs that have been canceled, modified, paused, or referred to the Under Secretary for Management or Deputy Secretary for additional oversight or action by the Board, Department Office of Inspector General, or the Comptroller General.</text>
 </subparagraph><subparagraph commented="no" id="H44472D07CA42455FA5F658B88D0B5766"><enum>(C)</enum><text>A listing of established Executive Steering Committees, which provide governance of a program or related set of programs and lower-tiered oversight, and support between acquisition decision events and component reviews, including the mission and membership for each.</text>
 </subparagraph></paragraph><paragraph id="H2B58D1FC072C49F2AA93F47E1D06174D"><enum>(2)</enum><header>Information for major acquisition programs</header><text>For each major acquisition program, the report shall include the following:</text> <subparagraph id="HB35FE64A70A049AEAC02047C96B64946"><enum>(A)</enum><text>A narrative description, including current gaps and shortfalls, the capabilities to be fielded, and the number of planned increments or units.</text>
 </subparagraph><subparagraph id="H84835C2C7A6346D5B61928842A578E62"><enum>(B)</enum><text>Acquisition Review Board (or other board designated to review the acquisition) status of each acquisition, including the current acquisition phase, the date of the last review, and a listing of the required documents that have been reviewed with the dates reviewed or approved.</text>
 </subparagraph><subparagraph id="HCBEA77F9D8E042ABBB05F88E8E79DDD7"><enum>(C)</enum><text>The most current, approved acquisition program baseline (including project schedules and events).</text> </subparagraph><subparagraph id="H767DB8A49CEC45069514502E43A68200"><enum>(D)</enum><text>A comparison of the original acquisition program baseline, the current acquisition program baseline, and the current estimate.</text>
 </subparagraph><subparagraph id="HEC21EF88C8AC4F9C90F602757F2220E9"><enum>(E)</enum><text>Whether or not an independent verification and validation has been implemented, with an explanation for the decision and a summary of any findings.</text>
 </subparagraph><subparagraph id="H03B4A3941F0245AFA108CE1C714A3F64"><enum>(F)</enum><text>A rating of cost risk, schedule risk, and technical risk associated with the program (including narrative descriptions and mitigation actions).</text>
 </subparagraph><subparagraph id="H729698153F4749E087207D5698009B01"><enum>(G)</enum><text>Contract status (including earned value management data as applicable).</text> </subparagraph><subparagraph id="HD05CEA227FC4425C926DA14BFD203E2B"><enum>(H)</enum><text>A life cycle cost of the acquisition, and time basis for the estimate.</text>
 </subparagraph></paragraph><paragraph id="H20AEA2CF12B04051B5C7A967014448D2"><enum>(3)</enum><header>Updates</header><text>The Under Secretary shall submit quarterly updates to such report not later than 45 days after the completion of each quarter.</text>
 </paragraph></subsection><subsection id="H7CD80F72DCDF4E2ABB856C99CB0337AB"><enum>(b)</enum><header>Quarterly program accountability report</header><text>The Under Secretary for Management shall prepare a quarterly program accountability report to meet the mandate of the Department to perform program health assessments and improve program execution and governance. The report shall be submitted to the congressional homeland security committees.</text>
 </subsection><subsection id="H5FAF886E070C491099ACD4AF53A45A00"><enum>(c)</enum><header>Congressional homeland security committees defined</header><text>In this section, the term <quote>congressional homeland security committees</quote> means—</text> <paragraph id="H5FD565A411CC498087367054A0444432"><enum>(1)</enum><text>the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text>
 </paragraph><paragraph id="HA3DC6B61D68F4A0595EFE1F0CB4FF648"><enum>(2)</enum><text>the Committee on Appropriations of the House of Representatives and the Committee on Appropriations of the Senate.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HE22DA378C66D47398B87BDAE2BAC7FC6"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is further amended by inserting after the item relating to section 839 the following new item:</text>
