			</subsection></section><title id="H2A7D65663A2F4A4C983AD7C85B3B0FF2"><enum>I</enum><header>Policyholder protections and information</header>
 <section display-inline="no-display-inline" id="HA572772852A54A20AC4D4193C3E23391"><enum>101.</enum><header>Annual limitation on premium increases</header><text display-inline="no-display-inline">Section 1308(e) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(e)</external-xref>) is amended—</text> <paragraph id="HE5F43C9A4CC743D2A009A635A2191A3F"><enum>(1)</enum><text>in paragraph (1), by striking <quote>18 percent</quote> and inserting <quote>15 percent</quote>; and</text>
 </paragraph><paragraph id="HDDC3488E5CDB45E9B8E9078752F12F19"><enum>(2)</enum><text>in paragraph (2), by striking <quote>5 percent</quote> and inserting <quote>8 percent</quote>.</text> </paragraph></section><section id="H2C044666B7C24415BF1C2945DEBA8A27" section-type="subsequent-section"><enum>102.</enum><header>Flood insurance affordability program</header><text display-inline="no-display-inline">Chapter I of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011</external-xref> et seq.) is amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H227506C1CC9A48CA9D99C45D22A733CE" style="OLC">
					<section id="H738681DC497844668B769AD8E6F22D7D"><enum>1326.</enum><header>Flood insurance affordability program</header>
 <subsection id="H09FC99D1F15D404AB84708407C8FAEA1"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Administrator shall carry out a program under this section to provide financial assistance, through State programs carried out by participating States, for eligible low-income households residing in eligible properties to purchase policies for flood insurance coverage made available under this title.</text>
 </subsection><subsection id="H4D66A64F7EED41EBAFA43D5D852F1C4B"><enum>(b)</enum><header>Participation</header><text>Participation in the program under this section shall be voluntary on the part of a State or consortium of States.</text>
 </subsection><subsection id="HE22DF45C653B4B738B6CDA57ECF49DEF"><enum>(c)</enum><header>State administration</header><text>Each participating State shall delegate to a State agency or nonprofit organization the responsibilities for administrating the State’s program under this section.</text>
						</subsection><subsection id="H73FE8AB9D6C14C75AC7F31B036FD3752"><enum>(d)</enum><header>Eligible households</header>
 <paragraph id="H9E4800245E784A63A7D931805B52A601"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">During any fiscal year, assistance under the program under this section may be provided only for a household that has an income, as determined for such fiscal year by the participating State in which such household resides, that is less than the income limitation established for such fiscal year for purposes of the State program by the participating State, except that—</text>
 <subparagraph id="H6930CD769F864E7FB4EDF660837AA96C"><enum>(A)</enum><text display-inline="yes-display-inline">assistance under the program under this section may not be provided for a household having a income that exceeds the greater of—</text>
 <clause id="HF96A02FF91B441C4A244691BAE4AC0CA"><enum>(i)</enum><text>the amount equal to 150 percent of the poverty level for such State; or</text> </clause><clause id="H44557FCA9C1A42519DA53CB6E8BD4861"><enum>(ii)</enum><text>the amount equal to 60 percent of the median income of households residing in such State; and</text>
 </clause></subparagraph><subparagraph id="H20CFA04A02A94133BEF8FA360D09D8B6"><enum>(B)</enum><text display-inline="yes-display-inline">a State may not exclude a household from eligibility in a fiscal year solely on the basis of household income if such income is less than 110 percent of the poverty level for the State in which such household resides.</text>
 </subparagraph></paragraph><paragraph id="HF68FD05C983C402799FA45A045E0E101"><enum>(2)</enum><header>State verification of income eligibility</header><text display-inline="yes-display-inline">In verifying income eligibility for purposes of paragraph (1), the participating State may apply procedures and policies consistent with procedures and policies used by the State agency administering programs under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.), under title XX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397">42 U.S.C. 1397</external-xref> et seq.), under subtitle B of title VI of the Omnibus Budget Reconciliation Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/9901">42 U.S.C. 9901</external-xref> et seq.; relating to community services block grant program), under any other provision of law that carries out programs which were administered under the Economic Opportunity Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2701">42 U.S.C. 2701</external-xref> et seq.) before August 13, 1981, or under other income assistance or service programs (as determined by the State).</text>
 </paragraph><paragraph id="HA996212655124083904E852EBD00FCDB"><enum>(3)</enum><header>Certification by State of eligibility households</header><text display-inline="yes-display-inline">For each fiscal year, each participating State shall certify to the Administrator compliance of households who are to be provided assistance under the State program during such fiscal year with the income requirements under paragraph (1).</text>
 </paragraph></subsection><subsection id="H56091CFCB098498EB436C45806DAFD7A"><enum>(e)</enum><header>Eligible properties</header><text display-inline="yes-display-inline">Assistance under the program under this section may be provided only for a residential property—</text> <paragraph id="HBA10C6F3A6D4446592558ADAC1872908"><enum>(1)</enum><text display-inline="yes-display-inline">that has 4 or fewer residences;</text>
 </paragraph><paragraph id="H9C2A30F3A03D4E4A84357B8AAC7B6AF5"><enum>(2)</enum><text>that is owned and occupied by an eligible household;</text> </paragraph><paragraph id="H6AA236A1D6214411BAEBA88E959A327C"><enum>(3)</enum><text>for which a base flood elevation is identified on a flood insurance rate map of the Administrator that is in effect;</text>
 </paragraph><paragraph id="HC1519C67A8894CC9850AD26F0059AF17"><enum>(4)</enum><text display-inline="yes-display-inline">for which such other information is available as the Administrator considers necessary to determine the flood risk associated with such property; and</text>
 </paragraph><paragraph id="H1F8ED94B188F43BAA0331B78C67F9058"><enum>(5)</enum><text>that is located in a community that is participating in the national flood insurance program.</text> </paragraph></subsection><subsection id="H75C5DC12DF454438AE51D75C38093791"><enum>(f)</enum><header>Types of assistance</header><text display-inline="yes-display-inline">Under the program under this section, a participating State shall elect to provide financial assistance for eligible households in one of the following forms:</text>
 <paragraph id="H2FFBFBFC005B40CA81EEB420E1A21373"><enum>(1)</enum><header>Limitation on rate increases</header><text>By establishing a limitation on the rate of increases in the amount of chargeable premiums paid by eligible households for flood insurance coverage made available under this title.</text>
 </paragraph><paragraph id="H56E96E1528474DC49150ABF99839582D"><enum>(2)</enum><header>Limitation on rates</header><text display-inline="yes-display-inline">By establishing a limitation on the amount of chargeable premiums paid by eligible households for flood insurance coverage made available under this title.</text>
 </paragraph></subsection><subsection id="HEE59DF8365664FE0886DE7F514495C12"><enum>(g)</enum><header>Notification to FEMA</header><text>Under the program under this section, a participating State shall, on a fiscal year basis and at the time and in the manner provided by the Administrator—</text>
 <paragraph id="H98C7B3BF65074D67BEBBE0E482832F4D"><enum>(1)</enum><text>identify for the Administrator the eligible households residing in the State who are to be provided assistance under the State program during such fiscal year; and</text>
 </paragraph><paragraph id="H6AC420DAF5AB4CE4BC03AA82670835D5"><enum>(2)</enum><text display-inline="yes-display-inline">notify the Administrator of the type and levels of assistance elected under subsection (f) to be provided under the State program with respect to such eligible households residing in the State.</text>
 </paragraph></subsection><subsection id="H1C31F38588CA4818B1448B028EB8FAB1"><enum>(h)</enum><header>Amount of assistance</header><text display-inline="yes-display-inline">Under the program under this section, in each fiscal year the Administrator shall, notwithstanding section 1308, make flood insurance coverage available for purchase by households identified as eligible households for such fiscal year by a participating State pursuant to subsection (e) at chargeable premium rates that are discounted by an amount that is based on the type and levels of assistance elected pursuant to subsection (f) by the participating State for such fiscal year.</text>
 </subsection><subsection id="HA626A2D300BA4588937076451C401D8D"><enum>(i)</enum><header>Billing statement</header><text>In the case of an eligible household for which assistance under the program under this section is provided with respect to a policy for flood insurance coverage, the annual billing statement for such policy shall include statements of the following amounts:</text>
 <paragraph id="H2A4762BA666B45CD80297A1899ED3AAF"><enum>(1)</enum><text>The estimated risk premium rate for the property under section 1307(a)(1).</text> </paragraph><paragraph id="HB315E943BCEF4111851FA392962FFE90"><enum>(2)</enum><text>If applicable, the estimated risk premium rate for the property under section 1307(a)(2).</text>
 </paragraph><paragraph id="H2FCC14D5960E47FABFC4DCC02AC240D3"><enum>(3)</enum><text>The chargeable risk premium rate for the property taking into consideration the discount pursuant to subsection (h).</text>
 </paragraph><paragraph id="HB89E89CDE7E64E9D809C9886062154DC"><enum>(4)</enum><text display-inline="yes-display-inline">The amount of the discount pursuant to subsection (h) for the property.</text> </paragraph><paragraph id="H6847B1AA303A451CB214780C30775C98"><enum>(5)</enum><text display-inline="yes-display-inline">The number and dollar value of claims filed for the property, over the life of the property, under a flood insurance policy made available under the Program and the effect, under this Act, of filing any further claims under a flood insurance policy with respect to that property.</text>
							</paragraph></subsection><subsection id="H7FC5AE52F3D94FCABFABD3A62B75A8B0"><enum>(j)</enum><header>Funding through State affordability surcharges</header>
 <paragraph id="HFB9519A07D3B47AF9C96D96AB3B054FB"><enum>(1)</enum><header>Imposition and collection</header><text display-inline="yes-display-inline">Notwithstanding section 1308, for each fiscal year in which flood insurance coverage under this title is made available for properties in a participating State at chargeable premium rates that are discounted pursuant to subsection (f), the Administrator shall impose and collect a State affordability surcharge on each policy for flood insurance coverage for a property located in such participating State that is (A) not a residential property having 4 or fewer residences, or (B) is such a residential property but is owned by a household that is not an eligible household for purposes of such fiscal year.</text>
 </paragraph><paragraph id="HFCDD570C5D504589803529401295EA16"><enum>(2)</enum><header>Amount</header><text>The amount of the State affordability surcharge imposed during a fiscal year on each such policy for a property in a participating State shall be—</text>
 <subparagraph id="H08C406283D264EBB93D7E8699E15919B"><enum>(A)</enum><text>sufficient such that the aggregate amount of all such State affordability surcharges imposed on properties in such participating State during such fiscal year is equal to the aggregate amount by which all policies for flood insurance coverage under this title sold during such fiscal year for properties owned by eligible households in the participating State are discounted pursuant to subsection (f); and</text>
 </subparagraph><subparagraph id="HDE2816CD2E35422A9AA6BA82C781696E"><enum>(B)</enum><text display-inline="yes-display-inline">the same amount for each property in the participating State being charged such a surplus.</text> </subparagraph></paragraph></subsection><subsection id="HD18BC624F92A4C118C4E79E6D61B609C"><enum>(k)</enum><header>Treatment of other surcharges</header><text display-inline="yes-display-inline">The provision of assistance under the program under this section with respect to any property and any limitation on premiums or premium increases pursuant to subsection (f) for the property shall not affect the applicability or amount of any surcharge under section 1308A for the property, of any increase in premiums charged for the property pursuant to section 1310A(c), or of any equivalency fee under section 1308B for the property.</text>
 </subsection><subsection id="H47AE007F758145608A776494BCCB4F34"><enum>(l)</enum><header>Definitions</header><text>For purposes of this section, the following definitions shall apply:</text> <paragraph id="H80B0E0D6ECA54504A2139AC295241D6A"><enum>(1)</enum><header>Participating State</header><text display-inline="yes-display-inline">The term <quote>participating State</quote> means, with respect to a fiscal year, a State that is participating in the program under this section for such fiscal year.</text>
 </paragraph><paragraph id="HE66FB5C7F59F4ED89C5D27B4404DF4A7"><enum>(2)</enum><header>Eligible household</header><text>The term <quote>eligible household</quote> means, with respect to a fiscal year and a participating State, a household that has an income that is less than the amount of the income limitation for the fiscal year established for purposes of the State program of such participating State pursuant to subsection (g)(1).</text>
 </paragraph><paragraph id="H6C1D813F460D48659BB908932F72646A"><enum>(3)</enum><header>Poverty level</header><text display-inline="yes-display-inline">The term <quote>poverty level</quote>’ means, with respect to a household in any State, the income poverty line as prescribed and revised at least annually pursuant to section 673(2) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>), as applicable to such State.</text>
 </paragraph><paragraph id="H873199DA79FB4D8AADE6987466DEB055"><enum>(4)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> shall include a consortium of States established for purposes of administrating the program under this section with respect to the member States of the consortium.</text>
 </paragraph><paragraph id="H27DC709D98BE4173820376FF9C3A2C24"><enum>(5)</enum><header>State program</header><text>The term <quote>State program</quote> means a program carried out in compliance with this section by a participating State in conjunction with the program under this section of the Administrator.</text>
 </paragraph></subsection><subsection id="HE6A7CE3141174CFD87D797E7829649F5"><enum>(m)</enum><header>Regulations</header><text>The Administrator shall issue such regulations as may be necessary to carry out the program under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H165FB8C4BD224CF7A62936A8651C6969"><enum>103.</enum><header>Disclosure of premium methodology</header><text display-inline="no-display-inline">Section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HFA3F8A4509D44DE793F8CCDA62C00557" style="OLC">
					<subsection id="H9BF437F5B4394B138D39517D8694213C"><enum>(n)</enum><header>Disclosure of premium methodology</header>
 <paragraph id="H25B97441EA194A1295989E40D40B3A48"><enum>(1)</enum><header>Disclosure</header><text display-inline="yes-display-inline">Six months prior to the effective date of risk premium rates, the Administrator shall cause to be published in the Federal Register an explanation of the bases for, and methodology used to determine, the chargeable premium rates to be effective for flood insurance coverage under this title.</text>
 </paragraph><paragraph id="H796D61B3C9C3422BAFFCD76BA833362A"><enum>(2)</enum><header>Alignment with industry practices</header><text display-inline="yes-display-inline">The disclosure required under paragraph (1) shall, to the extent practicable, be aligned with industry patterns and practices and shall include information and data recommended by the State insurance commissioners guidelines on rate filings.</text>
 </paragraph><paragraph id="H8CF9E15522FA4DBFAA983ADFCE1A9947"><enum>(3)</enum><header>Public meetings</header><text display-inline="yes-display-inline">The Administrator shall, on an annual basis, hold at least one public meeting in each of the geographical regions of the United States, as defined by the Administrator for purposes of the National Flood Insurance Program, for the purpose of explaining the methodology described in paragraph (1) and answering questions and receiving comments regarding such methodology. The Administrator shall provide notice of each such public meeting in advance, in such manner, and in using such means as are reasonably designed to notify interested parties and members of the public of the date and time, location, and purpose of such meeting, and of how to submit questions or comments.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="H6FFF6DE106424462B9D981E55780BF90" section-type="subsequent-section"><enum>104.</enum><header>Consideration of coastal and inland locations in premium rates</header>
 <subsection id="H61D96833B28F43A48F8E69FF0E2B60AD"><enum>(a)</enum><header>Estimates of premium rates</header><text display-inline="yes-display-inline">Subparagraph (A) of section 1307(a)(1) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(a)(1)(A)</external-xref>) is amended—</text>
 <paragraph id="H2A39E9C3B245432AB80082822353FE3F"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> at the end; and</text> </paragraph><paragraph id="H6FEA74379F0648E1BEF477A33801D716"><enum>(2)</enum><text>by adding at the end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="HAB6250625E694B618811DC7B8D03BE19" style="OLC">
 <clause id="H670CC0BD3CF94E6B9CCA6AE6F4321DE9"><enum>(iii)</enum><text display-inline="yes-display-inline">the differences in flood risk for properties located in coastal areas and properties located inland; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H3446F7ADD9514FFFB966A2504A863773"><enum>(b)</enum><header>Establishment of chargeable premium rates</header><text display-inline="yes-display-inline">Paragraph (1) of section 1308(b) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(b)(1)</external-xref>) is amended by inserting <quote>due to differences in flood risk for properties located in coastal areas and properties located inland and</quote> after <quote>including differences in risks</quote>.</text>
 </subsection><subsection id="H5049AFA4F3C042409A0C2E9C85724DC9"><enum>(c)</enum><header>Revised rates</header><text display-inline="yes-display-inline">Not later than the expiration of the two-year period beginning on the date of the enactment of this Act, the Administrator of the Federal Emergency Management Agency shall revise risk premium rates under the National Flood Insurance Program to implement the amendments made by this section.</text>
 </subsection></section><section id="H5E34F4434D9649B1B4EA6D1089736907"><enum>105.</enum><header>Monthly installment payment of premiums</header><text display-inline="no-display-inline">Subsection (g) of section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(g)</external-xref>) is amended—</text>
 <paragraph id="HEE60CE9EF7DC4017A181D5B2A04542FB"><enum>(1)</enum><text>by striking the subsection designation and all that follows through <quote>With respect</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HAB7661B423C0417F8E8E5B282151EC7D" style="OLC"> <subsection id="HBC3604456537467D8D6C3225EF6BF1A9"><enum>(g)</enum><header>Frequency of premium collection</header> <paragraph id="H2D5CE8E8C79E4776867D1CFBE0C02419"><enum>(1)</enum><header>Options</header><text display-inline="yes-display-inline">With respect</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H658EDFDBEE9B4A40A1E25406298CCAF8"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block id="H9E19810B836047B79E248CB87AA9256E"> <paragraph id="H94A3C713FBC34599B50ACAD2F2EDE34D"><enum>(2)</enum><header>Monthly installment payment of premiums</header> <subparagraph id="H9EF8F3DB91CA491AB78809931BFCDC09"><enum>(A)</enum><header>Exemption from rulemaking</header><text display-inline="yes-display-inline">Until such time as the Administrator promulgates regulations implementing paragraph (1) of this subsection, the Administrator may adopt policies and procedures, notwithstanding any other provisions of law and in alignment and consistent with existing industry escrow and servicing standards, necessary to implement such paragraph without undergoing notice and comment rulemaking and without conducting regulatory analyses otherwise required by statute, regulation, or Executive order.</text>
 </subparagraph><subparagraph id="H26B90857C10244B3B18350FDD64D7420"><enum>(B)</enum><header>Installment plan fee</header><text>The Administrator may charge policyholders choosing to pay premiums in monthly installments a fee not to exceed $50 annually.</text>
 </subparagraph><subparagraph id="HD7CCA37D59C84186B6E048FDF626FFC8"><enum>(C)</enum><header>Pilot program</header><text>The Administrator may initially implement paragraph (1) of this subsection as a pilot program that provides for a gradual phase-in of implementation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H640CEA59B48148779492D69D33CED300"><enum>106.</enum><header>Enhanced clear communication of flood risks</header>
 <subsection id="H3596F6858CDF4A6B8F560139B6B58660"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (l) of section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(l)</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HE9D9558A1B5C47028E26E8915B52E95C" style="OLC">
						<subsection id="HC342F2DCBCB84D979DCFC187D913BF12"><enum>(l)</enum><header>Clear communications</header>
 <paragraph id="HAB12179E062743A1AAAAC3AC8C5CC006"><enum>(1)</enum><header>Newly issued and renewed policies</header><text display-inline="yes-display-inline">For all policies for flood insurance coverage under the National Flood Insurance Program that are newly issued or renewed, the Administrator shall clearly communicate to policyholders—</text>
 <subparagraph id="H3ABDD071E4124E63AC98751A38FD5EE5"><enum>(A)</enum><text>their full flood risk determinations, regardless of whether their premium rates are full actuarial rates; and</text>
 </subparagraph><subparagraph id="H62594C6BD4A94026A4BB74E6CC4445F7"><enum>(B)</enum><text>the number and dollar value of claims filed for the property, over the life of the property, under a flood insurance policy made available under the Program and the effect, under this Act, of filing any further claims under a flood insurance policy with respect to that property.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H66DB5EEE9F70441F8E9A1BAC5CCC7A81"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">Subsection (l) of section 1308 of the National Flood Insurance Act of 1968, as added by subsection (a) of this section, shall take effect beginning upon the expiration of the 12-month period that begins on the date of the enactment of this Act. Such subsection (l), as in effect immediately before the amendment made by paragraph (1), shall apply during such 12-month period.</text>
 </subsection></section><section id="HE69EFBA66F0C4474BEFBC9708BAC54E7"><enum>107.</enum><header>Availability of flood insurance information upon request</header><text display-inline="no-display-inline">Section 1313 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4020">42 U.S.C. 4020</external-xref>) is amended—</text> <paragraph id="HDF822F25642447AAA0307FB757A0DC4F"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">Public information and data</header-in-text>.—</quote> after <quote><header-in-text level="subsection" style="traditional">Sec.</header-in-text> 1313.</quote>; and</text>
 </paragraph><paragraph id="H31A6EFFE596D46D885DDF49F8886D17B"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H2E72DCDB8B8E45DD85714D094F83EC2F" style="OLC"> <subsection id="H2458E912680C467EB52203F31F7B70FB"><enum>(b)</enum><header>Availability of flood insurance information upon request</header><text>Not later than 30 days after a request for such information by the current owner of a property, the Administrator shall provide to the owner any information, including historical information, available to the Administrator on flood insurance program coverage, payment of claims, and flood damages for the property at issue, and any information the Administrator has on whether the property owner may be required to purchase coverage under the National Flood Insurance Program due to previous receipt of Federal disaster assistance, including assistance provided by the Small Business Administration, the Department of Housing and Urban Development, or the Federal Emergency Management Agency, or any other type of assistance that subjects the property to the mandatory purchase requirement under section 102 of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H5A86363BAD49483AA4C5B936452C109D"><enum>II</enum><header>Increasing consumer choice through private market development</header>
 <section id="HAA3E1FFAA9A742C09F657713EAF17477"><enum>201.</enum><header>Elimination of non-compete requirement</header><text display-inline="no-display-inline">Section 1345 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4081">42 U.S.C. 4081</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HC6E0583617FE4669A2EF1150DEE5CBDE" style="OLC">
					<subsection id="H635A1E74BFCC47F68DD72A307C7FF304"><enum>(f)</enum><header>Authority To provide other flood coverage</header>
 <paragraph id="HB8FEAE91D5614456B518C21F287A33CD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may not, as a condition of participating in the Write Your Own Program (as such term is defined in section 1370(a)) or in otherwise participating in the utilization by the Administrator of the facilities and services of insurance companies, insurers, insurance agents and brokers, and insurance adjustment organizations pursuant to the authority in this section, nor as a condition of eligibility to engage in any other activities under the National Flood Insurance Program under this title, restrict any such company, insurer, agent, broker, or organization from offering and selling private flood insurance (as such term is defined in section 102(b)(9) of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a(b)(9)</external-xref>)).</text>
 </paragraph><paragraph id="HA7093F0016AD42A7AB0278D5380607AF"><enum>(2)</enum><header>Financial assistance/subsidy arrangement</header><text>After the date of the enactment of this subsection—</text> <subparagraph id="H09C864AE406D4145B8D47CE8361A5E8C"><enum>(A)</enum><text>the Administrator may not include in any agreement entered into with any insurer for participation in the Write Your Own Program any provision establishing a condition prohibited by paragraph (1), including the provisions of Article XIII of the Federal Emergency Management Agency, Federal Insurance Administration, Financial Assistance/Subsidy Arrangement, as adopted pursuant to section 62.23(a) of title 44 of the Code of Federal Regulations; and</text>
 </subparagraph><subparagraph id="H3E3F0B2917174AF8BF336D9048FF8387"><enum>(B)</enum><text>any such provision in any such agreement entered into before such date of enactment shall not have any force or effect, and the Administrator may not take any action to enforce such provision.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H1533902E433E4890BB4471EF608F4E56"><enum>202.</enum><header>Public availability of program information</header><text display-inline="no-display-inline">Part C of chapter II of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4081">42 U.S.C. 4081</external-xref> et seq.) is amended by adding at the end the following new section:</text>
				<quoted-block id="H68FA2D965E994056A0864DB70310D2D1">
					<section display-inline="no-display-inline" id="H97716E5D61574CCB9DBA570D9D460046"><enum>1349.</enum><header>Public availability of program information</header>
						<subsection id="HCA01F0CA4BB141BFB015B53999056848"><enum>(a)</enum><header>Flood risk information</header>
 <paragraph id="HB729F0C802FC435E9CC6C75740084337"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), to facilitate the National Flood Insurance Program becoming a source of information and data for research and development of technology that better understands flooding, the risk of flooding, and the predictability of perils of flooding, the Administrator shall make publicly available all data, models, assessments, analytical tools, and other information in the possession of the Administrator relating to the National Flood Insurance Program under this title that is used in assessing flood risk or identifying and establishing flood elevations and premiums, including—</text>
 <subparagraph id="H49022C4F3D1C47F5AC7C834CB81FDCDE"><enum>(A)</enum><text display-inline="yes-display-inline">data relating to risk on individual properties and loss ratio information and other information identifying losses under the program;</text>
 </subparagraph><subparagraph id="HF38D6DC7E8234A8FA160A508F495E4CB"><enum>(B)</enum><text>current and historical policy information, limited to the amount and term only, for properties currently covered by flood insurance and for properties that are no longer covered by flood insurance;</text>
 </subparagraph><subparagraph id="HF3EC4620A4E34974A0C7771BA2C7FF86"><enum>(C)</enum><text>current and historical claims information, limited to the date and amount paid only, for properties currently covered by flood insurance and for properties that are no longer covered by flood insurance;</text>
 </subparagraph><subparagraph id="H5130C63F308544D2AB2CA76C170A26B0"><enum>(D)</enum><text>identification of whether a property was constructed before or after the effective date of the first flood insurance rate map for a community;</text>
 </subparagraph><subparagraph id="HDA0E9870F2434093B50EE706DFD782F0"><enum>(E)</enum><text>identification of properties that have been mitigated through elevation, a buyout, or any other mitigation action; and</text>
 </subparagraph><subparagraph id="H4471B2ABCEB145AF84D371D3E8A41EB9"><enum>(F)</enum><text>identification of unmitigated multiple-loss properties.</text> </subparagraph></paragraph><paragraph id="H0BC265D5A6AC4D66AEB20D9B90570E27"><enum>(2)</enum><header>Open source data system</header><text>In carrying out paragraph (1), the Administrator shall establish an open source data system by which all information required to be made publicly available by such subsection may be accessed by the public on an immediate basis by electronic means.</text>
 </paragraph></subsection><subsection id="HCECD3C1CBA0A42B4BBE7C2CBF0E9C818"><enum>(b)</enum><header>Community information</header><text display-inline="yes-display-inline">Not later than the expiration of the 12-month period beginning upon the date of the enactment of this section, the Administrator shall establish and maintain a publicly searchable database that provides information about each community participating in the National Flood Insurance Program, which shall include the following information:</text>
 <paragraph id="H69FA582A81354CD48D1DBCCA7D09055E"><enum>(1)</enum><text>The status of the community’s compliance with the National Flood Insurance Program, including any findings of noncompliance, the status of any enforcement actions initiated by a State or by the Administrator, and the number of days of any such continuing noncompliance.</text>
 </paragraph><paragraph id="H075F665C27594A8D9934859A5FCDCC78"><enum>(2)</enum><text>The number of properties located in the community’s special flood hazard areas that were built before the effective date of the first flood insurance rate map for the community.</text>
 </paragraph><paragraph id="HD707A7D14C0747819EC95ADB5DC4A6B9"><enum>(3)</enum><text>The number of properties located in the community’s special flood hazard areas that were built after the effective date of the first flood insurance rate map for the community.</text>
 </paragraph><paragraph id="H3240196742E940D6AE187F21E433B4D3"><enum>(4)</enum><text>The total number of current and historical claims located outside the community’s special flood hazard areas.</text>
 </paragraph><paragraph id="H81FD32624F2D4B79B40D05F39317BF5A"><enum>(5)</enum><text>The total number of multiple-loss properties in the community.</text> </paragraph><paragraph id="H35B78C1FD5B245B284BA04E2CEB434AA"><enum>(6)</enum><text>The portion of the community, stated as a percentage and in terms of square miles, that is located within special flood hazard areas.</text>
 </paragraph></subsection><subsection id="H32736983FFEE4528BE2D3B35212F6159"><enum>(c)</enum><header>Identification of properties</header><text>The information provided pursuant to subsections (a) and (b) shall be based on data that identifies properties at the zip code or census block level, and shall include the name of the community and State in which a property is located.</text>
 </subsection><subsection id="H77490A0F40AD4E83B4E4A50062682D50"><enum>(d)</enum><header>Protection of personally identifiable information</header><text>The information provided pursuant to subsections (a) and (b) shall be disclosed in a format that does not reveal individually identifiable information about property owners in accordance with the section 552a of title 5, United States Code.</text>
 </subsection><subsection id="H72E1EF61D80B4BE29A082EE6E0728F85"><enum>(e)</enum><header>Definition of loss ratio</header><text>For purposes of this section, the term <quote>loss ratio</quote> means, with respect to the National Flood Insurance Program, the ratio of the amount of claims paid under the Program to the amount of premiums paid under the Program.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H5BD78776178A4A7FA8698CE76F335FB9"><enum>203.</enum><header>Refund of premiums upon cancellation of policy because of replacement with private flood insurance</header><text display-inline="no-display-inline">Section 1306 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4013">42 U.S.C. 4013</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H93376BD1D51D4C9A8F5B539CD7902BDD" style="OLC">
					<subsection id="HE249383DD6204735A902D5309E14A8E7"><enum>(e)</enum><header>Refund of unearned premiums for policies canceled because of replacement with private flood
			 insurance</header>
 <paragraph id="H910F9686F4214E3D8B2927B3A93DABE3"><enum>(1)</enum><header>Required refund</header><text display-inline="yes-display-inline">Subject to subsection (c), if at any time an insured under a policy for flood insurance coverage for a property that is made available under this title cancels such policy because other duplicate flood insurance coverage for the same property has been obtained from a source other than the National Flood Insurance Program under this title, the Administrator shall refund to the former insured a portion of the premiums paid for the coverage made available under this title, as determined consistent with industry practice according to the portion of the term of the policy that such coverage was in effect, but only if a copy of declarations page of the new policy obtained from a source other than the program under this title is provided to the Administrator.</text>
 </paragraph><paragraph id="H029C3FD6D89B44B88A48EAA20E838269"><enum>(2)</enum><header>Effective date of cancellation</header><text display-inline="yes-display-inline">For purposes of this subsection, a cancellation of a policy for coverage made available under the national flood insurance program under this title, for the reason specified in paragraph (1), shall be effective—</text>
 <subparagraph id="H39391592F2F74D11A0067C58646ACD29"><enum>(A)</enum><text display-inline="yes-display-inline">on the effective date of the new policy obtained from a source other than the program under this title, if the request for such cancellation was received by the Administrator before the expiration of the 6-month period beginning on the effective date of the new policy; or</text>
 </subparagraph><subparagraph id="HF445A82657D4400C85A3F72115A77F5E"><enum>(B)</enum><text display-inline="yes-display-inline">on the date of the receipt by the Administrator of the request for cancellation, if the request for such cancellation was received by the Administrator after the expiration of the 6-month period beginning on the effective date of the new policy.</text>
 </subparagraph></paragraph><paragraph id="H48E82898C18D4D818DFDF18F43D6DB3E"><enum>(3)</enum><header>Prohibition of refunds for properties receiving increased cost of compliance claims</header><text display-inline="yes-display-inline">No premium amounts paid for coverage made available under this title may be refunded pursuant to this subsection—</text>
 <subparagraph id="H8675D9C51CDB4CE2A81F8F4BBBD39A53"><enum>(A)</enum><text>with respect to coverage for any property for which measures have been implemented using amounts received pursuant to a claim under increased cost of compliance coverage made available pursuant to section 1304(b); or</text>
 </subparagraph><subparagraph id="HAED13B811C9C443CB9D28327E6AD9F3C"><enum>(B)</enum><text display-inline="yes-display-inline">if a claim has been paid or is pending under the policy term for which the refund is sought.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H1346CC30D873473F9CBE21821EB79146" section-type="subsequent-section"><enum>204.</enum><header>GAO study of flood damage savings accounts</header> <subsection id="H7FA27881B75F42ACA91C56F14604E30E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study to analyze the feasibility and effectiveness, and problems involved, in reducing flood insurance premiums and eliminating the need for purchase of flood insurance coverage by authorizing owners of residential properties to establish flood damage savings accounts described in subsection (b) in lieu of complying with the mandatory requirements under section 102 of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a</external-xref>) to purchase flood insurance for such properties.</text>
 </subsection><subsection id="H06EFC1A352ED43BD8B0978E1665A5102"><enum>(b)</enum><header>Flood damage savings account</header><text>A flood damage savings account described in this subsection is a savings account—</text> <paragraph id="H481AFCE284194C2DBBC433EE7B78A9B7"><enum>(1)</enum><text display-inline="yes-display-inline">that would be established by an owner of residential property with respect to such property in accordance with requirements established by the Administrator of the Federal Emergency Management Agency; and</text>
 </paragraph><paragraph id="H05EB5280BC3143EFB604F0F6142EE2B7"><enum>(2)</enum><text display-inline="yes-display-inline">the proceeds of which would be available for use only to cover losses to such properties resulting from flooding, pursuant to adjustment of a claim for such losses in the same manner and according to the same procedures as apply to claims for losses under flood insurance coverage made available under the National Flood Insurance Act of 1968.</text>
 </paragraph></subsection><subsection id="H6DB36F2433424ECCB145A09B6ADD986E"><enum>(c)</enum><header>Issues</header><text>Such study shall include an analysis of, and recommendation regarding, each of the following issues:</text>
 <paragraph id="HC6308C7BDCD14FAD86D06229C7C566EF"><enum>(1)</enum><text display-inline="yes-display-inline">Whether authorizing the establishment of such flood damage savings accounts would be effective and efficient in reducing flood insurance premiums, eliminating the need for purchase of flood insurance coverage made available under the National Flood Insurance Program, and reducing risks to the financial safety and soundness of the National Flood Insurance Fund.</text>
 </paragraph><paragraph id="H5D8ACCA7FCB84B8D84351C9B44877D85"><enum>(2)</enum><text>Possible options for structuring such flood damage savings accounts, including—</text> <subparagraph id="HA8D134B72D7B45268C4B0017B02864C9"><enum>(A)</enum><text>what types of institutions could hold such accounts and the benefits and problems with each such type of institution;</text>
 </subparagraph><subparagraph id="H41CB5BDC478545EBBE3DE304E5773995"><enum>(B)</enum><text>considerations affecting the amounts required to be held in such accounts; and</text> </subparagraph><subparagraph id="H6CC8E128661A47BB80EECF65022D9133"><enum>(C)</enum><text>options regarding considerations the conditions under which such an account may be terminated.</text>
 </subparagraph></paragraph><paragraph id="HFAE566976D24487796C41AC3FF21401E"><enum>(3)</enum><text>The feasibility and effectiveness, and problems involved in, authorizing the Administrator of the Federal Emergency Management Agency to make secondary flood insurance coverage available under the National Flood Insurance Program to cover the portion of flood losses or damages to properties for which such flood damage savings accounts have been established that exceed the amounts held in such accounts.</text>
 </paragraph><paragraph id="HF53772D9144746908E8261B97C4962FC"><enum>(4)</enum><text>The benefits and problems involved in authorizing the establishment of such accounts for non-residential properties.</text>
 </paragraph></subsection><subsection id="H6958606BB6FD44E8B8631C220B22903A"><enum>(d)</enum><header>Report</header><text>Not later than the expiration of the 12-month period beginning on the date of the enactment of this Act, the Comptroller General shall submit a report to the Committee on Financial Services of the House of Representatives, the Committee on Banking, Housing, and Urban Affairs of the Senate, and the Administrator that sets forth the analysis, conclusions, and recommendations resulting from the study under this section. Such report shall identify elements that should be taken into consideration by the Administrator in designing and carrying out the demonstration program under section 205.</text>
				</subsection></section><section display-inline="no-display-inline" id="HEFEDB1D418894FD28789E1492A9624B6" section-type="subsequent-section"><enum>205.</enum><header>Demonstration program for flood damage savings accounts</header>
 <subsection id="HFE4ACFE856A34165A2198186EC8CD77C"><enum>(a)</enum><header>Plan</header><text display-inline="yes-display-inline">If the Comptroller General of the United States concludes in the report required under section 204 that a demonstration program under this section is feasible and should be considered, then the Administrator of the Federal Emergency Management Agency shall, not later than the expiration of the 12-month period beginning upon the submission of the report under section 204(d), submit to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate a plan and guidelines for a demonstration program, to be carried out by the Administrator, to demonstrate the feasibility and effectiveness of authorizing the establishment of flood damage savings accounts, taking into consideration the analysis, conclusions, and recommendations included in such report.</text>
 </subsection><subsection id="HD1C6AD4DF2C742BC8869A8DF334B8D80"><enum>(b)</enum><header>Authority</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency shall carry out a program to demonstrate the feasibility and effectiveness of authorizing the establishment of flood damage savings accounts in the manner provided in plan and guidelines for the demonstration program submitted pursuant to subsection (a).</text>
 </subsection><subsection id="H85DABFFF4B774BCC9FC728E8673384E1"><enum>(c)</enum><header>Scope</header><text display-inline="yes-display-inline">The demonstration program under this section shall provide for the establishment of flood damage savings accounts with respect to not more than 5 percent of the residential properties that have 4 or fewer residences and that are covered by flood insurance coverage made available under the National Flood Insurance Program.</text>
 </subsection><subsection id="HECEB2A70557E403BAA57AB7CB6ACA9A9"><enum>(d)</enum><header>Timing</header><text>The Administrator shall commence the demonstration program under this section not later than the expiration of the 12-month period beginning upon the submission of the plan and guidelines for the demonstration pursuant to subsection (a).</text>
 </subsection><subsection id="HE9AC28E9DBC64868AD8AAF8880F72685"><enum>(e)</enum><header>Geographical diversity</header><text>The Administrator shall ensure that properties for which flood damage savings accounts are established under the demonstration are located in diverse geographical areas throughout the United States.</text>
 </subsection><subsection id="HF3727923AD384725870BAB238640F383"><enum>(f)</enum><header>Report</header><text display-inline="yes-display-inline">Upon the expiration of the 2-year period beginning upon the date of the commencement of the demonstration program under this section, the Administrator shall submit a report to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate describing and assessing the demonstration, and setting forth conclusions and recommendations regarding continuing and expanding the demonstration.</text>
 </subsection><subsection id="HB1D38B8CDE2B4FC7B61B89BEF87A4B76"><enum>(g)</enum><header>Feasibility</header><text display-inline="yes-display-inline">The Administrator shall implement this section only after determining that implementation is supported by the Comptroller’s conclusions and recommendations contained in the report required under section 204.</text>
				</subsection></section></title><title id="H407AF26CCF734CFBB1616DBB882C9714"><enum>III</enum><header>Mapping fairness</header>
			<section display-inline="no-display-inline" id="H74F8B7CBEC154362B50937783D1D8990" section-type="subsequent-section"><enum>301.</enum><header>Use of other risk assessment tools in determining premium rates</header>
 <subsection id="H23082B14FD504EFB853756C415B48486"><enum>(a)</enum><header>Estimates of premium rates</header><text display-inline="yes-display-inline">Subparagraph (A) of section 1307(a)(1) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(a)(1)(A)</external-xref>) is amended—</text>
 <paragraph id="HD2A5891CE2DB4A47A8DE83F8B993F903"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> at the end; and</text> </paragraph><paragraph id="H8888E39DD5094E1B9539F4FA734F7D7F"><enum>(2)</enum><text>by adding at the end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="H6ED252BA45174A609E16F2DEBD4D50E4" style="OLC">
 <clause id="H929038DE685C46BF86860F8742F1AA8D"><enum>(iii)</enum><text display-inline="yes-display-inline">both the risk identified by the applicable flood insurance rate maps and by other risk assessment data and tools, including risk assessment models and scores from appropriate sources; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H603462964447454FA5E7D3368C01C19A"><enum>(b)</enum><header>Establishment of chargeable premium rates</header><text display-inline="yes-display-inline">Paragraph (1) of section 1308(b) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(b)(1)</external-xref>) is amended by inserting before <quote>; and</quote> the following: <quote>, taking into account both the risk identified by the applicable flood insurance rate maps and by other risk assessment data and tools, including risk assessment models and scores from appropriate sources</quote>.</text>
				</subsection><subsection id="HE4D5E53A17E94D518CFCE84716AA30BB"><enum>(c)</enum><header>Effective date and regulations</header>
 <paragraph id="H2837A229841E4390BEDC27B50EA5F66B"><enum>(1)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsections (a) and (b) shall be made, and shall take effect, upon the expiration of the 36-month period beginning on the date of the enactment of this Act.</text>
 </paragraph><paragraph id="HC992D38C0C3E43758DC7FC7A79989568"><enum>(2)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency shall issue regulations necessary to implement the amendments made by subsections (a) and (b), which shall identify risk assessment data and tools to be used in identifying flood risk and appropriate sources for risk assessment models and scores to be so used. Such regulations shall be issued not later than the expiration of the 36-month period beginning on the date of the enactment of this Act and shall take effect upon the expiration of such period.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="HA853844C017643718D4E392B346CA1D3" section-type="subsequent-section"><enum>302.</enum><header>Appeals regarding existing flood maps</header>
 <subsection id="H4FE0805D0BC342BBB7F4A5C658438152"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1360 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101">42 U.S.C. 4101</external-xref>) is amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H57315530980D4CD9AD80D7BC1CB5F585" style="OLC">
						<subsection id="H9B6052110C68499B96AE053D3ED17F5A"><enum>(k)</enum><header>Appeals of existing maps</header>
 <paragraph id="H8EB94C6572A0420B8DAADA2C37BEDD5C"><enum>(1)</enum><header>Right to appeal</header><text display-inline="yes-display-inline">Subject to paragraph (6), a State or local government, or the owner or lessee of real property, who has made a formal request to the Administrator to update a flood map that the Administrator has denied may at any time appeal such a denial as provided in this subsection.</text>
 </paragraph><paragraph id="H2F0F45DE45F24649893B641D45EBCC95"><enum>(2)</enum><header>Basis for appeal</header><text>The basis for appeal under this subsection shall be the possession of knowledge or information that—</text>
 <subparagraph id="H904D4748B2D0419FA7076ED9388209BE"><enum>(A)</enum><text>the base flood elevation level or designation of any aspect of a flood map is scientifically or technically inaccurate; or</text>
 </subparagraph><subparagraph id="HBA5CC39D51884029894D95EF91F75F7E"><enum>(B)</enum><text>factors exist that mitigate the risk of flooding, including ditches, banks, walls, vegetation, levees, lakes, dams, reservoirs, basin, retention ponds, and other natural or manmade topographical features.</text>
								</subparagraph></paragraph><paragraph id="H536AD7FB495A4F25966EB600D07309F1"><enum>(3)</enum><header>Appeals process</header>
 <subparagraph id="H1DB00C7BC7054E3387876F29941929BB"><enum>(A)</enum><header>Administrative adjudication</header><text display-inline="yes-display-inline">An appeal under this subsection shall be determined by a final adjudication on the record, and after opportunity for an administrative hearing.</text>
 </subparagraph><subparagraph id="H674B0F51DC20481987E9D25E59F28907"><enum>(B)</enum><header>Rights upon adverse decision</header><text>If an appeal pursuant to subparagraph (A) does not result in a decision in favor of the State, local government, owner, or lessee, such party may appeal the adverse decision to the Scientific Resolution Panel provided for in section 1363A, which shall recommend a non-binding decision to the Administrator.</text>
								</subparagraph></paragraph><paragraph id="H0738273E738F4D3E8ADF02688A15EF88"><enum>(4)</enum><header>Relief</header>
 <subparagraph id="HA50C1AA734684AC4B8E77E5EA9449A1B"><enum>(A)</enum><header>Wholly successful appeals</header><text display-inline="yes-display-inline">In the case of a successful appeal resulting in a policyholder’s property being removed from a special flood hazard area, such policyholder may cancel the policy at any time within the current policy year, and the Administrator shall provide such policyholder a refund in the amount of any premiums paid for such policy year, plus any premiums paid for flood insurance coverage that the policyholder was required to purchase or maintain during the 2-year period preceding such policy year.</text>
 </subparagraph><subparagraph id="H1E84EE5A054340A9975DDFC662636918"><enum>(B)</enum><header>Partially successful appeals</header><text>In the case of any appeal in which mitigating factors were determined to have reduced, but not eliminated, the risk of flooding, the Administrator shall reduce the amount of flood insurance coverage required to be maintained for the property concerned by the ratio of the successful portion of the appeal as compared to the entire appeal. The Administrator shall refund to the policyholder any payments made in excess of the amount necessary for such new coverage amount, effective from the time when the mitigating factor was created or the beginning of the second policy year preceding the determination of the appeal, whichever occurred later.</text>
 </subparagraph><subparagraph id="H3BA8BDF32EB44680AD947A7CAB3B13D4"><enum>(C)</enum><header>Additional relief</header><text display-inline="yes-display-inline">The Administrator may provide additional refunds in excess of the amounts specified in subparagraphs (A) and (B) if the Administrator determines that such additional amounts are warranted.</text>
 </subparagraph></paragraph><paragraph id="H8778393436C04D828C378C78886C553A"><enum>(5)</enum><header>Recovery of costs</header><text display-inline="yes-display-inline">When, incident to any appeal which is successful in whole or part regarding the designation of the base flood elevation or any aspect of the flood map, including elevation or designation of a special flood hazard area, the community, or the owner or lessee of real property, as the case may be, incurs expense in connection with the appeal, including services provided by surveyors, engineers, and scientific experts, the Administrator shall reimburse such individual or community for reasonable expenses to an extent measured by the ratio of the successful portion of the appeal as compared to the entire appeal, but not including legal services, in the effecting of an appeal based on a scientific or technical error on the part of the Federal Emergency Management Agency. No reimbursement shall be made by the Administrator in respect to any fee or expense payment, the payment of which was agreed to be contingent upon the result of the appeal. The Administrator may use such amounts from the National Flood Insurance Fund established under section 1310 as may be necessary to carry out this paragraph.</text>
 </paragraph><paragraph id="HE087C1B85EE94D7791315DC9005EF82D"><enum>(6)</enum><header>Inapplicability to community flood maps</header><text>This subsection shall not apply with respect to any flood map that is in effect pursuant to certification under the standards, guidelines, and procedures established pursuant to section 100215(m)(1)(B) of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101a">42 U.S.C. 4101a(m)(1)(B)</external-xref>).</text>
 </paragraph><paragraph id="H1A8DDE55AFBA4CC6B275F2DE33913EDF"><enum>(7)</enum><header>Guidance</header><text display-inline="yes-display-inline">The Administrator shall issue guidance to implement this subsection, which shall not be subject to the notice and comment requirements under section 553 of title 5, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H8F2C7D89FDFA4469BF6B5CE76F0906FD"><enum>(b)</enum><header>Deadline</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency shall issue the guidance referred to section 1360(k)(7) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101">42 U.S.C. 4101(k)(7)</external-xref>), as added by the amendment made by subsection (a) of this section, not later than the expiration of the 6-month period beginning on the date of the enactment of this Act.</text>
				</subsection></section><section id="H25EB2E5755614AA9B3672EBFDB4B0CAE"><enum>303.</enum><header>Appeals and publication of projected special flood hazard areas</header>
 <subsection id="H4F8AAF24611240EFBB1729759C370EF2"><enum>(a)</enum><header>Appeals</header><text display-inline="yes-display-inline">Section 1363 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4104">42 U.S.C. 4104</external-xref>) is amended—</text> <paragraph id="H92636F3E5D56440A9CFC0DA1F8E71F25"><enum>(1)</enum><text>in subsection (b), by striking the second sentence and inserting the following: <quote>Any owner or lessee of real property within the community who believes the owner’s or lessee’s rights to be adversely affected by the Administrator’s proposed determination may appeal such determination to the local government no later than 90 days after the date of the second publication.</quote>;</text>
 </paragraph><paragraph id="HB76C877969B94688847A122482C3B974"><enum>(2)</enum><text>in subsection (d), by striking <quote>subsection (e)</quote> and inserting <quote>subsection (f)</quote>;</text> </paragraph><paragraph id="H06719EA213AC4D938EFDE14B60366E54"><enum>(3)</enum><text>by redesignating subsections (e), (f), and (g) as subsections (f), (g), and (h), respectively; and</text>
 </paragraph><paragraph id="H1713F5F323DA48AB9C06E6E19E8B3601"><enum>(4)</enum><text>by inserting after subsection (d) the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H0E1D527109DD4F2F8B89BBC93A6763D9" style="OLC"> <subsection id="H486352650EF94BE98A0B3FAB849B9314"><enum>(e)</enum><header>Determination by Administrator in the absence of appeals</header><text display-inline="yes-display-inline">If the Administrator has not received any appeals, upon expiration of the 90-day appeal period established under subsection (b) of this section the Administrator’s proposed determination shall become final. The community shall be given a reasonable time after the Administrator’s final determination in which to adopt local land use and control measures consistent with the Administrator’s determination.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H21E1B23C419B4608A9F98FDB203F1601"><enum>(b)</enum><header>Publication</header><text display-inline="yes-display-inline">Subsection (a) of section 1363 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4104">42 U.S.C. 4104(a)</external-xref>) is amended by striking <quote>in the Federal Register</quote>.</text>
 </subsection><subsection id="H4A229C17B7934BBF920704DBF2A6178D"><enum>(c)</enum><header>Inapplicability to private and community flood maps</header><text display-inline="yes-display-inline">Section 1363 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4104">42 U.S.C. 4104</external-xref>), as amended by the preceding provisions of this section, is further amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H57C164774C5748A7ADCEEF4027061BA5" style="OLC">
 <subsection id="H662FCE41DDCA4C5EB20F30FC2BB40641"><enum>(i)</enum><header>Inapplicability to community flood maps</header><text display-inline="yes-display-inline">This section shall not apply with respect to any flood map that is in effect pursuant to certification under the standards, guidelines, and procedures established pursuant to section 100215(m)(1) of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101a">42 U.S.C. 4101a(m)(1)</external-xref>), which shall include procedures for providing notification and appeal rights to individuals within the communities of the proposed flood elevation determinations.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="H61977B2F733F4FCB97CCF222BD09D470"><enum>304.</enum><header>Communication and outreach regarding map changes</header><text display-inline="no-display-inline">Paragraph (1) of section 100216(d) of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101b">42 U.S.C. 4101b(d)(1)</external-xref>) is amended—</text>
 <paragraph id="HCED21B35ADBA44E9BF966786B504E525"><enum>(1)</enum><text>in subparagraph (B), by inserting <quote>maximum</quote> before <quote>30-day period</quote>; and</text> </paragraph><paragraph id="H8D67676AB12844AF83B63B02794A339A"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C), by inserting <quote>maximum</quote> before <quote>30-day period</quote>.</text>
				</paragraph></section></title><title id="HA1CA6CF3BB8D4541A6DED663CC47B7BF"><enum>IV</enum><header>Protecting consumers and individuals through improved mitigation</header>
 <section id="H0E1CDD24C0A34F1C9CBD9C3C38752F9C" section-type="subsequent-section"><enum>401.</enum><header>Provision of Community Rating System premium credits to maximum number of communities practicable</header><text display-inline="no-display-inline">Subsection (b) of section 1315 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4022">42 U.S.C. 4022(b)</external-xref>) is amended—</text>
 <paragraph id="H3B9FA7D2E35D42DC97089C735DC17186"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>may</quote> and inserting <quote>shall</quote>; and</text> </paragraph><paragraph id="HD8EB23A6BD0C4975813FF1B138732A4C"><enum>(2)</enum><text>in paragraph (3), by inserting <quote>, and the Administrator shall provide credits to the maximum number of communities practicable</quote> after <quote>under this program</quote>.</text>
				</paragraph></section></title><title id="H6EC1DB08C9F640C482BFE58E04B71D07"><enum>V</enum><header>Program integrity</header>
 <section id="HB282631EB39142FB80FD6F3AE98E70B1"><enum>501.</enum><header>Independent actuarial review</header><text display-inline="no-display-inline">Section 1309 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4016">42 U.S.C. 4016</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HF1AF405C4FDC4FA4A36050A5B39243BC" style="OLC">
					<subsection id="HCB45373C11124E2BA5C3E645FD0D80C1"><enum>(e)</enum><header>Independent actuarial review</header>
 <paragraph id="H1176B3C6D02D4C8B9DF90CDF8126ACC7"><enum>(1)</enum><header>Fiduciary responsibility</header><text display-inline="yes-display-inline">The Administrator has a responsibility to ensure that the National Flood Insurance Program remains financially sound. Pursuant to this responsibility, the Administrator shall from time to time review and eliminate nonessential costs and positions within the Program, unless otherwise authorized or required by law, as the Administrator determines to be necessary.</text>
 </paragraph><paragraph id="H23B9774D638B4BDDB51EB763FDFB4E43"><enum>(2)</enum><header>Annual independent actuarial study</header><text display-inline="yes-display-inline">The Administrator shall provide for an independent actuarial study of the National Flood Insurance Program to be conducted annually, which shall analyze the financial position of the program based on the long-term estimated losses of the program. The Administrator shall submit a report (together with the independent actuarial study) annually to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate describing the results of such study, including a determination of whether the Program has collected revenue sufficient to cover the administrative expenses of carrying out the flood insurance program, which are reflected in the risk premium rates, cost of capital, all other costs associated with the transfer of risks, and expected claims payments during the reporting period, and an overall assessment of the financial status of the Program.</text>
						</paragraph><paragraph id="H6A70145488A24F209458B58A0CBEF63A"><enum>(3)</enum><header>Determination of actuarial budget deficit</header>
 <subparagraph id="H6FC16734C530475F8D1C0FE5C3F191A7"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">Within the report submitted under paragraph (2), the Administrator shall issue a determination of whether there exists an actuarial budget deficit for the Program for the year covered in the report. The report shall recommend any changes to the Program, if necessary, to ensure that the program remains financially sound.</text>
 </subparagraph><subparagraph id="H86A0C87D6E584A6BA86F76B9EC67DFCF"><enum>(B)</enum><header>Basis of determination</header><text display-inline="yes-display-inline">The determination required by subparagraph (A) shall be based solely upon whether the portion of premiums estimated and collected by the Program during the reporting period is sufficient to cover the administrative expenses of carrying out the flood insurance program, which are reflected in the risk premium rates, cost of capital, all other costs associated with the transfer of risk, and expected claims payments for the reporting period.</text>
 </subparagraph></paragraph><paragraph id="H45C83715AD0C4E33AC98B02535AE8AEE"><enum>(4)</enum><header>Quarterly reports</header><text display-inline="yes-display-inline">During each fiscal year, on a calendar quarterly basis, the Secretary shall cause to be published in the Federal Register or comparable method, with notice to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate, information which shall specify—</text>
 <subparagraph id="H837249963DF14006A94923E88524F95C"><enum>(A)</enum><text>the cumulative volume of policies that have been underwritten under the National Flood Insurance Program during such fiscal year through the end of the quarter for which the report is submitted;</text>
 </subparagraph><subparagraph id="HC33D0A82C03F4E048C2078741316E1B5"><enum>(B)</enum><text>the types of policies insured, categorized by risk;</text> </subparagraph><subparagraph id="H9FE34491926447298B716EB1700BC94E"><enum>(C)</enum><text>any significant changes between actual and projected claim activity;</text>
 </subparagraph><subparagraph id="HD60EE79DE5A946869C699E1FD6E3B26D"><enum>(D)</enum><text>projected versus actual loss rates;</text> </subparagraph><subparagraph id="HE5C2361B008E4CC18F6CE5C0C8825AFE"><enum>(E)</enum><text display-inline="yes-display-inline">the cumulative number of currently insured repetitive-loss properties, severe repetitive-loss properties, and extreme repetitive-loss properties that have been identified during such fiscal year through the end of the quarter for which the report is submitted;</text>
 </subparagraph><subparagraph id="H055CD010FCFF4740A3E5067FB21A3FF1"><enum>(F)</enum><text>the cumulative number of properties that have undergone mitigation assistance, through the National Flood Insurance Program, during such fiscal year through the end of the quarter for which the report is submitted; and</text>
 </subparagraph><subparagraph commented="no" id="HCD20E6960A6B47DF8CE5C1F99E940FAF"><enum>(G)</enum><text>the number and location, by State or territory, of each policyholder that has been identified for such fiscal year as an eligible household for purposes of the flood insurance affordability program under section 1326.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">The first quarterly report under this paragraph shall be submitted on the last day of the first
			 quarter of fiscal year 2018, or on the last day of the first full calendar
			 quarter following the enactment of the <short-title>21st Century Flood Reform Act</short-title>, whichever occurs later.</continuation-text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H5E12B28B35F649698A6C1C73B299B19C" section-type="subsequent-section"><enum>502.</enum><header>Adjustments to homeowner flood insurance affordability surcharge</header>
 <subsection id="H61D86E6B1D984154ACE9F10B481BBAC9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1308A of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015a">42 U.S.C. 4015a</external-xref>) is amended—</text> <paragraph id="H4624675DBDDF4AB784A32A1B9397AFB8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking the first sentence and inserting the following: <quote>The Administrator shall impose and collect a non-refundable annual surcharge, in the amount provided in subsection (b), on all policies for flood insurance coverage under the National Flood Insurance Program that are newly issued or renewed after the date of the enactment of this section</quote>; and</text>
 </paragraph><paragraph id="H878D4FD37FB84B61B4991CC479155132"><enum>(2)</enum><text>by striking subsection (b) and inserting the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HEDC0AEFB466C49A0BBFCB00D1E1E94EB" style="OLC"> <subsection id="HA624C674B18046E896562D82BF0124F5"><enum>(b)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount of the surcharge under subsection (a) shall be $40, except as follows:</text>
 <paragraph id="H5235073F802245E8A104DAD5C349B9FB"><enum>(1)</enum><header>Non-primary residences eligible for PRP</header><text>The amount of the surcharge under subsection (a) shall be $125 in the case of in the case of a policy for any property that is—</text>
 <subparagraph id="HFF3F44AF927F4F56BE8CAE9D32B61DAE"><enum>(A)</enum><text>a residential property that is not the primary residence of an individual, and</text> </subparagraph><subparagraph id="H7C3950EA3AA44CE396B5138277ADF8EB"><enum>(B)</enum><text>eligible for preferred risk rate method premiums.</text>
 </subparagraph></paragraph><paragraph id="H60215A7CF09D47B29A20D2130498A693"><enum>(2)</enum><header>Non-residential properties and non-primary residences not eligible for PRP</header><text display-inline="yes-display-inline">The amount of the surcharge under subsection (a) shall be $275 in case of in the case of a policy for any property that is—</text>
 <subparagraph id="H32A18C6EDEAC46EDA460B86B5F5B2FDB"><enum>(A)</enum><text>a non-residential property; or</text> </subparagraph><subparagraph id="HB9731425A8A04F7D87460F7DB1CFA32D"><enum>(B)</enum><text>a residential property that is—</text>
 <clause id="H36409CE36E56494EB38FBB07C371B145"><enum>(i)</enum><text>not the primary residence of an individual; and</text> </clause><clause id="H916C9FA644404EE28E33E67DD2776AF0"><enum>(ii)</enum><text>not eligible for preferred risk rate method premiums.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HA096B3F7FFA3472085EBB9EEB8C90157"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply with respect to policies for flood insurance coverage under the National Flood Insurance Act of 1968 that are newly issued or renewed after the expiration of the 12-month period beginning on the date of the enactment of this Act.</text>
 </subsection></section><section display-inline="no-display-inline" id="H5F19F27956CE4E78ADABB5DE3AE44BD7" section-type="subsequent-section"><enum>503.</enum><header>National Flood Insurance Reserve Fund compliance</header><text display-inline="no-display-inline">Section 1310A of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4017A">42 U.S.C. 4017A</external-xref>) is amended—</text> <paragraph id="HF55B539B16824F98B47CD8C934D2AB06"><enum>(1)</enum><text>in subsection (c)(2)(D), by inserting before the period at the end the following: <quote>, including any provisions relating to chargeable premium rates or annual increases of such rates</quote>;</text>
 </paragraph><paragraph id="HFC698DE4B0044D169E20DD117B5C9A3F"><enum>(2)</enum><text>in subsection (c)(3), by striking subparagraph (A) and inserting the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="H0CF73220D0C443F78BD9F0A85D4B8695" style="OLC"> <subparagraph id="HD7FBC7C187C342A98E5AFD9FD0CB654B"><enum>(A)</enum><header>Parity</header><text display-inline="yes-display-inline">In exercising the authority granted under paragraph (1) to increase premiums, the Administrator shall institute a single annual, uniform rate of assessment for all individual policyholders.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HB8F613E6C836488D82D519FFE0720089"><enum>(3)</enum><text>in subsection (d)—</text> <subparagraph id="H843260894CF547CA8DAD30EA8C234D52"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H9D396DC57FDB4841BBF224331DBA0E8F" style="OLC">
 <paragraph id="HD947C0B6574746CE9571A17F07AEF753"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning in fiscal year 2018 and not ending until the fiscal year in which the ratio required under subsection (b) is achieved—</text>
 <subparagraph id="H8D9EFA6DE5A147249C3DC46F43276D36"><enum>(A)</enum><text display-inline="yes-display-inline">in each fiscal year the Administrator shall place in the Reserve Fund an amount equal to not less than 7.5 percent of the reserve ratio required under subsection (b); and</text>
 </subparagraph><subparagraph id="HEB20B1FCE38B4A7C9E514F656E443F9A"><enum>(B)</enum><text>if in any given fiscal year the Administrator fails to comply with subparagraph (A), for the following fiscal year the Administrator shall increase the rate of the annual assessment pursuant to subsection (c)(3)(A) by at least one percentage point over the rate of the annual assessment pursuant to subsection (c)(3)(A) in effect on the first day of such given fiscal year.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HAD7D9F88D50A40DAADCE28BB9B1E4F1E"><enum>(B)</enum><text>in paragraph (2), by inserting before the period at the end the following: <quote>nor to increase assessments pursuant to paragraph (1)(B)</quote>; and</text> </subparagraph><subparagraph id="HFF8D11259FFD4075939DC1248D3535EA"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting before the period at the end the following: <quote>and paragraph (1)(B) shall apply until the fiscal year in which the ratio required under subsection (b) is achieved</quote>.</text>
					</subparagraph></paragraph></section><section display-inline="no-display-inline" id="H987870A6FBE848BD90451C7F7A8A6C46"><enum>504.</enum><header>Designation and treatment of multiple-loss properties</header>
 <subsection id="H09D30711786F452EBB783B33FD91B476"><enum>(a)</enum><header>Definition</header><text>Section 1370 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121</external-xref>) is amended—</text> <paragraph id="H44D2DD9782BE4F218049C8E573339F95"><enum>(1)</enum><text>in subsection (a)—</text>
 <subparagraph id="H0AF2A76029044F23A51B2C7ADC559FFC"><enum>(A)</enum><text>by striking paragraph (7); and</text> </subparagraph><subparagraph id="HBBD3B63BC2384A75903B7155EDCD6A30"><enum>(B)</enum><text>by redesignating paragraphs (8) through (15) as paragraphs (7) through (14), respectively; and</text>
 </subparagraph></paragraph><paragraph id="HEF4A65B370AF4074B8D10A1E7FF91129"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block id="H1540553AD9984727A5C2B44FCDD38AA3" style="OLC"> <subsection id="H632AEA00143647CF9C46CBBE1E2B339D"><enum>(d)</enum><header>Multiple-Loss properties</header> <paragraph id="HDE4EEC68BC4C43B1A68DC1622F6F8A0B"><enum>(1)</enum><header>Definitions</header><text>As used in this title:</text>
 <subparagraph id="H05FCA570920E4B86AEDF47086801049F"><enum>(A)</enum><header>Multiple-loss property</header><text>The term <quote>multiple-loss property</quote> means any property that is a repetitive-loss property, a severe repetitive-loss property, or an extreme repetitive-loss property.</text>
 </subparagraph><subparagraph id="H64926503B657468299CF22266E45A9E8"><enum>(B)</enum><header>Repetitive-loss property</header><text>The term <quote>repetitive-loss property</quote> means a structure that has incurred flood damage for which two or more separate claims payments of any amount have been made under flood insurance coverage under this title.</text>
 </subparagraph><subparagraph id="HC96C049875F74BB99DD37321F2524416"><enum>(C)</enum><header>Severe repetitive-loss property</header><text display-inline="yes-display-inline">The term <quote>severe repetitive-loss property</quote> means a structure that has incurred flood damage for which—</text> <clause id="H5DEF4249F334494F8BA86E54E961B7CD"><enum>(i)</enum><text>4 or more separate claims payments have been made under flood insurance coverage under this title, with the amount of each such claim exceeding $5,000, and with the cumulative amount of such claims payments exceeding $20,000; or</text>
 </clause><clause id="HBCCCEBE04AEC44A29CD46B2B6700C5FB"><enum>(ii)</enum><text>at least 2 separate claims payments have been made under flood insurance coverage under this title, with the cumulative amount of such claims payments exceeding the value of the structure.</text>
 </clause></subparagraph><subparagraph id="H22EC6D99FB844FD9A7A6D89C61233221"><enum>(D)</enum><header>Extreme repetitive-loss property</header><text>The term <quote>extreme repetitive-loss property</quote> means a structure that has incurred flood damage for which at least 2 separate claims have been made under flood insurance coverage under this title, with the cumulative amount of such claims payments exceeding 150 percent of the maximum coverage amount available for the structure.</text>
 </subparagraph></paragraph><paragraph id="H66830B2476054ABC95483D8EF003264B"><enum>(2)</enum><header>Treatment of claims before compliance with State and local requirements</header><text>The Administrator shall not consider claims that occurred before a structure was made compliant with State and local floodplain management requirements for purposes of determining a structure’s status as a multiple-loss property.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H487002AF993249ADA628FF4B4711F8CA"><enum>(b)</enum><header>Premium adjustment To reflect current flood risk</header>
 <paragraph id="H748A6C4C769D4FF0BD112D9E97C6CC32"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015</external-xref>), as amended by the preceding provisions of this Act, is further amended by adding at the end the following new subsection:</text>
						<quoted-block id="H7B5E5AF3C6804415BD2F2808F0C223FF" style="OLC">
							<subsection id="H999CA224AEEB4F73A9E2CD2DEEA2082E"><enum>(o)</enum><header>Premium adjustment To reflect current flood risk</header>
 <paragraph id="H32F9FA6F3DB14A4EB648ECDFAAD4E939"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the Administrator shall rate a multiple-loss property that is charged a risk premium rate estimated under section 1307(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(a)(1)</external-xref>) based on the current risk of flood reflected in the flood insurance rate map in effect at the time of rating.</text>
 </paragraph><paragraph id="HED2062185A5A45829067A023E1ADF634"><enum>(2)</enum><header>Adjustment for existing policies</header><text>For policies for flood insurance under this title in force on the date of the enactment of this Act for properties described in paragraph (1)—</text>
 <subparagraph id="H3A9E08325BDF4691BCB6F45DD8ABA8EB"><enum>(A)</enum><text display-inline="yes-display-inline">notwithstanding subsection (e) of this section, the Administrator shall increase risk premium rates by not less than 15 percent each year until such rates comply with paragraph (1) of this subsection; and</text>
 </subparagraph><subparagraph id="H0C349F9275FA404A8D97A05D7A1852D7"><enum>(B)</enum><text display-inline="yes-display-inline">any rate increases required by paragraph (1) shall commence following a claim payment for flood loss under coverage made available this title that occurred after the date of enactment of this Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H4DA646FA43BC49A887741263E85C01F7"><enum>(2)</enum><header>Conforming amendment</header><text>Section 1307(g)(2) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(g)(2)</external-xref>) is amended by striking subparagraph (B) and inserting the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H648B4E9CE3934426A380CED9B3A90E39" style="OLC">
 <subparagraph id="H05C18DA43D7B4BAFB1D269F348818674"><enum>(B)</enum><text display-inline="yes-display-inline">in connection with a multiple-loss property.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H7F8E0BE5E3694151BE735F8C7722D0AC"><enum>(c)</enum><header>Pre-FIRM multiple-Loss property</header> <paragraph id="HCABEE84BA7B54BCDA46AE29BEDC365E8"><enum>(1)</enum><header>Termination of subsidy</header><text>Section 1307 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014</external-xref>) is amended—</text>
 <subparagraph id="HC8C78121BAD0479ABDF5AB3FB4467BC5"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(2)—</text> <clause id="H499E9D98C01C4E4DB39B107E41BCB703"><enum>(i)</enum><text>by striking subparagraph (C) and inserting the following new subparagraph:</text>

 </clause><clause id="H7F9CEC5EB7FF429191D7A108195903B8"><enum>(iii)</enum><text>in subparagraph (E)—</text> <subclause id="HBF0BB857953B4D8CA5B20AF8E2037CB1"><enum>(I)</enum><text>in clause (i), by striking <quote>fair</quote>; and</text>
 </subclause><subclause id="HDC9C11C9CCF242D5892FE79C9517DF0A"><enum>(II)</enum><text>in clause (ii)—</text> <item id="H8E02062D920345ACB8035CCCFC74AABB"><enum>(aa)</enum><text>by striking <quote>fair</quote>; and</text>
 </item><item id="HEC3E54B844C649D4A2D9139C352A1382"><enum>(bb)</enum><text>by striking <quote>and</quote> and inserting <quote>or</quote>; and</text> </item></subclause></clause><clause id="HD7A13E71A51C4F4CAD5A35ACCC9BB561"><enum>(iv)</enum><text>by adding at the end the following new subparagraph:</text>
								<quoted-block display-inline="no-display-inline" id="HD3F364D22B9D4DEE94E657FCA028F2CD" style="OLC">
 <subparagraph id="H8F689889940342A88503F195DFD0AE4C"><enum>(F)</enum><text display-inline="yes-display-inline">any repetitive-loss property that has received a claim payment for flood loss under coverage made available this title that occurred after the date of enactment of this Act; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="HF1B4267255CC428D875AB73FA8CC1B3B"><enum>(B)</enum><text>by striking subsection (h).</text> </subparagraph></paragraph><paragraph id="H7138B979D8AB435AB2A27D9E903802B2"><enum>(2)</enum><header>Annual limitation on premium increases</header><text>Subsection (e) of section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(e)</external-xref>) is amended—</text>
 <subparagraph id="H22817AE9481F4997AFCB29970A3F1474"><enum>(A)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="H7BFB286D46DC46B7935BA1A45CCADD10"><enum>(B)</enum><text>in paragraph (4), by striking <quote>described under paragraph (3).</quote> and inserting <quote>estimated under section 1307(a)(1); and</quote>; and</text>
 </subparagraph><subparagraph id="HF3822CB6424B4F78BBF914143F0394FC"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block id="H08F8BA80AEAE4779822D2AD5E7EBC396" style="OLC"> <paragraph id="H3735C9341F864ABCB91E2AD7511972AA"><enum>(5)</enum><text>the chargeable risk premium rates for flood insurance under this title for any properties described in subparagraph (F) of section 1307(a)(2) shall be increased by not less than 15 percent each year, until the average risk premium rate for such properties is equal to the average of the risk premium rates for properties estimated under section 1307(a)(1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="H86C30EA4696D461BB3633DE34E1300F0"><enum>(d)</enum><header>Minimum deductibles for certain multiple-Loss properties</header>
 <paragraph id="H3D6BD562E9F44138B1886127D26B0518"><enum>(1)</enum><header>Clerical amendment</header><text>The National Flood Insurance Act of 1968 is amended—</text> <subparagraph id="HCA25D7E4E36B4AD0A9DBBA77D485D9EA"><enum>(A)</enum><text display-inline="yes-display-inline">by transferring subsection (b) of section 1312 (<external-xref legal-doc="usc" parsable-cite="usc/42/4019">42 U.S.C. 4019(b)</external-xref>) to 1306 (<external-xref legal-doc="usc" parsable-cite="usc/42/4013">42 U.S.C. 4013</external-xref>), inserting such subsection at the end of such section, and redesignating such subsection as subsection (e); and</text>
 </subparagraph><subparagraph id="H7789B12EC0054DC0888648659ED39549"><enum>(B)</enum><text display-inline="yes-display-inline">in section 1312 (<external-xref legal-doc="usc" parsable-cite="usc/42/4019">42 U.S.C. 4019</external-xref>), by redesignating subsection (c) as subsection (b).</text> </subparagraph></paragraph><paragraph id="HCBB398BD99A24F779631A5037E1F6A6B"><enum>(2)</enum><header>Certain multiple-loss properties</header><text display-inline="yes-display-inline">Subsection (e) of section 1306 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4013">42 U.S.C. 4013(e)</external-xref>), as so added and redesignated by paragraph (1) of this subsection, is amended adding at the end the following new paragraph:</text>
						<quoted-block id="HC2E68C54B4E04F2DB3A1A67D19EA5001" style="OLC">
 <paragraph id="H315B2013FDC646B0BC88AC55C4CD8347"><enum>(3)</enum><header>Certain multiple-loss properties</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1) or (2), the minimum annual deductible for damage to any severe repetitive-loss property or extreme repetitive-loss property shall be not less than $5,000.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H56A41FBB1B9C459F8AF7681F6059DD13"><enum>(e)</enum><header>Claim history validation</header><text>Beginning not later than the expiration of the 180-day period beginning on the date of the enactment of this Act, the Administrator of the Federal Emergency Management Agency shall undertake efforts to validate the reasonable accuracy of claim history data maintained pursuant to the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001</external-xref> et seq.).</text>
 </subsection><subsection id="H69FD65227F454DFBAA446A34D507148F"><enum>(f)</enum><header>Increased cost of compliance coverage</header><text>Paragraph (1) of section 1304(b) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011(b)(1)</external-xref>) is amended by striking <quote>repetitive loss structures</quote> and inserting <quote>multiple-loss properties</quote>.</text>
				</subsection><subsection id="HBE5E97F501934FFC8C1F61D035900DE8"><enum>(g)</enum><header>Availability of insurance for multiple-Loss properties</header>
 <paragraph id="HBFE23E48BE054D3D86B23DDC64C4701E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The National Flood Insurance Act of 1968 is amended by inserting after section 1304 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011</external-xref>) the following new section:</text>
						<quoted-block id="H7B9F9D4C43A5407B99D6A1F990A3E70A" style="OLC">
							<section id="H75461E95DFDD42E1B83D8C6398E553C0"><enum>1304A.</enum><header>Availability of insurance for multiple-loss properties</header>
 <subsection id="HCA9B173F23274C729F2F46278000D4B7"><enum>(a)</enum><header>Date and information identifying current flood risk</header><text>The Administrator may provide flood insurance coverage under this title for a multiple-loss property only if the owner of the property submits to the Administrator such data and information necessary to determine such property’s current risk of flood, as determined by the Administrator, at the time of application for or renewal of such coverage.</text>
								</subsection><subsection id="H1207332912614A57A0D966C892E21CF0"><enum>(b)</enum><header>Refusal To Mitigate</header>
 <paragraph id="HFE900306B2FE4AB3B937070228E3536D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided pursuant to paragraph (2), the Administrator may not make flood insurance coverage available under this title for any extreme repetitive-loss property for which a claim payment for flood loss was made under coverage made available under this title that occurred after the date of enactment of the <short-title>21st Century Flood Reform Act</short-title> if the property owner refuses an offer of mitigation for the property under section 1366(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/4104c">42 U.S.C. 4104c(a)(2)</external-xref>).</text>
 </paragraph><paragraph id="HF2702B495AF24C30B13E83E2FC40807F"><enum>(2)</enum><header>Exceptions; appeals</header><text>The Director shall develop guidance to provide appropriate exceptions to the prohibition under paragraph (1) and to allow for appeals to such prohibition.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H247335D069384360933DF991DC683255"><enum>(2)</enum><header>Effective Date</header><text>Section 1304A of the National Flood Insurance Act of 1968, as added by paragraph (1) of this subsection, shall apply beginning upon the expiration of the 12-month period beginning on the date of the enactment of this Act.</text>
 </paragraph></subsection><subsection id="HF00498D8A92E4C75822C87FCC43CB5B6"><enum>(h)</enum><header>Rates for properties newly mapped into areas with special flood hazards</header><text>Subsection (i) of section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(i)</external-xref>) is amended—</text>

					</paragraph></subsection><subsection id="H9FB5A9F5D558444EB878348CCEFC4482"><enum>(i)</enum><header>Clear communication of multiple-Loss property status</header>
 <paragraph id="HB38C5184FECA42739E3275E95BA07CE0"><enum>(1)</enum><header>In general</header><text>Subsection (l) of section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(l)</external-xref>), as amended by the preceding provisions of this Act, is further amended by adding at the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H776AAFD854A24DA79EB6858AFCB61A2A" style="OLC">
 <paragraph id="H6513BC41C6344589A8735E62CE53BBAA"><enum>(2)</enum><header>Multiple-loss properties</header><text display-inline="yes-display-inline">Pursuant to paragraph (1), the Administrator shall clearly communicate to all policyholders for multiple-loss properties the effect on the premium rates charged for such a property of filing any further claims under a flood insurance policy with respect to that property</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HE3BA05AB6DCE42A085206C7A62FB4FF5"><enum>(j)</enum><header>Mitigation assistance program</header><text>Section 1366 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4104c">42 U.S.C. 4104c</external-xref>) is amended—</text> <paragraph id="H947F9F70176F4D1ABDFD5E42015FC164"><enum>(1)</enum><text>in subsection (a)—</text>
 <subparagraph id="HD397427571284FC991D446ED4F9BA4B8"><enum>(A)</enum><text>in the matter preceding paragraph (1), by inserting after the period at the end of the first sentence the following: <quote>Priority under the program shall be given to providing assistance with respect to multiple-loss properties.</quote>;</text>
 </subparagraph><subparagraph id="HAAA32270BBF44DDBB1AE60933F316733"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>and</quote> after the semicolon at the end; and</text> </subparagraph><subparagraph id="HEE49A78F598B415AB4E859EB92E9E096"><enum>(C)</enum><text>by striking paragraphs (2) and (3) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="H82A6EF6B64F443FD96ED28B94BF03534" style="OLC">
 <paragraph id="H1C9ACD809E474FDB930DBDE63C784DAD"><enum>(2)</enum><text display-inline="yes-display-inline">to property owners, in coordination with the State and community, in the form of direct grants under this section for carrying out mitigation activities that reduce flood damage to extreme repetitive-loss properties.</text>
								</paragraph><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">The Administrator shall take such actions as may be necessary to ensure that grants under this
			 subsection are provided in a manner that is consistent with the delivery
			 of coverage for increased cost of compliance provided under section
			 1304(b).</quoted-block-continuation-text><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H71F563B5ACF14EB8A37D2428C32E5BB8"><enum>(2)</enum><text>in subsection (c)(2)(A)(ii), by striking <quote>severe repetitive loss structures</quote> and inserting <quote>multiple-loss properties</quote>;</text> </paragraph><paragraph id="H358AE78B91504E43B630825B5BD19E00"><enum>(3)</enum><text>in subsection (d)—</text>

 </clause></subparagraph></paragraph><paragraph id="H20AC836472524E87AF869F9F9B7FF776"><enum>(5)</enum><text>by inserting after subsection (g) the following new subsections:</text> <quoted-block display-inline="no-display-inline" id="H7303012631E3439481AFCF27C3375347" style="OLC"> <subsection id="HA7EADE4C2A5A4A3C95BAE8C4A8CFC6F1"><enum>(h)</enum><header>Alignment with increased cost of compliance</header><text display-inline="yes-display-inline">Notwithstanding any provision of law, any funds appropriated for assistance under this title may be transferred to the National Flood Insurance Fund established under section 1310 (<external-xref legal-doc="usc" parsable-cite="usc/42/4017">42 U.S.C. 4017</external-xref>) for the payment of claims to enable the Administrator to deliver grants under subsection (a)(2) of this section to align with the delivery of coverage for increased cost of compliance for extreme repetitive-loss properties.</text>
							</subsection><subsection id="H0B3064B1AE4C403F8843A0FFD6E40ACA"><enum>(i)</enum><header>Funding</header>
 <paragraph id="HDFD7F14B59914358878516876271BDF8"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $225,000,000 for each fiscal year for flood mitigation assistance grants.</text>
 </paragraph><paragraph id="H37B7F496262242B881328F0BEB0B2C93"><enum>(2)</enum><header>Availability</header><text>Amounts appropriated pursuant to this subsection for any fiscal year may remain available for obligation until expended.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="H13D085B1987643128E9B16DEB2732256"><enum>505.</enum><header>Elimination of coverage for properties with excessive lifetime claims</header><text display-inline="no-display-inline">Section 1305 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012">42 U.S.C. 4012</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block id="H6E837CC37C734348A57363B70EC0C852">
 <subsection id="HD576FF951B5943AE9C870CB23A9FED09"><enum>(e)</enum><header>Prohibition of coverage for properties with excessive lifetime claims</header><text>After the expiration of the 18-month period beginning on the date of the enactment of this subsection, the Administrator may not make available any new or renewed coverage for flood insurance under this title for any multiple-loss property for which the aggregate amount in claims payments that have been made after the expiration of such period under flood insurance coverage under this title exceeds twice the amount of the replacement value of the structure.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HDBE4AFBC6EEE4AD6A5BE4F80BEC2E4EB" section-type="subsequent-section"><enum>506.</enum><header>Addressing tomorrow’s high-risk structures today</header><text display-inline="no-display-inline">The National Flood Insurance Act of 1968 is amended—</text> <paragraph id="H8940A181376244C9B6812F6022F12D78"><enum>(1)</enum><text>in section 1305 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012">42 U.S.C. 4012</external-xref>), as amended by the preceding provisions of this Act, by adding at the end the following new subsections:</text>
					<quoted-block display-inline="no-display-inline" id="H6FC6AC78BF074ADA9C45EEB030B4E1FB" style="OLC">
						<subsection id="H3AC3C77FA29349C296B9883267CED51B"><enum>(f)</enum><header>Reducing future risks of the National Flood Insurance Fund</header>
 <paragraph id="H4E0EF333F53D4839BD78919939AFF60E"><enum>(1)</enum><header>Prohibition of new coverage for high-risk properties</header><text display-inline="yes-display-inline">Except as provided in subsection (g) and notwithstanding any other provision of this title, in carrying out the fiduciary responsibility to the National Flood Insurance Program under section 1309(e) (<external-xref legal-doc="usc" parsable-cite="usc/42/4016">42 U.S.C. 4016(e)</external-xref>) and to reduce future risks to the National Flood Insurance Fund, on or after January 1, 2021, the Administrator may not make available flood insurance coverage under this title as follows:</text>
 <subparagraph id="HA0FC9B25FBB54411B0CE912E83EE29AB"><enum>(A)</enum><header>New structures added to flood hazard zones</header><text display-inline="yes-display-inline">Any new coverage for any property for which new construction is commenced on or after such date and that, upon completion of such construction, is located in an area having special flood hazards.</text>
 </subparagraph><subparagraph id="H8072E1527BF24598B9AF9DF37CB1094E"><enum>(B)</enum><header>Structures with high-value replacement costs</header><text display-inline="yes-display-inline">Any new or renewed coverage for any residential property having 4 or fewer residences and a replacement value of the structure, at the time, exclusive of the value of the real estate on which the structure is located, of $1,000,000 or more (as such amount is adjusted pursuant to clause (i)), subject to the following provisions:</text>
 <clause id="H32B6F587764C42A0A0BA801B51BFBF55"><enum>(i)</enum><header>Adjustment of amounts</header><text>The dollar amount in the matter of this subparagraph that precedes this clause (as it may have been previously adjusted) shall be adjusted for inflation by the Administrator upon the expiration of the 5-year period beginning upon the enactment of this subsection and upon the expiration of each successive 5-year period thereafter, in accordance with an inflationary index selected by the Administrator.</text>
 </clause><clause id="HA42D933F060748C3B185A745079D575D"><enum>(ii)</enum><header>Valuation</header><text>The Administrator shall determine the replacement value of a property for purposes of this subparagraph using such valuation methods or indicia as the Administrator determines are reasonably accurate, consistent, reliable, and available for such purposes.</text>
 </clause></subparagraph></paragraph><paragraph id="H26F4B244CEFD48719E7188B1AF7E57D8"><enum>(2)</enum><header>Actuarial structures with hidden risks</header><text display-inline="yes-display-inline">For any property with risk premium rates estimated under section 1307(a)(1), on or after January 1, 2021, the Administrator shall charge risk premium rates based on the current risk of flood reflected in the flood insurance rate map or comparable risk rating metric in effect at the time a policy is newly issued, unless the newly issued policy covers a property with continuous flood insurance coverage under this title, or upon the renewal of a policy. For all such policy renewals, the Administrator shall increase the risk premium rate in accordance with section 1308(e)(2) until the risk premium rate is equal to the risk of flood reflected in the flood insurance rate map or comparable risk rating metric in effect at the time of renewal.</text>
 </paragraph><paragraph id="H0A7AFFEAA1BB4C7987BC4F4C0A2F0A7B"><enum>(3)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Administrator may implement this subsection without rulemaking, except that any such implementation shall include advance publication of notice in the Federal Register or advance notice by another comparable method, such as posting on an official website of the Administrator.</text>
							</paragraph></subsection><subsection id="H75E6B9F0418B4AD59B1D765A524DF53D"><enum>(g)</enum><header>Availability of otherwise prohibited flood insurance during counter-Cyclical market adjustment</header>
 <paragraph id="H13FFB21D98444225A32BFD4CE58F1750"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">Upon the effectiveness of a determination under paragraph (2) with respect to a geographical area, the Administrator may temporarily make available, for properties that are described in subparagraph (A) or (B), or both, of subsection (f)(1), and are located in such area, coverage for flood insurance under such Act, notwithstanding subsection (f), during the period that begins upon such determination and ends upon the termination date with respect to such period determined under paragraph (7) of this subsection.</text>
 </paragraph><paragraph id="H37EA149EE0094DB1AB17C05FA70676EE"><enum>(2)</enum><header>Determination of market contraction</header><text display-inline="yes-display-inline">A determination under this paragraph for a geographical area is a determination, made by the State insurance regulator for the affected geographical area, that the availability or affordability of private flood insurance coverage in the United States for properties that are described in subparagraph (A) or (B), or both, of subsection (f)(1) and are located in such area has contracted significantly, made in accordance with the following requirements:</text>
 <subparagraph id="H3113F1F9B558440086A2A17A7F903CEF"><enum>(A)</enum><text>The State insurance coordinator has determined that there is no evidence that the State regulatory or legislative structure has unduly hindered the ability of private insurance carriers to compete in the State.</text>
 </subparagraph><subparagraph id="HA84644D2D97042BFA3C34AACEF8CA703"><enum>(B)</enum><text>The State insurance coordinator has determined that there is evidence of a low market penetration of private flood insurance in the State, or a geographic area of the State, where private insurance carriers have been allowed to participate in the market in a fair process.</text>
 </subparagraph><subparagraph id="HBC051777C24845648C0D0E758D281E42"><enum>(C)</enum><text>The State insurance coordinator has determined that private insurers have been given an opportunity to offer flood insurance but have failed to penetrate the markets by more than 10 percent of the market share for flood insurance.</text>
 </subparagraph><subparagraph id="H9067E3208104424593BA7CE055530D72"><enum>(D)</enum><text>The determination under this paragraph was made after the State insurance commissioner provided private insurance carriers and consumers an opportunity to provide information regarding the determination under this paragraph, which included holding a public hearing regarding such determination at which to provide such information that was held not less than 45 days after public notice of the time and place of such hearing was first made available.</text>
 </subparagraph><subparagraph id="H4001B8B153EF40859B37051F16568C4D"><enum>(E)</enum><text>The Secretary of the Treasury has confirmed the determination under this paragraph based on the conditions of the insurance market for such determination, including the geographic area subject to the determination.</text>
 </subparagraph></paragraph><paragraph id="HEC7AB0A68F104C67B7E4751343DEBBA9"><enum>(3)</enum><header>Effective date</header><text>A determination under paragraph (2) shall take effect for purposes of paragraph (1) upon receipt by the Administrator of written notice of such determination, in accordance with such requirements as the Administrator shall establish.</text>
 </paragraph><paragraph id="HA9605231E694400596036BFEEAE4D172"><enum>(4)</enum><header>Surcharge</header><text display-inline="yes-display-inline">Any flood insurance coverage made available for a property pursuant to this subsection shall be made available at chargeable premium rates otherwise determined under this title for such property, notwithstanding subsection (f), except that the Administrator shall impose and collect a surcharge for such coverage in an amount equal to 10 percent of such chargeable premium rate, which shall be deposited into the National Flood Insurance Fund established under section 1310.</text>
 </paragraph><paragraph id="HF522C7DD677740BDA834E3BD0D5513A2"><enum>(5)</enum><header>Conditions for termination</header><text>Upon making a determination under paragraph (2), the Administrator shall also identify measurable criteria for determining when the conditions determined under paragraph (2) have ceased to exist for the affected geographical area.</text>
 </paragraph><paragraph id="H181E560B3C2C4F989FB94B38DC553A14"><enum>(6)</enum><header>Notice to Congress</header><text>Upon making a determination under paragraph (2), the Administrator shall provide, to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate, written notice of such determination, the geographical area to which such determination applies, and the specific measurable criteria identified pursuant to paragraph (5).</text>
 </paragraph><paragraph id="HB31F3442460A426692617500CBA36EEE"><enum>(7)</enum><header>Termination</header><text>The authority to make direct flood insurance coverage available pursuant to this subsection shall terminate upon the earlier of—</text>
 <subparagraph id="H71B969B3D5264C8689F0E2FD606C54C2"><enum>(A)</enum><text>the expiration of the 12-month period beginning upon the date that notice under paragraph (6) is provided to the specified Committees; or</text>
 </subparagraph><subparagraph id="H43B037B850704BBBA5E81F3C8A9C3AA7"><enum>(B)</enum><text>the occurrence of the conditions identified pursuant to paragraph (5).</text> </subparagraph></paragraph><paragraph id="H3DB0A2F717B1430DA9A2C407EB861510"><enum>(8)</enum><header>Rules of construction</header> <subparagraph id="HECE3FC74504647ABAE3CB6E8A105CAE3"><enum>(A)</enum><header>Multiple determinations</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to prevent multiple or consecutive periods during which direct flood insurance coverage may be made available pursuant to this subsection for properties referred to in subsection (f)(1).</text>
 </subparagraph><subparagraph id="H7E6BA3E90D7F4572849039C9482CD18D"><enum>(B)</enum><header>Effectiveness of policies</header><text>The termination pursuant to paragraph (7) of authority to make direct flood insurance coverage available pursuant to this subsection may not be construed to affect the effectiveness or term of coverage of any policy for such coverage purchased pursuant to such authority.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H3458DB513FC245F1AF26A8A3ACC33AF3"><enum>(2)</enum><text display-inline="yes-display-inline">in section 1306(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/4013">42 U.S.C. 4013(a)(1)</external-xref>), by inserting <quote>, subject to subsections (f) and (g) of section 1305</quote> before the semicolon at the end.</text> </paragraph></section><section id="H1A9A2F33920943B0883408DDC40CBD6D"><enum>507.</enum><header>Allowance for Write Your Own companies</header><text display-inline="no-display-inline">Section 1345 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4081">42 U.S.C. 4081</external-xref>), as amended by the preceding provisions of this Act, is further amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HFF45249B92F34AACB7F0C9EDE144E3AD" style="OLC">
 <subsection id="HBE51B4AFE23341DBAC263F43D05EAA59"><enum>(g)</enum><header>Allowance for Write Your Own companies</header><text display-inline="yes-display-inline">The allowance paid to companies participating in the Write Your Own Program (as such term is defined in section 1370 (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121</external-xref>)) with respect to a policy for flood insurance coverage made available under this title shall not be greater than 25 percent of the chargeable premium for such coverage.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="HEBB6DB7BB98F42B38102CDF6512F4100" section-type="subsequent-section"><enum>508.</enum><header>Enforcement of mandatory purchase requirements</header>
 <subsection id="H42877B3159A54DBE8FBD2E81E79C7739"><enum>(a)</enum><header>Penalties</header><text display-inline="yes-display-inline">Paragraph (5) of section 102(f) of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a(f)(5)</external-xref>) is amended by striking <quote>$2,000</quote> and inserting <quote>$5,000</quote>.</text>
 </subsection><subsection id="H78D03730310B4D71B82571A2249FC119"><enum>(b)</enum><header>Insured depository institutions</header><text>Subparagraph (A) of section 10(i)(2) of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1820">12 U.S.C. 1820(i)(2)(A)</external-xref>) is amended by striking <quote>date of enactment of the Riegle Community Development and Regulatory Improvement Act of 1994 and biennially thereafter for the next 4 years</quote> and inserting <quote>date of enactment of the <short-title>21st Century Flood Reform Act</short-title> and biennially thereafter</quote>.</text>
 </subsection><subsection id="H5E3035512E874C3EB3A860D5E54FAFE9"><enum>(c)</enum><header>Credit unions</header><text display-inline="yes-display-inline">Subparagraph (A) of section 204(e)(2) of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1784">12 U.S.C. 1784(e)(2)(A)</external-xref>) is amended by striking <quote>date of enactment of the Riegle Community Development and Regulatory Improvement Act of 1994 and biennially thereafter for the next 4 years</quote> and inserting <quote>date of enactment of the <short-title>21st Century Flood Reform Act</short-title> and annually thereafter</quote>.</text>
 </subsection><subsection id="HEE27E5545693453783EF73527741E94F"><enum>(d)</enum><header>Government-Sponsored enterprises</header><text display-inline="yes-display-inline">Paragraph (4) of section 1319B(a) of the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/4521">12 U.S.C. 4521(a)(4)</external-xref>) is amended, in the matter after and below subparagraph (B), by striking <quote>first, third, and fifth annual reports under this subsection required to be submitted after the expiration of the 1-year period beginning on the date of enactment of the Riegle Community Development and Regulatory Improvement Act of 1994</quote> and inserting <quote>first annual report under this subsection required to be submitted after the expiration of the 1-year period beginning on the date of enactment of the <short-title>21st Century Flood Reform Act</short-title> and every such second annual report thereafter</quote>.</text>
				</subsection><subsection id="H2C498B2A34B84BD0B6CB26809F21010C"><enum>(e)</enum><header>Mandatory purchase study; guidelines</header>
					<paragraph id="HB3B60C5157A84D249ACDBD38C904DEE9"><enum>(1)</enum><header>Study</header>
 <subparagraph id="H4C67FD015A0D47BE94983F8D8A268B13"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study of the implementation and efficacy of the requirements of section 102 of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a</external-xref>). Such study shall at minimum consider the following questions:</text>
 <clause id="HF52DD48B32B24A1E901ADE42293BB76C"><enum>(i)</enum><text>How effectively do Federal agencies, regulated lending institutions, and Federal entities for lending regulation implement the requirements of section 102 of the Flood Disaster Protection Act of 1973?</text>
 </clause><clause id="H31771FD084354130A57101B129C92320"><enum>(ii)</enum><text>Does the current implementation of Flood Disaster Protection Act of 1973 align with the congressional findings and purposes described in section 2(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4002">42 U.S.C. 4002</external-xref>)?</text>
 </clause><clause id="HA64A38796A1D4FAD881291C423F1F616"><enum>(iii)</enum><text>What, if any, unintended consequences have resulted from the requirements and implementation of section 102 of such Act?</text>
 </clause></subparagraph><subparagraph id="HDF13FD97FEFB4E9FABF79A2A00C1CF86"><enum>(B)</enum><header>Report</header><text>Not later than the expiration of the 18-month period beginning on the date of the enactment of this Act, the Comptroller General shall submit a report to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate regarding the findings and conclusions of the study conducted pursuant to this paragraph.</text>
 </subparagraph></paragraph><paragraph id="HA25A16E9005B4E71984F53E8638D607B"><enum>(2)</enum><header>Guidelines</header><text>The Federal entities for lending regulation (as such term is defined in section 3(a) of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4003">42 U.S.C. 4003(a)</external-xref>)), in consultation with the Administrator of the Federal Emergency Management Agency, shall jointly update and reissue the rescinded document of the Administrator entitled <quote>Mandatory Purchase of Flood Insurance Guidelines</quote> (lasted updated on October 29, 2014). The updated document shall incorporate recommendations made by the Comptroller General pursuant to paragraph (1) of this subsection.</text>
					</paragraph></subsection></section><section id="H83E5D76348B3446BA97D91AE58EC59A2"><enum>509.</enum><header>Satisfaction of mandatory purchase requirement in States requiring flood coverage in all-perils
 policies</header><text display-inline="no-display-inline">Section 102 of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a</external-xref>) is amended—</text> <paragraph id="H45E6E4466D6E426EA76FC1D431E78BAB"><enum>(1)</enum><text>in subsection (a), by striking <quote>After</quote> and inserting <quote>Subject to subsection (i) of this section, after</quote>;</text>
 </paragraph><paragraph id="H3053D7634D5E410D9A366EB4CDD46CAF"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text> <subparagraph id="H51068A9A865F4CD8AFFA56FE5E726A26"><enum>(A)</enum><text>in paragraph (1), by striking <quote>Each</quote> and inserting <quote>Subject to subsection (i) of this section, each</quote>;</text>
 </subparagraph><subparagraph id="H1026EA70A2BE467AAE8DD421320D2518"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>Each</quote> and inserting <quote>Subject to subsection (i) of this section, A</quote>; and</text> </subparagraph><subparagraph id="HD75BD4F93C1E4FCF85632A8A22C09485"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>The</quote> and inserting <quote>Subject to subsection (i) of this section, the</quote>;</text>
 </subparagraph></paragraph><paragraph id="HCC9FCCB27B274B3DAB776F119C7EA432"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e)(1), by striking <quote>If</quote> and inserting <quote>Subject to subsection (i) of this section, if</quote>; and</text> </paragraph><paragraph id="HAA2DA44C012C4C99AEA5690AF9AA1915"><enum>(4)</enum><text>by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HFE650B6232944A95A2800BEC9A8BEDC9" style="OLC">
						<subsection id="HAAFB706E5885490FA19B67DD6F327C67"><enum>(i)</enum><header>Satisfaction of mandatory purchase requirement in States requiring flood coverage in all-Perils
			 policies</header>
 <paragraph id="H80BC239B757F412D95C8E6694ECA2772"><enum>(1)</enum><header>Waivers</header><text display-inline="yes-display-inline">Subsections (a), (b), and (e) of section 102 shall not apply with respect to residential properties in any State for which the Administrator determines that State law, including any regulation or Executive order, requires that with respect residential properties any property insurance coverage that covers all perils except specifically excluded perils shall include coverage for flood perils in an amount at least equal to the outstanding principal balance of the loan or the maximum limit of flood insurance coverage made available under this title with respect to such type of residential property, whichever is less.</text>
 </paragraph><paragraph id="HE0BA6821578F49D09D96AD7D985E275C"><enum>(2)</enum><header>Definitions, procedures, standards</header><text>The Administrator may establish such definitions, procedures, and standards as the Administrator considers necessary for making determinations under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H498951C082E14F65B7719F8B4E62E05F" section-type="subsequent-section"><enum>510.</enum><header>Flood insurance purchase requirements</header><text display-inline="no-display-inline">Section 102 of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a</external-xref>), as amended by the preceding provisions of this Act, is further amended—</text>
 <paragraph id="H5FF77C66A383430FA9BD8BCD4C5866ED"><enum>(1)</enum><text>in subsection (c)(2)(A), by striking <quote>$5,000 or less</quote> and inserting the following: <quote>$25,000 or less, except that such amount (as it may have been previously adjusted) shall be adjusted for inflation by the Administrator upon the expiration of the 5-year period beginning upon the enactment of the <short-title>21st Century Flood Reform Act</short-title> and upon the expiration of each successive 5-year period thereafter, in accordance with an inflationary index selected by the Administrator</quote>; and</text>
 </paragraph><paragraph id="H7F7301A79728435D821332F1E4737B46"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H5D3C3E509CAB4C5CB9C2BB72CB685A98" style="OLC"> <subsection id="H07B9E9A16D504D889AE86E8ECE7CE6CC"><enum>(j)</enum><header>Flood insurance purchase requirements</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a State or local government or private lender may require the purchase of flood insurance coverage for a structure that is located outside of an area having special flood hazards.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
