 <section id="H1F6E3E20AD704DAB988FC1C15DE888AD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop, Observe, Ask, and Respond to Health and Wellness Act of 2018</short-title></quote> or the <quote><short-title>SOAR to Health and Wellness Act of 2018</short-title></quote>.</text> </section><section id="HB5405D5F3C1F4BF386B65C419BA599D0"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="HB3440984F9294A688477AC654EF142F7"><enum>(1)</enum><header>Human trafficking</header><text>The term <term>human trafficking</term> has the meaning given the term <term>severe forms of trafficking in persons</term> as defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text> </paragraph><paragraph id="HDE7733419ADC42BA80EFEA32AE599757"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text>
			</paragraph></section><section id="H1C071A4591BA47BD83CBB6756A472674"><enum>3.</enum><header>Program establishment</header>
 <subsection id="HA7DBEA3FD76E4A9ABE0CC896D3148099"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a program to be known as the Stop, Observe, Ask, and Respond to Health and Wellness Training Program or the SOAR to Health and Wellness Training Program (in this Act referred to as the <quote>Program</quote>) to provide training to health care providers and other related providers, at all levels, on human trafficking in accordance with the purpose described in subsection (c).</text>
 </subsection><subsection id="HB4400226779B4F7388B0E1AB2ABE2D91"><enum>(b)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary may carry out the Program through the award of grants to health care sites and health care professional organizations that represent diversity in—</text>
 <paragraph id="H927E8CD3BC794E4BA968A32BAFD2BF60"><enum>(1)</enum><text>geography;</text> </paragraph><paragraph id="HA0E87BF60CFB488C89FFF25E8705BCDA"><enum>(2)</enum><text>the demographics of the population served;</text>
 </paragraph><paragraph id="H771AB9DE18E541DD8A9672945D6F223F"><enum>(3)</enum><text>the predominant types of human trafficking cases; and</text> </paragraph><paragraph id="H8A41F437521442EEBA8EF968CE867F8A"><enum>(4)</enum><text>health care provider profiles.</text>
 </paragraph></subsection><subsection id="HDD71B3B3B0444BA78AD62AFD99E63554"><enum>(c)</enum><header>Purpose</header><text>The purpose of the Program shall be to train health care providers and other related providers to enable such providers to—</text>
 <paragraph id="H822CECBAEC2A4389BB5AA35208A1EA27"><enum>(1)</enum><text>identify potential human trafficking victims;</text> </paragraph><paragraph id="HB7BFA32D09284052BEAADE08C0A41DA3"><enum>(2)</enum><text>implement proper protocols and procedures for working with law enforcement to report, and facilitate communication with, such victims, in accordance with all applicable Federal, State, local, and tribal requirements, including legal confidentiality requirements for patients and health care providers;</text>
 </paragraph><paragraph id="HA007289257D942F1BE37DA0122711868"><enum>(3)</enum><text>implement proper protocols and procedures for referring such victims to appropriate health care, social, or victims service agencies or organizations;</text>
 </paragraph><paragraph id="H795C5954C4B747A7B06DF22EAA89F18E"><enum>(4)</enum><text>provide such victims care that is—</text> <subparagraph id="H05DA4567F0A94E96B94EEB07EEDE8A2A"><enum>(A)</enum><text>coordinated;</text>
 </subparagraph><subparagraph id="H09F2D44C6EE0400BA8CFA33E33DD718A"><enum>(B)</enum><text>victim centered;</text> </subparagraph><subparagraph id="HACECCB11693F4A92A49B5A8F7BC07CA1"><enum>(C)</enum><text>culturally relevant;</text>
 </subparagraph><subparagraph id="H2C01E20FAC824D1A8712DAE367E63879"><enum>(D)</enum><text>comprehensive;</text> </subparagraph><subparagraph id="H7D2463FACB444AD0A19485CB82AEE574"><enum>(E)</enum><text>evidence-based;</text>
 </subparagraph><subparagraph id="H7F6D3F68EC044EA39AAF71536A4F2E37"><enum>(F)</enum><text>gender responsive;</text> </subparagraph><subparagraph id="H00E5FE3BB5F0435282F00B3FDC983D2C"><enum>(G)</enum><text>age-appropriate, with a focus on care for youth; and</text>
 </subparagraph><subparagraph id="H229199CFE26D4B35A2CA7B1B59EBF38C"><enum>(H)</enum><text>trauma-informed; and</text> </subparagraph></paragraph><paragraph id="H1A3E4BEFC94142D8B2C893BA59284DE7"><enum>(5)</enum><text>consider the potential for integrating the training described in paragraphs (1) through (4) with training programs, in effect on the date of enactment of this Act, for victims of domestic violence, dating violence, sexual assault, stalking, child abuse, child neglect, child maltreatment, and child sexual exploitation.</text>
				</paragraph></subsection><subsection id="H53FC9AC86BBA41058EE81206FCAEF952"><enum>(d)</enum><header>Functions</header>
 <paragraph id="H1DABF9F73B544609BA69B48B6AF7C2E2"><enum>(1)</enum><header>In general</header><text>The functions of the Program shall include the functions of the Stop, Observe, Ask, and Respond to Health and Wellness Training program that was operating on the day before the date of enactment of this Act and the authorized initiatives described in paragraph (2).</text>
 </paragraph><paragraph id="HC41483217504466B98CD275174FDEFBB"><enum>(2)</enum><header>Authorized initiatives</header><text>The authorized initiatives of the Program shall include—</text> <subparagraph id="HD2DD672CD8704A2BAD4B68C974B92B43"><enum>(A)</enum><text>engaging stakeholders, including victims of human trafficking and any Federal, State, local, or tribal partners, to develop a flexible training module—</text>
 <clause id="H674A0EB7756F49E2BE713D1179C76E5C"><enum>(i)</enum><text>for achieving the purpose described in subsection (c); and</text> </clause><clause id="HE87F4FCB578242CAA05273954BBFEE82"><enum>(ii)</enum><text>that adapts to changing needs, settings, health care providers, and other related providers;</text>
 </clause></subparagraph><subparagraph id="HEFD23114951E4057BB80D7E6E9B5B69F"><enum>(B)</enum><text>providing technical assistance for health education programs and health care professional organizations to implement health care protocols, or develop continuing education training materials, that assist in achieving the purpose described in subsection (c);</text>
 </subparagraph><subparagraph id="H739855EF2ECB43D1B6815E5136853A31"><enum>(C)</enum><text display-inline="yes-display-inline">facilitating the dissemination of best practices and recommendations as the Secretary determines appropriate; and</text>
 </subparagraph><subparagraph id="H8A2A047E69A84BFCAC7670887F38DA8B"><enum>(D)</enum><text>developing a reliable methodology for collecting data, and reporting such data, on the number of human trafficking victims identified and served in health care settings or other related provider settings.</text>
					</subparagraph></paragraph></subsection></section><section id="H9B212B2A518D454686B7A0ACCFC0A34C"><enum>4.</enum><header>Data collection and reporting requirements</header>
			<subsection id="H981C40FD069B4E628DAE9BB47CBBBE2E"><enum>(a)</enum><header>Data collection</header>
 <paragraph id="H32AB7EBA4F9D4D5685C327C0E727093D"><enum>(1)</enum><header>In general</header><text>During each of fiscal years 2018 through 2022, the Secretary shall collect data on each of the following:</text>
 <subparagraph id="H7935E1FF01F24755A9D515BA273D3C65"><enum>(A)</enum><text display-inline="yes-display-inline">The total number of grantees operating under the Program.</text> </subparagraph><subparagraph id="HE0E527D455504F9CBE3B9CF9F4622073"><enum>(B)</enum><text>The total number of health care providers and other related providers trained through the Program.</text>
 </subparagraph></paragraph><paragraph id="HD4305974583A45139C7F9276C656B23F"><enum>(2)</enum><header>Initial report</header><text display-inline="yes-display-inline">In addition to the data required to be collected under paragraph (1), for purposes of the initial report to be submitted under subsection (b), the Secretary shall collect data on the total number of facilities and health care professional organizations that were operating under, and the total number of health care providers and other related providers trained through, the Stop, Observe, Ask, and Respond to Health and Wellness Training program that was operating before the establishment under section 3(a) of the Program.</text>
 </paragraph></subsection><subsection id="HC0F8FA82C11845A7849840BD1FC197B4"><enum>(b)</enum><header>Reporting</header><text>Not later than 90 days after the first day of each of fiscal years 2019 through 2023, the Secretary shall prepare and submit to Congress a report on the data collected under subsection (a).</text>
 </subsection></section><section commented="no" id="H280645E461304C8FB3F58EA501A35053"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $4,000,000 for each of fiscal years 2018 through 2022.</text>
 </section><section id="H3D7EC951E2884E088C64E10816BBBC55"><enum>6.</enum><header>Cut-go compliance</header><text display-inline="no-display-inline">Subsection (f) of section 319D of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-4">42 U.S.C. 247d–4</external-xref>) is amended by striking <quote>through 2018</quote> and inserting <quote>through 2017, and $118,300,000 for fiscal year 2018</quote>.</text>
