			<section id="HF54F17F8EF49412B9A84E1F136486723"><enum>101.</enum><header>Federal evidence-building activities</header>
 <subsection id="HD37481F8F3ED4BD190C1D84D97C1B503"><enum>(a)</enum><header>In general</header><text>Chapter 3 of part I of title 5, United States Code, is amended—</text> <paragraph id="H697470A4CAF2413DB7EC34070A0EC3B6"><enum>(1)</enum><text>before section 301, by inserting the following:</text>

							<subchapter id="H5D8C7C13BA6B469AA4F765335D2B6778"><enum>I</enum><header>General Provisions</header></subchapter><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H3B41B5C53FCC4DC5B1775B11DDC32764"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H11D232764FB84B78B980CCD0F4F42489" style="USC"> <subchapter id="HB6397A76F8864B16AEF061C9808A50C5"><enum>II</enum><header>Federal Evidence-Building Activities</header> <section id="HFDCB78EA0CE0438BAAAE8E9B196D2BDE"><enum>311.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text>
 <paragraph id="H4A70273381074A309E076BF9A55CA4C0"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means an agency referred to under section 901(b) of title 31.</text> </paragraph><paragraph id="HD8A3D6B60E9E49A8B3DA749F4B4B0D0E"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text>
 </paragraph><paragraph id="H4ED71F3314C5436E98B9AA500FE75936"><enum>(3)</enum><header>Evaluation</header><text>The term <term>evaluation</term> means an assessment using systematic data collection and analysis of one or more programs, policies, and organizations intended to assess their effectiveness and efficiency.</text>
 </paragraph><paragraph commented="no" id="H03ACD54CC4414A17A7443B68D98E1AD6"><enum>(4)</enum><header>Evidence</header><text display-inline="yes-display-inline">The term <term>evidence</term> means evaluation, policy research and analysis, and information produced as a result of statistical activities conducted for a statistical purpose.</text>
 </paragraph><paragraph commented="no" id="H7FDF3AA41E844E6CBDB025AF2F3B82E9"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, each territory or possession of the United States, and each federally recognized Indian Tribe.</text>
 </paragraph><paragraph commented="no" id="HC1A649FAB794460C86D473A84C0C3560"><enum>(6)</enum><header>Statistical activities; statistical agency or unit; statistical purpose</header><text display-inline="yes-display-inline">The terms <term>statistical activities</term>, <term>statistical agency or unit</term>, and <term>statistical purpose</term> have the meanings given those terms in section 3561 of title 44.</text> </paragraph></section><section id="HE1892A03C4824F6B95331AF0CF7888CB"><enum>312.</enum><header>Agency evidence-building plan</header> <subsection commented="no" id="H01132E8A16E14D2F8FA11427BACC7D8A"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than the first Monday in February of each year, the head of each agency shall submit to the Director and Congress a systematic plan for identifying and addressing policy questions relevant to the programs, policies, and regulations of the agency. Such plan shall be made available on the public website of the agency and shall cover at least a 4-year period beginning with the first fiscal year following the fiscal year in which the plan is submitted and published and contain the following:</text>
 <paragraph commented="no" id="H082CEC78F9204F68B779C3038F9FFE5B"><enum>(1)</enum><text>A list of policy-relevant questions for which the agency intends to develop evidence to support policymaking.</text>
 </paragraph><paragraph commented="no" id="HCE09E20A7D83430790A5059DF438E206"><enum>(2)</enum><text>A list of data the agency intends to collect, use, or acquire to facilitate the use of evidence in policymaking.</text>
 </paragraph><paragraph id="HC3483C7AB3A641A8B19834AFC01E9FA2"><enum>(3)</enum><text display-inline="yes-display-inline">A list of methods and analytical approaches that may be used to develop evidence to support policymaking.</text>
 </paragraph><paragraph commented="no" id="H27C5018BD3AC46C09531926D2617271F"><enum>(4)</enum><text>A list of any challenges to developing evidence to support policymaking, including any statutory or other restrictions to accessing relevant data.</text>
 </paragraph><paragraph commented="no" id="H095E476C62854B93A974007D6FDF0853"><enum>(5)</enum><text>A description of the steps the agency will take to accomplish paragraphs (1) and (2).</text> </paragraph><paragraph id="H587FD4DAB8E84DA5A870A19EEAE4BBAA"><enum>(6)</enum><text>Any other information as required by guidance issued by the Director.</text>
 </paragraph></subsection><subsection id="HCE2A4B6190AF4AFAB368385745C84662"><enum>(b)</enum><header>Consultation</header><text>In developing the plan required under subsection (a), the head of an agency shall consult with the following:</text>
 <paragraph id="HCC9F96AB70E044D883559EB58BD61390"><enum>(1)</enum><text>The public.</text> </paragraph><paragraph id="H2D0650A8592847DE9C41315BFF4A26E8"><enum>(2)</enum><text>Any evaluation or analysis unit and personnel of the agency.</text>
 </paragraph><paragraph id="H02FC78CCC00B4C208AC75634D3BFE4E4"><enum>(3)</enum><text>Agency officials responsible for implementing privacy policy.</text> </paragraph><paragraph id="HD5895BAEC5B246FFACEE5ED7C09F0271"><enum>(4)</enum><text>The Chief Data Officer of the agency.</text>
 </paragraph><paragraph id="H97F370591AF74D729762C9958278AFD7"><enum>(5)</enum><text>The officials of the agency designated under section 315.</text> </paragraph><paragraph id="HD82CEAEC01CF46F891591145C561AE05"><enum>(6)</enum><text>The Performance Improvement Officer of the agency.</text>
 </paragraph><paragraph id="HA87A9F42BCBF4ECDBF842CD1D70F26B2"><enum>(7)</enum><text>Program administrators of the agency.</text> </paragraph><paragraph id="H9135E3B8EA4E402EB52AB408A84BB36C"><enum>(8)</enum><text>The committees of the House of Representatives and Senate with oversight jurisdiction over the agency.</text>
										</paragraph></subsection></section><section id="H5A99B0D8CBD945F8ACED53DC8C74BE71"><enum>313.</enum><header>Governmentwide evidence-building coordination</header>
									<subsection id="H3D6C2D42314749358308E1F8AD690C92"><enum>(a)</enum><header>Unified evidence-Building coordination</header>
 <paragraph commented="no" id="HAA967CE136764911808D527CF45BE2E3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall consolidate the plans submitted under section 312 in a unified evidence-building plan. The Director shall notify agency heads of potentially overlapping or unnecessary duplicative data acquisition plans and facilitate interagency evidence gathering and sharing. The head of the agency may incorporate the results of any interagency coordination by updating the plan required under section 312. The Director shall incorporate any such agency update in the unified evidence-building plan.</text>
 </paragraph><paragraph id="HF576D67380A34654A653D811A99E455D"><enum>(2)</enum><header>Consultation</header><text>In developing the unified evidence-building plan required under paragraph (1), the Director shall consult with the following:</text>
 <subparagraph id="H4788406ED9F248BBBF01FF746B798409"><enum>(A)</enum><text>The public.</text> </subparagraph><subparagraph id="H315DED28513A4B5CB26660680A01014D"><enum>(B)</enum><text>The Interagency Council on Evaluation Policy established under subsection (b).</text>
 </subparagraph><subparagraph id="H198BDFB0DFFE40CFBB5B03ECFBFCACF4"><enum>(C)</enum><text>The Interagency Council on Statistical Policy established under section 3504(e)(8) of title 44.</text> </subparagraph><subparagraph id="H4E4C292F7AA74887B2BDEACFA302E17B"><enum>(D)</enum><text>Any other relevant interagency council.</text>
 </subparagraph><subparagraph id="HCA9845C1CBDB4228A3AB45D14198952B"><enum>(E)</enum><text>The head of each agency.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="HFD6E7F9E55EF4DF3914F24BE1699313B"><enum>(b)</enum><header>Interagency Council on Evaluation Policy</header> <paragraph commented="no" id="H97562CF83C144A80B5BAF09F27717A2F"><enum>(1)</enum><header>Establishment</header><text>There is established an Interagency Council on Evaluation Policy (in this section referred to as the <quote>Council</quote>) to advise and assist the Director in supporting Governmentwide evaluation activities and policies.</text>
 </paragraph><paragraph commented="no" id="H61CE122BC1644AE787FFE94A9A92D0FA"><enum>(2)</enum><header>Purpose and function</header><text>The Council shall act as the principal interagency forum for coordinating cross-agency evaluation activities and improving agency practices related to program evaluation. The Council shall—</text>
 <subparagraph commented="no" id="HCD5BEE8E15EC427EA996EAAC7296E322"><enum>(A)</enum><text>advise and assist the Director in supporting Governmentwide evaluation activities and policies;</text> </subparagraph><subparagraph commented="no" id="H84EF6B8CC5314045AEEC66C1B13EE93A"><enum>(B)</enum><text>foster capacity for program evaluation across agencies by collaborating on a set of Governmentwide human capital strategies that develop and maintain agencies’ capacity for program evaluation;</text>
 </subparagraph><subparagraph commented="no" id="H47800FCD12B343FC97E0E4792C598D97"><enum>(C)</enum><text display-inline="yes-display-inline">advise on the development of department-wide evaluation policies and the systematic plans for identifying and addressing priority policy questions described in agency evidence-building plans under section 312; and</text>
 </subparagraph><subparagraph commented="no" id="HB19D362C196D461291843AFB84D8F699"><enum>(D)</enum><text>serve as a forum in which members may engage in collective learning and sharing of information to strengthen and promote high-quality program evaluation practices across the Government.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H8A4E2C1ED36F44DDA43ED559D97F3246"><enum>(3)</enum><header>Membership</header><text>The members of the Council shall be the Chief Evaluation Officers appointed or designated under section 314. The Director shall designate a Chair of the Council. Additional members may be designated by the Chair.</text>
 </paragraph><paragraph commented="no" id="HF580108F38CE4F23AD30A12C4200CF07"><enum>(4)</enum><header>Meetings</header><text>The Council shall meet not less than twice per fiscal year and may meet at the call of the Chair or a majority of the members of the Council.</text>
 </paragraph><paragraph commented="no" id="HC2FE190BAC4647A489FBF91262BD4271"><enum>(5)</enum><header>Support</header><text>The head of each agency with a Chief Evaluation Officer serving on the Council shall, as appropriate and to the extent permitted by law, provide support in operating the Council, upon the request of the Chair.</text>
 </paragraph><paragraph commented="no" id="HCA5E0C53CE9743338701BBF9B5F92B3A"><enum>(6)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Chair of the Council shall submit an annual report on the Council’s work under paragraph (2) to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Government Affairs of the Senate. The Director shall make such report publicly available online.</text>
										</paragraph><paragraph commented="no" id="H648C5144FB184FE485FD2A0490C31C95"><enum>(7)</enum><header>Report and termination</header>
 <subparagraph commented="no" id="H2EB8DB199FD54B4F85102E62B282739F"><enum>(A)</enum><header>Evaluation of Council</header><text display-inline="yes-display-inline">Not later than four years after the date of the enactment of this subsection, the Comptroller General of the United States shall submit a report to Congress on whether the Council improved the use of evidence and program evaluation in the Federal Government.</text>
 </subparagraph><subparagraph commented="no" id="HF73009494AFF422F8AA4697FBE1A4AC7"><enum>(B)</enum><header>Termination of Council</header><text>The Council shall terminate and this subsection shall be repealed upon the expiration of the two-year period that begins on the date the Comptroller General of the United States submits the evaluation under subparagraph (A) to Congress.</text>
											</subparagraph></paragraph></subsection></section><section id="H6D8E1569DCC94341BC1D64AECADD88DC"><enum>314.</enum><header>Chief Evaluation Officers</header>
 <subsection id="H9E9E5FFC64084B57B9937F889EB64A12"><enum>(a)</enum><header>Establishment</header><text>The head of each agency shall appoint or designate an employee of the agency as the Chief Evaluation Officer of the agency.</text>
 </subsection><subsection id="HF9BDEC4071B641A1A0BFDAD6A1070FAD"><enum>(b)</enum><header>Qualifications</header><text>The Chief Evaluation Officer of an agency shall be appointed or designated without regard to political affiliation and based on demonstrated expertise in evaluation methodology, practices, and appropriate expertise to the disciplines of the agency.</text>
 </subsection><subsection id="H01BAD6B178264804943D65612E61F27D"><enum>(c)</enum><header>Limitations</header><text>The Chief Evaluation Officer of an agency may not simultaneously serve as any of the following:</text> <paragraph id="H5AE640E473474E7AA605A0CC7EF79426"><enum>(1)</enum><text>The Chief Financial Officer of any agency.</text>
 </paragraph><paragraph id="HD4F5AF84106E4E05AAC800DEDD7FB92F"><enum>(2)</enum><text>The Chief Information Officer of any agency.</text> </paragraph><paragraph id="HCFEC5EC23879488082E4D15F8C9A3CFF"><enum>(3)</enum><text>The Chief Human Capital Officer of any agency.</text>
 </paragraph><paragraph id="HA69B1B0ECDB54CD2B81E32B2652DD274"><enum>(4)</enum><text>The Chief Acquisition Officer of any agency.</text> </paragraph><paragraph id="HA5FAB67DFB4643958D120BDE153808DA"><enum>(5)</enum><text>The Inspector General of any agency.</text>
 </paragraph></subsection><subsection id="HB0FB7F173CFD44438EA6A821FAF139C4"><enum>(d)</enum><header>Coordination</header><text>The Chief Evaluation Officer of an agency shall, to the extent practicable, coordinate activities with agency officials, including the following:</text>
 <paragraph id="H7564DB98B2F14861A90AFD71E591F8DB"><enum>(1)</enum><text>Agency officials responsible for implementing privacy policy regarding privacy and confidentiality issues.</text>
 </paragraph><paragraph id="H4F15A953DE954F4684D9EFDCD136FC14"><enum>(2)</enum><text>The Chief Data Officer of the agency.</text> </paragraph><paragraph id="HDCCBA0CBE8674A34AEBCDE34F320A8EE"><enum>(3)</enum><text>Agency officials designated under section 315.</text>
 </paragraph><paragraph id="H0A33DB6CED234A5FBB5766D8320F2ED7"><enum>(4)</enum><text>Any evaluation or analysis unit and personnel of the agency on the needs for evaluation and analysis.</text>
 </paragraph><paragraph id="H01CE67D5D87949E7BE418CA9FA79DE25"><enum>(5)</enum><text>The Performance Improvement Officer of the agency.</text> </paragraph><paragraph id="HB1FD8F94EFCD4266AD2E7E155FF20E1D"><enum>(6)</enum><text display-inline="yes-display-inline">Program administrators of the agency.</text>
 </paragraph><paragraph id="H5F6643E59A124B9CAA0680BF3904C96A"><enum>(7)</enum><text>The Chief Evaluation Officers of other agencies.</text> </paragraph></subsection><subsection id="H9DA8D30112D445D8A1B973BF68FE4A7A"><enum>(e)</enum><header>Functions</header><text>The Chief Evaluation Officer of each agency shall—</text>
 <paragraph id="H113A7ADA87FB47C29378A82C032AF974"><enum>(1)</enum><text>continually assess the coverage, quality, methods, consistency, effectiveness, independence, and balance of the portfolio of evaluations, policy research, and ongoing evaluation activities of the agency;</text>
 </paragraph><paragraph id="H93CF8E9F99CF4ED2B681D006C3C1E7F1"><enum>(2)</enum><text>assess agency capacity to support the development and use of evaluation;</text> </paragraph><paragraph id="HA2CC8125EF964BE89E6B17BCF561B250"><enum>(3)</enum><text>establish and implement an agency evaluation policy; and</text>
 </paragraph><paragraph id="HD69BB3CE045047438F25AA30D7D35B7D"><enum>(4)</enum><text>coordinate, develop, and implement the plan required under section 312.</text> </paragraph></subsection></section><section commented="no" id="H774AAE1B21334D5EB5A141C7C5BFDAA5"><enum>315.</enum><header>Statistical expertise</header> <subsection id="H14D4EBD32C1C4190B244C1B6F1C98D27"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The head of each agency shall designate the head of any statistical agency or unit within the agency, or in the case of an agency that does not have a statistical agency or unit, any senior agency official with appropriate expertise, as a statistical official to advise on statistical policy, techniques, and procedures. Agency officials engaged in statistical activities may consult with any such statistical official as necessary.</text>
 </subsection><subsection id="H619A86FAEB67487093245389C8AB1621"><enum>(b)</enum><header>Membership on Interagency Council for Statistical Policy</header><text display-inline="yes-display-inline">Each statistical official designated under subsection (a) shall serve as a member of the Interagency Council for Statistical Policy established under section 3504(e)(8) of title 44.</text>
									</subsection></section><section id="H0A7964E1209C4E7FADE815A5C1FA29F9"><enum>316.</enum><header>Advisory Committee on Data for Evidence Building</header>
 <subsection id="H6CD49997D5B1493A9DB5C1BF237D5D0E"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Director, or the head of an agency head designated by the Director, shall establish an Advisory Committee on Data for Evidence Building (in this section referred to as the <quote>Advisory Committee</quote>) to review, analyze, and make recommendations on how to expand access to and use of Federal data for evidence building.</text>
 </subsection><subsection id="H3735171E67DA428AAABDFBD034F236D9"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The members of the Advisory Committee shall consist of the Chief Statistician of the United States, who shall serve as the Chair of the Advisory Committee, and other members appointed by the Director as follows:</text>
 <paragraph id="H25B4ED2F7FAC471586ECFD94EFD9AE71"><enum>(1)</enum><text>One member who is an agency Chief Information Officer.</text> </paragraph><paragraph id="HD38D5B488E54432AB984D4CAAC5FC0FE"><enum>(2)</enum><text>One member who is an agency Chief Privacy Officer.</text>
 </paragraph><paragraph id="H923F11067F8D41B2A68D78065FAFEC61"><enum>(3)</enum><text>One member who is an agency Chief Performance Officer.</text> </paragraph><paragraph id="HA8A6F2FE77B64978B9FD196D6B187B34"><enum>(4)</enum><text>Three members who are agency Chief Data Officers.</text>
 </paragraph><paragraph id="H48CD263998994725A8308654E8779703"><enum>(5)</enum><text>Three members who are agency Chief Evaluation Officers.</text> </paragraph><paragraph id="H2482B3FFF50C45528E0EF2625A98271D"><enum>(6)</enum><text display-inline="yes-display-inline">Three members who are members of the Interagency Council for Statistical Policy established under section 3504(e)(8) of title 44.</text>
 </paragraph><paragraph id="H8E5B4540647C46329BD28378451C3C1B"><enum>(7)</enum><text display-inline="yes-display-inline">At least 10 members who are representatives of State and local governments and nongovernmental stakeholders with expertise in government data policy, privacy, technology, transparency policy, evaluation and research methodologies, and other relevant subjects, of whom—</text>
 <subparagraph id="HCEC66923F5B741C18DF0B763A1962C70"><enum>(A)</enum><text>at least one shall have expertise in transparency policy;</text> </subparagraph><subparagraph id="H76929CE5B63545E688C3B60C5E5DD430"><enum>(B)</enum><text display-inline="yes-display-inline">at least one shall have expertise in privacy policy;</text>
 </subparagraph><subparagraph id="H109378165B384183B70327A21ECC9748"><enum>(C)</enum><text display-inline="yes-display-inline">at least one shall have expertise in statistical data use;</text> </subparagraph><subparagraph id="HE23212AD1F174106A4BFA914483924C4"><enum>(D)</enum><text>at least one shall have expertise in information management;</text>
 </subparagraph><subparagraph id="H888410FF809D40C5A3FC4BD65FCFCB26"><enum>(E)</enum><text>at least one shall have expertise in information technology;</text> </subparagraph><subparagraph id="H3A5484C41CD64A0FA6301247EA6A938B"><enum>(F)</enum><text>at least one shall be from the research and evaluation community; and</text>
 </subparagraph><subparagraph id="HFAF48F38626745DBA0EFFDD507C6588A"><enum>(G)</enum><text>if practicable, at least one shall be a former member of the Commission on Evidence-Based Policymaking.</text>
											</subparagraph></paragraph></subsection><subsection id="H39CDEB3B3D2641C4BE8A440932F3D005"><enum>(c)</enum><header>Term of service</header>
 <paragraph id="HE8FCAE840D634471A2BA3BA5C8E5DA50"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each member of the Advisory Committee (other than the Chair) shall serve for a term of two years.</text> </paragraph><paragraph commented="no" id="HC88C943445684088B73C389873DED867"><enum>(2)</enum><header>Vacancy</header><text display-inline="yes-display-inline">Any member appointed to fill a vacancy occurring before the expiration of the term for which the member’s predecessor was appointed shall be appointed only for the remainder of that term. A vacancy in the Commission shall be filled in the manner in which the original appointment was made.</text>
 </paragraph></subsection><subsection id="H1833219344AD45BBBF973CA65790FCCA"><enum>(d)</enum><header>Compensation</header><text>Members of the Advisory Committee shall serve without compensation.</text> </subsection><subsection id="H6D2510191EF14A008DBE85DF6F49130D"><enum>(e)</enum><header>Duties</header> <paragraph id="H169A1A1C02824B7CB5968D0AE54669DE"><enum>(1)</enum><header>First year</header><text>During the first year of the Advisory Committee, the Advisory Committee shall—</text>
 <subparagraph commented="no" id="HDB27269EB5894C29A5E872B6C0C3DD38"><enum>(A)</enum><text>assist the Director in carrying out the duties of the Director under part D of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44; and</text>
 </subparagraph><subparagraph id="H39553D39BD994D2EB83CDD9E54C2498A"><enum>(B)</enum><text>evaluate and provide recommendations to the Director on the establishment of a shared service to facilitate data sharing, enable data linkage, and develop privacy enhancing techniques, including—</text>
 <clause id="H29E731A17A2B4DCA9EB56AD46BE6B308"><enum>(i)</enum><text>the specific capabilities, needs, and necessary assets of such service, and the extent to which assets should be transferred from existing agencies;</text>
 </clause><clause id="H8349F5F74F854898977074AAF6F384EC"><enum>(ii)</enum><text>any prospective location for such service;</text> </clause><clause id="H374E621E408B4213867F23BDA9EDB724"><enum>(iii)</enum><text>best practices for transparency and interagency coordination;</text>
 </clause><clause id="H6E0871B1EBB343739510BBEE2F700D88"><enum>(iv)</enum><text>best practices for monitoring and auditing of privacy, data linkage, and confidentiality of data accessed through such service; and</text>
 </clause><clause id="H3701D1805B524B538B92891B87E65F50"><enum>(v)</enum><text>necessary administrative and financial authorities to support the activities of such service.</text> </clause></subparagraph></paragraph><paragraph id="H66BD5CE6D9BE4B23A73BC7D9C17A6024"><enum>(2)</enum><header>Second year</header><text>During the second and any subsequent year of the Advisory Committee, the Advisory Committee shall—</text>
 <subparagraph id="HB27E2DE3F95343969B8E284750A52BCF"><enum>(A)</enum><text>if determined necessary by the Director, carry out the duties described in paragraph (1); and</text> </subparagraph><subparagraph id="H7F58FD183C984DB5B66C48B1BE1C47CE"><enum>(B)</enum><text>review the coordination of data sharing or availability for evidence building across all agencies.</text>
 </subparagraph></paragraph></subsection><subsection id="H0A85546028CC4059A6492ADBC5BA7A72"><enum>(f)</enum><header>Reports</header><text>For each year of the existence of the Advisory Committee, the Advisory Committee shall submit to the Director and make publicly available an annual report on the activities and findings of the Advisory Committee.</text>
									</subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H291190BECA9B49159AFF762130E2746B"><enum>(b)</enum><header>Technical and conforming amendments</header><text>The table of sections for chapter 3 of part I of title 5, United States Code, is amended—</text> <paragraph id="HD39ABC5FE98C480E9966EEC128B1770C"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting before the item relating to section 301 the following:</text>

 <section id="H9EBFCBFE783046069D6C5225BE015D2F"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><quote><short-title>Open, Public, Electronic, and Necessary Government Data Act</short-title></quote></quote> or the <quote><short-title>OPEN Government Data Act</short-title></quote>.</text> </section><section id="HCFC13B7E867C40B08D53E711FA659669"><enum>202.</enum><header>OPEN Government Data</header> <subsection id="H10BB2C48E84D489BA751D6973F2227D2"><enum>(a)</enum><header>Definitions</header><text>Section 3502 of title 44, United States Code, is amended—</text>

 </paragraph><paragraph id="HE28129064D944100B8272F5B54E7D99F"><enum>(18)</enum><text>the term <term>metadata</term> means structural or descriptive information about data such as content, format, source, rights, accuracy, provenance, frequency, periodicity, granularity, publisher or responsible party, contact information, method of collection, and other descriptions;</text>
 </paragraph><paragraph id="HB79ABA696B0F4646B0C8EFA4009E042C"><enum>(19)</enum><text>the term <term>open Government data asset</term> means a public data asset that is—</text> <subparagraph commented="no" id="H81540E1665E84CA49B1CF449F09F2033"><enum>(A)</enum><text>machine-readable;</text>
 </subparagraph><subparagraph commented="no" id="H9447C72F4F3E4672ACF005B5501A4880"><enum>(B)</enum><text>available (or could be made available) in an open format;</text> </subparagraph><subparagraph commented="no" id="HB3DCB0050B064B6CBEDCFDE0B730CBA8"><enum>(C)</enum><text>not encumbered by restrictions that would impede the use or reuse of such asset; and</text>
 </subparagraph><subparagraph commented="no" id="H1D237C00C4F94D318B9A99E89E399572"><enum>(D)</enum><text>based on an underlying open standard that is maintained by a standards organization;</text> </subparagraph></paragraph><paragraph id="H5F023942911E4B01866B8306CDB8A715"><enum>(20)</enum><text>the term <term>open license</term> means a legal guarantee that a data asset is made available—</text>
 <subparagraph commented="no" id="HD8ED75456CFF4F9C88B98105A7F79970"><enum>(A)</enum><text>at no cost to the public; and</text> </subparagraph><subparagraph commented="no" id="H4E565D0682334A00A04C33508FE5277A"><enum>(B)</enum><text>with no restrictions on copying, publishing, distributing, transmitting, citing, or adapting such asset;</text>
 </subparagraph></paragraph><paragraph id="HBECFAD1AB52D4E8BB4394B8493DEEAA5"><enum>(21)</enum><text>the term <term>public data asset</term> means a data asset maintained by the Federal Government that has been, or may be, released to the public, including any data asset subject to disclosure under section 552 of title 5; and</text>
 </paragraph><paragraph commented="no" id="HB8B47286077A4A379AC62D0A88601CF9"><enum>(22)</enum><text display-inline="yes-display-inline">the term <term>statistical laws</term> means subchapter III of this chapter and other laws pertaining to the protection of information collected for statistical purposes as designated by the Director.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HDBB5AE63963D41E691ACFCA69220D9B6"><enum>(b)</enum><header>Guidance To make data open by default</header><text>Section 3504(b) of title 44, United States Code, is amended—</text> <paragraph id="H97B86C02D55D46A7899728D2C2D2B82A"><enum>(1)</enum><text>in paragraph (4), by striking <quote>; and</quote> and inserting a semicolon;</text>

 </subparagraph><subparagraph id="H5416B854FBBD4658907A363BD115316D"><enum>(B)</enum><text display-inline="yes-display-inline">security considerations, including the risk that information in an individual data asset in isolation does not pose a security risk but when combined with other available information may pose such a risk;</text>
 </subparagraph><subparagraph id="H76684D85F365480CB4699A24FC7EF7C5"><enum>(C)</enum><text display-inline="yes-display-inline">the cost and benefits to the public of converting a data asset into a machine-readable format that is accessible and useful to the public;</text>
 </subparagraph><subparagraph id="H72CF35B80F7C4AFF909751721EE2F721"><enum>(D)</enum><text>whether a data asset—</text> <clause id="H807B2A28CEEA4649B9892855ACA4795A"><enum>(i)</enum><text display-inline="yes-display-inline">is protected by intellectual property rights;</text>
 </clause><clause id="HC3BB4445B523468C87A14F150BE05101"><enum>(ii)</enum><text display-inline="yes-display-inline">contains confidential business information, that could be withheld under section 552(b)(4) of title 5; or</text>
 </clause><clause id="HB445D0E08CCF4FBE9CC23B6CC2828245"><enum>(iii)</enum><text display-inline="yes-display-inline">is otherwise restricted by contract or other binding, written agreement;</text> </clause></subparagraph><subparagraph id="H050BE2A615C44CBEACB61C4A4443840E"><enum>(E)</enum><text display-inline="yes-display-inline">the requirement that a data asset be disclosed, if it would otherwise be made available under section 552 of title 5 (commonly known as the Freedom of Information Act); and</text>
 </subparagraph><subparagraph id="H60D0657C36484FEAA42999DD8DF9B6E1"><enum>(F)</enum><text display-inline="yes-display-inline">any other considerations that the Director determines to be relevant.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="HE385E5924B874426B903AA3BAA31088E"><enum>(c)</enum><header>Federal agency responsibilities To make data open by default</header> <paragraph id="H7076FD52314C4FD98DCC278AF0EC18DA"><enum>(1)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 3506 of title 44, United States Code, is amended—</text>
 <subparagraph id="H1098FF13812B4DC4AC708662BE5D5953"><enum>(A)</enum><text>in subsection (b)—</text> <clause id="H47AD50BACEE04A32B6ACA947918E17B5"><enum>(i)</enum><text>by amending paragraph (2) to read as follows:</text>
								<quoted-block display-inline="no-display-inline" id="H6CD7CA363C1B405FBB3FEBD0D11E448C" style="USC">
 <paragraph id="H9446AFDF9F8A4C669CA6476C9AC017D6"><enum>(2)</enum><text display-inline="yes-display-inline">in accordance with guidance by the Director, develop and maintain a strategic information resources management plan that—</text>
 <subparagraph id="HA383C804288941D496E73715D4DE72AC"><enum>(A)</enum><text display-inline="yes-display-inline">describes how information resources management activities help accomplish agency missions;</text> </subparagraph><subparagraph id="HA246D0DD17574C4D9218156116F5584D"><enum>(B)</enum><text display-inline="yes-display-inline">includes an open data plan that—</text>
 <clause display-inline="no-display-inline" id="HB1E703D9B05E4B548C7C81C603AA15D2"><enum>(i)</enum><text>requires the agency to develop processes and procedures that—</text> <subclause commented="no" id="H11F9B8E0CF35430F8D42CA0EEBB95002"><enum>(I)</enum><text>require data collection mechanisms created on or after the date of the enactment of the OPEN Government Data Act to be available in an open format; and</text>
 </subclause><subclause id="H2B1550010E624162A7BB7E75CA6FB592"><enum>(II)</enum><text>facilitate collaboration with non-Government entities (including businesses), researchers, and the public for the purpose of understanding how data users value and use government data;</text>
 </subclause></clause><clause id="H0E5AA7568A2E4EF5B3452509A6AF88CF"><enum>(ii)</enum><text>identifies and implements methods for collecting and analyzing digital information on data asset usage by users within and outside of the agency, including designating a point of contact within the agency to assist the public and to respond to quality issues, usability issues, recommendations for improvements, and complaints about adherence to open data requirements within a reasonable period of time;</text>
 </clause><clause commented="no" id="H62E207946D47452E80FDD3CED92A825E"><enum>(iii)</enum><text display-inline="yes-display-inline">develops and implements a process to evaluate and improve the timeliness, completeness, consistency, accuracy, usefulness, and availability of open Government data assets;</text>
 </clause><clause commented="no" id="H7E29FB3DCE9B4B6CA28991F900D4B752"><enum>(iv)</enum><text>includes requirements for meeting the goals of the agency open data plan, including the acquisition of technology, provision of training for employees, and the implementation of procurement standards, in accordance with existing law, regulation, and policy, that allow for the acquisition of innovative solutions from public and private sectors; and</text>
 </clause><clause commented="no" id="H86EC8D3BF9D646D7B5F5CE5898F0E254"><enum>(v)</enum><text>requires the agency to comply with requirements under section 3511, including any standards established by the Director under such section, when disclosing a data asset pursuant to such section; and</text>
 </clause></subparagraph><subparagraph id="HDB7C0FD4FF204E03A65EA969566DE322"><enum>(C)</enum><text>is updated annually and made publicly available on the website of the agency not later than five days after each such update;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </clause><clause id="H79667A70FA3D48D1879E577C45906359"><enum>(ii)</enum><text>in paragraph (4), by striking <quote>; and</quote> and inserting a semicolon;</text> </clause><clause id="H23B256A796BA4402A93BBE230F13B457"><enum>(iii)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text>

 <subparagraph commented="no" id="H82AF599DA50E4030B73D22DD4C3B3F38"><enum>(A)</enum><text>make each data asset of the agency available in an open format and under an open license;</text> </subparagraph><subparagraph commented="no" id="H0370347BF8FE4827954F5A191307D5F0"><enum>(B)</enum><text>make each public data asset of the agency available as an open Government data asset; and</text>
 </subparagraph><subparagraph commented="no" id="HA2784AAE027C452C944B218C53612D54"><enum>(C)</enum><text>make each open Government data asset created by or for the agency available under an open license.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </clause></subparagraph><subparagraph commented="no" id="H6F6D378534784324B4905D9AED2CC724"><enum>(B)</enum><text>in subsection (d)—</text>
 <clause commented="no" id="H1908C499AA454FBC92B014770EF69E0A"><enum>(i)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text> </clause><clause commented="no" id="HB2109D203E7641E1A9B6B15C6F4EAE20"><enum>(ii)</enum><text>in paragraph (4), by striking the period at the end and inserting a semicolon; and</text>
 </clause><clause commented="no" id="H44B53A49DCAF4BD485621516F64D23D4"><enum>(iii)</enum><text>by adding at the end the following new paragraphs:</text> <quoted-block display-inline="no-display-inline" id="H3420C9225423458A8F5BDEDF4771F94C" style="USC"> <paragraph commented="no" id="HEC055DD3E7CD49AEBBE775372F6FC838"><enum>(5)</enum><text display-inline="yes-display-inline">ensure that any public data asset of the agency is machine-readable; and</text>
 </paragraph><paragraph commented="no" id="H43FC4B5E7A6842288E1757367711C738"><enum>(6)</enum><text>engage the public in using public data assets of the agency and encourage collaboration by—</text> <subparagraph commented="no" id="H254B992D001D4BA4A7E82E5587EAEA45"><enum>(A)</enum><text>publishing on the website of the agency, on a regular basis (not less than annually), information on the usage of such assets by non-Government users;</text>
 </subparagraph><subparagraph commented="no" id="H4C36296502D54B0094F96D2488F00E11"><enum>(B)</enum><text display-inline="yes-display-inline">providing the public with the opportunity to request specific data assets to be prioritized for disclosure and to provide suggestions for the development of agency criteria with respect to prioritizing data assets for disclosure;</text>
 </subparagraph><subparagraph commented="no" id="H0FEB190921104C62BF592225C365FF19"><enum>(C)</enum><text>assisting the public in expanding the use of public data assets; and</text> </subparagraph><subparagraph commented="no" id="H0096DB67BC2B45FBB51C5A4F6CE211DD"><enum>(D)</enum><text>hosting challenges, competitions, events, or other initiatives designed to create additional value from public data assets of the agency.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </clause></subparagraph></paragraph><paragraph id="HDFCC21CF074B4718BBD72F28A68A1D54"><enum>(2)</enum><header>Use of open data assets</header><text>Not later than 1 year after the date of the enactment of this Act, the head of each agency shall ensure that any activities by the agency or any new contract entered into by the agency meet the requirements of section 3506 of title 44, United States Code, as amended by this subsection.</text>
 </paragraph><paragraph id="H180D217E907C487397C8F3B76DA65A56"><enum>(3)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this subsection shall take effect on the date that is 1 year after the date of the enactment of this Act and shall apply with respect to any contract entered into by an agency on or after such effective date.</text>
					</paragraph></subsection><subsection id="H5A09DC9E6FC5486EA59041594409785E"><enum>(d)</enum><header>Data inventory and Federal data catalogue</header>
 <paragraph id="HB2E2DB05E48F4B429357605571E0B0A8"><enum>(1)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 3511 of title 44, United States Code, is amended to read to read as follows:</text> <quoted-block id="H783AD7BC00DA4CEBB4ED7B2045BCF233" style="USC"> <section id="H22929B5264CE45B99BD9DE769F7A3B13"><enum>3511.</enum><header>Data inventory and Federal data catalogue</header> <subsection id="HE2ED4A9F5C09415EA6788DF4EFF1BB8B"><enum>(a)</enum><header>Comprehensive data inventory</header> <paragraph id="H23DD046D82DD4D2D9F660649DBD2F81F"><enum>(1)</enum><header>In general</header><text>In consultation with the Director and in accordance with the guidance established under paragraph (2), the head of each agency shall develop and maintain a comprehensive data inventory that accounts for all data assets created by, collected by, under the control or direction of, or maintained by the agency. The head of each agency shall ensure that such inventory provides a clear and comprehensive understanding of the data assets in the possession of the agency.</text>
 </paragraph><paragraph commented="no" id="H1651BFE17EB84BE5A0E992FFD45D95D1"><enum>(2)</enum><header>Guidance</header><text>The Director shall establish guidance for agencies to develop and maintain comprehensive data inventories under paragraph (1). Such guidance shall include the following:</text>
 <subparagraph commented="no" id="H066DB4A15A5942F3B42C9BCA883A2438"><enum>(A)</enum><text>A requirement for the head of an agency to include in the comprehensive data inventory metadata on each data asset of the agency, including the following:</text>
 <clause commented="no" id="HB1137821A26F4146AC249D9B20E8440A"><enum>(i)</enum><text display-inline="yes-display-inline">A description of the data asset, including all variable names and definitions.</text> </clause><clause commented="no" id="HC1FF68A32DE940C89EEE4116EB317F55"><enum>(ii)</enum><text>The name or title of the data asset.</text>
 </clause><clause commented="no" id="H5CE5A8699ACE44EA874A193457C9951B"><enum>(iii)</enum><text>An indication of whether the agency—</text> <subclause commented="no" id="HE37EC85D8BE34396894AFA524FC2384F"><enum>(I)</enum><text display-inline="yes-display-inline">has determined if the data asset is an open Government data asset, available by request under section 552 of title 5, or a public data asset eligible for disclosure under subsection (b); or</text>
 </subclause><subclause commented="no" id="H0BFE784300D84C27992B1D58BEB77D58"><enum>(II)</enum><text>as of the date of such indication, has not made such determination.</text> </subclause></clause><clause commented="no" id="H55A477BE0D7B41FA86FC457D639A6CD7"><enum>(iv)</enum><text>Any determination made under section 3582, if available.</text>
 </clause><clause commented="no" id="H4D12FD2FD11C4047B02652FAD28754D1"><enum>(v)</enum><text>A description of the method by which the public may access or request access to the data asset.</text> </clause><clause commented="no" id="H577369A598FE4D7AA9493F0BA10AFBD7"><enum>(vi)</enum><text>The date on which the data asset was most recently updated.</text>
 </clause><clause commented="no" id="H889EE6FFECAF41519CC9ADB8D0F7E9F9"><enum>(vii)</enum><text>Each agency responsible for maintaining the data asset.</text> </clause><clause commented="no" id="H961972FFA05740598EDD7B1944E72ABF"><enum>(viii)</enum><text>The owner of the data asset.</text>
 </clause><clause commented="no" id="HA5D4E11F029E424DB1F4268689C2C3C8"><enum>(ix)</enum><text>Any restrictions on the use of the data asset.</text> </clause><clause commented="no" id="H12203145101A491281021C6709BF7C27"><enum>(x)</enum><text>The location of the data asset.</text>
 </clause><clause commented="no" id="H55C6A4D3B8C94072A5E917314EF2493C"><enum>(xi)</enum><text display-inline="yes-display-inline">Any other metadata necessary to make the comprehensive data inventory useful to the agency and the public, or otherwise determined useful by the Director.</text>
 </clause></subparagraph><subparagraph commented="no" id="HFDA63A7F16424E2685CD4E572A970724"><enum>(B)</enum><text>A requirement for the head of an agency to exclude from the comprehensive data inventory any data asset contained on a national security system, as defined in section 11103 of title 40.</text>
 </subparagraph><subparagraph commented="no" id="H0EB518E413384038A82F60828CEF8919"><enum>(C)</enum><text display-inline="yes-display-inline">Criteria for the head of an agency to use in determining which information, if any, in the comprehensive data inventory shall not be made publicly available, which shall include, at a minimum, a requirement to ensure all information in the inventory that would be subject to disclosure under section 552 of title 5 is made publicly available.</text>
 </subparagraph><subparagraph commented="no" id="HDEB897961E6848778F049B0C2A5AA00B"><enum>(D)</enum><text display-inline="yes-display-inline">A requirement for the head of each agency, in accordance with a procedure established by the Director, to submit for inclusion in the Federal data catalogue maintained under subsection (c) the data inventory developed pursuant to subparagraph (C), including any real-time updates to such inventory and data assets, or any electronic hyperlink providing access to such data assets, made available in accordance with subparagraph (E), listed on such inventory.</text>
 </subparagraph><subparagraph commented="no" id="H048E4C48318F420DAFD8F5E07FB28B1E"><enum>(E)</enum><text>Criteria for the head of an agency to use in determining whether a particular data asset should not be made publicly available in a manner that takes into account—</text>
 <clause commented="no" id="HD5BDE02AC0D741A9AA34280CEB44C2AD"><enum>(i)</enum><text display-inline="yes-display-inline">risks and restrictions related to the disclosure of personally identifiable information, including the risk that an individual data asset in isolation does not pose a privacy or confidentiality risk but when combined with other available information may pose such a risk;</text>
 </clause><clause commented="no" id="H443D109D293549BB8AFB7DE6EC36A756"><enum>(ii)</enum><text>security considerations, including the risk that information in an individual data asset in isolation does not pose a security risk but when combined with other available information may pose such a risk;</text>
 </clause><clause commented="no" id="H6E2A1327997D42A5B6C4BC7F84C11F4E"><enum>(iii)</enum><text>the cost and benefits to the public of converting the data into a manner that could be understood and used by the public;</text>
 </clause><clause commented="no" id="HDD7A0CD87CA9443FBEA89377DD19C0DB"><enum>(iv)</enum><text>whether the data asset—</text> <subclause id="HD9B51416B8D743E79E73C857560A71A7"><enum>(I)</enum><text display-inline="yes-display-inline">is protected by intellectual property rights;</text>
 </subclause><subclause id="HFDC811873CBA4A55876D469D87FB7F86"><enum>(II)</enum><text display-inline="yes-display-inline">contains confidential business information, that could be withheld under section 552(b)(4) of title 5; or</text>
 </subclause><subclause id="HD5437D6210D54BF6B006B9A025ACFE02"><enum>(III)</enum><text display-inline="yes-display-inline">is restricted by contract or other binding, written agreement;</text> </subclause></clause><clause id="H839655A55125433E9FA433FBFFD5E885"><enum>(v)</enum><text display-inline="yes-display-inline">the expectation that all data assets that would otherwise be made available under section 552 of title 5 be disclosed; and</text>
 </clause><clause commented="no" id="H429A6749413D48A19271E5A41DF6E3CD"><enum>(vi)</enum><text>any other considerations that the Director determines to be relevant.</text> </clause></subparagraph></paragraph><paragraph id="H9272BA9C91594E479E35D34877DE5E5C"><enum>(3)</enum><header>Regular updates required</header><text>With respect to each data asset created or identified by an agency, the head of the agency shall update the comprehensive data inventory of the agency not later than 90 days after the date of such creation or identification.</text>
 </paragraph></subsection><subsection commented="no" id="H99111170C34F497194F9A78A92760F69"><enum>(b)</enum><header>Public data assets</header><text>The head of each agency shall submit public data assets, or links to public data assets available online, as open Government data assets for inclusion in the Federal data catalogue in accordance with the guidance established in subsection (a)(2).</text>
								</subsection><subsection id="H5BFE580D078E4F85A02A9748D9D156A5"><enum>(c)</enum><header>Federal data catalogue</header>
 <paragraph commented="no" id="H2D0EF0B2349E4180BD0CA9E9E2B80E02"><enum>(1)</enum><header>In general</header><text>The Administrator of General Services shall maintain a single public interface online as a point of entry dedicated to sharing agency data assets with the public which shall be known as the <quote>Federal data catalogue</quote>. The Administrator and the Director shall ensure that agencies can submit public data assets or links to public data assets to be published and made publicly available on the interface.</text>
 </paragraph><paragraph commented="no" id="HC554B1463FF24F69A288627911AB33E0"><enum>(2)</enum><header>Repository</header><text>The Director shall collaborate with the Office of Government Information Services and the Administrator of General Services to develop and maintain an online repository of tools, best practices, and schema standards to facilitate the adoption of open data practices across the Federal Government, which shall—</text>
 <subparagraph commented="no" id="H70594D8EA63540388EA136407A560797"><enum>(A)</enum><text>include any definitions, regulations, policies, checklists, and case studies related to open data policy;</text>
 </subparagraph><subparagraph commented="no" id="H9B8E59487741489FAFA52629EA63001E"><enum>(B)</enum><text display-inline="yes-display-inline">facilitate collaboration and the adoption of best practices across the Federal Government relating to the adoption of open data practices; and</text>
 </subparagraph><subparagraph commented="no" id="HB1063A3D6EAC402E850E9EFD277F1D6F"><enum>(C)</enum><text>be made available on the Federal data catalogue developed under paragraph (1).</text> </subparagraph></paragraph><paragraph commented="no" id="H626C02E2599A48DEB2E06DC4D3BB87C8"><enum>(3)</enum><header>Access to other data assets</header><text>The Director shall ensure the Federal data catalogue maintained under paragraph (1) provides information on how the public can access data assets included in the public data inventory that are not yet available on the Federal data catalogue, including information regarding the application process established under section 3583 of title 44.</text>
 </paragraph></subsection><subsection id="HE44AE65650A74D3EB0CEAD307D056D11"><enum>(d)</enum><header>Delegation</header><text display-inline="yes-display-inline">The Director shall delegate to the Administrator of the Office of Information and Regulatory Affairs and the Administrator of the Office of Electronic Government the authority to jointly issue guidance required under this section.</text>
 </subsection><subsection id="HB9C72B27AB70481F976EA6B8105B6415"><enum>(e)</enum><header>Use of existing resources</header><text>To the extent practicable, the head of each agency shall use existing procedures and systems to carry out agency requirements under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H19B96F8A52C748B8B842B0FCEEB80B5C"><enum>(2)</enum><header>Technical and conforming amendments</header>
 <subparagraph id="H0B66D8461D16469E8AF8CD96B34DE0BC"><enum>(A)</enum><header>Table of sections</header><text display-inline="yes-display-inline">The item relating to section 3511 of the table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, is amended to read as follows:</text>

 </subsection><subsection id="HB6A4AD53B9444005848EFEE052946729"><enum>(b)</enum><header>Qualifications</header><text>The Chief Data Officer of an agency shall be designated on the basis of demonstrated training and experience in data management, collection, analysis, protection, use, and dissemination, including with respect to any statistical and related techniques to protect and de-identify confidential data.</text>
 </subsection><subsection id="HAB14E12743F449A99FED4E0725DEB24A"><enum>(c)</enum><header>Limitations</header><text>The Chief Data Officer of an agency may not simultaneously serve as any of the following:</text> <paragraph id="H4435C0C89EBB4316BFAAE8344E8A2F20"><enum>(1)</enum><text>The Chief Financial Officer of any agency.</text>
 </paragraph><paragraph id="H48C90714355D46D2B87434398E2BD98B"><enum>(2)</enum><text>The Chief Human Capital Officer of any agency.</text> </paragraph><paragraph id="HAD7A5C70D29048FAA1D0DBB9BAAD4CD4"><enum>(3)</enum><text>The Chief Acquisition Officer of any agency.</text>
 </paragraph><paragraph id="H0ED20F98A23B4E1D8D2E385A47013FD2"><enum>(4)</enum><text>The Inspector General of any agency.</text> </paragraph><paragraph id="HA8921E3099844933A38A1A417783D9B4"><enum>(5)</enum><text>The Performance Improvement Officer of any agency.</text>
 </paragraph></subsection><subsection id="HA6C5CB5F019046938380D0F60611ABF4"><enum>(d)</enum><header>Functions</header><text>The Chief Data Officer of an agency shall—</text> <paragraph id="HED59E0C3F8E04C30B705A4C6AF21A036"><enum>(1)</enum><text>be responsible for lifecycle data management;</text>
 </paragraph><paragraph id="HE4D2C5EEE0704F58A129BA3288BB9EF9"><enum>(2)</enum><text>coordinate with any official in the agency responsible for using, protecting, disseminating, and generating data to ensure that the data needs of the agency are met;</text>
 </paragraph><paragraph id="HABCD3B9908E04A3194FF1ED0A765EEB6"><enum>(3)</enum><text>manage data assets of the agency, including the standardization of data format, sharing of data assets, and publication of data assets in accordance with applicable law;</text>
 </paragraph><paragraph id="HEE39849EF45340A0AFB730B3C439DD4A"><enum>(4)</enum><text>in carrying out the requirement under paragraphs (3) and (5), consult with any statistical official of the agency (as designated under section 315 of title 5);</text>
 </paragraph><paragraph id="HEF028AB53C4F4E1783D150DD2E69A903"><enum>(5)</enum><text>carry out the requirements of the agency under subsections (b) through (d), (f), and (i) of section 3506, section 3507, and section 3511;</text>
 </paragraph><paragraph id="HDC973008163C4C68AD331F656FD5C6E3"><enum>(6)</enum><text>ensure that agency data conforms with data management best practices;</text> </paragraph><paragraph commented="no" id="HE1A776AA87B74CDEB6F8A60F36793CF0"><enum>(7)</enum><text>engage agency employees, the public, and contractors in using public data assets and encourage collaborative approaches on improving data use;</text>
 </paragraph><paragraph id="H6AE182C4D41F4891B6A1F43B24F314DE"><enum>(8)</enum><text>support the Performance Improvement Officer of the agency in identifying and using data to carry out the functions described in section 1124(a)(2) of title 31;</text>
 </paragraph><paragraph id="H704687A1AA4246EFB84731DD7B38F54F"><enum>(9)</enum><text>support the Chief Evaluation Officer of the agency in obtaining data to carry out the functions described in section 314 of title 5;</text>
 </paragraph><paragraph id="HF7CD46AAEA2942F9B52A21871CDC5AFA"><enum>(10)</enum><text>review the impact of the infrastructure of the agency on data asset accessibility and coordinate with the Chief Information Officer of the agency to improve such infrastructure to reduce barriers that inhibit data asset accessibility;</text>
 </paragraph><paragraph commented="no" id="H0D9CBCBD324F462D9BA12B1542CE200E"><enum>(11)</enum><text display-inline="yes-display-inline">ensure that, to the extent practicable, the agency maximizes the use of data in the agency, including for the production of evidence (as defined in section 3561), cybersecurity, and the improvement of agency operations;</text>
 </paragraph><paragraph id="HA03B2AF62DF4480188A4F448E42B37AF"><enum>(12)</enum><text>identify points of contact for roles and responsibilities related to open data use and implementation (as required by the Director);</text>
 </paragraph><paragraph id="H1EA9B1E98F5845F798F199D4F15019F0"><enum>(13)</enum><text>serve as the agency liaison to other agencies and the Office of Management and Budget on the best way to use existing agency data for statistical purposes (as defined in section 3561); and</text>
 </paragraph><paragraph commented="no" id="HCBEB2DB2397F40AFBD414996A519B573"><enum>(14)</enum><text display-inline="yes-display-inline">comply with any regulation and guidance issued under subchapter III, including the acquisition and maintenance of any required certification and training.</text>
									</paragraph></subsection><subsection commented="no" id="HCF29918AE9E247D18418932C8FD4716C"><enum>(e)</enum><header>Delegation of responsibilities</header>
 <paragraph commented="no" id="HB89822BCE2A54503A5BE953E5B6EC820"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To the extent necessary to comply with statistical laws, the Chief Data Officer of an agency shall delegate any responsibility under subsection (d) to the head of a statistical agency or unit (as defined in section 3561) within the agency.</text>
 </paragraph><paragraph commented="no" id="H048C08DEAA424F6E9989035A4254DA1F"><enum>(2)</enum><header>Consultation</header><text>To the extent permissible under law, the individual to whom a responsibility has been delegated under paragraph (1) shall consult with the Chief Data Officer of the agency in carrying out such responsibility.</text>
 </paragraph><paragraph commented="no" id="HAE411077CFD74F878A18061533019252"><enum>(3)</enum><header>Deference</header><text>The Chief Data Officer of the agency shall defer to the individual to whom a responsibility has been delegated under paragraph (1) regarding the necessary delegation of such responsibility with respect to any data acquired, maintained, or disseminated by the agency under applicable statistical law.</text>
 </paragraph></subsection><subsection commented="no" id="H6C817481665A4B8DA03561F7AECBC32A"><enum>(f)</enum><header>Reports</header><text display-inline="yes-display-inline">The Chief Data Officer of an agency shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives an annual report on the compliance of the agency with the requirements of this subchapter, including information on each requirement that the agency could not carry out and, if applicable, what the agency needs to carry out such requirement.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

 <subsection commented="no" id="H97BEB217789940F0854D4C88741DCE56"><enum>(a)</enum><header>Establishment</header><text>There is established in the Office of Management and Budget a Chief Data Officer Council (in this section referred to as the <quote>Council</quote>).</text>
 </subsection><subsection commented="no" id="H176E87585DE548239C89498243EAB803"><enum>(b)</enum><header>Purpose and functions</header><text>The Council shall—</text> <paragraph commented="no" id="H957F25944B664AC5A35D9D9DCB0E323F"><enum>(1)</enum><text>establish Governmentwide best practices for the use, protection, dissemination, and generation of data;</text>
 </paragraph><paragraph commented="no" id="H267C4D680AB84999B1C9AAEFF17D59F2"><enum>(2)</enum><text>promote and encourage data sharing agreements between agencies;</text> </paragraph><paragraph commented="no" id="H88D253198B6F4D8F949EED638F3E5F85"><enum>(3)</enum><text>identify ways in which agencies can improve upon the production of evidence for use in policymaking;</text>
 </paragraph><paragraph commented="no" id="HDB220D8BD9814D1E96760903AB5EF391"><enum>(4)</enum><text>consult with the public and engage with private users of Government data and other stakeholders on how to improve access to data assets of the Federal Government; and</text>
 </paragraph><paragraph commented="no" id="HA13C162F640340F9BDFB0BB147C618F0"><enum>(5)</enum><text>identify and evaluate new technology solutions for improving the collection and use of data.</text> </paragraph></subsection><subsection commented="no" id="H771A8B3905CC494DB0C403CB40A5AD3F"><enum>(c)</enum><header>Membership</header> <paragraph commented="no" id="HF6E859C8B9434EC0B537529117976C9A"><enum>(1)</enum><header>In general</header><text>The Chief Data Officer of each agency shall serve as a member of the Council.</text>
 </paragraph><paragraph commented="no" id="H13BDAC1EBCA74BA5BB622428D12F9FF0"><enum>(2)</enum><header>Chair</header><text>The Director shall select the Chair of the Council from among the members of the Council.</text> </paragraph><paragraph commented="no" id="HD1E57CA23D264D14A8D6B85CEBD3214E"><enum>(3)</enum><header>Additional members</header><text display-inline="yes-display-inline">The Administrator of the Office of Electronic Government shall serve as a member of the Council.</text>
 </paragraph><paragraph commented="no" id="H34E706E40811467B8BF0D37163D2A9F1"><enum>(4)</enum><header>Ex officio member</header><text>The Director shall appoint a representative for all Chief Information Officers and Chief Evaluation Officers, and such representative shall serve as an ex officio member of the Council.</text>
 </paragraph></subsection><subsection commented="no" id="H1BC9D39F472F4E8385A38DE1D157C3E6"><enum>(d)</enum><header>Reports</header><text>The Council shall submit to the Director, the Committee on Homeland Security and Governmental Affairs of the Senate, and the Committee on Oversight and Government Reform of the House of Representatives a biennial report on the work of the Council.</text>
								</subsection><subsection commented="no" id="H7BCBDE1C3F0D4C98A425FA524A00918E"><enum>(e)</enum><header>Evaluation and termination</header>
 <paragraph commented="no" id="HCC409719721D46DE808A0C3DFF6EA585"><enum>(1)</enum><header>GAO evaluation of Council</header><text display-inline="yes-display-inline">Not later than 4 years after date of the enactment of this section, the Comptroller General shall submit to Congress a report on whether the additional duties of the Council improved the use of evidence and program evaluation in the Federal Government.</text>
 </paragraph><paragraph commented="no" id="H8ECBAC04E59F4200B74526F6043929F1"><enum>(2)</enum><header>Termination of Council</header><text display-inline="yes-display-inline">The Council shall terminate and this section shall be repealed upon the expiration of the two-year period that begins on the date the Comptroller General submits the evaluation under paragraph (1) to Congress.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H7A6A7F00A8C146C8AA25D1E1FACAE738"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, is amended by inserting before the item relating to section 3521 the following new item:</text>

 <paragraph id="H082BE779B6BB49D9BA0ADF4B689E42D8"><enum>(1)</enum><header>GAO report</header><text>Not later than three years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives a report that identifies, to the extent practicable—</text>
 <subparagraph id="H941F076F401142CA961338C9DE6A6257"><enum>(A)</enum><text>the value of information made available to the public as a result of this Act and the amendments made by this Act;</text>
 </subparagraph><subparagraph id="H8662FD93701040D0A15584723D758FB8"><enum>(B)</enum><text>whether the public availability of any information that has not yet been made so available would be valuable to the public; and</text>
 </subparagraph><subparagraph id="HE276D235AFB641AEB6E57EB3321F57D3"><enum>(C)</enum><text>the completeness of each comprehensive data inventory developed under section 3511 of title 44, United States Code.</text>
 </subparagraph></paragraph><paragraph id="H214F241E4B1E4EFDBE11C4C0F7CDD7C7"><enum>(2)</enum><header>Biennial OMB report</header><text>Not later than one year after date of the enactment of this Act, and biennially thereafter, the Director of the Office of Management and Budget shall electronically publish a report on agency performance and compliance with this Act and the amendments made by this Act.</text>
					</paragraph></subsection></section></title><title commented="no" id="H957DBEAAEEBA4A4CB920EEC8EE4E8E01"><enum>III</enum><header>Confidential Information Protection and Statistical Efficiency</header>
 <section commented="no" id="HB3EE47C83B8C4F5DADAE21E0098CB108"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Confidential Information Protection and Statistical Efficiency Act of 2017</short-title></quote>.</text> </section><section id="HF7E6E5ECE02B4066B4E7EAF9EBD876A6" section-type="subsequent-section"><enum>302.</enum><header>Confidential information protection and statistical efficiency</header> <subsection id="HA2AA6F40C9854E7581A928B3F7834927"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code, is amended by adding at the end the following new subchapter:</text>

						<subchapter id="H58D19B7CECFA4DF7ADB1C1E68334C12F"><enum>III</enum><header>Confidential Information Protection and Statistical Efficiency</header>
							<part id="HA20A26CD2127446BB7120B2402C1DC5D"><enum>A</enum><header>General</header>
 <section id="HFCC936D776B04364969B15EBA34D72DD"><enum>3561.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text> <paragraph id="H2805E9855E3B44FEB93C25597AA72BC0"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means any entity that falls within the definition of the term <term>executive agency</term>, as defined in section 102 of title 31, or <quote>agency</quote>, as defined in section 3502.</text>
 </paragraph><paragraph id="HA4C11B359A9B4CBEAAFD25FE43EAA675"><enum>(2)</enum><header>Agent</header><text>The term <term>agent</term> means an individual—</text> <subparagraph id="HE1F9D1F644EC441489DF90213FF7FCA2"><enum>(A)</enum> <clause commented="no" display-inline="yes-display-inline" id="H5BB4D1E825A14F41B09D3AB2DEEE6352"><enum>(i)</enum><text>who is an employee of a private organization or a researcher affiliated with an institution of higher learning (including a person granted special sworn status by the Bureau of the Census under section 23(c) of title 13), and with whom a contract or other agreement is executed, on a temporary basis, by an executive agency to perform exclusively statistical activities under the control and supervision of an officer or employee of that agency;</text>
 </clause><clause id="H8353A86DE1F840139E639BFBF79BD898"><enum>(ii)</enum><text>who is working under the authority of a government entity with which a contract or other agreement is executed by an executive agency to perform exclusively statistical activities under the control of an officer or employee of that agency;</text>
 </clause><clause id="H0B212D60051C4493924C73422BE74BF7"><enum>(iii)</enum><text>who is a self-employed researcher, a consultant, a contractor, or an employee of a contractor, and with whom a contract or other agreement is executed by an executive agency to perform a statistical activity under the control of an officer or employee of that agency; or</text>
 </clause><clause id="H3FA01639D75D4D37AB108584400AD1C1"><enum>(iv)</enum><text>who is a contractor or an employee of a contractor, and who is engaged by the agency to design or maintain the systems for handling or storage of data received under this subchapter; and</text>
 </clause></subparagraph><subparagraph id="H8CF9339E9FF341799DBD269585D17FE5"><enum>(B)</enum><text>who agrees in writing to comply with all provisions of law that affect information acquired by that agency.</text>
 </subparagraph></paragraph><paragraph id="H0F903CB1A93F4723A482307E0533703D"><enum>(3)</enum><header>Business data</header><text>The term <term>business data</term> means operating and financial data and information about businesses, tax-exempt organizations, and government entities.</text>
 </paragraph><paragraph commented="no" id="H5517A9B949204EDCB1D7F5F4FE25A20E"><enum>(4)</enum><header>Data asset</header><text>The term <term>data asset</term> has the meaning given that term in section 3502.</text> </paragraph><paragraph commented="no" id="H918892BE0E1347FF9F89920FB777F0A2"><enum>(5)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text>
 </paragraph><paragraph commented="no" id="HBEBB8DA5F559478B94C97E6B1C3587EF"><enum>(6)</enum><header>Evidence</header><text>The term <term>evidence</term> means information produced as a result of statistical activities conducted for a statistical purpose.</text>
 </paragraph><paragraph id="H06AABD7358604F6BA008383B1108C8A8"><enum>(7)</enum><header>Identifiable form</header><text>The term <term>identifiable form</term> means any representation of information that permits the identity of the respondent to whom the information applies to be reasonably inferred by either direct or indirect means.</text>
 </paragraph><paragraph id="H91FC509952EC4D1B8EF1D45749114A0E"><enum>(8)</enum><header>Nonstatistical purpose</header><text>The term <term>nonstatistical purpose</term>—</text> <subparagraph id="HAAFEB8F6A4E44CECAD73226DBF543344"><enum>(A)</enum><text>means the use of data in identifiable form for any purpose that is not a statistical purpose, including any administrative, regulatory, law enforcement, adjudicatory, or other purpose that affects the rights, privileges, or benefits of a particular identifiable respondent; and</text>
 </subparagraph><subparagraph id="HA26F51ED0DFA4BF59578EA4813462ACC"><enum>(B)</enum><text>includes the disclosure under section 552 of title 5 of data that are acquired for exclusively statistical purposes under a pledge of confidentiality.</text>
 </subparagraph></paragraph><paragraph id="H505A41F6DFE048CFA017D1DB85A871C3"><enum>(9)</enum><header>Respondent</header><text>The term <term>respondent</term> means a person who, or organization that, is requested or required to supply information to an agency, is the subject of information requested or required to be supplied to an agency, or provides that information to an agency.</text>
 </paragraph><paragraph id="HD4EAF9ACC4D5484985DAE543D05EA34B"><enum>(10)</enum><header>Statistical activities</header><text>The term <term>statistical activities</term>—</text> <subparagraph id="HFA32E2FCA40447B0985A535EAC239548"><enum>(A)</enum><text>means the collection, compilation, processing, or analysis of data for the purpose of describing or making estimates concerning the whole, or relevant groups or components within, the economy, society, or the natural environment; and</text>
 </subparagraph><subparagraph id="HEBD3BF97BC2C45E79766A8AFF36AAEEB"><enum>(B)</enum><text>includes the development of methods or resources that support those activities, such as measurement methods, models, statistical classifications, or sampling frames.</text>
 </subparagraph></paragraph><paragraph id="HBF802C7346A241548E6EDE5A414EDCE6"><enum>(11)</enum><header>Statistical agency or unit</header><text display-inline="yes-display-inline">The term <term>statistical agency or unit</term> means an agency or organizational unit of the executive branch whose activities are predominantly the collection, compilation, processing, or analysis of information for statistical purposes, as designated by the Director under section 3562.</text>
 </paragraph><paragraph id="H671ECE3C7BED477499D993EFD8A11E8D"><enum>(12)</enum><header>Statistical purpose</header><text>The term <term>statistical purpose</term>—</text> <subparagraph id="H7F2553372E9147729A0A03C6C3E7233D"><enum>(A)</enum><text>means the description, estimation, or analysis of the characteristics of groups, without identifying the individuals or organizations that comprise such groups; and</text>
 </subparagraph><subparagraph id="H24437EFB0AEB47F09002E8DC3DEF404B"><enum>(B)</enum><text>includes the development, implementation, or maintenance of methods, technical or administrative procedures, or information resources that support the purposes described in subparagraph (A).</text>
										</subparagraph></paragraph></section><section id="HD367130131B64604BCFE161FACC9B2CD"><enum>3562.</enum><header>Coordination and oversight of policies</header>
 <subsection id="H94F759CDB8BD4870AF99FC9E607CEEA3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall coordinate and oversee the confidentiality and disclosure policies established by this subchapter. The Director may promulgate rules or provide other guidance to ensure consistent interpretation of this subchapter by the affected agencies. The Director shall develop a process by which the Director designates agencies or organizational units as statistical agencies and units. The Director shall promulgate guidance to implement such process, which shall include specific criteria for such designation and methods by which the Director will ensure transparency in the process.</text>
 </subsection><subsection id="H0C107868ED4B4665BE65F462879A5DCF"><enum>(b)</enum><header>Agency rules</header><text>Subject to subsection (c), agencies may promulgate rules to implement this subchapter. Rules governing disclosures of information that are authorized by this subchapter shall be promulgated by the agency that originally collected the information.</text>
 </subsection><subsection id="HA31F04320D3947AFAE54482F3D4A72A2"><enum>(c)</enum><header>Review and approval of rules</header><text>The Director shall review any rules proposed by an agency pursuant to this subchapter for consistency with the provisions of this chapter and such rules shall be subject to the approval of the Director.</text>
									</subsection><subsection id="HF1212EF0FBEA48A583D861936D5F1668"><enum>(d)</enum><header>Reports</header>
 <paragraph id="H92FCC3363BC840F1B42CB0454E6F43D8"><enum>(1)</enum><text>The head of each agency shall provide to the Director such reports and other information as the Director requests.</text>
 </paragraph><paragraph commented="no" id="HF50BB785E2964F909DA594EAC8E869B1"><enum>(2)</enum><text>Each Designated Statistical Agency (as defined in section 3576(e)) shall report annually to the Director, the Committee on Oversight and Government Reform of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs of the Senate on the actions it has taken to implement section 3576. The report shall include copies of each written agreement entered into pursuant to section 3576(c)(1) for the applicable year.</text>
 </paragraph><paragraph id="HA5708BF29C124D148F64DEAABBC4B105"><enum>(3)</enum><text>The Director shall include a summary of reports submitted to the Director under this subsection and actions taken by the Director to advance the purposes of this subchapter in the annual report to Congress on statistical programs prepared under section 3504(e)(2).</text>
										</paragraph></subsection></section><section id="H187DF3FE2D024C15AA83709EDCB70BF9"><enum>3563.</enum><header>Federal statistical agencies</header>
									<subsection commented="no" id="H0A51D6237B2140AF9F1B47D0D3C4813F"><enum>(a)</enum><header>Responsibilities</header>
 <paragraph commented="no" id="H512A4682A98A4F588ABC6F883877DD00"><enum>(1)</enum><header>In general</header><text>Each statistical agency or unit shall—</text> <subparagraph commented="no" id="HCEE33D4968794729B911E0EC5D753CCA"><enum>(A)</enum><text>produce and disseminate relevant and timely statistical information;</text>
 </subparagraph><subparagraph commented="no" id="H58F1F577D2454CED82402C84C9A27F5A"><enum>(B)</enum><text>conduct credible and accurate statistical activities;</text> </subparagraph><subparagraph commented="no" id="H36A6D696A71D49609CA42E4764957553"><enum>(C)</enum><text>conduct objective statistical activities; and</text>
 </subparagraph><subparagraph commented="no" id="H5C8B7A4E674143F3A6ABF1AF21256EC7"><enum>(D)</enum><text>protect the trust of information providers by ensuring the confidentiality and exclusive statistical use of their responses</text>
 </subparagraph></paragraph><paragraph commented="no" id="H1CFD6FFAE328464590E721248E2E5AA4"><enum>(2)</enum><header>Policies, best practices, and procedures</header><text>Each statistical agency or unit shall adopt policies, best practices, and appropriate procedures to implement the responsibilities described in paragraph (1).</text>
 </paragraph></subsection><subsection commented="no" id="HD4A025EBC2134AE3B3B22945A0D936BD"><enum>(b)</enum><header>Support from other agencies</header><text>The head of each agency shall enable, support, and facilitate statistical agencies or units in carrying out the responsibilities described in subsection (a)(1).</text>
 </subsection><subsection commented="no" id="HEB679368EB9A4E0EA50221C422B29AF2"><enum>(c)</enum><header>Regulations</header><text>The Director shall prescribe regulations to carry out this section.</text> </subsection><subsection commented="no" id="H9AC2B5088D354CC790D7EF31D20D2AEB"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph commented="no" id="H436E08F0C9084930BC133A320FE77DB0"><enum>(1)</enum><header>Accurate</header><text>The term <term>accurate</term>, when used with respect to statistical activities, means statistics that consistently match the events and trends being measured.</text>
 </paragraph><paragraph commented="no" id="H2CC35727ACDD44FD883443B91593A497"><enum>(2)</enum><header>Confidentiality</header><text>The term <term>confidentiality</term> means a quality or condition accorded to information as an obligation not to disclose that information to an unauthorized party.</text>
 </paragraph><paragraph commented="no" id="H30D41807C0FC46F5B841104D522602F8"><enum>(3)</enum><header>Objective</header><text>The term <term>objective</term>, when used with respect to statistical activities, means accurate, clear, complete, and unbiased.</text> </paragraph><paragraph commented="no" id="H2A025B5D980C46F7AC2DBF1C162BBDEA"><enum>(4)</enum><header>Relevant</header><text>The term <term>relevant</term>, when used with respect to statistical information, means processes, activities, and things that matter to policymakers and public and private sector data users.</text>
										</paragraph></subsection></section><section id="H5964DE3B5DFA4686A67040AC21339501"><enum>3564.</enum><header>Effect on other laws</header>
 <subsection id="H0C338670B81E4BA5BEA28C9894F1468A"><enum>(a)</enum><header>Title <enum-in-header>44</enum-in-header>, United States Code</header><text display-inline="yes-display-inline">This subchapter does not diminish the authority under section 3510 of the Director to direct, and of an agency to make, disclosures that are not inconsistent with any applicable law.</text>
 </subsection><subsection commented="no" id="HF9A7EAAD4D124E7C964DE6A6DAD2F71C"><enum>(b)</enum><header>Title <enum-in-header>13</enum-in-header> and title <enum-in-header>44</enum-in-header>, United States Code</header><text display-inline="yes-display-inline">This subchapter does not diminish the authority of the Bureau of the Census to provide information in accordance with sections 8, 16, 301, and 401 of title 13 and section 2108 of this title.</text>
 </subsection><subsection commented="no" id="HC998675364CE49DEB9200390BFE8A589"><enum>(c)</enum><header>Title <enum-in-header>13</enum-in-header>, United States Code</header><text display-inline="yes-display-inline">This subchapter shall not be construed as authorizing the disclosure for nonstatistical purposes of demographic data or information collected by the Bureau of the Census pursuant to section 9 of title 13.</text>
 </subsection><subsection commented="no" id="H9DF595F4D445416F830CE12BE36206D3"><enum>(d)</enum><header>Various energy statutes</header><text>Data or information acquired by the Energy Information Administration under a pledge of confidentiality and designated by the Energy Information Administration to be used for exclusively statistical purposes shall not be disclosed in identifiable form for nonstatistical purposes under—</text>
 <paragraph commented="no" id="HDBEA98F781534FA4A6F27D9A660BEA7C"><enum>(1)</enum><text>section 12, 20, or 59 of the Federal Energy Administration Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/771">15 U.S.C. 771</external-xref>, 779, 790h);</text> </paragraph><paragraph commented="no" id="H29DCD7EC49E543BFA5BE729AFA5941E6"><enum>(2)</enum><text>section 11 of the Energy Supply and Environmental Coordination Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/796">15 U.S.C. 796</external-xref>); or</text>
 </paragraph><paragraph commented="no" id="HE342A4B24F8440388B755A707FDDE296"><enum>(3)</enum><text>section 205 or 407 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7135">42 U.S.C. 7135</external-xref>, 7177).</text> </paragraph></subsection><subsection commented="no" id="H38E06135DCDD41FA827EF6C017BF31F1"><enum>(e)</enum><header>Section <enum-in-header>201</enum-in-header> of Congressional Budget Act of <enum-in-header>1974</enum-in-header></header><text display-inline="yes-display-inline">This subchapter shall not be construed to limit any authorities of the Congressional Budget Office to work (consistent with laws governing the confidentiality of information the disclosure of which would be a violation of law) with databases of Designated Statistical Agencies (as defined in section 3576(e)), either separately or, for data that may be shared pursuant to section 3576(c) or other authority, jointly in order to improve the general utility of these databases for the statistical purpose of analyzing pension and health care financing issues.</text>
 </subsection><subsection id="H13B26388A62941049BF6D2E4B1C96F39"><enum>(f)</enum><header>Preemption of State law</header><text>Nothing in this subchapter shall preempt applicable State law regarding the confidentiality of data collected by the States.</text>
 </subsection><subsection commented="no" id="HC2E9BD87B39546C09CAB7C0842079DB0"><enum>(g)</enum><header>Statutes regarding false statements</header><text>Notwithstanding section 3572, information collected by an agency for exclusively statistical purposes under a pledge of confidentiality may be provided by the collecting agency to a law enforcement agency for the prosecution of submissions to the collecting agency of false statistical information under statutes that authorize criminal penalties (such as section 221 of title 13) or civil penalties for the provision of false statistical information, unless such disclosure or use would otherwise be prohibited under Federal law.</text>
 </subsection><subsection id="H6DFBFE5626E641BAB8F813E7EDF46FE6"><enum>(h)</enum><header>Construction</header><text>Nothing in this subchapter shall be construed as restricting or diminishing any confidentiality protections or penalties for unauthorized disclosure that otherwise apply to data or information collected for statistical purposes or nonstatistical purposes, including, but not limited to, <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103</external-xref> of the Internal Revenue Code of 1986.</text>
 </subsection><subsection id="H5E7BD1FC8CC644A39C24EFD6E19CE70B"><enum>(i)</enum><header>Authority of Congress</header><text>Nothing in this subchapter shall be construed to affect the authority of the Congress, including its committees, members, or agents, to obtain data or information for a statistical purpose, including for oversight of an agency’s statistical activities.</text>
									</subsection></section></part><part id="H4D65917F65344AE5ACF7E0513507EDA8"><enum>B</enum><header>Confidential Information Protection</header>
								<section id="H77FC712194ED49C79743F71878825244"><enum>3571.</enum><header>Findings</header>
 <text display-inline="no-display-inline">The Congress finds the following:</text> <paragraph id="HF3FFEB92DF344A038DD6726A452CF9D0"><enum>(1)</enum><text>Individuals, businesses, and other organizations have varying degrees of legal protection when providing information to the agencies for strictly statistical purposes.</text>
 </paragraph><paragraph id="HD8145D36FFAE4FB480E83D2397C079A4"><enum>(2)</enum><text>Pledges of confidentiality by agencies provide assurances to the public that information about individuals or organizations or provided by individuals or organizations for exclusively statistical purposes will be held in confidence and will not be used against such individuals or organizations in any agency action.</text>
 </paragraph><paragraph id="H7861B0F3F6524A68AB978986C67C8BD5"><enum>(3)</enum><text>Protecting the confidentiality interests of individuals or organizations who provide information under a pledge of confidentiality for Federal statistical programs serves both the interests of the public and the needs of society.</text>
 </paragraph><paragraph id="H99D7CE430F614EC0A790754BB18843B8"><enum>(4)</enum><text>Declining trust of the public in the protection of information provided under a pledge of confidentiality to the agencies adversely affects both the accuracy and completeness of statistical analyses.</text>
 </paragraph><paragraph id="H16B1CD61339446F5871FD2EAD6104039"><enum>(5)</enum><text>Ensuring that information provided under a pledge of confidentiality for statistical purposes receives protection is essential in continuing public cooperation in statistical programs.</text>
									</paragraph></section><section id="HBA0DD64EB8DC4F389DE4DACF0D8B18C0"><enum>3572.</enum><header>Confidential information protection</header>
 <subsection id="H911D4DC6E0FD44A1B651108CC0277223"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are the following:</text> <paragraph id="H45E304C0011E4FF7A7A2C7BAAB4EECC0"><enum>(1)</enum><text>To ensure that information supplied by individuals or organizations to an agency for statistical purposes under a pledge of confidentiality is used exclusively for statistical purposes.</text>
 </paragraph><paragraph id="H9DA198CAE8744064875E72AB7B59683E"><enum>(2)</enum><text>To ensure that individuals or organizations who supply information under a pledge of confidentiality to agencies for statistical purposes will neither have that information disclosed in identifiable form to anyone not authorized by this subchapter nor have that information used for any purpose other than a statistical purpose.</text>
 </paragraph><paragraph id="HE04EF7DE2266457BAF17D627326B3B97"><enum>(3)</enum><text>To safeguard the confidentiality of individually identifiable information acquired under a pledge of confidentiality for statistical purposes by controlling access to, and uses made of, such information.</text>
 </paragraph></subsection><subsection id="HDECEA26982164BABB1E9268DD0B2481C"><enum>(b)</enum><header>Use of statistical data or information</header><text>Data or information acquired by an agency under a pledge of confidentiality and for exclusively statistical purposes shall be used by officers, employees, or agents of the agency exclusively for statistical purposes and protected in accordance with such pledge.</text>
									</subsection><subsection id="HFBEFFFEB469647EEA9D90E90C12D6431"><enum>(c)</enum><header>Disclosure of statistical data or information</header>
 <paragraph id="HF0D8D579E78A4590BB76ACA757B38861"><enum>(1)</enum><text>Data or information acquired by an agency under a pledge of confidentiality for exclusively statistical purposes shall not be disclosed by an agency in identifiable form, for any use other than an exclusively statistical purpose, except with the informed consent of the respondent.</text>
 </paragraph><paragraph id="H4E591A18865943AABC80AB9E83504D09"><enum>(2)</enum><text>A disclosure pursuant to paragraph (1) is authorized only when the head of the agency approves such disclosure and the disclosure is not prohibited by any other law.</text>
 </paragraph><paragraph id="H38417A597DED4495995D8611280125BC"><enum>(3)</enum><text>This section does not restrict or diminish any confidentiality protections in law that otherwise apply to data or information acquired by an agency under a pledge of confidentiality for exclusively statistical purposes.</text>
 </paragraph></subsection><subsection id="HCEBC36530D434F7DA9CB876FAE2501BB"><enum>(d)</enum><header>Rule for use of data or information for nonstatistical purposes</header><text>A statistical agency or unit shall clearly distinguish any data or information it collects for nonstatistical purposes (as authorized by law) and provide notice to the public, before the data or information is collected, that the data or information could be used for nonstatistical purposes.</text>
 </subsection><subsection id="H35D6AE4962C54FA3B0D345D2830EA623"><enum>(e)</enum><header>Designation of agents</header><text>A statistical agency or unit may designate agents, by contract or by entering into a special agreement containing the provisions required under section 3561(2) for treatment as an agent under that section, who may perform exclusively statistical activities, subject to the limitations and penalties described in this subchapter.</text>
 </subsection><subsection id="HA8BF3A2B5BE74C47899275568EE31E09"><enum>(f)</enum><header>Fines and penalties</header><text>Whoever, being an officer, employee, or agent of an agency acquiring information for exclusively statistical purposes, having taken and subscribed the oath of office, or having sworn to observe the limitations imposed by this section, comes into possession of such information by reason of his or her being an officer, employee, or agent and, knowing that the disclosure of the specific information is prohibited under the provisions of this subchapter, willfully discloses the information in any manner to a person or agency not entitled to receive it, shall be guilty of a class E felony and imprisoned for not more than five years, or fined not more than $250,000, or both.</text>
									</subsection></section></part><part id="H6691E7236F5747178218DAF2DA16F0D9"><enum>C</enum><header>Statistical Efficiency</header>
								<section id="H747B797AE9B04246B2DF58C103BD755D"><enum>3575.</enum><header>Findings</header>
 <text display-inline="no-display-inline">The Congress finds the following:</text> <paragraph id="HB17331A62C304635ABB1AF7CC0D980F8"><enum>(1)</enum><text>Federal statistics are an important source of information for public and private decision-makers such as policymakers, consumers, businesses, investors, and workers.</text>
 </paragraph><paragraph id="H9ADD55E9A0DE4598BF7ED2C79C0BC620"><enum>(2)</enum><text>Federal statistical agencies should continuously seek to improve their efficiency. Statutory constraints limit the ability of these agencies to share data and thus to achieve higher efficiency for Federal statistical programs.</text>
 </paragraph><paragraph id="H4D77E65AA2D64BEFBA6BBD77E90E8DD5"><enum>(3)</enum><text>The quality of Federal statistics depends on the willingness of businesses to respond to statistical surveys. Reducing reporting burdens will increase response rates, and therefore lead to more accurate characterizations of the economy.</text>
 </paragraph><paragraph id="H109272858E5249159BA7A48EF099B024"><enum>(4)</enum><text>Enhanced sharing of business data among the Bureau of the Census, the Bureau of Economic Analysis, and the Bureau of Labor Statistics for exclusively statistical purposes will improve their ability to track more accurately the large and rapidly changing nature of United States business. In particular, the statistical agencies will be able to better ensure that businesses are consistently classified in appropriate industries, resolve data anomalies, produce statistical samples that are consistently adjusted for the entry and exit of new businesses in a timely manner, and correct faulty reporting errors quickly and efficiently.</text>
 </paragraph><paragraph id="HADA3850528084E81BF8CF8A664B5C44A"><enum>(5)</enum><text>Congress enacted the International Investment and Trade in Services Survey Act (<external-xref legal-doc="public-law" parsable-cite="pl/94/472">Public Law 94–472</external-xref>), which allowed the Bureau of the Census, the Bureau of Economic Analysis, and the Bureau of Labor Statistics to share data on foreign-owned companies. The Act not only expanded detailed industry coverage from 135 industries to over 800 industries with no increase in the data collected from respondents but also demonstrated how data sharing can result in the creation of valuable data products.</text>
 </paragraph><paragraph id="HF81E53E889834F76BA1466577223D24F"><enum>(6)</enum><text>With part B of this subchapter, the sharing of business data among the Bureau of the Census, the Bureau of Economic Analysis, and the Bureau of Labor Statistics continues to ensure the highest level of confidentiality for respondents to statistical surveys.</text>
									</paragraph></section><section commented="no" id="HE4D4F1207AE5495BA5F895011411F5A8"><enum>3576.</enum><header>Designated Statistical Agencies</header>
 <subsection id="H0942AAD84216437ABEE736376B193B4C"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are the following:</text> <paragraph id="H2F76C46A9AF54E1E9FC9D0E98306370C"><enum>(1)</enum><text>To authorize the sharing of business data among the Bureau of the Census, the Bureau of Economic Analysis, and the Bureau of Labor Statistics for exclusively statistical purposes.</text>
 </paragraph><paragraph id="H62DBD82B6B0D42269709CEC11B749D08"><enum>(2)</enum><text>To reduce the paperwork burdens imposed on businesses that provide requested information to the Federal Government.</text>
 </paragraph><paragraph id="HC7D25E31834943A9B026D11FE378CAAF"><enum>(3)</enum><text>To improve the comparability and accuracy of Federal economic statistics by allowing the Bureau of the Census, the Bureau of Economic Analysis, and the Bureau of Labor Statistics to update sample frames, develop consistent classifications of establishments and companies into industries, improve coverage, and reconcile significant differences in data produced by the three agencies.</text>
 </paragraph><paragraph id="H5BE950768381468D8BC5F966D19166BD"><enum>(4)</enum><text>To increase understanding of the United States economy, especially for key industry and regional statistics, to develop more accurate measures of the impact of technology on productivity growth, and to enhance the reliability of the Nation’s most important economic indicators, such as the National Income and Product Accounts.</text>
 </paragraph></subsection><subsection commented="no" id="H5C8717F3DD13469183B67A5F1C5BB526"><enum>(b)</enum><header>Responsibilities of Designated Statistical Agencies</header><text>The head of each of the Designated Statistical Agencies shall—</text> <paragraph commented="no" id="H942F46A1E81743B1A0E015855D23A5C2"><enum>(1)</enum><text>identify opportunities to eliminate duplication and otherwise reduce reporting burden and cost imposed on the public in providing information for statistical purposes;</text>
 </paragraph><paragraph commented="no" id="HCC9A49580B194A54ACB4B1A7DF5DB330"><enum>(2)</enum><text>enter into joint statistical projects to improve the quality and reduce the cost of statistical programs; and</text>
 </paragraph><paragraph commented="no" id="H4FDAD9F835034A308ECE79CE604D43F4"><enum>(3)</enum><text>protect the confidentiality of individually identifiable information acquired for statistical purposes by adhering to safeguard principles, including—</text>
 <subparagraph commented="no" id="H011CA6EA5A7C47CF8B37AFA1B8DC7836"><enum>(A)</enum><text>emphasizing to their officers, employees, and agents the importance of protecting the confidentiality of information in cases where the identity of individual respondents can reasonably be inferred by either direct or indirect means;</text>
 </subparagraph><subparagraph commented="no" id="H374AB3A32B20475B91588290D9751521"><enum>(B)</enum><text>training their officers, employees, and agents in their legal obligations to protect the confidentiality of individually identifiable information and in the procedures that must be followed to provide access to such information;</text>
 </subparagraph><subparagraph commented="no" id="HE8EE7528E29E4D758F8E3AE7D50A5EAB"><enum>(C)</enum><text>implementing appropriate measures to assure the physical and electronic security of confidential data;</text>
 </subparagraph><subparagraph commented="no" id="H7A4C13F78E8F47C4ADD1DC97F99C1B7E"><enum>(D)</enum><text>establishing a system of records that identifies individuals accessing confidential data and the project for which the data were required; and</text>
 </subparagraph><subparagraph commented="no" id="H9B724B9B735E44D4892821FDC8D52F06"><enum>(E)</enum><text>being prepared to document their compliance with safeguard principles to other agencies authorized by law to monitor such compliance.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" id="H1057CC97289745D48B94AE7BC898E7D3"><enum>(c)</enum><header>Sharing of business data among Designated Statistical Agencies</header>
 <paragraph commented="no" id="H6AE23CC74E0C478BA16C0CB843472133"><enum>(1)</enum><header>In general</header><text>A Designated Statistical Agency may provide business data in an identifiable form to another Designated Statistical Agency under the terms of a written agreement among the agencies sharing the business data that specifies—</text>
 <subparagraph commented="no" id="H66032C13BA6240349A066A8F33AB7BBD"><enum>(A)</enum><text>the business data to be shared;</text> </subparagraph><subparagraph commented="no" id="HFADF4FBDE5154C8097A21ED2340B7235"><enum>(B)</enum><text>the statistical purposes for which the business data are to be used;</text>
 </subparagraph><subparagraph commented="no" id="H81D27EE27E874257B8B76D71B181B628"><enum>(C)</enum><text>the officers, employees, and agents authorized to examine the business data to be shared; and</text> </subparagraph><subparagraph commented="no" id="HD3DEC3BEB8B34096AC6D6DC688EDFCA9"><enum>(D)</enum><text>appropriate security procedures to safeguard the confidentiality of the business data.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HF5215CB4B2064FB489E5892DC6A71EC6"><enum>(2)</enum><header>Responsibilities of agencies under other laws</header><text>The provision of business data by an agency to a Designated Statistical Agency under this section shall in no way alter the responsibility of the agency providing the data under other statutes (including sections 552 and 552b of title 5) with respect to the provision or withholding of such information by the agency providing the data.</text>
 </paragraph><paragraph commented="no" id="H3EBDD7DC700849AB951E1D046E10311B"><enum>(3)</enum><header>Responsibilities of officers, employees, and agents</header><text>Examination of business data in identifiable form shall be limited to the officers, employees, and agents authorized to examine the individual reports in accordance with written agreements pursuant to this section. Officers, employees, and agents of a Designated Statistical Agency who receive data pursuant to this section shall be subject to all provisions of law, including penalties, that relate—</text>
 <subparagraph commented="no" id="HCF0C155699EE4462ACEBA5C861AACD13"><enum>(A)</enum><text>to the unlawful provision of the business data that would apply to the officers, employees, and agents of the agency that originally obtained the information; and</text>
 </subparagraph><subparagraph commented="no" id="H4BE433C2821B491F81F6E9583639D581"><enum>(B)</enum><text>to the unlawful disclosure of the business data that would apply to officers, employees, and agents of the agency that originally obtained the information.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HA48D7695B3194DBABA77B49D82375D5D"><enum>(4)</enum><header>Notice</header><text>Whenever a written agreement concerns data that respondents were required by law to report and the respondents were not informed that the data could be shared among the Designated Statistical Agencies, for exclusively statistical purposes, the terms of such agreement shall be described in a public notice issued by the agency that intends to provide the data. Such notice shall allow a minimum of 60 days for public comment.</text>
										</paragraph></subsection><subsection commented="no" id="HAAAB70186A2C40EB96D46447AC9BA50C"><enum>(d)</enum><header>Limitations on use of business data provided by Designated Statistical Agencies</header>
 <paragraph commented="no" id="H3B4FBF17BA6B4067A3A0473A537B90BD"><enum>(1)</enum><header>General use</header><text>Business data provided by a Designated Statistical Agency pursuant to this section shall be used exclusively for statistical purposes.</text>
 </paragraph><paragraph commented="no" id="H529E770EA0B8429188DAB3C675B32BF0"><enum>(2)</enum><header>Publication</header><text>Publication of business data acquired by a Designated Statistical Agency shall occur in a manner whereby the data furnished by any particular respondent are not in identifiable form.</text>
 </paragraph></subsection><subsection id="HEFD033AE3AD64A1FBBAFE85BA273A370"><enum>(e)</enum><header>Designated Statistical Agency defined</header><text display-inline="yes-display-inline">In this section, the term <term>Designated Statistical Agency</term> means each of the following:</text> <paragraph commented="no" id="H701705009F814C168314DA2AF5BECCBA"><enum>(1)</enum><text>The Census Bureau of the Department of Commerce.</text>

 <subsection commented="no" id="H58E40B1189F648E599AE974C84024AFD"><enum>(a)</enum><header>Accessibility of data assets</header><text>The head of an agency shall, to the extent practicable, make any data asset maintained by the agency available, upon request, to any statistical agency or unit for purposes of developing evidence.</text>
 </subsection><subsection commented="no" id="H8C3026DFFA8B44B5BDF8C582952B94DD"><enum>(b)</enum><header>Limitations</header><text>Subsection (a) does not apply to any data asset that is subject to a statute that—</text> <paragraph commented="no" id="HEA5D9523A3C1418B93DDDD817E0FC7CB"><enum>(1)</enum><text>prohibits the sharing or intended use of such asset in a manner as to leave no discretion on the issue; or</text>
 </paragraph><paragraph commented="no" id="H6CD199B9D301456298281BF6E6D17A00"><enum>(2)</enum><text>if enacted after the date of the enactment of this section, specifically cites to this paragraph.</text> </paragraph></subsection><subsection commented="no" id="H73CCED59AB904D95904D2430275281A9"><enum>(c)</enum><header>Regulations</header><text>The Director shall prescribe regulations for agencies to carry out this section. Such regulations shall—</text>
 <paragraph commented="no" id="H440D48126A1442878A81B514269F824C"><enum>(1)</enum><text>require the timely provision of data assets under subsection (a);</text> </paragraph><paragraph commented="no" id="HFAB8693EC8A44899A439D05D8204A11E"><enum>(2)</enum><text>provide a list of statutes that exempt agencies from the requirement under subsection (a) pursuant to subsection (b)(1); and</text>
 </paragraph><paragraph commented="no" id="HF0407367AC7C48C6B93ED83CFCA2334B"><enum>(3)</enum><text>require a transparent process for statistical agencies and units to request data assets from agencies and for agencies to respond to such requests.</text>
									</paragraph></subsection></section><section commented="no" id="H6CA6480952474B2F83A838D7A2F24488"><enum>3582.</enum><header>Expanding secure access to CIPSEA data assets</header>
 <subsection commented="no" id="H7D5BCA6B0B9E40E49AF587A4611BC23C"><enum>(a)</enum><header>Statistical agency responsibilities</header><text display-inline="yes-display-inline">To the extent practicable, each statistical agency or unit shall expand access to data assets of such agency or unit acquired or accessed under this subchapter to develop evidence while protecting such assets from inappropriate access and use, in accordance with the regulations promulgated under subsection (b).</text>
 </subsection><subsection commented="no" id="HBBD3FCD18C5446CAA75C6EB138858156"><enum>(b)</enum><header>Regulations for accessibility of nonpublic data assets</header><text>The Director shall promulgate regulations, in accordance with applicable law, for statistical agencies and units to carry out the requirement under subsection (a). Such regulations shall include the following:</text>
 <paragraph commented="no" id="HC7D97BD7C0BC4A398C4D2F972E42414B"><enum>(1)</enum><text>Standards for each statistical agency or unit to assess each data asset owned or accessed by the statistical agency or unit for purposes of categorizing the sensitivity level of each such asset and identifying the corresponding level of accessibility to each such asset. Such standards shall include—</text>
 <subparagraph commented="no" id="HC583206F15CE4E45B9976682B9DCD9AE"><enum>(A)</enum><text>common sensitivity levels and corresponding levels of accessibility that may be assigned to a data asset, including a requisite minimum and maximum number of sensitivity levels for each statistical agency or unit to use;</text>
 </subparagraph><subparagraph commented="no" id="H7078A889F67D411F93333F1B9B8454CA"><enum>(B)</enum><text>criteria for determining the sensitivity level and corresponding level of accessibility of each data asset; and</text>
 </subparagraph><subparagraph commented="no" id="HD5ACA84CF82E4518B47CEE63ED2FD595"><enum>(C)</enum><text>criteria for determining whether a less sensitive and more accessible version of a data asset can be produced.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HD7191EB6102747A4BEBE3A2EF6175B6B"><enum>(2)</enum><text display-inline="yes-display-inline">Standards for each statistical agency or unit to improve access to a data asset pursuant to paragraph (1) or (3) by removing or obscuring information in such a manner that the identity of the data subject is less likely to be reasonably inferred by either direct or indirect means.</text>
 </paragraph><paragraph commented="no" id="HD6556DD36AC144AB84478517BC9699A9"><enum>(3)</enum><text>A requirement for each statistical agency or unit to conduct a comprehensive risk assessment of any data asset acquired or accessed under this subchapter prior to any public release of such asset, including standards for such comprehensive risk assessment and criteria for making a determination of whether to release the data.</text>
 </paragraph><paragraph commented="no" id="H700DB1AF27C6472BA962C92F4262498E"><enum>(4)</enum><text>Requirements for each statistical agency or unit to make any process or assessment established, produced, or conducted pursuant to this section transparent and easy to understand, including the following:</text>
 <subparagraph commented="no" id="H19574B85C0974A0193EE4C07E4852204"><enum>(A)</enum><text>A requirement to make information on the assessment of the sensitivity level of each data asset conducted pursuant to paragraph (1) available on the Federal data catalogue established under section 3511(c)(1).</text>
 </subparagraph><subparagraph commented="no" id="H31B146A9BD964AC4BB5AEF7059585492"><enum>(B)</enum><text display-inline="yes-display-inline">A requirement to make any comprehensive risk assessment, and associated determinations, conducted under paragraph (3) available on the Federal data catalogue established under section 3511(c)(1).</text>
 </subparagraph><subparagraph commented="no" id="HF4BA877F7E544F2A87F445EC4C74F6E6"><enum>(C)</enum><text>A requirement to make any standard or policy established by the statistical agency or unit to carry out this section and any assessment conducted under this section easily accessible on the public website of such agency or unit.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="HCDC26C3D4E70411CADBF3F31039EDB03"><enum>(c)</enum><header>Responsibilities of the director</header><text>The Director shall—</text> <paragraph commented="no" id="HEBF842CB31B64340BD0862DBEA1CD6B0"><enum>(1)</enum><text>make public all standards and policies established under this section; and</text>
 </paragraph><paragraph commented="no" id="HC84171A1A688406784E2285C110EDA4A"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that statistical agencies and units have the ability to make information public on the Federal data catalogue established under section 3511(c)(1), in accordance with requirements established pursuant to subsection (b).</text>
									</paragraph></subsection></section><section commented="no" id="H96FA80BE6D424866BCD51C3E5555217D"><enum>3583.</enum><header>Application to access data assets for developing evidence</header>
 <subsection commented="no" id="H284352FC92EB46C68ECF02110D2855AB"><enum>(a)</enum><header>Standard application process</header><text display-inline="yes-display-inline">The Director shall establish a process through which agencies, the Congressional Budget Office, State, local, and Tribal governments, researchers, and other individuals, as appropriate, may apply to access the data assets accessed or acquired under this subchapter by a statistical agency or unit for purposes of developing evidence. The process shall include the following:</text>
 <paragraph commented="no" id="H721544084C64446C8C89741FA5FF1615"><enum>(1)</enum><text>Sufficient detail to ensure that each statistical agency or unit establishes an identical process.</text> </paragraph><paragraph commented="no" id="H7E93FF3294734E099FBE268E82C23CE3"><enum>(2)</enum><text>A common application form.</text>
 </paragraph><paragraph commented="no" id="H9D29BA9BBB424346ADC61AC0C4284BD2"><enum>(3)</enum><text>Criteria for statistical agencies and units to determine whether to grant an applicant access to a data asset.</text>
 </paragraph><paragraph commented="no" id="HF4106DC67F0643E1A047A8B3A79444F8"><enum>(4)</enum><text display-inline="yes-display-inline">Timeframes for prompt determinations by each statistical agency or unit.</text> </paragraph><paragraph commented="no" id="H99F3690E01E3411395DF35816945C6DE"><enum>(5)</enum><text>An appeals process for adverse decisions and noncompliance with the process established under this subsection.</text>
 </paragraph><paragraph commented="no" id="HD81AFCBED7F841208FE8BCD69C11635E"><enum>(6)</enum><text>Standards for transparency, including requirements to make the following information publicly available:</text>
 <subparagraph commented="no" id="HD5E5D95AC0E14613AC16BFAC6E1D568E"><enum>(A)</enum><text>Each application received.</text> </subparagraph><subparagraph commented="no" id="H6DF794F815DB44E0BFAD06938CEE6A07"><enum>(B)</enum><text>The status of each application.</text>
 </subparagraph><subparagraph commented="no" id="HCED2178508BC4F0FB04BF638E388FD3B"><enum>(C)</enum><text>The determination made for each application.</text> </subparagraph><subparagraph commented="no" id="HC50A59A295674B91A9679D5BF6CEFF25"><enum>(D)</enum><text>Any other information, as appropriate, to ensure full transparency of the process established under this subsection.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="H9CBFCB8DBDBB425F8CC2F6F15CE20572"><enum>(b)</enum><header>Consultation</header><text>In establishing the process required under subsection (a), the Director shall consult with stakeholders, including the public, agencies, State and local governments, and representatives of non-governmental researchers.</text>
 </subsection><subsection commented="no" id="H00AAB01AF6CA49C78BD423F4037D1470"><enum>(c)</enum><header>Implementation</header><text>The head of each statistical agency or unit shall implement the process established under subsection (a).</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="H140E1525A05343C09124F2043EC11A2B"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, as amended by sections 202(g) and 302(b), is further amended by adding at the end the following:</text>

 </subsection><subsection id="HEFA3E2825ADE4B42B389A78066C2E153"><enum>(c)</enum><header>Deadline for guidance and implementation</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Director of the Office of Management and Budget shall promulgate any regulation or guidance required by subchapter III of title 44, United States Code, as amended by this section, with a requirement to implement such regulation or guidance not later than 1 year after the date on which such regulation or guidance issues.</text>
				</subsection></section></title><title id="H44FC6CF3AB8E40BBA1A65BB20C597837"><enum>IV</enum><header>General Provisions</header>
 <section id="H9BF0F34E34614FA0A6C18F8863B29C7E"><enum>401.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or the amendments made by this Act, may be construed—</text> <paragraph id="HADE0925B364146F2A3190436E0688496"><enum>(1)</enum><text display-inline="yes-display-inline">to require the disclosure of information or records that are exempt from disclosure under section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>); or</text>
 </paragraph><paragraph id="H39C9412D00CE4E2EB49C0482AEA44A4D"><enum>(2)</enum><text display-inline="yes-display-inline">to create or expand an exemption from disclosure under such section.</text> </paragraph></section><section id="HE3509C0BF88148C4AD899B40749774C8"><enum>402.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as otherwise provided, this Act, and the amendments made by this Act, shall take effect on the date that is 180 days after the date of the enactment of this Act.</text>
