	<legis-body id="H05FA5C4C7E8C4C2E972912B698E81BBC" style="OLC">
 <section id="H8EB4E9B5CE3743BA9C0BF24C9B291F0C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financial Institution Living Will Improvement Act of 2017</short-title></quote>.</text> </section><section id="HAEF68C45924D4E91837E1395D8625074"><enum>2.</enum><header>Living will reforms</header> <subsection id="H21ECA2BA9D404802B40267BCDDFA4526"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 165(d) of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5365">12 U.S.C. 5365</external-xref>) is amended—</text>
 <paragraph id="H48893118DE504EC4BD167ABC2206C674"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>periodically</quote> and inserting <quote>not more often than every 2 years</quote>; and</text> </paragraph><paragraph id="H2D78DEC58972424796552C83D7CF8A3D"><enum>(2)</enum><text>in paragraph (3)—</text>
 <subparagraph id="HCFCF7244406C404FA9CEE711608AA543"><enum>(A)</enum><text>by striking <quote>The Board</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H6E40FBE2EA6A4CE492549EF78CB05590" style="OLC"> <subparagraph id="H7ECAFEA119B34318B34E753CAEDA4AB5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Board</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HCAE57DB99225447B9D76909AB3F74ECA"><enum>(B)</enum><text>by striking <quote>shall review</quote> and inserting the following:</text> <quoted-block display-inline="yes-display-inline" id="H7A21B6C9025C40159BDC63417FF804B3" style="OLC"> <text>shall—</text><clause id="H3E5D672DD0834265898FA6CB4AB04A78"><enum>(i)</enum><text display-inline="yes-display-inline">review</text></clause><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph><subparagraph id="H0729B23A313A455FAC5AD3BE2AD0AEFB"><enum>(C)</enum><text>by striking the period and inserting <quote>; and</quote>; and</text>
 </subparagraph><subparagraph id="H5F1FD29638594D5699D8E65B637D0E80"><enum>(D)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HC47B38B869D5468EAE8E26BF98D732FC" style="OLC"> <clause id="H68734EA5F882418E932D6B8616F4CBC7"><enum>(ii)</enum><text display-inline="yes-display-inline">not later than the end of the 6-month period beginning on the date the company submits the resolution plan, provide feedback to the company on such plan.</text>
 </clause><subparagraph id="HC781BA20784B4580A1B3C3419803F20E"><enum>(B)</enum><header>Disclosure of assessment framework</header><text display-inline="yes-display-inline">The Board of Governors and the Corporation shall publicly disclose the assessment framework that is used to review information under this paragraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H1CF1AAC592084F1285C3BA7753C48105"><enum>(b)</enum><header>Treatment of other resolution plan requirements</header>
 <paragraph id="H45D5B623EC7A4CD8B343436981C4C1CA"><enum>(1)</enum><header>In general</header><text>With respect to an appropriate Federal banking agency that requires a banking organization to submit to the agency a resolution plan not described under section 165(d) of the Dodd-Frank Wall Street Reform and Consumer Protection Act—</text>
 <subparagraph id="HFE69BF1F0FFE4F98AF68BF3BDAE00145"><enum>(A)</enum><text>the agency shall comply with the requirements of paragraphs (3) and (4) of such section 165(d);</text> </subparagraph><subparagraph id="H832AF2A42BCE46489039758001B849FF"><enum>(B)</enum><text display-inline="yes-display-inline">the agency may not require the submission of such a resolution plan more often than every 2 years; and</text>
 </subparagraph><subparagraph id="H5EBF1EC59E6C42458B15F4DA209A5E10"><enum>(C)</enum><text>paragraphs (6) and (7) of such section 165(d) shall apply to such a resolution plan.</text> </subparagraph></paragraph><paragraph id="H5098778023864F51A96B8E5E391DB333"><enum>(2)</enum><header>Definitions</header><text>For purposes of this subsection:</text>
 <subparagraph display-inline="no-display-inline" id="H381553FA076246D1B5D9526629AF1B0C"><enum>(A)</enum><header>Banking organization</header><text>The term <term>banking organization</term> means—</text> <clause id="H443B4625A9814DE4940CB4A86A4A55D4"><enum>(i)</enum><text>an insured depository institution;</text>
 </clause><clause id="H31522684217E4851BF2158BFFD7150A3"><enum>(ii)</enum><text>an insured credit union;</text> </clause><clause id="HC17D76BA110640AD9D386F40A33549CC"><enum>(iii)</enum><text display-inline="yes-display-inline">a depository institution holding company;</text>
 </clause><clause id="H7D1D90EB63A54AB09A5AAE919486337E"><enum>(iv)</enum><text display-inline="yes-display-inline">a company that is treated as a bank holding company for purposes of section 8 of the International Banking Act; and</text>
 </clause><clause id="H3084F3815503488F8D698652DD8FA513"><enum>(v)</enum><text display-inline="yes-display-inline">a U.S. intermediate holding company established by a foreign banking organization pursuant to section 252.153 of title 12, Code of Federal Regulations.</text>
 </clause></subparagraph><subparagraph id="H05E8D44AA9E54ED8A4F43C62500AB538"><enum>(B)</enum><header>Insured credit union</header><text>The term <quote>insured credit union</quote> has the meaning given that term under section 101 of the Federal Credit Union Act.</text> </subparagraph><subparagraph id="HF7A8802B3EB447879FD07FC253297C89"><enum>(C)</enum><header>Other banking terms</header><text>The terms <quote>appropriate Federal banking agency</quote>, <quote>depository institution holding company</quote>, and <quote>insured depository institution</quote> have the meaning given those terms, respectively, under section 3 of the Federal Deposit Insurance Act.</text>
					</subparagraph></paragraph></subsection></section></legis-body></bill>
