			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Federal Smart Building Program to implement smart building technology and
			 demonstrate the costs and benefits of smart buildings, and for other
			 purposes.</official-title></form>
	<legis-body id="H7EF6E1B67D4642F2896E9668B5D60E8A" style="OLC">
 <section id="H59C3EC74345148F3B496A374DE78FB0C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Smart Building Acceleration Act of 2018</short-title></quote>.</text> </section><section id="H587C590034AF4D0398CBF627A7963466"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
 <paragraph id="H2AC023C70EBF4CA697765DDDA16130BF"><enum>(1)</enum><text>the building sector uses more than 40 percent of the energy of the United States;</text> </paragraph><paragraph id="H4A5B95C1A894471B96AF67226FAE8DFD"><enum>(2)</enum><text>emerging building energy monitoring and control technologies are enabling a transition of the building sector to <term>smart</term> buildings that have dramatically reduced energy use and improved quality of service to occupants;</text>
 </paragraph><paragraph id="H3EE98EF27415436B84938F293A49CF91"><enum>(3)</enum><text>an analysis of select private-sector smart buildings by the Department of Energy would document the costs and benefits of the emerging technologies, promote the adoption of the technologies, and accelerate the transition to the technologies;</text>
 </paragraph><paragraph id="H37FA640A7F4943B5A7054BF9253DEB41"><enum>(4)</enum><text>with over 400,000 buildings, the Federal Government is the largest building owner in the United States; and</text>
 </paragraph><paragraph id="HD97DADB639F841088FCDB085B9253CBE"><enum>(5)</enum><text>the Federal Government can also accelerate the transition to smart building technologies by demonstrating and evaluating emerging smart building technologies using existing programs and funding to showcase selected Federal smart buildings.</text>
			</paragraph></section><section id="HDA5AAB64A4534B3AA7CEF4249F25CB93"><enum>3.</enum><header>Smart building acceleration</header>
 <subsection id="H79317F7D955046F7834C24D1FBB2B935"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H94778DA8A69446B59B7914188E73D85D"><enum>(1)</enum><header>Internet of things technology solution</header><text display-inline="yes-display-inline">The term <term>internet of things technology solution</term> means a solution that improves energy efficiency and predictive maintenance through cutting-edge technologies that utilize internet connected technologies including sensors, intelligent gateways, and security embedded hardware.</text>
 </paragraph><paragraph id="H32352EE730C9495297B034A8EE5B6CAA"><enum>(2)</enum><header>Program</header><text>The term <term>program</term> means the Federal Smart Building Program established under subsection (b)(1).</text> </paragraph><paragraph id="H9DB1CA09608B468C9E8C58022989214C"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text>
 </paragraph><paragraph id="H02FADE59F72E4C3DB841F44BD842F735"><enum>(4)</enum><header>Smart building</header><text>The term <term>smart building</term> means a building, or collection of buildings, with an energy system that—</text> <subparagraph id="H1A7CEA48EBC3432FAF0D260CE03F4611"><enum>(A)</enum><text>is flexible and automated;</text>
 </subparagraph><subparagraph id="HE0712F7CC1214E4BA4E66AA8F323229A"><enum>(B)</enum><text>has extensive operational monitoring and communication connectivity, allowing remote monitoring and analysis of all building functions;</text>
 </subparagraph><subparagraph id="H6ED019C1C4A64BCB9B5AE7A789A4AAF5"><enum>(C)</enum><text>takes a systems-based approach in integrating the overall building operations for control of energy generation, consumption, and storage;</text>
 </subparagraph><subparagraph id="HFC5D0D4026BA40B9B5D23B3C1B40683F"><enum>(D)</enum><text>communicates with utilities and other third-party commercial entities, if appropriate;</text> </subparagraph><subparagraph id="H65393666BEF046C8A2018AB1B5C11D89"><enum>(E)</enum><text>protects the health and safety of occupants and workers; and</text>
 </subparagraph><subparagraph id="H55A862F550784AC5BF9D4730FE6C44A2"><enum>(F)</enum><text>is cybersecure.</text> </subparagraph></paragraph><paragraph id="H482040A1E0C147DCA3E21B328AE10907"><enum>(5)</enum><header>Smart building accelerator</header><text>The term <term>smart building accelerator</term> means an initiative that is designed to demonstrate specific innovative policies and approaches—</text>
 <subparagraph id="H210847F6008445E8914671A634957399"><enum>(A)</enum><text>with clear goals and a clear timeline; and</text> </subparagraph><subparagraph id="H0179E392BAD7493585A113511BF5C5DC"><enum>(B)</enum><text>that, on successful demonstration, would accelerate investment in energy efficiency.</text>
					</subparagraph></paragraph></subsection><subsection id="HBCAA22EDACCF411CA6FB59E18D4E9CE2"><enum>(b)</enum><header>Federal smart building program</header>
 <paragraph id="HD342606F3F7E47D78D24CF5390BD0102"><enum>(1)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall, in consultation with the Administrator of General Services, establish a program to be known as the Federal Smart Building Program—</text>
 <subparagraph id="H9A3EFEB11C4844088D40F850DF1B0ED3"><enum>(A)</enum><text>to implement smart building technology; and</text> </subparagraph><subparagraph id="H6C7B2454387841A49D93FD21695AE80F"><enum>(B)</enum><text>to demonstrate the costs and benefits of smart buildings.</text>
					</subparagraph></paragraph><paragraph id="H5C041F098EFD48309016D1A8B45C1FF1"><enum>(2)</enum><header>Selection</header>
 <subparagraph id="H58A63BEB9DBB4D2781ADEDBA3E79229B"><enum>(A)</enum><header>In general</header><text>The Secretary shall coordinate the selection of not fewer than 1 building from among each of several key Federal agencies, as described in paragraph (4), to compose an appropriately diverse set of smart buildings based on size, type, and geographic location.</text>
 </subparagraph><subparagraph id="HEA7D76D5418E40789DD0081AA7760C40"><enum>(B)</enum><header>Inclusion of commercially operated buildings</header><text>In making selections under subparagraph (A), the Secretary may include buildings that are owned by the Federal Government but are commercially operated.</text>
 </subparagraph></paragraph><paragraph id="H1132B7EDA7ED436DBB376A5D30E7D9B0"><enum>(3)</enum><header>Targets</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall establish targets for the number of smart buildings to be commissioned and evaluated by key Federal agencies by 3 years and 6 years after the date of enactment of this Act.</text>
 </paragraph><paragraph id="H57F04037FE9A4AD081C20CE3A5EC859E"><enum>(4)</enum><header>Federal agency described</header><text>The key Federal agencies referred to in this subsection shall include buildings operated by—</text> <subparagraph id="HA9CB8467B9AA4557A37BE0420163118B"><enum>(A)</enum><text>the Department of the Army;</text>
 </subparagraph><subparagraph id="H08D0E90D41F84EC9A3D572CF48F588F9"><enum>(B)</enum><text>the Department of the Navy;</text> </subparagraph><subparagraph id="H2D271734B4334E4182CD5AAC592705FC"><enum>(C)</enum><text>the Department of the Air Force;</text>
 </subparagraph><subparagraph id="H011139C66F7D491D939B1420D3C1E9F3"><enum>(D)</enum><text>the Department;</text> </subparagraph><subparagraph id="H9F01FCD68FC34326B763A9CC4F6437C1"><enum>(E)</enum><text>the Department of the Interior;</text>
 </subparagraph><subparagraph id="H6BAA993BBE864E5F80AB73B4D84D87FF"><enum>(F)</enum><text>the Department of Veterans Affairs; and</text> </subparagraph><subparagraph id="HC55AC587C56A43AD937AC4F144E339B3"><enum>(G)</enum><text>the General Services Administration.</text>
 </subparagraph></paragraph><paragraph id="HFC6AF9E5D6E041239FCDB264E009A125"><enum>(5)</enum><header>Requirement</header><text>In implementing the program, the Secretary shall leverage existing financing mechanisms including energy savings performance contracts, utility energy service contracts, and annual appropriations.</text>
 </paragraph><paragraph id="H12918A4CEBAD434DA330E1A803EB7A95"><enum>(6)</enum><header>Evaluation</header><text>Using the guidelines of the Federal Energy Management Program relating to whole-building evaluation, measurement, and ver­i­fi­ca­tion, the Secretary shall evaluate the costs and benefits of the buildings selected under paragraph (2), including an identification of—</text>
 <subparagraph id="H4A53C9570840464F85A6F57736455A06"><enum>(A)</enum><text>which advanced building tech­nol­o­gies—</text> <clause id="H50539D611024488FA6333CA0769E7169"><enum>(i)</enum><text>are most cost-effective; and</text>
 </clause><clause id="HE8807B5A78364C0692D41240A5056683"><enum>(ii)</enum><text>show the most promise for—</text> <subclause id="H060F4CA0532F44CE9561E9249C093F0A"><enum>(I)</enum><text>increasing building energy savings;</text>
 </subclause><subclause id="H3A54EAD72E10473E9B09CB83E7C25683"><enum>(II)</enum><text>increasing service performance to building occupants;</text> </subclause><subclause id="H5D48720A6E1C40A3842CFEA4AF5A379E"><enum>(III)</enum><text>reducing environmental impacts; and</text>
 </subclause><subclause id="HC41BE2F8D4474116B16D3A900CCE5484"><enum>(IV)</enum><text>establishing cybersecurity; and</text> </subclause></clause></subparagraph><subparagraph id="H0E0F3241C2C3453DA26BEDA90747C4ED"><enum>(B)</enum><text>any other information the Secretary determines to be appropriate.</text>
 </subparagraph></paragraph><paragraph id="HC6A60685CCA84467A5A65BD0FA70817A"><enum>(7)</enum><header>Awards</header><text>The Secretary may expand awards made under the Federal Energy Management Program and the Better Building Challenge to recognize specific agency achievements in accelerating the adoption of smart building technologies.</text>
				</paragraph></subsection><subsection id="HFBD4C55874424E8799EF3649A0B39EC9"><enum>(c)</enum><header>Survey of private sector smart buildings</header>
 <paragraph id="H1F8A5D237B1E42BFB4E0A19BE8224A87"><enum>(1)</enum><header>Survey</header><text>The Secretary shall conduct a survey of privately owned smart buildings throughout the United States, including commercial buildings, laboratory facilities, hospitals, multifamily residential buildings, and buildings owned by nonprofit organizations and institutions of higher education.</text>
 </paragraph><paragraph id="H54C2E4822F274318BF8621A9D10AEDDE"><enum>(2)</enum><header>Selection</header><text>From among the smart buildings surveyed under paragraph (1), the Secretary shall select not fewer than 1 building each from an appropriate range of building sizes, types, and geographic locations.</text>
 </paragraph><paragraph id="HCD6853078A864BD08259B2734EC7A51D"><enum>(3)</enum><header>Evaluation</header><text>Using the guidelines of the Federal Energy Management Program relating to whole-building evaluation, measurement, and ver­i­fi­ca­tion, the Secretary shall evaluate the costs and benefits of the buildings selected under paragraph (2), including an identification of—</text>
 <subparagraph id="HC1A53D5D7BFD4E82870470782D25D23F"><enum>(A)</enum><text>which advanced building technologies and systems—</text> <clause id="HA6FA6327DD1E44FDA432A0C0EB5135E6"><enum>(i)</enum><text>are most cost-effective; and</text>
 </clause><clause id="H8B13770BFC41461895BA70159DDDDBB2"><enum>(ii)</enum><text>show the most promise for—</text> <subclause id="HCF97C0F9AE7345538E77C001DE03B8AF"><enum>(I)</enum><text>increasing building energy savings;</text>
 </subclause><subclause id="HA5FCD6DB71AB46698F9A05FD73152F0E"><enum>(II)</enum><text>increasing service performance to building occupants;</text> </subclause><subclause id="H870D628A8BB442858FF86CACE2F25A74"><enum>(III)</enum><text>reducing environmental impacts; and</text>
 </subclause><subclause id="H1383488E4E9D4E24A760A40F2883BA8E"><enum>(IV)</enum><text>establishing cybersecurity; and</text> </subclause></clause></subparagraph><subparagraph id="H1B0F8D75278142B8B354919CE8790AF9"><enum>(B)</enum><text>any other information the Secretary determines to be appropriate.</text>
					</subparagraph></paragraph></subsection><subsection id="H2343D8B90AAF4845B68B8B914E3BEE02"><enum>(d)</enum><header>Leveraging existing programs</header>
 <paragraph id="H62C31F6B0AF9473A88EE2EE73EA4E683"><enum>(1)</enum><header>Better building challenge</header><text>As part of the Better Building Challenge of the Department, the Secretary, in consultation with major private sector property owners, shall develop smart building accelerators to demonstrate innovative policies and approaches that will accelerate the transition to smart buildings in the public, institutional, and commercial buildings sectors.</text>
				</paragraph><paragraph id="H69CD2E4E45354DC2A0A7F16C99F79985"><enum>(2)</enum><header>Research and development</header>
 <subparagraph id="H50C91D68D5654424931D4E4743E31767"><enum>(A)</enum><header>In general</header><text>The Secretary shall conduct research and development to address key barriers to the integration of advanced building technologies and to accelerate the transition to smart buildings.</text>
 </subparagraph><subparagraph id="HDCE92C55B6A44ED99C3A83EABDF9209D"><enum>(B)</enum><header>Inclusion</header><text>The research and development conducted under subparagraph (A) shall include research and development on—</text>
 <clause id="H109C6D394DC84CB280E7E0878C39B9BF"><enum>(i)</enum><text>achieving whole-building, systems-level efficiency through smart system and component integration;</text> </clause><clause id="H6ED46CF820B44CF6B577A3675E3C159F"><enum>(ii)</enum><text>improving physical components, such as sensors and controls, to be adaptive, anticipatory, and networked;</text>
 </clause><clause id="HE58143EE48C843CEB744E60923495470"><enum>(iii)</enum><text display-inline="yes-display-inline">integration of internet of things technology solutions, including measure to increase water and energy efficiency, improve water quality, support real-time utility management, and enable actionable analytics and predictive maintenance to improve building systems long-term viability;</text>
 </clause><clause id="H8EDFA82419CA40958D578FACA4DFB78F"><enum>(iv)</enum><text>reducing the cost of key components to accelerate the adoption of smart building technologies;</text> </clause><clause id="HA8AE4043A8BE45449AAD4E45DC57E2AA"><enum>(v)</enum><text>data management, including the capture and analysis of data and the interoperability of the energy systems;</text>
 </clause><clause id="H35D5E1C51CD44132904C42674DB46808"><enum>(vi)</enum><text>protecting against cybersecurity threats and addressing security vul­ner­a­bil­i­ties of building systems or equipment;</text>
 </clause><clause id="H40269F4894034730A4D28D5FF095E6E7"><enum>(vii)</enum><text>business models, including how business models may limit the adoption of smart building technologies and how to support transactive energy;</text>
 </clause><clause id="HF23A89DBB20D496890DD5D938C3873A3"><enum>(viii)</enum><text>integration and application of combined heat and power systems and energy storage for resiliency;</text> </clause><clause id="HDF929CFD5CD048D7809A92428AF70C96"><enum>(ix)</enum><text>characterization of buildings and components;</text>
 </clause><clause id="HE3AB7540E6BE40B598021D6CE7792ED2"><enum>(x)</enum><text>consumer and utility protections;</text> </clause><clause id="H5AEEB5B469B44445BC66DB3A0DE269DA"><enum>(xi)</enum><text>continuous management, including the challenges of managing multiple energy systems and optimizing systems for disparate stakeholders; and</text>
 </clause><clause id="HD8E3A381DCF94D73BD30625D4B804B1C"><enum>(xii)</enum><text>other areas of research and development, as determined appropriate by the Secretary.</text> </clause></subparagraph></paragraph></subsection><subsection id="HFE6493904265401CA460284D022B7BD9"><enum>(e)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter until a total of 3 reports have been made, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce and the Committee on Science, Space, and Technology of the House of Representatives a report on—</text>
 <paragraph id="H95F1E0BAE6F44A919007FD273BB0EBD4"><enum>(1)</enum><text>the establishment of the Federal Smart Building Program and the evaluation of Federal smart buildings under subsection (b);</text>
 </paragraph><paragraph id="H731E74D9BFF6431FAFDB8FF15B3D2C80"><enum>(2)</enum><text>the survey and evaluation of private sector smart buildings under subsection (c); and</text> </paragraph><paragraph id="HC3EA59F04C214368ACAB694360B75DBC"><enum>(3)</enum><text>any recommendations of the Secretary to further accelerate the transition to smart buildings.</text>
