 <section id="HAC0403B3D56B4785A78F09EB3B4E5C5C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Air Cargo Security Improvement Act of 2018</short-title></quote>.</text> </section><section id="H1C7703F248AB4FB8A1E410B65FBA3F3E"><enum>2.</enum><header>Establishment of air cargo security division</header> <subsection id="H497C95879DB24BE1935C8BC3D2B915EC"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/449">chapter 449</external-xref> of title 49, United States Code, is amended by adding at the end the following new section:</text>

					<section id="H8039519E79744422BA0EB1AE9D33850B"><enum>44947.</enum><header>Air cargo security division</header>
 <subsection id="HEE25BBD400294E7392E434BE6B924DF0"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this section, the Administrator of the Transportation Security Administration shall establish an air cargo security division to carry out all policy and engagement with air cargo security stakeholders.</text>
 </subsection><subsection id="H179FB9CC8A2C4C829ADD53A69DEA715D"><enum>(b)</enum><header>Leadership; Staffing</header><text>The air cargo security division established pursuant to subsection (a) shall be headed by an individual in the executive service within the Transportation Security Administration and be staffed by not fewer than four full-time equivalents, including the head of the division.</text>
 </subsection><subsection id="H76503213F0A54E0FBE59D101971A5433"><enum>(c)</enum><header>Staffing</header><text display-inline="yes-display-inline">The Administrator of the Transportation Security Administration shall staff the air cargo security division with existing Transportation Security Administration personnel.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H0ECA646DE7F14158811BA28672644C95"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/449">chapter 449</external-xref> of title 49, United States Code, is amended by inserting after the item related to section 44946 the following new item:</text>

						<toc-entry level="section">44947. Air cargo security division.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HC639CFAB354645C58CD4D71B278238A5"><enum>3.</enum><header>Feasibility study and pilot program for emerging technologies</header>
 <subsection id="HAAD04403816E4BB58F24F7BB72A7C59E"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Administrator of the Transportation Security Administration, in coordination with the Under Secretary for Science and Technology of the Department of Homeland Security, shall submit to Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a feasibility study regarding expanding the use of computed tomography technology for the screening of air cargo transported on passenger aircraft operated by an air carrier or foreign air carrier in air transportation, interstate air transportation, or interstate air commerce. Such study shall consider the following:</text>
 <paragraph id="H11E72E8E0F354576930B6138EE58B5F8"><enum>(1)</enum><text>Opportunities to leverage computed tomography systems used for screening passengers and baggage.</text> </paragraph><paragraph id="H64F46CEBF56A441782DD29EC7898F88D"><enum>(2)</enum><text>Costs and benefits of using computed tomography technology for screening air cargo.</text>
 </paragraph><paragraph id="H82823EFE562B4809830F3B3404233ACA"><enum>(3)</enum><text>An analysis of emerging computed tomography systems that may have potential to enhance the screening of air cargo, including systems that may address aperture challenges associated with screening certain categories of air cargo.</text>
 </paragraph><paragraph id="H650C70E609A54C8EA79622DC97DCEE46"><enum>(4)</enum><text>An analysis of emerging screening technologies, in addition to computed tomography, that may be used to enhance the screening of air cargo.</text>
 </paragraph></subsection><subsection id="H2FCFB73D4B2D41E3864E7CE5907087ED"><enum>(b)</enum><header>Pilot program</header><text>Not later than 120 days after submission of the feasibility study required under subsection (a), the Administrator of the Transportation Security Administration shall initiate a 2-year pilot program to achieve enhanced air cargo security screening outcomes through the use of new or emerging screening technologies, such as computed tomography technology, as identified through such study.</text>
 </subsection><subsection id="H9E426C67C9D04CB5AED29E9716EF20B4"><enum>(c)</enum><header>Updates</header><text>Not later than 60 days after the initiation of the pilot program under subsection (b) and every 6 months thereafter for 2 years, the Administrator of the Transportation Security Administration shall brief the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the progress of implementation of such pilot program.</text>
 </subsection><subsection id="HCF0F2E443942416393BB042568121D4B"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HDB1AC864B5CE4CEABDF5956F38E8B4ED"><enum>(1)</enum><header>Air carrier</header><text>The term <quote>air carrier</quote> has the meaning given such term in section 40102 of title 49, United States Code.</text>
 </paragraph><paragraph id="H78F58637E8964B7086C5D88E18BC1EFA"><enum>(2)</enum><header>Air transportation</header><text display-inline="yes-display-inline">The term <quote>air transportation</quote> has the meaning given such term in section 40102 of title 49, United States Code.</text> </paragraph><paragraph id="H4922D296E1D84D4FA91DBABC63171A09"><enum>(3)</enum><header>Foreign air carrier</header><text display-inline="yes-display-inline">The term <quote>foreign air carrier</quote> has the meaning given such term in section 40102 of title 49, United States Code.</text>
 </paragraph><paragraph commented="no" id="H03366AAA412F4E99BCDF0E4913165E71"><enum>(4)</enum><header>Interstate air commerce</header><text display-inline="yes-display-inline">The term <quote>interstate air commerce</quote> has the meaning given such term in section 40102 of title 49, United States Code.</text> </paragraph><paragraph id="HC47727A0B7CB481E85433165759093AF"><enum>(5)</enum><header>Interstate air transportation</header><text display-inline="yes-display-inline">The term <quote>interstate air transportation</quote> has the meaning given such term in section 40102 of title 49, United States Code.</text>
				</paragraph></subsection></section><section id="H8537CCC2780B4C2DBA5AACF8959B3729"><enum>4.</enum><header>Air cargo regulation review</header>
 <subsection id="H17B8F51AA0D64C809459EFBD79F579F3"><enum>(a)</enum><header>Review</header><text>Not later than 150 days after the date of the enactment of this Act, the Administrator of the Transportation Security Administration shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on actions to improve the Certified Cargo Screening Program as established by the Administrator in September 2009. The report shall—</text>
 <paragraph id="H70E7D7B78A4E4108BB06E51960A3CDA8"><enum>(1)</enum><text>review the degree to which the Program is effective at fully addressing evolving threats to air cargo, particularly as air cargo volumes fluctuate;</text>
 </paragraph><paragraph id="H931D7A7A9DC44140A274C9255CAD9CEA"><enum>(2)</enum><text>review any vulnerabilities in the Program and effectiveness of information sharing with air cargo security stakeholders; and</text>
 </paragraph><paragraph id="H1FE1E95A7ABF491FA5A2F5A611920F1B"><enum>(3)</enum><text>include information on actions to be taken to address findings in paragraphs (1) and (2), including information on plans to issue new rulemaking, if necessary.</text>
				</paragraph></subsection></section><section id="H84FA98AC0220434D98042DB19A546451"><enum>5.</enum><header>Comptroller general review</header>
 <subsection id="HCEC2A95E1A8C43F189A9ECFAD17579B9"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall—</text>
 <paragraph id="HFBE21710F0D948EA8F86B8AE874F8343"><enum>(1)</enum><text>review the Department of Homeland Security’s analysis and intelligence pre-screening processes and procedures for air cargo entering the United States;</text>
 </paragraph><paragraph id="HC65C498ABCDF454498C1620BCCABE182"><enum>(2)</enum><text display-inline="yes-display-inline">review the pilot program conducted pursuant to section 3;</text> </paragraph><paragraph id="HAD7BB185403645659EB5BF0CD856D482"><enum>(3)</enum><text>assess the effectiveness of the Department’s risk-based strategy for examining air cargo and ensuring compliance with air cargo security rules and regulations; and</text>
 </paragraph><paragraph commented="no" id="HC7BC5619C8ED4572A61BCAEBB72047C9"><enum>(4)</enum><text display-inline="yes-display-inline">review the Department’s information sharing procedures and practices for disseminating information to relevant stakeholders on preventing, mitigating, and responding to air cargo related threats.</text>
 </paragraph></subsection></section><section id="H7240151BF19A45FA93282F08B4BAD3FE"><enum>6.</enum><header>Known shipper program review</header><text display-inline="no-display-inline">The Administrator shall request the Air Cargo Subcommittee of Aviation Security Advisory Committee (established under section 44946 of title 49, United States Code) to—</text>
 <paragraph commented="no" id="H0241843B0F7F45B6B1921C9C21A1278C"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a comprehensive review and security assessment of the known shipper program under sections 1546.215 and 1548.17 of title 49, Code of Federal Regulations;</text>
 </paragraph><paragraph id="H67813444606247F2B6F22DCF6A018078"><enum>(2)</enum><text>recommend whether the Known Shipper Program should be modified or eliminated considering the full implementation of 100 percent screening under section 44901(g) of title 49, United States Code; and</text>
 </paragraph><paragraph id="H8CF185BEBEF84087932475E769294BAF"><enum>(3)</enum><text>report its findings and recommendations to the Administrator of the Transportation Security Administration.</text>
			</paragraph></section></legis-body>
