 </subsection></section><section id="H364122FA4D2E4A548655AADC6CB5F041"><enum>2.</enum><header>Commission defined</header><text display-inline="no-display-inline">In this Act, the term <quote>Commission</quote> means the Federal Communications Commission.</text> </section><title id="HDD57DEA3FCB84779A6DC4F415E720F1E"><enum>I</enum><header>FCC Reauthorization</header> <section id="HD9C9CE0D378B46F29836052F2E25CC7C"><enum>101.</enum><header>Authorization of appropriations</header> <subsection id="H38AA20C01ED34DADBFCD81D0E050BAF3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 6 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/156">47 U.S.C. 156</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H2C3B37C5F269419F869A7BC5016E45A5" style="OLC">
						<section id="HDF13F9F36A8C43D2B4B7D113809D5092"><enum>6.</enum><header>Authorization of appropriations</header>
 <subsection id="HAB217A93C37D4CCDB2DC0EE457B91457"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Commission to carry out the functions of the Commission $333,118,000 for fiscal year 2019 and $339,610,000 for fiscal year 2020.</text>
 </subsection><subsection id="HA77BDEB3E7A04EC4B9DC4B9F43A00103"><enum>(b)</enum><header>Offsetting collections</header><text display-inline="yes-display-inline">The sum appropriated in any fiscal year to carry out the activities described in subsection (a), to the extent and in the amounts provided for in Appropriations Acts, shall be derived from fees authorized by section 9.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="HDCC14260A3D2439B8328DC5AE490FBCA"><enum>(b)</enum><header>Deposits of bidders To be deposited in Treasury</header><text display-inline="yes-display-inline">Section 309(j)(8)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)(C)</external-xref>) is amended—</text> <paragraph commented="no" id="HA38DB70DA225423F92A7B7A6BAEA4670"><enum>(1)</enum><text>in the first sentence, by striking <quote>an interest bearing account</quote> and all that follows and inserting <quote>the Treasury.</quote>;</text>
 </paragraph><paragraph commented="no" id="H2CA6507D2CB14042BA967C32085893D0"><enum>(2)</enum><text>in clause (i)—</text> <subparagraph commented="no" id="HD89DA29AFA0F49EEA542224B0FA72640"><enum>(A)</enum><text>by striking <quote>paid to the Treasury</quote> and inserting <quote>deposited in the general fund of the Treasury (where such deposits shall be used for the sole purpose of deficit reduction)</quote>; and</text>
 </subparagraph><subparagraph commented="no" id="H6FF951DECFB44B2EBA0885469DAE2841"><enum>(B)</enum><text>by striking the semicolon and inserting <quote>; and</quote>;</text> </subparagraph></paragraph><paragraph commented="no" id="H818463A0B7ED4D959048F6BDD91A2FBF"><enum>(3)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting <quote>, and payments representing the return of such deposits shall not be subject to administrative offset under section 3716(c) of title 31, United States Code.</quote>; and</text>
 </paragraph><paragraph commented="no" id="H4C1C20BBB0EF439B91D47AD7F45FADAD"><enum>(4)</enum><text>by striking clause (iii).</text> </paragraph></subsection><subsection id="HC18CA1C1D43046468544454C608BAB35"><enum>(c)</enum><header>Elimination of duplicative authorization of appropriations</header> <paragraph id="HF9A8CF55AF3B42CCB86FC2027A05DFF6"><enum>(1)</enum><header>In general</header><text>Section 710 of the Telecommunications Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/104">Public Law 104–104</external-xref>) is repealed.</text>
 </paragraph><paragraph id="H20F97E25BD2044FC9EC66C3E84F76FCF"><enum>(2)</enum><header>Conforming amendment</header><text>The table of contents in section 2 of such Act is amended by striking the item relating to section 710.</text>
 </paragraph></subsection><subsection commented="no" id="HBD1A6B1C8541497ABB950271F2D4FCDB"><enum>(d)</enum><header>Transfer of funds</header><text display-inline="yes-display-inline">On the effective date described in section 103, any amounts in the account providing appropriations to carry out the functions of the Commission that were collected in excess of the amounts provided for in Appropriations Acts in any fiscal year prior to such date shall be transferred to the general fund of the Treasury of the United States for the sole purpose of deficit reduction.</text>
				</subsection></section><section id="H0E17E9B31495420C997BC35825F76030"><enum>102.</enum><header>Application and regulatory fees</header>
 <subsection id="H1023D4DFF7F04D65B41D35DADA9E4DB9"><enum>(a)</enum><header>Application fees</header><text>Section 8 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/158">47 U.S.C. 158</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H7935CE0EC63A4E1FB88AE9ED96AB67C6" style="OLC"> <section id="HD13111AE83634379A9D12086424DA7F7"><enum>8.</enum><header>Application fees</header> <subsection id="H23B4AC0C280645F9978904AE59FF5832"><enum>(a)</enum><header>General authority; establishment of schedule</header><text display-inline="yes-display-inline">The Commission shall assess and collect application fees at such rates as the Commission shall establish in a schedule of application fees to recover the costs of the Commission to process applications.</text>
							</subsection><subsection id="H1E2F9082FCA9482BAC3A0349DB7EA6F9"><enum>(b)</enum><header>Adjustment of schedule</header>
 <paragraph id="H93DCF36912304855ABEF27B03A04F227"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In every even-numbered year, the Commission shall review the schedule of application fees established under this section and, except as provided in paragraph (2), set a new amount for each fee in the schedule that is equal to the amount of the fee on the date when the fee was established or the date when the fee was last amended under subsection (c), whichever is later—</text>
 <subparagraph id="H73DC985B0314487680F4A3D07B12E059"><enum>(A)</enum><text>increased or decreased by the percentage change in the Consumer Price Index during the period beginning on such date and ending on the date of the review; and</text>
 </subparagraph><subparagraph id="H190E94BFB90A4B1E8663A58122733FA5"><enum>(B)</enum><text>rounded to the nearest $5 increment.</text> </subparagraph></paragraph><paragraph id="H838BC345D6F64AA2B518269B15362F4D"><enum>(2)</enum><header>Threshold for adjustment</header><text>The Commission may not adjust a fee under paragraph (1) if—</text>
 <subparagraph id="H0D698649D8E04DAFA34B85E69F554371"><enum>(A)</enum><text>in the case of a fee the current amount of which is less than $200, the adjustment would result in a change in the current amount of less than $10; or</text>
 </subparagraph><subparagraph id="H652B30250E834E7588E339535D347477"><enum>(B)</enum><text>in the case of a fee the current amount of which is $200 or more, the adjustment would result in a change in the current amount of less than 5 percent.</text>
 </subparagraph></paragraph><paragraph id="HCD8CAC56688F48A589FF389DB3B08186"><enum>(3)</enum><header>Current amount defined</header><text>In paragraph (2), the term <quote>current amount</quote> means, with respect to a fee, the amount of the fee on the date when the fee was established, the date when the fee was last adjusted under paragraph (1), or the date when the fee was last amended under subsection (c), whichever is latest.</text>
 </paragraph></subsection><subsection commented="no" id="H08EABA2211664187AF01B23C36F3BC60"><enum>(c)</enum><header>Amendments to schedule</header><text>In addition to the adjustments required by subsection (b), the Commission shall by rule amend the schedule of application fees established under this section if the Commission determines that the schedule requires amendment—</text>
 <paragraph id="H7E66E5D5240A4F8183BDADA1226A3ED5"><enum>(1)</enum><text>so that such fees reflect increases or decreases in the costs of processing applications at the Commission; or</text>
 </paragraph><paragraph id="HF29134654CB14843AEF7077C4C4500BD"><enum>(2)</enum><text>so that such schedule reflects the consolidation or addition of new categories of applications.</text> </paragraph></subsection><subsection id="H3A55CD77F357466AA7F24F484985B5F3"><enum>(d)</enum><header>Exceptions</header> <paragraph id="H40223A498E44444BB0F8586C319A22D7"><enum>(1)</enum><header>Parties to which fees are not applicable</header><text display-inline="yes-display-inline">The application fees established under this section shall not be applicable to—</text>
 <subparagraph id="HAAA44763350F4A4CB740325E301F9710"><enum>(A)</enum><text>a governmental entity;</text> </subparagraph><subparagraph id="HEDFE68D622634FE4805F1275DC060B5C"><enum>(B)</enum><text>a nonprofit entity licensed in the Local Government, Police, Fire, Highway Maintenance, Forestry-Conservation, Public Safety, or Special Emergency Radio radio services; or</text>
 </subparagraph><subparagraph id="H64FB087586FF43D7BA7930849E140087"><enum>(C)</enum><text display-inline="yes-display-inline">a noncommercial radio station or noncommercial television station.</text> </subparagraph></paragraph><paragraph commented="no" id="H0956A28BE66A4193B8B892EF002C0228"><enum>(2)</enum><header>Cost of collection</header><text display-inline="yes-display-inline">If, in the judgment of the Commission, the cost of collecting an application fee established under this section would exceed the amount collected, the Commission may by rule eliminate such fee.</text>
 </paragraph></subsection><subsection id="HD415DFA642824FC9BA99DB6AE7D9E5FB"><enum>(e)</enum><header>Deposit of collections</header><text display-inline="yes-display-inline">Moneys received from application fees established under this section shall be deposited in the general fund of the Treasury.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HEB31781E8BEC45338F5D2C1588D5188C"><enum>(b)</enum><header>Regulatory fees</header><text display-inline="yes-display-inline">Section 9 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/159">47 U.S.C. 159</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HE7A0FD68064C4656B462A4DD5DCEC096" style="OLC"> <section id="H7C0889BFD28741F48DC3F326584B35EE"><enum>9.</enum><header>Regulatory fees</header> <subsection id="HDFC2592228924F2DBEC7B6833FF7E211"><enum>(a)</enum><header>General authority</header><text display-inline="yes-display-inline">The Commission shall assess and collect regulatory fees to recover the costs of carrying out the activities described in section 6(a) only to the extent, and in the total amounts, provided for in Appropriations Acts.</text>
 </subsection><subsection id="HEAF396AC7A0247A69D34D5AA4E5EE418"><enum>(b)</enum><header>Establishment of schedule</header><text>The Commission shall assess and collect regulatory fees at such rates as the Commission shall establish in a schedule of regulatory fees that will result in the collection, in each fiscal year, of an amount that can reasonably be expected to equal the amounts described in subsection (a) with respect to such fiscal year.</text>
							</subsection><subsection id="H5F55AA8823FE40BAB659353B3CF0C994"><enum>(c)</enum><header>Adjustment of schedule</header>
 <paragraph id="H11560422FBEF4FB5916900E429D311C4"><enum>(1)</enum><header>In general</header><text>For each fiscal year, the Commission shall by rule adjust the schedule of regulatory fees established under this section to—</text>
 <subparagraph id="H81CD330789D04223A41637B7B387A7A6"><enum>(A)</enum><text>reflect unexpected increases or decreases in the number of units subject to the payment of such fees; and</text>
 </subparagraph><subparagraph id="H038372BDE39549CFBDD0347C92821A48"><enum>(B)</enum><text>result in the collection of the amount required by subsection (b).</text> </subparagraph></paragraph><paragraph id="H81C205C376694CD0A247E4345FAD4136"><enum>(2)</enum><header>Rounding</header><text display-inline="yes-display-inline">In making adjustments under this subsection, the Commission may round fees to the nearest $5 increment.</text>
 </paragraph></subsection><subsection id="H714B4C5B6C77446DA07793641D5A4802"><enum>(d)</enum><header>Amendments to schedule</header><text display-inline="yes-display-inline">In addition to the adjustments required by subsection (c), the Commission shall by rule amend the schedule of regulatory fees established under this section if the Commission determines that the schedule requires amendment so that such fees reflect the full-time equivalent number of employees within the bureaus and offices of the Commission, adjusted to take into account factors that are reasonably related to the benefits provided to the payor of the fee by the Commission’s activities. In making an amendment under this subsection, the Commission may not change the total amount of regulatory fees required by subsection (b) to be collected in a fiscal year.</text>
							</subsection><subsection id="H7EE2F3FB4FD54038BDBD3C5B3BEEDFF4"><enum>(e)</enum><header>Exceptions</header>
 <paragraph id="H25727E3402C043C3AA6BDB7F79DC18D1"><enum>(1)</enum><header>Parties to which fees are not applicable</header><text display-inline="yes-display-inline">The regulatory fees established under this section shall not be applicable to—</text> <subparagraph id="H177DA7AE304D45ADBECF1EDD13C6EA4C"><enum>(A)</enum><text>a governmental entity or nonprofit entity;</text>
 </subparagraph><subparagraph id="HB33274FF6AD54AE3811DA4E4231C913C"><enum>(B)</enum><text>an amateur radio operator licensee under part 97 of the Commission’s rules (47 CFR part 97); or</text> </subparagraph><subparagraph id="HCF0BE0C7D08646C68F1A3C0D488EEEC2"><enum>(C)</enum><text display-inline="yes-display-inline">a noncommercial radio station or noncommercial television station.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H3F14453530CB40CEBCD0EA979B3CEF24"><enum>(2)</enum><header>Cost of collection</header><text>If, in the judgment of the Commission, the cost of collecting a regulatory fee established under this section from a party would exceed the amount collected from such party, the Commission may exempt such party from paying such fee.</text>
								</paragraph></subsection><subsection commented="no" id="HD4C2A8B5D0604F58A2132FA4CADC729A"><enum>(f)</enum><header>Deposit of collections</header>
 <paragraph commented="no" id="H80609D01D7844F9FA459D02A0A7760E8"><enum>(1)</enum><header>In general</header><text>Amounts received from fees authorized by this section shall be deposited as an offsetting collection in, and credited to, the account through which funds are made available to carry out the activities described in section 6(a).</text>
 </paragraph><paragraph commented="no" id="H7DD7CDD5955443C2AE1DC0517C5D1291"><enum>(2)</enum><header>Deposit of excess collections</header><text>Any regulatory fees collected in excess of the total amount of fees provided for in Appropriations Acts for a fiscal year shall be deposited in the general fund of the Treasury of the United States for the sole purpose of deficit reduction.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HCF9FD54F881247C1A15D073E96C738B6"><enum>(c)</enum><header>Provisions applicable to application and regulatory fees</header><text display-inline="yes-display-inline">Title I of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.) is amended by inserting after section 9 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H536DE4CBCCE14B9CB5145EDEE5F33157" style="OLC">
						<section id="H86B37FDE8DB14D7AA29EF80E4C3916AE"><enum>9A.</enum><header>Provisions applicable to application and regulatory fees</header>
 <subsection id="H160D1B73A1EC498BBACB9EC574E72CFA"><enum>(a)</enum><header>Judicial review prohibited</header><text>Any adjustment or amendment to a schedule of fees under subsection (b) or (c) of section 8 or subsection (c) or (d) of section 9 is not subject to judicial review.</text>
 </subsection><subsection id="H2F832FDCB843483482D12790E0F3159E"><enum>(b)</enum><header>Notice to Congress</header><text>The Commission shall transmit to Congress notification—</text> <paragraph id="H564CE429767B4C288B683F13EC8E0A8D"><enum>(1)</enum><text>of any adjustment under section 8(b) or 9(c) immediately upon the adoption of such adjustment; and</text>
 </paragraph><paragraph id="H42BBC9DE9C004BF4B2BFE2B47190F8AC"><enum>(2)</enum><text>of any amendment under section 8(c) or 9(d) not later than 90 days before the effective date of such amendment.</text>
								</paragraph></subsection><subsection id="H4EA50D0DC5EA4A7F938E9555A99BF1E5"><enum>(c)</enum><header>Enforcement</header>
 <paragraph id="H3084224F5B6F4B2A859E31BAA2399502"><enum>(1)</enum><header>Penalties for late payment</header><text>The Commission shall by rule prescribe an additional penalty for late payment of fees under section 8 or 9. Such additional penalty shall be 25 percent of the amount of the fee that was not paid in a timely manner.</text>
 </paragraph><paragraph id="H35E3F163F2FB421A8797CF9C9D65FB03"><enum>(2)</enum><header>Interest on unpaid fees and penalties</header><text display-inline="yes-display-inline">The Commission shall charge interest, at a rate determined under section 3717 of title 31, United States Code, on a fee under section 8 or 9 or an additional penalty under this subsection that is not paid in a timely manner. Such section 3717 shall not otherwise apply with respect to such a fee or penalty.</text>
 </paragraph><paragraph id="H5B6BBDADBC364873811A65AD312D8D0F"><enum>(3)</enum><header>Dismissal of applications or filings</header><text>The Commission may dismiss any application or other filing for failure to pay in a timely manner any fee under section 8 or 9 or any interest or additional penalty under this subsection.</text>
								</paragraph><paragraph id="H82A8CC01D1B8472A95470D1A974DE76B"><enum>(4)</enum><header>Revocations</header>
 <subparagraph id="HB91F45C6EF72487598B2D61AB9667051"><enum>(A)</enum><header>In general</header><text>In addition to or in lieu of the penalties and dismissals authorized by this subsection, the Commission may revoke any instrument of authorization held by any licensee that has not paid in a timely manner a regulatory fee assessed under section 9 or any related interest or penalty.</text>
 </subparagraph><subparagraph id="HD78D0DFA00CB4E23AD8D9703F2D6ABEB"><enum>(B)</enum><header>Notice</header><text>Revocation action may be taken by the Commission under this paragraph after notice of the Commission’s intent to take such action is sent to the licensee by registered mail, return receipt requested, at the licensee’s last known address. The notice shall provide the licensee at least 30 days to either pay the fee, interest, and any penalty or show cause why the fee, interest, or penalty does not apply to the licensee or should otherwise be waived or payment deferred.</text>
									</subparagraph><subparagraph id="HFCBEDA995CCD4947905B8CF14FEE3B09"><enum>(C)</enum><header>Hearing</header>
 <clause id="H0A3278B1E3FE47DAACEC3E2069C71574"><enum>(i)</enum><header>Generally not required</header><text>A hearing is not required under this paragraph unless the licensee’s response presents a substantial and material question of fact.</text>
 </clause><clause id="H2782CB97A2A543138F69ECD894B2AAEF"><enum>(ii)</enum><header>Evidence and burdens</header><text>In any case where a hearing is conducted under this paragraph, the hearing shall be based on written evidence only, and the burden of proceeding with the introduction of evidence and the burden of proof shall be on the licensee.</text>
 </clause><clause id="HA5ABC088A68D4D6BB4E9F50A10B61A1B"><enum>(iii)</enum><header>Costs</header><text>Unless the licensee substantially prevails in the hearing, the Commission may assess the licensee for the costs of such hearing.</text>
 </clause></subparagraph><subparagraph id="H6C92352A2DE447388774BC595ED9EF64"><enum>(D)</enum><header>Opportunity to pay prior to revocation</header><text>Any Commission order adopted under this paragraph shall determine the amount due, if any, and provide the licensee with at least 30 days to pay that amount or have its authorization revoked.</text>
 </subparagraph><subparagraph id="H8E9EAC8498554A10A1C0CA575BC0D85F"><enum>(E)</enum><header>Finality</header><text>No order of revocation under this paragraph shall become final until the licensee has exhausted its right to judicial review of such order under section 402(b)(5).</text>
 </subparagraph></paragraph></subsection><subsection id="HA31CFE69D0F84681B859CEE16ECE7BA8"><enum>(d)</enum><header>Waiver, Reduction, and Deferment</header><text>The Commission may waive, reduce, or defer payment of a fee under section 8 or 9 or an interest charge or penalty under this section in any specific instance for good cause shown, where such action would promote the public interest.</text>
 </subsection><subsection id="H343510E4EAB64E90AA3A37EB6A3F88D9"><enum>(e)</enum><header>Payment rules</header><text display-inline="yes-display-inline">The Commission shall by rule permit payment—</text> <paragraph id="H1AE38A0A6C80448FA6449AE0239D2C22"><enum>(1)</enum><text>in the case of fees under section 8 or 9 in large amounts, by installments; and</text>
 </paragraph><paragraph id="HA4F5348295ED4F7DBDED2846E73921ED"><enum>(2)</enum><text>in the case of fees under section 8 or 9 in small amounts, in advance for a number of years not to exceed the term of the license held by the payor.</text>
 </paragraph></subsection><subsection commented="no" id="H8425A919553A40ACB8D6484120729379"><enum>(f)</enum><header>Accounting System</header><text>The Commission shall develop accounting systems necessary to make the amendments authorized by sections 8(c) and 9(d).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="H87C50601CA844D5ABE013817481EA386"><enum>(d)</enum><header>Transitional rules</header>
 <paragraph commented="no" id="H499773CA2A444031B8B46506DAAB4500"><enum>(1)</enum><header>Application fees</header><text display-inline="yes-display-inline">An application fee established under section 8 of the Communications Act of 1934, as such section is in effect on the day before the effective date described in section 103 of this Act, shall remain in effect under section 8 of the Communications Act of 1934, as amended by subsection (a) of this section, until such time as the Commission adjusts or amends such fee under subsection (b) or (c) of such section 8, as so amended.</text>
 </paragraph><paragraph commented="no" id="H5F06A8D1DB7E4E03B37919394531D079"><enum>(2)</enum><header>Regulatory fees</header><text display-inline="yes-display-inline">A regulatory fee established under section 9 of the Communications Act of 1934, as such section is in effect on the day before the effective date described in section 103 of this Act, shall remain in effect under section 9 of the Communications Act of 1934, as amended by subsection (b) of this section, until such time as the Commission adjusts or amends such fee under subsection (c) or (d) of such section 9, as so amended.</text>
					</paragraph></subsection><subsection id="H992C5DE07D384CE9B3FA0080744CCCC9"><enum>(e)</enum><header>Rulemaking To amend schedule of regulatory fees</header>
 <paragraph id="HE67A81EEC8EC473DBA04296062419DBB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the effective date described in section 103, the Commission shall complete a rulemaking proceeding under subsection (d) of section 9 of the Communications Act of 1934, as amended by subsection (b) of this section.</text>
 </paragraph><paragraph id="H08EABD6BFBE6405F8CD31000BBE4EE05"><enum>(2)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">If the Commission has not completed the rulemaking proceeding required by paragraph (1) by the date that is 6 months after the effective date described in section 103, the Commission shall submit to Congress a report on the progress of such rulemaking proceeding.</text>
 </paragraph></subsection></section><section id="H99D4D5579FFE4B5CBFE9533B3DE651AD"><enum>103.</enum><header>Effective date</header><text display-inline="no-display-inline">This title and the amendments made by this title shall take effect on October 1, 2018.</text> </section></title><title id="HD6727798B0AD4755B4AE649B79BE67C4"><enum>II</enum><header>Application of Antideficiency Act</header> <section id="H5DBC152ACBF045188DD49F06F60B5336"><enum>201.</enum><header>Application of Antideficiency Act to Universal Service Program</header><text display-inline="no-display-inline">Section 302 of <external-xref legal-doc="public-law" parsable-cite="pl/108/494">Public Law 108–494</external-xref> (118 Stat. 3998) is amended by striking <quote>December 31, 2018</quote> each place it appears and inserting <quote>December 31, 2019</quote>.</text>
			</section></title><title id="H417034DB4FF946B2961727191E1996F0"><enum>III</enum><header>Securing Access to Networks in Disasters</header>
 <section id="HDE39197AFBE14FB997CBD14E9D46B6C2"><enum>301.</enum><header>Study on network resiliency</header><text display-inline="no-display-inline">Not later than 36 months after the date of enactment of this Act, the Commission shall submit to Congress, and make publically available on the Commission’s website, a study on the public safety benefits and technical feasibility and cost of—</text>
 <paragraph id="H6B8C1EC3FC2B475B83F69FC476713452"><enum>(1)</enum><text>making telecommunications service provider-owned WiFi access points, and other communications technologies operating on unlicensed spectrum, available to the general public for access to 9–1–1 services, without requiring any login credentials, during times of emergency when mobile service is unavailable;</text>
 </paragraph><paragraph id="H2E58C160A4D64933805616B632A2C23D"><enum>(2)</enum><text>the provision by non-telecommunications service provider-owned WiFi access points of public access to 9–1–1 services during times of emergency when mobile service is unavailable; and</text>
 </paragraph><paragraph id="H01A9F73CD6AB4FCAA1D7F1E841C9931E"><enum>(3)</enum><text>other alternative means of providing the public with access to 9–1–1 services during times of emergency when mobile service is unavailable.</text>
 </paragraph></section><section id="H27D77CEE0AFC43A48D135C387066F8E5"><enum>302.</enum><header>Access to essential service providers during federally declared emergencies</header><text display-inline="no-display-inline">Section 427(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5189e">42 U.S.C. 5189e(a)</external-xref>) is amended—</text>
 <paragraph id="HD9F23CA79A0E4F95AEB3AA9847E8A625"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="HED021F989F084B6D9CAF7F39AC0DB9E8"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>telecommunications service</quote> and inserting <quote>wireline or mobile telephone service, Internet access service, radio or television broadcasting, cable service, or direct broadcast satellite service</quote>;</text>
 </subparagraph><subparagraph id="HFA3C77407FFE42198E83E23793A9C228"><enum>(B)</enum><text>in subparagraph (E), by striking the semicolon and inserting <quote>; or</quote>; and</text> </subparagraph><subparagraph id="H9248286B711941C58F710037D8F45C5C"><enum>(C)</enum><text>by redesignating subparagraphs (A) through (E) as clauses (i) through (v), respectively; and</text>
 </subparagraph></paragraph><paragraph id="H6D2BF360A72B49C28CBF78321BEA7054"><enum>(2)</enum><text>by striking <quote>(1) provides</quote> and inserting <quote>(1)(A) provides</quote>.</text> </paragraph></section><section id="HBA06DBD26C734F2CBED35AA97C3D7F73"><enum>303.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this title—</text>
 <paragraph id="H721271BA12DC411E8771736817448291"><enum>(1)</enum><text>the term <term>mobile service</term> means commercial mobile service (as defined in section 332 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332</external-xref>)) or commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>));</text>
 </paragraph><paragraph id="H888A599164A648C4870EACFDB359298A"><enum>(2)</enum><text>the term <term>WiFi access point</term> means wireless Internet access using the standard designated as 802.11 or any variant thereof; and</text> </paragraph><paragraph id="H81A247F65E0F41288A496E1655182F92"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>times of emergency</term> means either an emergency as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>), or an emergency as declared by the governor of a State or territory of the United States.</text>
				</paragraph></section></title><title id="HEEFFAEA7BDBB485BA9A65E433A4BD6A1"><enum>IV</enum><header>FCC Consolidated Reporting</header>
 <section id="H7FFA40044C10492AA0BF6FD13364C674" section-type="subsequent-section"><enum>401.</enum><header>Communications marketplace report</header><text display-inline="no-display-inline">Title I of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4DB0750A0A1F4A50B43FAF741BCE8FD2" style="OLC">
					<section id="H19099955A39142368A203E46B1CF9F26"><enum>13.</enum><header>Communications marketplace report</header>
 <subsection id="H702B46DEF62E4212B97F8D6155F7582F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the last quarter of every even-numbered year, the Commission shall publish on its website and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the state of the communications marketplace.</text>
 </subsection><subsection id="H9F9FD12052784911B892B5D9434D50EF"><enum>(b)</enum><header>Contents</header><text>Each report required by subsection (a) shall—</text> <paragraph id="HF7570B8D2639424D82695737FC2EE5F3"><enum>(1)</enum><text display-inline="yes-display-inline">assess the state of competition in the communications marketplace, including competition to deliver voice, video, audio, and data services among providers of telecommunications, providers of commercial mobile service (as defined in section 332), multichannel video programming distributors (as defined in section 602), broadcast stations, providers of satellite communications, Internet service providers, and other providers of communications services;</text>
 </paragraph><paragraph id="H2FC71FE5B3B34DF0876F74AEA0428F40"><enum>(2)</enum><text display-inline="yes-display-inline">assess the state of deployment of communications capabilities, including advanced telecommunications capability (as defined in section 706 of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/1302">47 U.S.C. 1302</external-xref>)), regardless of the technology used for such deployment;</text>
 </paragraph><paragraph id="H529EA43A04D04227A9E5CAB44AF2B9A1"><enum>(3)</enum><text display-inline="yes-display-inline">assess whether laws, regulations, regulatory practices (whether those of the Federal Government, States, political subdivisions of States, Indian tribes or tribal organizations (as such terms are defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)), or foreign governments), or demonstrated marketplace practices pose a barrier to competitive entry into the communications marketplace or to the competitive expansion of existing providers of communications services;</text>
 </paragraph><paragraph id="H7DD78CDE06DB44D88D0FF4DFF92A93DC"><enum>(4)</enum><text display-inline="yes-display-inline">describe the agenda of the Commission for the next 2-year period for addressing the challenges and opportunities in the communications marketplace that were identified through the assessments under paragraphs (1) through (3); and</text>
 </paragraph><paragraph id="H0F847FEBA5CA4CA89AA134C444A695A6"><enum>(5)</enum><text display-inline="yes-display-inline">describe the actions that the Commission has taken in pursuit of the agenda described pursuant to paragraph (4) in the previous report submitted under this section.</text>
 </paragraph></subsection><subsection id="HDA5B33E2E5E04EB39CE94BC4DB744E62"><enum>(c)</enum><header>Extension</header><text display-inline="yes-display-inline">If the President designates a Commissioner as Chairman of the Commission during the last quarter of an even-numbered year, the portion of the report required by subsection (b)(4) may be published on the website of the Commission and submitted to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate as an addendum during the first quarter of the following odd-numbered year.</text>
						</subsection><subsection id="HC5D9E0DC4EEB4FB080BB5CFC1B109CF1"><enum>(d)</enum><header>Special requirements</header>
 <paragraph id="HEC8B1E020B4E4D559ED93A2EF0506A05"><enum>(1)</enum><header>Assessing competition</header><text display-inline="yes-display-inline">In assessing the state of competition under subsection (b)(1), the Commission shall consider all forms of competition, including the effect of intermodal competition, facilities-based competition, and competition from new and emergent communications services, including the provision of content and communications using the Internet.</text>
 </paragraph><paragraph id="HCA5047F7D33F4ED48FC8DF6579C590DB"><enum>(2)</enum><header>Assessing deployment</header><text display-inline="yes-display-inline">In assessing the state of deployment under subsection (b)(2), the Commission shall compile a list of geographical areas that are not served by any provider of advanced telecommunications capability.</text>
 </paragraph><paragraph id="HA34BECDB61564660BF155E1AEC1DC549"><enum>(3)</enum><header>Considering small businesses</header><text display-inline="yes-display-inline">In assessing the state of competition under subsection (b)(1) and regulatory barriers under subsection (b)(3), the Commission shall consider market entry barriers for entrepreneurs and other small businesses in the communications marketplace in accordance with the national policy under section 257(b).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HF3AE1C19AFD74B419A845A4CCFBE9011"><enum>402.</enum><header>Consolidation of redundant reports; conforming amendments</header>
 <subsection id="HB054A89185F242E5A9E7F16C72A589B4"><enum>(a)</enum><header>ORBIT Act Report</header><text display-inline="yes-display-inline">Section 646 of the Communications Satellite Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/47/765e">47 U.S.C. 765e</external-xref>; 114 Stat. 57) is repealed.</text> </subsection><subsection id="HD144A4F64780422DB3E1E02863484B3D"><enum>(b)</enum><header>Satellite Competition Report</header><text display-inline="yes-display-inline">Section 4 of <external-xref legal-doc="public-law" parsable-cite="pl/109/34">Public Law 109–34</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/47/703">47 U.S.C. 703</external-xref>) is repealed.</text>
 </subsection><subsection id="HAC91425B35D341A89F7018ED7B5C432F"><enum>(c)</enum><header>International Broadband Data Report</header><text>Section 103(b)(1) of the Broadband Data Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1303">47 U.S.C. 1303(b)(1)</external-xref>) is amended by striking <quote>the assessment and report</quote> and all that follows through <quote>Federal Communications Commission</quote> and inserting <quote>its report under section 13 of the Communications Act of 1934, the Federal Communications Commission</quote>.</text>
 </subsection><subsection id="HF76503CE721643D6BF5F0A87DD8E5BA2"><enum>(d)</enum><header>Status of Competition in the Market for the Delivery of Video Programming Report</header><text display-inline="yes-display-inline">Section 628 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/548">47 U.S.C. 548</external-xref>) is amended—</text> <paragraph id="HAA21D38AA9824CFCB0C393C38FC47F1F"><enum>(1)</enum><text>by striking subsection (g);</text>
 </paragraph><paragraph id="H495CF9354505400FBBC5204093B4937F"><enum>(2)</enum><text>by redesignating subsection (j) as subsection (g); and</text> </paragraph><paragraph id="H5C6906EB010648DDBC9BB9EE2D2BDB0A"><enum>(3)</enum><text>by transferring subsection (g) (as redesignated) so that it appears after subsection (f).</text>

					</paragraph></subsection></section><section id="HBF1DCEA2CFEE45588DBF713977DD6A6C"><enum>502.</enum><header>Authority of Chief Information Officer</header>
 <subsection id="HE7181150D6AA49C8A551654C9C86F6EA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall ensure that the Chief Information Officer of the Commission has a significant role in—</text>
 <paragraph id="H4A80A0BD47FB475482C4281D771F576D"><enum>(1)</enum><text>the decision-making process for annual and multi-year planning, programming, budgeting, and execution decisions, related reporting requirements, and reports related to information technology;</text>
 </paragraph><paragraph id="H18661DAD0BBB4310BE6248F75E685CE4"><enum>(2)</enum><text>the management, governance, and oversight processes related to information technology; and</text> </paragraph><paragraph id="HF7F504BECE3043AEB434273186A6D41D"><enum>(3)</enum><text>the hiring of personnel with information technology responsibilities.</text>
 </paragraph></subsection><subsection id="H13B47DF8FC574868849F850C790CBBFD"><enum>(b)</enum><header>CIO approval</header><text display-inline="yes-display-inline">The Chief Information Officer of the Commission, in consultation with the Chief Financial Officer of the Commission and budget officials, shall specify and approve the allocation of amounts appropriated to the Commission for information technology, consistent with the provisions of appropriations Acts, budget guidelines, and recommendations from the Director of the Office of Management and Budget.</text>
				</subsection></section><section id="H19100538D86C49ACBA823513D2DC39FD" section-type="subsequent-section"><enum>503.</enum><header>Spoofing prevention</header>
				<subsection id="H7CD4107B21F147E1B46AFA10E8769652"><enum>(a)</enum><header>Expanding and clarifying prohibition on misleading or inaccurate caller identification information</header>
 <paragraph id="H9B1D90B47932483CA0AE29777EE7204E"><enum>(1)</enum><header>Communications from outside the United States</header><text>Section 227(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(1)</external-xref>) is amended by striking <quote>in connection with any telecommunications service or IP-enabled voice service</quote> and inserting <quote>or any person outside the United States if the recipient is within the United States, in connection with any voice service or text messaging service</quote>.</text>
 </paragraph><paragraph id="HF7919062694741C8933F6C07B3DFDEA1"><enum>(2)</enum><header>Coverage of text messages and voice services</header><text>Section 227(e)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)</external-xref>) is amended—</text> <subparagraph id="H8801F17AB19041309F2E183C4A0B1F1F"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>telecommunications service or IP-enabled voice service</quote> and inserting <quote>voice service or a text message sent using a text messaging service</quote>;</text>

 </clause><clause id="HF636889C3FCC4E0BBB6625D7D49ED2B8"><enum>(ii)</enum><text>includes a short message service (commonly referred to as <quote>SMS</quote>) message and a multimedia message service (commonly referred to as <quote>MMS</quote>) message; and</text> </clause><clause id="HC1DC8ADC4392461C91F2D0C2A244C10A"><enum>(iii)</enum><text>does not include—</text>
 <subclause id="H146F234D6DDA45039C4FF233425E7DE0"><enum>(I)</enum><text>a real-time, two-way voice or video communication; or</text> </subclause><subclause id="HF8CA30EAED974D879315FD81B0AB085D"><enum>(II)</enum><text>a message sent over an IP-enabled messaging service to another user of the same messaging service, except a message described in clause (ii).</text>
 </subclause></clause></subparagraph><subparagraph id="HB51ACFEC6A754CAD9696FE3FCCFE4328"><enum>(D)</enum><header>Text messaging service</header><text>The term <term>text messaging service</term> means a service that enables the transmission or receipt of a text message, including a service provided as part of or in connection with a voice service.</text>
 </subparagraph><subparagraph id="HA676C98E1F0940EB979AE004A672658C"><enum>(E)</enum><header>Voice service</header><text>The term <term>voice service</term>—</text> <clause id="H7343F5F37F7A4BF2934D1771042797C7"><enum>(i)</enum><text>means any service that is interconnected with the public switched telephone network and that furnishes voice communications to an end user using resources from the North American Numbering Plan or any successor to the North American Numbering Plan adopted by the Commission under section 251(e)(1); and</text>
 </clause><clause id="H63E84EE17F894117A5439097609A2C96"><enum>(ii)</enum><text>includes transmissions from a telephone facsimile machine, computer, or other device to a telephone facsimile machine.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H089AC6BA064E40C19B5C29406D84BC1D"><enum>(3)</enum><header>Technical amendment</header><text>Section 227(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)</external-xref>) is amended in the heading by inserting <quote><header-in-text level="subsection">Misleading or</header-in-text></quote> before <quote><header-in-text level="subsection">Inaccurate</header-in-text></quote>.</text>
					</paragraph><paragraph id="H6FBF92FD0EEE4725A52FE26D78B0388B"><enum>(4)</enum><header>Regulations</header>
 <subparagraph id="H9F4703F164584D6897C636DCC741527E"><enum>(A)</enum><header>In general</header><text>Section 227(e)(3)(A) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(3)(A)</external-xref>) is amended by striking <quote>Not later than 6 months after the date of enactment of the Truth in Caller ID Act of 2009, the Commission</quote> and inserting <quote>The Commission</quote>.</text>
 </subparagraph><subparagraph id="H8AD01BBDAF6D493A9681BE4EA08DBE20"><enum>(B)</enum><header>Deadline</header><text>The Commission shall prescribe regulations to implement the amendments made by this subsection not later than 18 months after the date of enactment of this Act.</text>
 </subparagraph></paragraph><paragraph id="H5E7792F2DE914494B679CFF3F1617E54"><enum>(5)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date that is 6 months after the date on which the Commission prescribes regulations under paragraph (4).</text>
					</paragraph></subsection><subsection id="HA4E0991322674C49BE698899DB24F4A0"><enum>(b)</enum><header>Consumer education materials on how To avoid scams that rely upon misleading or inaccurate caller
			 identification information</header>
 <paragraph id="H2CBE3B02B1024D6A812E29A5236817DC"><enum>(1)</enum><header>Development of materials</header><text>Not later than 1 year after the date of enactment of this Act, the Commission, in coordination with the Federal Trade Commission, shall develop consumer education materials that provide information about—</text>
 <subparagraph id="HA35864FB69A542F8B3D277639C29E970"><enum>(A)</enum><text>ways for consumers to identify scams and other fraudulent activity that rely upon the use of misleading or inaccurate caller identification information; and</text>
 </subparagraph><subparagraph id="H2B7C8C665E95428E9402311AABF07336"><enum>(B)</enum><text>existing technologies, if any, that a consumer can use to protect against such scams and other fraudulent activity.</text>
 </subparagraph></paragraph><paragraph id="H40F4044ACE214719855EA0C87ADE9D1A"><enum>(2)</enum><header>Contents</header><text>In developing the consumer education materials under paragraph (1), the Commission shall—</text> <subparagraph id="H3AE417F6544143CE913921B088928551"><enum>(A)</enum><text>identify existing technologies, if any, that can help consumers guard themselves against scams and other fraudulent activity that rely upon the use of misleading or inaccurate caller identification information, including—</text>
 <clause id="HC06FD60FA6544577880075979E507B7C"><enum>(i)</enum><text>descriptions of how a consumer can use the technologies to protect against such scams and other fraudulent activity; and</text>
 </clause><clause id="H1F664B4158D546AF8C9D21B596C6DD7C"><enum>(ii)</enum><text>details on how consumers can access and use the technologies; and</text> </clause></subparagraph><subparagraph id="H2E06F5B4D9C04FD2AFEA7ECD488B5847"><enum>(B)</enum><text>provide other information that may help consumers identify and avoid scams and other fraudulent activity that rely upon the use of misleading or inaccurate caller identification information.</text>
 </subparagraph></paragraph><paragraph id="H7E967718023E4B09BE61844EF0F25B4D"><enum>(3)</enum><header>Updates</header><text>The Commission shall ensure that the consumer education materials required under paragraph (1) are updated on a regular basis.</text>
 </paragraph><paragraph id="HC59BE5520A5E49AAAC9C732132090C02"><enum>(4)</enum><header>Website</header><text>The Commission shall include the consumer education materials developed under paragraph (1) on its website.</text>
					</paragraph></subsection><subsection id="HB63BA40FB5964863A6296E920E785048"><enum>(c)</enum><header>GAO report on combating the fraudulent provision of misleading or inaccurate caller identification
			 information</header>
 <paragraph id="H20CA35AE213844D8AE76982F01C3C852"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct a study of the actions the Commission and the Federal Trade Commission have taken to combat the fraudulent provision of misleading or inaccurate caller identification information, and the additional measures that could be taken to combat such activity.</text>
 </paragraph><paragraph id="HB5ED6BEBC4DC4215BEF0EBF52E939A9B"><enum>(2)</enum><header>Required considerations</header><text>In conducting the study under paragraph (1), the Comptroller General shall examine—</text> <subparagraph id="H6F8FC8842BD7480996D6EF795FC10ABF"><enum>(A)</enum><text>trends in the types of scams that rely on misleading or inaccurate caller identification information;</text>
 </subparagraph><subparagraph id="HDF715852BCFE4D099209D400C78D96A2"><enum>(B)</enum><text>previous and current enforcement actions by the Commission and the Federal Trade Commission to combat the practices prohibited by section 227(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(1)</external-xref>);</text>
 </subparagraph><subparagraph id="H1819913B32814D76964AA0D3BC2887C7"><enum>(C)</enum><text>current efforts by industry groups and other entities to develop technical standards to deter or prevent the fraudulent provision of misleading or inaccurate caller identification information, and how such standards may help combat the current and future provision of misleading or inaccurate caller identification information; and</text>
 </subparagraph><subparagraph id="H89E54978D0474F9783AD07DE7D2541BC"><enum>(D)</enum><text>whether there are additional actions the Commission, the Federal Trade Commission, and Congress should take to combat the fraudulent provision of misleading or inaccurate caller identification information.</text>
 </subparagraph></paragraph><paragraph id="H62CBA0B69CB14602ADB498C28D640D55"><enum>(3)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Comptroller General shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the findings of the study under paragraph (1), including any recommendations regarding combating the fraudulent provision of misleading or inaccurate caller identification information.</text>
 </paragraph></subsection><subsection id="H5216CF964C15406DABA3F94C718101A1"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section, or the amendments made by this section, shall be construed to modify, limit, or otherwise affect any rule or order adopted by the Commission in connection with—</text>
 <paragraph id="H0E7EA8B4C4DD4E41A0E1462FC3EC2C99"><enum>(1)</enum><text>the Telephone Consumer Protection Act of 1991 (<external-xref legal-doc="public-law" parsable-cite="pl/102/243">Public Law 102–243</external-xref>; 105 Stat. 2394) or the amendments made by that Act; or</text>
 </paragraph><paragraph id="H9E25A811D842418088A3C881BE41E55D"><enum>(2)</enum><text>the CAN–SPAM Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/15/7701">15 U.S.C. 7701</external-xref> et seq.).</text> </paragraph></subsection></section><section id="HF699CEF2FC684F21864B49B18B89BD70"><enum>504.</enum><header>Report on promoting broadband Internet access service for veterans</header> <subsection id="HBE7890EEFD4F479886A3981E2929DA2A"><enum>(a)</enum><header>Veteran defined</header><text>In this section, the term <term>veteran</term> has the meaning given the term in section 101 of title 38, United States Code.</text>
 </subsection><subsection id="H4D3F1A1188B8494BBCA763ECAA54B1A8"><enum>(b)</enum><header>Report required</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall submit to Congress a report on promoting broadband Internet access service for veterans, in particular low-income veterans and veterans residing in rural areas. In such report, the Commission shall—</text>
 <paragraph id="H88240ACE03144AB894EDC5D909C08A64"><enum>(1)</enum><text>examine such access and how to promote such access; and</text> </paragraph><paragraph id="H1ECBF60159DB4F79A7B413A002BCDCD4"><enum>(2)</enum><text>provide findings and recommendations for Congress with respect to such access and how to promote such access.</text>
 </paragraph></subsection><subsection id="H264D426FD94544DCA74867AF055F68FF"><enum>(c)</enum><header>Public notice and opportunity To comment</header><text display-inline="yes-display-inline">In preparing the report required by subsection (b), the Commission shall provide the public with notice and an opportunity to comment on broadband Internet access service for veterans, in particular low-income veterans and veterans residing in rural areas, and how to promote such access.</text>
				</subsection></section><section id="H912B8AEB5AD14B1F9E33C9B0613EC13B"><enum>505.</enum><header>Methodology for collection of mobile service coverage data</header>
 <subsection id="H857FDF19ECEB487ABBB2EC3BBB44D0BC"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="HA121EECBC9AF46E5B217CF858D25853F"><enum>(1)</enum><text>the term <term>commercial mobile data service</term> has the meaning given the term in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>);</text>
 </paragraph><paragraph id="H5EB8051C522B44E28F45E335EF0E1392"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>commercial mobile service</term> has the meaning given the term in section 332(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(d)</external-xref>);</text>
 </paragraph><paragraph id="H8391EE720DEF43C7960AF84FE1A4EF37"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>coverage data</term> means, if commercial mobile service or commercial mobile data service is available, general information about the service, which may include available speed tiers, radio frequency signal levels, and network and performance characteristics; and</text>
 </paragraph><paragraph id="H2F14983CDAA14766BC7CF6BCD806E305"><enum>(4)</enum><text>the term <term>Universal Service program</term> means the universal service support mechanisms established under section 254 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>) and the regulations issued under that section.</text>
 </paragraph></subsection><subsection id="HF00091F441414238B17DDD78B67D247C"><enum>(b)</enum><header>Methodology established</header><text display-inline="yes-display-inline">Not later than 180 days after the conclusion of the Mobility Fund Phase II Auction, the Commission shall promulgate regulations to establish a methodology that shall apply to the collection of coverage data by the Commission for the purposes of—</text>
 <paragraph id="H6A291182C4F64DA687CE7EEE93E5234D"><enum>(1)</enum><text display-inline="yes-display-inline">the Universal Service program; or</text> </paragraph><paragraph id="H6257B40E1D2E4BDB83A432C53AD48285"><enum>(2)</enum><text>any other similar program.</text>
 </paragraph></subsection><subsection id="H68B06CB49FA24580A701405B2EAB0D72"><enum>(c)</enum><header>Requirements</header><text>The methodology established under subsection (b) shall—</text> <paragraph commented="no" id="H829E7F5EBDD34E3DAF981723B0AE537C"><enum>(1)</enum><text display-inline="yes-display-inline">contain standard definitions for different available technologies such as 2G, 3G, 4G, and 4G LTE;</text>
 </paragraph><paragraph id="HF62BA64416F94D7094E02F9CDFF73FBC"><enum>(2)</enum><text>enhance the consistency and robustness of how the data are collected by different parties;</text> </paragraph><paragraph id="H9A18F13E3DD945BDAB0FBCE939844722"><enum>(3)</enum><text display-inline="yes-display-inline">improve the validity and reliability of coverage data; and</text>
 </paragraph><paragraph id="H77354D22E89E44149DA134B10FFEDDCC"><enum>(4)</enum><text>increase the efficiency of coverage data collection.</text> </paragraph></subsection></section><section id="H674D89F823884836BD714D03C380F067"><enum>506.</enum><header>Accuracy of dispatchable location for 9–1–1 calls</header> <subsection id="HD314C8609EA54DB3AB316E178BD94F63"><enum>(a)</enum><header>Proceeding required</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Commission shall conclude a proceeding to consider adopting rules to ensure that the dispatchable location is conveyed with a 9–1–1 call, regardless of the technological platform used and including with calls from multi-line telephone systems (as defined in section 6502 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1471">47 U.S.C. 1471</external-xref>)).</text>
 </subsection><subsection id="HC83C90310ACD426D9879D3E63ABD0CAD"><enum>(b)</enum><header>Relationship to other proceedings</header><text display-inline="yes-display-inline">In conducting the proceeding required by subsection (a), the Commission may consider information and conclusions from other Commission proceedings regarding the accuracy of the dispatchable location for a 9–1–1 call, but nothing in this section shall be construed to require the Commission to reconsider any information or conclusion from a proceeding regarding the accuracy of the dispatchable location for a 9–1–1 call in which the Commission has adopted rules or issued an order before the date of the enactment of this Act.</text>
 </subsection><subsection id="H9B44109165204F2FA240606FDFEC5677"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H456BC9C834D243369809D10EF8E6AB37"><enum>(1)</enum><header>9–1–1 call</header><text display-inline="yes-display-inline">The term <quote>9–1–1 call</quote> means a voice call that is placed, or a message that is sent by other means of communication, to a public safety answering point (as defined in section 222 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/222">47 U.S.C. 222</external-xref>)) for the purpose of requesting emergency services.</text>
 </paragraph><paragraph id="HC74815DBB92E4C47BF9FAD2D109FD1D2"><enum>(2)</enum><header>Dispatchable location</header><text display-inline="yes-display-inline">The term <quote>dispatchable location</quote> means the street address of the calling party, and additional information such as room number, floor number, or similar information necessary to adequately identify the location of the calling party.</text>
					</paragraph></subsection></section><section commented="no" id="HC5A225B5FD3E4533B7B9F759A6F00B39"><enum>507.</enum><header>NTIA study on interagency process following cybersecurity incidents</header>
 <subsection id="HA543BA6440134B9B9771AA95DA52A792"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary of Commerce for Communications and Information shall complete a study on how the National Telecommunications and Information Administration can best coordinate the interagency process following cybersecurity incidents.</text>
 </subsection><subsection id="H1418390D11D741429D69D4FE9DB98787"><enum>(b)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Assistant Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report detailing the findings and recommendations of the study conducted under subsection (a).</text>
				</subsection></section><section commented="no" id="H1AEAA43122E14C9997B36122B3E6BD54"><enum>508.</enum><header>Tribal digital access</header>
				<subsection id="HF9407A827F1343C78DBA32E55B4574C5"><enum>(a)</enum><header>Tribal broadband data report</header>
 <paragraph id="HB9965408926D48C3925124B85BFC36E0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report evaluating broadband coverage in Indian country (as defined in section 1151 of title 18, United States Code) and on land held by a Native Corporation pursuant to the Alaska Native Claims Settlement Act.</text>
 </paragraph><paragraph id="H9E0C1F6C296D40EBB3F2AE8856746D5B"><enum>(2)</enum><header>Required assessments</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall include the following:</text> <subparagraph id="H48A2428E9A334086A13EEB7E37595BEB"><enum>(A)</enum><text display-inline="yes-display-inline">An assessment of areas of Indian country (as so defined) and land held by a Native Corporation pursuant to the Alaska Native Claims Settlement Act that have adequate broadband coverage.</text>
 </subparagraph><subparagraph id="HEC934FA5FDB8414CB3D4BFF044FFBE02"><enum>(B)</enum><text display-inline="yes-display-inline">An assessment of unserved areas of Indian country (as so defined) and land held by a Native Corporation pursuant to the Alaska Native Claims Settlement Act.</text>
 </subparagraph></paragraph></subsection><subsection id="H4F8578D933ED4A1F8A36F56D64DF84BF"><enum>(b)</enum><header>Tribal broadband proceeding</header><text display-inline="yes-display-inline">Not later than 30 months after the date of the enactment of this Act, the Commission shall complete a proceeding to address the unserved areas identified in the report under subsection (a).</text>
 </subsection></section><section id="H9FAC37EF0A7A416FAFB4DFCD4212F02D"><enum>509.</enum><header>Terms of office and vacancies</header><text display-inline="no-display-inline">Section 4(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/154">47 U.S.C. 154(c)</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HD2E4B56C2B7648128F6C8184C2595E86" style="OLC"> <subsection id="HDBA78A766D0649FB9CF59B03C943DBD1"><enum>(c)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="HF2EBAABD16EB4268A1407FDBDB9C1E07"><enum>(1)</enum><text>A commissioner—</text>
 <subparagraph id="HC59CC65848EA418F976FD32A5E615A13" indent="up1"><enum>(A)</enum><text>shall be appointed for a term of 5 years;</text> </subparagraph><subparagraph id="HF9F1E203B6474B04901A9F9ABB4EB790" indent="up1"><enum>(B)</enum><text>except as provided in subparagraph (C), may continue to serve after the expiration of the fixed term of office of the commissioner until a successor is appointed and has been confirmed and taken the oath of office; and</text>
 </subparagraph><subparagraph id="HC870C6A1070B4D3B868B08A0D49EAE76" indent="up1"><enum>(C)</enum><text>may not continue to serve after the expiration of the session of Congress that begins after the expiration of the fixed term of office of the commissioner.</text>
 </subparagraph></paragraph><paragraph id="H1308EAFDF57449E6A278D2FD8939C9D4" indent="up1"><enum>(2)</enum><text>Any person chosen to fill a vacancy in the Commission—</text> <subparagraph id="H073E907663524146811CBA270DD1D45C"><enum>(A)</enum><text>shall be appointed for the unexpired term of the commissioner that the person succeeds;</text>
 </subparagraph><subparagraph id="HA15F531DB1C14C6B836AE282C3B80946"><enum>(B)</enum><text>except as provided in subparagraph (C), may continue to serve after the expiration of the fixed term of office of the commissioner that the person succeeds until a successor is appointed and has been confirmed and taken the oath of office; and</text>
 </subparagraph><subparagraph id="H54D2D02846DC4696A3D677B58F814826"><enum>(C)</enum><text>may not continue to serve after the expiration of the session of Congress that begins after the expiration of the fixed term of office of the commissioner that the person succeeds.</text>
 </subparagraph></paragraph><paragraph id="H248260739CE249878A9FC94505DDDE79" indent="up1"><enum>(3)</enum><text>No vacancy in the Commission shall impair the right of the remaining commissioners to exercise all the powers of the Commission.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HD83D9C08E92845C499C458D73B322C5B"><enum>510.</enum><header>Submission of copy of certain documents to Congress</header><text display-inline="no-display-inline">Section 4 of the Communications Act of 1934, as amended by section 402(h), is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H50A707F5A9E44FBD9D7EF8A440700DAA" style="OLC">
					<subsection id="H283A95D27951443390D6CBA0FD6269F8"><enum>(o)</enum><header>Budget estimates and requests; legislative recommendations, testimony, and comments on legislation;
			 semiannual reports</header>
 <paragraph id="H494B730E3F0948569E24BCCAB574D7D0"><enum>(1)</enum><header>Budget estimates and requests</header><text>If the Commission submits any budget estimate or request to the President or the Office of Management and Budget, the Commission shall concurrently transmit a copy of that estimate or request to Congress.</text>
						</paragraph><paragraph id="H4826B2746EA44EAEB2C7C7E6810BE507"><enum>(2)</enum><header>Legislative recommendations, testimony, and comments on legislation</header>
 <subparagraph id="H6CB0F475ED9149FF8659950A05A62A8C"><enum>(A)</enum><header>In general</header><text>If the Commission submits any legislative recommendations, testimony, or comments on legislation to the President or the Office of Management and Budget, the Commission shall concurrently transmit a copy thereof to Congress.</text>
 </subparagraph><subparagraph id="H394894893148400F8B0DC9D732E61B03"><enum>(B)</enum><header>Prohibition</header><text>No officer or agency of the United States may require the Commission to submit legislative recommendations, testimony, or comments on legislation to any officer or agency of the United States for approval, comments, or review prior to the submission of the recommendations, testimony, or comments to Congress.</text>
							</subparagraph></paragraph><paragraph id="HD1E95AE131AC4138A410D456A81C3F17"><enum>(3)</enum><header>Office of Inspector General semiannual reports</header>
 <subparagraph id="H93B76AB30D464271B7081FE658B90379"><enum>(A)</enum><header>In general</header><text>Notwithstanding <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /5">section 5(b)</external-xref> of the Inspector General Act of 1978 (5 U.S.C. App.), the Inspector General of the Commission shall concurrently submit each semiannual report required under such section 5(b) to the Commission and to the appropriate committees or subcommittees of Congress.</text>
 </subparagraph><subparagraph id="H71F67997B4E24D32833EC06CB29682FC"><enum>(B)</enum><header>Rule of construction</header><text>Nothing in subparagraph (A) shall be construed to modify the requirement for the Commission to submit to the appropriate committees or subcommittees of Congress each such semiannual report together with a report by the Commission under such section 5(b).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section commented="no" display-inline="no-display-inline" id="H4FF351F1723A49E780E5971712F6B723" section-type="subsequent-section"><enum>511.</enum><header>Joint board recommendation</header><text display-inline="no-display-inline">The Commission may not modify, amend, or change its rules or regulations for universal service support payments to implement the February 27, 2004, recommendations of the Federal-State Joint Board on Universal Service regarding single connection or primary line restrictions on universal service support payments.</text>
 </section><section id="H837152D3A92F49A0AF8AE0888287062B"><enum>512.</enum><header>Disclaimer for press releases regarding notices of apparent liability</header><text display-inline="no-display-inline">The Commission shall include in any press release regarding the issuance of a notice of apparent liability under section 503(b)(4) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503(b)(4)</external-xref>) a disclaimer informing consumers that—</text>
 <paragraph id="HC00C1F5A7C1B42E6842F8AC02FEBE7CB"><enum>(1)</enum><text display-inline="yes-display-inline">the issuance of a notice of apparent liability should be treated only as allegations; and</text> </paragraph><paragraph id="H4DF3F4E955CA4A528836A79CF010BF7D"><enum>(2)</enum><text display-inline="yes-display-inline">the amount of any forfeiture penalty proposed in a notice of apparent liability represents the maximum penalty that the Commission may impose for the violations alleged in the notice of apparent liability.</text>
				</paragraph></section><section id="H2D65FCD32FCA457AB874CCBB0528DB98"><enum>513.</enum><header>Reports related to spectrum auctions</header>
 <subsection id="H197403C0580547C8A0AF484C598FC68A"><enum>(a)</enum><header>Estimate of upcoming auctions</header><text>Section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H393F2804FB3F47A69BA2B8B02520BA15" style="OLC">
						<paragraph id="HBBEDBCF5F36A4036B6607DB88CF357CA"><enum>(18)</enum><header>Estimate of upcoming auctions</header>
 <subparagraph id="H7A126F6488B64B88A1618DC11DF7664D"><enum>(A)</enum><text>Not later than September 30, 2018, and annually thereafter, the Commission shall make publicly available an estimate of what systems of competitive bidding authorized under this subsection may be initiated during the upcoming 12-month period.</text>
 </subparagraph><subparagraph id="HC31316590D69455B959B78421EE4A0EB"><enum>(B)</enum><text>The estimate under subparagraph (A) shall, to the extent possible, identify the bands of frequencies the Commission expects to be included in each such system of competitive bidding.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HAF23498439524E6F828A1FDBBD2529E0"><enum>(b)</enum><header>Auction expenditure justification report</header><text>Not later than April 1, 2019, and annually thereafter, the Commission shall provide to the appropriate committees of Congress a report containing a detailed justification for the use of proceeds retained by the Commission under section 309(j)(8)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)(B)</external-xref>) for the costs of developing and implementing the program required by section 309(j) of that Act.</text>
 </subsection><subsection id="HCE059AB17480448D893797C2E53A98FB"><enum>(c)</enum><header>Definition</header><text>For purposes of this section, the term <term>appropriate committees of Congress</term> means—</text> <paragraph id="H7622FE699DDA43FD8EFB7073B2ECED4A"><enum>(1)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text>
 </paragraph><paragraph id="HCB8269C6CA744C20AF7479AE1167468B"><enum>(2)</enum><text>the Committee on Appropriations of the Senate;</text> </paragraph><paragraph id="HD7C614740EB24B9EBE711BB27D24FF96"><enum>(3)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text>
 </paragraph><paragraph id="HCD033F973CBE4CD38A760A57D4EC1CFD"><enum>(4)</enum><text>the Committee on Appropriations of the House of Representatives.</text> </paragraph></subsection></section></title><title id="HEF7E644DBD74411D85E632CD9D6FE7A0"><enum>VI</enum><header>Viewer Protection</header> <section id="H87FB1E780D174CBBBF50A6A313571861"><enum>601.</enum><header>Reserve source for payment of TV broadcaster relocation costs</header> <subsection id="H675EB421BFFF4E7AA31120BC57822FEA"><enum>(a)</enum><header>Establishment of fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund to be known as the Broadcast Repack Fund.</text>
				</subsection><subsection id="H5778665DBDA44726B8924B72C198BA2D"><enum>(b)</enum><header>Availability of funds</header>
 <paragraph id="H81C9A2F7FC844A2796A992940F90E1C2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the Commission makes the certification described in paragraph (2), amounts in the Broadcast Repack Fund shall be available to the Commission to make reimbursements pursuant to subsection (b)(4)(A)(i) or (b)(4)(A)(ii) of section 6403 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1452">47 U.S.C. 1452</external-xref>).</text>
 </paragraph><paragraph id="H3034E02033E842E09A900C83E30F34FB"><enum>(2)</enum><header>Certification</header><text display-inline="yes-display-inline">The certification described in this paragraph is a certification from the Commission to the Secretary of the Treasury that the funds available in the TV Broadcaster Relocation Fund established under subsection (d) of such section are likely to be insufficient to reimburse reasonably incurred costs described in subsection (b)(4)(A)(i) or (b)(4)(A)(ii) of such section.</text>
 </paragraph><paragraph id="HA1FAD7CA8F664C8BACA59F328B960C4A"><enum>(3)</enum><header>Availability for payments after April 13, 2020</header><text display-inline="yes-display-inline">Notwithstanding subsection (b)(4)(D) of such section, the Commission may make payments pursuant to subsection (b)(4)(A)(i) or (b)(4)(A)(ii) of such section from the Broadcast Repack Fund after April 13, 2020, if, before making any such payments after such date, the Commission submits to Congress a certification that such payments are necessary to reimburse reasonably incurred costs described in such subsection.</text>
					</paragraph></subsection><subsection id="H4CACB0DDAC624B9E945691BF8EB36E1C"><enum>(c)</enum><header>Unused funds rescinded and deposited into the general fund of the Treasury</header>
 <paragraph id="HA53486E8C3AB4A9998DEF066DE9BACB9"><enum>(1)</enum><header>Rescission and deposit</header><text>If any unobligated amounts remain in the Broadcast Repack Fund after the date described in paragraph (2), such amounts shall be rescinded and deposited into the general fund of the Treasury, where such amounts shall be dedicated for the sole purpose of deficit reduction.</text>
 </paragraph><paragraph id="H68596F5BA20344BDB73178F99F2B8C15"><enum>(2)</enum><header>Date described</header><text>The date described in this paragraph is the earlier of—</text> <subparagraph id="H4C61572C5AA242BB9C34709A4FCD7CE4"><enum>(A)</enum><text display-inline="yes-display-inline">the date of a certification by the Commission under paragraph (3) that all reimbursements pursuant to subsections (b)(4)(A)(i) and (b)(4)(A)(ii) of such section 6403 have been made; or</text>
 </subparagraph><subparagraph id="HFEAA34BB6AED4170AB8EB2AE60FA457B"><enum>(B)</enum><text>July 3, 2022.</text> </subparagraph></paragraph><paragraph id="HBA34B6EBF27F4F6C9CA193ACA1D0DC25"><enum>(3)</enum><header>Certification</header><text display-inline="yes-display-inline">If all reimbursements pursuant to subsections (b)(4)(A)(i) and (b)(4)(A)(ii) of such section 6403 have been made before July 3, 2022, the Commission shall submit to the Secretary of the Treasury a certification that all such reimbursements have been made.</text>
 </paragraph></subsection><subsection id="HBFC5FC30B6BA41FEB7D649440B766EA5"><enum>(d)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">The amount of auction proceeds that the salaries and expenses account of the Commission is required to retain under section 309(j)(8)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)(B)</external-xref>), including from the proceeds of the forward auction under section 6403 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1452">47 U.S.C. 1452</external-xref>), shall be sufficient to cover the administrative costs incurred by the Commission in making any reimbursements out of the Broadcast Repack Fund.</text>
				</subsection></section><section id="H6B2D23E5D1474B22A9C03BCCC266A431"><enum>602.</enum><header>Payment of relocation costs of television translator stations and low power television stations</header>
				<subsection id="H7983A2EDED7E4725B37D94B42502A626"><enum>(a)</enum><header>Payment required</header>
 <paragraph id="H8395520881A64070940EE517D60A24C7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From amounts made available under subsection (b)(2), the Commission shall reimburse costs reasonably incurred by a television translator station or low power television station on or after January 1, 2017, in order for such station to relocate its television service from one channel to another channel or otherwise modify its facility as a result of the reorganization of broadcast television spectrum under subsection (b) of section 6403 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1452">47 U.S.C. 1452</external-xref>). Only stations that are eligible to file and do file an application in the Commission’s Special Displacement Window are eligible to seek reimbursement under this paragraph.</text>
 </paragraph><paragraph commented="no" id="H54ABFD2933A04013BC49901ED8EF001C"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Commission may not make reimbursements under paragraph (1) for lost revenues.</text> </paragraph><paragraph id="H858548DC5FEF47EDA9AE2F98D3E4EED9"><enum>(3)</enum><header>Duplicative payments prohibited</header><text display-inline="yes-display-inline">In the case of a low power television station that has been accorded primary status as a Class A television licensee under section 73.6001(a) of title 47, Code of Federal Regulations—</text>
 <subparagraph id="H05FDA91F4ED84B099F235EDE1CF43A09"><enum>(A)</enum><text display-inline="yes-display-inline">if the licensee of such station has received reimbursement with respect to such station under subsection (b)(4)(A)(i) of such section 6403 (including from amounts made available under section 601 of this title), or from any other source, such station may not receive reimbursement under paragraph (1); and</text>
 </subparagraph><subparagraph id="HFA9798C48A114143834C4B211223A417"><enum>(B)</enum><text display-inline="yes-display-inline">if such station has received reimbursement under paragraph (1), the licensee of such station may not receive reimbursement with respect to such station under subsection (b)(4)(A)(i) of such section 6403.</text>
 </subparagraph></paragraph><paragraph id="H0800AE53B1024942A6097AA13D2D7A96"><enum>(4)</enum><header>Additional limitation</header><text display-inline="yes-display-inline">The Commission may not make reimbursement under paragraph (1) for costs incurred to resolve mutually exclusive applications, including costs incurred in any auction of available channels.</text>
					</paragraph></subsection><subsection id="H4BAE58FFBF9C4758B683BD0E0BB8C667"><enum>(b)</enum><header>Funding</header>
 <paragraph id="HA587C4AF94114008A14ED52CB880807F"><enum>(1)</enum><header>Establishment of fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund to be known as the Translator and Low Power Station Relocation Fund.</text>
					</paragraph><paragraph id="H7E11BCFA04BB4338B8080B992DE8F62A"><enum>(2)</enum><header>Availability of funds</header>
 <subparagraph id="H67EE3D64998542208F8EF17AA174D313"><enum>(A)</enum><header>In general</header><text>Amounts in the Translator and Low Power Station Relocation Fund shall be available to the Commission to make payments required by subsection (a)(1).</text>
 </subparagraph><subparagraph id="H8282417B52C745CEA79600EA04D0A5B7"><enum>(B)</enum><header>Availability after April 13, 2020</header><text display-inline="yes-display-inline">Amounts in the Translator and Low Power Station Relocation Fund shall not be available to the Commission to make payments required by subsection (a)(1) after April 13, 2020, unless, before making any such payments after such date, the Commission submits to Congress a certification that such payments are necessary to reimburse costs reasonably incurred by a television translator station or low power television station on or after January 1, 2017, in order for such station to relocate its television service from one channel to another channel or otherwise modify its facility as a result of the reorganization of broadcast television spectrum under subsection (b) of section 6403 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1452">47 U.S.C. 1452</external-xref>).</text>
						</subparagraph></paragraph><paragraph id="HE51DD888F25B4B57BF72CA3CB9A74402"><enum>(3)</enum><header>Unused funds rescinded and deposited into the general fund of the Treasury</header>
 <subparagraph id="H49BA3D37B72E4D3AB3D0771A4853FE7A"><enum>(A)</enum><header>Rescission and deposit</header><text display-inline="yes-display-inline">If any unobligated amounts remain in the Translator and Low Power Station Relocation Fund after the date described in subparagraph (B), such amounts shall be rescinded and deposited into the general fund of the Treasury, where such amounts shall be dedicated for the sole purpose of deficit reduction.</text>
 </subparagraph><subparagraph id="H1401EE355AAB485AAEEE502975BB17A7"><enum>(B)</enum><header>Date described</header><text>The date described in this subparagraph is the earlier of—</text> <clause id="HC561DE80E7FC4144A50FF886E05826E3"><enum>(i)</enum><text display-inline="yes-display-inline">the date of a certification by the Commission under subparagraph (C) that all reimbursements pursuant to subsection (a)(1) have been made; or</text>
 </clause><clause id="H12A464668FA0423EA3AAFCC9BCD7E6CF"><enum>(ii)</enum><text>July 3, 2023.</text> </clause></subparagraph><subparagraph id="H9D5E0860758E4AA5B9D59996B26A7F64"><enum>(C)</enum><header>Certification</header><text display-inline="yes-display-inline">If all reimbursements pursuant to subsection (a)(1) have been made before July 3, 2023, the Commission shall submit to the Secretary of the Treasury a certification that all such reimbursements have been made.</text>

 </subsection><subsection id="HD9B9AA08FC32427B833A201E81849FC6"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HB9CBD9597F4D49419FF97BDF9E640D8C"><enum>(1)</enum><header>Low power television station</header><text display-inline="yes-display-inline">The term <quote>low power television station</quote> means a low power TV station (as defined in section 74.701 of title 47, Code of Federal Regulations) that was licensed and transmitting for at least 9 of the 12 months prior to April 13, 2017. For purposes of the preceding sentence, the operation of analog and digital companion facilities may be combined.</text>
 </paragraph><paragraph id="HB6B5A371AD3F4FA58A9385D4E7901026"><enum>(2)</enum><header>Television translator station</header><text display-inline="yes-display-inline">The term <quote>television translator station</quote> means a television broadcast translator station (as defined in section 74.701 of title 47, Code of Federal Regulations) that was licensed and transmitting for at least 9 of the 12 months prior to April 13, 2017. For purposes of the preceding sentence, the operation of analog and digital companion facilities may be combined.</text>
					</paragraph></subsection></section><section id="H7B735ECB32D3407BB4D3ED8DB3D74DD0"><enum>603.</enum><header>Payment of relocation costs of FM broadcast stations</header>
				<subsection id="HE85C057C1E6A423CA13E94AEA9D2258E"><enum>(a)</enum><header>Payment required</header>
 <paragraph id="HBFADD5EB0D9E4BF6960474536541F11A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From amounts made available under subsection (b)(2), the Commission shall reimburse costs reasonably incurred by an FM broadcast station for facilities necessary for such station to reasonably minimize disruption of service as a result of the reorganization of broadcast television spectrum under subsection (b) of section 6403 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1452">47 U.S.C. 1452</external-xref>).</text>
 </paragraph><paragraph commented="no" id="H1C19125C080B463C8306E3D89048DF65"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Commission may not make reimbursements under paragraph (1) for lost revenues.</text> </paragraph><paragraph id="H7E40BCB476D24196900C47B6C4464C2A"><enum>(3)</enum><header>Duplicative payments prohibited</header><text display-inline="yes-display-inline">If an FM broadcast station has received a payment for interim facilities from the licensee of a television broadcast station that was reimbursed for such payment under subsection (b)(4)(A)(i) of such section 6403 (including from amounts made available under section 601 of this title), or from any other source, such FM broadcast station may not receive any reimbursements under paragraph (1).</text>
					</paragraph></subsection><subsection id="H83ED9ADBCC9D4060B5317B10827D8A8F"><enum>(b)</enum><header>Funding</header>
 <paragraph id="H89C1533BC7FA4E00B5972B4366568F28"><enum>(1)</enum><header>Establishment of fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund to be known as the FM Broadcast Station Relocation Fund.</text>
					</paragraph><paragraph id="HB87DBC94B7A447E3BEE92FDD3EF41FD6"><enum>(2)</enum><header>Availability of funds</header>
 <subparagraph id="H5F7ED08937994C06B9D4A8817E9988AE"><enum>(A)</enum><header>In general</header><text>Amounts in the FM Broadcast Station Relocation Fund shall be available to the Commission to make payments required by subsection (a)(1).</text>
 </subparagraph><subparagraph id="H2E2F78FF6ADC46F7BEB7C90B3B878509"><enum>(B)</enum><header>Availability after April 13, 2020</header><text display-inline="yes-display-inline">Amounts in the FM Broadcast Station Relocation Fund shall not be available to the Commission to make payments required by subsection (a)(1) after April 13, 2020, unless, before making any such payments after such date, the Commission submits to Congress a certification that such payments are necessary to reimburse costs reasonably incurred by an FM broadcast station for facilities necessary for such station to reasonably minimize disruption of service as a result of the reorganization of broadcast television spectrum under subsection (b) of section 6403 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1452">47 U.S.C. 1452</external-xref>).</text>
						</subparagraph></paragraph><paragraph id="HB2A79E9824C949B0951FB99604585E48"><enum>(3)</enum><header>Unused funds rescinded and deposited into the general fund of the Treasury</header>
 <subparagraph id="H33E60E51571849AE81D627FC4A960757"><enum>(A)</enum><header>Rescission and deposit</header><text display-inline="yes-display-inline">If any unobligated amounts remain in the FM Broadcast Station Relocation Fund after the date described in subparagraph (B), such amounts shall be rescinded and deposited into the general fund of the Treasury, where such amounts shall be dedicated for the sole purpose of deficit reduction.</text>
 </subparagraph><subparagraph id="H7FFDED78E8054A82B62FC318725CD751"><enum>(B)</enum><header>Date described</header><text>The date described in this subparagraph is the earlier of—</text> <clause id="HA15FC73ADAF54F86ADF0108FB162AA21"><enum>(i)</enum><text display-inline="yes-display-inline">the date of a certification by the Commission under subparagraph (C) that all reimbursements pursuant to subsection (a)(1) have been made; or</text>
 </clause><clause id="HBB63F328C1954E5895A6163A1974C1C4"><enum>(ii)</enum><text>July 3, 2022.</text> </clause></subparagraph><subparagraph id="H1173B8193AB64DA0880C62194A4433FC"><enum>(C)</enum><header>Certification</header><text display-inline="yes-display-inline">If all reimbursements pursuant to subsection (a)(1) have been made before July 3, 2022, the Commission shall submit to the Secretary of the Treasury a certification that all such reimbursements have been made.</text>
 </subparagraph></paragraph></subsection><subsection id="H98513361190543799FF55D5067BA8FD1"><enum>(c)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">The amount of auction proceeds that the salaries and expenses account of the Commission is required to retain under section 309(j)(8)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)(B)</external-xref>), including from the proceeds of the forward auction under section 6403 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1452">47 U.S.C. 1452</external-xref>), shall be sufficient to cover the administrative costs incurred by the Commission in making any reimbursements out of the FM Broadcast Station Relocation Fund.</text>
 </subsection><subsection id="H61DC4B1961D74C299A6AE8A05204E0E6"><enum>(d)</enum><header>FM broadcast station defined</header><text display-inline="yes-display-inline">In this section, the term <quote>FM broadcast station</quote> has the meaning given such term in section 73.310 of title 47, Code of Federal Regulations, and, for an FM translator, has the meaning given the term <quote>FM translator</quote> in section 74.1201 of such title.</text>
				</subsection></section><section commented="no" id="H2494FDAF0EDF4651813A7DB7AA1F87DF"><enum>604.</enum><header>Consumer education payment</header>
 <subsection id="HD78EE8C567554533A61B6E90250F947B"><enum>(a)</enum><header>Establishment of fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund to be known as the Broadcast Station Relocation Consumer Education Fund.</text>
 </subsection><subsection id="HBCE483DFD5634E25AFF005F8BF6D27BB"><enum>(b)</enum><header>Availability of funds</header><text display-inline="yes-display-inline">Amounts in the Broadcast Station Relocation Consumer Education Fund shall be available to the Commission to make payments solely for the purposes of consumer education relating to the reorganization of broadcast television spectrum under subsection (b) of section 6403 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1452">47 U.S.C. 1452</external-xref>).</text>
 </subsection><subsection id="H32AB57A25CAD41B7A84FC989E52584C8"><enum>(c)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">The amount of auction proceeds that the salaries and expenses account of the Commission is required to retain under section 309(j)(8)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)(B)</external-xref>), including from the proceeds of the forward auction under section 6403 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1452">47 U.S.C. 1452</external-xref>), shall be sufficient to cover the administrative costs incurred by the Commission in making any payments out of the Broadcast Station Relocation Consumer Education Fund.</text>
 </subsection></section><section id="H17B208AC4FD94854A9B8C16E52380368"><enum>605.</enum><header>Implementation and enforcement</header><text display-inline="no-display-inline">The Commission shall implement and enforce this title as if this title is a part of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.). A violation of this title, or a regulation promulgated under this title, shall be considered to be a violation of the Communications Act of 1934, or a regulation promulgated under such Act, respectively.</text>
 </section><section id="HF16C4A43C8534A59B622AA77B2492237"><enum>606.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this title shall alter the final transition phase completion date established by the Commission for full power and Class A television stations.</text>
			</section></title><title id="HB641143D539A4D62BC18488F8672AFCA"><enum>VII</enum><header>MOBILE NOW</header>
 <section commented="no" display-inline="no-display-inline" id="H0A6FC0E6C7CA4E5BAB4020A6627AE304" section-type="subsequent-section"><enum>701.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Making Opportunities for Broadband Investment and Limiting Excessive and Needless Obstacles to Wireless Act</short-title></quote> or the <quote><short-title>MOBILE NOW Act</short-title></quote>.</text>
 </section><section commented="no" display-inline="no-display-inline" id="HF893374618B346E89CB92317D81A3A36" section-type="subsequent-section"><enum>702.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph commented="no" display-inline="no-display-inline" id="H727F6EF07DF245B4AD113C9145790FF1"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HA080656D129D4FE9B72300E6119AF54B"><enum>(A)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2BE7191DDF824D3EBD6A7C7B40D6FADB"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H89706713B94D4240BF8F08777692D20F"><enum>(C)</enum><text display-inline="yes-display-inline">each committee of the Senate or of the House of Representatives with jurisdiction over a Federal entity affected by the applicable section in which the term appears.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7107B5142E9C42CFB38699EB2CFE4768"><enum>(2)</enum><header display-inline="yes-display-inline">Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Federal Communications Commission.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC050280A7D3041668180C22B8BB5B335"><enum>(3)</enum><header display-inline="yes-display-inline">Federal entity</header><text display-inline="yes-display-inline">The term <term>Federal entity</term> has the meaning given the term in section 113(l) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(l)</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA20615C1617C4C9191AC4FF33893A0CC"><enum>(4)</enum><header display-inline="yes-display-inline">NTIA</header><text display-inline="yes-display-inline">The term <term>NTIA</term> means the National Telecommunications and Information Administration of the Department of Commerce.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFC85B214B18647A4A6ED14A7ECE49369"><enum>(5)</enum><header display-inline="yes-display-inline">OMB</header><text display-inline="yes-display-inline">The term <term>OMB</term> means the Office of Management and Budget.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA188DD30B96648519A4B38A3612DFBAC"><enum>(6)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Commerce.</text>
				</paragraph></section><section id="H2EB9FD492A27431F8CA73C5C451D3C97"><enum>703.</enum><header>Identifying 255 megahertz</header>
				<subsection id="HAFCCA00B89F448D6AA23416D167A9788"><enum>(a)</enum><header>Requirements</header>
 <paragraph id="H8785A7EA40934FFEB80D7B696F318476"><enum>(1)</enum><header>In general</header><text>Not later than December 31, 2022, the Secretary, working through the NTIA, and the Commission shall identify a total of at least 255 megahertz of Federal and non-Federal spectrum for mobile and fixed wireless broadband use.</text>
 </paragraph><paragraph id="H15317CCA056E4957A1381544C78C0240"><enum>(2)</enum><header>Unlicensed and licensed use</header><text>Of the spectrum identified under paragraph (1), not less than—</text> <subparagraph id="H1D1689671DF64FC387A222C9A06DCBE8"><enum>(A)</enum><text>100 megahertz below the frequency of 8000 megahertz shall be identified for use on an unlicensed basis;</text>
 </subparagraph><subparagraph id="H7742EEBF9FA9429A8CDF166EA01B13FA"><enum>(B)</enum><text>100 megahertz below the frequency of 6000 megahertz shall be identified for use on an exclusive, licensed basis for commercial mobile use, pursuant to the Commission’s authority to implement such licensing in a flexible manner, and subject to potential continued use of such spectrum by incumbent Federal entities in designated geographic areas indefinitely or for such length of time stipulated in transition plans approved by the Technical Panel under section 113(h) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(h)</external-xref>) for those incumbent entities to be relocated to alternate spectrum; and</text>
 </subparagraph><subparagraph id="H1CE6D9F5B4C947C785CDF4C111C604E1"><enum>(C)</enum><text>55 megahertz below the frequency of 8000 megahertz shall be identified for use on either a licensed or unlicensed basis, or a combination of licensed and unlicensed.</text>
 </subparagraph></paragraph><paragraph id="HA4B09045729B415B9A7F74DB060E13F2"><enum>(3)</enum><header>Non-eligible spectrum</header><text>For purposes of satisfying the requirement under paragraph (1), the following spectrum shall not be counted:</text>
 <subparagraph id="H52146C3C873E4B64839A0A2B8F7C0E2A"><enum>(A)</enum><text>The frequencies between 1695 and 1710 megahertz.</text> </subparagraph><subparagraph id="H37D31A08CEA74A2AB2F8B5237028FAD0"><enum>(B)</enum><text>The frequencies between 1755 and 1780 megahertz.</text>
 </subparagraph><subparagraph id="H0632452B41884FAA869C6D26D04F6D08"><enum>(C)</enum><text>The frequencies between 2155 and 2180 megahertz.</text> </subparagraph><subparagraph id="HF8B61CE7CA6F4838A5D0E243C9C9AD69"><enum>(D)</enum><text>The frequencies between 3550 and 3700 megahertz.</text>
 </subparagraph><subparagraph id="H137F13F95B58463FBC715D6C14A840DA"><enum>(E)</enum><text>Spectrum that the Commission determines had more than de minimis mobile or fixed wireless broadband operations within the band on the day before the date of enactment of this Act.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HEEF440FBE5C549F08AC7576D0FF5C1B3"><enum>(4)</enum><header>Treatment of certain other spectrum</header><text display-inline="yes-display-inline">Spectrum identified pursuant to this section may include eligible spectrum, if any, identified after the date of enactment of this Act pursuant to title X of the Bipartisan Budget Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/74">Public Law 114–74</external-xref>).</text>
 </paragraph><paragraph commented="no" id="H32A640CEAF9649A48604AA4ABC2AB20A"><enum>(5)</enum><header>Spectrum made available on and after February <enum-in-header>11, 2016</enum-in-header></header><text display-inline="yes-display-inline">Any spectrum that has been made available for licensed or unlicensed use on and after February 11, 2016, and that otherwise satisfies the requirements of this section may be counted towards the requirements of this subsection.</text>
 </paragraph><paragraph id="HEE68E02771E84EAB945A3D6C2143C6B7"><enum>(6)</enum><header>Relocation prioritized over sharing</header><text>This section shall be carried out in accordance with section 113(j) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(j)</external-xref>).</text>
 </paragraph><paragraph id="H18985BE599FB4F7C92C085984C8280CC"><enum>(7)</enum><header>Considerations</header><text>In identifying spectrum for use under this section, the Secretary, working through the NTIA, and Commission shall consider—</text>
 <subparagraph id="HDA62C122E145462B98F0C747065ACA85"><enum>(A)</enum><text>the need to preserve critical existing and planned Federal Government capabilities;</text> </subparagraph><subparagraph id="HA6F00D9927874C04A4649C8950E394BF"><enum>(B)</enum><text>the impact on existing State, local, and tribal government capabilities;</text>
 </subparagraph><subparagraph id="H25FDA60B40584C9B9952324D36E4DD23"><enum>(C)</enum><text>the international implications;</text> </subparagraph><subparagraph id="H1C8A0D7106CD4CD3A7D6E31B193E4B46"><enum>(D)</enum><text>the need for appropriate enforcement mechanisms and authorities; and</text>
 </subparagraph><subparagraph id="HEA45EA2D81F3428B9C6DD3E290D08AF5"><enum>(E)</enum><text>the importance of the deployment of wireless broadband services in rural areas of the United States.</text>
 </subparagraph></paragraph></subsection><subsection id="HA6A1061C979F4D60A83DEE7415D9E596"><enum>(b)</enum><header>Rules of construction</header><text>Nothing in this section shall be construed—</text> <paragraph id="H6AD897B93BBE4E629F32D5AE4563A9B1"><enum>(1)</enum><text>to impair or otherwise affect the functions of the Director of OMB relating to budgetary, administrative, or legislative proposals;</text>
 </paragraph><paragraph id="H7A319711CCE540CBB13EFA8698008A2D"><enum>(2)</enum><text>to require the disclosure of classified information, law enforcement sensitive information, or other information that must be protected in the interest of national security; or</text>
 </paragraph><paragraph id="H3F46857447914C26AEE761C16CD52807"><enum>(3)</enum><text>to affect any requirement under section 156 of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/921">47 U.S.C. 921</external-xref> note), as added by section 1062(a) of the National Defense Authorization Act for Fiscal Year 2000, or any other relevant statutory requirement applicable to the reallocation of Federal spectrum.</text>
					</paragraph></subsection></section><section id="HE34C584DEE634EB59417564C427C8D68"><enum>704.</enum><header>Millimeter wave spectrum</header>
 <subsection id="H065177BAE6FA4E62925E2D9E41B09D1E"><enum>(a)</enum><header>FCC proceeding</header><text>Not later than 2 years after the date of enactment of this Act, the Commission shall publish a notice of proposed rulemaking to consider service rules to authorize mobile or fixed terrestrial wireless operations, including for advanced mobile service operations, in the radio frequency band between 42000 and 42500 megahertz.</text>
 </subsection><subsection id="HA94484D6E5E84BF398AFA4BD3151FB73"><enum>(b)</enum><header>Considerations</header><text>In conducting a rulemaking under subsection (a), the Commission shall—</text> <paragraph id="HAB5B60F47629419BAECBEE18A85241DD"><enum>(1)</enum><text>consider how the band described in subsection (a) may be used to provide commercial wireless broadband service, including whether—</text>
 <subparagraph id="HE57CB214482241B7A96006D5986C2E97"><enum>(A)</enum><text>such spectrum may be best used for licensed or unlicensed services, or some combination thereof; and</text>
 </subparagraph><subparagraph id="H24B01C10E41144B78EF70BAE6C0799FC"><enum>(B)</enum><text>to permit additional licensed operations in such band on a shared basis; and</text> </subparagraph></paragraph><paragraph id="H8ADB1CEE914C4386BCB2A047ACAA39A0"><enum>(2)</enum><text>include technical characteristics under which the band described in subsection (a) may be employed for mobile or fixed terrestrial wireless operations, including any appropriate coexistence requirements.</text>
 </paragraph></subsection><subsection commented="no" id="HB5AB6605CAE0463EAF69BA896F385B60"><enum>(c)</enum><header>Spectrum made available on and after February <enum-in-header>11, 2016</enum-in-header></header><text display-inline="yes-display-inline">Any spectrum that has been made available for licensed or unlicensed use on or after February 11, 2016, and that otherwise satisfies the requirements of section 703 may be counted towards the requirements of section 703(a).</text>
				</subsection></section><section id="H05DA00A05816459392C736FEC77F58BD"><enum>705.</enum><header>3 gigahertz spectrum</header>
 <subsection id="HD82023F436AE482BB07CB3486C7028A3"><enum>(a)</enum><header>Between 3100 megahertz and 3550 megahertz</header><text>Not later than 24 months after the date of enactment of this Act, and in consultation with the Commission and the head of each affected Federal agency (or a designee thereof), the Secretary, working through the NTIA, shall submit to the Commission and the appropriate committees of Congress a report evaluating the feasibility of allowing commercial wireless services, licensed or unlicensed, to share use of the frequencies between 3100 megahertz and 3550 megahertz.</text>
 </subsection><subsection id="H6B1F3057D8154EF2882ED4441835F0E0"><enum>(b)</enum><header>Between 3700 megahertz and 4200 megahertz</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, after notice and an opportunity for public comment, and in consultation with the Secretary, working through the NTIA, and the head of each affected Federal agency (or a designee thereof), the Commission shall submit to the Secretary and the appropriate committees of Congress a report evaluating the feasibility of allowing commercial wireless services, licensed or unlicensed, to use or share use of the frequencies between 3700 megahertz and 4200 megahertz.</text>
 </subsection><subsection id="H7B80ECFB2FB7410982415843B436E764"><enum>(c)</enum><header>Requirements</header><text>A report under subsection (a) or (b) shall include the following:</text> <paragraph id="HE6D9BF0EC63F4E8AA6F334B4FF1BCA72"><enum>(1)</enum><text>An assessment of the operations of Federal entities that operate Federal Government stations authorized to use the frequencies described in that subsection.</text>
 </paragraph><paragraph id="H661703E8F9DE440A93D7717948E12C88"><enum>(2)</enum><text>An assessment of the possible impacts of such sharing on Federal and non-Federal users already operating on the frequencies described in that subsection.</text>
 </paragraph><paragraph id="HF65165C30C974D2AB9BD7441CCC1EFCE"><enum>(3)</enum><text>The criteria that may be necessary to ensure shared licensed or unlicensed services would not cause harmful interference to Federal or non-Federal users already operating in the frequencies described in that subsection.</text>
 </paragraph><paragraph id="H0BC7C6E13FEB49A4B2BEE92C3A63A340"><enum>(4)</enum><text>If such sharing is feasible, an identification of which of the frequencies described in that subsection are most suitable for sharing with commercial wireless services through the assignment of new licenses by competitive bidding, for sharing with unlicensed operations, or through a combination of licensing and unlicensed operations.</text>
 </paragraph></subsection><subsection id="H9FC3348899B04A539566F26676A3E0CC"><enum>(d)</enum><header>Commission action</header><text display-inline="yes-display-inline">The Commission, in consultation with the NTIA, shall seek public comment on the reports required under subsections (a) and (b), including regarding the bands identified in such report as feasible pursuant to subsection (c)(4).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H218F17E7C66A4C909C3D632ABB4A2525" section-type="subsequent-section"><enum>706.</enum><header display-inline="yes-display-inline">Broadband infrastructure deployment</header>
 <subsection commented="no" display-inline="no-display-inline" id="H8C42800BF06E48CB9D681065B4A716B2"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="H544DE0534D6B463E900D05DF2E13D42F"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate state agency</header><text display-inline="yes-display-inline">The term <term>appropriate State agency</term> means a State governmental agency that is recognized by the executive branch of the State as having the experience necessary to evaluate and carry out projects relating to the proper and effective installation and operation of broadband infrastructure.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0629FF507DE5493099C3520E75B63785"><enum>(2)</enum><header display-inline="yes-display-inline">Broadband infrastructure</header><text display-inline="yes-display-inline">The term <term>broadband infrastructure</term> means any buried, underground, or aerial facility, and any wireless or wireline connection, that enables users to send and receive voice, video, data, graphics, or any combination thereof.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53918F1127D645C79EBC526B587A1C60"><enum>(3)</enum><header display-inline="yes-display-inline">Broadband infrastructure entity</header><text display-inline="yes-display-inline">The term <term>broadband infrastructure entity</term> means any entity that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H0918F315AF0D4D43879907A69CB8EF0F"><enum>(A)</enum><text display-inline="yes-display-inline">installs, owns, or operates broadband infrastructure; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H113F4FA1FED64BE2A23EDFF015F955C8"><enum>(B)</enum><text display-inline="yes-display-inline">provides broadband services in a manner consistent with the public interest, convenience, and necessity, as determined by the State.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD8EE41FB7FA942A28DDD69C3C30AC4AB"><enum>(4)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H2C14152E96E44A22B737D49BD258B9B7"><enum>(A)</enum><text display-inline="yes-display-inline">a State;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H21DBDA65556E45A0951EE5B3F7048C00"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6B46E6ADC3D04A4BAE9F4E6FDDB825C5"><enum>(C)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA95C9216AC4944B0B454E8170DEEBD83"><enum>(b)</enum><header display-inline="yes-display-inline">Broadband infrastructure deployment</header><text display-inline="yes-display-inline">To facilitate the installation of broadband infrastructure, the Secretary of Transportation shall promulgate regulations to ensure that each State that receives funds under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, meets the following requirements:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H3B044018FFC6419A90677310713BDD86"><enum>(1)</enum><header display-inline="yes-display-inline">Broadband consultation</header><text display-inline="yes-display-inline">The State department of transportation, in consultation with appropriate State agencies, shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H9C15289440BE41B993C7592BA0BD95F7"><enum>(A)</enum><text display-inline="yes-display-inline">identify a broadband utility coordinator, that may have additional responsibilities, whether in the State department of transportation or in another State agency, that is responsible for facilitating the broadband infrastructure right-of-way efforts within the State;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H12594BFE535A41C4BEC099C77D67CE98"><enum>(B)</enum><text display-inline="yes-display-inline">establish a process for the registration of broadband infrastructure entities that seek to be included in those broadband infrastructure right-of-way facilitation efforts within the State;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCAF7776E975F41AA9E9DFBF5C9688DC9"><enum>(C)</enum><text display-inline="yes-display-inline">establish a process to electronically notify broadband infrastructure entities identified under subparagraph (B) of the State transportation improvement program on an annual basis and provide additional notifications as necessary to achieve the goals of this section; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8955F1F671514C158CD9033CC585CAFD"><enum>(D)</enum><text display-inline="yes-display-inline">coordinate initiatives carried out under this section with other statewide telecommunication and broadband plans and State and local transportation and land use plans, including strategies to minimize repeated excavations that involve the installation of broadband infrastructure in a right-of-way.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3C99239A1B59420BADE8624086823408"><enum>(2)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">If a State chooses to provide for the installation of broadband infrastructure in the right-of-way of an applicable Federal-aid highway project under this subsection, the State department of transportation shall carry out any appropriate measures to ensure that any existing broadband infrastructure entities are not disadvantaged, as compared to other broadband infrastructure entities, with respect to the program under this subsection.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB59E7E704A104CC7A35257EF9D32D981"><enum>(c)</enum><header display-inline="yes-display-inline">Effect of section</header><text display-inline="yes-display-inline">This section applies only to activities for which Federal obligations or expenditures are initially approved on or after the date regulations under subsection (b) become effective. Nothing in this section establishes a mandate or requirement that a State install or allow the installation of broadband infrastructure in a highway right-of-way. Nothing in this section authorizes the Secretary of Transportation to withhold or reserve funds or approval of a project under title 23, United States Code.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HD5CE809744894B9DA27A1B685677A0A4" section-type="subsequent-section"><enum>707.</enum><header display-inline="yes-display-inline">Reallocation incentives</header>
 <subsection commented="no" display-inline="no-display-inline" id="H6DC9E3407D284315B1022B6B5E740A0A"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 24 months after the date of enactment of this Act, the Assistant Secretary of Commerce for Communications and Information, in consultation with the Commission, the Director of OMB, and the head of each affected Federal agency (or a designee thereof), after notice and an opportunity for public comment, shall submit to the appropriate committees of Congress a report that includes legislative or regulatory recommendations to incentivize a Federal entity to relinquish, or share with Federal or non-Federal users, Federal spectrum for the purpose of allowing commercial wireless broadband services to operate on that Federal spectrum.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HFC7DA463DF8C441DB3C8AC75987A3FC6"><enum>(b)</enum><header display-inline="yes-display-inline">Post-Auction payments</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H4243171AA63241D8BC528A3F4E5F60FB"><enum>(1)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">In preparing the report under subsection (a), the Assistant Secretary of Commerce for Communications and Information shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HE5B9D80F009C4851A361701991C95BB3"><enum>(A)</enum><text display-inline="yes-display-inline">consider whether permitting eligible Federal entities that are implementing a transition plan submitted under section 113(h) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(h)</external-xref>) to accept payments could result in access to the eligible frequencies that are being reallocated for exclusive non-Federal use or shared use sooner than would otherwise occur without such payments; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H75CDC1FDF74E416E8D5E7385E8DB9D19"><enum>(B)</enum><text display-inline="yes-display-inline">include the findings under subparagraph (A), including the analysis under paragraph (2) and any recommendations for legislation, in the report.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7A9E4B6AF4004D819B4B8F441EE48E70"><enum>(2)</enum><header display-inline="yes-display-inline">Analysis</header><text display-inline="yes-display-inline">In considering payments under paragraph (1)(A), the Assistant Secretary of Commerce for Communications and Information shall conduct an analysis of whether and how such payments would affect—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H0A7CC4362D9146FFB7FBCB578D9912E7"><enum>(A)</enum><text display-inline="yes-display-inline">bidding in auctions conducted under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) of such eligible frequencies; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H05C938422CB14335809A76C5FCE72E61"><enum>(B)</enum><text display-inline="yes-display-inline">receipts collected from the auctions described in subparagraph (A).</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H36E88F42FC0546D3976269BFAFF59EF8"><enum>(3)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HB7B3D65E93DF4A6D8C2A0795740EA92B"><enum>(A)</enum><header display-inline="yes-display-inline">Payment</header><text display-inline="yes-display-inline">The term <term>payment</term> means a payment in cash or in-kind by any auction winner, or any person affiliated with an auction winner, of eligible frequencies during the period after eligible frequencies have been reallocated by competitive bidding under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) but prior to the completion of relocation or sharing transition of such eligible frequencies per transition plans approved by the Technical Panel.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8554B05BF99646779213B876FA6E38D2"><enum>(B)</enum><header display-inline="yes-display-inline">Eligible frequencies</header><text display-inline="yes-display-inline">The term <term>eligible frequencies</term> has the meaning given the term in section 113(g)(2) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(g)(2)</external-xref>).</text>
						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HCE820A0CE389439295E181656084A517" section-type="subsequent-section"><enum>708.</enum><header display-inline="yes-display-inline">Bidirectional sharing study</header>
 <subsection commented="no" display-inline="no-display-inline" id="H97650BCE826044C491168745F372AA5B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, including an opportunity for public comment, the Commission, in collaboration with the NTIA, shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HC985FBF7C7E8420293D1797A33A23043"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a bidirectional sharing study to determine the best means of providing Federal entities flexible access to non-Federal spectrum on a shared basis across a range of short-, mid-, and long-range timeframes, including for intermittent purposes like emergency use; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H375C0C17DA4B40B1BD22822486B5165F"><enum>(2)</enum><text display-inline="yes-display-inline">submit to Congress a report on the study under paragraph (1), including any recommendations for legislation or proposed regulations.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF19E7B8B992240D785DF216E01304D82"><enum>(b)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In conducting the study under subsection (a), the Commission shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="HCB3BA0EF6742475AA439C35C8037DDB8"><enum>(1)</enum><text display-inline="yes-display-inline">consider the regulatory certainty that commercial spectrum users and Federal entities need to make longer-term investment decisions for shared access to be viable; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B53F3024C23467BAF878363D7050B88"><enum>(2)</enum><text display-inline="yes-display-inline">evaluate any barriers to voluntary commercial arrangements in which non-Federal users could provide access to Federal entities.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H048395F2A6A740E0B6FD3A6E46ECE451" section-type="subsequent-section"><enum>709.</enum><header display-inline="yes-display-inline">Unlicensed services in guard bands</header>
 <subsection commented="no" display-inline="no-display-inline" id="H44F851F77FA04C28BD0CBE716374689F"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">After public notice and comment, and in consultation with the Assistant Secretary of Commerce for Communications and Information and the head of each affected Federal agency (or a designee thereof), with respect to frequencies allocated for Federal use, the Commission shall adopt rules that permit unlicensed services where feasible to use any frequencies that are designated as guard bands to protect frequencies allocated after the date of enactment of this Act by competitive bidding under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>), including spectrum that acts as a duplex gap between transmit and receive frequencies.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H6902C6463D9947F191B1EECCAD981439"><enum>(b)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The Commission may not permit any use of a guard band under this section that would cause harmful interference to a licensed service or a Federal service.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H6213D60C7584427D9EB56EA054F512A7"><enum>(c)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as limiting the Commission or the Assistant Secretary of Commerce for Communications and Information from otherwise making spectrum available for licensed or unlicensed use in any frequency band in addition to guard bands, including under section 703, consistent with their statutory jurisdictions.</text>
 </subsection></section><section commented="no" display-inline="no-display-inline" id="H56A59C14DBB14D2DBF434DC5999713E9" section-type="subsequent-section"><enum>710.</enum><header display-inline="yes-display-inline">Amendments to the Spectrum Pipeline Act of 2015</header><text display-inline="no-display-inline">Section 1008 of the Spectrum Pipeline Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/74">Public Law 114–74</external-xref>; 129 Stat. 584) is amended in the matter preceding paragraph (1) by inserting <quote>, after notice and an opportunity for public comment,</quote> after <quote>the Commission</quote>.</text>
			</section><section commented="no" display-inline="no-display-inline" id="H20F280CD01D14DB495767B24E74174F0" section-type="subsequent-section"><enum>711.</enum><header display-inline="yes-display-inline">GAO assessment of unlicensed spectrum and Wi-Fi use in low-income neighborhoods</header>
				<subsection commented="no" display-inline="no-display-inline" id="HCADCA051DA8C47E499D7CAEC29876807"><enum>(a)</enum><header display-inline="yes-display-inline">Study</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H19134C014C2A4DC08C8AA56DAE6701EA"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study to evaluate the availability of broadband Internet access using unlicensed spectrum and wireless networks in low-income neighborhoods.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1DCB9A311E01472ABE35C1765F592D5F"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Comptroller General shall consider and evaluate—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H4B6E004DE58542A7A71350E5FD9BD443"><enum>(A)</enum><text display-inline="yes-display-inline">the availability of wireless Internet hot spots and access to unlicensed spectrum in low-income neighborhoods, particularly for elementary and secondary school-aged children in such neighborhoods;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA2C0DDFEABB94C97B5E23D48B9581568"><enum>(B)</enum><text display-inline="yes-display-inline">any barriers preventing or limiting the deployment and use of wireless networks in low-income neighborhoods;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB7BF37DD957F45EFA5EB140F6C90B21C"><enum>(C)</enum><text display-inline="yes-display-inline">how to overcome any barriers described in subparagraph (B), including through incentives, policies, or requirements that would increase the availability of unlicensed spectrum and related technologies in low-income neighborhoods; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA1871031ECFE48128A6EED6CDB3E1800"><enum>(D)</enum><text display-inline="yes-display-inline">how to encourage home broadband adoption by households with elementary and secondary school-age children that are in low-income neighborhoods.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H369C4E328E704D4883F2876E2B723844"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General shall submit to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name> a report that—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HCA5DA61DA46E47ED8B6EC3A7B038C690"><enum>(1)</enum><text display-inline="yes-display-inline">summarizes the findings of the study conducted under subsection (a); and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H520FC7923A2C405BADDD6B407BA806C0"><enum>(2)</enum><text display-inline="yes-display-inline">makes recommendations with respect to potential incentives, policies, and requirements that could help achieve the goals described in subparagraphs (C) and (D) of subsection (a)(2).</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H23ABF1421FDB4EC0AEA8CBB618C157CC" section-type="subsequent-section"><enum>712.</enum><header display-inline="yes-display-inline">Rulemaking related to partitioning or disaggregating licenses</header>
 <subsection commented="no" display-inline="no-display-inline" id="H02919B41784045CFA8234BA20D33DEBA"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="H099B542FDA0945A29E2E1E977DF67E15"><enum>(1)</enum><header display-inline="yes-display-inline">Covered small carrier</header><text display-inline="yes-display-inline">The term <term>covered small carrier</term> means a carrier (as defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>)) that—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HF5F4F683A3DD4B7DBE68B65FC5825BCC"><enum>(A)</enum><text display-inline="yes-display-inline">has not more than 1,500 employees (as determined under section 121.106 of title 13, Code of Federal Regulations, or any successor thereto); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7EC0BC347CA44F53BD321A62B1958F0A"><enum>(B)</enum><text display-inline="yes-display-inline">offers services using the facilities of the carrier.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7439CBEB98384BE18FBDA756C9C3DAE4"><enum>(2)</enum><header display-inline="yes-display-inline">Rural area</header><text display-inline="yes-display-inline">The term <term>rural area</term> means any area other than—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H5F06574D34C14590A725C5E2053A1F6C"><enum>(A)</enum><text display-inline="yes-display-inline">a city, town, or incorporated area that has a population of more than 20,000 inhabitants; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBD7A3F0290B4413BAB853FF0FE4E0A57"><enum>(B)</enum><text display-inline="yes-display-inline">an urbanized area contiguous and adjacent to a city or town that has a population of more than 50,000 inhabitants.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H55CEFE32AF514B51BCA7DFDCAF1B1FB9"><enum>(b)</enum><header display-inline="yes-display-inline">Rulemaking</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H5BDCFBA0FDDA4B698A6FBEC158E6778C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall initiate a rulemaking proceeding to assess whether to establish a program, or modify existing programs, under which a licensee that receives a license for the exclusive use of spectrum in a specific geographic area under section 301 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301</external-xref>) may partition or disaggregate the license by sale or long-term lease—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H4B6E41886AEB4328AF07BFC1992CAE46"><enum>(A)</enum><text display-inline="yes-display-inline">in order to—</text> <clause commented="no" display-inline="no-display-inline" id="H7E58B769F2084510BBFCF558A2C8375B"><enum>(i)</enum><text display-inline="yes-display-inline">provide services consistent with the license; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H65231B6B32694C609CC1D9082BBCD871"><enum>(ii)</enum><text display-inline="yes-display-inline">make unused spectrum available to—</text> <subclause commented="no" display-inline="no-display-inline" id="H36C132D9AC7D4984B04FF4850FDACF90"><enum>(I)</enum><text display-inline="yes-display-inline">an unaffiliated covered small carrier; or</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="H32411A0EFF2C44A987A7F7453FAAC588"><enum>(II)</enum><text display-inline="yes-display-inline">an unaffiliated carrier to serve a rural area; and</text> </subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE9A6C04F568F4F3C8B4D01864A0B349D"><enum>(B)</enum><text display-inline="yes-display-inline">if the Commission finds that such a program would promote—</text>
 <clause commented="no" display-inline="no-display-inline" id="H209F23C76A8846728FF8A688B9221490"><enum>(i)</enum><text display-inline="yes-display-inline">the availability of advanced telecommunications services in rural areas; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="HB461537DDBCA4E3C95E41EB6D590F544"><enum>(ii)</enum><text display-inline="yes-display-inline">spectrum availability for covered small carriers.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H25E8260A0BDD41D1BBDA1BD2E0BB323D"><enum>(2)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In conducting the rulemaking proceeding under paragraph (1), the Commission shall consider, with respect to the program proposed to be established under that paragraph—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H8A52A795EF75452B9DA2E2FF6C8BB771"><enum>(A)</enum><text display-inline="yes-display-inline">whether reduced performance requirements with respect to spectrum obtained through the program would facilitate deployment of advanced telecommunications services in the areas covered by the program;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2A12177F75D246E8BD898A9F0D63A777"><enum>(B)</enum><text display-inline="yes-display-inline">what conditions may be needed on transfers of spectrum under the program to allow covered small carriers that obtain spectrum under the program to build out the spectrum in a reasonable period of time;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H48A53E8C2847482EAD259CB889481E26"><enum>(C)</enum><text display-inline="yes-display-inline">what incentives may be appropriate to encourage licensees to lease or sell spectrum, including—</text> <clause commented="no" display-inline="no-display-inline" id="H6D0EEDF2E0AA4E51995769E1CBA2D935"><enum>(i)</enum><text display-inline="yes-display-inline">extending the term of a license granted under section 301 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301</external-xref>); or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H4219B07C078043D7AEBE017DBB8B3E93"><enum>(ii)</enum><text display-inline="yes-display-inline">modifying performance requirements of the license relating to the leased or sold spectrum; and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5BE034E1B1E84ABEA47390C23CE6651A"><enum>(D)</enum><text display-inline="yes-display-inline">the administrative feasibility of—</text>
 <clause commented="no" display-inline="no-display-inline" id="H090257E73FA3465A869606CF76611842"><enum>(i)</enum><text display-inline="yes-display-inline">the incentives described in subparagraph (C); and</text> </clause><clause commented="no" display-inline="no-display-inline" id="H3871051707C74691960E13E766ED1072"><enum>(ii)</enum><text display-inline="yes-display-inline">other incentives considered by the Commission that further the goals of this section.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H84F2DDF1226E4938B286D0DB6456A66C"><enum>(3)</enum><header display-inline="yes-display-inline">Forfeiture of spectrum</header><text display-inline="yes-display-inline">If a party fails to meet any build out requirements set by the Commission for any spectrum sold or leased under this section, the right to the spectrum shall be forfeited to the Commission unless the Commission finds that there is good cause for the failure of the party.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H78BDB239A3A14414B8FDA7A978CAB021"><enum>(4)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">The Commission may offer a licensee incentives or reduced performance requirements under this section only if the Commission finds that doing so would likely result in increased availability of advanced telecommunications services in a rural area.</text>
					</paragraph></subsection></section><section id="HFF045FA2899A4E56AB0E2A54D0E853A6"><enum>713.</enum><header>Unlicensed spectrum policy</header>
 <subsection id="HF19D38B7B9DF492DBD56E670DBCE00F6"><enum>(a)</enum><header>Statement of policy</header><text>It is the policy of the United States—</text> <paragraph id="HDD28FB9B813D40CCA8D1E88F53CEC228"><enum>(1)</enum><text>to maximize the benefit to the people of the United States of the spectrum resources of the United States;</text>
 </paragraph><paragraph id="HE103C2F7125D4BC4B41D88848C7A1E50"><enum>(2)</enum><text>to advance innovation and investment in wireless broadband services; and</text> </paragraph><paragraph id="HB869D49F47E7418894E96E7EC67E61B8"><enum>(3)</enum><text>to promote spectrum policy that makes available on an unlicensed basis radio frequency bands to address consumer demand for unlicensed wireless broadband operations.</text>
 </paragraph></subsection><subsection id="H66C314808F4E4534925D031B394E1823"><enum>(b)</enum><header>Commission responsibilities</header><text>The Commission shall ensure that the efforts of the Commission related to spectrum allocation and assignment made available on an unlicensed basis radio frequency bands to address demand for unlicensed wireless broadband operations if doing so is, after taking into account the future needs of homeland security, national security, and other spectrum users—</text>
 <paragraph id="H8AB18C2A5F024029A746F5A782A63D89"><enum>(1)</enum><text>reasonable; and</text> </paragraph><paragraph id="H14065D23E6B44FD7A964E47FEAF290A4"><enum>(2)</enum><text>in the public interest.</text>
 </paragraph></subsection><subsection id="H90B6CBD82A9841708A0690CAD3220F09"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section confers any additional rights on unlicensed users or users licensed by rule under part 96 of title 47, Code of Federal Regulations, to protection from harmful interference.</text>
				</subsection></section><section id="HC8374606829843F092A788E6F4BAB65D"><enum>714.</enum><header>National plan for unlicensed spectrum</header>
 <subsection id="HF7F15EAD847440B1A12EAD8E2023DD0F"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H7863DF62A17C43F8AB69A76B27666E1C"><enum>(1)</enum><header>Spectrum relocation fund</header><text>The term <quote>Spectrum Relocation Fund</quote> means the Fund established under section 118 of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/928">47 U.S.C. 928</external-xref>).</text>
 </paragraph><paragraph id="H3A0AF88D65D54E6191A57630C26CF4E8"><enum>(2)</enum><header>Unlicensed or licensed by rule operations</header><text>The term <quote>unlicensed or licensed by rule operations</quote> means the use of spectrum on a non-exclusive basis under—</text> <subparagraph id="H938C63B5D9F14546950DEB9B180C5088"><enum>(A)</enum><text>part 15 of title 47, Code of Federal Regulations; or</text>
 </subparagraph><subparagraph id="H0824FAAD07F841F9A7DD23517E6F8D5E"><enum>(B)</enum><text>licensing by rule under part 96 of title 47, Code of Federal Regulations.</text> </subparagraph></paragraph></subsection><subsection id="H6C5B12BEC89046818A93F47CC30654AF"><enum>(b)</enum><header>National plan</header><text>Not later than 18 months after the date of enactment of this Act, the Commission, in consultation with the NTIA, shall develop a national plan for making additional radio frequency bands available for unlicensed or licensed by rule operations.</text>
 </subsection><subsection id="HCEC2A57F738F438AB49F3713A72818B7"><enum>(c)</enum><header>Requirements</header><text>The plan developed under this section shall—</text> <paragraph id="H1B948F24D443445F86977EA9B43B955E"><enum>(1)</enum><text>identify an approach that ensures that consumers have access to additional spectrum to conduct unlicensed or licensed by rule operations in a range of radio frequencies to meet consumer demand;</text>
 </paragraph><paragraph id="H5CD9B3AC8A514E66A896CC52E723BF52"><enum>(2)</enum><text>recommend specific actions by the Commission and the NTIA to permit unlicensed or licensed by rule operations in additional radio frequency ranges that the Commission finds—</text>
 <subparagraph id="HDA6F224E71114D89BD22EA7EAA4B820F"><enum>(A)</enum><text>are consistent with the statement of policy under section 713(a);</text> </subparagraph><subparagraph id="HF58E10AFC332491D9D18847845CD39FA"><enum>(B)</enum><text>will—</text>
 <clause id="H7DD1EDC6153C43D79C4AFD36B8186E4F"><enum>(i)</enum><text>expand opportunities for unlicensed or licensed by rule operations in a spectrum band; or</text> </clause><clause id="H4574BB835F604DC190F03217982C8CC8"><enum>(ii)</enum><text>otherwise improve spectrum utilization and intensity of use of bands where unlicensed or licensed by rule operations are already permitted;</text>
 </clause></subparagraph><subparagraph id="H6A059CFB35BF4BE888E3A329234C9BB7"><enum>(C)</enum><text>will not cause harmful interference to Federal or non-Federal users of such bands; and</text> </subparagraph><subparagraph id="HA0BC54044D56449BA1E0F89E8584747C"><enum>(D)</enum><text>will not significantly impact homeland security or national security communications systems; and</text>
 </subparagraph></paragraph><paragraph id="HD0D2B600C331427490B3F29BA4410EFD"><enum>(3)</enum><text>examine additional ways, with respect to existing and planned databases or spectrum access systems designed to promote spectrum sharing and access to spectrum for unlicensed or licensed by rule operations—</text>
 <subparagraph id="H693772D28D074689A8C4AD65ACE63B4D"><enum>(A)</enum><text>to improve accuracy and efficacy;</text> </subparagraph><subparagraph id="HC7AA372EEA084C3C8FB094A657BE5078"><enum>(B)</enum><text>to reduce burdens on consumers, manufacturers, and service providers; and</text>
 </subparagraph><subparagraph id="H38DCA90F391B439ABDFE7EBDD23AE5D8"><enum>(C)</enum><text>to protect sensitive Government information.</text> </subparagraph></paragraph></subsection><subsection id="HE1031D965E63450AAE23572D325E1110"><enum>(d)</enum><header>Spectrum relocation fund</header><text>To be included as an appendix as part of the plan developed under this section, the NTIA, in consultation with the Director of the Office of Management and Budget, shall share with the Commission recommendations about how to reform the Spectrum Relocation Fund—</text>
 <paragraph id="HD97DCAF33C714B62ACA2A967CBD9D3EB"><enum>(1)</enum><text>to address costs incurred by Federal entities related to sharing radio frequency bands with radio technologies conducting unlicensed or licensed by rule operations; and</text>
 </paragraph><paragraph id="HAFB777FBE4614D349F5706EA1C76E303"><enum>(2)</enum><text>to ensure the Spectrum Relocation Fund has sufficient funds to cover—</text> <subparagraph id="H3F2DB1FB2FFA4D6ABE1AB38288566206"><enum>(A)</enum><text>the costs described in paragraph (1); and</text>
 </subparagraph><subparagraph id="HB5CBAD45914741BEA9342731FA2AA5B2"><enum>(B)</enum><text>other expenditures allowed of the Spectrum Relocation Fund under section 118 of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/928">47 U.S.C. 928</external-xref>).</text>
						</subparagraph></paragraph></subsection><subsection id="HFD559033C5B4437FA90284AF1416E0D7"><enum>(e)</enum><header>Report required</header>
 <paragraph id="HBE53AEEFE5BD410CBF10A5D1A0A27775"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress a report that describes the plan developed under this section, including any recommendations for legislative change.</text>
 </paragraph><paragraph id="H74A42F2236464A9AA1144510078C5B92"><enum>(2)</enum><header>Publication on commission website</header><text>Not later than the date on which the Commission submits the report under paragraph (1), the Commission shall make the report publicly available on the website of the Commission.</text>
 </paragraph></subsection><subsection id="H1A00B0CA65764890B27D8DEFC9B88F27"><enum>(f)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section confers any additional rights on unlicensed users or users licensed by rule under part 96 of title 47, Code of Federal Regulations, to protection from harmful interference.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H404DADC6DCCA4908A3C181B4E69F1E78" section-type="subsequent-section"><enum>715.</enum><header display-inline="yes-display-inline">Spectrum challenge prize</header>
 <subsection commented="no" display-inline="no-display-inline" id="HE43C91389248412EBF3DD8B9BC654E4D"><enum>(a)</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Spectrum Challenge Prize Act</short-title></quote>.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="H25BF150B694F4E07959B9CF98C443FB4"><enum>(b)</enum><header display-inline="yes-display-inline">Definition of prize competition</header><text display-inline="yes-display-inline">In this section, the term <term>prize competition</term> means a prize competition conducted by the Secretary under subsection (c)(1).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HD99F0C8C6C36450B83B85FAB5F9A66F1"><enum>(c)</enum><header display-inline="yes-display-inline">Spectrum challenge prize</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H423F5D67B81446B7A60514391C683E7D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Assistant Secretary of Commerce for Communications and Information and the Under Secretary of Commerce for Standards and Technology, shall, subject to the availability of funds for prize competitions under this section—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H5070E5730A8D41D58D13E8F51DCF38B7"><enum>(A)</enum><text display-inline="yes-display-inline">conduct prize competitions to dramatically accelerate the development and commercialization of technology that improves spectrum efficiency and is capable of cost-effective deployment; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H99017F23A11B4F90B8D1BB175D7FF981"><enum>(B)</enum><text display-inline="yes-display-inline">define a measurable set of performance goals for participants in the prize competitions to demonstrate their solutions on a level playing field while making a significant advancement over the current state of the art.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H078A0E110C4348AAB6F12EF4FCD9AFA5"><enum>(2)</enum><header display-inline="yes-display-inline">Authority of Secretary</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary may—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H99294577F7C1409A9D581ACC8079F238"><enum>(A)</enum><text display-inline="yes-display-inline">enter into a grant, contract, cooperative agreement, or other agreement with a private sector for-profit or nonprofit entity to administer the prize competitions;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H34D369124C66446C920693B99E88E4E3"><enum>(B)</enum><text display-inline="yes-display-inline">invite the Defense Advanced Research Projects Agency, the Commission, the National Aeronautics and Space Administration, the National Science Foundation, or any other Federal agency to provide advice and assistance in the design or administration of the prize competitions; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4601CFB91B6D48E999ECCC7B04BAA58A"><enum>(C)</enum><text display-inline="yes-display-inline">award not more than $5,000,000, in the aggregate, to the winner or winners of the prize competitions.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC0F81CA5801D43D8A6253BC2F5D633E5"><enum>(d)</enum><header display-inline="yes-display-inline">Criteria</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which funds for prize competitions are made available pursuant to this section, the Commission shall publish a technical paper on spectrum efficiency providing criteria that may be used for the design of the prize competitions.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HDF482AD7DCCE4F44AF0605FBACD3EF2E"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this section.</text> </subsection></section><section commented="no" display-inline="no-display-inline" id="H8D07496EADDB404D9FF1FADE74D640B3" section-type="subsequent-section"><enum>716.</enum><header display-inline="yes-display-inline">Wireless telecommunications tax and fee collection fairness</header> <subsection commented="no" display-inline="no-display-inline" id="HB72C802B9DDB4AA081A9DFB881BEBE06"><enum>(a)</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Wireless Telecommunications Tax and Fee Collection Fairness Act</short-title></quote>.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HA5269996B39C4A70A250A1B43359D87C"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="H213415AE5DD240169E9D9D565E464BF7"><enum>(1)</enum><header display-inline="yes-display-inline">Financial transaction</header><text display-inline="yes-display-inline">The term <term>financial transaction</term> means a transaction in which the purchaser or user of a wireless telecommunications service upon whom a tax, fee, or surcharge is imposed gives cash, credit, or any other exchange of monetary value or consideration to the person who is required to collect or remit the tax, fee, or surcharge.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H604D7E9D368D44D0B8A385B6C132A3AC"><enum>(2)</enum><header display-inline="yes-display-inline">Local jurisdiction</header><text display-inline="yes-display-inline">The term <term>local jurisdiction</term> means a political subdivision of a State.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBB764163A2E645B0B9B4632F51CCA896"><enum>(3)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means any of the several States, the District of Columbia, and any territory or possession of the United States.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1BFFF23900804CC2A77C8094DDC27AB5"><enum>(4)</enum><header display-inline="yes-display-inline">State or local jurisdiction</header><text display-inline="yes-display-inline">The term <term>State or local jurisdiction</term> includes any governmental entity or person acting on behalf of a State or local jurisdiction that has the authority to assess, impose, levy, or collect taxes or fees.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H21B676F0CE9E41D2B81FEEB6365A1DDF"><enum>(5)</enum><header display-inline="yes-display-inline">Wireless telecommunications service</header><text display-inline="yes-display-inline">The term <term>wireless telecommunications service</term> means a commercial mobile radio service, as defined in section 20.3 of title 47, Code of Federal Regulations, or any successor thereto.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H15A3F9B2841A40658167501B302CAD7F"><enum>(c)</enum><header display-inline="yes-display-inline">Financial transaction requirement</header>
 <paragraph commented="no" display-inline="no-display-inline" id="HD25422A17DFB42219D6B9592DD465CB8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State, or a local jurisdiction of a State, may not require a person who is neither a resident of such State or local jurisdiction nor an entity having its principal place of business in such State or local jurisdiction to collect from, or remit on behalf of, any other person a State or local tax, fee, or surcharge imposed on a purchaser or user with respect to the purchase or use of any wireless telecommunications service within the State unless the collection or remittance is in connection with a financial transaction.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB34F5A61903147DD9C4559F650FF3A1F"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to affect the right of a State or local jurisdiction to require the collection of any tax, fee, or surcharge in connection with a financial transaction.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD52931FC7BE94819A5001D56545B4A16"><enum>(d)</enum><header display-inline="yes-display-inline">Enforcement</header>
 <paragraph commented="no" display-inline="no-display-inline" id="HCD6460F452CD4F3D9B34AEF6A4ABDEB5"><enum>(1)</enum><header display-inline="yes-display-inline">Private right of action</header><text display-inline="yes-display-inline">Any person aggrieved by a violation of subsection (c) may bring a civil action in an appropriate district court of the United States for equitable relief in accordance with paragraph (2) of this subsection.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF678B362B15E49D0816E2DB526375E6E"><enum>(2)</enum><header display-inline="yes-display-inline">Jurisdiction of district courts</header><text display-inline="yes-display-inline">Notwithstanding section 1341 of title 28, United States Code, or the constitution or laws of any State, the district courts of the United States shall have jurisdiction, without regard to the amount in controversy or citizenship of the parties, to grant such mandatory or prohibitive injunctive relief, interim equitable relief, and declaratory judgments as may be necessary to prevent, restrain, or terminate any acts in violation of subsection (c).</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H7516ECD3A7E04DF2849BF3AFCE55EBCA" section-type="subsequent-section"><enum>717.</enum><header display-inline="yes-display-inline">Rules of construction</header>
 <subsection commented="no" display-inline="no-display-inline" id="H115DE495813F4F1084160D71E306D355"><enum>(a)</enum><header display-inline="yes-display-inline">Ranges of frequencies</header><text display-inline="yes-display-inline">Each range of frequencies described in this title shall be construed to be inclusive of the upper and lower frequencies in the range.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H354003BB6F0E4159879D867F5619E64C"><enum>(b)</enum><header display-inline="yes-display-inline">Assessment of electromagnetic spectrum reallocation</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to affect any requirement under section 156 of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/921">47 U.S.C. 921</external-xref> note), as added by section 1062(a) of the National Defense Authorization Act for Fiscal Year 2000.</text>
 </subsection></section><section commented="no" display-inline="no-display-inline" id="HC67A6C7C63E947838A45C536475DAEAB" section-type="subsequent-section"><enum>718.</enum><header display-inline="yes-display-inline">Relationship to Middle Class Tax Relief and Job Creation Act of 2012</header><text display-inline="no-display-inline">Nothing in this title shall be construed to limit, restrict, or circumvent in any way the implementation of the nationwide public safety broadband network defined in section 6001 of title VI of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>) or any rules implementing that network under title VI of that Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref> et seq.).</text>
 </section><section id="HD6BE00C0B43D41E1AD72574D635D8FAD"><enum>719.</enum><header>No additional funds authorized</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated to carry out this title, or the amendment made by this title. This title, and the amendment made by this title, shall be carried out using amounts otherwise authorized.</text>
