			 aid by reducing the complexity and length of the Free Application for
			 Federal Student Aid (FAFSA) and increasing support for working students
			 and vulnerable populations.</official-title></form>
	<legis-body id="HB73FCA557D29443EB4E2324B903766A2" style="OLC">
 <section id="HD90D3C47AEE94119B5E3B968D71A8FDE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Simple FAFSA Act of 2017</short-title></quote>.</text> </section><section id="HE6C89A3516B24A4EB0DF759C86466D99"><enum>2.</enum><header>Special rules</header> <subsection id="H7474520F41384532AD5CCA6CC172C9A6"><enum>(a)</enum><header>References</header><text>Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref> et seq.).</text>
 </subsection><subsection id="H39D6ED0AF5ED467088464DB67BDDAFCB"><enum>(b)</enum><header>Orderly Transition</header><text>The Secretary shall take such steps as are necessary to provide for the orderly transition to, and implementation of, the amendments made by this Act. The authority provided in the preceding sentence shall cease on the day that is one year after the effective date of this Act.</text>
			</subsection></section><section id="H439B3278AB40416B90C14258128882E4"><enum>3.</enum><header>Effective date; table of contents</header>
 <subsection id="HC01C820693E249A9A583E612E53A4115"><enum>(a)</enum><header>Effective date</header><text display-inline="yes-display-inline">This Act, and the amendments made by this Act, shall take effect with respect to the first award year beginning after the first October after the date of enactment of this Act and each succeeding award year.</text>

 <subparagraph id="HE188F708FDBB4CEA99333D0C05C904D9"><enum>(A)</enum><text>in paragraph (1), by striking subparagraphs (A) and (B) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H05253644323E4C72ACB656D92C356D07" style="OLC"> <subparagraph commented="no" id="HE907743347894A94AB24D5E2FD6CE05B"><enum>(A)</enum><header>In general</header><text>For each award year after award year 2018–2019, the Secretary shall publish in the Federal Register a revised table of income protection allowances for the purpose of sections 475(c)(4) and 477(b)(4), subject to subparagraphs (B) and (C).</text>
 </subparagraph><subparagraph commented="no" id="H66A52A4779FC4A44ADD19F23A75401B3"><enum>(B)</enum><header>Table for independent students</header><text>For each award year after award year 2018–2019, the Secretary shall develop the revised table of income protection allowances by increasing each of the dollar amounts contained in the table of income protection allowances under section 477(b)(4) by a percentage equal to the estimated percentage increase in the Consumer Price Index (as determined by the Secretary for the most recent calendar year ending prior to the beginning of the award year for which the determination is being made), and rounding the result to the nearest $10.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph commented="no" id="H7856C7F5BB494D03AF82A404333C5647"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="HBED4E1B23DE440578B431F11A410CE89"><enum>(i)</enum><text>in the first sentence, by striking <quote>academic year after academic year 2007–2008</quote> and inserting <quote>award year after award year 2018–2019</quote>; and</text>
 </clause><clause id="H7FC4043439A14E398F340331A9EDE986"><enum>(ii)</enum><text>in the second sentence, by striking <quote>shall be developed</quote> and all that follows through the period at the end and inserting <quote>shall be developed for each award year after award year 2018–2019, by increasing each of the dollar amounts contained in such section for award year 2018–2019 by a percentage equal to the estimated percentage increase in the Consumer Price Index (as determined by the Secretary for the most recent calendar year ending prior to the beginning of the award year for which the determination is being made), and rounding the result to the nearest $10.</quote>; and</text>
 </clause></subparagraph></paragraph><paragraph id="HA66FBE049F24424485979D82B48189C3"><enum>(2)</enum><text>in subsection (e)(1), by striking <quote>academic year</quote> and inserting <quote>award year</quote>.</text> </paragraph></subsection></section><section id="HEBF9B0278C1A4BA780FE03727D8DEB90"><enum>103.</enum><header>Zero expected family contribution</header><text display-inline="no-display-inline">Section 479 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ss">20 U.S.C. 1087ss</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HC84FF0B11ED94DA3A7EDC852E31633EF" style="OLC">
					<section id="HC39863FEA24B4621B63B0487FB53901A"><enum>479.</enum><header>Zero expected family contribution</header>
 <subsection id="H86228E67DE2D4206B077A83459ADA3C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall consider an applicant to have an expected family contribution equal to zero if—</text> <paragraph id="HBEF4434FC56F4B189576C250E9232831"><enum>(1)</enum><text>in the case of a dependent student—</text>
								<subparagraph id="H05DCD8D4038E40FAB57B450D9DAF6839"><enum>(A)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H302EC0298F504EC7A52F478040D0AE24"><enum>(i)</enum><text>the student’s parents file, or are eligible to file, a qualifying form or certify that the parents are not required to file a Federal income tax return; and</text>
 </clause><clause id="H0FE2170286894D21A3CEFEB0AEC8DA2F" indent="up1"><enum>(ii)</enum><text>the sum of the adjusted gross income of the parents is less than or equal to $34,000; or</text> </clause></subparagraph><subparagraph id="H78FF33BC23F940F093C30D0503E19096"><enum>(B)</enum><text display-inline="yes-display-inline">the student’s parents, or the student, received benefits at some time during the previous 24-month period under a means-tested Federal benefit program;</text>
 </subparagraph></paragraph><paragraph id="HC56CA38ED6A24C628889F3B30FCECB7F"><enum>(2)</enum><text>in the case of an independent student without regard to whether the student has dependents other than a spouse—</text>
								<subparagraph id="HC3CFF2EE3D1E4F2E82839A28FF26AE2D"><enum>(A)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H38CA2EF2C330463DB6D80C1F27213569"><enum>(i)</enum><text>the student (and the student's spouse, if any) files, or is eligible to file, a qualifying form or certifies that the student (and the student's spouse, if any) is not required to file a Federal income tax return; and</text>
 </clause><clause id="H7F4082D2603343AA9237B01CE8844553" indent="up1"><enum>(ii)</enum><text>the sum of the adjusted gross income of the student and spouse (if appropriate) is less than or equal to $34,000; or</text>
 </clause></subparagraph><subparagraph id="HB73DE0E182FE4D1087B4E71CC6DF924B"><enum>(B)</enum><text display-inline="yes-display-inline">the student received benefits at some time during the previous 24-month period under a means-tested Federal benefit program; or</text>
 </subparagraph></paragraph><paragraph id="H03F9A69416174962829C2696952AA9CD"><enum>(3)</enum><text>the applicant is a pathway one applicant under section 483(a)(13).</text> </paragraph></subsection><subsection id="HBD6C322BEB6C424BB42886FEF4F1DEE7"><enum>(b)</enum><header>Earned income credit</header><text>An individual is not required to qualify or file for the earned income credit in order to be eligible under this section.</text>
 </subsection><subsection id="H486B3469E49D428C915533EA9121B969"><enum>(c)</enum><header>Adjustments</header><text display-inline="yes-display-inline">The Secretary shall annually adjust the income level necessary to qualify an applicant for the zero expected family contribution. The income level shall be annually increased by the estimated percentage change in the Consumer Price Index, as defined in section 478(f), for the most recent calendar year ending prior to the beginning of an award year, and rounded to the nearest $1,000.</text>
 </subsection><subsection id="HCE68B2F4C4BC49A7A728CA5EB26B10A0"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H98195B72C31E4AF3918CAC6DFDE9F3DA"><enum>(1)</enum><header>Qualifying form</header><text display-inline="yes-display-inline">The term <term>qualifying form</term> means, in the case of an independent student, the student, or in the case of a dependent student, the family, files—</text>
 <subparagraph id="H67C9DE3FF3EA42319F07DE05A886D12E"><enum>(A)</enum><text>a form 1040A or 1040EZ (including any prepared or electronic version of such form) required pursuant to the Internal Revenue Code of 1986;</text>
 </subparagraph><subparagraph id="H5B03AE871CE8492CA216D9550A7A2BC2"><enum>(B)</enum><text>a form 1040 (including any prepared or electronic version of such form) required pursuant to the Internal Revenue Code of 1986, except that such form shall be considered a qualifying form only if the student or family files such form in order to take a tax credit under <external-xref legal-doc="usc" parsable-cite="usc/26/25A">section 25A</external-xref> of the Internal Revenue Code of 1986, and would otherwise be eligible to file a form described in subparagraph (A); or</text>
 </subparagraph><subparagraph id="H7C85980C1CA0404DBD5E8D9D9950AAFF"><enum>(C)</enum><text>an income tax return (including any prepared or electronic version of such return) required pursuant to the tax code of the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, or Palau.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H4E495CCF81EA44F58DD72955FADDC3BA"><enum>(2)</enum><header>Means-tested Federal benefit program</header><text display-inline="yes-display-inline">For purposes of this paragraph, a <quote>means-tested Federal benefit program</quote> means a mandatory spending program of the Federal Government, other than a program under this title, in which eligibility for the program's benefits, or the amount of such benefits, are determined on the basis of income or resources of the individual or family seeking the benefit, and may include such programs as—</text>
 <subparagraph commented="no" id="H0CF3D40C651D46AC9FD3C7B36E0A254D"><enum>(A)</enum><text>the supplemental security income program under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381</external-xref> et seq.);</text>
 </subparagraph><subparagraph commented="no" id="H4774CE54A78B4C0E8DCE158D27A4E087"><enum>(B)</enum><text>the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.);</text>
 </subparagraph><subparagraph commented="no" id="H6A36911962304A97A2E40600695BB7CD"><enum>(C)</enum><text>the program of block grants for States for temporary assistance for needy families established under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.);</text>
 </subparagraph><subparagraph commented="no" id="HE2593F856CC542298ED7B66F2281DB23"><enum>(D)</enum><text>the special supplemental nutrition program for women, infants, and children established by section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>);</text>
 </subparagraph><subparagraph commented="no" id="H3B638857C9DE4E33B4E0ADAAB1190F96"><enum>(E)</enum><text>the State Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.); and</text> </subparagraph><subparagraph commented="no" id="HB392E122ABFB429A884FD5A1E44EE559"><enum>(F)</enum><text>other programs identified by the Secretary.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H62D6E12B664F439490F63AEED1D00BC0"><enum>104.</enum><header>Using data from the second preceding year</header><text display-inline="no-display-inline">Section 480(a)(1)(B) (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv(a)(1)(B)</external-xref>) is amended by striking <quote>may</quote> in both places it appears and inserting <quote>shall</quote>.</text> </section><section id="H5FEAC939376C405EAC83CCCE03F532CD"><enum>105.</enum><header>Changes to untaxed income and benefits</header><text display-inline="no-display-inline">Section 480(b) (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv(b)</external-xref> is amended—</text>
 <paragraph id="H5A19723F9F8D4C8B9877C2D11B316B5C"><enum>(1)</enum><text>in paragraph (1), to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HD2123894A297423EA9B35742673A3E36" style="OLC"> <paragraph id="HD516C486F24C4333AF3AFAB34C187B01"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>untaxed income and benefits</term> means—</text>
 <subparagraph id="H34C6C8213E7A4FD689269C92894BCBC1"><enum>(A)</enum><text>child support received;</text> </subparagraph><subparagraph id="H2B3E7DA9BE2A4AFF8DC792B9358BA9F0"><enum>(B)</enum><text>untaxed portion of pensions; and</text>
 </subparagraph><subparagraph id="H1E44575BDFA3490CA7DB20E95DD29D11"><enum>(C)</enum><text display-inline="yes-display-inline">payments to individual retirement accounts and Keogh accounts excluded from income for Federal income tax purposes.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H6D6BDE14276A4B2D940DA6608F1A093D"><enum>(2)</enum><text>in paragraph (2)—</text> <subparagraph id="HDC51231A3DB244F99A6D8A6A868DBA90"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of subparagraph (E);</text>

 </subparagraph><subparagraph id="H4256635FEC274830A1252190020D6BC6"><enum>(I)</enum><text>interest on tax-free bonds;</text> </subparagraph><subparagraph id="HF7A2CB1485F54D709C5A185DA9646F7B"><enum>(J)</enum><text>housing, food, and other allowances (excluding rent subsidies for low-income housing) for military, clergy, and others (including cash payments and cash value of benefits), except that the value of on-base military housing or the value of basic allowance for housing determined under section 403(b) of title 37, United States Code, received by the parents, in the case of a dependent student, or the student or student’s spouse, in the case of an independent student, shall be excluded;</text>
 </subparagraph><subparagraph id="HEC2A9AD64D5543189D5C73E681AB684C"><enum>(K)</enum><text>cash support or any money paid on the student’s behalf, except, for dependent students, funds provided by the student’s parents; and</text>
 </subparagraph><subparagraph id="H0F7733828FF74110AEA66A9EA78E7D72"><enum>(L)</enum><text>any other untaxed income and benefits, such as Black Lung Benefits, Refugee Assistance, or railroad retirement benefits, or benefits received through participation in employment and training activities under title I of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2801">29 U.S.C. 2801</external-xref> et seq.).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></section></title><title id="H3FEC6026CE8442BE961129F2FE69C448"><enum>II</enum><header>Simplifying the FAFSA</header>
 <section id="H372F29BF0AC54C60B06E65E3C9BB3E6D"><enum>201.</enum><header>FAFSA pathways</header><text display-inline="no-display-inline">Section 483(a) (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H5507D85627304A0893DC47612BB6FAC7" style="OLC"> <paragraph id="HA7DD0C154AAF4098B038F78A86A3AF1E"><enum>(13)</enum><header>FAFSA pathways</header> <subparagraph commented="no" id="H9A4EA6528E974C858C67537E41CE2E7E"><enum>(A)</enum><header>Memorandum of understanding</header><text display-inline="yes-display-inline">Not later than the effective date of the <short-title>Simple FAFSA Act of 2017</short-title>, the Secretary shall seek to enter into a Memorandum of Understanding with the Secretary of Health and Human Services, the Secretary of Agriculture, and the Secretary of the Treasury, under which any information exchanged under an income and eligibility verification system established pursuant to section 1137 of the Social Security Act by State agencies administering a program listed in paragraph (1), (4), or (5) of subsection (b) of such section which may be of use in establishing or verifying eligibility or benefit amounts under such program shall be made available to the Secretary of Education to assist in determining whether the applicant (or the applicant’s parents) received a benefit under a means-tested Federal benefit program at some time during the previous 24-month period under a means-tested Federal benefit program, but subject to the requirements of Federal law.</text>
 </subparagraph><subparagraph id="H262610D672F64C079CD3D8DD1B623CB0"><enum>(B)</enum><header>Requirement for all applicants and the Secretary</header><text display-inline="yes-display-inline">For any award year for which an applicant applies for financial assistance under this title (except for any award year for which, pursuant to paragraph (14), the applicant is not required to submit a FAFSA)—</text>
 <clause id="H7080F36D4BA140CB8E7437936409F83E"><enum>(i)</enum><text display-inline="yes-display-inline">the applicant shall provide on the form described in this subsection whether the applicant received, or in the case of a dependent applicant, whether the parents of the applicant received, a benefit under a means-tested Federal benefit program at some time during the previous 24-month period under a means-tested Federal benefit program; and</text>
 </clause><clause id="H756C4EE897544595855BEE487543CD5A"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary, to the extent practicable and pursuant to the Memorandum of Understanding entered into under subparagraph (A), and without any further action by the applicant, shall verify the applicant’s (or the applicant’s parents) receipt of such benefit.</text>
							</clause></subparagraph><subparagraph id="H2EB2616C7C84453695AD3A5DF2068723"><enum>(C)</enum><header>Pathway one applicants</header>
 <clause id="H16381D2F3E5148F9B98C35E6F38008AA"><enum>(i)</enum><header>In general</header><text>With respect to an applicant who received, or in the case of a dependent applicant, whose parents received, benefits at some time during the previous 24-month period under a means-tested Federal benefit program, the applicant shall not be required to provide any further income or asset information on the form under this subsection.</text>
 </clause><clause id="H7CAA178215FB48F683C1AE30EDBFD47C"><enum>(ii)</enum><header>Designation</header><text>For purposes of this section and part F, an applicant described in clause (i) shall be referred to as a <quote>pathway one applicant</quote>.</text>
							</clause></subparagraph><subparagraph id="H4F2D6F72F72F4003A6D6D58D913C7385"><enum>(D)</enum><header>Pathway two applicants</header>
 <clause id="H802476E4EA0B46E5981CC74FC1CCAB5A"><enum>(i)</enum><header>In general</header><text>With respect to an applicant who is not a pathway one applicant and who is not required to file or, in the case of a dependent applicant, no parent of the applicant is required to file, any schedule (other than a schedule R, schedule 8812, or schedule EIC) with a Federal income tax return, the Secretary, to the extent practicable, shall use the data retrieval tool under section 484(q) to obtain any information for the applicant beyond the information described in subparagraph (A) for purposes of the form under this subsection.</text>
 </clause><clause id="H209B723093F64048A6B14319AE95475D"><enum>(ii)</enum><header>Designation</header><text>For purposes of this section and part F, an applicant described in clause (i) shall be referred to as a <quote>pathway two applicant</quote>.</text>
							</clause></subparagraph><subparagraph id="H48A41FA14B30474BB12E4A0A2E6BF8FC"><enum>(E)</enum><header>Pathway three applicants</header>
 <clause id="H66091FF4EE6D4832835BA7445C1DB481"><enum>(i)</enum><header>In general</header><text>With respect to an applicant who is not a pathway one applicant or a pathway two applicant, the Secretary, to the extent practicable, shall use the data retrieval tool under section 484(q) to obtain any information for the applicant beyond the information described in subparagraph (A) for purposes of the form under this subsection.</text>
 </clause><clause id="HD547120B9FDE47CEA20A57CC968EBE93"><enum>(ii)</enum><header>Designation</header><text>For purposes of this section and part F, an applicant described in clause (i) shall be referred to as a <quote>pathway three applicant</quote>.</text>
 </clause></subparagraph><subparagraph id="HCF7C5D1C53CA4669BADF67CD20B42CC4"><enum>(F)</enum><header>Means-tested Federal benefit program defined</header><text>For purposes of this paragraph, the term <term>means-tested Federal benefit program</term> has the meaning given the term in section 479(d)(2).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H552928C117884314830DF94EF7E52826"><enum>202.</enum><header>One-time FAFSA filing for dependent students</header><text display-inline="no-display-inline">Section 483(a) (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090(a)</external-xref>) is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H77CB299CBF814532B6916EBC8DB19437" style="OLC">
					<paragraph id="H0805480DE6C842C585F96D10222124C3"><enum>(14)</enum><header>One-time FAFSA filing for dependent students</header>
 <subparagraph id="H39523E237DE94AA3B94DACFA005169C5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section and subject to subparagraphs (B) and (C), an applicant who submits a FAFSA for the first time during the period required for the completion of the first undergraduate baccalaureate course of study being pursued by such applicant and is determined to be a dependent student who is eligible to receive a Federal Pell Grant for the award year for which the applicant submitted such FAFSA, for any succeeding award year—</text>
 <clause id="H07A854AD42094D92926CC1C6F6E89DF7"><enum>(i)</enum><text display-inline="yes-display-inline">for which the applicant does not submit a FAFSA and for which the applicant submits a certification form described in subparagraph (D) based upon which the Secretary confirms that the applicant is a dependent student for such year, such applicant—</text>
 <subclause id="HA4C2C9E452B54F1C960C3A4443E44260"><enum>(I)</enum><text display-inline="yes-display-inline">shall not be required to submit a FAFSA to receive financial assistance under this title; and</text> </subclause><subclause id="H075C9FA17FEC4FA3B50D12798502F8F1"><enum>(II)</enum><text display-inline="yes-display-inline">shall have an expected family contribution for such year that is equal to the expected family contribution of the applicant determined for the award year for which the applicant submitted a FAFSA during such period, except that an adjustment to such expected family contribution may be made under section 479A;</text>
 </subclause></clause><clause id="H7FECF4006A384B5B8E0728561BC2FF14"><enum>(ii)</enum><text display-inline="yes-display-inline">for which the applicant submits a FAFSA, such applicant—</text> <subclause id="HDDA63AD98ADA4911B19BE4D0F06B1D0B"><enum>(I)</enum><text>shall have an expected family contribution for such year that is determined based on such FAFSA; and</text>
 </subclause><subclause id="H61A2E1892B114F128AE192A3DF81833A"><enum>(II)</enum><text>shall be required to submit a FAFSA for any other award year for which the applicant seeks financial assistance under this title; and</text>
 </subclause></clause><clause id="H12A21EC530B44263A25B93D91FB841E8"><enum>(iii)</enum><text>for which the applicant is determined to be an independent student or does not submit a certification form described in subparagraph (D), such applicant shall submit a FAFSA for such succeeding award year and any other award year for which the applicant seeks financial assistance under this title.</text>
 </clause></subparagraph><subparagraph id="H0828ED60ADFF48DFA07423D19F8378E1"><enum>(B)</enum><header>Adjustment of expected family contribution</header><text display-inline="yes-display-inline">With respect to an applicant described in subparagraph (A)(i) who receives an adjustment under section 479A to the expected family contribution of the applicant for an award year, for any succeeding award year after the award year for which the adjustment was made, subclause (II) of such subparagraph shall be applied to such applicant by substituting <quote>expected family contribution of the applicant as most recently adjusted under section 479A for such applicant</quote> for the <quote>expected family contribution of the applicant determined for the award year for which the applicant submitted a FAFSA during such period</quote>.</text>
 </subparagraph><subparagraph id="H6238A73736AE4B528772DDA3131CE5E4"><enum>(C)</enum><header>Rule for certain students</header><text>With respect to an applicant who submits a FAFSA for award year 2018–2019 and enrolls in an institution of higher education for such year, subparagraph (A) shall be applied—</text>
 <clause id="H6C6030690F474A74B4AF6EBB35EEA9ED"><enum>(i)</enum><text>in the matter preceding clause (i), by substituting <quote>award year 2018–2019</quote> for <quote>the first time</quote>; and</text> </clause><clause id="H2871D839F6C44E7D8C4D1E87FCAD11A4"><enum>(ii)</enum><text>in clause (i)(II), by substituting <quote>award year 2018–2019</quote> for <quote>the award year for which the applicant submitted a FAFSA during such period</quote>.</text>
 </clause></subparagraph><subparagraph id="H16F864BE870D4D129989557728DA3FD0"><enum>(D)</enum><header>Dependent student certification form</header><text display-inline="yes-display-inline">The Secretary, in cooperation with representatives of agencies and organizations involved in student financial assistance, shall use behavioral science insights to produce, distribute, and process free of charge a short and simple consumer-tested dependent student certification form that uses skip logic to bypass fields that are inapplicable to an applicant. Such form shall not require an applicant to provide data that the Secretary may otherwise obtain with respect to the applicant (such as age or active duty military status), and may only contain the data elements required for purposes of subparagraph (A)(i)—</text>
 <clause id="H7FFE8C2BE91642E5AEDDB5D2B489F206"><enum>(i)</enum><text>to confirm that the applicant is a dependent student;</text> </clause><clause id="HCDFD7EB3C1EA450E9B960174E609A1C9"><enum>(ii)</enum><text>to allow the applicant to update the contact information of such applicant or the Federal School Code of the institution of higher education in which the applicant is, or will be enrolled, for the award year for which the applicant submits such form; and</text>
 </clause><clause id="H128E37618E7244808D8F75A5870BA73A"><enum>(iii)</enum><text display-inline="yes-display-inline">to ask whether the applicant’s need and eligibility for financial assistance under this title has not changed substantially since the most recent of the following:</text>
 <subclause id="H019A7B166A7D48A6877419CD48961D12"><enum>(I)</enum><text display-inline="yes-display-inline">The applicant submitted a FAFSA.</text> </subclause><subclause id="H6F88C77661E24611BC9A4198D0C4B2ED"><enum>(II)</enum><text display-inline="yes-display-inline">The applicant received an adjustment under section 479A to the expected family contribution of the applicant.</text>
 </subclause></clause></subparagraph><subparagraph id="H4E01CA94098F4E4FA5DA168A6A59372B"><enum>(E)</enum><header>Succeeding award year defined</header><text display-inline="yes-display-inline">In this paragraph, the term <term>succeeding award year</term>—</text> <clause id="HE54CC80290D54860AC68D6B6F747DE90"><enum>(i)</enum><text display-inline="yes-display-inline">when used with respect to an applicant who submits a FAFSA for the first time for an award year during the period required for the completion of the first undergraduate baccalaureate course of study being pursued by such applicant, means any award year during such period that follows the award year for which the applicant submits such FAFSA; and</text>
 </clause><clause id="H47B9AEEA7894465CA59F2276F204AEDC"><enum>(ii)</enum><text display-inline="yes-display-inline">when used with respect to an applicant described in subparagraph (C), means any award year after award year 2018–2019 during the period required for the completion of the first undergraduate baccalaureate course of study being pursued by such applicant.</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block>
 </section><section id="H9DF9181B5B024C8F94C2E592406D3FAC"><enum>203.</enum><header>FAFSA in various languages</header><text display-inline="no-display-inline">Section 483(a) (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090(a)</external-xref>) is further amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H37325F44932E43A18906777D36779C46" style="OLC"> <paragraph id="HFD2EDD558D794E49A2768939E82BD121"><enum>(15)</enum><header>FAFSA in various languages</header><text display-inline="yes-display-inline">The Secretary shall—</text>
 <subparagraph id="HD1CCFFC55D90410BBEFF7DDA156C607F"><enum>(A)</enum><text>translate the form developed under this subsection into not fewer than 11 foreign languages based on the languages most often spoken by English learner students and their parents, and make the translated form available to applicants in paper and electronic formats; and</text>
 </subparagraph><subparagraph id="HC0D693563C184ACB9029AC861F571A69"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that the form developed under this subsection is available in formats accessible to individuals with disabilities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H7907C9BA66A14FAEA522E7936EC9E787"><enum>204.</enum><header>Use of Internal Revenue Service data retrieval tool to populate FAFSA</header><text display-inline="no-display-inline">Section 483(f) (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090(f)</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HA1C0AF661FC34350894A30A2D45BB1ED" style="OLC"> <subsection id="H800F47D04F4F4B3082607024D1CD1FF4"><enum>(f)</enum><header>Use of Internal Revenue Service data retrieval tool To populate FAFSA</header> <paragraph id="H3531ACEA68A64FE08EB88FE42F53BAC2"><enum>(1)</enum><header>Simplification efforts</header><text display-inline="yes-display-inline">The Secretary shall—</text>
 <subparagraph id="HC40CFFED358A4BCEBC34791F4857683A"><enum>(A)</enum><text display-inline="yes-display-inline">make every effort to allow applicants to utilize the current data retrieval tool to transfer data available from the Internal Revenue Service to reduce the amount of original data entry by applicants and strengthen the reliability of data used to calculate expected family contributions, including through the use of technology to—</text>
 <clause id="HFDE3CD8F522A4108B22BDC761B349D01"><enum>(i)</enum><text display-inline="yes-display-inline">allow an applicant to automatically populate the electronic version of the forms under this paragraph with data available from the Internal Revenue Service; and</text>
 </clause><clause id="HE8A014FC03C048F998484216A5077FCD"><enum>(ii)</enum><text>direct an applicant to appropriate questions on such forms based on the applicant’s answers to previous questions; and</text>
 </clause></subparagraph><subparagraph id="HB69EC4B0FCE84E399B3594144A154496"><enum>(B)</enum><text>allow single taxpayers, married taxpayers filing jointly, and married taxpayers filing separately to utilize the current data retrieval tool to its full capacity.</text>
 </subparagraph></paragraph><paragraph id="HE940977B54DA46D293ADC8DD3DFA34AD"><enum>(2)</enum><header>Use of tax return in application process</header><text display-inline="yes-display-inline">The Secretary shall continue to examine whether data provided by the Internal Revenue Service can be used to generate an expected family contribution without additional action on the part of the student and taxpayer.</text>
 </paragraph><paragraph id="HE2B17784BB6A42CAA5C7B2DF386F4A28"><enum>(3)</enum><header>Reports on FAFSA simplification efforts</header><text display-inline="yes-display-inline">Not less than once every other year, the Secretary shall report to the authorizing committees and the Committees on Appropriations of the House of Representatives and the Senate on the progress of the simplification efforts under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H3520B857860240B795BE5D69C9DDEBC4"><enum>205.</enum><header>Information on FAFSA verification</header><text display-inline="no-display-inline">Section 483 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>) is further amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H2124A4094C1D4C47ACB87E8FD62DF894" style="OLC"> <subsection id="HDC085933EE97427BBDBAE3438EDBFF85"><enum>(i)</enum><header>FAFSA verification</header> <paragraph id="HAB8C491CF27943AAB7BD6E604790EB09"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to applicants who submit a FAFSA for an award year and were eligible to receive a Federal Pell Grant for such award year, the Secretary shall submit to the authorizing committees, and make publicly available, a report for such award year on—</text>
 <subparagraph id="H9492DB63E9B041C4A9F0F671D2581212"><enum>(A)</enum><text display-inline="yes-display-inline">the percentage of such applicants who received a Federal Pell Grant for such award year;</text> </subparagraph><subparagraph id="HA24E9843AF5F4BACA7ECC3A6564B3DE4"><enum>(B)</enum><text>the percentage of such applicants who did not receive a Federal Pell Grant for such year;</text>
 </subparagraph><subparagraph id="H206B8688D0A449AE86B21A98AAA9D9E1"><enum>(C)</enum><text display-inline="yes-display-inline">the percentage of such applicants who were selected by the Secretary for verification of the data provided in the FAFSA;</text>
 </subparagraph><subparagraph id="H0A7EDA7AFAE649668A952893F3E72D96"><enum>(D)</enum><text display-inline="yes-display-inline">the percentage of applicants described in paragraph (1)(C) who received a Federal Pell Grant for such award year; and</text>
 </subparagraph><subparagraph id="H3B4863738B714D32B0C041B394813EA9"><enum>(E)</enum><text>the percentage of applicants described in paragraph (1)(C) who did not receive a Federal Pell Grant for such award year.</text>
 </subparagraph></paragraph><paragraph id="H458E7DB138AC4C6EABD6F525C9411EE5"><enum>(2)</enum><header>Disaggregation</header><text display-inline="yes-display-inline">The data provided in a report under paragraph (1) shall be disaggregated—</text> <subparagraph id="H1778A946C0A24A38B40C609D39FF24F5"><enum>(A)</enum><text>by applicants who were pathway 1 applicants for such year;</text>
 </subparagraph><subparagraph id="H0A3FCD72CCDD44258C37F6A28F6F1A4F"><enum>(B)</enum><text>by applicants who were pathway 2 applicants for such year;</text> </subparagraph><subparagraph id="H4E2FAD5CB9E04EF9A3E5E1C39194DE8A"><enum>(C)</enum><text>by applicants who were pathway 3 applicants for such year; and</text>
 </subparagraph><subparagraph id="H4F641B239A214FB8A8A2C11C827E7E2E"><enum>(D)</enum><text display-inline="yes-display-inline">to the extent practicable, by applicants who enrolled in an institution of higher education for such award year.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HA22EBD15EEC949C09A4F07B35D1AFAC9"><enum>206.</enum><header>Conforming amendments to section 483</header><text display-inline="no-display-inline">Section 483 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>), as amended by sections 201 through 205, is further amended—</text> <paragraph id="H9C43FC827A984D699341DB546409363E"><enum>(1)</enum><text>in subsection (a)—</text>

 <subsection id="H8224E175626B4C5DA6D7356430A069C2"><enum>(a)</enum><header>Exception</header><text display-inline="yes-display-inline">Part B of title I (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011</external-xref> et seq.) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HE36FFC420A5844AABDBB42C605163613" style="OLC"> <section id="H262FA1D636A64E11AD9F4D5BD2CEC5B1"><enum>124.</enum><header>Exception to required registration with selective service system</header><text display-inline="no-display-inline">Notwithstanding section 12(f) of the Military Selective Service Act (<external-xref legal-doc="usc" parsable-cite="usc/50/3811">50 U.S.C. 3811(f)</external-xref>), a person shall not be ineligible for assistance or a benefit provided under title IV if the person is required under section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/3802">50 U.S.C. 3802</external-xref>) to present himself for and submit to registration under such section, and fails to do so in accordance with any proclamation, rule, or regulation issued under such section.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HC4BD2C090DFE4D7B973615F01C526D92"><enum>(b)</enum><header>Repeal</header><text display-inline="yes-display-inline">Subsection (n) of section 484 (<external-xref legal-doc="usc" parsable-cite="usc/20/1901">20 U.S.C. 1901</external-xref>) is repealed.</text> </subsection></section><section id="HAB1D2175E5B54AA2845A7C366034ECC6"><enum>302.</enum><header>Repeal of suspension of eligibility under the Higher Education Act of 1965 for grants, loans, and work assistance for drug-related offenses</header> <subsection id="HC93A28BCAC9A482FACD53ABB82E93AC6"><enum>(a)</enum><header>Repeals</header> <paragraph id="H56EA6758FA5147369452865C88A0FDEC"><enum>(1)</enum><header>Suspension of eligibility</header><text display-inline="yes-display-inline">Subsection (r) of section 484 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091(r)</external-xref>) is repealed.</text>
 </paragraph><paragraph id="HAA181C0CA90A445FBFFA388DF99F4758"><enum>(2)</enum><header>Notice</header><text display-inline="yes-display-inline">Subsection (k) of section 485 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092</external-xref>) is repealed.</text> </paragraph></subsection><subsection id="HE00FE658BB3146369ABE7FCB07CEFB05"><enum>(b)</enum><header>Revision of FAFSA form</header><text>Section 483 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>), as amended by title II, is further amended by adding at the end the following:</text>

 <subsection id="H5C68A0253A8D44D1B17879F30DF9EB5A"><enum>(j)</enum><header>Convictions</header><text>The Secretary shall not include any question about the conviction of an applicant for the possession or sale of illegal drugs on the FAFSA (or any other form developed under subsection (a)).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="HE09BDD03201940B9A456198A3450E61B"><enum>303.</enum><header>Federal aid eligibility for DREAMer students</header><text display-inline="no-display-inline">Section 484 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091</external-xref>) is amended—</text> <paragraph commented="no" id="HDDFA5C50FFE34048B045506CBE7AC016"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(5), by inserting <quote>, or be a Dreamer student, as defined in subsection (u)</quote> after <quote>becoming a citizen or permanent resident</quote>; and</text>
 </paragraph><paragraph commented="no" id="H8326787BC7D9444FB122119C8FD63667"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HA9900F0664484E0B9301FEA540980AE1" style="OLC"> <subsection commented="no" id="HD4A2A6BF237C41E89708D401A57ED893"><enum>(u)</enum><header>Dreamer students</header> <paragraph commented="no" id="HF878FD2003E94263834B6E9C7F05C66C"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>Dreamer student</term> means an individual who—</text>
 <subparagraph commented="no" id="H76F4B253B0BB459BB2239C893ECBB481"><enum>(A)</enum><text>was younger than 16 years of age on the date on which the individual initially entered the United States;</text>
 </subparagraph><subparagraph commented="no" id="H3CC42BD9C16047638F220E909062D503"><enum>(B)</enum><text>has provided a list of each secondary school that the student attended in the United States; and</text> </subparagraph><subparagraph commented="no" id="H6D79B54C64A043DBAFB725B5D9D2855A"><enum>(C)</enum> <clause commented="no" display-inline="yes-display-inline" id="HA83266A78207442D9558955933F93103"><enum>(i)</enum><text>has earned a high school diploma, the recognized equivalent of such diploma from a secondary school, or a high school equivalency diploma in the United States or is scheduled to complete the requirements for such a diploma or equivalent before the next academic year begins;</text>
 </clause><clause commented="no" id="HE7CFF9EAE1B6470D9594515D88BA9C56" indent="up1"><enum>(ii)</enum><text>has acquired a degree from an institution of higher education or has completed not less than 2 years in a program for a baccalaureate degree or higher degree at an institution of higher education in the United States and has made satisfactory academic progress, as defined in subsection (c), during such time period;</text>
 </clause><clause id="H2D010FDA49884AE9ADBFE23EFA6B5788" indent="up1"><enum>(iii)</enum><text>at any time was eligible for a grant of deferred action under—</text> <subclause id="H9CB5CB3F4D61449D958EA6B2F57B739F"><enum>(I)</enum><text>the June 15, 2012, memorandum from the Secretary of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote>; or</text>
 </subclause><subclause id="H421AFC2253484CEA920EC4C6448A18BC"><enum>(II)</enum><text>the November 20, 2014, memorandum from the Secretary of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children and with Respect to Certain Individuals Who Are the Parents of U.S. Citizens or Permanent Residents</quote>; or</text>
 </subclause></clause><clause commented="no" id="H72360296B1A44D56898DA5A3CEF015A7" indent="up1"><enum>(iv)</enum><text>has served in the uniformed services, as defined in section 101 of title 10, United States Code, for not less than 4 years and, if discharged, received an honorable discharge.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="HF1C1729FF2E24BDABEBD947065B43FA1"><enum>(2)</enum><header>Hardship exception</header><text>The Secretary shall issue regulations that direct when the Department shall waive the requirement of subparagraph (A) or (B), or both, of paragraph (1) for an individual to qualify as a Dreamer student under such paragraph, if the individual—</text>
 <subparagraph commented="no" id="HE881CDA94DC341D8B93BECF1C221AA01"><enum>(A)</enum><text>demonstrates compelling circumstances for the inability to satisfy the requirement of such subparagraph (A) or (B), or both; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6182EB93D5FD4E9A81963340B6C8B238"><enum>(B)</enum><text>satisfies the requirement of paragraph (1)(C).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section></title><title id="H977A15A5A3C94B73B039EBEA3691A1A9"><enum>IV</enum><header>Financial Aid Shopping Sheet</header> <section id="HCA6CF97E76ED495996062666308771B7"><enum>401.</enum><header>Financial aid shopping sheet</header> <subsection id="HBC48E40C84C849BBA15E2CF7003C2DE3"><enum>(a)</enum><header>Secretarial requirements</header> <paragraph id="H4D44ACD075AA44ABBBE9672509434BFA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than the effective date of this Act, the Secretary of Education, in consultation with the Secretaries of Defense and Veterans Affairs, shall develop and finalize a financial shopping sheet that ensures each institution of higher education provides meaningful information about the financial cost and quality of such institution to students (including students who have authorized the Department of Education to send the student’s Institutional Student Information Record to such institution) to assist such students in determining how to use financial aid to attend such institution, and which—</text>
 <subparagraph id="H85A7355091834AEEAC673D4D3860F38C"><enum>(A)</enum><text>is standardized so that it can be used by all institutions of higher education;</text> </subparagraph><subparagraph id="HF90A75C71A24495FB5A7D930175EE5C3"><enum>(B)</enum><text display-inline="yes-display-inline">is consumer tested, and presented in a manner that is simple and easily understandable; and</text>
 </subparagraph><subparagraph id="H73F86B259CF445E1BCA08DBA2C6B5769"><enum>(C)</enum><text>is personalized for each student who receives such sheet by including—</text> <clause id="H8C51E1D7592840E1AB326BB613105C94"><enum>(i)</enum><text display-inline="yes-display-inline">the cost of attendance of the educational program in which the student is enrolled or seeks to be enrolled;</text>
 </clause><clause id="H3233F2DEE7B74B95814E2E8A864675B6"><enum>(ii)</enum><text>the type of Federal educational benefits available to assist in covering such cost of attendance, including loans and grants under title IV of the Higher Education Act of 1965;</text>
 </clause><clause id="H23F7F45D59FA426B8973E9464206C085"><enum>(iii)</enum><text>the amount of financial aid, including Federal, State, institutional, or other aid that can be used to assist in covering such cost of attendance;</text>
 </clause><clause id="HC32C4347134146C0A29B414474DE4B4D"><enum>(iv)</enum><text>information about student outcomes for students who graduate from such educational program, including, based upon the most recent data available—</text>

 </clause></subparagraph></paragraph><paragraph id="H69D82872B7464B549149539576EB1AA6"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="HE9255E0FAC9B49299081E5F34CCA6D4A"><enum>(A)</enum><header>Cost of attendance</header><text>The term <term>cost of attendance</term> has the meaning given the term in section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>).</text>
 </subparagraph><subparagraph id="H7329EA3C5B534BAFB96536417A0FC30B"><enum>(B)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text>
 </subparagraph></paragraph></subsection><subsection id="H26B3039A80014EE7A8A0C8F3D2724845"><enum>(b)</enum><header>Institution of higher education requirement</header><text>Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following:</text>
