 </subsection></section><section id="HC04C942D16A14D0DA35DDDAB28E90CB5"><enum>2.</enum><header>Commission defined</header><text display-inline="no-display-inline">In this Act, the term <quote>Commission</quote> means the Federal Communications Commission.</text> </section><title id="HE9CEA424EC0F419F9FB7536B381581D2"><enum>I</enum><header>FCC Reauthorization</header> <section id="H9B92F12CD8C94125A72EA6E6B689C6E8"><enum>101.</enum><header>Authorization of appropriations</header> <subsection id="H37A2CD077587438BB720193B3AFE9A6E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 6 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/156">47 U.S.C. 156</external-xref>) is amended to read as follows:</text>

						<section id="H320D285911D645439D6D1A09728A350C"><enum>6.</enum><header>Authorization of appropriations</header>
 <subsection id="HC5D56E9C2CA44BA893E6F0B359692483"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Commission to carry out the functions of the Commission $322,035,000 for each of the fiscal years 2019 and 2020.</text>
							</subsection><subsection id="H2819EC2BCADF417C91EC803A37A0DB7B"><enum>(b)</enum><header>Offsetting collections</header>
 <paragraph commented="no" id="H14ACC3B5C0BB4AAB8A5A4BD94EAB66FF"><enum>(1)</enum><header>In general</header><text>The sum appropriated in any fiscal year to carry out the activities described in subsection (a), to the extent and in the amounts provided for in advance in appropriations Acts, shall be derived from fees authorized by section 9.</text>
 </paragraph><paragraph id="HA0F9C82B09134A598DB64C494092663A"><enum>(2)</enum><header>Deposit of collections</header><text>Amounts received from fees authorized by section 9 shall be deposited as an offsetting collection in, and credited to, the account through which funds are made available to carry out the activities described in subsection (a).</text>
 </paragraph><paragraph id="H3BD322769377464297A852E99496AF16"><enum>(3)</enum><header>Deposit of excess collections</header><text>Any fees collected in excess of the total amount of fees provided for in appropriations Acts for a fiscal year shall be deposited in the general fund of the Treasury of the United States for the sole purpose of deficit reduction.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="HD8FFF35B4F974438AA4CB87C0A459416"><enum>(b)</enum><header>Deposits of bidders To be deposited in Treasury</header><text display-inline="yes-display-inline">Section 309(j)(8)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)(C)</external-xref>) is amended—</text> <paragraph commented="no" id="H0DE429C04A564F9A96BBA72FB32B658F"><enum>(1)</enum><text>in the first sentence, by striking <quote>an interest bearing account</quote> and all that follows and inserting <quote>the Treasury.</quote>;</text>
 </paragraph><paragraph commented="no" id="H9D0C4BE3F6084274B2411079531170C4"><enum>(2)</enum><text>in clause (i)—</text> <subparagraph commented="no" id="H35C3A7924ECC434394A69D8FB99F9E0E"><enum>(A)</enum><text>by striking <quote>paid to the Treasury</quote> and inserting <quote>deposited in the general fund of the Treasury (where such deposits shall be used for the sole purpose of deficit reduction)</quote>; and</text>
 </subparagraph><subparagraph commented="no" id="HBF6F7C5BE0AD4DBE9268C08B313F0C87"><enum>(B)</enum><text>by striking the semicolon and inserting <quote>; and</quote>;</text> </subparagraph></paragraph><paragraph commented="no" id="H60173391B8B44A5487E16519ABC6249C"><enum>(3)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting <quote>, and payments representing the return of such deposits shall not be subject to administrative offset under section 3716(c) of title 31, United States Code.</quote>; and</text>
 </paragraph><paragraph commented="no" id="H34BF552BBCB34ACBB820795A1A361C53"><enum>(4)</enum><text>by striking clause (iii).</text> </paragraph></subsection><subsection id="H0C95337ECCB944CAA7A71A2B81500E84"><enum>(c)</enum><header>Elimination of duplicative authorization of appropriations</header> <paragraph id="H5CA6753EBBF1483590D65AC78A26EFDD"><enum>(1)</enum><header>In general</header><text>Section 710 of the Telecommunications Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/104">Public Law 104–104</external-xref>) is repealed.</text>
 </paragraph><paragraph id="H36CE5696001E4EBBB5CDC7FB54572FD0"><enum>(2)</enum><header>Conforming amendment</header><text>The table of contents in section 2 of such Act is amended by striking the item relating to section 710.</text>
 </paragraph></subsection><subsection commented="no" id="H7516ED9F6B2F4B1DA182F9000965B47C"><enum>(d)</enum><header>Transfer of funds</header><text display-inline="yes-display-inline">On the effective date described in section 103, any amounts in the account providing appropriations to carry out the functions of the Commission that were collected in excess of the amounts provided for in appropriations Acts in any fiscal year prior to such date shall be transferred to the general fund of the Treasury of the United States for the sole purpose of deficit reduction.</text>
				</subsection></section><section id="H089D49CFB7F9465C87E1B8D090751771"><enum>102.</enum><header>Application and regulatory fees</header>
 <subsection id="H85F9F3D877F04B87874946D6CCDA253A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 9 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/159">47 U.S.C. 159</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HB9DA924C0DB04E2682A8ACA7368C44B6" style="OLC"> <section id="H0722B7FC41604BB3B271A76E870DE5E4"><enum>9.</enum><header>Application and regulatory fees</header> <subsection id="H876A8BBF86A44C15BB22055C24BCE72D"><enum>(a)</enum><header>General authority</header><text>The Commission shall assess and collect application fees and regulatory fees to recover the costs of carrying out the activities described in section 6(a) only to the extent and in the amounts provided for in advance in appropriations Acts.</text>
							</subsection><subsection id="H36D2F874BBA247B2B45D558D1FC2471B"><enum>(b)</enum><header>Application fees</header>
 <paragraph id="HE4E35C5A5F16443B91D30E93AC9A0139"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall assess and collect application fees at such rates as the Commission shall establish in a schedule of application fees to recover the costs of the Commission to process applications.</text>
								</paragraph><paragraph id="HA0798540F03446C4BBBD382701D10B09"><enum>(2)</enum><header>Adjustment of schedule</header>
 <subparagraph id="H4BC2B0EC753545D8984D405748BE15EF"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In every even-numbered year, the Commission shall review the schedule of application fees established under this subsection and, except as provided in subparagraph (B), set a new amount for each fee in the schedule that is equal to the amount of the fee on the date when the fee was established or the date when the fee was last amended under paragraph (3), whichever is later—</text>
 <clause id="HA1B4BB0A37FD4DBA8A6C976EF4698A6D"><enum>(i)</enum><text>increased or decreased by the percentage change in the Consumer Price Index during the period beginning on such date and ending on the date of the review; and</text>
 </clause><clause id="H8455333A12934D62AFE9E3DB7FB90645"><enum>(ii)</enum><text>rounded to the nearest $5 increment.</text> </clause></subparagraph><subparagraph id="H4E3F019AF9174BA9BACB96E0408F760E"><enum>(B)</enum><header>Threshold for adjustment</header><text>The Commission may not adjust a fee under subparagraph (A) if—</text>
 <clause id="HC86C41AAEC394784ADA8B51041E1ADF3"><enum>(i)</enum><text>in the case of a fee the current amount of which is less than $200, the adjustment would result in a change in the current amount of less than $10; or</text>
 </clause><clause id="HE0F7C108377B49A7BAFE9DA9109FB46B"><enum>(ii)</enum><text>in the case of a fee the current amount of which is $200 or more, the adjustment would result in a change in the current amount of less than 5 percent.</text>
 </clause></subparagraph><subparagraph id="HB156F65146204B0B90F9A4615F8E18C8"><enum>(C)</enum><header>Current amount defined</header><text>In subparagraph (B), the term <quote>current amount</quote> means, with respect to a fee, the amount of the fee on the date when the fee was established, the date when the fee was last adjusted under subparagraph (A), or the date when the fee was last amended under paragraph (3), whichever is latest.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HD8B8488C21F2417B869496D691F9CF4B"><enum>(3)</enum><header>Amendments</header><text>In addition to the adjustments required by paragraph (2), the Commission shall by rule amend the schedule of application fees established under this subsection if the Commission determines that the schedule requires amendment so that such fees reflect increases or decreases in the costs of processing applications at the Commission and the consolidation or addition of new categories of applications.</text>
								</paragraph></subsection><subsection id="H6AA6E55BE5C24B1DB20AF41B9ED904BE"><enum>(c)</enum><header>Regulatory fees</header>
 <paragraph id="HB71F5278697A454F96B429AB094A8644"><enum>(1)</enum><header>In general</header><text>The Commission shall assess and collect regulatory fees at such rates as the Commission shall establish in a schedule of regulatory fees that will result in the collection, in each fiscal year, of an amount that can reasonably be expected to equal the difference between—</text>
 <subparagraph id="HD76E0A2290AB40E8A38D86E1557BDCA9"><enum>(A)</enum><text>the amounts described in subsection (a) with respect to such fiscal year; and</text> </subparagraph><subparagraph id="HCABAB9C0976F43E9B5A16B18567AD74F"><enum>(B)</enum><text>the amount of application fees reasonably expected to be collected in such fiscal year.</text>
									</subparagraph></paragraph><paragraph id="H1C1C82DC12464907934719E40A0C8042"><enum>(2)</enum><header>Adjustment of schedule</header>
 <subparagraph id="H0C7F1C88F17B4BCA89655BA6A7CC4A63"><enum>(A)</enum><header>In general</header><text>For each fiscal year, the Commission shall by rule adjust the schedule of regulatory fees established under this subsection to—</text>
 <clause id="HAF11F7F29AE74B81B46709B5A1768CB9"><enum>(i)</enum><text>reflect unexpected increases or decreases in the number of units subject to the payment of such fees; and</text>
 </clause><clause id="H9BE543E32D1C4FC5B07C886F9ED58CD4"><enum>(ii)</enum><text>result in the collection of the amount required by paragraph (1).</text> </clause></subparagraph><subparagraph id="H27D862EE34824D938057FDA865E4AD38"><enum>(B)</enum><header>Rounding</header><text display-inline="yes-display-inline">In making adjustments under this paragraph, the Commission may round fees to the nearest $5 increment.</text>
 </subparagraph></paragraph><paragraph id="H1A9739854D5F40088A210113C32F4DC0"><enum>(3)</enum><header>Amendments</header><text display-inline="yes-display-inline">In addition to the adjustments required by paragraph (2), the Commission shall by rule amend the schedule of regulatory fees established under this subsection if the Commission determines that the schedule requires amendment so that such fees reflect the full-time equivalent number of employees within the bureaus and offices of the Commission, adjusted to take into account factors that are reasonably related to the benefits provided to the payor of the fee by the Commission’s activities. In making an amendment under this paragraph, the Commission may not change the total amount of regulatory fees required by paragraph (1) to be collected in a fiscal year.</text>
 </paragraph></subsection><subsection id="H3BD81A1E4FD2487EADAB69CF8B63DAEB"><enum>(d)</enum><header>Judicial review prohibited</header><text>An adjustment or amendment to a schedule of fees under subsection (b) or (c) is not subject to judicial review.</text>
 </subsection><subsection id="H5869769EAC0C47928D2C7F3D38C78C90"><enum>(e)</enum><header>Notice to Congress</header><text>The Commission shall transmit to Congress notification—</text> <paragraph id="H2D233425F2F04728812F210A3E7DE165"><enum>(1)</enum><text>of any adjustment under subsection (b)(2) or (c)(2) immediately upon the adoption of such adjustment; and</text>
 </paragraph><paragraph id="HCC5D2EF8CFBF423B9B7D7DF510C5C782"><enum>(2)</enum><text>of any amendment under subsection (b)(3) or (c)(3) not later than 90 days before the effective date of such amendment.</text>
								</paragraph></subsection><subsection id="H9215B4D306834B029CB0D72375F874C5"><enum>(f)</enum><header>Enforcement</header>
 <paragraph id="H66DD4C9E66344A46A9A8065AA3ED20AB"><enum>(1)</enum><header>Penalties for late payment</header><text>The Commission shall by rule prescribe a penalty for late payment of fees under this section. Such penalty shall be 25 percent of the amount of the fee that was not paid in a timely manner.</text>
 </paragraph><paragraph id="HCCBFFA1C5DB94897B22ED257BC71FA32"><enum>(2)</enum><header>Interest on unpaid fees and penalties</header><text display-inline="yes-display-inline">The Commission shall charge interest, at a rate determined under section 3717 of title 31, United States Code, on a fee or penalty under this section that is not paid in a timely manner. Such section 3717 shall not otherwise apply with respect to a fee or penalty under this section.</text>
 </paragraph><paragraph id="H306CFDBF4A0B495F8A450CF633DAD7A5"><enum>(3)</enum><header>Dismissal of applications or filings</header><text>The Commission may dismiss any application or other filing for failure to pay in a timely manner any fee, interest, or penalty under this section.</text>
								</paragraph><paragraph id="H4351121F79604F67A29ACA2B25B21379"><enum>(4)</enum><header>Revocations</header>
 <subparagraph id="H4D58BDC2410841B7909DF289F00A81FB"><enum>(A)</enum><header>In general</header><text>In addition to or in lieu of the penalties and dismissals authorized by paragraphs (1) and (3), the Commission may revoke any instrument of authorization held by any licensee that has not paid in a timely manner a regulatory fee assessed under this section or any related interest or penalty.</text>
 </subparagraph><subparagraph id="HBB39D170417645AAA50DB2AF062BD185"><enum>(B)</enum><header>Notice</header><text>Revocation action may be taken by the Commission under this paragraph after notice of the Commission’s intent to take such action is sent to the licensee by registered mail, return receipt requested, at the licensee’s last known address. The notice shall provide the licensee at least 30 days to either pay the fee, interest, and any penalty or show cause why the fee, interest, or penalty does not apply to the licensee or should otherwise be waived or payment deferred.</text>
									</subparagraph><subparagraph id="H9D1EC2C8855742AA8506C303D568EF21"><enum>(C)</enum><header>Hearing</header>
 <clause id="H5B8A5852F46D476DA835FE4EE2604316"><enum>(i)</enum><header>Generally not required</header><text>A hearing is not required under this paragraph unless the licensee’s response presents a substantial and material question of fact.</text>
 </clause><clause id="HA75A1598DD874D65AC79428C0291FCD0"><enum>(ii)</enum><header>Evidence and burdens</header><text>In any case where a hearing is conducted under this paragraph, the hearing shall be based on written evidence only, and the burden of proceeding with the introduction of evidence and the burden of proof shall be on the licensee.</text>
 </clause><clause id="H78F64B38AAB1467E9C03931BA6CC978F"><enum>(iii)</enum><header>Costs</header><text>Unless the licensee substantially prevails in the hearing, the Commission may assess the licensee for the costs of such hearing.</text>
 </clause></subparagraph><subparagraph id="H19CD985A7354455E8DA2ECF1C46EF9A4"><enum>(D)</enum><header>Opportunity to pay prior to revocation</header><text>Any Commission order adopted under this paragraph shall determine the amount due, if any, and provide the licensee with at least 30 days to pay that amount or have its authorization revoked.</text>
 </subparagraph><subparagraph id="HE0A81708FDB24CE9A9FABAC20CDEA4DA"><enum>(E)</enum><header>Finality</header><text>No order of revocation under this paragraph shall become final until the licensee has exhausted its right to judicial review of such order under section 402(b)(5).</text>
 </subparagraph></paragraph></subsection><subsection id="HDAC270B948224DE69CBD6E4EBDCEEBAD"><enum>(g)</enum><header>Waiver, Reduction, and Deferment</header><text>The Commission may waive, reduce, or defer payment of a fee, interest charge, or penalty in any specific instance for good cause shown, if such action would promote the public interest.</text>
 </subsection><subsection id="HAE4C9268C2954FCD81889410D177DA45"><enum>(h)</enum><header>Payment rules</header><text display-inline="yes-display-inline">The Commission shall by rule permit payment—</text> <paragraph id="H5462D02BE9F84F2C8040994301888C77"><enum>(1)</enum><text>in the case of fees in large amounts, by installments; and</text>
 </paragraph><paragraph id="H18D8168FCE8E4893B3600B99CAE66EE3"><enum>(2)</enum><text>in the case of fees in small amounts, in advance for a number of years not to exceed the term of the license held by the payor.</text>
								</paragraph></subsection><subsection id="H07B7B9A648E94670AF4CBEE1103C2B8A"><enum>(i)</enum><header>Exceptions</header>
								<paragraph id="HA1D8ABE79FE8414C8D36490DD96815F0"><enum>(1)</enum><header>Parties to which fees are not applicable</header>
 <subparagraph id="H9599008910B34AF4BD3E9C135E9C8217"><enum>(A)</enum><header>Application fees</header><text display-inline="yes-display-inline">The application fees established under this section shall not be applicable to—</text> <clause id="HB71D2783E32F48A487B27B7684A6A64D"><enum>(i)</enum><text>a governmental entity; or</text>
 </clause><clause id="H0CF507E03BC64469A2AA865711252B47"><enum>(ii)</enum><text>a nonprofit entity licensed in the Local Government, Police, Fire, Highway Maintenance, Forestry-Conservation, Public Safety, or Special Emergency Radio service.</text>
 </clause></subparagraph><subparagraph id="H537B95E089CE411598467F55182DE478"><enum>(B)</enum><header>Regulatory fees</header><text display-inline="yes-display-inline">The regulatory fees established under this section shall not be applicable to—</text> <clause id="H0F03505801204C7FB5862F635177E519"><enum>(i)</enum><text>a governmental entity or nonprofit entity; or</text>
 </clause><clause id="HCD891C60A751451DA0C7D1AFD2B8C6A9"><enum>(ii)</enum><text>an amateur radio operator licensee under part 97 of the Commission’s rules (47 C.F.R. part 97).</text> </clause></subparagraph></paragraph><paragraph commented="no" id="HF95A0EB54544488C99E48FFB8C0CC021"><enum>(2)</enum><header>Cost of collection</header> <subparagraph commented="no" id="H330D32C26F18413CA9D00F0A625E954B"><enum>(A)</enum><header>Application fees</header><text display-inline="yes-display-inline">If, in the judgment of the Commission, the cost of collecting an application fee established under this section would exceed the amount collected, the Commission may by rule eliminate such fee.</text>
 </subparagraph><subparagraph commented="no" id="H3047C90212B94876AB09BCBFCB837064"><enum>(B)</enum><header>Regulatory fees</header><text>If, in the judgment of the Commission, the cost of collecting a regulatory fee established under this section from a party would exceed the amount collected from such party, the Commission may exempt such party from paying such fee.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="HCEB070754CC74AD690768DFCEEC18B4C"><enum>(j)</enum><header>Accounting System</header><text>The Commission shall develop accounting systems necessary to make the amendments authorized by subsections (b)(3) and (c)(3).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H782BAA3731B4440DBE19FEAEDBCB0A4C"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">The Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.) is amended—</text> <paragraph id="H2B7474545ACE4F5DB86F9BD2092A8D31"><enum>(1)</enum><text>by repealing section 8; and</text>
 </paragraph><paragraph commented="no" id="H8AE5253310F94B3292A96272EE46D296"><enum>(2)</enum><text>in section 309(j)(6)(H), by striking <quote>charges imposed pursuant to section 8 of this Act</quote> and inserting <quote>application fees assessed under section 9</quote>.</text> </paragraph></subsection><subsection commented="no" id="H382EF5847A5C4CFD9BAA5D0EC581970C"><enum>(c)</enum><header>Transitional rules</header> <paragraph commented="no" id="H102C30BC87BB49858802B12FE50980CE"><enum>(1)</enum><header>Application fees</header><text display-inline="yes-display-inline">An application fee established under section 8 of the Communications Act of 1934, as such section is in effect on the day before the effective date described in section 103 of this Act, shall remain in effect under subsection (b) of section 9 of the Communications Act of 1934, as amended by subsection (a) of this section, until such time as the Commission adjusts or amends such fee under subsection (b)(2) or (b)(3) of such section 9, as so amended.</text>
 </paragraph><paragraph commented="no" id="H1393AD07EA144664944044A8FA066C1A"><enum>(2)</enum><header>Regulatory fees</header><text display-inline="yes-display-inline">A regulatory fee established under section 9 of the Communications Act of 1934, as such section is in effect on the day before the effective date described in section 103 of this Act, shall remain in effect under subsection (c) of section 9 of the Communications Act of 1934, as amended by subsection (a) of this section, until such time as the Commission adjusts or amends such fee under subsection (c)(2) or (c)(3) of such section 9, as so amended.</text>
					</paragraph></subsection><subsection id="H8B7B3968EC04411DB7E233E2280F7351"><enum>(d)</enum><header>Rulemaking To amend schedule of regulatory fees</header>
 <paragraph id="H35096917016949C3814EC5941210AA99"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the effective date described in section 103, the Commission shall complete a rulemaking proceeding under subsection (c)(3) of section 9 of the Communications Act of 1934, as amended by subsection (a) of this section.</text>
 </paragraph><paragraph id="HFAFD98DCB10C465887F42B6BA7C06B24"><enum>(2)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">If the Commission has not completed the rulemaking proceeding required by paragraph (1) by the date that is 6 months after the effective date described in section 103, the Commission shall submit to Congress a report on the progress of such rulemaking proceeding.</text>
 </paragraph></subsection></section><section id="H04E4C12AA3AA45D09B052E02692EF6A8"><enum>103.</enum><header>Effective date</header><text display-inline="no-display-inline">This title and the amendments made by this title shall take effect on October 1, 2018.</text> </section></title><title id="H99DBB7C5BE84431C80CE635A4049350D"><enum>II</enum><header>FCC Process Reform</header> <section id="H1705D54F65D3475DB863B550DFA95C23"><enum>201.</enum><header>FCC process reform</header> <subsection id="HC5DE158671924E1AA79353DA101FD492"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title I of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB344B7557B9F4CA4B974654584D18B10" style="OLC">
						<section id="H46F8286514A0415AA73F8177A479B4FA"><enum>13.</enum><header>Transparency and efficiency</header>
							<subsection id="H60F066A5742C43E9B3AB1BBEDD40E937"><enum>(a)</enum><header>Initial rulemaking and inquiry</header>
 <paragraph id="HBDB29244F6AD4C1FA5FF492F8C23943D"><enum>(1)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Commission shall complete a rulemaking proceeding and adopt procedural changes to its rules to maximize opportunities for public participation and efficient decisionmaking.</text>
 </paragraph><paragraph id="HDBB8D76C115643ADAAC0012A8515D0E3"><enum>(2)</enum><header>Requirements for rulemaking</header><text display-inline="yes-display-inline">The rules adopted under paragraph (1) shall—</text> <subparagraph id="H5169D0BA359945018DBEE1498E57D08D"><enum>(A)</enum><text display-inline="yes-display-inline">set minimum comment periods for comment and reply comment, subject to a determination by the Commission that good cause exists for departing from such minimum comment periods, for—</text>
 <clause commented="no" id="HC78A5AEF73554597913313E8E058FB35"><enum>(i)</enum><text display-inline="yes-display-inline">significant regulatory actions, as defined in Executive Order No. 12866; and</text> </clause><clause commented="no" id="H1DC3F4CBC8BE42179AE90577C2E0E1A9"><enum>(ii)</enum><text>all other rulemaking proceedings;</text>
 </clause></subparagraph><subparagraph id="H113973D5B06049ED831BFCCBFAC58D61"><enum>(B)</enum><text display-inline="yes-display-inline">establish policies concerning the submission of extensive new comments, data, or reports towards the end of the comment period;</text>
 </subparagraph><subparagraph id="H8FDBE2E56C994628AFD100692E8DEA58"><enum>(C)</enum><text display-inline="yes-display-inline">establish policies regarding treatment of comments, ex parte communications, and data or reports (including statistical reports and reports to Congress) submitted after the comment period to ensure that the public has adequate notice of and opportunity to respond to such submissions before the Commission relies on such submissions in any order, decision, report, or action;</text>
 </subparagraph><subparagraph id="HE8E2F06C5ED246C989C37A37F08C3260"><enum>(D)</enum><text display-inline="yes-display-inline">establish procedures for, not later than 14 days after the end of each quarter of a calendar year (or more frequently, as the Commission considers appropriate), publishing on the Internet website of the Commission and submitting to Congress a report that contains—</text>
 <clause id="H8679A94A72AD489C8BD673BD99724841"><enum>(i)</enum><text>the status of open rulemaking proceedings and proposed orders, decisions, reports, or actions on circulation for review by the Commissioners, including which Commissioners have not cast a vote on an order, decision, report, or action that has been on circulation for more than 60 days;</text>
 </clause><clause id="H37B025D6F3E24FBE83C6782390DE05B2"><enum>(ii)</enum><text display-inline="yes-display-inline">for the petitions, applications, complaints, and other requests for action by the Commission that were pending at the Commission on the last day of such quarter (or more frequent period, as the case may be)—</text>
 <subclause id="H0270D7F906DC4E0AA43618454F2E7012"><enum>(I)</enum><text>the number of such requests, broken down by the bureau primarily responsible for action and, for each bureau, the type of request (such as a petition, application, or complaint); and</text>
 </subclause><subclause id="H37C231E910014C6B9474A66A811BAD14"><enum>(II)</enum><text>information regarding the amount of time for which such requests have been pending, broken down as described in subclause (I); and</text>
 </subclause></clause><clause id="H81762B99885C403988337B2DA1CF867F"><enum>(iii)</enum><text display-inline="yes-display-inline">a list of the congressional investigations of the Commission that were pending on the last day of such quarter (or more frequent period, as the case may be) and the cost of such investigations, individually and in the aggregate;</text>
 </clause></subparagraph><subparagraph id="HF3CAC80A63F84BD0A8063F4EEDEEF12C"><enum>(E)</enum><text display-inline="yes-display-inline">establish deadlines (relative to the date of filing) for—</text> <clause id="HBD642C563F4B4D3C89499A948CE11D48"><enum>(i)</enum><text>in the case of a petition for a declaratory ruling under section 1.2 of title 47, Code of Federal Regulations, issuing a public notice of such petition;</text>
 </clause><clause id="H78BCE2597DDF4A2FAA69B64E512C0D28"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a petition for rulemaking under section 1.401 of such title, issuing a public notice of such petition; and</text>
 </clause><clause id="H0A056F31601B4A259913C99A70DC048B"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of a petition for reconsideration under section 1.106 or 1.429 of such title or an application for review under section 1.115 of such title, issuing a public notice of a decision on the petition or application by the Commission or under delegated authority (as the case may be);</text>
 </clause></subparagraph><subparagraph id="H2C5B465E0A4A42CA80EE99E90D9F233C"><enum>(F)</enum><text>establish guidelines (relative to the date of filing) for the disposition of petitions filed under section 1.2 of such title;</text>
 </subparagraph><subparagraph id="H697060F79D66402D9318D7F42BD50EB3"><enum>(G)</enum><text display-inline="yes-display-inline">establish procedures for the inclusion of the specific language of the proposed rule or the proposed amendment of an existing rule in a notice of proposed rulemaking; and</text>
 </subparagraph><subparagraph id="HDB6A14F6360F4679803A96865F0FB0B1"><enum>(H)</enum><text display-inline="yes-display-inline">require notices of proposed rulemaking and orders adopting a rule or amending an existing rule that—</text>
 <clause id="HCBBE1C778D2F42249506C03CAE865288"><enum>(i)</enum><text>create (or propose to create) a program activity to contain performance measures for evaluating the effectiveness of the program activity; and</text>
 </clause><clause id="H93B67700657A4CFEAA03412136FBB3F3"><enum>(ii)</enum><text display-inline="yes-display-inline">substantially change (or propose to substantially change) a program activity to contain—</text> <subclause id="H857FAB8BC3124284A6AA05B9786C9CC2"><enum>(I)</enum><text>performance measures for evaluating the effectiveness of the program activity as changed (or proposed to be changed); or</text>
 </subclause><subclause id="H5B32F73E440443E9BA802D95761AAD8E"><enum>(II)</enum><text>a finding that existing performance measures will effectively evaluate the program activity as changed (or proposed to be changed).</text>
 </subclause></clause></subparagraph></paragraph><paragraph id="H0B80204BBBE4423BB64DE6942B03E119"><enum>(3)</enum><header>Inquiry</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Commission shall complete an inquiry to seek public comment on whether and how the Commission should—</text>
 <subparagraph id="H894080803CCA4982969F48E2702FCE11"><enum>(A)</enum><text display-inline="yes-display-inline">establish procedures for allowing a bipartisan majority of Commissioners to place an order, decision, report, or action on the agenda of an open meeting;</text>
 </subparagraph><subparagraph id="HC4411C7AB47C468DB8D34265C16FAF57"><enum>(B)</enum><text display-inline="yes-display-inline">establish procedures for informing all Commissioners of a reasonable number of options available to the Commission for resolving a petition, complaint, application, rulemaking, or other proceeding;</text>
 </subparagraph><subparagraph id="HE9AC50FFC0FE4841B4C1363FA7760A21"><enum>(C)</enum><text display-inline="yes-display-inline">establish procedures for ensuring that all Commissioners have adequate time, prior to being required to decide a petition, complaint, application, rulemaking, or other proceeding (including at a meeting held pursuant to section 5(d)), to review the proposed Commission decision document, including the specific language of any proposed rule or any proposed amendment of an existing rule;</text>
 </subparagraph><subparagraph id="H9BEAA4272A8E4CF48DE064365DECB15B"><enum>(D)</enum><text display-inline="yes-display-inline">establish procedures for publishing the text of agenda items to be voted on at an open meeting in advance of such meeting so that the public has the opportunity to read the text before a vote is taken;</text>
 </subparagraph><subparagraph id="H85C97EC7084C454287E61E0D05448A14"><enum>(E)</enum><text display-inline="yes-display-inline">establish deadlines (relative to the date of filing) for disposition of applications for a license under section 1.913 of title 47, Code of Federal Regulations;</text>
 </subparagraph><subparagraph id="HA094F243B54C4B1DB79595CCDB9C53BF"><enum>(F)</enum><text>assign resources needed in order to meet the deadlines described in subparagraph (E), including whether the Commission’s ability to meet such deadlines would be enhanced by assessing a fee from applicants for such a license; and</text>
 </subparagraph><subparagraph commented="no" id="H9865156C41634D7B83B79793E61A7C01"><enum>(G)</enum><text display-inline="yes-display-inline">except as otherwise provided in section 4(o), publish each order, decision, report, or action not later than 30 days after the date of the adoption of such order, decision, report, or action.</text>
 </subparagraph></paragraph><paragraph id="H6CDAAE9C924A49068BBBD9210C297C5F"><enum>(4)</enum><header>Data for performance measures</header><text>The Commission shall develop a performance measure or proposed performance measure required by this subsection to rely, where possible, on data already collected by the Commission.</text>
 </paragraph><paragraph id="H8CF759C9470341EC8A0443C3F083B70C"><enum>(5)</enum><header>GAO audit</header><text display-inline="yes-display-inline">Not less frequently than every 6 months, the Comptroller General of the United States shall audit the cost estimates provided by the Commission under paragraph (2)(D)(iii) during the preceding 6-month period.</text>
 </paragraph></subsection><subsection id="H7F729C6B3B444C3DA4F7C00B55655AB3"><enum>(b)</enum><header>Periodic review</header><text display-inline="yes-display-inline">On the date that is 5 years after the completion of the rulemaking proceeding under subsection (a)(1), and every 5 years thereafter, the Commission shall initiate a new rulemaking proceeding to continue to consider such procedural changes to its rules as may be in the public interest to maximize opportunities for public participation and efficient decisionmaking.</text>
							</subsection><subsection id="HB30FCA2E2EC94CB18C8B7047CDFD0116"><enum>(c)</enum><header>Nonpublic collaborative discussions</header>
 <paragraph id="H61D2833634A648259831CED0F0998AD0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 552b of title 5, United States Code, a bipartisan majority of Commissioners may hold a meeting that is closed to the public to discuss official business if—</text>
 <subparagraph id="HCFE0E3A223514734840F0D7EAE303BF4"><enum>(A)</enum><text>a vote or any other agency action is not taken at such meeting;</text> </subparagraph><subparagraph id="HC48CF23B53FD41F5B77ECFB116CDA8F4"><enum>(B)</enum><text display-inline="yes-display-inline">each person present at such meeting is a Commissioner, an employee of the Commission, a member of a joint board or conference established under section 410, or a person on the staff of such a joint board or conference or of a member of such a joint board or conference; and</text>
 </subparagraph><subparagraph id="H16AB848211E04B8D833B94B39623F5C8"><enum>(C)</enum><text>an attorney from the Office of General Counsel of the Commission is present at such meeting.</text> </subparagraph></paragraph><paragraph id="H909DD3E145C541F789F72DCB7B0C43AD"><enum>(2)</enum><header>Disclosure of nonpublic collaborative discussions</header><text>Not later than 2 business days after the conclusion of a meeting held under paragraph (1), the Commission shall publish a disclosure of such meeting, including—</text>
 <subparagraph id="HDB921005506F4A38AD970C6A126034E3"><enum>(A)</enum><text>a list of the persons who attended such meeting; and</text> </subparagraph><subparagraph id="H34153CD541A94E1599D10F17E7F1AD67"><enum>(B)</enum><text>a summary of the matters discussed at such meeting, except for such matters as the Commission determines may be withheld under section 552b(c) of title 5, United States Code.</text>
 </subparagraph></paragraph><paragraph id="H8D2F5ECB739B47668B2344DF54D8DA33"><enum>(3)</enum><header>Preservation of open meetings requirements for agency action</header><text display-inline="yes-display-inline">Nothing in this subsection shall limit the applicability of section 552b of title 5, United States Code, with respect to a meeting of Commissioners other than that described in paragraph (1).</text>
 </paragraph></subsection><subsection id="HF597EF8082C740058B1079CE537B1281"><enum>(d)</enum><header>Access to certain information on Commission’s website</header><text display-inline="yes-display-inline">The Commission shall provide direct access from the homepage of its website to—</text> <paragraph id="HE834FA48EE86407EBD7A65A444108B59"><enum>(1)</enum><text>detailed information regarding—</text>
 <subparagraph id="H6656AC323C8B4852B64D3D540B3045ED"><enum>(A)</enum><text>the budget of the Commission for the current fiscal year;</text> </subparagraph><subparagraph id="HDDB4A8E28A304AD39E599B28569DE08A"><enum>(B)</enum><text>the appropriations for the Commission for such fiscal year; and</text>
 </subparagraph><subparagraph id="H25C862EE5A5546BF96C82FAB132709E7"><enum>(C)</enum><text display-inline="yes-display-inline">the total number of full-time equivalent employees of the Commission; and</text> </subparagraph></paragraph><paragraph id="HE2902E3B606C4825A8F690FB794BC80F"><enum>(2)</enum><text>the performance plan most recently made available by the Commission under section 1115(b) of title 31, United States Code.</text>
 </paragraph></subsection><subsection id="H71621931C6F848C0830FA9C3D5C9FC24"><enum>(e)</enum><header>Internet publication of certain FCC policies and procedures</header><text display-inline="yes-display-inline">The chairman of the Commission shall—</text> <paragraph id="HC76B491AA71D4422895F0E12734C0F88"><enum>(1)</enum><text>publish on the Internet website of the Commission any policies or procedures of the Commission that—</text>
 <subparagraph id="H0BBB047EB6A64C448EEA19AA210B52DF"><enum>(A)</enum><text>are established by the chairman; and</text> </subparagraph><subparagraph id="HAC8447A9C6504C3DB4905D7BADDE5E6E"><enum>(B)</enum><text>relate to the functioning of the Commission or the handling of the agenda of the Commission; and</text>
 </subparagraph></paragraph><paragraph id="H98271A6F259F48E283A663579120F2CC"><enum>(2)</enum><text>update such publication not later than 48 hours after the chairman makes changes to any such policies or procedures.</text>
								</paragraph></subsection><subsection id="HBB146592B9F24FECBBF4B3F4146AE20A"><enum>(f)</enum><header>Federal Register publication</header>
 <paragraph id="HC658B829B28443149063F667E3B64FF1"><enum>(1)</enum><header>In general</header><text>In the case of any document adopted by the Commission that the Commission is required, under any provision of law, to publish in the Federal Register, the Commission shall, not later than the date described in paragraph (2), complete all Commission actions necessary for such document to be so published.</text>
 </paragraph><paragraph id="HEE2FA80D4C924316B2D88BD7FA3B69F7"><enum>(2)</enum><header>Date described</header><text>The date described in this paragraph is the earlier of—</text> <subparagraph id="HF612913E2E9A40DB84082669B8686B1B"><enum>(A)</enum><text display-inline="yes-display-inline">the day that is 45 days after the date of the release of the document; or</text>
 </subparagraph><subparagraph id="H8CD917A21DD045489729F4944B4D5C26"><enum>(B)</enum><text>the day by which such actions must be completed to comply with any deadline under any other provision of law.</text>
 </subparagraph></paragraph><paragraph id="H24D7BAEC68A042E199E627F5B2F7212E"><enum>(3)</enum><header>No effect on deadlines for publication in other form</header><text display-inline="yes-display-inline">In the case of a deadline that does not specify that the form of publication is publication in the Federal Register, the Commission may comply with such deadline by publishing the document in another form. Such other form of publication does not relieve the Commission of any Federal Register publication requirement applicable to such document, including the requirement of paragraph (1).</text>
								</paragraph></subsection><subsection id="H709BE1FDE30545A79DA943C89275ABAC"><enum>(g)</enum><header>Consumer complaint database</header>
 <paragraph id="H27B44AE9C20A46539CA3A466943E2A78"><enum>(1)</enum><header>In general</header><text>In evaluating and processing consumer complaints, the Commission shall present information about such complaints in a publicly available, searchable database on its website that—</text>
 <subparagraph id="H5878C501D83344ADA7090DABBA314128"><enum>(A)</enum><text>facilitates easy use by consumers; and</text> </subparagraph><subparagraph id="H900C7BA54E364F458FE15EBEB4BEB7D3"><enum>(B)</enum><text>to the extent practicable, is sortable and accessible by—</text>
 <clause id="H0E7FDAD971994CE28219E774EA1C213B"><enum>(i)</enum><text>the date of the filing of the complaint;</text> </clause><clause id="H4E8D59A794144054A80CD8E7662DAF25"><enum>(ii)</enum><text>the topic of the complaint;</text>
 </clause><clause id="H64239E6C6C1C4C6182C2E894DDBD2474"><enum>(iii)</enum><text>the party complained of; and</text> </clause><clause id="HDAE1075432444C0DB3E9C0EED65AB30F"><enum>(iv)</enum><text>other elements that the Commission considers in the public interest.</text>
 </clause></subparagraph></paragraph><paragraph id="H08A6DB44C741435B8A57E4E3BC0FA297"><enum>(2)</enum><header>Duplicative complaints</header><text>In the case of multiple complaints arising from the same alleged misconduct, the Commission shall be required to include only information concerning one such complaint in the database described in paragraph (1).</text>
								</paragraph></subsection><subsection id="H67C7F0986C9345CE81EDEFFFD60507EE"><enum>(h)</enum><header>Form of publication</header>
 <paragraph id="H5FDD99D4A14742598A111BE3B8D2D20E"><enum>(1)</enum><header>In general</header><text>In complying with a requirement of this section to publish a document, the Commission shall publish such document on its website, in addition to publishing such document in any other form that the Commission is required to use or is permitted to and chooses to use.</text>
 </paragraph><paragraph id="HDFB544423B104FBEBA8A88ED4608CCC6"><enum>(2)</enum><header>Exception</header><text>The Commission shall by rule establish procedures for redacting documents required to be published by this section so that the published versions of such documents do not contain—</text>
 <subparagraph id="H948E3A3BC1004A529985B4CE0A2E166C"><enum>(A)</enum><text>information the publication of which would be detrimental to national security, homeland security, law enforcement, or public safety; or</text>
 </subparagraph><subparagraph id="H5B933460A8BD407B9B25BC13C749319D"><enum>(B)</enum><text>information that is proprietary or confidential.</text> </subparagraph></paragraph></subsection><subsection id="H4EE56CD627A5446BACDE2CF7CC3EDAD7"><enum>(i)</enum><header>Transparency relating to performance in meeting FOIA requirements</header><text display-inline="yes-display-inline">The Commission shall take additional steps to inform the public about its performance and efficiency in meeting the disclosure and other requirements of section 552 of title 5, United States Code (commonly referred to as the Freedom of Information Act), including by doing the following:</text>
 <paragraph id="H61AD10865D3C4C75850B9DBA7115A2AA"><enum>(1)</enum><text display-inline="yes-display-inline">Publishing on the Commission’s website the Commission’s logs for tracking, responding to, and managing requests submitted under such section, including the Commission’s fee estimates, fee categories, and fee request determinations.</text>
 </paragraph><paragraph id="H0B2C02FD05BF4CA2A9D19A8575DA073D"><enum>(2)</enum><text display-inline="yes-display-inline">Releasing to the public all decisions made by the Commission (including decisions made by the Commission’s Bureaus and Offices) granting or denying requests filed under such section, including any such decisions pertaining to the estimate and application of fees assessed under such section.</text>
 </paragraph><paragraph id="H842E418A3ADC43B1A44CD61C074BB386"><enum>(3)</enum><text display-inline="yes-display-inline">Publishing on the Commission’s website electronic copies of documents released under such section.</text> </paragraph><paragraph id="H9ED0D2B33A7540EFAB0854748FD64759"><enum>(4)</enum><text display-inline="yes-display-inline">Presenting information about the Commission’s handling of requests under such section in the Commission’s annual budget estimates submitted to Congress and the Commission’s annual performance and financial reports. Such information shall include the number of requests under such section the Commission received in the most recent fiscal year, the number of such requests granted and denied, a comparison of the Commission’s processing of such requests over at least the previous 3 fiscal years, and a comparison of the Commission’s results with the most recent average for the United States Government as published on www.foia.gov.</text>
 </paragraph></subsection><subsection id="HBAE7CFE3893644E18AE8D8778E48A3E6"><enum>(j)</enum><header>Prompt release of statistical reports and reports to Congress</header><text display-inline="yes-display-inline">Not later than January 15th of each year, the Commission shall identify, catalog, and publish an anticipated release schedule for all statistical reports and reports to Congress that are regularly or intermittently released by the Commission and will be released during such year.</text>
							</subsection><subsection id="H79CB0BFB04FA48D88E2DD882E558B80D"><enum>(k)</enum><header>Annual scorecard reports</header>
 <paragraph id="H261506420BD2457789108EEF5416D94C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For the 1-year period beginning on January 1st of each year, the Commission shall prepare a report on the performance of the Commission in conducting its proceedings and meeting the deadlines established under subsection (a)(2)(E) and the guidelines established under subsection (a)(2)(F).</text>
 </paragraph><paragraph id="HD511535D097F4F479C00D2B8F8F217CB"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each report required by paragraph (1) shall contain detailed statistics on such performance, including, with respect to each Bureau of the Commission—</text>
 <subparagraph id="H30421733A30C4C0EAFC2ED8C7D8444D4"><enum>(A)</enum><text>with respect to each type of filing specified in subsection (a)(2)(E) or (a)(2)(F)—</text> <clause id="H7B2ECE377C444C00B51B9F06D3573E80"><enum>(i)</enum><text display-inline="yes-display-inline">the number of filings that were pending on the last day of the period covered by such report;</text>
 </clause><clause id="H72DBC072DF774D4D98A3DA7EB8E5CBFE"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of filings described in clause (i) for which each applicable deadline or guideline established under such subsection was not met and the average length of time such filings have been pending; and</text>
 </clause><clause id="HB4023D4653FE4ABEA9B0DABB7CF8B092"><enum>(iii)</enum><text display-inline="yes-display-inline">for filings that were resolved during such period, the average time between initiation and resolution and the percentage for which each applicable deadline or guideline established under such subsection was met;</text>
 </clause></subparagraph><subparagraph commented="no" id="H2F141FDB82C543B6AD33E6FF5FF14AA4"><enum>(B)</enum><text>with respect to proceedings before an administrative law judge—</text> <clause commented="no" id="H1042DF5455E04F4296ACCABB6014BDFD"><enum>(i)</enum><text>the number of such proceedings completed during such period; and</text>
 </clause><clause commented="no" id="H59FE9328799B4608AF4D22EE43C92C27"><enum>(ii)</enum><text>the number of such proceedings pending on the last day of such period; and</text> </clause></subparagraph><subparagraph id="H57D40C497ACB4793A1AFD7A76A0E3245"><enum>(C)</enum><text>the number of independent studies or analyses published by the Commission during such period.</text>
 </subparagraph></paragraph><paragraph id="H209691B098184BE5B3DE43B8C423143D"><enum>(3)</enum><header>Publication and submission</header><text display-inline="yes-display-inline">The Commission shall publish and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate each report required by paragraph (1) not later than the date that is 30 days after the last day of the period covered by such report.</text>
 </paragraph></subsection><subsection id="H98F1217430A942F9BB646288419F55C2"><enum>(l)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HD855F8A28D834E0793CD7F1D2BB29C48"><enum>(1)</enum><header>Amendment</header><text>The term <term>amendment</term> includes, when used with respect to an existing rule, the deletion of such rule.</text>
 </paragraph><paragraph id="HC21C3722717D4BCBBEA5947E97F8FBBF"><enum>(2)</enum><header>Bipartisan majority</header><text>The term <term>bipartisan majority</term> means, when used with respect to a group of Commissioners, that such group—</text> <subparagraph id="HB16028A45D7C4E9EA1E9C60D32A9FA08"><enum>(A)</enum><text>is a group of three or more Commissioners; and</text>
 </subparagraph><subparagraph id="H118397452A2C42B8ADC36C665475E4C4"><enum>(B)</enum><text>includes, for each political party of which any Commissioner is a member, at least one Commissioner who is a member of such political party, and, if any Commissioner has no political party affiliation, at least one unaffiliated Commissioner.</text>
 </subparagraph></paragraph><paragraph id="H8B321BCA489141EFAF38651C5BF2B9A3"><enum>(3)</enum><header>Performance measure</header><text display-inline="yes-display-inline">The term <term>performance measure</term> means an objective and quantifiable outcome measure or output measure (as such terms are defined in section 1115 of title 31, United States Code).</text>
 </paragraph><paragraph id="H367C10C8A2424FD59717B724EECFD14C"><enum>(4)</enum><header>Program activity</header><text>The term <term>program activity</term> has the meaning given such term in section 1115 of title 31, United States Code, except that such term also includes any annual collection or distribution or related series of collections or distributions by the Commission of an amount that is greater than or equal to $100,000,000.</text>
 </paragraph><paragraph id="H39C5108E5A0A40508C8D7A1A429540AD"><enum>(5)</enum><header>Other definitions</header><text>The terms <term>agency action</term>, <term>ex parte communication</term>, and <term>rule</term> have the meanings given such terms in section 551 of title 5, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection commented="no" id="H435BB934F36D4EA2911B1A060104F4FD"><enum>(b)</enum><header>Effective dates and implementing rules</header> <paragraph commented="no" id="H69E291F98D804711BB4F5C72695523C8"><enum>(1)</enum><header>Effective dates</header> <subparagraph id="H14428A08AB6C4EFE9EF550E0068FB0FC"><enum>(A)</enum><header>Nonpublic collaborative discussions</header><text>Subsection (c) of section 13 of the Communications Act of 1934, as added by subsection (a), shall apply beginning on the first date on which all of the procedural changes to the rules of the Commission required by subsection (a)(1) of such section have taken effect.</text>
 </subparagraph><subparagraph commented="no" id="H9454FDE47DFA45118352AEFD0C32FDD9"><enum>(B)</enum><header>Report release schedules</header><text>Subsection (j) of such section 13 shall apply with respect to 2018 and any year thereafter.</text> </subparagraph><subparagraph id="H85733E7597014E288F7E4B43B8765463"><enum>(C)</enum><header>Annual scorecard reports</header><text display-inline="yes-display-inline">Subsection (k) of such section 13 shall apply with respect to 2017 and any year thereafter.</text>
 </subparagraph><subparagraph id="HDD9114AF8B3A49E88A4656F0C0FC98DF"><enum>(D)</enum><header>Internet publication of certain FCC policies and procedures</header><text display-inline="yes-display-inline">Subsection (e) of such section 13 shall apply beginning on the date that is 30 days after the date of the enactment of this Act.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H5A9B1DD4146C47B7970C64FB3CFDFB1A"><enum>(2)</enum><header>Rules</header><text>Except as otherwise provided in such section 13, the Commission shall promulgate any rules necessary to carry out such section not later than 1 year after the date of the enactment of this Act.</text>
 </paragraph></subsection></section><section id="H4E743C692A8649C6A2F569F77009E714"><enum>202.</enum><header>Categorization of TCPA inquiries and complaints in quarterly report</header><text display-inline="no-display-inline">In compiling its quarterly report with respect to informal consumer inquiries and complaints, the Commission may not categorize an inquiry or complaint with respect to section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) as being a wireline inquiry or complaint or a wireless inquiry or complaint unless the party whose conduct is the subject of the inquiry or complaint is a wireline carrier or a wireless carrier, respectively.</text>
 </section><section id="HE4E37697B68F4EE6B7BB30BEDBA25D30"><enum>203.</enum><header>Effect on other laws</header><text display-inline="no-display-inline">Nothing in this title or the amendments made by this title shall relieve the Commission from any obligations under title 5, United States Code, except where otherwise expressly provided.</text>
 </section><section id="H0717510BFBAD45F48CB9BE9975E1D149"><enum>204.</enum><header>Application of Antideficiency Act to Universal Service Program</header><text display-inline="no-display-inline">Section 302 of <external-xref legal-doc="public-law" parsable-cite="pl/108/494">Public Law 108–494</external-xref> (118 Stat. 3998) is amended by striking <quote>December 31, 2018</quote> each place it appears and inserting <quote>December 31, 2021</quote>.</text> </section><section id="H114D5A0173AB42D5AAF708028D9454E2" section-type="subsequent-section"><enum>205.</enum><header>Report on improving small business participation in FCC proceedings</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Commission, in consultation with the Administrator of the Small Business Administration, shall submit to Congress a report on—</text>
 <paragraph id="H2EEEE15021074A4DB4F685C018D2C78F"><enum>(1)</enum><text>actions that the Commission will take to improve the participation of small businesses in the proceedings of the Commission; and</text>
 </paragraph><paragraph id="H6A1885E808FD456D80FE6ED2A88ED526"><enum>(2)</enum><text>recommendations for any legislation that the Commission considers appropriate to improve such participation.</text>
				</paragraph></section><section id="H49538F00460A4AF686227D8996B7337B" section-type="subsequent-section"><enum>206.</enum><header>Timely availability of items adopted by vote of the Commission</header>
 <subsection id="H7E535B9A286C47A68E8B87C72B05C5E8"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 4 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/154">47 U.S.C. 154</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HCA47D63EFC0844F49DEB3BA4E55D6EBE" style="OLC">
 <subsection id="H1DC8DE9824614772ABAB5F6B4187E2AE"><enum>(o)</enum><text display-inline="yes-display-inline">In the case of any item that is adopted by vote of the Commission, the Commission shall publish on the Internet website of the Commission the text of such item not later than 24 hours after the Secretary of the Commission has received dissenting statements from all Commissioners wishing to submit such a statement with respect to such item.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HE074573C1D6F4E35ABBFED99AE60CBDF"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply with respect to an item that is adopted after the date that is 30 days after the date of the enactment of this Act.</text>
				</subsection></section></title><title id="H8E4756C977B042B5926BDAD067F668CC"><enum>III</enum><header>Amateur Radio Parity</header>
 <section id="H9D8CB8332C2A4797AF19F878A6E8F3B5"><enum>301.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="HFC5D71D5B75342BCB8FC7DFE03B10016"><enum>(1)</enum><text display-inline="yes-display-inline">More than 730,000 radio amateurs in the United States are licensed by the Commission in the amateur radio services.</text>
 </paragraph><paragraph id="HE59A01305C624ED9AE3B162BA959BE0E"><enum>(2)</enum><text>Amateur radio, at no cost to taxpayers, provides a fertile ground for technical self-training in modern telecommunications, electronics technology, and emergency communications techniques and protocols.</text>
 </paragraph><paragraph id="H130D70F2A85046BE916AE73E535B2191"><enum>(3)</enum><text>There is a strong Federal interest in the effective performance of amateur stations established at the residences of licensees. Such stations have been shown to be frequently and increasingly precluded by unreasonable private land use restrictions, including restrictive covenants.</text>
 </paragraph><paragraph id="H91EE991F8FB94347B0878E537DE9E3A4"><enum>(4)</enum><text>Commission regulations have for three decades prohibited the application to stations in the amateur service of State and local regulations that preclude or fail to reasonably accommodate amateur service communications, or that do not constitute the minimum practicable regulation to accomplish a legitimate State or local purpose. Commission policy has been and is to require States and localities to permit erection of a station antenna structure at heights and dimensions sufficient to accommodate amateur service communications.</text>
 </paragraph><paragraph id="H87FDB986F5E6481B840FADE4ED5EDC2F"><enum>(5)</enum><text>The Commission has sought guidance and direction from Congress with respect to the application of the Commission’s limited preemption policy regarding amateur service communications to private land use restrictions, including restrictive covenants.</text>
 </paragraph><paragraph id="H62DC085F8C59499AA2D7B5B4E50F3BC8"><enum>(6)</enum><text>There are aesthetic and common property considerations that are uniquely applicable to private land use regulations and the community associations obligated to enforce covenants, conditions, and restrictions in deed-restricted communities. These considerations are dissimilar to those applicable to State law and local ordinances regulating the same residential amateur radio facilities.</text>
 </paragraph><paragraph id="H4EC95C77B4004AF4AEEFDB68A4516CC8"><enum>(7)</enum><text display-inline="yes-display-inline">In recognition of these considerations, a separate Federal policy than exists at section 97.15(b) of title 47, Code of Federal Regulations, is warranted concerning amateur service communications in deed-restricted communities.</text>
 </paragraph><paragraph id="H1DC48CF2376B40ABAAE0DA843AF58A72"><enum>(8)</enum><text>Community associations should fairly administer private land use regulations in the interest of their communities, while nevertheless permitting the installation and maintenance of effective outdoor amateur radio antennas. There exist antenna designs and installations that can be consistent with the aesthetics and physical characteristics of land and structures in community associations while accommodating communications in the amateur radio services.</text>
				</paragraph></section><section id="H66EC904935B641A3944E77D4F88A45FD"><enum>302.</enum><header>Application of private land use restrictions to amateur stations</header>
 <subsection id="H2A83B12AD53E44D2895E3A17C4A302E4"><enum>(a)</enum><header>Amendment of FCC rules</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Commission shall amend section 97.15 of title 47, Code of Federal Regulations, by adding a new paragraph that prohibits the application to amateur stations of any private land use restriction, including a restrictive covenant, that—</text>
 <paragraph id="H4C4CDA2BF1AE47C0B47F36097B5A72B8"><enum>(1)</enum><text>on its face or as applied, precludes communications in an amateur radio service;</text> </paragraph><paragraph id="H9D03CE161A90431F9658C57727208B0A"><enum>(2)</enum><text display-inline="yes-display-inline">fails to permit a licensee in an amateur radio service to install and maintain an effective outdoor antenna on property under the exclusive use or control of the licensee; or</text>
 </paragraph><paragraph id="H2D6B881AB36B46238F96571D146089D5"><enum>(3)</enum><text>does not constitute the minimum practicable restriction on such communications to accomplish the lawful purposes of a community association seeking to enforce such restriction.</text>
 </paragraph></subsection><subsection id="H5146DB4750AC475FB6B2ECF423FE7F8F"><enum>(b)</enum><header>Additional requirements</header><text>In amending its rules as required by subsection (a), the Commission shall—</text> <paragraph id="H09A8DC54F4F24447A8EB2185997FB936"><enum>(1)</enum><text display-inline="yes-display-inline">require any licensee in an amateur radio service to notify and obtain prior approval from a community association concerning installation of an outdoor antenna;</text>
 </paragraph><paragraph id="H71D8E8C2E8C645A5A231C3C5AF54839A"><enum>(2)</enum><text display-inline="yes-display-inline">permit a community association to prohibit installation of any antenna or antenna support structure by a licensee in an amateur radio service on common property not under the exclusive use or control of the licensee; and</text>
 </paragraph><paragraph id="HB08838240BC943DDA95796D87A4D2396"><enum>(3)</enum><text>subject to the standards specified in paragraphs (1) and (2) of subsection (a), permit a community association to establish reasonable written rules concerning height, location, size, and aesthetic impact of, and installation requirements for, outdoor antennas and support structures for the purpose of conducting communications in the amateur radio services.</text>
 </paragraph></subsection></section><section id="H2EE2D252E4CF4E27A2D957FDF3293C53"><enum>303.</enum><header>Affirmation of limited preemption of State and local land use regulation</header><text display-inline="no-display-inline">The Commission may not change section 97.15(b) of title 47, Code of Federal Regulations, which shall remain applicable to State and local land use regulation of amateur service communications.</text>
 </section><section id="H4341A8F4C1F94B3FBD64AFC33272F8C0"><enum>304.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H57D3888D8314462184DF48CA102BE7F9"><enum>(1)</enum><header>Community association</header><text display-inline="yes-display-inline">The term <quote>community association</quote> means any nonprofit mandatory membership organization composed of owners of real estate described in a declaration of covenants or created pursuant to a covenant or other applicable law with respect to which a person, by virtue of the person’s ownership of or interest in a unit or parcel, is obligated to pay for a share of real estate taxes, insurance premiums, maintenance, improvement, services, or other expenses related to common elements, other units, or any other real estate other than the unit or parcel described in the declaration.</text>
 </paragraph><paragraph id="H9A91DB3511CC4453B49E69000E8BBA91"><enum>(2)</enum><header>Terms defined in regulations</header><text display-inline="yes-display-inline">The terms <quote>amateur radio services</quote>, <quote>amateur service</quote>, and <quote>amateur station</quote> have the meanings given such terms in section 97.3 of title 47, Code of Federal Regulations.</text> </paragraph></section></title><title id="H705829D712584F13B33586151CECEC90"><enum>IV</enum><header>Securing Access to Networks in Disasters</header> <section id="H01F578E9063B4E4EA1CB1AD469D6DF0B"><enum>401.</enum><header>Study on network resiliency</header><text display-inline="no-display-inline">Not later than 36 months after the date of enactment of this Act, the Commission shall submit to Congress, and make publicly available on the Commission’s website, a study on the public safety benefits and technical feasibility and cost of—</text>
 <paragraph id="H351FE7282BD74C1495A95D4E59FEE684"><enum>(1)</enum><text>making telecommunications service provider-owned WiFi access points, and other communications technologies operating on unlicensed spectrum, available to the general public for access to 9–1–1 services, without requiring any login credentials, during times of emergency when mobile service is unavailable;</text>
 </paragraph><paragraph id="HFC853C58FDBF44DCA508ED032591182C"><enum>(2)</enum><text>the provision by non-telecommunications service provider-owned WiFi access points of public access to 9–1–1 services during times of emergency when mobile service is unavailable; and</text>
 </paragraph><paragraph id="H01166578FA2144E690D2F1E26F5213EB"><enum>(3)</enum><text>other alternative means of providing the public with access to 9–1–1 services during times of emergency when mobile service is unavailable.</text>
 </paragraph></section><section id="H0D1AE5AA4A984877BA57244037641C53"><enum>402.</enum><header>Access to essential service providers during federally declared emergencies</header><text display-inline="no-display-inline">Section 427(a)(1)(A) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5189e">42 U.S.C. 5189e(a)(1)(A)</external-xref>) is amended by striking <quote>telecommunications service</quote> and inserting <quote>wireline or mobile telephone service, Internet access service, radio or television broadcasting, cable service, or direct broadcast satellite service</quote>.</text>
 </section><section id="H2DE81D1B4A6C407CAFACDD10626C1206"><enum>403.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this title—</text> <paragraph id="H28FE6720EC1048F8BFE645E9148CC2C4"><enum>(1)</enum><text>the term <term>mobile service</term> means commercial mobile service (as defined in section 332 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332</external-xref>)) or commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>));</text>
 </paragraph><paragraph id="H5073AC1ECC1F4AEDAD7A7B1B37FDEE39"><enum>(2)</enum><text>the term <term>WiFi access point</term> means wireless Internet access using the standard designated as 802.11 or any variant thereof; and</text> </paragraph><paragraph id="H5E47A78B1C8647EFA0DF553A6EBE0CA4"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>times of emergency</term> means either an emergency as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>), or an emergency as declared by the governor of a State or territory of the United States.</text>
				</paragraph></section></title><title id="H7D8382AF1383434D916D5F97612BA277"><enum>V</enum><header>FCC Consolidated Reporting</header>
 <section id="HF9061948A61D4E94981AA132D3C72464" section-type="subsequent-section"><enum>501.</enum><header>Communications marketplace report</header><text display-inline="no-display-inline">Title I of the Communications Act of 1934, as amended by section 201(a), is further amended by adding at the end the following:</text>

					<section id="H9A0104F7BEA84B809559639878F10C2B"><enum>14.</enum><header>Communications marketplace report</header>
 <subsection id="H1499A22259F048F9BE2CEFD5EEFBD1D2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the last quarter of every even-numbered year, the Commission shall publish on its website and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the state of the communications marketplace.</text>
 </subsection><subsection id="HC0A50E08FF094700AEE2AA56CA329B12"><enum>(b)</enum><header>Contents</header><text>Each report required by subsection (a) shall—</text> <paragraph id="H25BB185EB2434799BECCF6D8C50A9E1E"><enum>(1)</enum><text display-inline="yes-display-inline">assess the state of competition in the communications marketplace, including competition to deliver voice, video, audio, and data services among providers of telecommunications, providers of commercial mobile service (as defined in section 332), multichannel video programming distributors (as defined in section 602), broadcast stations, providers of satellite communications, Internet service providers, and other providers of communications services;</text>
 </paragraph><paragraph id="H9DCB7EA6A1984552ADB3C7DC19EB518F"><enum>(2)</enum><text display-inline="yes-display-inline">assess the state of deployment of communications capabilities, including advanced telecommunications capability (as defined in section 706 of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/1302">47 U.S.C. 1302</external-xref>)), regardless of the technology used for such deployment, including whether advanced telecommunications capability is being deployed to all Americans in a reasonable and timely fashion;</text>
 </paragraph><paragraph id="H5C0D7639E2CE4F61BCF565E3DCD2AED3"><enum>(3)</enum><text display-inline="yes-display-inline">assess whether laws, regulations, or regulatory practices (whether those of the Federal Government, States, political subdivisions of States, Indian tribes or tribal organizations (as such terms are defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)), or foreign governments) pose a barrier to competitive entry into the communications marketplace or to the competitive expansion of existing providers of communications services;</text>
 </paragraph><paragraph id="H54CA74F7F23E4BFCA25BA7BA384CAD2A"><enum>(4)</enum><text display-inline="yes-display-inline">describe the agenda of the Commission for the next 2-year period for addressing the challenges and opportunities in the communications marketplace that were identified through the assessments under paragraphs (1) through (3); and</text>
 </paragraph><paragraph id="H8F470BB62115412AB30DBF1D57E1D46F"><enum>(5)</enum><text display-inline="yes-display-inline">describe the actions that the Commission has taken in pursuit of the agenda described pursuant to paragraph (4) in the previous report submitted under this section.</text>
 </paragraph></subsection><subsection id="HBFA474EA6C4E43B39D3B22D50884852A"><enum>(c)</enum><header>Extension</header><text display-inline="yes-display-inline">If the President designates a Commissioner as Chairman of the Commission during the last quarter of an even-numbered year, the portion of the report required by subsection (b)(4) may be published on the website of the Commission and submitted to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate as an addendum during the first quarter of the following odd-numbered year.</text>
						</subsection><subsection id="H89311128771C4A6E88B60496C1C64E0E"><enum>(d)</enum><header>Special requirements</header>
 <paragraph id="HF75663A7DA4C4540B7941E0CC8BF628F"><enum>(1)</enum><header>Assessing competition</header><text display-inline="yes-display-inline">In assessing the state of competition under subsection (b)(1), the Commission shall consider all forms of competition, including the effect of intermodal competition, facilities-based competition, and competition from new and emergent communications services, including the provision of content and communications using the Internet.</text>
 </paragraph><paragraph id="H97637001E7924D8791A72DB1077A45A1"><enum>(2)</enum><header>Assessing deployment</header><text display-inline="yes-display-inline">In assessing the state of deployment under subsection (b)(2), the Commission shall compile a list of geographical areas that are not served by any provider of advanced telecommunications capability.</text>
 </paragraph><paragraph id="HB27BE1D7BED14A028D014B6F019B104E"><enum>(3)</enum><header>International comparisons and demographic information</header><text display-inline="yes-display-inline">The Commission may use readily available data to draw appropriate comparisons between the United States communications marketplace and the international communications marketplace and to correlate its assessments with demographic information.</text>
 </paragraph><paragraph id="HDD7D68E3D4BA4703ADE13292457027B4"><enum>(4)</enum><header>Considering small businesses</header><text display-inline="yes-display-inline">In assessing the state of competition under subsection (b)(1) and regulatory barriers under subsection (b)(3), the Commission shall consider market entry barriers for entrepreneurs and other small businesses in the communications marketplace in accordance with the national policy under section 257(b).</text>
 </paragraph><paragraph id="H4F7540101B9B4927A9ADDA0540BED374"><enum>(5)</enum><header>Considering cable rates</header><text display-inline="yes-display-inline">In assessing the state of competition under subsection (b)(1), the Commission shall include in each report required by subsection (a) the aggregate average total amount paid by cable systems in compensation under section 325 during the period covered by such report.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H46AB6F8B93A8477D8DCC9BB302C3287E"><enum>502.</enum><header>Consolidation of redundant reports; conforming amendments</header>
 <subsection id="H214F2540A8554726A4E920D6FDEF0262"><enum>(a)</enum><header>ORBIT Act Report</header><text display-inline="yes-display-inline">Section 646 of the Communications Satellite Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/47/765e">47 U.S.C. 765e</external-xref>; 114 Stat. 57) is repealed.</text> </subsection><subsection id="H256996D77D1E4C4FB47C03ABE592E7E5"><enum>(b)</enum><header>Satellite Competition Report</header><text display-inline="yes-display-inline">Section 4 of <external-xref legal-doc="public-law" parsable-cite="pl/109/34">Public Law 109–34</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/47/703">47 U.S.C. 703</external-xref>) is repealed.</text>

 <subsection id="H1A7BA7A6B76E4B4E8DC5E8E6177533A2"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">The Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text> <paragraph id="H0808F8CFBEB9469680899B888E892386"><enum>(1)</enum><text>in section 8G(a)(2), by striking <quote>the Federal Communications Commission,</quote>; and</text>

App.)—</text>
 <paragraph id="HF9A28E785D724194833AA1C15ABD52F7"><enum>(1)</enum><text>may continue so serving until the President makes an appointment under section 3(a) of such Act with respect to the Commission consistent with the amendments made by subsection (a); and</text>
 </paragraph><paragraph id="HD3DEE28214BA417FB696D2769DFCA28E"><enum>(2)</enum><text>shall, while serving under paragraph (1), remain subject to the provisions of section 8G of such Act which, immediately before the date of the enactment of this Act, applied with respect to the Inspector General of the Commission and suffer no reduction in pay.</text>
					</paragraph></subsection></section><section id="H24E02BBFA0474911A73146AA567EF9AA"><enum>602.</enum><header>Authority of Chief Information Officer</header>
 <subsection id="HB66D085E4467464482F382FD09F80795"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall ensure that the Chief Information Officer of the Commission has a significant role in—</text>
 <paragraph id="HBE2D02517AE541358FD801CCB6FAA2C4"><enum>(1)</enum><text>the decision-making process for annual and multi-year planning, programming, budgeting, and execution decisions, related reporting requirements, and reports related to information technology;</text>
 </paragraph><paragraph id="H0441C2DFA2FC45B3BEDEA89C60068858"><enum>(2)</enum><text>the management, governance, and oversight processes related to information technology; and</text> </paragraph><paragraph id="H29B5BAA51BE0468CB8005C40F48856E3"><enum>(3)</enum><text>the hiring of personnel with information technology responsibilities.</text>
 </paragraph></subsection><subsection id="H9F4DA484FEBA4EC1B0962E342CF6E5F6"><enum>(b)</enum><header>CIO approval</header><text display-inline="yes-display-inline">The Chief Information Officer of the Commission, in consultation with the Chief Financial Officer of the Commission and budget officials, shall specify and approve the allocation of amounts appropriated to the Commission for information technology, consistent with the provisions of appropriations Acts, budget guidelines, and recommendations from the Director of the Office of Management and Budget.</text>
 </subsection></section><section id="H4FB4DCA79E7F48419390573B75F3BBEC" section-type="subsequent-section"><enum>603.</enum><header>Ensuring the integrity of voice communications</header><text display-inline="no-display-inline">Part II of title II of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/251">47 U.S.C. 251</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDBBCB25FA98447CD8440B7A66579DF85" style="OLC">
					<section id="H6A4D715F67F346D98EC4A599884B6EDF"><enum>262.</enum><header>Ensuring the integrity of voice communications</header>
 <subsection id="H1DA903EC93714BC5909913FAF56D4F32"><enum>(a)</enum><header>Registration and compliance by intermediate providers</header><text display-inline="yes-display-inline">An intermediate provider that offers or holds itself out as offering the capability to transmit covered voice communications from one destination to another and that charges any rate to any other entity (including an affiliated entity) for the transmission shall—</text>
 <paragraph id="HDCB18AA97BCF45A7A16BC127C6009BCC"><enum>(1)</enum><text display-inline="yes-display-inline">register with the Commission; and</text> </paragraph><paragraph id="H59E455FE4343402EA3B1D6E841B5FC9F"><enum>(2)</enum><text display-inline="yes-display-inline">comply with the service quality standards for such transmission to be established by the Commission under subsection (c)(1)(B).</text>
 </paragraph></subsection><subsection id="HDF231D0C3DE24178B395DB3881E298BE"><enum>(b)</enum><header>Required use of registered intermediate providers</header><text display-inline="yes-display-inline">A covered provider may not use an intermediate provider to transmit covered voice communications unless such intermediate provider is registered under subsection (a)(1).</text>
						</subsection><subsection id="H426E88C18BF34467829A082938FA7B56"><enum>(c)</enum><header>Commission rules</header>
							<paragraph id="H78CB2E3D567447569056D655AF963B30"><enum>(1)</enum><header>In general</header>
 <subparagraph id="HD9542F43A88243FB9128D02D1B3DB9B0"><enum>(A)</enum><header>Registry</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Commission shall promulgate rules to establish a registry to record registrations under subsection (a)(1).</text>
 </subparagraph><subparagraph id="H36F6A62236374A7497F52FF789984BE0"><enum>(B)</enum><header>Service quality standards</header><text>Not later than 1 year after the date of enactment of this section, the Commission shall promulgate rules to establish service quality standards for the transmission of covered voice communications by intermediate providers.</text>
 </subparagraph></paragraph><paragraph id="HEC6FB5AF50E04F5B937F6BA68FF28949"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">In promulgating the rules required by paragraph (1), the Commission shall—</text> <subparagraph id="HD95DB468E91A4C639519F99A0A422AB1"><enum>(A)</enum><text display-inline="yes-display-inline">ensure the integrity of the transmission of covered voice communications to all customers in the United States; and</text>
 </subparagraph><subparagraph id="H7FCB728CC0494C118BB5FA58269B00A1"><enum>(B)</enum><text display-inline="yes-display-inline">prevent unjust or unreasonable discrimination among areas of the United States in the delivery of covered voice communications.</text>
 </subparagraph></paragraph></subsection><subsection id="HAA61A9C7820F4A4BB3F71B87FB6E8BFD"><enum>(d)</enum><header>Public availability of registry</header><text>The Commission shall make the registry established under subsection (c)(1)(A) publicly available on the website of the Commission.</text>
 </subsection><subsection id="H65C0C96FC73D475CB71BE1D018791EC9"><enum>(e)</enum><header>Scope of application</header><text display-inline="yes-display-inline">The requirements of this section shall apply regardless of the format by which any communication or service is provided, the protocol or format by which the transmission of such communication or service is achieved, or the regulatory classification of such communication or service.</text>
 </subsection><subsection id="H0E885A7311A940F7BEC0B36C766AA845"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to affect the regulatory classification of any communication or service.</text>
 </subsection><subsection id="H604AFDD6703343D885D73B40F4D27D34"><enum>(g)</enum><header>Effect on other laws</header><text>Nothing in this section shall be construed to preempt or expand the authority of a State public utility commission or other relevant State agency to collect data, or investigate and enforce State law and regulations, regarding the completion of intrastate voice communications, regardless of the format by which any communication or service is provided, the protocol or format by which the transmission of such communication or service is achieved, or the regulatory classification of such communication or service.</text>
 </subsection><subsection id="H29FFAA4272824CF4B5C66A61F3ACEA78"><enum>(h)</enum><header>Exception</header><text>The requirement under subsection (a)(2) to comply with the service quality standards established under subsection (c)(1)(B) shall not apply to a covered provider that—</text>
 <paragraph id="H12853853A2FB4BCE8F986501370A7DB6"><enum>(1)</enum><text>on or before the date that is 1 year after the date of enactment of this section, has certified as a Safe Harbor provider under section 64.2107(a) of title 47, Code of Federal Regulations, or any successor regulation; and</text>
 </paragraph><paragraph id="H6AD32C2DD7A9420397FD4BE66060B860"><enum>(2)</enum><text>continues to meet the requirements under such section 64.2107(a).</text> </paragraph></subsection><subsection id="H8A8D03183B8848CFBCB771E637660A92"><enum>(i)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="HBDBF8F4AF0764A1CAD4B806B479080C6"><enum>(1)</enum><header>Covered provider</header><text>The term <term>covered provider</term> has the meaning given the term in section 64.2101 of title 47, Code of Federal Regulations, or any successor thereto.</text>
 </paragraph><paragraph id="H270AC58E31FC43D4A220F893E15362E2"><enum>(2)</enum><header>Covered voice communication</header><text>The term <term>covered voice communication</term> means a voice communication (including any related signaling information) that is generated—</text> <subparagraph id="H28555C08E70940AC96A621676CC10A9A"><enum>(A)</enum><text>from the placement of a call from a connection using a North American Numbering Plan resource or a call placed to a connection using such a numbering resource; and</text>
 </subparagraph><subparagraph id="H13B86A91AFB149038C6FD54CE9298AC8"><enum>(B)</enum><text>through any service provided by a covered provider.</text> </subparagraph></paragraph><paragraph id="H291427137E324171BA72A0E6E33BAEE1"><enum>(3)</enum><header>Intermediate provider</header><text>The term <term>intermediate provider</term> means any entity that—</text>
 <subparagraph id="H8556114AEC3B49CBA236536452DE8337"><enum>(A)</enum><text>enters into a business arrangement with a covered provider or other intermediate provider for the specific purpose of carrying, routing, or transmitting voice traffic that is generated from the placement of a call placed—</text>
 <clause id="H7A2AD6DF45524224AB5EC9E00ADE2D98"><enum>(i)</enum><text>from an end user connection using a North American Numbering Plan resource; or</text> </clause><clause id="HEE91B10CF2F94A44B975550C3DE9F2FE"><enum>(ii)</enum><text>to an end user connection using such a numbering resource; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5CB0CB67E9004F0591D3A06FAFFBA6F1"><enum>(B)</enum><text>does not itself, either directly or in conjunction with an affiliate, serve as a covered provider in the context of originating or terminating a given call.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H409734BDC9AE4DBBA8474CC3981A82FD" section-type="subsequent-section"><enum>604.</enum><header>Spoofing prevention</header>
				<subsection id="H943EA54A2FFF4494A57FF53A3B83AEA4"><enum>(a)</enum><header>Expanding and clarifying prohibition on misleading or inaccurate caller identification information</header>
 <paragraph id="H4F62B1E2167541C98624B3A71CF4BCB5"><enum>(1)</enum><header>Communications from outside the United States</header><text>Section 227(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(1)</external-xref>) is amended by striking <quote>in connection with any telecommunications service or IP-enabled voice service</quote> and inserting <quote>or any person outside the United States if the recipient is within the United States, in connection with any voice service or text messaging service</quote>.</text>
 </paragraph><paragraph id="H59CC2BDBA13B4F05916DC9C23E4DA6B8"><enum>(2)</enum><header>Coverage of text messages and voice services</header><text>Section 227(e)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)</external-xref>) is amended—</text> <subparagraph id="HC1C107AA3206422AA1EC1148B50A4FE9"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>telecommunications service or IP-enabled voice service</quote> and inserting <quote>voice service or a text message sent using a text messaging service</quote>;</text>
 </subparagraph><subparagraph id="H75E247AD7D334BC295E66C3161E5D14D"><enum>(B)</enum><text>in the first sentence of subparagraph (B), by striking <quote>telecommunications service or IP-enabled voice service</quote> and inserting <quote>voice service or a text message sent using a text messaging service</quote>; and</text> </subparagraph><subparagraph id="HDC27180D1B4444008376D7C0B2EDC0AB"><enum>(C)</enum><text>by striking subparagraph (C) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="H33376C7B494C46F887ED8C93E0790539" style="OLC">
 <subparagraph id="H9A70B8E7595F4893B7DEAE94BDAE0FF1"><enum>(C)</enum><header>Text message</header><text>The term <term>text message</term>—</text> <clause id="H3812C17B735C441888DA83491DAFC65C"><enum>(i)</enum><text>means a message consisting of text, images, sounds, or other information that is transmitted to or from a device that is identified as the receiving or transmitting device by means of a 10-digit telephone number or N11 service code;</text>
 </clause><clause id="H79EC0577ECEE4067A159111E446EF159"><enum>(ii)</enum><text>includes a short message service (commonly referred to as <quote>SMS</quote>) message and a multimedia message service (commonly referred to as <quote>MMS</quote>) message; and</text> </clause><clause id="H744242B7C8BA442B8FEB5758EDE85D45"><enum>(iii)</enum><text>does not include—</text>
 <subclause id="H40B4918728C042C2BE5104F512474F9D"><enum>(I)</enum><text>a real-time, two-way voice or video communication; or</text> </subclause><subclause id="HBA38344E1FC04AAA8442546C7581D639"><enum>(II)</enum><text>a message sent over an IP-enabled messaging service to another user of the same messaging service, except a message described in clause (ii).</text>
 </subclause></clause></subparagraph><subparagraph id="H80AB49710D1D4191B7A97F2A8FA1FD71"><enum>(D)</enum><header>Text messaging service</header><text>The term <term>text messaging service</term> means a service that enables the transmission or receipt of a text message, including a service provided as part of or in connection with a voice service.</text>
 </subparagraph><subparagraph id="H8AF2C590ADF346C1948844069A84B536"><enum>(E)</enum><header>Voice service</header><text>The term <term>voice service</term>—</text> <clause id="HFB0B5F60E0C640E69CD8BF6BD169CDCF"><enum>(i)</enum><text>means any service that is interconnected with the public switched telephone network and that furnishes voice communications to an end user using resources from the North American Numbering Plan or any successor to the North American Numbering Plan adopted by the Commission under section 251(e)(1); and</text>
 </clause><clause id="H961145F9B83F4FFA85A76A89595F0B5F"><enum>(ii)</enum><text>includes transmissions from a telephone facsimile machine, computer, or other device to a telephone facsimile machine.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H30212080513B40DD95524EFECAEC4CD0"><enum>(3)</enum><header>Technical amendment</header><text>Section 227(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)</external-xref>) is amended in the heading by inserting <quote><header-in-text level="subsection">Misleading or</header-in-text></quote> before <quote><header-in-text level="subsection">Inaccurate</header-in-text></quote>.</text>
					</paragraph><paragraph id="H217A6C6885724863911F18100FB0E72D"><enum>(4)</enum><header>Regulations</header>
 <subparagraph id="HCDBEDB172C2747FF941330E7C53EDD90"><enum>(A)</enum><header>In general</header><text>Section 227(e)(3)(A) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(3)(A)</external-xref>) is amended by striking <quote>Not later than 6 months after the date of enactment of the Truth in Caller ID Act of 2009, the Commission</quote> and inserting <quote>The Commission</quote>.</text>
 </subparagraph><subparagraph id="H1D6CBF781C6E44EEBB9FEF6984C911EE"><enum>(B)</enum><header>Deadline</header><text>The Commission shall prescribe regulations to implement the amendments made by this subsection not later than 18 months after the date of enactment of this Act.</text>
 </subparagraph></paragraph><paragraph id="HD7A8410143B7466494382FF56E0B1D0E"><enum>(5)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date that is 6 months after the date on which the Commission prescribes regulations under paragraph (4).</text>
					</paragraph></subsection><subsection id="HA6E9D35A15A84549A11785570AB8257F"><enum>(b)</enum><header>Consumer education materials on how To avoid scams that rely upon misleading or inaccurate caller
			 identification information</header>
 <paragraph id="H9FC6C81B9687402289A5B1937EEBDC5A"><enum>(1)</enum><header>Development of materials</header><text>Not later than 1 year after the date of enactment of this Act, the Commission, in coordination with the Federal Trade Commission, shall develop consumer education materials that provide information about—</text>
 <subparagraph id="HBF3CFE3F3F474310BBB7847A89AF19AC"><enum>(A)</enum><text>ways for consumers to identify scams and other fraudulent activity that rely upon the use of misleading or inaccurate caller identification information; and</text>
 </subparagraph><subparagraph id="H7D414FBB24FC44D7A8283696A01F6E0D"><enum>(B)</enum><text>existing technologies, if any, that a consumer can use to protect against such scams and other fraudulent activity.</text>
 </subparagraph></paragraph><paragraph id="H164A48A853B84AF8A6E6CEBDFD3AE06E"><enum>(2)</enum><header>Contents</header><text>In developing the consumer education materials under paragraph (1), the Commission shall—</text> <subparagraph id="HD45E08B2F68D405DB2A1865FE148C823"><enum>(A)</enum><text>identify existing technologies, if any, that can help consumers guard themselves against scams and other fraudulent activity that rely upon the use of misleading or inaccurate caller identification information, including—</text>
 <clause id="H16CC3348D099407A864B652A74A8C4E1"><enum>(i)</enum><text>descriptions of how a consumer can use the technologies to protect against such scams and other fraudulent activity; and</text>
 </clause><clause id="H99886AA4EF684958B9B289E6E83326E5"><enum>(ii)</enum><text>details on how consumers can access and use the technologies; and</text> </clause></subparagraph><subparagraph id="HE99D41FD6C124610A9733F84A66B1531"><enum>(B)</enum><text>provide other information that may help consumers identify and avoid scams and other fraudulent activity that rely upon the use of misleading or inaccurate caller identification information.</text>
 </subparagraph></paragraph><paragraph id="H709568F5D91143B2AAC570DBE888FC8A"><enum>(3)</enum><header>Updates</header><text>The Commission shall ensure that the consumer education materials required under paragraph (1) are updated on a regular basis.</text>
 </paragraph><paragraph id="H6BEF7FD986A5442CB3C014AFEA36BDEB"><enum>(4)</enum><header>Website</header><text>The Commission shall include the consumer education materials developed under paragraph (1) on its website.</text>
					</paragraph></subsection><subsection id="H9AFCCD3D4ABD42969CCD482D69D01495"><enum>(c)</enum><header>GAO report on combating the fraudulent provision of misleading or inaccurate caller identification
			 information</header>
 <paragraph id="H361845D6D289468C8F38E1AC84FD2E21"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct a study of the actions the Commission and the Federal Trade Commission have taken to combat the fraudulent provision of misleading or inaccurate caller identification information, and the additional measures that could be taken to combat such activity.</text>
 </paragraph><paragraph id="H08CEF1B7A7F24EE4BC506C311CD8680F"><enum>(2)</enum><header>Required considerations</header><text>In conducting the study under paragraph (1), the Comptroller General shall examine—</text> <subparagraph id="HB385AF8454254994A95CFFE8A02C2E6E"><enum>(A)</enum><text>trends in the types of scams that rely on misleading or inaccurate caller identification information;</text>
 </subparagraph><subparagraph id="H8090CACBEC8F453CAAF6EBB2B47BF2B8"><enum>(B)</enum><text>previous and current enforcement actions by the Commission and the Federal Trade Commission to combat the practices prohibited by section 227(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(1)</external-xref>);</text>
 </subparagraph><subparagraph id="H45641E62A9464AA1AB8CE59CDEFC8811"><enum>(C)</enum><text>current efforts by industry groups and other entities to develop technical standards to deter or prevent the fraudulent provision of misleading or inaccurate caller identification information, and how such standards may help combat the current and future provision of misleading or inaccurate caller identification information; and</text>
 </subparagraph><subparagraph id="H9EABDAF3A5C34A9C92CBBD15DAA92ED9"><enum>(D)</enum><text>whether there are additional actions the Commission, the Federal Trade Commission, and Congress should take to combat the fraudulent provision of misleading or inaccurate caller identification information.</text>
 </subparagraph></paragraph><paragraph id="H6688B30EB08F47BBA51F08DE553A043F"><enum>(3)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Comptroller General shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the findings of the study under paragraph (1), including any recommendations regarding combating the fraudulent provision of misleading or inaccurate caller identification information.</text>
 </paragraph></subsection><subsection id="H46C06CC3EA2D4F85AF741F7D3994BE3A"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section, or the amendments made by this section, shall be construed to modify, limit, or otherwise affect any rule or order adopted by the Commission in connection with—</text>
 <paragraph id="H1A24E0D3FEF445B9A1BD112BDBBD5BFE"><enum>(1)</enum><text>the Telephone Consumer Protection Act of 1991 (<external-xref legal-doc="public-law" parsable-cite="pl/102/243">Public Law 102–243</external-xref>; 105 Stat. 2394) or the amendments made by that Act; or</text>
 </paragraph><paragraph id="HD3D8F9F3C5414A848948324633E3B8FE"><enum>(2)</enum><text>the CAN–SPAM Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/15/7701">15 U.S.C. 7701</external-xref> et seq.).</text> </paragraph></subsection></section><section id="H819AE0249CE34A5FBCF268B182ADE196"><enum>605.</enum><header>Configuration of multi-line telephone systems for direct dialing of 9–1–1</header> <subsection id="HF8F403D764424F91AC7EF8312C66AB8B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VII of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/601">47 U.S.C. 601</external-xref> et seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H95FA15AF7FB6481D8EB482CBB0015DFF" style="OLC">
						<section id="H554F95EA64F44E168BA7A129B11A3D46"><enum>721.</enum><header>Configuration of multi-line telephone systems for direct dialing of 9–1–1</header>
 <subsection id="HDA49823CAD50493FB70E4AF70348A8B5"><enum>(a)</enum><header>System manufacture, importation, sale, and lease</header><text display-inline="yes-display-inline">A person engaged in the business of manufacturing, importing, selling, or leasing multi-line telephone systems may not manufacture or import for use in the United States, or sell or lease or offer to sell or lease in the United States, a multi-line telephone system, unless such system is pre-configured such that, when properly installed in accordance with subsection (b), a user may directly initiate a call to 9–1–1 from any station equipped with dialing facilities, without dialing any additional digit, code, prefix, or post-fix, including any trunk-access code such as the digit ‘9’, regardless of whether the user is required to dial such a digit, code, prefix, or post-fix for other calls.</text>
 </subsection><subsection id="H94C7E7DBEC064112A87A4D28AABE252E"><enum>(b)</enum><header>System installation, management, and operation</header><text>A person engaged in the business of installing, managing, or operating multi-line telephone systems may not install, manage, or operate for use in the United States such a system, unless such system is configured such that a user may directly initiate a call to 9–1–1 from any station equipped with dialing facilities, without dialing any additional digit, code, prefix, or post-fix, including any trunk-access code such as the digit ‘9’, regardless of whether the user is required to dial such a digit, code, prefix, or post-fix for other calls.</text>
 </subsection><subsection id="HB476D933FBAD476F9040DBAAC884E495"><enum>(c)</enum><header>On-Site notification</header><text>A person engaged in the business of installing, managing, or operating multi-line telephone systems shall, in installing, managing, or operating such a system for use in the United States, configure the system to provide a notification to a central location at the facility where the system is installed or to another person or organization regardless of location, if the system is able to be configured to provide the notification without an improvement to the hardware or software of the system.</text>
 </subsection><subsection id="H0C70CD76F22E4480A1A055D15199B163"><enum>(d)</enum><header>Effect on State law</header><text>Nothing in this section is intended to alter the authority of State commissions or other State or local agencies with jurisdiction over emergency communications, if the exercise of such authority is not inconsistent with this Act.</text>
 </subsection><subsection id="H4A3244BA1FDC4CFDAC0F9FD51180EC3B"><enum>(e)</enum><header>Enforcement</header><text>This section shall be enforced under title V, except that section 501 applies only to the extent that such section provides for the punishment of a fine.</text>
 </subsection><subsection id="H7B9B9FC1D4B3403B80D30C196BD6252E"><enum>(f)</enum><header>Multi-Line telephone system defined</header><text>In this section, the term <quote>multi-line telephone system</quote> has the meaning given such term in section 6502 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1471">47 U.S.C. 1471</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HEC9C47200C264521AE0236B30439387D"><enum>(b)</enum><header>Effective date</header>
 <paragraph id="HC2A16EB8E58C491A8099850E12D80EA4"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), section 721 of the Communications Act of 1934, as added by subsection (a) of this section, shall apply beginning on the date that is 2 years after the date of the enactment of this Act.</text>
 </paragraph><paragraph id="H850146F77E81454CB86779A9C9E1BEF2"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Subsection (b) or (c) of such section 721 shall not apply to a multi-line telephone system that was installed before the date that is 2 years after the date of the enactment of this Act if such system is not able to be configured to meet the requirement of such subsection (b) or (c), respectively, without an improvement to the hardware or software of the system.</text>
					</paragraph></subsection></section><section id="H612A275035104F01A337BF584F01F56A"><enum>606.</enum><header>Report on promoting broadband Internet access service for veterans</header>
 <subsection id="HBEA4A885F9B540F09A71F05FC59D8E0A"><enum>(a)</enum><header>Veteran defined</header><text>In this section, the term <term>veteran</term> has the meaning given the term in section 101 of title 38, United States Code.</text> </subsection><subsection id="HD4EE438329524B42B8E7A898128BF7C6"><enum>(b)</enum><header>Report required</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall submit to Congress a report on promoting broadband Internet access service for veterans, in particular low-income veterans and veterans residing in rural areas. In such report, the Commission shall—</text>
 <paragraph id="H4EB07013C0DC4E7AA81FE07070386047"><enum>(1)</enum><text>examine such access and how to promote such access; and</text> </paragraph><paragraph id="H225F8DEA009E42D6965DA5DABD45686E"><enum>(2)</enum><text>provide findings and recommendations for Congress with respect to such access and how to promote such access.</text>
 </paragraph></subsection><subsection id="HC13636C9AB4A4D5CA9420619830F7E3A"><enum>(c)</enum><header>Public notice and opportunity To comment</header><text display-inline="yes-display-inline">In preparing the report required by subsection (b), the Commission shall provide the public with notice and an opportunity to comment on broadband Internet access service for veterans, in particular low-income veterans and veterans residing in rural areas, and how to promote such access.</text>
				</subsection></section><section id="H9DAA17EDFE0C4037926F00E0B6949D45"><enum>607.</enum><header>Methodology for collection of mobile service coverage data</header>
 <subsection id="HF3013041691B4E15A5567C16700B6200"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H63F5843F1340419999A9E11B18AFB1CD"><enum>(1)</enum><text>the term <term>commercial mobile data service</term> has the meaning given the term in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>);</text>
 </paragraph><paragraph id="HC32DF7BCDC7D46B2996484DFBBA960F8"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>commercial mobile service</term> has the meaning given the term in section 332(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(d)</external-xref>);</text>
 </paragraph><paragraph id="HEEE7AD88C27041CEAFEBA79AF2239128"><enum>(3)</enum><text>the term <term>coverage data</term> means, if commercial mobile service or commercial mobile data service is available, general information about the service, which may include available speed tiers and performance characteristics; and</text>
 </paragraph><paragraph id="H3EA77B49DBA540819BE3A302EC868378"><enum>(4)</enum><text>the term <term>Universal Service program</term> means the universal service support mechanisms established under section 254 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>) and the regulations issued under that section.</text>
 </paragraph></subsection><subsection id="H5DD59136CCE14BF7B7A0B1E045C7911E"><enum>(b)</enum><header>Methodology established</header><text display-inline="yes-display-inline">Not later than 180 days after the conclusion of Auction 903, the Commission shall promulgate regulations to establish a methodology that shall apply to the collection of coverage data by the Commission for the purposes of—</text>
 <paragraph id="HA61EF86223D6470BA9C15720904A5D04"><enum>(1)</enum><text display-inline="yes-display-inline">the Universal Service program; or</text> </paragraph><paragraph id="H8EC7D9D65228474D84CE3808DFF7A26B"><enum>(2)</enum><text>any other similar program.</text>
 </paragraph></subsection><subsection id="H0D92092542BF407885A0FFBFBA936DF3"><enum>(c)</enum><header>Requirements</header><text>The methodology established under subsection (b) shall—</text> <paragraph commented="no" id="HE1D9A7DCCE07472C9528E6A1EA16BAE9"><enum>(1)</enum><text display-inline="yes-display-inline">contain standard definitions for different available technologies such as 2G, 3G, 4G, and 4G LTE;</text>
 </paragraph><paragraph id="H11EE480343DE4D399826A253E8FA1F34"><enum>(2)</enum><text>enhance the consistency and robustness of how the data are collected by different parties;</text> </paragraph><paragraph id="H0F7596E10B224EFAB917222882A827F8"><enum>(3)</enum><text display-inline="yes-display-inline">improve the validity and reliability of coverage data; and</text>
 </paragraph><paragraph id="H32A9B905E38943268907BE925CD81B3F"><enum>(4)</enum><text>increase the efficiency of coverage data collection.</text> </paragraph></subsection></section><section id="H7818A4169C524C62A66434DB53C88BC2"><enum>608.</enum><header>Accuracy of 9–1–1 call location information</header> <subsection id="H401DAB2BDB3A447D95897BF2496C3F2B"><enum>(a)</enum><header>Proceeding required</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Commission shall conclude a proceeding to consider adopting rules to ensure that call location information is conveyed with a 9–1–1 call, regardless of the technological platform used and including with calls from multi-line telephone systems (as defined in section 6502 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1471">47 U.S.C. 1471</external-xref>)).</text>
 </subsection><subsection id="H1EA531A92EE84F1587C7398DC4DE1CE4"><enum>(b)</enum><header>Relationship to other proceedings</header><text display-inline="yes-display-inline">In conducting the proceeding required by subsection (a), the Commission may consider information and conclusions from other Commission proceedings regarding the accuracy of call location information, but nothing in this section shall be construed to require the Commission to reconsider any information or conclusion from a proceeding regarding the accuracy of call location information in which the Commission has adopted rules or issued an order before the date of the enactment of this Act.</text>
 </subsection><subsection id="H965F5BF624A14A8BB871D3186916F68B"><enum>(c)</enum><header>Other authority</header><text display-inline="yes-display-inline">In addition to the authority to adopt any rules the Commission finds to be necessary in the proceeding required by subsection (a), the Commission shall have the authority to adopt any other rules, technical standards, protocols, and procedures as are necessary to ensure that call location information is conveyed as described in such subsection.</text>
 </subsection><subsection id="HB46E38103161425593F977B1196B9E66"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H681DF80314354C38867DB33AC372B7A4"><enum>(1)</enum><header>9–1–1 call</header><text display-inline="yes-display-inline">The term <quote>9–1–1 call</quote> means a voice call that is placed, or a message that is sent by other means of communication, to a public safety answering point (as defined in section 222 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/222">47 U.S.C. 222</external-xref>)) for the purpose of requesting emergency services.</text>
 </paragraph><paragraph id="H31417172FA8D4E89BEE44889980CC3DF"><enum>(2)</enum><header>Call location information</header><text display-inline="yes-display-inline">The term <quote>call location information</quote> means accurate and timely information regarding the location of the caller, as determined to be technically feasible and achievable by the Commission.</text>
					</paragraph></subsection></section><section id="HFAE55CEC32034BDCAC7FC2D939270927"><enum>609.</enum><header>Interagency Communications Security Committee</header>
 <subsection id="HCA8E0DA28FBE4D01B4C5E778C64ABBE2"><enum>(a)</enum><header>Establishment</header><text>Not later than 6 months after the date of the enactment of this Act, the Assistant Secretary of Commerce for Communications and Information shall establish an advisory committee to be known as the Interagency Communications Security Committee (in this section referred to as the <quote>Committee</quote>).</text>
 </subsection><subsection id="H5086A6268783428990EE1C9836BBA207"><enum>(b)</enum><header>Duties</header><text>The Committee shall—</text> <paragraph id="H5B6D5D1DFD174C429F1A1B002040D529"><enum>(1)</enum><text>review each communications security report submitted to the Committee under subsection (d) or (f);</text>
 </paragraph><paragraph id="H14599E6903184436BE97714582A624B2"><enum>(2)</enum><text display-inline="yes-display-inline">recommend investigation to relevant agencies into any such communications security report; and</text> </paragraph><paragraph id="HCE5AB0D33E6C495B8B55C1B2070381D0"><enum>(3)</enum><text>issue regular reports containing the results of any such investigation, the Committee’s findings following each communications security incident, and policy recommendations that may arise from each communications security incident to the following:</text>
 <subparagraph id="HE3D347EFD71D41D1BFD77AF5E19A528C"><enum>(A)</enum><text>The agencies represented on the Committee.</text> </subparagraph><subparagraph id="H6548407FE785411AB3EB742933174EF8"><enum>(B)</enum><text display-inline="yes-display-inline">The Committee on Energy and Commerce of the House of Representatives.</text>
 </subparagraph><subparagraph id="H19F58F50901E48C5AAEB38F7638B9F5C"><enum>(C)</enum><text display-inline="yes-display-inline">The Committee on Commerce, Science, and Transportation of the Senate.</text> </subparagraph><subparagraph id="H23101CB094D34DA8B8DC4CDEBA73949D"><enum>(D)</enum><text display-inline="yes-display-inline">The Permanent Select Committee on Intelligence of the House of Representatives.</text>
 </subparagraph><subparagraph id="HAF1896E0E71D49D5AD09C176016302EA"><enum>(E)</enum><text display-inline="yes-display-inline">The Select Committee on Intelligence of the Senate.</text> </subparagraph><subparagraph id="H03EBD1DF88194306BDB00051D3290018"><enum>(F)</enum><text display-inline="yes-display-inline">The Armed Services Committee of the House of Representatives.</text>
 </subparagraph><subparagraph id="H31031794CF67477083BE4668B2231224"><enum>(G)</enum><text display-inline="yes-display-inline">The Armed Services Committee of the Senate.</text> </subparagraph><subparagraph id="HAF16957B763D4DAABF92DBDE2C1A6CB9"><enum>(H)</enum><text display-inline="yes-display-inline">The Committee on Homeland Security of the House of Representatives.</text>
 </subparagraph><subparagraph id="HDFDBBA9B13D84156A14E674E81846C13"><enum>(I)</enum><text display-inline="yes-display-inline">The Committee on Homeland Security and Governmental Affairs of the Senate.</text> </subparagraph><subparagraph id="H3B286CBDFF554AE4817A253F6B4C6DC2"><enum>(J)</enum><text display-inline="yes-display-inline">The Foreign Affairs Committee of the House of Representatives.</text>
 </subparagraph><subparagraph id="H535CAA3B51024C809B0B28577FD539EC"><enum>(K)</enum><text display-inline="yes-display-inline">The Foreign Relations Committee of the Senate.</text> </subparagraph></paragraph></subsection><subsection id="H6B079FDE2AFD44EFADE5DDE21F06C192"><enum>(c)</enum><header>Membership</header><text>The Committee shall be composed of 8 members, who shall each possess the appropriate access to classified information commensurate with the sensitivity of the classified information such members shall access in the course of service on the Committee. The members of the Committee shall include only—</text>
 <paragraph id="H54801DAC6C68445CBC322BC877EDCF64"><enum>(1)</enum><text display-inline="yes-display-inline">one appointee from the National Telecommunications and Information Administration, to be appointed by the Assistant Secretary of Commerce for Communications and Information, who shall serve as Chair of the Committee;</text>
 </paragraph><paragraph id="H24B6AAC94D2A4E148DC9465CFAF8FFC3"><enum>(2)</enum><text>one appointee from the Department of Defense, to be appointed by the Secretary of Defense;</text> </paragraph><paragraph id="H20E259CBD2B84A8084003C7AB106A01A"><enum>(3)</enum><text>one appointee from the Department of Homeland Security, to be appointed by the Secretary of Homeland Security;</text>
 </paragraph><paragraph id="H54145F5123E644FD97CE47747DD91EA5"><enum>(4)</enum><text>one appointee from the Department of Justice, to be appointed by the Attorney General of the United States;</text>
 </paragraph><paragraph id="HA55E2E78A47F4925A6B36CE8DF156302"><enum>(5)</enum><text>one appointee from the intelligence community, to be appointed by the Director of National Intelligence;</text>
 </paragraph><paragraph id="H267F7B5093B3440882EA3369F9BA743C"><enum>(6)</enum><text>one appointee from the National Institute of Standards and Technology, to be appointed by the Director of the National Institute of Standards and Technology;</text>
 </paragraph><paragraph id="H7A322A149AEA41C3AE2E6A9A412C67E0"><enum>(7)</enum><text display-inline="yes-display-inline">one appointee from the Federal Communications Commission, who shall not be a member of the Commission, to be appointed by the Chair of the Commission; and</text>
 </paragraph><paragraph id="HBCC99384804E484994C5177C852E654C"><enum>(8)</enum><text>one appointee from the Office of Management and Budget, to be appointed by the Director of the Office of Management and Budget.</text>
 </paragraph></subsection><subsection id="HD5C10CED9E054938B849E5477CA71C47"><enum>(d)</enum><header>Public communications security reports</header><text>The Committee shall consider communications security reports from communications network providers.</text> </subsection><subsection commented="no" id="HD7766B16532545C6876573F85C708080"><enum>(e)</enum><header>Application of critical infrastructure information protections</header><text>For purposes of subtitle B of title II of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/131">6 U.S.C. 131</external-xref> et seq.)—</text>
 <paragraph commented="no" id="HF0E4DA2CFCA54C35A7F73154945D6FE5"><enum>(1)</enum><text display-inline="yes-display-inline">communications networks shall be treated as critical infrastructure and protected systems defined in sections 2(4) and 212(6), respectively, of the <short-title>Homeland Security Act of 2002</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101(4)</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/131">6 U.S.C. 131(6)</external-xref>); and</text>
 </paragraph><paragraph commented="no" id="H7DC73B3B420B4D0E8D3E7D2B12D7ABBC"><enum>(2)</enum><text>with respect to critical infrastructure information relating to communications networks, the National Telecommunications and Information Administration (in addition to the Department of Homeland Security) shall be treated as a covered Federal agency defined in section 212(2) of such Act.</text>
 </paragraph></subsection><subsection id="H1146D3ED07A549D2AE798B0B0E155DB4"><enum>(f)</enum><header>Agency communications security reports</header><text>Not less frequently than every 3 months, the head of each agency shall submit to the Committee a report of each communications security incident for the previous 3 months.</text>
 </subsection><subsection id="HE0159216428C476FB6629A395EB825E8"><enum>(g)</enum><header>Continuation of committee</header><text>Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) does not apply to the Committee.</text> </subsection><subsection id="H6561ACA23D9E4A8E91EBB2F941199096"><enum>(h)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
 <paragraph id="H0FB7C3D993204E49BDE100E7C32FD621"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given that term in section 3502 of title 44, United States Code.</text> </paragraph><paragraph id="H1A9131ACB4544C45AF71593B823D728B"><enum>(2)</enum><header>Communications network</header><text>The term <term>communications network</term> means a network for the provision of wireline or mobile telephone service, Internet access service, radio or television broadcasting, cable service, direct broadcast satellite service, or any other communications service.</text>
 </paragraph><paragraph id="H5FB9A563388C46A5AE9B86E2B4D2C185"><enum>(3)</enum><header>Communications security incident</header><text>The term <term>communications security incident</term> means any compromise, whether electronic or otherwise, of any telecommunications system that the agency has reason to believe—</text>
 <subparagraph id="H5880236715BE41F4AD7AEAB7A92FC9EC"><enum>(A)</enum><text>resulted in Government-held or private information, including passwords and other similar means of access, being viewed or extracted; or</text>
 </subparagraph><subparagraph id="HC7A9F4185C5949E5AFF3670AE248998B"><enum>(B)</enum><text>resulted in the presence of outside programming on an agency computer or other electronic device.</text> </subparagraph></paragraph><paragraph commented="no" id="H17065BA57E574C1184F4092E2B4CAECB"><enum>(4)</enum><header>Communications Security Report</header><text>The term <term>communications security report</term> means a description of a communications security incident or multiple communications security incidents referred to the Committee.</text>
