<official-title display="yes">To amend the Securities Exchange Act of 1934 to require certain entities to develop internal risk control mechanisms to safeguard and govern the storage of market data.</official-title>

<section id="H05C15876823A445392AAB8F8C9F13042" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Market Data Protection Act of 2017</short-title></quote>.</text> </section> <section id="H165D744A8D004E44BD87A2F912E76665"><enum>2.</enum><header>Internal risk controls</header><text display-inline="no-display-inline">The Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78a">15 U.S.C. 78a</external-xref> et seq.) is amended—</text> 
<paragraph id="HB01371E300124EBA8FB5F46E2FCCFCB2"><enum>(1)</enum><text>by inserting after section 4E the following:</text> <quoted-block id="HEB44D439241745DBB2581171BC21CC67" style="OLC"> <section id="HFDE4436D9621448FB1B39D649A84DD36"><enum>4F.</enum><header>Internal risk controls</header> <subsection id="H8E5A42B3392F4F699D19BA1B1ABFA41A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each of the following entities, in consultation with the Chief Economist, shall develop comprehensive internal risk control mechanisms to safeguard and govern the storage of all market data by such entity, all market data sharing agreements of such entity, and all academic research performed at such entity using market data:</text> 
<paragraph id="HF0BC6D3D2A75478B821A92B47FD60F49"><enum>(1)</enum><text display-inline="yes-display-inline">The Commission.</text> </paragraph> <paragraph id="H9513F2F4165742DDA9FE118ABAA17317"><enum>(2)</enum><text>Each national securities association registered pursuant to section 15A.</text> </paragraph>
<paragraph id="HA342B118E6D045DEBF2F57DB850AF136"><enum>(3)</enum><text>The operator of the consolidated audit trail created by a national market system plan approved pursuant to section 242.613 of title 17, Code of Federal Regulations (or any successor regulation).</text> </paragraph></subsection> <subsection id="HA559A89F47E7469B9052F67D59A4B8A6"><enum>(b)</enum><header>Consolidated audit trail prohibited from accepting market data until mechanisms developed</header><text>The operator described in paragraph (3) of subsection (a) may not accept market data (or shall cease accepting market data) until the operator has developed the mechanisms required by such subsection. Any requirement for a person to provide market data to the operator shall not apply during any time when the operator is prohibited by this subsection from accepting such data.</text> </subsection>
<subsection id="HF11C996999AF4FB6AA54F501CA15D407"><enum>(c)</enum><header>Treatment of previously developed mechanisms</header><text display-inline="yes-display-inline">The development of comprehensive internal risk control mechanisms required by subsection (a) may occur, in whole or in part, before the date of the enactment of this section, if such development and such mechanisms meet the requirements of such subsection (including consultation with the Chief Economist).</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> <paragraph id="HD287636BBF454A7E8B5A012BD937379C"><enum>(2)</enum><text>in section 3(a)—</text> 
<subparagraph id="H429D028099F04837BC256A2DB6D8FC79"><enum>(A)</enum><text>by redesignating the second paragraph (80) (relating to funding portals) as paragraph (81); and</text> </subparagraph> <subparagraph id="HC079E381265440E5A0F9870ADF38FB12"><enum>(B)</enum><text>by adding at the end the following:</text>
