<congress display="no">115th CONGRESS</congress><session display="no">1st Session</session><legis-num display="no">H.R. 695</legis-num><current-chamber display="yes">In the Senate of the United States,</current-chamber><action><action-date date="20171016">October 16, 2017.</action-date></action><legis-type display="yes">Amendments:</legis-type></engrossed-amendment-form><engrossed-amendment-body><section id="idfd00413e90594ed18bf628e8d681620a" section-type="resolved"><text>That the bill from the House of Representatives (H.R. 695) entitled <quote>An Act to amend the National Child Protection Act of 1993 to establish a national criminal history background check system and criminal history review program for certain individuals who, related to their employment, have access to children, the elderly, or individuals with disabilities, and for other purposes.</quote>, do pass with the following</text></section><amendment><amendment-instruction blank-lines-after="0"><text>Strike all after the enacting clause and insert the following:</text></amendment-instruction><amendment-block blank-lines-after="1" changed="added" reported-display-style="italic"><section id="idD7C8AD166489424589FA69EB8AE1C5CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Protection Improvements Act of 2017</short-title></quote>.</text></section><section id="HB6F8D640B2F84BE7B9BC54FB8489F91A"><enum>2.</enum><header>National Criminal History Background Check and Criminal History Review Program</header><text display-inline="no-display-inline">The National Child Protection Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/34/40101">34 U.S.C. 40101</external-xref> et seq.) is amended—</text><paragraph id="H3B601B1166844DBD9A496123BC7750F5"><enum>(1)</enum><text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/34/40102">34 U.S.C. 40102</external-xref>)—</text><subparagraph id="HAFBBA6580D16453BA4E0392EA66BFF29"><enum>(A)</enum><text>by striking <quote>provider</quote> each place it appears and inserting <quote>covered individual</quote>;</text></subparagraph><subparagraph id="idAA1C063AE56047E7941259DD9C224236"><enum>(B)</enum><text>by striking <quote>provider's</quote> each place it appears and inserting <quote>covered individual's</quote>;</text></subparagraph><subparagraph id="HD3FC1DE5C0EA406199F832EE5EEC5787"><enum>(C)</enum><text>by amending subsection (a)(3) to read as follows:</text><quoted-block changed="added" display-inline="no-display-inline" id="HB7ECF6154FFC4C27A44401FDFCD0FE74" reported-display-style="italic" style="OLC"><paragraph id="H97377343D93849929E9B0829B6129EAA"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE95148DE51764DC7A443F7887B6CFBE2"><enum>(A)</enum><text>The Attorney General shall establish a program, in accordance with this section, to provide qualified entities located in States that do not have in effect procedures described in paragraph (1), or qualified entities located in States that do not prohibit the use of the program established under this paragraph, with access to national criminal history background checks on, and criminal history reviews of, covered individuals.</text></subparagraph><subparagraph changed="added" id="H65EFAEC7CE2347F980A66D9486B6687C" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>A qualified entity described in subparagraph (A) may submit to the appropriate designated entity a request for a national criminal history background check on, and a criminal history review of, a covered individual. Qualified entities making a request under this paragraph shall comply with the guidelines set forth in subsection (b), and with any additional applicable procedures set forth by the Attorney General or by the State in which the entity is located.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="HBCE5F9A12C3148C0AE097214E74D9D7A"><enum>(D)</enum><text>in subsection (b)—</text><clause id="H212703001B8B48998AD89C2629D4BFCD"><enum>(i)</enum><text>in paragraph (1)(E), by striking <quote>unsupervised</quote>;</text></clause><clause id="id71AE484B847F4C28AAE253949E9457F8"><enum>(ii)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="id88F92189A6CB4A6CB0A0C907561F5BBD" reported-display-style="italic" style="OLC"><paragraph commented="no" id="id98D6E593F987474B84A67847232C85CD"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1BC5C42988014C72B2F95B9BA2107189"><enum>(A)</enum><text>that the State, or in a State that does not have in effect procedures described in subsection (a)(1), the designated entity, ensures that—</text><clause changed="added" commented="no" id="idFAAF9F729C714D0C8380DAEADBBC8BBD" indent="up1" reported-display-style="italic"><enum>(i)</enum><text>each covered individual who is the subject of a background check under subsection (a) is entitled to obtain a copy of any background check report;</text></clause><clause changed="added" commented="no" id="id4ABEA6DFE0FE40CDB635DFB6555E9C10" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>each covered individual who is the subject of a background check under subsection (a) is provided a process by which the covered individual may appeal the results of the background check to challenge the accuracy or completeness of the information contained in the background report of the covered individual; and</text></clause><clause changed="added" commented="no" id="idE9A789669CDC46B098E015DB63CE8BD1" indent="up1" reported-display-style="italic"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id97C29F31234F4532A4C781FC3675E721"><enum>(I)</enum><text>each covered individual described in clause (ii) is given notice of the opportunity to appeal;</text></subclause><subclause changed="added" commented="no" id="idB0284750CB8E4A41918A120EAD48A2AD" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>each covered individual described in clause (ii) will receive instructions on how to complete the appeals process if the covered individual wishes to challenge the accuracy or completeness of the information contained in the background report of the covered individual; and</text></subclause><subclause changed="added" commented="no" id="idDAAE77440A694E5FB2DF5901169EDCDB" indent="up1" reported-display-style="italic"><enum>(III)</enum><text>the appeals process is completed in a timely manner for each covered individual described in clause (ii); and</text></subclause></clause></subparagraph><subparagraph changed="added" commented="no" id="id2F39CAC07ED04A25B6035E0FD783C641" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the State, or in a State that does not have in effect procedures described in subsection (a)(1), the designated entity, may allow for a review process—</text><clause commented="no" id="id51E635CBB24544ACA646849F578A5C2D"><enum>(i)</enum><text>through which the State or designated entity, as the case may be, may determine that a covered individual who is the subject of a background check under subsection (a) is disqualified for a crime specified in subsection (f)(2)(C); and</text></clause><clause commented="no" id="id1D1E34CEFF5E4921B14C0295091AC524"><enum>(ii)</enum><text>which shall be consistent with title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref> et seq.);</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H1A03A06BDB374E77908F75AB266CD27B"><enum>(iii)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting after <quote>authorized agency</quote> the following: <quote>or designated entity, as applicable,</quote>; and</text></clause><clause id="HE17E88F417124AD2869CC2DB8E24C94D"><enum>(iv)</enum><text display-inline="yes-display-inline">in paragraph (4), by inserting after <quote>authorized agency</quote> the following: <quote>or designated entity, as applicable,</quote>;</text></clause></subparagraph><subparagraph id="H8A6D4E571E224F978C85848828D76F04"><enum>(E)</enum><text>in subsection (d), by inserting after <quote>officer or employee thereof,</quote> the following: <quote>, nor shall any designated entity nor any officer or employee thereof,</quote>;</text></subparagraph><subparagraph id="H051AB76E908947A8BAC0AB8CF9C6E9C8"><enum>(F)</enum><text>by amending subsection (e) to read as follows:</text><quoted-block changed="added" display-inline="no-display-inline" id="HFEECC1C33D054E66A5B2F9795A7112F5" reported-display-style="italic" style="OLC"><subsection id="HAD649FB28735466EA6C61CAFB9804013"><enum>(e)</enum><header>Fees</header><paragraph id="H52C8C51A3B304068AD4CE6A09495DD7B"><enum>(1)</enum><header>State program</header><text display-inline="yes-display-inline">In the case of a background check conducted pursuant to a State requirement adopted after December 20, 1993, conducted with fingerprints on a covered individual, the fees collected by authorized State agencies and the Federal Bureau of Investigation may not exceed the actual cost of the background check conducted with fingerprints.</text></paragraph><paragraph id="H44B5B0367ABD453F8413BC2E2988B62A"><enum>(2)</enum><header>Federal program</header><text display-inline="yes-display-inline">In the case of a national criminal history background check and criminal history review conducted pursuant to the procedures established pursuant to subsection (a)(3), the fees collected by a designated entity shall be set at a level that will ensure the recovery of the full costs of providing all such services. The designated entity shall remit the appropriate portion of such fee to the Attorney General, which amount is in accordance with the amount published in the Federal Register to be collected for the provision of a criminal history background check by the Federal Bureau of Investigation.</text></paragraph><paragraph id="HE10FA859BFA44471A62273D892064619"><enum>(3)</enum><header>Ensuring fees do not discourage volunteers</header><text>A fee system under this subsection shall be established in a manner that ensures that fees to qualified entities for background checks do not discourage volunteers from participating in programs to care for children, the elderly, or individuals with disabilities. A fee charged to a qualified entity that is not organized under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 may not be less than the total sum of the costs of the Federal Bureau of Investigation and the designated entity.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H0E05729556C7449A839F957A5EB56B9E"><enum>(G)</enum><text>by inserting after subsection (e) the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="H260A9ED88612482DBBEC7DC4EE107F3A" reported-display-style="italic" style="OLC"><subsection id="H4B1083CE6C2C4FD89AB65ACF1956CE46"><enum>(f)</enum><header>National criminal history background check and criminal history review program</header><paragraph id="HD61FA97A4F834FD59E1D795DFB7B91CA"><enum>(1)</enum><header>National criminal history background check</header><text display-inline="yes-display-inline">Upon a designated entity receiving notice of a request submitted by a qualified entity pursuant to subsection (a)(3), the designated entity shall forward the request to the Attorney General, who shall, acting through the Director of the Federal Bureau of Investigation, complete a fingerprint-based check of the national criminal history background check system, and provide the information received in response to such national criminal history background check to the appropriate designated entity. The designated entity may, upon request from a qualified entity, complete a check of a State criminal history database.</text></paragraph><paragraph display-inline="no-display-inline" id="H30252DD40BC249DDA94445CE52B3B455"><enum>(2)</enum><header>Criminal history review</header><subparagraph id="H0424D91784FD426FB609DD0E84649197"><enum>(A)</enum><header>Designated entities</header><text display-inline="yes-display-inline">The Attorney General shall designate, and enter into an agreement with, one or more entities to make determinations described in paragraph (2). The Attorney General may not designate and enter into an agreement with a Federal agency under this subparagraph.</text></subparagraph><subparagraph id="HC25508E5BA6240A4841F5EFEB0ACC58C"><enum>(B)</enum><header>Determinations</header><text>A designated entity shall, upon the receipt of the information described in paragraph (1), make a determination of fitness described in subsection (b)(4), using the criteria described in subparagraph (C).</text></subparagraph><subparagraph id="H7CDE937EA8C845D0B4A9FB66F98148BA"><enum>(C)</enum><header>Criminal history review criteria</header><text display-inline="yes-display-inline">A covered individual may be determined to be unfit under subsection (b)(4) if the covered individual—</text><clause id="iddefefd3b7e3a421f92942046cd1cb1a6"><enum>(i)</enum><text>refuses to consent to a criminal background check under this section;</text></clause><clause id="id3B63CDE87E4842D982834C9D14F84A50"><enum>(ii)</enum><text>knowingly makes a materially false statement in connection with a criminal background check under this section;</text></clause><clause id="id06FA8696F06741F39C7E9491B979F8D3"><enum>(iii)</enum><text>is registered, or is required to be registered, on a State sex offender registry or repository or the National Sex Offender Registry established under the Adam Walsh Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/34/20901">34 U.S.C. 20901</external-xref> et seq.);</text></clause><clause id="id7D467487E81C4A129682ABC176FB1E51"><enum>(iv)</enum><text>has been convicted of a felony consisting of—</text><subclause id="id35E29FB60B564F1EA4F070BF46F0DFDA"><enum>(I)</enum><text>murder, as described in section 1111 of title 18, United States Code;</text></subclause><subclause id="id5DEACD7F182A44649485728F1A6CF758"><enum>(II)</enum><text>child abuse or neglect;</text></subclause><subclause id="idE2327CEA2C024155A025420EE8E8E0DF"><enum>(III)</enum><text>a crime against children, including child pornography;</text></subclause><subclause id="id11435C06A5F849B9AEDA721EB4443D67"><enum>(IV)</enum><text>spousal abuse;</text></subclause><subclause id="id687698FD0FD44A08B4428616F05EFD52"><enum>(V)</enum><text>a crime involving rape or sexual assault;</text></subclause><subclause id="id0EFE478DECA548CE830BCF489482058A"><enum>(VI)</enum><text>kidnapping;</text></subclause><subclause id="idFD672BE764A84DA8AE080462C1716C1E"><enum>(VII)</enum><text>arson;</text></subclause><subclause id="id1F74D61CB7B94303A96E24C0DB02DC96"><enum>(VIII)</enum><text>physical assault or battery; or</text></subclause><subclause id="idEB128824861645C08B4C953358651895"><enum>(IX)</enum><text>a drug-related offense committed during the preceding 5 years;</text></subclause></clause><clause id="id28A8841C699444A8BF988765AAC823A7"><enum>(v)</enum><text>has been convicted of a violent misdemeanor committed as an adult against a child, including—</text><subclause id="id11C36882C8DF49968C6F85D8862740E7"><enum>(I)</enum><text>child abuse;</text></subclause><subclause id="id2A92121A0DC3466DBEFE7BE65130D1DF"><enum>(II)</enum><text>child endangerment;</text></subclause><subclause id="id62A7FA7C55FF4D9AA35BEA7440C9821D"><enum>(III)</enum><text>sexual assault; or</text></subclause><subclause id="id52A04C1B2DBD460BB801EA0B660C4DC9"><enum>(IV)</enum><text>of a misdemeanor involving child pornography; or</text></subclause></clause><clause id="id66CE4229392A4ECF9C7A70C745FF0311"><enum>(vi)</enum><text>in the case of a covered individual who has, seeks to have, or may have access to the elderly or individuals with disabilities, has been convicted of any criminal offense relating to the abuse, exploitation, or neglect (as those terms are defined in section 2011 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397j">42 U.S.C. 1397j</external-xref>)) of an elder or an individual with disabilities.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H540E7AA2150E49448AA92D83B0F821DD"><enum>(2)</enum><text>in section 5 (<external-xref legal-doc="usc" parsable-cite="usc/34/40104">34 U.S.C. 40104</external-xref>)—</text><subparagraph id="HF2B219418CC9443CB62D31E6F82002DB"><enum>(A)</enum><text>by amending paragraph (9) to read as follows:</text><quoted-block changed="added" display-inline="no-display-inline" id="HCE46EC0773AC4AD8BCD63E5535303833" reported-display-style="italic" style="OLC"><paragraph id="HDE8379B86D55408192F1638AD48DB6F7"><enum>(9)</enum><text display-inline="yes-display-inline">the term <term>covered individual</term> means an individual—</text><subparagraph id="H54BAF8AAAA154639ADDFE023331A029E"><enum>(A)</enum><text>who has, seeks to have, or may have access to children, the elderly, or individuals with disabilities, served by a qualified entity; and</text></subparagraph><subparagraph id="H45687087B86243048740C69D31989D06"><enum>(B)</enum><text>who—</text><clause id="HADD2116E0985486987A9C8154AE4CCE6"><enum>(i)</enum><text>is employed by or volunteers with, or seeks to be employed by or volunteer with, a qualified entity; or</text></clause><clause id="H4D123A346A284823A4879B8F47D23AF2"><enum>(ii)</enum><text>owns or operates, or seeks to own or operate, a qualified entity;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H551EFA93FE824797AF3F8A2F48C45B60"><enum>(B)</enum><text>in paragraph (10), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H54816382426C4E708E6272EA90DCA01A"><enum>(C)</enum><text>in paragraph (11), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H3ADF0EBF3B4442CFB02D1481F02C4B41"><enum>(D)</enum><text>by inserting after paragraph (11) the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="H2EF86C55ABFB4C71897F1A53B017CFC1" reported-display-style="italic" style="OLC"><paragraph id="H441E5475940D4489B2985123F9C6E278"><enum>(12)</enum><text display-inline="yes-display-inline">the term <term>designated entity</term> means an entity designated by the Attorney General under section 3(f)(2)(A).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H54BAE3BD3C2D4B6381B97FCA07072038" section-type="subsequent-section"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall be fully implemented by not later than 1 year after the date of enactment of this Act.</text></section></amendment-block></amendment></engrossed-amendment-body><title-amends><official-title-amendment>Amend the title so as to read: <quote>A bill to  amend  the National	Child  Protection  Act	of  1993  to establish a voluntary
			 national
			 criminal  history  background	check  system  and  criminal  history 
			 review  program  for  certain	individuals  who,  related  to	their 
			 employment,  have  access to  children,  the  elderly,  or  individuals 
			 with  disabilities,  and  for	other purposes.</quote>.</official-title-amendment></title-amends><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
