<official-title display="yes">To amend the National Child Protection Act of 1993 to establish a national criminal history background check system and criminal history review program for certain individuals who, related to their employment, have access to children, the elderly, or individuals with disabilities, and for other purposes.<pagebreak/></official-title>

<section id="H58BA5ECFDE7C401E8314D4925CBD0A0E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Protection Improvements Act of 2017</short-title></quote>.</text></section> <section id="H73E98A67449B42A29672E088470E587A"><enum>2.</enum><header>National Criminal History Background Check and Criminal History Review Program</header><text display-inline="no-display-inline">The National Child Protection Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/5119">42 U.S.C. 5119</external-xref> et seq.) is amended—</text> 
<paragraph id="H9ABD9A6F66CA4A6A87DC4DDE6A7AC0BF"><enum>(1)</enum><text>in section 3—</text> <subparagraph id="HD642DCA0408744E28EF3B45C4BA02FD1"><enum>(A)</enum><text>by amending subsection (a)(3) to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H6B4DE4C803B4415C8D69064BAE8EA4B4" style="OLC"> 
<paragraph id="HDCF8F261B69B448192D6E23F26F98E05" indent="up1"><enum>(3)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HF24593DC59AA4F7193FA483D159353CF"><enum>(A)</enum><text>The Attorney General shall establish a program, in accordance with this section, to provide qualified entities located in States which do not have in effect procedures described in paragraph (1), or qualified entities located in States which do not prohibit the use of the program established under this paragraph, with access to national criminal history background checks on, and criminal history reviews of, covered individuals.</text></subparagraph> <subparagraph id="HC9B12A1477C543439EF1A7D036B1B42C" indent="up1"><enum>(B)</enum><text>A qualified entity described in subparagraph (A) may submit to the appropriate designated entity a request for a national criminal history background check on, and a criminal history review of, a covered individual. Qualified entities making a request under this paragraph shall comply with the guidelines set forth in subsection (b), and with any additional applicable procedures set forth by the Attorney General or by the State in which the entity is located.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H7AE79389270B46CDBCA5030303D8A22B"><enum>(B)</enum><text>in subsection (b)—</text> <clause id="HAA7743E077C54C698A971A64119F13EF"><enum>(i)</enum><text>in paragraph (1)(E), by striking <quote>unsupervised</quote>;</text></clause> 
<clause id="HFA3372F26060454292166560D2E9FB81"><enum>(ii)</enum><text>in paragraph (2)—</text> <subclause id="HC08CFEE997604CF783D3187EC6E18B38"><enum>(I)</enum><text>by redesignating subparagraph (A) as clause (i);</text></subclause>
<subclause id="H8CB5894F4C454D94A0E00D8E294718BB"><enum>(II)</enum><text>in subparagraph (B)—</text> <item id="H171BDA713B7849D3AA1A836D2C40E0AD"><enum>(aa)</enum><text>by adding <quote>and</quote> at the end; and</text></item>
<item id="HEA56BF8AF1954BFE974E4434FDF778EA"><enum>(bb)</enum><text>by redesignating such subparagraph as clause (ii);</text></item></subclause> <subclause id="H1BE5378774E3429BBC78C5D338C47ABB"><enum>(III)</enum><text>by striking <quote>that each provider who is the subject of a background check</quote> and inserting <quote><header-in-text level="subparagraph" style="OLC"><enum-in-header>(A) </enum-in-header></header-in-text>that each covered individual who is the subject of a background check conducted pursuant to the procedures established pursuant to subsection (a)(1)</quote>; and</text></subclause> 
<subclause id="HB5D0A513E24E4419B9B9C086A230358B"><enum>(IV)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HE7F17800E194453BA4221D81B995027D" style="OLC"> <subparagraph id="H3635363709B24B5C89C6CE77CA2A52B0" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">that each covered individual who is the subject of a national criminal history background check and criminal history review conducted pursuant to the procedures established pursuant to subsection (a)(3) is entitled to challenge the accuracy and completeness of any information in the criminal history record of the individual by contacting the Federal Bureau of Investigation under the procedure set forth in section 16.34 of title 28, Code of Federal Regulations, or any successor thereto.</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subclause></clause> 
<clause id="HEB68E4F9D7FA4772B04B21526DFED7D3"><enum>(iii)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting after <quote>authorized agency</quote> the following: <quote>or designated entity, as applicable</quote>; and</text></clause> <clause id="H83D92949D5B84CF0BCD2192E341195D2"><enum>(iv)</enum><text display-inline="yes-display-inline">in paragraph (4), by inserting after <quote>authorized agency</quote> the following: <quote>or designated entity, as applicable,</quote>;</text></clause></subparagraph> 
<subparagraph id="H1F74647F8A39460F9A15B0ADDE14D957"><enum>(C)</enum><text>in subsection (d), by inserting after <quote>officer or employee thereof,</quote> the following: <quote>nor shall any designated entity nor any officer or employee thereof,</quote>;</text></subparagraph> <subparagraph id="H42DD61F25E9F43BDB42E543E65975013"><enum>(D)</enum><text>by amending subsection (e) to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HE702E54639D346BE8F9980A957AC2898" style="OLC"> 
<subsection id="H7E3A3FAB69F246A4A715DCD62A0E5512"><enum>(e)</enum><header>Fees</header> 
<paragraph id="H19BD19F03C284B0DB634DCAC8F4C16C3"><enum>(1)</enum><header>State program</header><text display-inline="yes-display-inline">In the case of a background check conducted pursuant to a State requirement adopted after December 20, 1993, conducted with fingerprints on a covered individual, the fees collected by authorized State agencies and the Federal Bureau of Investigation may not exceed eighteen dollars, respectively, or the actual cost, whichever is less, of the background check conducted with fingerprints.</text></paragraph> <paragraph id="HF2D6F39566DB4560BA1C802F2979415F"><enum>(2)</enum><header>Federal program</header><text display-inline="yes-display-inline">In the case of a national criminal history background check and criminal history review conducted pursuant to the procedures established pursuant to subsection (a)(3), the fees collected by a designated entity shall be set at a level that will ensure the recovery of the full costs of providing all such services. The designated entity shall remit the appropriate portion of such fee to the Attorney General, which amount is in accordance with the amount published in the Federal Register to be collected for the provision of a criminal history background check by the Federal Bureau of Investigation.</text></paragraph> 
<paragraph id="H30598FC52050479A8F3C65CF9A67A699"><enum>(3)</enum><header>Ensuring fees do not discourage volunteers</header><text>A fee system under this subsection shall be established in a manner that ensures that fees to qualified entities for background checks do not discourage volunteers from participating in programs to care for children, the elderly, or individuals with disabilities.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HEADC525519EA4FD88D35C6D4983D9B33"><enum>(E)</enum><text>by inserting after subsection (e) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HDAC9CB0A1062460B9DC7357EF88A57A2" style="OLC"> 
<subsection id="HDCA956ACF3B346D98B01E5EB319455A2"><enum>(f)</enum><header>National criminal history background check and criminal history review program</header> 
<paragraph id="H663AC7004EC94530BF37955A4E45C982"><enum>(1)</enum><header>National criminal history background check</header><text display-inline="yes-display-inline">Upon a designated entity receiving notice of a request submitted by a qualified entity pursuant to subsection (a)(3), the designated entity shall forward the request to the Attorney General, who shall, acting through the Director of the Federal Bureau of Investigation, complete a fingerprint-based check of the national criminal history background check system, and provide the information received in response to such national criminal history background check to the appropriate designated entity. The designated entity may, upon request from a qualified entity, complete a check of a State criminal history database.</text></paragraph> <paragraph display-inline="no-display-inline" id="H5A5F846E2D7848389377ACCE56ABC76F"><enum>(2)</enum><header>Criminal history review</header> <subparagraph id="HB742FC858CBB4687BDAEF9A91EE66E0A"><enum>(A)</enum><header>Designated entities</header><text display-inline="yes-display-inline">The Attorney General shall designate, and enter into an agreement with, one or more entities to make determinations described in paragraph (2). The Attorney General may not designate and enter into an agreement with a Federal agency under this subparagraph.</text></subparagraph> 
<subparagraph id="H2A08F00E5B0B4EB49F231F9A6046FDE7"><enum>(B)</enum><header>Determinations</header><text>A designated entity shall, upon the receipt of the information described in paragraph (1), make a determination of fitness described in subsection (b)(4), using the criteria described in subparagraph (C).</text></subparagraph> <subparagraph id="H498043A65B9544599DDBE05B0D36553C"><enum>(C)</enum><header>Criminal history review criteria</header><text display-inline="yes-display-inline">The Attorney General shall, by rule, establish the criteria for use by designated entities in making a determination of fitness described in subsection (b)(4). Such criteria shall be based on the criteria established pursuant to section 108(a)(3)(G)(i) of the Prosecutorial Remedies and Other Tools to end the Exploitation of Children Today Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/42/5119a">42 U.S.C. 5119a</external-xref> note).</text></subparagraph></paragraph></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph>
<subparagraph id="H2848C27B545049648BC56AF6E37863DE"><enum>(F)</enum><text>by striking—</text> <clause id="HCE989AFB45E042E08A2222C94AF008A7"><enum>(i)</enum><text><quote>provider</quote> each place it appears, and inserting <quote>covered individual</quote>; and</text></clause>
<clause id="H9B01EF213C2F4BC6951B64E36CF7B0D7"><enum>(ii)</enum><text><quote>provider’s</quote> each place it appears, and inserting <quote>covered individual’s</quote>; and </text></clause></subparagraph></paragraph> <paragraph id="HCF4CC16DF9214071B0D27D999BEC7B77"><enum>(2)</enum><text>in section 5—</text> 
<subparagraph id="H9E8F5630A47041A0BFC3140F93C04A01"><enum>(A)</enum><text>by amending paragraph (9) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H45B7CC6797114216876E5726F38B806A" style="OLC"> <paragraph id="H18E953C82812476EAFE5B250A2C5ABF4"><enum>(9)</enum><text display-inline="yes-display-inline">the term <term>covered individual</term> means an individual—</text> 
<subparagraph id="H9D7BD1E6C5D34597B2F93AB003E59763"><enum>(A)</enum><text>who has, seeks to have, or may have access to children, the elderly, or individuals with disabilities, served by a qualified entity; and</text></subparagraph> <subparagraph id="HA8DD807250CE4FBD8BAEB09A3BC53C6A"><enum>(B)</enum><text>who—</text> 
<clause id="H7E4D6C425C3244DE829B738AE9800E6D"><enum>(i)</enum><text>is employed by or volunteers with, or seeks to be employed by or volunteer with, a qualified entity; or</text></clause> <clause id="H5D8A541A854D497CA96013085FC9B56E"><enum>(ii)</enum><text>owns or operates, or seeks to own or operate, a qualified entity.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HE7753F4FD6E74ECE8D32FDA44CB513F0"><enum>(B)</enum><text>in paragraph (10), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H428E809D2EAC4B3FA4327F3C05F51A3F"><enum>(C)</enum><text>in paragraph (11), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H884ACE2042774B6B9EACD1727E7A5B8A"><enum>(D)</enum><text>by inserting after paragraph (11) the following:</text> <quoted-block display-inline="no-display-inline" id="H730B37C44EF94BC9B226BEFE819E1657" style="OLC"> <paragraph id="H8236F083D4CA4AA8874BB79D3F829BDD"><enum>(12)</enum><text display-inline="yes-display-inline">the term <term>designated entity</term> means an entity designated by the Attorney General under section 3(f)(2)(A).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section>
