			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to
			 reauthorize and improve the brownfields program, and for other purposes.</official-title></form>
	<legis-body id="HC4704918A27F4EE78701C3A12EF57F45" style="OLC">
 <section commented="no" id="H56308C79B38D494A9DDB8310A8EFDB83" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brownfields Enhancement, Economic Redevelopment, and Reauthorization Act of 2017</short-title></quote>.</text> </section><section id="H46E4C79D6BBC40C289923D509625E471"><enum>2.</enum><header>Redevelopment certainty for governmental entities</header> <text display-inline="no-display-inline">Section 101(20)(D) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601(20)(D)</external-xref>) is amended by striking <quote>ownership or control</quote> and all that follows through <quote>by virtue</quote> and inserting <quote>ownership or control through seizure or otherwise in connection with law enforcement activity, or through bankruptcy, tax delinquency, abandonment, or other circumstances in which the government acquires title by virtue</quote>.</text>
 </section><section id="H6DA28F6379DB4C43B0309C10E1F6BDC8"><enum>3.</enum><header>Petroleum brownfield enhancement</header><text display-inline="no-display-inline">Section 101(39)(D)(ii)(II) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601(39)(D)(ii)(II)</external-xref>) is amended by amending item (bb) to read as follows:</text>
			<quoted-block id="H146946CE28554871880B375A67863448" style="OLC">
 <item id="H0DD3C26CF26D458DB8D413413AC86EAD" indent="up2"><enum>(bb)</enum><text display-inline="yes-display-inline">is a site for which there is no viable responsible party and that is determined by the Administrator or the State, as appropriate, to be a site that will be assessed, investigated, or cleaned up by a person that is not potentially liable for cleaning up the site under this Act or any other law pertaining to the cleanup of petroleum products; and</text></item><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H65F4869D16344ED9849C4EA03AED97C5"><enum>4.</enum><header>Clarification of leaseholder interest</header><text display-inline="no-display-inline">Section 101(40) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601(40)</external-xref>) is amended—</text>
 <paragraph id="H899AB8122DB045F88C68CFC74F06AF92"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by striking <quote>(or a tenant of a person) that acquires ownership of</quote> and inserting <quote>who acquires ownership of, or a leasehold interest in,</quote>;</text> </paragraph><paragraph id="H6F99940F9D274C34B77F7CD18B5C751C"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>or the leasehold interest in the facility</quote> before the period at the end;</text>
 </paragraph><paragraph id="H68D0CB151E2D472EA0BFE54874005BE7"><enum>(3)</enum><text>in subparagraph (B)—</text> <subparagraph id="H6624D7AE822344D0BF12D19D7CCE5B12"><enum>(A)</enum><text>in clause (ii), by inserting <quote>with respect to a person who acquires ownership of a facility. The Administrator shall establish standards and practices with respect to a person who acquires a leasehold interest in a facility</quote> before the period at the end; and</text>
 </subparagraph><subparagraph commented="no" id="H4179CBCD27034AB0B83FAB1E0892A088"><enum>(B)</enum><text>in clause (iii), by inserting <quote>, or acquisition of a leasehold interest,</quote> after <quote>time of purchase</quote>;</text> </subparagraph></paragraph><paragraph commented="no" id="H0AD45837ECAB4895874855E0898B226F"><enum>(4)</enum><text display-inline="yes-display-inline">in subparagraph (H)(i)(II), by inserting <quote>, by the instruments by which the leasehold interest in the facility is acquired after January 11, 2002,</quote> after <quote>financed</quote>; and</text>
 </paragraph><paragraph id="H5913BB9F954D48ED847BEE6E53602AAF"><enum>(5)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H7215755107AF4D508CB2AC657B41F92C" style="OLC"> <subparagraph id="H90CAF12DE78A4CFE9775F4A247C69672"><enum>(I)</enum><header>Leaseholders</header><text display-inline="yes-display-inline">In the case of a person holding a leasehold interest in a facility—</text>
 <clause id="H6CE855CFE54448E08F7DEAB45E09EB92"><enum>(i)</enum><text>the leasehold interest in the facility—</text> <subclause id="HF6811E991CB040DCB413A626F6D6A974"><enum>(I)</enum><text>is for a term of not less than 10 years; and</text>
 </subclause><subclause id="H8DDD50D05B664DA59BCE028BC1BF0991"><enum>(II)</enum><text>grants the person control of, and access to, the facility; and</text> </subclause></clause><clause id="H91F8C765ACF14BD58CB843CE1476A18C"><enum>(ii)</enum><text display-inline="yes-display-inline">the person is responsible for the management of all hazardous substances at the facility.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HD800BAB184D441CA89CB972BA9569DD3"><enum>5.</enum><header>Expanded eligibility for nonprofit organizations</header>
 <subsection id="HC722DC0CE6B3425BADACB5A0898ED2F5"><enum>(a)</enum><header>Nonprofit organizations</header><text display-inline="yes-display-inline">Section 104(k)(1) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(1)</external-xref>) is amended—</text>
 <paragraph id="HAF019449B3124A48A94514BD11ED1B39"><enum>(1)</enum><text>in subparagraph (G), by striking <quote>or</quote> after the semicolon;</text> </paragraph><paragraph id="H1AE8D647E5AD492DBCFDCDE90EB0E62D"><enum>(2)</enum><text>in subparagraph (H), by striking the period at the end and inserting a semicolon; and</text>
 </paragraph><paragraph id="HA1F60B1853CE452BABF991C4FB6FCB5C"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="HB1A2A165335042A7BEDC2A40B0CA513E" style="OLC"> <subparagraph id="H9152C50E9C2E4AE0BD52C715E242FFD7"><enum>(I)</enum><text>an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code;</text>
 </subparagraph><subparagraph id="H5D843AFEDBF847B688A44DD00588EB53"><enum>(J)</enum><text>a limited liability corporation in which all managing members are organizations described in subparagraph (I) or limited liability corporations whose sole members are organizations described in subparagraph (I);</text>
 </subparagraph><subparagraph id="H856D78F353414A049B49C6659B7AF5C7"><enum>(K)</enum><text>a limited partnership in which all general partners are organizations described in subparagraph (I) or limited liability corporations whose sole members are organizations described in subparagraph (I); or</text>
 </subparagraph><subparagraph id="HE9898E4718A9483682DC172847D2214B"><enum>(L)</enum><text>a qualified community development entity (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(c)(1)</external-xref> of the Internal Revenue Code of 1986).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="HF4C35843DD21420FA9D7FC3A929F7D65"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 104(k)(3) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(3)</external-xref>) is amended—</text>
 <paragraph commented="no" id="HBB966028EFAC487FAEB9E9A3C76BC6E6"><enum>(1)</enum><text>in subparagraph (A)(ii)—</text> <subparagraph commented="no" id="H62BCDDAAD1754CB6B4977AE6EFD0117B"><enum>(A)</enum><text>by striking <quote>or nonprofit organizations</quote>; and</text>
 </subparagraph><subparagraph commented="no" id="H8EF96CC977F647E68C1422E7643D887D"><enum>(B)</enum><text>by striking <quote>entity or organization</quote> and inserting <quote>eligible entity</quote>; and</text> </subparagraph></paragraph><paragraph commented="no" id="H34684E2507EB486BBEEEA0A6CCF58771"><enum>(2)</enum><text>in subparagraph (B)(ii)—</text>
 <subparagraph commented="no" id="H8AD0657F9C7640F498CE9685A9A64AA5"><enum>(A)</enum><text>by striking <quote>or other nonprofit organization</quote>; and</text> </subparagraph><subparagraph commented="no" id="H1A1B104B557440748D71973AC3841A66"><enum>(B)</enum><text>by striking <quote>or nonprofit organization</quote>.</text>
 </subparagraph></paragraph></subsection></section><section id="H86AE7F7E8C37418092D4717D9245EDFD"><enum>6.</enum><header>Treatment of publicly owned brownfield sites</header><text display-inline="no-display-inline">Section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604</external-xref>) is amended—</text>
 <paragraph id="H2CEE5692B5544FE0ADCB5ED1491E9E4B"><enum>(1)</enum><text>in paragraph (2), by adding at the end the following:</text> <quoted-block id="H39AB782D48AC4E7EA753723BE40D1AD1" style="OLC"> <subparagraph id="H201B9E0E9758442194E5C2BC3DD7790F"><enum>(C)</enum><header>Exemption for certain publicly owned brownfield sites</header><text>Notwithstanding any other provision of law, an eligible entity described in any of subparagraphs (A) through (H) of paragraph (1) may receive a grant under this paragraph for property acquired by that eligible entity prior to January 11, 2002, even if such eligible entity does not qualify as a bona fide prospective purchaser, so long as the eligible entity has not caused or contributed to a release or threatened release of a hazardous substance at the property.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H460EBAD49074400AB65BE9195FA93279"><enum>(2)</enum><text>in paragraph (3), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H733950446EF2482A872A0CEF96560540" style="OLC"> <subparagraph id="HE689B67733E54119BEA9D19E42FAD62E"><enum>(E)</enum><header>Exemption for certain publicly owned brownfield sites</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an eligible entity described in any of subparagraphs (A) through (H) of paragraph (1) may receive a grant or loan under this paragraph for property acquired by that eligible entity prior to January 11, 2002, even if such eligible entity does not qualify as a bona fide prospective purchaser, so long as the eligible entity has not caused or contributed to a release or threatened release of a hazardous substance at the property.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="HD2EB8CC2E1B94916B2A62A834D702DFD"><enum>7.</enum><header>Remediation grant enhancement</header><text display-inline="no-display-inline">Section 104(k)(3)(A)(ii) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(3)(A)(ii)</external-xref>) is amended by striking <quote>$200,000 for each site to be remediated</quote> and inserting <quote>$500,000 for each site to be remediated, which limit may be waived by the Administrator, but not to exceed a total of $750,000 for each site, based on the anticipated level of contamination, size, or ownership status of the site</quote>.</text>
 </section><section id="HB4F8BCFDC20E4015B4A985263DCF1FFA"><enum>8.</enum><header>Multipurpose brownfields grants</header><text display-inline="no-display-inline">Section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) is amended—</text>
 <paragraph id="H563CD3E0EF1E40E4BA0220352948B4D1"><enum>(1)</enum><text>by redesignating paragraphs (4) through (12) as paragraphs (5) through (13), respectively;</text> </paragraph><paragraph id="H789D9DC8CE2B49C7B80060F6F69D3C11"><enum>(2)</enum><text>in paragraph (3)(A), by striking <quote>Subject to paragraphs (4) and (5)</quote> and inserting <quote>Subject to paragraphs (5) and (6)</quote>;</text>
 </paragraph><paragraph id="H74519F8331A4424B92E3AE900B939E8B"><enum>(3)</enum><text>by inserting after paragraph (3) the following:</text> <quoted-block id="HB5B9CBBBC6D4425F9FB314E5F870B46B" style="OLC"> <paragraph id="H715FDFD3549C4F4C80C4C2F290A3A023"><enum>(4)</enum><header>Multipurpose brownfields grants</header> <subparagraph id="H882FA399F6324D4C9272645A1611A29B"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (D) and paragraphs (5) and (6), the Administrator shall establish a program to provide multipurpose grants to an eligible entity based on the criteria under subparagraph (C) and the considerations under paragraph (3)(C), to carry out inventory, characterization, assessment, planning, technical assistance, or remediation activities at 1 or more brownfield sites in an area proposed by the eligible entity.</text>
 </subparagraph><subparagraph id="H20B62FC255B747F6A23F7404A9CF53A2"><enum>(B)</enum><header>Grant amounts</header><text>Each grant awarded under this paragraph shall not exceed $1,000,000.</text> </subparagraph><subparagraph id="H1F521033CB0144E098B772F510EDB26E"><enum>(C)</enum><header>Criteria</header><text>In awarding a grant under this paragraph, the Administrator shall consider the extent to which the eligible entity is able—</text>
 <clause id="H9344E355BEB447FFBE2D2CEFADB17D0A"><enum>(i)</enum><text>to provide an overall plan for revitalization of the 1 or more brownfield sites in the proposed area in which the multipurpose grant will be used;</text>
 </clause><clause id="H2B89912E27E7406AA9FAED4F1856638A"><enum>(ii)</enum><text>to demonstrate a capacity to conduct the range of activities that will be funded by the multipurpose grant; and</text>
 </clause><clause id="H3FB003B1BDC2494F8A8C4506BD16CED6"><enum>(iii)</enum><text>to demonstrate that a multipurpose grant will meet the needs of the 1 or more brownfield sites in the proposed area.</text>
 </clause></subparagraph><subparagraph id="H546A7C701B5F4D09AA73E4B1A69EB82E"><enum>(D)</enum><header>Condition</header><text>As a condition of receiving a grant under this paragraph, each eligible entity shall expend the full amount of the grant not later than the date that is 5 years after the date on which the grant is awarded to the eligible entity, unless the Administrator provides an extension.</text>
 </subparagraph><subparagraph id="H4DC32348FD014F8DB20568FADE764293"><enum>(E)</enum><header>Ownership</header><text>An eligible entity that receives a grant under this paragraph may not expend any of the grant funds on remediation of a brownfield site until such time as the eligible entity owns the brownfield site.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H424A629902744819BFC2786B04951E51"><enum>(4)</enum><text>by striking <quote>(2) or (3)</quote> each place it appears and inserting <quote>(2), (3), or (4)</quote>.</text> </paragraph></section><section commented="no" id="H43DC70F9B06C47CD8E5D2290CCB82A76"><enum>9.</enum><header>Administrative costs for grant recipients</header><text display-inline="no-display-inline">Paragraph (5) of section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) (as redesignated by section 8 of this Act) is amended—</text>
 <paragraph commented="no" id="H83999132FEE944C4BF5068FACB904E76"><enum>(1)</enum><text>in subparagraph (B)—</text> <subparagraph commented="no" id="H00FA82067BD846F5809033AB0FC3CD7E"><enum>(A)</enum><text>in clause (i)—</text>
 <clause commented="no" id="HCBE222ABD8D54BDAAD22F58CA8934301"><enum>(i)</enum><text>by striking subclause (III); and</text> </clause><clause commented="no" id="H568BF0897C7944D5A9CFFCF3324F4F81"><enum>(ii)</enum><text>by redesignating subclauses (IV) and (V) as subclauses (III) and (IV), respectively;</text>
 </clause></subparagraph><subparagraph commented="no" id="HFFCCD63E51B44A1D91D1D58FEE02CF4C"><enum>(B)</enum><text>by striking clause (ii);</text> </subparagraph><subparagraph commented="no" id="HD69F28B8425F402BB012E7ABF760B970"><enum>(C)</enum><text>by redesignating clause (iii) as clause (ii); and</text>
 </subparagraph><subparagraph commented="no" id="H7C16CC6F56454ED4902175769416FE87"><enum>(D)</enum><text>in clause (ii) (as redesignated by subparagraph (C) of this paragraph), by striking <quote>Notwithstanding clause (i)(IV)</quote> and inserting <quote>Notwithstanding clause (i)(III)</quote>; and</text> </subparagraph></paragraph><paragraph commented="no" id="H40D3A2239A6745EF84746CAAAED0CF4A"><enum>(2)</enum><text>by adding at the end the following:</text>

					<subparagraph commented="no" id="H097A222A84B9459CA206E0F16F5B119D"><enum>(E)</enum><header>Administrative costs</header>
 <clause commented="no" id="H047AAF57B2E04598B114E1043FFDFB19"><enum>(i)</enum><header>In general</header><text>An eligible entity may use up to 5 percent of the amounts made available under a grant or loan under this subsection for administrative costs.</text>
 </clause><clause commented="no" id="H2EF0023DCBCD4B6F9E3EAD7B04099ECA"><enum>(ii)</enum><header>Restriction</header><text>For purposes of clause (i), the term <term>administrative costs</term> does not include—</text> <subclause commented="no" id="HF6ADF6BE5769422EA7773B7E1FB2E670"><enum>(I)</enum><text>investigation and identification of the extent of contamination of a brownfield site;</text>
 </subclause><subclause commented="no" id="HA7C21C6A3384439FA905F8B867B63A7B"><enum>(II)</enum><text>design and performance of a response action; or</text> </subclause><subclause commented="no" id="HE3D1478F0F37490DBF46050494AB81FF"><enum>(III)</enum><text>monitoring of a natural resource.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="HB5C4646D21D74EC1835EE8EAEEC313D7"><enum>10.</enum><header>Renewable energy on brownfield sites</header><text display-inline="no-display-inline">Paragraph (6) of section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) (as redesignated by section 8 of this Act) is amended by adding at the end of subparagraph (C) the following:</text>
			<quoted-block display-inline="no-display-inline" id="HA242D586DCA24917B06EC1FB0C0C06D8" style="OLC">
 <clause id="H6B4EE2B0579F4E89AC16B24E6F40285E"><enum>(xi)</enum><text display-inline="yes-display-inline">The extent to which a grant would facilitate the production of renewable energy on the site.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="HA1E8765C52BC418EA9C39CB13F5A5714" section-type="subsequent-section"><enum>11.</enum><header>Small community technical assistance grants</header><text display-inline="no-display-inline">Paragraph (7)(A) of section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) (as redesignated by section 8 of this Act) is amended—</text>
 <paragraph id="HEDCB61803669488A857C16B1EF15FB0C"><enum>(1)</enum><text>by striking <quote>The Administrator may provide, or fund eligible entities or nonprofit organizations to provide,</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H5BDA25AE405846008B8CD6F99D6C8CAC" style="OLC"> <clause id="H66499B9DE38F40D59A071514848FEFA0"><enum>(i)</enum><header>In general</header><text>The Administrator may provide, or fund eligible entities to provide,</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HBEFF2E6C15774E4D907127AD90091432"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H63D5B416791745A5BD824FE132C3ECCD" style="OLC"> <clause id="HF241A6794A6B4C098AE74E3547F185AB"><enum>(ii)</enum><header>Small community, Indian tribe, rural area, and disadvantaged area recipients</header> <subclause id="H084F68B532C749459BC62D0C25E6548F"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall use not more than $1,500,000 of the amounts made available to carry out this paragraph in each fiscal year to make grants to States that receive amounts under section 128(a) in that fiscal year to assist small communities, Indian tribes, rural areas, or disadvantaged areas in the State in carrying out activities described in clause (i) with respect to brownfield sites.</text>
 </subclause><subclause id="H9EA9C01B2C3E4A20B7691D148B629B48"><enum>(II)</enum><header>Limitation</header><text>Each grant made under subclause (I) shall be not more than $20,000.</text> </subclause></clause><clause id="H4508D3C62F514DBA83C9228FE2B89801"><enum>(iii)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subparagraph:</text>
 <subclause id="H58C5BF13EE784614946966D2EA7F8539"><enum>(I)</enum><header>Disadvantaged area</header><text>The term <term>disadvantaged area</term> means a community with an annual median household income that is less than 2⁄3 of the statewide annual median household income, as determined by the President based on the latest available decennial census.</text>
 </subclause><subclause id="HB587D55591DD47ACB32F798E6D1102F2"><enum>(II)</enum><header>Small community</header><text display-inline="yes-display-inline">The term <term>small community</term> means a community with a population of not more than 20,000 individuals, as determined by the President based on the latest available decennial census.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H2814D3F484C04B5EBBCC9DF68CCB14A6"><enum>12.</enum><header>Brownfields funding</header><text display-inline="no-display-inline">Paragraph (13) of section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) (as redesignated by section 8 of this Act) is amended to read as follows:</text>

 </section><section id="HF3238BEAAAD74AE786C09B67867835D6"><enum>13.</enum><header>State response program funding</header><text display-inline="no-display-inline">Section 128(a)(3) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9628">42 U.S.C. 9628(a)(3)</external-xref>) is amended to read as follows:</text>
