			</subsection></section><title id="H895FB3FDF1CE41949C7CD12F2D864224"><enum>I</enum><header>Improved access for veterans to non-Department of Veterans Affairs medical care</header>
 <section id="HE8EDC4510EBD40CE880A85DA9182F738"><enum>101.</enum><header>Assignment of veterans to primary care providers</header><text display-inline="no-display-inline">Section 1706 of title 38, United States Code, is amended by adding at the end the following new subsection:</text>

					<subsection id="H3C6056B3125944DB8B7259CFA4F20E9B"><enum>(d)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="H2FCFB518932B4E7B8653725618CD0FBD"><enum>(1)</enum><text>Except as provided in section 1703A of this title, in furnishing primary care under this chapter, the Secretary shall assign each eligible veteran to—</text>
 <subparagraph changed="added" committee-id="HVR00" id="H775E51C596FD4B7B8FAFECBF73F3738C" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>a patient-aligned care team of the Department; or</text> </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H0EC2D9D4DACB41F8B715BB40A718F12A" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>a dedicated primary care provider of the Department as a part of any other model of providing consistent primary care determined appropriate by the Secretary.</text>
 </subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="H6137019602B34F91B56B317958474ADD" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">Each patient-aligned care team of the Department shall consist of a team of health care professionals of the Department who—</text>
 <subparagraph commented="no" id="HD90ED7A521B54EB7B8599E853D9F3487"><enum>(A)</enum><text>provide to each eligible veteran comprehensive primary care in partnership with the veteran; and</text> </subparagraph><subparagraph commented="no" id="H4413504ACE3A46FEBE248A6B52154AEC"><enum>(B)</enum><text>manage and coordinate comprehensive hospital care and medical services consistent with the goals of care agreed upon by the veteran and team.</text>
 </subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="HA3E0643AF70E4433B50771707A31E857" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The Secretary shall ensure that an eligible veteran is not simultaneously assigned to more than one patient-aligned care team or dedicated primary care provider under this subsection at a single location, including by establishing procedures in the event a primary care provider retires or is otherwise no longer able to treat the veteran. In the case of an eligible veteran who resides in more than one location, the Secretary may assign such veteran to a patient-aligned care team or dedicated primary care provider at each such location.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H6735ECD810864CD08246CB83CCF22DE4" indent="up1" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>eligible veteran</term> means a veteran who—</text> <subparagraph id="H841D1DC6C7C64FB9BC21623C53838EB7"><enum>(A)</enum><text>is enrolled in the patient enrollment system of the Department established and operated under section 1705(a) of this title; and</text>
 </subparagraph><subparagraph id="HFFCE786AFD9E47609FD875A87317C083"><enum>(B)</enum><text>has—</text> <clause id="HC1992D7ECD7348FE8E66BB50716C7026"><enum>(i)</enum><text>been furnished hospital care or medical services at or through a Department facility on at least one occasion during the two-year period preceding the date of the determination of eligibility; or</text>
 </clause><clause id="H6EB88F5315604414BE0BDB21314F0EED"><enum>(ii)</enum><text>requested a first-time appointment for hospital care or medical services at a Department facility.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H525FCE6545284457821B9A2693F84B66"><enum>102.</enum><header>Establishment of VA Care in the Community Program</header> <subsection id="HA09E118E657640A5A958F3B51B68AB3B"><enum>(a)</enum><header>Establishment of program</header> <paragraph id="H6A51A5E4B0164971B5ED32261C2F78CA"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">Chapter 17</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1703">section 1703</external-xref> the following new section:</text>
						<quoted-block changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H2BC4141246204906B2AB7B9657E5DC15" reported-display-style="italic" style="USC">
							<section id="H601BFA231FAD461CAE21ACD51A71133D"><enum>1703A.</enum><header>VA Care in the Community Program</header>
								<subsection id="H5D59F6E1A36B45E0951920F81A5DD63F"><enum>(a)</enum><header>Program</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HF2868B4B85414DD5B0ED8CC06709E555"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to the availability of appropriations for such purpose, hospital care, medical services, and extended care services under this chapter shall be furnished to an eligible veteran through contracts or agreements authorized under subsection (d), or contracts or agreements, including national contracts or agreements, authorized under section 8153 of this title or any other provision of law administered by the Secretary, with network providers for the furnishing of such care and services to veterans.</text>
 </paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="H8420BA2AEF514B60AFC2A75BA643A177" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Subject to subsection (b), an eligible veteran may select a provider of such care or services from among network providers.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="H5AC4F6A64D8744B78AF9D6452835B98B" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The Secretary shall coordinate the furnishing of care and services under this section to eligible veterans.</text>
									</paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="HE06AB3D74222409F9B29E106F59B7038" indent="up1" reported-display-style="italic"><enum>(4)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H58F787EEF4C14D468729632176D49F5C"><enum>(A)</enum><text>In carrying out this section, the Secretary shall establish regional networks of network providers. The Secretary shall determine, and may modify, such regions based on the capacity and market assessments of Veterans Integrated Service Networks conducted under subsection (k) or upon recognized need.</text>
 </subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H3BB3C7C0EFE149DDB489FA960D815D86" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>The Secretary may enter into one or more contracts for the purposes of managing the operations of the regional networks and for the delivery of care pursuant to this section.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H9C5A5778489B42279B86B557F92FF585" indent="up1" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary shall—</text> <clause id="H7A42E6196C0A44D3BA17FC761AFDF3DC"><enum>(i)</enum><text display-inline="yes-display-inline">verify upon enrollment, and annually thereafter, that network providers have not been excluded from participation in other federally funded health care programs; and</text>
 </clause><clause id="HD4321BF2B6A5406CBF16CC57EA49E060"><enum>(ii)</enum><text>submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate an annual report on the results of such verifications.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="HF27EE8A49E044B5481871596A9908936"><enum>(b)</enum><header>Primary and specialty care</header>
									<paragraph commented="no" display-inline="yes-display-inline" id="H66E5448548BB4945B9445A3A3B6DF985"><enum>(1)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H450353DD2BFA4EFCA7DCB7A316D9A99F"><enum>(A)</enum><text>If the Secretary is unable to assign an eligible veteran to a patient-aligned care team or dedicated primary care provider under section 1706(d) of this title because the Secretary determines such a care team or provider at a Department facility is not available—</text>
 <clause changed="added" commented="no" committee-id="HVR00" display-inline="no-display-inline" id="H577F62324593402C9AE39A8477B24313" indent="up2" reported-display-style="italic"><enum>(i)</enum><text>the Secretary shall consult with the veteran regarding available primary care providers from among network providers that are located in the regional network in which the veteran resides or a regional network that is adjacent to the regional network in which the veteran resides; and</text>
 </clause><clause changed="added" commented="no" committee-id="HVR00" display-inline="no-display-inline" id="HFDFCB0E55C694B93B244EFE4E479E4EC" indent="up2" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">the veteran may select one of the available primary care providers to serve as the dedicated primary care provider of the veteran.</text>
 </clause></subparagraph><subparagraph changed="added" committee-id="HVR00" id="H281278F9786D47E99834A74FE199BE16" indent="up2" reported-display-style="italic"><enum>(B)</enum><text>In determining whether a patient-aligned care team or dedicated provider under section 1706(d) of this title is available for assignment to a veteran, the Secretary shall take into consideration each of the following:</text>
 <clause id="H39DF0F15763A4B9F9F9E6D38EAD35225"><enum>(i)</enum><text display-inline="yes-display-inline">Whether the veteran faces an unusual or excessive burden in accessing such patient-aligned care team or dedicated provider at a medical facility of the Department including with respect to—</text>
 <subclause id="HF78F50A9C5F343B9AA269E5CC2E276F3"><enum>(I)</enum><text>geographical challenges;</text> </subclause><subclause id="H6F149DAE962C40399E3D311A54628CC7"><enum>(II)</enum><text>environmental factors, including roads that are not accessible to the general public, traffic, or hazardous weather;</text>
 </subclause><subclause id="H5488018E262047EF8CBA5A9F0F8F428B"><enum>(III)</enum><text>a medical condition of the veteran; or</text> </subclause><subclause id="H9781BA3471DB434BB465A5A5CED75F73"><enum>(IV)</enum><text display-inline="yes-display-inline">such other factors as determined by the Secretary.</text>
 </subclause></clause><clause id="H1CB6121F3DE9443D8CF60672312E564B"><enum>(ii)</enum><text>Whether the veteran reasonably believes that the assignment of a particular care team or provider to the veteran would detrimentally affect the patient-provider relationship and result in sub-optimal care to the veteran.</text>
 </clause><clause id="HFEB70AE3A44E48FF883AB8EBA5165160"><enum>(iii)</enum><text>Whether the panel size of the care team or provider is at such a number that it would result in difficulty for the veteran in accessing timely care or in sub-optimal care to the veteran.</text>
 </clause><clause id="H2B8200A8CAE54ED3BAA9CFE1F70750B5"><enum>(iv)</enum><text>Whether the veteran resides in a State where the Department does not operated a full-service medical facility.</text>
 </clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" display-inline="no-display-inline" id="H8BCEF4F96D2044B3A497C5C93C8052BE" indent="up2" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">If the Secretary determines that a patient-aligned care team or dedicated primary care provider at a Department facility has become available for assignment to an eligible veteran who had been assigned to a network provider under subparagraph (A), the Secretary shall provide the veteran with the option of reassignment to the team or provider at the Department facility.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="HF06B40C508C34548ADB9416AC6AE5C73" indent="up2" reported-display-style="italic"><enum>(D)</enum><text>In the case of an eligible veteran who is assigned to a network provider under subparagraph (A), the Secretary shall reevaluate such assignment not earlier than one year after a veteran makes a selection under subparagraph (A)(ii), and on an annual basis thereafter, to—</text>
 <clause commented="no" id="H5C27C19DD5414C58B4AD17B9049B313D"><enum>(i)</enum><text>determine whether the Secretary is able to assign to the veteran a patient-aligned care team or dedicated primary care provider under section 1706(d) of this title; and</text>
 </clause><clause commented="no" id="H55EF1763C21E4DE09B113DAD3FC971E2"><enum>(ii)</enum><text>in consultation with and upon approval of the veteran, make such assignment if able.</text> </clause></subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H6BAD931F3ED54FC8B55B0D8FA8603B5C" indent="up1" reported-display-style="italic"><enum>(2)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="HA743949941E748A08A963DE0D42CAF95"><enum>(A)</enum> <clause commented="no" display-inline="yes-display-inline" id="H025846256E254354BFD52076A4160705"><enum>(i)</enum><text>Except as provided in clause (ii), the Secretary may only furnish specialty hospital care, medical services, or extended care services to an eligible veteran under this section pursuant to a referral for such specialty care or services made by the primary care provider of the veteran.</text>
 </clause><clause changed="added" committee-id="HVR00" id="H19C8E8FD005449ECBC9D13F1F3C37525" indent="up2" reported-display-style="italic"><enum>(ii)</enum><text>The Secretary may designate specialties which shall be exempt from the requirement under clause (i).</text>
 </clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H9FC5709B234C4876B60FF8EB76F3C3CC" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall determine whether to furnish specialty hospital care, medical services, or extended care services to an eligible veteran pursuant to subparagraph (A)—</text>
 <clause id="H7DA177E98BAC473081E9A2CF45C81B17"><enum>(i)</enum><text display-inline="yes-display-inline">at a medical facility of the Department that is within a reasonable distance of the residence of the veteran, as determined by the Secretary;</text>
 </clause><clause id="H8EFA12D3FF6E4E4E988AE858B5078B99"><enum>(ii)</enum><text display-inline="yes-display-inline">by a network provider that, to the greatest extent practicable, is located in the regional network in which the veteran resides or a regional network that is adjacent to the regional network in which the veteran resides; or</text>
 </clause><clause commented="no" id="HA04CE11472654700AAB2FB0BDE0C2B00"><enum>(iii)</enum><text display-inline="yes-display-inline">pursuant to an agreement described in subparagraph (C).</text> </clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" display-inline="no-display-inline" id="H0A5EE50F75FB490D940DE62DFA84D0DE" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>An agreement described in this subparagraph is an agreement entered into by the Secretary with a network provider under which—</text>
 <clause commented="no" id="HFB7E047C9883400997EBCCED0FD1EC0D"><enum>(i)</enum><text display-inline="yes-display-inline">specialty hospital care, medical services, or extended care services are furnished to an eligible veteran pursuant to subparagraph (A)—</text>
 <subclause commented="no" id="HC0B5FE45966A4962B13489D21676B4E9"><enum>(I)</enum><text display-inline="yes-display-inline">at a medical facility of the Department by a network provider possessing the appropriate credentials, as determined by the Secretary; or</text>
 </subclause><subclause commented="no" id="HFC455382B24944029370D87637C6A545"><enum>(II)</enum><text display-inline="yes-display-inline">at a facility of a network provider by a health care provider of the Department; and</text> </subclause></clause><clause commented="no" id="H32D3540F156141BD989E7AA04F87A743"><enum>(ii)</enum><text>such specialty care or services are so furnished either—</text>
 <subclause commented="no" id="H76433B1E78EB46A09497E9D63058BBC6"><enum>(I)</enum><text display-inline="yes-display-inline">in accordance with this section with respect to fees and payments for care and services furnished under subsection (a); or</text>
 </subclause><subclause commented="no" id="H07C08EA6554E497198BCD6B1A9C29317"><enum>(II)</enum><text>at no cost to the United States.</text> </subclause></clause></subparagraph><subparagraph changed="added" committee-id="HVR00" id="HB4CCCF333B03498A9B5E775F9F79697A" indent="up1" reported-display-style="italic"><enum>(D)</enum><text>In making the determination under subparagraph (B), the Secretary shall give priority to medical facilities and health care providers of the Department but shall take into account—</text>
 <clause id="H3B8A4EC6DB204B9E94E6232A7E00A447"><enum>(i)</enum><text>whether the veteran faces an unusual or excessive burden in accessing such specialty hospital care, medical services, or extended care services at a medical facility of the Department, including with respect to—</text>
 <subclause id="H3B4AEE0BB5444D44B05E8BE63DE465A8"><enum>(I)</enum><text>geographical challenges;</text> </subclause><subclause id="H576EDFA62A4543DF851773FA2D071093"><enum>(II)</enum><text>environmental factors, such as roads that are not accessible to the general public, traffic, or hazardous weather;</text>
 </subclause><subclause id="HD27ADE708261435DA315800C60B1D9B6"><enum>(III)</enum><text>a medical condition of the veteran; or</text> </subclause><subclause id="H1133B0E1FDB94319A1F9E84A1728DA00"><enum>(IV)</enum><text>such other factors as determined by the Secretary;</text>
 </subclause></clause><clause commented="no" id="HC2ABCE3925CF473981C1D2503B33A9F7"><enum>(ii)</enum><text display-inline="yes-display-inline">whether the primary care provider of the veteran recommends that such specialty hospital care, medical services, or extended care services should be furnished by a network provider;</text>
 </clause><clause id="HB58929BBDFD84F55954853ACE5AA6F0A"><enum>(iii)</enum><text>whether the veteran resides in a State where the Department does not operate a full-service medical facility; and</text>
 </clause><clause id="H0DEDAE3EB18F45E79F94228E25FDF708"><enum>(iv)</enum><text>in the case of a veteran who requires an organ or bone marrow transplant, whether the veteran has, in the opinion of the primary care provider of the veteran, a medically compelling reason to travel outside the region of the Organ Procurement and Transplantation Network, established under section 372 of the National Organ Transplantation Act (<external-xref legal-doc="public-law" parsable-cite="pl/98/507">Public Law 98–507</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/274">42 U.S.C. 274</external-xref>), in which the veteran resides, to receive such transplant.</text>
 </clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H96734514A2A542EFBA88C10AC3E92C1B" indent="up1" reported-display-style="italic"><enum>(E)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that each medical facility of the Department processes referrals for specialty hospital care, medical services, or extended care services in a standardized manner, including with respect to the organization of the program office responsible for such referrals.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H00B97B1EA3C84E5AB39AC707CED72235" indent="up1" reported-display-style="italic"><enum>(F)</enum><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall establish a process to review any disagreement between an eligible veteran and the Department, or between an eligible veteran and a health care provider of the Department, regarding the eligibility of the veteran to receive care or services from a network provider under this section or the assignment of a primary care provider of the Department to the veteran. In reviewing a disagreement under such process with respect to the availability of and assignment to a patient aligned care team or dedicated primary care provider, the Secretary may give deference to the veteran with respect to any determination under subsection (b)(1)(B)(ii).</text>
										</subparagraph><subparagraph changed="added" committee-id="HVR00" id="H0DD248C04D394E99A10C7BD4B2CE0C3E" indent="up1" reported-display-style="italic"><enum>(G)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H219F2D09FF1A40A7B9BCE76A5ED1D86B"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary shall develop procedures to ensure that assigning a veteran to a patient-aligned care team or dedicated primary care provider under subparagraph (A), (C), or (D) does not adversely affect the continuity or quality of care for the veteran during the transition.</text>
 </clause><clause changed="added" committee-id="HVR00" id="H477C95621E4D4A75BE1401A2666AE081" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>Procedures under clause (i) shall provide for—</text> <subclause id="H592932F7EFB14E2592A27CB972F9C5B7"><enum>(I)</enum><text>the appointment of a contact in the Department for the veteran who shall provide information to the veteran and resolve issues regarding the transition;</text>
 </subclause><subclause id="H396D4309F05F4C009F95254267DCF59F"><enum>(II)</enum><text>the transfer of relevant medical records;</text> </subclause><subclause id="H73FDF55F324F4486A5B21EB600CDCC5E"><enum>(III)</enum><text>coordination of care between providers;</text>
 </subclause><subclause id="H4535FA1D2B684647A250A3CD762E6470"><enum>(IV)</enum><text>the continued treatment of chronic or current episodes of care (by means including medication, subspecialty care, and ancillary services); and</text>
 </subclause><subclause id="HC3FBFEDAB7E449838707447B9FEEF419"><enum>(V)</enum><text>any other action the Secretary determines is necessary.</text> </subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H63762EA198254FADADC49720D93DB17B"><enum>(c)</enum><header>Episodes of care</header> <paragraph commented="no" display-inline="yes-display-inline" id="H34E885818DDE4DE4AAFD00F49FF33A58"><enum>(1)</enum><text>The Secretary shall ensure that, at the election of an eligible veteran who receives hospital care, medical services, or extended care services from a network provider in an episode of care under this section, the veteran receives such care or services from that network provider, another network provider selected by the veteran, or a health care provider of the Department, through the completion of the episode of care, including all specialty and ancillary services determined necessary by the provider as part of the treatment recommended in the course of such care or services. In making such determination with respect to necessary specialty and ancillary services provided by a network provider, the network provider shall consult with the Secretary, acting through the program office of the appropriate medical facility.</text>
 </paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="HE68330AED9654E2593287C6CE488DAB2" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">In cases of episodes of care that the Secretary determines case management to be appropriate, the Secretary shall provide case management to an eligible veteran who receives hospital care, medical services, or extended care services from a network provider for such episodes of care. The Secretary may provide such case management through the Veterans Health Administration or through an entity that manages the operations of the regional networks pursuant to subsection (a)(4)(B).</text>
									</paragraph></subsection><subsection id="HD8D8C9F263DE48A78CD4EBF9687AC7A9"><enum>(d)</enum><header>Care and services through contracts and agreements</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H5BAA9BF1DA1D4697ACB3D2C6C4763CC1"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall enter into contracts or agreements, including national contracts or agreements for, but not limited to, dialysis, for furnishing care and services to eligible veterans under this section with network providers.</text>
									</paragraph><paragraph changed="added" committee-id="HVR00" id="H5F5435381F8745ACB109497E16385068" indent="up1" reported-display-style="italic"><enum>(2)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H0D5BACE11EA943F08FFA64ECA39845DF"><enum>(A)</enum><text display-inline="yes-display-inline">In entering into a contract or agreement under paragraph (1) with a network provider, the Secretary shall—</text>
 <clause changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H22DE765E6D454D38BE2699D40AA0F626" indent="up1" reported-display-style="italic"><enum>(i)</enum><text>negotiate rates for the furnishing of care and services under this section; and</text> </clause><clause changed="added" committee-id="HVR00" id="HB375F84062AD4C1B8FE386EE946576B0" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">reimburse the provider for such care and services at the rates negotiated pursuant to clause (i) as provided in such contract or agreement.</text>
											</clause></subparagraph><subparagraph changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H2C2708D7A66D44B69AC293C0C10F8FD7" indent="up1" reported-display-style="italic"><enum>(B)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="HA2D10EC1A14B4FFF9E312002E0D0CCC8"><enum>(i)</enum><text>Except as provided in paragraph (3), rates negotiated under subparagraph (A)(i) shall not be more than the rates paid by the United States to a provider of services (as defined in section 1861(u) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(u)</external-xref>)) or a supplier (as defined in section 1861(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(d)</external-xref>)) under the Medicare Program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) for the same care or services.</text>
 </clause><clause changed="added" commented="no" committee-id="HVR00" id="HF406EEAC336D434BB33DD0827DF68515" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">In determining the rates under the Medicare Program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) for purposes of clause (i), in the case of care or services furnished by a provider of services with respect to which such rates are determined under a fee schedule to which the area wage index under section 1886(d)(3)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(3)(E)</external-xref>) applies, such area wage index so applied to such provider of services may not be less than 1.00.</text>
 </clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="HD4DEDC26C645446C9D0469B05C32D868" indent="up1" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">In carrying out paragraph (2), the Secretary may incorporate the use of value-based reimbursement models to promote the provision of high-quality care.</text>
										</subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="H8109858969DB4B57B268D87C8DE9F44F" indent="up1" reported-display-style="italic"><enum>(3)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H678DB134EA3E43378A1EB2DAAB1A5F64"><enum>(A)</enum><text display-inline="yes-display-inline">With respect to the furnishing of care or services under this section to an eligible veteran who resides in a highly rural area (as defined under the rural-urban commuting area codes developed by the Secretary of Agriculture and the Secretary of Health and Human Services), the Secretary of Veterans Affairs may negotiate a rate that is more than the rate paid by the United States as described in paragraph (2)(B).</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H6DD4DD45F7224468A074E476921C6C5D" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>With respect to furnishing care or services under this section in Alaska, the Alaska Fee Schedule of the Department of Veterans Affairs will be followed, except for when another payment agreement, including a contract or provider agreement, is in place.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H8A06A8A9CD0746288AD6196208ED63BA" indent="up1" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">With respect to furnishing care or services under this section in a State with an All-Payer Model Agreement under the Social Security Act that became effective on or after January 1, 2014, the Medicare payment rates under paragraph (2)(B) shall be calculated based on the payment rates under such agreement, or any such successor agreement.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H987207AE794847278E2AAC05565F3242" indent="up1" reported-display-style="italic"><enum>(D)</enum><text display-inline="yes-display-inline">With respect to furnishing care or services under this section in a location in which the Secretary determines that adjusting the rate paid by the United States as described in paragraph (2)(B) is appropriate, the Secretary may negotiate such an adjusted rate.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H14C6919E8E2947F2886DDFC05C4EAD96" indent="up1" reported-display-style="italic"><enum>(E)</enum><text display-inline="yes-display-inline">With respect to furnishing care or services under this section in a location or in a situation in which an exception to the rates paid by the United States under the Medicare Program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) for the same care or services applies, the Secretary may follow such exception.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H0964FF289AD0452F97E76C9C5B0A25DF" indent="up1" reported-display-style="italic"><enum>(F)</enum><text display-inline="yes-display-inline">With respect to furnishing care or services under this section for care or services not covered under the Medicare Program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.), the Secretary shall establish a schedule of fees for such care or services.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="HE39EC177FC33407C8443B3A4A119DE5F" indent="up1" reported-display-style="italic"><enum>(G)</enum><text>With respect to furnishing care or services under this section pursuant to an agreement with a tribal or Federal entity, the Secretary may negotiate a rate that is more than the rate paid by the United States as described in paragraph (2)(B).</text>
 </subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="HD116934F6DEC49759180DA564998739E" indent="up1" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">For the furnishing of care or services pursuant to a contract or agreement under paragraph (1), a network provider may not collect any amount that is greater than the rate negotiated pursuant to paragraph (2)(A).</text>
									</paragraph><paragraph changed="added" commented="no" committee-id="HVR00" display-inline="no-display-inline" id="H4E2167C0D246492C9DBE3BE0C7A621EA" indent="up1" reported-display-style="italic"><enum>(5)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H31A7C8C6B9364680A5B47DEB19D1D3B0"><enum>(A)</enum><text display-inline="yes-display-inline">If, in the course of an episode of care under this section, any part of care or services is furnished by a medical provider who is not a network provider, the Secretary may compensate such provider for furnishing such care or services.</text>
 </subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="HC5757F402DA14852ADD7F09F45703299" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>The Secretary shall make reasonable efforts to enter into a contract or agreement under this section with any provider who is compensated pursuant to subparagraph (A).</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF60401E5D5A6442AAFBFDAF6C930F46A"><enum>(e)</enum><header>Prompt payment standard</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H010220AA42274981B7861D1D2B02C1D2"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that claims for payments for hospital care, medical services, or extended care services furnished under this section are processed in accordance with this subsection, regardless of whether such claims are—</text>
 <subparagraph changed="added" committee-id="HVR00" id="H7EE5A91225CB4F3EB2EC5C50309EA6C9" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>made by a network provider to the Secretary;</text> </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H20863B9A1E334D0394409D71B767975C" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>made by a network provider to a regional network operated by a contractor pursuant to subsection (a)(4)(B); or</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H1769756036EC4F68B649AFA210CD8C2C" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>made by such a regional network to the Secretary.</text> </subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="H7097FE56879B421794B80C3C3035AB95" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">A covered claimant that seeks payment for hospital care, medical services, or extended care services furnished under this section shall submit to the covered payer a claim for payment not later than—</text>
 <subparagraph id="H39B0211D60F241C2BF3D1054A6EC8149"><enum>(A)</enum><text>with respect to a claim by a network provider, 180 days after the date on which the network provider furnishes such care or services; or</text>
 </subparagraph><subparagraph id="H742A7D9D2EFD48B2A2023011B36B3995"><enum>(B)</enum><text>with respect to a claim by a regional network operated by a contractor, 180 days after the date on which the contractor pays the network provider for furnishing such care or services.</text>
 </subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="H045C28A19CE3411E9ADB5D3EF877268D" indent="up1" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/39">chapter 39</external-xref> of title 31 or any other provision of law, the covered payer shall pay a covered claimant for hospital care, medical services, or extended care services furnished under this section—</text>
 <subparagraph commented="no" id="H71865BFA72104932BA65C8000D6D148D"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a clean claim submitted to the covered payer on paper, not later than 45 calendar days after receiving the claim; or</text>
 </subparagraph><subparagraph commented="no" id="H95CE870637704E41AAC9193F7E505CCD"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a clean claim submitted to the covered payer electronically, not later than 30 calendar days after receiving the claim.</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="H6D8E26A8427641A3918A4E3FCD5899F6" indent="up1" reported-display-style="italic"><enum>(4)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H22F86E56BD8847BE90D56D6A8BC468A3"><enum>(A)</enum><text display-inline="yes-display-inline">If the covered payer denies a claim submitted by a covered claimant under paragraph (1), the covered payer shall notify the covered claimant of the reason for denying the claim and the additional information, if any, that may be required to process the claim—</text>
 <clause changed="added" commented="no" committee-id="HVR00" id="H9F7A5913DFF9402FA6AFD0C733EBB18D" indent="up1" reported-display-style="italic"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a clean claim submitted to the covered payer on paper, not later than 45 calendar days after receiving the claim; or</text>
 </clause><clause changed="added" commented="no" committee-id="HVR00" id="H6648776D6F95478097561847A0D397C5" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a clean claim submitted to the covered payer electronically, not later than 30 calendar days after receiving the claim.</text>
 </clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H9E0D64BC850D49F39AC14E61F0B1D096" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">Upon receipt by the covered payer of additional information specified under subparagraph (A) relating to a claim, the covered payer shall pay, deny, or otherwise adjudicate the claim, as appropriate, not later than 30 calendar days after receiving such information.</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="H9A44438280BD484F9DA18975A434D211" indent="up1" reported-display-style="italic"><enum>(5)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H7656EB15577C4C0E9B0BB7F0BDF85095"><enum>(A)</enum><text display-inline="yes-display-inline">If the covered payer has not paid a covered claimant or denied a clean claim for payment by the covered claimant under this subsection during the appropriate period specified in this subsection, such clean claim shall be considered overdue.</text>
 </subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H0E107A0FDC88491CB1AE7B51C4D22E16" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>If a clean claim for payment by a covered claimant is considered overdue under subparagraph (A), in addition to the amount the covered payer owes the covered claimant under the claim, the covered payer shall owe the covered claimant an interest penalty amount that shall—</text>
 <clause commented="no" id="H356D69CC339F48638C29A9D4CE33DCB5"><enum>(i)</enum><text display-inline="yes-display-inline">be prorated daily;</text> </clause><clause commented="no" id="H55AC44B44A6C4C54AD40E7473A9A34B8"><enum>(ii)</enum><text display-inline="yes-display-inline">accrue from the date the payment was overdue;</text>
 </clause><clause commented="no" id="HD1209A6879264029859FDFD3D228FB63"><enum>(iii)</enum><text display-inline="yes-display-inline">be payable at the time the claim is paid; and</text> </clause><clause commented="no" id="H5B9CCC79A76D4297A4480B8F26FD8BC8"><enum>(iv)</enum><text display-inline="yes-display-inline">be computed at the rate of interest established by the Secretary of the Treasury, and published in the Federal Register, for interest payments under subsections (a)(1) and (b) of section 7109 of title 41 that is in effect at the time the covered payer accrues the obligation to pay the interest penalty amount.</text>
											</clause></subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="H2163ED4D81CE4AD8A47173BAE7A0B151" indent="up1" reported-display-style="italic"><enum>(6)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="HE6EB99E2499E4AB5944CE17904A1123D"><enum>(A)</enum><text display-inline="yes-display-inline">If the covered payer overpays a covered claimant for hospital care, medical services, or extended care services furnished under this section—</text>
 <clause changed="added" committee-id="HVR00" id="H6DA99CCC6C66477EA5A559FBEB23ADE6" indent="up1" reported-display-style="italic"><enum>(i)</enum><text display-inline="yes-display-inline">the covered payer shall deduct the amount of any overpayment from payments due to the covered claimant after the date of such overpayment; or</text>
 </clause><clause changed="added" committee-id="HVR00" id="H8967E6228C80421EA7EC14A779B31F9A" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>if the covered payer determines that there are no such payments due after the date of the overpayment, the covered claimant shall refund the amount of such overpayment not later than 30 days after such determination.</text>
											</clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="HE0B957E21ECF4EB1979354A204BD0D4D" indent="up1" reported-display-style="italic"><enum>(B)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H3FC308948E4E4785B9315EAF93C3EB77"><enum>(i)</enum><text>Before deducting any amount from a payment to a covered claimant under subparagraph (A), the covered payer shall ensure that the covered claimant is provided an opportunity—</text>
 <subclause changed="added" commented="no" committee-id="HVR00" id="HA0D78CA5AFA344A1955336FF74037B51" indent="up1" reported-display-style="italic"><enum>(I)</enum><text>to dispute the existence or amount of any overpayment owed to the covered payer; and</text> </subclause><subclause changed="added" commented="no" committee-id="HVR00" id="HA66F5759000F484CBCB6173F0C80B31F" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>to request a compromise with respect to any such overpayment.</text>
 </subclause></clause><clause changed="added" commented="no" committee-id="HVR00" id="H44CF608637734F2BA34334E9EC101148" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">The covered payer may not make any deduction from a payment to a covered claimant under subparagraph (A) unless the covered payer has made reasonable efforts to notify the covered claimant of the rights of the covered claimant under subclauses (I) and (II) of clause (i).</text>
 </clause><clause changed="added" commented="no" committee-id="HVR00" id="H459D7AF6F8954667BF364963E56A32CE" indent="up1" reported-display-style="italic"><enum>(iii)</enum><text display-inline="yes-display-inline">Upon receiving a dispute under subclause (I) of clause (i) or a request under subclause (II) of such clause, the covered payer shall make a determination with respect to such dispute or request before making any deduction under subparagraph (A) unless the time required to make such a determination would jeopardize the ability of the covered payer to recover the full amount owed to the covered payer.</text>
 </clause></subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="HBA64435741CE40FEB5ED8C0CBDD8D5BC" indent="up1" reported-display-style="italic"><enum>(7)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary may, except in the case of a fraudulent claim, false claim, or misrepresented claim, compromise any claim of an amount owed to the United States under this section.</text>
 </paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="H433BE1737CE042C7B2924ABB41906D7D" indent="up1" reported-display-style="italic"><enum>(8)</enum><text display-inline="yes-display-inline">This subsection shall apply only to payments made on a claims basis and not to capitation or other forms of periodic payments to network providers.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="HC324AF0FAE9A48A2927101D0152E503E" indent="up1" reported-display-style="italic"><enum>(9)</enum><text>A network provider that provides hospital care, medical services, or extended care services to an eligible veteran under this section may not seek any payment for such care or services from the eligible veteran.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="HEF5BFAAE4128476DA0593F17188017BD" indent="up1" reported-display-style="italic"><enum>(10)</enum><text>With respect to making a payment for hospital care or medical services furnished to an eligible veteran by a network provider under this section—</text>
 <subparagraph id="HF357569423C847A2903DF952C6AB1BB7"><enum>(A)</enum><text>the Secretary may not require receipt by the veteran or the Department of a medical record under subsection (g) detailing such care or services before a covered payer makes a payment for such care or services; and</text>
 </subparagraph><subparagraph commented="no" id="H8EE6AFBABC5B489FB84F5784CDD32FAD"><enum>(B)</enum><text>the Secretary may require that the network provider attests to such care or services so provided before a covered payer makes a payment for such care or services.</text>
										</subparagraph></paragraph></subsection><subsection id="H1F80E583DB344F93AFDC0E62DB0B93AB"><enum>(f)</enum><header>Cost-Sharing</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H5D30724FC4F7438A8AC46FBE2AF7E139"><enum>(1)</enum><text>The Secretary shall require an eligible veteran to pay a copayment for the receipt of care or services under this section only if such eligible veteran would be required to pay a copayment for the receipt of such care or services at a medical facility of the Department or from a health care provider of the Department under this chapter.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="HAAE5C288FC5241CE9C0CE86E1B51CE1B" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The amount of a copayment charged under paragraph (1) may not exceed the amount of the copayment that would be payable by such eligible veteran for the receipt of such care or services at a medical facility of the Department or from a health care provider of the Department under this chapter.</text>
 </paragraph><paragraph changed="added" commented="no" committee-id="HVR00" display-inline="no-display-inline" id="H94EFBB27FD4449C2AB4495EB25D713D3" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>In any case in which an eligible veteran is furnished hospital care or medical services under this section for a non-service-connected disability described in subsection (a)(2) of section 1729 of this title, the Secretary shall recover or collect reasonable charges for such care or services from a health-plan contract described in section 1705A in accordance with such section 1729.</text>
									</paragraph></subsection><subsection id="HB347EC71F3DB4649B87B17FC7C871390"><enum>(g)</enum><header>Medical records</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HBA4CF810CF6B4FB691FCE9ACC49F5F80"><enum>(1)</enum><text>The Secretary shall ensure that any network provider that furnishes care or services under this section to an eligible veteran—</text>
 <subparagraph changed="added" committee-id="HVR00" id="HF0AF84BB4CAB482CB9BC2B3161B9FC2D" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>upon the request of the veteran, provides to the veteran the medical records related to such care or services; and</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="HDFF7B182287044A0A7722A69669BD174" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">upon the completion of the provision of such care or services to such veteran, provides to the Department the medical records for the veteran furnished care or services under this section in a timeframe and format specified by the Secretary for purposes of this section, except the Secretary may not require that any payment by the Secretary to the eligible provider be contingent on such provision of medical records.</text>
 </subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="HB65543C6C2FF49598A03DACDC99E4F8C" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">To the extent practicable, the Secretary shall submit to a network provider that furnishes care or services under this section to an eligible veteran the medical records of such eligible veteran that are maintained by the Department and are relevant to such care or services.</text>
 </paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="HBC67C1A1307445899661878B4A736C24" indent="up1" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">To the extent practicable, the Secretary shall—</text> <subparagraph id="HED914C2FB2DB4E0787AC1C434592049B"><enum>(A)</enum><text>ensure that the medical records shared under paragraphs (1) and (2) are shared in an electronic format accessible by network providers and the Department through an Internet website; and</text>
 </subparagraph><subparagraph id="H703A06B58C76401181505B0C57CED97A"><enum>(B)</enum><text>provide to network providers access to the electronic patient health record system of the Department, or successor system, for the purpose of furnishing care or services under this section.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="H9472A6152B0743AB82A5E818D71AB734"><enum>(h)</enum><header>Use of card</header><text display-inline="yes-display-inline">The Secretary shall ensure that the veteran health identification card, or such successor identification card, includes sufficient information to act as an identification card for an eligible entity or other non-Department facility. The Secretary may not use any amounts made available to the Secretary to issue separate identification cards solely for the purpose of carrying out this section.</text>
								</subsection><subsection id="H2BAE147ADDF14BF19B916A84BD6A6F00"><enum>(i)</enum><header>Prescription medications</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H14F5EEEEA27E4569873B23D10EDC1166"><enum>(1)</enum><text>With respect to requirements relating to the licensing or credentialing of a network provider, the Secretary shall ensure that the network provider is able to submit prescriptions for pharmaceutical agents on the formulary of the Department to pharmacies of the Department in a manner that is substantially similar to the manner in which the network provider submits prescriptions to retail pharmacies.</text>
 </paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="H61DD20140CAE419081619F7A95B5E0A5" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Nothing in this section shall be construed to affect the process of the Department for filling and paying for prescription medications.</text>
 </paragraph></subsection><subsection display-inline="no-display-inline" id="HF530C88457CA472A94B83AA1EDC9DE92"><enum>(j)</enum><header>Quality of care</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall use the quality of care standards set forth or used by the Centers for Medicare &amp; Medicaid Services or other quality of care standards, as determined by the Secretary.</text>
								</subsection><subsection commented="no" id="H63EA372D37E6441AB8A6DF4F1E005324"><enum>(k)</enum><header>Capacity and commercial market assessments</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H858F9F8DAE094499BBA0626042A8DC10"><enum>(1)</enum><text>On a periodic basis, but not less often than once every three years, the Secretary shall conduct an assessment of the capacity of each Veterans Integrated Service Network and medical facility of the Department to furnish care or services under this chapter. Each such assessment shall—</text>
 <subparagraph changed="added" commented="no" committee-id="HVR00" id="HE9DA1F2BBB524C7E88A96DA6B8742B0E" indent="up1" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">identify gaps in furnishing such care or services at such Veterans Integrated Service Network or medical facility;</text>
 </subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="HFE45D0E64AB7498589128C1EC29F3723" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>identify how such gaps can be filled by—</text> <clause commented="no" id="HF4CF12AB2C72495BB2DB10D353326E24"><enum>(i)</enum><text>entering into contracts or agreements with network providers under this section or with entities under other provisions of law;</text>
 </clause><clause commented="no" id="HF3CB8B08C210412CAF23FAA8390554A7"><enum>(ii)</enum><text>making changes in the way such care and services are furnished at such Veterans Integrated Service Network or medical facility, including but not limited to—</text>
 <subclause id="H3FAD5A6862CA4A3D9D8617A15850887F"><enum>(I)</enum><text>extending hours of operation;</text> </subclause><subclause id="H45E770B00D6648939BC85C4EB55D9CB4"><enum>(II)</enum><text>adding personnel; or</text>
 </subclause><subclause id="H296B2B42C9FF42FFA21A0B1454DABE73"><enum>(III)</enum><text>expanding space through construction, leasing, or sharing of health care facilities; and</text> </subclause></clause><clause id="HB334D866240243368907012664C0A4A9"><enum>(iii)</enum><text display-inline="yes-display-inline">the building or realignment of Department resources or personnel;</text>
 </clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H8608E07EBAB44CC88184452BD8C57889" indent="up1" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">forecast, based on future projections and historical trends, both the short- and long-term demand in furnishing care or services at such Veterans Integrated Service Network or medical facility and assess how such demand affects the needs to use such network providers;</text>
 </subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H81F818D7E5574BAB861330A14F7DB013" indent="up1" reported-display-style="italic"><enum>(D)</enum><text>include a commercial health care market assessment of designated catchment areas in the United States conducted by a nongovernmental entity; and</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="HA794625CCD494B028C0797E0DA3E4534" indent="up1" reported-display-style="italic"><enum>(E)</enum><text>consider the unique ability of the Federal Government to retain a presence in an area otherwise devoid of commercial health care providers or from which such providers are at a risk of leaving.</text>
 </subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="H31202105211C49F8BB5C0700DD98C50C" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall submit each assessment under paragraph (1) to the Committees on Veterans’ Affairs of the House of Representatives and the Senate and shall make each such assessment publicly available.</text>
 </paragraph></subsection><subsection id="H289EA0ACA5F04F9FBF96B81CC1EFF4AA"><enum>(l)</enum><header>Allocation of funds</header><text>The Secretary shall develop a plan for the allocation of funds in the Medical Community Care account.</text>
 </subsection><subsection commented="no" id="H4A6E4CB82C8B449ABF20743DA007A0B9"><enum>(m)</enum><header>Reports on rates</header><text display-inline="yes-display-inline">Not later than December 31, 2019, and annually thereafter during each of the subsequent three years, the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report detailing, for the fiscal year preceding the fiscal year during which the report is submitted, the rates paid by the Secretary for hospital care, medical services, or extended care services under this section that, pursuant to subsection (d)(3), are more than the rates described in subsection (d)(2)(B) for the same care or services.</text>
 </subsection><subsection id="HD1B39BEEE4E642D5B3F702B40AD6AC44"><enum>(n)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H27602442B12147E9AAB5D613C36BC89D"><enum>(1)</enum><text>The term <term>clean claim</term> means a claim submitted—</text>
 <subparagraph id="HDA92BA28760E4C18BD60E319919DC821"><enum>(A)</enum><text>to the covered payer by a covered claimant for purposes of payment by the covered payer of expenses for hospital care or medical services furnished under this section;</text>
 </subparagraph><subparagraph id="H6FB2EFF0376247E2A7C0A57984C0374F"><enum>(B)</enum><text>that contains substantially all of the required elements necessary for accurate adjudication, without requiring additional information from the network provider; and</text>
 </subparagraph><subparagraph id="H5C9A2A48BB424934912F9C5C09A01452"><enum>(C)</enum><text>in such a nationally recognized format as may be prescribed by the Secretary for purposes of paying claims for hospital care or medical services furnished under this section.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HFF9A67DA48A24516B3DB7E4728F5A166"><enum>(2)</enum><text>The term <term>covered claimant</term> means—</text> <subparagraph commented="no" id="H957FBFB0C2DC4BE9B8115A137D33BD40"><enum>(A)</enum><text display-inline="yes-display-inline">a network provider that submits a claim to the Secretary for purposes of payment by the Secretary of expenses for hospital care or medical services furnished under this section; or</text>
 </subparagraph><subparagraph commented="no" id="H1517E1A04C934BAE89AD16639F0C69F8"><enum>(B)</enum><text display-inline="yes-display-inline">a regional network operated by a contractor pursuant to subsection (a)(4)(B) that submits a claim to the Secretary for purposes of reimbursement for a payment made by the contractor to a network provider for hospital care or medical services furnished under this section.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HD796A8CFE99C4E4CB6B1B1AF3D86438A"><enum>(3)</enum><text>The term <term>covered payer</term> means—</text> <subparagraph commented="no" id="HEC2648A3549E4386B54D46F61FC2AD7B"><enum>(A)</enum><text display-inline="yes-display-inline">a regional network operated by a contractor pursuant to subsection (a)(4)(B) with respect to a claim made by a network provider to the contractor for purposes of payment by the contractor of expenses for hospital care or medical services furnished under this section; or</text>
 </subparagraph><subparagraph commented="no" id="H8B4D37E4A0D9470BBD1F86A73F4BF025"><enum>(B)</enum><text>the Secretary with respect to—</text> <clause commented="no" id="HDDAC4F99D43648A795B57A78971CF59D"><enum>(i)</enum><text display-inline="yes-display-inline">a claim made by a network provider to the Secretary for purposes of payment by the Secretary of expenses for hospital care or medical services furnished under this section; and</text>
 </clause><clause commented="no" id="H5D2EB2E4785647A0A2F8F0883E63E93B"><enum>(ii)</enum><text display-inline="yes-display-inline">a claim made by a regional network operated by a contractor pursuant to subsection (a)(4)(B) for purposes of reimbursement for a payment described by subparagraph (A).</text>
 </clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H3F8892A1C4684956B170A27BE0FA57BE"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>eligible veteran</term> means a veteran who—</text> <subparagraph id="H27DACB6281184C078B28CB604069520F"><enum>(A)</enum><text>is enrolled in the patient enrollment system of the Department established and operated under section 1705(a) of this title; and</text>
 </subparagraph><subparagraph id="H618D0269A410466DB2DE92FC91E7497D"><enum>(B)</enum><text>has—</text> <clause id="H3931449E168944D4B12CB03C4E120734"><enum>(i)</enum><text>been furnished hospital care or medical services at or through a Department facility on at least one occasion during the two-year period preceding the date of the determination of eligibility; or</text>
 </clause><clause id="HB22105F9CD45474AAC1233DB79B0E711"><enum>(ii)</enum><text>requested a first-time appointment for hospital care or medical services at a Department facility.</text> </clause></subparagraph></paragraph><paragraph id="H502847751C2546C4AEFB3DEF4A29A3DA"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>fraudulent claim</term> means a claim by a network provider for reimbursement under this section that includes an intentional and deliberate misrepresentation of a material fact or facts that is intended to induce the Secretary to pay an amount that was not legally owed to the provider.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HDC83D5DD71A947F9BAF8451F98534254"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 17 of such title is amended by inserting after the item relating to section 1703 the following new item:</text>

 </paragraph></subsection><subsection id="H95112122AE3E4FB39B78A676DAD278AB"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">The Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>) is amended—</text> <paragraph id="H2E0E364C4C4F44E1B31E4AA9199411ED"><enum>(1)</enum><text>in section 101(p)(1) (<external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note), by inserting before the period at the end the following: <quote>or the date on which the Secretary certifies to the Committees on Veterans’ Affairs of the House of Representatives and the Senate that the Secretary is fully implementing section 1703A of title 38, United States Code, whichever occurs first</quote>; and</text>
 </paragraph><paragraph commented="no" id="HC22250F2B3084746A1A71087C5988D13"><enum>(2)</enum><text>in section 208(1), by striking <quote>section 101</quote> and inserting <quote>section 1703A of title 38, United States Code</quote>.</text> </paragraph></subsection><subsection commented="no" id="H334C1E1B125749B68E16005B43B57FB9"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1701 of title 38, United States Code, is amended by adding at the end the following new paragraphs:</text>
					<quoted-block changed="added" committee-id="HVR00" display-inline="no-display-inline" id="HC085D96007B54B209077DB144A574B0D" reported-display-style="italic" style="USC">
 <paragraph id="HC19B49C67528439BBB5BD3FA2D43BAE1"><enum>(11)</enum><text display-inline="yes-display-inline">The term <term>network provider</term> means any of the following health care providers that have entered into a contract or agreement under which the provider agrees to furnish care and services to eligible veterans under section 1703A of this title:</text>
 <subparagraph id="H4D0EB7C374404266A43DB51AE6FCD5A7"><enum>(A)</enum><text>Any health care provider or supplier that is participating in the Medicare Program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.), including any physician furnishing services under such program.</text>
 </subparagraph><subparagraph id="H28C0DFC0485740E6BDBDD5750F545019"><enum>(B)</enum><text display-inline="yes-display-inline">Any provider of items and services receiving payment under a State plan under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.) or a waiver of such a plan.</text>
 </subparagraph><subparagraph id="HA8DB312E77414546A2E74F42AD48F3A9"><enum>(C)</enum><text>Any Federally-qualified health center (as defined in section 1905(l)(2)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(l)(2)(B)</external-xref>)).</text>
 </subparagraph><subparagraph id="H5A1A3030A3C74618849B2D81B5EB851B"><enum>(D)</enum><text>The Department of Defense.</text> </subparagraph><subparagraph id="H3A103DD11F4543A9A89E1BDDE9D2E957"><enum>(E)</enum><text>The Indian Health Service.</text>
 </subparagraph><subparagraph id="H124EA94F04D94D5BBA26AC2F29DE6871"><enum>(F)</enum><text>Any health care provider that is an academic affiliate of the Department.</text> </subparagraph><subparagraph id="H0FD1E036AB584685B12EE17C19B5E8C0"><enum>(G)</enum><text>Any health care provider not otherwise covered under any of subparagraphs (A) through (F) that meets criteria established by the Secretary for purposes of such section.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H88FDA52DE62246449E6E860E4180A191"><enum>(12)</enum><text display-inline="yes-display-inline">The term <term>VA Care in the Community Program</term> means the program under which the Secretary furnishes hospital care or medical services to veterans through network providers pursuant to section 1703A of this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H4AE9F967CDBB4E60B14D7268A4B88ABD"><enum>(d)</enum><header>Transition of provision of care</header><text>This Act, and the amendments made by this Act, may not be construed to affect the obligations of the Secretary of Veterans Affairs under contracts and agreements for the provision of hospital care, medical services, and extended care services entered into before the date of the enactment of this Act at the terms and rates contained in such contracts and agreements.</text>
				</subsection></section><section display-inline="no-display-inline" id="H0F7CC3F95AE84FA9B54A4D6E5CE0B499" section-type="subsequent-section"><enum>103.</enum><header>Veterans Care Agreements</header>
 <subsection id="HCC4EB2604A7F46BC9C9A852697D45EE1"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is further amended by inserting after section 1703A, as added by section 102, the following new section:</text>
					<quoted-block changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H32EB73A0E37147F8B33F85429C076AAE" reported-display-style="italic" style="USC">
						<section id="H4A6BD90FEBF3463385094846EB8A7164"><enum>1703B.</enum><header>Veterans Care Agreements with non-network providers</header>
							<subsection id="H6A524003D7DC49F592590BDB2536EDFE"><enum>(a)</enum><header>Veterans Care Agreements</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H2E6B133F723041EF9286EAC7BE598F83"><enum>(1)</enum><text display-inline="yes-display-inline">In addition to furnishing hospital care, medical services, or extended care services under this chapter at facilities of the Department or under contracts or agreements entered into pursuant to section 1703A of this title or any other provision of law other than this section, the Secretary may furnish such care and services to eligible veterans through the use of agreements, to be known as <quote>Veterans Care Agreements</quote>, entered into under this section by the Secretary with eligible non-network providers.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="H624D5C0C654A46F0A9FBE87186E6648A" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may enter into a Veterans Care Agreement under this section with an eligible non-network provider if the Secretary determines that—</text>
 <subparagraph id="H04DAB232A53F4439B657BA5C24CDCCA9"><enum>(A)</enum><text>the provision of the hospital care, medical services, or extended care services at a Department facility is impracticable or inadvisable because of the medical condition of the veteran, the travel involved, or the nature of the care or services required, or a combination of such factors; and</text>
 </subparagraph><subparagraph id="HA88657597098429BB940645D342E3037"><enum>(B)</enum><text>such care or services are not available to be furnished by a non-Department health care provider under a contract or agreement entered into pursuant to a provision of law other than this section.</text>
									</subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" display-inline="no-display-inline" id="HA046B4246C404DB69D82D2C6BD76A210" indent="up1" reported-display-style="italic"><enum>(3)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="HDEB4F5A4FF2C4C0AB98460A0E32E4AB5"><enum>(A)</enum><text display-inline="yes-display-inline">In accordance with subparagraphs (C) and (D), the Secretary shall review each Veterans Care Agreement with a non-network provider to determine whether it is practical or advisable to, instead of carrying out such agreement—</text>
 <clause changed="added" committee-id="HVR00" id="H08E3E16B13C642C697FA675CD170CDFC" indent="up1" reported-display-style="italic"><enum>(i)</enum><text display-inline="yes-display-inline">provide at a Department facility the hospital care, medical services, or extended care services covered by such agreement; or</text>
 </clause><clause changed="added" committee-id="HVR00" id="H322A16A8804F4FC7B939C09F4280CE46" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">enter into an agreement with the provider under section 1703A of this title to provide such care or services.</text>
 </clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H5D13CA75B4F34CC6B205587B0662D8B3" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">If the Secretary determines pursuant to a review of a Veterans Care Agreement under subparagraph (A) that it is practical or advisable to provide hospital care, medical services, or extended care services at a Department facility, or enter into an agreement under section 1703A of this title to provide such care or services, as the case may be, the Secretary—</text>
 <clause commented="no" id="H9A75E5837739494BB46BC78767DD3F1E"><enum>(i)</enum><text>may not renew the Veterans Care Agreement; and</text> </clause><clause commented="no" id="H9636575B7A8544019906F2995A220BC5"><enum>(ii)</enum><text>shall take such actions as are necessary to implement such determination.</text>
 </clause></subparagraph><subparagraph changed="added" committee-id="HVR00" id="H1FAD7893C99F43ACA5C46304E10A890B" indent="up1" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">This paragraph shall apply with respect to Veterans Care Agreements entered into with a non-network provider whose gross annual revenue, as determined under subsection (b)(1), exceeds—</text>
 <clause id="H80A5C78F540046E0AA0B4FC3F6E0E803"><enum>(i)</enum><text display-inline="yes-display-inline">$3,000,000, in the case of a provider that furnishes homemaker or home health aide services; or</text> </clause><clause id="H01791FE5287249518EC90BF3D414E144"><enum>(ii)</enum><text>$1,000,000, in the case of any other provider.</text>
 </clause></subparagraph><subparagraph changed="added" committee-id="HVR00" id="H684FE44E1DCE489AAD51A4C2FED90E19" indent="up1" reported-display-style="italic"><enum>(D)</enum><text display-inline="yes-display-inline">The Secretary shall conduct each review of a Veterans Care Agreement under subparagraph (A) as follows:</text>
 <clause id="H11BB7550274D4D20BBB53F8CE721DF57"><enum>(i)</enum><text>Once during the 18-month period beginning on the date that is six months after date on which the agreement is entered into.</text>
 </clause><clause id="H6CFAF835AACA4411B27CE1268DC7A25D"><enum>(ii)</enum><text>Not less than once during each four-year period beginning on the date on which the review under subparagraph (A) is conducted.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="H9BF860D3B7ED4122B4DF8589EB6ED4A4"><enum>(b)</enum><header>Eligible non-Network providers</header><text display-inline="yes-display-inline">A provider of hospital care, medical services, or extended care services is eligible to enter into a Veterans Care Agreement under this section if the Secretary determines that the provider meets the following criteria:</text>
 <paragraph commented="no" id="HB7931DC9DBE8400A824E5C179717A453"><enum>(1)</enum><text display-inline="yes-display-inline">The gross annual revenue of the provider under contracts or agreements entered into with the Secretary in the year preceding the year in which the provider enters into the Veterans Care Agreement does not exceed—</text>
 <subparagraph id="HED09602EB14F47889A7276C3E84FD88C"><enum>(A)</enum><text>$5,000,000 (as adjusted in a manner similar to amounts adjusted pursuant to section 5312 of this title), in the case of a provider that furnishes homemaker or home health aide services; or</text>
 </subparagraph><subparagraph id="H5B72C32AF3C149A2A670B9BF57E55FD8"><enum>(B)</enum><text>$2,000,000 (as so adjusted), in the case of any other provider.</text> </subparagraph></paragraph><paragraph commented="no" id="H39D67C53712D4E8C9E63834988A79BC9"><enum>(2)</enum><text display-inline="yes-display-inline">The provider is not a network provider and does not otherwise provide hospital care, medical services, or extended care services to patients pursuant to a contract entered into with the Department.</text>
 </paragraph><paragraph commented="no" id="HEA397B855C4C4ACB99FEE66E3E11BAAF"><enum>(3)</enum><text>The provider is—</text> <subparagraph commented="no" id="HCA6D29E35BB24BD9BD8F180EFE9CDE8C"><enum>(A)</enum><text>a provider of services that has enrolled and entered into a provider agreement under section 1866(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc(a)</external-xref>);</text>
 </subparagraph><subparagraph commented="no" id="H7BD0524D49BF45679C77657976C545C9"><enum>(B)</enum><text>a physician or supplier that has enrolled and entered into a participation agreement under section 1842(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(h)</external-xref>);</text>
 </subparagraph><subparagraph commented="no" id="HE3779719529E451F8D00CC6FC6BB8381"><enum>(C)</enum><text>a provider of items and services receiving payment under a State plan under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.) or a waiver of such a plan;</text>
 </subparagraph><subparagraph commented="no" id="HB386DB54744A4B2CB726F210E1B8E0D2"><enum>(D)</enum><text>an Aging and Disability Resource Center, an area agency on aging, or a State agency (as defined in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>)); or</text>
 </subparagraph><subparagraph commented="no" id="HA9DDA194A49C4BD99BBAAB42CD2A76D6"><enum>(E)</enum><text>a center for independent living (as defined in section 702 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796a">29 U.S.C. 796a</external-xref>)).</text>
 </subparagraph></paragraph><paragraph id="H67E7E7FB1BBD41D7B77BEF825D9CB3C7"><enum>(4)</enum><text>The provider is certified pursuant to the process established under subsection (c)(1).</text> </paragraph><paragraph commented="no" id="HBD6466D645524C24BB7AC659ED8D615C"><enum>(5)</enum><text>Any additional criteria determined appropriate by the Secretary.</text>
								</paragraph></subsection><subsection commented="no" id="H6C87AFA3BB9241ACB2CD8D4EB233E62B"><enum>(c)</enum><header>Provider certification</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H97AB6FA7AB76423BAAEF7225ADD8C05D"><enum>(1)</enum><text>The Secretary shall establish a process for the certification of eligible providers to enter into Veterans Care Agreements under this section that shall, at a minimum, set forth the following:</text>
 <subparagraph changed="added" commented="no" committee-id="HVR00" id="H53D70D25722F484CAA74D55890DB5E9F" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>Procedures for the submission of applications for certification and deadlines for actions taken by the Secretary with respect to such applications.</text>
 </subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="HF1F4838935124C0788523D0F21D25CDF" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>Standards and procedures for the approval and denial of certifications and the revocation of certifications.</text>
 </subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H375B79539C704EACB0B47BA03305D69D" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>Procedures for assessing eligible providers based on the risk of fraud, waste, and abuse of such providers similar to the level of screening under section 1866(j)(2)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395(j)(2)(B)</external-xref>) and the standards set forth under section 9.104 of title 48, Code of Federal Regulations, or any successor regulation.</text>
 </subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H7169BBA70D974E91A9306317B907552D" indent="up1" reported-display-style="italic"><enum>(D)</enum><text>Requirement for denial or revocation of certification if the Secretary determines that the otherwise eligible provider is—</text>
 <clause commented="no" id="HC71B43D4A9524CD598B5DC29B49189BF"><enum>(i)</enum><text>excluded from participation in a Federal health care program (as defined in section 1128B(f) of the Social Security Act (42 U.S.C. 1320a–7b(f))) under section 1128 or 1128A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320a-7">42 U.S.C. 1320a–7</external-xref> and 1320a–7a); or</text>
 </clause><clause commented="no" id="H2A6270BE7405435BA044F214B21B1549"><enum>(ii)</enum><text>identified as an excluded source on the list maintained in the System for Award Management, or any successor system.</text>
 </clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H5484756B58E34E27AF5195EE2BD26DF4" indent="up1" reported-display-style="italic"><enum>(E)</enum><text>Procedures by which a provider whose certification is denied or revoked under the procedures established under this subsection will be identified as an excluded source on the list maintained in the System for Award Management, or successor system, if the Secretary determines that such exclusion is appropriate.</text>
 </subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="HCC048BF49BC342D1898C7C064DDCC599" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">To the extent practicable, the Secretary shall establish the procedures under paragraph (1) in a manner that takes into account any certification process administered by another department or agency of the Federal Government that an eligible provider has completed by reason of being a provider described in any of subparagraphs (A) through (E) of subsection (b)(4).</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="H60E2F5ADA9A8423FA7A1E9BF058C4166" indent="up1" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall—</text> <subparagraph id="H5D983EBC13244019A94E5FB124844FFE"><enum>(A)</enum><text display-inline="yes-display-inline">verify upon enrollment, and annually thereafter, that eligible providers have not been excluded from participation in other federally funded health care programs; and</text>
 </subparagraph><subparagraph id="HA7BD3E5F0D804A958C15089FF59F628C"><enum>(B)</enum><text>submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate an annual report on the results of such verifications.</text>
 </subparagraph></paragraph></subsection><subsection id="H0B1E2B5FAA73468DA576E6205A72647E"><enum>(d)</enum><header>Terms of Agreements</header><text display-inline="yes-display-inline">Subsections (d), (e), (f), and (g) of section 1703A of this title shall apply with respect to a Veterans Care Agreement in the same manner such subsections apply to contracts and agreements entered into under such section.</text>
							</subsection><subsection id="HB6DC8F993AA24DF28E9DF9B6BD93F2EC"><enum>(e)</enum><header>Exclusion of certain Federal contracting provisions</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HEB8FDA7C98214733951D722798B1D124"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary may enter into a Veterans Care Agreement using procedures other than competitive procedures.</text>
								</paragraph><paragraph changed="added" committee-id="HVR00" id="HDFB9E6D80AE34420B8287D9C3120E5FB" indent="up1" reported-display-style="italic"><enum>(2)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H945445422D214B1383CE5F42A930BCE5"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B) and unless otherwise provided in this section, an eligible non-network provider that enters into a Veterans Care Agreement under this section is not subject to, in the carrying out of the agreement, any provision of law that providers of services and suppliers under the original Medicare fee-for-service program under parts A and B of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) or the Medicaid program under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.) are not subject to.</text>
 </subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" id="H197891EADE964A628B2993C770ED4C88" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">In addition to the provisions of laws covered by subparagraph (A), an eligible non-network provider shall be subject to the following provisions of law:</text>
 <clause commented="no" id="HF5959303CE5E4C29AA08AE4F77E65963"><enum>(i)</enum><text>Any applicable law regarding integrity, ethics, or fraud, or that subject a person to civil or criminal penalties.</text>
 </clause><clause id="H98799DCE29D442BF8A3A89BC6D52C9FE"><enum>(ii)</enum><text>Section 1352 of title 31, except for the filing requirements under subsection (b) of such section.</text> </clause><clause commented="no" id="H8F54DEB666304D749869A52282460D8C"><enum>(iii)</enum><text display-inline="yes-display-inline">Section 4705 or 4712 of title 41, and any other applicable law regarding the protection of whistleblowers.</text>
 </clause><clause id="H188689A279E742969C1CB5951D8F5700"><enum>(iv)</enum><text>Section 4706(d) of title 41.</text> </clause><clause commented="no" id="H7581B2AD040C46DBA0989200D1C7961C"><enum>(v)</enum><text display-inline="yes-display-inline">Title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref> et seq.) to the same extent as such title applies with respect to the eligible non-network provider in providing care or services through an agreement or arrangement other than under a Veterans Care Agreement.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H5E53274CDA97465FB57685B016726493"><enum>(f)</enum><header>Termination of a Veterans Care agreement</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H6FB191AD97AB428692F3A08A9E2BF124"><enum>(1)</enum><text display-inline="yes-display-inline">An eligible non-network provider may terminate a Veterans Care Agreement with the Secretary under this section at such time and upon such notice to the Secretary as the Secretary may specify for purposes of this section.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="HC65ADAAFCE12466AA9D7368085691E51" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may terminate a Veterans Care Agreement with an eligible non-network provider under this section at such time and upon such notice to the provider as the Secretary may specify for the purposes of this section, if the Secretary determines necessary.</text>
								</paragraph></subsection><subsection id="HF5C551B88C3A479EBC0CC162FE4E8D2F"><enum>(g)</enum><header>Disputes</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H30908657C06A4E0398B305B196DC979B"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall establish administrative procedures for providers with which the Secretary has entered into a Veterans Care Agreement to present any dispute arising under or related to the agreement.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="HA1FF1924226B43BE89FCA36858E7963E" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">Before using any dispute resolution mechanism under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/71">chapter 71</external-xref> of title 41 with respect to a dispute arising under a Veterans Care Agreement under this section, a provider must first exhaust the administrative procedures established by the Secretary under paragraph (1).</text>
								</paragraph></subsection><subsection commented="no" id="HA3249AC347D84DB9A10D596F2BBC3D46"><enum>(h)</enum><header>Authority To pay for other authorized services</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H452980CCE4B54D9A951AF3B4DFFF2F29"><enum>(1)</enum><text display-inline="yes-display-inline">If, in the course of an episode of care for which hospital care, medical services, or extended care services are furnished to an eligible veteran pursuant to a Veterans Care Agreement, any part of such care or services is furnished by a medical provider who is not an eligible non-network provider or a network provider, the Secretary may compensate such provider for furnishing such care or services.</text>
 </paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="HB0D1C5E8BE414B049DF22B9D809170B9" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Secretary shall make reasonable efforts to enter into a Veterans Care Agreement with any provider who is compensated pursuant to paragraph (1).</text>
								</paragraph></subsection><subsection id="HD51A52BBD28E4CEFB2F4F8B8B08B21CA"><enum>(i)</enum><header>Annual reports</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H33D7D07D80624D3ABC5ECC6B4B14FEBE"><enum>(1)</enum><text>Not later than December 31 of the year following the fiscal year in which the Secretary first enters into a Veterans Care Agreement under this section, and each year thereafter, the Secretary shall submit to the appropriate congressional committees an annual report that includes a list of all Veterans Care Agreements entered into as of the date of the report.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="HDBE8E2FA26594275BE2EFD0A7ED9BC51" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The requirement to submit a report under paragraph (1) shall terminate on the date that is five years after the date of the enactment of this section.</text>
 </paragraph></subsection><subsection id="H560301EC544B41EEA2C56D3110FC4CD3"><enum>(j)</enum><header>Quality of care</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall use the quality of care standards set forth or used by the Centers for Medicare &amp; Medicaid Services or other quality of care standards, as determined by the Secretary.</text>
 </subsection><subsection id="HC4AA1CCBFCFC412DA6653C679F6B8B0E"><enum>(k)</enum><header>Delegation</header><text display-inline="yes-display-inline">The Secretary may delegate the authority to enter into or terminate a Veterans Care Agreement to an official of the Department at a level not below the Director of a Veterans Integrated Service Network or the Director of a Network Contracting Office.</text>
 </subsection><subsection commented="no" id="H135882C85C12406F83AE8A1D3A2DB45B"><enum>(l)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" id="H710D8E2AE3834595BD9BE4D6AF7976B0"><enum>(1)</enum><text>The term <term>appropriate congressional committees</term> means—</text>
 <subparagraph commented="no" id="H6ED0780470824C5DB2FEC340530DB93E"><enum>(A)</enum><text>the Committees on Veterans’ Affairs of the House of Representatives and the Senate; and</text> </subparagraph><subparagraph commented="no" id="H17AE331B35194CF9862DDD8AFC7C906F"><enum>(B)</enum><text>the Committees on Appropriations of the House of Representatives and the Senate.</text>
 </subparagraph></paragraph><paragraph id="H61A47AAE62214303B8BDE18A7D460EF2"><enum>(2)</enum><text>The term <term>eligible veteran</term> has the meaning given such term in section 1703A(m) of this title.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H40EB123F3EAE4C1A825FCE77C8DB133A"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1703A, as added by section 102, the following new item:</text>

				<subsection id="HA180C8273CB14582A60EBABF70893B39"><enum>(a)</enum><header>Use of agreements</header>
 <paragraph id="HC6D2131DA4E24714B5F36B5A05D735A7"><enum>(1)</enum><header>In general</header><text>Paragraph (1) of section 1745(a) of title 38, United States Code, is amended, in the matter preceding subparagraph (A), by striking <quote>a contract (or agreement under section 1720(c)(1) of this title)</quote> and inserting <quote>an agreement</quote>.</text>
 </paragraph><paragraph id="H178D47B9E22240AAB0D2FF54F5F792A9"><enum>(2)</enum><header>Payment</header><text>Paragraph (2) of such section is amended by striking <quote>contract (or agreement)</quote> each place it appears and inserting <quote>agreement</quote>.</text> </paragraph></subsection><subsection id="HA0607859B098421A802850AE48BEA1A8"><enum>(b)</enum><header>Treatment of certain laws</header><text>Such section is amended by adding at the end the following new paragraph:</text>

						<paragraph id="H366EAB9158E14B54A7BAAE1A76219362" indent="up1"><enum>(4)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H29ED49DD617A468A8DB833984499E2A4"><enum>(A)</enum><text>An agreement under this section may be entered into without regard to any law that would require the Secretary to use competitive procedures in selecting the party with which to enter into the agreement.</text>
							</subparagraph><subparagraph changed="added" committee-id="HVR00" id="HD770F151E9014521B989F70CE252D75F" indent="up1" reported-display-style="italic"><enum>(B)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H624877D72AB6468AAE8D4A65BA0CDE61"><enum>(i)</enum><text>Except as provided in clause (ii) and unless otherwise provided in this section or in regulations prescribed pursuant to this section, a State home that enters into an agreement under this section is not subject to, in the carrying out of the agreement, any law to which providers of services and suppliers are not subject under the original Medicare fee-for-service program under parts A and B of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) or the Medicaid program under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.).</text>
 </clause><clause changed="added" committee-id="HVR00" id="HCF6FCAFD1607437D981EA74A89A13088" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>The exclusion under clause (i) does not apply to laws regarding integrity, ethics, fraud, or that subject a person to civil or criminal penalties.</text>
 </clause></subparagraph><subparagraph changed="added" commented="no" committee-id="HVR00" display-inline="no-display-inline" id="HF57EE22F8FB84EFFA0B2E31E28C11025" indent="up1" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">Title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref> et seq.) shall apply with respect to a State home that enters into an agreement under this section to the same extent as such title applies with respect to the State home in providing care or services through an agreement or arrangement other than under this section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HF1067888E64F4394B41AC716F9074999"><enum>(c)</enum><header>Effective date</header>
 <paragraph id="H4C446321AADA42C785F2649F3E25EF5C"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall apply to agreements entered into under section 1745 of such title on and after the date on which the regulations prescribed by the Secretary of Veterans Affairs to implement such amendments take effect.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5B66903F9B624DBB9EA2C04E958D7BCC"><enum>(2)</enum><header>Publication</header><text>The Secretary shall publish the date described in paragraph (1) in the Federal Register not later than 30 days before such date.</text>
					</paragraph></subsection></section><section commented="no" id="H351429E040F74DF99690C165974230AA"><enum>105.</enum><header>Department of Veterans Affairs electronic interface for processing of medical claims</header>
 <subsection id="H774632140FC74709B80CA081DCC36078"><enum>(a)</enum><header>Electronic interface</header><text>Not later than the implementation date specified in section 108(a), the Chief Information Officer of the Department of Veterans Affairs shall ensure that the information technology system used by the Department to receive, process, and pay claims under the VA Care in the Community Program established in section 1703A of title 38, United States Code, as added by section 102, and under Veterans Care Agreements established in section 1703B of such title, as added by section 103, includes the following:</text>
 <paragraph id="H9970E6D1EFD04E03BD0ACCE28A19F232"><enum>(1)</enum><text>A function through which a covered non-Department health care provider may submit all required data and supporting information required for claims reimbursement through electronic data interchanges.</text>
 </paragraph><paragraph id="H4543A6F29EA24DCB95FA1D13BD802997"><enum>(2)</enum><text>An ability to automatically adjudicate claims.</text> </paragraph><paragraph id="HE4AF4A79160845B5B4FEF10288A86255"><enum>(3)</enum><text>A centralized claims database that is accessible nationwide.</text>
 </paragraph><paragraph id="HB3C9F3EE3BE545C982798F38FE849998"><enum>(4)</enum><text>Integration with the relevant eligibility and authorization information technology systems of the Department.</text>
 </paragraph><paragraph id="HCBB6BF7FAC274F83B661BE88981E474A"><enum>(5)</enum><text display-inline="yes-display-inline">Ability for a covered non-Department health care provider to ascertain the status of a pending claim submitted by the provider, receive information regarding missing documentation or discrepancies that may impede claim processing timelines or result in rejection, and receive notification when such claim is accepted for reimbursement or rejected.</text>
 </paragraph><paragraph id="HE3EF6136027F41EDADD821E505A46119"><enum>(6)</enum><text display-inline="yes-display-inline">A claim review system similar to that used by the Centers for Medicare &amp; Medicaid Services, as of the date of the enactment of this Act, including the use of contractors to perform audits through data analytics, to determine the appropriateness and accuracy of claims of providers and to ensure program integrity and oversight.</text>
 </paragraph></subsection><subsection id="H0A26776722C746748729D4E15D92A8C5"><enum>(b)</enum><header>Security and privacy</header><text>The Chief Information Officer shall also ensure that the information technology system covered under subsection (a) meets the following criteria:</text>
 <paragraph id="H5A838E602E52440599C3FA171A171D4F"><enum>(1)</enum><text display-inline="yes-display-inline">Such system shall be developed and implemented in compliance with all applicable laws, regulations and Federal Government standards regarding information security, privacy, and accessibility.</text>
 </paragraph><paragraph id="HCB8C56DF4E544CD08A6B6ABEB8DAAD9E"><enum>(2)</enum><text>Such system shall provide for the elicitation, analysis, and prioritization of functional and nonfunctional information security and privacy requirements for such system, including security and privacy services and architectural requirements relating to security and privacy based on a thorough risk assessment of all reasonably anticipated cyber and noncyber threats to the security and privacy of electronic protected health information made available through such interface.</text>
 </paragraph><paragraph id="HB0C4A43F21914ACA9C9D0C3F1C2E5743"><enum>(3)</enum><text>Such system shall provide for the elicitation, analysis, and prioritization of secure development requirements relating to such system.</text>
 </paragraph><paragraph id="H8C5E451535B34D0AA7C004D0589EE674"><enum>(4)</enum><text>Such system shall provide assurance that the prioritized information security and privacy requirements of such system—</text>
 <subparagraph id="H7C5CE73EE28B483EAA8EBAE8E1B9D1D8"><enum>(A)</enum><text>are correctly implemented in the design and implementation of such system through the systems development lifecycle; and</text>
 </subparagraph><subparagraph id="H7B1E58FC2C1F433189B4518ABB888D5C"><enum>(B)</enum><text>satisfy the information objectives of such system relating to security and privacy throughout the systems development lifecycle.</text>
 </subparagraph></paragraph></subsection><subsection id="HBA8B45871059479DA9F1E987C0EC4471"><enum>(c)</enum><header>Contract authority</header><text>The Chief Information Officer may enter into a contract for purposes of carrying out this section.</text> </subsection><subsection commented="no" id="H7826FFDD501E4CA286F572877D81AA6F"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph commented="no" id="HBE415C84D6E445E8855BE35D9BB2148B"><enum>(1)</enum><text>The term <term>electronic protected health information</term> has the meaning given that term in section 160.103 of title 45, Code of Federal Regulations, as in effect on the date of the enactment of this Act.</text>
 </paragraph><paragraph commented="no" id="H34D2E6F6112A43728C68734B9D23BEEC"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>covered non-Department health care provider</term> means—</text> <subparagraph commented="no" id="H545EC5B999334A419D3415E025AC3352"><enum>(A)</enum><text>a network provider (as defined by section 1701(11) of title 38, United States Code, as added by section 102);</text>
 </subparagraph><subparagraph id="H239961A893EF4CF7AB058654FCA38947"><enum>(B)</enum><text>a non-network provider with which the Secretary has entered into a Veterans Care Agreement under section 1703B of such title, as added by section 103; or</text>
 </subparagraph><subparagraph commented="no" id="HEE04CA7C3B854FBCAB3F7BA6210AF4DD"><enum>(C)</enum><text display-inline="yes-display-inline">any other non-Department eligible provider or non-Department health care provider that furnishes hospital care or medical services pursuant to chapter 17 of such title.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H2B69489791CB4449B672A10D6CEE59D1"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>secure development requirements</term> means, with respect to the information technology system established under subsection (a), activities that are required to be completed during the system development lifecycle of such interface, such as secure coding principles and test methodologies.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H166778FE37654B1999E224111620710E"><enum>(4)</enum><text>The term <term>VA Care in the Community Program</term> has the meaning given that term in section 1701(12) of title 38, United States Code, as added by section 102.</text>
					</paragraph></subsection></section><section commented="no" id="HB5D1AB890BED42F48CFAAC9BCB4BD2DD"><enum>106.</enum><header>Funding for VA Care in the Community Program</header>
 <subsection commented="no" id="HD02A1D0F87C144B2A8DDA47EFF383296"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">All amounts required to carry out the VA Care in the Community Program and Veterans Care Agreements under section 1703B of title 38, United States Code, shall be derived from the Veterans Health Administration, Medical Community Care account.</text>
				</subsection><subsection commented="no" id="H7A73905532AF44349908CA78104F2261"><enum>(b)</enum><header>Transfer of amounts</header>
 <paragraph commented="no" id="H4F41049814944A3CA29151892EEFCE4C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any unobligated amounts in the Veterans Choice Fund under section 802 of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note) shall be transferred to the Veterans Health Administration, Medical Community Care account on the later of the following dates:</text>
 <subparagraph commented="no" id="HEB355DCD05F64FACB4CDF6319125CD65"><enum>(A)</enum><text>The date that is one year after the date of the enactment of this Act.</text> </subparagraph><subparagraph commented="no" id="HA7EF2D79614F46D987D95826F3DF4A7B"><enum>(B)</enum><text>The date on which the Secretary of Veterans Affairs submits to the Committees on Veterans’ Affairs of the Senate and the House of Representatives the certification required by section 107(c).</text>
						</subparagraph></paragraph><paragraph commented="no" id="H6CE0B2A6C2BA4E8C83BB7F67049A2DE5"><enum>(2)</enum><header>Conforming repeal</header>
 <subparagraph commented="no" id="H22AEA83D629140318DD5B50F23A566EA"><enum>(A)</enum><header>In general</header><text>Effective immediately following the transfer of amounts under paragraph (1), section 802 of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note) is repealed.</text>
 </subparagraph><subparagraph commented="no" id="H591E422E800348E1A40F4BB83C35CFCF"><enum>(B)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 4003 of the Surface Transportation and Veterans Health Care Choice Improvement Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/41">Public Law 114–41</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note) is amended by striking <quote>for non-Department provider programs (as defined in section 2(d))</quote> and all that follows through <quote>1802)</quote> and inserting the following: <quote>for the VA Care in the Community Program (as defined in section 1701(12) of title 38, United States Code) and Veterans Care Agreements under section 1703B of title 38, United States Code</quote>.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H43BBA692DB464C968C43005BE349140F"><enum>(c)</enum><header>VA Care in the Community Program defined</header><text display-inline="yes-display-inline">In this section, the term <term>VA Care in the Community Program</term> has the meaning given that term in section 1701(12) of title 38, United States Code, as added by section 102.</text>
				</subsection></section><section id="HB2C8E87741C047A880EE351CB7C9AC1D"><enum>107.</enum><header>Termination of certain provisions authorizing medical care to veterans through non-Department of
			 Veterans Affairs providers</header>
				<subsection id="H74996EFA74E546D59A85A15259844A1C"><enum>(a)</enum><header>Termination of authority To contract for care in non-Department facilities</header>
 <paragraph id="HAF905E3BF2F14469A88288758693C0A6"><enum>(1)</enum><header>In general</header><text>Section 603of title 38, United States Code, is amended by adding at the end the following new subsection:</text>

 <subsection commented="no" id="H0CC95F2BCCC147DBAB56C993B048E5AA"><enum>(e)</enum><text display-inline="yes-display-inline">The authority of the Secretary to carry out this section terminates on the date on which the Secretary certifies to the Committees on Veterans’ Affairs of the House of Representatives and the Senate that the Secretary is fully implementing section 1703A of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H8735A60805A54CE7B65CAB8E14E9AF99"><enum>(2)</enum><header>Conforming amendments</header>
 <subparagraph id="HBA73767CDE854C719171EC9170D46BBC"><enum>(A)</enum><header>Dental care</header><text>Section 1712(a) of such title is amended—</text> <clause id="H524B4A6F8A8745BA8B587FE5B0781E79"><enum>(i)</enum><text>in paragraph (3), by striking <quote>under clause (1), (2), or (5) of section 1703(a) of this title</quote> and inserting <quote>under the VA Care in the Community Program</quote>; and</text>
 </clause><clause id="H9350CB7AAD7B4CDCB3042F996F2D03F3"><enum>(ii)</enum><text>in paragraph (4)(A), in the first sentence—</text> <subclause id="HD4CE51FA561B40F185A039097B73D076"><enum>(I)</enum><text>by striking <quote>and section 1703 of this title</quote> and inserting <quote>and the VA Care in the Community Program (with respect to such a year beginning on or after the date on which the Secretary commences implementation of the VA Care in the Community Program)</quote>; and</text>
 </subclause><subclause id="H537DCCC44638438E86EDDE6DDF91CCE2"><enum>(II)</enum><text>by striking <quote>in section 1703 of this title</quote> and inserting <quote>under the VA Care in the Community Program</quote>.</text> </subclause></clause></subparagraph><subparagraph id="H5045017D1DF74AF1A67CADB2F3ECD52E"><enum>(B)</enum><header>Readjustment counseling</header><text>Section 1712A(e)(1) of such title is amended by striking <quote>(under sections 1703(a)(2) and 1710(a)(1)(B) of this title)</quote> and inserting <quote>(under the VA Care in the Community Program)</quote>.</text>
 </subparagraph><subparagraph id="H6641F9319A16472383F5496A0D5C5ED5"><enum>(C)</enum><header>Death in Department facility</header><text>Section 2303(a)(2)(B)(i) of such title is amended by striking <quote>in accordance with section 1703 of this title</quote> and inserting <quote>under the VA Care in the Community Program</quote>.</text> </subparagraph><subparagraph id="H58E2734F724B4F71B31F329CE38C5EF2"><enum>(D)</enum><header>Medicare provider agreements</header><text>Section 1866(a)(1)(L) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc(a)(1)(L)</external-xref>) is amended—</text>
 <clause id="H7B6A39E6A2C34EB594CC1BB2BD1FD476"><enum>(i)</enum><text>by striking <quote>under section 1703 of title 38</quote> and inserting <quote>under the VA Care in the Community Program (as defined in section 1701(12) of title 38, United States Code)</quote>; and</text>
 </clause><clause id="H616819661D2649CC8D8207EDED16AF1C"><enum>(ii)</enum><text>by striking <quote>such section</quote> and inserting <quote>such program</quote>.</text> </clause></subparagraph></paragraph></subsection><subsection id="H9E88383EE4B4481F926151803F4B6DA1"><enum>(b)</enum><header>Repeal of authority To contract for scarce medical specialists</header> <paragraph id="H3B6603B9516446639A30238433E226D2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7409 of title 38, United States Code, is repealed.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA1674033511B4B108A94B2EB6485E0ED"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 74 of such title is amended by striking the item relating to section 7409.</text>
 </paragraph></subsection><subsection id="HC9B9695AAFBB4CE787D2DCF77A37364F"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsections (a) and (b) shall take effect on the date on which the Secretary certifies to the Committees on Veterans’ Affairs of the House of Representatives and the Senate that the Secretary is fully implementing section 1703A of title 38, United States Code, as added by section 102.</text>
				</subsection></section><section id="HE02F541917DC45C89356BE8251117854"><enum>108.</enum><header>Implementation and transition</header>
 <subsection commented="no" id="HF8B543307E8B4BEDBD602EA79A0A0DE9"><enum>(a)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall commence the implementation of section 1703A of title 38, United States Code, as added by section 102, and section 1703B of such title, as added by section 103, and shall make the transfer under section 106(b), by not later than one year after the date of the enactment of this Act. The Secretary shall prescribe interim final regulations to implement such sections and publish such regulations in the Federal Register.</text>
 </subsection><subsection id="H7CEAB6065A5742E2BD05402937D9F8B7"><enum>(b)</enum><header>Training</header><text display-inline="yes-display-inline">Before commencing the implementation of sections 1703A and 1703B of title 38, United States Code, as added by sections 102 and 103, respectively, the Secretary of Veterans Affairs shall—</text>
 <paragraph id="H60606867BFB14CBCA25CCBFA7EC282C8"><enum>(1)</enum><text>certify to the Committees on Veterans’ Affairs of the House of Representatives and the Senate that—</text> <subparagraph id="H2E443B36ADC64C428FB78C330CEE0348"><enum>(A)</enum><text>each network provider (as defined by section 1701(11) of title 38, United States Code) and eligible non-network provider that furnishes care or services under such section 1703A or section 1703B is trained to furnish such care or services under such sections; and</text>
 </subparagraph><subparagraph id="H85E79AA3895C459BAF50420C869F9E16"><enum>(B)</enum><text>each employee of the Department that refers, authorizes, or coordinates such care or services is trained to carry out such sections; and</text>
 </subparagraph></paragraph><paragraph id="HE6A05C99F0E4467AA51A9CE7CAB908D2"><enum>(2)</enum><text>establish standard, written guidance for network providers, non-Department health care providers, and any non-Department administrative entities acting on behalf of such providers, with respect to the policies and procedures for furnishing care or services under such sections.</text>
					</paragraph></subsection></section><section id="H669DE1688C6941B693657BA481CFCFC7"><enum>109.</enum><header>Transplant procedures with live donors and related services</header>
 <subsection id="H5D0E8EEDAA4046C5B88C48C34E5AE2D0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is further amended by inserting after section 1703B, as added by section 103, the following new section:</text>
					<quoted-block changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H278C1DCC3A044CC8B840D9257A2B3E17" reported-display-style="italic" style="USC">
						<section id="H3450D8062DD144F1B212B67DF0E4AD25"><enum>1703C.</enum><header>Transplant procedures with live donors and related services</header>
 <subsection id="H9D831C1EE1B54DEF9D1057A1F358BE69"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subsections (b) and (c), in a case in which a veteran is eligible for a transplant procedure from the Department, the Secretary may provide for an operation on a live donor to carry out such procedure for such veteran, notwithstanding that the live donor may not be eligible for health care from the Department.</text>
 </subsection><subsection id="H3EAB47B1594A4280A656DBD9494EDC8B"><enum>(b)</enum><header>Other services</header><text display-inline="yes-display-inline">Subject to the availability of appropriations for such purpose, the Secretary shall furnish to a live donor any care or services before and after conducting the transplant procedure under subsection (a) that may be required in connection with such procedure.</text>
							</subsection><subsection id="H994F89CEB06C4C6E9F10D07C3BAE0930"><enum>(c)</enum><header>Use of non-Department facilities</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H140EB31514A54D49BCF1E1DF0A453FC0"><enum>(1)</enum><text>In carrying out this subsection, the Secretary may provide for the operation described in subsection (a) on a live donor and furnish to the live donor the care and services described in subsection (b) at a non-Department facility pursuant to an agreement entered into by the Secretary under this section. The live donor shall be deemed to be an individual eligible for hospital care and medical services at a non-Department facility pursuant to such an agreement solely for the purposes of receiving such operation, care, and services at the non-Department facility.</text>

 <subsection id="H847340A498B0437DB15B4EF1F8FC7D95"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1725(c) of title 38, United States Code, is amended by adding at the end the following new paragraph:</text>

 <paragraph id="H5688F1A3EC884B1B86B8672B0AA3E4C3" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">In delineating the circumstances under which reimbursement may be made under this section for ambulance services for an individual, the Secretary shall treat such services as emergency services for which reimbursement may be made under this section if the Secretary determines that—</text>
 <subparagraph id="H97DC48C203194E529228F628AA6EDAD9"><enum>(A)</enum><text>the request for ambulance services was made as a result of the sudden onset of a medical condition of such a nature that a prudent layperson who possesses an average knowledge of health and medicine—</text>
 <clause id="H1EFB70EF7CB448718B9CAA6EDB25B925"><enum>(i)</enum><text>would have reasonably expected that a delay in seeking immediate medical attention would have been hazardous to the life or health of the individual; or</text>
 </clause><clause id="H2935C77A24C543CDA80714950FF8586D"><enum>(ii)</enum><text>could reasonably expect the absence of immediate medical attention to result in placing the health of the individual in serious jeopardy, the serious impairment of bodily functions, or the serious dysfunction of any bodily organ or part; and</text>
 </clause></subparagraph><subparagraph id="H670229F967204E6D9F3A0125B5036F79"><enum>(B)</enum><text>the individual is transported to the most appropriate medical facility capable of treating such medical condition.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="H418D16EACBF44D7CBFFA293AF06F42F2"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply with respect to ambulance services provided on or after January 1, 2019.</text>
 </subsection></section><section display-inline="no-display-inline" id="HF393549C4F1348C0BB34B2B77EA86CD1" section-type="subsequent-section"><enum>202.</enum><header>Improvement of care coordination for veterans through exchange of certain medical records</header><text display-inline="no-display-inline">Section 7332(b) of title 38, United States Code, is amended—</text> <paragraph id="H66596B42C408445483C442FE08B16186"><enum>(1)</enum><text>in paragraph (2), by adding at the end the following new subparagraphs:</text>

 </subparagraph><subparagraph id="H3796229DB25A4B05BBD700AB10A23361"><enum>(J)</enum><text display-inline="yes-display-inline">To a third party in order to recover or collect reasonable charges for care furnished to a veteran for a non-service-connected disability pursuant to section 1729 of this title or section 1 of <external-xref legal-doc="public-law" parsable-cite="pl/87/693">Public Law 87–693</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/2651">42 U.S.C. 2651</external-xref>).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>

				</paragraph></section><section id="H81ABFB29B6764613BCC451B8D7EDF5AC"><enum>203.</enum><header>Elimination of copayment offset</header>
 <subsection id="HD56B3132455F4192A3CD321390BDCC0F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1729(a) of title 38, United States Code, is amended by adding at the end the following new paragraph:</text>

 </subsection><subsection id="HF100A00282124C13BCCA616550336EB7"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and apply with respect to a copayment obligation that arises on or after the date of the enactment of this Act.</text>
				</subsection></section><section id="H834183C3661244689D614A0DD6A55F50"><enum>204.</enum><header>Use of Department of Veterans Affairs Medical Care Collections Fund for certain improvements in
 collections</header><text display-inline="no-display-inline">Section 1729A(c)(1)(B) of title 38, United States Code, is amended by inserting <quote>(including with respect to automatic data processing or information technology improvements)</quote> after <quote>collection</quote>.</text> </section><section id="HD5C8DB09D84C41669613F5414E54640B" section-type="subsequent-section"><enum>205.</enum><header>Department of Veterans Affairs health care productivity improvement</header> <subsection id="H6364150336B7414AB6D1924A784377C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is further amended by inserting after section 1705A the following new section:</text>

 <subsection id="H4C3C41F1663E49D087169EDD515066AC"><enum>(a)</enum><header>Relative value unit tracking</header><text display-inline="yes-display-inline">The Secretary shall track relative value units for all Department providers.</text> </subsection><subsection id="H31449EA8BAAF4A27BCAD16AAC6B76730"><enum>(b)</enum><header>Clinical procedure coding training</header><text>The Secretary shall require all Department providers to attend training on clinical procedure coding.</text>
							</subsection><subsection display-inline="no-display-inline" id="HCBA26903A4124C86B0FC1D48D64A3EB9"><enum>(c)</enum><header>Performance standards</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H19413DB634E049FDB4514A41B9C3F8C6"><enum>(1)</enum><text>The Secretary shall establish for each Department facility—</text> <subparagraph changed="added" committee-id="HVR00" id="H8A05E32D63774EF7B3BB78EF3D706797" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>in accordance with paragraph (2), standardized performance standards based on nationally recognized relative value unit production standards applicable to each specific profession in order to evaluate clinical productivity at the provider and facility level;</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="HA6A5C2AAE9AA486E86E117E739399B51" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>remediation plans to address low clinical productivity and clinical inefficiency; and</text> </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H7FFA1B4A680D4BD59009C177ACE452D0" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>an ongoing process to systematically review the content, implementation, and outcome of the plans developed under subparagraph (B).</text>
 </subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="H5CF257EA00444339A5567A5FC8E03F58" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>In establishing the performance standards under paragraph (1)(A), the Secretary may—</text> <subparagraph id="H5668A338047140678CBA3019AB5D12E9"><enum>(A)</enum><text display-inline="yes-display-inline">incorporate values-based productivity models; and</text>
 </subparagraph><subparagraph id="HBC311DAA163248CD8B5DB6289E63A390"><enum>(B)</enum><text display-inline="yes-display-inline">take into account non-clinical duties, including with respect to training and research.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="HC7D6A51F20FD4F168B2A0D8949AE5680"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph commented="no" id="H4F2069DA91B842C1905BA7A9FB2F15A2"><enum>(1)</enum><text>The term <term>Department provider</term> means an employee of the Department whose primary responsibilities include furnishing hospital care or medical services, including a physician, a dentist, an optometrist, a podiatrist, a chiropractor, an advanced practice registered nurse, and a physician’s assistant acting as an independent provider.</text>
 </paragraph><paragraph commented="no" id="H0AC18C3C63DE49338FF9BC6D3D1F3172"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>relative value unit</term> means a unit for measuring workload by determining the time, mental effort and judgment, technical skill, physical effort, and stress involved in delivering a procedure.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H999AD5FE15E741D2845A998EA3A4139A"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is further amended by inserting after the item relating to section 1705A the following new item:</text>

Such report shall include, for each professional category of Department providers, the relative value unit of such category of providers at the national, Veterans Integrated Service Network, and facility levels.</text>
				</subsection></section><section id="HE27FC7F09B6949C48845B2478EDD4968"><enum>206.</enum><header>Licensure of health care professionals of the Department of Veterans Affairs providing treatment
			 via telemedicine</header>
 <subsection id="H69D04C917CCD4320B98BA5F57210D450"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">Chapter 17</external-xref> of title 38, United States Code, is further amended by inserting after section 1730A the following new section:</text>
					<quoted-block changed="added" committee-id="HVR00" display-inline="no-display-inline" id="HA6647DF4B6444E5D956F336E6E7B138E" reported-display-style="italic" style="USC">
						<section id="H918FF2C581DD447583FD62219D056AC7"><enum>1730B.</enum><header>Licensure of health care professionals providing treatment via telemedicine</header>
 <subsection id="H768B3DC10D13407685839B39911B9979"><enum>(a)</enum><header>In general</header><text>Notwithstanding any provision of law regarding the licensure of health care professionals, a covered health care professional may practice the health care profession of the health care professional at any location in any State, regardless of where the covered health care professional or the patient is located, if the covered health care professional is using telemedicine to provide treatment to an individual under this chapter.</text>
 </subsection><subsection id="HB15883C48BDB484381436476E353D7F9"><enum>(b)</enum><header>Property of federal government</header><text>Subsection (a) shall apply to a covered health care professional providing treatment to a patient regardless of whether the covered health care professional or patient is located in a facility owned by the Federal Government during such treatment.</text>
 </subsection><subsection id="H15A6842384804473A6FF576CDA674A99"><enum>(c)</enum><header>Construction</header><text>Nothing in this section may be construed to remove, limit, or otherwise affect any obligation of a covered health care professional under the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.).</text>
 </subsection><subsection id="HFFAD9DED27504066AEAC32AF12B770AA"><enum>(d)</enum><header>Covered health care professional defined</header><text>In this section, the term <term>covered health care professional</term> means a health care professional who—</text> <paragraph id="HBB06FC494F004B409F188B34B0D9BDD6"><enum>(1)</enum><text>is an employee of the Department appointed under the authority under section 7306, 7401, 7405, 7406, or 7408 of this title, or title 5;</text>
 </paragraph><paragraph id="HF2DDBFD9E7A940FA84AEEA6E37272464"><enum>(2)</enum><text>is authorized by the Secretary to provide health care under this chapter;</text> </paragraph><paragraph id="HAFC57C43D5234E8CA04F73971FBC9195"><enum>(3)</enum><text>is required to adhere to all quality standards relating to the provision of telemedicine in accordance with applicable policies of the Department; and</text>
 </paragraph><paragraph id="HE5F635C7DA0F48CD9C01BF312FB9EFEA"><enum>(4)</enum><text>has an active, current, full, and unrestricted license, registration, or certification in a State to practice the health care profession of the health care professional.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H689CF6D8ABD6412AB89BD4FD8A336C42"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 17 of such title is further amended by inserting after the item relating to section 1730A the following new item:</text>

 <paragraph id="HD08D953A4CD742ABB836FEB95B69C141"><enum>(1)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the effectiveness of the use of telemedicine by the Department of Veterans Affairs.</text>
 </paragraph><paragraph id="HB78414C4A7254D47882C1720D9A3AEA6"><enum>(2)</enum><header>Elements</header><text>The report required by paragraph (1) shall include an assessment of the following:</text> <subparagraph id="H87E66558700D4B88BF00C0174ECCCBF7"><enum>(A)</enum><text>The satisfaction of veterans with telemedicine furnished by the Department.</text>
 </subparagraph><subparagraph id="HE284B21F0B4C4B6CBBE39E599586F50B"><enum>(B)</enum><text>The satisfaction of health care providers in providing telemedicine furnished by the Department.</text> </subparagraph><subparagraph id="H7AD365378D364CB8B668B4A42E4F8245"><enum>(C)</enum><text>The effect of telemedicine furnished by the Department on the following:</text>
 <clause id="H4AC6DB85D3D1405FB730B2A7C866CCF0"><enum>(i)</enum><text>The ability of veterans to access health care, whether from the Department or from non-Department health care providers.</text>
 </clause><clause id="H94541F97C8FE435698D71E3E6CA57BA8"><enum>(ii)</enum><text>The frequency of use by veterans of telemedicine.</text> </clause><clause id="H764300EF159647A7A5B5D37E7CA94114"><enum>(iii)</enum><text>The productivity of health care providers.</text>
 </clause><clause id="HC5D29E6FC0AD4F78AB04FF909EFEBA66"><enum>(iv)</enum><text>Wait times for an appointment for the receipt of health care from the Department.</text> </clause><clause id="HC85FD448224641C0A8544C8ECE7DD36F"><enum>(v)</enum><text>The reduction, if any, in the use by veterans of in-person services at Department facilities and non-Department facilities.</text>
 </clause></subparagraph><subparagraph id="HEC186BF1D33E4A1A988A25564C532BCE"><enum>(D)</enum><text>The types of appointments for the receipt of telemedicine furnished by the Department that were provided during the one-year period preceding the submittal of the report.</text>
 </subparagraph><subparagraph id="H3C411BD3D4B54F29B8CF4201436FEB2E"><enum>(E)</enum><text>The number of appointments for the receipt of telemedicine furnished by the Department that were requested during such period, disaggregated by Veterans Integrated Service Network.</text>
 </subparagraph><subparagraph id="H9454EE786EC94B72BCA4DFFABEB7F5E5"><enum>(F)</enum><text>Savings by the Department, if any, including travel costs, of furnishing health care through the use of telemedicine during such period.</text>
						</subparagraph></paragraph></subsection></section><section id="H3F63C49050DF4942AA0EDE5A002F70CC"><enum>207.</enum><header>Establishment of processes to ensure safe opioid prescribing practices by non-Department of
			 Veterans Affairs health care providers</header>
 <subsection id="HB787615228D842BA9A9FC0F4825607DD"><enum>(a)</enum><header>Receipt and review of guidelines</header><text>The Secretary of Veterans Affairs shall ensure that all covered health care providers are provided a copy of and certify that they have reviewed the evidence-based guidelines for prescribing opioids set forth by the Opioid Safety Initiative of the Department of Veterans Affairs under sections 911(a)(2) and 912(c) of the Jason Simcakoski Memorial and Promise Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/198">Public Law 114–198</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note) before first providing care under the laws administered by the Secretary and at any time when those guidelines are modified thereafter.</text>
 </subsection><subsection id="H21CEE42CD2F14E55A5BE20ADEFC53873"><enum>(b)</enum><header>Inclusion of medical history and current medications</header><text>The Secretary shall implement a process to ensure that, if care of a veteran by a covered health care provider is authorized under the laws administered by the Secretary, the document authorizing such care includes the relevant medical history of the veteran and a list of all medications prescribed to the veteran.</text>
				</subsection><subsection id="H45EBE2492B8541ACB8C3AE532FA33B94"><enum>(c)</enum><header>Submittal of prescriptions</header>
 <paragraph id="H4DE88FA2B63941379A1C52DA1D2BEEF7"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), the Secretary shall require, to the maximum extent practicable, each covered health care provider to submit prescriptions for opioids—</text>
 <subparagraph id="HAC72F201F6B340C9A1BFC22870FF69D2"><enum>(A)</enum><text>to the Department for prior authorization for the prescribing of a limited amount of opioids under contracts the Department has with retail pharmacies; or</text>
 </subparagraph><subparagraph id="HDF5713FCE1E744D9992494EAFC1FE7D8"><enum>(B)</enum><text>directly to a pharmacy of the Department for the dispensing of such prescription.</text> </subparagraph></paragraph><paragraph id="HD7304635D295473F818713CEB5B6771E"><enum>(2)</enum><header>Department responsibility</header><text>In carrying out paragraph (1), upon receipt by the Department of a prescription for opioids for a veteran under the laws administered by the Secretary, the Secretary shall—</text>
 <subparagraph id="H491C65636E8A4804BD5C112DADE567D9"><enum>(A)</enum><text>record such prescription in the electronic health record of the veteran; and</text> </subparagraph><subparagraph id="H4AB1511337B745118368117BF9CB5693"><enum>(B)</enum><text>monitor such prescription as outlined in the Opioid Safety Initiative of the Department.</text>
						</subparagraph></paragraph><paragraph id="HCC7735F7344A4B9D9B0C6D9475890044"><enum>(3)</enum><header>Exception</header>
 <subparagraph id="HD945B4D5C9244B03B8636F657013F646"><enum>(A)</enum><header>In general</header><text>A covered health care provider is not required under paragraph (1)(B) to submit an opioid prescription directly to a pharmacy of the Department if—</text>
 <clause id="H330D2E7F9872467BB2BC48C1845AE10F"><enum>(i)</enum><text>the health care provider determines that there is an immediate medical need for the prescription, including an urgent or emergent prescription or a prescription dispensed as part of an opioid treatment program that provides office-based medications; and</text>
							</clause><clause id="H966F4116D8DE4AEAB7F1B54C90DDD552"><enum>(ii)</enum>
 <subclause commented="no" display-inline="yes-display-inline" id="HD23831F6CC6B40BF9CCFB9EAE324D650"><enum>(I)</enum><text>following an inquiry into the matter, a pharmacy of the Department notifies the health care provider that it cannot fill the prescription in a timely manner; or</text>
 </subclause><subclause changed="added" committee-id="HVR00" id="HCCFF74C737B84E8CA9A0A1768C808A12" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>the health care provider determines that the requirement under paragraph (1)(B) would impose an undue hardship on the veteran, including with respect to travel distances, as determined by the Secretary.</text>
 </subclause></clause></subparagraph><subparagraph id="HBC4ABAFE4319476B8D8235C93EF9866C"><enum>(B)</enum><header>Notification to Department</header><text>If a covered health care provider uses an exception under subparagraph (A) with respect to an opioid prescription for a veteran, the health care provider shall, on the same day the prescription is written, submit to the Secretary for inclusion in the electronic health record of the veteran a notice, in such form as the Secretary may establish, providing information about the prescription and describing the reason for the exception.</text>
						</subparagraph><subparagraph id="HF5D5CB8E33CA4F938E8F20ED30DDB702"><enum>(C)</enum><header>Report</header>
 <clause id="H9351DDAC20FF42B39F5B2912A030BD30"><enum>(i)</enum><header>In general</header><text>Not less frequently than quarterly, the Secretary shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report evaluating the compliance of covered health care providers with the requirements under this paragraph and setting forth data on the use by health care providers of exceptions under subparagraph (A) and notices under subparagraph (B).</text>
 </clause><clause id="H723CFC4EC0EB43B58C35FFF4669029AF"><enum>(ii)</enum><header>Elements</header><text>Each report required by clause (i) shall include the following with respect to the quarter covered by the report:</text>
 <subclause id="HD99FC6ECB2234254BCBD10BE25FED237"><enum>(I)</enum><text>The number of exceptions used under subparagraph (A) and notices received under subparagraph (B).</text> </subclause><subclause id="HA703A01CFD044BCFBAC51F6EE748B5B0"><enum>(II)</enum><text>The rate of compliance by the Department with the requirement under subparagraph (B) to include such notices in the health records of veterans.</text>
 </subclause><subclause id="HF0C2A3B27A7442B287DFC0EEE1D4001C"><enum>(III)</enum><text>The identification of any covered health care providers that, based on criteria prescribed the Secretary, are determined by the Secretary to be statistical outliers regarding the use of exceptions under subparagraph (A).</text>
								</subclause></clause></subparagraph></paragraph></subsection><subsection id="H1548D0A8D2484EDAA8E3B4FFE0BC45D6"><enum>(d)</enum><header>Use of Opioid Safety Initiative guidelines</header>
 <paragraph id="HD1F70E26DA8845DB9BCFDCFF975471D7"><enum>(1)</enum><header>In general</header><text>If a director of a medical center of the Department or a Veterans Integrated Service Network determines that the opioid prescribing practices of a covered health care provider conflicts with or is otherwise inconsistent with the standards of appropriate and safe care, as that term is used in section 913(d) of the Jason Simcakoski Memorial and Promise Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/198">Public Law 114–198</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note), the director shall take such action as the director considers appropriate to ensure the safety of all veterans receiving care from that health care provider, including removing or directing the removal of any such health care provider from provider networks or otherwise refusing to authorize care of veterans by such health care provider in any program authorized under the laws administered by the Secretary.</text>
 </paragraph><paragraph id="H56716BF6A6C04845824D71F42928BA86"><enum>(2)</enum><header>Inclusion in contracts</header><text>The Secretary shall ensure that any contracts entered into by the Secretary with third parties involved in administering programs that provide care in the community to veterans under the laws administered by the Secretary specifically grant the authority set forth in paragraph (1) to such third parties and to the directors described in that paragraph, as the case may be.</text>
 </paragraph></subsection><subsection id="H085A5E0DA6914BF8B5F05289628A0998"><enum>(e)</enum><header>Denial or revocation of eligibility of non-Department providers</header><text>The Secretary shall deny or revoke the eligibility of a non-Department health care provider to provide health care to veterans under the laws administered by the Secretary if the Secretary determines that the opioid prescribing practices of the provider—</text>
 <paragraph id="HDE5B652A2A3D4D838846016F89390253"><enum>(1)</enum><text>violate the requirements of a medical license of the health care provider; or</text> </paragraph><paragraph id="HFB80A2F6B8D8407DBB8F6E63DD569333"><enum>(2)</enum><text>detract from the ability of the health care provider to deliver safe and appropriate health care.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H59740F4399C34231A636BA60E644CBF9"><enum>(f)</enum><header>Covered health care provider defined</header><text>In this section, the term <term>covered health care provider</term> means a non-Department of Veterans Affairs health care provider who provides health care to veterans under the laws administered by the Secretary of Veterans Affairs.</text>
				</subsection></section><section id="H609E3156B47245658298D2AD764E089B"><enum>208.</enum><header>Assessment of health care furnished by the Department to veterans who live in the territories</header>
 <subsection id="H40174BF262D24647AE99A9FDAB0163DC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the Senate and the House of Representatives a report regarding health care furnished by the Department of Veterans Affairs to veterans who live in the territories.</text>
 </subsection><subsection id="H3BD429CC44404F9DA6ED62353C0C7E1E"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">The report under subsection (a) shall include assessments of the following:</text> <paragraph id="H4B285203422A41BE8E3DFD5A67BB1773"><enum>(1)</enum><text display-inline="yes-display-inline">The ability of the Department to furnish to veterans who live in the territories the following:</text>
 <subparagraph id="H1CE24D1CB3E84CEBB1C4DF6719C82151"><enum>(A)</enum><text display-inline="yes-display-inline">Hospital care.</text> </subparagraph><subparagraph id="H8BCC98C7DCA84D0CA35A2F19062F4981"><enum>(B)</enum><text>Medical services.</text>
 </subparagraph><subparagraph id="HA181A8FEC51148D1868AB8ED712C3733"><enum>(C)</enum><text>Mental health services.</text> </subparagraph><subparagraph id="H920850D850BE47AA9D7D4FE85A393635"><enum>(D)</enum><text>Geriatric services.</text>
 </subparagraph></paragraph><paragraph id="H6E4187D7ED5C445998DEE27A27210DB9"><enum>(2)</enum><text display-inline="yes-display-inline">The feasibility of establishing a medical facility of the Department in any territory that does not contain such a facility.</text>
 </paragraph></subsection><subsection id="H11C3540331994F2A8DCA9DD08BB05807"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <quote>territories</quote> means the Northern Mariana Islands, Puerto Rico, American Samoa, Guam, and the Virgin Islands.</text> </subsection></section><section id="H37DDED1EE5A443DDA68F95E55D933DF1"><enum>209.</enum><header>Oversight and accountability of financial processes of Department of Veterans Affairs</header> <subsection id="HA461B26B7230443AB0D2095AF5430F1D"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text>
 <paragraph id="H1926551B89DF40DA8C18C9CBEEEFCAE6"><enum>(1)</enum><text display-inline="yes-display-inline">the normal budget process for the Department of Veterans Affairs should be grounded in sound actuarial analysis based on accurate demand forecasting;</text>
 </paragraph><paragraph id="HBB90286809A74C25B60471D233675DCA"><enum>(2)</enum><text>the regular budget process for the Department should be the norm;</text> </paragraph><paragraph id="H3C53FBFB0EC24D2EBBDE497E1D452927"><enum>(3)</enum><text>supplemental requests for appropriations should be used sparingly and for unforeseen demand or natural occurrences; and</text>
 </paragraph><paragraph id="H9AF7140C5076497D8738D075459C87E1"><enum>(4)</enum><text display-inline="yes-display-inline">upon receipt of the financial audit of the Office of Inspector General of the Department, the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives shall give due consideration to the report, including by holding hearings as appropriate</text>
 </paragraph></subsection><subsection id="H43FFCA7ED3394531AD41CBAF4420B04E"><enum>(b)</enum><header>Plans for use of supplemental appropriations required</header><text>Whenever the Secretary submits to address a budgetary issue affecting the Department of Veterans Affairs to Congress a request for supplemental appropriations or any other appropriation when the request is submitted outside the standard budget process, the Secretary shall, not later than 45 days before the date on which such budgetary issue would start affecting a program or service, submit to Congress a justification for the request, including a plan that details how the Secretary intends to use the requested appropriation and how long the requested appropriation is expected to meet the needs of the Department and certification that the request was made using an updated and sound actuarial analysis.</text>
 </subsection><subsection id="HA9B805111C4648ABB3CCA6377F4A1E3A"><enum>(c)</enum><header>Annual attestation regarding financial projections</header><text>Concurrent with the President's annual budget request submitted to Congress under section 1105 of title 31, United States Code, for fiscal year 2019 and each fiscal year thereafter, the Chief Financial Officer of the Department of Veterans Affairs shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives the following:</text>
 <paragraph id="H07A8D12AC03E46398DF2893291A3B9B8"><enum>(1)</enum><text>A statement of assurance that financial projections included in such budget or the supporting materials submitted along with such budget for the Department of Veterans Affairs are sufficient to provide benefits and services under laws administered by the Secretary of Veterans Affairs.</text>
 </paragraph><paragraph id="H28A9A07B9777494DB65E9211E9714636"><enum>(2)</enum><text>A certification of the Chief Financial Officer's responsibility for internal financial controls of the Department.</text>
 </paragraph><paragraph id="H5DBED129DF0C4FE38358F39D577D8A59"><enum>(3)</enum><text>An attestation that the Chief Financial Officer has collaborated sufficiently with the financial officers of the facilities and components of the Department to be confident in such financial projections.</text>
					</paragraph></subsection></section><section id="H1668A01A5FCC4E3291E18FB4F3493FB9"><enum>210.</enum><header>Authority for Department of Veterans Affairs Center for Innovation for Care and Payment</header>
 <subsection id="H1F87FF42F10C40B5BD5CACFB01B36F2D"><enum>(a)</enum><header>In general</header><text>Subchapter I of chapter 17, as amended by section 103, is further amended by inserting after section 1703C, as added by section 109, the following new section:</text>

						<section id="H3C481AA3A74944129ECE6629CBA70D28"><enum>1703D.</enum><header>Center for Innovation for Care and Payment</header>
							<subsection id="H01AFD06F6C6C481BABD451C8242AE3B2"><enum>(a)</enum><header>In general</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HC0F5518467434AA89CF78B31CA53934F"><enum>(1)</enum><text>There is established within the Department a Center for Innovation for Care and Payment (in this section referred to as the <quote>Center</quote>).</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="H034EF8AA8EB1440387521AC1E1762A78" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Secretary, acting through the Center, may carry out such pilot programs the Secretary determines to be appropriate to develop innovative approaches to testing payment and service delivery models in order to reduce expenditures while preserving or enhancing the quality of care furnished by the Department.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="H2E18E10DC1F047DD9477F6E2C0409131" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The Secretary, acting through the Center, shall test payment and service delivery models to determine whether such models—</text>
 <subparagraph id="HC8F553A92B344BB7BEDB6D10EDAD351B"><enum>(A)</enum><text>improve access to, and quality, timeliness, and patient satisfaction of care and services; and</text> </subparagraph><subparagraph id="HF1FD4BAAD586417EA7E41B0BA9F13ABB"><enum>(B)</enum><text>create cost savings for the Department.</text>
									</subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="H526362225A034F1F84F5D46D5F2C06B0" indent="up1" reported-display-style="italic"><enum>(4)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H263878A347464CF9B87EBA0FCD75477B"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary shall test a model in a location where the Secretary determines that the model will addresses deficits in care (including poor clinical outcomes or potentially avoidable expenditures) for a defined population.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H808AAC2040F8472FB3E884F5940E8ED9" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>The Secretary shall focus on models the Secretary expects to reduce program costs while preserving or enhancing the quality of care received by individuals receiving benefits under this chapter.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="HDEEBF13509674CE392896BC5ACB80565" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>The models selected may include those described in section 1115A(b)(2)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a(b)(2)(B)</external-xref>).</text>
 </subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="H1C65526D85A146AC9C35C1AB8C7E1274" indent="up1" reported-display-style="italic"><enum>(5)</enum><text display-inline="yes-display-inline">In selecting a model for testing, the Secretary may consider, in addition to other factors identified in this subsection, the following factors:</text>
 <subparagraph id="H4966C7DA3C3A4F74B990074AB353B425"><enum>(A)</enum><text display-inline="yes-display-inline">Whether the model includes a regular process for monitoring and updating patient care plans in a manner that is consistent with the needs and preferences of individuals receiving benefits under this chapter.</text>
 </subparagraph><subparagraph id="HD3BD8D6A3B2847B59F24DB95CD72EF33"><enum>(B)</enum><text display-inline="yes-display-inline">Whether the model places the individual receiving benefits under this chapter at the center of the care team (including family members and other caregivers) of such individual.</text>
 </subparagraph><subparagraph id="HCA2408805B2240DCB1C30D532CC07BEF"><enum>(C)</enum><text>Whether the model uses technology or new systems to coordinate care over time and across settings.</text> </subparagraph><subparagraph id="H7B9433520CF3464B944517C4D54F7C1F"><enum>(D)</enum><text>Whether the model demonstrates effective linkage with other public sector payers, private sector payers, or statewide payment models.</text>
									</subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="H56C605CC3D594C8C89D6C485D8BA75C4" indent="up1" reported-display-style="italic"><enum>(6)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="HB3D48F05304848F98874C6FE12AD54A1"><enum>(A)</enum><text>Models tested under this section may not be designed in such a way that would allow the United States to recover or collect reasonable charges from a Federal health care program for care or services furnished by the Secretary to a veteran under pilot programs carried out under this section.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H0B393E8BE9EF4B89B8C73078381F5F72" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>In this paragraph, the term <term>Federal health care program</term> means—</text> <clause id="H3F629557D9D441F2859CC33BFE63AFF4"><enum>(i)</enum><text>an insurance program described in section 1811 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395c">42 U.S.C. 1395c</external-xref>) or established by section 1831 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395j">42 U.S.C. 1395j</external-xref>); or</text>
 </clause><clause id="H898EDBF309F94BDB8E0FB3E1DA285B15"><enum>(ii)</enum><text>a State plan for medical assistance approved under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.); or</text>
 </clause><clause id="H4784A10160374ED4BC30924CC5029558"><enum>(iii)</enum><text>a TRICARE program operated under sections 1075, 1075a, 1076, 1076a, 1076c, 1076d, 1076e, or 1076f of title 10.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="H46BB36661645420992CF9769F8ED6B2B"><enum>(b)</enum><header>Duration</header><text>Each pilot program carried out by the Secretary under this section shall terminate no later than five years after the date of the commencement of the pilot program.</text>
 </subsection><subsection id="H50D1BE3AA62941488387EC98FED538D5"><enum>(c)</enum><header>Location</header><text>The Secretary shall ensure that each pilot program carried out under this section occurs in an area or areas appropriate for the intended purposes of the pilot program.</text>
 </subsection><subsection id="H75F3C64D5910490D8FF54844DFE2509C"><enum>(d)</enum><header>Budget</header><text display-inline="yes-display-inline">Funding for each pilot program carried out by the Secretary under this section shall come from appropriations—</text>
 <paragraph id="H384CE297821546609B60EF3BA9745304"><enum>(1)</enum><text>provided in advance in appropriations acts for the Veterans Health Administration; and</text> </paragraph><paragraph id="H8B4D10B55DF44D749C8F9A8096676B1A"><enum>(2)</enum><text>provided for information technology systems.</text>
 </paragraph></subsection><subsection id="H75014A0796B24F4285228F5F4CAE4204"><enum>(e)</enum><header>Notice</header><text display-inline="yes-display-inline">The Secretary shall—</text> <paragraph id="HC06EE71D0BED4587AC33E94F02A5AED6"><enum>(1)</enum><text>publish information about each pilot program under this section in the Federal Register; and</text>
 </paragraph><paragraph id="H44B9601A27584A77ADAC5FA976545E46"><enum>(2)</enum><text>take reasonable actions to provide direct notice to veterans eligible to participate in such pilot programs.</text>
								</paragraph></subsection><subsection id="H6602943F855243098EA05D9DB36CCF15"><enum>(f)</enum><header>Waiver of authorities</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H74F8C0FF22F741598AA576448114C0CF"><enum>(1)</enum><text>Subject to reporting under paragraph (2) and approval under paragraph (3), in implementing a pilot program under this section, the Secretary may waive such requirements in subchapters I, II, and III of this chapter as the Secretary determines necessary solely for the purposes of carrying out this section with respect to testing models described in subsection (a).</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="H7A8B7F49F3B94306A6915A75A0720E59" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Before waiving any authority under paragraph (1), the Secretary shall submit a report to the Speaker of the House of Representatives, the minority leader of the House of Representatives, the majority leader of the Senate, the minority leader of the Senate, and each standing committee with jurisdiction under the rules of the Senate and of the House of Representatives to report a bill to amend the provision or provisions of law that would be waived by the Department describing in detail the following:</text>
 <subparagraph id="H01FA1402BD21437F95B4148BF4D3D6CC"><enum>(A)</enum><text>The specific authorities to be waived under the pilot program.</text> </subparagraph><subparagraph id="HDF24AD33A3F94797947C590D6FF403F3"><enum>(B)</enum><text>The standard or standards to be used in the pilot program in lieu of the waived authorities.</text>
 </subparagraph><subparagraph id="HDFB08117FA3249759106970477B60E7D"><enum>(C)</enum><text>The reasons for such waiver or waivers.</text> </subparagraph><subparagraph id="H1E8088A14B664515B8E7EB0F3D6E5A4B"><enum>(D)</enum><text>A description of the metric or metrics the Secretary will use to determine the effect of the waiver or waivers upon the access to and quality, timeliness, or patient satisfaction of care and services furnished through the pilot program.</text>
 </subparagraph><subparagraph id="H12222994B62648789F3EE7C2206E0640"><enum>(E)</enum><text>The anticipated cost savings, if any, of the pilot program.</text> </subparagraph><subparagraph id="HEB89A0C43E7E4DD2B0319F363FF3FDCD"><enum>(F)</enum><text>The schedule for interim reports on the pilot program describing the results of the pilot program so far and the feasibility and advisability of continuing the pilot program.</text>
 </subparagraph><subparagraph id="HC43B00EFFC294B6CB5A733C726D71855"><enum>(G)</enum><text>The schedule for the termination of the pilot program and the submission of a final report on the pilot program describing the result of the pilot program and the feasibility and advisability of making the pilot program permanent.</text>
 </subparagraph><subparagraph id="HDAACADE3B8C04D4C85C1A92E7C1166FC"><enum>(H)</enum><text>The estimated budget of the pilot program.</text> </subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="H3CCBA6308755454B96DE30ADCE36B4FD" indent="up1" reported-display-style="italic"><enum>(3)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="HE7B3D82E072E42D4BF18A20A04E236AD"><enum>(A)</enum><text>Upon receipt of a report submitted under paragraph (2), each House of Congress shall provide copies of the report to the chairman and ranking member of each standing committee with jurisdiction under the rules of the House of Representatives or the Senate to report a bill to amend the provision or provisions of law that would be waived by the Department under this subsection.</text>
									</subparagraph><subparagraph changed="added" committee-id="HVR00" id="H43B08488100845F197FB93E1E66BD2DB" indent="up1" reported-display-style="italic"><enum>(B)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H809EA7F6B28B4FBA96BE079656C1CF2C"><enum>(i)</enum><text>The waiver requested by the Secretary under paragraph (2) shall be considered approved under this paragraph if there is enacted into law a bill or joint resolution approving such request in its entirety. Such bill or joint resolution shall be passed by recorded vote to reflect the vote of each member of Congress thereon.</text>
 </clause><clause changed="added" committee-id="HVR00" id="H45D41A4F1FEC42A88B1C939CE03E7382" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>The provisions of this paragraph are enacted by Congress—</text> <subclause id="H35548AACD79D481293A7B016B67F3B89"><enum>(I)</enum><text>as an exercise of the rulemaking power of the Senate and the House of Representatives and as such shall be considered as part of the rules of each House of Congress, and shall supersede other rules only to the extent that they are inconsistent therewith; and</text>
 </subclause><subclause id="H5F878030D20B47668B92E0A0E0DB0581"><enum>(II)</enum><text>with full recognition of the constitutional right of either House of Congress to change the rules (so far as they relate to the procedures of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text>
 </subclause></clause></subparagraph><subparagraph changed="added" committee-id="HVR00" id="HDA02FD2221B64D59B26E919FE804014E" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>During the 60-calendar-day period beginning on the date on which the Secretary submits the report described in paragraph (2) to Congress, it shall be in order as a matter of highest privilege in each House of Congress to consider a bill or joint resolution, if offered by the majority leader of such House (or a designee), approving such request in its entirety.</text>
									</subparagraph></paragraph></subsection><subsection id="H6FF5CFA5934A44CF9915997473BF203D"><enum>(g)</enum><header>Limitations</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H7B8CF0BB1FB94049812288AF27B5D0AC"><enum>(1)</enum><text display-inline="yes-display-inline">The waiver provisions in subsection (f) shall not apply unless the Secretary, in accordance with the requirements in subsection (f), submits the first proposal for a pilot program not later than 18 months after the date of the enactment of the VA Care in the Community Act.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="HB2C6E9217BBE4695AE034915FBB516F8" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Notwithstanding section 502 of this title, decisions by the Secretary under this section shall, consistent with section 511 of this title, be final and conclusive and may not be reviewed by any other official or by any court, whether by an action in the nature of mandamus or otherwise.</text>
								</paragraph><paragraph changed="added" committee-id="HVR00" id="H2EA673DE2A874C549EEF6F9B63B1C07D" indent="up1" reported-display-style="italic"><enum>(3)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H97948A0ED1274BC2975FF91A850E4BD3"><enum>(A)</enum><text>If the Secretary determines that the pilot program is not improving the quality of care or producing cost savings, the Secretary shall—</text>
 <clause changed="added" committee-id="HVR00" id="HA297CF33EB184A0DAC627FF7CCC698E4" indent="up1" reported-display-style="italic"><enum>(i)</enum><text>propose a modification to the pilot program in the interim report that shall also be considered a report under subsection (f)(2)(A) and shall be subject to the terms and conditions of subsection (f)(2); or</text>
 </clause><clause changed="added" committee-id="HVR00" id="H2D069B046598453EB5010A6369ABF802" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>terminate such pilot program not later than 30 days after submitting the interim report to Congress.</text>
 </clause></subparagraph><subparagraph changed="added" committee-id="HVR00" id="HCA53EB04DD8442448FE959587B9819CC" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>If the Secretary terminates the pilot program under subparagraph (A)(ii), for purposes of clauses (vi) and (vii) of subsection (f)(2)(A), such interim report will also serve as the final report for that pilot program.</text>
									</subparagraph></paragraph></subsection><subsection id="HCAE14DD031294E8BB5E598FEA576F221"><enum>(h)</enum><header>Evaluation and reporting requirements</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H3B5FB25BC7FB48CDBED6E696EF719ECB"><enum>(1)</enum><text>The Secretary shall conduct an evaluation of each model tested, which shall include, at a minimum, an analysis of—</text>
 <subparagraph changed="added" committee-id="HVR00" id="H0D509316773F4112BBCAEDC6B3D3E8B1" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>the quality of care furnished under the model, including the measurement of patient-level outcomes and patient-centeredness criteria determined appropriate by the Secretary; and</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H12E50FF0B3B449729C607EBFB21F876E" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the changes in spending by reason of that model.</text> </subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="HB2727862F6EE49D592A24576159F6ED2" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Secretary shall make the results of each evaluation under this subsection available to the public in a timely fashion and may establish requirements for other entities participating in the testing of models under this section to collect and report information that the Secretary determines is necessary to monitor and evaluate such models.</text>
								</paragraph></subsection><subsection id="H6A8AEEDDE4CD4BEB8108F6E16B7E39C8"><enum>(i)</enum><header>Coordination and consultation</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H2E4C27EED31C4A3284AAEC439D541D59"><enum>(1)</enum><text>The Secretary shall consult with the Under Secretary for Health and the Special Medical Advisory Group established pursuant to section 7312 of this title in the development and implementation of any pilot program operated under this section.</text>
 </paragraph><paragraph changed="added" committee-id="HVR00" id="HDE37B7ECAE5C42D598D64368796EF2AA" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>In carrying out the duties under this section, the Secretary shall consult representatives of relevant Federal agencies, and clinical and analytical experts with expertise in medicine and health care management. The Secretary shall use appropriate mechanisms to seek input from interested parties.</text>
 </paragraph></subsection><subsection id="H3D3D029EF74247A68587ED885834C707"><enum>(j)</enum><header>Expansion of successful pilot programs</header><text>Taking into account the evaluation under subsection (f), the Secretary may, through rulemaking, expand (including implementation on a nationwide basis) the duration and the scope of a model that is being tested under subsection (a) to the extent determined appropriate by the Secretary, if—</text>
 <paragraph id="HA5FF1BFBB52E405B96E4EF95E5E1F912"><enum>(1)</enum><text>the Secretary determines that such expansion is expected to—</text> <subparagraph id="HBC36C09ECFB54B30807923ED7122B061"><enum>(A)</enum><text>reduce spending without reducing the quality of care; or</text>
 </subparagraph><subparagraph id="HC1D8219FF5714F1FA29F65144116C367"><enum>(B)</enum><text>improve the quality of patient care without increasing spending; and</text> </subparagraph></paragraph><paragraph id="HF52984239D8A441C897D3D5E471F15F6"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary determines that such expansion would not deny or limit the coverage or provision of benefits for individuals receiving benefits under this chapter.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H66E6FC69746747E7B28B1E1CAA3FD342"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections at the beginning of such chapter, as amended by section 109, is further amended by inserting after the item relating to section 1703C the following new item:</text>

			<section id="H8C71F411FCDD4CFF8A599634D21A4287" section-type="subsequent-section"><enum>301.</enum><header>Designated scholarships for physicians and dentists under Department of Veterans Affairs Health
			 Professional Scholarship Program</header>
 <subsection id="HB8634521022C4F82954F2944C0F27778"><enum>(a)</enum><header>Scholarships for physicians and dentists</header><text display-inline="yes-display-inline">Section 7612(b) of title 38, United States Code, is amended by adding at the end the following new paragraph:</text>
					<quoted-block changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H64280DF654AA42AF9642D8EE4A1BA9B3" reported-display-style="italic" style="USC">
						<paragraph id="HFF9799A3260947DF92FFCEC7CC96B7A5" indent="up1"><enum>(6)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H45C73A98E1934C95A51FEC0C3AF83952"><enum>(A)</enum><text>Of the scholarships awarded under this subchapter, the Secretary shall ensure that not less than 50 scholarships are awarded each year to individuals who are accepted for enrollment or enrolled (as described in section 7602 of this title) in a program of education or training leading to employment as a physician or dentist until such date as the Secretary determines that the staffing shortage of physicians and dentists in the Department is less than 500.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="HD56AAAB1CF624D78B89C57F886CCD2CA" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>After such date, the Secretary shall ensure that of the scholarships awarded under this subchapter, a number of scholarships is awarded each year to individuals referred to in subparagraph (A) in an amount equal to not less than ten percent of the staffing shortage of physicians and dentists in the Department, as determined by the Secretary.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H614812046AC040BB8264E4904BCAF7AD" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>Notwithstanding subsection (c)(1), the agreement between the Secretary and a participant in the Scholarship Program who receives a scholarship pursuant to this paragraph shall provide the following:</text>
 <clause id="HA21F05272EEA40399306163036F0A45F"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary’s agreement to provide the participant with a scholarship under this subchapter for a specified number (from two to four) of school years during which the participant is pursuing a course of education or training leading to employment as a physician or dentist.</text>
 </clause><clause id="H31F06CA687764F71B36E6E642A0822E1"><enum>(ii)</enum><text display-inline="yes-display-inline">The participant's agreement to serve as a full-time employee in the Veterans Health Administration for a period of time (hereinafter in this subchapter referred to as the <quote>period of obligated service</quote>) of 18 months for each school year or part thereof for which the participant was provided a scholarship under the Scholarship Program.</text>
 </clause></subparagraph><subparagraph changed="added" committee-id="HVR00" id="HF77A1E4FE53F461587208903734C0C07" indent="up1" reported-display-style="italic"><enum>(D)</enum><text>In providing scholarships pursuant to this paragraph, the Secretary may provide a preference for applicants who are veterans.</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H31A75ECE61164F11B261FC91C7B24436" indent="up1" reported-display-style="italic"><enum>(E)</enum><text>On an annual basis, the Secretary shall provide to appropriate educational institutions informational material about the availability of scholarships under this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA8A1414BAD2344E2B10D8C0C7E92BD14"><enum>(b)</enum><header>Breach of agreement</header><text>Section 7617(b) of such title is amended—</text> <paragraph id="HED5C865317E74D1A9AE489F2C650E662"><enum>(1)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (5) and (6), respectively; and</text>
 </paragraph><paragraph id="H9362A2D62FD445F7B4BF62D2B2740CD1"><enum>(2)</enum><text>by inserting after paragraph (3) the following new paragraph (4):</text> <quoted-block changed="added" committee-id="HVR00" display-inline="no-display-inline" id="HC875ECB2CC344EA8BEB8FF4EF13BE800" reported-display-style="italic" style="USC"> <paragraph id="HEF7C11A375064474AAD671DC21367412"><enum>(4)</enum><text display-inline="yes-display-inline">In the case of a participant who is enrolled in a program or education or training leading to employment as a physician, the participant fails to successfully complete post-graduate training leading to eligibility for board certification in a specialty.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HF6E0B07A947E48BFB081BB7440858808"><enum>(c)</enum><header>Extension of program</header><text>Section 7619 of such title is amended by striking <quote>December 31, 2019</quote> and inserting <quote>December 31, 2033</quote>.</text> </subsection></section><section id="HD8A8B67C8AA548BC817EFE450E475E1D" section-type="subsequent-section"><enum>302.</enum><header>Establishment of Department of Veterans Affairs Specialty Education Loan Repayment Program</header> <subsection id="H79DE17AA80DB45A9BBE9102F13F7C677"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/76">Chapter 76</external-xref> of title 38, United States Code, is amended by inserting after subchapter VII the following new subchapter:</text>

						<subchapter id="H90FD374F415A4343B03D66F0900C79E9"><enum>VIII</enum><header>Specialty Education Loan Repayment Program</header>
 <section id="H8A845E6684F54C2184B946663E2C251C"><enum>7691.</enum><header>Establishment</header><text display-inline="no-display-inline">As part of the Educational Assistance Program, the Secretary may carry out a student loan repayment program under section 5379 of title 5. The program shall be known as the Department of Veterans Affairs Specialty Education Loan Repayment Program (in this chapter referred to as the <quote>Specialty Education Loan Repayment Program</quote>).</text>
 </section><section id="H3257275372894B57B25ECF94EAA19612"><enum>7692.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of the Specialty Education Loan Repayment Program is to assist, through the establishment of an incentive program for certain individuals employed in the Veterans Health Administration, in meeting the staffing needs of the Veterans Health Administration for physicians in medical specialties for which the Secretary determines recruitment or retention of qualified personnel is difficult.</text>
							</section><section id="HEDA564BAC865483895284BBCBA0CCA53"><enum>7693.</enum><header>Eligibility; preference; covered costs</header>
 <subsection id="HA905D66F17824F06A0B43657116A313C"><enum>(a)</enum><header>Eligibility</header><text>An individual is eligible to participate in the Specialty Education Loan Repayment Program if the individual—</text>
 <paragraph id="H2E18DA8E4FFD4DF89AE612048A536160"><enum>(1)</enum><text display-inline="yes-display-inline">is hired under section 7401 of this title to work in an occupation described in section 7692 of this title;</text>
 </paragraph><paragraph id="H9208BB35F65343BF877DC44ABB19D35D"><enum>(2)</enum><text display-inline="yes-display-inline">owes any amount of principal or interest under a loan, the proceeds of which were used by or on behalf of that individual to pay costs relating to a course of education or training which led to a degree that qualified the individual for the position referred to in paragraph (1); and</text>
 </paragraph><paragraph id="H8926F21AB7A6413FAB2EF97196DB39FB"><enum>(3)</enum><text display-inline="yes-display-inline">is—</text> <subparagraph id="H9675DC7464EF49B794F95682442998E4"><enum>(A)</enum><text>recently graduated from an accredited medical or osteopathic school and matched to an accredited residency program in a medical specialty described in section 7692 of this title; or</text>
 </subparagraph><subparagraph id="HE428130090F94EDA8D5A23F30211F406"><enum>(B)</enum><text display-inline="yes-display-inline">a physician in training in a medical specialty described in section 7692 of this title with more than two years remaining in such training.</text>
 </subparagraph></paragraph></subsection><subsection id="H10D660B3CE694731AD1CCE94ED226D44"><enum>(b)</enum><header>Preference for veterans</header><text display-inline="yes-display-inline">In selecting individuals for participation in the Specialty Education Loan Repayment Program under this subchapter, the Secretary may give preference to veterans.</text>
 </subsection><subsection id="H1403BBF390D549B9839330432B98137D"><enum>(c)</enum><header>Covered costs</header><text display-inline="yes-display-inline">For purposes of subsection (a)(2), costs relating to a course of education or training include—</text> <paragraph id="H82D53CC40A114AB7A0A0055C54CCFC5C"><enum>(1)</enum><text display-inline="yes-display-inline">tuition expenses;</text>
 </paragraph><paragraph id="H193C7A83AA1840D69A75385CFDE78721"><enum>(2)</enum><text display-inline="yes-display-inline">all other reasonable educational expenses, including expenses for fees, books, equipment, and laboratory expenses; and</text>
 </paragraph><paragraph id="H123E0F55FFE24E1E8396FDA6E8A45AAD"><enum>(3)</enum><text display-inline="yes-display-inline">reasonable living expenses.</text> </paragraph></subsection></section><section id="H8EC5FB8533654B5EA7C9F9F25153EEA4"><enum>7694.</enum><header>Specialty education loan repayment</header> <subsection id="H0832BC1BBD524CC3845BAF8E1DF7C156"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Payments under the Specialty Education Loan Repayment Program shall consist of payments for the principal and interest on loans described in section 7682(a)(2) of this title for individuals selected to participate in the Program to the holders of such loans.</text>
 </subsection><subsection id="HABAB4727213D4F5986EB641720EFB605"><enum>(b)</enum><header>Frequency of payment</header><text display-inline="yes-display-inline">The Secretary shall make payments for any given participant in the Specialty Education Loan Repayment Program on a schedule determined appropriate by the Secretary.</text>
								</subsection><subsection id="H7C33279E46724AC3B496433881CC2B2A"><enum>(c)</enum><header>Maximum amount; waiver</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H4D81810836474A77B6F6916831EA55EC"><enum>(1)</enum><text display-inline="yes-display-inline">The amount of payments made for a participant under the Specialty Education Loan Repayment Program may not exceed $160,000 over a total of four years of participation in the Program, of which not more than $40,000 of such payments may be made in each year of participation in the Program.</text>
									</paragraph><paragraph changed="added" committee-id="HVR00" id="H8E1FA14625E04599916C843546921F8F" indent="up1" reported-display-style="italic"><enum>(2)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H692D31332822487AB3BB69E9E5CE93CA"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary may waive the limitations under paragraph (1) in the case of a participant described in subparagraph (B). In the case of such a waiver, the total amount of payments payable to or for that participant is the total amount of the principal and the interest on the participant's loans referred to in subsection (a).</text>
 </subparagraph><subparagraph changed="added" committee-id="HVR00" id="H7D3FC4581A1245CFB1CC3285AD165C1B" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">A participant described in this subparagraph is a participant in the Program who the Secretary determines serves in a position for which there is a shortage of qualified employees by reason of either the location or the requirements of the position.</text>
 </subparagraph></paragraph></subsection></section><section id="HB44A1EE459034146B4387C85EF92B901"><enum>7695.</enum><header>Choice of location</header><text display-inline="no-display-inline">Each participant in the Specialty Education Loan Repayment Program who completes residency may select, from a list of medical facilities of the Veterans Health Administration provided by the Secretary, at which such facility the participant will work in a medical specialty described in section 7692 of this title.</text>
							</section><section id="H7969C538964449E4A125EC429836EDB7"><enum>7696.</enum><header>Term of obligated service</header>
 <subsection id="H72BD1E7DC54B4BEF9AFD5AC8DC4E293E"><enum>(a)</enum><header>In general</header><text>In addition to any requirements under section 5379(c) of title 5, a participant in the Specialty Education Loan Repayment Program must agree, in writing and before the Secretary may make any payment to or for the participant, to—</text>
 <paragraph id="H4494A5EDF88A48B7BC90C5238B29FF41"><enum>(1)</enum><text>obtain a license to practice medicine in a State;</text> </paragraph><paragraph id="HCC915E65A22649B1BB6BB146DADF9870"><enum>(2)</enum><text>successfully complete post-graduate training leading to eligibility for board certification in a specialty;</text>
 </paragraph><paragraph id="H75A6346E40E24F94A2DF8ABE306FB795"><enum>(3)</enum><text>serve as a full-time clinical practice employee of the Veterans Health Administration for 12 months for every $40,000 in such benefits that the employee receives, but in no case for fewer than 24 months; and</text>
 </paragraph><paragraph id="H6CBEF541658846E588CC5E8FF8AB0821"><enum>(4)</enum><text>except as provided in subsection (b), to begin such service as a full-time practice employee by not later than 60 days after completing a residency.</text>
 </paragraph></subsection><subsection id="HE34D9751658A42C993EA2348F35998EF"><enum>(b)</enum><header>Fellowship</header><text display-inline="yes-display-inline">In the case of a participant who receives an accredited fellowship in a medical specialty other than a medical specialty described in section 7692 of this title, the Secretary, on written request of the participant, may delay the term of obligated service under subsection (a) for the participant until after the participant completes the fellowship, but in no case later than 60 days after completion of such fellowship.</text>
								</subsection><subsection id="H25C40DBEDA7F4716921134AA39C1AA64"><enum>(c)</enum><header>Penalty</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HFAED20ADA97840AB8CFC7F0DE6AAECEF"><enum>(1)</enum><text>An employee who does not complete a period of obligated service under this section shall owe the Federal Government an amount determined in accordance with the following formula: <italic>A=B×((T−S)÷T))</italic><italic>.</italic></text>
 </paragraph><paragraph changed="added" commented="no" committee-id="HVR00" id="H66B3C420ADB04BCFBCCA42076513731A" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">In the formula in paragraph (1):</text> <subparagraph commented="no" id="H1CCFF209F7994D14ACD4A689D4BB6C51"><enum>(A)</enum><text><quote><italic>A</italic></quote> is the amount the employee owes the Federal Government.</text>
 </subparagraph><subparagraph commented="no" id="H8C72BFF4435B40ADAECD27DAEF9672AF"><enum>(B)</enum><text display-inline="yes-display-inline"><quote><italic>B</italic></quote> is the sum of all payments to or for the participant under the Specialty Education Loan Repayment Program.</text>
 </subparagraph><subparagraph commented="no" id="H2208014A7E1A4C209E0561EA0ED4B740"><enum>(C)</enum><text><quote><italic>T</italic></quote> is the number of months in the period of obligated service of the employee.</text> </subparagraph><subparagraph commented="no" id="H7EFDDEFC33344069979115AD83221259"><enum>(D)</enum><text display-inline="yes-display-inline"><quote><italic>S</italic></quote> is the number of whole months of such period of obligated service served by the employee.</text>
 </subparagraph></paragraph></subsection></section><section id="HC8C9AA1DB10147438C8A87382A2DFBC9"><enum>7697.</enum><header>Relationship to Educational Assistance Program</header><text display-inline="no-display-inline">Assistance under the Specialty Education Loan Repayment Program may be in addition to other assistance available to individuals under the Educational Assistance Program.</text></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HF9C48265B3C947648E5A2AEEF9BC31B5"><enum>(b)</enum><header>Conforming and technical amendments</header>

 <paragraph id="HA757B82D6ED34B51800B9EC82C3FCDE9" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">The term <quote>specialty education loan repayment amount</quote> means the maximum amount of specialty education loan repayment payments payable to or for a participant in the Department of Veterans Affairs Specialty Education Loan Repayment Program under subchapter VIII of this chapter, as specified in section 7694(c)(1) of this title and as previously adjusted (if at all) in accordance with this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="HA729345D55D04D0AA2F8860D17682FC8"><enum>(E)</enum><text display-inline="yes-display-inline">Section 7632 of title 38, United States Code, is amended—</text> <clause id="H8EA4BA6BBC564F4E9B6BC7AE93F29AC9"><enum>(i)</enum><text>in paragraph (1), by striking <quote>and the Education Debt Reduction Program</quote> and inserting <quote>the Education Debt Reduction Program, and the Specialty Education Loan Repayment Program</quote>; and</text>

 </paragraph></subsection><subsection id="H0D649530B6E34F188F9F40623DEEC959"><enum>(c)</enum><header>Needs of the VHA</header><text>In making determinations each year under section 7692 of title 38, United States Code, as enacted by subsection (a), the Secretary of Veterans Affairs shall consider the anticipated needs of the Veterans Health Administration during the period two to six years in the future.</text>
 </subsection><subsection id="H208F9C0E6EAC413392910CB21AB8675E"><enum>(d)</enum><header>Offer deadline</header><text display-inline="yes-display-inline">In the case of an applicant who applies before receiving a residency match and whom the Secretary of Veterans Affairs selects for participation in the Specialty Education Loan Repayment Program established by subsection (a), the Secretary shall offer participation to the applicant not later than 28 days after—</text>
 <paragraph id="H2E84828F5DAF4DBFB0C56690A443687E"><enum>(1)</enum><text>the applicant matches with a residency in a medical specialty described in section 7692 of title 38, United States Code, as enacted by subsection (a); and</text>
 </paragraph><paragraph id="H3EAD172406C14234AF3A25B44A01F1C4"><enum>(2)</enum><text>such match is published.</text> </paragraph></subsection><subsection id="H8F1148D2636343B198C0BD74AEB9CEAC"><enum>(e)</enum><header>Publicity</header><text>The Secretary of Veterans Affairs shall take such steps as the Secretary determines are appropriate to publicize the Specialty Education Loan Repayment Program established under subchapter VIII of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/76">chapter 76</external-xref> of title 38, United States Code, as enacted by subsection (a).</text>
				</subsection></section><section id="H6AAD57C6C0F045D6AF27ED8747AC32B7" section-type="subsequent-section"><enum>303.</enum><header>Veterans healing veterans medical access and scholarship program</header>
 <subsection id="H5F48AF68A6F2429890BBDA06DCE4AAD2"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs, acting through the Office of Academic Affiliations of the Department of Veterans Affairs, shall carry out a pilot program under which the Secretary shall provide funding for the medical education of a total of 18 eligible veterans. Such funding shall be provided for two veterans enrolled in each covered medical schools in accordance with this section.</text>
 </subsection><subsection id="H480E373EA5274A5A80069E667F3095C5"><enum>(b)</enum><header>Eligible veterans</header><text>To be eligible to receive funding for medical education under this section, a veteran shall—</text> <paragraph id="H73D58EAFEC8E43A28E8C18CEFC04AF3E"><enum>(1)</enum><text>have been discharged from the Armed Forces not more than ten years before the date of application for admission to a covered medical school;</text>
 </paragraph><paragraph id="HCB9F0878102B427DABCC0D6DC24CD183"><enum>(2)</enum><text display-inline="yes-display-inline">not be entitled to educational assistance under chapter 30, 31, 32, 33, 34, or 35 of title 38, United States Code, or chapter 1606 or 1607 of title 10, United States Code;</text>
 </paragraph><paragraph id="H462AF79C67D84C3BBD92B39FD95B7EBC"><enum>(3)</enum><text>apply for admission to a covered medical school for the entering class of 2019;</text> </paragraph><paragraph id="H39DB441FFC584A718D5E2F8123F00202"><enum>(4)</enum><text>indicate on such application for admission that the veteran would like to be considered for an award of funding under this section;</text>
 </paragraph><paragraph id="H15BF832F87F84FC2B914E5B41212A453"><enum>(5)</enum><text>meet the minimum admissions criteria for the covered medical school to which the veteran applies; and</text>
 </paragraph><paragraph id="HD9B8A078EADE40499C57A9FFA18AA332"><enum>(6)</enum><text>enter into an agreement described in subsection (e).</text> </paragraph></subsection><subsection id="H19CC9B3136CD4173A33D8439CE97B619"><enum>(c)</enum><header>Award of funding</header> <paragraph id="HBC739CC68400491C9FA03893908BCC78"><enum>(1)</enum><header>In general</header><text>Each covered medical school that opts to participate in the program under this section shall reserve two seats in the entering class of 2019 for eligible veterans who receive funding under such program. Such funding shall be awarded to the two eligible veterans with the highest admissions rankings for such class at such school.</text>
 </paragraph><paragraph id="H51EF13A4D83146A6AC858D2DF555E9BE"><enum>(2)</enum><header>Amount of funding</header><text>Each eligible veteran who receives funding under this section shall receive an amount equal to the actual cost of—</text>
 <subparagraph id="H4F7BE0FEFD954CF6B23C4D3657212772"><enum>(A)</enum><text>tuition at the covered medical school at which the veteran enrolls for four years;</text> </subparagraph><subparagraph id="HE2A961BA182C479BA763B7AD8CFED921"><enum>(B)</enum><text>books, fees, and technical equipment;</text>
 </subparagraph><subparagraph id="HD1400560429549C58F11DB5EF26743F0"><enum>(C)</enum><text>fees associated with the National Residency Match Program;</text> </subparagraph><subparagraph id="H4407FB7645A544D08C2AE6413D2C7237"><enum>(D)</enum><text>two away rotations performed during the fourth year at a Department of Veterans Affairs medical facility; and</text>
 </subparagraph><subparagraph id="H7D821DE079F74E7A984002B473779540"><enum>(E)</enum><text>a monthly stipend for the four-year period during which the veteran is enrolled in medical school in an amount to be determined by the Secretary.</text>
 </subparagraph></paragraph><paragraph id="HA3A0D6188D20471487F5D83CF0461F89"><enum>(3)</enum><header>Distribution of funding</header><text>In the event that two or more eligible veterans do not apply for admission at one of the covered medical schools for the entering class of 2019, the Secretary shall distribute the available funding to eligible veterans who applied for admission at other covered medical schools.</text>
					</paragraph></subsection><subsection id="HF6092292A1E840038CC6540B09F55ECB"><enum>(d)</enum><header>Agreement</header>
 <paragraph id="HFBC15F9C513F45CC89B6C3195EC067FA"><enum>(1)</enum><header>Terms of agreement</header><text>Each eligible veteran who accepts funding for medical education under this section shall enter into an agreement with the Secretary that provides that the veteran agrees—</text>
 <subparagraph id="H3586C1FA83AB409BB13BF0AE25D8F1BA"><enum>(A)</enum><text display-inline="yes-display-inline">to maintain enrollment and attendance in the medical school;</text> </subparagraph><subparagraph id="HF14CBF52C4664FB9B5B1DAA25626ADFB"><enum>(B)</enum><text>while enrolled in such medical school, to maintain an acceptable level of academic standing (as determined by the medical school under regulations prescribed by the Secretary);</text>
 </subparagraph><subparagraph id="HD4AE08DDFFA8415DBC384911FF198244"><enum>(C)</enum><text display-inline="yes-display-inline">to complete post-graduate training leading to eligibility for board certification in a speciality applicable to the Department of Veterans Affairs, as determined by the Secretary;</text>
 </subparagraph><subparagraph id="HB8F88C66FFCB43ECB06890C6089806E8"><enum>(D)</enum><text>after completion of medical school, to obtain a license to practice medicine in a State; and</text> </subparagraph><subparagraph id="HF3CA5CC4DCBD400C959CBA8FEFB728D5"><enum>(E)</enum><text>after completion of medical school and post-graduate training, to serve as a full-time clinical practice employee in the Veterans Health Administration for a period of four years.</text>
 </subparagraph></paragraph><paragraph id="HF559B9A8843A4D8B81ECF055DA440DAA"><enum>(2)</enum><header>Breach of agreement</header><text>If an eligible veteran who accepts funding under this section breaches the terms of the agreement described in paragraph (1), the United States shall be entitled to recover damages in an amount equal to the total amount of such funding received by the veteran.</text>
 </paragraph></subsection><subsection id="HC80C0B55A3D64B23863ECDBDD55DB4F6"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to prevent any covered medical school from accepting more than two eligible veterans for the entering class of 2019.</text>
 </subsection><subsection commented="no" id="HD95E5FFF2D5E4A509E658D1D7E3EC672"><enum>(f)</enum><header>Report to Congress</header><text>Not later than December 31, 2020, and annually thereafter for the subsequent three years, the Secretary shall submit to Congress a report on the pilot program under this section. Such report shall include the evaluation of the Secretary of the success of the pilot program, including the number of veterans who received funding under the program who matriculated and an evaluation of the academic progress of such veterans.</text>
 </subsection><subsection id="H36F9D0FB31E1411299A7EF14C350EAEF"><enum>(g)</enum><header>Covered medical schools</header><text>In this section, the term <quote>covered medical school</quote> means any of the following.</text> <paragraph id="HBA30B97873154827BCF63F2A178334D2"><enum>(1)</enum><text>The Teague-Cranston medical schools, consisting of—</text>
 <subparagraph id="H2824E17025A94A939F5ECE8A28818B20"><enum>(A)</enum><text>Texas A&amp;M College of Medicine;</text> </subparagraph><subparagraph id="H0322C591548D4F2B8D46AAC4908A55C2"><enum>(B)</enum><text>Quillen College of Medicine at East Tennessee State University;</text>
 </subparagraph><subparagraph id="H2B66EC2D4A6042B78B49CFC759E7D32C"><enum>(C)</enum><text>Boonshoft School of Medicine at Wright State University;</text> </subparagraph><subparagraph id="HD1B1B85FACF04A4AB6AB5E17FD4704E1"><enum>(D)</enum><text>Joan C. Edwards School of Medicine at Marshall University; and</text>
 </subparagraph><subparagraph id="HB63064CABF2C47DCBD913B5B0B7BAAF9"><enum>(E)</enum><text>University of South Carolina School of Medicine.</text> </subparagraph></paragraph><paragraph id="H9D9F69F9EFDC48038478E74DB955C8F4"><enum>(2)</enum><text display-inline="yes-display-inline">Charles R Drew University of Medicine and Science.</text>
