 <section id="H66CFFE6E66124879A28A8CDC483DA3A6" section-type="subsequent-section"><enum>101.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States to support efforts to—</text> <paragraph id="H3D8A33505E884B47A16CE042708A2367"><enum>(1)</enum><text>improve the rule of law, promote free and fair elections, strengthen and expand the private sector, and fight corruption in sub-Saharan Africa; and</text>
 </paragraph><paragraph id="HB896E2E5258940F79CAD913E3B1F1FAA"><enum>(2)</enum><text display-inline="yes-display-inline">promote the role of women in social, political, and economic development in sub-Saharan Africa.</text> </paragraph></section><section id="H741D4CFD0D174A34BF470F2E5CABA1C6"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title—</text>
 <paragraph id="H131ED2DD515949D0AD711623E2CDF300"><enum>(1)</enum><header>Agoa website</header><text>The term <quote>AGOA Website</quote> means the website established pursuant to section 103(a).</text> </paragraph><paragraph id="H927993FCA6C74FCDA84E179F2E9371D5"><enum>(2)</enum><header>Eligible sub-Saharan African country</header><text>The term <term>eligible sub-Saharan African country</term> means a country that the President has determined meets the eligibility requirements set forth in section 104 of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3703">19 U.S.C. 3703</external-xref>).</text>
				</paragraph></section><section id="H2C02E3BA49524054ADD231657E887F03"><enum>103.</enum><header>Activities in support of transparency</header>
				<subsection id="HAE42F06747C44164971687C1D1AA982C"><enum>(a)</enum><header>AGOA Website</header>
 <paragraph id="H6C07272145AC4DE6838FEF271505FD20"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall establish a publicly available website for the collection and dissemination of information regarding the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3701">19 U.S.C. 3701</external-xref> et seq.).</text>
 </paragraph><paragraph commented="no" id="H44960BE2FD6F464AB9DAAD4CDB49E317"><enum>(2)</enum><header>Contents</header><text>The President shall publish on the AGOA Website the information described in paragraph (1), including—</text>
 <subparagraph id="H103F2E3333EB43DBB1C9B1CBAF9089FB"><enum>(A)</enum><text display-inline="yes-display-inline">information and technical assistance provided at United States Agency for International Development regional trade hubs; and</text>
 </subparagraph><subparagraph commented="no" id="H97E13E1BA8D840EB81C08BA63247459E"><enum>(B)</enum><text display-inline="yes-display-inline">a link to the websites of United States embassies located in eligible sub-Saharan African countries.</text>
 </subparagraph></paragraph><paragraph id="H7B2A5BD63B834F758251C1634FC11E57"><enum>(3)</enum><header>Actions by United States embassies</header><text>The Secretary of State should direct United States embassies located in eligible sub-Saharan African countries to—</text>
 <subparagraph id="H9680B64AB3F94AE194FE9092FD4FFC0F"><enum>(A)</enum><text>encourage individuals and businesses in such countries to use the benefits available under the African Growth and Opportunity Act; and</text>
 </subparagraph><subparagraph id="HB61FD40316484CAD8C25D777EE3ED55D"><enum>(B)</enum><text display-inline="yes-display-inline">include a link to the AGOA Website on the websites of such diplomatic missions.</text> </subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HC2F61F772E1C4F5AA36628D603218AE3"><enum>(b)</enum><header>AGOA Forum</header><text display-inline="yes-display-inline">After each meeting of the United States–Sub-Saharan Africa Trade and Economic Cooperation Forum, the President should publish on the AGOA Website the following:</text>
 <paragraph id="HA5184C6419C54DF3BD7D7AC355400256"><enum>(1)</enum><text>The outcomes of the meeting of the Forum, including any commitments made by member countries and the private sector.</text>
 </paragraph><paragraph id="H3B076634A66B449CAA5F76FF0FA39566"><enum>(2)</enum><text display-inline="yes-display-inline">An assessment of progress made with respect to any commitments made by member countries and the private sector from the previous meeting of the Forum.</text>
 </paragraph></subsection><subsection id="H056909996F424576AA14F6AED747FE57"><enum>(c)</enum><header>Other information</header><text>The President should disseminate the information required under this section in a digital format to the public and publish such information on the AGOA Website.</text>
 </subsection></section><section id="HA3A747BF5251472FA01117FB37B8578D"><enum>104.</enum><header>Activities in support of trade capacity building</header><text display-inline="no-display-inline">The President should—</text> <paragraph id="H9BA40E0EF6F54735A3E6DC04E17F66DE"><enum>(1)</enum><text>develop and implement policies that—</text>
 <subparagraph id="HF559B3199AE146088A89444BE002758B"><enum>(A)</enum><text>encourage and facilitate cross-boundary cooperation among eligible sub-Saharan African countries in order to facilitate trade; and</text>
 </subparagraph><subparagraph id="H683EEC79E5674EEFA0D5DA946CE2C6FC"><enum>(B)</enum><text>encourage the provision of technical assistance to eligible sub-Saharan African countries to establish and sustain adequate trade capacity development;</text>
 </subparagraph></paragraph><paragraph id="H015E2B9C53004E41B7B3ACFA6FADC104"><enum>(2)</enum><text>provide specific training for businesses in eligible sub-Saharan African countries and government trade officials of such countries on accessing the benefits under the African Growth and Opportunity Act and other trade preference programs;</text>
 </paragraph><paragraph id="HF1D14D9507654643941FEBC04AF4423D"><enum>(3)</enum><text display-inline="yes-display-inline">provide capacity building for African entrepreneurs and trade associations on production strategies, quality standards, formation of cooperatives, market research, and market development;</text>
 </paragraph><paragraph id="H5DE306F51EBC4623855EB01040C8F069"><enum>(4)</enum><text>provide capacity building training to promote diversification of African products and value-added processing; and</text>
 </paragraph><paragraph id="H34481AC7080A4496BD1D299C69D6AC00"><enum>(5)</enum><text>provide capacity building and technical assistance funding for African businesses and institutions to help such businesses and institutions comply with United States counterterrorism initiatives and policies.</text>
				</paragraph></section></title><title id="HF752CC2E085F4059A2A44248AB5653FC"><enum>II</enum><header>Modernization of the Millennium Challenge Corporation</header>
			<section id="HBFC0749AB41A45188F98C51A9CD915B5"><enum>201.</enum><header>Candidacy status</header>
 <subsection id="H81AC8A3F92F244A09AFCF193AE30C3AC"><enum>(a)</enum><header>Low income countries</header><text display-inline="yes-display-inline">Section 606(a) of the Millennium Challenge Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/7705">22 U.S.C. 7705(a)</external-xref>) is amended—</text> <paragraph id="H6739355B3FE34A67908FCA0A176F200C"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>(3)</quote> and inserting <quote>(4)</quote>;</text>
 </paragraph><paragraph id="H450BB61ACCD44E2DB53D7941097B741D"><enum>(2)</enum><text>in paragraph (2)—</text> <subparagraph id="H2E29A865026A417184742BA18F790BE6"><enum>(A)</enum><text>by amending the paragraph heading to read as follows: <quote><header-in-text level="paragraph" style="OLC">Fiscal years 2005 through 2012</header-in-text></quote>; and</text>
 </subparagraph><subparagraph id="HD54DD12287324E4F96ED042C285E2858"><enum>(B)</enum><text>by striking <quote>fiscal year 2005 or a subsequent fiscal year</quote> and inserting <quote>each of fiscal years 2005 through 2012</quote>;</text> </subparagraph></paragraph><paragraph id="H15B947D7724944E6A17BE85A7DBE96A4"><enum>(3)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text>
 </paragraph><paragraph id="HB40F9A65DD2D4C7D85D16BFD6E65EB53"><enum>(4)</enum><text>by inserting after paragraph (2) the following:</text> <quoted-block display-inline="no-display-inline" id="H6C4078A83D554EC59411F8236B5A1487" style="OLC"> <paragraph id="H9DB204B14C6746C8A98944BA261A767F"><enum>(3)</enum><header>Fiscal year 2013 and subsequent fiscal years</header><text>A country shall be a candidate country for purposes of eligibility for assistance for fiscal year 2013 or a subsequent fiscal year if the country—</text>
 <subparagraph id="H6506C66971024AC5AFC9E60C720CFB35"><enum>(A)</enum><text>has a per capita income not greater than the lower middle income country threshold established by the International Bank for Reconstruction and Development for such fiscal year;</text>
 </subparagraph><subparagraph id="HF21BF4113FBD4CC280CA7BEBECE763C9"><enum>(B)</enum><text>is among the 75 countries identified by the International Bank for Reconstruction and Development as having the lowest per capita income; and</text>
 </subparagraph><subparagraph id="HC263768AE118402B87082DA556E65771"><enum>(C)</enum><text>meets the requirements under paragraph (1)(B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H18EF9B9F7B08497DB56F518AC7E95533"><enum>(b)</enum><header>Lower middle income countries</header><text>Section 606(b) of the Millennium Challenge Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/7705">22 U.S.C. 7705(b)</external-xref>) is amended—</text>
 <paragraph id="H04278D4E4B7B421CB1F0D0D65021F656"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="H43BF392FA1804A10994427605600CCAB"><enum>(A)</enum><text>by amending the paragraph heading to read as follows: <quote><header-in-text level="paragraph" style="OLC">Fiscal years 2006 through 2012</header-in-text></quote>; and</text>
 </subparagraph><subparagraph id="HC67204DAB91F4B44B02A5B126673ECEC"><enum>(B)</enum><text>in the matter preceding subparagraph (A), by striking <quote>fiscal year 2006 or a subsequent fiscal year</quote> and inserting <quote>fiscal years 2006 through 2012</quote>;</text> </subparagraph></paragraph><paragraph id="H4CFD8B5769FA4482B799C54099553C26"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text>
 </paragraph><paragraph id="HE99B13477D2749B39FF0E93890B7F455"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text> <quoted-block display-inline="no-display-inline" id="HFF3E3FEBFBEF490A9E8A58FB78A46872" style="OLC"> <paragraph id="H7401CE168FD74BFA895A0C5EB899BD7A"><enum>(2)</enum><header>Fiscal year 2013 and subsequent fiscal years</header><text>In addition to the countries described in subsection (a), a country shall be a candidate country for purposes of eligibility for assistance for fiscal year 2013 or a subsequent fiscal year if the country—</text>
 <subparagraph id="HCE570E1513A7432490FC4B0F97854BF3"><enum>(A)</enum><text>has a per capita income not greater than the lower middle income country threshold established by the International Bank for Reconstruction and Development for the fiscal year;</text>
 </subparagraph><subparagraph id="H945D59DCDCF74DF3A8255CD11361236B"><enum>(B)</enum><text>is not among the 75 countries identified by the International Bank for Reconstruction and Development as having the lowest per capita income; and</text>
 </subparagraph><subparagraph id="H822FDF6CDFDB412695811286D98B9CA6"><enum>(C)</enum><text>meets the requirements under subsection (a)(1)(B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="HD63147CB926A48A683FF7D6596B221BA"><enum>(c)</enum><header>Reclassification</header><text>Section 606 of the Millennium Challenge Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/7705">22 U.S.C. 7705</external-xref>) is amended—</text>
 <paragraph id="H759CEDB0B6184C768FD5349F0353C92C"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text> </paragraph><paragraph id="H9A128B5B8A5C4B22A078939882D5927C"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H51B29E13DA9A4C6FB155A3BE6E4B6442" style="OLC">
 <subsection id="H87CA2FFF9A534F009CD5C2CF7D1A317E"><enum>(c)</enum><header>Treatment of countries with per capita income changes</header><text>A country qualifying for candidate status under this section with a per capita income that changes during the fiscal year such that the country would be reclassified from a low income country to a lower middle income country or from a lower middle income country to a low income country shall retain its candidacy status in its former income classification for such fiscal year and the 2 subsequent fiscal years.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="HCF224699D9DF419A84582303AA0BCD21"><enum>202.</enum><header>Carryover authority for private-sector members of board of directors</header><text display-inline="no-display-inline">Section 604(c)(4)(B) of the Millennium Challenge Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/7703">22 U.S.C. 7703(c)(4)(B)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H7EF5442DEAA8427DAA7F559895DCB8E5" style="OLC">
 <subparagraph id="HA54C235812C54CB581D733A71C9FA585"><enum>(B)</enum><header>Other members</header><text>Each member of the Board described in paragraph (3)(B)—</text> <clause id="H8607862D584440139D7A5B670229BA87"><enum>(i)</enum><text>shall be appointed for a term of 3 years;</text>
 </clause><clause id="H646ADDF3BEE54796956A63A7C5F27ED9"><enum>(ii)</enum><text>may be reappointed for a term of an additional 2 years; and</text> </clause><clause id="H25BC821C7A094F5489B85CC846011AF3"><enum>(iii)</enum><text>may continue to serve in each such appointment until the earlier of—</text>
 <subclause id="H2EC53A14235B4D7DA5B8118E967530BC"><enum>(I)</enum><text>the date on which his or her successor is appointed; or</text> </subclause><subclause id="H5650BF2B52DE4F56A709EE53A0FA0CDA"><enum>(II)</enum><text>the date that is 1 year after the expiration of his or her appointment or reappointment, as the case may be.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HC05D5538910A40A1B0BEC0201F46E1B2"><enum>203.</enum><header>Additional reporting to the board on the treatment of civil society in an eligible country</header><text display-inline="no-display-inline">Section 607 of the Millennium Challenge Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/7706">22 U.S.C. 7706</external-xref>) is amended—</text> <paragraph id="H4AF76A72BF7E41C882E911E5C2581FB4"><enum>(1)</enum><text>in subsection (a), by adding at the end the following: <quote>A determination whether a country is eligible for a subsequent, non-concurrent Millennium Challenge Compact shall also be based, to the extent practicable, on significantly improved performance across the criteria in subsection (b) that, at a minimum, are relevant to the preceding Compact, compared to the country’s performance with respect to such criteria when selected for such preceding Compact.</quote> </text>
 </paragraph><paragraph id="H3066C4CCDFCA4F068EEB40A00F7BB9B6"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(1)—</text> <subparagraph id="HF023F224333044D88858EAA4E36C28BE"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text>
 </subparagraph><subparagraph id="H208E68C7CABE465C95C1FFA66C044669"><enum>(B)</enum><text>in subparagraph (E), by adding <quote>and</quote> at the end; and</text> </subparagraph><subparagraph id="H950ACCDFCAEF4AD4A8401BE9F52D047D"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H0A018AAE4A644E6BBAFDCAFD78E08A01" style="OLC">
 <subparagraph id="H6E102B0BACCA48DF955C9AE5CE6DDDDF"><enum>(F)</enum><text>the quality of the civil society enabling environment;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="HF29F938D3AB44BA0AB5740A9DBB4246C"><enum>(3)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text>
 </paragraph><paragraph id="H72B2ED40CFC5491B83D3277CAA3A4BB4"><enum>(4)</enum><text>by inserting after subsection (c) the following:</text> <quoted-block display-inline="no-display-inline" id="H4398829477E44600B65067C21E32DC8D" style="OLC"> <subsection id="HD1090206E3144F90A623C05CAC7354FE"><enum>(d)</enum><header>Reporting on treatment of civil society</header><text>For the 7-year period beginning on the date of the enactment of this subsection, before the Board selects an eligible country for a Compact under subsection (c), the Corporation shall provide information to the Board regarding the country’s treatment of civil society, including classified information, as appropriate. The information shall include an assessment and analysis of factors including—</text>
 <paragraph id="H3AEF53482C324331884F033E47667E82"><enum>(1)</enum><text>any relevant laws governing the formation or establishment of a civil society organization, particularly laws intended to curb the activities of foreign civil society organizations;</text>
 </paragraph><paragraph id="H2E11C873658D41C8B497B1D0F957D9C7"><enum>(2)</enum><text>any relevant laws governing the operations of a civil society organization, particularly those laws seeking to define or otherwise regulate the actions of foreign civil society organizations;</text>
 </paragraph><paragraph id="HD8B0365F9B59473BAF1045ECD0D834A8"><enum>(3)</enum><text>laws relating to the legal status of civil society organizations, including laws which effectively discriminate against foreign civil society organizations as compared to similarly situated domestic organizations;</text>
 </paragraph><paragraph id="HF798A43D15F74C33917C40B9B7F39BEA"><enum>(4)</enum><text>laws regulating the freedom of expression and peaceful assembly; and</text> </paragraph><paragraph id="H282CC9035E564DA48469ED4F8D6EBED0"><enum>(5)</enum><text>laws regulating the usage of the Internet, particularly by foreign civil society organizations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H357BCDD9295947A4B53CDECBA09DB3BC"><enum>204.</enum><header>Concurrent compacts under the Millennium Challenge Act of 2003</header>
 <subsection id="HE1A392A143BB4DC6A3402DFE86F863A5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 609 of the Millennium Challenge Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/7708">22 U.S.C. 7708</external-xref>) is amended—</text> <paragraph id="H6CFDF39890694A54BAD6DD77B8F9CE4D"><enum>(1)</enum><text>by striking the first sentence of subsection (k);</text>
 </paragraph><paragraph id="HF303AA675FF144A184A6F4F4F0C3C00C"><enum>(2)</enum><text>by redesignating subsection (k) (as so amended) as subsection (l); and</text> </paragraph><paragraph id="H0196C782AF20457B87E682961FE58FDA"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (j) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H42ECFAC0701443DAA6E7B72AC2DFFA75" style="OLC">
 <subsection commented="no" id="HAE0E1394AEE84B72ACC6C1EC0E7661CA"><enum>(k)</enum><header>Concurrent compacts</header><text display-inline="yes-display-inline">An eligible country that has entered into and has in effect a Compact under this section may enter into and have in effect at the same time not more than one additional Compact in accordance with the requirements of this title if—</text>
 <paragraph id="H8754C6673AD74E589F0803CE4943F05A"><enum>(1)</enum><text>one or both of the Compacts are or will be for purposes of regional economic integration, increased regional trade, or cross-border collaborations; and</text>
 </paragraph><paragraph id="HF79594732D514991A78D5C6E044CEF9A"><enum>(2)</enum><text>the Board determines that the country is making considerable and demonstrable progress in implementing the terms of the existing Compact and supplementary agreements thereto.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H28FA61F3F59A4C35BE6E0984B08A932E"><enum>(b)</enum><header>Conforming amendment</header><text>Section 613(b)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/7712">22 U.S.C. 7712(b)(2)(A)</external-xref>) is amended by striking <quote>the</quote> before <quote>Compact</quote> and inserting <quote>any</quote>.</text> </subsection><subsection id="H32BF29CB7B8142929A90602081542225"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section apply with respect to Compacts entered into between the United States and an eligible country under the Millennium Challenge Act of 2003 before, on, or after the date of the enactment of this Act.</text>
 </subsection></section><section id="HF1B437A870C54BFA927DD0B27F2154BB"><enum>205.</enum><header>Public notification of entering into a compact</header><text display-inline="no-display-inline">Section 610 of the Millennium Challenge Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/7709">22 U.S.C. 7709</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HC6F3B71006B74040A8D69203727FD751" style="OLC"> <section id="HDC25651DB66040C68ED8B04E59C5982C"><enum>610.</enum><header>Congressional and public notification</header> <subsection id="HE3CF584597E1497D92BD7FF681A3B40A"><enum>(a)</enum><header>Congressional consultations and notifications</header> <paragraph id="H0E924D2AC222407F8026F5C33043F371"><enum>(1)</enum><header>In general</header><text>The Board, acting through the Chief Executive Officer, shall consult with and notify the appropriate congressional committees not later than 15 days before taking any of the actions described in paragraph (2).</text>
 </paragraph><paragraph id="H92044FE24F294588B84CDC407D4A2664"><enum>(2)</enum><header>Actions described</header><text>The actions described in this paragraph are—</text> <subparagraph id="HA12689D1674E45F085F7F5AED68D4631"><enum>(A)</enum><text>providing assistance for an eligible country under section 609(g);</text>
 </subparagraph><subparagraph id="H9D12F3ECA8604605B41672A6D49364AF"><enum>(B)</enum><text>commencing negotiations with an eligible country to provide assistance for—</text> <clause id="H54C40E440608442589E1D899D37E04C1"><enum>(i)</enum><text>a Compact under section 605; or</text>
 </clause><clause id="HDD4AB1787ACE467EB92F9B9BC324BB1F"><enum>(ii)</enum><text>an agreement under section 616;</text> </clause></subparagraph><subparagraph id="H950CD400BC27470088EEB9E7A4439E40"><enum>(C)</enum><text>signing such a Compact or agreement; and</text>
 </subparagraph><subparagraph id="H5C5EA2EA8635459D876574BE82303C1D"><enum>(D)</enum><text>terminating assistance under such a Compact or agreement.</text> </subparagraph></paragraph><paragraph id="H3F34F642243042119930AC0CFBE42E69"><enum>(3)</enum><header>Economic justification</header><text>Any notification relating to the intent to negotiate or sign a Compact shall include a report describing the projected economic justification for the Compact, including, as applicable—</text>
 <subparagraph id="H7703471984184B9A8DA8ACB012448D0C"><enum>(A)</enum><text>the expected economic rate of return of the Compact;</text> </subparagraph><subparagraph id="HDD43FBE8691A49D68339C9965F5D800B"><enum>(B)</enum><text>a cost-benefit analysis of the Compact;</text>
 </subparagraph><subparagraph id="H6BF3A7BC725E4D2780124753B59B3645"><enum>(C)</enum><text>a description of the impact on beneficiary populations;</text> </subparagraph><subparagraph id="HA0239023186D40358348023949893B5D"><enum>(D)</enum><text>the likelihood that the investment will catalyze private sector investments; and</text>
 </subparagraph><subparagraph id="H42B3751AF982487380A50CA9D6985C0B"><enum>(E)</enum><text>any other applicable economic factors that justify each project to be funded under such a Compact to the extent practicable and appropriate.</text>
 </subparagraph></paragraph><paragraph id="H64E145E23874490F92E06FF4572E1D4F"><enum>(4)</enum><header>Risk management plan</header><text>Not later than 60 days before signing each concurrent Compact, as authorized under section 609, the Board, acting through the Chief Executive Officer, shall consult with and provide to the appropriate congressional committees—</text>
 <subparagraph id="H582D2B7E58CA44C98A1F0A972C1410B3"><enum>(A)</enum><text>an assessment and, as appropriate, the identification of potential measures to mitigate risks, of—</text> <clause id="HCC3C71C28E9441A3BEB681EC1D213B00"><enum>(i)</enum><text>the countries’ commitment to regional integration and cross-border cooperation and capacity to carry out commitments;</text>
 </clause><clause id="H6F3BC1632C2D452F8155A1E661319072"><enum>(ii)</enum><text>political and policy risks, including risks that could affect country eligibility;</text> </clause><clause id="H41C301ADE9D94F788596F12656F5F43C"><enum>(iii)</enum><text>risks associated with realizing economic returns;</text>
 </clause><clause id="H60E49AE9EA15467C8BC3327ECE67DB2A"><enum>(iv)</enum><text>time and completion risks; and</text> </clause><clause id="HA66A481F672248C69FC6415B1FC4F8CD"><enum>(v)</enum><text>cost and financial risks; and</text>
 </clause></subparagraph><subparagraph id="HE221B744C85848E4AEC9D9868795E738"><enum>(B)</enum><text>an assessment of measures to be taken to mitigate any identified risks, including—</text> <clause id="H1C4BCB47A04245EE968AAC371CD93F3A"><enum>(i)</enum><text>securing other potential donors to finance projects or parts of projects as needed; and</text>
 </clause><clause id="H88F33846BD4B4F2FB3F1C9159FE399FD"><enum>(ii)</enum><text>partnering with regional organizations to support and oversee effective cross-border cooperation.</text> </clause></subparagraph></paragraph></subsection><subsection id="H558B9CB141EB4B22BD895B675F612ADC"><enum>(b)</enum><header>Congressional and public notification after entering into a compact</header><text>Not later than 10 days after entering into a Compact with an eligible country, the Board, acting through the Chief Executive Officer, shall—</text>
 <paragraph id="H121B76C23419438DB3C5E3EBB51C9AE8"><enum>(1)</enum><text>publish the text of the Compact on the website of the Corporation;</text> </paragraph><paragraph id="H2819D2810F3248A5A153D39565C7A2B7"><enum>(2)</enum><text>provide the appropriate congressional committees with a detailed summary of the Compact and, upon request, the text of the Compact; and</text>
 </paragraph><paragraph id="H8AD763F2A4974FB6A7951FD5EDC50FCA"><enum>(3)</enum><text>publish in the Federal Register a detailed summary of the Compact and a notice of availability of the text of the Compact on the website of the Corporation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HCF6D4EE398A34768B6CD29700B18A3BC"><enum>206.</enum><header>Disclosure</header>
 <subsection id="H5F225F752E734B3BA0FA81CD9C2BDAA3"><enum>(a)</enum><header>Requirement for timely disclosure</header><text>Section 612(a) of the Millennium Challenge Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/7711">22 U.S.C. 7711(a)</external-xref>) is amended—</text> <paragraph id="H63F29D0B6D1C495AB9B909E176A1B3B2"><enum>(1)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">timely</header-in-text></quote> before <quote><header-in-text level="subsection" style="OLC">disclosure</header-in-text></quote>; and</text>
 </paragraph><paragraph id="H4E3300A519304459AC551E881657F7EE"><enum>(2)</enum><text>in the matter preceding paragraph (1)—</text> <subparagraph id="H2CCC56463739439AB334665E12D62BBA"><enum>(A)</enum><text>by striking <quote>The Corporation</quote> and inserting <quote>Not later than 90 days after the last day of each fiscal quarter, the Corporation</quote>; and</text>
 </subparagraph><subparagraph id="H1CD5DCF2809742F1A4F1A37D2608AE2E"><enum>(B)</enum><text>by striking <quote>on at least a quarterly basis,</quote>.</text> </subparagraph></paragraph></subsection><subsection id="H802D46D806BC46DEAAEE3615B4B93A96"><enum>(b)</enum><header>Dissemination</header><text>Section 612(b) of the Millennium Challenge Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/7711">22 U.S.C. 7711(b)</external-xref>) is amended to read as follows:</text>

 <subsection id="H08A2C94EE57A4B55BC738D5AFFBEDF3A"><enum>(b)</enum><header>Dissemination</header><text>The Board, acting through the Chief Executive Officer, shall make the information required to be disclosed under subsection (a) available to the public—</text>
 <paragraph id="HF85BB46E4F794F12AB5B49978CBEB2E8"><enum>(1)</enum><text>by publishing it on the website of the Corporation;</text> </paragraph><paragraph id="HAD4ACF18E1924940A40B668DB9079A39"><enum>(2)</enum><text>by providing notice of the availability of such information in the Federal Register; and</text>
 </paragraph><paragraph id="HBB9F1B8C39D4427AAD1EA4A90D565670"><enum>(3)</enum><text>by any other methods that the Board determines to be appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section id="H2CC94E46BF1748CFB64262368B5BA5C0"><enum>207.</enum><header>Restriction on the use of assistance under section 616</header><text display-inline="no-display-inline">Section 616(d) of the Millennium Challenge Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/7715">22 U.S.C. 7715(d)</external-xref>) is amended to read as follows:</text>

					<subsection id="HA83591346F204BC99725DB6BA47994A9"><enum>(d)</enum><header>Funding</header>
 <paragraph id="H8648D3BEEC6646DBAF7563253E72C4D7"><enum>(1)</enum><header>Limitation</header><text display-inline="yes-display-inline">Not more than 10 percent of the amounts made available to carry out this Act for a fiscal year may be made available to carry out this section.</text>
 </paragraph><paragraph id="H2B26EBF98FF447F1AF6A818719167CBD"><enum>(2)</enum><header>Restriction relating to assistance</header><text>None of the funds authorized to carry out the purposes of this Act shall be available for assistance under this section to a country that does not qualify as a candidate country under section 606 for the fiscal year during which such assistance is provided.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H55C57A5B0A3C48C9A0F01FAE13B755B8"><enum>208.</enum><header>Study on subnational compacts</header>
 <subsection id="HA21D338994EF4084A7C37C460E44CE7F"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Board of the Millennium Challenge Corporation, acting through the Chief Executive Officer, shall submit a study to the appropriate congressional committees that assesses the feasibility and desirability of developing partnerships at the subnational level within candidate countries that would be complementary to, and, as applicable, concurrent with, any Millennium Challenge Corporation national-level or regional investments.</text>
 </subsection><subsection id="HC935CF723CAA4743AF48FC858B5898B8"><enum>(b)</enum><header>Content</header><text>The study required under subsection (a) shall examine—</text> <paragraph id="HC25C93186F4942738110C2642F1AB4C7"><enum>(1)</enum><text>the extent to which targeting investments at the subnational level might provide new opportunities for reducing poverty through economic growth;</text>
 </paragraph><paragraph id="H270A1BAF543540C89240CB7218401C9C"><enum>(2)</enum><text>the extent to which traditional approaches to defining poverty may not adequately capture the nature of poverty within a country;</text>
 </paragraph><paragraph id="H666478F1EBB94E5C89D4DB0585C0E6D6"><enum>(3)</enum><text>the types of subnational entities that might be appropriate partners for subnational Millennium Challenge Corporation compacts;</text>
 </paragraph><paragraph id="HE392A0F00CF84480AA4C72936035063B"><enum>(4)</enum><text>how candidates for subnational partners might best be identified; and</text> </paragraph><paragraph id="H0105DDCFD8DE4FBF8F0149F10E15F4E0"><enum>(5)</enum><text>what role each national government should play in creating or implementing a subnational partnership.</text>
 </paragraph></subsection><subsection id="H71390EE6E6344FB39D84D3C226973C73"><enum>(c)</enum><header>Appropriate congressional committees</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text> <paragraph id="H8ED68D838CBC489E86DBF3C4A0808169"><enum>(1)</enum><text>the <committee-name committee-id="">Committee on Foreign Relations of the Senate</committee-name>;</text>
 </paragraph><paragraph id="H62D68A9E989C42C4ACB06A728F03AB77"><enum>(2)</enum><text>the <committee-name committee-id="">Committee on Appropriations of the Senate</committee-name>;</text> </paragraph><paragraph id="H77722AEC83314B6C8A254466432C8FC5"><enum>(3)</enum><text>the <committee-name committee-id="HFA00">Committee on Foreign Affairs of the House of Representatives</committee-name>; and</text>
