		<official-title display="yes">To impose sanctions against Hamas for violating universally applicable international laws of armed
			 conflict by intentionally using civilians and civilian property to shield
			 military objectives from lawful attack, and for other purposes.</official-title>

	<legis-body id="HEC286F21C2CF40B7B443865DA1D211C2" style="OLC"><pagebreak></pagebreak>
 <section id="H2643565CB5824E9AB5C4CE5CA9BFB31A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hamas Human Shields Prevention Act</short-title></quote>.</text> </section><section id="H23F451CB621D47B088E89C80CCDF8B82"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
 <paragraph id="H55D39379218A47DDA985602A6F1571D4"><enum>(1)</enum><text display-inline="yes-display-inline">The international law of armed conflict prohibits, during any armed conflict, the exploitation of the presence of civilians, or movement of civilians, in an effort to impede attack on or otherwise shield lawful targets from attack.</text>
 </paragraph><paragraph id="HCBF041C35F66424B9573E23244391B2A"><enum>(2)</enum><text display-inline="yes-display-inline">Violation of this obligation is commonly referred to as using persons as <quote>human shields</quote>, the unlawful exploitation of civilian persons or property in an attempt to impede attack on or otherwise shield lawful targets from attack.</text>
 </paragraph><paragraph id="H25B75592494941649BB2F557AE622C32"><enum>(3)</enum><text display-inline="yes-display-inline">The international law of armed conflict also prohibits exposing prisoners of war, other detainees, or the wounded and sick to unnecessary risks resulting from the conduct of hostilities, which clearly includes a prohibition against using such personnel in an effort to impede attack on or otherwise shield lawful targets from attack.</text>
 </paragraph><paragraph id="HDFD7DEF06BA143E6A535A06C98723CE7"><enum>(4)</enum><text display-inline="yes-display-inline">Under the international law of armed conflict, the use of human shields is a critical consideration when assessing whether infliction of civilian harm by a party to the conflict was in fact unreasonable under the circumstances.</text>
 </paragraph><paragraph id="H95C5FF09BC5B4370B672AB4729EA682F"><enum>(5)</enum><text display-inline="yes-display-inline">Throughout the violent takeover of Gaza by Hamas in 2007, the organization engaged in summary executions and torture, and put the lives of civilians at constant risk.</text>
 </paragraph><paragraph id="H521A0C6DEC0249098F36DED808805A77"><enum>(6)</enum><text display-inline="yes-display-inline">Since that 2007 takeover of Gaza, Hamas forces have repeatedly fired rockets into Israel in an indiscriminate manner, routinely striking civilian population areas that cannot plausibly be considered lawful military targets.</text>
 </paragraph><paragraph id="HA5F4A0B21AD244B3AF14D279A3DDCAE8"><enum>(7)</enum><text display-inline="yes-display-inline">Hamas attacks are routinely launched from firing positions in areas of dense civilian population, often in or near schools, mosques, or hospitals, with no plausible justification based on military necessity.</text>
 </paragraph><paragraph id="HA3C39AC919494041BF2FC68EC854C303"><enum>(8)</enum><text display-inline="yes-display-inline">Unlawful Hamas tactics also include routinely forcing Palestinian civilians to gather on the roofs of their homes to act as human shields.</text>
 </paragraph><paragraph id="H1E35B23BA4D4483D838B55700590CEF5"><enum>(9)</enum><text display-inline="yes-display-inline">Because these Hamas tactics cannot be justified by military necessity, they indicate an effort to endanger both Israeli and Palestinian civilians.</text>
 </paragraph><paragraph id="H1A51FED020894EF08F937E769FC89E08"><enum>(10)</enum><text display-inline="yes-display-inline">The Israel Defense Force, in response to such serious violations by Hamas, has vigorously taken all feasible precautions to minimize civilian casualties and protect civilian objects, in accordance with the international laws of armed conflict. Such tactics have included providing warnings to civilians when feasible.</text>
 </paragraph><paragraph id="H44E7D91E834F4678AAFBEF5B5F00FC48"><enum>(11)</enum><text display-inline="yes-display-inline">Since 2010, Hamas has enlisted children to work as laborers in the tunnel networks between Gaza and Egypt.</text>
 </paragraph><paragraph id="HAD430A6AECE145508D3A3BDBCB576743"><enum>(12)</enum><text display-inline="yes-display-inline">On June 9, 2017, the United Nations Relief and Works Agency announced it had discovered Hamas tunnels under two of its schools in the Gaza Strip, adding it was <quote>unacceptable that students and staff are placed at risk in such a way</quote>.</text>
 </paragraph><paragraph id="H4D719C8C36804F79B18C12538580B59D"><enum>(13)</enum><text display-inline="yes-display-inline">Hamas was designated as a foreign terrorist organization by the Secretary of State on October 8, 1997.</text>
 </paragraph><paragraph id="HB129EB262C024513915BD054BB7BA2DD"><enum>(14)</enum><text display-inline="yes-display-inline">In addition to Hamas, other armed groups, such as Hezbollah, the Islamic State, al-Qa'ida, and al-Shabaab, typically use civilians as human shields.</text>
 </paragraph></section><section id="HACE09005C21A4ABF81A8285648964172"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It shall be the policy of the United States to—</text> <paragraph id="HE29ECE1B06194BCE8B60966D927B1F21"><enum>(1)</enum><text display-inline="yes-display-inline">officially and publicly condemn Hamas for violating the international law of armed conflict by exploiting civilians, civilian property, and other specially protected personnel and facilities, in an effort to shield military targets from lawful attack; and</text>
 </paragraph><paragraph id="H59D60C414C5547A994DF13477517B833"><enum>(2)</enum><text>take effective action against those knowingly engaging in, supporting, facilitating, or enabling such undisputed violations of international law through the use of human shields.</text>
 </paragraph></section><section id="H2B3DC1ABB0A84B65914EE1B5A67A0955"><enum>4.</enum><header>United Nations Security Council</header><text display-inline="no-display-inline">The President should direct the United States Permanent Representative to the United Nations to use the voice, vote, and influence of the United States at the United Nations Security Council to secure support for a resolution that would—</text>
 <paragraph id="H22CE9233571A4606B9DE4782382D24FF"><enum>(1)</enum><text>impose multilateral sanctions against Hamas for the use of human shields;</text> </paragraph><paragraph id="H32A40DAC2C9546DDAEB750CE372F0FFE"><enum>(2)</enum><text display-inline="yes-display-inline">require member nations to take specific steps to prevent the use of human shields and impose consequences on those who use human shields;</text>
 </paragraph><paragraph id="H409F5D3BCD8E4FA38E9E374EF4C761A5"><enum>(3)</enum><text>require the United Nations to track and report the use of human shields in any conflict monitored by an organization or agency of the United Nations; and</text>
 </paragraph><paragraph id="HC7CC88EC12C44CB7836F70CA192232B3"><enum>(4)</enum><text display-inline="yes-display-inline">specify steps to prevent, and consequences for, the use of United Nations employees as human shields or the use of United Nations facilities or infrastructure to enable the use of civilians as human shields.</text>
			</paragraph></section><section id="HEAE77E150FD248D58A4FBD58DCBF60C6"><enum>5.</enum><header>Sanctions on foreign persons responsible for gross violations of internationally recognized human
			 rights</header>
 <subsection id="H732D192D1C664AD99B81CBE7F0228687"><enum>(a)</enum><header>In general</header><text>The President shall impose sanctions described in <internal-xref idref="H6A6F65405D874B97A55FB7322F25350B" legis-path="5.(c)">subsection (c)</internal-xref> with respect to each person on the list required under <internal-xref idref="H5E1ECA06AEBC484A8102A39EC5B666C2" legis-path="5.(b)">subsection (b)</internal-xref>.</text> </subsection><subsection id="H5E1ECA06AEBC484A8102A39EC5B666C2"><enum>(b)</enum><header>List</header> <paragraph id="HD02A0649D8B644C498C220C045DF44E6"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall transmit to the appropriate congressional committees a list of the following:</text>
 <subparagraph id="HA334B25CD5B84E1D89C6CB8F321341CE"><enum>(A)</enum><text>Each foreign person that the President determines—</text> <clause id="H6ED8A1A382D8444FBC1E6EBFE3E5CD0B"><enum>(i)</enum><text>is a member of Hamas or is acting on behalf of Hamas; and</text>
 </clause><clause id="H91B29551287542E1B0694FAD381A57C5"><enum>(ii)</enum><text display-inline="yes-display-inline">on or after the date of the enactment of this Act, knowingly orders, controls, or otherwise directs or is complicit in, any unlawful attempt to use civilians, civilian property, or other protected persons to shields military objectives from lawful attack.</text>
 </clause></subparagraph><subparagraph id="HBD8A9D45991C4F71A91E0FCB64D060E1"><enum>(B)</enum><text>Each foreign person, or each agency or instrumentality of a foreign state, that the President determines has knowingly, on or after the date of the enactment of this Act—</text>
 <clause id="H1C5A39A5E2414D7C807AC3D86BDD009B"><enum>(i)</enum><text display-inline="yes-display-inline">significantly facilitated, directly or indirectly, any act described in <internal-xref idref="H91B29551287542E1B0694FAD381A57C5" legis-path="5.(b)(1)(A)(ii)">subparagraph (A)(ii)</internal-xref> by a person described in <internal-xref idref="H91B29551287542E1B0694FAD381A57C5" legis-path="5.(b)(1)(A)(ii)">subparagraph (A)(ii)</internal-xref>; or</text> </clause><clause id="H878E4BBCD8F544CF849A57AC7E0CFF46"><enum>(ii)</enum><text>attempted to facilitate or support any such person.</text>
 </clause></subparagraph></paragraph><paragraph id="HDD04CA697D7B4F9B88A0DE00C902E93C"><enum>(2)</enum><header>Updates</header><text>The President shall transmit to the appropriate congressional committees an update of the list required under <internal-xref idref="HD02A0649D8B644C498C220C045DF44E6" legis-path="5.(b)(1)">paragraph (1)</internal-xref>—</text>
 <subparagraph id="H6E73F140A6CC4171A3F1858F06321205"><enum>(A)</enum><text>not later than 1 year after the date of transmission of such list, and annually thereafter for 3 years; and</text>
 </subparagraph><subparagraph id="HE7276C2AE9D8442285D30F4F9124BC5C"><enum>(B)</enum><text>as new information becomes available.</text> </subparagraph></paragraph></subsection><subsection id="H6A6F65405D874B97A55FB7322F25350B"><enum>(c)</enum><header>Sanctions described</header><text>The sanctions to be imposed on a foreign person or an agency or instrumentality of a foreign state on the list required under <internal-xref idref="H5E1ECA06AEBC484A8102A39EC5B666C2" legis-path="5.(b)">subsection (b)</internal-xref> are the following:</text>
 <paragraph id="H336BA5A2A59346EE85FE3DBC6ABB2A2D"><enum>(1)</enum><header>Blocking of property</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) to the extent necessary to block and prohibit all transactions in property and interests in property of the foreign person or of such agency or instrumentality of a foreign state if such property or interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text>
				</paragraph><paragraph id="HE3CC63DDFFF24BEB85C66A378C22389C"><enum>(2)</enum><header>Aliens ineligible for visas, admission, or parole</header>
 <subparagraph id="H679A5F087CF34FF0AAF90A6ADDBAD9B9"><enum>(A)</enum><header>Visas, admission, or parole</header><text>An alien who the Secretary of State or the Secretary of Homeland Security (or a designee of either such Secretary) determines is a foreign person on the list required under <internal-xref idref="H5E1ECA06AEBC484A8102A39EC5B666C2" legis-path="5.(b)">subsection (b)</internal-xref> is—</text>
 <clause id="H62FF1E2DCFD84879B25446D5E28C5452"><enum>(i)</enum><text>inadmissible to the United States;</text> </clause><clause id="H587DDA823BFB452CB014998F8B87162A"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text>
 </clause><clause id="HEE39A7ED657C4F29A447B1FF71DABCC6"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text>
						</clause></subparagraph><subparagraph id="HF398C474928447DB82B580C9B90CF0FD"><enum>(B)</enum><header>Current visas revoked</header>
 <clause id="H46A80077AB644932970DC9270C2513E6"><enum>(i)</enum><header>In general</header><text>Any visa or other documentation issued to an alien who is a foreign person on the list required under <internal-xref idref="H5E1ECA06AEBC484A8102A39EC5B666C2" legis-path="5.(b)">subsection (b)</internal-xref>, regardless of when such visa or other documentation was issued, shall be revoked and such alien shall be denied admission to the United States.</text>
 </clause><clause id="H882CDAE2566F43F4A29064126E2D9D5A"><enum>(ii)</enum><header>Effect of revocation</header><text>A revocation under <internal-xref idref="H46A80077AB644932970DC9270C2513E6" legis-path="5.(c)(2)(B)(i)">clause (i)</internal-xref>—</text> <subclause id="H1B51E950035642BCAF40D599CC599177"><enum>(I)</enum><text>shall take effect immediately; and</text>
 </subclause><subclause id="H3452D369C7D54CE792CD6B8DE58B38BA"><enum>(II)</enum><text>shall automatically cancel any other valid visa or documentation that is in the possession of the alien who is the subject of such revocation.</text>
 </subclause></clause></subparagraph><subparagraph id="H16C6E7AC6AF7469DAA91125B44AD4634"><enum>(C)</enum><header>Exception to comply with United Nations headquarters agreement</header><text display-inline="yes-display-inline">The sanctions under this paragraph shall not be imposed on an individual if admitting such individual to the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or with other applicable international agreements.</text>
 </subparagraph></paragraph></subsection><subsection id="HD3FBA9CD86AC4411A38082CEFF0248E9"><enum>(d)</enum><header>Waiver</header><text>The President may, on a case-by-case basis, waive the application of a sanction under this section with respect to a person or an agency or instrumentality of a foreign state for periods not longer than 180 days if the President certifies to the appropriate congressional committees that such waiver is in the national security interest of the United States.</text>
 </subsection><subsection id="HD56B9C41C9FE461288BD6A17A31A2D77"><enum>(e)</enum><header>Penalties</header><text display-inline="yes-display-inline">The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to any person that violates, attempts to violate, conspires to violate, or causes a violation of any regulation promulgated to carry out this section to the same extent that such penalties apply to a person that commits an unlawful act described in section 206(a) of such Act.</text>
			</subsection><subsection id="HAEBD1D36EC744FC894AF2474970BBE62"><enum>(f)</enum><header>Regulations</header>
 <paragraph id="HE018724CB6EF4D0EA55497F6F15CD378"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President may exercise all authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) for purposes of carrying out this section.</text>
 </paragraph><paragraph id="H54F4AC3B63B64C93B303080BBF6E1355"><enum>(2)</enum><header>Issuance of regulations</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall prescribe such regulations as may be necessary to implement this section.</text>
 </paragraph></subsection><subsection id="H5F41D28FA15746C1ADA0105E1B1C3B72"><enum>(g)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed—</text> <paragraph id="H28CADB92A16447AA8581F2B33D6C35CC"><enum>(1)</enum><text>to limit the authorities of the President pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) or any other relevant provision of law; or</text>
 </paragraph><paragraph id="H384F922D85964DDC960AFBE934CBB1F5"><enum>(2)</enum><text display-inline="yes-display-inline">to apply with respect to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091</external-xref> et seq.), or to any authorized intelligence activities of the United States.</text>
				</paragraph></subsection></section><section id="H0803AB9D79EE40BAA409374ADA04584F"><enum>6.</enum><header>Definitions</header>
 <text display-inline="no-display-inline">In this Act:</text> <paragraph id="H67164C40289D4A119F0A24094B2F2764"><enum>(1)</enum><header>Admitted; alien</header><text display-inline="yes-display-inline">The terms <term>admitted</term> and <term>alien</term> have the meanings given such terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text>
 </paragraph><paragraph id="H77CFCAAAE60F4437AFF320ADC411E440"><enum>(2)</enum><header>Agency or instrumentality of a foreign state</header><text display-inline="yes-display-inline">The term <term>agency or instrumentality of a foreign state</term> has the meaning given such term in section 1603(b) of title 28, United States Code.</text> </paragraph><paragraph id="H7ECB3B65E6934AC6800585FE4FAC0C6A"><enum>(3)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text>
 <subparagraph id="H426C508C10744665AF14A5CBBB686934"><enum>(A)</enum><text>the Committee on Financial Services, the Committee on Ways and Means, the Committee on the Judiciary and the Committee on Foreign Affairs of the House of Representatives; and</text>
 </subparagraph><subparagraph id="H0B3AEBF749E94942B9F16C7DD14F08CF"><enum>(B)</enum><text>the Committee on Banking, Housing, and Urban Affairs, the Committee on the Judiciary, and the Committee on Foreign Relations of the Senate.</text>
 </subparagraph></paragraph><paragraph id="H05D556AEB1964013B86EB8B85AE63DF6"><enum>(4)</enum><header>Foreign person</header><text display-inline="yes-display-inline">The term <term>foreign person</term> has the meaning given such term in section 594.304 of title 31, Code of Federal Regulations, as in effect on the date of the enactment of this Act.</text>
 </paragraph><paragraph id="HA25CDA6420684F048B48509114ED531F"><enum>(5)</enum><header>Hamas</header><text>The term <term>Hamas</term> means—</text> <subparagraph id="H92839F53279347F894A038373BF66D1F"><enum>(A)</enum><text>the entity known as Hamas and designated by the Secretary of State as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>); or</text>
 </subparagraph><subparagraph id="HFB0BE658B5634E6B9464F554B0384A3D"><enum>(B)</enum><text display-inline="yes-display-inline">any person identified as an agent, instrumentality, or affiliate of Hamas on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Asset Control of the Department of Treasury, the property or interests in property of which are blocked pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.).</text>
 </subparagraph></paragraph><paragraph id="HDF60F2C6015A467AADC24278E4BAA012"><enum>(6)</enum><header>United States person</header><text display-inline="yes-display-inline">The term <term>United States person</term> has the meaning given such term in section 594.315 of title 31, Code of Federal Regulations, as in effect on the date of the enactment of this Act.</text>
			</paragraph></section></legis-body>
