 <section commented="no" display-inline="no-display-inline" id="H5660547B1BA54197818F9D099B574A5F" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recognize, Assist, Include, Support, and Engage Family Caregivers Act of 2017</short-title></quote> or the <quote><short-title>RAISE Family Caregivers Act</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="H543AE152FB314398918A2409A1709634" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HC997D59DB1F249E88444B474DAE7BD17"><enum>(1)</enum><header display-inline="yes-display-inline">Advisory Council</header><text display-inline="yes-display-inline">The term <term>Advisory Council</term> means the Family Caregiving Advisory Council convened under section 4.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9FD88F43BEA04264821A6CA28A2BF9FB"><enum>(2)</enum><header display-inline="yes-display-inline">Family caregiver</header><text display-inline="yes-display-inline">The term <term>family caregiver</term> means an adult family member or other individual who has a significant relationship with, and who provides a broad range of assistance to, an individual with a chronic or other health condition, disability, or functional limitation.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7F752453ECE1491A88618C38321511B1"><enum>(3)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Health and Human Services.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF5B15E54F8574F2282D0F74C54D46F2C"><enum>(4)</enum><header display-inline="yes-display-inline">Strategy</header><text display-inline="yes-display-inline">The term <term>Strategy</term> means the Family Caregiving Strategy set forth under section 3.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HA64E6905886F494F8E78CAAAA2B33386" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Family Caregiving Strategy</header>
 <subsection commented="no" display-inline="no-display-inline" id="H748637E103B54A57AB80E5344DB4B9FD"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the heads of other appropriate Federal agencies, and acting jointly with the Advisory Council, shall develop and submit to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, the Committee on Education and the Workforce of the House of Representatives, and the State agencies responsible for carrying out family caregiver programs, and make publicly available on the internet website of the Department of Health and Human Services, a Family Caregiving Strategy.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H017014A633AE4F4AB8A46DF520C6685D"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The Strategy shall identify recommended actions that Federal (under existing Federal programs), State, and local governments, communities, health care providers, long-term services and supports providers, and others are taking, or may take, to recognize and support family caregivers in a manner that reflects their diverse needs, including with respect to the following:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HD7EEE173703241598E26671D8DE64476"><enum>(1)</enum><text display-inline="yes-display-inline">Promoting greater adoption of person- and family-centered care in all health and long-term services and supports settings, with the person receiving services and supports and the family caregiver (as appropriate) at the center of care teams.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD62DCE0820564D28944B6C0D7471EE91"><enum>(2)</enum><text display-inline="yes-display-inline">Assessment and service planning (including care transitions and coordination) involving family caregivers and care recipients.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H224135D7A9384D20B1F62D76E029947D"><enum>(3)</enum><text display-inline="yes-display-inline">Information, education and training supports, referral, and care coordination, including with respect to hospice care, palliative care, and advance planning services.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3C379F90917E4BFABF716C5131F3A995"><enum>(4)</enum><text display-inline="yes-display-inline">Respite options.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC966A876131E4E09A3168A511BC649B6"><enum>(5)</enum><text display-inline="yes-display-inline">Financial security and workplace issues.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE82052A98C4246E8B64190BF52941642"><enum>(6)</enum><text display-inline="yes-display-inline">Delivering services based on the performance, mission, and purpose of a program while eliminating redundancies.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1511D8B1BE5345FDA35F46C7E1AFB8D4"><enum>(c)</enum><header display-inline="yes-display-inline">Duties of the Secretary</header><text display-inline="yes-display-inline">The Secretary, in carrying out subsection (a), shall oversee the following:</text> <paragraph commented="no" display-inline="no-display-inline" id="H989917CB2DAF41F3963E3719E88B5DE6"><enum>(1)</enum><text display-inline="yes-display-inline">Collecting and making publicly available information, submitted by the Advisory Council under section 4(d), including evidence-based or promising practices and innovative models (both domestic and foreign) regarding the provision of care by family caregivers or support for family caregivers.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4F229C6EA326426790828B24E4444D68"><enum>(2)</enum><text display-inline="yes-display-inline">Coordinating and assessing existing Federal Government programs and activities to recognize and support family caregivers while ensuring maximum effectiveness and avoiding unnecessary duplication.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H723C03ABC3874DEF9F37D65FFAC68926"><enum>(3)</enum><text display-inline="yes-display-inline">Providing technical assistance, as appropriate, such as disseminating identified best practices and information sharing based on reports provided under section 4(d), to State or local efforts to support family caregivers.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0547EDB896784CDEB8FD66C4B3AD38E4"><enum>(d)</enum><header display-inline="yes-display-inline">Initial strategy; updates</header><text display-inline="yes-display-inline">The Secretary shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="H32DE1724F86745E8929FE39649A7C899"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 18 months after the date of enactment of this Act, develop, publish, and submit to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, the Committee on Education and the Workforce of the House of Representatives, and the State agencies responsible for carrying out family caregiver programs, an initial Strategy incorporating the items addressed in the Advisory Council's initial report under section 4(d) and other relevant information, including best practices, for recognizing and supporting family caregivers; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDDA1FE32900D4639A0B7AF042BFF36E4"><enum>(2)</enum><text display-inline="yes-display-inline">biennially update, republish, and submit to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, the Committee on Education and the Workforce of the House of Representatives, and the State agencies responsible for carrying out family caregiver programs, the Strategy, taking into account the most recent annual report submitted under section 4(d)(1)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H96496FCC66D74E1D893088B89150D555"><enum>(A)</enum><text display-inline="yes-display-inline">to reflect new developments, challenges, opportunities, and solutions; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9384D252B5794C1C9300D6A4A14865EB"><enum>(B)</enum><text display-inline="yes-display-inline">to review progress based on recommendations for recognizing and supporting family caregivers in the Strategy and, based on the results of such review, recommend priority actions for improving the implementation of such recommendations, as appropriate.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1A4E0A3D4FCA4027A99F1284B9FE8346"><enum>(e)</enum><header display-inline="yes-display-inline">Process for public input</header><text display-inline="yes-display-inline">The Secretary shall establish a process for public input to inform the development of, and updates to, the Strategy, including a process for the public to submit recommendations to the Advisory Council and an opportunity for public comment on the proposed Strategy.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H5B2C1F96AFED46ED8D79A0291996FE94"><enum>(f)</enum><header display-inline="yes-display-inline">No preemption</header><text display-inline="yes-display-inline">Nothing in this Act preempts any authority of a State or local government to recognize or support family caregivers.</text>
 </subsection><subsection id="H7D6D66E1F6E94140B47459D27E72E703"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed to permit the Secretary (through regulation, guidance, grant criteria, or otherwise) to—</text>
 <paragraph id="HB7A8008756884EA19C2CB86369EFD546"><enum>(1)</enum><text>mandate, direct, or control the allocation of State or local resources;</text> </paragraph><paragraph id="H743FD4ADA02D48B480B09909E897D650"><enum>(2)</enum><text>to mandate the use of any of the best practices identified in the reports required under this Act; or</text>
 </paragraph><paragraph id="H756311636B5B424F9D89C1A2D092ED5B"><enum>(3)</enum><text>to otherwise expand the authority of the Secretary beyond that expressly provided to the Secretary in this Act.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H96B969B7D4E64362B598E4A816D7B3E1" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Family Caregiving Advisory Council</header>
 <subsection commented="no" display-inline="no-display-inline" id="H5490AE8867E1494F81F57DF0AF5C89DE"><enum>(a)</enum><header display-inline="yes-display-inline">Convening</header><text display-inline="yes-display-inline">The Secretary shall convene a Family Caregiving Advisory Council to advise and provide recommendations, including identified best practices, to the Secretary on recognizing and supporting family caregivers.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H90D3EE68B96B4F9EBC02623CCD1AD706"><enum>(b)</enum><header display-inline="yes-display-inline">Membership</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H23A6F45DA5134561980908B17FA91C4D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The members of the Advisory Council shall consist of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H8084C857AD8B413EBDFA528687D4E014"><enum>(A)</enum><text display-inline="yes-display-inline">the appointed members under paragraph (2); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H70DA12731F754607867CD3456F772621"><enum>(B)</enum><text display-inline="yes-display-inline">the Federal members under paragraph (3).</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1FD8E9274F5E463C8D59270D27AF3211"><enum>(2)</enum><header display-inline="yes-display-inline">Appointed members</header><text display-inline="yes-display-inline">In addition to the Federal members under paragraph (3), the Secretary shall appoint not more than 15 voting members of the Advisory Council who are not representatives of Federal departments or agencies and who shall include at least one representative of each of the following:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HD981473DFF7045BC93C4167C76BC2ED4"><enum>(A)</enum><text display-inline="yes-display-inline">Family caregivers.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2B02A3F440FC47E0BA0B0B2A56596417"><enum>(B)</enum><text display-inline="yes-display-inline">Older adults with long-term services and supports needs.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1CCCB8C3A0964D6A8D3501D84A4326BA"><enum>(C)</enum><text display-inline="yes-display-inline">Individuals with disabilities.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H83CF24DA0E0D4F8AA9CCD6A0B10D1CFF"><enum>(D)</enum><text display-inline="yes-display-inline">Health care and social service providers.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4C024E3B9F714449BA776330647F91D8"><enum>(E)</enum><text display-inline="yes-display-inline">Long-term services and supports providers.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H820A7F39273942EFA5B6C3B3FEF66047"><enum>(F)</enum><text display-inline="yes-display-inline">Employers.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC7A42C9252F54442A70D5EE0E73E7DFE"><enum>(G)</enum><text display-inline="yes-display-inline">Paraprofessional workers.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0DD0B2B5000446FCA36A38A12DD4B6CC"><enum>(H)</enum><text display-inline="yes-display-inline">State and local officials.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4354BBA6690447C5B9CCCA48F9D1B848"><enum>(I)</enum><text display-inline="yes-display-inline">Accreditation bodies.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H755F8A519D2946FCA20BB0768BCDA202"><enum>(J)</enum><text display-inline="yes-display-inline">Veterans.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD49389378081490FAF235CE78756AE6F"><enum>(K)</enum><text display-inline="yes-display-inline">As appropriate, other experts and advocacy organizations engaged in family caregiving.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE76F3F6C54DD4023BE2341172576FAC3"><enum>(3)</enum><header display-inline="yes-display-inline">Federal members</header><text display-inline="yes-display-inline">The Federal members of the Advisory Council, who shall be nonvoting members, shall consist of the following:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H06A5300F035B4FDEA232F4AE41819CDE"><enum>(A)</enum><text display-inline="yes-display-inline">The Administrator of the Centers for Medicare &amp; Medicaid Services (or the Administrator's designee).</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H533EBF39CFA94D5681A64FFDDF9CCB85"><enum>(B)</enum><text display-inline="yes-display-inline">The Administrator of the Administration for Community Living (or the Administrator's designee who has experience in both aging and disability).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7BD05F83F7874C1EA2AD5DA4938FEF43"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary of Veterans Affairs (or the Secretary's designee).</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7D9FD56DAA4D40F0A9925E1992AD8E2E"><enum>(D)</enum><text display-inline="yes-display-inline">The heads of other Federal departments or agencies (or their designees), including relevant departments or agencies that oversee labor and workforce, economic, government financial policies, community service, and other impacted populations, as appointed by the Secretary or the Chair of the Advisory Council.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A4C3D6E4238498AB84C2CBB04FE4115"><enum>(4)</enum><header display-inline="yes-display-inline">Diverse representation</header><text display-inline="yes-display-inline">The Secretary shall ensure that the membership of the Advisory Council reflects the diversity of family caregivers and individuals receiving services and supports.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H20F2B3EC04464220BFABDAEC2FE42BFD"><enum>(c)</enum><header display-inline="yes-display-inline">Meetings</header><text display-inline="yes-display-inline">The Advisory Council shall meet quarterly during the 1-year period beginning on the date of enactment of this Act and at least three times during each year thereafter. Meetings of the Advisory Council shall be open to the public.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H030844CDECAA4CFB94D9BBEB1FC7C363"><enum>(d)</enum><header display-inline="yes-display-inline">Advisory Council annual reports</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H77299182380F48C380F6381AF7C30370"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of this Act, and annually thereafter, the Advisory Council shall submit to the Secretary, the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, the Committee on Education and the Workforce of the House of Representatives, and the State agencies responsible for carrying out family caregiver programs, and make publicly available on the internet website of the Department of Health and Human Services, a report concerning the development, maintenance, and updating of the Strategy, including a description of the outcomes of the recommendations and any priorities included in the initial report pursuant to paragraph (2), as appropriate.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0513A6565DA04AD2A69C525E103AB613"><enum>(2)</enum><header display-inline="yes-display-inline">Initial report</header><text display-inline="yes-display-inline">The Advisory Council's initial report under paragraph (1) shall include—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H3B480CF264CF4B37BE8C5EC7B84A39B4"><enum>(A)</enum><text display-inline="yes-display-inline">an inventory and assessment of all federally funded efforts to recognize and support family caregivers and the outcomes of such efforts, including analyses of the extent to which federally funded efforts are reaching family caregivers and gaps in such efforts;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1FAB230EDD924454B825A5BC7F060932"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations—</text> <clause commented="no" display-inline="no-display-inline" id="H9E6915C72DF740258409A593A36A19F8"><enum>(i)</enum><text display-inline="yes-display-inline">to improve and better coordinate Federal programs and activities to recognize and support family caregivers, as well as opportunities to improve the coordination of such Federal programs and activities with State programs; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HED333B18F59742EAAA2BE6BE1FD05FB2"><enum>(ii)</enum><text display-inline="yes-display-inline">to effectively deliver services based on the performance, mission, and purpose of a program while eliminating re­dun­dan­cies, avoiding unnecessary duplication and overlap, and ensuring the needs of family caregivers are met;</text>
 </clause></subparagraph><subparagraph id="H781022E4914943989CD18A15404BEFFA"><enum>(C)</enum><text>the identification of challenges faced by family caregivers, including financial, health, and other challenges, and existing approaches to address such challenges; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5D4DEC6814294F558AEBEF96D08983E3"><enum>(D)</enum><text display-inline="yes-display-inline">an evaluation of how family caregiving impacts the Medicare program, the Medicaid program, and other Federal programs.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H798D5CB202E84C92B19ADE966A65E40C"><enum>(e)</enum><header display-inline="yes-display-inline">Nonapplicability of FACA</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Council.</text> </subsection></section><section id="H1756B3E7EF76405A887B50EACE9522C6"><enum>5.</enum><header>Funding</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated to carry out the provisions of this Act. Such provisions shall be carried out using funds otherwise authorized.</text>
 </section><section commented="no" display-inline="no-display-inline" id="H7867606E4560418E9B2C1E489546832A" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Sunset provision</header><text display-inline="no-display-inline">The authority and obligations established by this Act shall terminate on the date that is 5 years after the date of enactment of this Act.</text>
