			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Veterans Affairs to ensure that each medical facility of the Department
			 of Veterans Affairs complies with requirements relating to scheduling
			 veterans for health care appointments, to improve the uniform application
			 of directives of the Department, and for other purposes.</official-title></form>
	<legis-body id="H19BD2587AD4C4476B751E355E6DF3538" style="OLC">
 <section id="HC36EB43A9EC046F39E9171AF0A041A10" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Scheduling Accountability Act</short-title></quote>.</text> </section><section id="H7C90C58A571E4555B8E0CD62202E7BF9" section-type="subsequent-section"><enum>2.</enum><header>Compliance with scheduling requirements</header> <subsection id="H73F0110191EB40A8AF2B1F4037C393A7"><enum>(a)</enum><header>Annual certification</header> <paragraph id="H0C8011078962452A97EE92D66EDD8B9B"><enum>(1)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall ensure that the director of each medical facility of the Department of Veterans Affairs annually certifies to the Secretary that the medical facility is in full compliance with all provisions of law and regulations relating to scheduling appointments for veterans to receive hospital care and medical services, including pursuant to Veterans Health Administration Directive 2010–027, or any successor directive.</text>
 </paragraph><paragraph id="HDD8CFAF5114E43539B09AC6BE8AA672D"><enum>(2)</enum><header>Prohibition on waiver</header><text display-inline="yes-display-inline">The Secretary may not waive any provision of the laws or regulations described in paragraph (1) for a medical facility of the Department if such provision otherwise applies to the medical facility.</text>
 </paragraph></subsection><subsection id="HE5C0A095E944470DAD87FF410AFA373C"><enum>(b)</enum><header>Explanation of noncompliance</header><text display-inline="yes-display-inline">If a director of a medical facility of the Department does not make a certification under subsection (a)(1) for any year, the director shall submit to the Secretary a report containing—</text>
 <paragraph id="HC5745A91071D423682E0AB12AD1239F3"><enum>(1)</enum><text>an explanation of why the director is unable to make such certification; and</text> </paragraph><paragraph id="HA6A21854486940F8903ECCB853ED4F1B"><enum>(2)</enum><text>a description of the actions the director is taking to ensure full compliance with the laws and regulations described in such subsection.</text>
				</paragraph></subsection><subsection id="H41BA7A15513F4FA5A72978CF098EDFA5"><enum>(c)</enum><header>Prohibition on bonuses based on noncompliance</header>
 <paragraph id="HD20965BEAE714AD5A65DE300B544EC81"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If a director of a medical facility of the Department does not make a certification under subsection (a)(1) for any year, each covered official described in paragraph (2) may not receive an award or bonus under chapter 45 or 53 of title 5, United States Code, or any other award or bonus authorized under such title or title 38, United States Code, during the year following the year in which the certification was not made.</text>
 </paragraph><paragraph id="HF53784FE8D2B4F73ACFFD62E20221A9F"><enum>(2)</enum><header>Covered official</header><text display-inline="yes-display-inline">A covered official described in this paragraph is each official who serves in the following positions at a medical facility of the Department during a year, or portion thereof, for which the director does not make a certification under subsection (a)(1):</text>
 <subparagraph id="H5F603DF5266448F6845D12AA99D182B9"><enum>(A)</enum><text>The director.</text> </subparagraph><subparagraph id="H5FE4AD6E97B2447AAA572B547D345E2A"><enum>(B)</enum><text>The chief of staff.</text>
 </subparagraph><subparagraph id="H1A8348792BA64688AEFA3F9F57176C6F"><enum>(C)</enum><text>The associate director.</text> </subparagraph><subparagraph id="HE71E24DFDFF54B94B3511E8809914928"><enum>(D)</enum><text display-inline="yes-display-inline">The associate director for patient care.</text>
 </subparagraph><subparagraph id="H2FC1AE1B67DD45BC9431F710D574394A"><enum>(E)</enum><text>The deputy chief of staff.</text> </subparagraph></paragraph></subsection><subsection id="HB23E5D54B3F4456FB2728888C440321C"><enum>(d)</enum><header>Annual report</header><text>The Secretary shall annually submit to the Committees on Veterans’ Affairs of the House of Representative and the Senate a report containing, with respect to the year covered by the report—</text>
 <paragraph id="H266D9E82FED8481EBA57550A3A4CC053"><enum>(1)</enum><text>a list of each medical facility of the Department for which a certification was made under subsection (a)(1); and</text>
 </paragraph><paragraph id="H6B499FE39FA8409BB8EAF8E8A0090CC1"><enum>(2)</enum><text>a list of each medical facility of the Department for which such a certification was not made, including a copy of each report submitted to the Secretary under subsection (b).</text>
				</paragraph></subsection></section><section id="H21D3F2A8A2204C6782F2DA6B4B0774E0"><enum>3.</enum><header>Standardized application of directives and policies of Department of Veterans Affairs</header>
 <subsection id="H4F989EC299724623A1B76717B65985DF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall ensure that the directives and policies of the Department of Veterans Affairs apply to, and are implemented by, each office or facility of the Department in a standardized manner, including such offices and facilities at the local level.</text>
 </subsection><subsection id="HA9409DED24B3438EBD69B720CB8BFD34"><enum>(b)</enum><header>Notification</header><text display-inline="yes-display-inline">If the Secretary does not apply and implement the directives and policies of the Department in a standardized manner pursuant to subsection (a), including by waiving such a directive or policy with respect to an office or facility of the Department, the Secretary shall notify the Committees on Veterans’ Affairs of the House of Representatives and the Senate of such nonstandardized application or implementation, including an explanation for the nonstandardized application or implementation, as the case may be.</text>
