			 surface transportation, secure against vehicle-based attacks, and conduct
			 a feasibility assessment of introducing new security technologies and
			 measures, and for other purposes.</official-title>

 <section id="H274F3E0A424244008BD7BDE27304785C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Surface Transportation Security Improvement Act of 2018</short-title></quote>.</text> </section><section id="H77218B2EA8FB460488DF63FE1E499807"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="H1B279AB60A8E45D1B102FC04EA05D63E"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text>
 </paragraph><paragraph id="H8DA18BF6F10B4712AFEC3AE176771E2C"><enum>(2)</enum><header>Public and private sector stakeholders</header><text>The term <quote>public and private sector stakeholders</quote> has the meaning given such term in section 114(u)(1)(C) of title 49, United States Code.</text> </paragraph><paragraph id="H963425C8B02C44ECBBC9422F71984DD5"><enum>(3)</enum><header>Surface transportation asset</header><text>The term <quote>surface transportation asset</quote> includes facilities, equipment, or systems used to provide transportation services by—</text>
 <subparagraph display-inline="no-display-inline" id="H038BFB2F117D44498A68A7DA915FCC0F"><enum>(A)</enum><text>a public transportation agency (as such term is defined in section 1402(5) of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/53">Public Law 110–53</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/1131">6 U.S.C. 1131(5)</external-xref>));</text>
 </subparagraph><subparagraph id="HEA8C2CDAC3924B8A8A018F64DDB2327A"><enum>(B)</enum><text>a railroad carrier (as such term is defined in section 20102(3) of title 49, United States Code);</text> </subparagraph><subparagraph id="HBFC6C93E7A7D4E5888737C44D9A4813A"><enum>(C)</enum><text>an owner or operator of—</text>
 <clause id="H193BB9EAB37A46F39777D77B5C187803"><enum>(i)</enum><text>an entity offering scheduled, fixed-route transportation services by over-the-road bus (as such term is defined in section 1501(4) of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/53">Public Law 110–53</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/1151">6 U.S.C. 1151(4)</external-xref>)); or</text>
 </clause><clause id="H01B2E511CC404EACB639448FFB3D1838"><enum>(ii)</enum><text>a bus terminal; or</text> </clause></subparagraph><subparagraph id="HD621E427DCB543CAB35CFB88916AB3ED"><enum>(D)</enum><text>other transportation facilities, equipment, or systems, as determined by the Secretary.</text>
 </subparagraph></paragraph></section><section id="HFA2F956E47FD4E7A844BB2C7914FD380"><enum>3.</enum><header>National strategy for transportation security review</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Comptroller General of the United States shall evaluate the degree to which the 2016 Biennial National Strategy for Transportation Security, as required pursuant to section 114(s) of title 49, United States Code, that was issued on August 11, 2016, by the Administrator of the Transportation Security Administration, is reflected in Federal transportation security programs, budgets, research, staffing levels, and related efforts and, in carrying out such evaluation, shall consider the degree to which—</text>
 <paragraph commented="no" id="HA83BC987149C411DB79DAB910C89BAC6"><enum>(1)</enum><text>such strategy is sufficiently forward-looking to guide future Federal efforts relating to transportation security;</text>
 </paragraph><paragraph commented="no" id="HC3A25116F4AA44CEB22E9FA53AFEBE5C"><enum>(2)</enum><text>Federal transportation security programs, budgets, research, staffing levels, and related efforts for fiscal year 2018 and beyond are guided by such strategy; and</text>
 </paragraph><paragraph commented="no" id="H11786E574B584C029750A1C86A4F3252"><enum>(3)</enum><text>the annual progress reports submitted to Congress pursuant to such section subsequent to the issuance of such strategy provide information on the degree to which such strategy guides Federal efforts relating to transportation security.</text>
			</paragraph></section><section id="H89927928AAF544DE872F99A1E4639141"><enum>4.</enum><header>Risk scenarios</header>
 <subsection id="H4B8217B8A0044298B6C7149B3D70F07A"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security shall annually develop, consistent with the transportation modal security plans required under section 114(s) of title 49, United States Code, risk-based priorities based on risk assessments conducted or received by the Secretary across all transportation modes that consider threats, vulnerabilities, and consequences.</text>
 </subsection><subsection commented="no" id="H8494E5B13A7A411EA07273F6B058F7EA"><enum>(b)</enum><header>Scenarios</header><text>The Secretary of Homeland Security shall ensure that the risk-based priorities identified pursuant to subsection (a) are informed by an analysis of terrorist attack scenarios for each transportation mode, including cyber attack scenarios and intelligence and open source information about current and evolving threats.</text>
 </subsection><subsection commented="no" id="H3195D62FA426403AA3B805ECF453019A"><enum>(c)</enum><header>Report</header><text>Not later than 120 days after each development of risk-based priorities under subsection (a), the Secretary of Homeland Security shall provide to the appropriate congressional committees a report that includes the following:</text>
 <paragraph commented="no" id="HE8FA27D2176E4FDCBFA3FB1F56F988B0"><enum>(1)</enum><text>Copies of the risk assessments for each transportation mode.</text> </paragraph><paragraph commented="no" id="HF44424E6265D4AF19F73C11E00BD7817"><enum>(2)</enum><text>A summary that ranks the risks within and across modes.</text>
 </paragraph><paragraph commented="no" id="H01D0467A8F5B4B69BB4F5EA6A5BD0F1F"><enum>(3)</enum><text>A description of the risk-based priorities for securing the transportation sector that identifies and prioritizes the greatest security needs of such transportation sector, both across and within modes, in the order that such priorities should be addressed.</text>
 </paragraph><paragraph commented="no" id="HD53F9379D9A149AC87E8F768CB04CE3B"><enum>(4)</enum><text display-inline="yes-display-inline">Information on the underlying methodologies used to assess risks across and within each transportation mode and the basis for any assumptions regarding threats, vulnerabilities, and consequences made in assessing and prioritizing risks within each such mode and across modes.</text>
 </paragraph></subsection><subsection id="H5A38A3C60E0A42C8A81CE270D07CF5B4"><enum>(d)</enum><header>Classification</header><text>The information provided under subsection (c) may be submitted in a classified format or unclassified format, as appropriate.</text>
			</subsection></section><section id="H56F6B364126F41DDB3F9F3DDBC63E159"><enum>5.</enum><header>Assessments and security plans; Frontline employee security training</header>
 <subsection id="H7F01EB5A898A4BBD8DD27BA2E279FA74"><enum>(a)</enum><header>Report</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the appropriate congressional committees and the Inspector General of the Department of Homeland Security a report on—</text>
 <paragraph id="H25272A6DF53046AE8CC81D0FF68298FE"><enum>(1)</enum><text>the status of regulations requiring assessments and security plans as specified in sections 1405, 1512, and 1531 of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1134">6 U.S.C. 1134</external-xref>, 1162, and 1181) that includes a timeline for the issuance of a final rulemaking subsequent to the December 16, 2016, publication in the Federal Register of an advance notice of proposed rulemaking; and</text>
 </paragraph><paragraph id="HF70A938B5F3C408DAF14FE7CEF9352AB"><enum>(2)</enum><text>the status of regulations for a security training program to prepare transportation employees for potential security threats and conditions as specified in sections 1408, 1517, and 1534 of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1137">6 U.S.C. 1137</external-xref>, 1167, and 1184) that includes a timeline for the issuance of a final rulemaking subsequent to the December 16, 2016, publication in the Federal Register of a notice of proposed rulemaking.</text>
 </paragraph></subsection><subsection id="HE8F722A4796B46B6B8F8F248FD06CEEA"><enum>(b)</enum><header>Inspector General review</header><text>Not later than 120 days after submission of the report under subsection (a), the Inspector General of the Department of Homeland Security shall submit to the appropriate congressional committees a review of such report that includes information on—</text>
 <paragraph id="H584559F970F04A03AD78C7BE0E1820B2"><enum>(1)</enum><text>departmental efforts to finalize rulemaking; and</text> </paragraph><paragraph id="H8C522A24EC844E60BAE52D0BA72E1215"><enum>(2)</enum><text>recommendations, as necessary, to ensure implementation of the regulations referred to in such subsection.</text>
				</paragraph></subsection></section><section id="H58012CFC9C86464798F6F4E4AAFA426C"><enum>6.</enum><header>Research and development</header>
 <subsection id="H41AA4CB888D142F9822228A81C529C6E"><enum>(a)</enum><header>Emerging issues</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security, acting through the Under Secretary for Science and Technology of the Department of Homeland Security and in coordination with the Administrator of the Transportation Security Administration, shall submit to the appropriate congressional committees a feasibility assessment of modifying the security of surface transportation assets by—</text>
 <paragraph id="H3AEA462C8C334CC7B2F3EEA1CB749B8F"><enum>(1)</enum><text>introducing next generation technologies to be integrated into systems of surface transportation assets to detect explosives, including through the deployment of mobile explosives detection technologies to conduct risk-based passenger and property screening at such systems;</text>
 </paragraph><paragraph commented="no" id="H73CD6C9630CB46D586A5331615606C39"><enum>(2)</enum><text>providing surface transportation asset operators with access to the Transportation Security Administration’s Secure Flight Program or a similar passenger vetting system maintained by the Transportation Security Administration;</text>
 </paragraph><paragraph id="H4B306FF4F0A04F968C29CE9CDD53B8AD"><enum>(3)</enum><text>deploying a credential authentication technology or other means of identification document inspection to high-risk surface transportation assets to assist operators conducting passenger vetting; and</text>
 </paragraph><paragraph id="H3289CF7A7136413CBF03087AACB14AEC"><enum>(4)</enum><text>deploying scalable, cost-effective technology solutions to detect chemical, biological, radiological, nuclear, or explosive threats within high-risk surface transportation assets that are capable of passive, continuous, and real-time sensing and detection of, and alerting passengers and operating personnel to, the presence of such a threat.</text>
 </paragraph></subsection><subsection id="H77062E7A2C8441829064D6911F1E44BD"><enum>(b)</enum><header>Considerations</header><text>In carrying out the assessment required under subsection (a), the Secretary of Homeland Security, acting through the Under Secretary for Science and Technology of the Department of Homeland Security and in coordination with the Administrator of the Transportation Security Administration, shall address the technological, privacy, operational, passenger facilitation, and public acceptance considerations involved with each security measure contemplated in such assessment.</text>
 </subsection></section><section id="H134AF09AB7654BA6B70DC6A75417AC02"><enum>7.</enum><header>Best practices to secure against vehicle-based attacks</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall disseminate best practices to public and private sector stakeholders regarding how to enhance transportation security against the threat of a vehicle-based terrorist attack.</text>
		</section><section id="H488078DEEA1D4E2194C0A5AC645E1DF9"><enum>8.</enum><header>Surface transportation stakeholder survey</header>
 <subsection id="HCD7A3786F7714C048F10921688972959"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland Security shall begin conducting a survey of public and private stakeholders responsible for securing surface transportation assets regarding resource challenges, including the availability of Federal funding, associated with securing such assets that provides an opportunity for respondents to set forth information on specific unmet needs.</text>
 </subsection><subsection id="HB5B6BA2DE43E4881A384FF8C414382CA"><enum>(b)</enum><header>Report</header><text>Not later than 120 days after beginning the survey required under subsection (a), the Secretary of Homeland Security shall report to the appropriate congressional committees regarding the results of such survey and the Department of Homeland Security’s efforts to address any identified security vulnerabilities.</text>
			</subsection></section><section id="H3D847797E84F4536B8F253A1EAE51F9A"><enum>9.</enum><header>Innovative technologies and capabilities</header>
 <subsection id="H98471CA0FF024FA4BB626DF1FC8256A5"><enum>(a)</enum><header>In general</header><text>The Administrator of the Transportation Security Administration may establish a task force to collaborate with public and private sector stakeholders to identify and develop an innovative technology or capability with the potential to enhance transportation security, including by—</text>
 <paragraph id="H4BF82020C74E49F899E95979E4E977BF"><enum>(1)</enum><text>conducting a field demonstration of such a technology or capability in an operational environment;</text> </paragraph><paragraph id="H80A2E1B4039E419EBB24E25C29D233C0"><enum>(2)</enum><text>gathering performance data from such a demonstration to inform the acquisition process; and</text>
 </paragraph><paragraph id="HD7ACE2DC8CD046ED93A980D44FE97186"><enum>(3)</enum><text>to the extent practicable, providing funding and promoting efforts to enable participation in a demonstration by a small business that has an innovative technology or capability but does not have adequate resources to participate in a field demonstration under paragraph (1).</text>
 </paragraph></subsection><subsection id="H39F01F6A52DF4E788BE6A80EA3DB07B0"><enum>(b)</enum><header>Composition</header><text>The task force authorized under subsection (a) shall be chaired by the Administrator of the Transportation Security Administration’s designee and comprised of representatives appointed by the Administrator, in consultation with the Chairperson of the Aviation Security Advisory Committee (established pursuant to section 44946 of title 49, United States Code).</text>
 </subsection><subsection id="HC824620DF865466E954BC55F767ABE47"><enum>(c)</enum><header>Activities</header><text>The chair of the task force shall—</text> <paragraph id="H161DA5F3EF2A4DF7A16ABD52669FC164"><enum>(1)</enum><text>evaluate technologies and capabilities for field demonstrations with potential to enhance surface transportation security, in addition to technologies and capabilities with potential to enhance aviation security;</text>
 </paragraph><paragraph id="HF459130D2CEA48FC8D4F0FBA06FF875A"><enum>(2)</enum><text>coordinate with the Science and Technology Directorate of the Department of Homeland Security to leverage such technologies and capabilities; and</text>
 </paragraph><paragraph id="H5561CF33CB5D4268A6D6B52B50E3F84A"><enum>(3)</enum><text>submit to the Secretary of Homeland Security an annual report regarding the task force’s activities that identifies, for each such technology or capability, what mode of transportation could be enhanced by the integration of such technology or capability into security operations and, as appropriate, plans for deploying such technology or capability.</text>
 </paragraph></subsection><subsection id="H37D17800BAB34301A52259359E34CB5B"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall require the Administrator of the Transportation Security Administration to acquire an innovative technology or capability.</text>
 </subsection><subsection id="HC9724E05D546479CBFBF02D757E1C4ED"><enum>(e)</enum><header>Non-Applicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the task force.</text> </subsection></section><section id="H5C0756FCDD2745769FEB37CF2F0725AE"><enum>10.</enum><header>Security technologies tied to foreign threat countries</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security, acting through the Under Secretary for Intelligence and Analysis of the Department of Homeland Security, in consultation with the Under Secretary for the National Protection and Programs Directorate of the Department, shall submit to the appropriate congressional committees an assessment of terrorist and other threats to the transportation sector, including surface transportation assets, posed by the use of security technologies, including software and networked technologies, developed or manufactured by firms that are owned or closely linked to the governments of countries that are known to pose a cyber or homeland security threat.</text>
		</section><section id="H4C0891B7146E4DAB99CDEE61C9752787"><enum>11.</enum><header>Surface transportation security inspectors</header>
 <subsection id="HA69EB6D8763C4ECA87C2A015BF5B2B3E"><enum>(a)</enum><header>Strategy</header><text>Not later than 180 days after the date of the enactment of this Act, the Administrator of the Transportation Security Administration shall submit to the appropriate congressional committees and the Comptroller General of the United States a strategy to guide operations of surface transportation security inspectors that addresses the following:</text>
 <paragraph id="H472F31DADB6341F39AA59983345CC29A"><enum>(1)</enum><text>Any limitations in data systems for such inspectors, as identified by the Comptroller General.</text> </paragraph><paragraph id="H2F97B2AAA42F4ED8BE8464797744F1DC"><enum>(2)</enum><text>Alignment of operations with risk assessment findings, including an approach to identifying and prioritizing entities and locations for inspections.</text>
 </paragraph><paragraph id="H24DDF33CADE34AE9AF45249FA42FEE79"><enum>(3)</enum><text>Measurable objectives for the surface transportation security inspectors program.</text> </paragraph></subsection><subsection id="H517867B1B36B4DDFA32330162BA52F13"><enum>(b)</enum><header>Comptroller General review</header><text>Not later than 180 days after the submission of the strategy required under subsection (b), the Comptroller General of<pagebreak></pagebreak> the United States shall review such strategy and, as appropriate, issue recommendations.</text>
			</subsection></section></legis-body>
